An immigrant being held in detention at an Immigration and Customs Enforcement facility in San Diego has died of COVID-19.

A 57-year-old detainee at ICE’s Otay Mesa facility, which is run by private contractor CoreCivic, died early Wednesday of complications of the coronavirus disease after being hospitalized since late April, according to San Diego County officials. This is the first reported COVID-19 death of an immigrant in ICE custody.

Carlos Ernesto Escobar Mejia was from El Salvador, according to a government report obtained by BuzzFeed News. He’d been held by ICE since January and was hospitalized April 24 after exhibiting coronavirus symptoms. He had hypertension and self-reported diabetes but was denied release from custody in mid-April by an immigration judge.

ICE and CoreCivic did not immediately respond to a request for further details.

Advocates had been warning about unsafe health conditions at the Otay Mesa detention center for weeks. The facility currently has the biggest outbreak of COVID-19 of any ICE detention center, with at least 132 immigrants and 10 ICE employees testing positive as of last week.

(CoreCivic in mid-April said it had given masks to detainees at Otay Mesa and was quarantining positive cases in “housing pods” and separating those at high medical risk.)

Of nearly 30,000 immigrants in ICE detention centers nationwide, the agency has so far tested only 1,460 for COVID-19, and more than 705 immigrants have tested positive.

Activists have been calling for the release of all people from immigration detention, warning that there is no realistic way to keep immigrants safe during a pandemic in such facilities, which have long been reported to have substandard health care and sanitation.

“This is a terrible tragedy, and it was entirely predictable and preventable,” Andrea Flores, deputy director of immigration policy at the American Civil Liberties Union, said in a statement Wednesday.

“For months, public health experts and corrections officials have warned that detention centers would be Petri dishes for the spread of COVID-19 — and a death trap for thousands of people in civil detention,” she added. “Unless ICE acts quickly to release far more people from detention, they will keep getting sick and many more will die.”

Ken Cuccinelli, the Trump administration’s acting head of U.S. Citizenship and Immigration Services, reinforced his controversial interpretation of the inscription on the Statue of Liberty ― this time giving it a racist twist.

CNN journalist Erin Burnett was asking Cuccinelli about his earlier interview with NPR, in which he reworded the Emma Lazarus poem “The New Colossus,” saying: “Give me your tired and your poor who can stand on their own two feet, and who will not become a public charge.”

“‘Wretched,’ ‘poor,’ refuse’ – right? That’s what the poem says America is supposed to stand for. So what do you think America stands for?” Burnett asked Cuccinelli.

“Well, of course, that poem was referring back to people coming from Europe,” Cuccinelli answered, “where they had class-based societies, where people were considered wretched if they weren’t in the right class … And it was written one year after the first federal public charge rule was written.”

It is unclear why Cuccinelli felt the need to specify the group of immigrants Lazarus was referring to. The poem itself describes the Statue of Liberty by saying, “From her beacon-hand/ Glows world-wide welcome.” USCIS did not immediately respond to HuffPost’s request for comment.

Cuccinelli was on NPR defending the Trump administration’s controversial new rule effectively barring legal immigrants who are on government benefits, like food stamps and Medicaid, from becoming permanent residents.

After his remarks on NPR, HuffPost spoke to Annie Polland, a historian and director of the organization that has the original manuscript of Lazarus’ poem.

“To see how something so expressive of the country’s greatest ideals, to see how it could be so contorted or distorted, is really, I think, dismay is the only word,” said Polland, the executive director of the American Jewish Historical Society in New York, adding that she was “not surprised because we’ve been hearing these sentiments more than we have in the past.”

Lazarus originally wrote the poem in 1883 and it was added to the statue in 1903. Since then, the poem has become a symbol of the United States’ history of immigration.

Polland argued that the poem “is as much about who America or what America should be, as it is about immigrants,” adding that “in many ways, America defines itself by how it’s welcoming immigrants.”

Speaking to NPR on Tuesday, the day after the administration unveiled a new rule that will penalize green card applicants for “financial liabilities” like having a low credit score or using Medicaid, Ken Cuccinelli, acting director of U.S. Citizenship and Immigration Services, was asked if Lazarus’s poem, “The New Colossus,” remains “part of the American ethos.” To which Cuccinelli offered some suggested edits inspired by the executive branch’s take on who should or shouldn’t be allowed to live in the United States. “They certainly are,” Cuccinelli said. “Give me your tired and your poor—who can stand on their own two feet and who will not become a public charge.”

One day prior, Cuccinelli had told reporters at the White House that he was “certainly not prepared to take anything down off the Statue of Liberty,” though apparently, having slept on it, he’s now up for some kind of appendage. During his interview with NPR, Cuccinelli noted that the plaque bearing Lazarus’s words “was put on the Statue of Liberty at almost the same time as the first public charge was passed—very interesting timing.” It’s not at all clear what point he thought he was making.

Despite having zero actual experience in immigration policy, Cuccinelli was hired in May thanks to previous work sponsoring bills that tried to repeal birthright citizenship and would force employees to speak English in the workplace. (Had the latter passed, we assume Cuccinelli would have proposed revising the Statue of Liberty’s poem to read, “Speak English, bitch.”) In 2013, his mother told the Washington Post that as Christians, the Cuccinellis raised their children to “care [for] the poor” and that “if someone is starving, you want to bring him a meal, not a book on how to cook,” lessons her son apparently forgot. (Speaking of his Christian values, Cuccinelli has said that homosexuality “brings nothing but self-destruction, not only physically but of their soul.”)

This isn’t the first time a member of the Trump administration has cast aspersions on the whole “give me your tired, your poor,” business. Back in 2017, Stephen Miller, the president’s chief white rage officer, told Jim Acosta that he didn’t give a shit about the poem because it “was added later and is not part of the original Statue of Liberty.”

Cages With ‘Kids’ Pop Up Around NYC To Protest Immigrant Detention

The art installations were meant to bring awareness to the horrific conditions children and other migrants face at the southern U.S. border.

Some people in New York City were confronted with an alarming image as they walked down the street on Wednesday morning: a chain-link cage on the sidewalk containing a child-size mannequin wrapped in a foil blanket, with audio playing of migrant children crying.

More than 20 cages were placed around Manhattan and Brooklyn ― from Union Square to the Barclays Center sports arena ― as part of a campaign called #NoKidsInCages by immigration nonprofit RAICES and ad agency Badger & Winters.

It was meant to draw Americans’ attention to the children and other migrants being held in alarming conditions at the U.S.-Mexico border.

Speakers in the cages played the viral recording released by ProPublica last summer of kids wailing for their “mamá” and “papá” after having been separated from them at the border as a result of the Trump administration’s “zero tolerance” immigration policy.

“We want to bring this back to the consciousness of the American people,” RAICES CEO Jonathan Ryan told HuffPost. “One of the many unfortunate consequences of the repeated traumatic stories coming from the border is that, as horrified and angry as people have been, we also become desensitized. It’s important for people … to be confronted with the reality that this is about children, human beings, whose lives are forever affected.”

“This is being done in our name by people who we elected,” he added. “And if we don’t do something to stop this, this will become who we are.”

About two dozen cages were dropped around the city from about 4 a.m. to 5 a.m., Ryan said. By midafternoon most of them had been taken down by police or city employees, with three remaining around 2 p.m., per Ryan. The New York Police Department confirmed to HuffPost that more than half a dozen cages had been removed around Manhattan, but did not respond to questions as to why.

The online campaign associated with the installations recalls the family separations under President Donald Trump’s hard-line zero-tolerance policy, which led to the separation of thousands of children from their parents last year. The policy sparked protests nationwide and was reversed by executive order in late June. But a January report from the Department of Health and Human Services found the administration may have separated thousands more kids from their families than was previously known, and it did not know how many or whether they were reunited.

RAICES also wants people to become aware of other issues migrants face, Ryan said.

He noted undocumented immigrant families are still separated “routinely” at the border, including when migrant kids are split from other guardians like uncles and aunts or older siblings. Separations occur inside the country too, he said, when a child’s undocumented mom or dad is arrested by immigration agents, for instance in a workplace raid.

U.S. Customs and Border Protection apprehended over 109,000 people at the border in April ― more than double the number of migrants detained during that month last year. A majority of the migrants apprehended were either families traveling together or unaccompanied kids.

A Department of Homeland Security watchdog, reporting on Border Patrol facilities in El Paso, Texas, found last month that detained migrants were kept in dirty and extremely crowded conditions, forcing some people to stand on toilets to get some breathing room.

Last week, Trump said he reached an agreement with Mexico that includes “rapidly” returning to Mexico anyone who crosses the border seeking asylum in the U.S. Advocates are concerned about the dangerous conditions in cities such as Tijuana and Ciudad Juárez, where more migrants will now be forced to wait as their claims are processed.

“When the American people hear stories of this problem being fixed by the ‘remain in Mexico’ policy, it hasn’t been fixed, it’s just further from their view,” Ryan said. “The suffering will only increase.”

JIM CROW REVIVAL: U.S. District Judge Carlton Reeves Blasts Trump’s Attacks On Judges As A Return To The Ugly Racist Age Of American Segregation!

U.S. District Judge Carlton Reeves fiercely criticized President Donald Trump’s attacks on the judiciary in a speech Thursday, likening some of his rebukes to tactics that had been used by the Ku Klux Klan and segregationists.

“We are now eyewitnesses to the third great assault on our judiciary,” Reeves said, according to a copy of the speech obtained by BuzzFeed News. Reeves, who is a judge in the U.S. District Court for the Southern District of Mississippi, delivered the speech Thursday at his alma mater, the University of Virginia School of Law, after being awarded its Thomas Jefferson Foundation Medal in Law.

“When politicians attack courts as ‘dangerous,’ ‘political’ and guilty of ‘egregious overreach,’ you can hear the Klan’s lawyers, assailing officers of the court across the South,” said Reeves, quoting Trump’s repeated criticisms of judges and the courts. (The speech’s footnotes cite the president’s tweets, speeches and more.)

“When the powerful accuse courts of ‘open[ing] up our country to potential terrorists,’ you can hear the Southern Manifesto’s authors, smearing the judiciary for simply upholding the rights of black folk,” Reeves went on, referring to a 1956 manifesto by Southern congressmen rebuking the Supreme Court’s 1954 landmark anti-segregation ruling, Brown v. Board of Education.

“When lawmakers say ‘we should get rid of judges,’ you can hear segregationist Senators, writing bills to strip courts of their power. And when the Executive Branch calls our courts and their work ‘stupid,’ ‘horrible,’ ‘ridiculous,’ ‘incompetent,’ ‘a laughingstock,’ and a ‘complete and total disgrace,’ you can hear the slurs and threats of executives like George Wallace, echoing into the present,” he added, referring to the pro-segregation Alabama governor elected in 1962.

Such pointed criticism of the president is unusual from sitting judges, who tend to abide by a judicial ethics code of impartiality. Reeves has used strong language in judicial opinions before, notably in blocking a 15-week abortion ban in his state last year.

Supreme Court Justice Ruth Bader Ginsburg faced backlash, and eventually had to apologize, in 2016 for criticizing then-candidate Trump.

In his speech, Reeves also skewered the lack of diversity among Trump’s judicial nominees ― as the vast majority of those confirmed have been white men.

“Think: In a country where they make up just 30% of the population, non-Hispanic white men make up nearly 70% of this Administration’s confirmed judicial appointees,” said Reeves, who was appointed by former President Barack Obama. “That’s not what America looks like. That’s not even what the legal profession looks like.”

“There is no excuse for this exclusion of minority experiences from our courts,” he added.

The Trump administration has faced myriad legal challenges to its policies. Trump’s travel ban targeting largely Muslim-majority countries was blocked several times by the courts before its third iteration was ultimately upheld by the Supreme Court. Trump’s February declaration of a national emergency to fund a wall at the U.S.-Mexico border was met by lawsuits from more than 20 states and an upcoming suit from House Democrats.

“Each of us has a role to play in defending our judiciary,” Reeves said in his speech. “Judges, politicians and citizens alike must denounce attacks that undermine our ability to do justice.

“It is not enough for judges, seeing race-based attacks on their brethren, to say they are merely ‘disheartened,’ or to simply affirm their non-partisan status,” he added. “We must do more to defend our bench.”

So, U.S. Immigration Judges aren’t the only ones under attack; they just have less protection than judges serving under Article III or Article I.

But, let’s get down to the “brass tacks.” As long as a majority of the Supremes fails to take a stand with lower court judges appointed by both parties who very consistently have called out Trump’s “pretextual” reasons for engaging in racially and religiously biased actions, the unwarranted attacks will continue.

Yes, we are in the “New Era Of Jim Crow;” and the Supremes’ majority has “taken a dive” this time around.

Wonder who will be left to speak up in their behalf when Trump inevitably turns against them?

Stephanie Clifford (aka Stormy Daniels), who claims she had an affair with Donald Trump, is now suing the president.

According to a lawsuit Clifford filed in Los Angeles on Tuesday, a copy of which was obtained by NBC News, Trump didn’t sign a nondisclosure agreement with the former adult film star, which blocked her from disclosing their 2006 relationship. According to the suit, Clifford and Trump’s lawyer signed the document, but Trump did not, allegedly making the agreement invalid.

Clifford and Trump’s attorney Michael Cohen both signed what the suit calls a “hush agreement” and a side letter agreement on Oct. 28, 2016, just 11 days before the presidential election. The documents are appended to the lawsuit, according to NBC.

The 2016 “hush agreement” detailed that $130,000 would be paid to Clifford’s then-attorney in exchange for Clifford not disclosing any confidential information about Trump or his sexual partners. The suit claims Clifford and Trump’s intimate relationship started in the summer of 2006 and went “well into the year 2007.”

Clifford’s attoreny, Michael Avenatti, released a copy of the complaint for declaratory relief on Twitter on Tuesday.

In January, The Wall Street Journal reported that Clifford had an affair with Trump in 2006, the year after he married Melania Knauss on Jan. 22, 2005, and a few months after their son, Barron, was born on March 20. The report said Clifford was paid $130,000 to sign a nondisclosure agreement and not discuss the relationship. At the time, Clifford’s lawyer released a statement from the actress denying the affair.

In the lawsuit, Clifford claims that Cohen had tried to block her from talking about the affair as recently as Feb. 27, according to NBC. The suit also claims that in January, Cohen, “concerned the truth would be disclosed … through intimidation and coercive tactics, forced Ms. Clifford into signing a false statement wherein she stated that reports of her relationship with Mr. Trump were false.”

After Cohen told The New York Times last month that he had in fact paid Clifford $130,000 in 2016, Clifford said she was free “to tell her story” because Cohen’s discussion of the agreement invalidated it. Cohen at the time did not say what the payment was for and said that neither the Trump Organization nor the Trump campaign reimbursed him for the payment.

Attorney Avenatti told HuffPost late Tuesday: “We confirm all facts as alleged in the complaint.”

HuffPost also reached out to the White House and Cohen for comment but did not receive a response as of this posting.

“With immigrants living in a climate of fear under President Donald Trump, lawyers like Cristian Minor are stepping up to help undocumented I families.
Minor volunteers at a Pittsburgh legal clinic run by local nonprofit Casa San Jose, where he provides free counsel to Latino immigrants. One of the most difficult matters he deals with is helping parents designate a guardian to care for their U.S.-born children in case the parents are detained or deported.
“The fears of the community are that at any moment ― when they go to work ― they could be detained by ICE,” Minor said, referring to the Immigration and Customs Enforcement agency. “Can you imagine that you live every day of your life and you don’t know if you’re going to come back and see your kids? I became a father recently ― and I cannot imagine my life being away from my child.”
Trump’s anti-immigrant rhetoric and policies ― including cracking down on undocumented immigrants and rescinding the Deferred Action for Childhood Arrivals program ― have generated great worry in immigrant communities. He has repeatedly referred to undocumented immigrants as criminals, while ICE is making headlines with its blunt enforcement efforts.
 In early February in Austin, Texas, ICE stopped undocumented immigrants in traffic, attempted to arrest them in their homes and patrolled around a grocery store. Later that month, school kids in the area told HuffPost that their parents were afraid to go food shopping or drop them off at school.
Casa San Jose started the legal clinic in November after Trump’s election.
Minor is an immigrant himself. Arriving in the U.S. from Mexico eight years ago, he considers himself “lucky” to have come here “with documents.” He initially attended law school in Mexico, ultimately earned his law degree in the U.S. and today is a lawyer focused on oil and gas consulting, immigration and family law. He’s now a U.S. citizen and is married to a woman from Pennsylvania.
Minor told HuffPost he wants to “destroy the image of the immigrant” as a criminal. Research has shown that immigrants — both documented and undocumented — are less likely to commit crimes than U.S. citizens.
“I can attest to the good faith of the immigrants who come here,” he said. “They don’t come to steal jobs. They just come for a better life.” 

Navigating the complexities of the U.S. immigration system can be a challenge, particularly if English is not your first language. Attorneys and law students from the University of Pittsburgh’s Immigration Law Clinic participate in Casa San Jose’s near-monthly event, helping usually more than a dozen people, the nonprofit’s executive director Julian Asenjo told HuffPost. The four-hour sessions are generally booked solid, he said.
With undocumented parents, Minor raises this question: If they are deported and choose not to take their U.S.-born children back to their home country ― which the children may never have visited and whose language they may not speak ― who will take care of the kids? He helps the parents to prepare a document that names their choice for their kids’ guardian.
But the documents are no guarantee. In Pennsylvania, Minor said, any final decision on guardianship is up to a judge, who must consider the best interest of the child. Even if the mother wants her sister to take care of her kid, for example, the judge could decide that the child is better off in foster care.
Minor’s clients are not alone: While custody rules vary by state, undocumented parents across the country have been developing plans for guardianship since Trump became president. Minor doesn’t know of any instance yet in which a parent getting deported had to leave kids behind without another parent or legal guardian. But he and others are seeking to avoid that worst-case scenario.
“The system of immigration is destroying these families,” Minor said. “They are people who came to this country fleeing situations of poverty, violence in their home countries.”
Although President Barack Obama carried out a record number of deportations and was even dubbed the “deporter-in-chief,” Trump’s policies have generated more fear because of their sweeping nature, Minor said.
Under Obama, there were clear priorities: People with criminal records or gang affiliation were at higher risk for deportation, while those with no criminal records or with U.S.-born children were lower on the list. Under Trump, however, most undocumented immigrants are at risk.
They come here, they work really hard to provide for their family, they pay taxes, they do everything right, they have not committed crimes,” Minor said. “Suddenly you have the risk that the father can be deported, or the mother, and the kids are probably going to end up in the foster care system. It’s a very difficult thing.”
A video of a 13-year-old girl crying over her father, who was detained as he was driving her to school, garnered widespread attention earlier this year.

Besides guardianship, Minor has counseled undocumented individuals on a range of issues, from a domestic worker who was being abused by her employers to a woman whose partner was beating her. In both cases, the victim was afraid to turn to authorities for fear of being deported.
In an April survey, immigration attorneys and advocates reported that immigrants are increasingly reluctant to complain to authorities about domestic violence and sexual assault.

“This is what’s happening right now, what the Trump administration’s rhetoric is creating: marginalization of immigrants, specifically Latinos, driving people underground for fear of deportation,” Minor said. “These policies create fear and empower individuals who use this rhetoric to oppress the immigrant populations here.”
For people who want to support undocumented families, Minor suggests donating to or volunteering at a community center, like Casa San Jose. If you have language or legal skills, one of these groups might welcome your time.”

Sarah’s article does a great job of illustrating the bogus narrative, wanton cruelty, and just plain “dumb” gonzo enforcement being promoted by Trump, Sessions, Miller and the White Nationalists, and being mindlessly carried out by DHS/ICE.

One of the worst aspects is that rather than making America safer, “gonzo enforcement,” empowers gangs, drug traffickers, domestic abusers, extorters, rapists, and sex abusers who have been essentially “turned loose” on ethnic communities by the Trump Administration with little chance being apprehended by law enforcement. That’s exactly what so-called sanctuary cities are organizing to resist.

Since DHS is prone to go for “low hanging fruit,” collaterals, minor criminals, and immigration violators, to build up bogus stats, that in turn justify their existence, the chances of the real ”bad guys” being taken off the streets by these tactics are likely reduced.

In the meantime, thank goodness for the real “good guys” like Cristian Minor who are working hard to limit and wherever possible repair the human, economic, social, and moral carnage being inflicted on America by the Trump Administration.
