Election Denial, “Sexual Anarchy,” Noah’s Ark: All the Mike Johnson Details We Regret to Inform You Of

By Bess LevinOctober 26, 2023

There’s a lot that’s concerning!

On October 25, after several weeks that saw dysfunction, chaos, humiliation, and anonymous threats to at least one lawmaker’s wife, Republicans finally elected a Speaker of the House to succeed Kevin McCarthy: Mike Johnson, a representative from Louisiana who has the distinction of being the least experienced Speaker in more than a century.

At the time of Johnson’s accession, a lot of Americans likely had no idea who he was; actual Republican senator Susan Collins, for one, told a reporter she didn’t know Johnson but planned to remedy that by googling him. And if you weren’t familiar with Johnson, you might’ve assumed that that was maybe even a good thing—that he was just a quiet Republican who hadn’t gotten wrapped up in the insanity plaguing the GOP over the last seven or so years. He didn’t have the name recognition of, say, Jim Jordan or Matt Gaetz, but perhaps that simply spoke to the fact that he wasn’t leading a series of absurd hearings in an attempt to take down Joe Biden; or bragging about being so devoted to Donald Trump that he answered his phone calls during sex. Maybe, you might have thought, he wasn’t someone you’d have to constantly worry about re: undermining democracy or trying to take away people’s rights.

Unfortunately, that is not the case with Johnson, who may not have been well known prior to being given one of the most powerful jobs in government but is very much someone whose extremist views and actions should keep you up at night.

Herein, a running list of the absolute most WTF things the new Speaker has said and done on everything from the 2020 election to abortion to LGBTQ+ rights and more.

Abortion

Johnson is proudly antiabortion. When Roe v. Wade was overturned last year, he called it “a great, joyous occasion,” later writing, “We will get the number of abortions [in Louisiana] to ZERO!!” As an attorney for the Alliance Defense Fund, now known as the Alliance Defending Freedom, he worked on efforts to shut down abortion clinics in the state. In Congress, he cosponsored legislation that would have banned abortions at about six weeks of pregnancy, i.e., a time when many people do not even know they’re pregnant. He’s beloved by the antiabortion organization Susan B. Anthony Pro-Life America, which has given him an A+ rating. In 2015, he blamed school shootings on abortion, telling writer Irin Carmon, “When you break up the nuclear family, when you tell a generation of people that life has no value, no meaning, that it’s expendable, then you do wind up with school shooters.”

In some real Handmaid’s Tale shit, he declared during a House hearing that if women were forced to have more children, a.k.a. “able-bodied” workers, there would be more funding for Social Security and Medicare:

On at least one occasion, he declared that doctors who perform abortions should be sentenced to “hard labor”:

Oh, and like many antiabortion zealots, Johnson doesn’t seem to like contraception either.

LGBTQ+ rights

Hoo boy, where to start? Here are some things that Johnson has said about LGBTQ+ people, same-sex marriage, and gay sex between consenting adults:

In his work as an attorney for the Alliance Defense Fund, Johnson also argued in court that same-sex couples should not receive domestic partnership benefits, and officially opposed the Supreme Court’s decision to decriminalize gay sex between consenting adults. In the Louisiana House of Representatives, he proposed a bill that critics say would have made it easier to discriminate against LGBTQ+ people. (In response, he claimed he was not a “bigot,” adding: “I know that I brought this bill for the right reason.”) Meanwhile, in Congress, he introduced a national bill seemingly modeled after Florida’s “Don’t Say Gay” law; voted against the 2022 bipartisan bill to codify gay marriage; and last year cosponsored a bill making it a crime to provide gender-affirming care to anyone under 18, despite the American Academy of Pediatrics backing such care.

“I would be hard-pressed to think of a worse member to be elected Speaker of the House,” Allen Morris, policy director for the National LGBTQ Task Force, told The 19th.

Separation of church and state

If you guessed that Johnson doesn’t believe in it, you guessed right. In April—as in, just a few months before he was elected Speaker—the congressman railed against what he referred to as the “so-called separation of church and state,” saying, “The founders wanted to protect the church from an encroaching state, not the other way around.”

In 2018, Johnson argued for prayer in public schools.

Evolution

In addition to blaming abortion for mass shootings, Johnson has also claimed that the teaching of evolution has played a part. In a 2016 sermon, he told the audience, “People say, ‘How can a young person go into their schoolhouse and open fire on their classmates?’ Because we’ve taught a whole generation—a couple generations now—of Americans, that there’s no right or wrong, that it’s about survival of the fittest, and [that] you evolve from the primordial slime. Why is that life of any sacred value? Because there’s nobody sacred to whom it’s owed. None of this should surprise us.”

In related news, a year prior, Johnson filed a lawsuit for an organization to receive tax subsidies to build a Noah’s Ark–focused theme park in Kentucky. “When the Ark Project sails, everybody will benefit,” he wrote in an op-ed, “even those who are stubbornly trying to sink it.” The Ark Encounter is operated by a fundamentalist Christian group that believes in creationism.

Climate

Where does Johnson, not exactly a man of science, land on global warming? Well, per The New York Times:

Representative Mike Johnson of Louisiana, the newly elected House Speaker, has questioned climate science, opposed clean energy, and received more campaign contributions from oil and gas companies than from any other industry last year. Even as other Republican lawmakers increasingly accept the overwhelming scientific consensus that human activity is dangerously heating the planet, the unanimous election of Mr. Johnson on Wednesday suggests that his views may not be out of step with the rest of his party.

A former constitutional lawyer, he does not sit on committees that decide the fate of major energy issues. But he has consistently voted against dozens of climate bills and amendments, opposing legislation that would require companies to disclose their risks from climate change and bills that would reduce leaks of methane, a potent greenhouse gas, from oil and gas wells. He has voted for measures that would cut funding to the Environmental Protection Agency.

In 2017, Johnson opined: “The climate is changing, but the question is, is it being caused by natural cycles over the span of the earth’s history? Or is it changing because we drive SUVs? I don’t believe in the latter. I don’t think that’s the primary driver.”

The 2020 election

By now you’ve likely heard that Johnson spent a significant amount of time and energy trying to overturn the 2020 election—an effort that included leading the amicus brief signed by more than 100 GOP lawmakers that asked the Supreme Court to overturn the 2020 election results in Georgia, Michigan, Wisconsin, and Pennsylvania. Johnson also objected to the certification of Biden’s win on January 6; his arguments for doing so were adopted by a significant number of Republicans, leading the Times to call him “the most important architect of the Electoral College objections.” One day prior, per Politico, he told colleagues, “This is a very weighty decision. All of us have prayed for God’s discernment. I know I’ve prayed for each of you individually,” before pressing them to oppose the Electoral College results. Oh, and he was a Dominion truther:

Go on over to the Levin Report at the above link to get all the gory (perhaps an understatement) details on America’s Retrograde Speaker!

MAGAMike often pretends as if the his interpretation of the Bible, not the Constitution or the Declaration of Independence, were our founding document.

But, believe it or not, the founding fathers were actually “revolutionaries,” not “reactionaries,” who overthrew tradition to arrive at a different place. In the process they incorporated what in those days were some “enlightenment” ideals to replace “traditionalist” regressive principles like the “divine” right of kings and a purely hierarchical society where there was no escape from the status assigned at birth!

One can debate the exact religious beliefs of the founders. But, they certainly foresaw a non-static society, open to change, and tolerating more than one viewpoint. They weren’t theocrats, and they weren’t wedded to the view that society can’t change and evolve to adapt to new norms and practical realities.

One could read the teachings of Christ as promoting love, kindness, tolerance, forgiveness, perspective, and siding with society’s outcasts. MAGAMike and his zealots appear to have a quite different “take.” That’s their prerogative. But, they shouldn’t be allowed to impose their peculiar, wayward views on the rest of us.

Faced with his first national tragedy, and a chance to show some real guts, leadership, and humane, common-sense principles derived from Christianity, all the self-professed “Man of God” and “protector of the unborn” (but “rejector of the  born”) could muster was the same old trite “hearts and minds” garbage that flows from spineless GOP politicos. Compare MAGAMike with Rep. Jared Golden (D-ME) who apologized and changed his position to favor an assault weapons ban. See, e.g., https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwiJ35iN1puCAxVBk2oFHWs3CX8QvOMEKAB6BAgQEAE&url=https%3A%2F%2Fwww.washingtonpost.com%2Fpolitics%2F2023%2F10%2F26%2Fmaine-shooting-gun-control-laws%2F&usg=AOvVaw1NdJWXqX0pvd75g3dguKa_&opi=89978449.

Jesus would have valued assault weapons over human lives? Gimmie a break!

🏴‍☠️🤮 “CHRISTIAN” WHITE NATIONALIST MAGAMIKE TAKES GOP TO NEW LOWS — Greg Sargent @ WashPost

MAGA MikeMAGA Mike

By Bruce Plante

Republished under license

Greg writes:

https://www.washingtonpost.com/opinions/2023/10/27/mike-johnson-great-replacement-theory-house-speaker/

Rep. Mike Johnson, the newly elected House speaker, has repeatedly flirted with what’s known as the “great replacement theory,” the idea that Democrats are scheming to supplant American voters with immigrants. The Louisiana Republican’s views show how fringe conspiracy theories have gone mainstream in the Republican Party at the highest levels of power.

“This is the plan of our friends on this side — to turn all the illegals into voters,” Johnson said at a congressional hearing in May 2022, gesturing at Democrats. “That’s why the border’s open.”

The “open borders” trope is a lie, and while a few municipalities allow voting for noncitizens in local elections, in no sense do national Democrats have any such “plan” for “all the illegals.” As far as I can determine, no House speaker in recent memory has been quite as reckless and incendiary with this kind of language.

Johnson employs it regularly. He reiterated the claim in an interview this year with the right-wing outlet Newsmax, accusing President Biden of “intentionally” encouraging undocumented migration to “turn all these illegals into voters for their side.” On numerous other occasions, he has made similar charges, even declaring that Democrats’ express goal is the “destruction of our country at the expense of our own people.”

On immigration, as well as on abortion and gay rights, Johnson’s elevation is a triumph for the far right. It has been widely noted that Johnson doesn’t come across as a MAGA bomb-thrower, despite his extreme views. That’s true on immigration, too: He voices high-minded platitudes about how providing asylum to the persecuted is a noble ideal, but he’s a big booster of the wildly radical House GOP border bill that would functionally gut asylum entirely.

The pro-immigrant group America’s Voice, which tracks lawmakers’ positions on the issue, has not documented any comparable rhetoric in Johnson’s predecessor, Rep. Kevin McCarthy. “Johnson has gone farther than most of his Republican colleagues in elevating alarmist and dangerous rhetoric,” says Vanessa Cardenas, the group’s executive director.

Other predecessors, such as John A. Boehner and Paul D. Ryan, were supporters — nominally, at least — of reforms that would legalize large numbers of undocumented immigrants, though they ultimately failed to deliver. Not even Newt Gingrich, the most extreme House speaker of the modern era, went as far as Johnson, says Nicole Hemmer, author of a history of conservatism in the 1990s.

“Even at his most anti-immigrant, he spoke largely in fiscal and law-and-order terms,” Hemmer told me, while eschewing the “eliminationist rhetoric” at the core of great replacement theory.

Yet little by little, those more extreme ideas have penetrated GOP leadership circles. In 2021, Rep. Elise Stefanik (N.Y.), a top House Republican, charged Democrats with scheming to replace conservative voters with Democratic-leaning immigrants.

🏴‍☠️☠️ AMERICAN FASCISTS: DeSANTIS & GOP KILLING KIDS, AS FLORIDA TEACHERS VOTE WITH THEIR FEET! — “What the GOP’s vendetta against the LGBTQ community really is, is a classic authoritarian tactic to vilify already marginalized people,” Says Robert Reich!

Nazi Book Burning

How DeSantis and other GOP lawmakers are killing LGBTQ young people

And why they’re doing it

ROBERT REICH
MAY 23

Friends,

Last Wednesday, Florida Governor Ron DeSantis — who is expected to announce his campaign for the presidency as soon as tomorrow — signed a gaggle of bills targeting LGBTQ youth.

In addition to those he had already signed into law — including a “Don’t Say Gay” measure barring teachers from mentioning sexual orientation or gender identity and another prohibiting gender-affirming care — his latest laws expand the state’s prohibition on classroom instruction about sexual orientation and gender identity, require that students use bathrooms associated with their sex assigned at birth, prohibit adults from taking children to see drag shows, and bar teachers from asking students about their preferred pronouns.

Another of the bills DeSantis just signed into law allows the state of Florida to take transgender minors away from parents who help them obtain gender-affirming care.

In raging against gender-affirming care, DeSantis lied that “they’re literally chopping off the private parts of young kids.” In fact, genital surgery is rarely, if ever, done under the age of 18. It’s not even all that common for adults. DeSantis is lying about it to scare people.

pastedGraphic.png

Meanwhile, the Republican presidential frontrunner has made it clear that trans people have no place in his vision of America:

“I will sign a new executive order instructing every federal agency to cease all programs that promote the concepts of sex and gender transitions at any age. I will ask Congress to pass a bill establishing that the only genders recognized by the United States government are male and female, and they are assigned at birth.”

***

My friends, these scare tactics are dangerous. Recent analysis found a 70% increase in hate crimes against LGBTQ Americans between 2020 and 2021, as the surge of these anti-LGBTQ bills began. And that’s only counting hate crimes that get reported. The years 2020 and 2021 each set a new record for the number of trans people murdered in America.

**

pastedGraphic_1.png

The cruelest irony is that these Republican bills pretending to protect children are putting our most vulnerable children at greater risk.

LGBTQ kids are more than four times likelier than non-LGBTQ kids to attempt suicide, especially transgender young people.

Gender-affirming care reduces that risk. That is why it is life-saving.

“Don’t Say Gay” laws also strip away potentially life-saving support. A teacher who positively and respectfully discusses sexual orientation and gender identity won’t turn a straight kid gay. But such a discussion will make an LGBTQ student 23% less likely to attempt suicide

The tragic truth is that “Don’t Say Gay” laws and bans on gender-affirming care are causing more young lives to be needlessly lost.

Laws that threaten to take transgender minors away from their families if they are receiving gender-affirming care will cause these young people even more trauma.

If Republicans really cared about protecting kids, they’d focus on gun violence, now the leading cause of death for American children.

If they were really worried about children undergoing life-altering medical procedures, they wouldn’t pass abortion bans that force teens to give birth or risk back-alley procedures.

What the GOP’s vendetta against the LGBTQ community really is, is a classic authoritarian tactic to vilify already marginalized people.

This is how fascism takes root.

We need to see DeSantis’s bills and similar bills signed by Republican governors across the land for what they are — attempts to use bigotry and hate to elevate their political standing.

And we need to see this Republican attack on LGBTQ Americans for what it is: a threat to all of our human rights.

[My thanks to Allan Piper for work on a version of today’s letter.]

Meanwhile, as Caleb Ecarma reports for Vanity Fair, Florida teachers have had enough:

https://www.vanityfair.com/news/2023/05/florida-education-brain-drain-hitting-schools-hard

. . . .

“For the first time, I’ve actually started talking to my investment guy about retirement,” Michael Woods, a teacher who has spent decades working in exceptional-student education for public schools in South Florida, tells me. “I’m a 30-year veteran who showed up every day, hardly calls in sick, but now I don’t want to be a teacher in Florida.” Most troubling to Woods—a gay man who teaches science and biology courses—is the ballooning list of laws that police classroom material, discriminate against LGBTQ+ educators and students, and restrict sex education. “They’re all so vague,” he says of DeSantis’s new laws. “Even things that used to be easy like human reproduction [for ninth graders], I now have to check with my co-teacher and ask, ‘Is this okay? Are we still allowed to teach this?’”

On Wednesday, the governor rubber-stamped a batch of four bills restricting LGBTQ+ rights and expanding the Parental Rights in Education Act—or, as critics have dubbed it, the “Don’t Say Gay” law. The new measures, which will be enforced at public and charter schools, ban educators from discussing sexual orientation or gender identity in pre-K through eighth grade, and place new, vague restrictions on sex education, including that such instructions “be age-appropriate or developmentally appropriate for students in accordance with state standards.”

This latest salvo was a bridge too far for many teachers, according to Rebecca Pringle, the president of the National Education Association, the largest labor union in the US. “I just talked to one teacher yesterday who is leaving and she said, ‘I can’t teach like this,’” Pringle tells me. “‘I can’t teach while worrying that they’re coming after my license, or I’m committing a felony.’ They’re leaving in protest.” Pringle says she has tried to convince teachers to stay in Florida, given the dearth of teachers in the state. But that discussion has been difficult to have, she says, with teachers who are facing death threats or harassment.

Case in point: One fifth-grade teacher in West Florida said this month that she was placed under investigation by the Florida Department of Education for showing her class Disney’s Strange World, a children’s movie that features an openly gay character. Jenna Barbee, the teacher at hand, said she played the film to give students a post-exam “brain break.” But when a local school board member learned of the showing, Barbee said, she was reported to state officials. Barbee told CNN that she had already submitted her resignation before the incident, in protest of the “politics and the fear of not being able to be who you are” in Florida public schools.

It appears that no educator has yet been prosecuted or charged under Florida’s “Don’t Say Gay” law or its legislation restricting books in schools. But as fears mount over their future implementation, parents are already witnessing the effects of shorthanded schools and overcrowded classrooms. “Last year, I saw several teachers leave, and we had substitutes for three, four months of the year,” says Reagan Miller, a parent in West Florida whose two children attend public school. “We had a teacher who taught advanced math at our middle school for years and years—he just left to go be a 911 operator,” she tells me, “which blows my mind, that becoming a 911 operator would be less stressful than being a teacher.”

. . . .

*****************************

My experience on the bench was that almost all the transgender individuals coming before me had attempted suicide on one or more occasions or expressed suicidal thoughts. To a person, they just wanted to be accepted, protected, and to live their own lives without harassment, interference, or fear. These are all things that today’s cowardly GOP “Brown Shirt Pols” would deny them.

The next generation is going to have to decide whether they want to live in a Nazi-inspired police “hate state” where individual freedoms are meaningless and cruelty, bullying, suppression, and betrayal are the norms. If not, then they had better get busy removing every GOP politico from every office — from local school boards and city councils to the Presidency.

How soon we forget the lessons of 1939! Perhaps that’s part of the GOP’s war on truth, education, and history!

GONZO’S WORLD: SPLC RESPONDS TO GONZO’S SLIME ATTACK!

We’re being attacked by Attorney General Jeff Sessions for standing up to anti-LGBT hate.

It’s an attack not just on us but on you and everyone else who believes in equality.

Yesterday, Sessions spoke to the Alliance Defending Freedom (ADF), a group that vilifies the LGBT community and promotes discrimination against it in the name of religion.

Because of its bigotry, we’ve named the ADF a hate group.

It’s a label that’s richly deserved.

The ADF has promoted the myth that there’s a link between homosexuality and pedophilia – even though the weight of scientific authority has debunked the claim. Linking the two is not an expression of religious belief. It is simply a dangerous and ugly falsehood.

The group also supports the criminalization of sexual relations between consenting adults abroad … opposes anti-bullying policies that provide protections on the basis of sexual orientation and gender identity … and is working to strip LGBT protections from U.S. law.

In his speech, Sessions attacked us for calling the ADF what it is – a hate group that would like to push the LGBT community into the closet if not into jail.

It’s ironic – and utterly hypocritical – for the attorney general to suggest that the rights of ADF sympathizers are under attack when the ADF is doing everything in its power to deny the equal protection of the laws to the LGBT community.

After he made similar comments last week, we explained in a letter to the attorney general that we identify hate groups in a manner analogous to how the Justice Department defines hate crimes.

Just as religious beliefs would not be a defense to a hate crime prosecution, vilifying others in the name of religion should not immunize a group like the ADF from being designated as a hate group.

Sessions’ boss, President Trump, promised during his campaign to be a “real friend” to the LGBT community. Yet, Sessions has taken multiple actions to roll back protections for the LGBT community, as have Trump and other administration officials.

The nation’s top law enforcement officer should not be lending the prestige of his office to a group that wants to enshrine its bigotry into law.

But based on everything we’ve seen from this administration, it’s not surprising. It’s obvious that this administration is no “friend” to the LGBT community.

We don’t relish being attacked by the attorney general of the United States, but we’re not going to be intimidated by him.

With supporters like you behind us, you can rest assured that we’re not going to stop calling out hate when we see it. In the Trump era, it may be our most important job.

Thank you for standing with us.

Sincerely yours,

Richard Cohen Signature

How upside down perverted has America become in the Age of Trump & the White Nationalists? Attorney General Jeff Sessions, who is charged with standing up for the rights of all Americans, instead stands up for a hate group, lies, tramples the First Amendment separation of church and state, and slimes a courageous and highly respected civil rights group that has been fighting such hate and discrimination for many years. Incredibly, Sessions fans the flames of intolerance and hate while White Supremacist hate groups are preparing for another assault on the good people of Washington and Charlottesville!

This is just the latest in Gonzo’s perverted, White Nationalist, anti-American agenda. That such a misguided and prejudiced individual is actually the holder of high public office, which he regularly misuses to deliver messages of hate, intolerance, and ignorance of the law, is beyond appalling.

AS WHITE SUPREMACISTS GATHER TO DISRUPT NATION’S CAPITAL, SESSIONS SUCKS UP TO NOTORIOUS HOMOPHOBIC HATE GROUP – Blames SPLC For Outing His Misconduct & Group’s Agenda Of Hate & Intolerance, Cloaked In Bogus Christianity!

A week after announcing a mysterious new “religious liberty task force,” Attorney General Jeff Sessions once again addressed the Alliance Defending Freedom (ADF) on Wednesday. He assured them that he does not believe they are a hate group for constantly advocating for discrimination against LGBTQ people, and then claimed that his Department of Justice does not “partner with any groups that discriminate.”

Sessions previously spoke to ADF last June, and his at-the-time secret address caused quite a backlash as many in the media pointed out that the Southern Poverty Law Center (SPLC) has identified ADF as an anti-LGBTQ hate group. His remarks were later made public, and ADF took a conservative media tour to claim that they were a victim of this false accusation.

This time, Sessions addressed the controversy head on. After mentioning “the ordeal faced bravely by Jack Phillips,” the baker ADF represented in Supreme Court who blatantly discriminated against a same-sex couple, Sessions told the group that people of faith are facing “a bigoted ideology which is founded on animus towards people of faith.”

“You’ll notice that they don’t rely on the facts,” he said. “They don’t make better arguments. They don’t propose higher ideals. No, they just call people names—like ‘hate group.’”

Sessions claimed that groups like the SPLC wield the “hate group” designation to “bully and intimidate” conservative groups “that refuse to accept their orthodoxy and choose instead to speak their conscience.” He noted, for example, that the label led Amazon to disqualify ADF from its Smile fundraising program.

“You and I may not agree on everything — but I wanted to come back here tonight partly because I wanted to say this: you are not a hate group,” he said.

Contrary to Sessions’ claims, there are ample facts to substantiate ADF’s designation as an anti-LGBTQ hate group — so much so that it’s pure gaslighting to say otherwise. The group has defended wedding vendors challenging nondiscrimination laws, parents and schools that want to reject transgender students, and businesses that want the right to refuse to even employ LGBTQ people. They have even repeatedly advocated for the criminalization of homosexuality. Media Matters recently published a massive report cataloging the litany of ways ADF has demonized LGBTQ people and lobbied against their basic civil rights.

Sessions had made similar remarks about hate group designations at last week’s religious liberty summit, and the SPLC responded. In a letter to Sessions, SPLC President Richard Cohen highlighted some of the facts that led to hate group designations for groups like ADF and the Family Research Council (FRC). “Linking the LGBT community to pedophilia as the FRC and the ADF have done is not an expression of a religious belief,” he wrote. “It is simply a dangerous and ugly falsehood. As you know, FBI hate crime data show that the LGBT community is the minority group most likely targeted for violent hate crimes.”

“If the ADF had its way, gay people would be back in the closet for fear of going to jail,” Cohen wrote. “It’s inappropriate for the nation’s top law enforcement officer to lend the prestige of his office to this group. And it’s ironic to suggest that the rights of ADF sympathizers are under attack when the ADF is doing everything in its power to deny the equal protection of the laws to the LGBT community.”

Sessions may also have been trying to protect his own reputation. In the same speech to ADF, he also insisted that the DOJ “will not partner with hate groups. Not on my watch.”

But of course the DOJ partners constantly with ADF. The Trump administration has backed ADF’s position in multiple cases, ADF’s representatives were front and center at last week’s religious liberty summit (including former ADF staff who now work for the DOJ), and Sessions even consulted with ADF when drafting the “religious freedom” guidance that the new task force will enforce. It’s just that Sessions himself has long advocated against LGBTQ equality, so he doesn’t think there’s anything wrong or hateful when it comes to taking such positions.

Anti-LGBTQ conservatives were quite flattered to have the U.S. attorney general’s support. The Heritage Foundation and The Federalist, as examples, were quick to praise Sessions’ remarks and join the pile-on to smear the SPLC. Rather than respond to the detailed critiques the SPLC provides about their prejudiced positions, anti-LGBTQ hate groups have instead campaigned to besmirch the historic civil rights organization’s reputation.

With Sessions constantly catering to these groups, they have only been more emboldened to express their discriminatory beliefs — further confirming the legitimacy of the SPLC’s designation.
***************************************
Yeah, pretty much says it all about our totally unqualified AG. Pumping up hate groups on the eve of a White Supremacist rally. Just what the country needs from its chief law officer! But, I suppose what you’d expect from a unrepenitent child abuser. Senator Elizabeth Warren tried to tell America who Jeff Sessions really is. But she was silenced and smeared by Mitch McConnell and the GOP, just like the SPLC is being smeared by Sessions.
I actually do have some “higher ideals” to propose — stop misusing the loving, inclusive, foregiving teachings of Jesus Christ in support of hate campaigns against the LGBTQ community; tolerate and respect all people as they are; stop discriminating against LGBTQ individuals; let transgender kids use the bathroom; stop trying to criminalize consenting sexual relations between adults; stop defending business people who bring their religion into the public marketplace by refusing to supply goods and services to members of the LGBTQ community based on so-called “religious beliefs.” Fundamentally, it’s no different than a lunch counter owner claiming that his “religion” forbade him to serve African Americans or Jews.
This story is “Classic Gonzo.”  Confronted with facts — ADF  is a hate group — and the law —  ethics considerations forbid the AG from speaking to hate groups, Sessions lies — says ADF isn’t a hate group — implicitly blames the victims — the LGBTQ community,— and smears their defenders — the SPLC — who happened to be on the side of truth. He also, as he no doubt intended, sent a strong message to all hate groups in America, from White Supremacists on down — Don’t worry, I’ve got your back! As if there were ever any doubt!
Fortunately, Sessions and his disingenuous cohorts won’t be able to evade the judgment of history. That’s why it’s important to keep making the record about who he really is and what he really believes in. And, I can guarantee you it’s not the U.S. Constitution, the rule of law, human decency, or American democracy!

AGENDA OF HATE AND INTOLERANCE: USDOE SCOFFS AT LAW, MOVES TO TRASH THE RIGHTS OF TRANSGENDER STUDENTS WHO WANT TO USE THE BATHROOM!

https://www.buzzfeed.com/dominicholden/edu-dept-trans-student-bathrooms?utm_term=.mlEGELBLKo#.mlEGELBLKo

Dominic Holden reports for Buzzfeed News:

“The Education Department has told BuzzFeed News it won’t investigate or take action on any complaints filed by transgender students who are banned from restrooms that match their gender identity, charting new ground in the Trump administration’s year-long broadside against LGBT rights.

It’s the first time officials have asserted this position publicly as an interpretation of law. No formal announcement has been made.

For nearly a year, the Trump administration took a less clear stance, with officials saying they were studying the issue. When the Education Department and Justice Department withdrew Obama-era guidance on transgender restroom access in February 2017, Trump’s officials said in a memo and court filings that they would “consider the legal issues involved.” Then last June, the Education Department issued another memo saying it was “permissible” for its civil rights division to dismiss a trans student’s restroom case. However, in those statements, officials never cemented their intent to reject all restroom complaints issued by trans students.

For the past three weeks, BuzzFeed News called and emailed Education Department officials attempting to pinpoint the agency’s position.

Finally on Thursday, Liz Hill, a spokesperson for the agency, responded “yes, that’s what the law says” when asked again if the Education Department holds a current position that restroom complaints from transgender students are not covered by a 1972 federal civil rights law called Title IX.

Asked for further explanation on the department’s position, Hill said Friday, “Title IX prohibits discrimination on the basis of sex, not gender identity.”

She added that certain types of transgender complaints may be investigated — but not bathroom complaints.

“Where students, including transgender students, are penalized or harassed for failing to conform to sex-based stereotypes, that is sex discrimination prohibited by Title IX,” Hill said. “In the case of bathrooms, however, long-standing regulations provide that separating facilities on the basis of sex is not a form of discrimination prohibited by Title IX.”

The bathroom rule is the Trump administration’s latest step to rescind and undermine LGBT protections. Attorney General Jeff Sessions withdrew a policy protecting transgender workers, while he took the unusual step of jumping into a private lawsuit arguing that anti-gay discrimination was permissible in employment under federal law. Sessions has also argued religious business owners can refuse service to gay customers, even when anti-gay discrimination is banned by state law, and Trump has attempted to ban transgender people from all military service.”

Homophobia, hate, White Nationalism, scoffing at the rule of law: that’s Jeff “Gonzo Apocalypto” Sessions and the rest of the alt-rightists (like DeVoss) who now represent the GOP. No wonder that these evil clowns were neck and neck in the balloting for the Worst Cabinet Member. Indeed, Gonzo is neck and neck with “John the Con” Mitchell for the worst AG of the “modern era.” And Gonzo hasn’t even been indicted (yet).

I just hope that decent folks will remember who’s pushing this agenda of hate and intolerance.

SLATE: AYATOLLAH ROY MOORE HAS ALWAYS BEEN A BIGOTED, LAWLESS, ANTI-AMERICAN SCUMBAG — What Does That Say About The Alabama GOP!

http://www.slate.com/articles/news_and_politics/jurisprudence/2017/11/we_ve_always_known_roy_moore_is_lawless_it_s_why_alabama_republicans_voted.html

Dahlia Lithwick and James Sample write in Slate:

“We may never know for sure whether the graphic, detailed allegations of sexual abuse reported about Roy Moore are true. It seems entirely plausible, though, that the accusations of horrid and criminal assault allegedly committed decades ago by Moore against—among others—a then-14-year-old girl are correct. On Monday, a new accuser, Beverly Young Nelson, came forward with a vivid portrait of an alleged assault that took place when she was 16 years old. She accompanied her stirring testimony with a list of a number of witnesses she has told about the alleged assault over the years, a promise to testify to Congress under oath, a request that the Senate compel Moore to do the same, and a note in her high school yearbook signed “Love, Roy Moore D.A.” The statute of limitations has expired in the cases in question, but the available evidence is damning. After Nelson’s press conference, a Republican Senate leader went so far as to say that the Senate should expel Moore should he refuse to drop out of his Senate race and should the good people of Alabama choose to elect him.

Moore’s disregard for norms that date back to Marbury v. Madison was never considered disqualifying for the Alabama Republican Party.
The fact that there are Moore supporters lining up to alternatively paint these women as cunning partisan liars or to explain away criminal conduct as biblical and benign is indeed one of the most stunning turns in this story. That many Alabama voters have actually redoubled their support as a result of the accusations beggars belief. But the idea that it might be the alleged molesting of multiple teenage girls and women that could prove disqualifying for Moore, rather than his decadeslong contempt for the law, the courts, and the Constitution, tells us how very far we have strayed from our legal moorings at this moment in history.

Roy Moore has long been the Joe Arpaio of the state judicial branch. He is revered not for his compliance with the rule of law, but for his long-standing performance of figurative—and literal—contempt for any legal ruling or norm with which he disagrees. Like Arpaio, he has been repeatedly disciplined for acts of contempt towards the courts over the years. And yet this behavior was rewarded with a Republican nomination for a Senate seat that has been a virtual lock for the party.

Brazen, unapologetic contempt for the rule of law is not often a trait associated with judges, much less justices. Yet, this has long been Moore’s calling card and a rallying cry for his loyal supporters. Moore’s patent defiance of the most fundamental tenets of American law should have disqualified him from public office years ago. The opposite has happened: He has been unerringly rewarded for it. We are talking about Moore’s alleged abuse because it represents depraved criminality. But his open lawlessness has been on display for decades.

Moore’s disregard for norms that date back to Marbury v. Madison was never considered disqualifying for the Alabama Republican Party, nor for the national GOP. National figures—like Senate Majority Leader Mitch McConnell, who on Monday called for Moore to drop out of the race—only broke with him over the sex crime allegations. Indeed, much like Arpaio, a pattern of disregard of the courts represents Moore’s singular previous qualification for Republicans.”

TRUMP’S TRANSGENDER TROOP BAN LATEST BIAS-BASED POLICY TO BE WHACKED BY US JUDGE!

https://www.huffingtonpost.com/entry/trump-transgender-military-ban-blocked_us_59f7572ce4b0aec146792e00?ncid=inblnkushpmg00000009

HuffPost reports:

“Trump’s reasons for the controversial ban “do not appear to be supported by any facts,” the judge found.

A federal judge blocked enforcement of President Donald Trump’s ban on transgender men and women serving in the U.S. armed forces on Monday.

“I am directing the Secretary of Defense, and the Secretary of Homeland Security with respect to the U.S. Coast Guard, to return to the longstanding policy and practice on military service by transgender individuals that was in place prior to June 2016,” United Stated District Judge Colleen Kollar-Kotelly wrote in her order.

Trump’s memorandum on the ban, which he released in August after first announcing the policy change in a series of tweets in July, has faced legal challenges from current and aspiring transgender service members who “fear that the directives of the Presidential Memorandum will have devastating impacts on their careers and their families,” Kollar-Kotelly wrote.

The reasons the Trump administration gave for enacting the ban, she continued, “do not appear to be supported by any facts.” While Trump defended the policy change as a cost-saving measure, analyses of the military budget found that spending on health care for transgender service members would be miniscule.

This is a developing story. Please check back for updates.”

DAVID LEONHARDT IN THE NY TIMES: THE PARTY OF BIGOTRY, INTOLERANCE, ANTI-AMERICANISM, & “AYATOLLAH ROY” FINDS ITS GROOVE!

Here’s a link to the “Complete Leonhardt” for today, from which the following is excerpted:
https://www.nytimes.com/newsletters/2017/10/25/opinion-today?nlid=79213886

“This morning’s headlines are about Jeff Flake, but I find myself thinking about Roy Moore. Right now, it seems that the Republican Party has room for Moore but not Flake.

Flake, of course, is the Republican senator and Trump critic who announced yesterday that he wouldn’t run for re-election, because he thought that winning would require giving in to Trumpism. “It is time for our complicity and our accommodation of the unacceptable to end,” he said on the Senate floor.

Moore is the former judge who recently won the Republican nomination for a Senate seat in Alabama. He is also a demagogue who has called homosexuality “evil” and “so heinous” and who engaged in a discussion, on video, about whether it should be “punished by death.”

After Flake’s speech, his Senate colleagues applauded and honored him. But applause is easy. The more important question is: What are those same senators doing about Moore — a man who, unlike President Trump, can still be prevented from taking high office?

They are endorsing him, that’s what.

Mike Lee of Utah has praised Moore’s “tested reputation of integrity.” Rand Paul of Kentucky has lauded Moore for “defending and standing up for the Constitution.” Ted Cruz, just a couple of hours before Flake’s speech, released a full-throated endorsement of Moore that celebrated his “lifelong passion for the Constitution and the Bill of Rights.”

Yes, you heard that correctly: They are praising the integrity and Constitutional commitment of a man who refused to take a stand against whether gay and lesbian Americans should be executed.

Moore was also removed from the Alabama Supreme Court for violating judicial ethics. He has said that Muslims should not be allowed in Congress and suggested that 9/11 was the result of this country’s godlessness. (If you want to read the full comments yourself, you can do so via CNNTime and The Hill.)

So far, only one Republican senator has spoken out against Moore, according to Politico. His name is Jeff Flake. “When we disagree with something so fundamental,” he said last month, “we ought to stand up and say, ‘That’s not right, that’s not our party, that is not us.’”

I leave you with a longer excerpt from Flake’s prepared remarks yesterday than you’re likely to find in most news stories:

“Acting on conscience and principle is the manner in which we express our moral selves, and as such, loyalty to conscience and principle should supersede loyalty to any man or party. We can all be forgiven for failing in that measure from time to time. I certainly put myself at the top of the list of those who fall short in that regard. I am holier-than-none.

“But too often, we rush not to salvage principle but to forgive and excuse our failures so that we might accommodate them and go right on failing — until the accommodation itself becomes our principle.

“In that way and over time, we can justify almost any behavior and sacrifice almost any principle. I’m afraid that this is where we now find ourselves.”

Marci A. Hamilton writes in Newsweek:

“I never expected to speak the phrase: “As Mississippi goes, so goes the federal government.” But when it comes to demeaning and disempowering LGBT, it is now apropos.

The self-righteous drive to make others suffer for not living Evangelical beliefs appears to be unstoppable with Trump in power and with Sessions as his henchman for civil rights. They are taking their cues from the Deep South and particularly Mississippi.

Mississippi is the national leader on religiously-motivated discrimination against LGBT and generating divisiveness on these issues, as I discussed here.

Mississippi continues to aspire to fomenting the most discrimination against LGBT with HB 1523, which explicitly permits business owners to refuse service to LGBT for religious reasons. The trial court correctly held that it was unconstitutional and issued a preliminary injunction.

In June, the Fifth Circuit let the law go into effect, holding that the challengers lacked standing. On further review, the Fifth Circuit refused to vacate the ruling, which let the law stand. Now perhaps it goes to the Supreme Court.

Its sponsors put it into place so that Evangelicals can legally exclude LGBT from the marketplace. They say it’s about their “religious liberty,” by which they mean not the right to observe their own practices, but rather their supposed right to judge and condemn others before doing business with them.

The whole anti-LGBT project is so unbelievably hypocritical: they aren’t fighting to bar liars, adulterers, rapists, or pedophiles from their businesses, all of whom who violate plain biblical commands.

GettyImages-646266774Attorney General Jeff Sessions at the Department of Justice on February 28, 2017 in Washington, D.C. ZACH GIBSON/GETTY

What they are engineering is lives without having to associate with “those people.” One can only hope that good, old-fashioned profit motives enrich those businesses that provide service to LGBT and put out of business those who prefer the Jim Crow life.

Trump Administration Follows Mississippi’s Lead

Now, Attorney General Jeff Sessions has piled onto this administration’s obsession with humiliating and harming transgender Americans here and here with a new document interpreting federal law to require accommodation of those in the government who believe LGBT are sinful.

That’s right, the drive is to accommodate the ones who cannot tolerate those who aren’t like them. This is all about deconstructing the LGBT civil rights the Obama administration put into place as discussed here and here.

For good measure, the administration is also rolling back protections intended to ensure LGBT are not discriminated against in long-term care facilities. (The administration also went after women’s rights to contraception as fellow columnist Joanna Grossman explains, again an issue where it is in lock step with Evangelical lobbyists.)

Where Did This Intolerance Come From?

The push to inflict exclusion and suffering on LGBT for religious reasons owes its origins to the working out of the Religious Freedom Restoration Act in American culture. Whether you have read Hegel or Calvin, this is what happens when you put into place a “right” that has no natural limit.

The religious lobbyists, including knowing conservatives and some truly naïve liberals, backed this benighted law in 1993. It was declared unconstitutional in 1997 in Boerne v. Flores, because it was so far removed from anything that the First Amendment had ever required .

What was unleashed with this federal statute, which morphed into state laws and later federal law, was a theory that the default position for religious liberty should be that a religious believer has a right to overcome any law that burdens religiously-motivated conduct.

Many laws exist to protect the vulnerable. When religious believers seize a “right” to trump the law, they in effect hurt the vulnerable. That is true here.

This power grab—particularly by religious organizations who believe in imprinting their beliefs on the culture—paved the way for the depraved arguments now being made for “religious liberty” that amount to exclusion and harm to an entire category of citizens defined solely by their sexual orientation. They have falsely claimed the mantle of victimhood while making victims of others.

The powerful choose the labels and the vulnerable suffer. If you have not seen this power maneuver elsewhere in history or in the Trump Administration’s dealings with race, you are not paying attention.

While the Evangelical right wages a bogus war against the non-existent “Sharia law in America,” the real threat to our freedoms, our Constitution, and the rule of law is posed by these very same right wingers. Led by folks like Gonzo who have moved from the “wacko fringe” to positions of power, they are forcing their false interpretation of Christianity down the throats of the rest of us who don’t share their “Gospel of Hate & Intolerance.”

From a theological standpoint (after all, it is Sunday), Jesus’s ministry was not to the rich, powerful, rulers, or Pharisees enforcing the Jewish Law; no, Jesus’s ministry was one of love, compassion, forgiveness, and eternal hope  for the outsiders, the outcasts, the poor, and the “rejected” of Jewish and Roman society. If Jesus were among us today, he would much more likely be found “rubbing shoulders” and preaching to the gay community or the undocumented than he would wandering the halls of Jeff Sessions’s Department of (In)Justice.

LEGACY OF HATE – TRUMP’S APPOINTMENT OF HOMOPHOBIC JUDGES LIKELY TO TORMENT LGBTQ AMERICANS FOR DECADES TO COME! — Elections Have Consequences!

http://www.huffingtonpost.com/entry/trump-judicial-nominee-abortion-rights_us_59d67a63e4b046f5ad96e117?feh

Jennifer Bendery reports for Huff Post:

WASHINGTON ― Thursday was a good day for Amy Coney Barrett. A Senate committee voted to advance her nomination to be a federal judge.

It wasn’t a pretty vote. Every Democrat on the Judiciary Committee opposed her nomination. They scrutinized her past writings on abortion, which include her questioning the precedent of Roe v. Wade and condemning the birth control benefit under the Affordable Care Act as “a grave infringement on religious liberty.” One Democrat, Al Franken (Minn.), called her out for taking a speaking fee from the Alliance Defending Freedom, a nonprofit that’s defended forced sterilization for transgender people and has been dubbed a hate group by the Southern Poverty Law Center.

But Republicans don’t need Democrats’ votes, and now Barrett, a 45-year-old law professor at the University of Notre Dame, is all but certain to be confirmed to a lifetime post on the U.S. Court of Appeals for the 6th Circuit — a court one level below the Supreme Court.

Barrett is the model judicial candidate for this White House: young, conservative, and opposed to abortion and LGBTQ rights. For all the stories about President Donald Trump using his executive power to roll back civil rights protections — in the past day, his administration axed the ACA birth control benefit and ended workplace protections for transgender people — it is here, on the courts, where his team is working most aggressively to reshape the country.

“Trump’s speed in nominating judges has been perhaps the most successful aspect of his presidency,” said Carl Tobias, a law professor at the University of Richmond who specializes in judicial nominations. “Trump has easily surpassed Obama, Bush and Clinton at this point in the first year of their presidencies in terms of the sheer number nominated.”

He has. Ten months in, Trump has nominated 17 circuit court judges and 39 district court judges. That’s far more than former President Barack Obama’s seven circuit court nominees and four district court nominees by this point in his first year of office. Former President George W. Bush had nominated 11 circuit judges and 31 district judges by this point.

He’s also got more court seats to fill. He inherited a whopping 108 court vacancies when he became president ― double the number of vacancies Obama inherited when he took office. That’s largely due to Republicans’ years-long strategy of denying votes to Obama’s court picks to keep those seats empty for a future GOP president to fill. It worked.

If Trump’s current judicial nominees are a preview of the kinds of judges he plans to nominate in the coming years, prepare for a significantly more socially conservative group of people shaping the nation’s laws.

Consider John Bush. The Senate confirmed him in July, on a party-line vote, to a lifetime post on the U.S. Court of Appeals for the 6th Circuit. Bush, 52, has compared abortion to slavery and referred to them as “the two greatest tragedies in our country.” He has also said he strongly disagrees with same-sex marriage, mocked climate change and proclaimed “the witch is dead” when he thought the Affordable Care Act might not be enacted.

The Senate also confirmed Kevin Newsom, 44, to the U.S. Court of Appeals for the 11th Circuit in August. He wrote a 2000 law review article equating the rationale of Roe v. Wade to Dred Scott v. Sandford, the 1857 decision upholding slavery. He also argued in a 2005 article for the Federalist Society, a right-wing legal organization, that Title IX does not protect people who face retaliation for reporting gender discrimination. The Supreme Court later rejected that position.

Ralph Erickson, 58, was confirmed to the U.S. Court of Appeals for the 8th Circuit in September. As a district judge in 2016, he was one of two judges in the country who ordered the federal government not to enforce health care nondiscrimination protections for transgender people.

CSPAN
Here’s U.S. circuit court judge John Bush testifying in his Senate confirmation hearing in June. He thinks abortion is like slavery, and they are “the two greatest tragedies in our country.”

These are just judges that have been confirmed. Nominees in the queue include Leonard Grasz, Trump’s pick for a seat on the U.S. Court of Appeals for the 8th Circuit. Grasz, 56, proposed amending the Omaha City Charter in 2013 to let employers discriminate against LGBTQ people. He has also compared the “personhood” of fetuses to the civil rights of Native Americans and African-Americans, according to an exhaustive report issued by the Alliance for Justice, a left-leaning advocacy group that focuses on the federal judiciary.

Trump’s effort to shift the federal bench to the right isn’t just aimed at district and circuit courts. He nominated Damien Schiff, a 37-year-old attorney, to a 15-year gig on the U.S. Court of Federal Claims. Schiff has criticized efforts to prevent bullying of LGBTQ students, referring to messages of equality as “teaching ‘gayness’ in schools.” He also argued that states should be allowed to criminalize “consensual sodomy.”

Part of the reason the White House has been able to nominate so many judges, so quickly, is because it’s been focused on filling court vacancies in states represented by two Republican senators. It’s easier for Trump’s team to work with Republicans in picking nominees, and then in moving them forward in committee, where it takes both home-state senators turning in a “blue slip” to get the hearing process going.

Trump has been less successful in confirming nominees, though. That’s partly because in the mad rush to fill courts seats, the White House isn’t reviewing nominees’ records as thoroughly as, say, the Obama administration did. That means more controversial nominees and more scrutiny. Democrats aren’t exactly eager to cooperate, either, given the way Republicans treated Obama’s judicial nominees (remember Merrick Garland?).

But as Trump plows through judicial nominations that will be a part of his legacy for decades, the only thing Democrats can do while they’re in the minority, for the most part, is make noise.

If they want real change, says Tobias, “Democrats need to win elections.”

*****************************************

Homophobe Jeff Sessions’s time as Attorney General won’t extend beyond the Trump Administration, if that long. However, the damage he has done to the U.S. legal system, our Constitution, the Department of Justice, and LGBTQ Americans won’t be easily repaired, if ever.

But, life tenured Federal Judges are an even bigger problem. These “robed bigots” will be inflicting cruel, discriminatory, and degrading treatment on the U.S. LGBTQ Community from their benches for decades to come.

In the end, Professor Tobias is entirely correct:“Democrats need to win elections.” Otherwise, our LGBT family, colleagues, friends, and neighbors are going to continue to be targets for homophobic Federal Judges and GOP politicos for many decades.

GONZO’S WORLD: HOMOPHOBIC AG ATTACKS LGBTQ COMMUNITY WITH BOGUS LEGAL MEMO STRIPPING TRANSGENDER INDIVIDUALS OF CIVIL RIGHTS PROTECTIONS!

https://www.buzzfeed.com/dominicholden/jeff-sessions-just-reversed-a-policy-that-protects

Dominic Holden reports for BuzzFeed News:

“US Attorney General Jeff Sessions has reversed a federal government policy that said transgender workers were protected from discrimination under a 1964 civil rights law, according to a memo on Wednesday sent to agency heads and US attorneys.

Sessions’ directive, obtained by BuzzFeed News, says, “Title VII’s prohibition on sex discrimination encompasses discrimination between men and women but does not encompass discrimination based on gender identity per se, including transgender status.”

It adds that the government will take this position in pending and future matters, which could have far-reaching implications across the federal government and may result in the Justice Department fighting against transgender workers in court.

“Although federal law, including Title VII, provides various protections to transgender individuals, Title VII does not prohibit discrimination based on gender identity per se,” Sessions writes. “This is a conclusion of law, not policy. As a law enforcement agency, the Department of Justice must interpret Title VII as written by Congress.”

But Sharon McGowan, a former lawyer in the Justice Department’s Civil Rights Division and now an attorney for the LGBT group Lambda Legal, countered that Sessions’ is ignoring a widespread trend in federal courts.

“It’s ironic for them to say this is law, and not policy,” McGowan told BuzzFeed News. “The memo is devoid of discussion of the way case law has been developing in this area for the last few years. It demonstrates that this memo is not actually a reflection of the law as it is — it’s a reflection of what the DOJ wishes the law were.”

“The sessions DOJ is trying to roll back the clock and pretend that the progress of the last decade hasnt’ happened,” she added. “The Justice Department is actually getting back in the business of making anti-transgender law in court.”

“The Justice Department is actually getting back in the business of making anti-transgender law in court.”
The memo reflects the Justice Department’s aggression toward LGBT rights under President Trump and Sessions, who reversed an Obama-era policy that protects transgender students after a few weeks in office. Last month, Sessions filed a brief at the Supreme Court in favor of a Christian baker who refused a wedding cake to a gay couple. And last week, the department argued in court that Title VII doesn’t protect a gay worker from discrimination, showing that Sessions will take his view on Title VII into private employment disputes.

At issue in the latest policy is how broadly the government interprets Title VII of the Civil Rights Act of 1964, which does not address LGBT rights directly. Rather, it prohibits discrimination on the basis of sex.

But the Equal Employment Opportunity Commission, an independent agency that enforces civil rights law in the workplace, and a growing body of federal court decisions have found sex discrimination does include discrimination on the basis of gender identity and sex stereotyping — and that Title VII therefore bans anti-transgender discrimination as well.

Embracing that trend, former attorney general Eric Holder under President Obama announced the Justice Department would take that position as well, issuing a memo in 2014 that said, “I have determined that the best reading of Title VII’s prohibition of sex discrimination is that it encompasses discrimination based on gender identity, including transgender status. The most straightforward reading of Title VII is that discrimination ‘because of … sex’ includes discrimination because an employee’s gender identification is as a member of a particular sex, or because the employee is transitioning, or has transitioned, to another sex.”

But Sessions said in his latest policy that he “withdraws the December 15, 2014, memorandum,” and adds his narrower view that the law only covers discrimination between “men and women.”

“The Department of Justice will take that position in all pending and future matters (except where controlling lower-court precedent dictates otherwise, in which event the issue should be preserved for potential future review),” Sessions writes.

Sessions adds: “The Justice Department must and will continue to affirm the dignity of all people, including transgender individuals. Nothing in this memorandum should be construed to condone mistreatment on the basis of gender identity, or to express a policy view on whether Congress should amend Title VII to provide different or additional protections.”

Devin O’Malley, a spokesperson for the Justice Department, explained the decision to issue the memo, telling BuzzFeed News, “The Department of Justice cannot expand the law beyond what Congress has provided. Unfortunately, the last administration abandoned that fundamental principle, which necessitated today’s action. This Department remains committed to protecting the civil and constitutional rights of all individuals, and will continue to enforce the numerous laws that Congress has enacted that prohibit discrimination on the basis of sexual orientation.”

McGowan, from Lambda Legal, counters, “The memo is so weak that analysis is so thin, that it will courts will recognize it for what it is — a raw political document and not sound legal analysis that should be given any weight by them.”

Virulent homophobia has always been a key element of the “Gonzo Apocalypto Agenda.” Check out this report from Mark Joseph Stern at Slate about how when serving as Alabama’s Attorney General Gonzo attempted to use an Alabama statute that had been ruled unconstitutional by a Federal Judge to both publicly demean LGBTQ students and stomp on their First Amendment rights. (So much for the disingenuous BS speech that Gonzo delivered on Free Speech at Georgetown Law last week.)  Here’s what happened:

“Attorney General Jeff Sessions delivered a speech at Georgetown University Law Center in which he argued that “freedom of thought and speech on the American campus are under attack.” As my colleague Dahlia Lithwick explained, the attorney general said this in “a room full of prescreened students who asked him prescreened questions while political demonstrators outside were penned off in ‘free speech zones.’ ” Ensconced in a safe space of his own, Sessions blasted the notion that speech can be “hurtful,” criticizing administrators and students for their “crackdown” on “speech they may have disagreed with.”

Mark Joseph Stern
MARK JOSEPH STERN
Mark Joseph Stern is a writer for Slate. He covers the law and LGBTQ issues.

Sessions’ hypocrisy on speech issues is not a new development. In 1996, the then–attorney general of Alabama used the full power of his office to try to shut down an LGBTQ conference at the University of Alabama. Sessions took his battle to court, asking a federal judge to let him block the conference altogether—or, at the very least, silence students who wished to discuss LGBTQ issues. He ultimately failed, but his campaign reveals a great deal about his highly selective view of free expression. Sessions claims to support freedom for “offensive” speech, but when speech offends him, he is all too happy to play the censor.

When Sessions served as Alabama attorney general, the state still criminalized sodomy. A 1992 law, Alabama Education Code Section 16-1-28, also barred public universities from funding, recognizing, or supporting any group “that fosters or promotes a lifestyle or actions prohibited by” the sodomy statute, either “directly or indirectly.” The law also forbade schools from allowing such organizations to use public facilities. Sessions’ predecessor, Jimmy Evans, had interpreted the statute to effectively outlaw the discussion or promotion of gay rights on public campuses, with that prohibition even extending to AIDS awareness campaigns.

In 1995, the University of South Alabama’s Gay Lesbian Bisexual Alliance sued in federal court to block Section 16-1-28. That summer, the U.S. Supreme Court had ruled that, under the First Amendment, public universities may not deny access to facilities or funding for student organizations on the basis of their viewpoints. This decision, the GLBA asserted, rendered Section 16-1-28 unconstitutional. U.S. District Judge Myron H. Thompson agreed, holding the law to be invalid in a January 1996 ruling.

This decision was excellent news for the Gay Lesbian Bisexual Alliance at the University of Alabama at Tuscaloosa. The GLBA had planned to host the Fifth Annual Lesbian, Gay, and Bisexual College Conference of the Southeastern United States in February 1996. Sessions, by now attorney general, was trying his hardest to shut it down.

“University officials say they’re going to try to obey the law,” Sessions said at the time, as CNN’s Andrew Kaczynski reported in December of last year. “I don’t see how it can be done without canceling this conference. I remain hopeful that if the administration does not act, the board of trustees will.” Sessions didn’t give up even after Judge Thompson struck down the law. “I intend to do everything I can to stop that conference,” he said.

In a last-ditch effort, Sessions returned to Thompson’s court and asked permission to ban the conference. “The State of Alabama,” he explained in court filings, “will experience irreparable harm by funding a conference and activities in violation of state law.” Failing a total ban, Sessions implored Thompson to let him censor any discussion of “safe sex and the prevention of sexually transmitted diseases.” Sessions claimed that, by talking about LGBTQ issues, conference attendees were essentially conspiring to promote criminal activity, and Alabama should not be obligated to support their criminality. Predictably, Thompson rejected Sessions’ arguments, writing that the attorney general was endeavoring to violate students’ free speech rights. Sessions then appealed to the 11th U.S. Circuit Court of Appeals, which unanimously ruled against Alabama. The conference went on as planned.

Cathy Lopez Wessell, a lead organizer and spokeswoman for the conference, told me Sessions’ intervention “was incredibly stressful. We got threatening phone calls. We were attacked from all sides.” She continued, “We were the abomination of the month. I didn’t feel safe in the world for a while. I started to internalize some of the judgment leveled at our group. I thought, there must be something deeply wrong with you if you need to be silenced.”

Lopez Wessell explained that Sessions’ campaign against the conference registered as a broader attack on LGBTQ students.

“If we can’t talk, do we have a right to exist?” Lopez Wessell asked. “If our speech is so dangerous that it needs to be stopped, then are we dangerous? We weren’t promoting any particular activity; we just wanted to talk—about our experiences, about our existence.”

Denying the humanity as well as the human rights of those he is biased against is a staple of the Gonzo Apocalypto agenda. Just look at his constant attempts to tie all members of the Hispanic ethnic community to crime, drugs, and gangs (even though all credible studies show that immigrants or all types have markedly lower crime rates than native-born U.S. citizens) and his false and gratuitous attempts to tie “Dreamers” to crime, terrorism, and loss of jobs!

There is no more certain way of knowing that a DOJ “legal” memo is all policy and no law than the statement: “This is a conclusion of law, not policy.“ In other words, “Don’t you dare accuse me of doing what I’m actually doing!”

Since assuming the office of Attorney General for which he is so spectacularly unqualified, here’s a list of the folks whose rights or humanity Sessions has attacked or disparaged:

Hispanics

African Americans

LGBTQ Individuals

Dreamers

Immigrants

Refugees

Asylum Seekers

Poor People

Undocumented Migrants

Women

Muslims

Civil Rights Protesters

Black Athletes

City Officials Seeking To Foster Community Law Enforcement

Prisoners

Immigration Detainees

Forensic Scientists

State Governors Who Disagree With Him

Federal Judges Who Find Trump Policies Illegal

State & Federal Judges Who Object To Migrants Being Arrested At Their Courts

Convicts

Liberal Students & College Administrators

Anti-Facists

Anti-Hate-Group Activists

Reporters

Unaccompanied Migrant Children

President Obama

Whistleblowers (a/k/a “Leakers” in “Gonzopeak”)

DOJ Career Attorneys

I’m sure I’ve left a few out.  Feel free to send me additions. The list just keeps getting longer all the time.

The only group that appears to be “A-OK” with Gonzo is “White straight Christian male Republican ultra rightists.”

GONZO’S WORLD: “Eggshell” Attorney General Is A Parody Of The First Amendment!

http://www.slate.com/articles/news_and_politics/jurisprudence/2017/09/jeff_sessions_wants_a_first_amendment_that_celebrates_robust_criticism_of.html

Dahlia Lithwick writes at Slate:

“Having seen the Sessions DOJ prosecute someone for laughing at Jeff Sessions, it’s hardly surprising that he wants a First Amendment that celebrates the robust criticism of everyone but himself. Watching Sessions’ DOJ going after private Facebook information for anti-Trump activists, it’s hardly surprising that these much-vaunted free speech protections flow in the direction of Trump officials and away from Trump dissenters. It is, nevertheless, somewhat more surprising to see that the burgeoning theory that conservatives deserve free speech protections, and liberals deserve none, is becoming yet another normalized part of this abnormal administration. After all, if you cannot even see anyone from the opposing side, you certainly have no reason to hear their voices. And what was most striking about Sessions’ rousing performance at Georgetown is that he didn’t seem to even notice or concede that an opposing side exists. This has very real practical effects for his DOJ and for our rule of law.

Read, for example, the work of my friend Garrett Epps on the stunning DOJ brief filed in the Masterpiece Cakeshop v. Colorado Civil Rights Commission “religious baker” case to be heard at the Supreme Court this fall. The Justice Department evinces no solicitude at all for the injuries of anyone but the Christian baker at issue, the one who seeks not to be compelled to make a wedding cake for a gay couple. Sessions’ Department of Justice, for instance, argues that Colorado hadn’t yet acknowledged the rights of marriage equality at the time of the cake incident, so the fact that such equality is now a constitutional right should not even be considered. It’s a hard case, as Epps notes. But it’s vastly easier if you simply pretend away the interests of the other side. For this DOJ, there is nobody else on the radar. Nobody else exists.

When talking about the First Amendment and the brutal and challenging clash of diverse opinions, a big part of that is the obligation to listen to ideas that might be uncomfortable or even painful to hear. But that relationship presupposes that we can see or acknowledge that there are speakers on the other side. More and more, it feels as though the Trump administration’s aperture has narrowed to the point where someone can espouse First Amendment values while viewing genuine opponents as wholly other, foreign, and not even worth giving the chance to respond. This is the framing for the NFL protests (Trump has free speech rights, the players do not) and the framing for Sessions’ speech about student speech.

There’s little doubt that Jeff Sessions meant it when he importuned the students before him to stand up for free speech and to spend their law school careers refining their own views in opposition to conflicting ideas. But it’s far from clear that he realized how absurd it was to say those things at an event that excluded faculty and students with different viewpoints. Admonishing law students to spend their time testing their pre-existing views against alternate ideas while engaging in almost daily acts of punishing and suppressing speech and expression of alternate ideas is insane. I’m not sure that the sparking, hotly contested debates between people who hate marriage equality and the people who really, really hate marriage equality is the sort of dispute Justices Jackson and Brandeis were thinking about.

And what is terrifying is the possibility that Sessions truly believes that people with different viewpoints don’t even exist anymore in any tangible application. These dissenters are all just enemies of the state. They are no more real to him than ghosts. More and more, Sessions is constructing a Justice Department in which the other side is just noise to him, not speech. And if you cannot even see protesters and political dissidents, it’s hardly a surprise that you cannot hear them either.”

I have to admit that it’s great to be retired, outside the repressively paranoid atmosphere of the DOJ (and that was before the reign of Gonzo began), and able to exercise my right to free speech again.

Sessions is enthusiastic about defending the right to promote hate speech, religious zealotry, and homophobia, all things in which he and his alt-right cronies fervently believe. But, when it comes to defending the rights of Blacks, Hispanics, immigrants, and the rest of us to protest, or in the case of Blacks and Hispanics to even exercise their voting rights, not so much.

Gonzo’s career has been built on disingenuously promoting bias, racial inequality, xenophobia, homophobia, intolerance, and white privilege in the name of a Constitution that it’s hard to believe he’s ever read much less understands or follows. Other than Trump, Bannon, or Miller, I can’t imagine anyone less qualified than Gonzo to pontificate about the First Amendment, or indeed any portion of the U.S. Constitution other than, perhaps, the Second Amendment which apparently is the only part of the Constitution they have ever heard about down in Ol’ Bammy.

“AYATOLLAH ROY” Preaches A Gospel Of Hate & Bigotry That Jesus Would Never Regognize

Michael Gerson writes in the Washington Post:

“The strongest objection to Moore’s hardness and harshness is theological. On the consistent evidence of Jesus’ ministry, what public attitude did he condemn the most? He stood against people who talked constantly of the law, who thought they were especially virtuous, who enjoyed scolding people, who judged others without tenderness and understanding. He was at constant war with the self-righteous and took the side of the social outcasts they condemned.

Now we see the return of the Pharisee.”

GONZO’S WORLD: 2D CIR AMUSED, BUT NOT RECEPTIVE TO DOJ’S “WHACKADOODLE” ADVOCACY FOR HOMOPHOBIA! — DOJ Attorneys Sacrifice Credibility & Self Respect Every Time They Stand Up To Defend Gonzo’s Hate Agenda! — They Are Becoming The “Neo Clowns”Of The Legal World🤡

http://www.slate.com/articles/news_and_politics/jurisprudence/2017/09/the_doj_s_new_anti_gay_legal_posture_just_got_shut_down_in_federal_court.html

Mark Joseph Stern reports for Slate:

“NEW YORK—The U.S. Court of Appeals for the 2nd Circuit had a burning question for Donald Trump’s Department of Justice on Tuesday: What are you doing in our courthouse? By the end of the day, the answer still wasn’t clear. Something else was, though: The DOJ’s new anti-gay legal posture is not going to be received with open arms by the federal judiciary.

The Justice Department’s latest wound was fully self-inflicted, as Tuesday’s arguments in Zarda v. Altitude Express should not have involved the DOJ in the first place. The case revolves around a question of statutory interpretation: whether Title VII of the Civil Rights Act of 1964 outlaws anti-gay workplace discrimination. Title VII bars employment discrimination “because of sex,” which many federal courts have interpreted to encompass sexual orientation discrimination. The 2nd Circuit is not yet one of them, and Chief Judge Robert Katzmann signaled recently that he would like to change that. So on Tuesday, all of the judges convened to consider joining the chorus of courts that believe Title VII already prohibits anti-gay discrimination in the workplace.

It’s important to understand some background before getting further into how those arguments went. The Equal Employment Opportunity Commission decided in 2015 that Title VII’s ban on sex discrimination does protect gay employees. Under President Barack Obama, the Justice Department took no position on this question. But in late July, Attorney General Jeff Sessions’ DOJ unexpectedly filed an amicus brief in Zarda arguing that Title VII does not protect gay people. The 2nd Circuit had not solicited its input, making the brief both puzzling and gratuitous. Its purpose only became apparent in September, when the DOJ filed a similarly uninvited brief asserting that bakers have a free speech right not to serve same-sex couples. Both anti-gay briefs were startlingly incoherent, seemingly the product of political pandering rather than legal reasoning.

Regardless, the DOJ’s decision to weigh in on Zarda ensured that oral arguments would include the weird spectacle of one federal agency opposing another in court. That doesn’t happen often—and really shouldn’t happen—because the executive branch is expected to speak with one voice on legal affairs. But the EEOC’s commissioners serve fixed terms and haven’t gotten the memo placing politics above the law yet. And so they were not exactly delighted to see political appointees at the Justice Department trash their theories in court on Tuesday when the two agencies faced off over what it means to discriminate “because of sex.”

. . . .

That set the stage for Mooppan’s appearance, which, to put it mildly, did not go well at all. Chief Judge Katzmann immediately wanted to know: Why didn’t the DOJ defer to the EEOC on Title VII, as it normally does? Mooppan’s basic reply was that the Justice Department is the nation’s “largest employer”—meaning, in short, that it has an interest in retaining its capacity to fire gay people for being gay.

“What is the process with regard to the EEOC and the DOJ in terms of filing a brief?” Katzmann followed up.

“That’s a complicated question,” Mooppan responded.

“Try to help us,” Katzmann implored. He also wanted to know what career attorneys at the DOJ’s civil rights division think about the agency’s position. But Mooppan wouldn’t answer: “That’s not appropriate for me to disclose,” he told the judge. Katzmann looked alarmed. Judge Pooler jumped in: “Does the Justice Department sign off on a brief that EEOC intends to file?” she wondered.

“That’s not appropriate for me to disclose,” Mooppan repeated.

“It’s procedure, not internal deliberations,” Pooler responded.

“I don’t think it’s appropriate,” Mooppan said again, stonewalling. Now a majority of the judges looked irritated. As a general rule, attorneys are supposed to answer questions posed by the court, not dodge them as though they’re taking the Fifth. It was a terrible start for Mooppan, and both Pooler and Katzmann looked genuinely perplexed that a DOJ attorney would show such blatant disrespect. Finally, Judge Dennis Jacobs broke the impasse: “I, for one, am prepared to proceed on the assumption that you’re here,” he said.”

Read the entire rather amazing, if disturbing, article at the link. Accounts of the daily doings of “Gonzo’s Justice” could be ripped right from the headlines of The Onion. But, sadly they aren’t. Every day that Gonzo serves in the office for which he is jaw-droppingly unaqualified diminishes the American legal system and our country as a whole.

Liz was right. She might even have understated the case against Gonzo. Happy to be retired. Pity those still at the DOJ. Move over, John Mitchell, you’ve got some real competition for “Worst Attorney General In Modern American History.” I feel like asking for a recount when Betsy De Vos allegedly edged out Gonzo for “Worst Cabinet Member!” Could it be Russian interference?
