“The IJ’s conclusion that Gao failed to meet her burden of proof is based on the lack of sufficient corroborating evidence. As mentioned above, where, as here, the petitioner’s testimony is deemed credible, but the IJ finds that additional corroborating evidence is necessary to satisfy the burden of proof, the IJ is required to “(1) point to specific pieces of missing evidence and show that it was reasonably available, (2) give the [petitioner] an opportunity to explain the omission, and (3) assess any explanation given.” Wei Sun, 883 F.3d at 31; see also Pinel-Gomez, 52 F.4th at 529. Because the IJ failed to comply with these requirements here, we remand for the agency to reconsider Gao’s claim that she will be singled out for persecution if she returns to China.”

“Based on the statutory language, structure, and context of § 1252, we conclude that a reinstated order of removal is not final for purposes of judicial review until the agency has completed withholding proceedings. Only when those proceedings conclude, if the noncitizen is eligible for that review, has the agency finalized all mandatory review and “fully determined” the noncitizen’s fate. Arostegui-Maldonado, 75 F.4th at 1140 (quoting Luna-Garcia, 777 F.3d at 1185). A contrary conclusion would contravene the express intent of Congress. Our own circuit’s precedent is consistent with this interpretation, having long treated reinstated orders of removal as final once withholding proceedings are complete. We see no reason to upset that precedent. Because F.J.A.P. filed his petition within 30 days of the completion of his CAT proceedings, we have jurisdiction to hear his petition and proceed to the merits. … Here, the Board did not just declare an absence of evidence; it actively ignored the evidence relied upon by the immigration judge. … The Board reweighed and discounted evidence in F.J.A.P.’s case instead of properly disputing that evidence with contrary facts from the record. … The Board did not explain how the immigration judge’s conclusion that F.J.A.P. would likely be tortured for having “the audacity to file a police report” is illogical, implausible, or lacks support. The Board did not explain why, in a country where gangs control much of the government—an assertion which was supported in the record by the State Department’s country report—an individual complaint about the gang made to the gang-controlled police would not put a target on someone’s back. … For these reasons, we find that the Board erred by failing to apply the required clear error standard of review. Because the Board failed to apply the correct standard of review, we need not reach whether substantial evidence supported its conclusion. In light of this error, we grant F.J.A.P.’s petition and remand to the Board of Immigration Appeals for reconsideration of the immigration judge’s decision under the correct standard of review consistent with this opinion.”

Great, if disturbing, examples of the “culture of any reason to deny” that flourishes in too many places in Garland’s EOIR and the poor leadership from the BIA! All these respondents were “garlanded,” and only saved by their outstanding lawyers and the Circuits!

Congrats to the attorneys involved in all these cases. Gerald Karikari appeared before me at the “Legacy” Arlington Immigration Court. Ben Winograd is a superstar appellate litigator. Harry S. Graver is an attorney in the DC Office of Jones Day, where I was a partner in the 1990s. Chuck Roth is a “superlitigator” for the NIJC!

The season’s outlook for justice in Manager Merrick Garland’s EOIR:

In the often other-worldly, fact-free, one-sided “debate” about immigration and asylum, we must remember that severe over-denial, abuse of in absentia orders, “courts in prison,” and lack of positive precedents in Garland’s EOIR badly distort the success rate for asylum seekers that the Government often throws around. Because of Garland’s failure to legitimize EOIR asylum adjudications by cleaning house, replacing unqualified leadership, and insisting on judges with demonstrated asylum expertise and reputations for fairness, we actually have little idea how asylum seekers would fare in a fair and functional system where due process and decisional excellence were required. 

Suffice it to say that significantly more asylum cases would be granted in a more timely manner. We just don’t know how many more!

CA7 on CIMT, Retroactivity: Zaragoza v. Garland

Zaragoza v. Garland

“Dulce Zaragoza, a native and citizen of Mexico and a lawful permanent resident of the United States, pleaded guilty to the Indiana offense of criminal neglect of a dependent after locking her six-year-old son in a closet for six hours. She was sentenced to one year in jail suspended to time served plus 30 days, with the remainder of the sentence to be served on probation. After completing her sentence, she traveled abroad and presented herself for admission when she returned. The Department of Homeland Security (“DHS”) found her inadmissible based on the neglect conviction, which the agency classified as a “crime involving moral turpitude.” 8 U.S.C. § 1182(a)(2)(A)(i)(I). She was placed in removal proceedings. Zaragoza fought removal on several grounds, with her arguments expanding as the proceedings progressed. Before the immigration judge, she argued that the Indiana neglect offense does not qualify as a crime involving moral turpitude. The judge disagreed and entered a removal order, and Zaragoza appealed to the Board of Immigration Appeals (“BIA” or “the Board”). In the meantime, she petitioned the state court to modify her sentence. Her purpose was to bring herself within the so-called “petty offense” exception to inadmissibility, which is available to first-time offenders sentenced to six months or less. Id. § 1182(a)(2)(A)(ii)(II). The state court obliged and reduced her one-year sentence to 179 days. With that order in hand, Zaragoza argued before the BIA that Indiana’s neglect offense is not a crime involving moral turpitude, and regardless, the petty-offense exception applies. The BIA rejected both arguments, agreeing with the immigration judge that the Indiana offense is categorically a crime involving moral turpitude, and further holding that the sentence-modification order was not effective to establish Zaragoza’s eligibility for the petty-offense exception. For the latter conclusion, the Board relied on a recent decision of the Attorney General declaring that state-court sentence modification orders are effective for immigration purposes only if based on a legal defect in the underlying criminal proceeding. Matter of Thomas & Thompson (“Thomas”), 27 I. & N. Dec. 674, 690 (Att’y Gen. 2019). Zaragoza sought reconsideration, this time adding two more arguments: (1) the phrase “crime involving moral turpitude” is unconstitutionally vague; and (2) the Attorney General’s decision in Thomas is impermissibly retroactive as applied to her. The BIA disagreed on both counts. Zaragoza petitioned for review in this court, reprising the entire array of arguments she presented to the Board. We agree with the BIA’s resolution of all issues but one: applying Thomas in Zaragoza’s case is an impermissibly retroactive application of a new rule. We therefore remand to the BIA for further proceedings consistent with this opinion.”

Crimmigration attorneys, get your motions ready.

At least in Chicago! Matter of Thomas and Thompson CANNOT be applied retroactively in the Seventh Circuit!

Sentence modifications/clarifications/European vacations obtained pre-T&T and that comply with Matter of Cota Vargas/Song/Estrada must be recognized for immigration purposes!

Also, when will A.G. Garland weigh in on Matter of Thomas and Thompson? The time is now.

When the BIA starts not with the correct legal concept that retroactivity is disfavored in the law, but rather with “how can we best help DHS Enforcement and/or curry favor and job security from our political ‘handlers’ at DOJ,” “bad things are going to happen.” And, they do, over and over!

There are plenty of well-qualified “practical scholars” out here who understand retroactivity in the immigration context and would get these basic questions right in the first instance without bothering the Courts of Appeals or generating disorder, inconsistency, and unnecessary backlog! Why hasn’t Garland recruited them to be the “New and Improved BIA” that would actually be driven by legal expertise, practical scholarship, due process, and fundamental fairness? The latter are qualities that EOIR and DOJ claims it seeks in Immigration Judges. But, it’s not the reality that practitioners too often actually face in todays dysfunctional, inefficient, and hopelessly backlogged EOIR. 

The public and those subject to substandard judging and often dehumanizing treatment by EOIR are suffering — amazingly, now more than ever! When will Garland do his job and reform his courts to conform to due process, fundamental fairness, best interpretations of law, and best practices? 

The latter desirable qualities, actually necessary for any legitimate judiciary, are certainly NOT descriptive of today’s broken EOIR! Garland and his lieutenants might consider themselves “above the fray!” 

But, my already over-stuffed e-mailbox is “lighting up” with EOIR horror stories from experienced, long-time practitioners who are questioning whether they can continue practicing in the hostile, lawless, “no due process,” “no customer service,” “no common sense,” “blame the victim” environment that Garland has allowed to mushroom, and sometimes even encouraged, at EOIR. 

I mentioned the term “Dedicated Docket” at an Executive Session of a major NGO recently. The anger and disgust that it provoked from those actually “doing the job” of fighting for justice in Garland’s broken system was palpable! 

Why is a Democratic Administration that is, despite beating expectations in the midterms, still hanging on by a thread, inflicting this type of disrespect, pain, and suffering on its own loyal supporters? How will this self-created legal, Constitutional, human rights disaster play out moving toward 2024!

“The EOIR HQ Tower” needs a complete shake-up and replacement of  those who have demonstrated their inability to get the job done with those who can! The latter are out here. But, the worse Garland lets his system get, the harder and most costly (dollars and lives) it will be to fix it!

“After an immigration judge ordered him removed from the United States, Olawole Oluwajana appealed to the Board of Immigration Appeals and retained counsel to represent him. But the government was slow in providing a copy of Oluwajana’s immigration file, without which his attorney could not prepare a brief. The Board granted one extension but denied a second, suggesting that Oluwajana instead submit his brief with a motion seeking leave to file it late. When he did so, less than two weeks after the submission deadline, the Board denied the motion in a cursory—and factually erroneous—footnote. And having rejected the brief, the Board upheld the removal order without considering Oluwajana’s allegations of error by the immigration judge. Based on the undisputed circumstances of this case, we conclude that the Board abused its discretion by unreasonably rejecting Oluwajana’s brief. We therefore grant the petition for review, vacate the Board’s order, and remand for further proceedings.”

Here, the BIA took 7 months to set a briefing schedule, didn’t get the file to counsel in a timely manner, then “dinged” the R’s counsel for being 12 days late in filing a brief on a complex issue where input from legal counsel would likely be “outcome determinative!”

But, along the way, “Garland’s Clown Show” 🤡 fabricated a 33 day “late period.” And, to add insult to injury, they ignored their own regulations and instructions to counsel.

Even OIL couldn’t defend this one! But, Garland nevertheless retains the “Miller Lite” Clowns from his predecessors’ “whatever it takes to deny and deport assembly line!”  No quality, no fairness, no accountability! Just “anything goes” when it’s “only immigrants of color!”

Briefing schedules aren’t “rocket science.” But Garland’s “Miller Lite” holdover gang can’t even get the simple stuff right!

How is this “expert judging” entitled to “deference?” 

How is having the Circuit spend time cleaning up Garland’s messes an acceptable use of Article III resources? 

What happens to the many human victims of Garland’s unjust and unprofessional system who don’t have Scott Pollock & Co. to take Garland to the Court of Appeals? 

What happens to Garland’s victims when the CA is on “autopilot,” which often happens?

Is it any wonder that “judges” who would rather fight with attorneys than read their briefs are running an astounding 1.6 million case backlog and an appellate backlog of 82,000, up approximately 7 times from just four years ago?

Wonder why an AG running a “second (or perhaps third or fourth) class justice system” for people of color isn’t a very effective leader or force for racial justice in America?

“In 2019, the Department of Human Services (“DHS”) sought to remove Ilir Osmani, a refugee of the Kosovo War, based on his criminal convictions and crimes of moral turpitude. An Immigration Judge (“IJ”) granted Osmani’s petition for an adjusted status under 8 U.S.C. § 1159(a) and for waiver under 8 U.S.C. § 1159(c). The Board of Immigration Appeals (“BIA”) reversed the IJ’s ruling based on new arguments the government, after failing to take any position before the IJ or to provide any notice to Osmani, raised for the first time on appeal and denied Osmani’s motion to remand for additional factfinding on the conditions in Kosovo. We find the BIA legally erred by considering arguments the government did not present to the IJ, put Osmani on notice of, or develop any record evidence to support. In denying Osmani’s motion to remand, the BIA also abused its discretion by engaging in impermissible factfinding. Accordingly, we grant Osmani’s petition for review and remand to the BIA. … Accordingly, we GRANT the petition for review; VACATE the Board’s decision in this case; and REMAND to the BIA for further proceedings consistent with this opinion.”

The outrageous errors, pro-DHS bias, gross incompetence, and lack of judicial qualifications reflected by this BIA decision is absolutely stunning, as is the Biden Administration’s:

  • Deportation of the respondent while this court challenge to this error-fest was pending (the respondent was removed based on this illegal order in April 2021, well after the Biden Administration took office and a month after Garland was sworn in as Attorney General);
  • The DOJ’s prima facie unethical defense of the BIA’s denial of due process, failure to follow precedent, clear abuse of discretion, and legally indefensible actions here;
  • Continuing abuse of scarce pro bono resources and Article III judicial time by not bringing in fair, expert, new, due–process-dedicated BIA judges who would get these right in the first place, set proper precedents, and follow them (rather than avoiding them when they spell victory for the individual);
  • Also, who at DHS authorized an improper appeal on this record? (Obviously, DHS recognized that given the BIA’s pro-DHS bias, they could “mail it in” before the IJ, take a frivolous appeal, and  STILL HAVE THE BIA HAND THEM A TOTALLY UNDESERVED VICTORY!)

Folks, this is a Democratic Administration enabling this pattern of biased, unprofessional, and illegal conduct against immigrants which should bring a smile to Stephen Miller’s face! It’s also unfair and demoralizing to Immigration Judges who take the time to get it right and grant relief only to be arbitrarily and illegally reversed by Garland’s unqualified BIA on appeal!

Garland should have replaced leadership at EOIR and OIL, and also replaced the BIA, on “day one.” Instead, more than a year into a supposedly due-process-oriented Administration, the garbage continues to flow into the Article IIIs from Garland’s EOIR unabated, while the indefensible continues to be defended by OIL, like it’s “business as usual.” This happens because Garland’s message is that “Dred Scottification” of “the other” will be tolerated, defended, and protected at his DOJ.

Why is Garland being allowed to get away with running this system into the ground, ignoring due process, “blowing off” judicial and legal ethics, treating migrants unfairly, and building the unnecessary backlog at record levels?

In the absence of Auer deference, the weight given to a BIA decision “hinges on the thoroughness evident in [the BIA’s] consideration, the validity of its reasoning, its consistency with earlier and later pronouncements, and all those factors which give it power to persuade”—that is, whether the interpretation should be afforded Skidmore deference. Zavaleta–Policiano v. Sessions, 873 F.3d 241, 246 n.2 (4th Cir. 2017) (internal quotation marks omitted). And here, a court reviewing Castro-Tum for Skidmore deference would not be persuaded to adopt the agency’s own interpretation of its regulation for substantially the same reasons it is not entitled to Auer deference: because it represents a stark departure, without notice, from long-used practice and thereby cannot be deemed consistent with earlier and later pronouncements. As a result, it lacks the “power to persuade.” Id.; see also Kisor, 139 S. Put another way, even under the view set forth by Justice Gorsuch in Kisor, the Attorney General’s interpretation would amount to a failure of proof because the evidence—that is, Castro- Tum—comes too late in the game.

In sum, the result is that 8 C.F.R. §§ 1003.10(b) and 1003.1(d)(1)(ii) unambiguously confer upon IJs and the BIA the general authority to administratively close cases such that the BIA’s decision should be vacated and remanded.

A huge victory for the “New Due Process Army.” The “Roundtable of Former Immigration Judges” actually filed an amicus brief before Sessions in Castro-Tum raising many of the points found determinative by the Fourth Circuit.  Our brief was, of course, ignored by  “Gonzo,” who undoubtedly had already drafted his decision along the lines dictated to him by some restrictionist interest group.

Finally, an Article III Court  “gets” how the DOJ under the Trump Administration is promoting “Aimless Docket Reshuffling” (“ADR”) in an attempt to build the backlog, destroy the system, blame the victims (respondents and their, largely pro bono, attorneys), and dishonestly call upon GOP Legislators to mount a pernicious attack on constitutional Due Process by statute!  

The idea that adding 330,000 cases to the already backlogged Immigration Courts was legally required or a good policy idea clearly is a piece of White Nationalist restrictionist propaganda promoted by corrupt public officials like Miller, Sessions, and Barr.   

With the Democrats in control of the House, there is no way that Congress will eliminate “Administrative Closing” by statute. And, while the DOJ under the sycophantic Barr might try to change the regulation, this decision makes it very clear that there is no rational basis for doing so. Therefore, any future regulation change is likely to be tied up in litigation in the Article III Courts for years, adding to the confusion and ADR, as well as threatening to immobilize the Article III Courts. 

Unless the Article III Courts want their dockets to be totally swamped with immigration appeals, the answer is to end this unconstitutional system administered by an Attorney General clearly unfit to act in a quasi-judicial capacity and place the Immigration Courts under a court-appointed independent “Special Master” to insure fairness, impartiality, and other aspects of Due Process until Congress fixes the glaring Constitutional defect by creating an independent U.S. Immigration Court outside of the DOJ.

WOOD, Chief Judge. Like most people, immigrants to the United States would like greater prosperity for themselves and their families. Nonetheless, it can take time to achieve the American Dream, and the path is not always smooth. Recognizing this, Congress has chosen to make immigrants eligible for various public benefits; state and local governments have done the same. Those benefits include subsidized health insurance, supplemental nutrition benefits, and housing assistance. Historically, with limited exceptions, temporary receipt of these supplemental benefits did not jeopardize an immigrant’s chances of one day adjusting his status to that of a legal permanent resident or a citizen.

Recently, however, the Department of Homeland Security (DHS) issued a new rule designed to prevent immigrants whom the Executive Branch deems likely to receive public assistance in any amount, at any point in the future, from entering the country or adjusting their immigration status. The Rule purports to implement the “public-charge” provision in the Immigration and Nationality Act, 8 U.S.C. § 1182(a)(4). States, cities, and nonprofit groups across the country have filed suits seeking to overturn the Rule.

Cook County, Illinois, and the Illinois Coalition for Immi- grant and Refugee Rights, Inc. (ICIRR) brought one of those cases in the Northern District of Illinois. They immediately sought a preliminary injunction against the Rule pending the outcome of the litigation. Finding that the criteria for interim relief were satisfied, the district court granted their motion. We conclude that at least Cook County adequately established its right to bring its claim and that the district court did not abuse its discretion by granting preliminary injunctive relief. We therefore affirm.

U.S. Circuit Judge Frank H. Easterbrook didn’t mince words earlier this year when sharing his thoughts on a recent decision by the immigration courts’ appellate board: “We have never before encountered defiance of a remand order, and we hope never to see it again.”

The Seventh Circuit judge, a Reagan-appointee, said the board had ignored the court’s directions to grant protection to an immigrant fighting deportation, instead ruling against the immigrant again. The rebuke wasn’t the first time the Board of Immigration Appeals has been reprimanded by the federal judiciary for seemingly prejudiced decisions under the Trump administration.

Just a month earlier, a judge on the Third Circuit tackling an appeal from the BIA wrote in a concurring opinion that it didn’t appear the board “was acting as anything other than an agency focused on ensuring [an immigrant’s] removal rather than as the neutral and fair tribunal it is expected to be.”

“That criticism is harsh and I do not make it lightly,” U.S. Circuit Judge Theodore McKee wrote.

While President Donald Trump’s judicial nominees and U.S. Supreme Court picks grab headlines for rtheir potential to shape the judiciary for years to come, the administration is staffing the lesser known BIA with former immigration judges who have high asylum-denial rates and individuals with backgrounds in law enforcement. Some of the picks have prompted advocates for immigrants and lawmakers to claim the hiring process is too politicized.

Documents newly obtained through the Freedom of Information Act reveal that the Trump administration has aimed to fast-track the hiring process  while giving the director of U.S. Department of Justice‘s Executive Office for Immigration Review, James McHenry, and the U.S. attorney general more say in who gets the nod.

Unlike the federal and appellate courts, the BIA, an administrative appellate board that hears appeals from immigration trial courts, is not independent but rather is housed with the EOIR.

Yet the board can issue precedential decisions that shape immigration policy — and the lives of immigrants facing deportation — well into the future.

“That the reasonably ordinary citizen has not heard of the BIA does not take away from the fact that it is the most important agency establishing immigration jurisprudence in the country, and when you politicize that, you’re obviously politicizing immigration jurisprudence,” said Muzaffar Chishti, head of the nonpartisan Migration Policy Institute’s New York office.

A spokesperson for EOIR told Law360 that the office sped up the hiring process as part of “commonsense changes” and in response to criticism from Congress.

She also said that EOIR “does not choose board members based on prohibited criteria such as race or politics, and it does not discriminate against applicants based on any prohibited characteristics,” and that “all board members are selected through an open, competitive, merit-based process.”

During the most recent hiring cycle, every panelist evaluating candidates was a career employee, not a political appointee, according to the spokesperson.

“Individuals who assert that such changes make the hiring process less neutral are either ignorant or mendacious,” the spokesperson said.

High Rates of Asylum Denials

Since August, the Trump administration has installed nine of the 19 current permanent members of the BIA, and most of the newcomers have asylum-denial rates above 80% and backgrounds in law enforcement or the military.

All but one of the nine were previously immigration judges, and according to data collected by Syracuse University’s Transactional Records Access Clearinghouse, the average asylum-denial rate among those eight judges was just over 92%. The denial rate for each of those eight judges ranged from 83.5% to 96.8%.

The average asylum-denial rate for immigration courts nationally is 63.1%, according to TRAC.

Asylum-denial rates aren’t perfect metrics; controlling asylum law varies by circuit, and the viability of asylum claims can vary based on location. New York’s immigration courts for instance, tend to see more asylum claims from Chinese citizens fleeing political oppression, which are more frequently successful, while courts near detention centers may see harder-to-win claims from longtime U.S. residents with less access to counsel.

However, Jeffrey Chase, a New York City immigration lawyer and former immigration judge, told Law360 that no one deciding cases fairly could have a 90% asylum denial rate.

“You’re looking to deny cases at that point,” he said.

The one recent Trump administration BIA hire who wasn’t previously an immigration judge had been a trial attorney at the Justice Department, while many of the other former judges had prior experience at the U.S. Department of Homeland Security or its predecessor agency.

One, V. Stuart Couch, was previously a senior prosecutor for detainees held at Guantanamo Bay, Cuba.

“There’s overall just a lack of diversity on the immigration judge bench, which is deeply concerning,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association. “I think the mark of justice is the idea that decision makers come from a diverse background.”

A hire to the BIA announced earlier this month, Philip J. Montante Jr., has come under fire not only for a sky-high asylum-denial rate — 96.3% — but for a history of ethics complaints.

In 2014, the DOJ’s Office of Professional Responsibility concluded that Judge Montante’s handling of an immigration case was “inappropriate” after an attorney accused him of showing bias when deciding a client’s case.

In March, not long before his promotion to the BIA was announced, the New York Civil Liberties Union accused Judge Montante in a proposed class action in federal court of denying detained immigrants’ bond requests nearly universally.

According to the advocacy organization, Judge Montante rejected 95% of bond requests between March 2019 and February 2020, bringing him within the top five lowest bond grant rates among the more than 200 immigration judges nationwide.

I find the Article III Courts’ recognition of the Due Process travesty going on in individual cases, while they ignore the systemic unfairness that makes a mockery out of the Due Process Clause of our Constitution, the rule of law, our entire justice system, and humanity itself, perhaps the most disturbing institutional failure under the Trump regime. While Article III Judges are “shocked and offended” by contemptuous actions directed at them in particular cases, they remain willfully “tone deaf” to the reality of our dysfunctional and biased Immigration Courts and their impact on “real human lives.” ☠️ 

This is how individuals seeking justice and the courageous lawyers representing them, many serving at minimal or no compensation to inject a modicum of integrity into our system, are treated every day. Not every wronged individual has the ability to reach the Article IIIs. 

And, given the Article IIIs failure to take the courageous, systemic steps necessary to stop abuses of migrants, the Trump regime has “taken it to a new level” by coming up with various illegal schemes and gimmicks to keep individuals seeking asylum from even getting a hearing in Immigration Court. Due Process? Fundamental Fairness? Rule of Law? No way! 

Yet, this unfolds before us daily as the Article IIIs basically “twiddle their collective thumbs” 👎🏻 and “nibble around the edges” of a monumental Constitutional disaster and blot on the humanity and integrity of our nation and our own souls. The complicity starts with the Supremes who have “passed” on  a number of critical opportunities to “just say no” to blatant violations of the Fifth Amendment, the Immigration and Nationality Act, the Refugee Act of 1980, international human rights conventions, and misuse and clear abuse of “emergency authority” to achieve a White Nationalist, racist agenda.

In other words, the Supremes’ majority is knowingly and intentionally encouraging the regime’s program of “Dred Scottification” — dehumanization or “de-personification” before the law — of “the other.” This disgusting and fundamentally un-American “resurrection and enabling” of a “21st Century Jim Crow Regime” might be “in vogue” with the “J.R. Five” and their right-wing compatriots right now. But, they are squarely on the “wrong side of history.” Eventually, the “truth will out,” and they will be judged accordingly!👎🏻

“We conclude again today, as we did when presented with the preliminary injunction, that the Attorney General cannot pursue the policy objectives of the executive branch through the power of the purse or the arm of local law enforcement; that is not within its delegation. It is the prerogative of the legislative branch and the local governments, and the Attorney General’s assertion that Congress itself provided that authority in the language of the statutes cannot withstand scrutiny. … Accordingly, we affirm the grants of declaratory relief as to the declarations that the Attorney General exceeded the authority delegated by Congress in the Byrne JAG statute, 34 U.S.C. § 10151 et seq., and in 34 U.S.C. § 10102(a), in attaching the challenged conditions to the FY 2017 and FY 2018 grants, and that the Attorney General’s decision to attach the conditions to the FY 2017 and FY 2018 Byrne JAG grants violated the constitutional principle of separation of powers. In light of our determination as to the language in § 10153, it is unnecessary to reach the constitutionality of § 1373 under the anticommandeering doctrine of the Tenth Amendment. The 7th Circuit Panel was BAUER, MANION, AND ROVNER, Circuit Judges. The opinion is by Judge Rovner. Judge Manion filed a separate opinion concurring in the legal analysis, but dissenting from the nationwide scope of the injunction.

The 7th Circuit strongly upholds the Constitutional separation of powers and local jurisdictions’ rights to police in a manner that protects their local communities. History eventually will catch up with them too. History recognizes neither life tenure nor “absolute immunity.”

Court says Trump administration can withhold money from NYC, 7 states in ‘sanctuary cities’ fight

The Trump administration can withhold federal money from seven states, as well as New York City, over their cooperation on immigration enforcement, a federal appeals court ruled Wednesday.

The decision by the 2nd US Circuit Court of Appeals reversed a lower court ruling that blocked the Justice Department from withholding a key law enforcement grant the department said was available only to cities that complied with specific immigration enforcement measures.

The federal appeals court ruling comes amid an ongoing feud between the Trump administration and so-called “sanctuary cities,” which limit cooperation between local law enforcement and federal immigration authorities. Over recent weeks, the administration has stepped up its fight against sanctuary jurisdictions and taken measures like barring New York residents from enrolling in certain Trusted Traveler programs, such as Global Entry.

Judge Reena Raggi, writing on behalf of the unanimous 3-judge panel, acknowledged the divisive nature of the issue at hand, writing: “The case implicates several of the most divisive issues confronting our country and, consequently, filling daily news headlines: national immigration policy, the enforcement of immigration laws, the status of illegal aliens in this country, and the ability of States and localities to adopt policies on such matters contrary to, or at odds with, those of the federal government.”

The city of New York is a plaintiff in the lawsuit, along with New York, Connecticut, New Jersey, Washington, Massachusetts, Virginia and Rhode Island.

In July 2017, then-Attorney General Jeff Sessions announced that applicants for Edward Byrne Memorial Justice Assistance Grants would have to comply with federal immigration enforcement. States pushed back and sued over the move.

My “Quick Takes:”

  • This one is headed to the Supremes, as there is now a “Circuit split.”
  • Don’t expect this to have much effect on actual immigration enforcement.
    • Coercing states and localities is unlikely to foster much meaningful cooperation.
    • It’s more likely to simply channel resistance to the regime elsewhere.
    • The affected jurisdictions always have the option of just taking a “pass” on “Byrne Grants.”
  • In any event, interior apprehensions are a minuscule part of the DHS civil enforcement program.  
    • They accounted for fewer than 100,000 removals during the last fiscal year.
    • At that rate, it would take more than a century for DHS to remove the estimated 10+ million undocumented U.S residents.
  • On the other hand, this is a major “propaganda victory” for the regime. And, make no mistake, this was always about anti-immigrant propaganda not legitimate law enforcement. 
    • The Administration will be able to tout that Second Circuit Judge Reena Raggi bought their disingenuous “enforcement policy” argument “hook line and sinker.” (The DHS “Community Terrorism” program has actually been shown to inhibit legitimate law enforcement by making it much less likely that victims of domestic violence and gang crimes will report them to local law enforcement.)
    • However, more thoughtful judges in the 7th Circuit and elsewhere have exposed the weaknesses of Judge Raggi’s reasoning.
  • It’s unlikely that the Supremes will resolve this before the November election.
    • If Trump wins, the “Roberts Five” have already demonstrated their obsequiousness in the face of Trump’s war on immigrants.
    • On the other hand, a Democratic Administration would be likely to withdraw this “punishment initiative” completely and try to reach a more harmonious working relationship with state and local law enforcement on immigration issues, thus “mooting” this litigation.

Even before he was hired as Donald Trump’s attorney general, William Barr made it clear that he would be acting as the president’s lackey first and the chief lawyer for the United States second, having auditioned for the role by sending an unsolicited letter to the Justice Department calling the Russia inquiry “fatally misconceived” and describing Robert Mueller’s actions as “grossly irresponsible.” Since then, Barr has told Congress it’s perfectly okay for the president to instruct aides to lie to investigators, suggested that Mueller’s report fully exonerated Trump, which of course it did not, and attempted to bury the “urgent“ whistle-blower report that became the basis of the House’s impeachment proceedings.

Now, if it were up to Barr, he’d happily carry on doing the president’s dirty work, but for one problem: Trump, with his flapping yap and quick trigger finger, has been making it a little too obvious that the DOJ, in its current form, exists to punish his enemies and spare his friends. The most recent example of this, of course, came this week, when the president tweeted, at 1:48 a.m., that the sentencing recommendation of seven to nine years for his longtime pal Roger Stone was “horrible,” “very unfair,” and a “miscarriage of justice.” Then, after Barr’s DOJ intervened with a new filing calling for a much lighter sentence—which prompted the four prosecutors on the case to withdraw from it—the president tweeted his thanks, congratulating the attorney general on getting involved in matters relevant to his personal interests.

For many people long aware of Barr’s status as a boot-licking hack, this was a bridge too far. The calls for him to resign or be impeached were swift. And they got so bad that on Thursday, the attorney general felt compelled to sit down with ABC News and send the message to the president that if he’d like the DOJ to continue to do his dirty work, he needs to stop tweeting about it. Do criminals tell their social-media followers “Check out this sweet scam I just pulled”? No! Of course, rather than stating directly that the president’s penchant for telling the world about the many ways he’s corrupted the government have made it difficult for that corruption to continue, Barr had to pretend his comments were all about ensuring the DOJ’s independence, which would be a funny, not-at-all-believable thing for him to start caring about now.

“I’m not going to be bullied or influenced by anybody….whether it’s Congress, newspaper editorial boards, or the president,” Bill Barr tells @ABC News.

“I cannot do my job here at the department with a constant background commentary that undercuts me.”

Asked about the decision to reverse the sentencing recommendation for Stone, Barr insisted that it definitely had nothing to do with the guy being a longtime friend of Trump’s, claiming that he came to the unbiased conclusion on his own that the seven-to-nine-years call was excessive and that he was planning to file an update even before Trump tweeted about it being “horrible and unfair.” (He was not asked about the NBC News report that he additionally removed a U.S. attorney from her post for failing to punish Trump’s enemy Andrew McCabe, or that the Justice Department also intervened to change the sentencing recommendation for convicted criminal and former national security adviser Michael Flynn.)

Barr said Trump’s middle-of-the-night tweet put him in a bad position. He insists he had already discussed with staff that the sentencing recommendation was too long. “Do you go forward with what you think is the right decision or do you pull back because of the tweet? And that just sort of illustrates how disruptive these tweets can be,” he said.

Barr also told ABC he was “a little surprised” that the entire Stone prosecution team had resigned from the case—and one from the DOJ entirely—which presumably has something to do with the fact that after using your department to do the president’s bidding for so long, you sometimes forget that other people will take issue with such behavior.

Asked if he expected Trump to react to his criticism of the tweets, Barr responded: “I hope he will react.”

“And respect it?” Thomas asked.

“Yes,” Barr said. You hear that, Mr. President? Let the man turn the judicial branch into your own personal score-settling operation in peace!

DON’T BELIEVE A WORD BILLY BARR SAYS!

Even smart folks like The NY Times’ David Leonhardt are babbling about, perhaps, giving Billy “the benefit of the doubt.” Come on, man! 

As Bess Levin points out, Barr’s faithfully been doing Trump’s “dirty work” for him since even before he set foot inside the DOJ again. It’s not like he’s suddenly had a “moral awakening” or discovered human decency. 

No, Trump is the “unitary Executive” that Billy and some of his GOP righty neo-fascists have always salivated over. But, understandably he’d prefer more privacy as he deconstructs the DOJ and undermines fair and impartial justice, including, of course, further trashing the Immigration Courts that, incredible as it might seem in a country that actually has a written Constitution supposedly guaranteeing Due Process to “all persons,” belong exclusively to him. 

Remarkably, and quite stunningly to anyone who has actually studied the law, the Article III Courts, all the way up to the feckless Supremes, have gone along with this absurd charade. You get the message: Immigrants, migrants, and asylum seekers aren’t really “persons” at all. They have been dehumanized by the regime and “Dred Scottified” by the Article IIIs.

There is no particular legal rationale or justification for this ongoing miscarriage of justice. It’s just a matter of enough folks in black robes being too cowardly or self-absorbed, or maybe in a few cases too ignorant, to stand up for the Constitutional and human rights of the most vulnerable among us.

To paraphrase an expression from the world of religion: “What would Jesus think about this blindness to human suffering?” Nothing good, I’m sure!

If he’s actually out there among us today, he’s undoubtedly among those suffering in the regime’s “New American Gulag” or waiting in squalor along the Mexican border for a “fixed hearing” that’s probably never going to happen anyway. I know where he isn’t: among the sign waving crazies shouting hateful slogans glorifying human rights abuses at the “hate fests” z/k/a “Trump rallies!”

In Immigration Court, the conflicts of interest and threats to human decency aren’t just “implied” or “apparent.” They are very real, and they are destroying real human lives, even killing innocent folks, every day. 

And, unlike U.S. District Judge Amy Berman Jackson, whose life tenure allows her to “ignore the noise and do what she thinks is right” (as Trump’s GOP toadies love to point out), Immigration Judges are “wholly owned commodities” of Billy and the regime: disposable, subservient, and told to “follow orders.” They can’t even schedule their own cases without political interference, let alone apply the law in a way that conflicts with Billy’s unethical precedents or those entered by his “wholly owned appellate body,” the Board of Immigration Appeals! 

The latter has recently gone out of its way to show total subservience to the regime’s White Nationalist anti-asylum, anti-due-process, anti-immigrant agenda. Indeed, they have even drawn the ire of at least one conservative GOP-appointed Article III Judge by contemptuously disobeying a direct court order in favor of a footnote in a letter from the Attorney General.

“Shocking” as this professional malpractice and contempt for the justice system might be to those journalists and former DOJ employees who haven’t been paying attention, it’s nothing new to those of us involved in immigration. For the last three years, the regime has been actively and unethically “gaming” the unconstitutional Immigration “Court” system against the very migrants and asylum seekers whose legal rights and human dignity they are actually supposed to be protecting!  How is this “just OK?”

Feckless Article III Courts have largely “gone along to get along,” although they might be showing less patience now that the scofflaw actions and disrespectful attitudes promoted by Billy and his predecessor “Gonzo Apocalypto” Sessions are directed at them personally rather than just screwing vulnerable migrants and asylum seekers.  

While it’s nice that at least some Article III Judges are finally reacting to being “given the finger” by Barr, Trump, and their gang of White Nationalist thugs, outrage at their own disrespectful treatment pales in comparison with the death, torture, rape, extortion, and the other parade of horribles being inflicted daily on vulnerable migrants by the Immigration “Courts” and the human rights criminals in the Trump regime while the Article IIIs fail to step in and save lives. 

In the end of the day, as history will eventually show, human lives, which are the key to the “rule of law,” will prove to be more important than “hurt feelings” among the Article III “lifers” or the kind of legal gobbledygook (much of it on “jurisdiction” which often translates into “task avoidance”) that Article IIIs, particularly those from the right wing, like to throw around to obscure their legal tone-deafness and moral failings from their fellow humans.

THE ROLE OF JUDGES TO “SAY WHAT THE LAW IS”: JUDICIAL OVERSIGHT OF IMMIGRATION ADJUDICATION

Since the beginning of the Trump Administration, the immigration court system has been used as a tool to further the executive branch’s anti-immigrant agenda. The Attorney General and other executive officials have enabled widespread due process violations and skyrocketing case backlogs while imposing case quotas and docketing rules that prevent judges from serving as impartial adjudicators.[1]

Last week, the Seventh Circuit highlighted a new abuse of power: the refusal of executive officials in the Board of Immigration Appeals (BIA) to follow a direct order from a federal court.

The BIA is the administrative body responsible for reviewing decisions that are appealed from sixty-eight immigration courts across the country. Like these immigration courts, the BIA is part of the Executive Office for Immigration Review (EOIR) – the immigration court system, located in the executive branch, that is ultimately overseen by the Attorney General of the United States. Despite the serious flaws inherent in the design of this system, BIA decisions may at least be appealed up to the appropriate federal circuit court, providing a crucial layer of independent judicial review in individual cases.[2]

In the case of Baez-Sanchez v. Barr, the Seventh Circuit had previously held that the immigration laws unambiguously grant immigration judges the power to waive a noncitizen’s inadmissibility to the United States, overruling the BIA’s prior decision to the contrary.[3] On remand, the BIA “flatly refused to implement” the court’s direct order.[4] Writing that the BIA’s decision “beggars belief,” the Seventh Circuit stated that

We have never before encountered defiance of a remand order, and we hope never to see it again. Members of the Board must count themselves lucky that [the Respondent] has not asked us to hold them in contempt, with all the consequences that possibility entails.[5]

This language is an extraordinary rebuke: it is very rare for a circuit court to issue an implicit threat to hold members of an administrative agency in contempt for directly disregarding a court order. The Seventh Circuit was clear that the BIA was mistaken if it thought that “faced with a conflict between our views and those of the Attorney General it should follow the latter.”[6] Affirming foundational separation of powers principles, the Seventh Circuit admonished that

[I]t should not be necessary to remind the Board, all of whose members are lawyers, that the “judicial Power” under Article III of the Constitution is one to make conclusive decisions, not subject to disapproval or revision by another branch of government . . . Once we reached a conclusion, both the Constitution and the statute required the Board to implement it.[7]

The Seventh Circuit’s decision also noted that the Attorney General had submitted a brief asking the court to give the BIA another opportunity to issue “an authoritative decision” on this issue, arguing that such a decision could be entitled to judicial deference.[8] The court aptly responded that this “request is bizarre,” as the court had already held that the applicable regulation was unambiguous – and an agency “cannot rewrite an unambiguous [law] through the guise of interpretation.”[9] As the Supreme Court made clear in Kisor v. Wilkie, “if the law gives an answer—if there is only one reasonable construction of a regulation—then a court has no business deferring to any other reading, no matter how much the agency insists it would make more sense.”[10]

Notably, even if the Seventh Circuit had found the laws in question to be ambiguous, the Attorney General and members of the BIA do not have free reign to impose any interpretation they choose. It is true that federal courts must defer to the reasoned decisions of administrative agencies when Congress has left the agency’s discretion to interpret an ambiguous provision of law, under the doctrine of Chevron deference.[11] But this deference is not boundless. As the Supreme Court made clear in Chevron, courts should defer to agencies’ interpretation of ambiguous statutes when the agency interpretation is “a reasonable accommodation of conflicting policies that were committed to the agency’s care by the statute.”[12] The agency’s interpretation must thus still fall “within the bounds of reasonable interpretation.”[13]

This standard, and the Seventh Circuit’s reprimand, is especially important as the Attorney General attempts to aggressively expand his control of immigration court adjudication. Under the Trump Administration, the Attorneys General have issued a number of “certified” decisions that attempt to restrict eligibility for asylum based on factors such as domestic violence, gang violence, or past persecution due to family membership.[14] In these decisions, which upend years of established immigration precedent, the Attorney General has pointedly asserted his authority to construe the terms of the Immigration and Nationality Act and implied that federal courts must fall in line with his interpretations.[15]

Yet the Attorney General’s reasoning holds only if his interpretations are actually entitled to judicial deference: if the laws in question are ambiguous and the federal courts find his interpretations reasonable.[16] And as the Supreme Court has admonished, “let there be no mistake: That is a requirement an agency can fail.”[17] Indeed, in addressing the application of the Attorney General’s certified decision in Matter of A-B-, at least one federal court has already held that a “general rule against domestic violence and gang-related claims during a credible fear determination is arbitrary and capricious and violates the immigration laws.”[18]

Faced with the Trump Administration’s weaponization of the immigration courts against asylum-seeking individuals, the role of the federal courts is more important than ever. As the Attorney General and other executive officials attempt to expand their authority to define the terms of immigration adjudication, federal courts should heed the Seventh Circuit’s decision – and remember the foundational legal principle that “[i]t is emphatically the province and duty of the judicial department to say what the law is.”[19]

What happened next beggars belief. The Board of Immigration Appeals wrote, on the basis of a footnote in a letter the Attorney General issued after our opinion, that our deci- sion is incorrect. Instead of addressing the issues we specified, the Board repeated a theme of its prior decision that the Secretary has the sole power to issue U visas and therefore should have the sole power to decide whether to waive in- admissibility. The Board did not rely on any statute, regulation, or reorganization plan transferring the waiver power under §1182(d)(3)(A)(ii) from the Attorney General to the Secretary. Nor did the Board discuss whether only aliens outside the United States may apply for relief under §1182(d)(3)(A)(ii). Likewise the Board did not consider whether Baez-Sanchez is entitled to a favorable exercise of whatever discretion the Attorney General retains. The Board seemed to think that we had issued an advisory opinion, and that faced with a conflict between our views and those of the Attorney General it should follow the la]er. Yet it should not be necessary to remind the Board, all of whose members are lawyers, that the “judicial Power” under Article III of the Constitution is one to make conclusive deci- sions, not subject to disapproval or revision by another branch of government. See, e.g., Plaut v. Spendthrift Farm, Inc., 514 U.S. 211 (1995). We acted under a statutory grant of authority to review the Board’s decisions. 8 U.S.C. §1252(a)(1). Once we reached a conclusion, both the Constitution and the statute required the Board to implement it.

A NOTE TO THE 7TH CIRCUIT AND OTHER ARTICLE III JUDGES:

My sympathies to you. 

But, frankly, rather than coming as a “shock,” you should know that similar stuff happens every day in our U.S. Immigration Courts, which are not “courts” by any known definition, do not provide fair and impartial decision makers, do not satisfy even minimal standards of Constitutional Due Process, and operate in a blatantly unconstitutional manner that you and your colleagues in other circuits and the Supremes have condoned for decades as it unfolded right under your noses. Contempt for the law, disregard of basic Due Process and fundamental fairness, bias against immigrants, particularly asylum seekers, rude treatment, disrespect for lawyers, contempt for the other coequal branches of Government, and failure to respect human decency and dignity are now among the “staples” of today’s “captive” Immigration Courts.

It’s just that most litigants don’t have the wherewithal and and access to competent lawyers to take their cases all the way to the Circuit Courts, sometimes several times as happened in this particular case, in a search for justice. They are, in very plain terms, simply railroaded out of the country without regard to the law or our Constitution.

Sadly, even when they do get before your colleagues across the country, far too many of them ignore the contemptuous travesty of justice being perpetrated by the Department of Justice in the Immigration “Courts.” They merely “rubber stamp” the defective final product. It’s called “going along to get along” or “cowardice in the face of tyranny.” 

For some reason, not obvious those of who once put our careers on the line to stand up for justice and the legal rights and human dignity of the most vulnerable among us, many, many Article III Judges seem to treat “life tenure” as a sinecure that empowers them to ignore needlessly ruined lines and human suffering, rather than as an opportunity, given to none others within our democratic institutions, to stand up for truth, justice, and the Constitution, even in the face of an overbearing and tyrannical Executive who has no respect for your functions. 

Since you seem to have disturbingly little understanding of the true nature of the system which forms a significant part of your appellate workload, let me help you out. Members of the Board of Immigration Appeals are not true “judges” in any sense of the word. They are “employees” of Attorney General Billy Barr. 

Billy himself is an acolyte of the “Unitary Executive” — a neo-fascist concept described by former White House Counsel and ex-con John Dean as meaning “that neither Congress nor the federal courts can tell the President what to do or how to do it.” In Billy’s view,. the power of Donald Trump, or any other GOP President (I doubt that he would apply it to a Democrat President), is unlimited and unfettered and the functions of the Judiciary and the Legislature are largely meaningless, except to the extent that they align with Trump’s agenda. The same goes for the U.S. Constitution and the U.S. Code. They are nothing more than what Donald Trump and his toadies like Billy say they are.

Billy Barr is also an unapologetic agent of DHS Enforcement. Although nominally listed as a “party” before these “kangaroo court’ proceedings involving migrants, Barr and his equally contemptuous and lawless predecessor, Jeff “Gonzo Apocalypto” Sessions, have made it clear that “their judges” are to operate as an adjunct of their “partners” at DHS enforcement. Their only meaningful function is to railroad as many migrants as possible out of the country without regard to Due Process or legal rights. 

Indeed, both Barr and Sessions have simply rewritten the law, through bogus “precedent decisions” that plainly violate the basic rules of judicial ethics requiring impartiality and forbidding prejudgment of cases, as will as requiring that litigants and their attorneys be treated with basic respect and civility. All of these “bogus precedents” favor DHS Enforcement; none favor the individuals trying to save their lives and vindicate their legal rights. A number reverse well-established rules insuring fair adjudication, particularly for asylum seekers, while others deprive “their judges” of even minimal power to manage their dockets in a rational manner.

Additionally, Sessions and Barr have proved to be historically incompetent managers. While doubling the number of Immigration Judges, by hiring almost exclusively from the ranks of government prosecutors, they have more than doubled the court backlog, now approximately 1.1 million “active” cases with another 300,000 “waiting in the wings” as a result of a mindless and unethical precedent decision by Sessions reversing years of slow but incremental progress on docket management. 

They have also created this dysfunctional mess through a process of eliminating the reasonable and sensible use of priorities and “prosecutorial discretion” by DHS in the Immigration Courts as well as by using a process known as “Aimless Docket Reshuffling” or “ADR.” Under ADR, judges and cases are shuffled around the country and the dockets are rearranged to respond to the “emergency of the day” while “ready for trial” cases, some of which have been pending for many years, are arbitrarily “orbited” to the end of dockets, some of which stretch out beyond 2024.

The judges and Board Members work for Billy Barr, who can fire them, reassign them, send them off to the FOIA unit, or turn them into “hall walkers.” (All of which actually happened during the reign of John Ashcroft, where a group of us were “punished” for exerting our authority as independent quasi-judicial officials and the BIA was absurdly cut from 23 Members to 12, under an astoundingly disingenuous claim of “efficiency.” By comparison, Barr recently announced an equally ill-conceived and unjustified plan to expand the BIA to over 50 Members stationed throughout the country).

Under these conditions, it is hardly surprising that Board Members feel themselves compelled and justified in ignoring your court orders in favor of a footnote in letter from the Attorney General, “the boss.” It’s completely consistent with the theory of the all-powerful “Unitary Executive” and the actuality that Board Members and Immigration Judges are constantly told that there are “mere employees” of the Attorney General required to carry out his “policies” under the threat of job loss.

The good news is that you folks aren’t as powerless as you seem to think yourselves to be. You don’t actually need a “motion” from private counsel to:

  • Hold this systemic clown show purporting to be a “court” system unconstitutional, as it most surely is, and shut it down pending legislative reform;
  • Throw Billy Barr in jail for his contemptuous behavior in allowing the BIA to violate your valid orders and then compounding it by neither confessing error nor apologizing, but rather sending his DOJ attorneys in to waste your valuable time and insult your intelligence;
  • Schedule some contempt hearings for non-compliant EOIR officials and explain to them that the “Unitary Executive” is nothing more than a figment of Billy’s warped imagination and that, no matter who signs their paychecks, they are obliged to follow the laws, obey your orders, provide Constitutional Due Process of law to individuals coming before them, exercise independent judgment based on the law and facts in the record, and ignore any nonsense stemming from Billy & company that flies in the face of any of the foregoing.

Then and only then, by standing up for the rights of the most vulnerable among us and your constitutional prerogatives, will you become part of the solution instead of “just another snappy quote line in one of my Courtside headlines.” 

If you don’t act now, this dysfunctional mess of an out of control, illegal, and grotesquely mismanaged system will eventually fall into your collective judicial laps, no matter how much you would like to shun it. For example, Billy is encouraging, basically demanding, that the BIA make more use of largely judicially discredited. “summary affirmances” and often arbitrary, capricious, and sloppily reasoned, “single member opinions,” both entered without meaningful deliberation or discussion, to “rubber stamp” more removal orders. Indeed, one of your retired colleagues, Judge Richard Posner, was an outspoken critic of the shockingly unprofessional and frequently incorrect results produced by the earlier “weaponization” of  “assembly line justice,” featuring “summary affirmances” and “single member decisions” resulting from the “Ashcroft debacle.”

Billy and his EOIR bureaucratic toadies fully intend to further reduce the already questionable quality of the “legal product” that the BIA sends your way. They are counting on you folks to either 1) look the way and join the”rubber stamp brigade,” or 2) do their dirty work for them.  At that point, you will not be able to avoid the “judgment of history” regarding your own complicity and fecklessness in the face of lawless tyranny that is destroying our precious democratic institutions and even more precious human lives every day. Wake up and act, before it’s too late, for you and for our nation!

THE BIG IDEA:

A panel of three judges, each appointed by a Republican president to the federal appeals court in Chicago, ruled unanimously on Thursday against President Trump’s effort to withhold money from “sanctuary cities.”

The U.S. Court of Appeals for the 7th Circuit upheld a nationwide injunction that blocks the Justice Department from using “the sword of federal funding to conscript state and local authorities to aid in federal civil immigration enforcement.”

Trump’s latest courtroom defeat offers yet another civics lesson about checks and balances for the first president in American history who lacks any prior governing or military experience. Unlike congressional Republicans who have by and large kowtowed and capitulated to Trumpism, despite private uneasiness and grumbling in many cases, Republican-appointed judges are free not to care about the wrath of the president or blowback from his loyalists. This gives them the breathing room to worry more about the rule of law than partisanship. That was the point of an independent judiciary and giving lifetime appointments. It’s how the Constitution is supposed to work.

Judge Ilana Rovner, who was appointed to a district judgeship by Ronald Reagan and elevated to the circuit by George H.W. Bush, offers a remarkable rebuke of the Trump administration in a 35-page opinion that can be read as a tutorial on the separation of powers. She even throws around words like “tyranny” that you don’t often see in opinions of this nature:

“Our role in this case is not to assess the optimal immigration policies for our country,” she writes. “Rather, the issue before us strikes at one of the bedrock principles of our nation, the protection of which transcends political party affiliation and rests at the heart of our system of government …

“The founders of our country well understood that the concentration of power threatens individual liberty and established a bulwark against such tyranny by creating a separation of powers among the branches of government. If the Executive Branch can determine policy, and then use the power of the purse to mandate compliance with that policy by the state and local governments, all without the authorization or even acquiescence of elected legislators, that check against tyranny is forsaken …

“Congress repeatedly refused to approve of measures that would tie funding to state and local immigration policies. Nor … did Congress authorize the Attorney General to impose such conditions. It falls to us, the judiciary, as the remaining branch of the government, to act as a check on such usurpation of power. We are a country that jealously guards the separation of powers, and we must be ever‐vigilant in that endeavor.”

Rovner, 79, and her parents fled Latvia, and the Nazis, when she was an infant. She lost family members in the Holocaust. She often says that she decided to become a lawyer to stop anything like that genocide from happening again. Displayed in her chambers are the green card she was issued when she arrived in America in 1939 and her mother’s passport. “These are the things that saved my life,” she told the Chicago Tribune for a 2011 profile.

Her scathing opinion was joined by Judge William Bauer, who was appointed by Gerald Ford. Judge Daniel Manion, who Reagan put on the bench, wrote a concurrence saying he would have narrowed the injunction to protect only Chicago, rather than keeping it national.

The injunction was ordered last September by District Judge Harry Leinenweber, who was also appointed by Reagan.

Sessions in 2017: ‘Sanctuary’ cities lead to crime

Attorney General Jeff Sessions criticized Chicago’s sanctuary city policy while speaking in Miami on Aug. 16, 2017.

Attorney General Jeff Sessions has tried to require that cities give federal immigration agents access to undocumented immigrants who are in their jails in order to get certain public safety grants. This effort has already been blocked in separate lawsuits by federal judges in California and Pennsylvania. The judge who blocked the administration from holding back money from Philadelphia, Michael Baylson, was appointed by George W. Bush and wrote an unusually long 128-page ruling against the administration in November.

The 7th Circuit opinion yesterday complains that the term sanctuary cities “is commonly misunderstood” and “a red herring.” Contrary to popular understanding, the judges explain, “the federal government can and does freely operate in ‘sanctuary’ localities.”

— The Justice Department quickly criticized the ruling, saying the administration continues to believe it has the power to attach strings to money appropriated by Congress and complaining that courts keep issuing broad injunctions that thwart Trump. “Many in the legal community have expressed concern that the use of nationwide injunctions is inconsistent with the separation of powers, and that their increased use creates a dangerous precedent,” DOJ spokesman Devin O’Malley said in a statement. “We will continue to fight to carry out the department’s commitment to the rule of law, protecting public safety, and keeping criminal aliens off the streets to further perpetrate crimes.”

— Chicago Mayor Rahm Emanuel held an afternoon news conference to blast Trump as petty for refusing to hand over the grant money while the case continues to play out in the courts. “The Trump Justice Department could actually say ‘OK, we’re going to go forward with these grants, and let’s fight the case out in court,’” said the Democrat, who was Barack Obama’s first White House chief of staff. “But they refuse to give municipalities like Chicago and other cities around the country the resources to fight crime and gun violence, because they think fighting us on the principle of being a sanctuary, welcoming city, is more important than helping the police departments get the technology they need to do a better job in public safety.”

Supreme Court restricts deportations of immigrant felons

The Supreme Court ruled on April 17 that an immigration statute requiring the deportation of noncitizens who commit felonies is unlawfully vague.

— This is just the latest legal setback for Trump when it comes to his far-reaching immigration agenda.

On Tuesday, Justice Neil Gorsuch joined the Supreme Court’s four liberal members to strike down part of a federal law used to deport noncitizens who commit felonies on the grounds that it was unconstitutionally vague. The 5-to-4 decision could limit the government’s ability to deport people with criminal records, a Trump priority.

“Vague laws invite arbitrary power,” Gorsuch wrote in a concurring opinion. “Today’s vague laws … can invite the exercise of arbitrary power all the same — by leaving the people in the dark about what the law demands and allowing prosecutors and courts to make it up.”

“For the conservative Gorsuch to align with the liberals might seem a surprise, but his vote was in keeping with questions he asked during oral argument in October. And he was in part following in the footsteps of the justice he replaced, the late Antonin Scalia,” explains Supreme Court beat reporter Robert Barnes. “In 2015, Scalia wrote the court’s decision in Johnson v. United States, which struck down a similarly vague description of violent felony in the Armed Career Criminal Act.”

— Trump is incensed about Gorsuch’s vote. Administration officials say the president has been complaining to them that the justice “had proved too liberal in recent cases,” Robert Costa, Josh Dawsey and Rosalind S. Helderman report. “Associates … said it renewed his doubts that Gorsuch would be a reliable conservative. One top Trump adviser played down the comments as unhappiness with Gorsuch’s decision rather than with Gorsuch broadly.”

— In February, the Supreme Court rejected Trump’s request to immediately review the lower court decisions that prevent him from ending the Deferred Action for Childhood Arrivals program (DACA). Getting cert. would have only taken four votes, which means at least one GOP appointee opposed the administration’s request. The litigation over the fate of the “dreamers” will now follow the normal process, winding through the circuit courts.

President-elect Donald Trump pledged to end “sanctuary cities” while campaigning for the White House. Washington, D.C., is one such city.

— The courts have proved vexing for Trump since his first days in office. District Judge James Robart in Washington state, who was nominated by George W. Bush in 2004, halted the president’s first travel ban, which blocked citizens of seven majority-Muslim countries from entering the United States.

“The opinion of this so-called judge, which essentially takes law-enforcement away from our country, is ridiculous and will be overturned!” Trump tweeted angrily.

But it wasn’t. A three-judge panel on the 9th Circuit, which included another Bush 43 nominee, unanimously agreed. The administration withdrew the ban and issued another watered-down version.

— Barack Obama also lost cases in the courts, including on immigration. But he typically failed before conservative judges who had been appointed by Republicans more than judges appointed by his Democratic predecessors. The Harvard-educated former constitutional law professor had a much better record. To be sure, most judges appointed by Republicans are still siding with the administration most of the time. And Trump is remaking the judicial branch by appointing nominees who share his worldview.

Bush) who led the “Charge of Judicial Outrage” that eventually shut down the “assembly line removal system” set up by Ashcroft following his infamous “BIA Purge.”

Trump and Sessions lose another sanctuary cities case

A federal appeals court struck another blow Thursday to the Trump administration’s efforts to pressure sanctuary cities, upholding a court order preventing the Justice Department from imposing conditions on grants to cities.

The three-judge panel from the 7th US Circuit Court of Appeals upheld a lower court’s decision blocking the Justice Department from adding new conditions on policing grants that had required some cooperation with federal immigration enforcement.

The ruling makes it the latest federal court, along with courts in California and Philadelphia, to restrict what the administration can try to do to pressure jurisdictions that restrict some cooperation with federal immigration enforcement.

It comes as President Donald Trump has been targeting his fury on Twitter at sanctuary cities, which administration officials accuse of jeopardizing public safety.

The judges sided with the city of Chicago in the case, which had challenged Attorney General Jeff Sessions’ July effort to condition the Edward Byrne Memorial Justice Assistance Grant Program on two new requirements: allowing federal immigration authorities access to local detention facilities and providing the Department of Homeland Security with at least 48 hours’ notice before local officials release an undocumented immigrant wanted by federal authorities.

The administration has been aggressive in asking cities to comply with those requests, but a number of cities and police chiefs around the country argue that cooperating in that way could jeopardize the trust police need to have with local communities, and in some cases could place departments in legal gray areas.

Like the district judge, the appellate judges found that Chicago was likely to succeed in its case that such conditions would be a violation of the Constitution and law, as Congress did not authorize those conditions when it created the grants.

The judge who wrote the opinion called the attorney general’s move a “usurpation of power.”
