By all accounts, President Biden and his White House were outraged this week when they were garlanded by the “Hur report.” Ironically, three years of complaining by some of Biden’s core supporters who helped elect him in 2020 about being systematically “garlanded” at EOIR brought not so much as a raised eyebrow from the WH. Indeed, they might now be viewed as just a preview of Biden’s “Miller Lite” dissing of his supporters and human lives at the border with his inanely enthusiastic support of an attempted human rights “fire sale” by Senate Dems! Obviously, it’s quite a different story when things come full circle and the “chickens finally come home to roost.”

But, enough of that. When we left our DOJ antihero last week he was fresh off paying out $1.2 million of your taxpayer dollars to settle a sexual harassment claim by one of his ex-EOIR employees! You might think that’s hard to top! But, you would be wrong! Let’s get started on this week’s trip around “the land where due process and fundamental fairness fear to tread!” 

  1. No Due Process In The Omaha Immigration Court

The ACLU released it’s report condemning Garland’s Omaha Immigration Court for a plethora of due process abuses. See https://www.aclunebraska.org/en/press-releases/new-report-finds-omaha-immigration-judges-routinely-compromise-peoples-rights.

Among the “lowlights:”

  • The project focused on pretrial hearings that can encompass pleadings, scheduling and other technical matters. The average observed hearing ran under four minutes, a rapid-fire pace to cover all of a hearing’s required steps.

  • Judges advised people of their rights in only 18% of the observed hearings. Most often, this involved reading rights to everyone in a group instead of individually.

  • Immigration courts are required to provide interpretation in the preferred language of the individual appearing at a hearing at no cost to the individual. The court frequently failed to provide Central American Indigenous language interpretation. This impacted roughly four out of five individuals who preferred to speak in a Central American Indigenous language.

  • In about one in five observed hearings, the individual was not represented by an attorney.

Of course, one might wonder why it is the responsibility of the ACLU to ferret out things that Garland should have discovered and corrected himself. But, no matter. Those poor souls whose lives and future are in the hands of the Omaha Immigration Court can expect to be garlanded.

2) Shenanigans in Chicago

Immigration court practitioners in many cities now face a new hurdle: find, and adhere to, a secret list of IJ procedural preferences (requirements, actually)…posted, in one case, in the “pro bono room” of one court.  NOT online anywhere.  Oh, and it changes frequently, and without warning.  See the attached sample from Chicago.

Practitioners have complained to EOIR, so let’s see what happens.

2024.02.05 – EOIR Chicago IJ Hearing Preference Sheet

Indeed I do, my friend, indeed I do. This one hits “close to home.”

Back in 2006 my friend and Round Table colleague Judge John Gossart of Baltimore headed a group of IJs who took on the monumental task of writing the first Immigration Court Practice Manual (“ICPM”). Based on Judge Gossart’s own “local court rules and best judicial practices” developed over decades, the ICPM built on the success of the award- winning BIA Practice Manual, created and issued during my tenure as BIA Chair. 

One of the key features of the ICPM is that  It superseded and erased all then-existing “local rules.”

Those few of us IJs who did public education events — under the watchful eye of our HQ “handlers” — were encouraged to tout and promote the ICPM as the “definitive guide” to successful practice before the courts, which, of course I dutifully did as reflected in my speeches from those days. I believe we even had “Q&A” sessions with the local immigration bar to promote and explain the ICPM.

Now, after years of gross mismanagement under Trump and Biden, things have come full circle. The oft-conflicting, idiosyncratic, and frequently inaccessible or counterintuitive “local rules” that the ICPM was created to eliminate evidently have returned with a vengeance.

Meanwhile, the very substantial amount of time, resources, credibility, and effort that went into creating, distributing, and implementing the ICPM has been a colossal waste of taxpayer resources because the last two Administrations have failed in their duty to competently and professionally administer EOIR!

And let’s not leave out Congress! If ever there were a need for a new, independent, professional, expert Article I Court System it’s EOIR. Yet, although Dems have introduced bills, the GOP has expressed no interest in Article I, nor has it been a priority for Congressional leadership and the Administration. It wasn’t even “on the radar screen” during the failed Senate “debate” on the immigration system.

Both Chicago Immigration Court practitioners and those IJs, current and past, who devoted their professional time and energy to the ICPM have been garlanded.

3) ADR On Steroids In Virginia

A long-time DMV immigration lawyer told the “Courtside I-Team” this week:

I routinely have MCHs listed as “in person” that are actually by Webex (I had one today). I also have an Individual on Thursday listed as Webex, but I received an email at 4:00 PM today stating that this was an error, and it was actually in person. I replied that I could not attend in person, as I have too many other cases and family issues to rearrange my schedule at the last minute. We’ll see what happens, but all this is typical of an agency that could care less about applicants, practitioners or due process of law. Take care.

For decades, practitioners and experts had been begging DOJ and EOIR to enter the 21st century with automation. Dishearteningly, now that automation has belatedly arrived at EOIR, it’s being used to severely diminish customer service rather than improve it!

It seems that every whim, irrationality, inefficiency, and inconvenience that developed at EOIR over years has now been “automated” to maximize the trauma and stress inflicted on those appearing before these broken courts. As this example points out, that has led to “Aimless Docket Reshuffling (“ADR”) on steroids!”

And here’s why automated ADR is such a powerful tool! Some practitioners have told me that it allows EOIR to unilaterally schedule them to be in three or four different courts at the same time, with almost no notice. Then, it’s up to the lawyer to file individual  “motions to reschedule” to clean up EOIR’s mess. 

Sometimes they are granted, sometimes denied without any rationale. All of this leads to more work and case shuffling but, importantly, without ever getting to the merits of any case! 

Meanwhile, the backlog grows exponentially and the stress levels on the private bar and the staff ratchet up.

There might be surer ways to destroy a court system, but none come immediately to mind. This is garlanding at its best!

4) Another “F” In “Immigration Law 101” From The 3rd Circuit

For that reason, we will remand his petition as it applies to that claim. … Herrow claims that the BIA and IJ erred in denying his CAT claim and in finding that (1) he is unlikely to face torture and (2) the Somali government would not acquiesce in such torture. Because the BIA and IJ ignored evidence favorable to Herrow, we will grant his petition in part and remand for a more comprehensive review of the evidence. … To establish a likelihood of future torture, the record must demonstrate an aggregate risk of torture to the noncitizen that exceeds fifty percent. In making this determination, the IJ must address what is likely to happen to the petitioner if removed, and whether “what is likely to happen amount[s] to the legal definition of torture.” In answering these questions here, the BIA and IJ found that Herrow did not demonstrate a likelihood of torture. We conclude, however, that this determination could not have been made if all the evidence presented by Herrow had been properly considered.”

Being wrongfully denied CAT is no small matter, particularly if the USG is threatening to send you to Somalia. Lets get a glimpse of what happens in Somalia, courtesy of the latest report from our State Department:

Government security forces, including NISA and the Puntland Intelligence Agency (PIA), detained boys and adult men in the same facility and threatened, beat, and forced them to confess to crimes, according to Human Rights Watch.  There were reports of rape and sexual abuse by government agents, primarily members of the security forces.  The Human Rights Center, a local nongovernmental organization (NGO), reported two Somaliland police officers, area commissioner Hassan Ismail and Mustafe Yusuf Dheere, raped Nimo Jama Hassan on June 4 in Caynabo (see sections 1.g. and 6).

Al-Shabaab imposed harsh treatment and punishment on persons in areas under its control (see section 1.g.).

Torture and other cruel, inhuman, or degrading treatment or punishment at the hands of clan militias, some of which were government-affiliated, remained frequent.  A strong and widespread culture of impunity continued, due mainly to clan protection of perpetrators and weak government capacity to hold the guilty to account.

You might think that would lead Garland and his subordinates to take extra care to get these cases right. But, you would be wrong. Dead wrong in many cases. “Good enough for government work” is the touchstone of garlanding. 

By all accounts, Garland was a stellar student during his Harvard Law days. But, not so much some of his EOIR judges at the trial and appellate levels, particularly some of the “Sessions/Barr holdovers” who appear to have been appointed to the bench primarily because they were viewed as likely to deny protection without regard to law or facts. (I’ll concede that Barr and Sessions were wrong about some of their appointments who turned out, perhaps against  the odds, to be fair judges.)

Far too many EOIR judges receive “Fs” from the Courts of Appeals on the basics of immigration and asylum law, even though most mistakes never get to the Article III Courts or manage to otherwise wend their way through the system, thereby endangering lives.

Mr. Herrow was garlanded, but survived (at least for now) thanks to the work of his lawyers and the Third Circuit.

And that’s because so many in the party — elected officials and voters — won’t be led. Republicans have the majority in the House, but it’s a majority in name only. In reality, the House Republicans are an amalgam of competing factions, from right to far-right to extremist, and party members genuinely loathe one another more than they dislike Democrats.

Conservative media and social media stardom have turned even the most junior and otherwise inconsequential figures — say, Florida Rep. Matt Gaetz, the architect of this speaker-less anarchy — into power brokers who insist on having their sway. Like-minded conservative voters — small-dollar donors steeped in Fox News — bankroll the chaos agents; Rep. Marjorie Taylor Greene, that Georgia peach of a provocateur, is among Congress’ most successful fundraisers.

Here’s how insurgent and “Beetlejuice” fan Rep. Lauren Boebert of Colorado explained why House Republicans have failed to agree on a speaker: “There are 224 alpha males and alpha females who are here in the Republican Party. We are here because we convinced hundreds of thousands of people that we are leaders.”

No matter how this speaker mess ends — and it must somehow end — that perverse reward system will remain. And the House under Republican “leadership” will be all but ungovernable through the 2024 election.

Former Speaker Nancy Pelosi had a similarly thin Democratic majority yet managed to keep her party factions united and to shepherd into law major legislation, some of it bipartisan. But here’s the difference: Democrats believe in governance. Too many Republicans do not; their credo has shifted over the last quarter century from small government to anti-government. We’re watching the result.

Again, take it from a Republican: “Frankly, it doesn’t matter who the speaker is,” Rep. Mike Lawler of New York said, “because if we [Republicans] can’t govern as a group, as a conference, it doesn’t matter.”

Jordan, true to his brand as a belligerent, on Friday insisted on a third House vote for speaker. As widely predicted, he lost by even more votes than on the earlier ballots. He and his allies talked of pressing his candidacy through the weekend; after all, McCarthy was elected in January on the 15th ballot. But in a closed-door caucus and with secret ballots, Republicans voted to yank Jordan’s nomination as speaker.

His refusal to accept that he was not going to be speaker until the reality was forced on him was hardly a surprise. Jordan still won’t concede that Donald Trump lost reelection. He declined to do so yet again at a news conference Friday morning. His stubborn opposition to democracy — that’s what it is — only underscored why Jordan should never be the speaker.

The sad fact, however, is that Jordan’s reprehensible role as Trump’s chief congressional lieutenant in the run-up to the Jan. 6, 2021, insurrection wasn’t even much of a factor in opponents’ thinking. Nor was the fact that as speaker, this unrepentant election denier could have sabotaged the certification of the 2024 presidential vote if the Republican lost.

Instead, the reasons Jordan’s foes gave were personal, political or both. Some blamed him for stoking the death threats against them and their families. One, Rep. Drew Ferguson of Georgia, said Republicans don’t “need a bully as the speaker.”

But they need someone — the country needs someone — so Congress can function. Government funding runs out Nov. 17. Biden is sending a request for aid to Ukraine and Israel. Other essential legislation, including agriculture and defense bills, are pending.

Many Republicans are trying to shift the blame for the fiasco onto Democrats because they all opposed McCarthy and then Jordan — as if Republicans would’ve voted to retain Pelosi had an insurgent Democrat ever moved, like Gaetz did against McCarthy, to unseat her.

But they know the blame actually lies with themselves — thus the name-calling and near-fisticuffs.

They need to come together, if only temporarily. And then voters should fire them in 2024.

Today’s GOP is a thuggy gang of anarchists out to destroy America and destabilize the world — mostly because they believe they can, and complicit GOP voters have inflicted these ignorant, valueless, yet existentially dangerous, clowns upon the rest of us!

Totally classless and obstructionist till the end, Jordan forced his colleagues to vote to rescind his never-viable nomination for Speaker after losing three floor votes by increasing margins. By contrast, Scalise, the Conference’s initial nominee over Jordan withdrew without a vote upon determining that he lacked the votes to win the job.

Yet, inexplicably, some in the “mainstream media”continue to treat the GOP as a “normal” opposition party. In one of a continuing string of jaw-droppingly poor choices for guests, NBC’s Kristen Walker gave deposed ex-Speaker McCarthy a forum to engage in a “Trumpian liefest” of mythic proportions, outrageously attempting to blame Dems, the Border, Biden, Jeffries, the GOP insurrectionists he empowered, and just about anyone but himself for the debacle he helped engineer and his morally bankrupt party carried out!

Every viewer should have felt dumber after watching Welker fruitlessly try to control the astounding stream of lies, nonsense, doublespeak, and intentional misrepresentations coming out of McCarthy. Honestly, that’s what Fox News, Breitbart, and the Examiner are for! No need to give shallow politicos with absolutely nothing to contribute another forum! I’ve always been a Kristen Welker fan, but her first month as moderator of Meet the Press can only be described as something between tragic and horrible.

As Calmes says, “fire [the GOP] in 2024.” The future of America, the world, and humanity might depend on the n common sense and decency of the majority of voters!

Representative Steve Scalise of Louisiana withdrew on Thursday from consideration for the speakership he was on the cusp of claiming after hard-line Republicans balked at rallying around their party’s chosen candidate, leaving the House leaderless and the G.O.P. in chaos.

After being narrowly nominated for speaker during a Wednesday closed-door secret-ballot contest among House Republicans, Mr. Scalise, their No. 2 leader, found himself far from the 217 votes needed to be elected on the House floor. Many supporters of his challenger, Representative Jim Jordan of Ohio, the right-wing Republican endorsed by former President Donald J. Trump, refused to switch their allegiance.

With no clear end in sight to the G.O.P. infighting that has left one chamber of Congress paralyzed at a time of challenges at home and abroad, Mr. Scalise said he would step aside in hopes that someone else could unite the fractious party.

“I just shared with my colleagues that I was withdrawing my name as a candidate for speaker-designee,” Mr. Scalise said. “If you look at where our conference is, there’s still work to be done. Our conference still has to come together, and it’s not there. There are still some people that have their own agendas.”

With two wars involving our allies raging and the USG on track to run out of funding in a month, the GOP focuses on what’s important to them: THEMSELVES!

The GOP is a national disgrace and an international menace! They have brought the same disorder, callous disregard for the common good, and wacko, selfish, far right minority agenda to national politics that they have to the states they misgovern.

The GOP also also threatens America’s standing and influence on the world stage. The only thing standing between us and disaster is President Biden’s determination to lead and govern despite the GOP’s disgraceful chaos and betrayal of the common good!

And remember, it’s not like Scalise, who has coddled White Supremacists — once comparing himself to Klanster David Duke — and is a lifetime shill for a divisive far/right extremist agenda, was qualified to be Speaker. He was, at best, “slightly less unqualified” than insurrectionist election denier and Trump toady Jim Jordan!

Saturday, at the 12th hour, GOP Speaker Kevin McCarthy (D-CA) finally did the obvious — reached out to Dems to save America from insurrectionist, anti-American GOP extremists by passing a last-minute continuing resolution that will fund American government until Nov. 17. 

All Dems except one (who was protesting the GOP’s pro-Putin defunding of Ukraine aid) voted for the House bill, while 90 GOP insurrectionists voted to tank America and manufacture a needless crisis. The bill passed the nominally Dem-controlled Senate in about 30 seconds, and was signed by President Biden before midnight. The message about which party is serious about governing for the common good is obvious to all real patriots, even if a shocking number of GOP voters have foisted these far-right GOP clowns upon the rest of us.

The mainstream media uses the namby-pamby misnomer “border security,” to refer to the GOP’s proposed racist-nativist attack on immigration, destruction of the long-established right to asylum, and bogus attempts to reinstate “proven to fail,” draconian deterrence measures. As happened when tried unsuccessfully in the past, the GOP would turn over control of border migration policies to cartels, smugglers, and organized crime, while deflecting attention and undermining law enforcement efforts to control human and drug smuggling. 

A true accounting for the GOP extremist agenda would clearly show how firmly on the side of Putin and border bandits today’s dangerous, “destroy America” GOP has become. Too bad the so-called “mainstream media” has so little interest in digging beyond the cosmetics on the border issues and Ukraine aid.

The mainstream media is also salivating about the bogus prospect of MAGA-maniac Matt Gaetz (R-Outer Space) unseating McCarthy. NBC, on the other hand, maybe still smarting from new-host Kristen Welker’s disastrous, totally uncalled for, “inaugural” interview with a raving, incoherent, lie-spouting Trump, gave us wall-to-wall coverage of the Ryder Cup in place of “Meet the Press.” Honestly!

Look forward to more clownish theatrics and anti-American posturing from the GOP and their “Chief Clown” Trump, and more insipid reporting from the mainstreamers as America careens toward another likely GOP-generated “crisis” in mid-November. It’s NOT a “Washington problem! It’s purely a GOP that lacks any interest whatsoever in responsible governing.

It turns out the special purpose grand jury of Fulton County, Georgia, created in May 2022 to investigate the attempt to disrupt the 2020 presidential election in Georgia, recommended criminal charges against more people than the 19 the traditional grand jury indicted in August. Their report, published today, shows that a majority of the 23-person special grand jury also recommended the state bring charges against South Carolina senator Lindsey Graham and the two Georgia senators in early 2020: David Perdue and Kelly Loeffler.

The special purpose grand jury also recommended charges against Trump lawyers Cleta Mitchell and Boris Epshteyn, Trump advisor Michael Flynn, and all the false electors.

In most of the votes, it appeared there was one staunch vote opposed to bringing charges against anyone associated with Trump.

Also today, U.S. district judge Steve C. Jones for the Northern District of Georgia denied the request of Trump’s former chief of staff Mark Meadows to move his prosecution to federal rather than state court. This is important. Meadows had argued that the crimes for which the Fulton County grand jury indicted him were part of his duties as a federal official. If the judge had agreed, the removal of his case to federal court would have enabled Meadows to argue that his case should be dismissed because his actions were part of his official duties. But the judge determined that Meadow’s actions were part of his work for the Trump campaign and thus could stay in state court.

To make his case, Meadows testified himself, a high-risk step that now leaves him, as legal analyst Harry Litman of the Los Angeles Times put it, “in a very bad place. He gambled heavily on winning & then getting immunity. Now his ability to cooperate w/ either Jack Smith or Fani Willis is a) of much less value & b) possibly even off the table. He is in a world of hurt.”

Meadows has already appealed.

Other defendants, including Trump himself, were hoping their cases would be removed to federal court, but the decision in Meadows’s case does not bode well for them.

It would be a shame if the growing legal troubles of the Trump conspirators overshadow the work of the Biden administration on the global stage this week as it seeks to counter the power and influence of China by supporting other countries in the region. Vice President Kamala Harris took the lead in a visit to Jakarta, Indonesia, where she participated in the U.S.–Association of Southeast Asian Nations (ASEAN) summit.

ASEAN is a political and economic group of 10 countries that, combined, have more than 600 million people. Within that group, different countries seek stronger ties either with the U.S. or with China, and Harris has become a key figure in the administration’s attempt to bolster U.S. interests there. This was her third trip to Southeast Asia as vice president and fourth to Asia.

In Jakarta, Harris told Chris Megerian of the Associated Press: “We as Americans…have a very significant interest, both in terms of our security but also our prosperity, today and in the future, in developing and strengthening these relationships.” She said the government must “pay attention to 10, 20, 30 years down the line, and what we are developing now that will be to the benefit of our country then.” Southeast Asia has a young population, with two thirds of it under 35; makes up the fourth-largest market for U.S. exports; and is a passageway for one third of global shipping.

As Harris returned to the U.S., Biden left for New Delhi, India, for the Group of 20 (G20) Leaders’ Summit. On Friday he and Indian prime minister Narenda Modi had a bilateral meeting, and on Saturday and Sunday he will participate in the G20 summit. The G20 is a forum made up of 19 countries and the European Union that works to address issues relating to the global economy. G20 countries are responsible for 85% of the world’s economy and 75% of the world’s trade. The G20 is meeting September 8–10 in New Delhi.

On Tuesday, National Security Advisor Jake Sullivan said that the U.S. focus at the G20 will be to emphasize the scaling up of development banks, especially the World Bank and the International Monetary Fund (IMF), which provide funding for developing countries. In August, Biden asked Congress to increase funding for the World Bank, and at the G20, Biden will call on G20 members “to provide meaningful debt relief so that low- and middle-income countries can regain their footing after years of extreme stress,” Sullivan said.

The U.S. will also emphasize the Partnership for Global Infrastructure and Investment (PGI), a collaborative effort by the Group of Seven (G7) put together in 2022 to fund infrastructure projects from rail to solar to supply chains in developing nations. The G7 is a political forum made up of Canada, France, Germany, Italy, Japan, the United Kingdom, the U.S., and the European Union (EU).

At the center of the G20 meeting is the issue of money for developing countries. In 2013, China launched the so-called Belt and Road Initiative (BRI) to invest in infrastructure development in more than 150 countries as part of its assumption of a greater role in world affairs. The U.S. and key allies, including Japan and Australia, saw the plan as an effort to tie world trade to China.

But now, economic troubles in the wake of the onset of the coronavirus pandemic have made BRI debt less attractive to borrowing countries, while China has tightened up lending to reduce its own risk in the midst of an economic downturn. China is planning a big celebration for the tenth anniversary of the initiative in October, but European leaders are not planning to attend. In August, Italy, which was the only G7 country to join BRI, announced it was withdrawing.

Meanwhile, China’s president Xi Jinping will not attend this week’s G20 for the first time since he took office in 2012, possibly signaling internal turmoil in China or Xi’s frustration with what he sees as its increasing orientation toward the U.S., especially the growing ties between the U.S. and India, which shares a contested 2,100-mile border with China. In his place, Premier Li Qiang, the second-ranking leader in the People’s Republic of China, will attend the meeting.

Xi appears to be focusing less on the G20 now and more on BRICS, a bloc of emerging economies that began in 2009 with four countries—Brazil, Russia, India, and China—and added South Africa in 2010. When the group suggested earlier this year that it might admit more member states, more than 40 expressed interest, and BRICS has invited six to join: Argentina, Egypt, Ethiopia, Iran, Saudi Arabia, and the United Arab Emirates.

Secretary of the Treasury Janet Yellen is with the president in New Delhi, where today she told the press that the U.S. is “committed to supporting emerging markets in developing countries” and outlined the ways in which the U.S. hopes to increase access to funds, especially to address climate change. She said the administration is asking Congress for $2.25 billion for the World Bank and a loan of up to $21 billion for the IMF, and is looking to find a way to provide debt relief for struggling countries.

After attending the G20, Biden will travel to Hanoi, Vietnam, as part of what national security advisor Jake Sullivan called “a vision for facing the 21st century together with an elevated and energized partnership.”

Russia is also part of the G20, but Russian president Vladimir Putin will not attend, sending foreign minister Sergey Lavrov instead. While that absence can be attributed to the increasing isolation of Putin and Russia by Russia’s invasion of Ukraine, there might also be a different source of tension between the normally cooperative Russia and India. Last month, both countries launched lunar probes. India’s landed successfully and has been completing scientific studies.

To say that people seeking asylum in the United States are “gaming the system,” as Fareed Zakaria did in his Aug. 14 op-ed, “Immigration can be fixed. Why aren’t we fixing it?,” not only was dehumanizing but also dismissed the very real and traumatic conditions that force people and their families to make the heartbreaking choice to leave their homes and embark on a journey in search of protection and safety.

Calling on people to claim asylum in their home countries revealed a fundamental misunderstanding of the asylum ban and asylum itself. Access to asylum in the United States remains critical because many of the countries that individuals are fleeing from and through cannot or will not protect them from violence.

The U.S. government’s asylum ban is exacerbating dangerous circumstances for all asylum seekers. Women, girls and other survivors of gender-based violence seeking asylum are being denied refuge and forced to remain in conditions along our border that increase their susceptibility to the same kinds of violence and threats to their lives that forced them to flee in the first place.

Asylum is a legal and human right for all people, born of our own recognition that every human being has the right to seek a life of safety and dignity. This has nothing to do with partisan politics. The United States has an obligation to uphold its own laws and live up to its promise as a welcoming nation.

The legal right to seek asylum in the U.S. or at our border is clear! Getting the USG to respect it and the media to accurately report on abusive, illegal attempts to limit it, not so much! Thanks, Casey, for speaking truth and “taking it to” purveyors of White Nationalist myths like Zakaria!

Rather than urging fixing the legal asylum system to work in a fair, generous, timely, and humane manner — something that should be well within the Government’s capabilities and clearly in the national interest — folks like Zakaria, who should know better, have taken to victim shaming and blaming. The current law gives the Government plenty of tools to deal with frivolous claims to asylum. 

That our Government lacks the will and expertise to implement and staff the current system in a manner that would fairly and reasonably “separate the wheat from the chaff” is NOT the fault of those seeking asylum and their dedicated, hard-working, long-suffering advocates. Indeed, asylum and human rights advocates appear to be the only folks interested in insuring Constitutional due process and upholding the rule of law! 

I don’t dispute that our immigration system needs a legislative overhaul. But, that must NOT come at the expense of asylum seekers, refugees, and others who need and are deserving of our protection!

WASHINGTON — Numerous Russians attempting to escape conscription onto the Ukrainian battlefield have made perilous journeys to the United States, trusting in the Biden administration’s declaration that the U.S. would “welcome” those fleeing the war and their forced participation in it.

Instead of winning asylum, however, some of these men have been detained and, in at least one case, deported back to Russia, where they could be thrown into the fight against U.S.-armed Ukraine — into “the meat grinder,” as the U.S. secretary of State recently put it.

The U.S. has deported nearly 190 Russians since the beginning of October 2022, almost three times as many as were removed during the entire prior year.

Some Russian conscripts have refused to board deportation flights, forcing U.S. immigration officers to return them to immigration detention and legal limbo.

Three Russians the U.S. detained and sought to deport told The Times that certain abuse awaited them at home, where draft dodgers are subject to imprisonment or swift dispatch to front lines. The three Russians said they felt bewildered — betrayed, even — bythe U.S. asylum system. The Times is withholding their identities because they fear retribution if they are returned to Russia.

“Death awaits me there if I go back,” said one Russian man in his 20s. He said he was slated to be deported but fainted when immigration officials loaded him onto the plane, which forced them to return him to detention.

Although Ukrainian President Volodymyr Zelensky urged Russians who opposed the war to stay at home and fight to topple Russian President Vladimir Putin, the Biden administration has explicitly encouraged Russians who do not want to fight in Ukraine to seek asylum in the United States.

“There are people out there in Russia who do not want to fight Putin’s war or die for it,” White House Press Secretary Karine Jean-Pierre said in September. “We believe that, regardless of nationality, they may apply for asylum in the United States and have their claim adjudicated on a case-by-case basis.

“We welcome any folks who are seeking asylum, and they should do that,” she said.

But Russians who have taken the U.S. up on that offer have quickly discovered that seeking asylum is not the same as winning it. The U.S. government’s willingness to help people who flee Russia — even if doing so undermines Russia’s war effort — is limited.

In some cases, the government has argued that being called up to serve in the Russian military is not alone sufficient grounds for asylum. Jennifer Scarborough, the lawyer for the three Russians The Times interviewed, has countered that they qualify for asylum because they did not want to be involved with the war for political reasons and would face unreasonable repercussions for refusing to serve.

“They could be deported back to a regime that is committing gross human rights violations,” she said. “I don’t understand how we are denying Russians at all.”

The number of Russians crossing the southern U.S. border surged in November and December, shortly after Putin, facing massive casualties among his troops, ordered up a fresh army mobilization and drafted up to 300,000 reservists.

Russians crossed the southern border more than 5,000 times in November and nearly 8,000 times in December, a major increase from earlier months.

More than 8 million Ukrainians have fled their homeland since Putin launched his invasion of the former Soviet Republic on Feb. 24, 2022. Their escapes have involved trains and commercial flights and massive assistance, and they have largely been welcomed in other countries.

By contrast, many of those fleeing Russia for the U.S. have used the same difficult and at times treacherous route that disfavored refugees from all over the world use. A flight from Dubai or Istanbul gets them to South America, where they continue on flights, buses and by foot northward, sometimes trekking through jungle, to reach Mexico and the U.S. border.

One man who spoke to The Times was picked up by immigration agents in December near Tecate. The man made the weeks-long journey to the U.S. with his younger brother.

The man fled Russia when his call-up notice arrived.

“Even in childhood, I understood that, for me, America was a symbol of freedom,” he said in a telephone interview from a detention center in Pennsylvania. “And yes, there was a dream to move here one day. Because during your entire life in Russia, it is difficult; you’re discriminated against at every turn.”

“I went through war,” the man said. “I know what this entails. I saw the war. And now they are trying to force me to bring this to Ukraine.”

Jenn Scarborough asks the right question. In a functioning protection system, one would expect most cases like this to be granted in short order. However, the BIA generally has restrictive precedents on draft evaders and deserters stemming largely from a desire to deny protection to applicants fleeing civil wars in Central America decades ago. See, e.g., Matter of A-G-, 19 I & N Dec. 502 (BIA 1987).

As “Courtsiders” know, the endemic problem is lack of expert, progressive, dynamic, courageous intellectual leadership in a system now solely controlled and operated by a Dem Administration that often acts more like an “old school GOP” one on immigration and human rights! Administration of both parties live in perpetual fear that making good on promises of fair treatment and legal protection would actually motivate refugees to seek it!

That’s a particular problem at EOIR which should be the legal intellectual leader here! We need practical, scholarly, generous, common sense precedents focusing on what should be easily grantable protection claims! 

Instead, we have a leaderless, bureaucratic, non-expert mess, still retaining too many elements of the anti-immigrant, anti-asylum, any reason to deny, go along to get along, court as a “deterrent” system constructed and promoted by the Trump Administration. That has continued to churn out both egregious inconsistencies and backlog-building inefficiencies in critical “life or death” cases!

FALLS CHURCH, VA – The Executive Office for Immigration Review (EOIR) today announced the appointment of Katharine E. Clark as a Board Member of EOIR’s Board of Immigration Appeals (BIA).

The BIA is the highest administrative body for interpreting and applying immigration laws, having nationwide jurisdiction to hear appeals of decisions by adjudicators, including Immigration Judges.

Attorney General Merrick Garland appointed Katharine E. Clark as an Appellate Immigration Judge in August 2023. Judge Clark earned a Bachelor of Arts, magna cum laude, in 2003 from Brown University and a Juris Doctorate in 2006 from Georgetown University Law Center. From 2022 to 2023, and 2007 to 2018, she served as a senior litigation counsel and trial attorney at the Office of Immigration Litigation, Civil Division, Department of Justice. From 2019 to 2021, she was a managing attorney at Ayuda in Silver Spring, Maryland, where she also handled cases on a pro bono basis. Hopefully she will be a force in returning EOIR to it’s proper (though long-abandoned) vision of: Through teamwork and innovation, becoming the world’s best administrative tribunals, guaranteeing fairness and due process for all!

It’s far away from that now! But, there are some judges at EOIR like Judge Clark qualified and capable of leading a “due process renaissance” at the beleaguered tribunals. Whether and to what extent they will be able to do so remains to be seen.

Like the 1980 and 1994 boatlift crises, the present one may be in part tacitly encouraged by the Havana regime, which, like its allies in Managua and Caracas, is closely aligned with Russia.

It is in these governments’ interest to export dissent and stir political trouble for President Biden — as the boatlifts did for his Democratic predecessors Jimmy Carter and Bill Clinton.

Notably, the exodus from Cuba accelerated after its ally Nicaragua ended its visa requirement for Cubans, making it far easier for the latter to reach the Central American isthmus — and continue on to the border.

Cuba, Nicaragua and Venezuela do not take their citizens back if deported from the United States, which renders the Biden administration all but powerless to deter the flow.

All of the above should inform the debate about “root causes” of migration, which, like so many of its predecessors, the Biden administration has promised to address. There is a related argument over the United States’ own culpability in the plight of people living under the three left-wing regimes. Washington has sanctioned each one for gross human rights violations, the most recent being Cuba’s nightmarish crackdown on protests that broke out in July 2021 and a similar round-up of dissidents by President Daniel Ortega’s regime in Nicaragua.

Even when the United States targets them to limit collateral damage, these measures can affect ordinary people and not just the regimes; obviously, too, millions have left non-communist countries in Latin America for a better life in the United States.

What is nevertheless undeniable is the historic debacle represented by the departure of over 6 million from Venezuela, whose population peaked at 30 million in 2015, when the main phase of the exodus began. That is a fifth of the entire country.

For Cuba, 200,000 emigrants in a year represents nearly 2 percent of its 11.3 million population. In Nicaragua, the 200,000 who have left since Ortega’s crackdown began four years ago, mostly for the United States and next-door Costa Rica, amount to 3 percent of a 6.6 million population.

U.S. sanctions, under which — for example — this country was still Cuba’s second-largest supplier of food imports in 2020, cannot possibly account for so many people “voting with their feet” against the systems they live under. The foreseeable failure of subjecting the economy to top-down control and denying people basic freedoms can.

The exodus is thus a tremendous compliment to the United States and other democratic capitalist countries. We should appreciate it. Meanwhile, it imposes duties: to treat migrants humanely and incorporate as many of them as we lawfully and realistically can; and to oppose more effectively the despotism that is the root cause of their desperation.

Growing up in the 50’s and 60’s in Wauwatosa, WI, then a GOP bastion, I remember that the party of Ike and Nixon never saw someone fleeing from Communism or lefty dictatorships that they didn’t swoon over. East Germans, Hungarians, the “Chang Gang” from China, Cubans, Russians, all were welcomed and viewed not only as great assets to America (which they were) but also as strong empirical evidence of the superiority of democracy over left-wing dictatorships!

In elementary and high school, I had good friends whose families had fled East Germany and Hungary. They were all hard-working folks who left much behind but “reinvented themselves” in a new environment.

Now,  the forces of xenophobia, hate, fear, and the hope of exploiting the foregoing for political gain have replaced more realistic and welcoming attitudes in MAGA land. It’s up to the rest of us to show that these “negative values and bad attitudes” don’t represent the real America!

WASHINGTON — The scenes witnessed by journalists and humanitarian workers in recent months have been striking: In Sudan, swollen-bellied babies are looking for anything to eat. In Yemen, where warring parties have blocked humanitarian aid, hollow-eyed children and their mothers languish on the brink of death from starvation. In Ukraine, the elderly are collecting rancid rain runoff for drinking water.

Malnourishment and hunger were big problems even before Russia invaded Ukraine in February and cut off Europe’s breadbasket from its markets, sparking a flurry of dire warnings about the world’s food supplies. Dozens of countries across the globe are already suffering from devastating food shortages, so much so that the number of people facing starvation more than doubled in just the last two years, to 345 million, according to United Nations figures.

The causes are myriad: drought and flooding, and the interruption of supply chains triggered by the COVID-19 pandemic, especially in China. An estimated 20 wars or conflicts — the latest in Ukraine — have also seriously disrupted access to food and water.

“The current food security challenge that we’re facing [is] due to these three Cs: climate, COVID and conflict,” said Ramin Toloui, assistant secretary of State for economic affairs, one of several Biden administration officials tasked to food-security issues.

The bleak situation drew the attention of powerful diplomats Friday when U.S. Secretary of State Antony J. Blinken and the foreign ministers of six other of the world’s largest economies met in Germany to map out plans for easing global food shortages. Few observers expect real solutions to emerge but hope the summit will highlight the crisis and boost funding for anti-hunger efforts.

The Biden administration has committed about $8.5 billion to emergency food assistance and related programs, focusing initially on the Horn of Africa, Yemen, Lebanon and Haiti, Blinken said.

“We hear all these numbers; we’ve all cited numbers of this growing food insecurity,” Blinken said in Berlin. “But what we know is this: We know that those numbers are people, real people, real lives, real livelihoods, mothers, fathers, children. … As human beings, all of us have to be seized with this.”

The U.N.’s World Food Program calculates that eight of the 10 largest food crises worldwide are being primarily driven by conflict — in Yemen, Ethiopia, Afghanistan and the Democratic Republic of Congo. Such wars force people from their homes into long desperate treks for safety. They devastate farms and wreak havoc on food distribution systems.

In Latin America, food scarcity is also driving tens of thousands of people to abandon parched or hurricane-leveled farms and migrate to the United States.

These were the disasters already in motion when Russia invaded Ukraine. Now, the U.N. says the Russian blockade of Ukraine’s Black Sea ports could lead 40 million more people to go hungry.

Caitlin Welsh, a veteran expert in global food security who heads that program at the Center for Strategic and International Studies in Washington, said hunger and famine have consequences for both health and politics.

Hungry people can be angry people, and the rising price of food or fuel have led to coups throughout history. The health effects of going hungry can be far-reaching and insidious, Welsh said.

“The sudden elevation in prices [of foodstuffs like bread] can make people shift from more nutritious food to items of lower nutrition,” she said. And for pregnant women and young children, that can cause lifelong disabilities, Welsh said.

“It’s a debate between those who think our openness as a democratic society is an advantage in the struggle with autocracies or a disadvantage,” Malinowski told me. “One of the central lessons of the Cold War was that it is an advantage. I just hope we choose the same strategy that won the Cold War.”

One thing that has changed since the Cold War is that now these skilled workers who are fleeing Russia and Hong Kong have more options. Some reports say 50,000 to 70,000 Russian tech workers fled to places such as Turkey, Georgia and the Baltic countries in the first weeks of the war in Ukraine. Hong Kong business leaders are decamping for Singapore. Canada has already expanded immigration for Hong Kongers with advanced degrees, and thousands are taking advantage.

The whole world is competing for the talents of those who are fleeing from Hong Kong and Putin’s Russia. Republicans’ excessive fear of immigration should not waste a strategic opportunity for the United States to strengthen itself and weaken its rivals at the same time. Congress should work to ensure that China’s and Russia’s losses are America’s gains.

Even as I write this, Garland’s failed BIA, with too many Trump restrictionist holdover judges, continues to crank out bad asylum precedents and anti-immigrant legally incorrect appellate decisions and precedents. 

DOJ mindlessly continues to advance and defend the indefensible in Federal Court. It’s “Miller Lite” on steroids! Squandering taxpayer money, wasting scarce pro bono resources, and worst of all, endangering human lives!

Essential human rights issues like providing definitive, generous, positive guidance to move gender-based asylum cases through the system, correcting “intentionally overly restrictive” and ridiculously hyper-technical, legally wrong, highly impractical applications of supposedly “generous” asylum laws, lack of common sense, expertise, understanding, and humanity remain endemic in Garland’s broken “court” system and the USCIS Asylum Offices which are supposed to be under their legal guidance. 

The border effectively remains illegally and irrationally closed to refugees seeking asylum! Absurdly, the decisions as to who lives and who dies are left to the unfettered, unreviewable, “discretion” of Border Patrol Agents who are glaringly unqualified to make them. There aren’t even any known criteria in effect!

Indeed, that’s the precise reason why Congress created Asylum Officers and put them and Immigration Judges into the life or death asylum screening process, only to have Trump abrogate the law as Federal Courts meekly and fecklessly stood by! Hardly America’s finest moment!

There is plenty of irresponsibility to go around! But, dilatory “What Me Worry” AG Merrick Garland and his feckless lieutenants Lisa Monaco, Vanita Gupta, Kristen Clarke, and Liz Prelogar, along with DHS Secretary Alejandro Mayorkas, deserve “special censure” for the brewing, unnecessarily out of control humanitarian and equal justice crisis!

Trump’s xenophobic policies had consequences beyond the cruelty inflicted while he was in office. On Thursday, Homeland Security Secretary Alejandro N. Mayorkas told reporters that Border Patrol agents were reminded they have some leeway with regard to enforcing Title 42, particularly when it comes to those fleeing the crisis in Ukraine, BuzzFeed News reported.

“This was policy guidance that reminded (border officers) of those individualized determinations and their applicability to Ukrainian nationals as they apply to everyone else,” the online news outlet quoted Mayorkas as telling reporters.

Come on, man! You’ve got to be kidding me!

Belatedly, it appears that the Biden Administration is now “considering” restoring the rule of law at the borders (something they actually promised during the election), according to Alexandra Meeks over at CNN:

The Biden administration is preparing for the potential of mass migration to the US-Mexico border when a Trump-era pandemic emergency rule ends. The influx is expected because officials are considering the possibility of terminating a public health order known as Title 42, which border authorities have relied on to turn away migrants, sources familiar with the discussions said. Internal documents, first reported by Axios, estimate around 170,000 people may be coming to the US border and some 25,000 migrants are already in shelters in Mexico. The Department of Homeland Security has asked department personnel to volunteer at the Mexico border in response.

But, it’s not clear that they have any real plan in mind. That’s certainly the case in Garland’s dysfunctional, astoundingly backlogged (1.6 million known cases) Immigration “Courts” led by a Trump restrictionist BIA. “Gauleiter” Stephen Miller must evilly chuckle every morning at how Garland has left his “designed for White Nationalism” system largely in place and continuing to shaft and screw asylum seekers on a daily basis.

And, no, 170,000 migrants arriving at the border, not all of whom are seeking asylum, isn’t a “mass migration” emergency! It’s a fairly predictable movement of migrants at a pace that should be well within the capabilities of our nation. 

Treat them with respect. Promptly and properly screen them with qualified Asylum Officers. Timely welcome those many who qualify for protection with competent expert Immigration Judges. End the anti-asylum nonsense and move the many grantable asylum, withholding, and CAT cases through the system. Develop humane, orderly responses for those who are rejected. Get in place a new BIA that understands asylum law, due process, and human rights. Empower them to “knock heads” of IJs and Asylum Officers who won’t let go of the White Nationalist “reject, don’t protect” program!” 

It’s not “rocket science.” 🚀 Not by a long shot!

No, an “emergency mass migration situation” is 3.2 million refugees fleeing war in Ukraine in three weeks and arriving in allied nations like Poland, Romania, and Moldova who have far fewer resources and ability to respond than the U.S.! These are also nations who legitimately fear that they could be next on Russia’s “hit list.”

And, while the humanitarian crisis is brewing, what’s Garland up to? He beefing up his already-record-setting Immigration Court backlog with “kiddie cases” (0-4 year olds, incredibly) — to the extent anyone can even figure it out, given his notoriously flawed and unprofessional record keeping at EOIR. Honestly! But, don’t say that “Courtside,” Jeffrey Chase Blog, Dan Kowalski, ImmigrationProf Blog, CGRS, Human Rights First, NIJC, AILA, KIND, NCIJ, ABA, and many other experts didn’t warn against this grotesque failure long ago — often predating the 2020 election!

I understand that “no fly zones” are more complicated than most American pols and media wags think and that there are challenges to waging war from afar without actually declaring war on Russia. But, repairing our refugee, asylum, and immigration systems, and restoring due process to our courts are not in this category of difficulty. 

It’s beyond time for the Biden Administration, particularly Mayorkas and Garland, to get the lead out, grow backbones, get rid of the remnants of Trumpism in their ranks  — personnel, substance, process — and run a refugee and asylum legal system that serves our and our allies’ needs. One that is values and law based! One that our nation can be proud of, rather than embarrassed before the world! End the Clown Show, in Falls Church and throughout our muddling immigration and (non) human rights bureaucracy!🤡

ICE report shows sharp drop in deportations, immigration arrests under Biden

WaPo: Advocates for immigrants said they welcomed many of the Biden administration’s early changes, such as ending the travel ban and increasing the number of refugees allowed into the United States. But they said the most recent spending bill increases funding for immigration enforcement and complained that Biden has not kept his campaign promise to end privately run detention, which accounts for the majority of the ICE system.

NYT: The tension has also resonated inside the White House, where senior officials have been anxious that unwinding the Trump-era border restrictions would open the United States to an increase in illegal crossings at the southern border and fuel Republican attacks that Mr. Biden is too lenient on illegal immigration.

 

Even Before War, Thousands Were Fleeing Russia for the U.S.

NYT: More than 4,100 Russians crossed the border without authorization in the 2021 fiscal year, nine times more than the previous year. This fiscal year, which began Oct. 1, the numbers are even higher — 6,420 during the first four months alone.

AP: All Florida government agencies would be barred from doing business with transportation companies that bring immigrants to the state who are in the country illegally under a bill sent to Gov. Ron DeSantis on Wednesday.

 

Coast Guard has returned to Haiti most of the 356 Haitians who arrived in Keys this week

Miami Herald: Nearly 200 Haitian migrants were returned to Haiti on Friday by the U.S. Coast Guard after their bid to reach U.S. shores ended with their overloaded sailboat running aground behind a wealthy North Key Largo resort in the Upper Florida Keys and some of their compatriots making a harried dash to freedom in the choppy waters. 2020 Census Undercounted Hispanic, Black and Native American Residents

NYT: Although the bureau did not say how many people it missed entirely, they were mostly people of color, disproportionately young ones. The census missed counting 4.99 of every 100 Hispanics, 5.64 of every 100 Native Americans and 3.3 of every 100 African Americans.

 

ICE Conducted Sweeping Surveillance Of Money Transfers Sent To And From The US, A Senator Says

Buzzfeed: Immigration and Customs Enforcement agents obtained millions of people’s financial records as part of a surveillance program that fed the information to a database accessed by local and federal law enforcement agencies, according to a letter sent Tuesday by Sen. Ron Wyden to the Department of Homeland Security inspector general requesting an investigation into whether the practice violated the US Constitution.

 

U.S. International Student Enrollment Dropped As Canada’s Soared

Forbes: “International student enrollment at U.S. universities declined 7.2% between the 2016-17 and 2019-20 academic years, before the start of the Covid-19 pandemic,” according a new analysis from the National Foundation for American Policy (NFAP). “At the same time, international student enrollment at Canadian colleges and universities increased 52% between the 2016-17 and 2019-20 academic years, illustrating the increasing attractiveness of Canadian schools due to more friendly immigration laws in Canada, particularly rules enabling international students in Canada to gain temporary work visas and permanent residence.”

LexisNexis: Dissent: I respectfully dissent from this court’s denial of rehearing en banc on the issue of whether to grant Chevron deference to the Board of Immigration’s (“Board”) recent interpretation of § 1101(a)(43)(S), providing that an aggravated felony under the INA is “an offense relating to the obstruction of justice, perjury or subornation of perjury, or bribery of a witness.” …Namely, this decision is the first and only to uphold the Board’s 2018 redefinition as reasonable—repudiating the Ninth Circuit’s 2020 decision. Accordingly, by no longer requiring a nexus element, this opinion expands the list of possible state crimes that could trigger immigration deportation consequences for many persons who may not have been otherwise subject to deportation. This is a sizeable impact for many people in our country.

 

CA5 On Stop-Time, Niz-Chavez: Gregorio-Osorio V. Garland

LexisNexis: The Government indicates that the matter should be remanded, in part, to the BIA for consideration of her request for voluntary departure in light of Niz-Chavez. Thus, the petition for review is granted as to the stop-time issue, and this matter is remanded to the BIA for consideration under Niz-Chavez and other relevant precedents.

 

CA7 On BIA Abuse Of Discretion: Oluwajana V. Garland

LexisNexis: The  Board granted one extension but denied a second, suggesting that Oluwajana instead submit his brief with a motion seeking leave to file it late. When he did so, less than two weeks after the submission deadline, the Board denied the motion in a cursory-and factually erroneous-footnote. And having rejected the brief, the Board upheld the removal order without considering Oluwajana’s allegations of error by the immigration judge. Based on the undisputed circumstances of this case, we conclude that the Board abused its discretion by unreasonably rejecting Oluwajana’s brief.

 

CA9 Judge Pans State-US Law Mismatch In Rape Case

Law360: The Ninth Circuit ordered the Board of Immigration Appeals on Wednesday to decide if an immigrant’s rape conviction bars deportation relief, with a dissenting judge saying the decision only delays the “unpalatable” conclusion that the man can seek a removal waiver.

The “Top News Section” is a good rundown of the Biden Administration’s “mixed bag” on immigration policy, particularly as it relates to our largely defunct asylum system and the refugee system (still reeling from Trump-era “deconstruction”) that does not appear to be prepared for the inevitable flow of Ukrainian refugees. It also highlights some of the lingering damage to our democracy (e.g., racially biased census undercount) done by the Trump regime and its toady enablers.

My Take: Ukrainian Refugees & The U.S. Response

So far, largely meaningless political rhetoric from the Administration concerning Ukrainian refugees has been predictably “welcoming.” But, the actions to date have amounted to nothing more than taking the obvious step of granting TPS to Ukrainians actually here.

That does little or nothing to address the nearly 3 million refugees who have fled Ukraine in recent weeks. If the Administration has a coherent plan for admitting our share of those refugees and resuming processing of Ukrainians and all other refugees seeking asylum at the border, they have not announced it.

For example, despite U.S. and worldwide condemnation of China’s treatment of Uyghurs — some characterizing it as “genocide” — the Administration has done nothing to speed the processing of the very limited number of Uyghur refugees languishing in our still largely dysfunctional asylum system. If, as I’ve pointed out on numerous occasions, the Administration is unable to address “low hanging fruit” like Uyghurs and Immigration Court reform, in a bold and timely matter, how are they going to respond to more difficult human rights issues?  

As this op-ed in today’s NY Times points out, “generous” responses to large-scale refugee situations are often short-lived. As refugees flows inevitably continue and grow, the initial positive responses too often “morph” into xenophobia, nativism, racism, culture wars, and restrictionism.  https://www.nytimes.com/interactive/2022/03/15/opinion/ukraine-refugee-crisis.html

Ukrainian refugees have two potential “advantages” over those from Syria, Afghanistan, Iraq, Haiti, Venezuela, Ethiopia, DRC, and the Northern Triangle that could help them realize “more durable” protection. They are 1) mostly White Europeans, and 2) mostly Christian.

Neither of these is a legally recognized international criterion for defining refugees. Fact is, however, that they were not universally descriptive of those aforementioned groups who have often received less enthusiastic receptions from Western democracies. As a practical matter, “cultural attitudes” influence the Western World’s acceptance of refugees, probably to a greater extent than the actual dangers which those refugees face in the lands from which they have fled.

But, that has also been true in Haiti, Syria, Central America, the DRC and many other trouble spots. It has made little positive difference to the U.S. The Trump regime, led by Uber racist-misogynist refugee deniers “Gonzo Apocalypto” Sessions and “Gauleiter” Stephen Miller actually went out of their way to target the most vulnerable women and children fleeing persecution for further abuse.

And, to date, the Biden Administration’s promise to do better and regularize the treatment of those fleeing gender-based violence has been a huge “nothingburger.” Whatever happened to those promised “gender-based regulations” and the “common-sense recommendations” to replace the restrictionist holdover, bad-precedent-setting BIA with real judges who are experts in gender-based asylum?

The flow of refugees from Ukraine, and a much smaller (at this point) flight of dissidents from Russia, has already “exceeded projections” and is not likely to diminish in the coming weeks and months. Moreover, with Russia focusing on civilian targets and leveling parts of many major metropolitan areas in Ukraine, the essential infrastructure and “livability” of many areas is rapidly being destroyed. 

Thus, even if a “truce” were declared tomorrow (which it won’t be), many who have fled would not be able to return for the foreseeable future, perhaps never, even if they wanted to. The latter is a particular risk if Russia makes good on its threats to eradicate the current Ukrainian Government and replace it with a Russian puppet regime.

Refugee planning has consistently lagged foreign policy developments even though that has been shown to be problematic over and over. When will we ever learn?

We can’t necessarily prevent all foreign wars and internal upheavals, worthy as that goal might be. But, we can learn to deal better with inevitable refugee displacements. 

Indeed, that was the purpose of the UN Convention and Protocol on the Status of Refugees, to which we and the other major democracies are parties. That more than 70 years after the initial Convention was signed we are still groping for solutions (indeed, we have shamefully abrogated a number of our key responsibilities under both domestic and international law) to recurring, somewhat predictable, and inevitable dislocations of humanity is something that should be of concern to all. 

Despite all of the nativist propaganda, the truth is that nobody wants to be a refugee and that it could happen to any of us for reasons totally beyond our control! The similarity of the lives of many Ukrainians, up until a few weeks ago, to daily life in Western Democracies has perhaps “brought home” these realities in ways that the equally bad or even worse plight of other refugees in recent times has not.

I hope that we can learn from this terrible situation and treat not only Ukrainian refugees, but all refugees, with generosity, humanity, compassion, kindness, and as we would hope to be treated if our situations were reversed. Because, in reality, nobody is immune from the possibility of becoming a refugee!

Newsflash: It wasn’t the radical left that stormed the doors of the Capitol on Wednesday. It wasn’t the radical left that told a group of known white nationalists to “stand by” during a nationally televised presidential debate. It wasn’t the radical left that addressed the soon-to-be rioters and declared to members of Congress that “we’re coming for you.” It wasn’t the radical left who on the eve of the Capitol siege announced their plans to walk the path to sedition.

The only “radical” elements America sees now are the words and actions of the Republican Party. Yet Republicans have forever gotten away with throwing around the label “radical” to characterize the Democratic Party.

How many times in political ads have Republicans used the words “radical” and “dangerous” to describe their Democratic challengers? How many Fox News segments have Sean Hannity and friends devoted to the Democrats’ “radical extreme socialist agenda”?

What happened on Wednesday was an inevitable culmination of years of extreme and alarmist rhetoric from the Republican Party and their propaganda platforms. Watching Republicans act shocked that the people they have relentlessly and unapologetically pandered to for years is appalling.

With every tweet, every soundbite, every campaign ad, Republicans have been signaling to their supporters that it’s time to take matters in their hands. When you label something as “radical” or “extreme” or “dangerous,” you are telling people they need to defend themselves against a threat. You are telling them they need to be ready to fight. You are telling them their impulse to resort to violence and destruction is justified and righteous.

There is absolutely nothing radical or extreme about protesting racial inequality, social injustice and a culture of police brutality in America. There is nothing radical or extreme about speaking out for gender equality and women’s rights. There is nothing radical or extreme about advocating for universal healthcare coverage. There is nothing radical or extreme about supporting action to address the growing threat of climate change. There is nothing radical or extreme about wanting corporations to pay their fair share of taxes. There is nothing radical or extreme about embracing the need for gun reform in the wake of mass shootings. There is nothing radical or extreme about wearing a mask and social distancing amid a global pandemic that has taken the lives of more than 365,000 Americans.

The extremists are the ones who egged on the insurrectionists with four years of lies. Republicans may be abandoning the sinking Trump ship, but don’t let this 11th-hour maneuver fool you. That even after Wednesday’s events Republicans in Congress and in the media are still clinging to the “radical socialist agenda” narrative shows they haven’t changed — though they are scurrying to launder their tattered reputations.

Don’t believe me?

Just watch how many of them will vote to support articles of impeachment if the Democrats bring those to the House floor next week.
