Thirty-two years of diplomatic service taught me a number of things. One is that wherever politics and society seem irredeemably dysfunctional, it is not an accident. It is, at some level, intentional. Someone has a vested interest in continuing the chaos. Someone is getting rich, or powerful, or both; and even the most zealous reform efforts will likely fail unless those interests are mollified or neutralized.

The immigration debate follows that lesson. It is shrill, jumbled, disjointed, often illogical—and largely irrelevant to the reality it claims to address. A big, beautiful wall across our southern border may do little to stem the flow of drugs, criminals, terrorists and even unauthorized migrants into the United States—but its promise is pure gold. Like all the other sharp notes in this performance—including the travel ban, chain migration and anchor babies—the cacophony surrounding the wall helps both supporters and opponents puff out their chests and strut their virtue.

The only losers are those who have more than a partisan or emotional interest in resolving the conflict, including actual immigrants and the communities that receive them. They should not expect a resolution to their real and pressing concerns anytime soon.

Yet the scope of irregular migration today—with upward of 65 million people on the move—is such that it cannot be pushed aside. At the same time, no single country can respond adequately on its own. Diplomacy in the interest of fashioning international agreements to manage the problem is the only viable approach.

Legal Requirements vs. Humanitarian Instincts

Public talk about immigration reminds me of every discussion I ever heard in a Bosnian coffee shop during my 2014-2015 tenure as principal deputy high representative, and earlier as a refugee officer. It invariably begins and ends with an impassioned reference to some horrific event that obscures rather than illuminates the issue at hand. Both sides illustrate strongly held opinions with graphic examples excoriating the other point of view. Anti-immigrant zealots demonize immigrants as rapists and murderers; the other extreme sanctifies them as innocent victims of circumstance or malice. Both points of view are dehumanizing. They rely on stirring but distorted images to carry their arguments rather than on real people with complex motives and histories. Their aim is to capture the moral high ground, not to solve the problem.

Focusing on national immigration reform as a response to that wave is neither comprehensive nor realistic.

But manipulating imagery does not change the facts. Immigration has no inherent moral value, and immigrants are neither more nor less virtuous than anyone else. They were pushed or pulled from their homes by a host of different reasons from personal ambition to cataclysmic disaster. Some are victims, some are opportunists; some should be welcomed, some rejected. What separates migrants and non-citizen immigrants from their citizen neighbors is vulnerability. Regardless of wealth, stature or origin, immigrants are at the mercy of authorities and systems over which they have little or no influence. Their voices and images may be emotionally affecting, but their future is beyond their control.

That dependency drives the conflict about immigration reform, setting the rule of law against humanitarian impulse. It also opens the door to diplomacy. National laws deciding who may and may not enter a country always produce inequities; they always leave on the outside someone who has a legitimate need for entry but lacks the appropriate legal category or political timing to gain it. Visa classifications, refugee protocols and asylum guidelines cannot keep pace with global trends—from criminal violence and global warming to new definitions of marriage and family composition. Immigration liberalizers point to the law’s deficiencies and appeal to values over statutes, while build-the-wall advocates tout the law as the final, unyielding authority. The debate has turned into a name-calling melee as the number of migrants and intending immigrants continues to grow.

My own views on migration evolved in two parts. As a junior consular officer in the Dominican Republic, I scrupulously followed the rules and kept away from America’s shores the “wretched refuse” desperate enough to believe our own mythology. Years later, as a refugee officer, I met humanity’s outcasts in the makeshift places they sought shelter. The memory of a refugee child from Kosovo haunts me still. Who had the right to confine a 10-year-old boy behind a chain link fence? Legally, the government of Macedonia, whose border he had crossed; morally, nobody. It is shocking to me that I may now encounter that same scenario in the United States: legally permitted, morally repugnant.

Unproductive Approaches to Irregular Migration

Erasing that image and closing the distance between legal requirements and humanitarian instincts is a global, rather than national, enterprise. No single country has the political or social bandwidth to respond adequately to the growing demands and pressures of irregular migration. Sixty-five million people on the move do not fit into existing categories, either legal or humanitarian. Neither will they be deterred by piecemeal border controls. Focusing on national immigration reform as a response to that wave is neither comprehensive nor realistic. It is akin to promoting air conditioners as the answer to climate change. The problem will just continue to grow until it overwhelms efforts to avoid it.

Equally unproductive is treating irregular migration as principally a development challenge. Initiatives to reduce poverty or end conflict may have merit in their own right, but they are a long-term gamble, at best, and seldom include migrants in their plans and programs. The Dadaab complex in Kenya, a “temporary” shelter to hundreds of thousands of refugees for three decades, is a case in point. By any rational measure, Dadaab is a development challenge rather than a humanitarian crisis, but that transition never happened. In the meantime, its occupants remain in limbo, deprived of relatively normal and productive lives. Those who are able will continue to migrate and seek their futures elsewhere, including in the United States.

The Global Compact for Safe, Orderly and Regular Migration, though nonbinding, marks the first comprehensive effort to address human mobility at the global level.

Sidestepping the challenge of irregular migration leads nowhere. The only realistic starting point for effective, palatable reform is to accept shared responsibility for managing migration in the first place. We cannot eliminate the reasons large numbers of people move unexpectedly, nor can we isolate ourselves from their impact. We can, however, build agreements and networks across borders that establish the norms and rules for their treatment and that address the concerns of the communities that encounter them. We can, through diplomatic agreements, impose a semblance of order on what has become chaos.

There is precedent for this approach. The 1951 Refugee Convention and the subsequent regional agreements it prompted have created a durable framework for the protection of people fleeing persecution and seeking asylum in other countries. They make refugee protection a duty under international law and prohibit forcible return home. The agreements also establish common criteria for adjudicating refugee claims. The regime is imperfect and under stress, but it works. It measures progress, clarifies disputes and assigns responsibility. It is also the basis for a web of public and private, national and international agencies working to implement and improve it. Until recently, the United States was its most generous and reliable supporter.

A Necessary First Step

Extending the principles of protection and due process beyond refugees to all vulnerable migrants seemed within reach as recently as the United Nations General Assembly in 2016. All 193 member-states approved the New York Declaration for Refugees and Migrants that, among other actions, called for a Global Compact for Safe, Orderly and Regular Migration. The compact was approved in December 2018. Although nonbinding, it marks the first comprehensive effort to address human mobility at the global level. It extends human rights norms and development goals to previously disregarded people while reaffirming the prerogative of every country to enforce its own laws. While not a permanent solution to runaway migration, the compact is a necessary first step toward diplomatic problem-solving. It is a meeting place, not a traffic cop, and shifts the needle away from blame toward shared responsibility.

Predictably, however, storm clouds gathered early. The United States was the first to jump ship, citing the paper-thin excuse that the compact interfered with sovereign law enforcement even though it explicitly reaffirms state sovereignty on all immigration decisions. A transparently flimsy excuse made even before the document had been fully drafted, it nevertheless emboldened others to follow. By the time the compact came to a vote, 29 countries had abandoned the effort, leaving 164 to endorse it.

Washington’s position on almost any significant issue signals either permission or caution; and at best, when directed skillfully, it compels action.

This backtracking is significant because it reflects pernicious nationalism as much as supposed flaws in the compact itself— such as signaling climate change as a trigger for migration and encouraging the use of detention only as a last resort. Politically manipulated fear of migrants from “shithole countries” (as our president has called them) and Muslim refugees from war zones had advanced a narrative that facts, no matter how twisted, simply did not support. Yet while the threat may be fake news, proclaiming it worked to the advantage of politicians and pundits who trade on isolationism, supremacy and ignorance.

It may not be unusual for countries to walk away from nonbinding agreements, and often their absence goes unnoticed. The United States is an exception to that rule; its absence is always felt and its presence is almost always required for meaningful international agreements to take root. An ambassador from a Middle Eastern country sitting next to me in Geneva in December 2011 groaned and shook his head when Secretary of State Hillary Clinton declared to the packed audience that gay rights are human rights. I asked him why he had come, knowing the direction of the speech in advance. He smiled, shrugged and said: “The American Secretary of State. Of course I’m here. But I don’t like it.” He didn’t have to like it, but he did have to deal with it—as long as the United States and its allies continued to press the point.

Diplomatic Leadership

While a Secretary of State’s moral and diplomatic authority may be less compelling today than it was then, it still matters. Influence is not optional for the United States. Washington’s position on almost any significant issue signals either permission or caution; and at best, when directed skillfully, it compels action. Not supporting the Global Compact for Safe, Orderly and Regular Migration is a missed opportunity to set a global agenda that is too complex and ambitious to thrive without U.S. diplomatic and financial support. There are signs of hope, mainly in Africa, in countries that have embraced the compact and are building the legal and humanitarian framework it promotes. They may have some regional success; but globally their influence is no match for the challenge they face.

So the question remains: Where will the global leadership come from? Humanitarian imperatives and rule of law requirements are still on a collision course. The administration apparently hopes the problem will go away if we hide behind a wall. It will not. The rational choice is to join ranks with those seeking a coordinated response to the challenge. That is the direction American diplomacy should take and American diplomats should endorse.

RUDE AWAKENING? — Some In GOP Finally Concerned About Idiotic Actions Of White Nationalist “Tariff Man” — But Don’t Expect Much Action Given GOP’s Endemic Cowardice In The Face Of Trump!

WASHINGTON — Republican senators sent the White House a sharp message on Tuesday, warning that they were almost uniformly opposed to President Trump’s plans to impose tariffs on Mexican imports, just hours after the president said lawmakers would be “foolish” to try to stop him.

Mr. Trump’s latest threat to impose 5 percent tariffs on all goods imported from Mexico, rising to as high as 25 percent until the Mexican government stems the flow of migrants, has prompted some of the most serious defiance in the Republican ranks since the president took office.

Republican senators emerged from a closed-door lunch at the Capitol angered by the briefing they received from a deputy White House counsel and an assistant attorney general on the legal basis for Mr. Trump to impose new tariffs by declaring a national emergency at the southern border.

“I want you to take a message back” to the White House, Senator Ted Cruz, Republican of Texas, told the lawyers, according to people familiar with the meeting. Mr. Cruz warned that “you didn’t hear a single yes” from the Republican conference. He called the proposed tariffs a $30 billion tax increase on Texans.

“I will yield to nobody in passion and seriousness and commitment for securing the border,” Mr. Cruz later told reporters. “But there’s no reason for Texas farmers and ranchers and manufacturers and small businesses to pay the price of massive new taxes.”

The president’s latest foray into a global trade war has troubled economists and roiled stock and bond markets. The Federal Reserve chairman, Jerome H. Powell, hinted on Tuesday that the central bank could cut interest rates if the trade war started to hurt the economy. The remarks sent stocks higher for their strongest day in months.

But senators were mindful of the long-term stakes for their home states.

[Mr. Powell’s comments sent a signal that the central bank was watching Mr. Trump’s trade wars warily.]

Texas would be hit the hardest by the proposed tariffs on Mexican products, followed by Michigan, California, Illinois and Ohio, according to the U.S. Chamber of Commerce. A 25 percent tariff would threaten $26.75 billion of Texas imports.

“We’re holding a gun to our own heads,” said Senator John Cornyn, Republican of Texas.

If Mr. Trump were to declare an emergency to impose the tariffs, the House and the Senate could pass a resolution disapproving them. But such a resolution would almost certainly face a presidential veto, meaning that both the House and the Senate would have to muster two-thirds majorities to beat Mr. Trump.

Senator Ron Johnson, Republican of Wisconsin, said he warned the lawyers that the Senate could muster an overwhelming majority to beat back the tariffs, even if Mr. Trump were to veto a resolution disapproving them. Republicans may be broadly supportive of Mr. Trump’s push to build a wall and secure the border, he said, but they oppose tying immigration policy to the imposition of tariffs on Mexico.

“The White House should be concerned about what that vote would result in, because Republicans really don’t like taxing American consumers and businesses,” Mr. Johnson said.

Mr. Trump, just hours before at a news conference in London with the British prime minister, Theresa May, said he planned to move forward with imposing tariffs on Mexican imports next week as part of his effort to stem the flow of migrants crossing the southern border.

“I think it’s more likely that the tariffs go on, and we’ll probably be talking during the time that the tariffs are on, and they’re going to be paid,” Mr. Trump said. When asked about Senate Republicans discussing ways to block the tariffs, Mr. Trump said, “I don’t think they will do that.”

He said, “I think if they do, it’s foolish.”

Republicans are still holding out hope that the tariffs can be avoided. Mexico’s foreign minister is leading a delegation to Washington this week to try to defuse the situation with the Trump administration. A White House meeting with Vice President Mike Pence and Secretary of State Mike Pompeo on Wednesday could prove pivotal.

“There is not much support for tariffs in my conference, that’s for sure,” said Senator Mitch McConnell of Kentucky, the majority leader. “Our hope is that the tariffs will be avoided, and we will not have to answer any hypotheticals.”

Rubio’s pro-Trump tweet seems pretty off-base. Other than the fact that Trump is incompetently using Border Patrol on a self-created emergency that could be handled by Inspectors and Asylum Officers at ports of entry, allowing Border Patrol Officers to focus on more important law enforcement duties, there doesn’t appear to be any known connection between families from the Northern Triangle turning themselves in and applying for legal asylum under our laws and “drug smuggling.” Nor do such individuals who turn themselves in present any known threat to either national security or our economy (particularly since Trump plans to bar them from working unless and until they actually receive asylum under a system he has intentionally skewed against them). Indeed, smugglers would have to be pretty stupid to use individuals who intended to turn themselves in to the Border Patrol at the border as “drug couriers.”

On the other hand, Trump’s incompetent handling of the border situation, his gross misuse of national emergency and tariff authorities, and his attacks on trade with Canada and Mexico, two of our major allies and trading partners, does promise to threaten both our econommy and our national security. Rather ironic that the asylum applicants are the ones using our legal system while Trump is the one trashing it in multiple ways.

Sen. Tillis also seems out of bounds.  Individuals have a right to apply for ayslum.  Undoubtedly, the number of individuals now applying could be processed fairly and legally for much less than Trump’s tariffs would cost U.S. consumers, not to mention the money wasted on useless walls, unnecessary detention, and misuse of American troops. Even spending some money on helping Mexico improve its system and joining Mexico’s initiative to improve conditions in the Northern Triangle would be more cost effective than tariffs.

Why would Tillis expect Mexico, a smaller and poorer country, to do a better job of stopping the flow than the U.S. has? How would he expect Mexico to process all the migrants without major human rights violations? Wouldn’t wrecking the Mexican economy, along with our own, restart the flow of Mexicans going north that actually has been reversed in recent years? Pretty scary how little the GOP understands about migration and sound immigration policies.

When policy is made based on irrational factors such as White Nationalism, racism, contempt for foreign countries, and disregard for human rights, bad things are going to happen. But, I’m still not betting on the GOP to stand up to Trump. Lots of grumbling; but, in the past, such grumbling has seldom been turned into action.

TRUMP UNINTERESTED IN SOLVING CENTRAL AMERICAN MIGRATION ISSUES: While Mexico & Others Propose Regional Effort To Improve Conditions, Trump Responds With Racist Rants & “Guaranteed To Fail” Enforcement!

Even by President Trump’s pyrotechnic standards, his announcement on Thursday that he will impose a sweeping 5 percent tariff on all Mexican goods coming into the United States unless Mexico stops the flow of illegal immigration is unprecedented. The threat is unjustifiably heavy-handed and will further erode cooperation in bilateral relations as the contentious debate over immigration spills into areas that had been successfully compartmentalized.

Above all, Trump’s threat illustrates his absolute disinterest in reaching a sensible understanding.

The government of President Andrés Manuel López Obrador has shown unparalleled compliance with the White House’s punitive demands. It has increased the number of agents at its southern border, agreed to hold asylum seekersand dramatically increased deportations of potential asylum seekers.

Late on Thursday, López Obrador answered Washington with a long letter that included a lecture on American history, a brief declaration of discrepancy with Trump’s methods and a mellifluous plea for productive and urgent dialogue. Good luck with that.

Trump’s latest salvo also illustrates the profound rift in the different approaches to solve the humanitarian crisis that first began in Central America’s “Northern Triangle” of Guatemala, Honduras and El Salvador.

Early last week in Mexico City, Alicia Bárcena, head of the United Nations Economic Commission for Latin America and the Caribbean, revealed an ambitious development project for Mexico’s southeast and the troubled Northern Triangle.

“Why do people choose to leave?” Bárcena asked. “The lack of a basic source of income and economic opportunity is one of the main reasons.” She went on to explain how inequality, violence and global warming have also fueled the emergency. Bárcena then suggested what she called an “innovative” solution to the problem: Rather than focus on punishing measures to deter immigration, the region should instead emphasize growth through cooperation. López Obrador, sitting a few feet away, nodded. “This plan is important because it goes to the heart of the matter,” López Obrador later added. “People emigrate out of necessity. There’s no other way but to cooperate in search of development.”

But López Obrador’s words belied his own government’s actions.

Contrary to Trump’s unfounded complaints, Mexico has actually implemented myriad other, more bruising ways to try to stem the flow of immigrants toward the United States. In a somewhat schizophrenic policy, it has simultaneously slashed funding for the agencies assigned to handle refugees within the country while executing some of the most punitive schemes put in place by the Trump administration. Not exactly development-oriented actions.

Still, López Obrador insists that the only long-term solution to the current immigration crisis lies in opening new areas of opportunity for the hundreds of thousands of Central Americans who decide to migrate. All three Northern Triangle countries seem to agree: Diplomats for Honduras, Guatemala and El Salvador surrounded López Obrador for Bárcena’s presentation in Mexico City.

The problem, of course, is the one country missing from this seemingly unanimous show of goodwill: the United States.

For six months now, López Obrador has tried to persuade the Trump administration to invest billions in Central America rather than just focus on enforcement. Just a few days after Bárcena’s impassioned announcement, López Obrador dispatched Foreign Minister Marcelo Ebrard to sell Trump’s team on regional development. Ebrard didn’t go far. While he did meet with acting Homeland Security Secretary Kevin K. McAleenan and Jared Kushner, he was snubbed by Secretary of State Mike Pompeo, who canceled a previously scheduled meeting with his Mexican counterpart. Ebrard flew back empty-handed.

Is Mexico being naive? Clearly. To acquiesce to an investment project for Central America would require a complete about-face in Trump’s hostility toward the region. Before Trump announced that he will suspend all aid to Guatemala, Honduras and El Salvador as punishment for their supposed inaction to prevent the migrant exodus, the United States had assigned slightly more than $180 million in funding for the three countries combined in 2019, less than 2 percent of the amount Mexico would like to see the United States provide the area through aid and investment in the coming years.

Getting Trump to invest seems like a long shot. Just how long? The White House isn’t exactly masking his invective.

Aside from the drastic imposition of tariffs, the Trump administration is also apparently considering limiting the ability of potential migrants to request asylum in the United States if they have traveled by land through Mexico, a radical change that could create an unmanageable bottleneck and humanitarian crisis of catastrophic proportions for Mexico’s unprepared and underfunded government agencies.

As if that weren’t enough, consider McAleenan’s visit to Central America this week. McAleenan did indeed carry with him a message of collaboration, but certainly not in the areas Ebrard and Bárcena might have hoped for.

On Wednesday, McAleenan met with the Guatemalan Ministry of Government to sign a formal memorandum of cooperation that focuses almost exclusively on enforcement. “Both countries have agreed to take concrete actions necessary to combat the scourge of human trafficking and smuggling, interdict illicit drug trafficking, and target illegal trade and financial flows,” the Department of Homeland Security explained in a statement. “This will include law enforcement training and collaboration to improve criminal investigations.”

The region’s long-term development merited only the vaguest of mentions. In theory, DHS said, the agreement will “improve the ability of both countries to identify and better understand” the root causes of immigration. That’s a long way from the kind of commitment needed to rebuild an impoverished, violent and drought-stricken region.

On Wednesday, I asked a spokesman for Mexico’s foreign ministry about the development plan’s outlook if the Trump administration ultimately declines to join. “Their support is important,” he told me. “But we don’t need the United States. This is our plan.”

This bravado is misguided. The United States is not just another actor in the current drama. Without it — or worse, with the Trump administration as rabid antagonist — a regional bet on Central America’s future will face impossible odds.

  • The U.S. bears considerable responsibility for Central America’s current problems;
  • Therefore, U.S. acceptance of responsibility and meaningful participation in the solution is essential;
  • Any solution will require the U.S. to accept a robust number of those forced to flee the Northern Triangle;
  • A solution will take time; the longer the Trump Administration dawdles, the more the problems leading to forced migration will fester and grow;
  • Unilateral law enforcement, gimmicks, and threats can’t solve the problem and are in fact proving to be counterproductive;
  • The Trump Administration’s current approach is not only spectacularly unsuccessful, but will sow regional resentment against the U.S. for decades to come.

Power is condemning lawful asylum seekers to a system designed for criminals.

For more than seven months, Ysabel has been incarcerated without bond at an immigrant detention center in southern Arizona, part of a vast network of for-profit internment facilities administered by private companies under contract with the Department of Homeland Security.

I visit Ysabel (who has asked not to be identified by her real name for her protection) every two weeks as a volunteer with the Kino Border Initiative, one of ahandful of migrant advocacy groups running desperately needed visitation programs in Arizona, including Mariposas Sin Fronteras and Transcend. As volunteers, our primary role is to provide moral support; facilitate communication with family members and legal service providers; and serve as a sounding board for frustration, confusion and, often, raw despair.

Ysabel and the other asylum seekers we visit often ask for simple forms of support, such as small deposits into their commissary accounts to let them call relatives or purchase overpriced goods like dry ramen, tampons, shampoo or headphones for watching telenovelas. They often ask us to send them books in Spanish — one of the few things that they are permitted to receive through the mail without clearance from a property officer. Large-print Bibles are the most popular, along with books of song and prayer, bilingual dictionaries and English course books, romance novels, and other books that provide ways to pass the time — word puzzle collections, coloring books, books for learning how to draw and instruction manuals for making origami figurines.

Ysabel arrived at the United States border last October after leaving her home and two children in eastern Venezuela. The region she fled was plagued by disorder long before the more widely reported upheavals of recent months, suffering frequent power outages, widespread violence and unrest, and severe shortages of food, water and medication. In the years leading up to her flight from the country, Ysabel told me that she had been kidnapped, robbed at gunpoint multiple times and shot at during an attempted carjacking.

Abigail Hauslohner and Maria Sacchetti report: “Federal law and court orders require that children in Border Patrol custody be transferred to more-hospitable shelters no longer than 72 hours after they are apprehended. But some unaccompanied children are spending longer than a week in Border Patrol stations and processing centers, according to two Customs and Border Protection officials and two other government officials. … One government official said about half of the children in custody — 1,000 — have been with the Border Patrol for longer than 72 hours, and another official said that more than 250 children 12 or younger have been in custody for an average of six days. …

The McAllen Border Patrol station, a facility near the southern tip of Texas that is routinely overwhelmed, was holding 775 people on Tuesday, nearly double its capacity. The Washington Post this week made a rare visit inside the facility, where adults and their toddler children were packed into concrete holding cells, many of them sleeping head-to-foot on the floor and along the wall-length benches, as they awaited processing at a sparsely staffed circle of computers known as ‘the bubble.’ … Experts say transferring children out of detention facilities as quickly as possible is critical, especially for ‘tender age’ children — those 12 or younger, who face physical and mental health issues even during short periods in detention. They sleep fitfully, do not eat well and suffer anxiety, said Amy Cohen, a child psychiatrist and expert witness in the Flores case.”

— Border agents apprehended 1,036 migrants in a record roundup near El Paso earlier this week. The apprehensions, which included 63 children traveling alone, reflect an uptick in the number of large groups trying to cross the border. Border agents apprehended a group of 424 migrants, the previous record, just last month. (NBC News)

WASHINGTON, May 31, 2019 — The American Bar Association is deeply disturbed by reports that hundreds of unaccompanied children seeking refuge in the United States are being held by the U.S. Border Patrol in violation of the law and federal policies.According to federal law and court orders, immigrant children generally cannot be held by law enforcement for more than 72 hours before being transferred to shelters that are better equipped to care for their physical and psychological needs. WASHINGTON — President Trump said Thursday that he planned to impose a 5 percent tariff on all imported goods from Mexico beginning June 10, a tax that he said would “gradually increase” until Mexico stopped the flow of undocumented immigrants across the border.

The announcement, which Mr. Trump hinted at on Thursday morning and announced on his Twitter feed, said the tariffs would be in place “until such time as illegal migrants coming through Mexico, and into our Country, STOP.”

In a presidential statement that followed, he said that tariffs would be raised to 10 percent on July 1 “if the crisis persists,” and then by an additional 5 percent each month for three months.

Yeah, I know, the economy continues to blaze away, markets are high, and unemployment low. But, remember the little warning line at the bottom of the prospectus of your most successful financial investment: Past results are not a prediction of future returns.

HISTORY: CHINESE WORKERS MADE AMERICA GREAT BY BUILDING THE TRANSCONTINENTAL RAILWAY: Their “Reward” From A Racist Nation: Deportation, Exclusion, Bias!

One of the earliest stories I heard as a child was that my immigrant great-great-grandfather worked out West on the first transcontinental railroad. Yuan Son, along with tens of thousands of other Chinese workers, blasted tunnels, carved footholds and laid grade at death-defying heights through the most arduous parts of the Sierra Nevada, miraculously making it out alive. I envisioned him tough and swashbuckling — a cross between my tall, bartender grandfather, who often told me these stories while smoking a Marlboro in our home in Queens, and Yosemite Sam.

My great-great-grandfather and his fellow laborers toiled around the clock in rotating shifts, handling explosive nitroglycerine, blasting through miles of granite, hauling tons of rock and dirt, even in upwards of 30 feet of snow. They endured brutal working conditions we would consider unconscionable today to complete the most difficult sections through the Sierra Nevada — the same terrain that stopped the ill-fated Donner Party in its tracks — and finally out to Nevada and Utah’s blistering desert heat. They were paid less and worked longer hours than their Irish or American counterparts, and they had to provide their own food and accommodations. Although some claimed it could never be done, Yuan Son and other Chinese workers completed the task in record time.

It wasn’t until, as an adult, I traveled to Promontory Summit, Utah, and saw the site of the railroad’s completion with my own eyes that I realized the true weight of this legacy. The railroad is a complicated affair for Chinese American descendants like me: The greatest U.S. engineering feat of the 19th century may have physically unified the country when it was finished in 1869, but this new network of rail also brought scores of white workers to the West, many of whom grew resentful when they saw Chinese holding down jobs they considered rightfully theirs. Not 15 years after the completion of the railroad, this ire, coupled with a severe economic depression, helped usher in the Chinese Exclusion Act — the country’s first major federal law that limited immigration based on race, class and nationality — setting the tone for future wide-reaching restrictive immigration policies.

As a schoolgirl, I scanned the official photograph that came to symbolize the railroad’s completion — engineers shaking hands, flocks of laborers posing for the camera, the champagne toast, a carefully choreographed scene — more than 100 years later, searching for faces like my great-great-grandfather’s. Only white faces stared back. Chinese workers were written out of this triumphant American story.

Their contributions were already being erased when Chinese Exclusion was enacted, and soon followed by a tsunami of anti-Chinese violence that swept across much of the West — lynchings, expulsions, boycotts of Chinese businesses, politicians jumping on the bandwagon. Nativism was as popular and potent then as it is today. Yuan Son, now an entrepreneurial shop owner, had happily settled in Idaho, where, after the railroad’s completion, Chinese made up close to 30 percent of the population. Although he had been living in the country for almost 30 years, one day he was forced out of his home at gunpoint by a band of masked vigilantes.

Despite these hardships, Yuan Son resettled back into life in China and surprisingly spoke of the work he had done on the railroad with great pride. He even taught my grandfather his first words in English: “Central Pacific,” “Southern Pacific” and “Union Pacific.” My chain-smoking grandfather repeated these names back to me through his ringing Cantonese intonations, in our home half a world away, as if he were a conductor calling out stations.

It is also to disingenuously decline to recognize our true immigrant heritage and the overwhelming contributions of immigrants of color, enslaved Americans, immigrant women, and native Americans in making America great.

Sadly, the Chinese weren’t the only ones “airbrushed out” of the triumphant picture of the Transcontinental Railroad’s completion. Blacks, women, and Native Americans also made major contributions while suffering disproportionately; yet, they also received little or no appreciation or recognition.

In April 2018, the Department of Homeland Security began using a new word to describe the situation at the southern border: crisis. The number of parents and children crossing the border to seek protection under US asylum laws was climbing to nearly 10,000 per month, up from barely a thousand at the start of the Trump administration. Trump did everything in his power to stop families from coming. He deployed the military to the border, separated parents from children, turned away asylum seekers at official border crossings, and then tried to make it illegal to request asylum unless people went to those crossings.

Nothing worked. More than 58,000 parents and children traveling togethercrossed the border last month, the seventh record-high in eight months. DHS officials have upped their hyperbolic rhetoric, saying that the immigration system is “on fire” and in “meltdown.”

At first, Democrats dismissed Trump’s fearmongering on immigration by pointing out that the total number of border crossers was still near historic lows. But as the number of parents and children coming to the border continues to skyrocket and the backlog of asylum seekers awaiting court hearings swells, it’s becoming clear to people across the political spectrum that doing nothing is not an option. Solutions are needed—the question is, what do they look like?

Mother Jones interviewed a half-dozen immigration experts from the left and center to see how they would create a fairer, more efficient, more humanitarian system for asylum seekers. Here’s what they recommend.

1. Hire more immigration judges

A backlog of nearly 900,000 asylum cases means that families seeking asylum often spend years living in the United States before their cases are decided by immigration judges. Most asylum seekers from El Salvador, Guatemala, and Honduras have not won their cases in recent years, and it’s even harder now that the Trump administration has limited protections for victims of gang and domestic violence, the most common forms of persecution in these “Northern Triangle” countries. Many of those who receive deportation orders, either because they lost their case or they did not apply for asylum after being released at the border, remain in the country as undocumented immigrants.

The backlog, combined with ICE’s limited ability to find people who don’t comply with removal orders, creates the accurate perception among migrants that families who turn themselves in to border agents are highly unlikely to be quickly deported. That presents an incentive for families unlikely to win asylum to cross the border anyway. More than 260,000 parents and children crossed the southern border between the 2016 and 2018 fiscal years. ICE deported about 7,000 family members during that period.

Trump has increased the number of immigration judges from 289 in 2016 to 435. But the backlog has been increasing by more than 100,000 cases per year,faster than under Barack Obama. That’s partly because of the surge in asylum claims but also because indiscriminate immigration enforcement has led to a dramatic increase in arrests of immigrants without criminal histories and forced judges to reopen cases they had set aside. The president is asking to fund 100 new judges in his 2020 budget, while Democrats have called for hiring at least 300 judges over four years.

Those numbers of hires would barely put a dent in the backlog in the short term. That’s why some experts think the administration should bring entire new classes of judges into the fold. Paul Schmidt, who served as an immigration judge from 2003 to 2016, suggests training retired state judges to handle bond and scheduling hearings so that judges have more time to handle asylum decisions. Kristie De Peña, director of immigration at the center-right Niskanen Center, proposes appointing emergency judges to decide asylum cases, and says that to assuage concerns about the Trump administration’s hiring, these judges could be selected by groups such as the American Bar Association and signed off on by governors. 

2. Process asylum claims more efficiently

While serving as Bill Clinton’s top immigration official in the 1990s, Doris Meissner eliminated a similar asylum backlog with a series of technical fixes. Previously, asylum seekers were eligible for work permits immediately, even if their cases wouldn’t be resolved for years, giving people with weak asylum cases an incentive to come to the United States and start working. To remove that incentive, Meissner imposed a six-month waiting period before asylum seekers were eligible for work permits and made sure that nearly all cases were decided within six months. The number of new asylum applications fell by more than half within a year, and the share of claims that were approved eventually more than doubled.

Meissner, now a senior fellow at the Migration Policy Institute, proposes another change that could have a huge impact on the backlog: letting asylum officers, not immigration judges, make the initial decisions in asylum cases.

Those officers already decide many asylum cases—for people who weren’t stopped at the border—and conduct all the “credible fear” interviews that determine whether asylum seekers have a strong enough case to go before an immigration judge. If officers took the place of immigration judges in asylum cases, migrants arriving at the border with strong claims would have their asylum approved more quickly, allowing them to bring their families to the United States rather than waiting years for a hearing before being allowed to bring relatives. Those with weaker claims, sensing that they’d be denied quickly and deported, might skip the trip and avoid taking on massive debts in a futile attempt to win asylum.

Another solution that could spare asylum seekers a long and uncertain trip to the United States and cut down on the backlog would be letting Central Americans apply for refugee status from their home countries. The Obama administration started a program along these lines, but the Trump administration quickly ended it. Democrats are calling for bringing back an expanded version so people have an alternative to traveling to the border.

Schmidt also thinks attorneys should be provided to asylum seekers so they’re informed of their legal rights and cases run more smoothly. The problem for the Trump administration, he says, is that fairer hearings would likely lead to more people winning their cases. Instead of running an effective asylum system, the Trump administration practices what Schmidt calls “malicious incompetence,” a noxious mix of bureaucratic dysfunction and intentional undermining of legal protections for asylum seekers. “If you had a competent administration willing to put the money in the right places,” he says, “you could solve this problem, and it wouldn’t cost as much as all the stuff they’re doing now.”

3. Consider alternatives to family detention

There’s no issue where the government and immigrant advocates differ more sharply than immigrant detention. The vast majority of families are quickly released at the border because of detention capacity constraints and the Trump administration’s recognition that short-term detention doesn’t do much to deter immigration. Under both Obama and Trump, DHS has sought to detain families for longer than the current legal limit of about 20 days and quickly deport them if they lose their cases.

Indefinite family detention is a nonstarter for immigrant advocates, who point to the government’s abysmal track record on immigration detention, the traumatic impact detention can have on children, and the challenges of fighting cases from behind bars. Immigrant advocates and Democrats in Congress oppose all family detention, preferring to release immigrants and track them with ankle monitors and check-ins with case workers.

De Peña is trying to find a middle ground. She proposes a solution that would avoid prolonged detention and the quick releasing of families at the border,while taking advantage of a move Trump already made. Trump has cut refugee admissions to record lows, forcing resettlement agencies to close offices and lay people off. De Peña wants to bring some work back to these agencies by having the government contract with them to house families seeking asylum. Under her plan, the families would be located in proximity to one another and have access to schools, medical facilities, and lawyers. They could move about freely, though they’d be monitored with ankle bracelets, as they often are now. That way, families seeking asylum wouldn’t be locked up like criminals, but they would also be less likely to disappear into undocumented life in American cities.

4. Send foreign aid—but don’t rely on it

Almost everyone in both parties supports sending foreign aid to Central America.Senate Democrats’ border plan, which was first introduced in October, provides $3 billion in aid to address the “root causes” of migration from the Northern Triangle, specifically poverty and violence. The outlier is Trump, who is moving to cut off aid to Central America despite his own acting DHS secretary’s support for that assistance.

But that foreign aid is not likely to be a quick fix. Michael Clemens, a senior fellow at the Center for Global Development, and researcher Hannah Postel concluded in a 2018 article that the chance of deterring migration through development assistance is “weak at best.” To greatly impact migration, theyfound, aid would have to work in “unprecedented ways” over multiple generations. There is some evidence that security assistance for neighborhood-level programs such as community policing can reduce migration, but economic aid could actually have the opposite effect, boosting migration from the poorest areas of the Northern Triangle by giving people the resources needed to reach the border. Clemens considers Trump’s decision to cut off aid “vacuous and nihilistic,” but he believes foreign aid mostly gets as much attention as it does because it’s a “political winner”not an actual short- or medium-term solution to the migration challenge. 

5. Open up economic visas

People are leaving the Northern Triangle to escape intense gang violence, find jobs, or reunite with relatives—often all three. The problem is that economic and family concerns aren’t valid grounds for asylum, but asylum is essentially the only way for most Central Americans to come to the United States legally. (The State Department rejects nearly all tourist visa applications from low-income Central Americans, worried that they’ll overstay their visas.) But asylum doesn’t have to be the only path into the United States.

 Last year, the Department of Labor approved nearly 400,000 guest workers recruited by US employers to work in agriculture and other seasonal industries. The vast majority of the temporary work visas have gone to Mexicans, many of whom have longstanding relationships with specific employers. The United States could easily require or encourage employers to hire more Central Americans. Clemens calls this the “lowest-hanging fruit” for accommodating people whose countries are passing through the same phase of economic development that caused migrants to come to the United States from everywhere from Sweden to South Korea in previous generations.

Opening up more visas for Central Americans wouldn’t require legislation and could be done “literally next month,” Clemens says. And given that Trump and his family already employ many of these guest workers, he says, “they know all about it.”

These problems can be solved. But, not by “malicious incompetence.”

The biggest and most critical statutory change has nothing at all to do with “closing” bogus “loopholes” in asylum law that have been invented to further the White Nationalist narrative.

If I could make just one statutory change, it would be an independent Article I Immigration Court. Over time, a “real” court would establish a fair and efficient administration of the existing asylum laws and would hold the Government accountable for violating and ignoring those laws.

A border control system focused on administering asylum laws, rather than avoiding, flouting, or intentionally misinterpreting them, would look much different and undoubtedly would produce different results. That, in turn, would force the Government to establish and carry out real border law enforcement, rather than just targeting asylum seekers. Without a credible independent Immigration Court system to insure the integrity of the law, no statutory change in immigration law will be fully effective.

Listservs: The government argued that, because the client’s convictions were on appeal pursuant to a late filed notice of appeal – that per Acosta we needed to rebut the finality presumption by providing evidence that the client’s appeal related to the merits or a ‘substantive defect’ in the proceedings. We provided an affidavit from the criminal appeal attorney stating that she “expected to challenge the client’s case on the merits”. At the BIA, we argued that a NY late-filed notice of appeal is essentially a direct appeal because under NY Criminal Procedure – it becomes a direct appeal once it is granted. We also argued that even if it wasn’t a direct appeal, we had rebutted the presumption of finality with our affidavit from the criminal appeal attorney. The BIA punted on the first issue and decided that the presumption of finality had been rebutted sufficiently in this case.

I strongly recommend that you read my choice for “Article of the Week” — “Trump Administration makes a mockery of our asylum system” in The Hill, written by my friends Anna Gallagher and Victoria Nielson of CLINIC.  Here’s an excerpt:

For an administration that claims to believe in the rule of law, it has shown little interest in following domestic and international asylum law. If Border Patrol agents are willing to slam the door on asylum seekers, where asylum officers would not, the administration may win political points with its base. In the end, the United States loses, as our executive branch simply stops following laws it doesn’t like. As the number of displaced persons around the world rises to its highest levels since World War II, if the United States finds ways to sidestep its obligations under international law, other countries will do the same. With each new affront to our moral obligations as a nation, the “lamp beside the golden door” held high by the Statue of Liberty fades towards darkness.

President Trump’s progress in corrupting the Department of Justice — and, to some extent, the entire federal government — into a weapon of his autocratic aspirations relies on the acquiescence of figures like Rod Rosenstein. It is the Rosensteins who translate the president’s lizard-brain impulses into practical directives and create a patina of normalcy around them. (Or, in some increasingly rare cases, refuse to do so.) And so Rosenstein’s spate of valedictory remarks attempting to cleanse and justify his service to Trump give us real insight into the worldview of the compliant bureaucratic functionary.

In a speech last night, Rosenstein delivered a sharp attack on former FBI Director James Comey. Rosenstein, of course, supplied Trump with a letter justifying Comey’s removal. Rosenstein justified his cooperation by claiming ignorance of any obstruction of justice motive. “Nobody said that the removal was intended to influence the course of my Russia investigation.”

It is perhaps remotely possible that Rosenstein actually did not realize what was going on with Trump, Comey, and the Russia investigation. It is not possible that Rosenstein believed, as he wrote, that Donald “Lock her up!” Trump fired Comey for treating Hillary Clinton unfairly, which is the reason Rosenstein elucidated in his letter.

Rosenstein also gushed about the rule of law, assuring his audience that it is safe, and implictly crediting Trump with upholding it. “We use the term ‘rule of law’ to describe our obligation to follow neutral principles,” he lectured. “As President Trump pointed out, ‘we govern ourselves in accordance with the rule of law rather [than] … the whims of an elite few or the dictates of collective will.’”

More revealingly, Rosenstein lashed out at Comey, who has made some cutting remarks about Rosenstein’s character, as a “partisan pundit.” Rosenstein’s conceit here is that Comey, a lifelong Republican, has become “partisan” by attacking Trump’s character. Meanwhile, Rosenstein, also a Republican, has maintained his neutrality and therefore his credibility.

But Rosenstein’s idea of nonpartisan neutrality does not require abstaining from political commentary. It merely requires abstaining from criticism of his boss. In another recent speech, Rosenstein attacked the Obama administration for failing “to publicize the full story about Russian computer hackers and social media trolls, and how they relate to a broader strategy to undermine America.” (Blaming Obama for doing too little to stop the Russian operation, when Trump was abetting it and Republican leader Mitch McConnell threatened to publicly attack any administration statement against it, is one of Trump’s Orwellian talking points.)

It might seem hypocritical for Rosenstein to parrot Trump’s talking points and then lash out as Comey as a partisan pundit. But from Rosenstein’s standpoint, it probably feels perfectly consistent. Opinions that extol and burnish the powers that be are qualitatively different than opinions tearing them down. Rosenstein’s opinions are not opinions at all. They are merely the lubricant in the proper functioning of the machinery of government.

And so Rosenstein joined with William Barr to spin the Mueller report — in a fashion so misleading that Mueller himself memorialized his objections in a memo — and declare all of Trump’s efforts to obstruct the probe to be non-crimes. Barr is meanwhile authorizing the fourth counter-investigation of the Russia probe. This will probably fail to yield any charges, but will succeed in making anybody in the Department of Justice think very carefully before looking into any crimes by Trump or his friends, with the full understanding that Republicans will harass them for years if they try.

Trump continues to mock even the pretense that his attorney general should make investigative decisions independent of politics. “I’m proud of our attorney general that he is looking into it,” he told reporters today. Somehow, Rosenstein is able to look upon the situation he has left with pride. Mueller was never fired. More importantly, neither was Rosenstein himself. It is easy for the inside man to confuse a system that is intact with a system that is working.

Here is my assessment of Rosenstein’s legacy from a recent post:

Rosenstein is on his way out the door at the DOJ.  He’ll leave behind a mixed legacy. He’ll deserve great credit for protecting the Mueller investigation from Trump’s various attempts to interfere and compromise it. On the other hand, he drafted the infamous “pretext memo” which was part of the ultimately unsuccessful attempt to cover up Trump’s real real reason for firing FBI Director Jim Comey.

His failure to stand up for judicial independence, fairness, and due process for vulnerable individuals coming before our U.S. Immigration Courts and his continuing defense of the Administration’s indefensible and harmful White Nationalist immigration agenda will go down as one of his lesser moments.

America needs an independent Article I U.S. Immigration Court where judges act fairly and impartially and owe allegiance to the U.S. Constitution, not the Attorney General or any other political official.

Rosenstein is a good illustration of why 1) we need an independent U.S. Immigration Court, and 2) the U.S. Department of Justice is a failed organization whose mission and functions need thoughtful reexamination once Trump and his GOP toadies have been removed from power.

Interestingly, Rosenstein once was considered a “straight up guy” — a public servant who had served honorably in Administrations of both parties. Whatever else one might say about Trump, he does have a talent for bringing out and exploiting the underlying sliminess and weakness in folks once thought to be decent human beings and good public servants: John Kelly, Lindsay Graham, Kirstjen Nielsen, Rosenstein, Nikki Haley, Bill Barr, Rachel Brand, etc.

Somewhere out there are pockets of the “anti-Rosensteins” — civil servants who continue to uphold their oaths of office, do the right thing, and put Due Process, human lives, and the public welfare above job security or sucking up to power. Hopefully, we will reach a point in time where their stories can be told and where “sell-outs” like Rosenstein are held accountable for aiding and abetting the abuse of power.

VADO, N.M. — Rigoberto Pablo ran out of hope. There was no work, no decent schooling for his children. Nothing in the dried-out streams, wilting coffee plants and wafting sewage of his village in the western highlands of Guatemala gave him reason to think his family’s suffering would end. So late last year, he crossed the nearby Mexican border, U.S.A.-bound.

Three months later, in February, I met him in this small New Mexico town, a timid man with a gentle smile. Pablo, age 37, is in American limbo, like hundreds of thousands of migrants. Seated on a sofa in the home of his hosts, he reached down, turned up the hem of his pants and revealed the electronic ankle monitor that Immigration and Customs Enforcement affixed when it released him. A green light confirmed he was being tracked. “If I take it off,” he said, “they’ll come after me.”

His 14-year-old son, Alex, who crossed the border with his father on Nov. 14 and is now in seventh grade at a nearby school, gazed at the device. His dad, he said, is “not a rapist or murderer. He wants to work and I want to study.”

Desperate people do desperate things! Duh! That’s what one of my colleagues told me my first week on the bench in Arlington. Too bad that Trump and the incompetents who work for him don’t take the time to understand the basics of human migration and conduct themselves lives like human beings and responsible public officials.

America deserves someone better than Donald Trump and his cowardly sycophantic GOP. Both Guatemala and the U.S appear to be “governed” by kakistocracies!

We diminish ourselves as a nation with each day that Trump is in office. But, that won’t stop human migration. It’s going top take folks much smarter, more humane, and more competent that Trump and his toadies to successfully address today’s immigraton issues.

Immigrants got the job done

History finally has its eyes on Chinese laborers who built transcontinental railroad’s western leg

The nation’s first transcontinental railroad, completed 150 years ago today at Promontory Summit in Utah, connected the vast United States and brought America into the modern age. Chinese immigrants contributed mightily to this feat, but the historical accounts that first transcontinental followed often marginalized their role.

Between 1863 and 1869, as many as 20,000 Chinese workers helped build the treacherous western portion of the railroad, a winding ribbon of track known as the Central Pacific that began in Sacramento.

At first, the Central Pacific Railroad’s directors wanted a whites-only workforce. Leland Stanford, the railroad’s president, had advocated for keeping Asians out of the state in his 1862 inaugural address as governor of California. When not enough white men signed up, the railroad began hiring Chinese men for the backbreaking labor. No women worked on the line.

Company leaders were skeptical of the new recruits’ ability to do the work, but the Chinese laborers proved themselves more than capable — and the railroad barons came to consider them superior to the other workers.

My colleagues and I initiated an international research project — based, appropriately, at Stanford University — to investigate the enormous contribution Chinese workers made to the transcontinental project. It proved to be a formidable task, not least because no written record produced by what were called “railroad Chinese” is known to exist. Without letters, diaries and other primary sources that are historians’ stock in trade, we amassed a sizable collection of evidence that included archaeological findings, ship manifests, payroll records, photographs and observers’ accounts.

The material allowed us to recover a sense of the lived experiences of the thousands of Chinese migrants Leland Stanford came to greatly admire. He told President Andrew Johnson that the Chinese were indispensable to building the railroad: They were “quiet, peaceable, patient, industrious and economical.” In a stockholder report, Stanford described construction as a “herculean task” and said it had been accomplished thanks to the Chinese, who made up 90% of the Central Pacific Railroad’s labor force.

These workers showed their mettle, and sealed their legacy, on the peaks of the Sierra Nevada. Many observers at the time had assumed that Stanford and the railroad were daft for thinking they could link California with the East because an immense mountain range separated the state from Nevada and beyond. The Sierra Nevada is a rugged, formidable range, its inhospitableness encapsulated by the gruesome tragedy of the Donner party in 1847 and 1848. Trapped by winter storms in the mountains, they resorted to cannibalism.

To get to the High Sierra, Chinese workers cut through dense forests, filled deep ravines, constructed long trestles and built enormous retaining walls — some of which remain intact today. All work was done by hand using carts, shovels and picks but no machinery.

The greatest challenge was to push the line through the Sierra summit. Solid granite peaks soared to 14,000 feet in elevation. The railroad bed snaked through passes at more than 7,000 feet. The men who came from humid south China labored through two of the worst winters on record, surviving in caverns dug beneath the snow.

They blasted out 15 tunnels, the longest nearly 1,700 feet. To speed up the carving of the tunnels, the Chinese laborers worked from several directions. After opening portals along the rock face on either side of the mountain, they dug an 80-foot shaft down to the estimated midway point. From there, they carved out toward the portals, doubling the rate of progress by tunneling from both sides. It still took two years to accomplish the task.

The Chinese workers were paid 30% to 50% less than their white counterparts and were given the most dangerous work. In June 1867, they protested. Three-thousand workers along the railroad route went on strike, demanding wage parity, better working conditions and shorter hours. At the time it was the largest worker action in American history. The railroad refused to negotiate but eventually raised the Chinese workers’ pay, though not to parity.

After the Sierra, the Chinese workers faced the blistering heat of the Nevada and Utah deserts, yet they drove ahead at an astonishing rate.

As they approached the meeting point with the Union Pacific, thousands of them laid down a phenomenal 10 miles of track in less than 24 hours, a record that has never been equaled. A Civil War officer who witnessed the drama declared that the Chinese were “just like an army marching over the ground and leaving the track behind.”

Progress came at great cost: Many Chinese laborers died along the Central Pacific route. The company kept no records of deaths. But soon after the line was completed, Chinese civic organizations retrieved an estimated 1,200 bodies along the route and sent them home to China for burial.

The transcontinental railroad’s completion allowed travelers to journey across the country in a week — a trip that had previously taken more than a month. Politicians pointed to the achievement as they declared the United States the leading nation of the world.

The transcontinental railroad has been viewed in a similarly nationalistic way ever since. Chinese workers were often left out of the official story because their alienage and suffering did not fit well with celebration. And attitudes toward them soon soured, with anti-Chinese riots sweeping the country. The Chinese Exclusion Act of 1882 barred Chinese laborers from entering the United States and placed restrictions on those already here.

Federal immigration law prohibited Chinese citizens from becoming Americans until 1943.

As a faculty member of the university that bears his name, I am painfully aware that Leland Stanford became one of the world’s richest men by using Chinese labor. But I also try to remember that Stanford University exists because of those Chinese workers. Without them, Leland Stanford would probably be at best a footnote in history — and the West and the United States would not exist as we know it today.

Sometimes, it takes too long. Often, the “real heroes” die unrecognized (like the more than 1,200 Chinese workers mentioned in this article or the many anonymous enslaved African-Americans whose uncompensated labor and ingenuity “propped up” at least five of our first seven Presdients) long before justice comes. And, frequently, the flawed folks who were wrongly acclaimed “popular heroes” of their day escape judgement within their lifetimes.

But, history has a way of eventually “getting it right.” Trump and his misguided followers eventually will be in for a reckoning.

It won’t be pretty. Once the subpoenas can’t be ignored, the testimony perjured, the innumerable lies, intentional misrepresentations, and squalid distortions presented as “business as normal,” and the full historical record becomes available for study and analysis, free from the political hoopla of the present, it will be much, much worse than we can possibly imagine. The true unpalatable nature of Trump and his enablers will be revealed for some future generations. And, those who stood against them and their racism, greed, dishonesty, and cruelty will be vindicated.

There have been many articles pointing out that Bill Barr unethically has acted as Trump’s defense counsel rather than fulfilled his oath to uphold the Constitution and be the Attorney General of all of the American people. There have also been some absurdist “apologias” for Barr some written by once-respected lawyers who should know better, and others written by the normal Trump hacks.

Here are my choices for four of the best articles explaining why Barr should not be the Attorney General. It goes without saying that he shouldn’t by any stretch of the imagination be running the Immigration Court system. His intervention into individual cases in a quasi-judicial capacity is a clear violation of judicial ethics requiring avoidance of even the “appearance” of a conflict of interest. There is no “appearance” here. Barr has a clear conflict in any matter dealing with immigration.

Congress Should Impeach William Barr

House Democrats are going to face a difficult decision about launching an impeachment inquiry into President Trump. Balanced against the president’s impressive array of misconduct is the fact that several more criminal investigations that may add to the indictment are already underway, and that impeaching the president might jeopardize the reelection of red-state Democratic members. But in the meantime, Attorney General William Barr presents them with a much easier decision. Barr has so thoroughly betrayed the values of his office that voting to impeach and remove him is almost obvious.

On March 24, Barr released a short letter summarizing the main findings of the Mueller investigation, as he saw them. News accounts treated Barr’s interpretation as definitive, and the media — even outlets that had spent two years uncovering a wide swath of suspicious and compromising links between the Trump campaign and Russia — dutifully engaged in self-flagellation for having had the temerity to raise questions about the whole affair.

Barr had done very little to that point to earn such a broad benefit of the doubt. In the same role in 1992, he had supported mass pardons of senior officials that enabled a cover-up of the Iran–Contra scandal. Less famously, in 1989 he issued a redacted version of a highly controversial administration legal opinion that, as Ryan Goodman explained, “omitted some of the most consequential and incendiary conclusions from the actual opinion” for “no justifiable reason.”

And while many members of the old Republican political Establishment had recoiled against Trump’s contempt for the rule of law, Barr has shown no signs of having joined them. He met with Trump to discuss serving as his defense lawyer, publicly attacked the Mueller investigation (which risked “taking on the look of an entirely political operation to overthrow the president”), called for more investigations of Hillary Clinton, and circulated a lengthy memo strongly defending Trump against obstruction charges.

The events since Barr’s letter have incinerated whatever remains of his credibility. The famously tight-lipped Mueller team told several news outlets the letter had minimized Trump’s culpability; Barr gave congressional testimony hyping up Trump’s charges of “spying,” even prejudging the outcome of an investigation (“I think there was a failure among a group of leaders [at the FBI] at the upper echelon”); evaded questions as to whether he had shared the Mueller report with the White House; and, it turns out, he’s “had numerous conversations with White House lawyers which aided the president’s legal team,” the New York Times reports. Then he broke precedent by scheduling a press conference to spin the report in advance of its redacted publication.

It is not much of a mystery to determine which officials have offered their full loyalty to the president. Trump has reportedly “praised Barr privately for his handling of the report and compared him favorably to former Attorney General Jeff Sessions” —whose sole offense in Trump’s eyes was following Department of Justice ethical protocol. Trump urged his Twitter followers to tune in to Barr’s conference, promotional treatment he normally reserves for his Fox News sycophants.

The press conference was the final disqualifying performance. Barr acted like Trump’s defense lawyer, the job he had initially sought, rather than as an attorney general. His aggressive spin seemed designed to work in the maximal number of repetitions of the “no collusion” mantra, in accordance with his boss’s talking points, at the expense of any faithful transmission of the special counsel’s report.

Barr’s letter had made it sound as though Trump’s campaign spurned Russia’s offers of help: “The Special Counsel did not find that the Trump campaign, or anyone associated with it, conspired or coordinated with the Russian government in these efforts, despite multiple offers from Russian-affiliated individuals to assist the Trump campaign,” he wrote. In fact, Mueller’s report concluded, “In some instances, the Campaign was receptive to the offer,” but that the cooperation fell short of criminal conduct.

Where Mueller intended to leave the job of judging Trump’s obstructive conduct to Congress, Barr interposed his own judgment. Barr offered this incredible statement for why Trump’s behavior was excusable: “[T]here is substantial evidence to show that the President was frustrated and angered by a sincere belief that the investigation was undermining his presidency, propelled by his political opponents, and fueled by illegal leaks,” Barr said. “Nonetheless, the White House fully cooperated with the Special Counsel’s investigation,” and credited him further with taking “no act that in fact deprived the Special Counsel of the documents and witnesses necessary to complete his investigation.”

Sincere? How can Barr use that word to describe the mentality of a man whose own staffers routinely describe him in the media as a pathological liar? Trump repeatedly lied about Russia’s involvement in the campaign, and his own dealings with Russia. And he also, contra Barr, repeatedly denied the special counsel access to witnesses by dangling pardons to persuade them to withhold cooperation.

It is true that many of Trump’s attempts to obstruct justice failed. As Mueller wrote, the president’s “efforts to influence the investigation were mostly unsuccessful, but that is largely because the persons who surrounded the President declined to carry out orders or accede to his requests.”

This is a rather different gloss on the facts than the happy story Barr offered the press. What’s more, it is a pressing argument for Barr’s own removal. Next to the president himself, the attorney general is the most crucial actor in the safeguarding of the rule of law. The Justice Department is an awesome force that holds the power to enable the ruling party to commit crimes with impunity, or to intimidate and smear the opposing party with the taint of criminality.

There is no other department in government in which mere norms, not laws, are all that stand between democracy as we know it and a banana republic. Barr has revealed his complete unfitness for this awesome task. Nearly two more years of this Trumpian henchman wielding power over federal law enforcement is more weight than the rickety Constitution can bear.

In the years after Watergate, Justice Department officials — from both parties — worked hard to banish partisan cronyism from the department. Their goal was to make it the least political, most independent part of the executive branch.

“Our law is not an instrument of partisan purpose,” Edward Levi, Gerald Ford’s attorney general, said at the time. Griffin Bell, later appointed to the same job by Jimmy Carter, described the department as “a neutral zone in the government, because the law has to be neutral.”

Attorney General William Barr clearly rejects this principle. He’s repeatedly put a higher priority on protecting his boss, President Trump, than on upholding the law in a neutral way. He did so in his letter last month summarizing Robert Mueller’s investigation and then again in a bizarre prebuttal news conference yesterday. As The Times editorial board wrote, Barr yesterday “behaved more like the president’s defense attorney than the nation’s top law-enforcement officer.”

Throughout his tenure, Barr has downplayed or ignored the voluminous evidence of Trump’s wrongdoing — his lies to the American people, his willingness to work with a hostile foreign country during a presidenial campaign, his tolerance of extensive criminal behavior among his staff and his repeated efforts to obstruct an investigation. Barr even claimed that Trump “fully cooperated” with that investigation, which Vox’s Ezra Klein notes is “an outright lie.”

Since he took office, Trump has made clear that he wants an attorney general who acts as first an enforcer of raw power and only second as an enforcer of federal law. In Barr, Trump has found his man. Together, they have cast aside more than four decades worth of Justice Department ideals and instead adopted the approach of Richard Nixon.

The Ways William Barr Misled The Public About The Mueller Report

Instead of just releasing the special counsel’s findings, the U.S. attorney general spun the report to the benefit of President Trump.
Letting this farce of a “judicial system” continue unfairly endangering individual lives and deferring to officials who are neither subject matter experts nor fair and impartial quasi-judicial decision makers is unconstitutional. By letting it continue, life-tenured Federal Judges both tarnish their reputations and fail to fulfill their oaths of office.
As a young attorney in the Department of Justice during the Watergate Era, I, along with many others, were indelibly impressed and inspired when then Attorney General Elliot Richardson and his Deputy William Ruckelshaus resigned rather than carry out Nixon’s illegal order to fire the Watergate Special Prosecutor (a/k/a/ “The Saturday Night Massacre”). Obviously, Barr has dragged the Department and its reputation down to new depths — back to the days of Nixon and disgraced (and convicted) Attorney General “John the Con” Mitchell, who actually planned criminal conspiracies in his fifth floor office at the DOJ.
Obviously, there are systemic problems that have allowed unqualified individuals like Barr and Sessions to serve in and co-opt the system of justice, and denigrate the Department of Justice. (I spoke to some recently retired DOJ officials who characterized the morale among career professionals at the DOJ as “below the floor”). Some of those can be traced to the lack of backbone and integrity in the “Trump GOP” which controls the Senate and refuses to enforce even minimal standards of professionalism, meaningful oversight, and independent decision making in Trump appointees. That’s what a “kakistocracy” is. It’s up to the rest of us to do what is necessary under the law to replace the kakistocracy with a functioning democracy.

CORQUÍN, Honduras — The farmer stood in his patch of forlorn coffee plants, their leaves sick and wilted, the next harvest in doubt.

Last year, two of his brothers and a sister, desperate to find a better way to survive, abandoned their small coffee farms in this mountainous part of Honduras and migrated north, eventually sneaking into the United States.

Then in February, the farmer’s 16-year-old son also headed north, ignoring the family’s pleas to stay.

The challenges of agricultural life in Honduras have always been mighty, from poverty and a neglectful government to the swings of international commodity prices.

But farmers, agricultural scientists and industry officials say a new threat has been ruining harvests, upending lives and adding to the surge of families migrating to the United States: climate change.

And their worries are increasingly shared by climate scientists as well.

Gradually rising temperatures, more extreme weather events and increasingly unpredictable patterns — like rain not falling when it should, or pouring when it shouldn’t — have disrupted growing cycles and promoted the relentless spread of pests.

The obstacles have cut crop production or wiped out entire harvests, leaving already poor families destitute.

Central America is among the regions most vulnerable to climate change, scientists say. And because agriculture employs much of the labor force — about 28 percent in Honduras alone, according to the World Bank — the livelihoods of millions of people are at stake.

Last year, the bank reported that climate change could lead at least 1.4 million people to flee their homes in Mexico and Central America and migrate during the next three decades.

The United States has allocated tens of millions of dollars in aid in recent years for farmers across Central America, including efforts to help them adapt to the changing climate.

But President Trump has vowed to cut off all foreign aid to Honduras, Guatemala and El Salvador because of what he calls their failure to curb the flow of migrants north.

Critics contend the punishment is misguided, though, because it could undermine efforts to address the very problems that are driving people to abandon their farms and head to the United States.

“If Donald Trump withdraws all the funds for Honduras, it’s going to generate more unemployment, and that’s going to generate more migration,” said María Esperanza López, the general manager of Copranil, a coffee-growers cooperative here in western Honduras. “And that’s going to result in more abandoned farms.”

Coffee cultivators in the region are at particular risk of disruption because the crop is highly sensitive to weather variations.

Fredi Onan Vicen Peña, the coffee farmer whose brothers, sister and teenage son have already given up and joined the exodus north, reached over and tore a leaf off one of his plants.

It was a mottled yellow and brown: signs of coffee rust, a disease whose spread has been influenced by climate variability. As much as 70 percent of his crop, planted across five acres in a pine forest, had been affected, he estimated, and there was little chance he could salvage it.

“Climate change is destroying some farms,” said Mr. Vicen, 41.

Beyond that, some of his healthier plants had begun to blossom nearly two months ahead of schedule because of a heavy unseasonable downpour, throwing the entire growing cycle into doubt.

“This is not something we predicted,” Mr. Vicen said.

Average temperatures have risen by about two degrees Fahrenheit in Central America over the past several decades, making the cultivation of coffee difficult, if not untenable, at lower altitudes that were once suitable.

That has forced some farmers to search for land at higher altitudes, switch to other crops, change professions — or migrate.

“Some very fine families that have been producing quality coffee for a long time are now facing the decision of whether to stay in coffee,” said Catherine M. Tucker, a professor of anthropology at the University of Florida who has done research in Honduras for more than two decades.

Some climate scientists say that in the absence of long-term meteorological data, it is hard for them to say with certainty whether the increasing variability is caused by long-term changes in the region’s climate. But, they say, they are leaning in that direction.

“It’s becoming so unusual, it’s almost certainly climate change,” said Dr. Edwin J. Castellanos, dean of the Research Institute at the Universidad del Valle de Guatemala, a university in Guatemala City, and one of Central America’s leading scientists in the field of climate change.

Climate change is rarely the sole factor in the decision to migrate. Violence and poverty are prime drivers, but climate change can be a tipping point, farmers and experts say.

“Small farmers are already living in poverty; they’re already at the threshold of not being able to survive,” Mr. Castellanos said. “So any changes in the situation may push them to have enough incentives to leave.”

The outlook for the region seems bleak. Reduced yields of coffee and subsistence crops like corn and beans could significantly increase food insecurity and malnutrition. By some predictions, the amount of land suitable for growing coffee in Central America could drop by more than 40 percent by 2050.

The number of coffee producers in the area where Mr. Vicen lives has dropped by a quarter in the past decade — to about 9,000 from about 12,000 — partly because of pressure from climate change, said Marlon Danilo Mejía, the regional coordinator for the Honduran Coffee Institute, an industry trade group.

A vast majority are small producers, managing less than about nine acres each, he said.

José Edgardo Vicen, 37, one of Mr. Vicen’s brothers, had weighed migrating for years. He had worked in the coffee fields since he was a boy, continuing the family tradition. In this part of Honduras, coffee is a major crop, with an increasing amount bound for North America, Europe and Asia.

But after a rust outbreak and other pressures in recent years, including plunging commodity prices, the younger Mr. Vicen said he could no longer earn enough from his harvest to cover production costs.

He headed north with his 14-year-old son last August, crossed the border illegally and settled in Texas. A brother and a sister, driven by similar circumstances, left Honduras soon afterward and also sneaked into the United States.

“For the small producer, I promise you, there’s no way to get ahead,” said Mr. Vicen, who now works in construction and sends remittances home to support his wife and daughter.

When he was younger, harvest time “was like a party,” he recalled. Now, “there are only losses, no profits.”

Fifteen producers from the Vicens’ coffee cooperative — more than 10 percent of its members — have migrated to the United States in the past year, said Ms. Esperanza López, the general manager of the cooperative. They have joined thousands of others from villages in Honduras’s western highlands.

Stephanie Leutert, director of the Mexico Security Initiative at the University of Texas at Austin, said that government statistics on apprehension of migrants at the southwest border of the United States in recent years reflect a sharp increase in people from western Honduras.

After large caravans of migrants arrived last fall in Tijuana, Mexico, a United Nations survey found that 72 percent of those surveyed were from Honduras — and 28 percent of the respondents had worked in the agricultural sector.

The exodus of farm workers has worsened already serious labor shortages in western Honduras. Some industry leaders in the region joke that if the caravans in recent months were “the laborer caravans,” the next wave will be “the grower caravans.”

Coffee farmers have been scrambling to adjust to the changes, learning which species are more resistant to plague and drought, and branching out into other crops — like cacao, avocados or trees that produce construction-grade wood.

Nongovernmental and public-private initiatives have also taken root in coffee-growing regions of Central America and around the world to help guide farmers. Some have received the backing of the world’s biggest coffee sellers — like Starbucks, Tim Horton’s and Lavazza — trying to ensure their future supply.

Yet even the application of best practices is no guarantee that everything will be fine.

“The weather is crazy,” said Carlos Peña Orellana, 58, a farmer and member of a local coffee cooperative. “Everything’s out of control.”

He owns 12 acres of land but can afford to farm only about five. He gets by with income from a tomato greenhouse he built with the cooperative’s help, and with remittances from two sons who migrated to the United States after struggling through the rust crisis of 2012-13.

“They’re helping to revive the farm,” he said at his ramshackle ranch one recent afternoon. “It’s really difficult now.”

He turned to his youngest son, Carlos, 12, and saw a future migrant. Pointing a leathery finger, he said: “You’re next, right?” Mr. Peña chuckled. The boy squirmed, saying nothing.

Accusing the Trump administration of being motivated by politics and not facts, a second U.S. federal judge is blocking the U.S. Department of Homeland Security from forcing tens of thousands of Haitians to return to Haiti by ending their temporary legal protection.

In a 145-page federal ruling, U.S. District Judge William F. Kuntz of the Eastern District of New York issued a nationwide temporary injunction preventing DHS from terminating Temporary Protected Status, TPS, for Haitians. Kuntz said 50,000 to 60,000 Haitians and their U.S.-born children would suffer “irreparable harm” if the legal protection ended and they were forced to return to a country that is not safe.

Kuntz’s detailed ruling came out of a lawsuit filed by Haitians in Florida and New York, challenging the Trump administration’s decision to end TPS granted to Haiti by the Obama administration after its 2010 devastating earthquake. The administration has rescinded the protection for Central America and some African nations as well, sparking several lawsuits around the country.

“It’s a sweeping indictment of the political manner in which the Trump administration at the very highest levels of the government illegally terminated Protected Status for Haitians,” said Miami immigration attorney Ira Kurzban, one of several lawyers who filed the lawsuit.

In October, a federal judge in California granted a temporary injunction blocking the administration from deporting Haitian TPS holders and others as their termination deadlines approach. U.S. District Judge Edward Chen granted the temporary injunction as part of a California lawsuit filed by lawyers on behalf of TPS recipients from Haiti, Nicaragua, El Salvador and Sudan who have U.S.-born children. The decision is being appealed by the government.

Kurzban noted that unlike the California case, which had not yet gone to trial when Chen issued his decision, Kuntz’s decision is the result of a full-blown trial. The New York lawsuit was the first of the five to go to trial.

“It’s far more detailed in its reasoning in respect to why what the government did was completely illegal,” Kurzban said of Kuntz’s decision. “It found findings on discrimination. … It found very clearly that the government’s decision was not only an arbitrary decision, but they violated their own procedures in reaching the conclusion that they reached.

“This is a direct and very detailed account of how the government acted in a completely arbitrary way,” he added.

During the trial, lawyers for the plaintiffs argued that then-Acting DHS Secretary Elaine Duke violated procedures and TPS holders’ due process when she ended the program for Haiti. They also cited emails and other internal government documents, including Duke’s handwritten November 2017 notes, to bolster the plaintiffs’ argument: that the White House was not interested in the facts about conditions in Haiti as DHS officials mulled over whether to continue to shield up to 60,000 Haitians from deportations, and Duke was under repeated pressure to terminate the program.

The decision, the suit alleged, was also rooted in the president’s “racially discriminatory attitude toward all brown and black people.”

“Clearly political motivations influenced Secretary Duke’s decision to terminate TPS for Haiti,” Kuntz said in his findings. “A TPS termination should not be a political decision made to carry out political motivations. Ultimately, the potential political ramifications should not have factored into the decision to terminate Haiti’s TPS.”

Kuntz said he could not issue a final injunction, only a temporary one, because Haiti’s TPS designation, which was supposed to end on July 22 but was recently extended by DHS until January 2020 due to the legal challenges, has not yet expired.

Steve Forester, an immigration advocate who has been championing the rights of Haitians enrolled in the TPS program, said it was “a victory demonstrating the government’s unlawful and unconstitutional behavior in reaching its decision to terminate Haiti TPS.”

“It’s a resounding condemnation of unlawful government behavior,” added Forester, who works as policy coordinator for the Boston-based Institute for Justice & Democracy in Haiti.

The government is expected to appeal.
