This is an idea that Yliana Johansen-Méndez and I have been talking about for a long time and I am so excited to see it come to fruition at Immigrant Defenders Law Center. We need more Spanish speaking attorneys ready to fight for our communities, and there simply are not enough to fill the need that exists currently. So, let’s change that.

Compare this creativity and action with the moribund bureaucracies and weak, unimaginative, timid leadership at DHS, EOIR, and DOJ. The wrong folks are running the immigration bureaucracy, and doing a really lousy job of it!

This Administration might “nominally claim” to recognize the importance of representation for asylum seekers and other immigrants and to encourage it; but, their actions tell a much different story.

The dysfunctional chaos at EOIR, culture of denial, “Aimless Docket Reshuffling” on steroids, poor personnel and staffing choices, failure to establish a constructive dialogue with NGOs and the pro bono bar, and the simply jaw-dropping, avoidable “extreme user unfriendliness of almost everything at EOIR” has been a huge “turn off” for those who might be considering taking on pro bono, or even low bono, cases. If anything, some practitioners have told me that they are cutting back on their Immigration Court work because it has become so stressful, all encompassing, and discouraging.  

EOIR should  NOT be operating in this insane manner in a Dem Administration! But, unhappy fact is that it is!

“It’s a debate between those who think our openness as a democratic society is an advantage in the struggle with autocracies or a disadvantage,” Malinowski told me. “One of the central lessons of the Cold War was that it is an advantage. I just hope we choose the same strategy that won the Cold War.”

One thing that has changed since the Cold War is that now these skilled workers who are fleeing Russia and Hong Kong have more options. Some reports say 50,000 to 70,000 Russian tech workers fled to places such as Turkey, Georgia and the Baltic countries in the first weeks of the war in Ukraine. Hong Kong business leaders are decamping for Singapore. Canada has already expanded immigration for Hong Kongers with advanced degrees, and thousands are taking advantage.

The whole world is competing for the talents of those who are fleeing from Hong Kong and Putin’s Russia. Republicans’ excessive fear of immigration should not waste a strategic opportunity for the United States to strengthen itself and weaken its rivals at the same time. Congress should work to ensure that China’s and Russia’s losses are America’s gains.

WASHINGTON — Time was — not that long ago — that after a mass shooting, gun rights advocates would nod to the possibility of compromise before waiting for memories to fade and opposing any new legislation to regulate firearms.

This time, they skipped the preliminaries and jumped directly to opposition.

“The most effective tool for keeping kids safe is armed law enforcement on the campus,” Texas Republican Sen. Ted Cruz said to MSNBC a few hours after a shooter killed at least 21 people in Uvalde, Texas. “Inevitably, when there’s a murder of this kind, you see politicians try to politicize it. You see Democrats and a lot of folks in the media whose immediate solution is to try to restrict the constitutional rights of law-abiding citizens. That doesn’t work.”

The speed of that negative reaction provides the latest example of how, on one issue after another, the gap between blue America and red America has widened so much that even the idea of national agreement appears far-fetched. Many political figures no longer bother pretending to look for it.

And yet, significant agreement does exist.

Poll after poll has shown for years that large majorities of the public agree on at least some limited steps to further regulate firearms.

A survey last year by the Pew Research Center, for example, showed that, by 87% to 12%, Americans supported “preventing people with mental illnesses from purchasing guns.” By 81% to 18% they backed “making private gun sales and sales at gun shows subject to background checks.” And by a smaller but still healthy 64% to 36% they favored “banning high-capacity ammunition magazines that hold more than 10 rounds.”

The gunman in Uvalde appears to have carried seven 30-round magazines, authorities in Texas have said.

So why, in the face of such large majorities, does Congress repeatedly do nothing?

One powerful factor is the belief among many Americans that nothing lawmakers do will help the problem.

Asked in that same Pew survey whether mass shootings would decline if guns were harder to obtain, about half of Americans said they would go down, but 42% said it would make no difference. Other surveys have found much the same feeling among a large swath of Americans.

The argument about futility is one that opponents of change quickly turn to after a catastrophe. It’s a powerful rhetorical weapon against action.

“It wouldn’t prevent these shootings,” Sen. Marco Rubio (R-Fla.) said on CNN on Wednesday when asked about banning the sort of semiautomatic weapons used by the killer in Uvalde and by a gunman who killed 10 at a Buffalo, N.Y., supermarket 10 days earlier. “The truth of the matter is these people are going to commit these horrifying crimes — whether they have to use another weapon to do it, they’re going to figure out a way to do it.”

Republican Texas Gov. Greg Abbott made a similar claim at his news conference on Wednesday: “People who think that, ‘well, maybe we can just implement tougher gun laws, it’s gonna solve it’ — Chicago and L.A. and New York disprove that thesis.”

The facts powerfully suggest that’s not true.

Go back 15 years: In 2005, California had almost the same rate of deaths from guns as Florida or Texas. California had 9.5 firearms deaths per 100,000 people that year, Florida had 10 and Texas 11, according to data from the National Center for Health Statistics.

Since then, California repeatedly has tightened its gun laws, while Florida and Texas have moved in the opposite direction.

California’s rate of gun deaths has declined by 10% since 2005, even as the national rate has climbed in recent years. And Texas and Florida? Their rates of gun deaths have climbed 28% and 37% respectively. California now has one of the 10 lowest rates of gun deaths in the nation. Texas and Florida are headed in the wrong direction.

Obviously, factors beyond a state’s laws can affect the rate of firearms deaths. The national health statistics take into account differences in the age distribution of state populations, but they don’t control for every factor that might affect gun deaths.

Equally clearly, no law stops all shootings.

California’s strict laws didn’t stop the shooting at a Taiwanese church in Laguna Woods this month, and there’s no question that Chicago suffers from a large number of gun-related homicides despite strict gun control laws in Illinois. A large percentage of the guns used in those crimes come across the border from neighboring states with loose gun laws, research has shown.

The overall pattern is clear, and it reinforces the lesson from other countries, including Canada, Britain and Australia, which have tightened gun laws after horrific mass shootings: The states with America’s lowest rates of gun-related deaths all have strict gun laws; in states that allow easy availability of guns, more people die from them.

Fear of futility isn’t the only barrier to passage of national gun legislation.

Gun law opponents harden positions

Hard-core opponents of gun regulation have become more entrenched in their positions over the last decade.

Mostly conservative and Republican and especially prevalent in rural parts of the U.S., staunch opponents of any new legislation restricting firearms generally don’t see gun violence as a major problem but do see the weapons as a major part of their identity. In the Pew survey last year, just 18% of Republicans rated gun violence as one of the top problems facing the country, compared with 73% of Democrats. Other surveys have found much the same.

Strong opponents of gun control turn out in large numbers in Republican primaries, and they make any vote in favor of new restrictions politically toxic for Republican officeholders. In American politics today, where most congressional districts are gerrymandered to be safe for one party and only a few states swing back and forth politically, primaries matter far more to most lawmakers than do general elections.

Even in general elections, gun issues aren’t the top priority for most voters. Background checks and similar measures have wide support, but not necessarily urgent support.

Unfortunately, the much ballyhooed polls on this issue turn out to be highly misleading. The polls showing widespread support for gun control suggest that there should be a heavy political price to pay for GOP gun zealots who mock the need for rational measures to protect kids, worshippers, shoppers, and others from mass firearms’ assaults.

However, the exact opposite is true. As Chuck Todd recently pointed out on NBC News, even in the “post-Sandy-Hook” era, no incumbent politician has lost his or her position for opposing reasonable firearms controls. The converse is not true. 

Todd also pointed out that we now have more guns than people in the U.S., a situation that didn’t exist a decade ago. The irrational response to more gun deaths, lead by the NRA and GOP politicos, has been more guns — NOT common sense, concern for the common good, or courageous bipartisan problem solving.

That perhaps explains how sleazy immoral characters like Gov. Greg Abbott, Sen. Ted Cruz, VA Lt. Gov. Winsome Earle-Sears and a host of other corrupt “guns are the answer to all problems” GOP politicos remain in office as innocent kids and others die and the problem gets worse.

As the article suggests, lack of urgency and priority also might be a reason why the polls are so completely misleading on this issue. For the “guns trump human lives crowd,” adhering to positions promoting irresponsible “absolutist” firearms agendas are a “litmus test.” Apparently, for too many of those in the “majority,” saving some kids and other human lives is in the “nice to have, but not essential” category. 

So, despite their immoral and irrational stand on guns, the GOP controls a majority of state and local Governments. Nationally, thanks to the electoral college, gerrymandering, and local control of national voting, the GOP appears poised to sweep back into power on the national level and impose their anti-individual-liberty, anti-democracy, anti-humanity, pro-guns and big corporations agenda on all until the last shadow of American liberal democracy is wiped out.

It’s clear from the “in your face” reactions of Cruz and other GOP pols that they expect no fallout from their latest, deadly policy failures. Indeed, I think they fully anticipate a political boost from their ridiculous and widely-panned suggestions and their ever more outrageous fact-free “shoot ‘em up — ignore the real problem” proposals. Kid deaths and grieving parents who can be fobbed off or ignored have become a “gold mine” for valueless GOP politicos to exploit and demean.

Sadly, they probably are correct. Despite the perhaps “over coverage” by the media obsessed with public demonstrations, the GOP has little to fear politically from outraged parents of dead kids, students walking out of classes, newspaper editorials, or demonstrators outside the NRA Convention. 

Unless and until gun control proponents can find a way to make arrogant GOP pols on all levels “pay a price” for their immoral actions and horrible positions, the latest “surge in public sentiment” will be just as meaningless as the polls they engender. That means reaching out to the rural Americans who drive the GOP’s pro-gun agenda and changing at least some minds with facts. That’s something that Dems as a whole have failed to do over decades, as the GOP developed a stranglehold over rural America. 

While GOP politicos like Abbott and Cruz (who, let’s remember, fled with his family to a resort in Mexico while ordinary Texans suffered through Abbott’s mismanagement of the power grid) babble nonsense, parents who have lost children understand exactly who is to blame for preventable mass murders:

“There’s no reason for just an average citizen to have these types of weapons,” she said. Adding, “What for? What do you need them for? Is it worth my kid? These kids?”

Of course, as the article acknowledges, gun control won’t solve all problems or prevent all mass shootings. But, contrary to widely promoted GOP myths, such laws would be a major step in the right direction that demonstrably would preserve some human lives.

The GOP gun lobby’s outrageous “expand the universe of gun ownership and military-style firepower” agenda clearly results in more unnecessary deaths. Even more significantly, there is no case for the proposition that reasonable firearms restrictions and limitations on military assault-type weapons place any unreasonable burden on sportsmen, target shooters, or other types of legitimate gun owners. 

No private citizen in America needs an assault weapon for self defense or sporting purposes! Pro-gun commercials suggesting that assault weapons are necessary for self-defense at home or to “protect America” are the pure BS! But, they apparently are much more effective than angry demonstrations, school walkouts, or tearful testimonials from those deprived of their loved ones and colleagues by preventable mass gun violence.

Tougher laws might, however, stop at least a few kids or angry folks from getting their hands on military-grade weapons of mass destruction and murder. 

Significantly, it now appears that about the only folks who “did the right thing at the right time” during the Uvalde mass murder were the unarmed kids who, risking their lives, called, sometimes repeatedly, those authorized to use deadly force and assault-style weapons for public protection. But, it was largely to no avail, as the so-called “good guys with guns” stood around as kids died — they were afraid they might get shot by an 18-year-old kid armed like a combat soldier. Their teachers, not the “good guys with guns” were the ones willing to sacrifice their lives in an attempt to save others.

Also, while Texas seems to revel in “anti-Federalism,” it’s worth noting that the slaughter only stopped when Federal Border Patrol Officers ignored local police leaders and confronted the shooter.

Born in 1921, Motley was the first Black woman to argue at the Supreme Court and the first to serve as a federal judge. Democratic presidents twice considered — and twice rejected — her for a seat on a federal appeals court.

Motley, who went by Connie, faced countless indignities. She graduated from New York University and Columbia Law School, and a Wall Street firm offered her a job interview based on her stellar academic record. But the firm wouldn’t even meet with her when she showed up for the appointment because she was Black. Instead, she took a job at the NAACP Legal Defense Fund.

She was the only female lawyer at the Fund for 15 years. During her employment interview in 1945 with then Legal Defense Fund boss Thurgood Marshall, the future Supreme Court justice asked her to climb a ladder next to a bookshelf. “He wanted to inspect her legs and feminine form,” writes Tomiko Brown-Nagin in her compelling and readable new biography of Motley, “Civil Rights Queen.” When Marshall stepped down to become a judge in 1961, he passed over Motley and picked a less experienced White man as his successor.

Motley earned less than men who did the same work. Motley nonetheless won nine of the 10 cases she argued at the Supreme Court. As a new mother, struggling with postpartum depression, she drafted briefs for Brown v. Board of Education. Pursuing the implementation of the landmark decision turned out to be a decades-long slog. She successfully integrated the flagship universities in Georgia and Mississippi, where she was James Meredith’s attorney.

In 1965, Lyndon B. Johnson had intended to nominate Motley to take Marshall’s seat on the U.S. Court of Appeals for the 2nd Circuit when he resigned to become solicitor general — a stepping-stone to the Supreme Court in 1967. But then-Sen. Robert F. Kennedy (D-N.Y.), remembered by history as a civil rights champion, pressed Johnson to pick a White man over Motley for the appellate court. Kennedy called Attorney General Nicholas Katzenbach in July 1965 to complain that naming Motley would be too risky from a “political and public relations viewpoint.” Katzenbach summarized the call in a memo to Johnson. “I think there is merit in Sen. Kennedy’s assessment,” the attorney general told the president.

(Johnson nominated Motley to the District Court for the Southern District of New York a year later. The American Bar Association declined to give Motley a “highly qualified” rating on the dubious grounds that she lacked trial experience in New York, even though she’d litigated hundreds of cases in federal courts. Senate Judiciary Committee Chairman James O. Eastland (D-Miss.) accused her of being a communist sympathizer and held up Motley’s confirmation for seven months.)

A dozen years later, during Jimmy Carter’s presidency, Attorney General Griffin Bell had veto power over judicial nominations and opposed Motley’s elevation to the 2nd Circuit because they’d tangled when she was a lawyer for the Legal Defense Fund. Carter eventually nominated Amalya Kearse, a Black woman who was a partner at a major law firm and didn’t have critics inside his administration.

Along the way, Motley mentored Sonia Sotomayor after the future justice joined Motley’s court in 1992. Sotomayor, who in 1998 secured the 2nd Circuit appeals court seat that eluded Motley, famously wrote that “wise Latina” judges “would more often than not reach a better conclusion” than White male judges who lacked their lived experiences. Motley, who rejected being called a “feminist,” disagreed that female judges brought special insight to the bench. Instead, she argued for a more representative judiciary on the grounds that inclusion would strengthen democracy by increasing confidence in the rule of law among racial minorities.

Motley died in 2005 at 84, still believing in the ability of the third branch to help deliver on that promise. Biden’s pledge to name a Black woman to the Supreme Court is a validation of Motley’s enduring faith in a system that repeatedly passed her over.

The Thurgood Marshall story shows that it wasn’t only White men who undervalued Black women. Black men displayed some of the same disgusting and condescending attitudes! Motley just kept on achieving and contributing, making the most of her opportunities, rather than stewing about what had unfairly (and probably illegally) been denied to her.

Obviously, the careers of guys like GOP Senators Wicker, Cruz, and Kennedy show that White guys still benefit from a system that still doesn’t hold them to the same standards imposed on women, particularly talented women of color. See, e.g., https://apple.news/A-e_PL2khRhiEbrj_L7woCA

But, unlike these “snowflake right-wing whiners,” women of color are used to “plowing forward” and making their own way, despite systemic biases and obstacles placed in their path by men of limited ability who spread lies, show disgusting bias, and contribute little to the common good!

Folks, this is the same Ted Cruz who demonstrated his true character and lack of concern for his constituents by fleeing with his family to a cushy resort in Cancun while Texas was in crisis! He’s also someone who would deny legal refuge to those whose lives are actually in danger because they don’t “fit in” with his White Nationalist view of desirable demographics. (Compare “Cancun Ted’s” version of “refuge” with the camps in which real refugees and their families are rotting in Mexico thanks to righty-wing judges and GOP AGs.)

Perhaps the most interesting disconnect among the privileged GOP White guys who are opposing a Black woman nominee who hasn’t even been named yet is the juxtaposition with the performance of these dudes during the Kavanaugh confirmation hearings — an unending homage to the “birth privilege” of angry, entitled right-wing white guys. Here’s an apt quote from  Chauncey Devega in Salon:

When Trump says “young men,” no adjective or modifier is needed. It is clear to everyone, given his inclinations, history, words and deeds, that “young men” of course means “white men”.

This reflects a larger sentiment in America at present. For too many white men — poor, working-class and middle-class — there is widespread anger at somehow being displaced by nonwhites and women who are “cutting ahead in line” because of “affirmative action” and other nonexistent “entitlements.”

These angry white men feel obsolete and marginalized in a changing America, frustrated by globalization and excluded by a more cosmopolitan country. But their anger is misdirected toward the groups they perceive to be receiving “special treatment.” Their collective anger would be better directed at men who look like them but who have created social inequality, injustice and immiseration in America and around the world.

President Biden should stick to his guns and nominate a talented and deserving Black woman. It’s  long, long overdue! And, he should pay no attention whatsoever to the outrageous, totally disingenuous laminations of privileged guys like Cruz, Wicker, and Kennedy who have already “achieved” far above the level of their demonstrated merit, ability, or positive contributions to the common good. 

We need Federal Judges and Justices who are wise, fair, talented, experienced contributors to society; we don’t need the advice or “stamp of approval” of insurrectionists and dividers who rely on racially biased myths to cover for their own all too obvious human inadequacies!

If you’ve taken Econ 101, you were probably taught that the economy is a zero-sum game. If I win, another economic actor has to lose. One group’s gains mean another’s losses. The issue with that theory? It’s not only wrong, it’s dangerous: Nationalist leaders around the world have played on voters’ fears by threatening that the economic progress of immigrants and minorities will result in losses for everyone else.
The truth is, life isn’t a zero-sum game. A growing body of evidence actually shows that inclusion isn’t just compatible with economic growth – it’s absolutely necessary.
On this week’s episode of Nick Hanauer’s podcast Pitchfork Economics, JP Julien discusses a report that he co-wrote as a leader of global management consulting firm McKinsey & Company’s Institute for Black Economic Mobility. This think tank isn’t in the business of getting accolades from progressive circles – or conservative ones – it’s focused on the cold, hard data. Here’s what Julien told us about economic inclusion:
When more people can fully participate in the economy, we all win

Julien says that when people from all races and backgrounds are able to participate as workers, entrepreneurs, and consumers, the economy is stronger and more resilient. There’s already plenty of evidence for this theory: Between 1960 and 2010, 40% of GDP growth can be directly tied to women and people of color joining the labor force. “The data speaks quite clearly that the more we get people to participate, the better outcomes we produce,” Julien says.

Economic discrimination hurts all of us

There’s a staggering price tag on economic discrimination against people of color and women in America. In his paper, Julien found that eliminating wealth disparities between Black and white households and Hispanic and white households could add $2 to $3 trillion of incremental annual GDP to the U.S. economy. And if more women join the workforce over the coming years, we could add $2.1 trillion in GDP by 2025.

These gains aren’t zero-sum numbers; they don’t come at the expense of the economic value of white men – those numbers are in addition to that growth. That means America’s missing out on at least $5 trillion of economic activity because whole demographics have been shut out of the economy.

In his research, Julien found that corporations with more diverse boards and diverse leadership teams actually outperform their peers. It’s becoming impossible to ignore: DEI policies lead to a better and more profitable workplace.

For centuries, our economy has been constructed around exclusionary policies that shut out women and people of color – and this is discrimination is taking a toll on everyday Americans and our country’s economic growth. Couldn’t help thinking of these words as I listened to insurrectionist/traitor “Cancun Ted” Cruz pontificate about why it’s OK to exploit farmworker labor and mischaracterize a long-overdue and well-earned legal status as “amnesty” in responding to Sen. Alex Padilla (D-CA) during a hearing yesterday on helping farm workers.

Despite the noxious, racist, White Nationalist bogus rhetoric of Cruz, Gov. Gregg Abbott, and other GOP political hacks from the Lone Star State, Texas and its economy would indeed be in dire straits without the economic and cultural contributions of migrants, both documented and undocumented.  So would the rest of us without the essential services, productivity, and societal contributions of immigrants of all types. Indeed, without immigrants of all types, Native Americans would be the only inhabitants of America.

We need immigration laws and policies built on truth and optimism about the future, not the “beggar thy neighbor” White Nationalist myths of the nativist restrictionists!

The Republican senator Ted Cruz has drawn criticism for taking a trip to America’s southern border as the conservative Texan politician once again became the butt of internet jokes and memes.

In the style of a wildlife documentary, Cruz captured his experience with the help of professional photographers and shared his recent journey to the US-Mexico border Thursday night on social media, where he aimed to shed light on what Republicans have dubbed a crisis.

Despite his claims that the border situation is a direct result of the Biden administration’s immigration policies, residents in the Rio Grande Valley have said no such crisis exists. In fact, the number of border crossings under the Biden administration largely mirror those under the former Trump administration. Cruz was accompanied by 18 other Republican senators including John Cornyn, Susan Collins and Lindsey Graham.

After claiming he ran into heckling cartel members and saw a dead body floating in the Rio Grande, Cruz was derided by many, including the former congressman Beto O’Rourke who said:  “You’re in a border patrol boat armed with machine guns. The only threat you face is unarmed children and families who are seeking asylum (as well as the occasional heckler).”

Read more at the link about the GOP’s complete farce — while much more courageous individuals, asylum seekers, are forced to risk their lives because the U.S. is incapable of administering our own asylum laws in a fair, responsible, and competent manner. Cruz & co apparently view this as a “photo op.” Actually, it’s a human tragedy for which history will hold Cruz and his racist party largely responsible, even if the voters fail to do so.

The best solution is to hire experts from the private/NGO/academic sectors; build a functioning asylum and refugee system that will process applicants fairly, generously, predictably, and efficiently; reopen legal ports of entry; establish a robust “on site” refugee program for the Northern Triangle; and work with the international community to alleviate the causes of forced migration. Figure out how new arrivals who qualify for legal status can help rebuild our economy moving forward. Develop a humane program for returning those who don’t qualify without endangering their lives, health, and safety.

An absolutely essential part of the solution is a new, “reimagined” EOIR, staffed with real judges who are experts in asylum, human rights, and due process. An EOIR that will “through teamwork and innovation, be the world’s best courts, guaranteeing fairness and due process for all.” Judge Garland, where are you in American justice’s hour of dire need?

Leon Krauze in the WashPost tells us what’s really happening at the border. WARNING: It has little to do with the myths and false narratives being peddled by the GOP, the Administration, and the media.

The current emergency at the border has found the U. S. media at its most solipsistic. Coverage seems more focused on whether the emergency should be called “a crisis” (it should) and what the political fallout for the Biden administration will be. With few exceptions — like the remarkable work of MSNBC’s Jacob Soboroff or Politico’s Sabrina Rodriguez — many news outlets seem utterly uninterested in the stories of the migrants themselves.

This is wrong because it fails to provide one crucial piece of the puzzle: the very concrete context of human suffering.

This by no means excuses the stories of anguish and confinement that have emerged over the last few weeks from within the facilities set up by the Biden administration to deal with the number of young migrants crossing the border, nor does it absolve the president himself from delivering on his promise of a humane immigration system, diametrically opposed to Trump’s cruel policies, designed in collaboration with unapologetic racist xenophobes like Stephen Miller.

The Biden administration can and should do better. But the current debate cannot ignore the very concrete despair facing thousands of immigrant families who, under the direct threat of violence or abuse, chose to push their young children to the United States, in search of safety.

If the alternative was famine, gang violence, kidnapping, rape or sexual slavery, wouldn’t you bet it all on the journey north? If more people understood this, the political debate and the coverage surrounding the crisis would be much more empathetic and we would get closer at delivering concrete, humane solutions.

America’s immigration impasse — an endless loop across different administrations — is largely self-inflicted, because Congress has repeatedly failed to acknowledge one simple thing: Immigration happens.

Accordingly, immigration laws must be continually adjusted, reformed and revised, experts say.

“People will always want to come to the U.S., and the U.S. will always need people,” said former Commerce Secretary Carlos Gutierrez, who was a top immigration adviser to President George W. Bush.

Until there is a system that allows enough legal immigration to meet the economy’s needs, there will be illegal immigration, Gutierrez said.

“That’s just part of how our economy is set up. It’s part of demographics,” Gutierrez said. “Our birthrate is not high enough to be able to fill the needs of our economy.”

The coronavirus pandemic reinforced the importance of immigrant labor to the American economy, including labor by the undocumented.

It opened many Americans’ eyes to the precariousness of the U.S. food supply, which depends on immigrant and undocumented farmworkers and meat plant workers, as well as to other immigrants’ roles as essential workers, such as home health care aides, nurses and paramedics.

All of those people and many other immigrants, including young immigrants — often called “Dreamers” based on never-passed proposals in Congress called the DREAM Act — will play a key role in helping the economy recover from its pandemic bust.

But immigration requires periodic calibration, and the economics and the changing patterns are lost in the politics.

“People are going to move — as they are all around the world — where they think they can find places to better feed their children. That’s the bottom line, and that’s the history of migration to the United States,” said Luis Fraga, director of the Institute for Latino Studies at the University of Notre Dame.

Degrading Ourselves As A Nation Won’t Stop Human Migration

Notwithstanding the endlessly disingenuous and self-centered alarmist rhetoric coming from all directions on the border mess, often mindlessly regurgitated by the press (not just Fox News), the real “crisis” involves the human lives at stake and the unnecessary human misery we are causing by failing to establish, professionally staff, and fairly and competently operate the legal refugee and particularly asylum systems required by law. This “due process crisis” actually has devastating and debilitating practical effects, starting with the dysfunctional immigration, refugee, and asylum system and the beyond dysfunctional Immigration Courts.

Heck, we don’t even pretend to comply with Constitutionally-required due process of law for asylum seekers who present themselves to us seeking life-saving refuge. Most of those who show up at legally-established border ports are told that the border is “closed” and that there is no way for them to apply. OK, so they attempt to cross between ports and immediately present themselves to the Border Patrol. But, they also are told there is no way to apply and are orbited back to some of the most dangerous countries in the world without any process whatsoever, let alone due process of law. Who are we kidding with all our dishonest pontificating about “the rule of law?”

It’s a strange way to implement the statutory command that any foreign national “irrespective of . . . status, may apply for asylum,” along with a constitutional guarantee that “No person shall . . . be deprived of life, liberty, or property without due process of law.” Gee, you don’t even need one of those fancy Ivy League law degrees to understand that language. You just have to be able to read, comprehend, and act.

What you do have to do to get where we are today is to view asylum seekers and other migrants (predominantly people of color) as less than human — “non-persons” in a constitutional sense. It’s what some of us call “Dred Scottification of the other” and it has accelerated over the past four years — not just in immigration.

The whole idea of a “court system” being run by the Executive who also is the chief of enforcement is beyond constitutionally preposterous. It’s a “negative tribute” to the Supremes and other Article III life-tenured judges who have grown so distant from their own humanity and immigration stories as to become willfully blind to the ongoing farce that constitutes “justice” and “due process of law” for asylum seekers and other immigrants in the U.S.

Today’s nearly non-existent “asylum system” is a deadly and illegal “catch 22,” with the Supremes sitting in their marble palace refusing to do the primary task that justifies their continued existence: enforce the Constitution against Government misbehavior and in favor of the “little guys” and the “vulnerable.” No thanks, not up to the job! 

The real tragedy is that there are plenty of folks out here with the knowledge, integrity, courage, and ability to establish a legal system that would actually comply with out laws, our Constitution, and further offer the hope of constructively addressing some problems before refugees arrive at our borders. But, they remain “benched,” even by the Biden Team. So the “good guys”are going to keep attacking the corrupt and broken system in court and at the polls for as long as it takes to get some course correction — years, decades, centuries — ask most African Americans how long it takes to achieve the true justice that America promises to all, but historically has only delivered to some. 

In the long run, a fair system would undoubtedly accept many more legal refugees and asylum seekers. That’s what happens in refugee situations — it’s the core of what we call “forced migration” — when you sign on to international conventions intended to prevent the “next holocaust,” and you fairly and humanely apply the rules meant to protect refugees and those who face torture. And, as they have in the past, the overwhelming number of refugees and asylees, like the overwhelming majority of immigrants (essentially all of us, except Native Americans) will adapt, fit in, and contribute to the health, wealth, and future of our nation. They will change, but so will we — ultimately for the better!

Sure, America wouldn’t be as white, “Christian” (to the extent that adherence to a nominal Christian denomination, rather than actually performing Christ’s extremely difficult, self-sacrificing, risky, compassionate mission, defines Christianity), and nominally heterosexual as it was when White Nationalist myths and whitewashed history ruled the roost. But, it would be a better nation — one that actually has a chance of prospering, realizing the full potential of all its residents, and leading the world in the 21st century. A nation that could devote more human, natural, and monetary resources to building and exporting greatness, rather than to an endless stream of cruel, inhuman, stupid, and wasteful enforcement and deterrence gimmicks.

Bottom line, folks are going to come to America, as they have throughout history. Some will stay, some won’t. But, come they will, unless and until those like Trump and the GOP create such a mess that our own people start fleeing to foreign shores. Immigration, regardless of status, is a sign of strength. Xenophobia a sign of fatal weakness.

Our real choice isn’t whether we want to “close” borders, bar refugees, and abuse children as the Cottons, Cruzes, Millers, and Hawleys advocate. It’s whether we create a robust, orderly, rational legal system to screen, regulate, and distribute the inevitable flow or whether, as we have for the past decades, we force millions to reside and work underground — part of an “extralegal” or “black market” system that pols of both parties and those who profit from that underground system have created.

Sprawling mismanaged enforcement bureaucracies, dysfunctional “courts,” armies of publicly-paid lawyers defending the indefensible, for-profit civil prisons, big agriculture, hospitality giants, loads of upwardly mobile professionals who need child care to pursue careers, communities that live off of marketing ethnic culture, meat packing conglomerates, architects and construction firms who are “building America,” even news media fixated on hyping the problem rather than fixing it (see, e.g., yesterday’s Biden press conference), the list of those who profit from a talented, hard working, reliable, loyal, yet politically and socially disenfranchised, workforce is endless.

Even the GOP’s “Cotton-Cruz crowd” benefits from having an imaginary enemy to rant and rail and gin up hate against — safe in the knowledge that the tanking of our economy, upheaval of society, and possible threat to their privilege that would result from realizing their disingenuous call to boot the entire undocumented population will never happen. Their kids and grandkids can continue to reap the privilege that comes from exploiting an essential, yet politically neutered, workforce. It’s really more about institutionalizing racism to maintain economic and political power over the eventual non-white majority that drives their bogus and ugly narratives.

We can degrade ourselves as a nation, but it won’t stop human migration!

This was a failure that Sen. Cory Booker (D-N.J.) aimed to make clear when he asked Garland whether he was familiar with a biblical reference to justice that advises to “act justly and to love mercy.” Much of Booker’s questioning centered around racism within the criminal justice system — the disproportionate arrests of minorities, lousy legal representation for the poor, sentencing imbalances and the issue that caused Kennedy such befuddlement, implicit bias.

Garland acknowledged these issues, the flaws in the system, the need to change. And then he told in public, the story he’d told Booker in private about why he wanted to leave a lifetime appointment on the federal bench to do this job. It’s the most reasonable question, but one that so often is never asked: Why do you want to do this?

“This is the highest, best use of my one set of skills,” Garland said. “And so I want very much to be the kind of attorney general you’re saying I could be.”

And that would be one focused on protecting the rights of the greatest and the least — and even the worst. Punishment is part of the job. But it’s not the definition of justice.

Judge Garland’s awareness and humility are refreshing. But, unless he takes immediate action to redo EOIR and the rest of the DOJ’s immigration kakistocracy, it won’t mean much. 

Judge, it could have been YOUR family forced to suffer kidnapping, extortion, murder threats, family separation, and other overtly cruel and inhuman treatment in squalid camps in Mexico, waiting for “hearings” that would never come before “judges” known for denying almost 100% of claims regardless of merit! YOUR family’s plea for refugee could have been rejected by some nativist bureaucrat or “hand-selected by the prosecutor” “Deportation Judge” for specious, biased reasons!

YOUR family was welcomed! But what if the only thought had been how to “best deter” “you and others like you” from coming?

Maybe because you and yours are White and hail from Eastern Europe, the “rule of law” has a different meaning and impact than it would if you were Brown, Black, or some other “non-White” skin color and had the misfortune to be from a “shithole” country where we have no concern for what happens to humanity? Or, worse yet, what if your family’s claim had been based on your Grandmother’s gender status? You would really be out of luck under today’s overtly misogynist approach to refugee law flowing out of EOIR!

Then, where would you and your nice family be today? Would you even be? THOSE are the questions you should be asking yourself!

Unfortunately, it’s easy to see that folks like Cotton, Hawley, Cruz, and Kennedy will be deeply offended if you attack their White Nationalist privilege, views, and agendas in any meaningful way. 

And, if you actually make progress in holding the Capitol insurrectionists accountable, you’ll have to deal with the unapologetic, disingenuous, anti-democracy, insurrectionist actions of folks like Hawley and Cruz. That won’t be too “bipartisanly popular” with a GOP gang that just overwhelmingly worked and voted to ignore the evidence and “acquit” the “Chief Insurrectionist.”  Who, by the way, was a main purveyor of the institutionalized racism that infects EOIR and the rest of the DOJ. It’s no real secret that “America’s anti-democracy party” aids, abets, encourages, and exonerates White Supremacists and domestic terrorists. 

In the GOP world, “mercy” and “due process” are reserved for White guys like Trump, Flynn, Stone, White Supremacists, and “Q-Anoners.” Folks of color and migrants exist largely below the floor level of the GOP’s definition of “person” or “human.” For them, justice is a “hammer” to beat them into submission and punish them for asserting their rights.

So, restoring the rule of law at the DOJ is going to be a tough job —  you need to clean house and get the right folks (mostly from outside Government) in to help you. And, you must examine carefully the roles of many career civil servants who chose to be part of the problems outlined by Chairman Durbin in his opening remarks. 

You’re also going to have to “tune out” the criticism, harassment, and unhelpful “input” you’re likely to get from GOP legislators in both Houses who are firmly committed to the former regime’s White Nationalist agenda of “Dred Scottification,” disenfranchisement, nativism, and preventing equal justice for persons of color, of any status!

Think about all the reasons why you and your family are grateful for the treatment you received from our country. Then, think of the ways you could make those things a reality for all persons seeking refuge or just treatment, regardless of skin color, creed, or status. That’s the way you can “give back” at today’s DOJ! That’s the way you can be remembered as the “father of the diverse, representative, independent, due-process exemplifying 21st Century Immigration Judiciary!” 🧑🏽‍⚖️👩‍⚖️👨🏻‍⚖️

Quick: You’re a lawyer and your client is on trial for inciting a violent insurrection. The problem is, he’s guilty beyond a shadow of a doubt. Literally, there is no question whatsoever that he did what he’s been accused of—none! Whatsoever! And everyone knows it! To wonder if he’s guilty is to look at O.J. Simpson and think, “Well, the glove doesn’t fit, so who knows?” Nevertheless, you’ve been hired to defend him—after basically everyone else in your profession refused—and defend him you will! But how? If you’re Donald Trump’s attorneys, the answer is clearly: Lie, lie, play some Madonna clips, and lie some more.

There were far, far too many lies told over the course of Bruce Castor Jr., David Schoen, and Michael van der Veen’s presentation to catalog them all. In fact, it would be easier to simply point out the rare moments in which they did tell the truth. But, just for posterity’s sake, here were some of the biggest whoppers the defense team told as it claimed that Trump wasn’t responsible for the rally that took place at the Capitol on January 6:

  • Trump never intended for “the joint session [of Congress] be prevented from conducting its business”: This is obviously completely false and the reason we know that is because Trump repeatedly tried to get Mike Pence to stop Congress from doing just that, reportedly telling the V.P., “You can either go down in history as a patriot, or you can go down in history as a pussy.”

 

  • The rioters were mostly antifa, and one of the first people arrested was a member of the left-wing group: This, like virtually all of Trump’s lawyers’ claims are not true. The first person arrested was John E. Sullivan, who has denied being a member of antifa, and the FBI has said there is zero evidence that the supporters’ movements participated in the riot, no matter what Trump’s most shameless loyalists say. (Rep. Matt Gaetz, for instance, falsely claimed, “They were masquerading as Trump supporters and, in fact, were members of the violent terrorist group antifa.”)

 

  • A prior protest in front of the White House was just as bad: Referring to the June protest in front of the White House, van der Veen claimed “violent rioters” attacked officers and “at one point, pierced a security wall, culminating in the clearing of Lafayette Square.” (1) There was no breach; (2) five people didn’t die (3) the people who were hurt were the protesters tear-gassed so that Trump could do a photo shoot with a bible outside a church (an event that, surprisingly, did not result in him bursting into flames).

 

 

  • “The reality is Mr. Trump not in any way shape or form instructing these people to fight or use physical violence. What he was instructing them to do was to challenge their opponents in primary elections, to push for sweeping election reforms, to hold Big Tech responsible—all customary and legal ways to petition your government for redress of grievances which of course is also protected Constitutional speech.” Right, right, sure, sure. Trump totally wasn’t encouraging his supporters to air their grievances via violence, he just wanted them to push for election reforms. He just wanted them to form political action committees, you see! Run for office! Fight ideological differences at the ballot box! It’s actually extremely impressive van der Ween was able to get through this whole thing without bursting into laughter, and for that he should win some kind of award (and then lose his license to practice law).

 

  • “There was no insurrection”: There was! We all saw it! If you missed it, just google “Capitol riot” or “Capitol attack” or “Trump insurrection.”

In addition to the many lies told by Trump’s defense, his legal team also proffered a series of arguments for why he couldn’t possibly be found guilty that sound like something a bunch of stoned college kids came up with shortly before a mock trial they forgot to prepare for, which is actually an insult to stoned college kids unprepared for mock trials. Specifically, we’re talking about the series of clips the defense presented showing various Democrats using the word “fight,“ which they claim means Trump can’t also be held responsible for telling his supporters to “fight,“ because other people have said “fight” before and they weren’t found guilty of inciting insurrections. (Naturally, they left out the part about how, for instance, when Elizabeth Warren told supporters to “fight” they didn’t proceed to storm the Capitol and try to burn down democracy):

Of course, the bald-faced lies and complete lack of convincing arguments will clearly do little to sway the majority of Republicans, who have already decided how they’re going to vote, which we know because they‘ve already said as much and also because during the question-and-answer portion of the day, a typical question posed of the attorneys went something like, “Can you tell us how it’s possible that President Trump has not been named People’s Sexiest Man Alive yet? Is it because the media is in the can for liberals? Because we can’t think of another explanation!”

CNN reports that the ex-president insisted the rioters were patriots in a call with House leader Kevin McCarthy:

In an expletive-laced phone call with House Republican leader Kevin McCarthy while the Capitol was under attack, then President Donald Trump said the rioters cared more about the election results than McCarthy did. “Well, Kevin, I guess these people are more upset about the election than you are,” Trump said, according to lawmakers who were briefed on the call afterward by McCarthy.

McCarthy insisted that the rioters were Trump’s supporters and begged Trump to call them off. Trump’s comment set off what Republican lawmakers familiar with the call described as a shouting match between the two men. A furious McCarthy told the president the rioters were breaking into his office through the windows, and asked Trump, “Who the f–k do you think you are talking to?” according to a Republican lawmaker familiar with the call.

“I think it speaks to the former president’s mindset,” Rep. Anthony Gonzalez, an Ohio Republican who voted to impeach Trump last month, told CNN. “He was not sorry to see his unyieldingly loyal vice president or the Congress under attack by the mob he inspired. In fact, it seems he was happy about it or at the least enjoyed the scenes that were horrifying to most Americans across the country.”

In reality, as others have observed, the “defense team” could have read old copies of the Congressional Record or all the baseball scores from the 2019 season from the podium and it wouldn’t have made any difference to corrupt GOP Sens who had already decided to acquit notwithstanding the overwhelming evidence of guilt. 

The indifference and boredom with the suffering of others and the clear misdeeds of Trump exhibited by scumbags like Cruz (who actually helped prepare the inept “defense”), Hawley, Cotton, et al, was pretty telling. Obviously, they wouldn’t have cared a fig if Trump’s rioters had done in Pence, Romney, or any other of their “colleagues.” 

It’s all about the next election and destroying American democracy. 

My favorite part is when the Trump defense Team kept whining about the rights of 74 million who voted for the The Big Clown. It’s like their attempt to disenfranchise and diss the 81+ million of us who didn’t vote for Putin’s Puppet are irrelevant? But, that’s always been the way the “modern GOP” has “governed.” 

Right now, the GOP is hard at work at the state level trying to disenfranchise as many Black and Brown voters as possible in advance of the 2022 elections. 

Remember all the great “bipartisanship” and concern with the legislative process on the tax giveaway (nobody actually read it, clearly not Trump) or the unsuccessful attempt to “do in” Obamacare. Lots of great “bipartisanship” on display with the Coney Barrett confirmation and the confirmation of a steady stream of Federalist Society judges.

The current GOP is an ongoing threat to the national security and well-being of our nation.

Then-President Donald Trump in early January entertained a plan to replace the acting attorney general with a different Justice Department lawyer who was more amenable to pursuing his unfounded claims of voter fraud, nearly touching off a crisis at the country’s premier federal law enforcement institution, people familiar with the matter said.

The plan — if enacted — would have pushed out Jeffrey Rosen as the acting attorney general and installed in his place Jeffrey Clark, whom Trump had appointed to lead the Justice Department’s Environment and Natural Resources Division and who later would come to lead the Civil Division. Clark, then, could have taken steps to wield the Justice Department’s power to help keep Trump in office. But the president was ultimately dissuaded from moving forward after a high-stakes meeting with those involved, the people said.

The people spoke on the condition of anonymity to discuss a politically sensitive matter. The move was first reported by the New York Times. Legal analysts said it amounted to a disastrous attack on the Justice Department’s independence, and perhaps something worse.

“Before the insurrectionist assault on the US Capitol, there was an attempted coup at the Justice Dept. — fomented by the President of the United States,” former Justice Department official David Laufman wrote on Twitter.

A Justice Department spokesman declined to comment, as did Rosen.

So, after their failed coup attempt, the “Party of Treason” 🏴‍☠️☠️is suddenly making bogus calls for “unity” and “healing.” Of course, there is nothing whatsoever stopping any Republican from denouncing Trump and his followers, announcing support for impeachment of the Traitor, and calling for all Americans to unify behind the Biden-Harris Administration. But, that’s not what’s happening.

No, somehow the GOP treasonists outrageously believe it’s Joe Biden’s job to “call off the dogs of justice” and “heal” the country from the unmitigated disaster caused by GOP misrule ending in a failed coup. (Did I mention that due to the totally disgraceful, maliciously incompetent handling of the worst public health emergency in more than a century, one that the GOP consistently downplayed, mocked, and denied, the US has the world’s worst record and is now on the way to over a half a million COVID deaths with millions unemployed!) While admitting no wrongdoing on their part, “traitor twerps” like Graham now think that Biden should absolve them of any wrongdoing and move forward as if the GOP attack on our nation had never happened.

This election was over on November 7, when the major networks finally called it. 

At that point, Biden had not only in insurmountable lead in the electoral college, but also a significant and growing lead in the popular vote. No candidate has ever overcome margins like that to win a Presidential election. All others similarly situated have conceded. Therefore, Trump should have conceded and the GOP congratulated the President Elect and his running mate.

Instead, the GOP lined behind Traitor Trump’s fascist fabricated election fraud claims! (Was it surprising that a “President” who told thousands of bald-faced lies starting from day one would continue to lie?). “Count all the votes” said the GOP treasonists, while actively trying to prevent state and local officials from doing just that. 

Of course all the counts and recounts confirmed all of the Biden wins, some even adding a few votes to his margins. Then, the GOP “battle cry” became “Wait for the courts to rule.” This “process” (actually an outrageous abuse of legal process) resulted in an impressive streak of more than 50 consecutive losses for the Trump frivolous/obstructionist/unethical/conspiracy theory mongering “litigation team” of sleazy lawyers in courts at all levels from judges appointed by both Dems and the GOP, some by Trump himself. 

Then it was “Wait for the states to certify” while again trying to interfere with that process. Once the states, including ones firmly controlled by the GOP, certified the results and Biden’s win, the bogus GOP party line became “Wait for the Electoral College.” Of course, that, in turn, voted for Biden exactly as the states had certified, despite Trump’s attempts to interfere.

But, still the GOP treasonists kept on with their knowingly false narratives. This time, it was “Wait for Congress to accept the results” a purely ceremonial process that has never resulted in a change of outcome. 

Nevertheless, Trump invited, actually urged, his followers to come to D.C. and stage a violent insurrection at the Capitol in a vain attempt to prevent the Congressional process from being completed. He also urged Vice President Pence (usually a reliable, anti-democracy toady) to violate his constitutional oath by throwing the election to Trump. By this time, it was clear that Biden had won the popular vote by more than 7 million — which would have made a Trump “victory” the biggest anti-democracy “steal” and disenfranchisement in American history.

Nevertheless, Cruz, Hawley, McCarthy and a host of other GOP legislators continued to commit treason by pressing Trump’s baseless insurrectionist theories, and pressing to disenfranchise millions of Biden voters across the nation, even as the debris from their failed coup still littered the Capitol. 

Now that their coup has failed, and there is at least a chance, however unlikely, that the Party of Treason 🏴‍☠️and some of its supporters 🦹🏿‍♂️ will be held accountable, these traitors have the absolute audacity to basically demand that Biden “bail them out” in the name of “national unity.”

I call BS! As Steve points out, history shows that failing to hold accountable those responsible for a failed coup merely insures that another coup will take place!

America will not be safe for the majority of us until the GOP is forever disempowered as a political force and Graham, Cruz, Hawley, McCarthy, and rest of the of the GOP traitors are held accountable for their treason.

Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.”

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

  The lie outlasts the liar. 

The idea that Germany lost the First World War in 1918 because of a Jewish “stab in the back” was 15 years old when Hitler came to power. How will Trump’s myth of victimhood function in American life 15 years from now? And to whose benefit?

On Jan. 7, Trump called for a peaceful transition of power, implicitly conceding that his putsch had failed. Even then, though, he repeated and even amplified his electoral fiction: It was now a sacred cause for which people had sacrificed. Trump’s imagined stab in the back will live on chiefly thanks to its endorsement by members of Congress. In November and December 2020, Republicans repeated it, giving it a life it would not otherwise have had. In retrospect, it now seems as though the last shaky compromise between the gamers and the breakers was the idea that Trump should have every chance to prove that wrong had been done to him. That position implicitly endorsed the big lie for Trump supporters who were inclined to believe it. It failed to restrain Trump, whose big lie only grew bigger.

The breakers and the gamers then saw a different world ahead, where the big lie was either a treasure to be had or a danger to be avoided. The breakers had no choice but to rush to be first to claim to believe in it. Because the breakers Josh Hawley and Ted Cruz must compete to claim the brimstone and bile, the gamers were forced to reveal their own hand, and the division within the Republican coalition became visible on Jan. 6. The invasion of the Capitol only reinforced this division. To be sure, a few senators withdrew their objections, but Cruz and Hawley moved forward anyway, along with six other senators. More than 100 representatives doubled down on the big lie. Some, like Matt Gaetz, even added their own flourishes, such as the claim that the mob was led not by Trump’s supporters but by his opponents.

Trump is, for now, the martyr in chief, the high priest of the big lie. He is the leader of the breakers, at least in the minds of his supporters. By now, the gamers do not want Trump around. Discredited in his last weeks, he is useless; shorn of the obligations of the presidency, he will become embarrassing again, much as he was in 2015. Unable to provide cover for their gamesmanship, he will be irrelevant to their daily purposes. But the breakers have an even stronger reason to see Trump disappear: It is impossible to inherit from someone who is still around. Seizing Trump’s big lie might appear to be a gesture of support. In fact it expresses a wish for his political death. Transforming the myth from one about Trump to one about the nation will be easier when he is out of the way.

As Cruz and Hawley may learn, to tell the big lie is to be owned by it. Just because you have sold your soul does not mean that you have driven a hard bargain. Hawley shies from no level of hypocrisy; the son of a banker, educated at Stanford University and Yale Law School, he denounces elites. Insofar as Cruz was thought to have a principle, it was that of states’ rights, which Trump’s calls to action brazenly violated. A joint statement Cruz issued about the senators’ challenge to the vote nicely captured the post-truth aspect of the whole: It never alleged that there was fraud, only that there were allegations of fraud. Allegations of allegations, allegations all the way down.

The big lie requires commitment. When Republican gamers do not exhibit enough of that, Republican breakers call them “RINOs”: Republicans in name only. This term once suggested a lack of ideological commitment. It now means an unwillingness to throw away an election. The gamers, in response, close ranks around the Constitution and speak of principles and traditions. The breakers must all know (with the possible exception of the Alabama senator Tommy Tuberville) that they are participating in a sham, but they will have an audience of tens of millions who do not.

If Trump remains present in American political life, he will surely repeat his big lie incessantly. Hawley and Cruz and the other breakers share responsibility for where this leads. Cruz and Hawley seem to be running for president. Yet what does it mean to be a candidate for office and denounce voting? If you claim that the other side has cheated, and your supporters believe you, they will expect you to cheat yourself. By defending Trump’s big lie on Jan. 6, they set a precedent: A Republican presidential candidate who loses an election should be appointed anyway by Congress. Republicans in the future, at least breaker candidates for president, will presumably have a Plan A, to win and win, and a Plan B, to lose and win. No fraud is necessary; only allegations that there are allegations of fraud. Truth is to be replaced by spectacle, facts by faith.

Trump’s coup attempt of 2020-21, like other failed coup attempts, is a warning for those who care about the rule of law and a lesson for those who do not. His pre-fascism revealed a possibility for American politics. For a coup to work in 2024, the breakers will require something that Trump never quite had: an angry minority, organized for nationwide violence, ready to add intimidation to an election. Four years of amplifying a big lie just might get them this. To claim that the other side stole an election is to promise to steal one yourself. It is also to claim that the other side deserves to be punished.

Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.

Our big lie is typically American, wrapped in our odd electoral system, depending upon our particular traditions of racism. Yet our big lie is also structurally fascist, with its extreme mendacity, its conspiratorial thinking, its reversal of perpetrators and victims and its implication that the world is divided into us and them. To keep it going for four years courts terrorism and assassination.

When that violence comes, the breakers will have to react. If they embrace it, they become the fascist faction. The Republican Party will be divided, at least for a time. One can of course imagine a dismal reunification: A breaker candidate loses a narrow presidential election in November 2024 and cries fraud, the Republicans win both houses of Congress and rioters in the street, educated by four years of the big lie, demand what they see as justice. Would the gamers stand on principle if those were the circumstances of Jan. 6, 2025?

To be sure, this moment is also a chance. It is possible that a divided Republican Party might better serve American democracy; that the gamers, separated from the breakers, might start to think of policy as a way to win elections. It is very likely that the Biden-Harris administration will have an easier first few months than expected; perhaps obstructionism will give way, at least among a few Republicans and for a short time, to a moment of self-questioning. Politicians who want Trumpism to end have a simple way forward: Tell the truth about the election.

America will not survive the big lie just because a liar is separated from power. It will need a thoughtful repluralization of media and a commitment to facts as a public good. The racism structured into every aspect of the coup attempt is a call to heed our own history. Serious attention to the past helps us to see risks but also suggests future possibility. We cannot be a democratic republic if we tell lies about race, big or small. We cannot be a democratic republic if we tell lies about race, big or small. Democracy is not about minimizing the vote nor ignoring it, neither a matter of gaming nor of breaking a system, but of accepting the equality of others, heeding their voices and counting their votes.

Professor Snyder’s last sentence encapsulates my own view of what 21st Century American Democracy should look and act like:

I still hear GOP politicos falsely claim that “nobody could see this coming.” What total unadulterated BS! 💩 Trump planned and instigated this insurrection of thugs in public, even while his goons Cruz, Hawley, and McCarthy were actively promoting it in Congress and Moscow Mitch was more or less “in his shell” looking the other way. Republican National Committee Chairwoman Ronna McDaniel was unanimously reelected on Friday for another term. Her message to the party: “I am mad and I’m not going to let socialism rule this country.”

Newsflash: It wasn’t the radical left that stormed the doors of the Capitol on Wednesday. It wasn’t the radical left that told a group of known white nationalists to “stand by” during a nationally televised presidential debate. It wasn’t the radical left that addressed the soon-to-be rioters and declared to members of Congress that “we’re coming for you.” It wasn’t the radical left who on the eve of the Capitol siege announced their plans to walk the path to sedition.

The only “radical” elements America sees now are the words and actions of the Republican Party. Yet Republicans have forever gotten away with throwing around the label “radical” to characterize the Democratic Party.

How many times in political ads have Republicans used the words “radical” and “dangerous” to describe their Democratic challengers? How many Fox News segments have Sean Hannity and friends devoted to the Democrats’ “radical extreme socialist agenda”?

What happened on Wednesday was an inevitable culmination of years of extreme and alarmist rhetoric from the Republican Party and their propaganda platforms. Watching Republicans act shocked that the people they have relentlessly and unapologetically pandered to for years is appalling.

With every tweet, every soundbite, every campaign ad, Republicans have been signaling to their supporters that it’s time to take matters in their hands. When you label something as “radical” or “extreme” or “dangerous,” you are telling people they need to defend themselves against a threat. You are telling them they need to be ready to fight. You are telling them their impulse to resort to violence and destruction is justified and righteous.

There is absolutely nothing radical or extreme about protesting racial inequality, social injustice and a culture of police brutality in America. There is nothing radical or extreme about speaking out for gender equality and women’s rights. There is nothing radical or extreme about advocating for universal healthcare coverage. There is nothing radical or extreme about supporting action to address the growing threat of climate change. There is nothing radical or extreme about wanting corporations to pay their fair share of taxes. There is nothing radical or extreme about embracing the need for gun reform in the wake of mass shootings. There is nothing radical or extreme about wearing a mask and social distancing amid a global pandemic that has taken the lives of more than 365,000 Americans.

The extremists are the ones who egged on the insurrectionists with four years of lies. Republicans may be abandoning the sinking Trump ship, but don’t let this 11th-hour maneuver fool you. That even after Wednesday’s events Republicans in Congress and in the media are still clinging to the “radical socialist agenda” narrative shows they haven’t changed — though they are scurrying to launder their tattered reputations.

Don’t believe me?

Just watch how many of them will vote to support articles of impeachment if the Democrats bring those to the House floor next week.
