Human Rights First Welcomes Resettlement, Condemns Bars to Asylum Seekers

WASHINGTON – Human Rights First welcomes today’s announcement of the Biden administration’s plans to expand refugee resettlement and family reunification parole in the Americas while reiterating the organization’s call for the administration to abandon its planned asylum ban and the conduct of fast-track credible fear interviews in Border Patrol custody.

“The Biden administration is rightly expanding refugee resettlement from the Americas, an overdue step towards addressing a long-standing gap for people in need of international protection,” said Senior Director of Refugee Protection Eleanor Acer. “This initiative should swiftly bring refugees to safety and not be used to reduce the resettlement of refugees from other regions. The Biden administration should focus on measures like increasing refugee resettlement and regular pathways and abandon its plan to impose an asylum ban that would be a legal, moral, and political mistake.”

In today’s announcement, the Biden administration confirmed its plans to implement its proposed ban on asylum, which would violate U.S. and international refugee law and has sparked widespread opposition from faith leaders, civil rights organizations, unions, and many Members of Congress. People seeking asylum at United States borders will be subjected to fast-track credible fear interviews while in Border Patrol custody and barred under the asylum ban, fueling wrongful deportations to persecution and torture.

“The Biden administration rightly ended and should not resurrect Trump-era policies that conduct credible fear interviews in Border Patrol custody where access to legal counsel is restricted,” Acer said. “This due process disaster, along with the imposition of the planned asylum ban, will be a sham process for deporting refugees who qualify for asylum. Instead of implementing policies that punish people seeking asylum, the United States should lead in upholding refugee protections and human rights.”

Human Rights First and other groups have long urged the U.S. government to step up refugee resettlement from the Americas and offer safe pathways for migration. We recommend the Biden administration focus on transformational steps like increasing refugee resettlement and regular pathways and maximizing asylum capacity at ports of entry rather than pursuing its misguided plan to impose a new bar on asylum.

Today’s announcements are part of the Biden administration’s plans to address regional migration and initiate punitive policies as the use of the Title 42 public health order ends on May 11. Human Rights First has repeatedly documented human rights abuses inflicted by the Title 42 policy, including over 13,000 attacks against migrants and asylum seekers blocked in or expelled to Mexico under Title 42 during the Biden administration. The organization has also repeatedly detailed the harms and violations of law that would be caused by the Biden administration’s proposed ban on asylum.

To me, the DHS/DOS statement (referenced by HRF) sounds like folks who expect to fail, want to “tamp down” expectations, and intend to blame the victims (asylum seekers and their advocates) and Congress for their (likely) failure.

Almost everybody agrees that reforms in our immigration system are overdue. But, there is no agreement whatsoever in Congress on what those reforms should be, as shown by the absolutely insanely “bonkers” proposal from the House GOP which seeks to make everything infinitely worse!

So, we’re not going to get the needed expansions and simplification of our legal immigration system, including more generous treatment of refugees and asylum seekers, in the foreseeable future. That’s not a surprise! After two plus years in office, the Biden Administration should have foreseen the obvious and come up with ways to make the current law work. 

As almost any expert will tell you, our existing legal asylum system can be made to work in a fair, timely, and reasonable manner at the borders. But, that’s not going to happen with the current personal, poor leadership, bad attitudes, lousy precedents, and a badly failed Immigration Court system.

A fair, functional, properly run asylum system, in conjunction with a robust realistic overseas refugee program, will result in more individuals being admitted into the U.S. as legal immigrants through the refugee and asylum processes. That’s how they are supposed to work (but generally have not) as key components of our legal immigration system.

It’s also a fulfillment of our important international obligations that we intentionally took on after our questionable performance on Jews fleeing Europe just prior to, and even during, WWII. While we can absorb, even need, more legal immigrants, Administrations don’t want to admit and deal with the obvious. Forced refugee migrations aren’t going to disappear any time in the foreseeable future, much as politicos of both parties might want them to!

Yes, these are legacies of the Trump Administration, and, to a lesser extent, the Obama Administration. But, one of the reasons why the Biden Administration is in office is to make things work, not just to whine and wring their hands.  

Sure, the Trump Administration undermined the rule of law (and, I might add, largely got away with it). But, that’s no excuse for Biden and Harris not to have listened to experts (like, for example, Eleanor Acer), replaced personnel at DHS and DOJ with “practical experts” who can get the job done, and established at least a working operational framework for a successful, orderly, refugee and asylum admission system. Over-relying on coercive and inhumane detention, denial-oriented decision-making, bogus bars to asylum, criminal prosecutions, threats, and a dysfunctional Immigration Court system are NOT that framework.

Of course the Administration’s proposals to increase refugee admissions, reprogram resources, and develop a better resettlement program for refugees and asylees in the U.S. are good ideas. But, they are basically “no brainers” that HRF and other experts urged even before “day one” of this Administration. They should be in place and operating by now! We’ll see how much due process and fairness this Administration can actually deliver, or whether their proposed solutions devolve into yet another “uber-enforcement fueled” fiasco with the most vulnerable humans as the victims!

As I always say: “Better Judges for a better America!” This a step forward, although we still have a long way to go to repair the extensive damage inflicted on the Federal Judiciary by Trump & McConnell.

Moreover, as I will discuss below, one of America’s most important (and readily “improvable”) judiciaries, one completely controlled by the Biden Administration, the U.S. Immigration Court, has actually taken steps backward in terms of progressive appointments under Garland. It’s like a new coach taking over in the 4th quarter of a game his team is losing 48-7 and saying “OK, let’s spot them another 17 points before we start playing to win!” Incredible, yet, sadly, true!

As the latest census shows an increasingly diverse America, the Article III Federal Judiciary remains an embarrassing backwater of “non-diversity.” This was intentionally aggravated by Trump & McConnell who, as noted above, elevated primarily White ultra right wing men, many with thin or questionable qualifications, to the Federal Bench!

As stated above:

It is crucial that the more than 1.1 million immigrants and nearly 1 million Latinx people in Washington feel that they are represented on the courts by people who share their experiences and identities.

Evidently, AG Merrick Garland and his team @ DOJ haven’t gotten that message. So far, Garland’s appointments to the Immigration Court, and the composition of his BIA, look more like Stephen Miller’s, Billy Barr’s, and Jeff “Gonzo Apocalypto” Sessions’s “skewed whitewashed vision” of America than they do the real America. That’s particularly true when you consider the American communities whose lives and futures are existentially affected (primarily adversely) by substandard and biased EOIR decisions that continue to be cranked out under Garland. This is despite a few moves by Garland to “kill off” the most horrible of the many bad precedents cranked out by the AG and the BIA during the Trump regime.

Judge Estrada sounds like just the type of individual that Garland should be appointing to the U.S. Immigration Court and the BIA. Compare Judge Estrada’s experience, qualifications, and “real life” background and human engagement with the lackluster profiles of Immigration Judges recently appointed by Garland and with many of those appointed to the Immigration Court and the BIA over the past two decades.

There are plenty of diverse, extraordinarily talented, courageous, practical experts out there in the NDPA to reform and improve the EOIR Judiciary at all levels! Many haven’t applied in the past (or have had their applicants rejected in favor of lesser-qualified candidates) because of the White Nationalist, xenophobic, nativist tone set by Sessions and Barr. Indeed, I spoke over the weekend to one of the leading progressive immigration/human rights experts in America who felt that way. Obviously, I encouraged that “NDPA superstar” to submit the applications — not just for EOIR but also for the Article III Judiciary which also needs to get its act together on human rights, immigration, and racial justice.

Garland & team need to reform and improve the selection criteria, involve outside expert input, and then actively recruit the “best and the brightest” from the NDPA to remake and elevate the Immigration Judiciary! As I have mentioned before, my colleagues in the Round Table and I have done more outreach, cajoling, inspiring, and recruiting among the progressive immigration and human rights community to apply for EOIR jobs than have those at DOJ and elsewhere in the Administration whose job it should be to do just that! It’s ridiculous, and it’s wrong!

No wonder things continue to be an ungodly mess at EOIR despite mountains of blueprints, action plans, and other readily achievable reform recommendations and proposed improvements produced by practical experts in the immigration/human rights/racial justice community! The Immigration Judiciary cries out for diverse, progressive, talented, practical scholar “role models” drawn from the NDPA! 

Lucas Guttentag, are you listening somewhere out there? Don’t get co-opted by the DOJ bureaucracy that overall failed to stand up to Trump and his gang of insurrectionists! Don’t let the new leadership at DOJ “de-prioritize or back burner” essential, long overdue, achievable EOIR reforms! Expose “Obamathink revolution by evolution” as the ridiculous and dangerous nonsense that it is (and always was)! Fight for your ideals, speak out, and shake up this disastrously broken and unfair system with the progressive change we need! At this point in your distinguished career, what do you have to lose? Those who consciously chose “not to rock the boat” at EOIR in the past, when human lives, due process, and human dignity were at stake, now share in the responsibility for its sinking!

Court Orders Release of ICE Prisoner: Pimentel-Estrada v. Barr

“Today U.S. District Court Judge Richard Martinez ordered the federal government to release an immigrant detained at the Northwest Detention Center (NWDC), AKA Northwest ICE Processing Center (NWIPC), who is at high risk of serious illness or death if he contracts COVID-19. The Court ordered the release of Mr. Pimentel, a 65-year old man who has been a lawful permanent resident in the United States since 1996, but was placed in removal proceedings after pleading guilty to a drug offense. After completing his sentence, Mr. Pimentel returned to live with his family in Salt Lake City, Utah, but was subsequently arrested by ICE in May of 2019 after he appeared for an appointment. ICE ultimately transferred Mr. Pimentel to the detention center in Tacoma, Washington.

Judge Martinez found that federal immigration authorities “detain Petitioner at the NWIPC in conditions that create a substantial risk he will be exposed to the coronavirus and contract COVID-19.”

Judge Martinez relied on declarations from public health experts stating that once COVID-19 reaches the detention center it will spread like “wildfire.” The Court noted that experts have attributed a mortality rate as high as 15% for high risk individuals who contract COVID-19. Judge Martinez ultimately concluded that “Petitioner has made a clear showing that he faces a substantial risk of serious harm due to the conditions of his present confinement and the fact that he is at higher risk for serious illness or death from COVID-19.”

Judge Martinez ordered that Mr. Pimentel be immediately released. He will now be permitted to return to live with his son and daughter-in-law in Salt Lake City while he waits for his immigration case to be completed.

What if we had a functional, impartial, expert U.S. Immigration Court that could order release of folks like this without protracted litigation in the U.S. District Courts? Indeed, what’s the purpose of a so-called “court system” that’s incapable of doing much of anything except “rubber stamping” the unconstitutional actions and extraordinarily poor judgments of DHS officials and their contractors?

The Cost of Outsourcing Refugees

It seems perversely appropriate that it was on 9/11 that the Supreme Court removed the legal barrier to the Trump Administration’s most recent deadly attack on the right to asylum in this country.  I continue to believe that eventually, justice will prevail through the courts or, more likely, through a change in administration. But in the meantime, what we are witnessing is an all-out assault by the Trump Administration on the law of asylum.  The tactics include gaming the system through regulations and binding decisions making it more difficult for asylum seekers to prevail on their claims. But far uglier is the tactic of degrading those fleeing persecution and seeking safety here. Such refugees, many of whom are women and children, are repeatedly and falsely portrayed by this administration and its enablers as criminals and terrorists.  Upon arrival, mothers are separated from their spouses and children from their parents; all are detained under dehumanizing, soul-crushing conditions certain to inflict permanent psychological damage on its victims. In response to those protesting such policies, Trump tweeted on July 3: “If illegal immigrants are unhappy with the conditions in the quickly built or refitted detention centers, just tell them not to come.  All problems solved!”

How innocent women and children resigning themselves to being severely beaten, raped, and killed in their home countries constitutes all problems being solved is beyond comprehension.

Those in Trump’s administration who have given more thought to the matter don’t seek to solve the problem, but rather to make it someone else’s problem to solve.  By disqualifying from asylum refugees who passed through any other country on their way to our southern border or who entered the country without inspection; by forcing thousands to remain exposed to abuse in Mexico while their asylum claims are adjudicated, and by falsely designating countries with serious gang and domestic violence problems as “safe third countries” to which asylum seekers can be sent, this administration is simply outsourcing refugee processing to countries that are not fit for the job in any measurable way.  Based on my thirty-plus years of experience in this field, I submit that contrary to Trump’s claim, such policies create very large, long-term problems.

I began my career in immigration law in the late 1980s representing asylum seekers from Afghanistan, many of whom were detained by our government upon their arrival.  In the late 1980s and early 1990s, Afghans constituted the largest group of refugees in the world. At one point, there were more than 6 million refugees from Afghanistan alone, most of whom were living in camps in Pakistan.  Afghan children there received education focused on fundamentalist religious indoctrination that was vehemently anti-western. The Taliban (which literally means “students”) emerged from these schools. The Taliban, of course, brought a reign of terror to Afghanistan, and further provided a haven for Al-Qaeda to launch the 9/11 terrorist attacks.  The outsourcing of Afghan refugees to Pakistan was the exact opposite of “all problems solved,” with the Taliban continuing to thwart peace in Afghanistan up to the present.

Contrast this experience with the following: shortly before I left the government, I went to dinner with a lawyer who had mentioned my name to a colleague of his earlier that day.  The colleague had been an Afghan refugee in Pakistan who managed to reach this country as a teen in the early 1990s, and was placed into deportation proceedings by the U.S. government.  By chance, I had been his lawyer, and had succeeded in obtaining a grant of asylum for him. Although I hadn’t heard from him in some 25 years, I learned from his friend that evening that I had apparently influenced my young client when I emphasized to him all those years ago the importance of pursuing higher education in this country, as he credited me with his becoming a lawyer.  Between the experiences of my former client and that which led to the formation to the Taliban, there is no question as to which achieved the better outcome, and it wasn’t the one in which refugees remained abroad.

In 1938, at a conference held in Evian, France, 31 countries, including the U.S. and Canada, stated their refusal to accept Jewish refugees trapped in Nazi Germany.  The conference sent the message to the Nazis on the eve of the Holocaust that no country of concern cared at all about the fate of Germany’s Jewish population. The Trump administration is sending the same message today to MS-13 and other brutal crime syndicates in Central America.  Our government is closing the escape route to thousands of youths (some as young as 7 years old) being targeted for recruitment, extortion, and rape by groups such as MS-13, while simultaneously stoking anti-American hatred among those same youths through its shockingly cruel treatment of arriving refugees.  This is a dangerous combination, and this time, it is occurring much closer to home than Pakistan. Based on historic examples, it seems virtually assured that no one will look back on Trump’s refugee policies as having solved any problems; to the contrary, we will likely be paying the price for his cruel and short-sighted actions for decades to come.

Former IJs File Amicus Brief in Padilla v. ICE

The late Maury Roberts, a legendary immigration lawyer and former BIA Chair, wrote in 1991: “It has always seemed significant to me that, among all the members of the animal kingdom, man is the only one who captures and imprisons his fellows.  In all the rest of creation, freedom is the natural order.”1  Roberts expressed his strong belief in the importance of liberty, which caused him consternation at “governmental attempts to imprison persons who are not criminals or dangerous to society, on the grounds that their detention serves some other societal purpose,”  including noncitizens “innocent of any wrongdoing other than being in the United States without documents.”2

The wrongness of indefinitely detaining non-criminals greatly increases when those being detained are asylum-seekers fleeing serious harm in their home countries, often after undertaking dangerous journeys to lawfully seek protection in this country.  The detention of those seeking asylum is at odds with our obligations under the 1951 Refugee Convention, which at Article 31 forbids states from penalizing refugees from neighboring states on account of their illegal entry or presence, or from restricting the movements of refugees except where necessary; and the International Covenant on Civil and Political Rights, which guarantees at Article 9, para. 4 the right of detainees to have a court “without delay” determine the lawfulness of the detention order release if it is not.

In 1996, in response to an increase in asylum seekers at ports of entry, Congress enacted a policy known as expedited removal, which allows border patrol officers to enter deportation orders against those noncitizens arriving at airports or the border whom are not deemed admissible.  A noncitizen expressing a fear of returning to their country is detained and referred for a credible fear interview. Only those whom a DHS asylum officer determines to have a “significant possibility” of being granted asylum pass such interview and are allowed a hearing before an immigration judge to pursue their asylum claim.

In 2005, the Board of Immigration Appeals issued a precedent decision stating that detained asylum seekers who have passed such credible fear interview are entitled to a bond hearing.  It should be noted that the author of this decision, Ed Grant, is a former Republican congressional staffer and supporter of a draconian immigration enforcement bill enacted in 1996, who has been one of the more conservative members of the BIA.  He was joined on the panel issuing such decision by fellow conservative Roger Pauley. The panel decision was further approved by the majority of the full BIA two years after it had been purged of its liberal members by then-Attorney General John Ashcroft.  In other words, the right to bond hearings was the legal conclusion of a tribunal of conservatives who, although they did not hold pro-immigrant beliefs, found that the law dictated the result it reached.

14 years later, the present administration issued a precedent decision in the name of Attorney General Barr vacating the BIA’s decision as “wrongly decided,” and revoking the right to such bond hearings.  The decision was immediately challenged in the courts by the ACLU, the Seattle-based Northwest Immigrant Rights Project, and the American Immigration Council. Finding Barr’s prohibition on bond hearings unconstitutional, U.S. District Judge Marsha Pechman issued a preliminary injunction blocking the decision from taking effect, and requiring bond hearings for class members within 7 days of their detention.  The injunction additionally places the burden on the government to demonstrate why the asylum-seeker should not be released on bond, parole, or other condition; requires the government to provide a recording or verbatim transcript of the bond hearing on appeal; and further requires the government to produce a written decision with particularized determinations of individualized findings at the end of the bond hearing.

The Administration has appealed from that decision to the U.S. Court of Appeals for the Ninth Circuit.  On September 4, an amicus brief on behalf of 29 former immigration judges (including myself) and appellate judges of the BIA was filed in support of the plaintiffs.  Our brief notes the necessity of bond hearings to due process in a heavily overburdened court system dealing with highly complex legal issues. Our group advised that detained asylum seekers are less likely to retain counsel.  Based on our collective experience on the bench, this is important, as it is counsel who guides an asylum seeker through the complexities of the immigration court system. Furthermore, the arguments of unrepresented applicants are likely to be less concise and organized both before the immigration judge and on appeal than if such arguments had been prepared by counsel.  Where an applicant is unrepresented, their ongoing detention hampers their ability to gather evidence in support of their claim, while those lucky enough to retain counsel are hampered in their ability to communicate and cooperate with their attorney.

These problems are compounded by two other recent Attorney General decisions, Matter of A-B- and Matter of L-E-A-, which impact a large number of asylum claimants covered by the lawsuit who are fleeing domestic or gang violence.  Subsequent to those decisions, stating the facts giving rise to the applicant’s fear can be less important than how those facts are then framed by counsel.  Immigration Judges who are still navigating these decisions often request legal memoranda explaining the continued viability of such claims. And such arguments often require both a legal knowledge of the nuances of applicable case law and support from experts in detailed reports beyond the capability of most detained, unrepresented, newly-arrived asylum seekers to obtain.

Our brief also argues that the injunction’s placement of the burden of proof on DHS “prevents noncitizens from being detained simply because they cannot articulate why they should be released, and takes into account the government’s institutional advantages.”  This is extremely important when one realizes that, under international law, an individual becomes a refugee upon fulfilling the criteria contained in the definition of that term (i.e. upon leaving their country and being unable or unwilling to return on account of a protected ground).  Therefore, one does not become a refugee due to being recognized as one by a grant of asylum. Rather, a grant of asylum provides legal recognition of the existing fact that one is a refugee. 3 Class members have, after a lengthy screening interview, been found by a trained DHS official to have a significant possibility of already being a refugee.  To deny bond to a member of such a class because, unlike the ICE attorney opposing their release, they are unaware of the cases to cite or arguments to state greatly increases the chance that genuine refugees deserving of this country’s protection will be deported to face persecution

The 9th Circuit Court of Appeals on Monday ruled against the Trump administration’s policy allowing for the indefinite detention of certain asylum-seekers, saying a lower court ruling temporarily blocking it can remain in place.

In the ruling, the judges said the Department of Justice did not make a “persuasive showing that it will suffer irreparable harm if it is required to provide bond hearings pending the outcome of this appeal in the same way it had done for several years.”

However, the appeals court did not allow a district judge’s order requiring the government to release some asylum-seekers within a certain amount of time after immigration proceedings begin, saying it “would impose short-term hardship for the government and its immigration system.”

Barr first issued the order earlier this year, determining that asylum-seekers who pass a “credible fear” test and go on to full deportation proceedings aren’t entitled to bond hearings.

But Judge Marsh Pechman, a Clinton appointee in federal court in Seattle, ruled earlier this month that policy is unconstitutional and blocked it from being enforced.

The three-judge panel on the 9th Circuit — Carter appointees Judges Mary Schroeder and William Canby as well as Judge Morgan Christen, an Obama appointee — declined to place a stay on Pechman’s ruling.

“The government failed to show a likelihood of success on the merits of its underlying argument that the government may indefinitely detain the plaintiffs without affording bond hearings at all,” Monday’s order reads.

Pechman had also ruled earlier this year that the Trump administration must take several steps in regard to asylum-seekers who are detained during immigration proceedings, including that certain migrants should be released if they are not granted a hearing within seven days of those proceedings beginning.

But the judges said that lawyers for the Trump administration showed that those requirements would be “too burdensome,” and temporarily halted the order as the full appeal of Pechman’s ruling plays out.

The appeals court is set to rule on the policies further, and Monday’s order asked that arguments be scheduled in the case for October of this year.

The Trump administration was critical of Pechman’s ruling against Barr’s asylum policy, with White House press secretary Stephanie Grisham saying in a statement that the order is “at war with the rule of law.”

On Monday officials said they were pleased the panel partially granted the government’s request.

“Unfortunately, in the same decision, the Ninth Circuit also allowed a radical decision from a district judge to go into effect during the pendency of the government’s appeal, which had held unconstitutional a section of the Immigration and Nationality Act,” said Deputy Press Secretary Steven Groves in a statement. “Based on the unprecedented theory that illegal aliens who recently entered the country have a constitutional right to be released on bond into the United States, the district court struck down a statute passed by bipartisan majorities in Congress during the Clinton administration specifically requiring certain aliens to be detained pending their asylum proceedings.”

He said the administration expected to ultimately prevail in the appeal.

The 9th Circuit’s ruling comes as the Trump administration seeks to implement tighter restrictions on asylum.

Trump officials announced last week that they would not accept asylum claims from migrants who pass through another country while traveling to the U.S.’s southern border, with limited exceptions. That rule is currently being challenged in a pair of federal courts.

A Seattle federal judge ruled Tuesday that asylum-seeking migrants detained for being in the U.S. illegally have the right to a bond hearing in immigration court rather than being held until their cases are complete.

U.S. District Judge Marsha Pechman said it is unconstitutional to indefinitely detain migrants who fled to the U.S. seeking asylum protections.

The decision reverses an April directivefrom Attorney General William Barr ordering immigration judges not to release migrants on bail after an applicant successfully establishes “a credible fear of persecution or torture” in the home country — a policy that has been in place since 2005.

“The court finds that plaintiffs have established a constitutionally-protected interest in their liberty, a right to due process, which includes a hearing before a neutral decision maker to assess the necessity of their detention and a likelihood of success on the merits of that issue,” Pechman wrote.

In her ruling, Pechman also took issue with an aspect of Barr’s policy that left open the possibility that migrants, still awaiting a hearing, could be re-detained by ICE after being released on bond.

“The Government’s unwillingness to unconditionally assert that Plaintiffs will not be re-detained means that the specter of re-detention looms and these Plaintiffs and many members of their class face the real and imminent threat of bondless and indefinite detention …,” she said.

The ruling comes amid a widespread shortage of immigration judges that has caused massive delays in processing hearings. The most recent dataavailable from The Transactional Records Access Clearinghouse shows a total of 424 judges nationwide face a backlog of 892,517 cases on the courts’ active dockets as of the end of April.

“The three largest immigration courts were so under-resourced that hearing dates were being scheduled as far out as August 2023 in New York City, October 2022 in Los Angeles, and April 2022 in San Francisco,” TRAC reports

Pechman also modified a preliminary injunction issued earlier this year. The new injunction requires the government to ensure bond hearings are held within seven days after they are requested by eligible asylum-seekers. If the government exceeds that limit, the undocumented immigrant must be released.

Immigrant rights advocates, including the American Civil Liberties Union and the Northwest Immigrant Rights Project, sued to block the policy, which was set to take effect this month.

In a statement, Matt Adams, legal director of Northwest Immigrant Rights Project, said: “The court reaffirmed what has been settled for decades: that asylum seekers who enter this country have a right to be free from arbitrary detention.”

Michael Tan, senior staff attorney for the ACLU’s Immigrants’ Rights Project, added: “Try as it may, the administration cannot circumvent the Constitution in its effort to deter and punish asylum-seekers applying for protection.”

The Department of Justice is expected to appeal the ruling quickly.

SEATTLE — Immigrant rights activists can continue to challenge what they describe as unlawful U.S. government delays in asylum cases, a federal judge has ruled.

U.S. District Judge Marsha Pechman in Seattle dismissed some arguments raised by the lawsuit in a ruling Tuesday, but she said the activists can pursue their claim that the delays violate the due process rights of detained asylum seekers across the country. The government sought to dismiss the case.

The Seattle-based Northwest Immigrant Rights Project filed the lawsuit in June against U.S. Immigration and Customs Enforcement, which said through a spokeswoman Wednesday that it does not comment on pending litigation.

According to the complaint, migrants seeking asylum after entering the U.S. illegally have had to wait weeks or months for their initial asylum interviews, at which an immigration officer determines whether they have a credible fear of persecution or torture in their home country. After that, there have been long delays in getting bond hearings, which determine whether an asylum seeker will be released from custody as the case proceeds.

The group initially filed the lawsuit in response to the administration’s family separations at the U.S.-Mexico border, saying the delays had kept mothers detained at the Northwest Detention Center in Tacoma, Washington, from being reunited with their children in immigration custody across the country. Those plaintiffs have since been released, but the lawsuit seeks class-action status on behalf of thousands of asylum seekers.

The complaint asks the judge to order the government to make credible fear determinations within 10 days and to conduct bond hearings within seven days of an asylum seeker’s request for one.

Pechman disagreed, saying that because the detainees had crossed into the U.S. they were entitled to greater constitutional protections than the government claimed.

“Simply put, are they ‘excludable aliens’ with little or no due process rights, or are they aliens who are in the country illegally, but nevertheless in the country such that their presence entitles them to certain constitutional protections?” she wrote. “Plaintiffs have adequately plead that they were within the borders of this country without permission when detained, and thus enjoy inherent constitutional due process protections.”

Despite all of their disingenuous whining about being required to follow the law by mere judges, and Trump’s successful effort to fill the Federal Courts with right-wing jurists, there will be plenty more well deserved defeats for this lawless Administration.

Even the most conservative jurists tend to have a concept of the Constitution, the law, and fairness. Trump and his minions, including particularly his stooges at the DOJ, have little concern for law of any type except when it happens to advance their political agenda.  It’s just a political game for them, driven by an anti-American, racist, White Nationalist agenda. That’s not likely to be a successful long-range litigation strategy with judges across the philosophical spectrum.

Many judges are going to require the Administration to comply with Due Process, as is happening here. Significantly, Judge Pechman gave short shrift to the DOJ’s argument that individuals detained at or near the border have no Due Process rights.

A federal judge in Washington on Monday ordered the U.S. government to immediately release or grant hearings to more than 1,000 asylum seekers who have been jailed for months or years without individualized case reviews, dealing a blow to the Trump administration’s crackdown on migrants.

U.S. District Judge James E. Boasberg of Washington said U.S. Immigration and Customs Enforcement ignored its own policy stating that asylum applicants who establish a “credible fear” of persecution in their native country must be granted a court hearing within seven days or released.

He granted a preliminary injunction preventing the government from carrying out blanket detentions of asylum seekers at five large U.S. field offices, including those currently held, pending resolution of the lawsuit.

The American Civil Liberties Union and other groups sued in March after finding detention rates at the offices surged to 96 percent in the first eight months after President Trump took office in 2017, up from less than 10 percent in 2013.

The ACLU says the mass imprisonment of people seeking refuge while awaiting immigration court hearings stems from policies promoted by Trump and Attorney General Jeff Sessions that amount to a deterrent to using the asylum provision. The policy, the ACLU argued, unlawfully denies asylum seekers as a group based on only one of the factors used to assess the danger an individual poses: how long they have been in the United States.

“As the events of recent months make clear, the question of how this nation will treat those who come to our shores seeking refuge generates enormous debate,” Boasberg wrote in a 38-page opinion, an allusion to the administration’s family-separation policy recently implemented and then abandoned amid international condemnation.

“This Opinion does no more than hold the Government accountable to its own policy, which recently has been honored more in the breach than the observance. Having extended the safeguards of the Parole Directive to asylum seekers, ICE must now ensure that such protections are realized,” Boasberg said.

The lawsuit was filed on behalf of nine detained asylum seekers from Haiti, Venezuela and other countries who were initially determined to have credible stories and have been jailed for up to two years awaiting a hearing before an immigration judge, lawyers said. Two have been granted asylum and released since the case was filed in March, said attorneys with the ACLU and the Covington & Burling law firm.

The court action named the Department of Homeland Security and its sub-agency ICE, which detains immigrants, and the Justice Department, which runs the immigration courts where immigrants can seek bond hearings.

“A federal judge in Seattle has partially lifted a ban on certain refugees imposed by the Trump administration.

U.S. District Judge James Robart issued a ruling on behalf of the American Civil Liberties Union (ACLU) and Jewish Family Service on Saturday.

The groups had urged the judge, an appointee of former President George W. Bush, to halt the ban on refugees from some majority-Muslim nations.

Robart ruled that the federal government should process certain refugee applications, saying his order doesn’t apply to refugees who do not have a “bona fide” relationship with an individual or an entity in the U.S.

The ban originally went into effect after the president issued an executive order reinstating the refugee program “with enhanced vetting capabilities” in October.

The ACLU argued that a memo sent to the president from Secretary of State Rex Tillerson, acting Homeland Security Secretary Elaine Duke and Director of National Intelligence Daniel Coats saying certain refugees should be banned unless security was enhanced did not provide enough evidence for why more security was needed.

The judge wrote Saturday that “former officials detailed concretely how the Agency Memo will harm the United States’ national security and foreign policy interests” and said his ruling restores “refuge procedures and programs to the position they were in prior” to the ban, which he noted included thorough vetting of individuals traveling to the U.S.

The lawsuits stemming from the ACLU and Jewish Family Services were consolidated and involved refugees who have been blocked from coming to the U.S.”

THWARTED: Judge Stops Feds From Interfering With Pro Bono Help!

SEATTLE (AP) — A federal judge temporarily blocked a Justice Department decision that immigrant legal rights organizations around the country said would curtail much of the work they do help those facing deportation.

U.S. District Judge Richard Jones issued his ruling Wednesday immediately following oral arguments in a lawsuit brought by the nonprofit Northwest Immigrant Rights Project.

The Justice Department last month sent the group a cease-and-desist letter saying it cannot provide certain legal assistance to immigrants unless it undertakes formal representation of them in court. The nonprofit says it doesn’t have the resources to do that, as formal representation can require intensive investigation of a client’s case and remaining involved until its resolution.

The order would force it and similar groups around the country to stop preparing motions and other documents on behalf of immigrants who represent themselves, the organization said.

The judge agreed that the Justice Department’s action would violate the Northwest Immigrant Rights Project’s constitutional rights to freedom of speech, association and to petition the government, and that the cease-and-desist letter would limit its work — forcing many immigrants to go without legal help, since people facing deportation are not entitled to an attorney the way criminal defendants are. He barred the Justice Department from sending such letters to any other nonprofit organizations doing similar work around the nation.”

4th Cir. Judges File Separate Opinion Praising Bravery Of Transgender Teen — Take Shot At Those On The “Wrong Side Of History!”

Senior Judge Davis, joined by Judge Floyd said this in a published separate opinion:

“Our country has a long and ignominious history of discriminating against our most vulnerable and powerless. We have an equally long history, however, of brave individuals—Dred Scott, Fred Korematsu, Linda Brown, Mildred and Richard Loving, Edie Windsor, and Jim Obergefell, to name just a few—who refused to accept quietly the injustices that were perpetuated against them. It is unsurprising, of course, that the burden of confronting and remedying injustice falls on the shoulders of the oppressed. These individuals looked to the federal courts to vindicate their claims to human dignity, but as the names listed above make clear, the judiciary’s response has been decidedly mixed. Today, G.G. adds his name to the list of plaintiffs whose struggle for justice has been delayed and rebuffed; as Dr. King reminded us, however, “the arc of the moral universe is long, but it bends toward justice.” G.G.’s journey is delayed but not finished.

G.G.’s case is about much more than bathrooms. It’s about a boy asking his school to treat him just like any other boy. It’s about protecting the rights of transgender people in public spaces and not forcing them to exist on the margins. It’s about governmental validation of the existence and experiences of transgender people, as well as the simple recognition of their humanity. His case is part of a larger movement that is redefining and broadening the scope of civil and human rights so that they extend to a vulnerable group that has traditionally been unrecognized, unrepresented, and unprotected.

The Trump Administration’s attacks on vulnerable individuals such as Muslims, migrants, and now transgender students have given rise to an interesting new phenomenon in the U.S. Courts of Appeals: separate published opinions vigorously commenting on or dissenting from what normally would be routine, unsigned, unpublished, barely noticed, procedural orders.

Another good example was the recent spate of published opinions dissenting and concurring with the granting of an uncontested motion by the Government to dismiss the appeal from the TRO in State of Washington v. Trump (“Travel Ban 1.0”) which I discussed in an earlier blog: http://wp.me/p8eeJm-vM

In the 9th Circuit case, several judges used separate opinions to lash out at their colleagues and show their support for the Trump Administration’s “Travel Ban 1.0.” This drew a reaction from some of their colleagues who accused the dissenters of using the forum and device of the separate opinions to deliver a message to politicians, other courts, and the parties for use in future litigation that was not yet before the court. In other words, to influence matters that were not part of the the actual “case or controversy” before the court, which was being dismissed without objection by either party.

In any event, in just a short time in office, the Trump Administration has “gotten the attention” of normally aloof and “ivory towerish” Federal Appellate Judges who seem to be energized and eager to engage in the fray with the Administration, its detractors, and each other.

“Attorney General Jeff Sessions recently ordered a review of federal agreements with a number of local law enforcement agencies aimed at reforming troubled departments. As a first step, the Justice Department on Monday asked a judge to delay a consent decree that would overhaul Baltimore’s police force.

On its face, Mr. Sessions’s order simply asks whether the consent decrees promote public safety, support officers, respect local control and are warranted. But underlying the order is the Trump administration’s belief that efforts to align police practices with the Constitution have compromised public safety and thrown police officers under the bus.

This couldn’t be farther from the truth.

Countless police chiefs and mayors are vocal about wanting federal reform or have emerged from the consent decree process remarking that their departments were the better for it. Mr. Sessions claims to want to revert to local control, but he should listen to local officials like Baltimore’s police commissioner, Kevin Davis, who called the Justice Department’s request to delay the reform agreement “a punch in the gut” and noted that “a consent decree will make the Baltimore police department better both with the crime fight and our community relationships.”

No matter what review Mr. Sessions conducts, he cannot unilaterally undo these reform agreements. That’s because the district courts that oversee them will ultimately decide their fate. In addition, the reforms are negotiated with local elected officials and law enforcement leaders, with extensive input from grass-roots organizations, police unions, officers and civilians. Mr. Sessions can try to undermine them, but many of the reforms are durable.

That’s good, because communities around the country need this work to continue. In cities like Ferguson, Mo., Chicago and Baltimore, federal reform addresses unconstitutional stops, searches and arrests, and excessive and retaliatory force. These problems erode trust between police departments and the communities they serve, trust that is essential to effective policing as well as officer and public safety.
Rebuilding these ties is also necessary for preventing and solving crime. Few in law enforcement would disagree with this. When we worked on police reform at the Justice Department, we heard over and over again from officers and community members during our investigations in Baltimore and Chicago that relationships had broken down so badly, witnesses sometimes refused to share vital information and victims declined police assistance.

Mr. Sessions’s suggestion that the Justice Department’s policing agreements interfere with proactive policing is likewise baseless. There is no question that lawful stops, arrests and, at times, the use of force are all necessary tools for ensuring public safety. But Baltimore’s misguided zero-tolerance policing strategy, for example, severely damaged police-community relations, especially in black neighborhoods. Even the Baltimore Fraternal Order of Police acknowledged that officers felt “pressure to achieve numbers for perception’s sake.”

And, Seattle’s recent experience shows that Federal intervention and consent decrees improve policing and saves lives, as shown by this report in the Seattle Times:

“Five years after the U.S. Justice Department found Seattle police officers too often resorted to excessive force, the federal monitor overseeing court-ordered reforms issued a glowing report Thursday concluding the department has carried out a dramatic turnaround.

Crediting Mayor Ed Murray, Police Chief Kathleen O’Toole and, most of all, the Seattle Police Department’s men and women, the monitor, Merrick Bobb, found overall use of force is down and, when officers do use it, it is largely handled in a reasonable way consistent with department policies.
As a result, Bobb found the department to be in substantial compliance — formally known as initial compliance — with core provisions of a 2012 consent decree that required the city to adopt new policies and training to address excessive force.
“The significance and importance of this finding cannot be understated, as this report makes clear,” Bobb wrote in the 102-page assessment. “It represents a singular and foundational milestone on SPD’s road to full and effective compliance — and represents Seattle crystallizing into a model of policing for the 21st century.”

Moreover, use of force has dropped even as officer injuries have not gone up and crime, by most measures, has not increased, Bobb and his monitoring team write in the report.

O’Toole shared the results in a departmentwide email Monday afternoon, saying, “In short, the Monitor’s assessment confirms the data that SPD reported on earlier this year: of the hundreds of thousands of unique incidents to which SPD officers respond every year, only a small fraction of one percent result in any use of force.”

The report, which has been in the works for some time, comes days after U.S. Attorney General Jeff Sessions ordered Justice Department officials to conduct a review of reform agreements with more than a dozen police agencies nationwide to determine whether they, among other things, undermine officer safety and crime fighting.

While the order could undercut newer agreements reached under the civil-rights emphasis during the Obama administration, officials have said it is unlikely to affect Seattle’s pact because it is under the firm control of a federal judge.

The judge, James Robart, has shown an unwavering commitment to Seattle’s consent decree, even declaring “black lives matter” during a court hearing, and earlier this year halted the Trump administration’s first travel ban.
In a statement Tuesday, Murray said, “Our progress under the Consent Decree cannot be undone by empty bureaucratic threats. Our police department is well into the process of reform and will continue this work. We are too far along for President Trump to pull us away from justice.”

Must be hard for current and former DOJ Civil Rights Division attorneys, who have spent years painstakingly investigating, drafting, and negotiating agreements to promote effective, constitutional policing to see their work being trashed by a guy who has spent most of his career trying to limit civil and human rights. Been there myself, in a somewhat different context, and it’s very disheartening and maddening.

While I don’t have much optimism that career attorneys in the DOJ will be able to stand up to Sessions and keep their jobs, it is encouraging that many of the jurisdictions, police departments, and Federal Judges involved in the consent decree process intend to keep the ball rolling despite Session’s attempts to undermine their efforts.

And, certainly advocates, like Gupta and Stoughton in their new “private sector” positions, intend to keep the pressure on even if it means doing battle with the Trumped-up Sessions version of the DOJ. Forget civil rights, gotta keep a close eye on what those H-1B workers and their employers are up to.

Seattle Sues Over DOJ’s “Sanctuary City” Threat — Preemptive Action Claims Harm From Uncertainty!

“Seattle is suing President Donald Trump over his executive order cracking down on so-called “sanctuary cities” for how they handle people living in the United States illegally.

The city is doing nothing wrong by limiting its own involvement in immigration enforcement, while Trump is overreaching by trying to make cities do the work of the federal government, Mayor Ed Murray and City Attorney Pete Holmes said Wednesday.
The goal of the lawsuit, filed in U.S. District Court in Seattle, is to have the executive order declared unconstitutional, Murray said at a news conference, accusing the Trump administration of waging “a war on cities.”

“Our lawsuit is staying true to our values,” the mayor said. “We value civil rights, we value the courts and we value the Constitution.”

I suspect that this is just the first of many suits we will see about this issue. I doubt that anything Trump has done so far will create jobs for working class Americans (sadly). But, he has been, and is likely to continue to be, a boon for lawyers and reporters.

He’s even keeping me pretty busy in retirement. I can’t even “blog” all of the interesting articles and cases I read in one day. Have to be “selective.”

DOJ’s Travel Ban Litigating Strategy Discussed — The Rush Appears To Be “Off!”

“Legal analysts and opponents say the Justice Department is likely pursuing a more methodical, strategic approach in hopes of a long-term victory — although in the process, the administration is hurting its case that the order is needed for urgent national security.

“If they don’t try to move the case as quickly as possible,” said Leon Fresco, deputy assistant attorney general for the Office of Immigration Litigation in President Barack Obama’s Justice Department, “it does undermine the security rationale.”

Trump’s new travel order — which suspended the U.S. refugee program for 120 days and blocked the issuance of new visas to citizens of Iran, Sudan, Somalia, Libya, Somalia and Syria for 90 days — was supposed to take effect March 16, but U.S. District Judge Derrick K. Watson in Hawaii blocked the administration from enforcing the critical sections of it. Early the next day, a federal judge in Maryland issued a similar ruling — leaving the administration with two different cases, in two different appellate circuits, that they would need to get overturned before they could begin carrying out the president’s directive. All roads seemed to lead to the Supreme Court.
But now it seems all but certain that the president’s revised entry ban will stay suspended at least into April, and possibly longer.

Lawyers for the Justice Department filed a notice of appeal in the Maryland case a day after the judge there ruled, but — unlike last time — they did not ask the higher court to immediately set aside the freeze on the new ban. They said they will do so Friday, but those challenging the ban will have a week to respond, and the Justice Department will then be allowed to file more written arguments by April 5.

The Trump administration has been content to let the court battle play out even more slowly in Hawaii, not elevating the dispute beyond a lower-court judge. The Justice Department has not filed a notice of its intent to appeal the ruling, and the next hearing in that case is set for March 29. Justice Department lawyers wrote Thursday that they would appeal to a higher court if that hearing doesn’t resolve in their favor. The courts will ultimately have to decide important questions, including how much authority they have to weigh in on the president’s national security determinations, whether Trump’s order was meant to discriminate against Muslims, and whether and how the president’s and his advisers’ own comments can be used against them.

There could be strategic reasons for pumping the brakes. Stephen W. Yale-Loehr, a professor of immigration law at Cornell Law School, said the Justice Department might be hoping for a favorable ruling from the U.S. Court of Appeals for the 4th Circuit, of which Maryland is a part, before they bring a case before the 9th Circuit, of which Hawaii is a part. A three-judge panel in the 9th Circuit unanimously rejected the administration’s bid to restore Trump’s first entry ban after it was frozen. The 4th Circuit on Thursday scheduled oral argument in its case for May 8.

And the Justice Department could be playing an even longer game, hoping that by the time the case makes its way to the Supreme Court, Neil Gorsuch will have joined the justices and brought to an end what many see as a 4-to-4 split along ideological lines, said Jonathan E. Meyer, a former deputy general counsel in the Department of Homeland Security under Obama who now works in private practice at Sheppard Mullin.”

Even assuming that the Supremes eventually take the case, by no means a “gimme,” it probably would not be heard by the Court until some time in 2018 with a decision perhaps months after the argument. During that time, it is highly likely that the Travel Ban will remain enjoined.

From a government standpoint, it’s always prudent to 1) think carefully before taking on issues that can be litigated in U.S. District Courts which have authority to issue nationwide injunctions which require only a preliminary showing and are very difficult to “undo” (by contrast, “Removal Cases” usually can only be litigated in Circuit Courts of Appeal, which, although higher on the “judicial totem pole” than USDCs, lack authority to issue nationwide injunctions in connection with such individual case judicial review); and 2) always have “Plan B.” Here, “Plan B” might be the more stringent requirements for screening and issuing visas from countries where terrorist activity has taken place set forth in Secretary of State Tillerson’s recent instructions discussed in my previous blog:
