Yup, it’s a great settlement! But, only for those in the CDCA or who don’t understand how totally screwed up, unfair, directionless, visionless, and out of control Garland’s “Clown Courts” 🤡 are!

So, Garland agrees that “his judges” will comply with the Constitution, but ONLY in the CDCA. In the other 95% of Immigration Courts nationwide, they evidently are free to choose to act in a “normal” arbitrary and capricious unconstitutional manner. Nice!

Of course, by initially setting no bond or more than $10K in any case, DHS can unilaterally invoke the “regulatory clamper” (8 CFR 1003.19(i)(2)) to defeat any release on bond pending appeal. Since the BIA routinely holds bond appeals until the detained merits cases are complete, then dismisses them as “moot,” the Administration retains lots of tools to act unconstitutionally.

Another nice touch!

Does anyone truly understand how completely screwed up and unconstitutional Garland’s “star chambers courts” are? 

This is what “justice” looks like in 21st Century America, in a Dem Administration no less? Gimmie a break?

A better BIA might have imposed Constitutional due process requiring consideration of ability to pay nationwide, thus preempting the need for more Article III Court litigation and inconsistent decisions affecting the fundamental human right of liberty!

A “better BIA” might have properly limited the DHS’s unconstitutional authority to use the “clamper” to block release on bond, rather than reducing Immigration Judges to a “clerical” role. See, e.g., Matter of Joseph (“Joseph I”), 22 I&N Dec. 660, 674 (BIA 1999) (Moscato, Board Member dissenting, joined by Schmidt, Chair, and Heilman, Villageliu, Guendelsberger, Rosenberg, Jones, Board Members).

A better AG might have eliminated the unconstitutional “clamper” that gives ICE counsel unfair leverage in bond cases.

Immigration Judge Ashley Tabaddor called the Justice Department’s latest move to deny asylum-seekers bond hearings “highly problematic,” saying courts should not be used as a political tool by law enforcement.

“This in terms of the procedure that has been used is highly problematic,” Tabaddor, who is the president of the National Association of Immigration Judges, told Hill.TV’s Buck Sexton and Krystal Ball in an appearance on “Rising.”

“It is allowing the chief prosecutor of the United States to step in, in the middle of judicial proceedings and rewrite the law,” she continued.

Tabaddor added that Barr’s move is another example of why the immigrant court system should function independently of the Justice Department.

“It yet highlights again why immigration court proceedings should really be removed from the Justice Department and be outside of the purview of the political usage of the court as an extension of law enforcement,” she told Hill.TV.

Attorney General William Barr last week issued a new order directing immigration judges not to release asylum-seekers and detain them indefinitely while they await their court hearings.

Barr’s decision reverses a 2005 order, which said certain migrants who passed a “credible fear” interview could stay in the U.S. and seek release on bond until their case is heard in court. But Barr wrote that only the Department of Homeland Security has the authority to release asylum seekers.

The change comes amid an ongoing legal battle over the Trump administration’s policy that requires asylum-seekers to wait in Mexico while their claims make their way through the immigration court system.

Earlier this month, a federal judge issued a preliminary injunction against the policy, saying it failed to protect migrants from danger. Days later, the 9th Circuit Court of Appeals took action allowing the Trump administration to temporarily resume returning asylum-seekers to Mexico as it considers the administration’s appeal to the injunction.

Trump’s program of returning migrants to Mexico was initially launched in January, and the program is part of the administration’s crackdown on the recent influx of migrants at the southern border.

During a recent visit to the border, Trump said the U.S. is being overwhelmed by Central American migrants seeking asylum.

“We can’t take you anymore. I’m sorry. Can’t happen, so turn around,” Trump said, referring to the migrants.

Undoubtedly, the participation of Chief Trump Cheerleader and immigration enforcement advocate Bill Barr creates an “appearance of bias.” Indeed, it’s more than an “appearance;” it’s actual bias. So, his interference in the quasi-judicial process is unethical.

The only real question is why Barr, like his predecessor Sessions and their predecessors, is allowed to get away with violating clear standards of ethical conduct. Why don’t “real” Article III Courts fulfill their constitutional role by vacating both the decisions and any case in which an Immigration Judge relies on these invalid attempts to influence and control the quasi-judicial decision-making process for the benefit of a party — the DHS?

WASHINGTON, DC – On April 16, 2019, Attorney General William Barr issued a decision in Matter of M-S- in which he determined that asylum seekers who establish a credible fear of persecution and will be placed in removal proceedings are not eligible for an individualized determination of their custody status before the immigration court.

AILA Treasurer Jeremy McKinney stated, “With this decision, the Attorney General is unilaterally depriving asylum seekers of their right to a bond hearing in front of an immigration judge despite the fact they have passed a credible fear interview administered by a USCIS asylum officer. By overturning Matter of X-K, which provided for an independent review of the government’s justification to detain someone, the Attorney General is sweeping aside 14 years of standing Board of Immigration Appeals precedent that the courts and DHS have long implemented. This is a devastating blow to those seeking protection from persecution at the U.S. border, since far more will be held in detention. This decision further expands mandatory and prolonged detention of people who are neither dangerous nor flight risks, practices which are constitutionally suspect and a waste of taxpayer money. This administration is using detention as a sword against both due process and the humanitarian principles our nation was founded upon.”

AILA Executive Director Benjamin Johnson added, “While Matter of M-S- will not take effect for 90 days, the impact of Attorney General Barr’s decision, along with the other decisions issued by his immediate predecessors on asylum and the nation’s immigration courts, cannot be overstated. There is no end to this Administration’s campaign of unrelenting cruelty toward asylum seekers. Even lack of ability to carry out their morbid fascination with creating the “New American Gulag” —-  this time targeting individuals who actually have established a “credible fear” of persecution — doesn’t deter their inhumanity. It’s likely to face Constitutional obstacles, at least in the lower Federal Courts.

AILA gets it right. It would be possible to fairly process asylum seekers with additional trained Asylum Officers (not Border Patrol Officers masquerading as Asylum Officers) through an independent Article I Immigration Court System committed to fairly and efficiently applying asylum laws. Lawyers are an essential part of the equation.

We should stop confusing families seeking asylum with “security threats.” Indeed, the obsession with those who present no real threat to our country actually detracts from efforts to combat real threats — drug smugglers and human traffickers. Those require undercover and anti-smuggling investigative techniques that have little to do with individuals and families turning themselves in at or near the border to apply for asylum or building physical barriers (although a modest building program could be part of a rational border security package).

True “Border Security” doesn’t require harsh, demeaning, or unfair treatment of asylum seekers, nor does it involve huge walls or more immigration prisons. A fairly administered asylum system along with targeting of smugglers and other criminals and more attention to the root causes of the migration would actually enhance real border security along with Due Process and adherence to the rule of law.

Tigar ruled that the Government failed to meet its burden to demonstrate by clear and convincing evidence that Ms. Liborio Ramos poses a threat to the community.

Judge Tigar found Immigration Judge Burch had erred when she unfairly ruled that Floricel was a danger to the community given her previous DUIs, “The IJ’s decision not to release Liborio Ramos rests firmly on Liborio Ramos’s two DUI convictions.[…] while an immigrant’s criminal history is relevant, ‘criminal history alone will not always be sufficient to justify denial of bond on the basis of dangerousness.’”

“[T]wo non-violent [DUI] misdemeanors in which no one was injured, in light of the other facts in this record, simply do not justify indefinite detention,” Judge Tigar’s ruling continued. In a few days, Ms. Liborio Ramos would have been detained for nearly a year, more than the longest sentence she could have served under California law for a misdemeanor DUI.

“We’re seeing undocumented immigrants punished twice by the immigration courts,” claimed Jehan Laner Romero, Ms. Liborio Ramos’ attorney at Pangea Legal Services. “This was the case with Floricel, who was complying with the criminal court order for her prior DUI conviction.”

Community supporters of Ms. Liborio have much to celebrate after 8 months of arduous efforts to support her case by packing the courtroom during her hearings, holding rallies and uplifting their support for Floricel. Immigration Judge Valerie A. Burch had denied her bond on two different occasions, even though the Government failed to sustain its burden to prove Ms. Liborio Ramos was a danger to the community. To many, this only highlights the unjust practices of some immigration courts — and the importance of higher courts and community members to hold immigration judges accountable. “An immigration court should not serve to merely justify an immigrant’s deportation, but rather it should be there to serve justice,” said Blanca Vazquez, one of the organizers supporting Ms. Liborio Ramos’ case with the Immigrant Liberation Movement. “We hope Floricel’s case serves as a lesson for all immigration judges across the United States.”

There were quite a few of these “Withholding Only” cases on the Detained Docket when I was at the Arlington Immigration Court. I imagine there are even more now. So, this decision could have a major impact.

Judge Brinkema noted quite correctly that withholding-only proceedings take substantially longer than 90 days.” In other words, “real due process” can’t be rolled off the “judicial assembly line” like it is in some Border Detention Courts where most of the respondents are unrepresented and many are essentially “duressed” by prolonged detention in poor conditions, intentional lack of access to legal assistance, and orchestrated inaccessibility of material evidence into giving up viable claims for protection under our laws.

Nice work by the NDPA “Legal Team!” I know each of the attorneys personally from their work in my courtroom, my classroom, or my “CLE outreach” since retirement. This just continues to demonstrate how “good lawyering” from “outstanding attorneys” can turn potential losers into “winners.”

That’s why the “Sessions Proposals” to “speed up” the U.S. Immigration Judges and put more roadblocks in the way of pro bono legal representation and full due process hearings are so invidious. We need an independent Article I Immigration Court fully committed to Constitutional Due Process! And, we need it now!

How A Bond Hearing Saved Me From Deportation By Mark Hwang

Today the Supreme Court will hear Jennings v. Rodriguez, a case that will decide the fate of thousands of men and women locked up in immigration prisons across the country. The federal government is challenging a 2015 Ninth Circuit ruling, in which the American Civil Liberties Union secured the right to a bond hearing for people in deportation proceedings after six months of detention.

Bond hearings allow people to go before a judge so that he or she can decide if imprisonment is necessary, weighing factors like public safety and flight risk. It’s basic due process. Bond hearings are a vital check on our country’s rapidly-expanding immigration system. I’ve seen their power firsthand, because not too long ago, I was one of the people locked up.

In February 2013, I was driving with my one-year-old son when we were stopped by an immigration officer. He said that I hadn’t used my turn signal when changing lanes and asked to see my identification. When he came back to the car, he asked if I had ever been convicted of a crime.

I answered truthfully. More than a decade ago, when I was in my early 20s, I was convicted of marijuana possession with intent to sell. I had served a short sentence and had remained out of trouble since. Still the officers said that I needed to go with them and that I would have to explain “my situation” to a judge. I was shackled and put in the back of the car while one of the officers got into my car to drive my son home.

I thought there had to be some kind of mistake. Around two weeks earlier, my wife Sarah had given birth to our identical twin daughters. My life at the time was full, growing, and completely rooted in the United States.

When I was booked into custody, an officer told me that my drug conviction meant that my detention was “mandatory.” Nobody had ever told me that pleading guilty on a drug charge could have implications for my immigration status. I petitioned a court to vacate the marijuana conviction, but because I was locked up, I couldn’t appear at the hearing. The request was denied and I had no idea for how long I would be locked up, leaving my wife to run our business and care for our children alone. When my family came to visit me in detention, I wasn’t allowed any physical contact, so I couldn’t hold my newborn daughters or my son.

I was at a breaking point, and nearly ready to sign deportation papers when – after being locked up for six months — I finally received a bond hearing as result of the court decision in Jennings. I was granted bond and released, allowing me to return to my family. With the help of an attorney, I was able to vacate my marijuana conviction because I had never been apprised of the immigration consequences to pleading guilty. As a result, ICE no longer had a reason to try to deport me.

Before Jennings, people fighting deportation could be detained indefinitely while they defend their rights to remain in the United States. This includes lawful permanent residents like me; asylum seekers and survivors of torture; the parents of young children who are citizens; and even citizens who are wrongly classified as immigrants. Many go on to win their deportation cases, which means their detention was completely unnecessary.

Even worse, a lot of people simply give up their cases because they can’t endure the hardship of being locked up. Detention almost broke me and I could have lost my life in the only country I’ve known since I was six years old. Instead, I’m here to share my story. Through this experience, I found my faith and am now deeply involved in my church and community. My son is six years old and my twins are five. My wife and I still run our business and I thank her all the time for being a pillar of strength while I was locked up. I hope the justices make the right choice — it can make all the difference.

We’re in “Catch 22” territory here! This respondent was locked up by DHS in “mandatory detention” because he was wrongfully convicted in state court. But, he couldn’t successfully challenge his state court conviction because he was locked up by DHS. Once he got a bond hearing, after six months, he was released, his conviction was vacated, and he and his family could go back to living their lives and being productive Americans. 

But, without the intervention of the 9th Circuit in Jennings, this individual likely would have been coerced into “voluntarily” relinquishing his Constitutional rights and accepting removal to a country where he hadn’t been since he was six years old. I can guarantee you that in jurisdictions where the Article III Courts have not intervened in a manner similar to Jennings, individuals are coerced into abandoning their Constitutional rights and foregoing potentially winning Immigration Court cases on a daily basis.

And, just think of the absurd waste of taxpayer money in detaining this harmless individual for months and forcing the legal system to intervene, rather than having both Congress and the DHS use some common sense and human decency. Few Americans fully contemplate just how broken our current immigration system is, and how we are trashing our Constitution with inane statutes enacted by Congress and poor judgment by the officials charged with administering them.

Easy to “blow off” until it’s you, a relative, or a friend whose Constitutional rights are being mocked and life ruined. But, by then, it will be too late! Stand up for Due Process and human decency now!
