Watching the Trump campaign’s attacks on the election results, I now see what might have happened if, rather than nip and tuck the Trump agenda, responsible Justice Department attorneys had collectively — ethically, lawfully — refused to participate in President Trump’s systematic attacks on our democracy from the beginning. The attacks would have failed.

Read the full op-ed at the link. That’s right Erica. Lack of ethics, morality, and failing to uphold the Constitution and the rule of law have consequences. Helping to “custom design” obvious pretexts for racist and hate inspired policies, for consumption by right-wing judges who only seek “cover” for going along  to get along with fascism, is wrong. Duh!

It’s no surprise that the clearly unconstitutional and racially and religiously bigoted “Travel Ban,” willingly embraced by an intellectually dishonest and morally compromised Supremes majority, was first on the list in Erica’s “confession.” 

But, don’t expect any apologies from the vast majority of Trumpist lawyer/enablers who violated their oaths of office or from the big time law firms (one where I was formerly a partner) who have granted them undeserved refuge at fat salaries! Nor should we expect large-scale redemption from the legions of Government lawyers in DOJ, DHS, and elsewhere who will assert the “Nuremberg defense” of “just following orders.”  But, that doesn’t mean that the rest of us can’t demand some accountability for participation in  what are essentially “crimes against humanity.” 

Erica’s article largely echoes what my friend and colleague Judge Jeffrey Chase, many of our colleagues in the Round Table of Former Immigration Judges, ⚔️🛡 and numerous members of the New Due Process Army (“NDPA”) have been saying throughout this Administration. Indeed, I frequently have noted that the once-respected Solicitor General’s Office and EOIR operated as basically “ethics free zones” under the disgraced “leadership” of Sessions, Whitaker, and Barr.

It’s also why the the Biden-Harris team that takes over at DOJ must: 

  1. immediately remove all the current “executives” (and I use that term lightly) at EOIR as well as all members of the BIA and transfer them to positions where they can do no further damage to asylum seekers, migrants, their (often pro bono or low bono) lawyers, or the rest of humanity; 
  2. replace them with qualified individuals from the NDPA; and 
  3. be circumspect in eventually making retention decisions for Immigration Judges, taking into account public input as to the the degree to which each such judge’s jurisprudence during the Trump kakistocracy continued to reflect adherence to constitutionally required due process and fundamental fairness to migrants, respect for migrants and their representatives, best practices, and interpretations that blunted wherever reasonably possible the impact of the kakistocracy’s xenophobic, racist, White Nationalist policies. 

American justice has been ill-served by the DOJ and the Immigration Courts over the past four years. That’s something that must not be swept under the carpet (as is the habit with most incoming Administrations). 

The career Civil Service overall, and particularly complicit and often ethics-free government lawyers,  failed to put up the necessary resistance to an overtly anti-American regime with an illegal and immoral agenda. Lives were lost or irreparably ruined as a result. That’s a big-time problem that if not addressed and resolved will likely make continuance of our national democratic republic impossible.

Trump’s Asylum & Immigration Policies Must be Rolled Back

“Stephen Miller, the self-hating white nationalist who has dictated this administration’s immigration policy from the beginning, was once a staffer for then-Senator Jeff Sessions. Miller subscribes to the ‘white replacement’ or ‘white genocide’ theory that the brown-skinned migrant hordes will replace the superior descendants of Western civilization if not stopped.”

In 2016, after a legal career of 30 years in refugee and asylum protection, including eight years as a federal refugee officer and seven years as an immigration judge, I accepted a position in the Arlington, Virginia asylum office as a Supervisory Asylum Officer. I had tremendous respect for the U.S. asylum program and I knew from experience that most asylum officers choose the job as a humanitarian calling; their ranks include many attorneys and individuals with graduate degrees, with experience in the Peace Corps and other humanitarian backgrounds. And I can affirm that Asylum Officers have the hardest job of any immigration officers in USCIS-United States Citizenship and Immigration Services, due to the complex and ever-changing asylum law, and the nature of the intensive interviews.

The law enforcement side of our immigration system is exercised by ICE — Immigration and Customs Enforcement, a sub-agency of DHS that was created, along with Department of Homeland Security, in 2003 after the tragedy of 9/11. ICE officers are hired from a completely different profile of applicants and receive much less training in the humanitarian aspect of immigration law. The equivalent at the border is CBP — Customs and Border Protection.

The Netflix Series Immigrant Nation, airing in August 2020, exposes how, soon after Trump’s ascendancy to the presidency, he and his nativist cronies put into place a series of executive measures designed to practically eliminate refugee admissions; to curtail and eventually eliminate access to our asylum system; and even to severely reduce lawful migration to the United States. Virtually all of these executive measures are unlawful, in conflict with our nation’s immigration statute and in violation of our international treaty obligations, and even demonstrably harmful to the economic well-being of the U.S. They have all been challenged in court and practically every such executive measure has been deemed unlawful by federal district and appellate courts, yet the anti-immigrant juggernaut sails on. Recently the GAO — Government Accounting Office, an independent body, declared that, according to the Federal Vacancies Reform Act the current Acting Directors of both DHS, Chad Wolf, and USCIS, Ken Cuccinelli, were unlawfully appointed, and presumably every edict that they have issued since their appointments this past year will also be deemed unlawful.

One of the first ignoble acts of the administration’s new appointee to head U.S. Citizen and Immigration Services, Director Lee Cissna, was the removal of this truism from the agency’s mission statement: “America is a Nation of Immigrants.” Why would the head of the agency that receives all applications for visas, both temporary and permanent, and for asylum and refugee protection choose to redact such seemingly innocuous and self-evident verbiage from the agency’s mission statement?

In the same time frame the Department of Housing and Urban Development, headed by Trump’s appointee Ben Carson, removed the words “inclusion” and “free from discrimination” from its mission statement. We’ve seen in history how totalitarian regimes try to control the dialogue within their populace by changing and sanitizing language, including the use of language within federal institutions.

Simultaneously the administration was implementing the so-called Muslim ban against citizens and residents of seven mostly-Muslim countries out of supposedly national security reasons. No one has ever explained why Saudi Arabia, the home of 15 of the 19 9/11 bombers, was not included in the list. (Saudi Arabia is also the home of the Al Qaeda sympathizer who shot up the Naval Air Station at Pensacola,Florida Air Base in December, 2019, killing three sailors and wounding eight.)

In the early days of this administration there was much hype over the “migrant caravans” composed mostly of Central Americans from the “northern triangle” countries, El Salvador, Honduras and Guatemala, that were “invading” our country — the old “barbarian hordes” trope that is a favorite of every totalitarian regime. In fact the numbers of each such “caravan” for the most part would easily fit inside a typical college stadium. (Current demographics demonstrate that even if we admitted all of them as potential workers and residents, the U.S. would still experience labor shortfalls in the near future and they would not supplant the decline of our native-born population.)

In the final months of 2016, I traveled with a group of asylum and refugee officers to San Salvador where we interviewed and vetted minors who were requesting refugee protection because of threats to themselves and their families by the ruthless MS-13 and 18th Street gangs. The children we spoke with or their parents had all received such threats as, “Either you work for us or you and your parents will be dead next week,” or “Give me your daughter or you have two days to leave the country.” And they all knew neighbors or close relatives who had died when such threats were ignored. We felt gratified knowing that we were granting these kids a lifeline of resettlement to the U.S.. I would only hope that any American father or mother, if ever faced with such a choice by a credible threat, would have the courage and means to flee across borders in order to protect their children, just as those parents joining the caravans with their children have chosen to do.

The new administration ordered a halt to such in-country interviews and even the resettlement of the cases we had already approved for travel. Its spokesmen have continuously and falsely characterized such asylum applicants as fraudsters who are gaming the system. The administration’s first morally challenged Attorney General, Jeff Sessions, claimed there was a conspiracy of corrupt attorneys who are manufacturing all of their stories. Believe me, they are not manufactured. All credible international reporters, including our own State Department, rebut the claim that such migrants are merely seeking jobs in the U.S. International reports affirm that some gangs in El Salvador are able to maintain such power and territorial control that they exercise the functioning equivalent of State authority, making it impossible for potential victims to resist their demands.

Sessions even admonished the assembled group of immigration judges at a conference, telling them they must not let their humanitarian impulses interfere with some fictitious mandate to deport as many applicants as possible. (Stephen Miller, the self-hating white nationalist who has dictated this administration’s immigration policy from the beginning, was once a staffer for then-Senator Jeff Sessions. Jeff Sessions also chose to meddle in the administration of the immigration courts, in such a bungling manner that his mandated reforms achieved the opposite of his goal to reduce backlogs. By restricting the ways in which immigration judges can control their own docket, such as eliminating a judge’s ability to place a case on hold or “administratively close” a case while collateral legal action is ongoing in the migrant’s case, and by taking away ICE trial attorneys’ discretion to agree to grants of compelling cases, backlogs blossomed by the tens of thousands — within the two and a half years of this administration from approximately 500,000 to currently one and a half million.

The Netflix film crew obtained unprecedented access to ICE and CBP operations in the making of their series. I have trained asylum officers at the Federal Law Enforcement Training Center at Glencoe, Georgia, featured in the first episode of the Netflix series, and I have supervised asylum officers at the ICE family detention centers in Texas featured in the first episode. And I experienced, along with my colleagues, the devastating effects of the administration’s continuing attempts to deter refugees from coming to our southern border through abuse and cruelty, the so-called family separation policy. It is telling to see how many ICE and CBP officers and supervisors conceded, on camera, that the deterrence of ripping children from their parents’ arms upon arrival at the border is cruel and inhumane and un-American, but they felt compelled to follow the orders because “it’s the law.”

The so-called Zero Tolerance policy that was advanced by retired Marine General Kelly, first DHS Secretary and later White House Chief of Staff, and AG Sessions was a sham from the get-go. An impossible task, launched for public consumption and to create the impression that only by locking up all unlawful border crossers could any order be returned to the enforcement of our laws. The sham is that no law enforcement body in the country, federal or state, has a zero tolerance policy, simply because no one has the resources to detain, charge, prosecute, adjudicate and jail all offenders. (This stark reality is in fact the reason for the plea bargaining system in criminal court). In my career I observed how the U.S. Attorney’s Offices in Washington, D.C., and in San Diego, would, within their discretion, “no-paper” cases they considered too minor or insignificant to prosecute, saving their powder for bigger game. This was also the policy that the Obama Administration, under guidance of then DHS Secretary Janet Napolitano, established as ICE policy, when ICE agents and prosecuting attorneys were advised to let the low-hanging fruit go, such as hard-working but undocumented laborers, and concentrate instead on serious felons for apprehension and removal. The admitted consequences of this administration’s Zero Tolerance policy was to require all migrants be detained and prosecuted. Since children cannot be detained in an adult facility, they were to be separated from their parents, in order to achieve the maximum of trauma and pain upon the children and their parents. The trauma itself was to be a deterrent to future unlawful crossers, by “sending a message” not to come to the U.S. The notorious photos of kids in cages have tarnished our international reputation and provided talking points for terrorists.

Netflix film crews accompanied agents on raids in multiple locations, when the Zero Tolerance policy initially led to mass inland roundups. The cameras recorded agents blatantly lying to targets about who they are and their authority to enter private dwellings and arrest suspects without criminal arrest warrants, clear violations of the Fourth Amendment. We see numerous ICE veterans, and even FODs-Field Office Directors — lamenting the new ‘catch everyone’ policy, knowing from experience that such tactics are inhumane and bound to fail in the long run.

We see a gung-ho ICE public affairs officer trying to convince the Field Office Director of the Charlotte, North Carolina office to lie in a press briefing and indicate that 90% of the migrants detained in a community-wide sweep have criminal records; the FOD twice corrects him that the correct figure is 30–35%, meaning the remaining 70% are harmless field workers, hotel employees, construction workers or single mothers with U.S. citizen children.

Even though political appointees such as DHS Secretary Kirsjten Nielsen and AG Sessions were willing to blatantly lie to Congress about the motivation and consequences of such cruel policies, they were still tossed out by the president when the reality on the ground impaired their ability to achieve deportation numbers sufficient to satisfy the Nativist in Chief. Ultimately it took an even more barbaric policy, the Migrant Protection Protocol (MPP), another unlawful executive order, to force legitimate asylum seekers to remain on the Mexican side of the border while their cases were piling up in the bureaucracy. MPP is Orwellian double-speak, because the migrants, rather than being protected, are being sent into circumstances where they are easy prey for cartels targeting them and are notoriously subject to kidnappings, rapes, robberies and murders. No migrant being forced to wait for months in tents or temporary shelters along the border is safe.

Most disappointing to me as a Supervisory Asylum Officer was how management at the Arlington Asylum office, as soon as the MPP operating instructions came down in early 2019, was so willing to coerce asylum officers into violating their oaths to uphold the Constitution and the laws of the U.S. At an internal meeting with management and the asylum officers, supposedly to hash out the ground rules of this new MPP program, one of my officers complained that he felt both ethically and morally conflicted for the first time in his career, knowing that forcing asylum seekers to wait in Ciudad Juarez, one of the most dangerous cities in the world, was a violation of his oath and his training to offer protection to asylum seekers.

I wondered how our managers could justify to themselves the cruel and unlawful policies they were insisting that their subordinates carry out. Were they hoping that the federal courts would soon overturn the blatantly illegal policy and they would thus be off the hook? Were they thinking that at least they, as a federal officer with some limited power, were better than whoever might replace them if they were to resign? I’m sure that is how many attorneys and jurists, working within totalitarian regimes, justify their collaboration and acceptance of policies that are dehumanizing and deadly. When they were asked by their subordinates for justification they threw up a disingenuous wall of semantics, and when asked what procedures Customs and Border Protection were following in the context of MPP, they were told, “We believe CBP knows how to do their jobs.” Basically, just shut up and do what we tell you to do.

I was one of the first supervisors sent to oversee our officers conducting the new MPP screening interviews at the San Ysidro border crossing south of San Diego. Under the new guidelines the migrant must demonstrate to the asylum officer that it is “more likely than not” that they would meet serious harm if forced to wait for many months in Mexico until returning for an audience in front of an immigration judge, in order to be exempted from the requirement of waiting in Mexico. One of my very conscientious officers decided to refer for protection a young Guatemalan woman who had been held captive in an apartment in Tijuana by her domestic partner and brutalized and assaulted, and then viciously stalked when she fled from the dwelling. She should be allowed to remain in the U.S. pending her court date because it was clearly too dangerous for her to return to where her tormentor could easily locate her. I reviewed the interview notes and consulted with my officer and I agreed that it was a good case for protection. We informed CBP and our chain of command of the decision. The next day I received a call from the Deputy Director of the Arlington Asylum office., Jennifer Rellis. I was told that we had to be very careful with our assessments of the MPP cases because the “front office” had eyes on these cases. I was instructed to overturn our decision and to deny the young woman protection. And I was instructed that, going forward, any time I was inclined to approve any of my officers’ decisions to grant protection, I must first have one of my managers also review and sign off on it. There was no such requirement if we decided to deny protection to an applicant. Thus a presumption was created that we should deny protection in our MPP adjudications, a reversal of all of our training as asylum and refugee officers, and a blatant violation of our own statute and of U.N. refugee guidelines. In the following months this presumption against protection has continued to be enforced.

I wondered how Ms. Rellis could live with herself in so callously stripping me of my discretion to afford protection to legitimate refugees, given her training as a humanitarian lawyer. I’m sure if asked, she would argue we have no choice but to comply, and we can still protect asylum seekers within the limits of this new program. But there was no articulable reason why she would order me to enact an unlawful presumption of ‘not qualified’ where none exists in our asylum statute, regulation, case law, or international refugee law. The fact that such managers, whom we had always believed were motivated by their own humanitarian commitments, would so enthusiastically fall in line with a blatantly unlawful program caused great distress among the ranks of asylum officers. Many of my colleagues sought reassignment to other divisions within USCIS or even left the agency altogether. When I received that phone call I also began making arrangements to leave what had become a compromised agency.

Only months after I departed in June, the much-beloved Director of the Asylum Division was reassigned by the unlawfully appointed Acting USCIS Director Ken Cuccinelli to a management position in an uncontroversial department of USCIS. It was conceded that he had lamented to his asylum officers in an internal e-mail that it was unfortunate that the troops were being asked to adjust to these new policies with no forewarning or opportunity to adequately train.

It is remarkable that American Federation of Government Employees Union Local 1924, the union that represents asylum officers, has submitted “friend-of-the-court” briefs in numerous lawsuits against the administration’s attempts to implement the MPP program and otherwise curtail and dismantle the asylum program; and that Union Local 1924 President Michael Knowles has testified before Congress in opposition to such policies.

Jeff Session’s replacement AG William Barr has shown himself willing to continue the dismantling of our asylum program. He issued an edict that immigration judges would no longer have the discretion to grant bonds to asylum seekers in custody — clearly another attempt to discourage applicants from seeking shelter in the U.S. through the use of cruelty. This is an issue that is especially dear to my heart, as it has always been my principle that no asylum applicant should remain detained a day longer than necessary for routine administrative procedures. In fact, I testified before the Senate Judiciary Committee in 2013, at a time that comprehensive immigration reform was optimistically expected to be passed, in favor of granting immigration judges additional authority to issue bonds. My proposal wound up in the Senate’s draft legislation, which regretfully was never even taken up by the House. (In a meeting with Senator Marco Rubio’s immigration staffer I was assured that “the Senator is behind your proposals 100%.” During his subsequent presidential campaign in 2016 Rubio claimed he had never been in favor of comprehensive immigration reform). Again, several weeks after Barr’s edict against bond, a federal court blocked Barr’s draconian and heartless ban on conditional release from custody of asylum seekers from taking effect.

From the earliest campaign rallies in 2016, Trump has used fear and hatred of others to divide Americans and energize his base. The forefathers of most European Americans gained entry to the U.S. in exactly the same fashion as all those “illegal aliens” at our southern border; by showing up and asking for admission, at Ellis Island, at a time when there were no immigration controls in place other than routine screening for communicable diseases. Today the vast majority of Americans would not qualify for admission if measured against the standards this administration is trying to implement.

I was a refugee officer in the field at the time of the current President’s election. My colleagues and I were already conducting “extreme vetting” on Syrian, Iraqi, Somali, and numerous other populations, in conjunction with security resources of the CIA, FBI, Defense Intelligence Agency and Pentagon, years before this President decided to use fear as a means of control. My last assignment at the Refugee Affairs Division in 2015, before transferring to the asylum program, was to assist in the heightened vetting of all Syrian applicants at headquarters. Ironically, it is demonstrable that, on average, Syrian and Iraqi migrants to the U.S. are among the highest educated migrants in sciences and technology.

Refugee Admissions Decimated

During the last year of the Obama administration, in the context of the worst international refugee crisis since the end of the 2nd World War, the Obama administration asked that the Refugee Affairs Division increase refugee admissions from the already admirable number of 90,000 in fiscal year 2016 to 110,000 for 2017. However, on the heels of the Muslim ban came the new administration’s pronouncement that rather than 110,000, in fiscal year 2017 the program would be suspended for the rest of the year, thus grounding all refugee officers. . In 2018 the admissions was capped at 45,000 refugees, and it was determined that a ceiling of 30,000 admissions would be set for 2019. At a time when the U.S. should have been manning the bulwarks of refugee protection (Germany received a million refugees in 2015, comparable to the U.S. taking in 4 million) the U.S. effectively withdrew from the field, sending the signal that the U.S. no longer considers itself a leader in the world for refugee protection. A ceiling of 18,000 was set for fiscal year 2020, and this amount was only agreed to after push back from the Pentagon in reference to promises we had made to allies and interpreters working with our troops in the field in Irag, Afghanistan and Syria.

In 2018 Director Cissna also made the shocking announcement that USCIS would close all of its overseas offices, passing numerous tasks onto the State Department and domestic offices. The offices, established over a period of decades in such countries as Kenya, Ghana, South Africa, China, South Korea, Thailand, Mexico and Peru, primarily function as facilitators for family unity and refugee operations. Perhaps the first time that a federal bureaucracy has voluntarily given up turf, but in line with the administration’s seeming loathing for family unity.

The Myth of Skilled Migration

When then Chief of Staff General Kelly, formally DHS Secretary, disparagingly pronounced that most Central American migrants are “rural” migrants, as though of less value than presumably better educated “urban” migrants from white European countries, I took personal offense. My grandfather Grussendorf migrated with his family from a rural village in Lower Saxony, Germany at the end of the 19th Century at a time when there were no immigration controls at Ellis Island. He settled in the farming community of Grand Rapids, Minnesota, where he ran a farm and begat five children, one of whom became a high school math teacher; one became a state judge, one opened a nursery in Duluth, and one, my father, became a highly decorated Marine colonel, former company commander at the WWII landings at Saipan, Iwo Jima, and Okinawa. (I was born at Camp Pendleton). The state judge’s children included Cousin Benny Grussendorf who became Speaker of the House in the Alaskan Legislature. My father’s children included a Navy Captain and minister, a Navy enlisted man and transportation professional; a political activist, and an immigration judge. My brother the Navy Captain’s children include an Air Force flight surgeon and base hospital director; a veterinary, and a multi-lingual translator with her own business in France. All of these offspring were imbued with strong “rural” family values. That’s how migration works.

The idea of skilled-based migration, to be administered by a point system involving education, employment background, and language skills, isn’t all that bad in and of itself. Our close alleys Canada, the U.K., Australia and New Zealand all administer a version of this skills-based migration. The problem is the suggestion to eliminate family-based migration, when clearly the vast majority of our nation’s people, including the President’s own family, have benefited from it. The better idea is to double the current admissions level of permanent residents, half to be drawn from a skills-based system. It is the unnaturally low numbers of annual permanent resident admissions that is partly responsible for the log-jam of our immigration system, in today’s world where there is such an interest in immigration to the U.S., and given that our otherwise native-born population is in decline.

We must recognize that the recent surge at our southern border is not some kind of existential challenge to the nation’s existence, as seen in a vacuum, but rather only one component of the world-wide refugee crisis, a symptom of wars and world-wide insecurity. The long-term solution to any refugee crisis is always peace and prosperity in the country/region that is generating the refugees. Only peace and stability in Syria and northern Africa can allay the human waves of refugees into Europe. Only a Marshal-type program for the northern triangle countries, coupled with short term humanitarian protection for those fleeing eminent death, can resolve the crisis at our southern border.

And finally, regarding the present state of the U.S. Immigration Court system under this white nationalist administration, I’d like to quote my friend and colleague, Judge Paul Schmidt:

Once upon a time, there was a court system with a vision: Through teamwork and innovation, one of the world’s best administrative tribunals guaranteeing fairness and due process for all. Two decades later, that vision has become a nightmare. (…)

Today, the U.S. Immigration Court betrays due process, mocks competent administration, and slaps a false veneer of “justice” on a “deportation railroad” designed to evade our solemn Constitutional responsibilities to guarantee due process and equal protection. It seeks to snuff out every existing legal right of migrants. Indeed, it is designed specifically to demean, dehumanize, and mistreat the very individuals whose rights and lives it is charged with protecting.

It cruelly betrays everything our country claims to stand for and baldly perverts our international obligations to protect refugees. In plain terms, the Immigration Court has become an intentionally “hostile environment” for migrants and their attorneys.

As Paul points out, beyond all of the regime’s racism, illegality, and immorality that has already been exposed in the media, the deep corruption, cowardice, and cruelty of those carrying out the program is simply stunning! It’s precisely how authoritarian, anti-democracy, illiberal regimes of the past like Nazi Germany, Soviet Russia, and Mao’s China operated. 

Inflicting “trauma for deterrence” on vulnerable humans is a “war crime” and a “crime against humanity,” plain and simple — regardless of the unlikelihood that regime’s many “perps” will be brought to justice within their lifetimes.

To those who doubt it, when the pandemic subsides, take a tour of the Holocaust Museum. The disgraceful conduct of the German judiciary and civil service is eerily similar to what Paul describes at DHS and EOIR.

We also must remember that despite being well-aware of the Trump/Miller racist-motivated immigration agenda, and the patent falseness of the legal and factual pretexts cooked up by the regime and its ethically challenged lawyers to provide “thin cover” for illegality and inhumanity, a Supremes’ majority improperly intervened to overrule lower Federal Courts and “greenlight” gratuitous cruelty and abuses of humanity! This process, known as “Dred Scottification” (“dehumanization of the other”) has carried over into the Supremes’ majority’s disgraceful  mistreatment of African Americans, Hispanic Americans, and other minorities in our society. It’s one of the key reasons why we have actually moved further away from racial equality and racial harmony in our society since the advent of the far-right judiciary.

Paul also exposes one of the biggest “shams” advanced by the racist right and their congressional supporters: That we must build an Immigration Court capable of deporting everyone in the U.S. without authorization. To state the obvious, this would be a practical impossibility, as well as an economic and social disaster — destabilizing industries and communities throughout the U.S., at a high cost, with no overall benefit.

It’s insane to charge the Immigration Courts with deporting everyone! That inevitably leads to mindlessly and exponentially increasing the number of judges without thinking about the training, support, technology, and wise policies necessary for them to operate successfully, fairly, and efficiently. Moreover, at some point, aimlessly increasing the number of judges without fixing the disgraceful deficiencies in the current system merely adds to the chaos, disorder, and the gross inconsistencies for which the system has become notorious. 

Obviously, the system must be fixed before a rational decision can be made on whether or not to expand it. Fixing the current system also lays the important groundwork for the necessary creation of an independent Article I Immigration Court.

No, the answer is to invest in fixing the current system to get it operating, as it originally was intended, as a high quality, modern, efficient court system that guarantees fairness and due process for all. 

With approximately 500 Immigration Judges already on board (not, of course, all the best qualified judges to carry out the mission — but that’s a problem for later), the reasonable annual capacity of the system is around 250,000 (500 judges x 500 cases/year) to 300,000. That means that more than one million of the current “deadwood” cases currently being warehoused on the EOIR docket by politicos at EOIR and DHS with no practical plan in place for ever completing them, must be removed and returned to DHS. 

That’s actually a job for a new, non-racist, professional DHS. But, given past spotty to downright contemptuous performance by DHS field officials, the Immigration Judges must be given strong authority to, where necessary, close and remove cases even in the face of DHS opposition. 

This means, of course, reversing “Gonzo Apocalypto” Sessions’s absurdly wrong decision in Castro-Tum. But, return to the prior status-quo is not enough! The BIA and the Immigration Judges must be empowered to take even more aggressive actions to close cases when necessary to do justice and to force the DHS to respect and comply with docket capacities. 

Then, as Paul suggests, like all other law enforcement agencies in the U.S., DHS enforcement must be required to develop strategies and prioritize cases in a manner that will not exceed the 250,000 per year capacity of the Immigration Courts. A large scale legalization program for those already here, a much more robust overseas asylum program, particularly in the Northern Triangle, and more “user friendly” legal programs to bring in needed workers, on either a temporary or permanent basis, would be great starting points to “rationalizing” the immigration system.

We thereby could end “Aimless Docket Reshuffling” as it has been practiced and expanded by DOJ & DHS politicos for the past two decades while taking the pressure off the Immigration Courts to do anything other than their only and only mission: through teamwork and best practices, guaranteeing fairness and due process for all who come before these courts. 

The key to making this happen: Immediate disempowerment of the deadly ongoing “Clown Show” 🤡☠️⚰️  in EOIR  “management” and at the BIA and replacing them with members of the NDPA: experts in asylum law, due process, practical scholarship, problem solving, and best practices. Then, and only then, will we see the restoration and progressive advancement of due process and humanity in the disgracefully broken U.S. Immigraton Courts. Without immediate EOIR reform, there can and will be no “equal justice for all” in the U.S. justice system! And, that’s bad news  for all of us!

How totally perverse has the EOIR system become?

Well, the BIA’s sole function is to insure Due Process for individuals and to apply top-flight expertise and scholarship to keep the Immigration Courts, ICE, CBP, and USCIS in line and following the law and best practices.

Instead, the BIA has become a corner-cutting, sloppy, “rubber stamp” on DHS Enforcement and USCIS “enforcement wannabes.” Remember, early on, the Trump regime made it clear that service to the public, i.e., immigrants, their families, and their communities, was no longer “part of the mission” at USCIS. Instead, the mission is to help ICE & CBP institute politically-driven White Nationalist xenophobic enforcement initiatives.

USCIS was created as a separate agency under DHS specifically to allow service to the immigrant community to flourish without the subservience to law enforcement often present and institutionalized at the “Legacy INS.” However, this regime and its toadies in DHS “Management” have seen fit to recreate the very same conflicts of interest and enforcement dominance that USCIS was created to overcome. In most ways, things are far worse than they ever were at the “Legacy INS.” And, let’s remember that USCIS is funded largely by user fees collected from the public on the now largely fictional rationale that they are getting valuable and professionalized services. What a complete mess and abuse of public funding!

Moreover, given the BIA’s lousy performance, rather than assisting the Article III Courts, it now all too often falls to the Article IIIs to keep the BIA in line and do its job for it. But, given the wide disparity in interest levels, expertise, and integrity among the Article IIIs, the results have been spotty.

Some Article III Judges step up and do the job; others sweep the chronic problems under the table and look the other way as rights are trampled and service to the public mocked. And, no Article III to date has been courageous and scholarly enough to take on the real problem: the glaring unconstitutionality under the Due Process Clause of a so-called “court” controlled, staffed, and evaluated by a highly biased prosecutor empowered to reverse individual case outcomes that don’t match his political agenda!

A glimpse of future horrors to come: Emboldened by Article III complicity, and egged on by the White Nationalist nativists, EOIR now outrageously proposes to charge astronomically higher fees for its shabby, biased, and ever deteriorating “work product.” This is a transparent attempt to further restrict access to justice for the most vulnerable among us. Another clear denial of Due Process!  

Yes, Congress is responsible. Yes, Congress is largely in failure. But, that doesn’t absolve the Article IIIs of their duty to the Constitution, the rule of law, and human decency. Will they finally wake up, act with some courage, and do their jobs? Or, will they engage in further “judicial task avoidance” until it’s too late for all of us?

U.S. District Judge Randy Moss (not to be confused with the NFL hall of fame receiver, one-time “bad boy,” and now commentator of the same name) ruled that Cooch Cooch was illegally appointed to his position of Acting Director of USCIS, thereby invalidating some of his written anti-asylum directives aimed at denying fair processing during the credible fear process and perhaps killing brown-skinned asylum seekers. 

KEY QUOTE FROM JUDGE MOSS’S OPINION:

The Court concludes that it has jurisdiction over Plaintiffs’ challenges to the reduced-time-to-consult and prohibition-on- extensions directives and that it lacks jurisdiction over Plaintiffs’ challenge relating to the in- person-orientation directive. The Court also concludes that Cuccinelli was not lawfully appointed to serve as the acting Director of USCIS and that, accordingly, the reduced-time-to- consult and prohibition-on-extensions directives must be set aside as ultra vires under both the FVRA, 5 U.S.C. § 3348(d)(1), and the APA, 5 U.S.C. §706(2)(A). Finally, the Court sets aside the individual Plaintiffs’ negative credible-fear determinations and expedited removal orders and remands to USCIS for further proceedings consistent with this decision.

Although only tangental to the actual result reached by Judge Moss, his detailed description of how the regime has unconstitutionally and immorally skewed the credible fear process to screw asylum seekers, largely based on their race, as opposed to acting in good faith to insure that needed protection is granted under U.S. law without regard to political pandering or racial bias, should outrage every American. It also points out how, even though this has been going on since June 2019, and thousands of individuals’ lives have been endangered by this illegal and immoral action, Federal Courts are only now beginning to “scratch the surface” of the regime’s invidious assault on asylum seekers from south of our border.

Indeed, in a move likely to warm the hearts (if, in fact, they have such organs) of Trumpist Judges like Gorsuch and Thomas, Judge Moss limited his order to the five individual named plaintiffs rather than entering the highly controversial, yet totally justified in cases like this, “nationwide injunction.” That means that thousands of similarly situated individuals who were screwed by Cooch Cooch’s scofflaw behavior will have to sue individually to get the law properly applied to them. That assumes that they are still alive and able to sue.

While the decision correctly points to numerous serious defects in the regime’s operation of USCIS, the practical effects might remain small. The regime can always seek to have it undone by the D.C. Circuit or the compliant “J.R. Five” on the Supremes. They also should be able to find some Senate-confirmed politico who was on duty on June 1, 2019 and simply have Trump appoint him or her “acting” and order them to re-issue Cooch’s “Miller-approved” White Nationalist directives on pain of dismissal. Surely, there is never a shortage of toadies among Trump’s gang of sycophants.

Clearly, the only real way to save our democracy and save the lives we should be saving is to vote for regime change, at all levels, this November. Otherwise, we might all find ourselves “Cooched” at some point in the future! 

For now, maybe “Cooch Cooch” should be required to join his fellow “illegals” fighting for their existence in squalor and cruel and inhumane conditions under bridges and on street corners on the Mexican side of the border! Or, perhaps he should be “orbited” to Guatemala, El Salvador, or Honduras to pursue his claims from there! One truly scary thing: “Cooch Cooch” was actually once the top “legal” officer of the Commonwealth of Virginia, serving a purely awful term as Attorney General. Thankfully, we Virginia voters had the good sense to send him packing when he ran for Governor!

IN THE TWO YEARS AND 308 DAYS THAT DONALD Trump has been president, he has constructed zero miles of wall along the southern border of the United States. He has, to be fair, replaced or reinforced 76 miles of existing fence and signed it with a sharpie. A private group has also built a barrier less than a mile long with some help from Steve Bannon and money raised on GoFundMe. But along the 2,000 miles from Texas to California, there is no blockade of unscalable steel slats in heat-retaining matte black, no electrified spikes, no moat and no crocodiles. The animating force of Trump’s entire presidency—the idea that radiated a warning of dangerous bigotry to his opponents and a promise of unapologetic nativism to his supporters—will never be built in the way he imagined.

And it doesn’t matter. In the two years and 308 days that Donald Trump has been president, his administration has constructed far more effective barriers to immigration. No new laws have actually been passed. This transformation has mostly come about through subtle administrative shifts—a phrase that vanishes from an internal manual, a form that gets longer, an unannounced revision to a website, a memo, a footnote in a memo. Among immigration lawyers, the cumulative effect of these procedural changes is known as the invisible wall.

In the two years after Trump took office, denials for H1Bs, the most common form of visa for skilled workers, more than doubled. In the same period, wait times for citizenship also doubled, while average processing times for all kinds of visas jumped by 46 percent, even as the quantity of applications went down. In 2018, the United States added just 200,000 immigrants to the population, a startling 70 percent less than the year before.

Before Trump was elected, there was virtually no support within either party for policies that make it harder for foreigners to come here legally. For decades, the Republican consensus has favored tough border security along with high levels of legal immigration. The party’s small restrictionist wing protested from the margins, but it was no match for a pro-immigration coalition encompassing business interests, unions and minority groups. In 2013, then-Alabama Senator Jeff Sessions introduced an amendment that would have lowered the number of people who qualified for green cards and work visas. It got a single vote in committee—his own. As a former senior official at the Department of Homeland Security observed, “If you told me these guys would be able to change the way the U.S. does immigration in two years, I would have laughed.”

In November, Cuccinelli was promoted to DHS deputy acting secretary. Kathy Nuebel Kovarik became acting deputy at USCIS and Robert Law, the former FAIR lobbyist, ascended to the head of the policy office. The agency has promised a new flurry of major policy changes before the end of the year. And in what is perhaps the purest expression of the administration’s intentions so far, it started sending Central American asylum seekers to Guatemala with no access to an attorney, no review by an immigration court, far away from the border infrastructure of activists and reporters and lawyers or any form of help at all.

IT’S EASY ENOUGH TO BELIEVE THAT BECAUSE NONE of the Trump administration’s reforms are entrenched in law, they can be overturned as quickly as they were introduced. And yet even though, in theory, the policy memos can all be withdrawn, the “sheer number of both significant and less significant changes is overwhelming,” said Jaddou, the former USCIS chief counsel. “It will take an ambitious plan over a series of years to undo it all.” Formal regulations, like the third-country asylum rule and public charge rule, if it succeeds, will be especially hard to unravel.

The institutional implications run deeper. The backlog of delayed cases will likely take several years to get under control. The administration has promoted six judges with some of the highest asylum denial rates to the Justice Department’s immigration appeals court, including one who threatened to set a dog on a 2-year-old child for failing to be quiet in his courtroom. Those appointments are permanent.

The refugee program, too, will take years to rebuild. The plunge in admissions caused a plunge in funding to the nine resettlement agencies, which have closed more than 100 offices around the country since 2016. That’s a third of their capacity, according to a report by Refugees Council USA. “The whole infrastructure is deteriorating,” said Rodriguez, the former USCIS director. Because the application process is so lengthy, even if a new administration raises refugee admissions on day one, it would take as long as five years before increased numbers of people actually make it to the United States. Consider that in January 2017, the State Department briefly paused in-bound flights for refugees who had finally made it through the gauntlet of health, security and other checks. As of this summer, some of those refugees were still waiting to leave. While the flights were grounded, they missed the two-month window during which all of their documents were current. When one document expires, it can take months to replace, causing others to expire and trapping the refugee in what the report called “a domino effect of expiring validity periods.”

Even harder to repair is the culture shift within USCIS. New visa adjudicators will remain in their jobs long after the political appointees have gone—kings and queens of their own offices. Employees who were promoted for their skeptical inclinations will stay in those positions, setting priorities for subordinates. The multitude of changes at USCIS are the product of an administration that regards immigration as its political lifeblood. There’s no guarantee—or indication—that any of the potential Democratic nominees would apply the same obsessive zeal to overturning them.

Back in 1924, Johnson-Reed’s supporters never anticipated the Holocaust, and yet they expanded its horrors. We don’t know where our own future is headed, but we live in a time of metastasizing instability. Last year, the United Nations’ official tally of refugees passed 70 million, the highest since World War II. Mass migrations, whether because of violence or inequality or environmental calamity or some murky blend of factors that don’t conveniently fit existing laws, are the reality and challenge of our era. There aren’t any easy solutions. But already, what started as a series of small, obscure administrative changes is resulting in unthinkable cruelty. If left to continue, it will, in every sense, redefine what it means to be American.

Building Due Process and fundamental fairness is a painstaking incremental process that takes years, sometimes decades, to achieve. Destroying it can happen basically overnight.

This should never have happened if the Supremes had stood up to the Administration’s unconstitutional, factually bogus, racist, religiously targeted “Travel Ban” instead of green-lighting the return of “Jim Crow 2” under a clearly pretextual and fabricated “national security” facade. Judicial complicity and task avoidance enables cruelty and the destruction of democratic institutions (including, ultimately, the independent judiciary).  That’s why the “New Due Process Army” is in it for the long run!

WASHINGTON, DC — On July 29, 2019, Attorney General (AG) William Barr issued a precedent decision in Matter of L-E-A- and announced that in his view, families cannot be considered a particular social group (and thus grounds for asylum) unless they are recognized by society as such.

AILA Second Vice President Jeremy McKinney stated, “Matter of L-E-A- is a poorly-reasoned decision from an Administration that seems intent on ending legal asylum. AG Barr’s decision ignores decades of circuit court case law which has concluded that families are the ‘prototypical’ or ‘quintessential’ particular social group to qualify for asylum. Courts, like the 4th Circuit Court of Appeals in Richmond, Virginia, have voluminous case law directly contradicting the Attorney General’s decision today.

 

“The impact of AG Barr’s decision, along with the other decisions issued by his immediate predecessors on asylum and the nation’s immigration courts, cannot be overstated. Last summer, the AG issued Matter of A-B- attempting to end the category of persecution – essentially restricting domestic violence victims and other victims of crimes perpetrated by private, non-government actors from their ability to qualify for asylum. Today, the AG’s office further attempts to restrict asylum by targeting a new category of asylum seekers: families. This will cause irreparable harm. We know that these are some of the most vulnerable of asylum seekers as parents flee with their children in order to protect them from persecution. This decision unnecessarily makes asylum harder. Clearly, our nation needs an independent immigration court system separate from the Department of Justice.”

Cowardice is the very definition of when those in power whose job and solemn duty is to protect and vindicate the rights of others, particularly the most vulnerable among us like refugees, instead grossly abuse their power by picking on them, bullying them, and abusing them. On Friday, the New York Times reported that former Virginia attorney general Kenneth Cuccinelli will be tapped for a role in the Trump administration. He will be put in charge of the country’s legal immigration system, as head of U.S. Citizenship and Immigration Services (USCIS). While it had been earlier rumored that Cuccinelli would be placed in a new job as “immigration czar,” both the Times and the Washington Post noted that he now seems set for the top spot at USCIS.

No matter what job Cuccinelli ends up in, he is neither deserving nor qualified to play any role in shaping immigration policy. He is an immigration hardliner with views that are at odds with American values. He has a history of xenophobic, homophobic, and sexist comments. Ironically, one nice thing that can be said about Cuccinelli is that he fosters bipartisanship — he has generated opposition from both sides of the aisle.

Given that Cuccinelli could soon be presiding over USCIS, his comments on immigration are worthy of review. In 2018, he told Breitbart News Daily that states should use “war powers” to turn back migrants: “You just point them back across the river and let them swim for it,” he said. In 2015, appearing on a conservative radio station, he claimed that President Obama was encouraging an “invasion” of undocumented immigrants. In 2012, he compared immigration policy to pest control. He’s called the infamous Rep. Steve King (R-Iowa) “one of my very favorite congressman.” So Cuccinelli is hardly someone who can be trusted to run USCIS in keeping with the agency’s core values, which include “respect” and “integrity.”

Most importantly, Cuccinelli has no significant experience in immigration policy, notwithstanding his failed attempt to end birthright citizenship as a state senator. He is not from a border state, nor has he been a credible voice in the immigration debate. His background is in law enforcement, not immigration law.

Cuccinelli’s prime qualification for his new job seems to be that he has been a tireless defender of the president on cable news. That could almost be seen as laughable if the stakes were not so high. Consider that as head of USCIS, Cuccinelli would wield tremendous power over immigrants like refugees, domestic abuse victims, and asylum-seekers. Or that our legal immigration system is byzantine and complicated, attracting the largest number of immigrants in the world. In FY 2017, the U.S. granted Legal Permanent Resident status to about 1.1 million people, including 120,000 refugees and 25,000 asylum-seekers.

Cuccinelli’s anti-LGBTQ record is especially troubling. As attorney general, he was against policies banning discrimination on the basis of sexual orientation in public colleges and universities. As a state senator, he unsuccessfully fought to criminalize sodomy, calling “homosexual acts… intrinsically wrong.” In 2008, he declared that homosexuality “brings nothing but self-destruction, not only physically but of their soul.” The extreme views matter because LGBTQ people are among our most vulnerable immigrants. The Human Rights Campaign, for example, has documented “the precarious position of transgender immigrants and asylum seekers.” Sadly, it seems unlikely that Cuccinelli would respect their human rights, let alone treat LGBTQ immigrants with kindness and compassion.

There are myriad ways in which Cuccinelli has demonstrated that he is far out of the mainstream, so much so that handing him a huge job would be dangerous. The man who worried about getting his newborn son a social security number because he was concerned about the government tracking his family is probably not the ideal person to put in charge of E-Verify, the federal database that checks employment eligibility.

True, the president can choose whomever he likes for high-level positions. But Cuccinelli isn’t even a smart political pick. In addition to being unpopular with Democrats, he doesn’t have the full support of Republican lawmakers either. According to the website Vox, Sen. Mitch McConnell (R-Ky.) does not want to confirm Cuccinelli (the ill will stems from the fact that Cuccinelli headed up a political action committee that supported primary challenges to incumbent Republicans in 2014). Besides, on immigration most Americans are moving away from Trump. This January, the Pew Center found that 62 percent of Americans believe that immigrants strengthen our country. A restrictionist like Cuccinelli is not what the public wants or needs.

As head of USCIS, Cuccinelli would bring little to the job except a track record as a Trump loyalist. With his outdated and narrow views, he would be a disaster overseeing our legal immigration system.

Francis Cissna was the man who “took the ‘Services’ out of US Citizenship and Immigration Services.” His dismal anti-immigrant polices and undermining of public service have brought unprecedented backlogs to USCIS adjudications that are now under Congressional investigation. He also reportedly “tanked” employee morale at USCIS. Nevertheless, he wasn’t quite nasty enough for Trump and his neo-Nazi White Nationalist advisor Stephen MIller.

As a Virginia resident who suffered through “Cooch Cooch’s”  disastrous tenure as Attorney General and his thankfully unsuccessful bid to become our Governor, I can testify that he is indeed without any redeeming social values. In other words, a perfect fit for the “Trump Immigration Kakistocracy.” But, “Cooch Cooch” has some powerful enemies in the GOP Senate. He pissed off Senate Majority Leader Mitch McConnell, and powerful Senator Chuck Grassley (R-IA) can’t be too pleased with Trump’s treatment of his former staffer Cissna.

In the meantime, it’s “chaos as usual” in the DHS/USCIS kakistocracy.

The Trump administration has sent new guidelines to asylum officers directing them to take a more skeptical and confrontational approach during interviews with migrants seeking refuge in the United States. It is the latest measure aimed at tightening the nation’s legal “loopholes” Homeland Security officials blame for a spike in border crossings.

According to internal documents and staff emails obtained Tuesday by The Washington Post, the asylum officers will more aggressively challenge applicants whose claims of persecution contain discrepancies, and they will need to provide detailed justifications before concluding an applicant has a well-founded fear of harm if deported to their home country.

The changes require officers to zero in on any gaps between what migrants say to U.S. border agents after they are taken into custody and testimony they provide during the interview process with a trained asylum officer.

The new guidelines and directive to asylum officers are among the most significant steps the administration has taken to limit access to the country for foreigners seeking asylum, whose right to apply for humanitarian protection is protected by U.S. law and rooted in post-World War II international treaties granting refuge to those fleeing persecution. The changes appear to signal the administration wants to turn away asylum seekers earlier in the legal process, aiming to cut down on the number of applicants who enter the court system and to deter others from attempting to cross into the United States to seek asylum.

With a record number of Central American families arriving at the border and swamping U.S. courts with asylum claims, Trump has repeatedly scoffed at the protections and has told crowds that dangerous criminals are using it to game the system and stay in the United States.

“The asylum program is a scam,” Trump said last month in a speech. “Some of the roughest people you’ve ever seen, people that look like they should be fighting for the UFC (Ultimate Fighting Championship) . . . you look at this guy you say ‘Wow, that’s a tough cookie!”

Jessica Collins, a CIS spokesperson, confirmed that new guidelines — included in a lesson plan Reuters has posted online — were issued to officers, describing them as a “periodic update.”

“As part of this periodic update, we have reiterated to asylum officers long-standing policies that help determine an individual’s credibility during the credible fear interview and have ensured there are consistent processes for both positive and negative credible fear determinations,” Collins said in a written statement.

Homeland Security agencies already are struggling to comply with court orders limiting the amount of time families with children can be held in detention, and further processing delays could exacerbate dangerous overcrowding at Border Patrol stations and immigration jails. Some areas along the border have been overwhelmed, at times seeing three times as many migrants as they have beds in detention facilities, leading many to be directly released into the United States after initial questioning.

The initial screening is known as a “credible fear” assessment, and it has become a particular focus of frustration for the White House at a time when illegal border crossings have jumped to a 12-year high, exceeding 100,000 per month.

The influx has swamped U.S. agents and filled Border Patrol stations far beyond their capacity, forcing the government to frequently bypass the credible fear screening process and release tens of thousands of Central American families with little more than a notice to appear in court.

“We’ve released four times as many people as we’re able to arrest on an annual basis,” said Albence, noting that ICE makes approximately 40,000 “at large” arrests of immigration violators in the U.S. interior each year.

Statistics show most migrants who claim persecution pass the initial credible fear screening, but far fewer ultimately receive asylum from a judge. An avalanche of new applicants in recent years has contributed to a backlog of more than 860,000 cases in U.S. immigration courts, and it can take years for an asylum applicant to get a final answer in court.

That lag time that has created a loophole in U.S. immigration enforcement, Homeland Security officials say, especially for applicants who arrive with children. They are typically released from custody and allowed to remain in the country while their cases are adjudicated. The process allows them to spend years living and working in the United States, regardless of whether their claims are ultimately found to be valid.

One senior DHS official said Miller and others in the administration are struggling against an asylum officer corps that doesn’t share its immigration goals and would rather refer an applicant to the courts than risk making the wrong choice in a rushed decision with life-or-death consequences.

The administration’s changes take effect immediately, and asylum officers will be trained in their application in coming weeks, according to the emails and CIS officials.

Those changes also direct the Justice Department to complete processing of asylum claims within 180 days.

Lafferty also told staff that 10 U.S. Border Patrol agents had volunteered to join a pilot program that will train them to conduct credible fear screenings. As many as 50 agents will be trained in coming months, he said.

The plan has raised concerns from immigrant advocates who say agents should not be making such consequential decisions about credibility of migrants’ deportation fears and their eligibility for humanitarian refuge.

“Credible fear interviews involve the discussion of sensitive, difficult issues,” Julie Veroff, of the American Civil Liberties Union’s Immigrant Rights Project, wrote Monday, calling the plan “highly concerning.”

“Federal law thus requires that credible fear interviews be conducted in a ‘nonadversarial manner,’” Veroff wrote. “Credible fear interviews have always been conducted by professionals who specialize in asylum adjudication, not immigration enforcement.”

Does it violate human rights to hold children in fenced enclosures in grim facilities that are bone-chillingly cold for weeks on end? Is separating children from their parents a form of cruel and unusual punishment? When does a crisis justify the kind of treatment normally seen as inhumane?

The furious debate over migrant detention along the nation’s southwest border with Mexico has put these questions front and center in American politics. But they’re not new. The treatment of people on the margins of American life — criminals, immigrants, civilians in overseas war zones — has always proven a challenge to our democratic ideals.

Yet beginning in the 1920s, activists waged a half-century-long struggle to persuade the Supreme Court to stop abusive practices by authorities. After World War II, the United States also committed itself to the promotion of international human rights. These two signal developments have been seriously eroded, first by the excesses of the war on terrorism and now by the Trump administration’s targeting of the unwelcome and powerless, whether they are undocumented immigrants in the United States or asylum seekers. We have returned to a pattern of willful ignorance, one that allows us to avoid grappling with deeply immoral policies.

Threats to our safety, perceived or real, have long justified the kind of “tougher policies” that President Trump has demanded for the southern border. He may not be well versed in history, but the president is joining a long line of elected officials who found that rights and basic norms are easily jettisoned when they collide with demands for greater security. Across our history, from the Indian wars to the war on terrorism, officials were quick to call for “tougher policies” and slow to fill in the details. In 1901, President Theodore Roosevelt ordered military commanders in the Philippines to adopt “the most stern measures” to punish Filipino guerrillas; in a subsequent campaign the Marines followed orders and left a trail of devastation and death across the island of Samar. But such methods were justified as a “military necessity.”

Roosevelt rationalized the brutal treatment of alleged guerrillas by citing the need to stanch the threat to security. This kind of evasive language has repeatedly prevented us from coming to terms with acts of cruelty carried out in the name of national security. We’re seeing that pattern again.

What precisely did Trump officials mean when they announced “a tougher direction” for immigration? They certainly imply more than just the proposals for new fees and regulations reducing the numbers of asylum seekers. Are the American people ready to confront the reality of harsh security measures? Or will we retreat into euphemisms such as a “hardened” border and “zero tolerance” for migrants that covers up the reality of what is actually happening on the border?

We are deciding day by day whether to extend the basic protections of law and civilization to the people arriving on our border. For much of the nation’s history, the prohibition on cruelty and torture in American law rested on the premise that the fundamental decency of Americans, especially empathy for fellow citizens, would make such violations unthinkable.

But our capacity to empathize begins to fray at the margins, and we grow less certain about who, exactly, deserves protection. Those deemed undeserving, unwelcome or powerless — Native Americans, the enslaved, prison inmates and criminal suspects — have commonly suffered forms of violence and abuse that violated our national principles. Some people are inside the protection of the law, and some are cast out from it.

In fact, we’ve already seen this pattern. Accusations of cruelty and torture by ICE and CBP agents have been circulating for years, and they follow this well-worn pattern. Official denials are followed by investigations that almost always find limited violations by “a few bad apples,” not the kind of systemic abuse that would call our broader policies into question.

This pattern has long historical roots: When investigations of police brutality in Washington during the 1930s revealed widespread use of abusive interrogation methods, the police superintendent, whose predecessors had dismissed similar allegations for decades, only grudgingly conceded that a few officers may have gone too far in their resolve to protect the public.

Focusing on bad apples has long allowed us to excuse morally bankrupt policies. We need to realize that human rights abuses on the southern border aren’t spurred by immoral actors in ICE or CBP, but rather because of a political leadership that can’t or won’t come up with humane immigration policies.

Congress needs to do its job and exercise scrupulous oversight of Trump’s immigration policies. But the real solution to our border crisis is to demand that all elected officials, from local sheriffs to senators, responsibly address immigration and human rights. Trump declared that he wants immigration to be a key campaign issue in 2020. His opponents should accept that challenge. We must shine a spotlight on cruel and illegal policies that undermine our national ideals and find the wisdom and the courage to do better.

Trump White House plots amped-up immigration crackdown

The purge of Homeland Security leaders will allow the president to shift direction on policy.

President Donald Trump’s dramatic purge of Homeland Security leaders is about more than personnel: It helps clear the way for him to take controversial new steps to curb illegal immigration, including an updated version of his furiously criticized family separation policy.

Leading the new charge is Trump’s top White House immigration aide Stephen Miller, who wants tent cities to house migrants on the border and is pressing to extend the amount of time U.S. immigration officials can detain migrant children beyond the current 20-day limit imposed by a federal judge. Miller wants to force migrant parents arrested at the border to choose between splitting apart from their children or remaining together indefinitely in detention while awaiting court proceedings, according to five people familiar with the plans.

Those hard-line policies could get new traction after a major staffing shakeup at the Homeland Security Department over the past several days. Secretary Kirstjen Nielsen resigned Sunday and Secret Service Director Randolph Alles was ousted Monday. Those moves came after the White House on Friday unexpectedly withdrew its nominee for director of Immigration and Customs Enforcement, Ronald Vitiello. Other officials could be on the chopping block in coming days, according to three other people familiar with the White House’s considerations.

The dramatic proposals and leadership purge are politically risky — family separation has sparked more political anger than almost any other issue in Trump’s presidency — and come as Trump has alarmed his fellow Republicans with abrupt threats to kill Obamacare and to shut down the border. But Trump is determined to make immigration central to his reelection push, betting that he can once again energize his core conservative voters on a promise to secure America’s borders.

Trump and Miller have become increasingly frustrated as the number of Central American migrants massing at the southwest border surges to levels not seen in a decade. Now Miller — who’s even started calling mid-level federal officials to demand they do more to stem the influx — will have a new opportunity to pursue his tougher approach amid the leadership vacuum at DHS.

Trump said Sunday that Customs and Border Protection Commissioner Kevin McAleenan would become acting DHS secretary. Other top DHS positions currently filled by acting officials will be the deputy secretary, ICE director, inspector general and administrator of the Federal Emergency Management Agency. Three of those jobs lack a nominee from the White House.

Miller did not respond to a request for comment.

A federal judge on Monday temporarily blocked a plan to send certain non-Mexican asylum seekers back to Mexico while they await a resolution to their case. The order will not be effective until Friday evening, which allows the administration a chance for a quick appeal.

Still, Miller has a set of new policies he wants to try, according to the five people familiar with the plans, including a “binary choice” between separation or joint detention for families, an idea that first surfaced in the run-up to the midterm elections. Miller also wants to fast-track the regulation that would allow migrant children to be detained for longer than the 20-day limit. He’s eager to finalize the so-called public charge rule, which could block immigrants from obtaining a green card if they’ve received public benefits in the past or are deemed likely to do so in the future.

In addition, Miller has pressed for the federal government to set up tent cities along the border, so that cases can be swiftly resolved — and migrants with non-meritorious claims can be deported.

He’s also pushing for the purge at DHS to continue.

“If you lose Claire, and John, and Francis, I don’t know where that leaves us. But it’s not in a good place,” this person said.

At least some of the personnel moves are getting pushback from immigration restrictionist groups, who like Cissna’s approach.

Roy Beck, president of NumbersUSA, a grassroots organization that seeks lower levels of immigration, said he’s confounded by reports that Cissna may be removed from his post at USCIS.

“He’s great. He’s worked in this issue for years, he’s extremely knowledgeable,” Beck said. “He’s exactly the type of person who needs to be in DHS in leadership.”

But Miller has pressed Cissna, unsuccessfully, to launch more experimentally and legally questionable policies, according to three people familiar with the situation.

Cissna’s defenders contend that he tried to adhere to the law while Miller pressed to overstep legal boundaries.

“If they push out the uber-competent guy that the left hates because he’s getting things done within the law and the right loves because he’s actually being faithful to the president’s campaign promises, they’re even bigger idiots than we already know,” one former DHS official said.

McALLEN, Texas — Federal immigration officials dropped the first group of several dozen asylum seekers — all Central American parents with children — at the downtown bus station early in the day.

They dropped more throughout the day, all of them Spanish speakers in need of food, medicine and guidance from volunteers.

Jose Manuel Velasquez, 24, cradled his squirming 3-year-old-daughter, Sofia, as volunteer Susan Law advised him how to reach Oklahoma City, where he hoped to join his cousin. He was one of thousands of asylum seekers trying to leave the border region this week to reach friends, family and immigration court hearings in other parts of the country.

Ahead of President Trump’s Friday visit to California,volunteers along the border helped hundreds of asylum seekers who had been released from U.S. custody. Cities are pitching in, but helping the migrants has mainly fallen to volunteers whose resources were already at a breaking point from responding to a slew of new immigration policies.

On Thursday in McAllen, the U.S. released 700 migrants to crowded nonprofit shelters and dropped others at the bus station. Some arrived at the station with confirmation numbers to claim tickets paid for by relatives. Many arrived confused.

Law, a volunteer with the group Angry Tias and Abuelas of the Rio Grande Valley, said the constant arrivals this week made volunteers’ work “more overwhelming.”

The 73-year-old, a retired human resources director for Texas RioGrande Legal Aid, sat with one parent after another Thursday. She explained each step of their bus trip, highlighting connections on a stack of maps.

She reviewed their paperwork, reminded them to keep their addresses updated and attend immigration court, and shared lists of free legal services at their destinations.

Many eastbound buses arriving in McAllen on Thursday were already packed with those released in El Paso and San Antonio. The wait time for migrants released to shelters to make it onto a bus has stretched to two days, according to Eli Fernandez, a volunteer at a nonprofit shelter.

Migrant advocates have suggested that recent mass releases at the border were intended to create chaos and give Trump something to point to when he argues that there is a national emergency.

Border Patrol officials have said their resources were strained by people crossing into the U.S. and asking for asylum. The officials have asked for millions more in funding to run temporary holding areas in Texas’ Rio Grande Valley.

A Federal Emergency Management Agency team arrived in the valley this week, meant to support Border Patrol operations and nongovernmental groups, a FEMA spokeswoman said. But many volunteers said they hadn’t been contacted by the agency.

Trump policies blocking asylum seekers led volunteers to found Angry Tias and Abuelas about a year ago, after U.S. officials blocked asylum seekers at a border bridge south of McAllen. They brought food and supplies to the bridge and kept helping migrant families once Border Patrol started separating them. As immigrant parents were released, the volunteers shifted to the bus station to assist Catholic Charities, which runs a nearby shelter.

Most volunteers in Angry Tias and Abuelas are local, some are winter Texans, and others out-of-state visitors.

Luis Guerrero, a retired firefighter, remembers a 4-year-old Salvadoran girl explaining why she and her parents had to flee to the U.S.: Armed men had broken into their house and demanded money. “If you stay here,” Guerrero told the couple, “make sure your daughter gets therapy.”

Many of the migrants are from poor, rural areas and need the most basic help, volunteers said.

A young Honduran mother paid attention Thursday as Law traced the route she would follow to join her sister, a legal resident who migrated years ago and settled in Memphis, Tenn. Olga Lara had brought her 3-year-old, Alva, but left her 13-year-old daughter, Lilia, in Honduras with Lara’s mother.

Lara, 29, said she hoped to learn to read, as her sister had, in the U.S. She doesn’t know how to spell her name. She has never attended school, she said, because her family couldn’t afford it.

Law ensured the woman was traveling with another migrant who could read, write and look out for her. Law also warned Lara and other female migrants about the risk of trafficking, advising them to stay in main bus terminals and avoid anyone who might try to persuade them to leave.

Lara tucked her ticket into her bra and her paperwork into a bag next to Alva’s Elmo doll. She was wearing a donated puffy jacket and sneakers that were stripped of shoelaces while she was in Border Patrol detention. Law ran to grab her some of the laces she keeps stashed at the bus station. Lara threaded them through her shoes and thanked the volunteer.

On Thursday, good Samaritans from local churches dropped by with books, toys and hot breakfast tacos for the migrants. But there were not enough tacos to go around. A van from the nearby shelter was delayed when it ran out of gas. A few families boarded buses without eating.

Volunteer Roland Garcia, a former U.S. Marine, loaned his cellphone to a single Salvadoran mother of three, a domestic violence victim, so she could contact family in Houston and book her bus ticket.

“If we could just get more volunteers to help these people,” he said. “To them, everything is new. Some of them don’t even know how to work the Coke machine.”

Garcia, 60, who used to be a truck driver, started volunteering after he ducked into the bus station a few months ago to wait during a delivery and saw the crowds. He had been diagnosed with stage 4 pancreatic cancer and felt the need to do something meaningful. He’s already recruited other volunteers.

His friend Rafael Mendoza said volunteers counter misinformation some asylum-seeking families receive from staff in Border Patrol facilities: “You’re wasting your time, you’re going to lose your case, you’re not welcome here.”

“Our own agents are telling them that,” said Mendoza, 59. “It’s very discouraging.”

The Catholic Charities shelter was packed Thursday, even after opening a second site when the Border Patrol started releasing large groups of families two weeks ago. The shelter’s halls were full of parents with small children who had not bathed in days while being held in chilly Border Patrol cells, where they said they caught colds.

Honduran Eulogio Erazo Varela said his 3-year-old daughter developed a fever while they were held for almost a week, first in a Border Patrol cell — what migrants call a hielera, or icebox — then behind a chain-link fence in a converted warehouse.

He was relieved to meet volunteers at the bus station Thursday. He said they treated him kindly as he prepared to catch a bus to Memphis — unlike Border Patrol agents, he said, who didn’t provide much treatment or help.

Many of the volunteers, including Law, had caught the migrants’ colds. But they were determined to keep helping. Law has driven a few migrants whose families could afford tickets to the airport, and hoped to recruit more volunteer escorts to help them navigate air travel in coming weeks.

Law recalled a migrant mother she met Wednesday, confused by her bus itinerary until the volunteer walked her through it in Spanish. Afterward, the woman said she would have been lost without Law’s help.

“That’s what keeps me going,” Law said.

When a problem is misdiagnosed, it is no surprise that it gets worse. The current “crisis at the border” is real, but one that results from flawed policy analysis and inappropriate policy responses.

The Department of Homeland Security (DHS) officials overseeing Customs and Border Protection (CBP) project that they will have over 100,000 migrants in their custody for the month of March, the highest monthly total since 2008. CBP reported that over 1,000 migrants reached El Paso on one day alone last week. As many border security experts have noted, these numbers are not unprecedented. Border apprehensions of all irregular migrants (including asylum seekers) remain lower than the peak of 1.6 million in fiscal year 2000.

Making matters worse, DHS uses dated policy tools that were crafted in response to young men attempting to enter the United States to work. The threat of detention was considered a deterrent for economic migrants. At that time, they most often were from Mexico and thus could just be turned around at the border because they came from a contiguous country.

Today, the migrants are families with children from the northern triangle countries. Rather than being pulled by the dream of better jobs, these families are being pushed by the breakdown of civil society in their home countries. As the Pew Research Center reports, El Salvador had the world’s highest murder rate (82.8 homicides per 10,000 people) in 2016, followed by Honduras (at a rate of 56.5). Guatemala was 10th (at 27.3). Many of them have compelling stories that likely meet the “credible fear” threshold in the Immigration and Nationality Act.

It is abundantly clear that policies aimed at deterring single men are inappropriate and that CBP is unequipped to deal with families seeking asylum. Journalist Dara Lind maintains that these policy inadequacies have contributed to death of multiple children in DHS custody. Former DHS Secretary Jeh Johnson recently stated that the Trump administration strategy at the border is not working because it does not address the underlying factors.

Meissner replied: “Because people are uncertain about what’s going to happen. They see the policies changing every several months. They hear from the smugglers that help them, and from the communities in the United States that they know about, that the circumstances are continually hardening. And so with the push factors that exist in Central America — lots of violence, lots of gang activity — they’re trying to get here as soon as they can.”

Fortunately, the United States has an array of policy options that would more effectively respond to the surge of families seeking asylum from Central America than the erratic and ill-conceived policies of the Trump administration.

Aid to Central America to stimulate economic growth, improve security and foster governance is a critical policy response to address the factors propelling migrants. Congress appropriated $627 million for these purposes, but reportedly the distribution of the funds is stalled because President Trump wants to cut the aid countries because they failed to stop the flight of their people. This is another misguided policy reaction — if these countries would crack down on people trying to leave, it would escalate people’s panic to flee.

As is often said, the most important step is to beef up the asylum corps in DHS’s Citizenship and Immigration Services and to fully staff the immigration judges in the Department of Justice’s Executive Office for Immigration Review. This action would enable expeditious processing of asylum claims in a fair and judicious manner — key to reversing the bottleneck of asylum seekers at the border.

Current law enables asylum seekers arriving without immigration documents to have a credible fear hearing and be released from detention pending their court dates. Those who establish that they have well-founded fear of returning home would be permitted to stay in the United States and those who do not would be deported. If DHS implemented our asylum laws to the fullest effect, it would increase the likelihood that migrants understood our laws.

Absolutely, Ruth! Basically what others and I who have spent years working in and studying this system have been saying all along.

The current law provides the necessary tools for addressing the only real border crisis:  the humanitarian tragedy. But, this Administration has neither the competence nor the interest to address that problem in a constructive, effective, and humane manner.  It wouldn’t fit their bogus White Nationalist false narratives and agenda.

That’s why we need “regime change” in 2020.  Until then, we’ll have to rely on private groups, some states, and the New Due Process Army to keep the country functioning until we get better, wiser, and more competent leaders.

Court Rebukes Youth Policy Shift

This past Friday, the Department of Homeland Security’s random policy change deeming youths between the ages of 18 and 20 years old ineligible for special immigration protection ran into a brick wall in the form of the U.S. District Court for the Southern District of New York.  In his decision in R.F.M. v. Nielsen, Judge John G. Koeltl held that DHS’s sudden policy shift denying Special Immigrant Juvenile Status (or SIJS, for short) to qualified youths over the age of 18, a group that it had previously approved under the same statute for nearly three decades, (1) was contrary to the plain language of the statute it claimed to interpret; (2) lacked a reasonable explanation, (3) was premised on an erroneous interpretation of state law, and (4) was not enacted with adequate notice, as required by the Administrative Procedures Act.  For these reasons and more, Judge Koeltl concluded that the policy shift was arbitrary and capricious, in excess of statutory jurisdiction, and without observance of the procedure required by law. The judge further granted the plaintiffs’ motions for class certification and for summary judgment.

What exactly did DHS do to invoke such a strong judicial rebuke?  SIJS was created by Congress in 1990 to provide a path to legal residence for immigrant youths who have suffered abuse, neglect, or abandonment.  The statute defines juveniles eligible for such benefit as those under the age of 21, and applicants under that cut-off age were generally afforded such status.  However, in early 2018, the present administration suddenly and without warning began denying applications involving applicants over the age of 18. Sounding very much like Herr Zeller in The Sound of Music claiming that “nothing in Austria has changed,” government counsel attempted to argue that there had been no change in policy, a claim that Judge Koeltl outright rejected in light of clear evidence to the contrary.  As the L.A. TImes reported in January, the impact of the policy shift was magnified by another DHS policy directive to commence deportation proceedings against those whose applications for benefits are denied, an action that had previously rarely been taken against juvenile applicants.

What immediately struck me about the new DHS policy at the time of the shift was its position that the New York Family Court lacked jurisdiction over youths who had reached the age of 18 as a basis for denying the petitions.  How could a federal agency feel it had the right to rule on a state court’s jurisdiction over a matter of state law? Of course, Judge Koeltl noted in his decision that in spite of a USCIS Policy Manual requiring the agency to rely on the state court’s expertise on such matters, and prohibiting the agency from reweighing the evidence itself or substituting its own interpretation of state law for that of the state court,  DHS nevertheless did exactly that, substituting its own interpretation of New York law for that of the New York Family Court in arguing for that court’s lack of jurisdiction. Of course, DHS’s improper interpretation wasn’t even a correct one; with the judge finding that DHS’s conclusion “is based on a misunderstanding of New York State law.”

Just in case there was any doubt as to its bad faith, the Government even opposed the motion that the young Plaintiffs be allowed to proceed anonymously in the action, identified only by their initials.  What possible reason other than harassment could DHS have in opposing such motion made by young plaintiffs who had suffered abuse or abandonment?

Not coincidentally, there has been a surge in SIJS-eligible youth arriving at the border in recent years, with most coming from the besieged Northern Triangle countries of El Salvador, Guatemala, and Honduras.  Youths in those countries run a shockingly high risk of being targeted for domestic violence, forced gang recruitment, and other physical and psychological harm. These are children that we are talking about. Nevertheless, the Trump Administration has consistently targeted citizens of these countries, inaccurately labeling them as criminals and deriding the legitimacy of their motives for seeking refuge in this country.  And, like pieces in a puzzle, the shift in SIJS policy is just one more way that the Trump Administration has created obstacles for a group it should be seeking to protect.

What about the DOJ attorneys who are defending these patently illegal actions in court, often without providing any rationale that would pass the “straight face test?” Why is it OK to present “pretextual” reasons for policies that publicly available information shows are actually based on bias, undue outside influence, ignoring facts, and sometime outright racism, and xenophobia? Why are DOJ attorneys and their supervisors, who are also members of the bar, allowed to operate in an “ethics free zone?”

Don’t expect any help from newly minted Trump sycophant AG Bill Barr. Despite his “Big Law Corporate Patina” and his bogus claim that he seeks to “restore confidence” in the DOJ, his first project is reputed to be a scurrilous Trump-type attack on Federal Judges issuing nationwide injunctions who are among those (the private, often pro bono, bar and NGOs being others) having the courage to stand up for the rule of law and our Constitution against the outrageous onslaughts of Trump, his cronies, and his team of disingenuous lawyers who seem to believe that they have been immunized from the normal rules of ethical and professional conduct.

No, Barr isn’t just a “conservative lawyer.” I actually worked for a number of  very “conservative” lawyers both in and out of Government. While I didn’t always agree with their policies and their legal arguments (that wasn’t a job requirement), I did find them willing to listen and consider “other views” and occasionally be persuaded. Moreover, they all had a respect for both our legal system and the Constitution, as well as Federal Judges and those on “the other side” of issues that I find completely, and disturbingly lacking in the Trump Administration and its “ethnics free” legal team.

Not only are the efforts of the Trump Administration to “undo” provisions of our law that “work,” promote justice, and save lives illegal and immoral, they also are tying up rousources with frivolous and unnecessary litigation. What if all of that time and effort were put into solving problems and making our country better, rather than destroying it?

NEW YORK (Reuters) – Growing up in eastern Honduras, Jose said his father would get drunk and beat him with a horse whip and the flat side of a machete. He said he watched his father, a coffee farmer whose crops succumbed to plague, hit his mother on the head with a pistol, sending her to the hospital for three days.

At 17, Jose said, he hired a coyote to ferry him to the United States, seeking to escape his home life and violent feuding among his relatives, as well as seek better opportunities for himself and his siblings. He was picked up by border agents, then released pending deportation proceedings.

After struggling to get a good lawyer, Jose applied at 19 for special protection under a program for young immigrants subjected to childhood mistreatment including abuse, neglect or abandonment.

But like a growing number of applicants, his petition hit a series of hurdles, then was denied. Now he is appealing.

“It’s like being stuck not going forward or backwards,” said Jose, now 22 and living in New York. He spoke on condition his last name not be used because he is working without a permit and does not want to jeopardize his appeal. “You can’t advance in life,” he said.

As President Donald Trump vociferously pushes for a physical barrier across the country’s southern border, young people claiming to be eligible for protection under the Special Immigrant Juvenile (SIJ) program increasingly face a less publicized barrier: heightened demands for paperwork.

Data obtained by Reuters under the Freedom of Information Act shows that the U.S. Citizenship and Immigration Services (USCIS) has recently ramped up demands for additional documents through “Requests for Evidence” and “Notices of Intent to Deny,” which can tie up cases for months.

Importantly, the restrictionst group CIS’s claim (in the part of the article NOT set forth above) that SIJ status was intended solely for trafficking victims is untrue.  I actually worked on the enactment of the original SIJ provision in IMMACT 90 when I was in private practice. It was intended to be used by various states and localities, the largest number of which were in California, who had significant numbers of foreign-born “wards of the court” (some of them foster children) who otherwise would have been denied work and study opportunities upon becoming adults.

The later amendments to SIJ status were not intended to limit the scope in any way to “trafficked individuals.” The emphasis was on those who had suffered domestic abuse. Indeed, there is scant evidence that SIJ was ever intended to be limited to trafficked juveniles as restrictionists claim, although such juveniles often fit within the remedial scope of SIJ status. First, that’s clearly not what the statute says. Second, Congress has other specific provisions for the protection of trafficking victims and victims of crime under the “T” and “U” nonimmigrant statuses which may also lead to permanent status.

Just another example of how the USCIS and the Trump Administration have improperly incorporated many parts of the false narrative promoted by immigration restrictionists into Government policies and procedures.

TWO LA TIMES EDITORIALS “SPOT ON” IN CALLING OUT TRUMP’S FAILED BORDER POLICIES, BOGUS EMERGENCY, & ABUSE OF IMMIGRATION ENFORCEMENT AUTHORITY!

TThe numbers are sobering. The federal government reported Tuesday that immigration agents apprehended 76,000 people — most of them families or unaccompanied minors — at the U.S.-Mexico border in February, twice the level of the previous year and the highest for February in 11 years. The increase continues a trend that began in the fall, and offers direct evidence that President Trump’s strategy of maximal enforcement at the border is not reducing the flow of migrants.

And no, the answer is not “a big, beautiful wall.” Most of those apprehended weren’t trying to sneak past border agents; instead, they sought out agents once they reached the border and turned themselves in, hoping to receive permission to stay.

Furthermore, the situation isn’t a national security emergency, as he has declared in an effort to spend more on his border wall than Congress provided. It’s a complex humanitarian crisis that appears to be worsening, and it’s going to take creative analytical minds to address.

For instance, the vast majority of the families flowing north in recent months come from poor regions of Guatemala, where food insecurity and local conflicts over land rights and environmental protections are pushing more people off their farms and into even deeper poverty, according to human rights observers and U.S. Customs and Border Protection. Just months earlier, gang violence in urbanized areas were pushing people north to the United States; increasingly now, it’s economics.

But Trump’s rhetoric may be playing a role too. The more he threatens draconian enforcement and cutbacks in legal immigration, the more people contemplating moving north are pushed to go sooner, before it gets even harder to reach the U.S. Similarly, more migrants are arriving at more treacherous and remote stretches of the border to avoid getting stuck in Tijuana or other border cities where the U.S. government has reduced the number of asylum seekers it will allow in, claiming an inability to process the requests.

The system is overwhelmed. But the solution isn’t to build a wall, incarcerate more people, separate children from their parents or deny people their legal right to seek asylum. The solution is to improve the efficiency and capacity of the system to deal with the changed migrant demographics. A decade ago, about 1 in 100 border crossers was an unaccompanied minor or asylum seeker; now about a third are.

More judges and support staffs are necessary for the immigration court system, as the Trump administration has sought from Congress. Yet the case backlog there has continued to grow — in part because the increase in enforcement actions, in part because the Justice Department ordered the courts to reopen cases that had been closed administratively without deportations, often because the migrant was in the process of obtaining a visa. A faster and fair process would give those deserving asylum the answer they need sooner, cutting back on the years they spend in limbo, while no longer incentivizing those unqualified for asylum to try anyway.

The Migration Policy Institute, a think tank, has suggested one partial fix. Currently, migrants claiming asylum have a near-immediate initial “credible fear” hearing with an asylum officer from U.S. Citizenship and Immigration Services, who determines whether the migrant has a significant potential to make a successful asylum claim. Most migrants pass that low threshold and are then directed to the immigration courts to make the formal case, a more involved process that can take years. Keeping those cases within the citizenship and immigration branch for an administrative hearing instead of sending them to immigration court could lead to faster decisions for the deserving at a lower cost — a single asylum agent is cheaper than a court staff — while preserving legal rights by giving those denied asylum a chance to appeal to the immigration courts. That’s a process worth contemplating.

More fundamentally, the current system hasn’t worked for years, and under Trump’s enforcement strategy it has gotten worse. It’s a big ask, but Congress and the president need to work together to develop a more capable system that manages the many different aspects of immigration in the best interests of the nation while accommodating the rights of the persecuted to seek asylum.

The U.S. government is reportedly compiling dossiers on journalists, lawyers and activists at the border.

ASan Diego television station recently obtained some troubling documents that seem to show that the U.S. government, working with Mexican officials under a program called Operation Secure Line, has created and shared dossiers on journalists, immigrant rights lawyers and activists covering or involved with the so-called caravans of migrants moving from Central America to the U.S.-Mexico border.

Worse yet, the government then detained some of these people for questioning (one photojournalist was held for 13 hours), barred some of them from crossing the border and interfered with their legitimate efforts to do their jobs. NBC 7 also received a copy of a purported government dossier on lawyer Nicole Ramos, refugee program director for a migrant rights group, that included a description of her car, her mother’s name, and details on her work and travel history. That’s not border security, that’s an intelligence operation and, as the American Civil Liberties Union pointed out, “an outrageous violation of the First Amendment.”

The ACLU noted correctly that it is impermissible for the government to use “the pretext of the border to target activists critical of its policies, lawyers providing legal representation, or journalists simply doing their jobs.”

It’s unclear when the intelligence gathering began, or how widespread it is, but the Committee to Protect Journalists reported in October that U.S. border agents, using the broad power the law gives them to question people entering the country, seemingly singled out journalists for in-depth examinations, including searching their phones, laptops and cameras — all without warrants, because they’re generally not required at the border. These are troubling developments deserving of close scrutiny by Congress and, if warranted, the courts.

The Department of Homeland Security is responsible for controlling the flow of people across U.S. borders and has broad and court-recognized authority to search for contraband. But the government should not use that authority as a pretext to try to gain information to which it would not otherwise be entitled. And it certainly doesn’t give it a framework for harassing or maintaining secret files on journalists, lawyers and activists who are covering, representing or working with activists.

Homeland Security defended the targeting by linking the intelligence operation to the agency’s investigation of efforts this winter by some Central American migrants to cross the wall near San Ysidro, Calif. It said also that all the people entered into the database had witnessed border violence. That sounds an awful lot like a criminal investigation, not a border security operation.

The name of the report leaked to NBC 7 was “Migrant Caravan FY-2019: Suspected Organizers, Coordinators, Instigators, and Media.” The only thing suspect here is the government’s actions.

Unfortunately, the second editorial on the “enemies list” shows why the first one on solving the Central American forced migration issue in a sensible, legal, and humanitarian manner simply isn’t in the cards without “regime change.”

First, the Trump Administration simply lacks the competence, professionalism, and expertise to solve real problems. The absolutely stunning incompetence of Nielsen and the rest of the politicos who supposedly run immigration and national security policy these days was on full display this week. America’s “real” enemies must have been watching with glee at this public demonstration of lack of competence and concern for any of the actual national security issues facing our nation.

Career civil servants who have the knowledge, expertise, motivation, and ability to solve migration problems have been forced out, buried in make-work “hallwalker jobs” deep in the bowls of the bureaucracy, or simply silenced and ignored. The Administration has also declared war on facts, knowledge, human decency and scorns the humanitarian expertise available in the private and NGO sectors.

Second, there is zip motivation within the Trump Kakistocracy to solve to the problem. As long as neo-Nazi Stephen Miller is in charge of immigration policy, we’ll get nothing but White Nationalist, racist nonsense. Miller and the White Nationalist restrictionists (like Trump & Sessions) have no motivation to solve immigration problems in a practical, humane, legal manner.

No, the White Nationalist agenda is to use lies, intentionally false narratives, racial and ethnic stereotypes, bogus statistics, and outright attacks on our legal system to further an agenda of hate, intolerance, and division in America intended to enfranchise a largely White GOP kakistocracy while disenfranchising everyone else. It plays to a certain unhappy and ill-informed political “base” that has enabled a minority who cares not a whit about the common good to seize control of our country.

While the forces of evil, division, and Constitutional nihilism can be resisted in the courts, the press, and now the House of Representatives, the reign of “malicious incompetence” can only be ended at the ballot box. If it doesn’t happen in 2020, and there is certainly no guarantee that it will, it might well be too late for the future of our republic.
