After destabilizing the nation over abortion, and moving further right on guns, climate, and religion, the conservative justices’ sights are on affirmative action, voting rights, and a fringe legal theory that could empower Trump-friendly state legislatures for future elections.

On the eve of his retirement, the nation’s first Black justice and ­constitutional giant, Thurgood Marshall, took a moment to denounce the Supreme Court of the United States over its “radical” path of abandoning past decisions for no other reason than the court’s membership had changed. Owing to these shifts in personnel, Marshall charged, now “scores of established constitutional liberties” hung in the balance, the powerless were left defenseless, and the court’s own authority and legitimacy were diminished. “Power, not reason, is the new currency of this Court’s decisionmaking,” Marshall warned in 1991, in what turned out to be his final dissenting opinion.

The dissenting justices in Dobbs v. Jackson Women’s Health Organization, the watershed case that discarded nearly 50 years of American jurisprudence protecting a woman’s right to terminate a pregnancy, felt the need to quote from Marshall’s decades-old warning because power, indeed, is the only sensible explanation for the Supreme Court’s present course. The seismic end of Roe v. Wade and Planned Parenthood v. Casey, two pillars of a much larger structure of unenumerated constitutional rights the high court has erected over almost a century, was neither legally necessary nor a product of profound changes in American society. Instead, five justices tore these precedents off the law books, ushering in a new era of abortion criminalization and second-class citizenship for half the nation, simply because they could—and had the numbers to do so. “Neither law nor facts nor attitudes have provided any new reasons to reach a different result than Roe and Casey did,” wrote Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan in their anguished Dobbs dissent. “All that has changed is this Court.”

As radical and destabilizing as the fall of Roe is for our most intimate personal decisions, beyond just abortion rights, its ripples will extend to other areas where the conservative justices are already smelling blood. Not satisfied with the erasure of just one constitutional right, Clarence Thomas, writing separately in Dobbs, indicated that contraception and same-sex marriage could be next. That future begins now. These actions and other signals make abundantly clear what Marshall foresaw: The Supreme Court is on a collision course with democracy itself. Dobbs merely sets the stage.

Every new justice creates a new court, the maxim goes. Yet for much of their time on the bench, Justice ­Samuel Alito, long a soldier in the Republican holy war to curtail abortion rights, and Thomas, an avowed Roe antagonist, had the will but not the votes to impose their antiabortion vision on the majority of the Supreme Court, much less on the rest of the country. Their fortunes, and power, changed with the election of Donald Trump, whose own marriage of convenience with white evangelicals and social conservatives paved the way for his presidency and the installation of three new justices of a different mold, all of them more extreme and lacking the moderation of Republican appointees of the past, including those who made Roe and Casey possible.

Next to this “restless and newly constituted Court,” as Sotomayor branded this new majority in June, Chief Justice John Roberts looks as weakened as ever. The Supreme Court may bear his name, and the chief may have come of age during the abortion wars of the 1980s and ’90s, but neither his title nor institutionalist bent could convince the reactionaries to his right that their ­power grab in Dobbs represented “a serious jolt to the legal system” that he simply could not join in full. Too much, too soon. To the Trump justices, plus Thomas and Alito, this shock to the nation could not come soon enough.

Nominated by a president who lost the popular vote and narrowly confirmed by a Senate plagued by minority rule, these justices—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—were all groomed for this moment. All of them were grown in the test tube of the Federalist Society, the conservative legal brain trust that for decades has been a judicial pipeline for Republican administrations and state governments, which since the time of Ronald Reagan have made the fall of Roe a white whale of their politics.

Cristian creates an interesting vignette. The Justices take a few minutes to gather to welcome Justice Ketanji Brown Jackson to the Court. Then, the Right Wing Majority goes to work ignoring her views, insuring her marginalization, and pushing a minority agenda drawing into question her very existence as a person under law. 

The conclusion of the article is perhaps most illustrative of the uncertain future of democracy, human rights, equal justice, and indeed basic human decency:

“Women are not without electoral or political power,” wrote without irony the five justices who ended their right to be full and equal citizens before the law in Dobbs. In asserting power rather than reason over what remains of our less than perfect union, the Supreme Court may well unravel democracy with it, taking us down a path from which there is no return.

Quite an achievement for a Court now dominated by those appointed by Presidents whose election (initial or sole) contravened the will of the majority of voters.

Influx Of Solo Kids Poses Challenge For Immigration Courts

Law360 (March 31, 2022, 2:44 PM EDT) — Unaccompanied minors arriving in increasing numbers at the southern U.S. border are likely to face a tough time finding legal representation and navigating an overwhelmed immigration court system that has no special procedures for handling their cases.

The number of unaccompanied children encountered by U.S. Customs and Border Protection has risen sharply over the past year, to an average of more than 10,000 per month, according to CBP data. Those kids’ cases often end up in immigration court, where they are subject to the exact same treatment as adults, no matter their age.

“Nobody really thought of this when the laws were enacted,” said retired Immigration Judge Paul Wickham Schmidt, now an adjunct professor at Georgetown Law. “Everything dealing with kids is kind of an add-on,” he said, referring to special dockets for minors and other initiatives that aren’t expressly laid out in the law but have been tried in various courts over the years.

About a third of the immigration court cases started since October involve people under 18, and of those people, 40% are 4 or under, according to recent statistics from the U.S. Department of Justice’s Executive Office for Immigration Review, which operates the courts.

It’s unclear how many of those cases involve unaccompanied children and how many involve kids with adult relatives, and it’s hard to make historical comparisons because of changes in how the EOIR has tracked data on kids’ cases over the years.

But kids’ cases are indeed making up an increasing share of immigration court dockets, according to Jennifer Podkul, vice president of policy and advocacy for Kids in Need of Defense, or KIND, one of the main providers of legal services for migrant kids in the U.S.

“The cases are taking a lot longer because the backlog has increased so much,” Podkul said. Amid the crush of cases, attorneys can be hard to find.

The immigration courts should consider “getting some real juvenile judges who actually understand asylum law and have real special training, not just a few hours of canned training, to deal with kids,” said Schmidt, the former immigration judge.

For what seems to be the millionth time with Garland, it’s not “rocket science.”🚀 He should have brought in Jen Podkul, her “boss,” Wendy Young of KIND, or a similar qualified leader from outside Government, to kick tail, roll some heads, clean out the deadwood, and set up a “Juvenile Division” of the Immigration Court staffed with well-qualified “real” judges, experts in asylum law, SIJ status, U & T visas, PD, and due process for vulnerable populations. 

Such judicial talent is out there. But, that’s the problem with Garland! The judicial and leadership talent remain largely “out there” while lesser qualified individuals continue to botch cases and screw up the justice system on a regular basis! Actions have consequences; so do inactions and failure to act decisively and courageously.

And, of course, Garland should have replaced the BIA with real judges — progressive practical scholars who wouldn’t tolerate some of the garbage inflicted on kids by the current out of control, undisciplined, “enforcement biased,” anti-immigrant EOIR system. 

Instead, Garland employs Miller “restrictionist enforcement guru” Tracy Short as his “Chief Immigration Judge” and another “Miller holdover” David Wetmore as BIA Chair. No immigration expert in America would deem either of these guys capable or qualified to insure due process for kids (or, for that matter anyone else) in Immgration Court. 

Yet, more than a year into the Biden Administration, there they are! It’s almost as if Stephen Miller just moved over to DOJ to join his buddy Gene Hamilton in abusing immigrants in Immigration Court. (Technically, Hamilton is gone, but it would be hard to tell from the way Garland and his equally tone-deaf lieutenants have messed up EOIR. Currently, he and Miller are officers of “America First Legal” a neo-fascist group engaged in “aiming to reinstate Trump-era policies that bar unaccompanied migrant children from entering the United States,” according to Wikipedia.)

Meanwhile, the folks with the expertise to solve problems and get the Immigration Courts back on track, like Jen & Wendy, are giving interviews and trying to fix Garland’s ungodly mess from the outside! What’s wrong with this picture? What’s wrong with this Administration?

We’re about to find out! Big time, as Garland’s broken, due-process denying “court” system continues it’s “death spiral,” ☠️ taking lots of kids and other human lives down with it!

Dear Colleagues,

 

Today the Federal Labor Relations Authority reversed two decades of precedent and issued a baseless decision effectively decertifying the National Association of Immigration Judges as the union of immigration judges. See the decision here. We are outraged, though not surprised, by the lack of legal analysis. As dissenting member Ernest DuBester notes, the decision is pure “sophistry.”

 

This decision is not being rendered in a vacuum. We have suffered an all-out assault on labor and unions from the outset of three executive orders designed to decimate bargaining rights of unions to the most recent executive order designed to transform the federal workforce into an ”at-will” and deeply politicized body. And in the context of immigration judges, this is in line with our experience of undue interference and influence in our independent decision making authority.

 

We have lost this battle, but we will win the war. The NAIJ has prepared for just this day. We shall continue to fight. We are pursuing any and all available legal and other options.

Unquestionably, the move by the Attorney General to “decertify” the NAIJ (essentially eradicate it) was intended to “punish and silence” Judge Tabaddor and other NAIJ officers who have spoken out about serious due process abuses and chronic mismanagement at EOIR and the DOJ. No case in the Supreme Court’s current docket has higher stakes for human life in the era of COVID-19 than its upcoming ruling on the fate of so-called Dreamers—young undocumented immigrants brought to the United States as children through no fault of their own, and who remain shielded from deportation thanks to a program President Barack Obama instituted in 2014.

A highly unusual letter made its way to the justices late last month, after the case had already been briefed, argued, and for which a decision is already in the works. Lawyers for a group of beneficiaries of the Deferred Action for Childhood Arrivals program, known colloquially as DACA, wrote to the justices to warn about the dire consequences that a ruling in favor of Trump would have on the roughly 27,000 health care workers who happen to be DACA recipients. Among them are doctors, nurses, paramedics, and others on the front lines of combating the rapid spread of COVID-19 across the country. “Termination of DACA during this national emergency would be catastrophic,” the lawyers wrote.

The letter wasn’t just an appeal to the justices’ humanity and sense of fairness—after all, like the rest of us, they themselves have had to cancel public hearings, practice social distancing, and adjust to telework. But the filing also brought to bear a legal requirement the Trump administration had to weigh, but didn’t, when the Department of Homeland Security first announced the wind-down of DACA: the multitude of “reliance interests” that the government had created when it instituted the program—not just for recipients who have built their livelihoods around it, but the scores of local governments, businesses, and institutions that rely on so-called Dreamers for their own day-to-day functioning. “The public health crisis now confronting our nation illuminates the depth of those interests as borne by employers, civil society, state, and local governments, and communities across the country, and especially by health care providers,” the lawyers wrote in their letter, which also listed examples of health care workers who would be at risk of losing it all if the Supreme Court somehow agreed with the arguments the Trump administration has made in its years-long bid to terminate DACA.

A pair of recent analyses by the Center for Migration Studies and the Center for American Progress broadened the lens and found that the number of DACA recipients who qualify as essential workers during the pandemic could reach hundreds of thousands, as many of them also work in the health industry as food preparers, custodians, or in administrative roles, or otherwise in the fields of education, manufacturing, transportation, food retail, or the hard-hit restaurant industry. Some of these health care professionals, like others in the trenches, have begun to speak up. “I am treating people suspected of having COVID-19, and all I’m asking is to stay in this country and provide that care,” Veronica Velasquez, a 27-year-old physical therapist at a Los Angeles community hospital, told USA Today. “We’re definitely helping them stay alive.” Speaking to the New York Times in the middle of his shift, Aldo Martinez, a 26-year-old paramedic in Florida who was brought to the U.S. when he was 12, seemed to make a direct appeal to the justices. “It’s imperative that the Supreme Court take account of conditions that did not exist back in November,” he said. “It seems nonsensical to invite even more chaos into an already chaotic time.”

The pandemic was unforeseen at the time the justices considered the DACA dispute in November and could well change the calculus for how the Supreme Court ultimately rules in the case. But the issue of “reliance,” which federal agencies promulgating or rolling back policy are required to consider under administrative law, is not new to the case. The words reliance or reliance interests came up dozens of times at the oral argument in November, with some justices appearing rightly concerned that the Trump administration did not engage in the due diligence federal law demands when rescinding a policy on which people’s lives, the economy, and other third parties depend. At the hearing, Justice Stephen Breyer articulated what the law expects in these circumstances. “When an agency’s prior policy has engendered serious reliance interests,” Justice Breyer said, quoting from a decade-old opinion by the late conservative stalwart Justice Antonin Scalia, “it must be taken into account.” Justice Scalia added in his original 2009 opinion “that a reasoned explanation is needed for disregarding facts and circumstances that underlay or were engendered by the prior policy.” In other words, explain to the public why the current reality doesn’t affect your thinking for what you’re trying to do.

But when one reads the 2017 memorandum that rescinded DACA, or a later one that purported to better explain the termination, there’s no indication anywhere that the Trump administration took into account the human, economic, and social costs of leaving so many people—many of them with jobs, small businesses, American families, and ties to the community—unprotected. Later reporting by the New York Times revealed that a key actor in the deliberations to end DACA, then Acting Homeland Security Secretary Elaine Duke, was herself deeply conflicted with signing her name to the anti-immigrant rationales that the White House, Stephen Miller, and then Attorney General Jeff Sessions advanced for rolling back the program—none of whom, it would seem, took into consideration the myriad harms that would flow from that decision.

Courts in California, New York, and Washington, D.C., took notice of these self-inflicted flaws and allowed DACA to remain in the books. “As a practical matter,” wrote a Brooklyn federal judge in early 2018, “it is obvious that hundreds of thousands of DACA recipients and those close to them planned their lives around the program.” United States District Judge John Bates, an appointee of President George W. Bush, wrote in an opinion leaving DACA in place that the Trump administration showed “no true cognizance of the serious reliance interests at issue here”—and worse, that “it does not even identify what those interests are.”

The Trump administration’s evident failure to own up to the human cost of its policy choices and to spell them out clearly has now given the Supreme Court an opportunity to fix the mess. But as Joe Biden suggested in a statement shortly after the DACA letter was filed, the justices cannot just close their eyes to a reality that was not before them when they first took up the case: a pandemic that has touched every single one of us—and that has fallen hardest on those providing needed medical care. “If the Supreme Court upholds President Trump’s termination of DACA in the midst of a national public health emergency, it will leave a gaping hole in our health care system that is liable to cost American lives,” Biden said.

At the very least, the justices could discard the bare-bones justifications offered by the Trump administration for doing away with DACA and make him and his administration show their work. In the letter filed with the Supreme Court at the end of March, the lawyers suggest a sort of middle ground: a new round of legal arguments in writing addressing “whether remand to the agency for reconsideration of its decision to terminate DACA is appropriate in light of the extraordinary public health emergency.” In an interview, Muneer Ahmad, a Yale law professor who is a signatory to the letter, suggested that New York, where his clients reside, is a kind of ground zero that would be instructive for the justices. “New York is both an epicenter for Dreamers and DACA recipients and an epicenter of the pandemic,” he told me.

Trump may not want to take full responsibility for the federal response to the coronavirus. But the DACA controversy, at its very core, is about political accountability—about how the law requires the president and his government to take ownership of their policy choices, even those that harm others. During the hearing to consider DACA’s fate, Justice Sonia Sotomayor alluded to the realpolitik dimensions of ending the program when she asked Noel Francisco, Trump’s chief Supreme Court lawyer, to articulate the administration’s rationale for trying to end the program. “Where is the political decision made clearly?” she asked. “That this is not about the law; this is about our choice to destroy lives.”

Here’s an excerpt from Linda’s analysis of the Supreme mockery of justice in the recent Wisconsin voter case, RNC v. DNC:

In more than four decades of studying and writing about the Supreme Court, I’ve seen a lot (and yes, I’m thinking of Bush v. Gore). But I’ve rarely seen a development as disheartening as this one: a squirrelly, intellectually dishonest lecture in the form of an unsigned majority opinion, addressed to the four dissenting justices (Need I name them? Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan), about how “this court has repeatedly emphasized that lower federal courts should ordinarily not alter the election rules on the eve of an election.”

Let’s think about that. “Ordinarily not alter”?

There are quite a few things that should not ordinarily be happening these days. People shouldn’t ordinarily be afraid of catching a deadly virus when exercising their right to vote. Half the poll-worker shifts in the city of Madison are not ordinarily vacant, abandoned by a work force composed mostly of people at high risk because of their age.

Milwaukee voters are not ordinarily reduced to using only five polling places. Typically, 180 are open. (Some poll workers who did show up on Tuesday wore hazmat suits. I wonder how Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh understand the word “ordinarily.” And I wonder why the opinion was issued per curiam — “by the court.” Did none of the five have the nerve to take ownership by signing his name?

I’ve been warning for some time about the institutional failure of the Article III Courts led by the disgraceful example of Roberts who is afraid to stand up to Trump when it counts. Interesting that in this and other areas, the “professional commentators” are picking up on and reinforcing things I have been saying on Courtside for a long time. And, much of the shabby performance of America’s life tenured judiciary begins with failing to stand up to Trump’s racist assault on migrants and his unconstitutional dismantling of justice in our overtly biased Immigration Courts. 

Justice Sotomayor said it very clearly at oral argument in the DACA case:  “That this is not about the law; this is about our choice to destroy lives.” The same can be said about much of the J.R. Five’s one-sided immigration jurisprudence in the “Age of Trump.”

For more than two years, immigration judges have been subject to a policy that more or less prevents them from performing an essential part of their civic duties: speaking publicly about their work.

Since September 2017, immigration judges and all other employees at the Justice Department’s Executive Office for Immigration Review have been required to adhere to an onerous pre-approval process whenever they desire or are invited to speak publicly on any issue, immigration-related or not. I learned of the policy through a Freedom of Information Act request my colleagues made to the department, as part of an investigation I’ve been conducting on the intersection of free speech and U.S. border enforcement.

It is not uncommon for government agencies to set rules on employee conduct and outside activities. But the perspective of immigration judges is particularly valuable to the public, especially one grappling with complicated questions about America’s immigration laws. In his 2019 year-end report on the federal judiciary, Chief Justice John Roberts commended American judges who, “without fanfare or acclaim,” take time to reach out to their communities in all sorts of public-education initiatives. As Ashley Tabaddor, the president of the National Association of Immigration Judges, told Congress in 2018, immigration judges “help the community better understand our immigration courts and their function in the community, helping to demystify the system and bring transparency about our operations to the public.”

Although immigration judges are employees of the executive branch, they’re judges in the truest sense of the term, presiding over cases that have enormous consequences for asylum seekers or people facing removal from the U.S. The Trump administration appears determined to remove from the public’s view the very people the chief justice  and Tabaddor believe play an essential role in promoting public confidence in the administration of justice. The Justice Department should heed their call—rescind its misguided policy and let judges speak.

In the 2017 memo, the official overseeing the work of immigration judges, James McHenry III, did acknowledge that “the public has become increasingly interested in hearing about, and understanding, what the agency does and specifically how Immigration Courts operate.” But the policy went on to severely restrict judges’ freedom to speak even in a personal capacity about these matters, requiring them to seek permission through the chain of command. “Supervisors will determine the capacity in which an employee is speaking,” McHenry’s memo stated, thus effectively eliminating a judge’s discretion to speak about immigration in public settings, even with a disclaimer that he or she was doing so in a personal capacity. Supervising judges and other senior employees have it even worse—they are simply forbidden from speaking at public events in a personal capacity at all.

Lawyers at the Knight First Amendment Institute at Columbia University, where I’ve been conducting my investigation, believe that the policy violates the First Amendment, and in early January issued a letter asking the Justice Department to suspend it. Their reasoning was grounded in well-settled Supreme Court precedent. In the 1968 case Pickering v. Board of Education, the Supreme Court recognized that public employees’ “right to speak on issues of public importance” doesn’t vanish the moment they take a government job. For the government to restrain public employees’ ability to speak, the Supreme Court has said, the Constitution requires officials to show that their interest in restraining speech outweighs employees’ interest in speaking and the public’s interest in hearing what they have to say. “The Government must show,” Justice John Paul Stevens explained in a 1995 case, “that the interests of both potential audiences and a vast group of present and future employees in a broad range of present and future expression are outweighed by that expression’s ‘necessary impact on the actual operation’ of the Government.” That’s a heavy lift.

The Justice Department hasn’t officially responded to the lawyers’ letter. But in mid-January, McHenry’s office did reply in a way: It purported to reissue the 2017 memorandum, calling it “established policy,” and unveiled an online portal through which immigration judges may submit their speaking-engagement requests for approval. According to the department, the new portal was necessary “to provide for more certainty and clarity” for judges, an implicit acknowledgment that the earlier guidance was causing confusion among immigration judges. (The reissued policy hasn’t been made public, but a person familiar with it showed it to me.)

“The earliest, highest-profile critic of granting an executive reprieve to Dreamers was none other than Justice Antonin Scalia. The plight of young immigrants brought to the United States as children was not something the Supreme Court was concerned with in 2012, but the late justice somehow felt the need to protest, in open court, President Obama’s then weeks-old decision to not deport them for humanitarian reasons. “The president has said that the new program is, quote, the right thing to do, close quote, in light of Congress’ failure to pass the administration’s proposed revision of the immigration laws,” he said as he read from a summary of his partial dissent in Arizona v. United States. That case and decision had nothing to do with Dreamers.

Maybe Scalia’s real qualm was with the sitting president and not the recipients of the Deferred Action for Childhood Arrivals program, better known as DACA. But his broader point, which a Supreme Court majority rejected, was that states should have leeway in enforcing federal immigration laws, since they — and not undocumented immigrants — face the “human realities” of a broken immigration system. The citizens of border states like Arizona “feel themselves under siege by large numbers of illegal immigrants who invade their property, strain their social services, and even place their lives in jeopardy,” Scalia complained. Somewhere, a future President Trump may have been taking notes.

More than five years since that screed, the Supreme Court could soon get a chance to judge the propriety, if not the legality, of Trump’s decision last September to pull the plug on DACA. A federal judge in California in January ordered the reinstatement of the program, reasoning that its rescission rested on a “flawed legal premise” — namely, Jeff Sessions’s paper-thin conclusion that DACA was illegal the moment it was conceived. The judge also rejected as “spin” and “post-hoc rationalization” the Trump administration’s contention that DACA was vulnerable to a legal challenge by Texas and other states, which had threatened Sessions with a lawsuit if he didn’t kill the initiative outright. “The agency action was not in accordance with law because it was based on the flawed legal premise that the agency lacked authority to implement DACA,” wrote the judge, William Alsup, in a ruling that effectively brought DACA back from the dead. Days later, the administration began accepting renewal applications as if the rollback had never happened.

Legal scholars weren’t impressed with the ruling. And Sessions, not one to give up on Trump’s anti-immigrant crusade, then took the “rare step” of appealing Alsup’s decision directly to the Supreme Court — and why not? The Ninth Circuit, Trump’s least favorite appeals court, is unruly, liberal, and anti-Trump, anyway; leapfrogging it seemed the smart thing to do. What’s more, Sessions wanted the justices to act expeditiously — his solicitor general filed an additional request to decide the case before the end of June. Not doing so, he suggested, would be the same as blessing “indefinitely an ongoing violation of federal law being committed by nearly 700,000 aliens.” So much for Trump’s wish to treat Dreamers “with heart.” There was only one problem: The Supreme Court rarely, if ever, lets anyone skip over the regular appeals process. And if Sessions is in such a hurry, why didn’t the administration seek to block Alsup’s ruling rather than comply with it? Last Friday, a coalition that includes the University of California, several states, a local chapter of the SEIU, and a number of Dreamers told the Supreme Court to reject the Trump administration’s request to hear the case. The DACA mess, this alliance broadly contended, is Trump’s and Congress’s to own, and the justices shouldn’t be the ones fixing it, at least not with the urgency Sessions is demanding.

The principle of prosecutorial discretion, which is what holds DACA together, was never once discussed by Sessions when he announced the wind-down of DACA. He didn’t even try. Prosecutorial discretion wasn’t some novelty that Napolitano came up with at the time, let alone a quirk of immigration law. In a path-breaking memorandum written some 40 years ago, Sam Bernsen, the general counsel of the now-defunct Immigration and Naturalization Service, advised the agency’s commissioner that the “ultimate source for the exercise of prosecutorial discretion” lies with the inherent powers of the presidency. “Under Article II, Section 1 of the Constitution, the executive power is vested in the President,” Bernsen wrote in what is believed to be the first in a long string of government memos justifying prosecutorial discretion in the immigration realm. “Article II, Section 3, states that the President ‘shall take care that the laws be faithfully executed.’” Ironically, conservatives would later seize on this “take care” language to argue breathlessly that Obama’s immigration actions were an affront to the constitutional text, but no judge took that argument seriously.

Far and wide, executive officers enjoy similar discretion to enforce the law. From the president down to a lowly street cop, every law enforcer, state or federal, exercises some form of prosecutorial discretion over the laws they’re entrusted to oversee. It’s the reason you don’t always get ticketed for jaywalking or pulled over for doing 65 on a 55, even in instances where you happen to do those things in full view of the police: The government has ample discretion to not go after you if it feels you’re a low-priority lawbreaker. Maybe the 75-miles-per-hour driver is the bigger fish. Whichever the case, the decision is, by and large, unchallengeable. “Federal officials, as an initial matter, must decide whether it makes sense to pursue removal at all,” wrote Justice Anthony Kennedy in the same immigration ruling that Scalia assailed in 2012. “Discretion in the enforcement of immigration law embraces immediate human concerns,” he added.

Kirstjen Nielsen, the new DHS secretary, and Trump himself have all but conceded the point in recent weeks. In an interview with CBS’s John Dickerson, Nielsen said that it’s “not the policy of DHS” to go after Dreamers who are DACA recipients, even if the current legislative talks fail and the program isn’t renewed. “It’s not going to be a priority of the Immigration and Customs Enforcement to prioritize their removal,” Nielsen clarified, directly contradicting the Department of Justice’s position on DACA before the Supreme Court. (Dreamers and immigration advocates know better than to trust Nielsen’s assurances.) Asked last month if he might extend the arbitrary March 5 end date of the DACA rollback process — which is no longer the end date as a result of Judge Alsup’s ruling — Trump spoke as if he never truly believed, like Sessions did, that deferred action was unlawful: “I certainly have the right to do that if I want.”

In this climate, and with Trump still fielding immigration offers as Congress faces yet another deadline to fund the government, the Supreme Court would be crazy to jump into the DACA controversy. “I think for the Supreme Court to reach down to a district court decision and not allow the normal appellate process to proceed would necessarily, under the circumstances, involve or indicate that the Supreme Court is signaling its involvement in a deeply political matter,” Napolitano told me. Scalia may have felt comfortable criticizing policy choices from the bench, but that doesn’t mean Chief Justice John Roberts and his colleagues have to take the bait. For their own peace of mind and that of Dreamers, the Court is better off staying as far away as possible, and letting Trump take care of the laws that give him broad authority to spare young undocumented immigrants if he really wants to.”

“Since taking office as Donald Trump’s attorney general, Jeff Sessions hasn’t missed a chance to remind the public that the North Star of his Department of Justice is the rule of law. Eliminating protections for Dreamers and exposing them to deportation; threatening to pull federal funding from sanctuary cities that refuse to do the administration’s bidding on immigration; asserting in court that gay workers aren’t protected by the letter of Title VII of the Civil Rights Act of 1964; siding with a religious baker who declined to make a wedding cake for a same-sex couple wishing to marry — all actions demanded by fidelity to the the rule of law.

Because the rule of law matters to Sessions, he decided to make it the centerpiece of his Friday remarks at the annual national lawyers’ gathering of the Federalist Society, the conservative legal brain trust that helped Trump handpick Neil Gorsuch for the Supreme Court. About the president’s own disdain for the rule of law and so-called judges who rule against him, the group has largely turned a blind eye. Instead, they celebrate the parade of originalist judges he’s sent to the federal bench. For conservative legal thinkers, this covers a multitude of sins. “Attendees this year have an ebullience I haven’t seen before,” Ariane de Vogue, a longtime Supreme Court correspondent, observed on Twitter. The Federalist Society’s chairman, for his part, is already plotting how to turn the judicial map red.

Chalk it up to the electricity in the air, all this winning, that Sessions, after an introduction by Edwin Meese, his predecessor at the Justice Department during the Reagan administration, suddenly decided the rule of law was a joke. “Is Ambassador Kislyak in the room?” Sessions asked of the lawyerly audience, which greeted the question with laughter. “Before I get started here, any Russians? Anybody been to Russia? Got a cousin in Russia or something?” The audience was loving it. Meese was rolling.

Sessions must have thought of the Russia bit on the spot, as it wasn’t in his prepared remarks. There’s a reason he may have found the whole thing hilarious right there and then: He delivered the line at none other than the Mayflower Hotel, the same location where he and Kislyak, the former Russian ambassador, had an encounter during the presidential campaign that went undisclosed during his confirmation hearing. Sessions’s own shifting recollections and denials about his contacts with Russian officials in later Senate testimony are hard to keep up with. For all we know, he may have lied to Congress. Suffice it to say, the extent of those contacts played a significant role in Sessions’s recusal from all things Russia, a move that blindsided Trump and infuriated him. With a loyalist out of the way, it fell to Rod Rosenstein, Sessions’s deputy, to appoint Robert Mueller to lead the criminal and counterintelligence probes into the Kremlin’s disruption of last year’s election. Sessions came this close to resigning over Mueller’s appointment.

None of this is a laughing matter. That Sessions had the presence of mind to crack a joke about it makes a mockery of his self-professed commitment to the rule of law. The rule of law isn’t just rescinding Obama-era rules or steering the federal government toward more conservative outcomes. The rule of law, fragile as it is, is also a set of unwritten norms that stay the same no matter who’s in power — such as the nation’s top law-enforcement officer recognizing that he should not make light of an investigation in which he himself is implicated and may have committed perjury. One in which his own Justice Department has active, ongoing prosecutions of campaign officials that he once worked with. Sessions treating this as a joke undermines keepers of the constitutional order — Congress, the Executive branch, and now the courts — who are taking it very seriously.

“Recusals happen all the time throughout the Department of Justice … just because we follow the rules. That furthers confidence in justice,” Sessions declared near the end of his Federalist Society speech. Now that’s a good one. Desiree Fairooz, the activist who laughed at Jeff Sessions during his confirmation hearing and was prosecuted by his Justice Department over it, would be forgiven if she heard that zinger and laughed again.

Mueller, for his part, has his sights on another uproarious matter: ABC News reported Sunday that the special counsel is looking into the Justice Department’s role in the firing of James Comey. Sessions may have a hard time laughing that one off.”

Sessions, who lives on and for the “wrong side of history and human decency,” should go down as the most lawless Attorney General since John Mitchell. Indeed, I think he has the potential to surpass Mitchell in terms of contempt for the American system, for the majority of Americans, and for the rule of law. Having lived through the “Watergate Era,” that’s saying something!
