Multiple House Democrats have expressed anger and frustration over President Biden’s decision to sign a resolution ending a Washington, D.C., crime bill, after they were led to believe he would veto the resolution and protect the bill.

According to The Hill, some of these Democratic Party lawmakers are so outraged over Biden’s decision that they’ve resorted to blasting the White House in expletive-laden epithets. One told the outlet that this is “F—ING AMATEUR HOUR.”

The same lawmaker claimed that the White House “f—ed this up royally.” Others said Biden’s decision was “disappointing.”

House Republicans, led by loudest maniac Jim Jordan, had high hopes of stealing some of President Joe Biden’s thunder after his historic surprise trip to Kyiv, Ukraine. “Oh, yeah,” you could hear them squeaking. “We’ll show him.” So in the best tradition of nativist, isolationist know-nothingism, they headed for the southern border to put on a show of hunting for the crisis of the hordes invading “our” country. What they got was … not that.

“As they rumbled along the entry port of San Luis, a dam along the Colorado River and more desolate sections of the U.S. border between Arizona and Mexico, though, their search came up empty,” a reporter on the scene described. “Hours later, immigration officials would spot a group crossing north, but it was long after Congress members had retired for the night.”

This was part of what they’re calling a “field hearing” by the House Judiciary Committee, explaining Jordan’s, ahem, leadership. (Seriously, they need to rethink having this guy as their mascot. Does anyone, could anyone, find this guy compelling?) The “convoy” included “more than a dozen congressional Republicans, a large contingent of staffers and a handful of reporters.” Having turned the trip into some kind of sick safari, the group thwarted their own goal.

“Jordan’s group was told that around 4,000 immigrants cross the U.S. border near Yuma each day, but its conspicuous presence thwarted the expedition’s goal of spotting immigrants attempting an unobtrusive entry.” You don’t say. They did spot a bus parked across the border, however. No one came out of it to make a run for the border.

No Democrats participated in what ranking committee Democrat Jerry Nadler called a “stunt hearing,” though he did say that some Democrats from the committee would go to the border next month to to “hear from the community and government officials on the ground.”

The big convoy also help put the lie to the GOP’s government spending obsession. This is the third trip to the border by some contingent of GOP House members in the new Congress, with Barely Speaker Kevin McCarthy having already gone to try to score points, as well as members of the Energy and Commerce Committee.

The Homeland Security Committee has what they’re calling a “border bootcamp” for Republican freshmen members, and the Oversight Committee has plans to go in the near future, too. That’s one way to stop illegal crossings: Just keep sending down convoys of GOP representatives to play border patrol.

All that’s pretty expensive. The GOP Judiciary Committee alone has requested $262,400 for travel this session. In 2022, with Democrats in charge of the committee, they spent $7,986.

When it comes to actual border policy rather than publicity and preening, they’ve got nothing. Or rather they’ve got an interparty fight, as Gabe Ortiz reported. Their first go at an immigration bill “was so extreme it derailed itself, after so-called moderates refused to sign on.”

If the GOP were really serious about cutting wasteful spending, they could “ground” Jordan and his traveling White Nationalist circus!

Notably, however, JJ is one of the few politicos in either party to endorse (somewhat tepidly) Biden’s totally ill-advised proposal to “deter” refugees from fleeing their countries (actually, that’s what refugees “do”) and invoking their right to seek asylum. Why would a Dem President curry favor for his border policies from an anti-democracy, White Nationalist, election-denying blowhard, eschewing the rule of law, human decency, and the expert advice of many who voted for him in the process? Got me on that one! 

“The White House must be really proud of getting endorsements from guys like Jordan and Chad Wolf (a/k/a “Wolfman”),” one human rights wag reportedly quipped!

Democrats! Has there ever been a more frustrating party when it comes to human rights, backbone, and carrying out promises, not to mention using the brainpower and resources available to solve problems, rather than lamely “gimmicking” them? Honestly!🤯

In a (perhaps unexpectedly) shrewd move, House Judiciary Dems took a pass on this GOP clown show. It would be a good idea, however, for Dems to go to the border, without the Ringling Bros, Barnum & Bailey act, observe the human carnage caused by the wrong-headed (not to mention illegal) approach of the last two Administrations, and interact with some of those humans affected, including asylum seekers, local officials, residents, dedicated advocates, and NGO personnel. The latter two have been about the ONLY ones trying to uphold the rule of law and to inject some common sense and much needed humanity into this unnecessarily chaotic situation caused by our Government’s abandoning our legal and moral obligations toward those fleeing persecution — over two Administrations.

But, even as Fox moved McCarthy onto its corporate ledger, some Wall Street analysts predicted that the network would rue the day that it acquired the congressman.

We received an oral ruling from Judge Vazquez today—EOIR lost; it violated the terms of our stipulated agreement by failing to grant (or even rule on) Webex motions.  We are preparing another proposed order to submit to the Judge early next week.  He stated that if EOIR fails to comply moving forward, he will hold them in contempt.

“Based on past experiences, if returned to Guatemala, Selvin Heraldo Saban-Cach fears being persecuted by a local gang because of his identity as an indigenous person. Accordingly, he seeks withholding of removal under the Immigration and Nationality Act and protection from removal under the Convention Against Torture. The Immigration Judge denied his applications and ordered his removal, and the Board of Immigration Appeals affirmed. This petition for review followed. For the reasons that follow, we will grant the petition, vacate the BIA’s decision, and remand for further proceedings consistent with this opinion. … Although the BIA need not write an overly detailed explanation of its review of an IJ’s decision, it must provide an adequate explanation of its ruling and afford us an opportunity to review it. Here, the BIA did neither. At times, the IJ’s decision completely conflicts with the record. Yet, for reasons that are not at all apparent, the BIA affirmed the IJ’s decision in its entirety. … The BIA must review the first, factual question for clear error and the second, legal question de novo. In affirming the IJ’s decision of the second question regarding acquiescence, the BIA concluded that it found “no clear error in the [IJ]’s predictive fact-finding.” Accordingly, in addition to not bifurcating the Myrie step-two inquiry, the BIA also erred by applying this heightened standard of review to a legal question. Because of these errors, “we have little insight into the basis for [the BIA’s] determination that the IJ’s opinion ‘clearly reflects that [s]he used the proper “willful blindness” standard in relation to the issue of acquiescence.’” Accordingly, on remand the BIA needs to reassess each question.”

Congratulations to NDPA star Stephanie Norton! This is yet another example of the great talent “out here” who could replace mal-functioning EOIR judges. Human lives are at stake, this system is dysfunctional, crying out for bold reforms! Wonder how the Dems will try to “spin” their miserable performance at EOIR in 2024?

The IJ’s and BIA’s findings of “no past persecution” in this case rise to the level of absurd! Here’s what happened:

The BIA recognized that gang members had attacked Saban-Cach on multiple occasions and that the worst attack left him unconscious after he was stabbed with a broken glass bottle. However, the BIA agreed with the IJ that, in the aggregate, this abuse did not rise to the level of persecution. The BIA explained that, “because most of the incidents did not involve physical injuries, and because the worst attack did not require him to seek professional medical care for his physical injuries, the applicant did not establish harm rising to the level of past persecution.”

Come on man! No competent, fair minded judge would reach such a totally ridiculous conclusion based on such shallow, specious, and basically “made up reasoning!” Not incidentally, it also directly conflicted with Circuit precedent as well as with the realities of life in Guatemala!

The BIA also ran roughshod over its OWN binding precedent, Matter of O-Z- & I-Z-, 23 I&N Dec. 22 (BIA 1998) (cumulative harm is persecution), which should have made a finding of past persecution a “no brainer” for a panel of competent asylum adjudicators! The sloppy, biased, “any reason to deny” culture at EOIR is a major cause of their out of control backlog. Efforts to deny easily grantable cases, and failure to direct wayward asylum-denying IJs to get it right in the first place, is a drag on our entire justice system — all the way up to the Courts of Appeals!

That’s because EOIR’s “any reason to deny” approach to asylum encourages, and often rewards, frivolous litigating positions by ICE, discourages stipulations and settlements in cases that should easily be granted, and results in OIL taking ethically and legally flawed positions in the Courts of Appeals. For example, in this case the 3rd Circuit characterized parts of OIL’s position as “disingenuous,” “puzzling and disappointing,” and pointedly stated that “[r]egrettably, the government’s response brief doubles down on this inaccuracy.”

So, these are the legal quality and ethical standards set at DOJ by AG Merrick Garland, a former Circuit Judge himself who certainly should be expected to “know better.” Apparently, in his view, due process, fundamental fairness, impartial adjudication, adherence to the law, judicial and legal ethics don’t apply when it’s “only migrants” whose lives are at stake! While this is a common approach from White Nationalist GOP politicos, don’t we deserve better from a Dem Administration that claims to care about racial justice, but whose actions with respect to migrants say otherwise?

The court also blasted EOIR for “ethnocentric” judging and failure to fairly evaluate cases.

We have previously cautioned IJs and the BIA against ethnocentric evaluations of petitioners’ resources. Petitioners primarily come from countries in the poorest and most dangerous regions of the world. Any presumption that they enjoy the same kinds of resources as their adjudicators is shortsighted and unfair. Unless the record supports it, IJs and the BIA should not assume that their own views of appropriate medical care and its ready accessibility make up a universal reality.

Petitioners for relief under the asylum system must be afforded the just hearing that due process and basic fairness demands. The immigration system can only provide a fair and neutral determination of the claims of people from different cultural and economic circumstances if adjudicators diligently avoid unrealistic assumptions about petitioners’ circumstances.

Any competent asylum practitioner would understand what the court is getting at. But, EOIR IJs at both the trial and appellate level make these basic mistakes time after time.

The 3rd Circuit and other courts might claim to find the BIA’s “entire” affirmance of a decision often in “complete conflict” with the record to be inexplicable. But, WE know that it’s because the “deportation assembly line” works on the “principle” of “any reason to deny” and “keep cranking out those final orders of removal.” To Hell with justice, quality, fairness, and the human lives involved!

Also, Guatemalan applicants, along with others from the Northern Triangle, are “de facto disfavored” in EOIR’s asylum adjudications. That’s right “in line” with the bias against asylum seekers from the Northern Triangle exhibited by both the Trump and Biden Administrations. This disasterous, backlogged, “star chamber system” is neither appropriately staffed nor competently operated to afford individuals “the just hearing that due process and basic fairness demands.” How is this due process and fundamental fairness required by our Constitution?

Style. — AG Merrick Garland appears to be blissfully unconcerned about the methods applied by too many of his EOIR “judges,” and his DOJ attorneys who “run interference” for them, to achieve “removal for any reason, at any cost!”

Until a court has the guts to “pull the plug” on EOIR’s ongoing, deadly clown show 🤡, declare it unconstitutional, and require at least minimal due process reforms, these outrages will continue! “Puzzling” about recurring miscarriages of justice at EOIR, as the 3rd Circuit did here, is one thing; acting decisively to enforce the Constitution by stopping the abuse, once and for all, is quite different. Requiring EOIR judges with demonstrated expertise in asylum law, willing to professionally review records, and decide cases of asylum seekers correctly, without “ethnocentrism” or bias, would be a logical starting point! It should be a “no brainer!”

“With the highest possible human stakes,” amen, Kate! I get that, you get that, those stuck in the “purgatory of EOIR” get that! But, sadly, Biden, Harris, Garland, Mayorkas, their too often bumbling bureaucrats, and a whole bunch of Federal Judges at all levels DON’T “get” the dire human consequences and the practical impact of many of their decisions. That’s particularly true of those that give EOIR a “pass” on bad interpretations, opaque procedures, and a “super-user-unfriendly” forum that all too often defies logic and common sense!  If they did “get it,” EOIR wouldn’t be the dystopian, likely unconstitutional, and life-threatening mess that it is today!

All you have to do is imagine yourself to be an unrepresented individual, who doesn’t speak English, on trial for your life in this messed up and unaccountable “court” system that holds millions of lives in its fumbling hands! Seems like a “modest ask” for those who have risen to the Federal Bench. But, for many, it’s a “bridge too far!” Let’s just hope that the Court does the “right thing” here!

The Let Freedom Ring Celebration is an annual celebration of the legacy of Dr. Martin Luther King, Jr., jointly presented by The John F. Kennedy Center for the Performing Arts and Georgetown University. Following a two-year hiatus prompted by the COVID pandemic, ‘Let Freedom Ring’ returns this weekend to the Kennedy Center Concert Hall with a stellar program headlined by Tony and Grammy winner Leslie Odom, Jr. and music produced by NEWorks Productions CEO, Nolan Williams, Jr.

The program will feature Odom performing a range of selections from the American songbook, Williams leading the Let Freedom Ring Celebration Choir and NEWorks Band, and the presentation of the 21st annual John Thompson Jr. Legacy of a Dream Award to Paula Fitzgerald, executive director of Ayuda.

Other program participants include: Naomi Eluojierior, Georgetown University student; Marc Bamuthi Joseph, VP & Artistic Director of Social Impact, The Kennedy Center; [Cheri Carter, Vice President,] Boeing (LFR Title Sponsor); and John J. DeGioia, President, Georgetown University.

Williams will present two original works as part of the program, performed by the Let Freedom Ring Celebration Choir and Band, Georgetown University student poets Cameren Evans, Isaiah Hodges, and Lucy Lawlor, and community soloists Roy Patten, Jr. and Laura Van Duzer.

The program [opened] with the world premiere of Williams’ “We’re Marching On!,” a work commissioned by Georgetown University. The piece draws inspiration from a 1965 speech by Dr. Martin Luther King, Jr. and features spoken word delivered by Evans, Hodges and Lawlor.

Williams’ second musical contribution is the social-justice-themed ballad, “We are the ones to heal our land.” Commissioned last year by Choral Arts Society and Washington Performing Arts, this work has been adapted for this occasion and will feature Patten and Van Duzer.

The program [closed] with a stirring rendition of Dick Holler’s 1968 classic “Abraham, Martin and John.” The song pays tribute to the memory of Abraham Lincoln, Martin Luther King, Jr., John F. Kennedy, and Robert F. Kennedy, all American icons of social change who were tragically assassinated.

[Odom then brought the audience to its feet one final time with a totally awesome and inspiring encore rendition of “Ave Maria,” to piano accompaniment, in recognition of the “Christ energy” of Dr. King: A characteristic that, to paraphrase Odom’s words, “transcends individual religious beliefs or non-beliefs!”]

[I loved that in his musical selections Odom took pains to showcase the talents of, and share the spotlight with, each member of his amazing band. That shows just the type of teamwork, awareness, humility, and appreciation of those who made and make you what your are that Dr. King preached. It also reminded me of my experiences with Paula, AYUDA, and Georgetown Law (which I’ve also found to be a great team effort.)]

PROLOGUE

Sometimes I find myself running,

my feet burnt and charred from the fire behind me,

A gleeful American history lesson

that always came with a fog.

[During the concert, the stage was enveloped in machine-generated (I assume) smoke and fog to emphasize (I assume) the often ambiguous position and perspective of African Americans and other minorities in relation to the “standard — often whitewashed — version” of the “American Dream.” Does that “Dream” really look the same if your family members were denied educational, political, and economic rights, or the entire “pursuit of life, liberty, and happiness” because of their skin color? I doubt it.]

Sometimes the American dream sounds a lot like pitchforks and screams.

ABOUT THE SONG…

“For most of my life, I have been deeply inspired by the scriptural verse, 2 Chronicles 7:14. If the text does not readily come to mind, here it is for your immediate reference:

If my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then I will hear from heaven, and I will forgive their sin and will heal their land. (King James Version)

These words have long embodied for me the profound hope that God will eventually make right the many wrongs that trouble our land.

In recent years, however, I have found myself challenged by the application of this verse. It’s a wonderful award to a terrific person and true American hero who embodies the values and determination of Dr. Martin Luther King, Jr., and John Thompson, Jr., to fight to finally make equal justice in America a reality and to make our world a better place!

Former Georgetown and Princeton Head Basketball Coach John Thompson III and the Thompson Family attended and were recognized for their continuing contributions to social justice in America and for making this great event possible. Cathy and I were honored and thrilled to be in the audience.

I was especially moved by Paula’s highlighting the successful efforts of AYUDA and other community groups to welcome and care for migrants to DC who were bussed here as part of a nativist political stunt by some governors. Certainly, it illustrates who “gets” Dr. King’s spirit, dreams, and messages of hope and who is arrogantly, and cynically, paying his memory and values “lip service,” at best!

The late Senator Bill Proxmire (D-WI) was a ”good government activist,” famous for his monthly “Golden Fleece Awards!” 🏆🐑 The latter were presented to recognize, or more accurately expose, “the biggest, most ridiculous or most ironic example of government spending.” 

Proxmire was Wisconsin’s longest-serving U.S. Senator (1957-89), having been elected in a 1957 special election to replace the infamous Sen. Joe McCarthy (R-WI) who died in office. (1957 was the year the then Milwaukee Braves beat the mighty NY Yanks to bring Milwaukee what remains its only World Series Championship. We were allowed to listen on the PA system at Washington Grade School, in Wauwatosa, where I was a student!) 

According to his Congressional bio, “Proxmire also set an attendance record not likely to be beaten. Over a period of more than 20 years, he did not miss a single roll-call vote, casting 10,252 consecutive votes before leaving the Senate in 1989.” https://www.senate.gov/senators/FeaturedBios/Featured_Bio_ProxmireWilliam.htm. (Actually, the record was recently broken by Sen. Chuck Grassley (R-IA), sort of, as Grassley eclipsed Proxmire’s years of service, but cast thousands fewer votes, thanks to Congress’s lackadaisical approach to governing in recent years.)

He also famously won contested re-election in 1976 spending under an inflation adjusted $1,000! “He relied upon retail politics — selling himself to Wisconsinites by shaking hands and listening to their stories — to fuel his reelection bid.” https://captimes.com/content/tncms/live/. Proxmire was a rare pol who “walked the walk!”

Sen. Proxmire left the Senate well before the creation of DHS. But, he would have had a field day with entrenched bureaucracy, lack of creativity, and spendthrift ways that have become ingrained in DHS’s poor to pathetic delivery of public services. USCIS lost its way under the malicious incompetence of the Trump Administration and such stunningly unqualified   “leaders” as Ken “Cooch Cooch” Cuccinelli. But, it has continued to “wander in the wilderness” under Biden.

David “hits the nail on the head”: with these two paragraphs:

USCIS is charging more money for less efficient work. It is not surprising that it is taking adjudicators much longer to process forms because the length of the forms keeps growing. The average form length has increased from about 3 pages in 2003—when the agency started—to about 10 pages in 2022.

USCIS should be eliminating the number of required applications and streamlining the process through electronic filing. The “discounts” for online filing that it plans on introducing hardly compensate applicants who must spend much more time using USCIS’s difficult online application portals, and regardless, online filing will remain unavailable for many types of forms. USCIS is moving too slowly to create a modern immigration system.

I’ll bet that with his brilliant mind and work ethic, Eric Holder could actually substantially improve on the alleged 13.2 minute average “adjudication” time for Form I-765.

The EAD is probably the most egregious example of an out of control bureaucracy that charges more for less service and complicates, rather than simplifies, a routine “no-brainer/low risk” function. Even the current $410 fee for an EAD is a ripoff that should be generating tons of excess cash for USCIS. Given the incomprehensible EAD backlog, in fact, the public has paid for lots of “service” that has never been “delivered.” 

In private industry, that would be a “red flag” for potential fraud, waste, and abuse. If there were a “Better Business Bureau” for the bureaucracy, USCIS be in hot — no boiling — water! 

Actually, the DHS IG and the GAO are supposed to perform this function for the Government, but have been largely “MIA” on the rapid downward spiral of the immigration bureaucracy over the past decade! In any event, nobody appears to pay much attention to their reports. They are issued, covered initially by the media, the subject of a few “political sound bites,” and then buried and forgotten (except, perhaps, by historians and scholars). 

DHS needs new creative management, an emphasis on public service, and some close oversight (something Dems conveniently ignored while they had “unified control” of Congress). Most of us “get” that Trump and his flunkies intentionally destroyed what passed for “service” at USCIS. But, that was a well-known fact going into the 2020 election.

After two years in office, whining about what the Trump kakistocracy did or didn’t do, and pointing to Congress’s undoubted dereliction of duty, is getting old. Very old!

The Biden Administration needs to get new leadership into the dysfunctional immigration bureaucracy at DHS, DOJ, DOL, DOS, & other agencies. That must be leadership with a vision, courage, expertise, and a determination to deliver great public services in a competent, timely manner without “breaking the bank” or further blaming, shaming, punishing, or burdening the public “victims” of failed government.

Additionally, the out of touch “Miller Lite Brew Crew” that passes for immigration, human rights, and security advisors at and to the Biden White House needs to be replaced with practical experts who can get the job done without breaking laws and resorting to “built to fail” gimmicks. 

Perhaps Senate Dems need much more of “Sen. Bill Proxmire’s Ghost” 👻 and far less tolerance for “Miller Lite thinking” among Congressional Dems and the Biden Administration!

Undoubtedly, once they get rolling, the “GOP Clown Show” 🤡  in the House will provide lots of unwanted “oversight” to Mayorkas and Garland. But, given the GOP’s toxic record on immigration, it’s highly unlikely to focus on solving any of the REAL problems in the immigration bureaucracy, nor will it promote better public service — something simply not in the GOP lexicon these days.

On Title 42, the Supreme Court rules for a partisan agenda

COVID-19 is no reason to shut out migrants. Yet it’s used as a political pretext.

The Supreme Court’s ruling last week to keep in place a Trump-era immigration order can only be understood as five conservative justices advancing a conservative political agenda, in violation of clear legal rules.

Without giving reasons or any explanation, the court reversed lower court decisions that allowed the Biden administration to lift a restriction that prevents asylum seekers at the border from entering the country, imposed early during the COVID-19 pandemic.

The federal law — referred to as Title 42 — permits the Centers for Disease Control and Prevention to prohibit people from coming into the U.S. to avert the spread of a “communicable disease” present in a foreign country.

In November, U.S. District Judge Emmet Sullivan, in Washington, D.C., found that the continued use of Title 42 was “arbitrary and capricious in violation of the Administrative Procedure Act.” He ruled that the expulsion policy was no longer justified based in light of the present state of the pandemic, which includes widely available vaccines, treatments and increased travel in the United States.

Nineteen states with Republican attorneys general, however, oppose that ruling and sought the right to appeal to the U.S. Court of Appeals for the District of Columbia Circuit. They were not parties to the lawsuit in the District Court and the law generally does not allow parties to get into a case for the first time at the appeals level. On Dec. 16, the federal Court of Appeals, following its well-established law, refused to allow the states to intervene. The states then sought Supreme Court review of that decision.

On Dec. 27, in Arizona vs. Mayorkas, the Supreme Court, in a 5-4 ruling, not only said that it would hear the states’ appeal, but that it would require that the Biden administration continue to use Title 42 to expel migrants.

The court’s action makes no sense for several reasons. Title 42 provides the government authority to close the borders only if a public health crisis involving a communicable disease requires it. No one in the litigation disputes that COVID no longer warrants restrictions on immigration.

The states are intervening not because they believe that a continuing public health emergency requires Title 42, but because they want to use it as a pretext to close the borders.

In fact, in another case now pending on the Supreme Court’s docket — on whether the Biden administration’s student loan forgiveness program is justified as a response to the pandemic emergency — 12 of the states in the Title 42 case argued in their brief that “COVID-19 is now irrelevant to nearly all Americans.”

The Supreme Court’s order is senseless for another reason: The only issue before the court is whether the states can intervene in the case. It is not about whether the District Court erred in ending the use of Title 42 to expel migrants. Even if the states were allowed to join the case, they can’t plausibly make the case that COVID concerns still justify immigration expulsions at this point.

The five conservative justices based their decision not on the purpose of Title 42, which is to stop the spread of a communicable disease, but on their partisan agreement with conservatives on immigration issues. We should expect better of the court than that.

Having a High Court, with life tenure, where a majority of the Justices enter “senseless orders” — targeting some of the most vulnerable and abused in our society who also happen to be predominantly individuals of color — is in and of itself senseless — from a standpoint of preserving our democracy!

The action of the five GOP Supremes is beyond outrageous! The NDPA CAN turn this gross right-wing minority abuse of our judicial system around!  Likely not in my lifetime!

But, you need to keep pushing Dems to pay attention to judicial appointments and start insisting on meaningful professional expertise in immigration and actual experience representing individuals in Immigration Court as a basic requirement to serve as a Justice. Also we need an Article I Immigration Court and NO MORE Attorneys General without proven “grass roots” immigration and human rights experience! 

Immigration is “where the action is” on the fight to save American democracy! If tone-deaf and spineless Dem politicos keep “running” from the key issue in American law and society, perhaps it’s time for true liberals, progressives, and constitutional humanitarian realists to “run” from the Dem Party!

This Supreme farce also reinforces the disgraceful failure of Garland and the Dems to reform the “Supreme Court of Immigration” — the BIA — by replacing enforcement-tilted Trump holdovers with practical scholar, expert, progressive judges committed to realizing long-denied due process, fundamental fairness, and the best interpretations of immigration and refugee laws! Dems control an important Federal Appellate body and are too clueless and afraid to do the right thing — even with the rule of law, racial justice, and human lives on the line!

🤯TRAC: GARLAND’S IMMIGRATION COURT BACKLOG HITS 2 MILLION: More Judges, More Completions, Less Representation, Defective BIA, Mindless Mal-Administration = More Backlog!

It would take approximately 20 Michigan Stadiums to hold all the 2,000,000 + folks waiting for hearings in Garland’s dysfunctional and backlogged Immigration Courts! And, that doesn’t include their families, communities, employers, co-workers and others affected by their fates! If Garland were the managing partner of a law firm or the CEO of a business, he would be “long gone.” Why aren’t competence and accountability  “minimum requirements” for America’s chief lawyer?

Quick takes:

  • Even at this accelerated completion rate, on an annualized basis, I calculate that  EOIR will still be building backlog at a rate of nearly 300,000 annually, based on 800,000 new receipts from DHS.
  • At approximately 700 completions/year/judge (EOIR’s figure), EOIR would need approximately 400 additional, fully trained, fully productive IJs on the bench just to “break even” and stop creating more backlog.
  • Nearly 800,000 asylum cases are sitting in the backlog, many ready to try and pending for years. With a better BIA and better trained IJs who actually applied Cardoza-Fonseca, Mogharrabi, and the regulatory presumptions of well-founded fear properly (instead of being “programmed to deny”) the vast majority of these old asylum cases could be prioritized and granted in short hearings.
  • Even with today’s broken, biased, and unconstitutionally inconsistent Immigration Courts, migrants prevail against deportation in approximately 60% of cases! This suggests that the majority of the Immigration Court’s cases could be prioritized and resolved in the migrant’s favor without lengthy hearings IF the system had a better BIA, better IJs, better training, better practices, and a better working relationship with the private bar and DHS. 
  • Far too few bonds are being granted, and insufficient attention is being paid to inconsistencies in the bond process.
  • Only an infinitesimally small percentage, .56%, of new cases filed by ICE involve allegations of criminal conduct. This suggests continuing problems with the way ICE allocates enforcement resources and chooses to use Immigration Court time.

I was off by 3 months, as it actually took him until the end of November 2022 to achieve this negative landmark.

Nevertheless, some things are clear: This system is “beyond FUBAR!” It needs professional leadership, a new appellate board, better judges, better training, better utilization of the private bar, smarter, more creative and innovative practices, and authority to “rein in” in out of control ICE Enforcement. All the same things experts said were needed back at the time of Biden’s election! Ignoring expert advice has resulted in just the continuing, mushrooming disaster at EOIR and in our legal system that experts predicted!

Over two years, Garland has shown that he is not the person for the job. Nor have his political subordinates shown any aptitude for addressing the festering management, legal, and quality control problems @ EOIR!

Experts and advocates should be pushing the Administration and Dems in Congress for a change in leadership at the DOJ! Every day of failure means more backlog, more injustice, more frustration, more lives endangered, and a growing threat to American democracy — from those sworn to protect and uphold it, but aren’t getting the job done!

“The IJ granted Omorodion’s application for deferral of removal under the CAT and, after an initial remand by the BIA, reaffirmed that decision. In July 2018 the BIA vacated the IJ’s grant of CAT relief and ordered Omorodion removed, concluding that Omorodion did not show that she would suffer torture or that public officials would acquiesce in her torture. … First, Omorodion argues that the BIA mischaracterized and ignored key evidence. We agree. … The BIA also erred by failing to apply the clear error standard in its review of the IJ’s “predictive finding that [Omorodion] would suffer torture by or with the acquiescence of the Nigerian government.” … The BIA erred as a matter of law when it overlooked such evidence and rejected the IJ’s predictive finding. To summarize, we grant the petition and remand because the BIA overlooked material components of the record and misconstrued others. See Xiao Kui Lin v. Mukasey, 553 F.3d 217, 220 (2d Cir. 2009). Should the BIA vacate the IJ’s grant of CAT relief on remand, it should explain where it identifies clear error in the IJ’s factfinding based on the totality of the record. If any vacatur is not due to clear error, the BIA must otherwise “provide sufficient explanation to permit proper appellate review” of its decision. Hui Lin Huang, 3 677 F.3d at 137. For the foregoing reasons, the petition for review is GRANTED, the BIA’s decision is VACATED, and the case is REMANDED for further proceedings consistent with this order.”

CA2 on Asylum, Changed Circumstances: Perez Nagahama v. Garland

“We remand for the agency to conduct the required factfinding and analysis regarding the reasonableness of Perez Nagahama’s delay in filing her asylum claim following her changed circumstances. An asylum applicant must file an asylum “application . . . within 1 year after the date of . . . arrival in the United States.” 8 U.S.C. § 1158(a)(2)(B). There is an exception for “changed circumstances which materially affect the applicant’s eligibility for asylum.” Id. § 1158(a)(2)(D). Where there is such a change, the applicant must file an application “within a reasonable period given those ‘changed circumstances.’” 8 C.F.R. § 1208.4(a)(4)(ii). The IJ concluded and the BIA assumed that Perez Nagahama’s circumstances changed materially when she began living as openly gay in April 2015. What is a reasonable period for filing after a changed circumstance is a fact-specific inquiry: IJs should make specific “findings of fact with respect to the particular circumstances involved in the delay of the respondents’ applications” to determine the reasonableness of the delay. Matter of T-M-H- & S-W-C-, 25 I. & N. Dec. 193, 195–96 (B.I.A. 2010). … Perez Nagahama has raised a reviewable question of law that the agency failed to apply the proper standard because it did not consider her specific circumstances before concluding that her delay was unreasonable. … The agency did not conduct the required factfinding and analysis. … Here, the IJ did not make findings of facts regarding the reasonableness of the delay in light of the attendant circumstances. The BIA should have remanded to the IJ to consider whether the delay was reasonable. … Instead, the BIA made its own factual determinations that Perez Nagahama beginning to live as openly gay did not make her delay reasonable and that the other facts she pointed to were not related to this underlying changed circumstance. Compounding this issue, the BIA gave no reasoning for its conclusion that the relevant circumstance made her delay unreasonable.”

Clearly, the BIA’s performance in this and other recent CA remands is far below even the “good enough for government work” mantra that prevails at Garland’s dysfunctional EOIR! Why does Garland think “NOT good enough for government work” is “good  enough for due process for ‘persons’ who happen to be foreign nationals” with the their lives at stake in his “smashed to smithereens” piece of our “justice” system? 

The only way Garland gets to where his EOIR is today is by “Dred Scottification:” That is, intentionally treating “persons” (“humans”) in his Immigration Courts as “non –persons” under the Due Process Clause of our Constitution. If that sounds like a “Stephen Miller wet dream”🤮 (grotesque as that image undoubtedly is), it’s because that’s exactly what it is! How does a Dem Administration get away with this affront to due process, equal protection, and racial justice in America?

Kind of makes me wonder what they taught at Harvard Law (Garland’s alma mater) and other so-called “elite” law schools. I daresay that virtually all law students I have encountered in teaching immigration and refugee law for a number of years at Georgetown Law would have done better than the BIA had these cases been on my final exams. 

The BIA’s inability to fairly and competently apply basic legal standards, honestly and professionally evaluate evidence of record, give asylum applicants the “benefit of the doubt” to which they are entitled under international standards, provide positive practical expert guidance on granting relief, eliminate “asylum free zones,” promote uniform outcomes, and develop and enforce “best judicial practices” is a major factor in the incredible two million case backlog that Garland has built in Immigration Court! His failure to take corrective action by replacing the BIA with competent, expert, unbiased appellate judges is a major breach of both ethical standards and his oath of office! How does he get away with it?

Thousands of asylum applicants at our border are being illegally returned to danger! Individuals with valid claims to be in the United States are routinely being denied relief for specious reasons and clear misapplications of basic legal standards in his “courts” —  powerful indicators of systemic bias that should have been forcefully addressed by Garland on “day one” of his tenure at EOIR, as experts recommended.

Garland’s victims’ lives are irrevocably ruined or even ended! Misery is inflicted on their family, loved ones, and American communities! Dedicated lawyers working overtime to save lives are mistreated by Garland’s courts and traumatized by sharing the horrible consequences to their clients of systemic inferior judging! America is denied legal immigrants we need! 

Our Federal justice system is overwhelmed with wasteful and never-ending litigation of immigration cases that should have been timely granted in the first instance and bad policies that never should have seen the light of day. In this respect, note that the IJ actually got it right in Omorodion! Then, in attempting to accommodate DHS and achieve an illegal removal, the BIA completely botched it on appeal! Even where justice prevails at the “retail” level, the BIA screws it up!

Yet Garland just shows up for work and draws his paycheck as if this were the way “justice” is supposed to work in America and fixing it is “below his pay level!” Gimmie a break!

Meanwhile, back at the ranch, many congrats and much appreciation to NDPA stalwarts Tom Moseley and Genet Getachew!

Garland is a disgraceful failure as our nation’s top lawyer; Congress is deadlocked and uninterested in solving immigration and human rights problems; Federal Courts, these days often “stacked” with far-right ideologues, too often look the other way at gross violations of due process, overt racism, misogyny, and bad interpretations as long as it’s “only migrants of color” (“non-persons” in the view of some) and their lawyers whose lives are being trashed. At best, the Circuits provide widely inconsistent review and results — perhaps not quite as bad as EOIR, but still far beyond anything that would be acceptable if migrants were actually treated as “persons” as the Constitution clearly provides.

I receive some desperate anecdotal complaints about the absurdly broken system and unprofessional conduct by some IJs and EOIR officials here at “Courtside.”

Here’s a recent one from a long-time practitioner that more or less sums up Garland and the Biden Administration’s incredibly disreputable mal-administration of EOIR:

Everything at EOIR is such a disgrace. It is now very difficult for me to appear before IJs, as I have complete contempt for the agency. It is so much worse now than when Trump was in charge. But of course, EOIR could care less, and obviously, this IJ could care less as well…

“Much worse now than when Trump was in charge!” Let that sink in folks!

As I’ve said before, “This just isn’t right!” But, we seem to be dealing with three branches of “Government” who have simply turned their collective backs on the Constitution, the rule of law, common sense, and the fundamental obligations of decency that human beings owe to each other. They also deny the truth: That immigrants are and will continue to be an essential part of the fabric of our society. So, many have asked me “What’s the answer?”

Storm the fort “from the inside!” Use your superior knowledge, organizational, and problem solving skills to get on the Immigration Bench and get paid to do things the right way, help force systemic change over time, save some very deserving lives, and help preserve and improve our democracy at the same time. 

One of the few advantages of working in an “out of control” system is this: there isn’t much control. That often motivates sloppy work, corner-cutting, and a “who cares” approach. 

But, it can also motivate and allow those with the skills and moral integrity to “do the right thing,” to put due process first, solve problems (satisfying), and institute “best practices” rather than worst practices in YOUR courtroom, even if only on a case-by-case basis. And, guess what? Things that “work” and efficiently resolve problems in your courtroom do impact the rest of the system! 

Eventually, it can lead to demands to stop doing things the same old wrong and unfair way and start start treating others fairly and with dignity. Surprisingly, despite persistent bureaucratic myths to the contrary, doing things the right way and treating everyone fairly is more efficient than repeating the same old mistakes, based on the same old discredited “deterrence myths,” over and over. Recognizing and timely granting deserving cases is the very best, totally overlooked, way of cutting backlog and forcing the system to be more efficient without stomping on anyone’s rights or humanity!

Sure, the EOIR system only superficially claims to be interested in efficiency. What they really want is the “appearance of efficiency” with the ability to shift blame for problems to the “victims” of their incredibly poor performance! 

But, eventually enough folks in the right places can get the idea that doing things the right way could actually be better for the system than repeating past mistakes and covering up. The latter gets stressful, even for politicos and bureaucrats who have made careers out of avoiding accountability and responsibility. And, there are certainly plenty of those in today’s EOIR and DOJ.

So here are 10 great opportunities to “get on the inside” and start fixing justice in America and the critical “retail level.”

It is REALLY important that great attorneys of all genders and ethnic groups apply for these important positions. EOIR has NEVER been representative of either the communities it serves or the talent and diversity of the private immigration/human rights bar. The “bureaucratic excuse” has been that the “pool” of USG applicants, particularly those from DHS and prosecutorial backgrounds, is always far “superior.” 

I call BS! But, the only way to “prove it wrong” is if “the best and brightest” from the private sectors apply en masse. 

EOIR will NOT improve voluntarily. Over the past two disgraceful years, Garland has proved that “beyond a reasonable doubt.” So, get on the inside and start changing this system to promote impeccable scholarship, due process, fundamental fairness, and best practices from the inside and from “the bottom up!”

Because, waiting for Merrick Garland and his “clueless” crew @ DOJ and EOIR to get the job done for equal justice and racial justice in America will be like “Waiting for Godot.” And, we all know how that turns out.
