Victory for US immigration judges as Biden administration recognizes union

Settlement comes after judges accused president of ‘doubling down’ on Trump’s position

In a stunning victory, US immigration judges have settled a tense dispute with Joe Biden’s administration over their effort to restore union rights taken away from them under Donald Trump.

Biden’s Department of Justice agreed on Tuesday to recognize the union as the exclusive representative for the nation’s immigration judges and follow the terms of their collective bargaining agreement, at least for the time being.

Days before reaching the settlement, the head of the federal immigration judges’ union had accused the Biden administration of “doubling down” on its predecessor’s efforts to freeze out their association even as they struggle with a backlog of almost 1.5m court cases and staff shortages, which exacerbate due process concerns in their courts.

Mimi Tsankov, president of the National Association of Immigration Judges (NAIJ), had declared herself “mystified” that Biden’s Department of Justice would not negotiate with her members despite the US president vocally and frequently touting his support for workers’ representation.

“This administration has really doubled down on maintaining the [Trump] position that we are not a valid union,” Tsankov said before the settlement.

Tsankov was appointed as an immigration judge in 2006 and is based in New York, where she also teaches at Fordham University School of Law. She spoke to the Guardian only in her union role.

After what she described as “decades” of relatively smooth relations between the NAIJ and the Department of Justice, Donald Trump capped four years of rightwing immigration policy by successfully petitioning to strip hundreds of immigration judges of their right to unionize.

The hostile move was decided by the Federal Labor Relations Authority (FLRA), an independent administrative federal agency that controls labor relations between the federal government and its employees, on 2 November 2020, the day before the presidential election.

Despite a Democratic victory and Joe Biden taking the White House pledging to undo damage done by Trump, the union remained shut out and silenced for more than a year, without a date set to hear its case attempting to restore its official status.

“I cannot understand it … Working together, as the president has stated, working with federal employees, working with unions, achieves better results,” said Tsankov.

Congrats to Judge Tsankov and former NAIJ Presidents Judge Amiena Khan, Judge Ashley Tabaddor, and all of the others who courageously and steadfastly fought against this scurrilous retaliation by Billy Barr directed against those with the guts and integrity to “speak truth to power” about the due process disaster in our Immigration Courts!

Yes, it’s a great victory for the NAIJ and “good government.” But, I’m with Judge Tsankov here: Why on earth did it take so much time and wasted effort for the Garland DOJ to finally “do the right thing?”

This should have been “day one stuff” for Garland — a true “no brainer.” The real “stunner” here is that it took so long!

The NAIJ was and remains “the only game in town” when it comes to expert professional judicial training @ EOIR! The rest of EOIR’s professionalism and training program could be characterized as a shambles — that is, if it actually existed, which it effectively doesn’t.

Compare EOIR “management’s” pathetic attempts at training with what the “real pros” at NAIJ and the VIISTA Program at Villanova (training for non-attorney reps) under Professor Michele Pistone have developed over the past year. There is no comparison — NAIJ and VIISTA win, hands down!

Yet, rather than harnessing this available energy, talent, expertise, and creativity, “Team Garland” has dawdled away the time, making few material inroads into the toxic culture and broken pieces of our Immigration Courts. Ask almost any practitioner how much their life and the lives of their clients in Immigration Court have “improved” under Garland! You’ll get an “earful” — as I do on occasion.

A new group of progressive practical expert leaders at EOIR should have made NAIJ, representatives of the private bar and NGOs, and representatives of ICE OPLA part of  an “expert advisory team” working cooperatively to reform EOIR, institute merit-based hiring practices, and reduce the backlog without more wasteful gimmicks and in full compliance with due process.

Instead, most of the first year of Garland’s DOJ tenure has been wasted fighting battles that never should have been fought, irrationally alienating would-be allies who could have provided creative solutions to endemic problems, and engaging in yet more “Aimless Docket Reshuffling” even while continuing to build unnecessary backlog. The actual state of due process at EOIR has remained deplorable, morale at record lows, and the frustration and anger of attorneys subjected to Garland’s ongoing mess growing.

Even the “lowest of low-hanging fruit” — speedy approvals of applications for recognition and accreditation of non-attorney representatives involving graduates of VIISTA and other top NGO programs have been inexplicably allowed to languish. A process that should easily be completed in 30-60 days in most cases delayed for months, perhaps years, under unrealistically low staffing and “low priority” assigned by habitually negligent and unresponsive to public needs “EOIR Management.” This, at  a time when there is a dire crisis in representation that VIISTA and other “top drawer NGOs” are fighting and innovating to solve.

(Remember, of course, that former EOIR Director James McHenry improperly “took over” the R&A program, which has become less, rather than more, functional and timely as a result. That’s a good measure of how inane EOIR “management” became under Trump. But, although McHenry is gone, it’s not that there has been drastic improvement under Garland. The lack at EOIR HQ of those who truly understand the Immigration Court process and could solve problems and “make the trains run on time,” without stomping on anyone’s rights, is simply mind-boggling!)

But, however bad EOIR is and remains, the “real buck stops with Garland” who has miserably failed to address in a timely, professional, systemic, rational manner the ongoing mess in his “EOIR Star Chambers!”

Good immigration news from Washington D.C.!Immigration law professor Lucas Guttentag has been named senior counselor on immigration policy and report to the Department of Justice’s Deputy Attorney General Lisa Monaco. Guttantag served in the Obama administration as a senior adviser on immigration policy, including as senior counselor to the secretary of Homeland Security.Anita Kumar for Politico states that “Guttentag will not only help dismantle Trump-era policies but will coordinate Biden policy among various agencies and departments.”

Kumar writes that “[p]rior to entering the administration, Guttentag served as law professor at Stanford Law School and lecturer at Yale Law School. He launched the Immigration Policy Tracking Project in 2017 to develop and maintain a complete record of Trump administration immigration actions.

In total, Trump made more than 400 alterations to immigration policy during his time in office, according to the Migration Policy Institute, a think tank with staffers across the political spectrum that provides data and analysis on immigration policy. The Immigration Policy Tracking Project put that number closer to 1,000.”

If you are an immigrant requesting asylum or fighting deportation before the federal immigration court in San Francisco, it’s likely to take nearly three years for your case to be resolved — the average processing time, as of June, was 1,057 days.

That’s because the San Francisco court’s 26 judges are working their way through close to 76,000 cases — the third highest number of pending cases in the country, after New York and Miami. Nationwide, the backlog has grown to an unprecedented 1.3 million cases, more than twice what it was when President Donald Trump took office.

What’s at stake, says Doris Meissner, a senior fellow at the Migration Policy Institute in Washington DC, is the credibility of the entire immigration system — both for the individuals whose futures are on the line, and for broader public confidence.

The epic case backlog results from a convergence of factors.

Immigration enforcement, which had increased under President Barack Obama, ballooned during the presidency of Donald Trump. Trump ended Obama-era prosecution priorities that focused on immigrants with serious criminal histories, and instead pursued deportation of any undocumented immigrant. As of last December, more than 98% of the cases in immigration court were for people whose only charge was an immigration violation, according to an analysis by the Transactional Records Access Clearinghouse at Syracuse University.

Also in the past several years, a much larger share of the migrants arriving at the U.S.-Mexico border are people requesting asylum, rather than trying to evade border authorities to come work or join family in the U.S. And if migrants can establish a “credible fear” of persecution in a screening interview with an asylum officer, they can’t be quickly removed from the country. Instead, their cases go straight into the immigration court system.

But that court system is chronically underfunded, with not enough judges or support staff, according to a 2019 report by the American Bar Association. While the Trump administration hired more judges and imposed a case completion quota on judges meant to speed up their work, neither made a dent in the backlog. Meanwhile the ABA report found that hiring practices became politicized and the administration’s policies threatened due process.

On top of all of that came the COVID-19 pandemic, which led to months of closed courts, suspended hearings and delayed processing.

While many state and federal courts moved quickly to conduct hearings over video conference calls, the Executive Office of Immigration Review, as the immigration court system is known, was behind the curve, according to longtime San Francisco immigration judge, Dana Leigh Marks, who is the executive vice president of the National Association of Immigration Judges.

“What the pandemic and quarantine restrictions revealed is just how abysmally prepared EOIR has been from the technology aspect,” said Marks, speaking in her role with the NAIJ, the judge’s union. “And we do not have universal electronic filing… so there’s roughly a million cases or more that are still paper-based. And that really makes hearings from a judge’s home much more problematic.”

Advocates for asylum seekers are also looking forward to seeing new regulations from the Biden administration in another area: establishing clear eligibility standards for asylum so as to prevent future instances where an attorney general can override decades of case law, as Sessions did in the case of a Salvadoran woman fleeing domestic violence, known as the Matter of A-B-.

Karen Musalo, director of the Center on Gender and Refugee Studies at UC Hastings in San Francisco, said she was relieved when Garland reversed that ruling in June, but she called that just a first step in restoring fairness to the asylum system.

“What is much more important is asylum regulations that specifically look at aligning U.S. law with international norms,” she said. “We need to get the law back on track.”

That regulation is being drafted jointly by the departments of Justice and Homeland Security and is expected by late October, she said.

Musalo also called on the Biden administration to improve training and oversight for immigration judges, who are appointed to the bench by the U.S. attorney general. The fact that asylum grant rates vary wildly between judges suggests that rulings can be influenced by political leanings more than an impartial application of the law, she said.

“You could have very good rules and laws, but if you don’t have fair, unbiased, competent, professional individuals applying the rules in the law, you don’t solve the problems,” she said. “How can you have a fair game when the referee is unfair?”

Legal organizations including the American Bar Association, the American Immigration Lawyers Association and NAIJ, the judges’ union, have long called on Congress to overhaul the immigration courts by taking them out of the Department of Justice altogether. And this summer there’s a move to do just that.

Rep. Zoe Lofgren, D-San Jose, the chair of the House immigration subcommittee, will soon introduce a bill to make the immigration court system a so-called Article I court, akin to federal tax court or bankruptcy court. Staff involved in drafting the bill say the new system would better protect due process of law and would be shielded from political pressure from presidents, be they Democratic or Republican.

Some observers, including Meissner and Musalo, say such a change is needed but they aren’t convinced the bill could win enough support to pass.

But Marks, the immigration judge, says the current dysfunction shows how badly the immigration courts are compromised and how urgently they need independence from the Department of Justice.

“It’s an uncomfortable and inappropriate placement for a neutral court system. And that’s the inherent structural flaw that we need Congress to fix,” she said. “I really feel like it is an idea whose time has come… now.”

Nevertheless, as Professor Karen Musalo cogently points out, without better judges and leaders at EOIR — high caliber, proven progressive experts “in the  Guttentag-Musalo mold,” — any favorable regulatory or even legislative changes will likely founder. As currently staffed and led, EOIR simply lacks the expertise, independence, moral/intellectual leadership, courage, and “judicial firepower” to achieve a progressive, practical, due-process-compliant immigration and human rights system. Due process, fundamental fairness, and a correct application of U.S. asylum law — one that honors Cardoza-Fonseca and Mogharrabi — can only be realized by replacing “Club Denial @ EOIR” — actively encouraged and promoted by Sessions and Barr, with competent, expert, progressive judges committed to fair and humane treatment of asylum seekers and other migrants under law.

Simply adding more judges to an incredibly broken system, without correcting the legal, personnel, and judicial administration issues that led to this massive (largely self-created) dysfunction will not solve the problem! Lucas knows this as well as anyone! So does Judge Dana Marks, who actually litigated and won the landmark “well-founded fear” case INS v. Cardoza-Fonseca before the Supremes!

But even with experts like Lucas at DOJ, Ur Jaddou, John Trasvina, and Judge Ashley Tabaddor in place at DHS, it’s going to take a huge additional infusion of progressive expertise at EOIR, DHS, HHS, and throughout Government to get immigration and refugee policy under control. 

GOP Administrations have proved willing to make the bold, often-criticized personnel and policy moves necessary to carry out a nativist, restrictionist, anti-immigrant agenda. Their “response” to criticism has basically been: “We’re in power, you’re not! So, go pound sand!”

Will the Biden Administration “break the Dem mold” and be bold and visionary enough to make the available, necessary, yet potentially controversial, moves to restore and improve due process and efficiency to the Government immigration bureaucracy? Will Lucas finally be able to get Team Garland to see and realize the cosmic importance of developing a progressive Immigration Judiciary: One that will eventually provide the “Article III ready” judicial candidates who will bring balance and quality to the Article III system perverted by four years of Trump-McConnell extremest right-wing, ideological, far out of the mainstream, judicial picks? Contrary to the timid, ineffective, ultimately destructive Obama Administration approach, EOIR is “a boat that needs to be rocked” — big time!

It’s an ambitious task to be sure. But, those with the vision and courage to accomplish it might well go down in history as the saviors of  American democracy. It’s that important!

The Biden administration looks very different from Trump’s.  That much is clear.

In that vein, Hamed Aleaziz for BuzzFeed reports that

“Ur Jaddou will become the first woman and first person of Arab and Mexican descent to be sworn in as director of US Citizenship and Immigration Services after the Senate confirmed her nomination on Friday.

The agency has not had a Senate-confirmed leader in more than two years . . . . ”

Secretary of Homeland Security Alejandro N. Mayorkas released this statement on Jaddou’s  confirmation:

“It is my honor to congratulate Ur Mendoza Jaddou on her confirmation as Director of United States Citizenship and Immigration Services.  Ur has two decades of experience in immigration law, policy, and administration.  She will administer our Nation’s immigration system fairly and justly.  As the daughter of hard-working immigrants, Ur understands how immigrant families enrich our country and the challenges they face.  I want to thank the United States Senate for confirming Ur.  I look forward to working closely with her to rebuild and restore trust in our immigration system.”

In announcing Jaddou’s nomination, President Biden offered the following biography:

“Ur Mendoza Jaddou has two decades of experience in immigration law, policy, and administration.  Most recently, she was the Director of DHS Watch, a project of America’s Voice, where she shined a light on immigration policies and administration that failed to adhere to basic principles of good governance, transparency, and accountability.  She is an adjunct professor of law at American University, Washington College of Law and counsel at Potomac Law Group, PLLC.  Previously, Jaddou was the Chief Counsel for U.S. Citizenship and Immigration Services (USCIS) . . . from June 2014 to January 2017.  Jaddou’s experience on immigration policy began as counsel to U.S. House of Representative Zoe Lofgren (2002-2007) and later as Chief Counsel to the House Immigration Subcommittee chaired by Rep. Great choice, and congrats to Ur! 

USCIS was one of the “major victims” of the Trump immigration kakistocracy! Overt xenophobia and malicious incompetence literally “bankrupted” what was once one of the USG’s few self-supporting and “money making” operations. Think about that the next time some GOP “magamoron” babbles on about “fiscal responsibility!” 

Wonderful as this news is, Ur would have been even better as Director of EOIR or BIA Chair. THAT’S where the real “progressive leadership gap” and absence of “practical scholarship and experience in understanding and respecting the rights of migrants” is so glaring and debilitating. Also, I think that without better qualified, enlightened, progressive leadership at EOIR (or Article 1) many “reforms” at USCIS will be ineffective or not achieve their full potential.

For example, the Asylum Offices are a key component of USCIS. But the lousy guidance and precedent setting from past AGs and the BIA has severely limited the ability of the Asylum Office to achieve its full potential.

Perhaps, working together, they can get the attention of Garland, Monaco, Gupta, and Clarke and successfully urge some long overdue progressive, due-process-oriented changes and better judicial appointments at EOIR.

Should be a great panel from two real experts from the NDPA! 

Sadly, however, it’s not clear that Judge Garland, Lisa Monaco, Vanita Gupta, Kristen Clarke, and others who are supposed to be fixing the dysfunction will be among the audience. Nor do I see much concrete evidence that they have established a meaningful dialogue with those, like Amiena and Julia, who have the expertise and creative problem solving ability to fix the DOJ’s embarrassingly broken “courts” before more migrants and their attorneys are abused.

In my view, and the view of many others, the “destructive phase” of the last four years moved much more rapidly and with more purpose than the “reconstructive and improvement phase” that was promised by the Biden Administration.

There are still far too many of those who were “part of the problem” in key positions, and far, far too few, if any, dynamic new faces who have been brought in (or promoted from within) with the capability and the mandate to fix the mess, establish progressive values, and return to a due process/fundamental fairness/best practices focus!

There are “reliable rumors” of some better appointments in the offing. But, it hasn’t happened till it happens.

President Biden’s top advisers promise “long-needed systemic reforms” to address a backlog of more than 1 million asylum cases in the immigration court system, which often keeps people applying for asylum waiting years to resolve their cases. That could mean some big changes to how asylum cases are processed at the southern border.

The plan the Biden administration is considering to speed up the process would take some asylum cases from the southern border out of the hands of the overloaded immigration courts under the Department of Justice and instead handle them under the purview of the Department of Homeland Security, where asylum officers already process tens of thousands of cases a year, two people familiar with the discussions who were not authorized to speak about administration plans told NPR exclusively.

Those familiar with the discussions say one outcome could be discouraging unauthorized migration. That’s because those who can argue for a certain fear of persecution are able to gain temporary residence and often a work permit as they wait out their cases.

Advocates say they welcome a more efficient system, provided changes are not used as a way to expedite removals as the Trump administration did.

Eleanor Acer of Human Rights First says there are a host of reasons to allow asylum officers to conduct the first set of interviews and reduce the numbers, but she says it’s important that applicants have a chance to appeal to the court before being removed.

“The massive backlog must be dealt with,” she said. “But the answer to that problem is not to deprive asylum seekers of due process and a fair hearing, or to weaponize the asylum process to try to deter other people from seeking U.S. protection.”

The Biden administration has already ended two of the Trump administration’s programs, the Prompt Asylum Case Review and the Humanitarian Asylum Review Program, that were designed to quickly return Mexican and Central American asylum seekers suspected of having invalid claims.

House Passes 2 Bills Aimed At Overhauling The Immigration System

Department of Homeland Security officials declined to discuss plans to shift border cases to the asylum division.

But an administration official said last week they are now working on a number of policies and regulations to create “a better functioning asylum system.”

That includes establishing refugee processing in the region and strengthening other countries’ asylum systems.

Biden also resurrected the Central American Minors program that reunited children with parents who are in the United States legally.

The Biden administration is now seeking to “pick up the pieces” after the Trump administration, with a different set of policies that abide by U.S. law but also international obligations, Meissner said.

“We need to have access to asylum,” Meissner said, “but it needs to be done in a way that can be prompt and fair, not in a way that leads to waits of years and years and court backlogs.

Why it could work:

  • Granting relief at the lowest level of the system is cost effective;
  • It’s easier to hire, train, and assign Asylum Officers than Immigration Judges;
  • Immigration Court time should be reserved for those cases where there is a real issue as to whether relief can be granted.

Why it probably won’t work:

  • Leadership is critical. Right now, there are only a few experts in government with the knowledge, proven leadership ability, organizational skills, and courage to lead this program. 
    • Two obvious names that come to mind are Judge A. Ashley Tabaddor, currently USCIS Chief Counsel, and Judge Dana Leigh Marks, one of the “founding mothers” of U.S. asylum law and pioneer of the well-founded fear standard. Both are past Presidents of the NAIJ. Neither has yet been tapped for this assignment.
    • By contrast, there are a number of experts in the private/NGO sector who could lead this effort. Obvious choices would be Judge Paul Grussendorf, former Immigration Judge, Asylum Officer, UN Representative, and professor; Professor Karen Musalo, Director, Center for Refugee & Gender Studies, UC Hastings Law; Eleanor Acer, Senior Director, Refugee Protection, Human Rights First (quoted in this article); Professor Michele Pistone, Creator and Founder of the VIISTA asylum training program at Villanova Law; Professor Phil Schrag, Co-Director of the CALS Asylum Clinic at Georgetown Law and author of Baby Jails and the upcoming release The End of Asylum; Michelle Mendez, Director, Defending Vulnerable Populations at CLINIC; or Judge Ilyce Shugall of our Round Table. But, nobody of that caliber has been tapped either. 
    • Without creative, dynamic, expert leadership, and a different approach to personnel, the program will be yet another bureaucratic failure. In case nobody has noticed, after four years of never ending abuse, gross mismanagement, and intentional misdirection by the Trump kakistocracy, the USCIS Asylum & Refugee program is also in shambles — demoralized, disorganized, leaderless, incredibly backlogged. An obvious untapped source is retired Asylum Officers and Adjudicators who could be brought back on a limited-term basis, intensively trained by experts from a “Better EOIR,” and who often are in a position to travel frequently and on short notice.
  • It’s not about deterrence. Already, this article speaks of “possible deterrent effect.” WRONG! The purpose of an asylum adjudication system is to provide fair, timely, generous adjudications of asylum eligibility in accordance with the letter and spirit of the Refugee Act of 1980, the U.N. Convention and Protocol on which it is based, and the due process clause of our Constitution. We have never had such a system, which inevitably would be more orderly and efficient, but also result in many more grants. 
    • The main reason why we don’t currently have a functioning asylum system, and never have had the system that asylum seekers need and deserve, is that the system is at the mercy of a bogus Executive-controlled “court” system that time and time again has been compromised by politicos seeking who use it as an enforcement tool rather than an independent court of justice. 
      • In 2014, the last year that I taught Refugee Law & Policy at Georgetown Law I “graded” the U.S. Asylum system at “B-.” Not as good as it should be, but not as bad as it could be. 
      • Now I’d give it an “F.” Completely dysfunctional, highly arbitrary, and a tool of institutionalized racism and White Nationalism.
    • The system is ineffective as a deterrent. There is no known basis to believe that quick and often arbitrary and wrongful “rejections” are an effective deterrent. That’s particularly true because rejections are seldom explained in a reasonable, understandable manner. So, to the extent that there is a “message” it’s that you got the wrong officer or the wrong judge on the wrong day or that the U.S. legal system is inherently unfair and should be avoided by hiring a smuggler to get you to the interior of the U.S. where, as a practical matter, you have a better chance of obtaining “de facto refuge.” 
    • The only “efficiency and leverage” that comes from the Asylum Officer system is in quickly identifying and consistently granting a substantial number of applications. That, and only that, does actually relieve the Immigration Court system of unnecessary cases. Otherwise, “non-grants” still have to go to the Immigration Courts for de novo review. I probably granted the majority of asylum cases “referred” from the Asylum Office. That leaves plenty of room to believe that a better trained and operated system with some positive guidance and effective supervision by better Immigration Judges and a truly expert BIA would achieve substantially higher grant rates and higher efficiency at the Asylum Office, thereby keeping many cases out of court and speeding the process for asylees to obtain permanent residence and eventually U.S. citizenship!
  • Some assumptions appear invalid. This article also repeats the unproven assumption that a fair, just, and efficient asylum system would result in rejection of the majority of cases. I doubt that. 
    • Prior to the Trump disaster, approximately 75-80% of asylum applicants at the Southern Border passed “credible fear.” That the majority of them never achieved asylum was due less to the lack of merit in their claims than to factors such as: 1) lack of a system to match asylum seekers with qualified counsel; 2) wrong-headed anti-asylum precedents from the BIA that were specifically directed against asylum seekers from Latin America — basically institutionalized racism in the guise of “enforcement;” 3) poor selection, training, and motivation of Immigration Judges some of whom simply did not treat asylum seekers fairly, nor were they given any incentive to do so. 
    • I granted asylum or other protection to many refugees from the Northern Triangle. I probably could have granted twice that number had the BIA precedents actually fairly and reasonably interpreted asylum law to specifically cover gender-based claims and claims arising from persecution by gangs basically operating “in lieu of government authorities” in most of the Northern Triangle.
    • Additionally, an honest interpretation of the CAT by the BIA would have allowed life-saving protection to be extended to many others who lacked nexus but had a high probability of torture with Government acquiescence upon return. I believe that a return to the original Acosta-Kasinga line of asylum analysis and adoption of proper CAT interpretations along the lines set forth by the (exiled) dissenting judges in Matter of J-E- would result in grants of some type of protection (asylum, withholding, or CAT) in the majority of Southern Border cases coming from the Northern Triangle that passed credible fear or reasonable fear.
    • Asylum, along with refugee status, is a key form of legal immigration to the U.S. There is absolutely nothing wrong with that. It’s NOT a “loophole.” It’s the law! Studies by groups of experts such as CMS have shown the huge benefits that refugees confer on the U.S. I have no reason to believe that asylum seekers as a group are any different. 
    • As long as we keep treating the reality of human migration and the strengths and humanity of asylum seekers as a negative rather than a positive, we will continue to fail, as we have for decades, to fully comply with either our own laws or international conventions.
  • A broken, dysfunctional, unfair EOIR will continue to drag American justice down. There must be de novo review of denials by EOIR and far, far more competent review and direction in the review of credible fear denials by EOIR. A better BIA could actually set binding precedents on “credible fear” and “reasonable fear.”
    • Currently, EOIR is incapable of producing either consistently fair results (particularly for asylum seekers) or the inspired legal scholarship and leadership for the asylum system to be functional and held accountable. It’s going to require all new leadership, an all new BIA, elimination of all of the Trump-era  precedents that impede fairness for asylum seekers, new merit-based selection criteria for Immigration Judges, professional administration from judicial experts, and an immediate slashing of the largely self-created “backlog” of 1.3 million cases by closing and removing from the docket every case more than a year old that doesn’t relate to a priority (most are folks who would be covered by Biden’s legalization program anyway; many are eligible for relief that USCIS could grant) to get EOIR in a position to provide the necessary legal guidance and system accountability for the Asylum Office. The absurdist notion that we could or would want to remove every one of the 10-11 million undocumented residents (many performing essential services that propped us up through the pandemic) is one of the “big lies” that has prevented rational reforms of our immigration system.
    • In plain terms, EOIR needs an immediate “rebuild” with a new progressive, humanitarian judiciary of experts. There is no early indication that Judge Garland either understands that “mission-critical” need or has a plan for achieving it. 

As we say in the business the “devil is in the details.” Right now, I can see neither the details nor the leadership in place or “in the pipeline” to solve the debilitating problems in our asylum system that actually are undermining the entire U.S. justice system.

Biden could fix it. But, I wouldn’t count on it. That means that the only real fix in the offing will be for the NDPA to force the Administration to “get it right” through aggressive, never-ending litigation as well as continuing to seek better legislators. Highly inefficient. Yet, sometimes it’s the only way to get the attention of those in power.

If nothing else, we’ll continue to make an important historic record of the cruelty and stupidity with which the current asylum system is being administered. It doesn’t have to be this way. We can always choose to follow our “better angels.” It just takes the courage and the good judgement to get the right folks in the right jobs to make it happen.

The union is hopeful that President Biden will reverse the decision, but they have yet to see action. “I know the new administration is extremely busy; I think this is a very important and significant issue,” said Paul Shearon, president of the International Federation of Professional and Technical Engineers, a union that represents many high-skilled federal employees.

As the administration begins to process asylum seekers in the “Remain in Mexico” program and otherwise roll back Trump’s asylum blockades, the court system will need to run efficiently and fairly. As it is, the immigration court backlog—largely created by Trump policies—is at 1.3 million cases.

Trump’s decertification of NAIJ “was to retaliate against NAIJ for our strong voice and our strong call to demand transparency and accountability,” said Amiena Khan, NAIJ president. The union’s previous president, A. Ashley Tabaddor, is now chief counsel at U.S. Citizenship and Immigration Services. The union is hopeful that Biden will take action, though nothing has yet been forthcoming.

“We are very supportive of the current Biden administration and appreciate his strong support for unions and collective bargaining,” said Khan.

Biden’s position on unions in other contexts has been clear. Some labor historians have said he is the most pro-labor president in their lifetimes. In an executive order in January, Biden directed the Office of Personnel Management to make recommendations concerning raising the minimum wage for federal employees to $15 per hour. In February, Biden voiced support for Amazon workers’ right to organize, an unprecedented level of support from a sitting president.

Almost immediately, the immigration judges’ union asked if he would follow up by voluntarily recognizing their union. No action has been taken. A White House spokesperson has not yet responded to a request for comment.

Merrick Garland has now been confirmed as attorney general, perhaps setting the stage for quicker movement. But the union says that, despite immigration judges being part of the Justice Department, an attorney general appointment isn’t needed to reverse the decision. The administration can voluntarily recognize the union.

Over the last four years, the NAIJ was was one of the few “inside sources” of truth about the Trump Administration’s misconduct and gross mismanagement — “malicious incompetence”  at the DOJ. Obviously, in the Trump Administration speaking truth to power was a punishable offense. NAIJ was no exception.

This union representing Immigration Judges was illegally “decertified” in an absurd decision by the FLRA finding that IJs were now “management officials” on the basis of actions that had reduced them to little more than “deportation clerks” carrying out the regime’s White Nationalist, xenophobic agenda. 

Not only did IJs continue to have no control whatsoever over their staff and working conditions, but they were unceremoniously stripped of their already-limited authority to professionally manage their dockets and to exercise independent discretion. They were subjected to due-process-killing “deportation quotas” and bogus “performance evaluations” by unqualified and largely out of touch “supervisors” —  few, if any, of whom handled full dockets themselves — that would have been more suited to entry level deportation officers than supposedly independent and impartial “judges.” Meanwhile, the real primary cause of uncontrollable backlogs and endless delays at EOIR  — “Aimless Docket Reshuffling” by politicos at EOIR HQ and the DOJ, and horrible, anti-due process, out of touch with reality “precedents” by biased AGs and the BIA —  continued unabated.

Always subject to control by their “handlers” at EOIR HQ and DOJ, IJs were further humiliated by being barred from teaching at professional seminars and writing for scholarly publications. Their dockets and roles were defined by highly unqualified politicos who had never presided at an immigration hearing in their careers! Talk about screwed up! 

Who ever heard of a “judiciary” that operates like a totally dysfunctional bureaucratic agency — that has most recently been run by non-judicial personnel who lack expertise, experience, and a commitment to due process — but were focused on carrying out an overtly anti-immigrant, anti-human rights, anti-due-process White Nationalist political agenda!

To add to this outrageously politically-biased scenario, to reach its ludicrous result the FLRA had to steamroll both their prior precedent on the same issues and overrule the decision of their own Regional Director. 

Presently, the NAIJ is the only organization providing due-process oriented training directly to Immigration Judges. The leadership of the NAIJ stand out as some of the most qualified, courageous, and talented judges on the immigration bench.

Judge Garland and the Biden Administration simply can’t afford to leave the NAIJ out in the cold if they intend to fix the now totally-screwed-up EOIR and bring constitutionally-required equal justice under law to the broken and reeling DOJ. You simply can’t promote racial justice in America while running a “court” that has institutionalized racial biases and mocks, tramples, and ignores due process and equal justice on a daily basis!

That is why the Justice Department must also identify categories of non priority immigration court cases that can be dismissed now. One obvious category is the estimated 460,000 cases — an astounding 37 percent of the current backlog — that involve individuals who could qualify, under current law, for legal status. It makes little sense to waste limited enforcement resources by having immigration prosecutors and judges spend years trying these cases in court, when trained adjudicators at another agency, U.S. Citizenship and Immigration Services, can handle them more efficiently through paper applications.

Another category of cases that should be removed from judges’ dockets are the 200,000 cases that have been pending for more than five years. By definition, these old cases are ones that prosecutors and judges have deemed low priorities.

Biden has noted that the Obama administration “took too long” to begin fixing the nation’s immigration system. His initial steps are a promising indication that he intends to move swiftly to build the fair, humane and functional immigration enforcement system he has promised. To guarantee results, the new president must use his first 100 days to identify and remove the non priority cases bottlenecked in America’s immigration courts.

Presto: 1.3 million million docket becomes 640,000. And that’s just the beginning!

Here are some more low-budget, immediate action “No-Brainers:”

  • Vacate all of the anti-asylum, backlog expanding “precedents” issued by Sessions, Whitaker, Barr, and the BIA over the past four years (immediately returning needed flexibility and some degree of fairness to the system);
  • Reassign the current BIA and replace with expert judges committed to due process who know how to grant asylum and establish precedents on how “clear grants” can be easily identified, properly documented, and consistently adjudicated (eliminate “refugee roulette” — largely a product of an “any reason to deny culture” combined with defective judicial selection, poor training, and lousy leadership);
  • Return all asylum cases denied over the past four years to the USCIS Asylum Office for adjudication without all the anti-asylum precedents and dehumanizing policies of the Trump regime; 
  • Work with the private bar and NGOs to increase representation with universal representation as the goal; 
  • Eliminate inane and demeaning “production quotas” for EOIR judges (thus placing the emphasis back on careful decision making, thoughtful analysis, and getting the correct result the first time — also restoring IJs’ ability to schedule and manage dockets).

Realistically, 500 Immigration Judges can complete approximately 250,000 to 300,000 cases annually. A combination of 1) the “Chen-Markowitz plan;” 2) the “Schmidt Addendum;” and 3) the more sensible and realistic enforcement priorities initiative already underway at DHS will have EOIR “operating in real time” (and, significantly, in the national interest) in no time at all — without legislation or busting anyone’s budget!

Of course, these initial steps are just the “tip of the iceberg” of the reforms necessary at EOIR, leading to the fulfillment of the vision of “through teamwork and innovation becoming the world’s best tribunals guaranteeing fairness and due process for all.” Congress must at the earliest opportunity create an independent Article I Immigration Court to institutionalize and preserve these reforms and “best practices.” 

But, in the meantime, lives and our national interests are imperiled by the current deadly (and wasteful) dysfunction @ EOIR. There is every reason to fix the system now! And, it’s not “rocket science” — just expertise and common sense.

Which leads me to another obvious point — Members of the NDPA like Chen, Markowitz, Dean Kevin Johnson, Michelle Mendez, Associate Dean Professor Jaya-Ramji Nogales, Professor Phil Schrag, Professor Michele Pistone, up and coming all-star Lauren Wyatt, Judge Dana Marks and other leaders of the NAIJ, experienced due process oriented Immigration Judges like my former BIA colleague Judge Noel Brennan, and many others like them should be in charge of this effort to reform EOIR and create a model court system. 

The Biden Administration must apply the same principles to EOIR Reform that they have elsewhere: Get rid of the “middlemen” and  “bring in the experts” to run the show! Articles, papers, speeches, TV interviews, encounter groups, studies, and blogs are great — but putting the right folks in the right places to take action to solve problems is much better and more efficient! Put the folks with the answers in charge!

That would not only create a “laboratory of best judicial practices” that could be applied to the floundering Article III Judiciary, but also would provide the Biden Administration with source of well-trained progressive candidates for the Article III Judiciary. Leadership, including “leading by example” is critical in any well-functioning judicial system; it has been sorely lacking at EOIR (and in the Article III Judiciary) over the past four years. As the Biden Administration has already recognized, the only real leadership among the Federal Judiciary has come from “resistors” like Judge Ashley Tabaddor, now at USCIS.

Incidentally, in her current position at USCIS, Judge Tabaddor is perfectly placed to work with EOIR in carrying out the “Chen-Markowitz plan” to get cases of those potentially eligible for residence out of the EOIR backlog and into USCIS where they can be handled more efficiently.

To state the obvious, EOIR needs more “headquarters personnel” like a hole in the head! What you need is a streamlined staff of better-qualified individuals across the board: real judges and professional judicial administrators who will restore due process and get this system functioning again — sooner rather than later.

Additionally, the current Deputy Director Carl C. Consequently, there is no apparent need for additional “counsel” in his office right now. To say the least, this ill-timed “example of the “Continuing Clown Show at EOIR”🤡 has already become a “internet mini-sensation!” At the very least, you should wait until Risch’s replacement arrives and let her or him make the selection.

Undoubtedly, a reformed IJ tenure program (considering not only discipline but also retention of current judges and improved professional training) that is transparent, fair, and effective is a badly needed and long overdue improvement. But, hiring another bureaucrat (on short notice, which is likely to produce a less than “best qualified” candidate) isn’t the answer.

That being said, I’ve already heard from a number of private practitioners who would love to be in charge of “professional responsibility for Immigration Judges.” They have lots of great ideas for improvements and a number of places where they would start the process immediately, if not sooner!

WASHINGTON — When President Biden swore in a batch of recruits for his new administration in a teleconferenced ceremony late last week, it looked like the country’s biggest Zoom call. In fact, Mr. Biden was installing roughly 1,000 high-level officials in about a quarter of all of the available political appointee jobs in the federal government.

At the same time, a far less visible transition was taking place: the quiet dismissal of holdovers from the Trump administration, who have been asked to clean out their offices immediately, whatever the eventual legal consequences.

If there has been a single defining feature of the first week of the Biden administration, it has been the blistering pace at which the new president has put his mark on what President Donald J. Trump dismissed as the hostile “Deep State” and tried so hard to dismantle.

From the Pentagon, where 20 senior officials were ready to move in days before the Senate confirmed Lloyd J. Austin III as defense secretary, to the Voice of America, where the Trump-appointed leadership was replaced hours after the inauguration, the Biden team arrived in Washington not only with plans for each department and agency, but the spreadsheets detailing who would carry them out.

A replacement was even in the works for the president’s doctor: Dr. Sean P. Conley, who admitted to providing a rosy, no-big-deal description of Mr. Trump’s Covid-19 symptoms last year, was told to pack his medical kit. While all presidents eventually bring in their own doctor, Mr. Biden wasted no time bringing back a retired Army colonel, Dr. Kevin O’Connor, who was his doctor when he was vice president.

Mr. Biden had named nearly all of his cabinet secretaries and their immediate deputies before he took office last Wednesday, most of them familiar faces from the Obama administration. But the president’s real grasp on the levers of power has come several layers down.

Ashley Tabaddor, a constant critic of the Trump administration as the former head of the union that represents immigration judges, will take over as chief counsel at U.S. Citizenship and Immigration Services, the federal legal immigration agency.

At the Justice Department — where morale was largely decimated and Biden administration officials are eager to begin reversing Trump policies on civil rights, immigration and police oversight — all of the department’s top incoming acting department heads are alumni, some of whom worked under multiple administrations.

Until Judge Merrick B. Garland is confirmed as attorney general, Monty Wilkinson, a longtime career employee who worked closely with Eric H. Holder Jr. when he was attorney general, is serving in an acting capacity.

The acting deputy attorney general is John P. Carlin, who ran the national security division of the Justice Department during the Obama administration. He is holding the office only until Lisa Monaco, who has worked closely with Mr. Carlin over the years, can be confirmed as deputy attorney general. She served as homeland security adviser under Mr. Obama and, during the Trump years, she and Mr. Carlin ran a group studying the hardest issues in cyberpolicy.

Much as the politicization of the Justice Department angered Mr. Trump’s critics, the neutering of the Environmental Protection Agency prompted outrage from progressives, and it is probably no surprise that the agency is already in the throes of transformation.

Trump spent his first week in office spouting lies about the size of his inauguration crowd and launching a White Nationalist assault on Muslim refugees. Biden came in with a detailed plan for governing America and is putting it into effect on multiple fronts notwithstanding the crises and absolute mess left behind by the defeated kakistocracy!

The Tabaddor appointment is a powerful signal to civil servants who stand up for their rights and the rights of others. Judge Tabaddor undoubtedly is one of the most talented, dynamic, and capable leaders at any level of the Federal Judiciary. But, that didn’t protect her from the DOJ/EOIR bureaucracy.

Judge Tabaddor was bullied by EOIR management during the Obama Administration because she had been recognized as an outstanding Iranian American. During the Trump regime, she led the effort of the National Association of Immigration Judges (“NAIJ”) to expose bias and political interference with judicial functions, gross mismanagement, disregard for due process, and suppression of First Amendment free speech by the DOJ/EOIR kakistocracy.

“Billy the Bigot” Barr & his toady McHenry punished the NAIJ by filing to “decertify” the union — a move to silence Judge Tabaddor and her her colleagues and deflect Congressional attention from the ongoing chaos and dysfunction the Trump DOJ had created in the Immigration Courts. 

Apparently, somebody on the Biden Team was paying attention to this travesty, recognized the grotesque abuses going on at the EOIR Clown Show🤡, and the courage and leadership shown by Judge Tabaddor in the battle for integrity and  “good government.”

So far, so good. Looks like the “EOIR Clown Show”  🤡 is finally “going to go” and be replaced with real judges and pros in judicial administration who will refashion it into a real, functioning, due-process-oriented, model court system that will compliment the legislative initiative to create an independent Article I U.S. Immigration Court of which we all can be proud.

McHenry informed EOIR employees last Friday that he was returning to his position as an OCAHO Administrative Law Judge. Can’t imagine there were too many tears shed, except within the “inner circle” of the “EOIR kakistocracy.”

 

OCAHO has long been viewed as EOIR’s “Siberia equivalent” and has been used to “exile” other “out of favor” Senior Execs in the past (ironically including King). Given OCAHO’s traditionally rather limited docket, it appears that McHenry’s ability to further damage our justice system and demean humanity will be restricted.

 

Notably, he was appointed Director by former Attorney General and notorious child abuser Jeff “Gonzo Apocalypto” Sessions without any known qualifications to manage one of America’s largest, most important, and totally screwed-up court systems. Over his four-year tenure, he proved to be every bit as unqualified for the job as his embarrassingly-thin resume originally suggested he would be.

He was part of the remarkably unqualified aptly-named “Atlanta Mafia” at EOIR. They degraded justice and humanity in equal portions as part of their nativist crusade to expand the “Atlanta Asylum Free Zone” nationwide. Basically, only the courageous hard work of talented immigration advocates stopped their nefarious program from reaching its objective, although that’s not to minimize in any way the lasting damage they did to our legal system and human lives.

Among McHenry’s many negative achievements was driving already-low EOIR morale and poor working conditions to depths never before seen or imagined. And, that was for his own employees! Imagine what it was like for foreign nationals and their courageous, determined, yet beleaguered attorneys consigned to this “hell on earth” specially designed to chew up lives and degrade humanity as part of as vile “strategy” to use “courts as deterrents” to those with audacity to seek justice in America.

 

Jean King, by contrast, is an experienced public servant known for her commitment to due process, fundamental fairness, sound scholarship, ethical standards (something that has “gone AWOL” at the DOJ over the past four years), and the “lost art of good government” which the Biden-Harris Administration appears committed to re-establishing.

 

Jean served on the on the BIA staff when I was Chair. She advanced in EOIR during the tenure of the late Juan Osuna as BIA Chair and then Director. She reportedly chose “exile to OCAHO” after she refused as General Counsel to “go along get along” with some of McHenry’s more outrageously illegal regulatory/administrative moves. He also retaliated by cutting the authority of the OGC and assigning it instead to his bogus “Office of Policy.” (Talk about “fraud, waste, and abuse” of government resources –- while the Immigration Courts lacked, and still lack, a functioning e-filing system, McHenry found time and resources for shenanigans like this, obscene “Immigration Judge dashboards,” and pursuing “decertification” of the NAIJ which had “blown the whistle” on his “maliciously incompetent” management!)

 

McHenry’s continuing presence as Director following the inauguration and his “in your face audacity” in issuing memos attempting to define “judicial independence” as obedience to the White Nationalist restrictionist agenda he had been implementing rightly drew outrage from all immigration experts who understand the ongoing contempt for due process and abuses of humanity that have somehow become “institutionalized” as “acceptable behavior” at EOIR during the last four years. https://www.politico.com/news/2021/01/27/biden-replaces-immigration-court-463053

 

 

If nothing else, Jean King should be able to stop the flood of illegal regulations, false and misleading policy memos and bogus “fact sheets,” and further deterioration of due process until “Team Garland” gets its “EOIR Reform Group” in place.

 

All of us who care about American justice and due process should be heartened that somebody on the Biden Team is aware of the due process disaster at EOIR, has taken bold, decisive action, and apparently plans to fix it, sooner rather than later!

As the Migration Policy Institute has shown, the Trump-era changes to the immigration system numbered in the hundreds and consisted of dramatic reinterpretations of the laws alongside seemingly clerical changes, such as revised application forms for visas, higher fees and tighter deadlines in immigration courts — all to advance a maximalist enforcement agenda and slow down the ordinary gears of immigrant admissions. High-level White House advisers, working with knowledgeable allies in the Homeland Security and Justice departments, pushed out regulation after regulation to render asylum laws more restrictive and make it harder for noncitizens to present their case in immigration courts. Trump’s attorneys general exerted unprecedented authority to define asylum laws to severely limit claims by victims of domestic and gang violence, and to constrain immigration judges’ ability to grant relief and manage their dockets in a way that provides a semblance of due process.

And yet, the new administration’s policy agenda will not be complete unless legislative proposals are accompanied by concerted executive action across the administrative state, and not just because ambitious legislation on any issue faces an uphill climb in a Senate with the narrowest of Democratic majorities. Even when it comes to pass, legislation emerges from a bargain, leaving issues unaddressed, introducing new concepts to be interpreted and creating new programs that demand administration. Changing the direction of our government requires not only executive vision, but also multilayered strategies that make their way through the bureaucracy and down to the ground — along with the stamina and patience to see them through.

Read Cristina’s complete article at the link. The book that she and Adam Cox wrote The President and Immigration Law along with that of my friend and colleague Professor Phil Schrag, Baby Jails, should be required reading for all incoming Biden-Harris officials.

A “democracy” that doesn’t understand how it came to run prisons for vulnerable kids and star chambers for legal asylum seekers, and how to end them immediately, can expect little success in achieving social justice, promoting economic equality and prosperity for all, or leading and advocating for democracy abroad. 

It all starts with immigration. I can draw a straight line from the Muslim Ban, to the Roberts’ Court’s disgraceful and cowardly abdication of responsibility to stop it in its tracks (grotesquely undermining the many lower court Federal Judges who had courageously “mapped it out for them”), to GOP politicos running around undermining our free and fair elections, to “magamorons” and other traitor/crazies storming the Capitol. Folks “get” the abdication of moral responsibility and legal accountability when it is delivered by those who should be standing up for democracy.

The failure of career civil servants at all levels to “just say no” and rebel against these outrageous failures of Constitutional governance and simple human decency, combined with a horribly deficient Supremes’ majority that abandoned both legal legitimacy and moral leadership, created a beyond dangerous pattern that came very close to toppling two centuries of the “democratic experiment” and still has the future of our democratic republic “on the ropes.” 

Just look at what happened at the DOJ in the final weeks of the regime! Government officials who knew better settled for “heading off” a President’s treasonous acts rather than exposing them to the public, the Vice President, and leaders of Congress (perhaps other than treacherous co-conspirator Kevin McCarthy) who could have taken action for the immediate removal of this “clear and present threat” to our national security from the office for which he was so completely unqualified. Who knows, they might even have stopped the insurrection!

Look at the failed and ethically vapid Solicitor General’s Office (once, but no longer, one of the “Jewels in the Crown” of Government) that time and time again moved forward to defend unethical and unconstitutional policies before a willing Supremes’ majority based on patently false narratives and obvious pretexts (not very convincingly) concealing the overt racist, White Nationalist agenda of Trump, Miller, and the other neo-Nazis who had seized control of large portions of our governing machinery. Who, with the disgraceful complicity of the Supremes, turned American asylum law from the life-saving humanitarian refuge it was intended to be to instead an ugly weapon of racism, xenophobia, misogyny, child abuse, death, torture, unjust imprisonment, and overall dehumanization of the most vulnerable among us! What’s wrong with this picture? Everything!

Checks and balances and the courage and integrity of a professional career civil service are supposed to halt abuses like this, even in the face of failure of one of our two major political parties and our highest Court to act with integrity and adhere to democratic norms! But, with a few exceptions, courageous folks like U.S. Immigration Judge Ashley Tabaddor, Col. Alexander Vindman, and others like them, it did not happen over the past four years. That nearly cost us our country! (Note that Tabaddor, Vindmin, and others like them were punished, with the disgraceful treasonists from the GOP looking on and actually cheerleading, for speaking out and upholding their oaths of office.) 

Buried in the carnage of the departed regime are the many lives unnecessarily lost, futures ruined, and lasting trauma — trauma that will continue to adversely affect our nation far into the future — caused by failure to stop the kakistocracy’s unconstitutional, cruel, and inhuman abuses. From intentionally inept COVID policies, to “politicizing” masks, to deaths in detention, to unlawful deportations to torture, to unfair, clearly political misapplications of the death penalty (basically “legalized murder”), to officially-sanctioned misogyny — this damage can’t be swept away overnight. 

Like legislative and judicial failures, bureaucratic failure comes at a cost — a huge one! The fact that it might be largely “out of sight, out of mind” to the arrogant, largely white, privileged, ruling elites and ivory tower “High Court” jurists doesn’t mean the harm isn’t real. Just that our society has enabled some in power to look away and avoid meaningful contact with the human wreckage and lasting pain and damage they have caused and or tolerated!

Already, we can see how the Biden-Harris Administration’s inexplicable failure to “take charge” at a broken DOJ is undermining the long-overdue and well-thought-out progressive immigration agenda they announced with such fanfare. Here’s what’s come to light in just the past few days at the broken and dysfunctional DOJ:

  • Seeking the illegal deportation to Haiti of a mentally ill individual denied due process by the EOIR kakistocracy;
  • Failure to repudiate scurrilous, misogynist attacks on well-known refugee woman “Ms. A-B-“ by unqualified then “acting” AG Jeffrey Rosen; 
  • Issuance by the “EOIR Clown Show” of more false narratives and anti-migrant “precedents” — basically delivering the “big, public middle finger” to the new Administration and the AG-designate;
  • Release of a blockbuster investigative report on misogyny and misconduct within the Immigration Judiciary — with no response or plan for corrective action from the DOJ;
  • Appointment of a bunch of bureaucratic nobodies to “caretaker” duties at the DOJ — including one quickly found by reporters — but apparently missed by the incoming Administration — to have had ties to the grotesque child abuse program run by White Nationalist former AG “Gonzo” Sessions;
  • Release by the IG of a report showing the role of Sessions, Rosenstein, and other DOJ officials in “official child abuse” –  without any promise of accountability for past or future misconduct;
  • A treasonous plot by the President, a GOP Congressman, and a corrupt DOJ political hack that, although thwarted, went unreported until uncovered by reporters from The NY Times!

To state the obvious, why weren’t folks with known integrity, courage, and ability — professional decision-makers with track records of upholding our Constitution — like Judge Ashley Tabaddor and her colleagues in the leadership of the National Association of Immigration Judges — put in charge of the DOJ debacle to “ride herd”on this mess, restore some integrity, and prevent any more damage until “Team Garland” arrives? Few folks at Justice know as much about the “inept DOJ bureaucracy and failure of justice at Justice” than the NAIJ leadership which has been “at war” with the kakistocracy for years!

The solutions are still out there. But, it will take boldness, courage, and some “quick thinking outside the box” by “Team Garland” to get this completely (and unnecessarily) unacceptable situation under control!

That begins with an immediate clean-up of the “immigration kakistocracy/bureaucracy” throughout Justice — starting with the “EOIR Clown Shown.” Bring in the immigration/human rights/due process experts and let them start fixing the problems! 

Stop defending the unprofessional garbage being aimlessly tossed into the Federal Courts by the EOIR White Nationalist deportation factory still running under orders from Miller and Hamilton. Have all these cases reviewed by experts in immigration/human rights/due process and racial justice! 

Fire anyone in the SG’s office who presents bogus arguments concerning fake “immigration emergencies” and illegally promulgated “regulations” to the Supremes. End the unethical practice of using one-sided “precedents” to develop anti-immigrant “litigating positions” for OIL. 

Stop appointing unqualified individuals to precious Immigration Judgeships. Remove the entire BIA and replace it with real expert appellate judges unswervingly committed to fundamental fairness and due process for all. Replace “worst practices” with “best practices.” Stop the “Aimless Docket Reshuffling” at EOIR. Cut the largely self-created Immigration Court “backlog.”

Bring in Professor Rodriguez, Professor Schrag, Professor Ingrid Eagly, Judge Dana Marks (who argued and won the landmark Cardoza-Fonseca case before the Supremes), Judge (and former BIA Judge and high-ranking DOJ official) Noel Brennan, Judge Amiena Khan, Judge Mimi Tsankov, Marielena Hincapie (NCIJ), Dean Kevin Johnson (UC Davis Law), and a “due process brain trust” of others like them! Let them start “kicking some tail,” fixing the problems, and restoring sanity, humanity, and due process to the broken immigration kakistocracy at DOJ. Now, before any more lives are lost or futures irrevocably ruined! 

Let “practical scholars” like Rodriguez, Schrag, Eagly, and Johnson “turn their research and great thoughts into action.” “A little less talk, and a lot more action,” as Toby Keith would say!

The NDPA has already shown that it can out-litigate and out-strategize the Government immigration kakistocracy. In many ways, only the abject failure of the Supremes’ majority to stand up for the Constitution, rule of law, and human decency has prevented the NDPA from completely annihilating the kakistocracy, wiping out all of its misdeeds by judicial decree, and perhaps even holding criminals like Miller and Wolf accountable for their “crimes against humanity.” 

Judge Garland is a smart person. The “smart thing” would be to get the “NDPA on the inside at Justice,” creating order from chaos and re-establishing justice @ Justice now! 

Otherwise, smart or not, he’s likely to spend the bulk of his tenure as a “caption” on the never-ending avalanche of new legal actions filed against the deadly immigration bureaucracy by the NDPA. Because, I promise that the fight for due process in immigration and human rights isn’t over! It has just begun! 

There is lots to be gained by working together to solve these problems. But if it takes litigation, continuing conflict, and a never-ending political and press crusade against an Administration I otherwise support to get the job done, so be it!

The battle isn’t over until the kakistocracy is removed, at every level, and due process, fundamental fairness, equal justice, and respect for human dignity — all both Constitutional and human rights — become a reality for all persons in America (including those physically present at our borders) rather than just the cruel, unfulfilled promises they have been to date.

Tal Kopan of the SF Chronicle confirmed on Twitter that Judge A. Ashley Tabaddor will be leaving the Immigration Court and NAIJ for a policy position at USCIS. Sources say that she will become the Chief Counsel @ USCIS.

Judge Tabaddor is a friend, colleague, and one of the brightest shining stars 🌟 of the Federal Judiciary at any level. She led the NAIJ during the scurrilous attack on judicial independence and First Amendment rights carried out by the Trump kakistocracy and a corrupt, politically-motivated FLRA. She is an example of the dynamic, fearless, due-process leadership that has been sadly lacking in the Federal Judiciary as a whole, particularly during the past four years of the Trump regime’s unrelenting attack on our democracy.

Judge Tabaddor’s appointment is also a recognition of those who fought and resisted the EOIR kakistocracy as opposed to those who “went along to get along” with the parade of due process abuses and White Nationalist scheming that went on at EOIR under the regime and the horrible AGs and White Nationalist leadership at DOJ. 

Judge Tabaddor will be just the ticket for shaking up USCIS and getting it back on track to serving the public, rather than carrying out a perverted White Nationalist bogus enforcement mission that not only bankrupted a once self-supporting agency but was an embarrassment to American public service and democratic government.

Friends, you know, and I know, what is the biggest crisis facing the American justice system today. One that undermines and threatens racial justice, social justice, equality before the law, voting rights, American values, and indeed the very foundations of our democratic institutions and our justice system.

It’s imperative that our incoming Administration and its leaders fully recognize the overwhelming importance and extreme urgency of immediately ending the ongoing, deadly, and dangerous “Clown Show” at EOIR – the Executive Office for Immigration Review.

Under the defeated but not yet departed regime, EOIR has been weaponized by White Nationalist nativists to function as America’s Star Chambers. Once envisioned by its founders, including me, as a potential “jewel in the crown” of American justice, EOIR now has become an ungodly nightmare of anti-due process, anti-immigrant propaganda, bad judges, bogus stats, uncontrollable backlogs, malicious incompetence, stupid regulations, daily doses of irrationality, abuse of private attorneys, and institution of “worst practices.” But, it doesn’t have to be that way! No, not at all!

With courage, bold action, and, most important, the right people in place in leadership and key judicial positions, EOIR can be fixed: sooner, not later. The Immigration Courts can, indeed, through teamwork and innovation become the world’s best courts guaranteeing fairness and due process for all, promoting a model of best practices for the Federal Judiciary as a whole, and providing a trained and ready source of due-process oriented judges with strong immigration, human rights, and equal justice backgrounds for the Article III Judiciary and public policy positions.

EOIR will then be positioned for the essential transition to an Article I independent U.S. Immigration Court when we have the votes.

But, it will require a far more progressive, visionary, and aggressive approach than past Democratic Administrations. We must immediately (and legally) clear out the deadwood and get the problem solvers from the New Due Process Army (“NDPA”) — mostly now in the NGO, clinical, and private sectors, folks like you and your colleagues — in place to fix this horribly broken system.

Hi all:  A few outcomes right before the holiday (two good, one bad):

(1) The Fourth Circuit just granted the motion for rehearing en banc in Portillo-Flores v. Barr, in which the Round Table filed an amicus brief.  This was a decision with a very problematic unwilling/unable determination by two judges (the petitioner, who was 14 when the events occurred, stated on the third time he was asked that it was possible the police might have taken some action), and a very strongly worded dissent.

(2) In a bond case in the Second Circuit in which we also filed an amicus brief in a case represented by Legal Aid., Arana v. Barr, the petitioner was released from custody today after having two prior requests denied.  Legal Aid believes our brief was helpful in achieving that result.  Counsel is expecting a stipulation for dismissal without prejudice.

(3) The bad news: in a petition to the 4th Circuit in support of CAIR Coalition involving Matter of A-B- issues, the 4th Cir. denied the petition for review, but did so in an unpublished decision.

I’m so thankful for all of the fantastic work that you and our other knightesses and knights of the Round Table do to keep due process and best practices on the forefront and spread truth in the face of tyranny, lies, and false narratives. While we often focus on the weekly amicus briefs we file with tribunals across the nation, the work also goes on in analysis, public speaking, media interviews, teaching, political involvement, video appearances, and grass roots pro bono and community work.

For example, our amazing colleague Judge Charlie Pazar of Tennessee just reported that he was featured on a CLE panel entirely devoted to the work and impact of our Round Table! Way to go Charlie! You are one of those who tirelessly works to improve American justice on all levels and you are certainly “super generous” in sharing your time, knowledge, expertise, and perspective!

Just recently, Sir Jeffrey, along with Round Table knightesses Judge Denise Slavin and Judge Sue Roy, in addition to yours truly and our friend NAIJ President Judge Ashley Tabaddor, were quoted by Suzanne Monyak in a Law360 article about the future of the NAIJ and the Immigration Court in a Biden Administration. Sadly, the article is “hidden behind the pay wall,” but those with access can read it in its entirety.  

Compare these unselfish, teamwork-oriented, effective, expert professional activities aimed at improving the justice system and access to it for everyone with the disgraceful, ignorant, divisive, counterproductive, and often downright racist and illegal actions of the current regime’s immigration kakistocracy, starting, but by no means ending, with the deadly ☠️⚰️🏴‍☠️ “EOIR Clown Show” 🤡!  

Think what a “Better EOIR” and a “better bureaucracy,” led by members of the NDPA could do to solve problems, promote the rule of law and best practices, and make “equal justice for all” a reality rather than a false promise that is intentionally never fulfilled! It isn’t rocket science. But, it does take replacing the kakistocracy, on all levels, throughout Government with experts from the NDPA committed to achieving “good government in the public interest.”

Brief of Amici Curiae Retired IJs and Former Members of the Board of Immigration Appeals

Highlight:

As this Court has recognized, “when [an] alien appears pro se, it is the IJ’s duty to ‘fully develop the record.’” Agyeman v. INS, 296 F.3d 871, 877 (9th Cir. 2002) (quoting Jacinto v. INS, 208 F.3d 725, 733-34 (9th Cir. 2000)). Despite this long-recognized obligation, the record in this case demonstrates that this duty is not always fulfilled; and that the consequence may be unfairness and injustice to the pro se petitioner who is unable to develop the record without guidance and assistance. We respectfully submit that this Court should use this case to provide much-needed guidance to IJs on the scope of their duty to work with pro se respondents to elicit the information necessary to develop the factual record. Based upon our own extensive experience, we are of the view that this can be done efficiently and effectively by conscientious IJs, so long as the rule that they are required to do so is clear.

  • Mindless “haste makes waste” enforcement gimmicks (often supported by knowingly false or misleading narratives) imposed by political hacks at DOJ and Falls Church;
  • A BIA lacking expertise and objectivity that instead of focusing on due process for those in Immigration Court, spews forth “blueprints for denial and deportation” without regard for statutory, Constitutional, and human rights;
  • A system that has elevated “malicious incompetence” and “worst judicial practices” to a “dark art form.”☠️

TIME FOR COURAGEOUS NEW IMMIGRATION LEADERSHIP!

It’s time for the “EOIR Clown Show” in Falls Church to go! Bring in competent jurists and administrators from the NDPA: practical scholars and problem solvers with real life skills developed by saving lives from this broken and biased system. Real jurists with expertise in human rights and courage, who will make due process, fundamental fairness, humane values, and “best judicial practices” the only objectives of the Immigration Courts. Jurists who will courageously resist political interference and improper and unethical weaponization of the Immigration Courts by any Administration.

Let the incoming Biden-Administration know that you won’t accept failed “retreads” from the past and “go along to get along” bureaucrats running and comprising what is probably the most important and significant court system in America from an equal justice, social justice, constitutional development, and saving human lives standpoint. 

This is the “retail level” of our justice system: The  foundation upon which the rest of our legal system all the way up to a tone-deaf, flailing, failing, and generally spineless Supremes stands! This is a court system that the Biden Administration can fix without Mitch McConnell!

The members of the NDPA are the ones who have been fighting in the trenches (and at the borders) to save lives, advance social justice, insure equal justice for all, end institutional racism, and preserve our democracy in the face of a tyrannical, unscrupulous, corrupt, racially biased, anti-democracy regime and its enablers! Many have sacrificed careers, health, not to mention financial security in this fight!

Don’t let those who watched from the sidelines, above the day-to-day fray, or were part of the problem swoop in and take control after the battle has been won! 

Get mad! Get vocal! Get active! Call everyone you know in the incoming Administration! Demand that the NDPA and its members be given the leadership roles they have earned and deserve in remaking EOIR and reforming a thoroughly corrupt, politicized, and dysfunctional immigration bureaucracy across our Government! 

Don’t let the Dems turn their back on achievable reforms and “shut out” the reformers and problem solvers in the advocacy sector (who have “carried the water” for Dems for decades) as has been the case in the past! Don’t let the mistakes and short-sightedness of the past destroy YOUR chances for a better future!

Don’t let timidity, ignorance, indifference, and fear of “rocking the boat” in the name of justice, due process, and human dignity replace “malicious incompetence” in Government!

Due Process Forever! Same old, same old, never! It’s time for real change and reform! It’s YOUR time to shine! Let YOUR voices be heard!

“It can’t be much of a surprise that I should have deep insight and strong feelings about the current state of our Immigration Courts, after more than forty years working in immigration law, twenty-one of them as an Immigration Judge appointed by Attorney General Janet Reno in 1995. Having retired in 2016, the issues I noted have become radically more pronounced and dire.

What do children in cages, refugee camps in Mexico, TV judges, lengthy delays and erratic scheduling have in common? They are all a part of the new look of the Trump Immigration Court, a shift in style and substance that is extraordinarily dismaying in many of its aspects. The Immigration Court is not an independent judicial tribunal. It is housed in a small agency within the Department of Justice (DOJ). Because of that placement, the Court has been plagued by a conflicted, dual identity, aspiring to be an independent tribunal while housed in law enforcement. It was only a matter of time before this politicized enforcement branch infected the Court.

Immigration Judges were recognized in 1979 as a collective bargaining unit called the National Association of Immigration Judges (NAIJ). Why did the judges feel a need to seek the protection of a labor organization? Quite simply, almost none of the people managing the huge bureaucracy of the Court actually spend any time in courtrooms. These high-level policy makers often have no practical knowledge of how the Court functions, and this defect has persisted through multiple political administrations. The DOJ issues policy and practice memoranda that bind judges without consulting them about their practical impact. Thus, a need arose for collective bargaining to assure input from the judges who implement these edicts.

On November 2nd, in an action by DOJ to decertify NAIJ, the Federal Labor Relations Authority (FLRA), remanded the action back to the Regional Director for a final decision, finding that Immigration Judges influence policy and are thus managers. That notion is laughable. Applying established law to a particular case is not influencing policy. Virtually every decision the judges make is subject to review and reversal by higher courts. Generally, judges are under the thumb of DOJ, ignored or ridiculed by leadership. It has gotten far worse for my colleagues after I left at the end of 2016.
