The new version of MPP expands its focus to asylum seekers from across the hemisphere, stranding even more people seeking safety in dangerous conditions at the border.

 

Kennji Kizuka, Associate Director for Research and Analysis, Refugee Protection, appeared on Democracy Now! and detailed the many human rights violations faced by asylum seekers processed under the “Remain in Mexico” policy.

 

“It’s extraordinarily concerning that the Biden administration is not only restarting this policy but expanding it,” said Kizuka.

Human Rights First also announced the resumption of our research documenting the human rights abuses suffered by people turned away to wait in danger under MPP.

Our position is gaining widespread support from those who understand the issue.  The Roundtable of Former Immigration Judges condemned

MPP as the “antithesis of fairness,” concluding that there has been “no greater affront to due process, fairness and transparency,” and called for administration to “permanently end the program.”

 

The union for U.S. Citizenship and Immigration Services (USCIS) asylum officers tasked with MPP screenings call it “irredeemably flawed.”  They said that restarting MPP “makes our members complicit in violations of U.S. federal law and binding international treaty obligations of non-refoulement that they have sworn to uphold.”

Republicans are convinced that attacking President Biden’s border policies will win them the midterms. House Minority Leader Kevin McCarthy (R-Calif.) has gleefully labeled the situation there “Biden’s border crisis.”

In this, Republicans are benefiting from a media debate that has gone off the rails.

There’s a huge hole in this GOP attack, but it’s rarely described clearly in news reports and commentary. You can read endless headlines warning of a “crisis.” But even if that’s so, a crisis relative to what, exactly ?

What’s missing is a serious comparison with the pre-Biden status quo. It’s as if the current situation exists in a vacuum: Before there was no crisis, and now there’s a crisis .

That’s absurd. The situation under former president Donald Trump was substantially worse from a humanitarian and a pragmatic governing perspective: worse for the migrants, worse for the rule of law and worse for our country.

Biden is cleaning up Trump’s mess

It’s true that child and teenage migrants are overwhelming our facilities.

Because they can’t get released alone, they must be held at Border Patrol facilities for 72 hours before getting transferred to the Office of Refugee Resettlement, which places them with relatives or guardians. The ORR facilities are jammed, backlogging border facilities.

This is a terrible situation. But it’s happening in large part because Biden is undoing a Trump policy that should be undone.

Due to covid-19, the previous administration turned away most asylum seekers — without hearings — under a legal provision allowing a temporary block on noncitizens from entering to protect public health.

Biden is no longer applying this provision to unaccompanied children and teenagers (while keeping it for adults), helping fuel child backlogs. But that’s a move in the right direction, both from a humanitarian and rule-of-law perspective.

Coronavirus will be tamed before long, and we have a legal obligation to allow migrants to exercise their right to seek asylum. And as David Bier notes, that provision is not for controlling migrant flows outside a genuine public health rationale. If anything, expelling adults abuses it.

So continuing to use this tool is not a tenable long-term solution to the humanitarian problem, and it’s not in keeping with the rule of law. That requires letting in the kids, and we will have to allow more adults to apply for asylum. The question is how we manage it.

I understand why Fox News, Breitbart, and the rest of the “truth averse” right wing media shills promote the GOP’s racist, xenophobic “border crisis” myths.

What I don’t get is why the so-called “mainstream media” doesn’t do its homework on the real situation on the border and the Trump-created mess facing Biden in restoring some sense of order and lawful behavior to an intentionally broken and dysfunctional system. 

A few journalists like Greg, his WashPost colleague Arelis Hernandez, Cindy Carcamo (LA Times), Nicole Narea (Vox News), and Priscilla Alvarez (CNN), to name some, have taken the time to get it right (or close to right). But, far too many reporters who should know better just repeat the Abbott, McCarthy, GOP disingenuous nonsense without critical analysis or pushback. 

And, what’s sorely missing is the perspective of those at the heart of this situation: the kids and families faced with such a desperate situation in their home countries that they are willing to seek mercy and refuge in a country that proudly advertises its lack of respect for their humanity, our own laws, and international norms that are supposed to insure fair and humane treatment. 

They aren’t numbers, stats, bar graphs, and trend lines — they are human beings. They assert rights to apply for refuge under international norms that the U.S. has written into laws –  laws we have unilaterally decided not to follow.

The overwhelming majority seek not to “evade” authorities, but to turn themselves in to our legal system: A system that functionally no longer exists at our Southern Border thanks to Trump and, to some extent, the Supremes. This is neither a “law enforcement” nor a “national security” crisis — it’s a fundamental breakdown in our legal system and a betrayal of humane values. 

That’s the real problem here. It originated long before the Biden Administration. To date, no GOP  politico has offered any type of constructive solution. And, too few journalists have held the GOP nativists accountable for their racist-inspired lies, misrepresentations, myths, and lack of any semblance of constructive proposals for rational, lawful, governance — real solutions for problems aggravated by their own toxic, inhumane, and often illegal policies!

CNN: Some Separated Families Reunited; Biden Restores Legal Immigration; “Remain in Mexico” Phaseout Begins!

Lawyers are slowly making progress in locating and reuniting children and families separated at the southern US border as part of the Trump administration’s “zero tolerance” immigration policy. A month ago, the parents of 611 children had yet to be located. Now, that number is down to 506. President Biden this month signed an executive order establishing a new task force designed to identify and reunify these separated families. Meanwhile, the Biden administration has lifted an order that temporarily banned certain immigrant visas during the pandemic and will begin admitting some of the hundreds of migrants held in deplorable conditions in tent camps as part of a policy requiring them to stay in Mexico until their US court dates. Both these decisions are reversals of controversial Trump-era policies.

White House announces sweeping immigration bill

The White House announced a sweeping immigration bill Thursday that would create an eight-year path to citizenship for millions of immigrants already in the country and provide a faster track for undocumented immigrants brought to the US as children.

The legislation faces an uphill climb in a narrowly divided Congress, where House Speaker Nancy Pelosi has just a five-vote margin and Senate Democrats do not have the 60 Democratic votes needed to pass the measure with just their party’s support.

Administration officials argued Wednesday evening that the legislation was an attempt by President Joe Biden to restart a conversation on overhauling the US immigration system and said he remained open to negotiating.

“He was in the Senate for 36 years, and he is the first to tell you the legislative process can look different on the other end than where it starts,” one administration official said in a call with reporters, adding that Biden would be “willing to work with Congress.”

The effort comes as there are multiple standalone bills in Congress aimed at revising smaller pieces of the country’s immigration system. Sens. Lindsey Graham, a Republican from South Carolina, and Majority Whip Dick Durbin, a Democrat from Illinois, for example, have reintroduced their DREAM Act, which would provide a path to citizenship for immigrants who came to the country illegally as children.

Administration officials said the best path forward and plans either to pass one bill or break it into multiple pieces would be up to Congress.

“There’s things that I would deal by itself, but not at the expense of saying, ‘I’m never going to do the other.’ There is a reasonable path to citizenship,” Biden said at a CNN town hall in Milwaukee on Tuesday.

“The President is committed to working with Congress to engage in conversations about the best way forward,” one administration official said.

Officials did not say if they believed that the reconciliation process, a special budget tool that applies only to a specific subset of legislation and allows the Senate to pass bills with a simple majority, would be applicable for an immigration bill. “Too early to speculate about it right now,” one official said.

The Senate is working on passing the President’s coronavirus relief legislation through reconciliation. The expectation is that the administration could also use the process to pass an infrastructure bill.

Biden’s immigration bill will be introduced by Democrats Bob Menendez of New Jersey in the Senate and Linda Sanchez of California in the House.

Here’s what that summary says about the U.S. Immigration Courts:

  • Improve the immigration courts and protect vulnerable individuals. The bill expands family case management programs, reduces immigration court backlogs, expands training for immigration judges, and improves technology for immigration courts. The bill also restores fairness and balance to our immigration system by providing judges and adjudicators with discretion to review cases and grant relief to deserving individuals. Funding is authorized for legal orientation programs and counsel for children, vulnerable individuals, and others when necessary to ensure the fair and efficient resolution of their claims. The bill also provides funding for school districts educating unaccompanied children, while clarifying sponsor responsibilities for such children.

  • Support asylum seekers and other vulnerable populations. The bill eliminates the one-year deadline for filing asylum claims and provides funding to reduce asylum application backlogs. It also increases protections for U visa, T visa, and VAWA applicants, including by raising the cap on U visas from 10,000 to 30,000. The bill also expands protections for foreign nationals assisting U.S. troops.

Unfortunately, the bill does not contain the most important legislative solution: An Article I  Immigration Court. Nevertheless, a separate Article I bill will be introduced in the House soon. Since the “USCA of 2021” is largely a “talking draft” anyway, there is no reason why Article I couldn’t be combined with the other changes in the bill.

While attention to improving the Immigration Courts is welcome and long overdue, I think this proposal actually misses the major point: What’s needed right now isn’t necessarily more Immigration Judges; it’s better Immigration Judges, starting, but not ending, with a replacement of the current dysfunctional Board of Immigration Appeals. Only with the improvements in the administrative case law, docket management, and “best practices” that better EOIR judges would bring could we really tell whether more judges are actually necessary.

Right now, throwing more bodies into the ungodly mess at EOIR would only create confusion and aggravate existing problems. And, while the proposal correctly spotlights woeful inadequacies in IJ training and professional development, those alone will not be enough to restore due process to a system wracked by decades of bad judicial selection practices that basically have excluded the “best and brightest” immigration experts from the private sector, those with actual experience representing individuals in Immigration Court, from the “21st Century Immigration Judiciary.”

The good news: Judge Garland won’t need legislation to get this system back on track by:

  • Immediately replacing the current BIA with judges who are renowned experts in immigration, human rights, and due process, with special attention to those with actual experience representing asylum seekers;
  • Vacating all of the improper Sessions and Barr precedents, and letting the “new BIA” straighten out the law and implement best practices, including holding IJs who are members of the “Asylum Deniers Club” accountable;
  • Implementing efficient merit-based judicial hiring practices which would involve public input and actively recruit from communities now underrepresented in the Immigration Judiciary;
  • Eventually re-competing all Immigration Judge jobs under these merit criteria, again with public input on the performance of current judges part of the process;
  • Replacing all of EOIR’s incompetent upper “management” with competent professional judicial administrators;
  • Examining the justification and “bang for the buck” in EOIR’s bloated, yet highly ineffective, headquarters operation in Falls Church with an eye toward maximizing support for the local Immigration Courts and minimizing counterproductive and politicized micromanagement and interference with the operation of local courts;
  • Making peace and working with the National Association of Immigration Judges (“NAIJ”), which is much more “on top of” the real problems in the Immigration Courts than often clueless EOIR “management” in Falls Church;
  • Instituting e-filing and other long overdue 21st Century judicial administration practices in the Immigration Courts;
  • Working cooperatively with the private bar, NGOs, ICE, and local IJs to maximize representation and improve docketing and scheduling practices.

Judge Garland has the authority to make all the foregoing changes, which will immediately improve the delivery of justice at the critical “retail level” of our justice system and make the achievement of racial justice and equal justice for all more than just “pipe dreams.” Immigrant justice is essential for racial justice!

The only question is whether Judge Garland will actually do what’s necessary. If not, he can expect some “aggressive pushback” from those of us who are fed up with the “EOIR Clown Show” 🤡🦹🏿‍♂️☠️ and its daily mockery of American justice!

As the calls for immediate EOIR reform grow, so does the sense of urgency for those vulnerable individuals (and their courageous, badly abused lawyers) caught up in the current unfair, biased, dysfunctional, and disgracefully misdirected and mal-administered Immigration Courts. 

Notably, EOIR “management” has continued its unseemly race to implement a racist, White Nationalist, anti-asylum, anti-lawyer agenda right up until the end! Their latest unlawful regulations were immediately and emphatically enjoined by several Federal Courts. 

EOIR has totally screwed up the Immigration Courts by piling up an avoidable backlog that greatly exceeds 1.1 million cases, largely by scheming to deny cases that could be granted, retaining cases that should be closed on their artificially bloated docket, selecting unqualified judges without expertise in immigration, human rights, and due process, and arbitrarily changing priorities and “churning” cases (“Aimless Docket Reshuffling”). They have then had the gutless audacity and intellectual dishonesty to attempt to shift the blame for their gross management and squandering of public resources to their victims: the individuals denied due process and fair hearings and their lawyers!

Additionally, EOIR’s continuing efforts to abuse asylum seekers and their lawyers through illegal and immoral regulations, and DOJ attorneys’ equally unethical “defense of the indefensible,” has continued to waste the time of the Article III Courts. It was obvious that these latest regulations would undermine the incoming Biden Administration’s pledge to reinstate due process and that they were illegal from the “git go!” 

This type of arrogantly “in your face Biden, Garland, democracy, and humanity” approach deserves immediate reputation, revocation, and removal of these responsible for the last, disgusting gasps of the “EOIR Clown Show!”🤡 It also demands that some action be taken to deal with the unethical DOJ lawyers 🦹🏿‍♂️🤮who have continued to “press this mess” before the Federal Courts. 

A Federal paycheck does NOT exempt lawyers from ethical codes nor is it a license to clog the courts with a frivolous, invidiously intended civil litigation “strategy” designed to “wear down and exhaust” those private, largely pro bono or low bono, lawyers defending due process and the rights of the most vulnerable among us. In civil litigation, the USG does NOT have either a right or an obligation to defend an illegal racist agenda of invidious actions. 

The disgraceful performance of all too many parts of the DOJ over the past four years must never, ever be repeated! This is a real, festering problem that “Team Garland” can’t afford to ignore as it takes the helm at the broken and dysfunctional DOJ that has become an actual threat to our democracy and our system of justice and an overt mockery of legal ethics.

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!

As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!

One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.

The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.” 

And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences! 

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!

What kind of people are we? As a society, are we so decadent and insecure that we show “toughness” by deliberately being cruel to innocent children? Is this what our nation has come to? Or are we better than that?

This election demands we answer those questions. The choice between President Trump and Joe Biden is not just political. It is also moral. And perhaps nothing more starkly illustrates the moral dimension of that decision than the Trump administration’s policy of kidnapping children at the southern U.S. border, ripping them away from their families — and doing so for no reason other than to demonstrate Trump’s warped vision of American strength.

We learned this week that some of those separations will probably be permanent. As NBC News first reported, 545 boys and girls taken as many as three years ago — the children of would-be immigrants and asylum seekers, mostly from Central America — have not been reunited with their parents and may never see their families again.

These are not among the nearly 3,000 families separated at the border in 2018, when children were kept in cages like animals or shipped away to facilities across the country, hundreds or thousands of miles from the border. We now know, thanks to the American Civil Liberties Union and other pro bono lawyers, that an additional 1,500 children were torn away from their families beginning in 2017, when the Trump administration conducted a trial run of the separation policy.

Please think about that. The shocking scenes we saw two years ago did not result from a sudden spasm of presidential anger. They didn’t stem from a Fox News segment Trump might have seen one evening. Rather, the administration rehearsed this form of cruelty.

What the administration did not plan for was how to reunite the children taken in 2017 with their families. Many of the parents were deported, and their children were placed in shelters around the country, then ostensibly released to parents or guardians, placements that the ACLU is still trying to confirm.

The ACLU and other organizations have sent investigators to towns and villages in Central America in an attempt to find the kidnapped children’s families — an effort complicated not just by time and distance, but also by the covid-19 pandemic. Parents of 545 children have not been found, the ACLU reported this week.

Disturbingly, the Department of Homeland Security suggested that some of the parents declined to get their children back so they could remain in the United States. Keep in mind that most of these families were seeking asylum from deadly violence in their home countries. The Trump administration changed immigration guidelines to make it unlikely that the families would ultimately be allowed to stay in the United States, but federal law gives them the right to apply for asylum and to have their cases heard. They did nothing wrong. They should never have been asked to choose between parenting their children and getting them to safety — not by their home countries, and not by the United States.

Trump’s racism and xenophobia have been hallmarks of his presidency from the beginning, so perhaps it should be no surprise that he would preside over such an outrage. But he didn’t do this by himself. He had plenty of help.

Former attorney general Jeff Sessions seized an opportunity to make his rabid antipathy toward Hispanic immigration into policy. White House senior adviser Stephen Miller, a former Sessions aide in the Senate, was the architect of Trump’s “zero tolerance” immigration policy. Then-White House Chief of Staff John F. Kelly said in 2018 that the children taken would be “taken care of — put into foster care or whatever.” Former homeland security secretary Kirstjen Nielsen said last year that she regretted that “information flow and coordination to quickly reunite the families was clearly not in place” — but not the separations themselves.

President Donald Trump’s administration started and carried out a policy that took more than 4,000 children from their parents, at least 545 of whom are still split apart years later. But at Thursday’s debate, the president insisted that he did nothing wrong at all ― blaming his Democratic predecessors and even insisting the kids are doing fine.

“They are so well taken care of,” Trump said of the children taken from their parents by his administration. “They’re in facilities that were so clean.”

Trump’s first term was marked by a full-out assault on immigration, both legal and unauthorized. The most dramatic was his “zero tolerance” policy on unauthorized border-crossing, used in a 2017 pilot program and expanded more broadly in 2018, that led to criminal prosecution of parents and locking up their kids separately. Splitting up families was intentional and calculated, according to multiple reports.

Thanks to mass public outrage and a court order, Trump was forced to stop his family separation policy. Most families were reunited, but the American Civil Liberties Union, which was part of the lawsuit against the government that stopped the policy, said this week that at least 545 kids are still away from their parents.

“Their kids were ripped from their arms and separated,” Democratic nominee Joe Biden said during the debate. “And now they cannot find over 500 sets of those parents and those kids are alone. Nowhere to go. Nowhere to go. It’s criminal.”

That is the number of children still separated from their families by the Trump administration — separated deliberately, cruelly and recklessly. They might never be reunited with their parents again. Even if they are, the damage is unimaginable and irreparable.

Even one would be too many. Each one represents a unique tragedy. Imagine being ripped from your parents, or having your child taken from you. Imagine the desperation that the parents feel, the trauma inflicted on their children.

That number represents an indelible stain on President Trump and every individual in his administration who implemented this policy, flawed at the conception and typically, gruesomely incompetent in the execution. It is, perhaps in the technical sense but surely in the broader one, a crime against humanity. It is torture.

That number — I will stop repeating it, yet it cannot be repeated enough — represents a moral challenge and responsibility for the next administration. If Joe Biden is elected president, he must devote the maximum resources of the federal government to fixing this disaster. The United States broke these families; it must do whatever it takes to help them heal.

Nothing like that would happen in a second Trump term, because Trump himself doesn’t care. He doesn’t grasp the horror that he oversaw. He doesn’t comprehend the policy, and he is incapable of feeling the pain it inflicted.

Those truths could not have been clearer cut than during Thursday night’s debate.

Moderator Kristen Welker of NBC News asked the president a simple question: “How will these families ever be reunited?”

First, Trump misstated the situation: “Their children are brought here by coyotes and lots of bad people, cartels, and they’re brought here, and they used to use them to get into our country.”

No. These are children separated from their families, not separated from smugglers. They are children brought by their parents in desperate search of a better life, desperate enough that they would take the risk of the dangerous journey.

Then Trump pivoted to the irrelevant: “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers. And we let people in, but they have to come in legally.”

Welker persisted: “But how will you reunite these kids with their families, Mr. President?”

Trump responded by pointing his finger at his predecessor: “Let me just tell you, they built cages. You know, they used to say I built the cages, and then they had a picture in a certain newspaper and it was a picture of these horrible cages and they said look at these cages, President Trump built them, and then it was determined they were built in 2014. That was him.”

This is typical Trumpian deflection, bluster undergirded by ignorance. The “cages” are ugly but irrelevant to the topic at hand: the deliberately cruel plan to deter border-crossing by separating children from parents. That was a Trump administration special, implemented with callous sloppiness and so extreme that even the Trump administration abandoned it.

Welker, for the third time: “Do you have a plan to reunite the kids with their families?”

At which point Trump made clear that he did not: “We’re trying very hard, but a lot of these kids come out without the parents, they come over through cartels and through coyotes and through gangs.” The children, he added later, “are so well taken care of, they’re in facilities that were so clean.”

The third and final presidential debate gave Donald Trump and Joe Biden the opportunity to make their final pitch to the American people before the 2020 election. For the Democratic nominee, that meant driving home the point that he believes in science, that he’ll take the COVID-19 pandemic seriously, that climate change is real, and that systemic racism must be dealt with. For Trump, it meant making it clear that in addition to being a science-denying, QAnon-promoting dimwit, he’s also an actual monster who thinks separating small children from their parents, in some cases permanently, is absolutely fine.

Asked by moderated Kristen Welker about the news that parents of 545 children separated at the border—60 of whom are under the age of five—cannot be located, Trump defended the policy and gave no explanation for how the government plans to find these people and reunite their families. “Children are brought here by coyotes and lots of bad people, cartels, and they’re brought here and they used to use them to get into our country,” Trump said, which is objectively false, as they are brought here by their parents, which is why it’s called the family separation policy. “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers and we let people in but they have to come in legally.”

Noting that Trump hadn’t answered the question, Welker pressed: “But how will you unite these kids with their families?”

“They built cages, they used to say I built cages…that was him,” Trump said, pointing to Biden and referring to the fact that the Obama administration did build temporary enclosures but failing, naturally, to mention that his predecessor did not separate families.

“Do you have a plan to reunite the kids with their parents?” Welker asked a third time. Again, Trump responded by claiming that the children “come without the parents, they come over through cartels and through coyotes and through gangs.”

At this point, Joe Biden was given a chance to weigh in and used his time to describe the policy implemented by Trump as the horror show all non-sociopaths know it to be. “Parents, their kids were ripped from their arms and they were separated and now they cannot find over 500 sets of those parents and those kids are alone, nowhere to go. It’s criminal.”

Then Trump interjected with what he apparently believed was an important point that would cast his administration in a much more favorable light and perhaps might even win it some awards or sainthood by the Catholic church. “Kristen, I will say this,” he told the moderator, of the children stolen from their parents. “They’re so well taken care of. They’re in facilities that are so clean.

With regard to that claim, NBC News reporter Jacob Soboroff weighed in on that after the debate, telling Rachel Maddow: “I was one of the reporters I guess the president mentioned, they invited me to go to the epicenter of this policy…what I saw was little children sitting on concrete floors, covered by mylar blankets, supervised by security contractors in a watchtower, it makes me sick every time I recall it. And Physicians for Human Rights…called this torture…the American Academy of Pediatrics called this state-sanctioned child abuse, and the president of the United States I guess interprets that as children being well taken care of.”

Jim Clyburn got right to the point when asked about Attorney General William Barr’s comment on Wednesday that calls for a nationwide lockdown to stem the spread of the novel coronavirus were the “greatest intrusion on civil liberties” in US history “other than slavery.”

Speaking with CNN’s John Berman on “New Day,” the House majority whip distilled the absurdity at the heart of Barr’s words.

“I think that that statement by Mr. Barr was the most ridiculous, tone-deaf, God-awful thing I’ve ever heard,” Clyburn, longtime Black leader from South Carolina, said on Thursday. “It is incredible, as chief law enforcement officer in this country, to equate human bondage to expert advice to save lives. Slavery was not about saving lives. It was about devaluing lives.”

Or as the author Isabel Wilkerson puts it in her new book, “Caste: The Origins of Our Discontents”: “The institution of slavery was, for a quarter of a millennium, the conversion of human beings into currency, into machines who existed solely for the profit of their owners, to be worked as long as the owners desired, who had no rights over their bodies or loved ones.”

In this system, African captives “could be mortgaged, bred, won in a bet, given as wedding presents, bequeathed to heirs, sold away from spouses or children to cover an owner’s debt or to spite a rival or to settle an estate,” Wilkerson writes.

That Barr painted a few months of being told — or as it was in many cases, asked — to stay home during a global pandemic as being even remotely in the same category as the practice of enslavement is ridiculous. (To say nothing of the fact that he skipped over, among other things, Jim Crow, Japanese internment during World War II and the slaughter of Native Americans.)

But even during a summer that’s been seized by a racial reckoning, the attorney general’s comment was the furthest thing from surprising.

A court declaration Friday from US Border Patrol Deputy Chief Raul Ortiz revealed the number, which previously hadn’t been released to the public. 

Since the Trump administration invoked a public health law to implement new restrictions at the border on March 20, the agency has expelled more than 159,000 people, according to Ortiz. That figure, Ortiz says, included 8,800 children who were traveling alone and 7,600 family members.

The Border Patrol official’s filing, first reported by CBS News, reveals new details about who has been kicked out of the US under the sweeping public health restrictions, which largely bar migrants from entering the country.

The declaration was filed as part of the government’s appeal of a recent court ruling over a controversial aspect of the coronavirus restrictions: the increasing use of hotels to detain migrant kids rather than licensed and monitored facilities.

Immigrant and civil rights advocates have warned that the secretive system is putting kids in danger. They have criticized the administration for using public health claims as a pretext to impose harsh immigration restrictions.

Last week, US District Judge Dolly M. Gee ruled that detaining migrant children in hotels wasn’t safe and did not “adequately account for the vulnerability of unaccompanied minors in detention.” She has ordered the government to stop the practice by September 15.

(CNN)A federal judge in Maryland on Friday ruled that Chad Wolf is likely unlawfully serving as acting secretary of the Department of Homeland Security and temporarily barred the Trump administration from enforcing new asylum restrictions on members of two immigration advocacy groups, according to court documents.

“In sum, the Court concludes that Plaintiffs are likely to demonstrate (former acting Homeland Security Secretary Kevin) McAleenan’s appointment was invalid under the agency’s applicable order of succession, and so he lacked the authority to amend the order of succession to ensure Wolf’s installation as Acting Secretary,” Judge Paula Xinis’ 69-page ruling said.

Xinis also wrote that “by extension, because Wolf filled the role of Acting Secretary without authority, he promulgated the challenged rules also ‘in excess of…authority,’ and not ‘in accordance with the law.'”

CNN has reached out to the department for comment.

The preliminary finding that Wolf is likely unlawfully serving in his position came as a part of temporarily blocking two asylum rules while the lawsuit over those rules is heard. The case is ongoing.

CNN has previously reported that the Government Accountability Office found that Wolf and Ken Cuccinelli, the senior official performing the duties of deputy secretary, were appointed as part of an invalid order of succession.

Washington (CNN)Attorney General William Barr made a series of false and misleading claims in a contentious interview with CNN’s Wolf Blitzer on Wednesday.

Barr also made additional claims that have not been proven or were lacking in context. Here are fact checks of some of his remarks.

Russian interference in the 2020 election

Blitzer noted that the intelligence community’s top elections official said that Russia is working to help President Donald Trump get elected, while both China and Iran prefer Democratic opponent Joe Biden to win. Blitzer asked Barr: “First of all, do you accept that Russia is once again interfering in the U.S. presidential election?”

Barr said, “I accept that there is some preliminary activity that suggests that they might try again.”

Facts First: The intelligence official, William R. Evanina, said that Russian interference is happening now, not that Russia “might” try to interfere. In an August statement, Evanina said, “We assess that Russia is using a range of measures to primarily denigrate former Vice President Biden and what it sees as an anti-Russia ‘establishment.'”

Barr went on to tell Blitzer that he was talking about two kinds of Russian activities: hacking emails to disclose embarrassing documents, and the use of social media. Evanina’s August statement said that Russian social media influence efforts were already underway: “Some Kremlin-linked actors are also seeking to boost President Trump’s candidacy on social media and Russian television.”

On Wednesday, ABC News reported that in July, the Department of Homeland Security withheld an intelligence bulletin warning of a Russian plot to spread misinformation regarding Biden’s mental health.

Mail voting and fraud

Barr said, “Elections that have been held with mail have found substantial fraud and coercion.”

Facts First: This is such an over-generalization, we can call it false: all evidence shows that fraud in mail voting is extremely rare. While a 2020 city council race in New Jersey and a 2018 congressional race in North Carolina were allegedly marred by substantial fraud involving mail ballots, such cases are highly uncommon. Jurisdictions that have long conducted elections primarily by mail, such as the reliably Republican state of Utah, have done so without significant incident.

Foreign countries and interference with mail voting

Blitzer asked Barr what is the basis for his claims that foreign countries could make a large number of fake ballots and send them in without detection, Barr said, “I’m basing that on logic.”

Facts First: Experts on voting say Barr’s “logic” is wrong. They say it would be extraordinarily difficult for a foreign country, or anyone else, to succeed with a counterfeit ballot scheme.

“Mail-in ballots are very hard to duplicate on the fly. Each jurisdiction has their own ballot format, form of paper, and races differ for voters by their respective districts,” Rick Hasen, a University of California professor of law and political science and a prominent expert on election law, wrote on Twitter.

“Ballot envelopes also often contain coding that helps election officials track them. Ballot forms must contain certain information that must be verified, like a signature, identification information, and sometimes witness requirements. These would all have to be faked, and done in a way to escape attention.”

“Of all the ridiculous schemes that have been floated by the President or AG (William) Barr for how mail-in ballot fraud could affect the election, the possibility of a foreign entity swaying election by mailing fraudulent absentee ballots is the most ludicrous,” said Hasen.

(CNN)Attorney General Bill Barr’s written opening statement to the House Judiciary Committee was replete with mischaracterizations, fallacies and unnerving stereotypes that run afoul of the principle of equal justice — and which, taken together, show how he has transformed the Department of Justice that enforces the law to a department that undermines the rule of law.

These are but a few lines that should evoke a visceral reaction to the views of a man who sits at the helm of the most powerful prosecutorial office in the country.

1. “Ever since I made it clear that I was going to do everything I could to get to the bottom of the grave abuses involved in the bogus ‘Russiagate’ scandal, many of the Democrats on this Committee have attempted to discredit me by conjuring up a narrative that I am simply the President’s factotum who disposes of criminal cases according to his instructions.”

No, Attorney General Barr, you are not being accused of being a factotum, colloquially defined as a handyman. You stand accused of being a henchman who acts not only under the President’s instructions but, perhaps more nefariously, exclusively in the President’s interests. And what conveys this impression is not a deceptive narrative crafted by the Democratic members of the House Judiciary Committee, but rather your own conduct.

Case in point: undermining career prosecutors in what appears to clearly be the interests of President Donald Trump. Not once can I recall an attorney general weighing in on a career prosecutor’s sentencing recommendations for a defendant convicted of multiple felonies by a jury. Yet, this appears to be an increasingly frequent endeavor by this Attorney General on behalf of Trump associates, including, most recently former National Security Adviser Michael Flynn and the President’s long-time friend Roger Stone.

The disturbing trend is underscored by the fact that the one convicted felon who has fallen out of the President’s favor, Trump’s former lawyer Michael Cohen, felt the knife twisted rather than removed when the Justice Department recently, albeit briefly, sent him back to prison under questionable 

And Barr’s misuse of terms continues with the use of the term “Russiagate.” The use of the suffix “gate” insinuates that it is conspiratorial, farcical and worthy of derision. And yet, the Attorney General has confirmed, as recently as today’s colloquy with Louisiana Rep. Cedric Richmond, that Russia did interfere with the past presidential election and will presumably continue to interfere with our upcoming presidential election. Perhaps the nod to conspiracy theorists was inadvertent in light of overwhelming evidence he fails to dispute.

2. “Like his predecessors, President Trump and his National Security Council have appropriately weighed in on law-enforcement decisions that directly implicate national security or foreign policy, because those decisions necessarily involve considerations that transcend typical prosecutorial factors.”

No one doubts the propriety of the President of the United States and members of his National Security Council to get involved in cases that directly implicate the national security of this nation or those matters that directly relate to our foreign policy interests. What is in doubt is whether Barr’s defense of deploying federal agents to US cities is anything more than a pretextual reason to infringe upon the constitutional rights of Americans, namely their First Amendment rights to assemble and to protest their grievances with the government. A bald assertion of a national security interest does not absolve the executive branch from having to provide an appropriate and lawful justification when constitutional rights are implicated. And yet Barr has offered no compelling reason.

3. “I had nothing to prove and had no desire to return to government. … When asked to consider returning, I did so because I revere the Department and believed my independence would allow me to help steer her back to her core mission of applying one standard of justice for everyone and enforcing the law even-handedly, without partisan considerations.”

This is just laughable. He had no desire to return to the government? I have a June 2018 memo that says otherwise. It was entirely unsolicited, offered Barr’s insight on special counsel Robert Mueller’s handling of an investigation into Russia’s interference in our presidential election and read like a solicitation for a job. And lo and behold, he got his wish. Now, Barr has launched an investigation into the origins of what he calls “Russiagate” that seems to track the very outline he presented when he, ahem, had no desire to put skin in the game.

Barr’s suggestion that he was compelled to return to the helm out of a sincere interest to restore the objectivity and credibility of the Department of Justice is belied by his decision-making. His sentencing decisions that seem to show political favor, his failure to justify the use of force against peaceful protestors and his involvement in the removal of Geoffrey Berman, the former Attorney General for the Southern District of New York, comprise just a handful of the many instances where his conduct has undermined — not restored — the credibility of the Justice Department.

It’s a familiar pattern. After “stonewalling” Congressional oversight, Administration Kakistocrat finally shows up and arrogantly spews lies, misrepresentations, and false narratives under oath. Dems spend their time lecturing and pontificating, but don’t create the factual record for a subsequent perjury prosecution. (Ask yourself: What if Laura Coates were doing the questioning?)

GOP toadies in Congress “circle the wagons” and double down on the lies showing their complete contempt for truth, human decency, and good governance.

We already knew Barr was a shady character and that the GOP is unfit for any office in any branch. So, this hearing didn’t really accomplish much.

But it does demonstrate the absolute necessity for the majority of us who want to save our nation to get out the vote to remove Trump and the GOP at every level 🧹 in November. 

This November, vote like your life depends on it! Because it does! Another four years of Trump’s racist malicious incompetence and the GOP kakistocracy could kill us all (including the truth-impervious Trumpsters and GOP toadies willing to seek the end of our democracy)! Victory for the “good guys” isn’t inevitable —  it will take lots of energy and continuing hard work to save our nation!👍🏼🗽🇺🇸
