EOIR plays a pivotal role in the administration of the Nation’s immigration system. EOIR’s mission is to adjudicate immigration cases fairly, equitably, and efficiently at the trial and appellate level, governed by due process and the rule of law. Under delegated authority from the Attorney General, EOIR conducts immigration court proceedings, appellate reviews, and other administrative hearings, applying the immigration laws while ensuring that adjudicators are impartial, that laws are applied humanely and equitably, that all parties are treated with respect and dignity, and that cases are resolved expeditiously and in accordance with the Administration’s priorities and all applicable laws and regulations.

EOIR consists of three adjudicatory components: the Office of the Chief Immigration Judge, which is responsible for managing the numerous immigration courts located throughout the United States where immigration judges adjudicate individual cases; the Board of Immigration Appeals, which primarily conducts appellate reviews of the immigration judges’ decisions; and the Office of the Chief Administrative Hearing Officer, which adjudicates immigration-related employment cases. Job Description:

Immigration Judges preside in formal, quasi-judicial hearings. Proceedings before Immigration Judges include but are not limited to removal, and bond adjudications, and involve issues of removability as well as applications for relief such as asylum, withholding of removal, protection under the Convention Against Torture, cancellation of removal, and adjustment of status.

Immigration Judges make decisions that are final, subject to appeal to the Board of Immigration Appeals. In connection with these proceedings, Immigration Judges exercise certain discretionary powers as provided by law, and are required to exercise independent judgment in reaching final decisions. Immigration Judges may be required to conduct hearings in penal institutions and other remote locations.

Qualifications:

In order to qualify for the Immigration Judge position, applicants must meet all of the following minimum qualifications:

  • Education: Applicants must possess a LL.B., J.D., or LL.M. degree. (Provide the month and year in which you obtained your degree and the name of the College or University from which it was conferred/awarded.)

AND

  • Licensure: Applicants must be an active member of the bar, duly licensed and authorized to practice law as an attorney under the laws of any state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued.)

AND

  • Experience: Applicants must have seven (7) years of post-bar admission experience as a licensed attorney preparing for, participating in, and/or appealing court or administrative agency proceedings at the federal, state or local level. Relevant experience may include that gained in civil, criminal, or military cases, as well as in any case in which a formal procedure was initiated by a government administrative body.

NOTE: Qualifying experience is calculated only after bar admission.

Successful applicants will have a strong combination of experience demonstrating that they will perform at the level of competence, impartiality, and professionalism expected of an Immigration Judge. Additional information

This is an Excepted Service position, subject to a probationary period. The initial appointment is for a period not to exceed 24 months. Conversion to a permanent position is contingent upon appointment by the Attorney General.

Alternative work schedule options are available. Immigration Judges’ tour of duty may include Saturdays and Sundays.

What The DAG SHOULD Have Said To New U.S. Immigration Judges (But, Of Course Didn’t) . . .

WELCOME: DUE PROCESS IS YOUR ONLY MISSION

Congratulations on your appointment as U.S. Immigration Judges. It’s a difficult and important judicial position under the best of circumstances. Given the many controversies surrounding immigration today your job is even more challenging.

You face an overwhelming backlog resulting from factors largely beyond your control. Rather than being consumed or demoralized by that backlog, your job is to guarantee fairness and due process in each individual case coming before you. This requires you to act independently and resist pressures, from any quarter, to “cut corners” or otherwise compromise your constitutional duty to act impartially, fairly, and professionally toward each individual appearing before you.

While you occupy an unusual position as quasi-judicial officers who are also employed by Department of Justice, the Department regulations charge you with exercising your “independent judgment and discretion and . . . [taking] any action consistent with [your] authorities under the Act and regulations that is appropriate and necessary for the disposition of such cases.”

Indeed, the United States Supreme Court in the landmark case U.S. ex rel. Accardi v. Shaughnessy, 347 U.S. 260 (1954) stated with respect to your similarly situated judicial colleagues on the Board of Immigration Appeals that each administrative judge serving under these regulations “must exercise his authority according to his own understanding and conscience. This applies with equal force to the Board and the Attorney General. In short, as long as the regulations remain operative, the Attorney General denies himself the right to sidestep the Board or dictate its decision in any manner.”

Consequently, although as a cabinet officer the Attorney General might sometimes take certain positions or advocate certain policies, you must consider only the facts, the statutes, the regulations, and any precedent decisions directly relevant to your particular case in reaching your decisions. And, you must always treat the Department of Homeland Security as a separate party, with the same respect and consideration that you will give to individuals coming before you and their attorneys. That you are all employees of the same Government should not entitle DHS to special or preferable treatment or deference not afforded to other parties coming before your courts.

The motto of the Department of Justice, basically refers to one “who prosecutes in the name of justice.” Thus, our Department stands alone in incorporating a moral principle — the requirement of doing justice — into its mission. As that great American Dr. Martin Luther King, Jr., once said “injustice anywhere is a threat to justice everywhere.”

Some of the most vulnerable individuals entitled to due process under our Constitution will come before you in your courts. Your awesome and solemn responsibility is to insure that they receive due process and fairness — in other words justice — no matter how difficult their individual circumstances might be or any handicaps under which you might be operating.

Many of those arriving in the United States today are applying for asylum under our laws. Those fleeing persecution on account of race, religion, nationality, membership in a particular social group, or political opinion are eligible for protection. In INS v.Cardoza-Fonseca, 480 U.S 421 (1987) our Supreme Court instructed us to apply the asylum standard in a generous manner. Others who face torture at the hands of, or with the “willful blindness” of, their governments, are entitled to protection without having to establish that the torture results from one of the foregoing “protected grounds.” An important part of your job will be insure that those who qualify for protection under our laws are given a full and fair chance to prepare their cases, to be represented by counsel of their choice, receive fair and reasoned decisions, and are not unfairly returned to harm in the countries they fled.

For my part, I pledge that during the time I remain with the Department of Justice I will do everything in my power to protect your quasi-judicial independence from improper influence, to allow you to manage your own dockets and develop “best practices” without bureaucratic interference,  and to secure for you the resources you need to do your critically important jobs. I trust that my successor will do likewise.

The vision of our Immigration Courts is “through teamwork and innovation become the world’s best administrative tribunals guaranteeing fairness and due process for all.” Your challenge is to do everything within your power to make that vision a reality each day you are on the bench.

Congratulations again on your selection and on choosing to serve our country in these important judicial positions at this critical juncture in our history. I thank you in advance for your future service and commitment to insuring equal justice for all. Good luck, do great things, and make due process for all your daily goal.

Someday, we will once again have an Attorney General and a DAG who truly respect Constitutional Due Process, don’t fear independent judicial decision-making, and have the courage and backbone to “just say no” to White Nationalist restricitionist agendas that conflict with our Constitution, our statutes, our international obligations, common human decency, and what were once almost universally considered “true American values.”

Until then, it will be up to the “New Due Process Army” and their allies to keep Due Process and fairness for all of us alive during what will go down as one of the darkest and most evil periods in modern American history.

We are happy to report that the Agency will be posting an advertisement very soon seeking to hire retired IJs.  We know this is something NAIJ has wanted for a long time, and we are excited about the prospects of having retired IJs back on board to assist with our critical mission.  While the specifics of the advertisement are still in flux, we expect to advertise for all 58 court locations, as well as the Falls Church VTC location.  Selectees will be hired as intermittent employees, which likely will allow for flexibilities in their schedules to account for the their personal preferences, as well as to meet varying needs of the Agency.  Selectees also will be expected to be available to travel, as necessary, to meet the mission.  Retired IJs will be hired pursuant to the Reemployment of Annuitants regulation (5 C.F.R. § 837), as well as accompanying OPM guidance,available at, https://www.chcoc.gov/content/reemployment-civilian-retirees-under-national-defense-authorization-act-fiscal-year-2010-1.  To assist NAIJ and potential applicants in understanding the impact of returning as a reemployed annuitant, the Agency has prepared the attached reference sheet.

EOIR INVESTS ELEVEN NEW U.S. IMMIGRATION JUDGES — PRIVATE SECTOR TOTALLY SHUT OUT!

Here are the bios of the new U.S. Immigration Judges:

This brings the total number of sitting U.S. Immigration Judges to 326. Congratulations to the new Judges, and please don’t forget the due process mission of the U.S. Immigration Courts!

Unfortunately, however, this continues the trend of creating a one-sided U.S. Immigration Court which basically has excluded from the 21st Century Immigration Judiciary those who gained all or most of their experience representing respondents, teaching, or writing in the public sector. It’s not particularly surprising that Attorney General Jeff Sessions, who has expressed a strong enforcement bias, would prefer to “go to the Government well” for all or most of his selections.

However, the real problem here is with the DOJ during the Obama Administration.  With a chance to fill perhaps a record number of U.S. Immigration Judge positions over eight years, and to create an evenly balanced, diverse Immigration Judiciary in the process, they not only turned the hiring process in to a ridiculous two-year average cycle, but also selected 88% of the candidates from Government backgrounds.

Why would someone take two years for a selection process that selects from a limited inside pool anyway? And, why would you lead outside applicants to take the time to apply, believing they had a fair chance of competing, when the process obviously was “fixed” in favor of insiders? Sort of reminds me of the discussion of the labor certification recruitment process that we recently had in my Immigration Law & Policy Class at Georgetown Law!

Just more ways in which the “Due Process Vision” of the U.S. Immigration Courts has basically been trashed by the last three Administrations!

“AIMLESS DOCKET RESHUFFLING” (“ADR”) IN NEW YORK — NPR’s Beth Fertig Exposes Due Process/Management Abuses By Obama & Trump Administrations!

“There are 29 immigration judges assigned to court rooms in the Federal Building in Lower Manhattan. But as the number of pending cases grew from about 70,000 in January to nearly 80,000 this spring, more and more people have been coming to court only to discover they don’t have judges.

On a Tuesday morning in May, Alin Guifarro expected to attend a hearing with his 18-year-old son, Jose David Rodriguez. The teen came from Honduras last year to join his father and is trying to get legal status in the U.S.

But when they went to the 12th floor and scanned the long list of names with appearances scheduled that day, Guifarro saw his son’s case wasn’t assigned to a judge. Confused, he went to the clerk’s office and was told he would eventually get a letter in the mail about a new court date.

Guifarro was frustrated. “I came over here driving 2 ½ hours for nothing,” he said, referring to his journey from his home in Mastic, Long Island.

This father and son aren’t the only ones whose immigration cases have been postponed lately.

“In the last two months this has happened every week,” said Bryan Johnson, an immigration lawyer based on Long Island. Many of his clients are seeking asylum, and he said some have already been waiting a couple of years. With extra delays, he said, “if they have children who are abroad, that will delay family unification or spousal unification if their spouse is abroad.”

On a single day in May, when almost 400 hearings were scheduled to take place in immigration court, WNYC counted 60 people who didn’t have judges.

The Executive Office for Immigration Review runs the nation’s immigration courts. It says staffers typically mail a notice if a judge is out or a case is delayed, but they don’t always go out in time. As for why people are coming to court without judges, the agency explained that they are technically assigned to ”visiting judges.” But it acknowledged these judges don’t actually exist.

“The concept of ‘visiting judges’ is for internal case management,” said E.O.I.R. spokesman John Martin. “When judges retire, or temporarily stop hearing cases due to illness, the New York City Immigration Court will assign these dockets to a ‘visiting judge’ in order to maintain continuity of these cases. As new immigration judges are hired and officially placed at their respective immigration court locations, these ‘visiting judge’ dockets in those locations are reassigned to them.”

Even after a recent hire, New York City has only 29 immigration judges, compared to 31 at this time last year.

The backlog in immigration courts isn’t new. There are almost 600,000 pending cases, nationally. The problem started well before President Donald Trump took office.”

Then, there are the retirements. It’s hardly rocket science that an aging workforce in high-stress jobs might retire in large numbers. I ran “Immigration Judge retirements” into my search engine and got 9 articles, right off the bat. Try it yourself.

Additionally, there is the practice of both Administrations of mindlessly jamming more new cases in the front of the system without a rational plan for completing the ones already in it. That’s followed by reassigning Immigration Judges (like they were assembly line workers) from existing dockets of cases scheduled for final hearings to new dockets of Not Quite Ready For Prime Time (“NQRFPT”) cases. And to cap it off, Secretary Kelly, egged on by Jeff Sessions, has told DHS agents to arrest anyone the feel like arresting without any regard for reasonable priorities or space on already overcrowded court dockets!

And, while we’re at it, let’s stuff more non-criminals into dangerous, expensive, and unneeded immigration detention, thereby turning them into self-created emergency situations, rather than thinking creatively about cheaper, more humane, and more effective methods of getting non-dangerous folks through the system in a reasonable manner.

And you gotta love imaginary “visiting judges.”  Visiting from where, “The Twilight Zone?” Almost as good as “warehousing” tens of thousands of cases on a single day in November 2019. No wonder that once in extreme frustration I referred to this administrative morass as “Clown Court!”🤡

No, it’s not all the fault of EOIR bureaucrats, most of whom mean well and are simply caught up in a “built for failure” system. But, it is the fault of the DOJ whose politicized management of the Immigration Courts has been a disaster since the beginning of this century. And, even if you removed politics from the equation, the DOJ obviously lacks the basic administrative competence to run a complicated, high volume court system. Ultimately, Congress must assume the responsibility for allowing this travesty to continue to exist. An independent Immigration Court outside the Executive Branch is long overdue.

But, other than that, it’s a great system!

Trump Budget Calls For 75 New U.S. Immigration Judge Teams

The Washington Post writes:

“Trump’s spending blueprint released Thursday is light on specifics, but makes clear that his campaign pledge to confront illegal immigration is a top priority. Even as he plans to cut the Justice Department’s budget by more than $1 billion, Trump is asking for hundreds of millions of dollars to hire 60 federal prosecutors and 40 deputy U.S. Marshals to focus on border cases.

He also wants to boost immigration courts by $80 million to pay for 75 additional teams of judges. That would speed up removal proceedings for people in the United States illegally and address a backlog of more than 540,000 pending cases. The plan foreshadows a greater emphasis on prosecuting people who cross the border illegally, those who come back after being deported, and anyone tied to human and drug smuggling.

Trump’s proposal also calls for adding $1.5 billion to Immigration and Customs Enforcement’s budget to find, detain and deport immigrants living in the U.S. illegally, along with more than $300 million to hire 500 new Border Patrol agents and 1,000 immigration agents.

The president’s budget is the first step in a lengthy process of funding government agencies, and it’s not clear which of Trump’s priorities will be approved by Congress.”

My take:

Undoubtedly, the Immigration Court needs more Immigration Judges. On the positive side:

The Administration recognizes the need;

By referring to “teams” it appears that the Administration recognizes that judges can’t function without support, space, computers, etc.

On the negative side:

Given EOIR’s recent past performance, it could take the rest of the Administration to fill these new positions and expand Immigration Court facilities to accommodate the new judges. There currently are approximately 70 vacant IJ positions, most from the last Congressional increase;

There are likely to be a fair number of judicial retirements, compounding the hiring problems;

What kind of Immigration Judges would Sessions hire? He has never shown much respect for due process, fairness, or the rights of migrants. So, if he hires “Immigration Judges in his own image,” as he is legally entitled to do, that’s going to be a “due process disaster” for individuals seeking justice in Immigration Court;

Even with 449 fully trained judges on the bench, it would take nearly 1.6 years just to adjudicate currently pending cases. Piling more “priority” cases on top without any reasonable plan for deciding the currently pending cases is likely just to add to the backlogs and waiting times and further compromise due process and justice.  It will undoubtedly result in  more “aimless docket reshuffling” (“ADR”) which expends effort without producing any final dispositions.

There is no mention of needed reforms in Immigration Court structure, administration, and technology. Without those needed reforms, more judicial positions are unlikely to solve the Immigration Court’s deep existing problems in delivering due process and justice in a timely fashion.

Meanwhile, some sources have reported that existing Immigration Judges have been asked to be available for possible details outside of their “home” courts for up to 10 months of the year. As I have pointed out before, each time a sitting Immigration Judge is detailed, he or she leaves behind a full docket of cases which must be rescheduled.

Ordinarily, this results in cases scheduled for the near future being “reset” to dates at the end of overcrowded dockets, usually several years in the future. Plus, every act of mass rescheduling creates staff burdens that result in defective notices or other important work (such as answering phones, logging in new cases, or filing briefs and motions for upcoming cases) being put on hold.
