“To the extent the TPS statute places constraints on the Secretary’s discretion, it does so in favor of limiting unwarranted designations or extensions of TPS,” wrote Callahan, an appointee of President George W. Bush. She was joined by Judge Ryan D. Nelson, an appointee of President Trump.

Judge Morgan Christen, an appointee of President Obama, dissented.

She said the Trump administration had changed policy and practice without public review. She described the administration’s action as “an abrupt and unexplained change.”

She noted that the lawsuit challenging the deportation notices said they were motivated by racial and ethnic bias.

Trump reportedly called Haiti and El Salvador “shithole countries” and characterized immigrants from Mexico and Central America as criminals and snakes.

“We cannot sweep aside the words that were actually used, and it would be worse for us to deny their meaning,” wrote Christen. “Some of the statements expressly referred to people, not to places. The President’s statements require no deciphering.”

A statement by the ACLU Foundation of Southern California, which represented the immigrants and their children, said the ruling would not immediately end temporary protected status.

Such holders from these countries will be permitted to maintain their status until at least February, and those from El Salvador until at least November.

The challengers said they would appeal the ruling to a larger panel of the 9th Circuit.

The Federal Courts obviously know exactly what they are doing and what’s at stake when they blow by due process and equal protection to advance the Trump/Miller/Bar agenda of overt bigotry and racism, often supported by patently contrived or false narratives. 

In the end, this will be decided by the election. Still, the disingenuous, racism-denying performances of Judges Callahan and Nelson show why the already failing U.S Judicial system will remain a problem no matter who wins the election. The only issue is whether it will just be a problem or, if Trump were re-elected, become an out of control cancer that will hasten the demise of our democratic republic.

This week, the Trump administration has descended to a new level of contempt for the US refugee protection system. From its very first days in office when it evoked specious national security concerns to suspend the US Refugee Admissions Program (USRAP) for 120 days and indefinitely bar the admission of Syrian refugees, the administration has sought to discredit and diminish the US refugee resettlement, asylum, temporary protection, and other humanitarian programs.

As a presidential candidate, Donald Trump regularly decried the ways in which President Barack Obama exercised Executive authority, including by offering status, work authorization and protection from deportation to undocumented residents brought to the United States as children. As president, however, he has far exceeded Obama in unilaterally exercising his immigration authorities, albeit in favor of indiscriminate enforcement and evisceration of humanitarian programs. Many of these measures – although often justified on rule of law grounds – have not survived legal challenge.

To provide just a sampling of the Trump administration’s misguided policies, it has cut refugee admissions to historically low levels at a time of unprecedented need; has sought to rescind Temporary Protected Status (TPS) for 95 percent of the program’s beneficiaries; ended the Central American Minors (CAM) program which allowed El Salvadoran, Guatemalan, and Honduran children to undergo refugee screening in their own countries and join their legally present parents in the United States; cut aid to the Northern Triangle states, which have produced in recent years the lion’s share of migrants and asylum-seekers to the United States, and; denied access to the US asylum system through interception, border enforcement, and cruel deterrence strategies, such as separating children from parents and forcing asylum seekers to wait for months in dangerous Mexican border cities while their US claims are pending.

The president habitually impugns the patriotism of his critics, but has systematically attempted to dismantle quintessentially American programs, which have long reflected and projected US values. Some of the most shameful episodes in the US history – as when it turned away the Jewish refugees fleeing Nazi Germany on the S.S. St. Louis – involve the United States’ failure to protect refugees. By contrast, its leadership in responding to the refugees generated by World War II, the Vietnam conflict, the Cuban revolution, and the Balkans war in the former Yugoslavia – earned it the respect, gratitude and good will of many states and countless persons.  They made it a beacon of freedom.

How do these programs serve US interests? They save lives (a core value). They promote regional and global stability. They reduce irregular migration. They promote US foreign policy goals. They encourage developing nations to continue to offer haven and integration opportunities to the bulk of the world’s refugees. They promote cooperation with US diplomatic, military and counterterror strategies. They link communities, including diverse faith communities, that work together to welcome and resettle refugees. As President Ronald Reagan put it in 1981, they continue “America’s tradition as a land that welcomes peoples from other countries” and shares the “responsibility of welcoming and resettling those who flee oppression.”

On July 18, Politico reported that the administration has been trying to make the case for admitting no refugees in FY 2020 – not those already approved for admission, not the family members of refugees in the United States, not those who assisted the US military in Iraq and Afghanistan, and not survivors of religious persecution, although the administration regularly touts its commitment to religious liberty. It has reportedly been weighing a farcical rationale for this extraordinary step; that is, the United States cannot both process asylum claims and resettle refugees, although it has been doing both for decades.

On July 15, the Department of Homeland Security (DHS) and the Department of Justice (DOD) issued final interim regulations – which became effective the following day – that seek to deny access to the US asylum system to virtually every asylum-seeker at the southern border. With narrow exceptions, the rule would bar asylum claims by those “who did not apply for protection from persecution or torture where it was available in at least one third country” outside his or her “country of citizenship, nationality, or last lawful habitual residence through which he or she transited en route to the United States.”

Yet the Immigration and Nationality Act allows any non-citizen physically present in the United States to apply for asylum.  Removal is permitted only “pursuant to a bilateral or multilateral agreement” to a third country where “the alien’s life or freedom would not be threatened on account of race, religion, nationality, membership in a particular social group, or political opinion, and where the alien is eligible to receive asylum or equivalent temporary protection.” In short, this exception applies to “safe third country” agreements with other nations.  The United States has only one such agreement – with Canada – which does not apply to asylum-seekers with family members in the other country, as the DHS and DOD regulation would.  The pre-conditions for such an agreement are that an agreement actually exists,  the state parties to the agreement are “safe,” and they have “full and fair” asylum policies and procedures. The DHS/DOJ rule flouts all of these statutory requirements.

Ironically, the Trump administration claims that it needs to take this step based on the numbers of people seeking protection from countries such as El Salvador, Guatemala, Honduras, Nicaragua, and Venezuela. Yet great demand and need argue for a robust, well-resourced asylum system, not the shell of a program.

Some percentage of asylum-seekers from these countries will ultimately be found to be ineligible for asylum, although a very high percentage have been forced to leave their violence-torn homelands and will at least present credible claims. For its part, the Trump administration has not effectively addressed the causes driving the flight of these migrants, has not offered legal migration opportunities to those in great need, and has failed to take any of steps necessary to address a human crisis of this magnitude. These steps would certainly reduce irregular migration and the high numbers of asylum seekers at the US-Mexico border.  Instead, it has resorted to deterrence, interception and border enforcement policies – a recipe for failure on humanitarian, legal, and enforcement grounds, and a boon only to human smuggling networks and for-profit prisons.

The administration is dismantling the US refugee resettlement program and the asylum system – at immense human cost, to the nation’s detriment, and with disastrous consequences for the international system of refugee protection which it once led.  This isn’t patriotism.  It’s an act of sabotage of a defining set of American value and a once proud program.  One day – perhaps soon – it will be looked upon as a shameful episode in US history.

Under Trump, the U.S. has become a leading shirker of refugee resettlement responsibilities, encouraging other prosperous Western Nations to follow our cowardly and selfish example.

Lebanon (GNP approx. $52 billion) hosted 1.4 million refugees, or 156 refugees per 1,000 inhabitants; Jordan (GNP approx. $41 billion) hosted 2.5 million refugees, or 72 refugees per 1,000 inhabitants. Meanwhile, the U.S., GNP approx. $20 trillion+, has reduced its refugee resettlement commitment to less than 30,000 and now outrageously proposes to “zero it out.” 

Cowardly, inhumane, irresponsible, selfish, racist leaders reflect on all of us, not just on the disturbing lack of values of the minority of Americans who installed them in office and keep them propped up.

The U.S. is now officially leading the “race to the bottom.” Will those of us who believe in a confident, generous, courageous, patriotic America, reestablishing ourselves as a human rights leader be able to get it together to “right the ship” in 2020. Or, will the Ship of State continue to sink with Trump and his unpatriotic White Nationalist racists at the helm?

GREENVILLE, N.C. —  Mark and Nancy Dawson think Muslims should be removed from the United States.

The couple drove an hour and a half from Seaboard, North Carolina, for Wednesday’s campaign rally for President Donald Trump. They arrived early, setting up some lawn chairs in the shade of a tree as temperatures climbed toward 100 degrees outside Williams Arena.

“I think Muslims should be kicked out of the country because Sharia law is not conducive to the Constitution, period,” said Mark, a retiree in a camouflage “Trump 2020” baseball cap and a T-shirt emblazoned with the words “United States of America: Love It or Leave It.”

“I don’t hate them,” Nancy, a retired IBM programmer, said of Muslims. “I just think they should go back where they can be together and have their own country and their own religion.”

The Dawsons’ vision of mass deportation didn’t feel like much of a fringe position at Wednesday’s “Keep America Great” rally in Greenville. When the president took the stage, he reupped his call for four Democratic congresswomen of color, all four of whom are American, to “go back” to the countries they came from.

When the president attacked Rep. Ilhan Omar (D-Minn.) — who came to this country as a Somali refugee before becoming a citizen — thousands of people inside the arena broke into a chant of “Send her back!”

It was an arresting scene: a predominantly white crowd of thousands, many in red “Make America Great Again” hats, encouraging a receptive president to illegally deport one of his political opponents, who is a black, Muslim American woman.

To scholars of fascism — who have been ringing the alarm bells since Trump began his climb to power in 2015 — the rally in Greenville felt like an escalation. Like the U.S. just made another leap toward outright fascism.

“I am not easily shocked. But we are facing an emergency,” tweeted Jason Stanley, a Yale University philosophy professor and author of the book “How Fascism Works.”

“Journalists must not get away with sugar coating this,” Stanley wrote. “This is the face of evil.”

Ruth Ben-Ghiat, a history professor at New York University who is an expert on fascism and propaganda, saw historical parallels in the Greenville rally.

“Trump has created a corps of supporters fanatically loyal to him who turn his latest racist messages into group rituals (chants, slogans) and who hate the people he tells them to,” Ben-Ghiat told HuffPost.

“All of this is consistent with the leader-follower relationship of fascist regimes.”

“Oh yea, it’s a fascist rally,” said Shane Burley, author of the book “Fascism Today: What It Is and How to End It.”

“I think that this rally is a rhetorical and political escalation for Trump, establishing him firmly to the right of his 2016 election,” Burley told HuffPost in a text exchange. “Which is what he wants to do because he wants to double down on his base for support, and he is doing that by playing on racist populism to create that motivation.”

This strategy, Burley said, will ensure that Trump supporters will “escalate their political behavior, which can be expressed violently, as we have seen with the rise of groups like Patriot Prayer.”

“I think that the rhetoric he chose to use, both about the congresswoman and with regards to the antifascist left, will have the result of inspiring violence.”

Inside the arena Wednesday, Trump supporters cheered on a brief act of violence. When a protester briefly interrupted the president’s speech, he was tackled by security guards and arrested. The crowd roared, breaking into a chant of “U-S-A!”

Trump, of course, has already inspired much more serious political violence, especially toward Somali-Americans like Omar.

In January, three Trump supporters, who belonged to a militia group called the “Crusaders,” were each sentenced to 25 years in prison for plotting to massacre Somali Muslims in Garden City, Kansas. That same month, two other Trump-supporting militia group members pleaded guilty to bombing a Somali mosque in Minnesota.

Among Trump supporters in Greenville on Wednesday, anti-Muslim bigotry was ubiquitous.

“Islam is not a real religion,” Bud “Wizzard” Harrell, a 61-year-old resident of Bear Grass, North Carolina, stated falsely. “It’s a religion of wars is what it is. Read the [Quran]. I’ve read a little bit. All I’ve seen is hateful stuff in there, vile, hateful stuff.”

“And also I see, just like what’s happening to Europe, they’re trying to do here: invade our country and get enough people in to have voting power to take over and control our country, and that’s what it is, an invasion,” Harrell said of Muslim immigrants, in a perfect recitation of the white supremacist “Great Replacement” conspiracy theory, which motivated a shooter to massacre 51 Muslims inside two New Zealand mosques this past March.

Brian Innis, a military veteran from Roanoke Rapids, North Carolina, said he supported Trump’s 2016 proposal to ban all Muslims — 1.7 billion people — from entering the U.S.

“Hardly no terror attacks being performed in the world by Christians,” Innis stated, incorrectly. “I wouldn’t say it’s called profiling, but you have to direct the issue where it’s coming from, and that’s where it’s stemming from.”

Trump supporters here also refused to entertain the idea that the president was racist when he told the four congresswomen of color — Reps. Omar, Alexandria Ocasio-Cortez (D-N.Y.), Ayanna Pressley (D-Mass.) and Rashida Tlaib (D-Mich.) — to “go back” to their own countries.

Telling people of color to “go back” where they came from is a foundational white nationalist insult in American history. (When nine black teenagers integrated a school in Little Rock, Arkansas, in 1957, a mob of a thousand white people heckled them with screams of “Go back to Africa.”)

Danny Sills, a 50-year-old truck driver from Williamston, North Carolina, said the president’s remarks about the congresswomen were “absolutely not” racist.

“If they wanna come here and assimilate and be Americans, they’re fine to be here,” he said of the congresswomen. “If they’re gonna try and destroy this country from within, they need to be somewhere else.”

As at every Trump rally before it, there was a widespread hatred of the press in Greenville, a well-documented characteristic of fascist movements.

Trump, after all, has spent his entire presidency calling the media “fake news” and “the enemy of the people.” It’s a view his supporters have embraced wholeheartedly.

As people stood in line outside the arena, MAGA merchants hawked “CNN sucks!” T-shirts while a band of teenagers in MAGA hats played a song called “CNN sucks.”

As this HuffPost reporter conducted interviews outside the rally, with supporters who wanted to answer questions, he was approached by a police officer, who warned him that there had been complaints he was “threatening and harassing” event attendees. The cop warned that if he received more complaints, this reporter would be removed from the rally.

When some reporters in the press pit stayed seated during the pledge of allegiance and the national anthem, Trump supporters angrily yelled “Stand up, media!” from the stands.

And of course, when Trump attacked the media in his speech, the crowd went wild.

“I don’t listen to Fox, I don’t listen to CNN. I don’t listen to any of ’em,” said Allicyn Steverson, a 57-year-old teacher from Florence, South Carolina. “I listen to Trump’s tweets and his QAnons.”

QAnon, or simply “Q,” is an anonymous poster, or posters, on message boards like 8chan, who claims to be a government official with high-level security clearance. Followers of Q believe that this anonymous poster is secretly working with the Trump administration to arrest Democrats en masse. QAnon is, in essence, a pro-Trump conspiracy theory — one with a large following.

“We had Q shirts on and [the Secret Service] made us take our shirts off,” Steverson said.

“They said they were given orders that if anyone had a Q shirt on they had to take it off, so we had to go buy these,” Steverson added, pointing to brand-new Trump T-shirts she and her friend were wearing.

Steverson said she wasn’t mad though. She was sure the Trump campaign had its reasons.

Inside the arena in Greenville, the devotion to Trump was complete. And it seemed like the president could feel it.

“Just returned to the White House from the Great State of North Carolina,” Trump tweeted Wednesday night. “What a crowd, and what great people. The enthusiasm blows away our rivals on the Radical Left. #2020 will be a big year for the Republican Party!”

Omar, however, had a tweet of her own, posting a verse from the poem “Still I Rise” by American poet Maya Angelou.

“You may shoot me with your words / You may cut me with your eyes / You may kill me with your hatefulness / But still, like air, I’ll rise.”

The real danger to America comes not from those who peacefully exercise their Constitutional right to dissent and criticize Government policies. No, it comes from those like Trump who spread lies and false narratives intended to incite hate and violence against “the other.” Really the key to Nazism.

Today, Trump disingenuously tried to distance himself from the hate chant he encouraged. As usual, he lied. The videos of the event show the ugly truth. Trump and his supporters are the ones who hate the real America and who are committed to destroying our Constitution and our democracy. The GOP has shown itself to be Trump’s party of facism. Can the rest of us stop them before it’s too late for America and the world?

But they were willing to do whatever it took. Going back to Guatemala was simply not an option, they said. Monterroso explained that in October, their family was forced to flee after a gang threatened to murder the children if they didn’t pay an exorbitant bribe, five months’ worth of profits from their tiny juice stall. The family hid for a day and a half in their house and then sneaked away before dawn. “There is nobody that can protect us there,” Monterroso said. “We have seen in the other cases, they kill the people and kill their children.” Her voice caught. “The first thing is to have security for them,” she said of her kids, “that nothing bad happens to them.”

All told, more than 159,000 migrants filed for asylum in the U.S. in fiscal year 2018, a 274% increase over 2008. Meanwhile, the total number of apprehensions along the southern border has decreased substantially—nearly 70% since fiscal year 2000. President Donald Trump has labeled the southern border a national crisis. He refused to sign any bill funding the federal government that did not include money for construction of a wall along the frontier, triggering the longest shutdown in American history, and when Democrats refused to budge, he threatened to formally invoke emergency powers. The President says the barrier, which was the centerpiece of his election campaign, is needed to thwart a dangerous “invasion” of undocumented foreigners.

But the situation on the southern border, however the political battle in Washington plays out, will continue to frustrate this U.S. President, and likely his successors too, and not just because of continuing caravans making their way to the desert southwest. Months of reporting by TIME correspondents around the world reveal a stubborn reality: we are living today in a global society increasingly roiled by challenges that can be neither defined nor contained by physical barriers. That goes for climate change, terrorism, pandemics, nascent technologies and cyber-attacks. It also applies to one of the most significant global developments of the past quarter-century: the unprecedented explosion of global migration.

They abandoned their homes for different reasons: tens of millions went in search of better jobs or better education or medical care, and tens of millions more had no choice. More than 5.6 million fled the war in Syria, and a million more were Rohingya, chased from their villages in Myanmar. Hundreds of thousands fled their neighborhoods in Central America and villages in sub-Saharan Africa, driven by poverty and violence. Others were displaced by catastrophic weather linked to climate change.

Taken one at a time, each is an individual, a mixture of strengths and weaknesses, hope and despair. But collectively, they represent something greater than the sum of their parts. The forces that pushed them from their homes have combined with a series of global factors that pulled them abroad: the long peace that followed the Cold War in the developed world, the accompanying expansion of international travel, liberalized policies for refugees and the relative wealth of developed countries, especially in Europe and the U.S., the No. 1 destination for migrants. The force is tidal and has not been reversed by walls, by separating children from their parents or by deploying troops. Were the world’s total population of international migrants in 2018 gathered from the places where they have sought new lives and placed under one flag, they would be its fifth largest country.

The mass movement of people has changed the world both for better and for worse. Migrants tend to be productive. Though worldwide they make up about 3% of the population, in 2015 they generated about 9% of global GDP, according to the U.N. Much of that money is wired home—$480 billion in 2017, also according to the U.N.—where the cash has immense impact. Some will pay for the passage of the next migrant, and the smartphone he or she will keep close at hand. The technology not only makes the journey more efficient and safer—smugglers identify their clients by photos on instant-messaging—but, upon arrival, allows those who left to keep in constant contact with those who remain behind, across oceans and time zones.

Yet attention of late is mostly focused on the impact on host countries. There, national leaders have grappled with a powerful irony: the ways in which they react to new migrants—tactically, politically, culturally—shape them as much as the migrants themselves do. In some countries, migrants have been welcomed by crowds at train stations. In others, images of migrants moving in miles-long caravans through Central America or spilling out of boats on Mediterranean shores were wielded to persuade native-born citizens to lock down borders, narrow social safety nets and jettison long-standing humanitarian commitments to those in need.

The U.S., though founded by Europeans fleeing persecution, now largely reflects the will of its Chief Executive: subverting decades of asylum law and imposing a policy that separated migrant toddlers from their parents and placed children behind cyclone fencing. Trump floated the possibility of revoking birthright citizenship, characterized migrants as “stone cold criminals” and ordered 5,800 active-duty U.S. troops to reinforce the southern border. Italy refused to allow ships carrying rescued migrants to dock at its ports. Hungary passed laws to criminalize the act of helping undocumented people. Anti-immigrant leaders saw their political power grow in the Czech Republic, Slovenia, Sweden, Germany, Finland, Italy and Hungary, and migration continued to be a factor in the Brexit debate in the U.K.

These political reactions fail to grapple with a hard truth: in the long run, new migration is nearly always a boon to host countries. In acting as entrepreneurs and innovators, and by providing inexpensive labor, immigrants overwhelmingly repay in long-term economic contributions what they use in short-term social services, studies show. But to maximize that future good, governments must act -rationally to establish humane policies and adequately fund an immigration system equipped to handle an influx of newcomers.

But protocols and treaties can, at best, hope to respond to the human emotions and hard realities that drive migration. No wall, sheriff or headscarf law would have prevented Monterroso and Calderón, or Yaquelin and Albertina Contreras, or Sami Baladi and Mirey Darwich from leaving their homes. Migrants will continue to flee bombs, look for better-paying jobs and accept extraordinary risks as the price of providing a better life for their children.

The question now is whether the world can come to define the enormous population of international migrants as an opportunity. I strongly encourage everyone to read Haley’s outstanding article at the link.  It is one of the best and most easily understandable explanations of a complex phenomenon that I have seen recently. As I always say, “lots of moving parts.” But Haley and her colleagues have distilled the fundamental truths concealed by this complexity. Congrats and appreciation to Haley and everyone who worked on this masterpiece!

Haley debunks and eviscerates the restrictionist, racist “fear and loathing” baloney that Trump and his White Nationalist gang peddle. The simple truth always has been and continues to be that America needs more immigration.

The only real question is whether we are going to be smart and funnel it into expanded legal and humanitarian channels or dumb like Trump and push the inevitable migration into an extra-legal system. The latter best serves neither our country nor the humans pushed into an underground existence where they can be exploited and are artificially prevented from achieving their full potential for themselves and for us. Right now, we have a mix skewed toward forcing far, far too many good folks to use the extra-legal system.

We’ll only be able to improve the situation by pushing the mix toward the legal and the humanitarian, rather than the extra-legal. That’s why it’s virtually impossible to have a rational immigration debate with folks like Trump who start with the racist-inspired fiction that migrants are a “threat” who can be deterred, punished, and diminished.

Contrary to Trump and the White Nationalists, the real immigration problems facing America are 1) how can we best integrate the millions of law-abiding and productive undocumented individuals already residing here into our society, and 2) how can we most fairly and efficiently insure that in the future individuals like them can be properly screened and come to our country through expanded humanitarian and legal channels. Until we resolve these, American will continue to founder with immigration and fail to maximize its many benefits. That’s bad for us, for migrants, and for the future of our nation.

As a reminder, in the context of Congressional negotiations on border security, I recently put together a list of “practical fixes” to the immigration system which would address border security, humanitarian relief, and improved compliance with Constitutional Due process without major legislative changes — mostly “tweaks” and other common sense amendments that would make outsized improvements and certainly would be an improvement on squandering $5.7 billion and getting nothing but a largely symbolic “instant white elephant” border wall in return.  So, here it is again in all its hypothetical glory:  “THE SMARTS ACT OF 2019:

By 7 p.m., the sun had set and groups of young men had begun to gather inside a small, nameless restaurant on a narrow street in Tapachula, Mexico. Anywhere else in the city, a hub of transit and commerce about ten miles north of the Guatemalan border, there would be no mistaking that you were in Latin America: The open colonial plaza, with its splaying palms and marimba players, men with megaphones announcing Jesus, and women hawking woven trinkets and small bags of cut fruit suggested as much. But inside the restaurant, the atmosphere was markedly different. The patrons hailed not from Mexico or points due south but from other far-flung and unexpected corners of the globe—India, Pakistan, Eritrea, Cameroon, Sierra Leone, Congo. Men, and all of the diners were men, gathered around tables, eating not Mexican or Central American fare but steaming plates of beef curry, yellow lentils, and blistered rounds of chapati. The restaurant’s proprietor, a stern, stocky Bangladeshi man in his thirties named Sadek, circulated among the diners. He stopped at one table of South Asian men and spoke to them in Hindi about how much they owed him for the items he’d collected on their tab. The waitress, patiently taking orders and maneuvering among the crowds of men, was the only Spanish speaker in the room.

Outside, dozens of other such men, travelers from around the world, mingled on the avenue. They reclined against the walls of restaurants and smoked cigarettes on the street-side balconies of cheap hotels. They’d all recently crossed into the country from Guatemala, and most had, until recently, been held in Tapachula’s migrant detention center, Siglo XXI. Just released, they had congregated in this packed migrants’ quarter as they prepared to continue their journeys out of Mexico and into the United States. They had traveled a great distance already: a transatlantic journey by airplane or ship to Brazil; by car, bus, or on foot to Peru, Ecuador, and Colombia; through Panama, Costa Rica, and Nicaragua; on to Honduras, Guatemala, and into Mexico. Again and again, I heard their itinerary repeated in an almost metronomic cadence, each country a link in a daunting, dangerous chain. They’d crossed oceans and continents; slogged through jungles and city slums; braved detention centers and robberies; and they were now, after many months, or even longer, tantalizingly close to their final goal of the United States and refugee status.

They are the extreme outliers of a global migration crisis of enormous scale. Today, more than 65 million people around the world have been forced from their homes—a higher number than ever recorded, as people flee war, political upheaval, extreme poverty, natural disasters, and the impacts of climate change. Since 2014, nearly 2 million migrants have crossed into Europe by sea, typically landing in Italy or Greece. They hail from dozens of countries, but most are from Syria, Afghanistan, Iraq, and Nigeria—countries struggling with war, political repression, climate change, and endemic poverty.

Their passage to supposed safety, which takes them across Libya and the Sinai, as well as the Mediterranean, has become increasingly perilous. According to the United Nations High Commissioner for Refugees, nearly 150,000 people crossed the Mediterranean in 2017. More than 3,000 are believed to have drowned. Stories of detention in Libya, as well as physical and sexual abuse, are commonplace among those who manage to make it to Europe. A recent CNN report depicted a Libyan slave auction, where people were being sold for as little as $400. Even the lucky ones who wash up on Europe’s shores may end up stuck for years in transit camps and detention centers in the south of the continent, in some cases only in the end to be deported. In 2013, in an effort to curb migration and ease the burden of migrants within its borders, the European Union began ramping up deportations. In 2016, nearly 500,000 people were deported from Europe.

While the global drivers of migration have not subsided—devastation in Syria and Afghanistan, political repression in parts of sub-Saharan Africa—200,000 fewer migrants attempted to cross into Europe in 2017 than the year before. In response to the migrant crisis, European countries have sent strong messages that newcomers are no longer welcome; they’ve built fences to stop refugees from crossing their borders and elected far-right politicians with staunchly anti-immigrant messages. Meanwhile, most asylum cases are stalled in overburdened court systems, with slim prospects for any near-term resolution, which leaves many migrants stuck in the wicked limbo of a squalid, under-resourced refugee camp or austere detention facility. Today, European authorities have stiffened their resistance not only to new arrivals, but to the hundreds of thousands of asylum-seekers who arrived years before and remain in an eerie liminal zone: forbidden to live or work freely in Europe and unwilling, or often unable, to go home.

Because of the high risks of crossing and the low odds of being permitted to stay, more and more would-be asylum-seekers are now forgoing Europe, choosing instead to chance the journey through the Americas that brings them to Sadek’s restaurant in Tapachula. Each year, thousands of migrants from the Middle East, Africa, and Asia make their way to South America and then move northward, bound for the United States—and their numbers have been increasing steadily. It’s impossible to know how many migrants from outside the Americas begin the journey and do not make it to the United States, or how many make it to the country and slip through undetected. But the number of “irregular migrants”—they’re called extra-continentales in Tapachula—apprehended on the U.S. side of the border with Mexico has tripled since 2010.

They remain a tiny fraction of the hundreds of thousands of Mexicans and Central Americans crossing into the United States. But it is a hastening trickle that may well become a flood. “These ‘extra-continental’ migrants will probably increase,” said Roeland De Wilde, chief of mission for the International Organization for Migrationin Costa Rica, “given the increased difficulties in entering Europe, relative ease of entry in some South American countries, and smugglers’ increased organization across continents.”

A migrant from Bangladesh, Sadek (in a red shirt) is part restaurateur, part migratory middleman. He can help a traveler with a good meal—or a good travel agent or immigration attorney.

One tragic lesson of the extra-continentales is that no set of governments, however callous, can solve the migration crisis by closing its doors to refugees seeking shelter. All Europe has done is redirect the flow of vulnerable humanity, fostering the development of a global superhighway to move people over this great distance. The doors will not hold, and neither will the fences. You can build a wall, but it will not work. Desperate people find a way.

“Lots of the news from sub-Saharan Africa is about war, famine, poverty or political upheaval. So it’s understandable if many Americans think most Africans who immigrate to the United States are poorly educated and desperate.

That’s the impression that President Trump left with his comments to members of Congress opposing admission of immigrants from “shithole countries” in Africa and elsewhere.

But research tells another story.

While many are refugees, large numbers are beneficiaries of the “diversity visa program” aimed at boosting immigration from underrepresented nations. And on average, African immigrants are better educated that people born in the U.S. or the immigrant population as a whole.

“It’s a population that’s very diverse in its educational, economic and English proficiency profile,” said Jeanne Batalova, a senior policy analyst at the Migration Policy Institute think tank in Washington and coauthor of a report last year on sub-Saharan African immigrants in the U.S. “People came for a variety of reasons and at various times.”

Overall, their numbers are small compared with other immigrant groups but have risen significantly in recent years. The U.S. immigrant population from sub-Saharan Africa (49 countries with a total population of more than 1.1 billion) grew from 723,000 to more than 1.7 million between 2010 and 2015, according to a new report by New American Economy, a Washington-based research and advocacy group. Still, they make up just half a percent of the U.S. population.

Drawing from U.S. surveys and Census Bureau data, the report found that the majority come from five countries: Nigeria, Ghana, Kenya, Ethiopia and South Africa.

The Pew Research Center reported that African immigrants are most likely to settle in the South or Northeast, and that the largest numbers — at least 100,000 — are found in Texas, New York, California, Maryland, New Jersey, Massachusetts and Virginia. Many African refugees have also relocated to or have been resettled in states such as Minnesota and South Dakota.

The Refugee Act of 1980 made it easier for people fleeing war zones to resettle in the U.S., and today there are tens of thousand of refugees from Somalia, Sudan and Congo. About 22% of African immigrants are refugees, according to Andrew Lim, associate director of research at New American Economy.

At the same time, the diversity visa program — also known as the visa lottery — has opened the door to immigrants from more peaceful places. Of the sub-Saharan immigrants who have become legal permanent residents, 17% came through the program, compared with 5% of the total U.S. immigrant population, according to Batalova.

Applicants to the program must have completed the equivalent of a U.S. high school education or have at least two years of recent experience in any number of occupations, including accountant, computer support specialist, orthodontist and dancer.

As a result, the influx includes many immigrants from sub-Saharan Africa who are highly skilled professionals.

Batalova’s research found that of the 1.4 million who are 25 and older, 41% have a bachelor’s degree, compared with 30% of all immigrants and 32% of the U.S.-born population. Of the 19,000 U.S. immigrants from Norway — a country Trump reportedly told lawmakers is a good source of immigrants — 38% have college educations.

The New American Economy study found that 1 in 3 of these undergraduate degrees were focused on science, technology, engineering and math — “training heavily in demand by today’s employers.”

That report also found that African immigrants were significantly more likely to have graduate degrees. A total of 16% had a master’s degree, medical degree, law degree or a doctorate, compared with 11% of the U.S.-born population, Lim said.

African immigrants were more than twice as likely than the U.S. population overall to work in healthcare, Lim said. There are more than 32,500 nursing, psychiatric or home health aides, more than 46,000 registered nurses and more than 15,700 doctors and surgeons.

“Overwhelmingly the evidence shows that [African immigrants] make a significant, positive economic contribution to the U.S. economy,” both at a national level and in districts where they are concentrated, Lim said. “They contribute more than $10.1 billion in federal taxes, $4.7 billion in state and local taxes, and most importantly, they have significant economic clout to the point of $40.3 billion in spending power.”

That $40.3 billion pays for housing, transportation, consumer goods and education for their children — “things that actually stimulate the economy around them,” Lim said.

The biggest beneficiary is Texas, where their spending power is $4.7 billion, followed by California, Maryland, New York and Georgia.

“It’s a population that leverages its human resources and contributes to the U.S. economy by revitalizing communities, starting businesses, but also by working in a variety of professional fields,” Batalova said.

Even those with less education who arrive as refugees often fill certain lower-skill niches in healthcare, such as home health aides, researchers said.

“In the communities they were resettled in, they have made significant contributions,” Lim said.

In many towns and cities in the Great Lakes area of the Midwest, for example, they have started new businesses, infused local labor forces with younger workers, and expanded local tax bases, Lim said.

A report last year by the National Academies of Sciences, Engineering, and Medicine found that immigrants in general had little to no negative effect on overall wages or employment levels for U.S.-born workers, and higher-skilled immigrants in fields such as technology and science had a positive influence on the U.S. labor force.

Still, supporters of stricter immigration policy back the Trump administration’s calls to end the visa lottery as well as programs that allow certain immigrants to sponsor family members to settle in the U.S. They believe that a merit system that selects immigrants based on individual skills should replace the current system.”

Truth, facts, and helping American workers have never been part of the GOP restrictionist agenda. The xenophobia is no longer limited to so-called undocumented immigrants; it’s clear that guys like Purdue, Cotton, and Goodlatte really don’t like immigrants of any type, and particularly those of color or from “developing nations.” It’s really all about race with religion and culture thrown in — slowing down the “browning and blackening” of America, attacking the Hispanic American and African-American cultures, and trying to block or limit the immigration of non-Christians (including, of course, Muslims).

Trump’s racist remarks this week (which Perdue, Cotton, and Nielsen are rather disingenuously trying to claim never happened) and the GOP’s basic defense of the idea of drawing immigrants from White European countries rather than Haiti, Africa, or Central America has basically “blown the cover” off of so-called “merit based” immigration being pushed by some in the GOP. Trump was just articulating the hateful White Nationalist immigration agenda that he ran on and many (not all) in the GOP have now adopted under the code word “merit based.” That doesn’t bode well for bipartisan immigration reform of any type or, for that matter, for the future of a diverse “nation of immigrants.”

“According to Eric Posner, a professor at the University of Chicago Law School, the lower U.S. courts have created a “Trump exception” to settled law on presidential powers with their travel ban decisions. They have ignored the Supreme Court’s admonition that courts may not “look behind” a “facially legitimate” reason for an executive order, which in these cases was a national security interest in stricter vetting.

Trump appealed to the Supreme Court, but his case became moot when he replaced the temporary travel ban with a permanent program with the Presidential Proclamation he issued on September 24, 2017, “Enhancing Vetting Capabilities and Processes for Detecting Attempted Entry Into the United States by Terrorists or Other Public-Safety Threats.”

When fourth and ninth circuit courts enjoined implementation of his proclamation, he went back to the Supreme Court. On December 4, 2017, the Court ordered stays of the fourth circuit and the ninth circuit injunctions.

The Court did not state its basis for granting Trump’s stay request in either decision, but stays are not granted for meritless cases. I expect Trump to prevail on the merits of his case.

He [Judge Derick Watson of the USDC in Hawaii] goes on to say that nevertheless “any reasonable, objective observer would conclude … that the stated secular purpose of the Executive Order is, at the very least, ‘secondary to a religious objective’ of temporarily suspending the entry of Muslims.” This “assessment rests on the specific historical record,” which “focuses on the president’s statements about a ‘Muslim ban,’” including on the campaign trail.

If the Supreme Court allows the courts to continue to do this to Trump, they will interfere with any national security decision he makes that impacts a country with a large Muslim population, regardless of the circumstances.”

“Way, way back in February, a three-judge panel of the United States Court of Appeals for the 9th Circuit heard oral arguments in State of Washington v. Trump, the first iteration of the first appeal of the first attempt at Donald Trump’s travel ban. This version was a hastily executed implementation of the president’s promise to create a Muslim ban, signed on Jan. 27, just a week after Trump took office.

America was riveted, listening eagerly to arguments broadcast without images and parsing—or trying to parse—complicated appellate questions about standing, and justiciability, and religious animus. As the court ultimately found—before this first version was pulled from commission and replaced with a new one—Trump’s ban trampled over all sorts of due process rights.

Almost a year later, a different panel of the 9th Circuit heard on Wednesday a different oral argument, about a third iteration of a Trump executive order limiting immigration from some majority-Muslim countries. This one, though, was offered without the glare of national media and by seemingly worn-out advocates. More than anything, the argument was reminiscent of one of those old-timey dance marathons, in which weary partners pushed one another around a high school gymnasium in the futile hope that anything might still matter.

Wednesday’s effort made the second argument about the very same issuesfrom May seem positively zippy (May? Remember May??). But here we are in December, and the travel ban has been sanitized and then sanitized again. The current version, announced in September, targets 150 million travelers from Muslim-majority countries Chad, Iran, Libya, Somalia, Syria, and Yemen, as well as the non–Muslim majority outlier North Korea along with some Venezuelan government officials. It was promptly blocked by judges before it went into effect, and on Monday the Supreme Court allowed it to go forward for the time being, warning the appeals courts that they had better rule quickly.So here in December, it is now being defended by seemingly competent counsel, despite the fact that—if one noticed such things anymore—the president was tweeting Muslim revenge porn only a week ago.

We should all possibly care about travel ban 3.0 and its cretinous defenders a whole lot more than we apparently do, simply because it’s permanent, it’s nearly as bad as the original, and the Supreme Court appears inclined to tolerate it. Thousands of people will be harmed for no reason other than Donald Trump dislikes Muslim countries and crafted a nearly legal theory to achieve his ban after two abject failures.

A fortiori, for the record, means an argument made with greater reason or more convincing force. Who knew that something so grotesquely cynical and cruel as this travel ban could become a fortiori, just from sheer wariness, repetition, and fatigue?”

Interestingly, Nolan and Dahlia appear to agree on one thing: the Supremes (or at least a majority of them, excluding Justices Sotomayor and Ginsburg who dissented from the dissolution of the stay) have signaled that they are ready to “greenlight” Trump’s “Travel Ban 3.0.” In other words, if Trump is exceeding “political and societal norms” (which many of us think he is) ultimately it will be up to the political branches of Government and the voters, not the courts, to rein him in.

“Since President Donald Trump took office on Jan. 20, his administration has repeatedly implemented policies that pull the welcome mat from under the feet of refugees and immigrants seeking safety in the United States. The latest directive, announced in late October, institutes new vetting measures for refugees from 11 countries, effectively extending the travel ban that recently expired.

These developments are unbefitting America’s history as a safe haven for refugees. Democratic and Republican presidents alike have ensured that the United States supports refugees who seek liberty and reject ideologies opposed to American values.
U.S. leadership is needed now more than ever, when tens of millions across the globe face life-threatening situations. Yet the Trump administration continues to issue anti-immigrant and anti-refugee policies that endanger innocent people fleeing persecution and, inherently, weaken America’s reputation both at home and abroad.
Here is a timeline of the Trump administration’s immigrant policies during its first nine months.
Travel ban

During his first week in office, President Trump instituted a travel ban that suspended the U.S. refugee resettlement program for 120 days and barred Syrian refugees from entry to the U.S. indefinitely. It also indiscriminately excluded any travel from six other countries—Iraq, Iran, Sudan, Libya, Somalia and Yemen—for 90 days.
Opponents of the travel ban challenged the directive in the courts. The Administration drafted a second travel ban as replacement: It allowed travelers who hold green cards entry the U.S.; removed Iraq from the list of restricted countries; and struck down the indefinite ban on Syrian refugees.
Even with this second ban, an eventual Supreme Court ruling required the administration to rewrite its travel guidelines over the summer, stipulating that people who have a “credible claim of bona fide relationship” with a person living in the U.S. can enter the country. The new guidelines, however, raised more questions than answers. For example, “bona fide relationships” didn’t include grandparents or resettlement agencies until advocates further challenged the protocols. Meanwhile, thousands of vulnerable refugees who were not already on flights to the U.S. were left stranded.
“The human toll on families who have patiently waited their turn, done the vetting, given up jobs and prepared to travel is wrong,” said David Miliband, president of the International Rescue Committee (IRC), in a July 13 statement. “After decades of leading with its gold standard resettlement program, this defective policy shifts the goal posts and sees America turn its back on—and break its promise to—the world’s most vulnerable.”
The Supreme Court scheduled hearings on the legality of the travel ban, but the expiration date for the directive rendering the case moot.
End of protections for Central American refugee children
On Aug. 16, the Trump administration ended the automatic parole option for children in the CAM program (formally called the Central American Minors Refugee and Parole program). Since December 2014, the CAM program has helped reunite children fleeing gang violence in Guatemala, Honduras and El Salvador with parents already in the U.S.
Many of these children avoided a perilous journey in order to reunite with parents and relatives—who are lawfully in the U.S.—and begin their new lives with refugee status protected under U.S. and international laws, notes Jennifer Sime, senior vice president of United States Programs at the IRC. “These children are no longer separated from their parents due to conflict and unrest, and are able to attend school and have a childhood free from violence.”
Terminating this lifesaving program, as this administration has done, is brutally tearing families apart—and in many cases, endangering children.

Why the U.S. should accept more refugees
On Sept. 5, Trump ended the Deferred Action for Childhood Arrivals (“DACA”) program, which created a fair and necessary safeguard for hundreds of thousands of young people—commonly known as Dreamers—brought to the U.S. as children.
This decision puts nearly 800,000 young people at risk of deportation from the only country they have ever known. It will have a painful and lasting impact on their lives, the fortunes of their employers, and the wellbeing of their communities.
“The devastating decision to discontinue DACA … unnecessarily tears families apart,” says Hans van de Weerd, vice president of United States Programs at the IRC. “To take away the promised protection of DACA without an alternative, from those who courageously came out of the shadows to apply to the program, bolster our economy and enrich our communities, is simply inhumane.”

Historically low refugee cap
On Sept. 27, the Trump administration announced that it would cap at 45,000 the number of refugees granted admission to the U.S. in Fiscal Year 2018. This number is a historic low—the annual cap on average has exceeded 95,000 since 1980—and comes at a time when more people are uprooted by war and crisis than ever before.
“This administration’s decision to halve the number of refugees admitted to America is a double-blow—to victims of war ready to start a new life, and to America’s reputation as a beacon of hope in the world,” says Miliband. “When America cuts its numbers, the danger is that it sets the stage for other nations to follow suit, a tragic and contagious example of moral failure.”

Why the existing vetting process already works
The travel ban officially expired on Oct. 24, but the Trump administration substituted the directive with a round of new vetting procedures for refugees entering the U.S. All refugees will now need to provide addresses, phone numbers, email addresses and other details – over the past decade – for themselves and, potentially, their extended family members.
Further measures essentially allow Trump to extend the ban for 90 days for refugees from 11 countries.
“This will add months, or potentially years, to the most urgent cases, the majority of which are women and children in heinous circumstances,” says Sime. “With a world facing brutal and protracted conflicts like in Syria, or new levels of displacement and unimaginable violence against the Rohingya, this moment is a test of the world’s humanity, moral leadership, and ability to learn from the horrors of the past.”

“At the end of last month, the Trump administration quietly rolled out new restrictions on certain groups of refugees, ostensibly aimed at “protect[ing] people from terrorist attacks and other public-safety threats.” This latest form of “extreme vetting” reportedly targeted citizens of 11 purportedly high “risk” countries, along with the children and spouses of refugees already in the United States.

These high “risk” refugees would be temporarily barred from entering the country and kept from resettlement, so yet another layer of reviews could be added to the already years-long process. Here is the list of affected countries: Egypt, Iran, Iraq, Libya, Mali, North Korea, Somalia, South Sudan, Sudan, Syria, and Yemen. Nine of these countries are Muslim-majority nations. The list was not made public in the executive order itself. Instead, the State Department released an accompanying memo saying that the refugee freeze would affect 11 unnamed countries for which additional security screening had been previously required for males age 16–50.

The new policy expands the additional scrutiny for people from those 11 nations to include all refugees, and not just males of a certain age, while attempting to hide which 11 countries are affected. It also “temporarily prioritizes” applications of refugees from countries not on the list. The list of countries has never been made public outside of media reports, but was included in a December 2016 State Department memo seen by Slate. The new executive order was the Trump administration’s latest attempt to secretly sanitize and repurpose President Trump’s long-proffered and repeatedly bungled Muslim ban.

To put it more simply: This is another Muslim ban.
In addition to the new vetting and resettlement restrictions for a certain type of refugee, the “follow-to-join” program for close relatives of refugees who are already in the U.S. was paused indefinitely until further review. That means that refugees already lawfully admitted will be prevented from reuniting with their spouses and minor children. Department of Homeland Security data shows that about 2,000 follow-to-join family members came to the U.S. in 2015. Just as a reminder, one of the first plaintiffs in a lawsuit against Trump’s first “travel ban,” Haider Sameer Abdulkhaleq Alshawi, was an Iraqi who had qualified for a Follow to Join Visa. Alshawi’s wife and 7-year-old son, whom he had not seen for three years, were lawful permanent residents living in Houston. He was detained at JFK Airport in transit to the U.S. when the first travel ban was signed in January, before ultimately being allowed to reunite with his family.

Seen together, the new restrictions will not only disproportionately affect Muslim refugees: They will also extend an already cumbersome process that at present features extensive vetting that can average between 18–24 months.”

Now, in yet another blow to America’s legacy as a beacon of hope to beleaguered people around the world, his administration plans to make entry into the United States even more difficult for those refugees who are lucky enough not to be banned from the country entirely.

Mr. Trump’s first two travel bans suspended all refugee admissions into the United States for 120 days. On Tuesday, that aspect of the ban expired — and the administration has replaced it with a mean-spirited policy not defensible on any conceivable grounds of national security.

Notwithstanding the president’s promises to implement “extreme vetting,” refugees seeking entry into the United States already are subject to a gantlet of security checks and interviews. Under this new policy, the process will become even more arduous. Refugees will need to hand over more detailed biographical data and contact information for family members. The government will scale up efforts to spot possible fraud. Meanwhile, a program allowing swifter entry for refugees seeking to join family members who have already reached the United States has been put on hold.

The policy is harshest toward refugees from 11 countries, which Reuters reports as Egypt, Iran, Iraq, Libya, Mali, North Korea, Somalia, South Sudan, Sudan, Syria and Yemen. For 90 days, citizens and stateless residents of these countries will be blocked from the United States unless their admission is determined not to pose a security threat and to be in the national interest of the United States. That loophole is particularly small because the State Department plans to prioritize refugees from other countries. Essentially, the administration has extended the refugee ban another month and a half for these 11 nations. (They produced more than 40 percent of refugees admitted to the United States in fiscal 2017.) That makes for a drastic cut in refu­gee admissions.”

“Washington (CNN)The Trump administration on Monday announced an end to protections for Sudanese immigrants, a move that advocates fear could be a sign of things to come.

The Department of Homeland Security announced Monday afternoon that it would be ending Temporary Protected Status for Sudan after a 12-month sunset period. It opted to extend, however, Temporary Protected Status for South Sudan, which gained its independence in 2011, through May 2019.
The decision was overdue. By law, decisions on TPS designations are required 60 days before an expiration deadline. With both countries’ status set to expire on November 2, the decision was due September 3. DHS said it made a decision in time, but kept it quiet for more than two weeks and did not respond to requests for an explanation.
While the decision on the future of Temporary Protected Status for Sudanese and South Sudanese immigrants only affects just over 1,000 people in the US, the decision is being closely watched as a harbinger of where the administration will go on upcoming TPS decisions that affect more than 400,000 people in the US.
Under Acting DHS Secretary Elaine Duke’s direction on Monday, recipients of protections from Sudan will be allowed to remain protected from deportation and allowed to work under the program until November 2, 2018, during which they are expected to arrange for their departure or seek another immigration status that would allow them to remain in the US.
Individuals from South Sudan will be able to extend their status until May 2, 2019, when DHS will make another decision on their future based on conditions in the country.
According to USCIS data, at the end of 2016 there were 1,039 temporarily protected immigrants from Sudan in the United States and 49 from South Sudan.
Temporary Protected Status is a type of immigration status provided for by law in cases where a home country may not be hospitable to returning immigrants for temporary circumstances, including in instances of war, epidemic and natural disaster.
While DHS did not explain the delay in publicizing the decision, which the agency confirmed last week was made on time, the law only requires “timely” publication of a TPS determination. The decision was made as the administration was preparing to announce the end of the Deferred Action for Childhood Arrivals program, or DACA, a popular program that has protected nearly 800,000 young undocumented immigrants brought to the US as children from deportation since 2012.

Some of the affected individuals have been living in the US for 20 years. TPS is not a blanket protection — immigrants have to have been living in the US continuously since a country was “designated” for TPS in order to qualify.

For example, Sudan was first designated in 1997 and was re-designated in 1999, 2004 and 2013, meaning people had opportunities to apply if they’ve been living in the US since any of those dates. South Sudan’s TPS was established in 2011 and had re-designations in 2014 and 2016.
Both countries were designated for TPS based on “ongoing armed conflict and extraordinary and temporary conditions.”

The situation in Sudan has improved in recent years, but there are still concerns about its stability and human rights record. In January, outgoing President Barack Obama eased sanctions on Sudan but made some moves contingent upon further review. President Donald Trump has extended that review period. South Sudan, meanwhile, remains torn by conflict.

Advocates for TPS have expressed fear that if the administration were to begin to unwind the programs, it could be a sign of further decisions to come. In the next six months, roughly 400,000 immigrants’ status will be up for consideration, including Central American countries like El Salvador that have been a focus of the Presidents’ ire over illegal immigration and gang activity.

California Rep. Zoe Lofgren, the top Democrat on the immigration subcommittee for the House Judiciary Committee, said in an interview before the decision that ending Sudan’s protections could be a sign of more to come.

“I mean look what’s going on in Sudan,” Lofgren said. “If that is a wise decision, what’s an unwise one?”

Let’s take a closer look at some of those supposedly “improved conditions,” using the Government’s own information, the U.S. Department of State’s latest (2016) Country Report on Human Rights Conditions for Sudan:

“The three most significant human rights problems were inability of citizens to choose their government, aerial bombardments of civilian areas by military forces and attacks on civilians by government and other armed groups in conflict zones, and abuses perpetrated by NISS with impunity through special security powers given it by the regime. On January 14, the government launched an intensive aerial and ground offensive against Sudan Liberation Army-Abdul Wahid (SLA/AW) strongholds in the Jebel Marra area of Darfur. This operation displaced more than 44,700 persons by January 31, according to the UN Office for the Coordination of Humanitarian Affairs (OCHA). In February the government established in Darfur a suboffice of the National Human Rights Commission to enhance the commission’s capacity to monitor human rights in Darfur. Meanwhile, ground forces comprising Rapid Support Forces (RSF) and Border Guards carried out attacks against more than 50 villages in an attempt to dislodge the armed opposition. Attacks on villages often included killing and beating of civilians; sexual and gender-based violence; forced displacement; looting and burning entire villages; destroying food stores and other infrastructure necessary for sustaining life; and attacks on humanitarian targets, including humanitarian facilities and peacekeepers. In September, Amnesty International issued a report alleging that, through September the government engaged in scorched-earth tactics and used chemical weapons in Jebel Marra, Darfur. UN monitors were unable to verify the alleged use of chemical weapons, due in part to lack of access to Jebel Marra, including by rebel commanders loyal to Abdel Wahid. By year’s end the Organization for the Prohibition of Chemical Weapons (OPCW) had not been presented with sufficient corroborating evidence to conclude chemical weapons had been used. The NISS continued to show a pattern of widespread disregard for rule of law, committing major abuses, such as extrajudicial and other unlawful killings; torture, beatings, rape and other cruel or inhuman treatment or punishment; arbitrary arrest and detention by security forces; harsh and life-threatening prison conditions; incommunicado detention; prolonged pretrial detention; obstruction of humanitarian assistance; restrictions on freedom of speech, press, assembly,association, religion, and movement; and intimidation and closure of human rights and nongovernmental organizations (NGOs). Societal abuses included discrimination against women; sexual violence; female genital mutilation/cutting (FGM/C); early childhood marriage; use of child soldiers; child abuse; sexual exploitation of children; trafficking in persons; discrimination against ethnic and religious minorities, persons with disabilities, and persons with HIV/AIDS; denial of workers’ rights; and child labor. Government authorities did not investigate human rights violations by NISS, the military or any other branch of the security services, with limited exceptions relating to the national police. The government failed to adequately compensate families of victims of shootings during the September 2013 protests, make its investigations public, or hold security officials accountable. Impunity remained a problem in all branches of the security forces.

The 2005 Interim National Constitution prohibits torture and cruel, inhuman, and degrading treatment, but security forces, government-aligned groups, rebel groups, and ethnic factions continued to torture, beat, and harass suspected political opponents, rebel supporters, and others. In accordance with the government’s interpretation of sharia (Islamic law), the penal code provides for physical punishments, including flogging, amputation, stoning, and the public display of a body after execution, despite the constitution’s prohibitions. With the exception of flogging, such physical punishment was rare. Courts routinely imposed flogging, especially as punishment for the production or consumption of alcohol. The law requires police and the attorney general to investigate deaths on police premises, regardless of suspected cause. Reports of suspicious deaths in police custody were sometimes investigated but not prosecuted. For example, in November authorities detained a man upon his return from Israel. He died while in custody, allegedly from falling out a window, although the building had sealed windows. The president called on the chief prosecutor and chief justice to ensure full legal protection of police carrying out their duties and stated that police should investigate police officers only when they were observed exceeding their authority. Government security forces (including police, NISS, and military intelligence personnel of the Sudanese Armed Forces (SAF)) beat and tortured physically and psychologically persons in detention, including members of the political opposition, civil society, religious activists, and journalists, according to civil society activists in Khartoum, former detainees, and NGOs. Torture and other forms of mistreatment included prolonged isolation, exposure to extreme temperature variations, electric shock, and use of stress positions. Some female detainees alleged NISS harassed and sexually assaulted them. Some former detainees reported being injected with an unknown substance without their consent. Many former detainees, including detained students, reported being forced to take sedatives that caused lethargy and severe weight loss. The government subsequently released many of these persons without charge. Government authorities detained members of the Darfur Students Association during the year. Upon release, numerous students showed visible signs of severe physical abuse. Government forces reportedly used live bullets to disperse crowds of protesting Darfuri students. There were numerous reports of violence against student activists’ family members.

Security forces detained political opponents incommunicado, without charge, and tortured them. Some political detainees were held in isolation cells in regular prisons, and many were held without access to family or medical treatment. Human rights organizations asserted NISS ran “ghost houses,” where it detained opposition and human rights figures without acknowledging they were being held. Such detentions at times were prolonged. Journalists were beaten, threatened, and intimidated (see section 2.a.). The law prohibits (what it deems as) indecent dress and punishes it with a maximum of 40 lashes, a fine, or both. Officials acknowledged authorities applied these laws more frequently against women than men and applied them to both Muslims and non-Muslims. Courts denied some women bail, although by law they may have been eligible. There were numerous abuses reported similar to the following example: On June 25, the Public Order Police arrested several young women and men in Khartoum under the Public Order Act for “indecent dress.” During the sweep, all women who did not have their hair covered were taken into custody. The Public Order Police further arrested two young men for wearing shorts. According to NGO reports, the Public Order Police released the young women and men later the same day without charges.

Security forces, rebel groups, and armed individuals perpetrated sexual violence against women throughout the country; the abuse was especially prevalent in the conflict areas (see section 1.g.). As of year’s end, no investigations into the allegations of mass rape in Thabit, Darfur, had taken place (see section 6).”

What I’ve set forth above is just a small sample of some of the “lowlights.” Virtually every paragraph of the Country Report is rife with descriptions of or references to gross abuses of Human Rights.

Clearly, these are not the type of “improved country conditions” that would justify the termination of TPS for Sudan. Moreover, since it affects only 1,000 individuals, there are no overriding policy or practical reasons driving the decision.

No, the Administration’s totally disingenuous decision is just another example of wanton cruelty, denial of established facts, and stupidity.  Clearly, this is an Administration that puts Human Rights last, if at all.

As pointed out by Nolan Rappaport in a a recent post, the best solution here is a legislative solution that would provide green cards to long-time “TPSers” through the existing statutory device of “registry.” With some lead time to work on this, hopefully Lofgren can convince enough of her colleagues to make it happen.
