As a former president of the United States excoriates immigrants for “poisoning the blood” of our country, as the governors of Texas and my current home state of Florida bus and fly migrants to points north — including my hometown, Chicago — my thoughts turn to baseball.

While that inhospitable bunch has been villainizing migrants and refugees as a strain on U.S. resources, I have been marveling at how much foreign-born players have enlivened (and enriched) baseball in recent decades. Far from being poisoned, the sport has been rejuvenated by infusions of immigrants from Ohtani to Soto to Ronald Acuña Jr., Yordan Álvarez, Ha-Seong Kim, the Cubs’ Seiya Suzuki and so many others.

As these non-White non-Americans wow — and earn — millions with their transcendent talents, in a sport still emerging from its startlingly racist past, bigoted fictions about the “blood of our country” are being exposed. It’s true that baseball is still struggling with exploitative international recruiting practices, decreasing numbers of U.S.-born Black players and a lack of diversity among its executive ranks. Yet the increasing number of foreign-born major leaguers now counted among the best in the game’s long history dispels the self-aggrandizing myth that the United States possesses any monopoly on excellence.

The Republican presidential front-runner might argue that undocumented migrants and refugees aren’t elite athletes and are instead “animals” arriving from “s—hole countries.” But such dehumanizing insults are not only guilty of offensive fixation on national origin, ethnicity and race. They also mistake a person’s predicament for a person’s potential.

This is made plain by the origin stories of some of baseball’s biggest stars. Those same players who fashioned makeshift mitts out of milk cartons and cardboard, who rose to the game’s highest levels through arduous, harrowing and near-tragic journeys, might have languished on the other side of a barbed and militarized wall if this country’s right wing had its way.

The politicians who would build those walls, who attack immigrants for supposedly burdening our national resources, need only consider baseball’s explosive growth into a $10 billion industry and the financial value of Ohtani alone to the Dodgers — some estimate the team could make more than $1 billion off his deal over the course of a decade — to see that industries and economies thrive by inclusion, not exclusion.

Even so, ideologues seek to end inclusive practices in private industry and public education. They guarantee endless winning and new revolutions by promising to slash resources and wall off our country — all while whiffing on the most rudimentary of winning principles understood by most every baseball fan in America:

Great teams are made great by deep, diversified rosters. They are built on investment in both homegrown and international talent. And there are no curses except those that are self-inflicted by cheap, regressive thinking.

As the Republican presidential primary churns toward that party’s national convention, coincidingthis July with baseball’s annual All-Star Game, all of this will be evident to anyone ready to take a break from the campaign, take a seat in the bleachers and take in the world’s greatest ballplayers thriving at America’s game.

Executive Summary

This paper examines the staffing needs of the US Department of Justice’s Executive Office for Immigration Review (EOIR), as it seeks to eliminate an immigration court backlog, which approached 2.5 million pending cases at the end of fiscal year (FY) 2023. A previous study by the Center for Migration Studies of New York (CMS) attributed the backlog to systemic, long-neglected problems in the broader US immigration system. This paper provides updated estimates of the number of immigration judges (IJs) and “judge teams” (IJ teams) needed to eliminate the backlog over ten and five years based on different case receipt and completion scenarios. It also introduces a data tool that will permit policymakers, administrators and researchers to make their own estimates of IJ team hiring needs based on changing case receipt and completion data. Finally, the paper outlines the pressing need for reform of the US immigration system, including a well-resourced, robust, and independent court system, particularly in light of record “encounters” of migrants at US borders in FY 2022 and 2023.

During the week, the term “border crisis” was featured prominently in the national airwaves in both political rhetoric and media coverage. Perhaps the term would be appropriate and accurate if it referred to people freezing in the snow and rain, or dying crossing the desert in the summer. Yet, even though thousands have died crossing the world’s most dangerous land border—including record numbers in the past two years—this is almost never mentioned in media reports on the “border crisis.” Instead, the most prominent “crisis” is the right wing narrative of an overrun, open border. Everything else follows. The Border Patrol is overwhelmed. The enforcement apparatus is overwhelmed. Washington is overwhelmed. An NBC headline alarmingly suggested that ICE and CBP might have budget shortfalls, or entirely run out of money (spoiler: that’s not going to happen). “Border crisis” has been used so frequently that it has become both abstract and mind numbing, a term deployed either to gain political points or to justify more funding for border and immigration enforcement, which has received more than a hefty $400 billion since DHS opened its doors in 2003. “Border crisis” rarely refers to people like the injured, sick, wet, and shivering asylum seekers at the border, who on Saturday included children and pregnant women.

Perhaps instead of portraying the border as in crisis, we should say that the border, by its very design, creates crisis. I thought about this on Monday when I went down with a group of Green Valley Samaritan volunteers to where the asylum seekers had crossed. The snow was gone, but the mud puddles were not. The makeshift camp where many of the 400 people had stayed was empty. I kneeled by a tent made of aluminum blankets where a single kid’s sandal was on the ground. I meditated on that sandal and wondered how many times I’d seen this same scenario over the decades in Arizona—a kid’s Mickey Mouse suitcase, a stuffed animal, a small pair of pants or a shirt—in places where people had camped. How many times had I seen the electrolyte bottles, black bottles, empty tin cans in desolate places of the desert where people couldn’t possibly carry enough water to get where they were going?

The border is designed to create crisis; that is the deterrence strategy. Right next to the camp were two idly parked Caterpillar excavators, presumably used to construct the border wall. Staring at them over the tents and makeshift shelters, I assumed that it was machinery from Spencer Construction—a company that received more than $600 million in contracts from CBP in the summer—for “border maintenance.” Now Spencer construction crews cruise up and down the border road, “filling in the gaps” of the border wall, as the Biden administration puts it. They filled in one such gap much closer to Sasabe several months ago, and now people crossed much farther away. With its focus on enforcement, the now-rejected border bill would have injected $14.4 billion into CBP and ICE (on top of a 2024 budget that was already more than $28 billion), including more funds for wall construction. Also included in the bill was money dedicated to surveillance technology, such as more autonomous towers (in addition to the nearly 400 such towers already installed), and the further digitization of the border, including systems for taking DNA samples from border crossers, and ground and maritime drone systems (yes, boat drones). Detention Watch Network describes the bill’s proposed expansion of ICE’s detention and deportation apparatus as the “largest appropriation of funds for immigration detention custody and surveillance operations in ICE’s history,” which included a daily capacity for detainment rising from 34,000 people to 50,000. Mind you, many of ICE’s detention facilities are run by private companies, so, as with surveillance, the profit motive is always lurking behind the scenes.

In short, the bill was what GOP lawmakers wanted, yet they rejected it. Democrats such as Chuck Schumer and Kyrsten Sinema (or excuse me ex-Democrat, now independent) lamented that Republicans weren’t taking the border seriously—an accurate critique, since the bill was only offering more fortification, including an unprecedented provision that gave Washington the authority to shut down the border (though it was unclear what closing the border meant exactly). Even more confusing was that Donald Trump opposed ramping up enforcement. It all makes sense, however, when the election is considered: Trump wants to run against Biden on this issue, but he can hardly do that if Biden is pounding the iron fist. As ABC News reported, “Trump probably still does benefit politically from a protracted [and manufactured!] border crisis.” However, Senator Chris Murphy, who was the chief Democratic negotiator for the bill, wrote: “Republicans can’t claim that the border is in crisis and then vote against the bipartisan bill, written by their own leadership, that would fix the problem.” He concluded, “Quite simply, we risk losing the 2024 election if we do not seize this opportunity to go on offense on the issue of the border and turn the tables on Republicans on a key fall voting issue.” The Senate Democrats took Murphy’s challenge and went on the offensive with a slick video on Twitter showing Democrats as hardline border enforcers. For his part, Biden stated, “Every day between now and November the American people are going to know the only reason the border is not secure is Donald Trump and his MAGA Republican friends.” In other words, the so-called border crisis has become a race to see which candidate can better fortify the border.

As for the people freezing and in various states of medical distress, this border cold war (and the proposed border bill) only makes matters worse. On top of that, according to a press release by No More Deaths on Saturday, Border Patrol agents told the humanitarian aid organization that they were “informed of the situation,” of people stranded in potentially life-threatening conditions, “but did not plan to drive out to address it.” Volunteers began to transport people from the border wall to the Border Patrol substation, also known as its processing center, so refugees could turn themselves in. Volunteers reported that Border Patrol agents in Sasabe detained and threatened them, and took pictures of their driver’s licenses. At one point there was a “rolling roadblock” of Border Patrol trucks. One volunteer reported a situation in which two agents spoke to them at “yelling volume” that seemed to be “backed with a bunch of anger.” The agents told the volunteers that they were “breaking the law” and threatened to arrest them and impound vehicles. But the volunteers persisted, driving the 15 miles or so back to retrieve more people. More and more asylum seekers assembled in front of the Border Patrol processing center. Eventually, the school in Sasabe was opened as a temporary shelter for the night. By the end of the day, the humanitarian aid organizations evacuated every person from the border. On Sunday morning all migrants were in Border Patrol custody. And as Arizona Public Media reported, “Seemingly at odds with the aid workers’ account, Customs and Border Protection says they prioritized the humanitarian response to the migrants abandoned in the cold.”

By the time I arrived on Monday, the real crisis had come and gone. There was the shoe, the blankets now drying on the mesquite trees, the construction workers driving up and down the road in their vehicles, and a 30-foot border wall meant to push people further into the desert. No More Deaths and Samaritans volunteers cleaned up the mess in the aftermath. What played out was not just a battle between humanitarian aid and the Border Patrol. It was a battle over what the crisis really was.

So, our brave nation and our courageous leaders are “existentially threatened” by a bunch of desperate unarmed people patiently waiting in misery to turn themselves in to the Border Patrol for asylum screening because our Government can’t process them in a fair and timely manner through legal ports of entry as required by law! That’s despite the relative predictability of flows of forced migrants and their slow progress toward the border.

If our “intelligence” services can’t foresee very public flows of forced migrants northward, and our nation can’t prepare to fulfill our legal and moral obligations to our fellow humans, Lord help us!

$600 million for annual “border maintenance,” but not enough trained Asylum Officers to screen asylum seekers at ports of entry? $28 billion for ineffective “deterrence,” but they can’t run resettlement programs that get asylum seekers and those granted asylum to the many places in the U.S. that need their skills? Gimmie a break!

This is the human face 😢 of our shameful and preventable bipartisan failure to meet our legal, humanitarian, and moral obligations to forced migrants at the border and elsewhere! No wonder cowardly politicos and complicit media don’t have the guts to “look their victims in the eye!”👁️ 🐥

And, the failed bogus bipartisan Senate bill that the Administration and many Dems tout and the media fawn over, would have done ABSOLUTELY NOTHING to solve this real humanitarian crisis at the border. Indeed, as almost all real border experts agree, it would have made the suffering and dereliction of duty by our Government immeasurably worse for these our fellow humans in need!

Thanks to folks like Todd Miller and Melissa del Bosque for bearing witness, speaking truth, and refusing to let our nation’s grotesque abuses of, and intentional misrepresentations about, forced migrants be swept under the carpet.

As the economy has improved and consumers have begun recognizing that improvement, Republicans have pivoted to attacking President Biden on a different policy weakness: immigration. After all, virtually everyone — Democrats included — seems to agree the issue is a serious problem.

But what if that premise is wrong? Voters and political strategists have treated our country’s ability to draw immigrants from around the world as a curse; it could be a blessing, if only we could get out of our own way.

Consider a few numbers: Last week, the nonpartisan Congressional Budget Office released updated 10-year economic and budget forecasts. The numbers look significantly better than they did a year earlier, and immigration is a key reason.

The CBO has now factored in a previously unexpected surge in immigration that began in 2022, which the agency assumes will persist for several years. These immigrants are more likely to work than their native-born counterparts, largely because immigrants skew younger. This infusion of working-age immigrants will more than offset the expected retirement of the aging, native-born population.

Instead, GOP lawmakers scaremonger about the foreign-born, characterizing immigration as an invasion. As Rep. Mike Collins (R-Ga.) dog-whistled last week, “Import the 3rd world. Become the 3rd world.”

Alas, the faction working to turn the United States into a developing country is not immigrants but Collins’s own party. It’s Republicans, after all, who have supported the degradation of the rule of law; the return of a would-be dictator; the gutting of public education and health-care systems; the rollback of clean-water standards and other environmental rules; and the relaxation of child labor laws (in lieu of letting immigrants fill open jobs, of course).

America has historically drawn hard-working immigrants from around the world precisely because its people and economy have more often been shielded from such “Third World”-like instability, which Republican politicians now invite in.

Ronald Reagan, the erstwhile leader of the conservative movement, often spoke poignantly of this phenomenon. In one of his last speeches as president, he described the riches that draw immigrants to our shores and how immigrants in turn redouble those riches:

Thanks to each wave of new arrivals to this land of opportunity, we’re a nation forever young, forever bursting with energy and new ideas, and always on the cutting edge, always leading the world to the next frontier. This quality is vital to our future as a nation. If we ever closed the door to new Americans, our leadership in the world would soon be lost.

Reagan’s words reflected the poetry of immigration. Since then, the prose — as we’ve seen in the economic numbers, among other metrics — has been pretty compelling, too.

Already the media are “at it again,” most attributing Democrat Tom Souzzi’s easy win over his GOP opponent for the House seat vacated by George Santos to his “move right” on immigration. But, as Catherine suggests above, “what if that premise is wrong?”

Sadly, and outrageously, the so-called Senate “compromise” border bill that Souzzi touted and which has become the “darling” of the tone-deaf mainstream media does neither. Not even close!

Yet, supposedly responsible journalists are falling all over themselves touting the benefits to Dems of a horrible “Miller-Lite” bill that essentially would have destroyed the right to asylum while turning the border over to cartels and smugglers to exploit some of the world’s most vulnerable who are victims of our own failings. We don’t have to “guess” at the human consequences of the nativist-inspired “bipartisan” non-solution at the border being trumpeted and glorified by Post editorialists safely ensconced in their “ivory tower!” We know! The results of recent half-baked attempts to close the border and eliminate asylum seekers are clear and well documented: death and human carnage inflicted on legal asylum seekers! Nowhere, and I repeat nowhere, are the voices of those with decades of actual hands on experience working with migrants at the border, and the voices of those migrants themselves, being heard and heeded in this “non-debate” that resulted not in a “compromise” but in a “human rights giveaway.” What gives us the right to arrogantly and immorally give away rights and human lives that are NOT ours in the first place as if they were “table favors at a political fundraiser?“

We are being offered a “choice” between “cruel and stupid” and “crueler and dumber!” Certainly, the Dems and our nation could and should do better!

Supporting fairness, orderly processing, and actions that protect asylum and the community would be a far more prudent choice for Dems than the virulent “death to asylum craze” (the unstated part of which is that it also means “death to asylum seekers”) that currently seems to be “in vogue” with both parties and mindlessly hyped by the media.

It’s quite possible that Souzzi won not because of his extreme position on asylum, but because his position was “less extreme” that that of his GOP opponent and her openly xenophobic party. This conclusion is actually supported by polls that show that while most voters understandably want “order at the border,” they also want to protect the right to claim asylum and a fair process for doing so. There is opportunity here for Dems to change minds and create a stronger coalition for asylum seekers and other immigrants. NGO experts like Beatriz Lopez need to partner with Congressional Dems who understand asylum and the border (like Rep. Hillary Scholten (D-MI) and Rep. Joaquin Castro (D-TX)) to reach out and meet with Rep. Souzzi and others like him to explain practical solutions and useful changes at the border that would create order while maintaining and enhancing fair and timely asylum processing.

Among these is the low-budget, common sense proposal advanced by retired Wisconsin Judge Thomas Lister and me for “Judges Without Borders,” essentially “leveraging” voluntary service by trained, retired State and Federal Judges to work with groups informing and advising individuals before they make the dangerous journey to our Southern Border. Beyond that, advocates must explain and model how migrants themselves can help resolve the problems facing Rep. Souzzi’s district and improve the quality of life for all. They must show how migrants are “part of the solution,” perhaps, for example, by establishing public-private partnerships that would involve migrant communities in constructing high-quality, attractive affordable housing that would help the entire community. Working on various civic improvement projects might also be a mutually beneficial option.

Advocates, NGOs, and political supporters of migrants must do more than just point to graphs and cite statistics about the long-term economic and societal benefits of immigration. They must actually model and create practical joint projects and expand opportunities for the benefit of migrants and the communities to which they have been relocated.

Problem-solving needs to be brought into the “here and now” rather than just being presented to U.S. communities as a vague promise of future benefits. My experience is that most people react to what’s before them today rather than than relying on a constructed view of tomorrow, now matter how attractive and statistically supported that future vision might be.

In addition to the misguided “Miller Lite nonsense” from the editorial board and, disappointingly, even the usually responsible and insightful Karen Tumulty, today’s WashPost contained useful observations from Eduardo Porter about the need to get migrants to places in the U.S. where they, their job skills, and their work ethic would be welcomed, appreciated, and useful.

But, both the Biden Administration and Congress have shamefully failed to convert this “low-hanging fruit” into reality. Even worse, that has allowed White Nationalist demagogues like Abbott and DeSantis to waste and divert millions in public funds to make the situation worse and to convert those who want to help America succeed and prosper into hapless “political footballs” being tossed back and forth between GOP nativists and wimpy Dem politicos who long-ago lost their moral bearings. Although NGOs and advocates are weary and overburdened, if they don’t take the initiative to make this happen, on at least some scale, the opportunity will be lost and the nativist myth-makers will prevail.

Only by modeling actual results in real time will we be able to demonstrate the fallacy and counterproductivity of the GOP’s nativist “burden myths.” There’s no time like the present to start!

Washington, D.C. (February 5, 2024) – Yesterday, Senate negotiators released language for the supplemental funding bill that would dramatically alter the U.S. asylum system in exchange for foreign aid and humanitarian assistance.

Ayuda joins immigrant communities and advocacy organizations across the country in strongly condemning this proposal that would lead to more families separated, children detained, and asylum seekers sent back to face persecution and even death.

Amongst many of the draconian changes proposed, this legislation would create a new authority, with narrow exceptions, that would allow officials to summarily expel asylum seekers. It would also restrict screening standards for asylum seekers and expedite asylum claims to the extent that many will not be able to access counsel or adequately represent themselves.

Ayuda and our partner organizations believe there are far more effective solutions to immigration policy failures. We call on the Senate to reject this framework, disentangle humanitarian assistance from changes that would eviscerate U.S. asylum law, and recommit themselves to building compassionate and humane immigration system.

So, let’s just focus on the real problem:

People close to Mr. Biden said he had always supported enforcing the law. Some of his top aides, such as Susan E. Rice, who served as his domestic policy adviser until last summer, and Jake Sullivan, his national security adviser, embodied that tough-minded approach.

“Migrants and asylum seekers absolutely should not believe those in the region peddling the idea that the border will suddenly be fully open to process everyone on Day 1,” Ms. Rice had said early on in Mr. Biden’s presidency.

Contrary to these border myths, which the NYT article does not really adequately take on, “the law” requires that individuals be given a chance to apply for asylum regardless of “status” and “entry point.” Congress provided a “quick screening” process called “credible fear” to deal with “mass migration” situations.

Assuming for the sake of argument that “the law” also requires that individuals be “detained” while credible fear screening and adjudication of claims by those who pass takes place, four elements are necessary for the legal system to work in a fair and timely manner.

Humane, NGO-operated reception centers, with on-site representation available, in locations preferably removed from the immediate border for screening to take place;
A huge corps of true expert Asylum Officers to do credible fear screening and outright grant clearly valid cases wherever possible;
A large corps of true expert Immigration Judges and BIA Appellate Judges to guide Asylum Officers, review their work, and, where the case can’t be granted at first instance, conduct timely full adjudication of claims for those who pass credible fear, prioritizing those claims most likely to succeed;
A functional resettlement program for those granted asylum and those whose cases require more in-depth process.

These four steps are the core of what real law enforcement at the border is all about! Prioritize them, accomplish them, and the other pieces will fall in place.

Contrary to Susan Rice, Jake Sullivan, and what the NYT article suggests, a plan to accomplish this 1) isn’t rocket science; 2) does not require legislation; and 3) needed to be “ready to go” with dynamic, courageous, due-process-focused leadership on Day 1 of the Administration or very shortly thereafter.

As always in Government, it’s a question of priorities, courage, and leadership. Despite the “overabundance” of proven, creative legal and administrative talent then in the private sector, most of whom were available to assist Biden, the Administration was not “ready to roll” with this program on Day 1 (as Steven Miller was with his vile “kill asylum and asylum seekers” agenda).

Sadly, even today, the Administration has not come close to putting in place any of these four critical requirements for success. It was highly predictable to any informed expert that forced migrants would continue to arrive at the border in large numbers and that GOP White Nationalists would “leverage” the Administration’s failure to achieve order at the border.

There is something else that’s completely predicable: That, if passed (a big if), the “nativist-driven compromise” now being “debated” by Congress and the Administration will NOT solve the humanitarian issue of forced migration BUT WILL create more death, trauma, and failure at the border and beyond.

Until America elects humanitarian-focused, problem-solving leaders with the vision to regularize fair asylum processing and the courage and skills to implement it, our border will continue to be a godawful mess: Just as GOP White Nationalists want! And, the great opportunity presented by talented asylum seekers who want only to save their and their families’ lives while helping us succeed will be squandered.

(RNS) — Chicago was already facing a homelessness crisis before Texas’ Republican governor, Greg Abbott, began directing thousands of migrants entering his state to Democratic bastions that had declared themselves migrant-friendly sanctuary cities.

Since the transfers began in April 2022, more than 20,000 migrants, many of them destitute Venezuelans, have arrived, and many Chicagoans have expressed concerns that the city’s resources are being drained and have accused government officials of failing to communicate about the migrants’ cost and their fates.

At the same time, advocates for the migrants, especially community organizers in more vulnerable neighborhoods, have pushed back against attempts to pit two marginalized groups against each other. These groups have stepped up to support the new arrivals and in many cases have found allies in local faith leaders.

Black said the majority of community residents want to find a way to both support the migrants and build support for a part of Chicago that has been historically underserved and underresourced. At the banquet at First Presbyterian, a speaker from Southside Together Organizing for Power, a community organizing group, talked about what it means to have Black and brown unity.

“It’s basically founded on this idea that there’s no scarcity,” Black said. “Not only is there enough for everybody — for the asylum-seekers, and the historically disenfranchised populations of South Side Chicago.”

He added, “We have so much more to gain from our unity than from the division which is being manufactured and orchestrated by interests that don’t want these communities to get the resources they need.”

Anyone who works in this space knows just how complicated our laws & system are, the challenges global crises present, all compounded by recent attempts to totally destroy our immigration system. We know this is hard. However, the President has had at his service very smart ppl, experts, not to mention those in NGO space w decades of experience who have provided him reams of recommendation papers from before he was elected President, all wanting to help him to succeed at making the immigration system more efficient, more fair, but I’d guess most also came out of 4 yrs of Trump wanting to ensure we treat ppl w dignity & respect their basic human rights. If only he would listen.

How did the President go from vowing to “restore asylum” & “stop kids in cages” to essentially trying to out-Trump Trump? I wish we had a President who had the political courage to stand by immigrants, to stand in public & declare why detention, border walls, & summary deportations don’t work, & to invest in humane & smart solutions. The truly enraging thing about this is he will never win in his gross political posturing despite throwing migrants under the bus, or more aptly–literally to the cartels–the Right will never be satisfied & now he has put himself on record as in favor of Trump’s policies.

Shame. Shame on whoever had a hand in this hateful declaration and shame on the leader who put his name to it.

MIAMI (AP) — Eight months after crossing the Rio Grande into the United States, a couple in their 20s sat in an immigration court in Miami with their three young children. Through an interpreter, they asked a judge to give them more time to find an attorney to file for asylum and not be deported back to Honduras, where gangs threatened them.

Judge Christina Martyak agreed to a three-month extension, referred Aarón Rodriguéz and Cindy Baneza to free legal aid provided by the Catholic Archdiocese of Miami in the same courthouse — and their case remains one of the unprecedented 3 million currently pending in immigration courts around the United States.

Fueled by record-breaking increases in migrants who seek asylum after being apprehended for crossing the border illegally, the court backlog has grown by more than 1 million over the last fiscal year and it’s now triple what it was in 2019, according to government data compiled by Syracuse University’s Transactional Records Access Clearinghouse.

Judges, attorneys and migrant advocates worry that’s rendering an already strained system unworkable, as it often takes several years to grant asylum-seekers a new stable life and to deport those with no right to remain in the country.

Experts like retired judge Paul Schmidt, who also served as government immigration counsel while the last major reform was enacted nearly forty years ago, say the broken system can only be fixed with major policy changes. An example would be allowing most asylum cases to be solved administratively or through streamlined processes instead of litigated in courts.

“The situation has gotten progressively worse since the Obama administration, when it really started getting out of hand,” said Schmidt, who in 2016, his last year on the bench, was scheduling cases seven years out.

The “debate” on the Hill defines “legislative malpractice!” The voices of legal integrity, experience, and practicality aren’t being heard! Also, lots of great ideas from experts on fixing EOIR are stuffed in the “Biden Transition Team” files squirreled away in some basement cubbyhole at Garland’s DOJ.

But most politicos aren’t interested in listening to the experts, nor do they seem motivated to understand the real human problems at the border, in the broken Immigration Courts, and how many of the things they are considering will make the situation worse while empowering smugglers and cartels! Those are real human corpses piling up along the border, carried out of immigration prisons, being abused in Mexico, and floating in the river — mostly due to the brain-dead “enforcement only” policies now being given an overdose of steroids by congressional negotiators.

So, things just keep deteriorating. Many in the backlog who deserve a chance at a permanent place in our society, and the ability to contribute to their full abilities and potential, remain in limbo! That’s bad for them and for us as a society!

We all have heard the story about the Rev. Martin Luther King Jr. the night before he was killed. How he’d seen the promised land and might not be with us when we got to the mountaintop. It’s important that we remember King incorporated the good Samaritan story into his speech.

He was in Memphis to aid sanitation workers, who were marching for a livable wage and safe working conditions. He went despite threats to his life and the fact that other civil rights leaders were present to march along with 1,300 Black workers on strike. He went because if not him, who? Here’s where he incorporated a Bible story we’ve heard before.

“And so the first question that the Levite asked was, ‘If I stop to help this man, what will happen to me?’ But then the good Samaritan came by. And he reversed the question: ‘If I do not stop to help this man, what will happen to him?’

“That’s the question before you tonight. Not, ‘If I stop to help the sanitation workers, what will happen to all of the hours that I usually spend in my office every day and every week as a pastor?’ The question is not, ‘If I stop to help this man in need, what will happen to me?’ ‘If I do not stop to help the sanitation workers, what will happen to them?’ That’s the question.”

King ended his speech by emphasizing the work we all need to do together to make this nation great, working toward justice not just for ourselves but for all those along the road we come across who require it.

“Let us rise up tonight with a greater readiness. Let us stand with a greater determination. And let us move on in these powerful days, these days of challenge to make America what it ought to be. We have an opportunity to make America a better nation. And I want to thank God, once more, for allowing me to be here with you.”

This is what I want to remember and honor this Martin Luther King Jr. Day.

Compare this message of self-sacrificing kindness toward fellow humans with the GOP “race to the bottom” taking place today during the totally overhyped and over-covered Iowa caucuses! (One more breathless account of the “enthusiasm gap” among Haley voters — not to mention her double-digit deficit in the endless “up to the minute” polls — could make a person want to puke.🤮)

Elected officials must act to prevent more migrant deaths

The United States has the resources to welcome new neighbors, but it is going to take cooperation, from the White House to the mayor’s office, to prevent further loss of life and improve safety for migrants.

It was heartbreaking to learn of the death of 5-year-old Jean Carlos Martinez Rivero, who had been living with his family at a privately contracted Chicago migrant shelter. This tragedy must be a wakeup call for all levels of government to start working together to protect people’s basic human rights at a time of increasing global humanitarian displacement.

For months, community members raised concerns about conditions inside the city’s shelters and volunteered to help better meet migrants’ basic needs. The accounts of life inside the shelter now coming to light are disturbingly similar to those that my colleagues at the National Immigrant Justice Center hear from clients held in immigration detention centers.

The city and the companies profiting from shelter contracts must be held accountable.

No doubt, the city has been forced to face the unprecedented challenge of welcoming thousands of new neighbors with minimal support from the federal government. The Biden administration and Congress must also be held accountable to repair the broken immigration system, support cities like Chicago that are welcoming migrants, and provide legal pathways so new arrivals have access to employment, secure housing and safety.

Jean Carlos’ death occurred at the same time the Biden administration and some U.S. senators are considering signing off on extreme anti-immigrant legislation in exchange for military aid for Ukraine and Israel.

The proposals under negotiation would create permanent new barriers to asylum protection and put U.S. immigrant communities at heightened risk of mass deportations. The proposals are structured to put Black, Brown and Indigenous communities at most risk.

Biden seems to have lost sight of his prior promises to defend immigrants’ rights, not to mention the U.S. government’s obligations to uphold international human rights law. Chicagoans should be holding our own Sens. Dick Durbin and Tammy Duckworth accountable to loudly oppose these proposals.

The United States has the resources to welcome new neighbors, but it is going to take cooperation at every level — from the White House to the mayor’s office — to prevent further loss of life and improve access to safety for migrant communities.

Unfortunately, accountability seems unlikely unless it happens at the ballot box. The GOP has become the party of inhumanity, irresponsibility, and immunity. And, although the Biden Administration and “wobbly” Dems tend to avoid overtly dehumanizing asylum seekers with their language, their actions and attitudes too often mirror those of Trump, Miller, and the GOP nativists. Indeed, quite disgustingly, politicos of both parties appear to expect to harvest political gains from the blood of migrants! 🤮

The Senate is basically engaging in “bipartisan” negations to knowingly and intentionally violate domestic and international protection laws, abrogate constitutional due process, and increase the number of unnecessary deaths of asylum seekers. That arrogant politicos, on both sides of the aisle, although primarily the GOP, openly advocate for such actions shows just how little fear of any type of accountability they have.

In many ways, that’s precisely the message that Trump and his MAGAmaniacs have been pushing — intentionally hateful and inflammatory language, followed by horrible, sometimes deadly, actions with little or no fear of any type of accountability. Sadly, the Dems seem to think that a program of cowardly acquiescence, rather than principled opposition, is the key to political success.

Migrants are cut from the same cloth as the rest of us

One of the words I have not heard to describe migrants — but is a more accurate than the negative portrayals — is “families.”

With the holidays upon us, there will undoubtedly be plenty of work parties, shopping sprees with kids in tow and the ubiquitous family gatherings. The coming months will also challenge us to wear layers of clothes and wrap ourselves and our loved ones in blanket-like coats. I am fortunate to have plenty of gloves, scarves, coats and boots.

Others are less fortunate. The unfortunate ones include the “new arrivals,” most of whom have never experienced a Chicago winter. Since the migrants’ arrival, critics have taken to the airwaves offering their comments about the tents, buses, use of police stations, encroachment on city streets, and, what they believe is the destruction of the city’s social and economic fabric. Descriptions of migrants are also disconcerting: liars, troublemakers, thieves, wayward parents using their kids to manipulate the immigration system and outsiders trying to live off the municipal dough.

One of the words I have not heard but is a more accurate depiction of the new arrivals is families. The buses full of people reflect a multi-generational exit from countries steeped in turmoil and unrest: infants, children, parents, or other caretakers. Describing those who arrive as families could lead us to consider them fully human, more like us. Instead, we use words that create a chasm that places the migrants at an arm’s distance from us, society and our city.

Throughout the next month, love, joy, harmony and peace will be words we will likely hear daily in songs, written in holiday cards and celebrated in plays and movies that bring friends and families together. Some will celebrate the season by remembering the birth of a unique child. Warned to flee to ensure the safety of his wife and newborn child, the family patriarch left for other lands. Wouldn’t it be remarkable if we could see the face of this child in the faces of the children we see coming here? Perhaps we can take the first step by using words that remove the stigma and distance between us and the “new arrivals.” The words? Families, of course.

I am at the Stanton Street Bridge between El Paso and Ciudad Juárez, where one year ago I watched groups of people wade through the shallow water to “pedir posada,” the Spanish-language term used for Joseph and Mary asking for refuge in Bethlehem 2,023 years ago. This year, there are no people below me, at least not right now, and the Rio Grande is a greenish, contaminated trickle that will dry up completely just east of El Paso, and then be replenished by the Rio Conchos 200 miles downriver in Presidio, Texas. On the other side of the bridge, you can see that the holiday season is in full gear as the line of people entering the United States coming from Ciudad Juárez extends up to the top of the bridge, exactly above the river. Surrounding the river are the props of the modern-day nativity scene: coiling razor wire, 30-foot walls, Texas Army National Guard troops and their armored jeeps, armed U.S. Border Patrol agents in their green-striped trucks, drone surveillance, camera surveillance, biometric systems. Partially, this is the result of the most money ever put toward federal border and immigration enforcement (as we reported this year, 2023 was $29.8 billion, a record number, which adds to the more than $400 billion since 2003). Partially, this is because Texas’s spending on Operation Lone Star, courtesy of Governor Greg Abbott and his right-wing, un-Christian justification machine, which has added up to $4.5 billion over the last two years. And this has been the response of the United States for people “pidiendo posada” for 30 years since Operation Blockade/Hold the Line began a border-building spree that has not ceased: there is no room at the inn.

I think of that cold night on the ground in a stable that is depicted in so many places this time of year as I walk past shivering refugees in heavy coats sitting outside against the Sagrado Corazón church in El Paso a few blocks from the border. I am reminded of the hundreds upon hundreds of people arriving to the Arizona border, as Melissa reported on earlier this week. I am reminded of the young Guatemalan mother I met myself at the border wall in late November as she tended to her two-month-old under the 30-foot border wall. They had been waiting there for two days. The infant was sick, and the nights were cold. The rest of the group, from the coast of Guatemala, built a fire to keep warm. When were the wise men going to arrive, the kings, the angels? The humanitarians did arrive, as they do, day after day (see Melissa’s reporting on that). I am reminded of being in Bethlehem myself a few years back, visiting the Aida refugee camp of Palestinians, which was surrounded by a tall concrete wall that had an embedded “pill box,” or a tower where snipers could point their assault rifles located mere miles from that stable where Mary gave birth on the cold ground. The Christmas story is playing out all around us, as lawyer and anthropologist Petra Molnar pointed out for us just yesterday. Where Mary, Joseph, and the infant Jesus had to flee Bethlehem when King Herod started to wield authoritarian power, the long trek to Egypt fleeing persecution is happening right now, throughout the world, such as in the Darién Gap in Colombia and Panama, as discussed in Melissa’s two interviews with anthropologist Caitlyn Yates—one podcast in December, one in August. Or the equivalent might be in the Mediterranean, as we discussed with Lauren Markham last June after a ship capsized near Greece, killing 600 people, or the countless places across the world where people struggle with a huge enforcement apparatus, which Anna Lekas Miller wrote about in her book Love Across Borders. We have spent the year doing our best to give you insight into what is happening on our borders.

I love this time of year, December, because things start to slow down, the frenetic pace starts to wane. For me, this becomes a more reflective period. Yet this modern Christmas story is anything but reflective. On television sets, commercials remind us of the holiday spirit (and to buy as much as we can), and movies have heartwarming tales of people coming together. Yet hospitality is scoffed at in words and policy, no matter what president, no matter what political party. Melissa has reported time and time again about the dehumanizing rhetoric; earlier this week, she wrote about a Fox News reporter talking about invaders and invasions and “credible fear thresholds.” This discourse abounds, with stories of people “taking advantage of our asylum system,” and claims that the United States can’t absorb any more people. Did Mary and Joseph hear similar soundbites on their journeys?

In these stories, we rarely hear about U.S. foreign policy, both historical and current. Take, for example, the Monroe Doctrine’s effect in Latin America: the centuries of upholding dictatorships, training generals, arming militaries—and, lately, creating border guards—and influencing politics, as well as the economic domination, in which corporate power and extractive industries enjoy a borderless world and can travel anywhere and take anything they want (see NAFTA, see CAFTA), from precious resources to cheap labor. Meanwhile, regular people—sometimes the very people displaced by corporate power—face harsher and harsher border regimes that extend throughout the continent. The same thing the Greg Abbotts of the world accuse undocumented people of doing here, corporate power is doing there. Studies have continually shown how a migrant labor force bolsters the U.S. economy in myriad, even critical ways (see, for example, the film A Day without a Mexican), yet border crossers get blamed for the big societal problems as if they had the power to set policy in corporate board rooms and in Washington. In the halls of power, debates stagnate over whether people are refugees or economic migrants—creating more divisions between the people most affected by the entrenched borders.

At the height of her pregnancy, Mary and Joseph walked for days, fleeing a Caesar Augustus’s occupying force—a story that resonates with more than 184 million people on the move today. I am reminded of my dear friend Irene Morales, a nun with the Madres of the Eucaristia, who I worked with two decades ago and who told me day after day—as we traveled through northern Mexico and the U.S. borderlands—that she saw Christ in the faces of people on the move. In the early 2000s, thousands of people were arriving to Altar, Sonora, to cross through the Arizona deserts. The people I talked to and interviewed were mostly from southern Mexico, and in many cases they were migrating because they could no longer make ends meet. From about 2002 to 2005, I talked to hundreds of people, and often it was parents thinking about their children, parents who talked about skipping meals for their children, wanting their children to get an education, or sometimes it was children on the move for a sick parent. So often it was a story of sacrifice at a time in a post-9/11 era characterized by a massive ramp-up on the border, with terrorism and migration blurring into each other at a policy level. “El rostro de Cristo,” Irene told me.

As I stand on the bridge in Juárez, where everything seems basically the same, I know a lot has happened over the last year, and we have covered much of it at The Border Chronicle. I, for one, have been following that contaminated river and have gone into Chihuahua to report on border water struggles for a forthcoming book, and I have shared some photo essays here. Melissa also wrote about Chihuahua earlier this year for The New Yorker, focusing on the epidemic of journalists assassinated in Mexico, which she summarized in The Border Chronicle. I feel so fortunate to work alongside Melissa, who not only wrote (and talked to experts) about the innards of this massive border fortification, whether it be the surge of wall building, deadly vehicle chases, Operation Lone Star, or Florida cops patrolling the border—and the right-wing rhetoric that so often propels it (not to mention the Elon Musk circus)—but also about people in border communities for inspiration and solutions such as border artists, a brilliant sidewalk school, or a doctor who spends his time treating border crossers (Doctor Brian Elmore also penned an op-ed for us). And that’s just a taste. This year, I had the opportunity to go to Yale and debate border enforcement, a humbling and educational experience, to say the least. As I wrote about my losing effort, some of the dynamics we constantly struggle with in this sort of border journalism were clearly revealed.

Much has changed over the last year, but—from what I can tell suspended between El Paso and Ciudad Juárez—much has remained the same. The border policy is the same, there is more money in the budgets, there is more money in as-of-yet-unpassed supplemental funding bills, there are more and more contracts for private industry. And now we have an election year. And, as we all know, during an election year, the border is a politician’s sacrificial lamb. So be prepared for a good dose of border theater, and we’ll be here with our coverage, commentary, interviews, and podcasts. The last thing I want to do is stand on that bridge a year from now and watch people wade through the trickling Rio Grande to “pedir posada” at a large gate at an even more fortified border wall in El Paso. That is, however, the likely outcome of 2024, and we will cover all of it. But we will also find the spaces where people are trying to make change, we will listen to the border communities, and we will document the humanitarian efforts. And trust me you, we will be looking in the places where there is generosity toward the stranger.

Also lost in the rush to cruelty and “deterrence:” Individuals have a legal right to apply for asylum at the U.S. border regardless of whether they arrive at a port of entry. See, INA, section 208.

The so-called “illegal” crossings are driven largely by the USG’s failure to implement timely and fair screening and processing at ports of entry. Even so, many individuals cross nearby the ports and wait patiently, in an orderly manner, outdoors, often in harsh conditions, to be “processed” by CBP.

This is hardly a “law enforcement crisis.” It’s a humanitarian crisis that, despite warnings and plenty of constructive ideas from experts, Congress and the Executive have jointly failed to address in a reasonable and responsible manner.

How unserious are Congress and the Administration about addressing the situation at the border in a responsible manner? The increasing flow of asylum seekers is predictable, considering that it is part of a worsening worldwide refugee flow.

So one logical, obvious thing to do, rather than building walls, prisons, and installing barbed wire, would be to hire and “surge” more USCIS Asylum Officers to the Southern Border to screen asylum seekers for credible fear, perhaps even expanding operations to foreign territory.

One year later, in September 2023, that number hadn’t changed! EXECUTIVE SUMMARY

This white paper provides a comprehensive assessment of the Biden

administration’s treatment of children facing removal in immigra-

tion court. While much attention has rightly been given to the Biden

administration’s border and asylum policy, less attention has been

paid to child-specific policies in immigration court. This matters

both because tens of thousands of removal orders have been issued

against children during the Biden administration, and because chil-

dren’s cases present unique legal issues—including most obviously

that children generally bear little, if any, legal responsibility for the

situations in which they find themselves.

We find that the Biden administration took important steps at the

outset to protect children in ways the prior administration did

not. The decision to exempt children from the border expulsion

policy known as Title 42 was particularly significant in this respect.

However, for children who were permitted to enter the system and

ordered to appear for proceedings in immigration court, the Biden

administration has largely continued the policies of previous admin-

istrations. Those policies have utterly failed to protect the rights of

children in court.

These failures are all the more striking because they have continued

even as the administration has signaled support for the principle

that children deserve legal representation in immigration court as

a matter of basic fairness. Department of Homeland Security Sec-

retary Mayorkas—the nation’s foremost immigration enforcement

official—has repeatedly stated that he does not believe children can

receive fair removal hearings without legal representation, even as

prosecutors under his purview have proceeded with thousands of

such hearings and obtained thousands of removal orders against

unrepresented children through those grossly unfair processes.

The administration’s policies toward children in immigration court

have far-reaching impacts. In the first five months of Fiscal Year 2022,

almost one third of all new cases in immigration court involved chil-

dren, including tens of thousands of children under the age of five.1

Some of these children are “unaccompanied” because they arrived

alone, while others are in “consolidated proceedings” with their fami-

lies. The immigration system, and the Biden administration, has failed

both. Many of these children proceeded without counsel, and a huge

number of children have been ordered removed for failure to appear.

We explain why these two policies—the imposition of in absentia

removal orders against unrepresented children and the failure to

provide counsel—are unlawful, and we provide recommendations

for how the Biden administration can remedy this crisis.

It should be obvious that immigration court proceedings are far too

complex for children to navigate without legal representation. As

Secretary Mayorkas acknowledged earlier this year, “a nine-year-old

child cannot navigate the immigration system.”44 Attorneys General

under the Obama administration made similar statements, as had

the government’s own expert in litigation challenging the failure to

provide counsel for children several years ago.45 Prior to that conces-

sion, one supervisory immigration judge was extensively ridiculed

for stating his view that he could teach three- and four-year-olds to

understand immigration law and represent themselves in immi-

gration court.46 Yet, despite the obvious absurdity of that view, the

Biden administration’s immigration courts—like the immigration

courts of all prior administrations—recognize no age below which

children cannot proceed without a lawyer in court.

CONCLUSION

Despite taking some strong symbolic and practical steps in its early

days, the Biden administration has failed children in immigration

court under its watch. In the last three years, Immigration Judges

have issued removal orders against tens of thousands of children in

violation of basic due process principles. Though the administration

has not enforced most of those removal orders, nothing will stop a

future administration from doing so without ever providing those

children a fair day in court.

But there is time to reverse course. We urge the administration to

adopt the concrete recommendations laid out in this paper: prohibit

the issuance of in absentia removal orders against unrepresented

children; terminate the Dedicated Docket; and ensure legal represen-

tation for all children in removal proceedings. To do so would make

real the Biden administration’s promise of a fair and humane immi-

gration system for children.

This should be a fixable problem! Instead, Congress and the Administration are fixated on making things worse for children and other legal asylum seekers at the border. What’s happening in the Senate now is neither a “negotiation” nor does it have much to do with “national security.”

It’s mostly about bullying the most vulnerable while diverting attention from the failure of all three branches of Government to address human migration and human rights in an rational, lawful, and constructive manner.

Artificially inflating and manipulating “in absentia” order statistics has been a long-time practice of EOIR under Administrations of both parties. The DOJ and EOIR use their own unfair procedures to paint a false picture of individuals evading the system.

In reality, statistics show that the overwhelming majority of those able to secure representation and therefore understand the “system” want fair merits decisions on their asylum applications.

But, as many who, unlike Garland and his minions, have actually practiced in the dysfunctional Immigration Courts know, getting a timely merits hearing on meritorious, already-prepared cases can be “mission impossible” in a system wedded to “Aimless Docket Reshuffling” and lacking in dynamic due-process-focused expert leadership!

Human migration is real;
Forced migration is largely beyond the unilateral control of any one nation;
Deterrence alone won’t stop migration;
More legal pathways for migration are necessary.

A robust asylum system is essential to national security. A closed border is as dangerous as an open border. If you close the asylum system, they will just cross illegally. Republicans need the border out of control. This is a trap!

That’s it in a nutshell! Reality and practicality have nothing to do with it. It’s about the GOP creating chaos and fanning hate! Unhappily, Dems fall for it — every time! That’s why American democracy is on the ropes!

The Dems have ready access to the greatest “treasure trove” of real life expertise and truth about the border in history. Yet, they routinely ignore it and let themselves be “hoodwinked” by GOP nativists peddling lies, hate, and myths. It’s seriously undermining our democracy while squandering human lives and potential!

There’s deep irony in “national security” being disingenuously parroted by a party lead by a demagogue who encouraged actual insurrection against the U.S. Government! Yet Dems and the “mainstream media” fall for it! Gimmie a break!
