Ariana Figueroa reports for Source New Mexico:

WASHINGTON — An immigration judge and lawyer told a U.S. Senate Judiciary panel on Wednesday that an independent immigration court would help ease a  backlog of more than 2 million pending cases.

Because the immigration court system is an arm of the U.S. Justice Department — the Executive Office for Immigration Review — each presidential administration has set immigration policy, and often those courts are subject to political interference, said Mimi Tsankov, an immigration judge, and Jeremy McKinney, an immigration attorney.

In the immigration court system, judges hold formal court proceedings to determine whether someone who is a noncitizen should be allowed to remain in the United States, or should be deported.

“Every administration has interfered with the courts. This undermines the courts’ integrity, and many of the executive branch’s manipulations of judges and their dockets simply backfire,” said McKinney, the former president of the American Immigration Lawyers Association.

Tsankov, the president of the National Association of Immigration Judges, said in order to alleviate the backlog of immigration court cases, Congress should establish an independent immigration court under Article I of the U.S. Constitution.

. . . .

“An independent board will begin the process of healing this broken system,” she said.

The witnesses also argued that many people going through the immigration system lack legal representation, which can greatly impact their outcome.

The top Republican on the Senate panel, John Cornyn of Texas, argued that most cases are without merit, as opposed to asylum cases, which are based on a credible fear of death or harm. He said that people are “clogging the courts” and are aware the severe backlogs will allow them to stay in the country. Some courts have backlogs until 2027.

Sen. Mazie Hirono, Democrat of Hawaii, pushed back.

“People who have attorneys are 10.5 times more likely to be granted relief,” she said. “So it is when they have attorneys that they can proceed with their asylum claims.”

She added that another issue is that many children who are unaccompanied, even some toddlers, are expected to legally represent themselves.

“There is no guarantee that children will also have a lawyer, and this is alarming because children are some of the most vulnerable people in our immigration system,” she said.

Cornyn said he did not believe that “the taxpayer should be on the hook” for paying for legal fees and representation.

McKinney said that those who have representation and are not detained are five times more likely to gain relief. Immigrants who are detained and have legal representation are 10 times more likely to be granted relief than those who do not have representation.

“The point is that representation ensures due process,” he said. “It also makes the system more efficient when all the parties know the rules and know how to present a case. Cases move faster.”

In his opening statement, ranking GOP Sen. Cornyn made it very clear that fixing the Immigration Courts is a nonstarter for the GOP.

Instead of engaging on this critically important initiative, he wasted much of his introduction disingenuously repeating the oft-debunked claim of a connection between asylum seekers and fentanyl smuggling. See, e.g., “Who is sneaking fentanyl across the southern border? Hint: it’s not the migrants,”  https://www.npr.org/2023/08/09/1191638114/fentanyl-smuggling-migrants-mexico-border-drugs.

Obviously grasping at straws, in the absence of any empirical support for his nativist “scare scenario,” Cornyn went so far as to suggest — of course without a shred of evidence — that perhaps “go-arounds” were smuggling fentanyl.

This theory appears particularly questionable in light of evidence that most fentanyl is successfully smuggled through ports of entry by U.S. citizens and legal residents. Why would cartels abandon proven successful methods of port of entry smuggling to entrust their cargos to individuals who might not even survive the border crossing and, if apprehended, would certainly be searched? Cornyn had no answer.

What does seem likely is that by concentrating border law enforcement largely on “apprehending” and fruitlessly trying to “deter” those merely seeking to turn themselves in to exercise legal rights, the USG has diverted attention and resources from real law enforcement like an anti-fentanyl strategy. That almost certainly would require undercover infiltration of smuggling rings — dangerous and sophisticated law enforcement operations far removed from “apprehending” folks who WANT to be caught because they were forced to leave their home countries, are unsafe in Mexico, and can’t wait to schedule asylum appointments at ports of entry through the badly flawed and inadequate “CBP One App!” Building a fair and efficient asylum system should even help CBP apprehend more of Sen. Cornyn’s “go arounds!”

But, Cornyn’s misdirection isn’t just a distraction; it’s actually dangerous! As the GOP has shown over and over, if you repeat a lie or myth enough times, folks start to believe it. Witness the demonstrably totally frivolous claims of election interference that drive much of the GOP’s agenda and has become “truth” for their misguided “base.”

A case in point is the outrageous political boondoggle recently carried out by Virginia’s right-wing Governor Glenn Youngkin. In response to Texas Gov. Greg Abbott’s White Nationalist plea, Youngkin wasted two million taxpayer dollars on a bogus detail of the National Guard to the Texas border, ostensibly to “protect Virginians from the scourge of fentanyl.”

However, a recent NBC 4 DC investigative team report showed that the Guard encountered no fentanyl at the border!  They accomplished nothing notable except to deny thirsty migrants they encountered water — on orders from Abbott’s troops! See https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwi7zp3Pq4eCAxVjEFkFHSmyAHYQFnoECA4QAQ&url=https://www.nbcwashington.com/investigations/inside-virginia-national-guards-2m-border-mission/3445536/&usg=AOvVaw3aI4OM_UhxJFVsE-bS3GYT&opi=89978449. As we often say, “The cruelty is the point!”

What if Youngkin had spent the same amount of money supporting NGOs in Virginia struggling to resettle and represent migrants aimlessly bussed to the DMV by Abbott and DeSantis as part of a political stunt? Community social justice NGOs generally use funds more carefully and efficiently than GOP blowhards like Youngkin and co.

The GOP claim that most asylum claims are frivolous also is misleading. For those who can actually get a merits hearing on asylum at EOIR — often in and of itself no mean feat given the prevalence of “Aimless Docket Reshuffling” — TRAC statistics for FY 2022 show that 46% are granted. See https://trac.syr.edu/whatsnew/email.221129.html#. And, this is in a system that is still heavily tilted against asylum seekers. EOIR still has many “holdover judges” from the Trump years who were hired not because of their expertise, qualifications, or reputations for fairness, but because their backgrounds indicated that they were likely to be unsympathetic to asylum seekers!

Moreover,  contrary to myth, the vast majority of represented asylum seekers show up for their immigration hearings. See, e.g., https://www.americanimmigrationcouncil.org/news/11-years-government-data-reveal-immigrants-do-show-court.

Admittedly, the manner in which EOIR keeps asylum statistics can make meaningful analysis difficult. For example, more than half of asylum “dispositions” are listed as “other” — which covers  “abandoned, not adjudicated, other, or withdrawn,” a facially, at least partially, circular definition! See https://www.justice.gov/media/1174741/dl?inline.

Moreover, since EOIR procedures generally require that all potential relief be stated at the time of pleading or presumptively be waived, prudence requires that the right to appply for asylum be protected, even if it is unlikely that the case will proceed to the merits on that application.

Also, it’s worth remembering that the Government already has a powerful tool for both identifying and quickly tossing frivolous asylum claims and expeditiously granting clearly meritorious claims to keep them out of the Immigration Court. It’s called the Asylum Office at USCIS! That despite much ballyhooed regulatory changes, DHS has failed to obtain “maximum leverage” from the credible fear/Asylum Office process is not a reason for eschewing EOIR reform!

What we can tell from the available data is that, rather than wasting more money on expensive and ineffective “deterrence gimmicks,” the best “bang for the buck” for the USG would be to invest in representation for asylum seekers and in a better, professionally-managed EOIR with better, independent judges, acknowledged experts in asylum law, who could “keep the lines moving” without denying due process or stomping on individual rights. They could also set helpful precedents for the Asylum Office. That’s what Congress and the Administration should be investing in.

Reforming the Immigration Courts and creating an independent Article I Court should be a high national priority. While no single action can bring “order to the border” overnight, fixing EOIR is an achievable priority that will support the rule of law and dramatically improve the quality and efficiency of justice at the border and throughout the U.S.

As Chairman Padilla (D-CA) said, this should be a bipartisan “no-brainer.” Just don’t look to today’s White-Nationalist-myth-driven GOP for help or rational dialogue on the subject.

🏀MARCH MADNESS:  Bucky Game, But Bears Got Game — Baylor Knocks Badgers Off Dance Floor! ☹️

March 21, 2021

The Wisconsin Badgers (18-13) made it respectable. But, the #1-seed Baylor Bears seized control early in the first half  of the South Second Round Game from West Lafayette, IN on their way to a convincing 76-63 victory. The Bears thus move on to the Sweet 16, while the Badgers’ season ends.

The three-point shot, which was the Badgers “best friend” in their round one victory over the North Carolina Tar Heels on Friday night, abandoned the Badgers and went over to the Bears. Baylor drained 8 of 17 threes for 47.1%, while Wisconsin shot only 37% from behind the arc, missing 13 of 21 attempts. Turnovers, often a Badgers strength, were their achilles heel this afternoon, with the Badgers committing 13 to the Bears’ four.

Baylor led 42-29 at the half. To their credit, the Badgers hung in and cut the lead to seven points several times in the second half. But, they couldn’t get any closer. After playing consistently against North Carolina, the Badgers reverted to their regular season form with several long “dry spells” that helped seal their fate. Overall, however, Baylor was just too good.

The Badgers were led by seniors D’Mitrik Trice (12 pts.), Nate Reuters (11 pts.), and freshman guard Jonathan Davis (10 pts.). The victorious Bears were paced by junior guard Matthew Mayer, who came off the bench to score 17, eight above his season average.

Although the Badgers were not expected to make the “Sweet 16,” they joined a growing list of Big-10 failures in this year’s NCAA Men’s tournament. Just before the start of the Wisconsin-Baylor game, the #8 Loyola Ramblers (led in spirit by their #1 fan, the famous “Sister Jean”) dominated #1-seed Illinois 71-58, in another “nobody saw this coming” upset. Of the nine Big-10 teams invited to the dance, only Rutgers, Michigan, Iowa, and Maryland remain alive, all with second round games coming up.

Congratulations to Coach Greg Gard and his team on another winning season and NCAA Tournament birth.

Not all news was bad for Wisconsin sports over the weekend. The Badger Women’s hockey team beat Northeastern on Saturday to win the “Frozen Four” and the NCAA Championship!

🏆CONGRATS TO THE CAPS! – WASHINGTON TOPS VEGAS 4-3 TO WIN STANLEY CUP FOR FIRST TIME IN 44-YEAR HISTORY! – DC’s 26 Year Dry Spell Of Major Sports Champs Ends In The Desert! 🏆

Putting years of Stanley Cup frustrations behind them, the Washington Capitals skated to a hard-fought 4-3 victory over the home team Las Vegas Golden Knights to win their first Stanley Cup in the team’s 44-year history. By contrast, Vegas was playing in the Cup finals in the first year of their existence as an expansion team. The Caps won the series 4-1.

After a scoreless first period, Washington jumped to leads of 1-0 and 2-1, but couldn’t hold on. Each time, the home-standing Golden Knights fought back to tie the score and took a 3-2 lead into the dressing room at the end of the second period.

Near the halfway point of the third period, the Caps’ Devonte Smith-Pelly tallied to tie the score. Then, with under nine minutes left Lars Eller added what proved to be the game winner. The Caps held off the Golden Knights’ frantic last-minute push to notch the win.

The “Great 8,” Caps’ Captain Alex Ovechkin scored the first goal and was named the MVP of the Cup series. It was a sweet moment for Ovechkin, one of the NHL’s all-time top goal scorers who more or less “reinvented” himself as an even better all-around player and inspirational leader this season under the guidance of Caps’ Coach Barry Trotz. By winning the elusive Cup, Ovechkin also shed the dubious title of being the “greatest hockey player never to win the Stanley Cup” which had been hanging over his head for most of his amazing and prolific career in DC.

So, tonight DC is “rockin’ the red” and celebrating its first major sports championship in 26 years, since the Redskins won the Super Bowl in 1992! Congrats again to the Caps, Coach Barry Trotz, long-suffering owner Ted Leonsis and the entire “Caps family” on a spectacular season and for bringing some joy to the DC area. Let’s Go Caps!

TRUMP DECLARES WAR ON AFRICAN-AMERICAN ATHLETES — DISSES CURRY, NFL, NBA, LEBRON JAMES REACTS! — Packers & Other NFL Teams Push Back Against President’s Appeals To Racism & Disrespect For Constitution!

http://www.cnn.com/2017/09/23/politics/donald-trump-nfl-nba/index.html

Chris Cillizza writes on CNN:

“On one level, this is classic Trump. He feels as though he is being disrespected — whether by NFL players not standing for the national anthem or by Curry saying if it was up to him, the Golden State Warriors would not visit the White House. (The Warriors, in a statement Saturday afternoon, said they would come to Washington and do events to promote diversity and inclusiveness rather than meet with Trump.)
They hit him, so he hit back.
But, there’s something far more pernicious here. Both the NFL and the NBA are sports in which the vast majority of the players are black and the vast majority of owners are white. In the NFL, there are 0 black owners of the 32 teams. In the NBA, Michael Jordan is the lone black owner of a team.
Consider that in the context of what Trump said both Friday night and Saturday.
In Alabama, Trump called the players who refuse to stand for the anthem “sons of bitches” and insisted that any owner worth his or her salt should fire them immediately.
That got a lot of attention — and rightly so. But it’s what Trump said next that’s really telling. “Total disrespect of our heritage, a total disrespect of everything that we stand for,” he said — adding for emphasis: “Everything that we stand for.”
Notice the use of “our heritage” and “we” in those two sentences above.
But wait, there’s more. In both his Curry tweet and his two NFL tweets, Trump expressed frustration that these lucky athletes felt the need to be ungrateful.
Trump noted the “great honor” of going to the White House and the “privilege of making millions of dollars in the NFL.” You should just be thankful for what you have and not be making any trouble, Trump is telling these players.
Here’s the thing: Even if we lived in a color-blind society, that would be a dangerous sentiment. After all, freedom of expression is right there in the First Amendment. And our brave soldiers didn’t fight and die so that everyone stood during the national anthem. They fought so people could have the right to make a choice about whether or not they wanted to stand. That’s the whole damn point of the First Amendment.
The thing is: We don’t live in a color-blind society. Slavery sits at the founding roots of America. The goal of racial equality remains a goal, not an achievement. To pretend otherwise is to willfully blind yourself to hundreds years of history.
Even more context darkens the picture for Trump. He played at racially coded language throughout his presidential campaign. He also displayed a stunningly simplistic view of the black community.
“You’re living in poverty, your schools are no good, you have no jobs, 58% of your youth is unemployed — what the hell do you have to lose?” Trump said of African-Americans in a speech to a largely white audience in Michigan during the campaign. When NBA star Dwyane Wade’s cousin was shot in Chicago, Trump tweeted: “Dwayne Wade’s cousin was just shot and killed walking her baby in Chicago. Just what I have been saying. African-Americans will VOTE TRUMP!”” He took an inordinate amount of time to condemn former Ku Klux Klan leader David Duke. And so on.
As President, Trump has done little too ease concerns about his racial views — and, in fact, has heightened them. His handling of the Charlottesville, Virginia, protests — in which white supremacists and neo-Nazis marched in protest of the removal of a statue of Robert E. Lee — was particularly alarming.
Even as the protests turned violent — one woman was killed — Trump claimed that there were violent factions “on many sides” to be blamed. Days later, he doubled down on that false premise; “I watched those very closely, much more closely than you people watched it,” Trump said. “And you have — you had a group on one side that was bad, and you had a group on the other side that was also very violent, and nobody wants to say that, but I’ll say it right now.”
Although his administration tried desperately to move on from his remarks, it was made clear recently that Trump meant exactly what he said. The day after meeting at the White House with South Carolina Sen. Tim Scott — the lone black Republican in the Senate — Trump was quick to note that he had been right in his initial comments after Charlottesville.
“I think especially in light of the advent of Antifa, if you look at what’s going on there, you have some pretty bad dudes on the other side also, and essentially that’s what I said,” Trump told reporters.
And now, this.
I’ve long believed that Trump is simply saying whatever comes to mind, that there is no broader strategy to his comments. But it’s impossible to conclude that after Charlottesville, Trump is totally ignorant of the racial context in which his remarks on the NFL and NBA land. No one is that oblivious.
When, given all the water under the bridge — both in terms of our country’s history and the more narrow history of Trump’s campaign — you make comments about how the athletes in predominantly black pro sports leagues should just be happy with what they have and not complain, you aren’t doing it by accident. You really believe it.
Play football or basketball so we can be entertained, Trump seems to be telling these athletes. No one wants to hear your lack of gratitude for what you’ve been given.
There’s so many things wrong with that view.
First of all, no one gave these players anything. They worked for it.
Second, just because you are a professional athlete doesn’t mean you don’t get to be a citizen, too. We don’t tell accountants, for example, that they can’t express their opinions on politics and the culture more broadly, right? So why should we be in the business of telling professional athletes? And would Trump feel the same way if the majority of those protesting the anthem were white?
Trump defenders will note that Trump didn’t name names — other than Curry — when he blasted professional athletes. That “we” are adding color to it, not him.

But that doesn’t fly. As I noted above, both the NFL and NBA are majority black. And those refusing to stand during the national anthem are, with one exception, also all black.
Trump knows this. He is an avid consumer of TV and culture. Which means that he is purposely playing at and with racial animus here. That is a dark thing to do as the leader of the United States. And something he deserves to be condemned for.”

As reported in the Green Bay Press Gazette, Packer President/CEO Mark Murphy issued the following statement:

The full statement from Murphy:

“It’s unfortunate that the President decided to use his immense platform to make divisive and offensive statements about our players and the NFL. We strongly believe that players are leaders in our communities and positive influences. They have achieved their positions through tremendous work and dedication and should be celebrated for their success and positive impact.

“We believe it is important to support any of our players who choose to peacefully express themselves with the hope of change for good. As Americans, we are fortunate to be able to speak openly and freely.”

**********************************

Trump’s racism and his condescending attitude toward minorities should come as no surprise given his campaign, his base, the GOP’s racially divisive agenda, and the folks surrounding him. It also should come as no surprise that Trump’s remarks came in Alabama, a state unable to advance beyond its disgusting racist history (except on the football field in Tuscolusa in the Fall) and move into the present.

It will be interesting to see what happens tomorrow at NFL stadiums. It will also be interesting to see whether African-American athletes put their money, time, and prestige behind encouraging others to vote so that Trump will never happen again and that the GOP stranglehold on our Government and our country will be broken.

Finally, why do we sing the National Anthem at sporting events in the first place? These athletic contests are entertsinment, not expressions of patriotism. We don’t sing it before concerts, movies, plays, and other performances. It doesn’t belong at sporting events either.

It is a bizarre and sad state of affairs when the President of the Green Bay Packers has to “school” the President of the United States on the meaning of our Constitution and an appropriate tone for race relations in our country!

⚾️NATS EXTRA: Bryce’s Big Blast Sends Easter Crowd Home Happy — Nats Top Phils 6-4 Despite Another Bullpen Meltdown!

https://mediadownloads.mlb.com/mlbam/mp4/2017/04/17/1292986883/1492397459976/asset_1800K.mp4

The Nats and Bryce Harper were down to their last strike on Easter Sunday. Nats relievers had blown a fine pitching performance by Gio Gonzalez and turned a 3-2 lead into a 4-3 deficit.

With two men on and two out in the bottom of the 9th and a 3-2 count on Harper, the Nat’s prospects for salvaging the “rubber game” of three with the Phils looked dim. But, Phils’ reliever Joaquin Benoit grooved a fast ball and Harper teed off, sending a towering blast 421 feet over the fence in the deepest part of center field at Nats Park. It was his second homer of the day (4th of the year) and his sixth career “walk off.” Take a look at the above link.

Also, congrats to the Washington Wizards for getting their playoff run off to a good start with a  114-107 win over the Atlanta Hawks behind a personal playoff high of 32 points from star guard John Wall. 🏀

Not as good a result for the Washington Caps on Saturday night in their Stanley Cup quest. The Caps dropped a tough one in overtime to the underdog Toronto Maple Leafs, 4-3. The teams move to Toronto for the next game on Monday night with the series tied 1-1.🏒
