“Two members of a white supremacist group hung a banner decrying the “Dreamer” movement outside the American Immigration Lawyers Association office in D.C. Saturday.

Surveillance video shows two men hanging a large banner outside the office on G Street NW in broad daylight.

“They stood in the windowsills and they put a sign up over the doorway,” said Kenneth Thomas, who witnessed the men hanging the banner.

The sign read, “We Are Your Dreamers No Amnesty Identity Evropa.”

Identity Evropa is a white supremacist group “focused on the preservation of ‘white American culture’ and promoting white European identity,” according to the Anti Defamation League.

“There was a gentleman across the street who hollered at them who said, you know, ‘Nazi, nazi, fascist’ whatever,” Thomas said.

The two men then ran away.

News4 spoke with the witness who yelled at the men by phone. He did not want to be identified but said the incident shocked and angered him.

“It’s a scary time right now. I think that they might have the expectation that they’re not going to face any consequences,” he told News4.

D.C. police are investigating the incident as a possible hate crime.

Ben Johnson, the executive director of the American Immigration Lawyers Association, said the organization is saddened but undeterred by the banner.

“It’s important work that’s, you know, the constitution commands us to do and we’re not gonna give up on doing that. We’ve got a long, proud history as a nation of immigrants and we’re proud to be part of that,” Johnson said.

“Dreamers” refers to the hundreds of thousands of young immigrants who had been given a deportation reprieve under former President Barack Obama’s Deferred Action for Childhood Arrivals, also known as DACA.

President Trump ended the program in September and has told lawmakers his hardline immigration priorities, including the wall, must be approved if he is to go along with protecting the young immigrants from deportation.

“With eyes wide open, Mike Pence eagerly auditioned for the role as Donald Trump’s poodle. Now comfortably leashed, he deserves the degradations that he seems too sycophantic to recognize as such. He did Trump’s adolescent bidding with last Sunday’s preplanned virtue pageant of scripted indignation — his flight from the predictable sight of players kneeling during the national anthem at a football game. No unblinkered observer can still cling to the hope that Pence has the inclination, never mind the capacity, to restrain, never mind educate, the man who elevated him to his current glory. Pence is a reminder that no one can have sustained transactions with Trump without becoming too soiled for subsequent scrubbing.

A man who interviewed for the position Pence captured, Sen. Bob Corker (R-Tenn.), is making amends for saying supportive things about Trump. In 2016, for example, he said he was “repulsed” by people trying to transform the Republican National Convention from a merely ratifying body into a deliberative body for the purpose of preventing what has come to pass. Until recently, Corker, an admirable man and talented legislator, has been, like many other people, prevented by his normality from fathoming Trump’s abnormality. Now Corker says what could have been said two years ago about Trump’s unfitness.

The axiom that “Hell is truth seen too late” is mistaken; damnation deservedly comes to those who tardily speak truth that has long been patent. Perhaps there shall be a bedraggled parade of repentant Republicans resembling those supine American communists who, after Stalin imposed totalitarianism, spawned the gulag, engineered the Ukraine famine, launched the Great Terror and orchestrated the show trials, were theatrically disillusioned by his collaboration with Hitler: You, sir, have gone too far.

Trump’s energy, unleavened by intellect and untethered to principle, serves only his sovereign instinct to pander to those who adore him as much as he does. Unshakably smitten, they are impervious to the Everest of evidence that he disdains them as a basket of gullibles. He understands that his unremitting coarseness satisfies their unpolitical agenda of smashing crockery, even though his self-indulgent floundering precludes fulfillment of the promises he flippantly made to assuage their sense of being disdained. He gives his gullibles not governance by tantrum, but tantrum as governance.

With Trump turning and turning in a widening gyre, his crusade to make America great again is increasingly dominated by people who explicitly repudiate America’s premises. The faux nationalists of the “alt-right” and their fellow travelers such as Stephen K. Bannon, although fixated on protecting the United States from imported goods, have imported the blood-and-soil ethno-tribalism that stains the continental European right. In “Answering the Alt-Right” in National Affairs quarterly, Ramon Lopez, a University of Chicago PhD candidate in political philosophy, demonstrates how Trump’s election has brought back to the public stage ideas that a post-Lincoln America had slowly but determinedly expunged. They were rejected because they are incompatible with an open society that takes its bearing from the Declaration of Independence’s doctrine of natural rights.

With their version of the identity politics practiced by progressives, alt-right theorists hold that the tribalism to which people are prone should not be transcended but celebrated. As Lopez explains, the alt-right sees society as inevitably “a zero-sum contest among fundamentally competing identity groups.” Hence the alt-right is explicitly an alternative to Lincoln’s affirmation of the Founders’ vision. They saw America as cohesive because of a shared creed. The alt-right must regard Lincoln as not merely mistaken but absurd in describing America as a creedal nation dedicated to a “proposition.” The alt-right insists that real nationhood requires cultural homogeneity rooted in durable ethnic identities. This is the alt-right’s alternative foundation for the nation Lincoln said was founded on the principle that all people are, by nature, equal.

Trump is, of course, innocent of this (or any other) systemic thinking. However, within the ambit of his vast, brutish carelessness are some people with sinister agendas and anti-constitutional impulses. Stephen Miller, Bannon’s White House residue and Trump’s enfant terrible,recently said that “in sending our [tax reform] proposal to the tax-writing committees, we will include instructions to ensure all low- and middle-income households are protected.” So, Congress will be instructed by Trump’s 32-year-old acolyte who also says the president’s national security powers “will not be questioned.” We await the response of congressional Republicans, who did so little to stop Trump’s ascent and then so much to normalize him.”

Leave it to Trump and his White Nationalist gang to have me agreeing with George Will, something that rarely happened in the pre-Trump era. But, the folks who perpetrated this mess are our fellow citizens who voted for Trump notwithstanding his clearly established philosophy of sowing and pandering to hate, incompetence, and his glaring unsuitability for any public office. And, too many of those “core supporters” are still out there, coarsely and ignorantly screaming their approval for an Administration that is destroying America, and endangering the lives, rights, and human dignity of many of their fellow Americans, one day at a time.

“When rapid immigration and terrorist attacks occur simultaneously — and the terrorists belong to the same ethnic or religious group as the new immigrants — the combination of fear and xenophobia can be dangerous and destructive. In much of Europe, fear of jihadists (who pose a genuine security threat) and animosity toward refugees (who generally do not) have been conflated in a way that allows far-right populists to seize on Islamic State attacks as a pretext to shut the doors to desperate refugees, many of whom are themselves fleeing the Islamic State, and to engage in blatant discrimination against Muslim fellow citizens.

But this isn’t happening only in European countries. In recent years, anti-immigration rhetoric and nativist policies have become the new normal in liberal democracies from Europe to the United States. Legitimate debates about immigration policy and preventing extremism have been eclipsed by an obsessive focus on Muslims that paints them as an immutable civilizational enemy that is fundamentally incompatible with Western democratic values.

Yet despite the breathless warnings of impending Islamic conquest sounded by alarmist writers and pandering politicians, the risk of Islamization of the West has been greatly exaggerated. Islamists are not on the verge of seizing power in any advanced Western democracy or even winning significant political influence at the polls.

The same cannot be said of white nationalists, who today are on the march from Charlottesville, Va., to Dresden, Germany. As an ideology, white nationalism poses a significantly greater threat to Western democracies; its proponents and sympathizers have proved, historically and recently, that they can win a sizable share of the vote — as they did this year in France, Germany and the Netherlands — and even win power, as they have in the United States.

Far-right leaders are correct that immigration creates problems; what they miss is that they are the primary problem. The greatest threat to liberal democracies does not come from immigrants and refugees but from the backlash against them by those on the inside who are exploiting fear of outsiders to chip away at the values and institutions that make our societies liberal.

Anti-Semitic and xenophobic movements did not disappear from Europe after the liberation of Auschwitz, just as white supremacist groups have lurked beneath the surface of American politics ever since the Emancipation Proclamation. What has changed is that these groups have now been stirred from their slumber by savvy politicians seeking to stoke anger toward immigrants, refugees and racial minorities for their own benefit. Leaders from Donald Trump to France’s Marine Le Pen have validated the worldview of these groups, implicitly or explicitly encouraging them to promote their hateful opinions openly. As a result, ideas that were once marginal have now gone mainstream.”

“I never expected to speak the phrase: “As Mississippi goes, so goes the federal government.” But when it comes to demeaning and disempowering LGBT, it is now apropos.

The self-righteous drive to make others suffer for not living Evangelical beliefs appears to be unstoppable with Trump in power and with Sessions as his henchman for civil rights. They are taking their cues from the Deep South and particularly Mississippi.

Mississippi is the national leader on religiously-motivated discrimination against LGBT and generating divisiveness on these issues, as I discussed here.

Mississippi continues to aspire to fomenting the most discrimination against LGBT with HB 1523, which explicitly permits business owners to refuse service to LGBT for religious reasons. The trial court correctly held that it was unconstitutional and issued a preliminary injunction.

In June, the Fifth Circuit let the law go into effect, holding that the challengers lacked standing. On further review, the Fifth Circuit refused to vacate the ruling, which let the law stand. Now perhaps it goes to the Supreme Court.

Its sponsors put it into place so that Evangelicals can legally exclude LGBT from the marketplace. They say it’s about their “religious liberty,” by which they mean not the right to observe their own practices, but rather their supposed right to judge and condemn others before doing business with them.

The whole anti-LGBT project is so unbelievably hypocritical: they aren’t fighting to bar liars, adulterers, rapists, or pedophiles from their businesses, all of whom who violate plain biblical commands.

What they are engineering is lives without having to associate with “those people.” One can only hope that good, old-fashioned profit motives enrich those businesses that provide service to LGBT and put out of business those who prefer the Jim Crow life.

Trump Administration Follows Mississippi’s Lead

Now, Attorney General Jeff Sessions has piled onto this administration’s obsession with humiliating and harming transgender Americans here and here with a new document interpreting federal law to require accommodation of those in the government who believe LGBT are sinful.

That’s right, the drive is to accommodate the ones who cannot tolerate those who aren’t like them. This is all about deconstructing the LGBT civil rights the Obama administration put into place as discussed here and here.

For good measure, the administration is also rolling back protections intended to ensure LGBT are not discriminated against in long-term care facilities. (The administration also went after women’s rights to contraception as fellow columnist Joanna Grossman explains, again an issue where it is in lock step with Evangelical lobbyists.)

Where Did This Intolerance Come From?

The push to inflict exclusion and suffering on LGBT for religious reasons owes its origins to the working out of the Religious Freedom Restoration Act in American culture. Whether you have read Hegel or Calvin, this is what happens when you put into place a “right” that has no natural limit.

The religious lobbyists, including knowing conservatives and some truly naïve liberals, backed this benighted law in 1993. It was declared unconstitutional in 1997 in Boerne v. Flores, because it was so far removed from anything that the First Amendment had ever required .

What was unleashed with this federal statute, which morphed into state laws and later federal law, was a theory that the default position for religious liberty should be that a religious believer has a right to overcome any law that burdens religiously-motivated conduct.

Many laws exist to protect the vulnerable. When religious believers seize a “right” to trump the law, they in effect hurt the vulnerable. That is true here.

This power grab—particularly by religious organizations who believe in imprinting their beliefs on the culture—paved the way for the depraved arguments now being made for “religious liberty” that amount to exclusion and harm to an entire category of citizens defined solely by their sexual orientation. They have falsely claimed the mantle of victimhood while making victims of others.

The powerful choose the labels and the vulnerable suffer. If you have not seen this power maneuver elsewhere in history or in the Trump Administration’s dealings with race, you are not paying attention.

While the Evangelical right wages a bogus war against the non-existent “Sharia law in America,” the real threat to our freedoms, our Constitution, and the rule of law is posed by these very same right wingers. Led by folks like Gonzo who have moved from the “wacko fringe” to positions of power, they are forcing their false interpretation of Christianity down the throats of the rest of us who don’t share their “Gospel of Hate & Intolerance.”

From a theological standpoint (after all, it is Sunday), Jesus’s ministry was not to the rich, powerful, rulers, or Pharisees enforcing the Jewish Law; no, Jesus’s ministry was one of love, compassion, forgiveness, and eternal hope  for the outsiders, the outcasts, the poor, and the “rejected” of Jewish and Roman society. If Jesus were among us today, he would much more likely be found “rubbing shoulders” and preaching to the gay community or the undocumented than he would wandering the halls of Jeff Sessions’s Department of (In)Justice.

LEGACY OF HATE – TRUMP’S APPOINTMENT OF HOMOPHOBIC JUDGES LIKELY TO TORMENT LGBTQ AMERICANS FOR DECADES TO COME! — Elections Have Consequences!

WASHINGTON ― Thursday was a good day for Amy Coney Barrett. A Senate committee voted to advance her nomination to be a federal judge.

It wasn’t a pretty vote. Every Democrat on the Judiciary Committee opposed her nomination. They scrutinized her past writings on abortion, which include her questioning the precedent of Roe v. Wade and condemning the birth control benefit under the Affordable Care Act as “a grave infringement on religious liberty.” One Democrat, Al Franken (Minn.), called her out for taking a speaking fee from the Alliance Defending Freedom, a nonprofit that’s defended forced sterilization for transgender people and has been dubbed a hate group by the Southern Poverty Law Center.

But Republicans don’t need Democrats’ votes, and now Barrett, a 45-year-old law professor at the University of Notre Dame, is all but certain to be confirmed to a lifetime post on the U.S. Court of Appeals for the 6th Circuit — a court one level below the Supreme Court.

Barrett is the model judicial candidate for this White House: young, conservative, and opposed to abortion and LGBTQ rights. For all the stories about President Donald Trump using his executive power to roll back civil rights protections — in the past day, his administration axed the ACA birth control benefit and ended workplace protections for transgender people — it is here, on the courts, where his team is working most aggressively to reshape the country.

“Trump’s speed in nominating judges has been perhaps the most successful aspect of his presidency,” said Carl Tobias, a law professor at the University of Richmond who specializes in judicial nominations. “Trump has easily surpassed Obama, Bush and Clinton at this point in the first year of their presidencies in terms of the sheer number nominated.”

He has. Ten months in, Trump has nominated 17 circuit court judges and 39 district court judges. That’s far more than former President Barack Obama’s seven circuit court nominees and four district court nominees by this point in his first year of office. Former President George W. Bush had nominated 11 circuit judges and 31 district judges by this point.

He’s also got more court seats to fill. He inherited a whopping 108 court vacancies when he became president ― double the number of vacancies Obama inherited when he took office. That’s largely due to Republicans’ years-long strategy of denying votes to Obama’s court picks to keep those seats empty for a future GOP president to fill. It worked.

If Trump’s current judicial nominees are a preview of the kinds of judges he plans to nominate in the coming years, prepare for a significantly more socially conservative group of people shaping the nation’s laws.

Consider John Bush. The Senate confirmed him in July, on a party-line vote, to a lifetime post on the U.S. Court of Appeals for the 6th Circuit. Bush, 52, has compared abortion to slavery and referred to them as “the two greatest tragedies in our country.” He has also said he strongly disagrees with same-sex marriage, mocked climate change and proclaimed “the witch is dead” when he thought the Affordable Care Act might not be enacted.

The Senate also confirmed Kevin Newsom, 44, to the U.S. Court of Appeals for the 11th Circuit in August. He wrote a 2000 law review article equating the rationale of Roe v. Wade to Dred Scott v. Sandford, the 1857 decision upholding slavery. He also argued in a 2005 article for the Federalist Society, a right-wing legal organization, that Title IX does not protect people who face retaliation for reporting gender discrimination. The Supreme Court later rejected that position.

Ralph Erickson, 58, was confirmed to the U.S. Court of Appeals for the 8th Circuit in September. As a district judge in 2016, he was one of two judges in the country who ordered the federal government not to enforce health care nondiscrimination protections for transgender people.

These are just judges that have been confirmed. Nominees in the queue include Leonard Grasz, Trump’s pick for a seat on the U.S. Court of Appeals for the 8th Circuit. Grasz, 56, proposed amending the Omaha City Charter in 2013 to let employers discriminate against LGBTQ people. He has also compared the “personhood” of fetuses to the civil rights of Native Americans and African-Americans, according to an exhaustive report issued by the Alliance for Justice, a left-leaning advocacy group that focuses on the federal judiciary.

Trump’s effort to shift the federal bench to the right isn’t just aimed at district and circuit courts. He nominated Damien Schiff, a 37-year-old attorney, to a 15-year gig on the U.S. Court of Federal Claims. Schiff has criticized efforts to prevent bullying of LGBTQ students, referring to messages of equality as “teaching ‘gayness’ in schools.” He also argued that states should be allowed to criminalize “consensual sodomy.”

Part of the reason the White House has been able to nominate so many judges, so quickly, is because it’s been focused on filling court vacancies in states represented by two Republican senators. It’s easier for Trump’s team to work with Republicans in picking nominees, and then in moving them forward in committee, where it takes both home-state senators turning in a “blue slip” to get the hearing process going.

Trump has been less successful in confirming nominees, though. That’s partly because in the mad rush to fill courts seats, the White House isn’t reviewing nominees’ records as thoroughly as, say, the Obama administration did. That means more controversial nominees and more scrutiny. Democrats aren’t exactly eager to cooperate, either, given the way Republicans treated Obama’s judicial nominees (remember Merrick Garland?).

But as Trump plows through judicial nominations that will be a part of his legacy for decades, the only thing Democrats can do while they’re in the minority, for the most part, is make noise.

If they want real change, says Tobias, “Democrats need to win elections.”

Homophobe Jeff Sessions’s time as Attorney General won’t extend beyond the Trump Administration, if that long. However, the damage he has done to the U.S. legal system, our Constitution, the Department of Justice, and LGBTQ Americans won’t be easily repaired, if ever.

But, life tenured Federal Judges are an even bigger problem. These “robed bigots” will be inflicting cruel, discriminatory, and degrading treatment on the U.S. LGBTQ Community from their benches for decades to come.

In the end, Professor Tobias is entirely correct:“Democrats need to win elections.” Otherwise, our LGBT family, colleagues, friends, and neighbors are going to continue to be targets for homophobic Federal Judges and GOP politicos for many decades.

“US Attorney General Jeff Sessions has reversed a federal government policy that said transgender workers were protected from discrimination under a 1964 civil rights law, according to a memo on Wednesday sent to agency heads and US attorneys.

Sessions’ directive, obtained by BuzzFeed News, says, “Title VII’s prohibition on sex discrimination encompasses discrimination between men and women but does not encompass discrimination based on gender identity per se, including transgender status.”

It adds that the government will take this position in pending and future matters, which could have far-reaching implications across the federal government and may result in the Justice Department fighting against transgender workers in court.

“Although federal law, including Title VII, provides various protections to transgender individuals, Title VII does not prohibit discrimination based on gender identity per se,” Sessions writes. “This is a conclusion of law, not policy. As a law enforcement agency, the Department of Justice must interpret Title VII as written by Congress.”

But Sharon McGowan, a former lawyer in the Justice Department’s Civil Rights Division and now an attorney for the LGBT group Lambda Legal, countered that Sessions’ is ignoring a widespread trend in federal courts.

“It’s ironic for them to say this is law, and not policy,” McGowan told BuzzFeed News. “The memo is devoid of discussion of the way case law has been developing in this area for the last few years. It demonstrates that this memo is not actually a reflection of the law as it is — it’s a reflection of what the DOJ wishes the law were.”

“The sessions DOJ is trying to roll back the clock and pretend that the progress of the last decade hasnt’ happened,” she added. “The Justice Department is actually getting back in the business of making anti-transgender law in court.”

The memo reflects the Justice Department’s aggression toward LGBT rights under President Trump and Sessions, who reversed an Obama-era policy that protects transgender students after a few weeks in office. Last month, Sessions filed a brief at the Supreme Court in favor of a Christian baker who refused a wedding cake to a gay couple. And last week, the department argued in court that Title VII doesn’t protect a gay worker from discrimination, showing that Sessions will take his view on Title VII into private employment disputes.

At issue in the latest policy is how broadly the government interprets Title VII of the Civil Rights Act of 1964, which does not address LGBT rights directly. Rather, it prohibits discrimination on the basis of sex.

But the Equal Employment Opportunity Commission, an independent agency that enforces civil rights law in the workplace, and a growing body of federal court decisions have found sex discrimination does include discrimination on the basis of gender identity and sex stereotyping — and that Title VII therefore bans anti-transgender discrimination as well.

Embracing that trend, former attorney general Eric Holder under President Obama announced the Justice Department would take that position as well, issuing a memo in 2014 that said, “I have determined that the best reading of Title VII’s prohibition of sex discrimination is that it encompasses discrimination based on gender identity, including transgender status. The most straightforward reading of Title VII is that discrimination ‘because of … sex’ includes discrimination because an employee’s gender identification is as a member of a particular sex, or because the employee is transitioning, or has transitioned, to another sex.”

But Sessions said in his latest policy that he “withdraws the December 15, 2014, memorandum,” and adds his narrower view that the law only covers discrimination between “men and women.”

“The Department of Justice will take that position in all pending and future matters (except where controlling lower-court precedent dictates otherwise, in which event the issue should be preserved for potential future review),” Sessions writes.

Sessions adds: “The Justice Department must and will continue to affirm the dignity of all people, including transgender individuals. Nothing in this memorandum should be construed to condone mistreatment on the basis of gender identity, or to express a policy view on whether Congress should amend Title VII to provide different or additional protections.”

Devin O’Malley, a spokesperson for the Justice Department, explained the decision to issue the memo, telling BuzzFeed News, “The Department of Justice cannot expand the law beyond what Congress has provided. Unfortunately, the last administration abandoned that fundamental principle, which necessitated today’s action. This Department remains committed to protecting the civil and constitutional rights of all individuals, and will continue to enforce the numerous laws that Congress has enacted that prohibit discrimination on the basis of sexual orientation.”

McGowan, from Lambda Legal, counters, “The memo is so weak that analysis is so thin, that it will courts will recognize it for what it is — a raw political document and not sound legal analysis that should be given any weight by them.”

Virulent homophobia has always been a key element of the “Gonzo Apocalypto Agenda.” Check out this report from Mark Joseph Stern at Slate about how when serving as Alabama’s Attorney General Gonzo attempted to use an Alabama statute that had been ruled unconstitutional by a Federal Judge to both publicly demean LGBTQ students and stomp on their First Amendment rights. (So much for the disingenuous BS speech that Gonzo delivered on Free Speech at Georgetown Law last week.)  Here’s what happened:

“Attorney General Jeff Sessions delivered a speech at Georgetown University Law Center in which he argued that “freedom of thought and speech on the American campus are under attack.” As my colleague Dahlia Lithwick explained, the attorney general said this in “a room full of prescreened students who asked him prescreened questions while political demonstrators outside were penned off in ‘free speech zones.’ ” Ensconced in a safe space of his own, Sessions blasted the notion that speech can be “hurtful,” criticizing administrators and students for their “crackdown” on “speech they may have disagreed with.”

Sessions’ hypocrisy on speech issues is not a new development. In 1996, the then–attorney general of Alabama used the full power of his office to try to shut down an LGBTQ conference at the University of Alabama. Sessions took his battle to court, asking a federal judge to let him block the conference altogether—or, at the very least, silence students who wished to discuss LGBTQ issues. He ultimately failed, but his campaign reveals a great deal about his highly selective view of free expression. Sessions claims to support freedom for “offensive” speech, but when speech offends him, he is all too happy to play the censor.

When Sessions served as Alabama attorney general, the state still criminalized sodomy. A 1992 law, Alabama Education Code Section 16-1-28, also barred public universities from funding, recognizing, or supporting any group “that fosters or promotes a lifestyle or actions prohibited by” the sodomy statute, either “directly or indirectly.” The law also forbade schools from allowing such organizations to use public facilities. Sessions’ predecessor, Jimmy Evans, had interpreted the statute to effectively outlaw the discussion or promotion of gay rights on public campuses, with that prohibition even extending to AIDS awareness campaigns.

In 1995, the University of South Alabama’s Gay Lesbian Bisexual Alliance sued in federal court to block Section 16-1-28. That summer, the U.S. Supreme Court had ruled that, under the First Amendment, public universities may not deny access to facilities or funding for student organizations on the basis of their viewpoints. This decision, the GLBA asserted, rendered Section 16-1-28 unconstitutional. U.S. District Judge Myron H. Thompson agreed, holding the law to be invalid in a January 1996 ruling.

This decision was excellent news for the Gay Lesbian Bisexual Alliance at the University of Alabama at Tuscaloosa. The GLBA had planned to host the Fifth Annual Lesbian, Gay, and Bisexual College Conference of the Southeastern United States in February 1996. Sessions, by now attorney general, was trying his hardest to shut it down.

“University officials say they’re going to try to obey the law,” Sessions said at the time, as CNN’s Andrew Kaczynski reported in December of last year. “I don’t see how it can be done without canceling this conference. I remain hopeful that if the administration does not act, the board of trustees will.” Sessions didn’t give up even after Judge Thompson struck down the law. “I intend to do everything I can to stop that conference,” he said.

In a last-ditch effort, Sessions returned to Thompson’s court and asked permission to ban the conference. “The State of Alabama,” he explained in court filings, “will experience irreparable harm by funding a conference and activities in violation of state law.” Failing a total ban, Sessions implored Thompson to let him censor any discussion of “safe sex and the prevention of sexually transmitted diseases.” Sessions claimed that, by talking about LGBTQ issues, conference attendees were essentially conspiring to promote criminal activity, and Alabama should not be obligated to support their criminality. Predictably, Thompson rejected Sessions’ arguments, writing that the attorney general was endeavoring to violate students’ free speech rights. Sessions then appealed to the 11th U.S. Circuit Court of Appeals, which unanimously ruled against Alabama. The conference went on as planned.

Cathy Lopez Wessell, a lead organizer and spokeswoman for the conference, told me Sessions’ intervention “was incredibly stressful. We got threatening phone calls. We were attacked from all sides.” She continued, “We were the abomination of the month. I didn’t feel safe in the world for a while. I started to internalize some of the judgment leveled at our group. I thought, there must be something deeply wrong with you if you need to be silenced.”

Lopez Wessell explained that Sessions’ campaign against the conference registered as a broader attack on LGBTQ students.

“If we can’t talk, do we have a right to exist?” Lopez Wessell asked. “If our speech is so dangerous that it needs to be stopped, then are we dangerous? We weren’t promoting any particular activity; we just wanted to talk—about our experiences, about our existence.”

Denying the humanity as well as the human rights of those he is biased against is a staple of the Gonzo Apocalypto agenda. Just look at his constant attempts to tie all members of the Hispanic ethnic community to crime, drugs, and gangs (even though all credible studies show that immigrants or all types have markedly lower crime rates than native-born U.S. citizens) and his false and gratuitous attempts to tie “Dreamers” to crime, terrorism, and loss of jobs!

There is no more certain way of knowing that a DOJ “legal” memo is all policy and no law than the statement: “This is a conclusion of law, not policy.“ In other words, “Don’t you dare accuse me of doing what I’m actually doing!”

“Most intriguingly, some have said that black players ought to protest exclusively in ways white football fans approve of. The author John Pavlovitz has explicitly named this latter critique “the arrogant heart of privilege.” As he put it, this defines that core of white privilege: “being the beneficiaries of systematic injustice, and then wanting to make the rules for the marginalized in how they should speak into that injustice.”

This is an incredibly astute and important observation, but in the past few days another more sinister theme has emerged in the attack on professional athletes and their acts of silent protest. It’s a second coming of Trump’s ongoing war on truth, except in this iteration, the attack is on the truths of others. No longer content to simply lie about things, this White House wants to tell you what other people actually mean when they speak. Nobody better captured this mentality than Trump’s press secretary, Sarah Huckabee Sanders. During Monday’s White House press briefing, Sanders was asked why the president wouldn’t acknowledge that players who knelt during the national anthem were doing so to protest racism and police brutality. Questioned about Trump’s claim that “the issue of kneeling has nothing to do with race,” Sanders responded, “I think the focus has long since changed.” She amplified that unsupported claim by saying that the players were protesting incorrectly to begin with. “I think if the debate is really, for them, about police brutality, they should probably protest the officers on the field that are protecting them instead of the American flag,” she offered.

That takes us from privilege to silencing, and it’s not a move that should go unremarked.
So, when Colin Kaepernick explicitly says time and time and time again that he is protesting police brutality, he is wrong. And when another player, Eric Reid, said on Monday that players are taking a knee expressly not to protest the flag or the military, but to protest the “incredible number of unarmed black people being killed by the police,” he is also wrong. What Sanders and Trump are saying here exemplifies one of the most grotesque aspects of unchecked privilege. It transcends even patronizing lectures about how black men should protest in such a way as to avoid offending white people. This is an attempt to dictate—with the threat of job loss—the very ability of some black men to have and maintain control over their own speech. What the president and Sanders are claiming is that they are better situated than the actual speakers to understand what those speakers are saying. That takes us from privilege to silencing, and it’s not a move that should go unremarked.

The president and Sarah Huckabee Sanders have the double luxury of being able to claim to know what NFL players really mean by their protests, and also being able to invent fake after-the-fact rationales with which to cover their own false and racially inflammatory statements. Colin Kaepernick doesn’t have that luxury. He doesn’t—at this moment—even have a job. If we are truly interested in anything that resembles truth seeking anymore, instead of allowing this controversy to be sidetracked by those who would put false words in a protester’s mouth, let’s give him the dignity of accepting at face value the real words and intentions he claims for himself.“

“More Dangerous Than Weed.” — Gonzo Apocalypto Gets A Warm “Welcome” To Portland, OR!

“Portland is a sanctuary city in a sanctuary state — a place where officials have scoffed at threats from the Trump administration, where court employees have shuffled illegal immigrants out through employee entrances when Immigration and Customs Enforcement personnel conducted raids, and where local law enforcement officials have argued that enforcing federal immigration policies is not their job.

Sessions’s appearance here Tuesday was brief. He spoke to a group of federal employees — ICE, FBI, Drug Enforcement Administration, and Bureau of Alcohol, Tobacco, Firearms and Explosives — for 18 minutes in the “oath room” of a Pearl District building, the place where people recite the Oath of Allegiance before they are granted U.S. citizenship. Sessions railed against sanctuary cities, places he called a “trafficker’s, a smuggler’s or gang member’s best friend.”

But outside, the protest against Sessions lasted for hours. A group of a dozen protesters leaned on a metal barricade just before 11 a.m. — hours before Sessions even touched down in Portland. And they were ready.

 

Juan Rogel, 26, is a leader of Milenio.org, a group that helps engage Latinos in political action and was one of several groups that organized protesters Tuesday.

“We want to send a clear message that he is not allowed to come here,” Rogel said of Sessions. “We’re pissed off.”

Rogel said it’s essential for Latinos to organize and for Sessions to see, if only for a moment, that people here aren’t welcoming of him.

“My dad used to say, ‘If you knock on the door for opportunity and they don’t open it, you have to break it down,’ ” Rogel said. “We haven’t been heard. We are young people working on a legacy for tomorrow.”

No, Gonzo, “sanctuary cities” are not a “smuggler’s best friends.” Look in the mirror:  you, Gonzo, are the smugglers’ and gangsters’ “best friend” with your xenophobic policies intended to drive a wedge between the Hispanic communities across the nation and law enforcement and to heap shame and blame on law-abiding residents who are just trying to make a living helping America out.

I can guarantee that smuggling and gang violence won’t be solved by a bunch of White Nationalists sitting at the DOJ thinking about the next attack they can make on Hispanic America. There is no “silver bullet” solution to deep-seated problems. But, whatever the solution might be, it’s going to take some reflection and lots of help, trust, assistance, and sharing of information with the Hispanic community which would like to get rid of gangs as much as you would (because they are much more likely to be victims than you and your white buddies are) and whose undocumented members (usually intermingled with family or neighbors in legal status) would vastly prefer being allowed to come to the United States through legal channels rather than paying smugglers.

Almost forty years ago when I was counsel to the “Legacy INS” Enforcement, among other things, one of the few effective tools we had for breaking up smuggling rings involved fairly sophisticated undercover operations. These, in turn, almost always involved agents, local law enforcement, or informants from ethnic communities.

Why would anyone from the Hispanic community want to risk his or her life to help someone like Gonzo, who disses them, denies their achievements, and intentionally minimizes their monumental contributions to America’s success and prosperity at every turn?

NYT OP-ED: “MAINSTREAMING” HATE: How Trump & His Supporters Help Legitimize A Global White Hate Movement!

Last September, Patrik Hermansson, a 25-year-old graduate student from Sweden, went undercover in the world of the extreme right. Posing as a student writing a thesis about the suppression of right-wing speech, he traveled from London to New York to Charlottesville, Va. — and into the heart of a dangerous movement that is experiencing a profound rejuvenation.

Mr. Hermansson, who was sent undercover by the British anti-racist watchdog group Hope Not Hate, spent months insinuating himself into the alt-right, using his Swedish nationality (many neo-Nazis are obsessed with Sweden because of its “Nordic” heritage) as a way in. It wasn’t always easy. “You want to punch them in the face,” he told me of the people he met undercover. “You want to scream and do whatever — leave. But you can’t do any of those things. You have to sit and smile.”

What he learned while undercover is one part of a shocking, comprehensive new report from Hope Not Hate that sheds light on the strange landscape of the alt-right, the much discussed, little understood and largely anonymous far-right movement that exists mostly online and that has come to national attention in part because of its support for Donald Trump.

As a result of the growing influence of the far-right social-media ecosystem, once-moribund hate groups in both the United States and Europe — groups that mostly existed long before “alt-right” entered the vernacular — are enjoying a striking uptick in recruitment.

This latest wave of potential members is young — teenage and 20-something men (they’re mostly men) appear to be exhibiting interest in far-right ideas in numbers that would have been unthinkable just a few years ago. These young men are being radicalized largely through the work of a popular group of new far-right internet personalities whose videos, blog posts and tweets have been consistently nudging the boundaries of acceptable conversation to the right — one of the explicit goals of racist extremists everywhere.

And while “globalist” may be one of the alt-right’s favorite slurs, Hope Not Hate conclusively shows that the alt-right is itself now a global movement with regular interaction among far-right figures from Scotland to Sweden to Seattle.

Mr. Hermansson’s story offers vital insights into these groups’ tactics and their sometimes bizarre practices. During his time undercover, he hung out with heavily armed Holocaust deniers and attended gatherings where extremists drank mead from a traditional Viking horn and prayed to the Norse god Odin. In Charlottesville, he marched alongside hundreds of young neo-Nazis and white supremacists before he was sprayed with Mace by a counterprotester and witnessed the car attack that killed Heather Heyer.

In Britain, Mr. Hermansson attended a private dinner of extremists where Greg Johnson, a reclusive leading American far-right figure who is editor in chief of Counter-Currents Publishing, explained the need to “mainstream this stuff — or, more precisely, we need to bring the mainstream towards us.”

“If Mr. Jorjani wasn’t exaggerating to Mr. Hermansson, and he did have a relationship with White House officials, that would certainly be alarming. But even if he was exaggerating, it’s still important to understand how messages like his could travel from the far reaches of the right-wing internet and all the way into — or close to, at least — the White House.

The extreme alt-right are benefiting immensely from the energy being produced by a more moderate — but still far-right — faction known as the “alt-light.”

The alt-light promotes a slightly softer set of messages. Its figures — such as Milo Yiannopoulos, Paul Joseph Watson and Mike Cernovich — generally frame their work as part of an effort to defend “the West” or “Western culture” against supposed left-liberal dominance, rather than making explicitly racist appeals. Many of them, in fact, have renounced explicit racism and anti-Semitism, though they will creep up to the line of explicitly racist speech, especially when Islam and immigration are concerned.

This apparent moderation partly explains why they tend to have much bigger online audiences than even the most important alt-right figures — and why Hope Not Hate describes them as “less extreme, more dangerous.” Alt-light sites like Breitbart, formerly home to Mr. Yiannopoulos, as well as Prison Planet, where Mr. Watson is editor at large, draw millions of readers and are key nodes in a hyperkinetic network that is endlessly broadcasting viral-friendly far-right news, rumors and incitement.

Fluent in the language of online irony and absurdism, and adept at producing successful memes, alt-lighters have pulled off something remarkable: They’ve made far-right ideas hip to a subset of young people, and framed themselves as society’s forgotten underdogs. The alt-light provides its audience easy scapegoats for their social, economic and sexual frustrations: liberals and feminists and migrants and, of course, globalists.

The alt-light’s dedicated fan base runs into the millions. Mr. Watson has more than a million YouTube followers, for example, while Mr. Yiannopoulos has more than 2.3 million on Facebook. If even a tiny fraction of this base is drafted toward more extreme far-right politics, that would represent a significant influx into hate groups.

According to researchers, the key to hooking new recruits into any movement, and to getting them increasingly involved over time, is to simply give them activities to participate in. This often precedes any deep ideological commitment on the recruits’ part and, especially early on, is more about offering them a sense of meaning and community than anything else.

Intentionally or not, the far right has deftly applied these insights to the online world. Viewed through the filters of alt-light outlets like Breitbart and Prison Planet, or through Twitter feeds like Mr. Watson’s, the world is a horror show of crimes by migrants, leftist censorship and attacks on common sense. And the best, easiest way to fight back is through social media.

The newly initiated are offered many opportunities to participate directly. A teenager in a suburban basement can join a coordinated global effort to spread misinformation about Emmanuel Macron, France’s centrist president, in the hopes of helping far-right leader Marine Le Pen. Anyone who wants to do so can help spread the word about supposed mainstream media censorship of the Muslim “crime wave” the far right says is ravaging Europe.

These efforts — a click, a retweet, a YouTube comment — come to feel like important parts of an epochal struggle. The far right, once hemmed in by its own parochialism, has manufactured a worldwide online battlefield anyone with internet access can step into.

And if you’re one of those newcomers happily playing the part of infantryman in the “meme wars” that rage daily, maybe, along the way, one of your new online Twitter buddies will say to you, “Milo’s O.K., but have you checked out this guy Greg Johnson?” Or maybe they’ll invite you to a closed online forum where ideas about how to protect Europe from Muslim migrants are discussed a bit more, well, frankly. Maybe, if you’re really lucky, you’ll eventually discover a whole new political movement to join.

All of which can explain why members of the hard-core alt-right are watching the explosive success of their more moderate counterparts with open glee, unable to believe their good luck. “I’m just fighting less and less opposition to our sorts of ideas when they’re spoken,” Mr. Johnson, the Counter-Currents editor, told Mr. Hermansson. His optimism, unfortunately, appears to be well founded.”

The program wasn’t federal intrusion. Local police asked for it to improve relations with the communities they serve.
As St. Louis and the rest of the country reacted to the acquittal of the police officer who killed Anthony Lamar Smith last Friday, the Justice Department had its focus on something else. While we expressed outrage at continued state violence and another fatal police shooting of a Black man with no accountability, Attorney General Jeff Sessions did just the opposite.
On Friday, DOJ announced the end of a community policing program as we know it. The program, which once helped St. Louis County police address racial profiling and other localities address issues like excessive use of force, is no more. Instead, DOJ will now assist local agencies in “fight[ing] violent crime,” aka, Session’s failed drug war agenda.
The Collaborative Reform Initiative for Technical Assistance, or “collaborative reform” for short, was started in 2011 at the request of local law enforcement. The DOJ program provided resources to law enforcement agencies that were experiencing serious policing failures and reached out to the agency for help. These police departments were plagued by excessive force, biased policing, and failed police-community relations.
As the former head of the COPS office, Ron Davis, described, “[collaborative] reform worked because it was driven by local police, elected [and] community leaders who wanted stronger relationships [and] safer cities.” This effort was far from the “federal intrusion” that Sessions uses to describe the previous administration’s oversight of local policing. Police departments and local communities sought out and volunteered for this federal program. And they were right to do so.
The police departments benefiting from collaborative reform were often responsible for fatal police shootings that garnered national attention. We are talking about departments in Milwaukee, Wisconsin, where Dontre Hamilton was fatally shot by police; Saint Anthony, Minnesota, where Philando Castile met the same fate; and North Charleston, South Carolina, where Walter Scott was also fatally gunned down by a police offer.
The collaborative reform cities that were waiting on DOJ’s recommendations, like Milwaukee, have been told to stop holding their breath. The reports are not coming. A draft of the Milwaukee report shows just what is at stake with the loss of these federal resources. The report revealed that “MPD members generally do not understand their roles in community policing.” The report also found that “MPD’s traffic enforcement practices have a disparate impact on the African-American community” and the department “does not have specific guidelines for conducting use of force investigations.”
For DOJ to now deny critical policing resources to troubled agencies and communities is appalling. Police departments and local officials asked for federal help so they could attempt to “strengthen and build the mutual trust” between law enforcement and communities in the midst of tragedy, often a fatal police shooting. And for Sessions to say he now wants the program to “fight violent crime” is ridiculous. Fatal police shootings can be violent crimes; they just tend to happen without consequence as we saw most recently in St. Louis.
So what can be done with police practices and a justice system that continues to fail this country? Let’s keep organizing, advocating, and litigating, making sure our voices are heard. Let’s tell our local police departments that we will work with them to ensure constitutional policing practices; that we will hold them accountable even if this Justice Department will not.

The latest issue of Action Comics No. 987 contains a scalding scene: A white supremacist, fed up with a company that just laid him off, decides to load up his machine gun and kill the undocumented workers he believes took his job. Luckily, in the nick of time, Superman arrives to shield the would-be victims from a storm of bullets:

Superman then subdues the shooter, telling him that he needs to take more personal responsibility and to rethink his homicidal tendencies. He also tells the police officers who respond to the incident to see to it that the shooter’s intended victims are safe:

Given the violent events that took place in Charlottesville, Virginia, last month, including a domestic terror attack that killed Heather Heyer, as well as the recent national conversation over the Trump administration’s stance on DACA, it’s easy to see how the plot of Action Comics No. 987 could feel like a knee-jerk reaction and parallel to reality. But in reality, comic book issues and arcs — including this one, which was written by Dan Jurgens and illustrated by artists Viktor Bogdanovic, inkers Jonathan Glapion and Jay Leisten, and colorist Mike Spicer — are planned well in advance.

 

Still, the action of preventing a mass murder, which seems in line with Superman’s moral compass, hasn’t come without controversy. Fox News has a column calling the Man of Steel a “propaganda tool for the defenders of illegal aliens,” and the right-wing website Breitbart derided him as “Social Justice Supes.”

Their argument is that comic book writers and artists have inserted a pro–illegal immigrant agenda into their comics, and that it’s part of a larger trend of politicizing comic books.

But there are a couple of things to note about the issue.

The first is that the “undocumented workers” designation in Action Comics No. 987 comes from the homicidal white supremacist — an unreliable narrator. It could be interpreted that he’s shooting at the workers at his company who aren’t white because he’s stereotyping and projecting his bigotry onto them.

Another facet of this issue is that in the universe of the comic, similar violent outbursts and anger are happening worldwide. Vaccines are being stolen, animals are being poached, workplaces are being shot up, prison riots are taking place — and Superman is struggling to figure out why it’s all erupting at once. The thwarted workplace shooting is part of a bigger arc that involves the idea that the “common good” has been dissolved, and there’s a villain responsible for it (the issue has a giant reveal at the end).

Perhaps the most entertaining aspect of any conversation bemoaning Superman’s lifesaving actions is the failure to realize that Superman himself is a literal alien immigrant who grew up in America. Superman’s creators, Jerry Siegel and Joe Shuster, are the children of Jewish immigrants.

And Superman has always stood up for the justice of all Americans, as he did in this 1950s poster:

 

“If you hear anybody talk against a schoolmate or anyone else because of his religion, race or national origin — don’t wait: tell him that kind of talk is un-American,” Superman says in the scene on the poster.

This week’s issue of Action Comics, despite the outcry against it, seems to be following that credo.

“At his swearing-in as the nation’s top law enforcement official in February, Attorney General Jeff Sessions picked up a thread that had run throughout Donald Trump’s campaign for president: America is experiencing an alarming crime wave.

“We have a crime problem,” Sessions said. “I wish the rise that we are seeing in crime in America today were some sort of aberration or a blip. My best judgment, having been involved in criminal law enforcement for many years, is that this is a dangerous, permanent trend that places the health and safety of the American people at risk.”

Preliminary analysis of crime data from the nation’s 30 largest cities released by the Brennan Center for Justice on Wednesday suggests that it isn’t. According to the center’s overview of crime and murder data, 2017 is on pace to have the second-lowest violent crime rate of any year since 1990.

From the report:

  • The overall crime rate is projected to drop by 1.8 percent to the second-lowest point since 1990.
  • The violent crime rate is projected to fall by 0.6 percent, also to the second-lowest point in over 25 years. (The lowest rate was in 2014.) “This result,” the report’s authors write, “is driven primarily by stabilization in Chicago and declines in Washington, D.C., two large cities that experienced increases in violence in recent years.”
  • The murder rate is projected to be down 2.5 percent, on-par with the rate in 2009.

Explore the center’s data for each of the country’s largest cities.

While there was indeed a national uptick in violent crime and murder during 2015 and 2016, one of the underrecognized drivers of those shifts was the sharp increase in killings in two cities, Chicago and Baltimore, which combined made up more than half of the increase in murders in large cities from 2014 to 2017. This year, the number of murders in Chicago alone is expected to drop 2.4 percent. But it’s declines in New York, Houston and Detroit that are driving the overall decrease.

Inimai Chettiar, director of the justice program at the center, told The Post that the analysis suggested two things.

“First, the long-term trend toward safer cities isn’t going anywhere,” Chettiar said over email. “The evidence conclusively shows there is currently no national crime wave. Second, short-term fluctuations in crime are often driven by local factors.”

There are several cities that reinforce that point. The murder rate in Charlotte, doubled over the first half of 2017, for example, even as it fell sharply in other places.

Chettiar addressed Sessions’s concerns directly.

“Our data leads us to believe that the upticks in 2015 and 2016 were likely short-term fluctuations,” she wrote, noting that “not enough research has been done to identify the exact catalyst.”

The center, which is a part of the New York University School of Law, shared its report with Ronal Serpas, a former New Orleans police superintendent who now co-chairs an organization focused on reducing incarceration rates.

“In contrast to what we have been hearing from the president and attorney general, this new data from police departments shows that all measures of crime and murder are in decline this year,” Serpas said in a statement provided to The Post. “It’s irresponsible to incite public panic based on falsehoods, and it makes our police officers’ jobs harder.” Both Serpas and Chettiar noted that in places where violent crime had increased the Trump administration’s focus was best placed on that crime — as opposed to immigration violations, for example.

As the Trump campaign and then the Trump presidency cited localized increases as examples of the crime threat that Trump pledged to solve, independent observers frequently noted that, despite the uptick in crime in recent years, overall levels were still near recent lows following the sharp drop of the last 20 years. The Brennan Center’s analysis suggests that this trend will continue, leading the administration to a no-doubt vexing problem:

I’ve noted many times before that Session’s disingenuous, xenophobic, White Nationalist focus on immigration enforcement actually makes the country less safe from crime. This report confirms that.

Moreover, with his “morbid fixation” on spreading a false narrative on immigration, Sessions has abandoned the real law enforcement functions of the DOJ, particularly in the areas of civil rights, voting rights, police brutality, prison reform, protection of the LGBTQ community, right-wing hate groups, domestic violence, and effectively combatting gangs, drug cartels, and human traffickers. As I’ve noted before, the latter three groups have been energized and empowered by Sessions’s focus on janitors, maids, gardeners, Dreamers and other “collaterals” — even dissing legal immigrants ands implicitly U.S. citizens of ethnic and immigrant heritage — rather than working on nuanced solutions to real law enforcement problems. By sowing unnecessary fear, mistrust, and terror among law-abiding productive members of migrant communities, he has basically “green-lighted” them as targets for crime, domestic violence, sexual exploitation, and gang recruitment. Ironically, this is a scenario I heard many times from individuals seeking refuge from third world countries: “I can’t go to the police because they won’t help and might even abuse or arrest me with impunity.”

Sessions is destroying the hard work of of community policing in ethnic communities in many cities throughout the U.S. One reason that many jurisdictions abandoned the “Safe Communities” program pushed by the Obama Administration is because they found it was a misnomer: busting undocumented workers and minor offenders actually did not make communities “safer.” Rather than learning from history, Sessions is doubling down on past failures. “Irresponsible” might be too kind a word to describe the Trump-Sessions White Nationalist legal agenda.

GONZO’S LATEST TARGET: LGBTQ Americans — DO”J” Gratuitously Files “Embarrassing” Brief With Supremes SUPPORTING Homophobia: “politicized bigotry dressed up in inane legalese!”

“On Thursday afternoon, the Department of Justice filed an amicus brief in Masterpiece Cakeshop v. Civil Rights Commission, a constitutional challenge to LGBTQ nondiscrimination laws. The DOJ urged the Supreme Court to rule that laws barring businesses from refusing to serve gay couples may violate the First Amendment’s free speech guarantee. Its brief is an exercise in cynical dishonesty, one that’s difficult to read as anything less than politicized bigotry dressed up in inane legalese.

Even worse, the brief does not explain why homophobia deserves special respect under the law. The Supreme Court has said that homosexuality is immutable, like race. Why, then, should animus toward same-sex couples be treated differently from animus toward interracial couples? And what about religious bigotry? Can a devout baker refuse to sell a cake to an interfaith couple, and can an atheist one say a Christian can’t buy cupcakes for a christening? Can a sexist baker refuse to serve a female customer? What if his misogyny is derived from religion? And why stop at a cake? Shouldn’t the preparation of other foods qualify as expressive conduct, too? Doesn’t every good or service involve some measure of expressive conduct or association that the First Amendment could theoretically protect?

In its brief, the DOJ implicitly raises all of these questions without answering them because it can’t answer them—not honestly, at least. The reality is that the courts cannot, with any logical coherence or consistency, deny civil rights protections to some groups but not others. Either nondiscrimination law are constitutional or they aren’t. The First Amendment does not grant greater rights to homophobic bakers than racist or sexist ones. Plenty of bigoted business owners wish they could assert a constitutional privilege not to associate with specific groups. If the courts open the door to one, they’ll open the door to all. Shopkeepers do not have a special right to turn away gays from their stores.

The brief strives to avoid this problem because it is, at bottom, a political document. Attorney General Jeff Sessions recently gave a speech to ADF thanking the organization for its “important work” defending “religious liberty.” Through Sessions, President Trump is discharging his obligation to appease the bigots in his base. The DOJ’s efforts, however, may prove counterproductive. This brief will delight the court’s reactionaries who favor religious supremacy and disdain gay rights. But it can only estrange Kennedy—who notably, has allowed an LGBTQ nondiscrimination policy to trump a First Amendment claim in the past. Kennedy is always eager to protect the “equal dignity” of same-sex couples; the DOJ now seeks to undermine it. The Trump administration might score political points with this brief, but it won’t win enough votes at the court.

Under Sessions, the Department of Justice has become  purveyor of racism, bigotry, hate, voter suppression, xenophobia, White Nationalism, homophobia, and some incredibly bad and intellectually dishonest lawyering. Gonzo is a disgrace to his position and an insult to American justice. Liz was right. And let’s not forget how she was treated by the GOP when she tried to speak truth about Sessions in the Senate!
