As of December 31, 2023, only the first quarter of FY 2024, the Biden Administration had already initiated 696,400 cases at EOIR. That’s more than the highest FULL FY (12 mo.) of the Trump Administration, 2019, in which 694,771 cases were started. 

Moreover, in FY 2023, Biden filed an astounding 1,485,769 cases, more than twice the number that Trump did in FY 2019. Biden’s numbers in FY 2023 topped Trump’s other three years (278,218; 356,034; 216,589) BY MULTIPLES. In fact, Biden instituted approximately as many Immigration Court cases in FY 2023 as Trump did in his entire FOUR YEARS and is on a path to greatly exceed his 2023 total in FY 2024!

So the Trump/GOP blather about Biden not enforcing immigration laws is complete BS!

Biden’s muscular immigration enforcement efforts give lie to the GOP’s “open borders” claims, a point seldom made by the “mainstream media.” But, such over the top enforcement is NOT necessarily good news for America. 

Even with more Immigration Judges under Biden — going on 700 — the annual decision-making capacity at EOIR is somewhere between 350,000 to 550,000. So, the Immigration Courts will not come close to keeping up with the flow of incoming cases, let alone reducing the backlog that has now mushroomed to more than 3,000,000.

There is no apparent plan for controlling the EOIR backlog and improving the much-criticized quality of decisions, which disproportionately harms legal asylum seekers of color while often adding to the backlog when rejected on review. That makes the Administration’s institution of new cases on a level guaranteed to create additional backlog appear irresponsible.

Moreover, it hasn’t helped that Attorney General Garland ignored pleas from most experts to make EOIR reform one of his highest, ideally his highest, national priority. Nor has Congress paid much attention to the glaring, chronic dysfunction at EOIR, despite pending legislation to create an Article I Immigration Court!

Biden is following in the footsteps of his Dem predecessors Obama and Clinton. In their initial election campaigns they “played to their base” by criticizing harsh GOP enforcement policies and extolling the benefits of immigration. Once in office, however, they became convinced that their credibility, and perhaps manhood, depended on out-enforcing and “out-crueling” their GOP predecessors.

Of course, this naive approach never produces the apparently desired result: That the GOP will acknowledge that Dems are serious about enforcement and strike the long needed “grand bargain” on immigration reform. 

Predictably, that always backfires. The GOP just keeps repeating their “open borders” big lies, and the mainstream media provide little, if any, critical analysis or pushback. As long as kids aren’t being proudly exhibited in cages, the “mainstreams” quickly lose interest in the suffering, dehumanization, and death piling up on both sides of the border and in the “New American Gulag” as a result of the disastrously (and predictably) failed “enforcement-only” approach. 

What Biden’s effort to “out-Trump Trump” REALLY shows is that more enforcement and attempting to use anti-immigrant legal decisions and a hopelessly backlogged adjudication system that keeps legal asylum seekers waiting indefinitely with a significant chance of wrongful denial if and when they are reached as a “deterrent,” doesn’t work, and in fact never has worked!

What’s needed is actually painfully obvious: A balanced approach that combines a properly generous asylum adjudication system, more avenues for legal immigration (both permanent and temporary), and an independent, functioning, expert, due-process oriented Immigration Court with reasonable, targeted, humane enforcement. That’s a message that both parties and the mainstream media are ignoring, to our national detriment. Too many Americans seem to have forgotten that in the process of dehumanizing and demonizing “the other” we degrade ourselves.

Or, put another way, we can diminish ourselves as a nation, but it won’t stop human migration!

THE HILL: Nolan Says Visa Waiver Overstays & Wage & Hour Laws Should Be Enforcement Priorities

Trump’s border security funding request therefore should include measures to locate and remove overstays. He could start with the overstays who used the Visa Waiver Program (VWP) to come here.

This program allows eligible visitors from 38 countries to enter the United States for 90 days as nonimmigrant visitors for business or pleasure without obtaining a visa from an American consulate office.

VWP overstays totaled 379,734 from fiscal 2015 through fiscal 2017. No one knows how many overstayed in the 27-year period between the inception of the program in 1988, and when DHS began recording entry/exit data for fiscal 2015.

They can be removed without adding to the immigration court backlog crisis. If a VWP alien does not leave at the end of his admission period, he can be sent home on the order of a district director without a hearing before an immigration judge, unless he applies for asylum or withholding of removal.

Perhaps Trump should request legislation to remove aliens from the program who may not be bona fide visitors, such as young men who are unemployed. Restrictions are already in place to remove aliens from the program for security reasons.

Nationals of VWP countries who have been in Iran, Iraq, Libya, Somalia, Sudan, Syria, or Yemen on or after March 1, 2011, are not allowed to use the program. They may still be able to come here, but they will have to go through the visa application screening process.

Trump also should request funding to address the incentives that encourage illegal border crossings, such as the “job magnet.”

The Immigration Reform and Control Act of 1986 (IRCA) added section 274A to the Immigration and Nationality Act to provide sanctions for employers who hire aliens who are not authorized to work in the United States. But the program has never been fully implemented.

The Trump administration has increased worksite enforcement efforts. In fiscal 2018, the Homeland Security Investigations office opened 6,848 worksite investigations, compared to 1,691 in fiscal 2017. But there are more than 30.2 million businesses in the United States.

A new approach is needed.

DOL enforces federal labor laws that were enacted to curb such abuses, such as the Fair Labor Standards Act which established a minimum wage, overtime pay, and other employment standards. With additional funding, DOL could mount a large-scale, nationwide campaign to stop the exploitation of employees in industries known to hire large numbers of undocumented immigrants.

A vast 86 percent of Americans support a right to residency for undocumented immigrants who arrived in the United States as children, with support crossing the political spectrum. While all polls, particularly those on immigration, must be looked at with some circumspection, these are great numbers to keep in mind when faced with the constant bogus claims from Trump Administration and GOP Congressional restrictionists that they are somehow representing the “national will” or “the people’s voice” with their out of touch policies and proposals.

Interestingly, one enforcement initiative that got widespread support was enforcing existing employer sanctions laws, something that neither GOP nor Democratic Administrations has been willing to do over the past three decades since they were in acted in 1986.

Nor does their Trump Administration appear to be putting any emphasis on this program. And, it’s easy to see why. Employer sanctions would involve going after U.S. businesses, some of the same folks who helped put Trump and the GOP in power. Some of them like the current system, which keeps many needed workers marginalized and dependent, so they can be exploited.

Perhaps more important, going after U.S.employers doesn’t do anything for the Trump/GOP racist base. Much better to sack up some decent productive Hispanic workers and count it as “law enforcement.” That’s what the racist xenophobes like to see.

“JEROME, IDAHO —In the Magic Valley of southern Idaho, milk is money.

Over 400,000 cows reside in this area, where the miracle of modern irrigation from the Snake River fed pioneer farming. Bovines now outnumber humans by more than two to one. Workers in rubber boots pull long shifts feeding livestock, clearing mountains of manure and extracting millions of pounds of milk all day, every day, all year, on ranches tucked into the rock and sagebrush-studded landscape. Sleek silver tankers filled with milk barrel down Interstate 84 toward dairy processing plants, among them one owned by Chobani, which opened the world’s biggest yogurt factory five years ago just down the road in Twin Falls. Since 2000, milk production has doubled in Idaho, providing the state with $10.4 billion in direct sales, according to University of Idaho economists. Chobani’s gleaming $750 million, cream-colored plant is just one of the many big businesses linked to Idaho’s voluminous milk production, now around third- or fourth-largest among states.

 

In short, the Magic Valley’s dairy boom is a contemporary rural American success story—the kind that President Donald Trump railed as a candidate is too often missing across the country. Unemployment here was less than 3 percent this summer, about as good as it gets, and optimism should be high. Yet on dairy farms, among both owners and workers, a sense of dread hangs in the dry southern Idaho air.

Dairy farmers lean heavily Republican in this deeply red state of only 1.7 million people, where 88 percent of the voting-age population are non-Hispanic whites. But in the age of Donald Trump—who won Idaho handily —even the farmers who supported the new president fear their businesses are about to run headlong into a harsh political reality. They’re frightened that Trump’s aggressive deportation policies will soon start to pick off or push away the mostly Hispanic immigrants who do the gritty work that Americans aren’t interested in doing. Many of these workers are probably undocumented, farmers acknowledge, yet they’re the sturdy backbone of a surging industry. Here in the Magic Valley, the farmers’ perspective is starkly different from the president’s claim that undocumented workers “compete directly against vulnerable American workers.”

And the farmers’ view is pitting them against a vocal contingent of neighbors who’ve responded both to Trump’s rhetoric and far-right media that has targeted immigrants as a threat. Southern Idaho, in fact, became a flashpoint for xenophobia this past year when outlets like Breitbart and InfoWars, seized on false reports about Muslim refugees—accusing them of gang rapes and the spread of fatal diseases like tuberculosis—and turned the remote area into an anti-immigrant cause celebre. But locally, it’s starting to sink in that Trump’s vows to oust undocumented workers—whom he claims are a drain on the economy—could actually kick the legs out from under the “Made in America” model the Magic Valley exemplifies.

Idaho dairy industry representatives estimate that between 85 to 90 percent of on-site dairy workers in the state are foreign-born. The U.S. Department of Labor and other estimates suggest that nearly half to 70 percent of all U.S. farm laborers are undocumented—certainly enough to shut down many of the milk pumps here if workers are ousted as a result of Trump’s policies.

That’s why farmers’ groups have for years pushed Congress, unsuccessfully, to make it possible for them to legally employ immigrants they say are desperately needed. Prospects don’t look any rosier now. In recent months, anti-immigrant rhetoric has only grown more vitriolic, and Trump supporters—including some here—are expecting the president to follow through on campaign promises and deport more people.

Those who understand the dairy business here fear that a political solution won’t materialize before it’s too late, if ever. And that means businesses could struggle due to labor shortages and plummeting production.

“The dairy industry is a big money maker. She’s already watched helplessly as her own family was split by deportation.”

For those of us who have worked in the field of immigration for decades, it is hardly surprising that policies driven by White Nationalism, xenophobia, and just plain old racism and meanness would hurt a wide and diverse swarth of Americans, including many of those same misguided souls who ignored the facts and voted Trump into office.

We need to screen the undocumented folks who are here now, remove those who are criminals or engaging in socially destructive conduct, and give some type of legal status to the rest. Then, we need to significantly expand the number of legal immigrants we accept each year to more closely match market demand, save more lives of those fleeing harm, harness the energy, skills, and talents that will allow us to prosper and lead in the future, and make future immigration enforcement rational, efficient, and effective (by not wasting time arresting, detaining, and deporting those who actually are here to help us).

Folks like Jeff Sessions are pushing an irrational program that if it actually were achievable (which is isn’t) would cripple and perhaps destroy both the economy and the social fabric of our great nation.

It’s time for the majority of “rationalists” (regardless of party affiliation) to band together and defeat the attack of a well-organized minority that is out to harm our country and endanger our future.

HEAVYWEIGHT BOUT: RAHM V. GONZO — Chicago Sues DOJ Over Sanctuary Cities!

“Mayor Rahm Emanuel‘s Law Department on Monday filed its much-touted lawsuit against President Donald Trump‘s Justice Department over its effort to withhold some grant funding from so-called sanctuary cities.

Emanuel wants a federal judge to block the Trump administration from enforcing its new policy, which would affect not just Chicago, but other major U.S. cities like New York and San Francisco. U.S. Attorney General Jeff Sessions’ funding decision also would affect Cook County, which also holds sanctuary status and operates the largest single-site jail in the country.

The Justice Department quickly fired back in an emailed response that notes last year more people were killed in Chicago than New York and Los Angeles combined. “It’s especially tragic that the mayor is less concerned with that staggering figure than he is spending time and taxpayer money protecting criminal aliens and putting Chicago’s law enforcement at greater risk,” the response stated.

Trump has long maintained that illegal immigration fuels crime, an assertion that critics say is not backed by statistics that show immigrants in the country without the required permission are less likely to commit crimes than U.S. citizens and legal residents. And Emanuel in a rare Sunday news conference maintained Trump’s policy would damage efforts to tamp down crime, because people in the city without documentation would then be afraid to cooperate with police.”

Uh, cutting funding for law enforcement to make cities safer doesn’t make much sense either. And, I have no doubt that if Sessions were really interested in getting criminals off the streets, he and Emanuel could reach some type of working agreement. But, what Sessions and the DOJ are really after is to cause more “collateral damage.” To date, the “gonzo” increased enforcement efforts promoted by Trump, Sessions, Kelly, and some within ICE have netted about 70% “collaterals” — folks without any serious criminal record. So, either ICE is particularly incompetent at targeting criminals, or the whole beefed up interior enforcement program is just a smokescreen for more arbitrary enforcement by DHS. I think that’s why Emmanuel and others are concerned about the Trump Administrations “punish sanctuary cities” initiatives.

CNN: American Families Are The Human Wreckage Of Trump’s Deportation Policies!

“New Fairfield, Connecticut (CNN)Six-year-old Preston Colindres runs up the driveway and front steps and jumps into his father’s arms.

“Hey buddy! How are you? Oh, I love you!” Joel Colindres says as he kisses his son’s cheek. He picks up his 2-year-old daughter, Lila, hugs her and tells her he loves her.
Colindres’ children don’t know their father’s heart is breaking.
Colindres, 33, fled from Guatemala more than a decade ago. He and his American wife, Samantha, can’t quite figure out how to tell their young children that in less than a month he may no longer greet them on the steps of their New Fairfield home.
How do you explain to a 6-year-old why their father is going to be deported? The couple is unsure — especially when they can’t figure it out themselves.
“I can’t seem to summon the courage to look them in the face and say all that,” Samantha Colindres said. “How can you say it before bed, how’s he going to sleep? How do you say it in the morning before school and ruin his day? When’s the right time?”
Colindres must produce an airline ticket to Guatemala on Thursday as proof that on August 17 he intends to comply with a deportation order.
Stopping illegal immigration and kicking out “bad hombres” was a central theme of Donald Trump’s presidential campaign. In the days after his inauguration, he vowed to rid the country of violent criminals who enter the country illegally.

Since he came into office, the number of undocumented immigrant arrests has risen by roughly one-third, according to Immigrations and Customs Enforcement statistics. That was largely driven by an increase in the number of non-criminals arrested.
But the Colindres family never thought Joel would be a target for deportation. They, along with family, friends, and their lawyer Larry Delgado, maintain his case is typical of a change in the face of those targeted for deportation.
“This is one of the most compelling cases that we have ever seen in terms of the positives versus the negatives,” Delgado said.
Delgado counts off the positives rapidly: Colindres is married to a US citizen; has two children who are citizens; pays his taxes; owns his own home and is a skilled worker who has been with the same company for 12 years. Most importantly, Delgado said, Colindres has no criminal record.
Delgado believed Colindres’ case would be a “slam dunk” to at least get a stay of deportation. But a growing number of undocumented immigrants have found themselves expecting one outcome and getting another, Democratic Connecticut Sen. Richard Blumenthal said.
“These individuals relied on the good word and promise of the American government. They were permitted to stay here, they reported periodically, they made no effort to hide, they violated no laws, they raised children here, US citizens, and contributed and worked hard,” Blumenthal said.

Unfairness should ‘strike the hearts of Americans’

Nury Chavarria, also a Guatemala native, sought sanctuary from deportation inside a church.

The Colindres family is not alone.
“There are hundreds and maybe thousands in Connecticut and many, many more around the country that find themselves in this trauma and tragedy,” Blumenthal said.
Similar cases include that of single mother Nury Chavarria, also a Guatemala native, who had taken sanctuary with her four children inside a New Haven, Connecticut, church last week to avoid deportation. Her eldest son, who is 21 years old, has cerebral palsy. Chavarria was granted a stay of deportation in her case on Wednesday night, according to her lawyer.
Sen. Blumenthal believes immigration laws should be enforced, but with discretion.
“We should be deporting people who are dangerous and who pose a threat to society, not people like Nury and Joel and others who have lived here, worked, paid taxes, raised families, and have people depending on them at work and in their homes,” Blumenthal said.
“That is a betrayal of American values, it’s also against our interest because our economy depends on the talents and energy of these people, and we should be providing some pathway to earned citizenship for them.”
But the Trump administration has made clear anyone here illegally can be subject to deportation.
“The fact that you are not a priority does not exempt you from potential enforcement,” a Department of Homeland Security official said. People with crimes like DUIs and status violations, or noncriminal histories but a final order of removal could be subject to deportation, the official added.
Blumenthal believes those like Colindres and Chavarria should get a chance to further present their cases to remain in America.
“The fundamental unfairness of it ought to strike the hearts of Americans,” he said.”

Only 6% Of Trump Immigration Arrests Involve “Violent Crimes!”

“For the most part, the Trump campaign was transparent in its xenophobia, playing to the anti-immigrant sentiments of Trump’s base with promises to increase deportations of the undocumented. But on one point, Trump pretended to care about nuance: He would not, he stated on multiple occasions, target undocumented immigrants indiscriminately, but would focus on those with criminal records—the “bad hombres,” to use the president’s own ridiculous words. Predictably, this has not been the case in practice. A new report shows that amidst a staggering increase in undocumented immigrant deportations overall, arrests of law-abiding undocumented immigrants shot up the most, by a whopping 150 percent.

A report by U.S. Immigration and Customs Enforcement boasts that between January 29 and April 22, agents arrested 41,318 undocumented immigrants. That figure, which breaks down to roughly 400 arrests per day, represents an increase of 37 percent over arrests made during the same period under President Obama, who previously held the title of Deporter-in-Chief. Seventy-five percent of those taken into custody have criminal convictions, but even that notation is potentially misleading. As Vox notes, “it’s not clear how many of those were for crimes that might be considered minor, or for crimes that are the result of being an unauthorized immigrant in the U.S. (such as driving without a license in a state that doesn’t permit unauthorized immigrants to get drivers’ licenses).” In fact, as the outlet points out, just 6 percent of those arrested had been convicted of violent crimes such as “homicide, rape, kidnapping and assault.”

The number of non-criminal undocumented immigrants arrested more than doubled, going “from approximately 4,200 in 2016 to more than 10,800 in 2017.” The ICE reports highlights this statistic as a point of pride, stating that while “convicted criminals are an immigration enforcement priority, Homeland Security Secretary John F. Kelly has made it clear that ICE will no longer exempt any class of individuals from removal proceedings if they are found to be in the country illegally.”

Disrupting communities across America, pushing the U.S. Immigration Courts to the brink, burning through taxpayer dollars, without accomplishing much of anything useful. That’s the Trump way!

Contrary to the GOP fantasy hype, the Obama Administration was certainly no slouch at apprehending and removing serious criminals. So, the Trump enforcement charade has increased misery, deepened divisions, and created unnecessary commotion, while, by most reliable accounts, actually making us less safe by eroding years of hard-earned trust and cooperation between migrant communities and local police in reporting and solving crimes! Talk about a “built for failure” program!

TRAC Starts Analyzing “Trump Enforcement Data” — Initial Results Are Inconclusive

“Because of these filing and recording delays, it is too soon to determine overall trends. However, some large shifts in the composition of post-Trump cases are suggestive:

The court is now seeing many more cases where the individual was detained at the time the case is filed, and fewer non-detained cases. See Figure 1.

California, as compared to Texas and New York, are seeing larger numbers proportionately than previously.

The court is receiving fewer cases from individuals who entered the country within the last year, including fewer unaccompanied juveniles and women with children seeking refuge in the U.S.”

Read the complete report, with charts, at the above link. These results do appear consistent with the Trump initiatives — more detention, fewer cases being referred from the border, more action in major urban areas such as California.

But, as a “rank amateur,” I found the stats too small a sample, too early in the Administration to draw any valid conclusions.  In other words, our expectations as set by the Executive Orders might be affecting how we interpret the data.

“Effective February 27, 2017, new changes to the asylum screening process could lead to an increased number of deportations of asylum-seekers who fear persecution upon return to their home country.

On February 13, 2017, U.S. Citizenship and Immigration Services (USCIS) revised its Asylum Division Officer Training Course (ADOTC) lesson plans on how to assess an asylum seeker’s credible and reasonable fear of persecution or torture. The lesson plans were revised to be consistent with the January 25, 2017 Executive Order on border security and immigration enforcement and provide guidelines to the asylum officers when conducting credible fear interviews (for those at the border or port of entry who were never previously deported) and reasonable fear interviews (for those who were previously order deported but who later seek asylum).

The changes to the lesson plans are significant and may cause the denial rate to skyrocket, in which case thousands of asylum seekers would be wrongfully denied a meaningful day in court . Not only does the new guidance provide asylum officers with greater discretion to deny an applicant for reasons which may be out of the applicant’s control, but the applicant will essentially be forced to undergo a full asylum hearing with none of the safeguards in place to ensure a meaningful opportunity to present a claim for relief.”

If this carries over into Immigration Court where unsuccessful applicants can seek “expedited review,” it would mean that “credible fear reviews” could become more time consuming.

I was usually able to complete them in a few minutes using the Asylum Officer’s notes and asking a few questions. I found that the overwhelming number of those denied had “credible fear,” and probably at least half of those cases eventually resulted in relief. However, over the last year of my career I was primarily on the non-detained docket, so I only did “credible fears” when I was on detail to a detention center or the system was backed up.

As an Immigration Judge, I did not use the USCIS lesson plans. But, I did rely on the Asylum Officer’s notes for a basic understanding of the claim. I then usually asked a few questions to verify that the notes accurately reflected the claim and that nothing relevant had been omitted.

THE HILL: Nolan Rappaport Gives Thumbs Up To President Trump’s “VOICE” Program

Nolan writes in The Hill:

“The VOICE office will create a programmatic liaison between ICE and victims of crimes committed by removable aliens. The objective is to facilitate engagement with the victims and their families to ensure, to the extent permitted by law, that they are provided with information about the offender, including the offender’s immigration status and custody status.
Secretary Kelly funds this program by ordering the director of ICE to reallocate the resources currently used to advocate on behalf of undocumented aliens (except to comply with a judicial order) to the new VOICE Office, and to terminate outreach and advocacy services to undocumented aliens immediately.

VOICE is not a completely new idea. ICE established a Victim Assistance Program in 2008, but it has worked primarily with victims of human trafficking.

A Huffington Post contributor says, “Let’s call this what it is: VOICE is racist government propaganda.” He claims that VOICE will embroil the media and the public in a constant debate about the merits of immigration in the United States.

Even if the contributor is right about President Trump’s intention in creating this program, and I do not think he is, I applaud the president’s attempt to help crime victims.

Moreover, I believe that the public is entitled to more information about crimes committed by immigrants, particularly the ones who are here in violation of our immigration laws. Then, we will be able to let the facts speak for themselves.”

David Nakamura Reports in the Washington Post:

“The Trump administration on Tuesday sought to allay growing fears among immigrant communities over wide-ranging new directives to ramp up enforcement against illegal immigrants, insisting the measures are not intended to produce “mass deportations.”

Federal officials cautioned that many of the changes detailed in a pair of memos from Homeland Security Secretary John F. Kelly will take time to implement because of costs and logistical challenges and that border patrol agents and immigration officers will use their expanded powers with care and discretion.

Yet the official public rollout of Kelly’s directives, first disclosed in media reports over the weekend, was met with outrage from immigrant rights advocates over concerns the new policies will result in widespread abuses as authorities attempt to fulfill President Trump’s goals of tightening border control.

Trump took a hard line against illegal immigration during his campaign, at times suggesting he would seek to create a nationwide “deportation force” to expel as many of the nation’s estimated 11 million unauthorized immigrants as possible.

In a conference call with reporters, a senior Department of Homeland Security official moved to avert what he called a “sense of panic” among immigrant communities.”

Summary: Duh! So, we roll out this big new program in the first 35 days of the new Administration to great fanfare. But, nobody considered the resource and funding implications with Congress. So, it’s much ado about nothing (for now). But, don’t you dare lie about all the great things we’ve already accomplished. Watch for the biased media falsely claiming that it’s all smoke and mirrors or that we’re already rounding up some of the folks we said we’d deport. We mean what we say, but we’re not actually doing what we said we’d do. What kind of fools would panic about that?

Michele Waslin, Immigration Impact: Trump Administration Ditches “Common Sense Priorities” In Adopting a Max Enforcement Program!

“The Trump administration is quickly unraveling the last administration’s efforts to prioritize those for deportation who pose a serious threat over those who don’t. The new administration is ignoring priorities that were put into place by the Obama Administration as a way to manage limited law enforcement resources. The priorities recognized that there is a finite budget available for immigration enforcement, thus making prioritization important. The approach now being pursued by the Trump Administration casts a wide net and will result in an aggressive and unforgiving approach to immigration enforcement moving forward.

The most significant indications of this shift came through the “Enhancing Public Safety in the Interior of the U.S.” executive order, issued January 25, 2017, which prioritizes for deportation those noncitizens who:

Have been convicted of any criminal offense;
Have been charged with any criminal offense;
Have committed acts that constitute a chargeable criminal offense;
Have engaged in fraud or willful misrepresentation in connection with any official matter or application before a government agency;
Have abused any program related to the receipt of public benefits;
Are subject to a final order of removal but have not departed;
Otherwise pose a risk to public safety or national security.
In addition, unauthorized immigrants with no criminal history will likely fit under the third bullet because entering without inspection is a chargeable criminal offense (illegal entry or re-entry). And since the executive order states that many immigrants without immigration status or who overstayed their visas are a risk to public safety and national security, it appears the final bullet is a catch-all category for many others. In other words, the president has “prioritized” everyone, which means in reality he’s prioritized no one, making everyone a target for enforcement. Furthermore, legal immigrants—even green card holders–who are convicted of aggravated felonies or crimes of moral turpitude could also be subject to deportation.

Yet despite the more aggressive approach, it is still unclear from where the resources to identify, arrest, detain, and deport all of these individuals will come. For example, the U.S. is already over-capacity in detention, and immigration courts are seriously backlogged.

In the past, the government has stated that budget realities make it impossible to remove everyone who is in the country without authorization or who is otherwise deportable. This meant the agency had to set priorities and focus on a subset of deportable immigrants.

The Obama administration released a series of memos designed to prioritize those who pose a threat to public safety and national security and other categories of individuals.”

The Obama Administration made a total mess out of the already stressed U.S. Immigration Court dockets by unwisely and unnecessarily “prioritizing” cases of recently arrived unaccompanied children, women, and families fleeing violence and corruption in the Northern Triangle.

Nevertheless, thorough programs such as DACA, stateside processing, closing cases with possible relief pending before USCIS, and frequent wise use of prosecutorial discretion (“PD”) in “clean” cases with difficult legal issues but strong humanitarian factors, the Obama Administration was the first Administration I have seen make progress on developing a system that could eventually have helped “rationalize” Immigration Court dockets. If freed from politicized and unrealistic “priorities” from above, this eventually could have allowed the courts to focus on cases that really needed to be litigated, as is the case with almost all other high-volume court systems.

By contrast, the Trump Administration seems intent on “torquing” the Immigration Court system until it breaks apart. Even the Obama Administration used an overly broad concept of “criminal alien.” They included too many individuals who, while technically removable under the law, were doing useful things in the community and presented no real threat to the safety or security of the U.S.

Certainly the Trump Administration could have focused on those whose removals should be prioritized by “fine tuning” the Obama enforcement priorities. Instead, they have embarked on an expensive and ill-planned “mission impossible” to make everybody a priority (and, hence, nobody a priority) without any regard to the capacity or the best uses of court time and resources within our judicial system.

Additionally, the Trump Administration seems to be going out of its way to “disempower” those who are closest to the problem and are actually in the best position to determine which cases should be prosecuted:  the local Offices of Chief Counsel of the DHS (the “immigration equivalent” of the U.S. Attorney). In Arlington, the Office of Chief Counsel was well-respected by all and had an excellent grasp of how to make the justice system work for all involved. Their main problem, like that of the Immigration Courts, was unrealistic priorities and directives imposed on them by political officials “up the chain.”

Sadly, the Trump Administration seems determined not to build on those things that have been successful in the past and instead to embark on a new “blunderbuss” approach to immigration enforcement that is almost guaranteed to get tied up with both legal challenges and practical impossibilities.
