BIDEN ADMINISTRATION’S AGREEMENT TO ALLOW A FEW MORE LEGAL ASYLUM SEEKERS TO BE PROCESSED FALLS FAR SHORT OF RESTORING THE RULE OF LAW @ OUR SOUTHERN BORDER!

Elliot Spagut reports for AP:

The Biden administration has agreed to let about 250 people a day through border crossings with Mexico to seek refuge in the United States, part of negotiations to settle a lawsuit over pandemic-related powers that deny migrants a right to apply for asylum, an attorney said Monday.

The government also said it would stop flying migrant families from Texas’ Rio Grande Valley to El Paso, Texas, and San Diego to then be expelled to Mexico under pandemic powers, said Lee Gelernt, an attorney for the American Civil Liberties Union, which has sued in federal court in Washington, D.C. The government has reserved rights to resume flights “if it deems the circumstances warrant.”

The government concessions would dramatically reshape exercise of powers known as Title 42, named for a section of an obscure 1944 law that former President Donald Trump used to let the U.S. Centers for Disease Control and Prevention effectively end asylum at the border while it sought to prevent the coronavirus from spreading.

Biden has exempted unaccompanied children from Title 42 but kept it for single adults and many families. He has come under criticism from progressives for keeping asylum off-limits to many and for encouraging some parents to send children across the border alone. Enforcement-minded critics say exempting children traveling alone led to record numbers crossing and that lifting restrictions more will invite many more people to come.

The government and the ACLU agreed to “a streamlined process for assessing and addressing exemption requests brought by particular vulnerable families and other individuals,” Gelernt said. Once fully up and running, an estimated 250 particularly vulnerable individuals will be allowed in daily to seek humanitarian protection through a consortium of nongovernmental organizations. They must test for COVID-19 before entering the country.

About 2,000 people have already been allowed to enter the country, exempted from the pandemic-related powers to pursue asylum or other forms of protection while in the United States, Gelernt said.

“While these concessions will hopefully save lives, they are not a substitute for eliminating Title 42 and restoring asylum processing fully,” Gelernt said.

The Department of Homeland Security did not immediately respond to a request for comment Monday night.

The Administration basically has conceded that the bogus Trump-era Title 42 bar had little to do with public health (never much of a concern for the Trump kakistocracy) and everything to do with eliminating the rights of legal asylum seekers, particularly refugee women and those of color. The Biden Administration’s defense of this travesty is pretty disingenuous.

Lawyers are slowly making progress in locating and reuniting children and families separated at the southern US border as part of the Trump administration’s “zero tolerance” immigration policy. A month ago, the parents of 611 children had yet to be located. Now, that number is down to 506. President Biden this month signed an executive order establishing a new task force designed to identify and reunify these separated families. Meanwhile, the Biden administration has lifted an order that temporarily banned certain immigrant visas during the pandemic and will begin admitting some of the hundreds of migrants held in deplorable conditions in tent camps as part of a policy requiring them to stay in Mexico until their US court dates. Both these decisions are reversals of controversial Trump-era policies.

by Adolfo Flores and Hamed Aleaziz in BuzzFeed News:

After days of confusion about changes along the southern border, the Biden administration on Wednesday said immigrants should not try to enter the US because most will still be turned away under a Trump-era policy that has recently come under legal scrutiny.

. . . .

Confusion about who was being allowed into the US in recent days forced the administration to issue a stronger warning. Last week, reports of some families being allowed into the US after being apprehended at the border resulted in speculation that immigrants would no longer be immediately expelled and instead be allowed to fight their immigration cases from within the United States. In the Rio Grande Valley in South Texas, immigration advocates have reported seeing about 100 people a day released by Customs and Border Protection. In other parts of Texas, shelters have also seen increasing numbers of immigrant families, but it is not clear why.

Attorneys and advocates who work with immigrants along the border have been bombarded with phone calls and texts about whether they should try their luck at getting into the US. Erika Pinheiro, policy and litigation director with the immigrant advocacy group Al Otro Lado, said it was “incredibly disappointing” that the Biden administration has continued to expel immigrants under the CDC order.

“We know now that the CDC order prohibiting asylum processing at the border did not arise from public health concerns but rather was part of Stephen Miller’s efforts to dismantle the US asylum system and was implemented despite opposition from CDC leadership,” Pinheiro said, referring to one of Trump’s former senior advisers. “US expulsions of asylum-seekers, including infants, constitute plain violations of domestic and international laws meant to protect vulnerable refugees. CBP absolutely has the resources to process asylum-seekers in a safe and humane way.”

The turnbacks, known as expulsions, are legally different from deportations, which would mean an immigrant had actually undergone the immigration process and found to not be legally allowed to stay in the US. Critics say the government is using the public health orders as an excuse to turn back immigrants at the border.

. . . .

“While we recognize that the Biden administration has been saddled with a lot of bad policy and structural problems, it cannot continue the Trump administration practice of turning away people in danger based on illegal policies, such as the notorious and pretextual Title 42 policy,” said Lee Gelernt, an attorney with the ACLU.

“Go suffer and die somewhere else, out of our sight,” might not be the best message for an Administration trying to re-establish its human rights and humanitarian leadership and credentials. Ever hear of the “St. Louis Incident?” It’s always easy to find a way to “just say no” to refugees — and the consequences are seldom pretty.

Those who won’t learn from history are destined to repeat it. Refugee and forced migration situations happen in the “here and now;” they can’t be “back burnered” — no matter how much policy officials might wish otherwise. In a forced migration situation, “doing nothing” is an action that produces consequences for both the forced migrant and those who ignore their plight.

There are many daily potentially deadly and dehumanizing consequences of continuing to ignore asylum laws and Constitutional due process for asylum seekers at our Southern Border.

One predictable one: Instead of turning themselves in at the border or to the Border Patrol shortly after entry, as had been happening until Miller & co. intervened, those seeking refuge apparently have gotten the message that our legal system is and remains a sham for them. Consequently, increasingly they are simply evading the Border Patrol and disappearing into the interior with no screening whatsoever — health, legal, or background. Also, by intentionally driving people out of the legal system, the Administration is totally blowing a chance to harness and build upon one of the most powerful known facts — represented individuals with asylum hearings scheduled show up for their hearings!

⚖️🗽OUTING THE BIG NATIVIST LIE: EOIR/DHS CLAIM THAT MIGRANTS DON’T SHOW UP FOR HEARINGS REFUTED BY USG’S OWN DATA — Professor Ingrid Eagly & Steven Schafer Analyzed Millions Of Records To Show How False Narratives Drive Draconian Policies — Eagley, Shafer, Reichlin-Melnick, Schmidt Set Record Straight @ Press Conference!

According to an article in today’s Washington Post, the estimated number of so-called “get always” — actually human beings seeking refuge — hit 1,000 on Sunday.

https://www.washingtonpost.com/immigration/border-arrests-increased-in-january/2021/02/10/8604f714-6bc0-11eb-9f80-3d7646ce1bc0_story.html

Sure, there are many aspects of this problem. But, it has been “out there” for nearly a year!

Sure seems to me that with the right experts in charge, including folks like Lee Gelernt and Erika Pinhero, this issue could and should have been addressed more constructively and with much more urgency by the Biden Administration by now. Why not harness the expertise and proven problem solving abilities of folks like Lee, Erika, and many other members of the New Due Process Army rather than fighting with and resisting them?

Instead, it looks like time and resources will continue to be wasted on forcing policy changes through litigation. Meanwhile, vulnerable asylum seekers and their families will continue to suffer as illustrated by this recent article from HuffPost about the human consequences for those caught up in the Government’s scofflaw border policies.

https://www.huffpost.com/entry/biden-trump-migrant-asylum-seekers_n_60219e61c5b6c56a89a39a32

NOTE TO PRESIDENTIAL PRESS SECRETARY JEN PSAKI: Sorry, Jen, but those fleeing for their lives don’t generally respond well to “don’t come right now, we don’t want you” messages, particularly from folks who have never been in that situation themselves. It’s actually pretty insulting to think that folks fleeing to the U.S. 1) aren’t smart enough to know the dangers involved; 2) don’t realize that the the U.S. Government doesn’t want them; and/or 3) have choices about their travel as Jen and her buddies might have when planning a summer vacation.

As one of my esteemed colleagues once told me: “Desperate people do desperate things.” What about people who keep repeating the same policy mistakes over and over while expecting different results and failing to grasp either the absolute urgency or the human side of forced migration issues? It’s sort of like going to the emergency room with a burst appendix and being told, “Why don’t you just sit in the waiting room until we doctors figure out what to do? Get back to you later!”

Somewhere out there, Stephen Miller must be gloating about how he totally outsmarted and outflanked the Biden Team!

Trump Administration Ordered To Stop Expelling Children Who Cross Border

At least 8,800 unaccompanied children have been expelled since March.

pastedGraphic.png

Nomaan Merchant

HOUSTON (AP) — A federal judge on Wednesday ordered the Trump administration to stop expelling immigrant children who cross the southern border alone, halting a policy that has resulted in thousands of rapid deportations of minors during the coronavirus pandemic.

U.S. District Judge Emmet Sullivan issued a preliminary injunction sought by legal groups suing on behalf of children whom the government sought to expel before they could request asylum or other protections under federal law.

The Trump administration has expelled at least 8,800 unaccompanied children since March, when it issued an emergency declaration citing the coronavirus as grounds for barring most people crossing the border from remaining in the United States.

Border agents have forced many people to return to Mexico right away, while detaining others in holding facilities or hotels, sometimes for days or weeks. Meanwhile, government-funded facilities meant to hold children while they are placed with sponsors have thousands of unused beds.

Sullivan’s order bars only the expulsion of children who cross the border unaccompanied by a parent. The government has expelled nearly 200,000 people since March, including adults, and parents and children traveling together.

“This policy was sending thousands of young children back to danger without any hearing,” said Lee Gelernt, a lawyer for the American Civil Liberties Union. “Like so many other Trump administration policies, it was gratuitously cruel and unlawful.”

The Justice Department did not immediately say whether it would appeal. It has appealed another federal judge’s order barring the use of hotels to detain children.

The incoming administration of President-elect Joe Biden has not directly said whether it will keep trying to expel immigrants under public-health authority. Biden is expected to roll back several Trump administration policies restricting asylum as part of a broader shift on immigration.

But the government said that, even if these withholding claims succeed, it still retains the right to deport the group of immigrants to other countries that will accept them. Because deportation is still on the table regardless of the status of those claims, the administration argued, the group of immigrants should be treated identically to those who are about to be deported.

The ACLU rebutted that argument, saying that such third-country deportations are exceedingly rare. Because of this, the ACLU said the availability of a third-country option should not mean the

deportation-ready provision of the law kicks in. According to the American Immigration Council, fewer than 2% of immigrants who received persecution-based relief in fiscal year 2017 were ultimately deported to a third country.

The Justice Department also raised the possibility that having to scrutinize the practical odds of removal from immigrant to immigrant would be “patently unworkable.”

“A case-by-case approach … would needlessly add to the burdens that are already ‘overwhelming our immigration system,'” the department said, quoting a prior case.

But a coalition of former immigration trial and appeals judges pushed back on that idea with their own amicus brief Thursday.

“Bond hearings in withholding of removal proceedings are no different than bond hearings in other contexts,” the group, representing 34 judges who have cumulatively overseen thousands of cases, wrote. “Contrary to [the administration’s] assertion, bond hearings in withholding of removal proceedings neither lead to a slowdown of cases that ‘thwart Congress’ objectives’ in enacting the immigration laws, nor impose an administrative burden on immigration courts.” The American Civil Liberties Union is represented by its own Michael Tan, Omar Jadwat, Judy Rabinovitz, Cecillia Wang and David D. Rachel McFarland
Legal Aid Justice Center
Charter Member, New Due Process Army

This disgraceful performance by the Solicitor General’s Office (once revered, now reviled) has become “the norm” under Trump. Francisco’s arguments are those of an attorney who didn’t do “due diligence,” but doesn’t expect the Court to know or care what really happens in Immigration Court. And, unfortunately, with the exception of Justice Sotomayor and perhaps Justice Kagan, that may well be a correct assumption. But that doesn’t make it any less of a powerful and disturbing indictment of our entire U.S. Justice system in the age of Trump.

Reality check: I routinely did 10-15, sometimes more, bond hearings at a Detained Master Calendar in less than one hour. I treated everyone fairly, applied the correct legal criteria, and set reasonable bonds (usually around $5,000) for everyone legally eligible. Almost all represented asylum seekers and withholding seekers eligible for bond who had filed complete and well-documented asylum or withholding applications were released on bond. About 99% showed up for their merits hearings.

I encouraged attorneys on both sides to file documents in advance, discuss the case with each other, and present a proposed agreed bond amount or a range of amounts to me whenever possible. Bond hearings were really important (freedom from unnecessary restraint is one of our most fundamental rights), but they weren’t “rocket science.” Bond hearings actually ran like clockwork.

Indeed, if the attorneys were “really on the ball,” and ICE managed to find and present all the detainees timely, I could probably do 10-15 bond cases in 30 minutes, and get them all right. My courtroom and my approach weren’t any different from that of my other then-colleagues at Arlington. In thirteen years on the bench, I set thousands of bonds and probably had no more than six appeals to the BIA from my bond decisions. I also reviewed many bond appeals at the BIA. (Although, most bond appeals to the BIA were “mooted” by the issuance of a final order in the detained case before the bond appeal was adjudicated.) Most took fewer than 15 minutes.

Indeed, my past experience suggests that a system led (not necessarily “run”) by competent judicial professionals and staffed with real judges with expertise in immigration, asylum, and human rights and unswervingly committed to due process and fundamental fairness could establish “best practices” that would drastically increase efficiency, cut (rather than mindlessly and exponentially expand) backlogs, without cutting out anyone’s rights. In other words, EOIR potentially could be a “model American judiciary,” as it actually was once envisioned, rather than the slimy mass of disastrous incompetence and the national embarrassment that it is today!

The idea that doing something as straightforward as a bond hearing would tie the system in knots is pure poppycock and a stunning insult to all Immigration Judges delivered by a Solicitor General who has never done a bond case in his life!

Yes the system is overwhelmingly backlogged and dysfunctional! But that has nothing to do with giving respondents due process bond hearings.

It has everything to do with unconstitutional and just plain stupid “politicization” and “weaponization” of the courts under gross incompetence and mismanagement by political hacks at the DOJ who have installed their equally unqualified toadies at EOIR. It also has to do with a disingenuous Solicitor General who advances a White Nationalist political agenda, rather than constitutional rights, fundamental fairness, rationality, and best practices. It has to do with a Supreme Court majority unwilling to take a stand for the legal rights and human dignity of the most vulnerable, and often most deserving, among us in the face of bullying and abuse by a corrupt, would-be authoritarian, fundamentally anti-American and anti-democracy regime.

It has to do with allowing a corrupt, nativist, invidiously-motivated regime to manipulate and intentionally misapply asylum and protection laws at the co-opted and captive DHS Asylum Office; thousands of “grantable” asylum cases are wrongfully and unnecessarily shuffled off to the Immigration Courts, thus artificially inflating backlogs and leading to more pressure to cut corners and dispense with due process.

It also paints an intentionally false and misleading picture that the problem is asylum applicants rather than the maliciously incompetent White Nationalists who have seized control of our system and acted to destroy years of structural development and accumulated institutional expertise.

Good Government matters! Maliciously incompetent Government threatens to destroy our nation! (Doubt that, just look at the totally inappropriate, entirely dishonest, response of the Trump kakistocracy to their overwhelming election defeat by Biden-Harris and the unwillingness of both the GOP and supporters to comply with democratic norms and operate in the real world of facts, rather than false narratives.)

Due process, fundamental fairness, equal justice, simple human decency, and Good Government won’t happen until we get the White Nationalist hacks out of the DOJ and replace the “clown show” at EOIR with qualified members of the New Due Process Army. Problem solvers, rather than problem creators; over-achievers, rather than screw-ups!

The incoming Biden-Harris Administration is left with a stark, yet simple, choice: oust the malicious incompetents and bring in the “competents” from the NDPA to fix the system; or become part of the problem and have the resulting mess forever sully your Administration.

The Obama Administration (sadly) chose the latter. President Elect Biden appears bold, confident, self-aware, and flexible enough to recognize past mistakes. But, recognition without reconstruction (action) is useless! Don’t ruminate — govern! Like your life depends on it!

And, by no means is EOIR the only part of DOJ the needs “big time” reform and a thorough shake up. We must have a Solicitor General committed to following the rules of legal ethics and common human decency and who will insist on her or his staff doing likewise.

The next Solicitor General must also have demonstrated expertise in asylum, immigration, civil rights, and human rights laws and be committed to expanding due process, equal justice, racial justice, and fundamental fairness throughout the Government bureaucracy and “pushing” the Supremes to adopt and endorse best, rather than worst, practices in these areas.

American Justice and our court systems are in “free fall.” This is no time for more “amateur night at the Bijou.”

And here are some thoughts for the future if we really want to achieve “Good Government” and equal justice for all:

  • Every future Supreme Court Justice must have served a minimum of two years as a U.S. Immigration Judge with an “asylum grant rate” that is at or exceeds the national average for the U.S. Immigration Courts;
  • Every future Solicitor General must have done a minimum of ten pro bono asylum cases in U.S. Immigration Court.

Due Process Forever! Clown Show (With Lives & Humanity On The Line) Never!

WASHINGTON — The Supreme Court on Monday agreed to review two major Trump administration immigration initiatives: a program that has forced at least 60,000 asylum seekers to wait in Mexico while their requests are heard and the diversion of $2.5 billion in Pentagon money to build a barrier on the southwestern border.

Lower courts blocked both measures.  But the Supreme Court, in earlier orders, allowed them to remain in effect while appeals moved forward.

The arguments in the two cases will not be heard until after the November election. Should President Trump’s Democratic opponent, Joseph R. Biden Jr., win, his administration could take steps to make the cases moot.

In the case on asylum seekers, an appeals court in February blocked the program, known as Remain in Mexico, saying it was at odds with both federal law and international treaties and was causing “extreme and irreversible harm.”

The losers in these cases have already been determined: the innocent human lives destroyed, the rule of law, the Constitution, human decency, and the Supremes’ reputation. If the Supremes’ majority hadn’t already “pre-judged” these cases in the regime’s favor, then their unwarranted and ethically questionable “early intervention” in the process to allow the abuses of humanity, Congressional authority, and the public fisc to continue would be even more unconscionable.

Indeed, both of these cases are examples of a democracy in danger, a judicial system in decay, and a  Supremes who have established themselves as part of the problem, not the solution.

Michelle Hackman reports for the WSJ:

WASHINGTON—The Trump administration, which has used the coronavirus health emergency to expel migrants at the border without allowing them to apply for asylum, faces its first court challenge over the practice in a lawsuit filed on behalf of a 16-year-old boy.

Since President Trump declared a public-health emergency in March, immigration agents have turned back nearly all migrants, including children, at the border without providing a chance to file asylum claims. The government invoked a 1944 public-health law allowing it to expel any noncitizen who poses a threat of spreading disease during an emergency. It extended that provision indefinitely in May.

The new process overrides immigration laws that allow any foreigner on American soil with a credible fear of persecution to apply for asylum, and laws prohibiting migrant children from being deported.

The lawsuit was filed in the district court in Washington by the American Civil Liberties Union on behalf of a 16-year-old boy from Honduras, known only by his initials J.B.B.C. He crossed the border in early June to join his father, who is living in the U.S. and awaiting his own immigration case to be heard, after fleeing what the suit described as “severe persecution” in his home country.

Under the typical process, border agents would have turned over the child to the Department of Health and Human Services, which runs a network of migrant shelters for children across the country and seeks to find them suitable guardians. Instead, border agents detained the boy in El Paso, Texas, and plan to deport him imminently, in accordance with the public-health emergency process.

Late Tuesday evening, Judge Emmet G. Sullivan granted J.B.B.C. a temporary restraining order, ordering the government not to deport him through at least Wednesday at midnight.

The White House and the Department of Homeland Security didn’t immediately respond to requests for comment.

The lawsuit’s supporters acknowledge that the suit is a gamble. If a federal judge rules that immigration laws can be bypassed during an emergency—a novel application of the public-health law—the government would gain broad new authority. But not suing, they say, could allow deportations without due process to continue.

“If the courts don’t step in, the Trump administration will continue to indefinitely strip refugees of the right to seek asylum,” said Aaron Reichlin-Melnick, policy counsel at the American Immigration Council.

The name of the use is J.B.B.C. v. Wolf.

So far, in showing no genuine concern for human rights, the rule of law, or overt racism in major non-legislative eradications of asylum, refugee, and immigration protections by a scofflaw Administration, which has made only cosmetic efforts to disguise its racist immigration agenda, a Supremes’ majority has sent a strong chilling signal to lower Federal Judges willing to stand up for racial justice, equal justice before the law, and Executive accountability. Will  the Trump regime continue to literally “get away with attempted (or actual) murder” of children and other asylum applicants? How far does the Supremes’ majority’s resolve not to give Black and Brown lives and rights their deserved legal protections, and to fold in the face of Trump’s racist bullying, extend?

DEATH IN THE GULAG⚰️: ICE Notches First Known COVID-19 Prisoner Fatality ☠️ — Advocates Have Been Warning 🆘 Of Dangers & Seeking Releases — How Many More Will Die ⚰️ in Captivity?

Sarah Ruiz-Grossman reports for HuffPost:

An immigrant being held in detention at an Immigration and Customs Enforcement facility in San Diego has died of COVID-19.

A 57-year-old detainee at ICE’s Otay Mesa facility, which is run by private contractor CoreCivic, died early Wednesday of complications of the coronavirus disease after being hospitalized since late April, according to San Diego County officials. This is the first reported COVID-19 death of an immigrant in ICE custody.

Carlos Ernesto Escobar Mejia was from El Salvador, according to a government report obtained by BuzzFeed News. He’d been held by ICE since January and was hospitalized April 24 after exhibiting coronavirus symptoms. He had hypertension and self-reported diabetes but was denied release from custody in mid-April by an immigration judge.

ICE and CoreCivic did not immediately respond to a request for further details.

Advocates had been warning about unsafe health conditions at the Otay Mesa detention center for weeks. The facility currently has the biggest outbreak of COVID-19 of any ICE detention center, with at least 132 immigrants and 10 ICE employees testing positive as of last week.

(CoreCivic in mid-April said it had given masks to detainees at Otay Mesa and was quarantining positive cases in “housing pods” and separating those at high medical risk.)

Of nearly 30,000 immigrants in ICE detention centers nationwide, the agency has so far tested only 1,460 for COVID-19, and more than 705 immigrants have tested positive.

Activists have been calling for the release of all people from immigration detention, warning that there is no realistic way to keep immigrants safe during a pandemic in such facilities, which have long been reported to have substandard health care and sanitation.

“This is a terrible tragedy, and it was entirely predictable and preventable,” Andrea Flores, deputy director of immigration policy at the American Civil Liberties Union, said in a statement Wednesday.

“For months, public health experts and corrections officials have warned that detention centers would be Petri dishes for the spread of COVID-19 — and a death trap for thousands of people in civil detention,” she added. “Unless ICE acts quickly to release far more people from detention, they will keep getting sick and many more will die.”

This illustrates the point recently raised by Don Kerwin at CMS in an article posted on Courtsidehttps://immigrationcourtside.com/2020/05/03/don-kerwin-cms-detention-should-not-be-a-death-sentence-☠%EF%B8%8F☠%EF%B8%8F⚰%EF%B8%8F⚰%EF%B8%8F/

According to Sarah’s article, this victim was denied bond by an Immigration Judge, despite exhibiting “high risk” factors in an inherently unhealthy and unsafe detention center. Judge Jeffrey Chase and I have pointed out before that a functional Immigration Court, including a BIA committed to fair and impartial justice and willing to reign in unjustified policies and poor judgment on the part of ICE, could have avoided such tragedies. https://immigrationcourtside.com/2020/04/06/hon-jeffrey-s-chase-matter-of-r-a-v-p-bond-denial-maximo-cruelty-minimal-rationality-idiotic-timing-bonus-my-monday-mini-essay-how-eoir/

But, we have just the opposite these days. https://immigrationcourtside.com/2020/03/18/latest-outrage-from-falls-church-bia-ignores-facts-abuses-discretion-to-deny-bond-to-asylum-seeker-matter-of-r-a-v-p-27-in-dec-803-bia-2020/

That means that responsibility for meaningful custody review passes to the U.S. District Courts.

Why have an Immigration Court at all if it’s going to function as a mindless “rubber stamp” on DHS Enforcement driven by White Nationalist extremist politicos like Miller? If the Immigration Courts are no longer willing or able to guarantee fair and impartial adjudications, which unfortunately appears to be the case under Billy Barr, maybe all removal proceedings and bond hearings should just be held before U.S. Magistrate Judges and U.S. District Judges until Congress establishes an independent Article I Immigration Court!

ANOTHER BLOW TO THE REGIME SCOFFLAWS, AS MORE WILL BE REVIEWED FOR RELEASE FROM THE GULAG: Judge Dana Sabraw, USDC SD CA, Orders Further Review, After Plaintiffs Show Undercount In Original DHS Affidavit Submitted To Court!

Kate Morrissey reports for the San Diego Union Tribune:

The facility’s warden had initially given the judge an undercount of how many detainees were at high risk of complications due to COVID-19

By KATE MORRISSEY

APRIL 30, 202012:04 PM

A San Diego federal judge ordered Immigration and Customs Enforcement to review for release a list of newly identified detainees at the Otay Mesa Detention Center who would be at high risk for serious health complications if they get COVID-19.

U.S. District Court Judge Dana Sabraw granted the American Civil Liberties Union’s request to create a subclass of people at high risk under the pandemic, which has spread widely within the facility. The judge made his decision after learning that the facility’s warden had undercounted the number of people in that category in his initial declaration for the case.

“That information is significant,” Sabraw told attorneys during a telephonic hearing Thursday. “It does change measurably the underlying facts and whether or not the petitioners are entitled to relief.”

A spokeswoman for CoreCivic, the private prison company that runs the facility, said that the initial report sent to the judge was compiled with data from ICE Health Service Corps, which provides the medical care at the facility, and the report “was made with the best available information we had from our partners at the time.”

There was a time, long ago, when a Government agency’s submission of false, materially incomplete, or misleading information to a Federal Court would have earned sanctions up to and including threats of contempt from a U.S. District Judge. Sadly, bending the truth, omitting material information, and outright lies have become “the norm” for DHS and DOJ under Trump.

Indeed, the burden is now on the plaintiffs, often serving pro bono and stretched to the limit, to show and document for the courts each false, incomplete, or misleading affirmation from the Government. Against reason and the clear record over the past three years, Federal Courts continue to presume the proven unlikely — nay, likely impossible — that a regime led by a pathological liar and his toadies will provide them true, accurate, and complete information about anything!

Instead of asylum applicants being given “the benefit of the doubt,” as our law is supposed to require, that benefit of the doubt is now being given to an overtly bigoted and dishonest Executive who in no way has earned or deserved it. Everything has been turned upside down.

But, until the Article III Courts take actions to insure that this regime respects the integrity of the process, the practice of “lie, obfuscate, and mislead first and see if they catch you” will continue largely unabated. Vulnerable migrants aren’t the only victims here. Failing to force the regime to act in an honest, ethical, and professional manner in Federal litigation is eroding the integrity of the Article III Courts all the way up to the complicit Supremes.

Remember, several years ago, the DHS and DOJ lied to Federal Courts and the public about the existence of Sessions’s “child separation policy.” Two years later, they continue to feed erroneous information to the courts with impunity. But, who’s surprised when in the meantime the Supremes’ majority has sent such a powerful and consistent message that “Brown Lives Don’t Matter” and they won’t examine the truth or actual motivation behind any Executive attack on the rights, lives, and safety of migrants.

Here’s a report from a member of the NDPA and a Courtside reader on the front lines of the battle to save humanity: “[T]wo of our clients detained in Otay Mesa Detention Center were finally released after a Federal Judge issued a TRO. I am relieved. ICE has been unreasonable and in my opinion reckless with the lives of people in detention and even their own employees. . . .  And the attorneys at the ACLU are the true heroes here and . . . students.”

Why is this abject failure of responsible Government and absence of powerful, coordinated, courageous judging that puts an end to these human rights abuses acceptable? Why isn’t our Supreme Court delivering a powerful message that Executive dishonesty, denials of due process, systemic detention abuses, and disregard of established human rights principles aren’t acceptable in 21st Century America? Why is “Dred Scottification” the new policy endorsed by the “JR Five” on the Supremes?

Until we get better Federal Judges willing to stand up to Executive abuses and a Congress that retakes its responsibility to legislate and oversee the Executive in the area of immigration and human rights, it will continue to fall to the private bar and NGO lawyers to force officials among our failed institutions in all three Branches to do their jobs in accordance with the law and the Constitution. That’s not the way it’s supposed to work. But, it’s the only way it does work in today’s America. Thank goodness for the (non-regime) lawyers!

Due Process Forever!

Round Table Member Judge Ilyce Shugall & Genna Beier, Deputy Public Defender report:

Hi all,

I write with wonderful news from the Zepeda Rivas crew. Judge Chhabria granted our motion for provisional class certification and motion for temporary restraining order. See attached!

He found that “the plaintiffs have demonstrated an exceedingly strong likelihood that they will prevail on their claim that current conditions at the facilities violate class members’ due process rights by unreasonably exposing them to a significant risk of harm.”

He also faulted the government for failing to be ready with basic information about class members:

“[C]ounsel for ICE asserted that it will take a significant amount of time for the agency to prepare a list of detainees with health vulnerabilities because it is ‘burdensome.’ The fact that ICE does not have such a list at the ready, six weeks after Governor Newsom shut down the entire state and one week after this lawsuit was filed, speaks volumes about where the safety of the people at these facilities falls on ICE’s list of priorities.” (emphasis added). ZING!!

He ordered ICE to provide records. Then, we will begin a process of individualized “bail” applications (“[T]his Court—likely with the assistance of several Magistrate Judges—will consider bail applications from class members over a roughly 14-day period.”). We don’t know yet what that process will look like, and we’ll have an opportunity to discuss it at a case management conference tomorrow. We’ll update you, of course.

If you haven’t already, please fill out the attached form for your clients! At tomorrow’s hearing want to be able to give the judge a survey of the individuals for whom we have clear release plans, for example. (Tips: try to use Adobe; if all else fails, save as PDF and email to me).

Lastly, we’ve got an amazing team of ACLU, SFPD, LCCR and UC Berkeley Law School people ready to take calls from unrepresented people in detention to start gathering info for bail applications. Please tell your clients to spread the following Lyon pin to others in their dorm who do not have attorneys to fill out these forms for them.

NUMBER TO CALL FOR UNREPRESENTED FOLKS: 7654

Folks will be on shifts taking calls from 9:00 am to 9:00 pm. Spread the word!

Congratulations, Team!👍🏼👍🏼👍🏼👍🏼👍🏼

Thank goodness! Another courageous U.S. District Judge refusing to “buy into” the regime’s disingenuous, immoral “no problem until the bodies start piling up, it’s only the lives of migrants, not ‘real humans’” approach.

Imagine what would happen if all Federal Judges were willing to act on their oaths of office and uniformly reject all aspects of the regime’s unlawful, unconstitutional “Dred Scottification” program directed at “deterrence through death, disease, and dehumanization.” What would it take? What if the families of Federal Judges were treated with the same basic disregard for due process, life, health, and human dignity as the regime inflicts on migrants? What if the corrupt officials carrying out these programs and the lawyers who defend them were actually held accountable for their actions by the Federal Courts rather than largely being given “free passes”?

What if we had a Government that actually respected our Constitution rather than seeking to shred it?

Due Process Forever!

Andrea Castillo and Brittny Mejia report for the LA Times:

For weeks, as the coronavirus spread, Jose Hernandez Velasquez worried about the dangers of being detained inside the Adelanto ICE Processing Center 80 miles east of Los Angeles.

The 19-year-old Guatemalan immigrant listened uneasily as other men called their families, begging them to do everything possible to get them released so as to reduce their odds of contracting the deadly illness.

Ultimately, in light of the pandemic, a federal judge ordered immigration authorities to release Hernandez, an asylum seeker with hypertension who had spent nearly 21/2 years at the facility. When a guard came to tell him the news, Hernandez was speechless. Other detainees burst into applause.

“I was really worried,” he said in a phone call after his release. “It was so difficult to be inside.”

As an increasing number of Immigration and Customs Enforcement detainees across the country test positive for COVID-19, California lawyers are working to free as many clients as they can by invoking constitutional rights and arguing on humanitarian grounds. In the last two weeks, U.S. District Judge Terry Hatter Jr. ordered at least 10 people released from Adelanto, one of the country’s largest detention centers, holding nearly 2,000 people.

It’s unclear how many detainees have been released nationwide because of coronavirus concerns. In recent weeks, federal judges across the country have ordered the release of more than 40 detainees.

Like Hernandez, most have been released after lawyers petitioned federal courts on their behalf. Others have been released on bond or through humanitarian parole, which is free to people with a compelling emergency.

In response to the pandemic, ICE has instructed field offices to assess and consider for release those deemed to be at greater risk of exposure, reviewing cases of individuals age 60 and older, as well as those who are pregnant.

In court filings, ICE has argued that concern about detainees contracting COVID-19 is “based on mere speculation” and that releasing large numbers of them would set a precedent that would persist even after the virus subsides.

Until ICE agrees to release more detainees, “you’re going to keep seeing petitions like this,” said Jessica Bansal, senior staff attorney at the American Civil Liberties Union of Southern California, which got Hernandez and others released from Adelanto. “Because people need to get out.”

The ACLU has sued ICE facilities in multiple states over coronavirus concerns.

Empowering a regime that functions in such a contemptuous, cruel, and incompetent manner is insane and wasteful to boot. Everyone, including the legitimate needs of DHS enforcement (not much resemblance to the current racially-driven scofflaw mess) would benefit from a professionalized, accountable, and properly focused DHS and an independent, due process with efficiency-oriented U.S. Immigration Court.

Immigration enforcement could focus on priorities that actually relate to the safety and security of our nation, the private and NGO immigration bar could expand individual case representation before the Immigration Courts thus promoting efficiency with due process, and the U.S. District Courts could return to other cases. It would be a win-win-win, notwithstanding the bogus blather of the White Nationalist restrictionists who seek to use the pandemic as a weapon to “zero out” legal immigration and force all migration into the “black market” where it can more easily be exploited and abused by them and their cronies.

GOOD GUYS WIN ANOTHER: Modest Victory For Detainees & Their Lawyers On Phone Access

Matt Stiles
Matt Stiles

Matt Stiles reports for the LA Times:

A federal judge ruled Saturday that immigration enforcement officials must allow confidential telephone calls between detainees at the Adelanto ICE Processing Center and their attorneys in light of the coronavirus outbreak.

The 15-page ruling by U.S. District Judge Jesus G. Bernal found that U.S. Immigration and Customs Enforcement must reverse a policy that critics said made it virtually impossible for detainees and their attorneys to confer in private at the facility, about 80 miles east of Los Angeles in San Bernardino County.

Bernal wrote that the agency must provide “free, reasonably private legal calls on unrecorded and unmonitored telephone lines, and must devise a reliable procedure for attorneys as well as detainees to schedule those calls within 24 hours of a request.”

The decision came after the American Civil Liberties Union Foundation of Southern California and others sought a temporary restraining order late last month, noting the risks posed by in-person visitation amid the COVID-19 pandemic.

Attorneys for the detainees, which included the Immigrants’ Rights Clinic at Stanford Law School and the law firm Sidley Austin, hailed the ruling for opening other methods for them to communicate with the outside world during the pandemic.

“This order will protect detained immigrants’ constitutional right to speak with their lawyers — enabling them to fight deportation and regain their freedom,” Eva Bitrán, staff attorney with the ACLU, said in a statement.

. . . .

“Nibbling around the edges” of the real problem we’re not addressing: far too much unnecessary, and now dangerous, so-called “civil” immigration detention.

Trump’s “New American Gulag” is a stain on our nation. Phone access is good, but doesn’t address the reality that most of the individuals in the Gulag shouldn’t be there at all.

And, one might well ask why this is an issue at all. Why are officials acting with impunity to deny basic constitutional rights? Why are lawyers required to sue for basics that should be provided in any detention system?

I actually remember a time in the past where every finding by a Federal Court that an Immigration Judge had violated an individual’s legal rights automatically generated a review by the DOJ’s Office of Professional Responsibility and sometimes disciplinary action. Why are Trump law enforcement officials immune from ethical and professional responsibilities and never held accountable (except, apparently, where they follow the law rather than Trump’s whims and desires)?
