A fed­eral ap­peals court for now agreed to nar­row the ef­fect of its re­cent rul­ing that blocked a Trump ad­min­is­tra­tion pol­icy of re­turn­ing im­mi­grants at the south­ern U.S. bor­der to Mex­ico while their re­quests for asy­lum are con­sid­ered.

The San Fran­cisco-based Ninth U.S. Cir­cuit Court of Ap­peals, in an or­der is­sued Wednes­day, said it ruled cor­rectly last week that the ad­min­is­tration’s “Re­main in Mex­ico” pol­icy is un­law­ful. But the court ac­knowl­edged the “in­tense and ac­tive con­troversy” over na­tion­wide in­junc­tions against ad­min­istra­tion poli­cies and said it would limit its rul­ing for now to the two bor­der states within its ju­ris­diction: Ari­zona and Cal­i­fornia.

The Ninth Cir­cuit also said none of its rul­ing would go into ef­fect un­til March 12, to give the Trump ad­min­is­tra­tion a week to ask the Supreme Court for an emer­gency stay to keep the pol­icy in place every-where for the time be­ing.

A fed­eral judge in Mary­land blocked Pres­i­dent Trump’s ex­ec­u­tive or­der giv­ing state and lo­cal gov­ern­ments the abil­ity to say no to hav­ing refugees placed in their com­mu­ni­ties.

U.S. Dis­trict Judge Pe­ter J. Mes­sitte is­sued a pre­lim­inary in­junc­tion Wednes­day that barred the ad­min­is­tration from im­ple­ment­ing the pres­i­dent’s or­der. He said refugee-re­set­tle­ment or­ga­ni­za­tions that sued to chal­lenge the pol­icy “are clearly likely to suc­ceed in show­ing, that, by giv­ing states and lo­cal gov­ernments veto power over the re­set­tle­ment of refugees within their bor­ders, the or­der is un­law­ful.”

Giv­ing states the power to de­ter­mine whether refugees will be re­ceived “flies in the face of clear con­gres­sional in­tent,” Judge Mes­sitte, a Clin­ton ap­pointee, said in the opin­ion.

This “victory” might be little more than symbolic for refugee advocates. In an unprecedented action, the Trump Administration has slowed the flow of legal refugees to a trickle and could simply use the “bureaucratic veto” to prevent any more from coming, as they have gotten away with in other areas.

Certainly, this should give lie to the Trump Administration’s inevitable argument to Federal Appeals Courts that this is an “emergency” requiring them to intervene prior to the completion of District Court proceedings. But, up until now, neither law nor reality has been much of a factor when it comes to the Supremes, and sometimes the Circuits, going “belly up” and allowing the regime to run roughshod over human lives and the rule of law in the immigration and refugee areas. 

Chief Justice Roberts wonders why the judiciary is treated with contempt by the regime and is losing respect from the large majority of the legal community not subservient to Trump. The answer is all too often pretty obvious.

Violence Plagues Migrants Under U.S. ‘Remain in Mexico’ Program

Migrants seeking shelter in the U.S. under Trump administration policy report rising numbers of kidnappings by criminal groups

NUEVO LAREDO, Mexico—Every morning, Lorenzo Ortíz, a Baptist pastor who lives in Texas, drives a 12-seat passenger van packed with food and blankets across the border to pick up migrants who have been dropped off in Mexico and ferry them to shelters.

His mission is to keep the migrants safe from organized crime groups that prowl the streets of this violent Mexican border town. Since the Trump administration began implementing its Migrant Protection Protocols program at the start of 2019—widely known as Remain in Mexico—some 54,000 migrants, mostly from Central America, have been sent back to northern Mexico to wait while their asylum claims are processed. Mexico’s government is helping implement it.

But in cities like Nuevo Laredo, migrants are sitting ducks. Over the years, thousands have reported being threatened, extorted or kidnapped by criminal groups, who prey upon asylum seekers at bus stations and other public spaces.

“Over the last year, it’s gotten really bad,” Mr. Ortíz said.

A typical scheme involves kidnapping migrants and holding them until a relative in the U.S. wires money, typically thousands of dollars, in ransom money. Gangs have also attacked shelters and even some Mexican clergy members who help migrants.

There have been 636 reported cases of kidnapping, rape, torture and other violent crimes against migrants returned to Mexico under Remain in Mexico, according to Human Rights First, which interviews victims in border cities and advocates for migrants’ due process rights. At least 138 of these incidents involved kidnappings of children.

Many more cases of extortion and violence go unreported for fear of retribution. As more migrants are returned to dangerous areas such as Nuevo Laredo under Remain in Mexico, the situation is expected to worsen, the nonprofit Human Rights First said in a recent report.

The Mexican government has played down the violence. Foreign Minister Marcelo Ebrard recently acknowledged kidnapping incidents, but said that “it’s not a massive number.” Only 20 such cases have been investigated by the government, he added.

The Trump administration has credited the program with deterring migrants from attempting to cross into the U.S. Monthly apprehensions of migrants at the U.S. Southern border have plunged from more than 144,000 in May to 33,500 in November. The Remain in Mexico program was expanded in June.

On a recent visit to the border, acting Department of Homeland Security Secretary Chad Wolf said the program has been a “game-changer” for U.S. Customs and Border Protection officers because it has freed them from having to perform humanitarian duties.

But Mr. Ortíz’s daily commute back and forth over the border highlights what migrants’ advocates say is a key element of the program—it isolates migrants not only from the legal counsel they need to argue their asylum claims, but from resources like food, shelter and medical care that are abundant on the U.S. side, but near-nonexistent in Mexico.

“You have all this infrastructure to help feed and clothe and house people set up on this side, in Laredo and Del Rio and Eagle Pass, and then suddenly the administration changes the policy, and you have to send it all to Mexico, because now everyone is on the other side,” said Denise LaRock, a Catholic Sister who helps distribute donations to asylum seekers through the nonprofit Interfaith Welcome Coalition. Mexico has been unable to provide enough safe shelter and other resources to migrants.

In Matamoros, another large recipient of asylum seekers under the program across the border from Brownsville, Texas, a tent city of more than 3,000 people has sprung up. Migrants there have complained of overcrowding, unsanitary conditions and insufficient medical treatment. In November, a migrant from El Salvador was murdered in Tijuana, opposite San Diego, while waiting with his wife and two children for an asylum hearing under the Remain in Mexico program.

On a recent, briskly-cold Wednesday, Mr. Ortíz, dressed in a ski vest and a baseball cap with the logo of the U.S. Chaplain International Association, picked up six migrants, including two children aged 8 and 14, at the immigration office in Nuevo Laredo. All were from El Salvador, Guatemala or Honduras, and were returning from legal appointments in the U.S. Hearings take place in makeshift courts set up in tents in Laredo, just across the bridge over the Rio Grande that separates the two cities.

At the front door of the office, six young men sat idly around a motorcycle, hats pulled low over their heads, watching the scene unfold, periodically walking up to the church van and peering in. Mr. Ortíz said these men were “hawks” or lookouts for criminal gangs.

“They know who I am, I know who they are,” he said. “You have to know everyone to do this work. The cartels respect the church. I’ve driven all around Nuevo Laredo in this van, full of migrants, and they never mess with me.”

At one point two of the lookouts asked the pastor for some food. He gave them two boxes of sandwich cookies. They clapped him on the shoulder, eating the treats as they walked back to their observation post.

Mr. Ortíz, a native of central Mexico, came to the U.S. at age 15 and eventually built a small contracting business in Texas. He became an ordained Baptist minister about a decade ago and three years ago began ministering to migrants full time. This year, he converted several rooms of his home in Laredo, Texas, into a dormitory for migrants and built men’s and women’s showers in his backyard.

After picking up the migrants, Mr. Ortíz ferried the group to an unmarked safe house with a chain-locked door on a busy street in the center of Nuevo Laredo, Mexico.

Inside, about 90 migrant families crowded into rows of cots set up in a handful of bedrooms and a concrete back patio. Among the Central Americans are also migrants from Peru, Congo, Haiti, Angola and Venezuela.

Reports of migrant kidnappings have increased since the Remain in Mexico program began, Mr. Ortíz said. In September, armed men stormed the safe house—one of two that the pastor brings migrants to—and detained the shelter’s staff for about an hour.

Since then, Mr. Ortíz said, the volunteer staff has stopped allowing migrants to leave the house unaccompanied, even to buy milk for young children at a nearby store.

Rosa Asencio, a schoolteacher fleeing criminal gangs in El Salvador and traveling with her two children ages 4 and 7, was returned to Nuevo Laredo under Remain in Mexico. She says she hasn’t been outside the shelter for nearly three weeks. “They can kidnap you anywhere,” she said.

María Mazariegos, an Honduran housekeeper, said she was kidnapped along with her 12-year-old daughter Alexandra from the bus station in Nuevo Laredo in September.

Gang members held her in a windowless cinder-block room that bore signs of torture for three days with one meal of tortillas and beans. She was released after her family members in the U.S. convinced her captors that they didn’t have the money to pay a ransom.

Then, two weeks later, while she was returning from a court appointment in the U.S., a shelter staff member confirmed, another group tried to kidnap her. An escort from the shelter was able to talk the kidnappers out of it.

She has court hearing under Remain in Mexico rules on Jan. 22, where a judge is expected to decide on her asylum case. If she is rejected, she plans to move to the Mexican city of Saltillo, where she has heard there are more jobs and less violence.

“Just about anywhere is better than here,” Ms. Mazariegos added.

Let’s not forget that the Immigration “Court” system that has life or death power over these asylum claims has been twisted and “gamed” against legitimate asylum seekers, particularly women and children with brown skins, by the White Nationalist politicos who unconstitutionally control it. All this while the Article III appellate courts look the other way and “swallow the whistle” on protecting the legal and constitutional rights of the most vulnerable among us.

Let’s see, essentially: “It’s great program because it allows us to evade our humanitarian duties under humanitarian laws and concentrate on faux law enforcement directed against individuals who are not legitimate targets of law enforcement.” Doesn’t say much for the legal and moral authority of the Article III, life-tenured judges who think this is acceptable for our country.

Obviously, this has less to do with the law, which is clearly against what the “regime” is doing, or legitimate law enforcement, which has little to do with the vast majority of legal asylum seekers, and lots to do with vulnerable, brown-skinned individuals desperately seeking justice being “out of sight, out of mind” to the exalted, tone-deaf Article III Judges who are failing to do their Constitutional duties. “Going along to get along” appears to be the new mantra of far too many of the Article III appellate judges.

Assuming that our republic survives and that “Good Government” eventually returns to both the Executive and the Legislative Branches, an examination of the catastrophic failure of the Article III Judiciary to effectively stand up for the Constitutional, legal, and individual human rights of asylum seekers obviously needs reexamination and attention.

The glaring lack of legal expertise in asylum, immigration, and human rights laws as well as basic Constitutional Due Process, and the total lack of human empathy among far, far too many Article III appellate jurists is as stunning as it is disturbing! The past is the past; but, we can and should learn from it. At some point, if we are to survive as a nation of laws and humane values, we need a radically different and more courageous Article III Judiciary that puts humanity and human rights first, not last!

The “Let ‘Em Die In Mexico Program” will not go down in history as a “law enforcement success” as Wolf-man and the other Trump regime kakistocrats and their enablers and apologists claim; it eventually will take its place as one of the most disgraceful and cowardly abandonments of American values in our history. And, the role of the complicit Supreme Court Justices and Court of Appeals Judges who turned their backs on our asylum laws, our Constitution, and human decency will also be spotlighted!

As I was “indexing” this article, I “scrolled through” the name and thought of my old friend the late Arthur Helton, a courageous humanitarian, lawyer, teacher, role model, and occasional litigation opponent (during my days at the “Legacy INS”). Arthur, who literally gave his life for others and his steadfastly humane view of the law, was a believer in the “fundamental justice” of the American judicial system. I wonder what he would think if he were alive today to see the cowardly and complicit performance of so many Article III appellate judges, all the way up to and including the Supremes, in the face of the unlawful, unconstitutional, institutionalized evil, hate, and tyranny of our current White Nationalist regime.

Immigration Tent Courts at Border Raise Due-Process Concerns

BROWNSVILLE, Texas—Each morning well before sunrise, dozens of immigrants line up on the international bridge here to enter a recently erected tent facility at the U.S. border.

Inside a large wedding-style tent, the government has converted shipping containers into temporary courtrooms, where flat screens show the judge and a translator, who are in front of a camera in chambers miles away.

The tents, which appeared at ports of entry here and up the Rio Grande in Laredo in late summer, are the latest manifestation of the Trump administration’s evolving response to a surge of migrants seeking asylum at the southern border.

Migrants are ushered to these courts dozens at a time, allowing them access to the U.S. legal system without admitting them onto U.S. soil. They are already part of yet another Trump administration experiment, the Migrant Protection Protocols, which requires migrants to live in Mexico for the duration of their court cases.

The administration says the tent courts are designed to help the immigration system move more quickly through cases, providing asylum faster for qualified applicants and turning away the rest—many of whom, the administration says, have submitted fraudulent claims.

In the past, nearly all families and children arriving at the border were allowed into the U.S. to await hearings. But now, tens of thousands of asylum seekers must wait months in Mexican border cities that have some of the highest crime rates in the Western Hemisphere.

On a recent Friday, Judge Eric Dillow connected with the Brownsville tent via videoconference from his courtroom in Harlingen, Texas, about 30 miles away. The migrants, seated at a folding table, were shown on a large screen.

Judge Dillow planned to hold hearings for 28 migrants that morning, but only 17 appeared at the bridge the requisite four hours before their 8:30 a.m. hearing. Only two brought a lawyer. The rest were read their rights as a group, and when asked if they had questions, none raised their hands.

James McHenry, head of the Executive Office for Immigration Review, the Justice Department agency that oversees immigration courts, said temporary courts adhere to the same procedures and offer the same rights to people as other immigration courts. “In all cases, a well-trained and professional immigration judge considers the facts and evidence, applies the relevant law, and makes an appropriate decision consistent with due process,” he said.

But immigrant-rights advocates and the union representing immigration judges—who are Justice Department employees—say the unique conditions of the tent courts deny migrants due process by depriving them of meaningful access to lawyers or interaction with judges, making the setup essentially a rubber stamp for deportation.

“It’s a system that’s designed in its entire structure to turn people away,” said Laura Lynch, senior policy counsel with the American Immigration Lawyers Association.

The judges union has expressed concern over numerous issues: Judges can’t interact with applicants face-to-face, which the union says is important to assess credibility. Immigration court officials aren’t in the tents, which are operated by U.S. Customs and Border Protection. Judges can’t hand migrants documents directly to ensure they contain no errors. Unlike most U.S. courts, the tents are closed to the public and press.

A Cuban asylum seeker waited in Matamoros to present his documents to the agent who will be escorting him to his immigration hearing.

“The space of the court is supposed to be controlled by the court,” said Judge Ashley Tabaddor, president of the National Association of Immigration Judges. “But the tents, we don’t have any control over.”

Most migrants who cross the border near Brownsville are sent to Matamoros, Mexico, just across the Rio Grande, where they live in shelters or tents near the bridge.

They are returned with little more than a sheet of paper stating their first court date and a list of lawyers to contact. But those contacts aren’t very useful because they have either U.S.-based or toll-free phone numbers that don’t function in Mexico.

Of the 47,313 people whose cases were filed between January and September, only 2.3% have legal representation and only 11 have been granted asylum or other legal status, according to the Transactional Records Access Clearinghouse at Syracuse University, which tracks immigration court data.

Pro-bono lawyers who work with these migrants are fearful to travel far beyond the U.S. border into Mexico. Inside the tents, lawyers are typically permitted 15 minutes to meet clients before hearings. In most other U.S. courts, lawyers are free to visit clients, and detention facilities provide more opportunities for meetings.

On two recent days in the tents, migrants appearing alone spent about five minutes each before a judge, while migrants with lawyers took between 20 and 30 minutes each.

“The system is dependent on individuals not finding representation because they can be deported much easier and faster,” said Jeff O’Brien, a California-based immigration lawyer representing several Brownsville clients pro bono. “If everyone had a lawyer, it would essentially come to a halt.”

Documentation errors are a common hurdle. Applicants’ addresses are often listed on forms as simply “domicilio conocido,” which roughly translates as general delivery, or sometimes a Matamoros shelter that many migrants avoid because they are scared to travel farther into the city.

Tent camp residents also had notices for hearings when courts aren’t open: one at 1 a.m. and another on a Saturday.

It isn’t known how the government notifies these migrants about changes in their cases without valid addresses. Migrants who aren’t at the bridge for hearings are assumed to have abandoned their cases. Government lawyers ask judges to deport absentees—ending asylum requests and barring them from the U.S. for a decade.

Asked about how address discrepancies are handled, a Justice Department spokesman said judges follow the Immigration Court Practice Manual. The manual requires migrants in the U.S. to notify the court of address changes, and in cases where they are detained, it requires the government to notify the court where. Neither scenario applies to migrants in Mexico.

Without lawyers, applicants routinely make paperwork errors—such as submitting documents in Spanish, or documents translated into English without a form certifying the translator is English-proficient—that advocates say they have seen judges use to order them deported.

At a recent hearing in Brownsville, a Honduran woman and her baby daughter appeared before Judge Sean D. Clancy in Harlingen. A CBP officer in Brownsville had faxed the woman’s asylum application to Harlingen, where a clerk handed it to the judge.

A Central American asylum-seeking mother hugged her child on a November morning in Matamoros.

“Are you afraid of returning to Honduras?” Judge Clancy asked the woman. A translator beside him repeated the question in Spanish. “Very much,” came the translated reply.

Judge Clancy looked at her application and noted a different response. “One question here says, ‘Do you fear harm if you return to your home country?’ And you checked ‘no.’”

The woman appeared confused. Judge Clancy told her to return to court with a properly completed application on April 15, when a date for her full asylum hearing would be set.

What a total disgrace and mockery of justice! What do Circuit Court of Appeals judges do for a living if they don’t have the legal skills and courage to stand up for our Constitution and our asylum laws against US Government fraud and abuses like this?

Nobody without a lawyer has any chance in this system! With a representation rate of an astoundingly low 2.3% due to the Trump regime’s intentional obstacles, roadblocks, and refusal to promote and facilitate pro bono representation, this system is nothing less than an unconstitutional and illegal “killing floor” (a reasonable chance to be represented by pro bono counsel is actually a statutory requirement). You don’t have to be much of an Article III Judge to recognize the the systemic fraud and abuse going on here. But, a judge would have to have the courage to stand up to the Trump regime and put a stop to this disgraceful nonsense! Sadly, courage seems to be something in very short supply at the appellate levels of the Federal Judiciary these days.

Judges Quietly Disrupt Trump Immigration Policy in San Diego

Immigration court terminates more than a third of ‘Remain in Mexico’ cases

SAN DIEGO—Immigration judges in this city are presenting a challenge to the Trump administration’s policy of sending asylum-seeking migrants back to Mexico, terminating such cases at a significantly higher rate than in any other court, according to federal data.

Between January and the end of September, immigration judges in San Diego terminated 33% of more than 12,600 Migrant Protection Protocols cases, also known as Remain in Mexico, according to data collected by the Transactional Records Access Clearinghouse at Syracuse University.

Judges in El Paso, Texas, the busiest court hearing MPP cases, terminated fewer than 1% of their more than 14,000 cases.

The nine San Diego judges have repeatedly ruled that asylum seekers waiting in Mexico weren’t properly notified of their court dates or that other due process rights were violated.

The high rate of dismissals is undermining the Trump administration’s goal of quickly ordering the deportation of more illegal border crossers who request asylum, including those who don’t show up from Mexico for their court hearings.

The effect is more symbolic than practical. Such a decision doesn’t mean a migrant is allowed to stay in the U.S., even if they show up for their court hearing. Instead, it saves them from being banned from coming to the country for 10 years and makes it tougher for the government to charge them with a felony if they cross the border illegally in the future. Those whose case is dismissed when they aren’t in court might not even know about the decision unless they call a government hotline.

Spokespeople for Customs and Border Protection, which carries out MPP at the border, and the Department of Homeland Security didn’t respond to requests for comment.

However, Immigration and Customs Enforcement, whose lawyers represent the government in immigration Court, have filed an appeal with a Justice Department panel. The appeal questions whether judges who terminate cases for migrants who don’t show up in court made a mistake.

A spokeswoman for the Executive Office for Immigration Review, the immigration court’s parent agency, said immigration judges don’t comment on their rulings.

Denise Gilman, an immigration lawyer and director of the immigration clinic at the University of Texas School of Law in Austin, said the high number of dismissals in San Diego sends a message that judges there believe many government’s cases don’t meet minimum legal standards.

That stands in contrast to immigration judges elsewhere, experts and advocates said.

“Everywhere but in San Diego, [judges] are going with the flow,” said Aaron Reichlin-Melnick, a lawyer and policy analyst with the American Immigration Council, which opposes the Trump administration’s border policies.

Immigration judges are unlike most other judges in that they are civil servants, neither appointed nor elected. In civil courts, some jurisdictions are known as more plaintiff- or defendant-friendly. Some federal appeals courts skew left or right, but most don’t rule so frequently on a single policy as immigration judges on MPP.

The Trump administration has sent more than 55,000 asylum-seeking migrants to Mexico to await court hearings under MPP. Migrants were first turned back in January, and through the end of September, just over 5,000 have been ordered deported. Eleven were granted some sort of relief, including asylum, according to TRAC.

Over two recent days in San Diego, multiple judges made clear that they had concerns about Remain in Mexico program as they dismissed cases.

Judge Scott Simpson terminated cases for a family of three from Honduras after ruling that the government violated their due process rights by not properly filling out their notice to appear. As a result, he said, the migrants didn’t know the grounds on which they could fight their case.

“I found that the charging document was defective on a technicality,” Judge Simpson explained to Belma Marible Coto Ceballos and her two children. “It just means that your court case is over.”

Ms. Coto quietly nodded as she listened to an interpreter before her attorney, Carlos Martinez, objected to the government’s plan to send the family back to Mexico while it appeals the termination. She and her children are afraid to return, Mr. Martinez explained, after Ms. Coto was assaulted in Tijuana.

Judge Simpson said he didn’t have the authority to keep the family in the U.S., but sought assurances that authorities would interview Ms. Coto about her fears of being sent back to Mexico.

During a separate hearing that same day, 10 MPP cases were closed by Judge Christine A. Bither, who also raised questions about the migrants’ addresses listed on government documents. She denied a government request to issue deportation orders in their absence.

Judge Simpson, meanwhile, repeatedly questioned how the government would update migrants in Mexico about their cases. Migrants routinely move between shelters or cities and don’t have a fixed address where they can receive mail.

He noted that migrants’ addresses are routinely listed on government documents as “domicilio conocido,” or general delivery in Spanish. In one case, he noted that “domicilio conocido” was misspelled for a migrant family that arrived late to the port of entry and missed the bus to immigration court. The government agreed to dismiss that case.

As noted in the article, the issues raised by the San Diego rulings are now before the Board of Immigration Appeals (“BIA”). Even if the BIA Appellate Immigration Judges “do the right thing” and reject the DHS appeal, I’m relatively sure that Billy Barr will change the result so that the DHS “wins” (and justice “loses”) no matter what the law says.

Larger question: a system where the biased prosecutor gets to hire and supervise the “judges” and then change the result if the individual nevertheless wins is obviously unconstitutional under the Fifth Amendment. So whatever happened to the Article III Courts whose job it is to uphold the Constitution and enforce the Bill of Rights against Executive overreach (which is exactly why the Bill of Rights was included in our Constitution)? Why are those gifted with life-tenure so feckless in the face of clear Executive tyranny?

Some Immigration Judges who lack life tenure and the other protections given to Article III judges are willing to stand up; those who are empowered so they can stand up instead stand by and watch injustice unfold every day in this fundamentally unfair system that is an insult to Constitutional Due Process, a mockery of justice, and a disgrace to their oaths of office!

WASHINGTON—The White House personnel office chief has told President Trump that his top two picks to fill the Homeland Security secretary job aren’t eligible under a federal law dictating who can fill the role without Senate confirmation, people familiar with the matter said.

During a meeting Friday at the White House, Sean Doocey, head of the White House Presidential Personnel Office, informed the president that neither Ken Cuccinelli nor Mark Morgan, who head two prominent immigration agencies at the Department of Homeland Security, were legally eligible to lead the department on an acting basis.

Mr. Trump and many of his top immigration advisers favored Messrs. Cuccinelli and Morgan, who have worked at DHS for only the past few months but are ardent defenders of the president’s immigration policies on television. The previous acting secretary, Kevin McAleenan, submitted his resignation this month but will remain on the job through the end of the month.

The two men were installed in the spring after the White House pushed out several officials, including former DHS Secretary Kirstjen Nielsen, whom they felt were standing in the way of tougher immigration enforcement.

Mr. Cuccinelli heads the U.S. Citizenship and Immigration Services, the agency overseeing legal immigration and asylum applications, while Mr. Morgan leads Customs and Border Protection. Both men are serving on an acting basis, and neither has been nominated by Mr. Trump for permanent roles, which would require Senate confirmation.

Although he is popular with conservative immigration activists, Mr. Cuccinelli in particular isn’t a likely candidate to lead the department on a permanent basis. He made powerful enemies in the Senate, including Senate Majority Leader Mitch McConnell (R., Ky.), when he ran the Senate Conservatives Fund, an outside group that challenged incumbent Republicans. Mr. McConnell has said his nomination would inspire a “lack of enthusiasm.”

The federal statute that governs vacancies states that acting officials in cabinet-level positions must either be next in line for a position or hold a Senate-confirmed position.

Under a third option, the official being elevated must have served for at least 90 days in the past year under the previous secretary.

 

During the meeting Friday, Mr. Doocey briefed Mr. Trump on an opinion from the Justice Department’s Office of Legal Counsel that the past secretary was Ms. Nielsen, not Mr. McAleenan, the people familiar with the matter said. Under that interpretation, Messrs. Cuccinelli and Morgan wouldn’t qualify, as they joined the agency after Ms. Nielsen departed.

The meeting with Mr. Trump on Friday included Stephen Miller, a top adviser to the president, and Emma Doyle, deputy chief of staff, the people said.

An administration official said the president hopes to announce his next acting DHS secretary in the next few days. Another White House official said the administration doesn’t intend for that person to serve for as long as Mr. McAleenan did.

The White House didn’t respond to a request for comment.

White House officials are instead considering Chad Wolf, Ms. Nielsen’s former chief of staff, as acting secretary, administration officials said, a move supported by Mr. Miller. In February, Mr. Wolf was nominated to serve as the department’s undersecretary for policy.

The White House is also considering David Pekoske, the Transportation Security Administration head who is serving as acting deputy DHS secretary, and Chris Krebs, head of the Cybersecurity and Infrastructure Security Agency, according to administration officials. Mr. Pekoske has already indicated to DHS colleagues that he doesn’t want the top job, though, and would prefer to return to the TSA full-time, according to a person familiar with the matter.

As Mr. Wolf’s possible appointment began to circulate on Monday, it drew public criticism from outside groups pushing a more restrictive immigration policy.

RJ Hauman, government relations director at the Federation for American Immigration Reform, pointed to Mr. Wolf’s past work for the National Association of Software and Services Companies, which lobbies for the U.S. government to issue more green cards to foreign workers each year. Advocates also said Mr. Wolf’s close relationship with Ms. Nielsen meant he likely wouldn’t steer the department in a more hard-line direction.

The legal ineligibility of Messrs. Morgan and Cuccinelli for the acting DHS post isn’t likely to have a big impact on Mr. Trump’s immigration agenda. The two men will continue at their respective agencies, where they have been given wide latitude to set policy and shape the administration’s immigration messaging—sometimes to the chagrin of Mr. McAleenan, the department’s top official.

A White House official said that if the next secretary formally nominated to lead the department doesn’t have a strong immigration background, the president may revive an idea to appoint a “border czar” to oversee the Department’s immigration policy and enforcement. That position wouldn’t require Senate confirmation.

Not hard to see the corruption here. DHS is actually supposed to protect our national security and fairly administer our immigration laws, which includes insuring that applicants for various benefits including asylum and legal immigration are promptly approved when eligible. It’s not supposed to be a repository for White Nationalist, racist, restrictionist, xenophobes and their extralegal policies. Enforcement is supposed to be professional, humane, even-handed, nonpartisan, and include reasonable exercises of prosecutorial discretion.

 

But, given the DHS’s well-deserved reputation as the least trusted and most despised agency of the Federal Government, I’m sure that whomever gets the next “acting” role will serve up a steady diet of cruel, illegal, and counterproductive xenophobia.

WASHINGTON—The union representing the nation’s more than 400 immigration judges filed a labor complaint against the Justice Department, escalating an already tense situation between the Trump administration and the judges carrying out its immigration policy.

The judges—who unlike most other jurists work for the Justice Department—based their complaint on two recent incidents.

The most recent occurred in late August, when the Executive Office of immigration Review, which oversees the judges, included a link to a blog post on a white nationalist website in its daily news briefing emailed to all employees. The blog post in question described immigration judges using several racial and ethnic slurs, angering judges around the country and prompting a formal letter to the office’s director.

The other incident came in April, when the union sought clarification from the Justice Department on whether the judges’ positions made them regular employees or managers in the course of contract negotiations. The Justice Department didn’t respond to the query but later filed a petition with the Federal Labor Relations Authority to decertify the union, on the basis it considered the judges managers.

The union’s complaint was filed with the Federal Labor Relations Authority, and could slow the Justice Department’s attempts to disband the union.

The judges’ union, known formally at the National Association of Immigration Judges, allows its leadership to fill a unique role as government employees empowered to criticize their employer and, by extension, the administration’s immigration policies.

The union has been outspoken about the government’s efforts to exert increasing political control over the nation’s immigration court system, narrowing the judges’ discretion around who can qualify for asylum.

Attorney General William Barr, for example, overruled the Board of Immigration Appeals in deciding people with family ties to gang targets or others with domestic violence claims couldn’t qualify for asylum. More recently, the administration has been temporarily allowed to enforce a rule disqualifying anyone for asylum if they traveled through a third country en route to the U.S. The rule faces further court challenges.

In its effort to move more quickly through a backlog of pending cases that has grown to more than one million, the Justice Department has also placed new quota requirements on the judges. It has pressed individual judges to move through cases faster, giving judges a one-year deadline to decide each case and setting a 700-case annual quota. Only about a third of judges are on track to meet that goal, according to A. Ashley Tabaddor, the union’s president.

The administration has also begun shifting cases to judges known to work quickly, sometimes handing cases to courts located far from where an immigrant is living. More recently, it has also begun diverting some judges from their normal duties to hear cases of the government’s “remain in Mexico” program, under which migrants who have claimed asylum must wait in Mexican cities while their cases make their way through the courts.

The government has set up makeshift tent courts at ports of entry to process these cases more quickly, and judges have been hearing cases using a videoconferencing tool. These courts, unlike most others in the country, aren’t open to the public or to journalists.

The union rebuked the tent courts’ closed conditions as “another glaring reason why the immigration courts have been deprived of key characteristics of what it means to be a court in the United States.”

The union has also argued that immigration courts should be given judicial independence, rather than answering to the Justice Department’s political leadership.

WASH­ING­TON—The Trump ad­min­is­tra­tion moved to al­low the gov­ernment to in­def­i­nitely de­tain fam­i­lies cross­ing the U.S.-Mex­ico bor­der and su­persede a decades-old court set­tle­ment that both lim­its how long mi­grant chil­dren can be held in cus­tody and sets stan­dards for their care.

The new rules are the Re­pub­li­can ad­min­is­tration’s lat­est ef­fort to tighten im­mi­gra­tion laws on its own, with Con­gress long un­able to agree on any le­gal over­haul. Wednesday’s pol­icy change could per­mit au­thor­i­ties to de­tain fam­i­lies through the du­ration of their im­mi­gra­tion pro­ceed­ings, rather than re­lease them or sep­a­rate chil­dren from their detained par­ents.

Im­mi­gra­tion-rights ad­vo­cates are ex­pected to chal­lenge the rules in fed­eral court, where they have blocked the ad­min­istra­tion be­fore. A le­gal chal­lenge would likely keep the pol­icy from tak­ing im­me­di­ate ef­fect.

Ad­min­is­tra­tion of­fi­cials say the new rules are in­tended to dis­cour­age fam­ily mem­bers from at­tempt­ing to cross the bor­der to­gether in the be­lief that they will gain an ad­van­tage in lodg­ing their asy­lum claims be­cause of the cur­rent de­ten­tion lim­its for chil­dren. “No child should be used as a pawn to scheme our im­mi­gra­tion sys­tem,” said act­ing De­partment of Home­land Se­cu­rity Sec­re­tary Kevin McAleenan on Wednes­day.

As Michelle points out, McAleenan and his corrupt DHS flunkies are simply “making it up” as they go along to justify unconstitutional, racist policies intended to target legitimate asylum seekers based on the color of their skin. By continuously doing “in your face” moves, often with little expectation of success in the in the courts, but a great expectation of rallying racial animosity for political gain, Big Mac & Co. are misusing their access to Federal Courts, constantly violating their oaths of office, and making a mincemeat out of Federal and State professional ethics rules.

Contrary to Big Mac’s false blather, the “solution” to the exodus of refugees is straightforward and not prohibitively expensive:

  • Release them to community placements;
  • Help them find pro bono lawyers;
  • Ask judges to schedule court cases at the earliest possible date consistent with the legitimate needs of those pro bono lawyers;
  • See what happens on the merits of their asylum cases in a fairer, non coercive system where applicants are encouraged to fully develop claims assisted by lawyers who understand the complexities of asylum law. (This is actually the way the U.N. Convention-based system is supposed to work, but too often doesn’t).

As I have pointed out before, even with unabashed bias and the open encouragement by the Trump  Administration of blatant anti-asylum adjudications, a significant number of represented Central American applicants continue to win their claims both before the Asylum Office and in Immigration Court.

Without the effects of intentionally coercive detention, and gimmicks intended to limit access to counsel and inhibit preparation, many of those who lose in Immigration Court will have a fair opportunity to exercise their legal rights to pursue their claims before Article III Appellate Courts. While far, far too deferential to flawed agency decision makers, the Article IIIs are much closer to operating as fair, impartial, and unbiased decision-makers than are Immigration Judges working for Barr and his White Nationalist regime. 

Over time, I think many more asylum seekers will win their claims. But, whether that happens or not, the process will have more legitimacy. U.S. asylum law will come to represent more than the Administration’s anti-asylum ideology. Those who lose their cases after exhausting their legal avenues for appeal can be removed in a dignified and humane manner after receiving full Due Process. 

This incident also graphically illustrates the “reward” received by those Democrats who recently worked in good faith with the Administration to pass “emergency border funding.” Rather than returning that good faith by using funds to improve conditions in detention and to explore the many available options to reduce the instances of detention, the Administration is squandering money in an almost certain to be DOA attempt to expand their White Nationalist Gulag to unnecessarily punish more (Hispanic) families for asserting their legal rights to apply for protection under U.S. laws.

I have seen little or no evidence that this “emergency funding” — falsely advertised as “necessary” to put food in kids mouths and provide them medical care — has been used for those purposes. By all reliable accounts, conditions in DHS detention remain intentionally deplorable. Instead of working in good faith with public interest groups and Democrats to solve the problems with border detention, Big Mac & Co. are off wasting time and abusing their publicly funded salaries by spreading lies and insulting the intelligence of Federal Judges. 

Indeed, Big Mac regularly ignores the overwhelming body of medical evidence that any amount of detention has potential lifetime adverse effects upon young people. The idea that the “Flores settlement,” which has been in effect for years prior to the Trump regime, is primarily responsible for fueling a surge of children fleeing the Northern Triangle is beyond absurd. Moreover, as Big Mac is undoubtedly aware, the increase in child refugees is part of a worldwide trend that transcends any particular U.S. court settlement. Actually, it’s the dumb policies of the Trump Administration and their insistence on using gimmicks rather than the legal mechanisms available that has fueled the profits of smugglers.

Enough! This Administration simply cannot be trusted on anything involving immigration and humanitarianism. Democrats need to demand fundamental, demonstrable changes at DHS, including a phase out of most civil detention, and a commitment to fair access to the legal system, as a condition for providing any further funding.

Mr. Trump is set to un­veil an im­mi­gra­tion plan de­vised in part by son-in-law and se­nior ad­viser Jared Kush­ner that in­cor­po-rates sev­eral ideas that have been gain­ing cur­rency in Re­pub­li­can cir­cles.

Chief among them: a bill crafted by con­ser­v­a­tive Re­pub­li­cans that would es­tab­lish a visa sys­tem pri­or­i­tiz­ing im­mi­grants based on cri­te­ria such as ed­u­ca­tion, Eng­lish-language abil­ity and high-pay­ing job of­fers.

The pro­posal also would elim­i­nate the di­ver­sity-visa lot­tery long de­rided by Mr. Trump as well as im­mi­gra-tion routes for fam­ily mem­bers such as sib­lings. More­over, it would limit the num­ber of refugees of­fered per­ma­nent res­i­dency to 50,000 a year.

More Trump “smoke and mirrors.” No, it isn’t about “diversity” as one Trump toady falsely claims. Trump eliminates the current diversity visas.

It’s largely about the (likely false) assumption by Trump and others in the GOP that they have cleverly defined “merit” in a restrictive way that will bring in more white, English-speaking, highly-educated individuals from Europe, Canada, Australia, New Zealand, etc. and fewer Africans, Hispanics, Haitians, and Syrians, etc.

Contrary to nativist expectations when the basic current system was enacted in 1965, “immigrants of color” have dramatically increased their share of legal immigration over the past half-century. That has led to a diverse, talented, innovative, dynamic, successful yet “less white” America. According to nativist stereotypes, dumping on family members and  refugees and increasing skill, educational, and English-language requirements will result in a “whiter” (that is “more meritorious”) immigrant population going forward.

However, like the nativists of 1965, Trump and his nativists might be surprised by the likely results of their own stereotypical assumptions. Actually, English-speaking immigrants from Africa, Haiti, the Middle East, Mexico, and Venezuela are among the highest skilled and best educated.

Of course, Trump’s elitist proposal also ignores that some of our greatest needs for immigrants pertain to important, but less glamorous, occupations for which neither education nor instant English language skills are a requirement. To keep our economy moving, we actually need more qualified roofers, construction workers, agricultural workers, child care workers, health assistants, security guards, janitors, landscapers, and convenience store operators than we do rocket scientists.

And, no, Tom Cotton and David Purdue, there aren’t enough “American workers” available to fill all these positions, even at greatly increased wages (which, incidentally, your fat cat GOP business supporters have no intention of paying anyway)! How high would the wages have to be to make guys like Cotton and Purdue give up their legislative sinecures (where they do nothing except show up for a few judicial votes on far right candidates scheduled by McConnell) and lay roofs correctly in 100-degree heat?

Rather than working against market forces to artificially restrict the labor supply, those wanting to improve wages and working conditions for American workers should favor higher minimum wages, aggressive enforcement of wage and hour and OSHA laws, and more unions. But, the GOP hates all of those real solutions.

The proposal also ignores “Dreamers,” which is sure to be a sore point with the Democrats. On the other side, it fails to sharply (and mindlessly) slash overall legal immigration levels as demanded by GOP nativists. While this proposal does not directly target children or dump on refugees from the Northern Triangle based on race and nationality, the ever slimier Trump sycophant Lindsey Graham has introduced a bill that promises to do both.

Beyond the purely humanitarian considerations, refugees make huge contributions to our economy and society.  So, why would we want to screw them over? Family immigrants arrive not only with skills, but with a “leg up”on adjustment and assimilation. So, why would we want to dump on them?

For the most part, this looks more like a Trump campaign backgrounder or a diversion from his endless stream of lies, unethical behavior, and downright stupid actions that are a constant threat to our national security. What it doesn’t look like is a serious bipartisan proposal to give America the robust, expanded, more realistic, market responsive legal immigration, asylum, and refugee systems we need to secure our borders from real dangers (which doesn’t include most asylum seekers and would-be workers) and move America forward in the 21st century. Without regime change and a sea change that would break the GOP’s minority hold on Congress through the Senate, immigration is likely to remain a mess.

Democrats largely came up short in their quest to limit the detention of immigrants as part of a bipartisan border deal reached this week, but the arcane math left lawmakers citing different numbers and activists on both sides crying foul.

The dispute over funding for Immigration and Customs Enforcement detention beds emerged as a late sticking point in the negotiations, and its resolution was key to the deal. Democrats wanted fewer beds and sought limits designed to prioritize the detention of criminals over other immigrants, such as people who overstayed their visas. Republicans wanted more beds and no constraints on which immigrants ICE can detain.

In the last fiscal year, Congress funded ICE’s average daily population at 40,520. Under the agreement reached by Democrats and Republicans this week, the administration will get funding for an average daily population of 45,274 in the current fiscal year, congressional aides say. ICE currently holds over 49,000 people in custody.

Democrats have pointed to the possibility that the negotiated number means ICE will have to reduce detention to make the new average work. Republicans have countered that ICE has the ability to transfer money, as it has been doing, to maintain a higher level of beds. Democrats aren’t disputing that they can transfer money, though they note that money will have to come from another account.

The complexities led to varying takes on Capitol Hill, with lawmakers disagreeing on whether the deal increased or decreased the number of detention beds.

Senate Majority Whip John Thune (R., S.D.) estimated that once ICE has transferred money, it could fund up to “58,000 or thereabouts” beds. Sen. Mazie Hirono (D., Hawaii) argued the agreed-to number of beds was actually a reduction. “They are pretty much at 45,000 or so,” she said.

Rep. Mark Meadows (R., N.C.), a hard-liner on illegal immigration, made the GOP’s initial goal his baseline. Comparatively, “it’s less than that,” he said. “It’s about 7,000 beds less.”

Pro- and anti-immigration activists both saw problems with the deal. Sandra Cordero, director of Families Belong Together, said the deal would keep detention levels steady and was “funneling more money to agencies that ripped thousands of children from their parents’ arms.” Mark Krikorian, head of the Center for Immigration Studies, said the reduction in ICE detention capacity “more than cancels out any benefit from that small amount of extra fencing.

Others saw the result as more clear-cut.

Sen. Mitch McConnell (R., Ky.), the Senate majority leader, claimed victory on the issue and applauded Democrats for abandoning what he called “extreme positions,” including “the idea that we should impose a hard, statutory cap on ICE detainees.”

Sen. Dick Durbin (D., Ill.), a member of the 17-lawmaker group that negotiated the border deal, said Tuesday the Democrats didn’t get everything they had hoped for on beds, a reflection of GOP control of the Senate and White House.

“We had hoped to not only stop the grand and glorious wall, paid for by Mexico, but also to deal with detention beds. I don’t know what the final wording is on this,” Mr. Durbin said, but “we wanted to address both, and it became more difficult when we realized the political reality.”

I recognize that the Dems couldn’t solve this problem in these particular negotiations. That’s particularly true because, as aptly noted by Senator Durbin, the GOP holds power in two of the three political entitles of government.

However, let’s not forget that “behind the numbers” are real human beings, not just objects like “beds” or “bed numbers” — terms used to dehumanize the victims and obscure the true nasty nature of DHS “civil” detention. Most of them are not serious criminals and there might not be an “actual suspected terrorist” in DHS detention today. Indeed, it would probably be “gross negligence” to entrust a real suspected terrorist to DHS detention. If given a reasonable chance to get a lawyer, understand the system, and prepare a case, the vast majority of those now detained would appear for their Immigration Hearings, particularly if given an opportunity to be released on ankle monitors or other “alternatives to detention.”

While in the “Gulag,” these individuals have their rights to fairness and Due Process impaired, suffer from substandard conditions (while private contractors who run much of DHS detention profit), and are often duressed into giving up valuable rights and opportunities to apply for relief and “taking removal” just to escape from the intentionally coercive situation that DHS creates.

Yes, a much more limited amount of detention, 15% to 25% of the current number of “beds” (actually humans held in the “Gulag”) might be necessary to protect us from the relatively small number of dangerous individuals and those likely to abscond.

Nevertheless, the “New American Gulag” as now constituted by Trump and enthusiastically supported by the GOP is both unnecessary and a total disgrace to our national reputation and humanity. So, the Dems should “keep at it” for the next budget cycle and continue educating the American public about the useless cruelty, intentional dehumanization, wasted taxpayer money, and questionable contractual arrangements involved in promoting this human rights abomination. It’s also a massive (and expensive) failure as a “deterrent” which, for the most part, is its real purpose.

It’s possible that the Article III Courts eventually will step in. As noted previously in this blog, the Administration appears headed for a “big time” loss on the constitutionality of indefinite detention in the 9thCircuit. However, unless Chief Justice Roberts “gets religion” and joins the liberals, the Supremes are likely to sell out the Constitution on this one. After all, none of the “Conservative Justices” are in unconstitutional indefinite “civil” detention right now. But, life being what it is, they might not want to be so smugly tone-deaf about caving to the Executive on issues affecting life and liberty. Who knows, maybe someday someone they are related to, know personally, or love will be arbitrarily tossed in the Gulag and have the keys thrown away.

Whether it happens now or long after I’m gone, history will judge the GOP and their enablers harshly for this intentional and thinly disguised racially motivated degradation of humanity.  It will have adverse consequences for our country and the world for many generations to come.

Therefore, it’s important to continue “making the record” and never letting the GOP off the hook for what they are doing (although, I will concede that the Dems have also gone through periods of infatuation with the idea of “detention as a deterrent.” Won’t work, never has, never will.)

And, this is from someone, me, who spent part of my earlier career defending, with mixed results, the “Legacy INS’s” right to detain individuals, sometimes indefinitely.

WASHINGTON—House Democratic leaders held firm through the five-week government shutdown that ended last month. Still, the party’s liberal wing is keeping up pressure on leadership as negotiations over a border-security deal heat up.

A group of liberal House Democrats and advocacy groups are urging Democrats in a bipartisan negotiating committee to refuse further funding for the Homeland Security Department, which oversees the border with Mexico. The group’s 17 lawmakers have less than two weeks to reach a deal before government funding expires again.

President Trump has said several times he is pessimistic lawmakers can reach a deal that he would accept, and he has threatened to take action to build his long-promised border wall on his own, including possibly declaring a national emergency.

Congressional leaders have been optimistic the group of House and Senate lawmakers can reach an agreement, but any bipartisan deal is unlikely to appease some in the party’s left wing.

A letter to House Democrats, written by freshman Democratic Reps. Ayanna Pressley of Massachusetts, Ilhan Omar of Minnesota, Rashida Tlaib of Michigan and Alexandria Ocasio-Cortez of New York, and signed by at least three others, criticizes Homeland Security for practices including prosecution and detention of immigrants.

The department and its frontline enforcement units—Immigration and Customs Enforcement and Customs and Border Protection—have become high-profile targets as they implement the Trump administration’s attempts to step up deportations and the zero-tolerance policy that last year resulted in family separations at the border.

“These agencies have promulgated an agenda driven by hate—not strategy,” the lawmakers wrote. They argue that the agencies’ ability to shift funds makes it impossible to prevent money from being used for policies that Democrats generally oppose.

Refusing funding for the agency housing the president’s top political priority isn’t going to draw Republican support, a House Democratic aide said, which the committee would need to produce a deal.

“It’s totally unrealistic,” Sen. Roy Blunt (R., Mo.), who is in the negotiating group, said of the Democratic letter. “That basically says you don’t want to secure the border.”

Democrats overall say they favor border security, just not Mr. Trump’s border wall, and immigration advocates said their task is to counter the president.

There hasn’t been any meaningful oversight of DHS or the mess DOJ politicos have created at EOIR in two years. So, while there certainly should not be additional funding for DHS’s already overused and abused detention system, for now, Democrats should probably work with DHS as the “only game in town” on the Southern Border.

Over the next year, DHS and DOJ politicos should be required to testify and should be held accountable for the absolute, largely avoidable, chaos and inefficiency they have intentionally, incompetently, or maliciously created in immigration enforcement, our Immigration Courts, the refugee and asylum system, and the system for granting immigration benefits.

Then, based on the record, make rational, fact-based proposals for needed improvements in immigration enforcement, administration, and adjudication for the next budget cycle.

E-Verify, the program that hard-liners favor because it bars hiring of illegal immigrant workers, was closed. Around 20,000 U.S. Border Patrol agents worked without pay for an agency already short of about 2,000 officers because of hiring issues and attrition.
“It’s chaos on top of disaster,” said Paul Wickham Schmidt, a retired immigration judge and former chairman of the Board of Immigration Appeals. “It’s already a system bursting at the seams….We have a shutdown over border security and immigration, but they shut the mechanism that issues final deportations. How does that make sense?”
The Trump administration says the court delays allow illegal immigrants to stay in the U.S. even if they don’t have strong claims to do so. Immigrant advocates say the delays weaken the cases of immigrants who do have claims to stay, and leave them in limbo.
Before the shutdown, the administration tried to accelerate the court’s docket by imposing case- completion quotas on its 400 judges. The president also proposed adding 75 judges as part of an ultimately unsuccessful deal to end the shutdown. The shutdown effectively denied the government one year’s worth of work by 40 judges—with no new judges to show for it.

Clearinghouse at Syracuse University, which tracks court activity. Between Dec. 21 and Jan. 11, a period that included some days where the courts would have been closed for holidays anyway, 42,726 scheduled hearings had been canceled, TRAC said.
TRAC estimated that each subsequent week the courts were closed would result in approximately 20,000 canceled hearings. Susan Long, TRAC’s co-director, said it couldn’t calculate a total for the backlog now because current Freedom-of-Information requests about the number of cases in the system, including new ones added, went unanswered as the people handling them were furloughed.

E-Verify, the voluntary online system employers use to verify workers’ immigration status, was suspended through the shutdown. Employers couldn’t enroll, create new cases or view existing ones. The 300 E- Verify workers at the U.S. Citizenship and Immigration Services were the only of the agency’s 17,973 employees to be furloughed because the program is funded through congressional appropriations; others, such as naturalizations, are funded through user fees.
Some supporters of tighter immigration restrictions say E-Verify is the federal government’s most important tool to curb illegal immigration because it makes it harder for illegal immigrants to work in the U.S.
Eric Ruark, director of research at NumbersUSA, a group advocating reduction of immigration both legal and illegal, said E-Verify is much more effective than border barriers, and his group has supported mandating its use for employers. “A wall is not at the top of our list,” he said.
E-Verify reported more than 40 million people were checked during the year ended Sept. 30, on requests from more than 266,000 employers, for an average of more than 750,000 cases a week. Citizenship and Immigration Services said employers were still required during the shutdown to obtain and submit information from new hires about their immigration status, even if they couldn’t immediately obtain a verification determination.
Customs and Border Protection required around 55,000 of its roughly 60,000 employees to work without pay through the shutdown, according to contingency planning documents drawn up by the Department of Homeland Security.
Meanwhile, Justice Department lawyers working on important litigation were furloughed, applied for stays, and courts agreed to postpone deadlines.

Lee Gelernt, an American Civil Liberties Union lawyer who is suing the administration in several cases, said he planned to use the government’s request for a pause against it in the case over asylum-seeking outside of ports of entry. “The administration told the Supreme Court—and the country—that the asylum ban was critical for our national security yet then asked that the case be stayed during the shutdown, leaving no doubt that the administration itself does not actually believe the asylum ban is a matter of national security,” he said.
A Justice Department spokeswoman, one of a handful working through the shutdown, said the government had been granted stays in some cases and denied in others. She said she couldn’t comment in detail because the majority of her co-workers were still furloughed.

“No idea,” one White House official said, asked about backup plans to end the shutdown. The White House didn’t respond to a request for comment.

Mr. Trump, in a Saturday address from the White House, called for $5.7 billion to pay for steel barriers on the U.S. border with Mexico, as well as funding for other border-security enhancements, in exchange for three years’ protection from deportation for some undocumented immigrants.

Those people are now protected by the Obama-era Deferred Action for Childhood Arrivals program, known as DACA.

“Nothing has changed with the latest Republican offer; President Trump and Senate Republicans are still saying: ‘support my plan or the government stays shut.’ That isn’t a compromise or a negotiation—it’s simply more hostage-taking,” Justin Goodman, a spokesman for Senate Minority Leader Chuck Schumer (D., N.Y.), said Monday in a statement.

Shortly before she graduated from Yale Law School in 1951, Patricia Wald secured a job interview with a white-shoe firm in Manhattan. The hiring partner was impressed with her credentials — she was one of two women on the law review — but lamented her timing.

“It’s really a shame,” she recalled the man saying. “If only you could have been here last week.” A woman had been hired then, she was told, and it would be a long time before the firm considered bringing another on board.

Gradually, working nights and weekends while raising five children, she built a career in Washington as an authority on bail reform and family law. Working for a pro bono legal services group and an early public-interest law firm, she won cases that broadened protections for society’s most vulnerable, including indigent women and children with special needs.

She became an assistant attorney general under President Jimmy Carter, who in 1979 appointed her to the U.S. Court of Appeals for the District of Columbia Circuit — often described as the country’s most important bench after the U.S. Supreme Court. She was the first woman to serve on the D.C. Circuit and was its chief judge from 1986 to 1991. Later, she was a member of the United Nations tribunal on war crimes and genocide in the former Yugoslavia.

Judge Wald, whom Barack Obama called “one of the most respected appellate judges of her generation” when he awarded her the Presidential Medal of Freedom in 2013, died Jan. 12 at her home in Washington. She was 90.

The cause was pancreatic cancer, said a son, Douglas Wald.

On the D.C. Circuit, Judge Wald served on three-member panels that decided some of the most complicated legal disputes on the federal docket. She wrote more than 800 opinions during her tenure — many on technical matters involving separation of powers, administrative law and the environment — and she counted herself among the more liberal jurists, viewing the law as a tool to achieve social progress.

At the time, demonstrators regularly gathered outside the South African Embassy to shame the apartheid regime and outside the Nicaraguan and Soviet embassies to call attention to human rights violations. (The case was brought by conservative activists protesting Nicaragua’s radical left-wing Sandinista regime and the treatment of Soviet dissident Andrei Sakharov.)

Writing for the majority, Judge Robert H. Bork cited the obligation of the United States to uphold the “dignity” of foreign governments. Judge Wald responded that the ruling “gouges out an enormously important category of political speech from First Amendment protection.”

Judge Wald played a small role in a long-running, high-profile case involving the Justice Department’s effort to break up the software giant Microsoft on the grounds of anti-competitive practices.

She dissented in 1998, when the court ruled that the company had not violated a consent decree regarding Microsoft’s bundling of its Internet browser with its Windows 95 operating system. She concurred with the government’s argument that bundling gave the software company’s browser an unfair advantage and could be financially harmful to competitors. (Microsoft and the Justice Department reached a settlement in 2002.)

In 1997, she delivered a unanimous opinion in a case growing out of a corruption probe involving Mike Espy, who served as agriculture secretary under President Bill Clinton and was accused of accepting illegal gifts. In her opinion, one of the most cited executive-privilege cases since the Watergate era, Judge Wald broadened the scope of executive privilege to include the president’s senior advisers while noting that it was “not absolute” and could not be claimed in all circumstances.

In a speech at Yale in 1988, she likened judges on the appeals court to “monks or conjugal partners locked into a compulsory and often uneasy collegiality. . . . I constantly watch my colleagues in an effort to discern what it takes to be a good appellate judge: alertness, sensitivity to the needs of the system and one’s colleagues, raw energy, unselfishness, a healthy sense of history, some humility, a lively interest in the world outside the courthouse and what makes it tick.”

Summer jobs at the factory

Patricia Ann McGowan was born in the factory town of Torrington, Conn., on Sept. 16, 1928. She was 2 when her father, whom she called an alcoholic, abandoned the family. Her mother raised her with the help of relatives. They all worked at Torrington Co., which produced sewing and surgical needles and, during World War II, ball bearings.

She remembered working summers, as a teenager, at the factory, “up to my arms in ball-bearing grease.” The drudgery and her encounters with union activists sparked her interest in labor law.

In 1952, she married a Yale classmate, Robert L. Wald. After a stint clerking for a federal judge and working as an associate in a Washington law firm, she shifted her attention to her family for the next decade.

She did legal research projects on the side, collaborating with Daniel J. Freed, a Yale classmate and Justice Department lawyer, on “Bail in the United States — 1964,” a book credited with spurring the Bail Reform Act of 1966. That landmark legislation upended the bail system, which had left poor defendants little choice but to languish in jail before trial, by allowing defendants to be released without bond in certain noncapital cases. (The act was later watered down by preventive-detention laws.)

Judge Wald led a team that successfully argued in 1970 before the D.C. Circuit federal appeals court that the financial barrier was effectively an unconstitutional denial of access to the courts.

Judge Wald’s subsequent work for the Center for Law and Social Policy, a public-interest law firm, led to one of the first court decisions requiring that school districts provide an adequate education to the mentally and physically disabled.

Sen. Gordon J. Humphrey (R-N.H.), citing an article she had written on the legal rights of children to seek without parental approval medical and psychiatric attention in extreme cases, accused her of being “anti-family.” Appearing before the Senate Judiciary Committee, Bob Jones III, a fundamentalist preacher and president of Bob Jones University in South Carolina, called her an “instrument of the devil.”

Judge Wald liked to recall that a reporter approached her son Thomas, then in high school, for his reaction to his mother being called a minion of Lucifer. “Well, she burns the lamb chops,” Thomas replied, “but otherwise she’s okay.”

Her husband, who became a prominent Washington antitrust lawyer in private practice, died in 2010. Survivors include their children, Sarah Wald of Belmont, Mass., Douglas Wald of Bethesda, Md., Johanna Wald of Dedham, Mass., Frederica Wald of New York and Thomas Wald of Denver; 10 grandchildren; and one great-grandson.

Judge Wald was a former vice president of the American Law Institute, an organization of legal professionals. After the collapse of the Soviet Union, she participated in American Bar Association efforts to assist structural changes to the legal systems of former communist nations in Eastern Europe.

In 1999, U.N. Secretary General Kofi Annan named her one of 14 judges, from as many countries, to serve on the war crimes tribunal for the former Yugoslavia at The Hague.

She sat for two years on the now-defunct criminal court and was on the panel of judges that in 2001 convicted former Bosnian Serb general Radislav Krstic, the first person found guilty of genocide by the tribunal. The tribunal sentenced Krstic to 46 years in prison for his role in the slaughter of thousands of Muslim men and boys near Srebrenica in 1995. An appeals court later reduced the sentence to 35 years.

Judge Wald brought what the New York Times called a refreshing lack of pomp to the tribunal, often running down documents herself, instead of dispatching clerks to fetch them, leaving her office door open for visitors and taking her meals in a canteen where judges were seldom spotted.

She sat on many blue-ribbon panels and commissions. But she said she took particular pride in her role in an appellate decision involving a Naval Academy honor student, Joseph Steffan, who had been expelled because he was openly gay.

Judge Wald was part of the three-judge panel that unanimously ruled in 1993 that the armed forces could not make sexual orientation the sole criterion for expulsion. The Justice Department then asked for a rehearing by the full D.C. Circuit court, which in a 7-to-3 ruling — with Judge Wald dissenting — rejected Steffan’s readmission.

“You always have a sad feeling when you write a dissent because it means you lost,” Judge Wald said in an interview with a D.C. Bar publication. “But you write them because you have faith that maybe they will play out at some time in the future, and because of the integrity you owe to yourself. There are times when you need to stand up and say, ‘I can’t be associated with this point of view.’ That was certainly the way I felt in the gay midshipman case.”

I knew Judge Wald back in the Carter Administration when she was the Assistant Attorney General for Legislative Affairs at the DOJ and I was the Deputy General Counsel of the “Legacy INS.” I was working for then General Counsel David Crosland, now Judge Crosland of the Baltimore Immigration Court. Part of my “portfolio” was the INS Legislative Program. Judge Wald’s “right hand man” on immigration legislation was my friend the late Jack Perkins who later went on to a distinguished career as a Senior Executive at EOIR.
I remember Judge Wald as wise, courteous, congenial, humane, practical, and supportive.  She was also a long-time friend of the late former EOIR Director Kevin D. Rooney who was then the Assistant Attorney General for Administration.
My favorite Judge Wald quote from this obit was the last one:
“You always have a sad feeling when you write a dissent because it means you lost,” Judge Wald said in an interview with a D.C. Bar publication. “But you write them because you have faith that maybe they will play out at some time in the future, and because of the integrity you owe to yourself. Yup, I can certainly relate to that.
