Democratic Secretary of State Katie Hobbs has defeated Republican Kari Lake in Arizona’s race for governor, NBC News projected Monday.

Hobbs’ victory is key for Democrats in a presidential battleground state and a rebuke to a prominent election denier — although the closeness of the contest left the result up in the air for nearly a week.

“I am honored to have been selected to serve as the next Governor of Arizona,” Hobbs said in a statement Monday night. “I want to thank the voters for entrusting me with this immense responsibility. It is truly an honor of a lifetime, and I will do everything in my power to make you proud.”

Too close, considering the yawning gap in qualifications between the candidates. Indeed, I couldn’t conceive of a public office that unqualified Trumpist Lake would be qualified to hold. That she was even on the ballot and made the election so close shows the tenuous state of our republic!

You can read Hobbs’s gracious statement above. Lake’s asinine comment on learning of the people’s verdict was contemptuous and worthy of her anti-American idol Trump  — the biggest and sorest loser in modern American politics.

Hopefully, Hobbs’s first act as Governor, replacing GOP hack Ducey, will be to stop polluting the border with cargo containers. Honestly, what idiocy will GOP White Nationalists come up with next to waste taxpayer dollars and make America a laughingstock?

⚠️The Saga of Surveillance Capitalism Continues: LexisNexis’s Contract With ICE Foretells a Bleak Era of Data Policing Immigrants, Intercept Writes

On April 2, 2021, The Intercept published a damning article revealing that the oft-used legal research giant, LexisNexis, has contracted with ICE to provide the agency access to its massive data bank. 

According to Sam Biddle from The Intercept, “[LexisNexis] also caters to the immensely lucrative ‘risk’ industry, providing, it says, 10,000 different data points on hundreds of millions of people to companies like financial institutions and insurance companies who want to, say, flag individuals with a history of fraud. LexisNexis Risk Solutions is also marketed to law enforcement agencies, offering ‘advanced analytics to generate quality investigative leads, produce actionable intelligence and drive informed decisions’ — in other words, to find and arrest people.” 

The unholy marriage between the research tool-turned-Palantir and ICE is not a new development. Several years ago, LexisNexis had already begun courting ICE with similar data-exchange deals along with the other legal research titan, WestLaw. Prior talks had prompted members of the legal community to express obvious displeasure for the ethical dilemma that was being forced upon them. Most notably, Sarah Lamdan, professor and librarian at CUNY School of Law, published an authoritative article in the N.Y.U. Review of Law & Social Change that provided insight into the developing relationship between ICE and both legal research companies. This article came at the cusp of what is now an incredibly normalized occurrence. You know, a private company that offers an essential tool branches out into the lucrative data surveillance industry, you’ve probably seen it before. 

It is impossible for most people to hear about these partnerships without getting a bad taste in their mouth. Unfortunately, our society’s dependence on tech has left us largely unable to divest or otherwise eschew these tools with much success. This dependence is the reason many of these companies don’t even try to hide how incestuous their relationships to government agencies like ICE really are

The Intercept article should be read and taken as a clarion call to action for immigration advocates. The playing field is being skewed in favor of an omniscient government, leaving attorneys and those they represent more eggshells to avoid as they tread lightly around unseen information landmines. The façade of neutrality touted by Big Data and Big Tech is being torn down by the very companies who worked so hard to create it. What’s worse, the tech industry itself is the outfit that created the narrative that the internet, and all that comes with it, is a strictly neutral medium existing between the two groups allegedly existing in perpetual struggle: the masses and the government. (Don’t believe me? Don’t worry, someone already wrote an article about it here) This news should encourage more fervent use of alternative channels of informational support among those who represent non-citizens. Likewise, more collaborative efforts should also be made to place organized pressure on brazen unions such as that of LexisNexis and ICE. As it stands, it may even be advisable for many of us in the legal community to return to antiquated means of record-keeping and information-gathering if one can help it. After all, just because you’re paranoid, doesn’t mean they aren’t after you!

WASHINGTON — The Trump administration plans to begin turning asylum-seekers back across the southern border on Friday to wait in Mexico under a new policy designed to crack down on immigration by Central American families, according to three Department of Homeland Security officials familiar with the matter.

Customs and Border Protection officers will begin returning asylum-seekers trying to enter at the San Ysidro port of entry in California from Tijuana, Mexico, where thousands of migrants from Honduras, Guatemala and El Salvador are already waiting in poor conditions.

Under current policy, immigrants who pass an initial “credible fear” interview are allowed to remain in the U.S. while they wait for immigration judges to decide their cases. Single adults are detained while they await their hearing, but a federal court decision in 2015 mandates that families with children be detained no longer than 20 days.

The Trump administration has blamed that court decision, known as the Flores settlement, for being a magnet that is driving record numbers of immigrant families to apply for asylum at the southern border. Last summer under the “zero tolerance” policy, DHS separated asylum-seeking parents from their children at the border, sparking international outcry.

Overall numbers of undocumented immigrants apprehended or stopped from legally entering the United States are lower than the historic highs reached in the early 2000s.

Children who travel without a guardian, immigrants who appear ill as well as other “vulnerable populations” will be exempt from the policy and allowed to wait in the U.S. for an immigration hearing.

Immigrant and civil rights organizations have threatened to sue the Trump administration over the policy, known as Migration Protection Policy, which Homeland Security Secretary Kirstjen Nielsen announced was coming in her congressional testimony in December.

The policy is a unilateral move by the U.S. and not part of an agreement with Mexico, two officials said, though Mexico has agreed to care for immigrants who are waiting to apply. The Lopez Obrador administration in Mexico has been vocal about its opposition to the policy in the past.

Beginning Friday, the asylum-seekers who come to the San Ysidro port of entry will be sent back to Tijuana with a notice to appear in court in San Diego. On their court dates, U.S. Immigration and Customs Enforcement will provide transportation from the port of entry to immigration court. Asylum-seekers will also be given a 24-hour hotline to call for the status of their asylum cases.

SHUTDOWN HAS FURLOUGHED IMMIGRATION COURT JUDGES

Due to a backlog in U.S. immigration courts of more than 800,000 cases, asylum-seekers currently have to wait months or even years to see a judge. DHS has asked the Justice Department to expedite the cases of immigrants waiting in Mexico, and two officials said they expect the asylum-seekers affected by the new policy to wait no more than a year.

U.S. Customs and Border Protection encountered only six immigrants at ports of entry on the U.S-Mexico border in the first half of fiscal year 2018 whose names were on a federal government list of known or suspected terrorists, according to CBP data provided to Congress in May 2018 and obtained by NBC News.

The low number contradicts statements by Trump administration officials, including White House press secretary Sarah Sanders, who said Friday that CBP stopped nearly 4,000 known or suspected terrorists from crossing the southern border in fiscal year 2018.

Secretary of Homeland Security Kirstjen Nielsen told reporters on Monday the exact number, which NBC News is first to report, was classified but that she was working on making it public. The data was the latest set on this topic provided to Congress. It is possible that the data was updated since that time, but not provided to Congress.

Overall, 41 people on the Terrorist Screening Database were encountered at the southern border from Oct. 1, 2017, to March 31, 2018, but 35 of them were U.S. citizens or lawful permanent residents. Six were classified as non-U.S. persons.

On the northern border, CBP stopped 91 people listed in the database, including 41 who were not American citizens or residents.

Border patrol agents, separate from CBP officers, stopped five immigrants from the database between legal ports of entry over the same time period, but it was unclear from the data which ones were stopped at the northern border versus the southern border.

The White House has used the 4,000 figure to make its case for building a wall on the southwest border and for closing the government until Congress funds it. They have also threatened to call a national emergency in order to get over $5 billion in funding for the wall.

The U.S. keeps databases of people it believes may have ties to terrorist networks based on their spending activities, travel patterns, family ties or other activities. It is not a list of people who could be criminally charged under terrorism statutes, and it is possible that someone could be stopped because they have the same name as a person on the list.

As most readers probably know, the Washington Post and others recently have exposed what many of us knew all along: The DOJ intentionally used false and misleading numbers to support the racist, xenophobic narratives set forth by Sessions, Nielsen, Homan, and others! And, shamelessly, the DOJ refuses to withdraw its bogus reports!

Once we get real government back again, seems that the DOJ is a prime candidate for a thorough housecleaning! Integrity seems to have disappeared from the DOJ’s mission at all levels!

President Trump on Sunday explicitly advocated for depriving undocumented immigrants of their due-process rights, arguing that people who cross the border into the United States illegally are invaders and must immediately be deported without trial or an appearance before a judge.

Trump’s attack on the judicial system sowed more confusion as lawmakers struggle to reach consensus on immigration legislation and as federal agencies scramble to reunite thousands of migrant children and their parents who were separated at the border under an administration policy that the president abruptly reversed last week.

The House is preparing to vote this week on a broad Republican immigration bill. Although the White House supports the proposed legislation, its prospects for passage appeared dim Sunday, both because Democrats oppose the measure and because Republicans have long been divided over how restrictive immigration laws should be.

Meanwhile, some GOP lawmakers were preparing a more narrow bill that would solely address one of the flaws in Trump’s executive order, which mandates that migrant children and parents not be separated during their detention. The 1997 “Flores settlement” requires that children be released after 20 days, but the GOP proposal would allow for children and their parents to stay together in detention facilities past 20 days.

At the center of the negotiations is a president who has kept up his hard-line rhetoric even as he gives contradictory directives to Republican allies. In a pair of tweets sent late Sunday morning during his drive from the White House to his Virginia golf course, Trump described immigrants as invaders, called U.S. immigration laws “a mockery” and wrote that they must be changed to take away legal rights from undocumented migrants.

“We cannot allow all of these people to invade our Country,” Trump wrote. “When somebody comes in, we must immediately, with no Judges or Court Cases, bring them back from where they came. Our system is a mockery to good immigration policy and Law and Order. Most children come without parents.”

In a series of June 24 tweets, President Trump argued that people who cross the border into the U.S. illegally must immediately be deported without trial.

The president continued in a second tweet: “Our Immigration policy, laughed at all over the world, is very unfair to all of those people who have gone through the system legally and are waiting on line for years! Immigration must be based on merit — we need people who will help to Make America Great Again!”

Trump also exhorted congressional Democrats to “fix the laws,” arguing that “we need strength and security at the Border! Cannot accept all of the people trying to break into our Country.”

After House Republicans failed to pass a hard-line immigration billlast week, they were preparing to vote on another broad bill this week that would provide $25 billion for Trump’s long-sought border wall, limit legal immigration and give young undocumented immigrants a path to citizenship.

“I did talk to the White House yesterday. They say the president is still 100 percent behind us,” Rep. Michael McCaul (R-Tex.), a co-sponsor of the bill, said on “Fox News Sunday.”

But because that bill may not garner enough votes to pass the House, momentum was building over the weekend for a more narrow measure that would effectively end the Flores settlement. Should the broader bill fail, the White House is preparing to throw its support behind the measure, which is expected to garner wider support among lawmakers, according to a White House official.

Legislative negotiations are continuing behind the scenes despite Trump’s vacillations over the past week. The president began the week defending his administration’s family separation policy. On Tuesday night, he expressed support for two rival GOP bills in a muddled and meandering address to House Republicans in which he insulted Rep. Mark Sanford (R-S.C.) without prompting, drawing a smattering of boos. Then on Friday, he urged lawmakers to throw in the towel, tweeting, “Republicans should stop wasting their time on Immigration until after we elect more Senators and Congressmen/women in November.”

That tweet demoralized Republicans as they headed home for the weekend, but it did not end talks about what the House might pass. Brendan Buck, counselor to House Speaker Paul D. Ryan (R-Wis.), said Sunday that a solution specifically dealing with family separation had been “a topic of discussion all week,” although he noted that there was not one policy or bill that Republicans had coalesced behind.

Marc Short, the White House director of legislative affairs, said Sunday that it was premature to announce which measures Trump would sign but urged Congress to act quickly to address the immigration issue broadly.

“The White House has consistently raised our concern about the Flores settlement with Congress,” Short said. “It’s, in fact, an issue that previous administrations grappled with also, and we anticipate Congress acting on that sooner rather than later.”

Meanwhile, Trump’s attack on the due-process rights of immigrants follows a week in which he has been fixated on the immigration court system, which he has called “ridiculous.” The president has balked at proposals from Sen. Ted Cruz (R-Tex.) and other lawmakers to add court personnel to help process more immigration cases.

Democrats and immigrant rights advocates sought to shame Trump for saying he wants to deny illegal immigrants their due-process rights.

“America rules by law,” tweeted Rep. Gerald E. Connolly (D-Va.), “not by presidential diktat.”

Omar Jadwat, director of the American Civil Liberties Union’s Immigrants’ Rights Project, said in a statement: “What President Trump has suggested here is both illegal and unconstitutional. Any official who has sworn an oath to uphold the Constitution and laws should disavow it unequivocally.”

And at least one GOP lawmaker spoke out against Trump’s threat. Rep. Justin Amash (Mich.), a libertarian-leaning Republican who has often criticized the president, responded to the controversy by quoting the Fifth Amendment.

“No person shall be . . . deprived of life, liberty, or property, without due process of law,” Amash tweeted.

Trump has been beating this drum for several days now. In a speech Tuesday, Trump said: “I don’t want judges. I want border security. I don’t want to try people. I don’t want people coming in.”

“Do you know, if a person comes in and puts one foot on our ground, it’s essentially, ‘Welcome to America, welcome to our country’?” Trump continued. “You never get them out, because they take their name, they bring the name down, they file it, then they let the person go. They say, ‘Show back up to court in one year from now.’ ”

Trump suggested in those remarks, delivered before the National Federation of Independent Businesses, that many immigrants were “cheating” because they were following instructions from their attorneys.

“They have professional lawyers,” he said. “Some are for good, others are do-gooders, and others are bad people. And they tell these people exactly what to say.”

Many immigration hard-liners see it differently. Asylum applications and deportation proceedings go before immigration courts, staffed by judges who can make rulings without consulting juries.

Cruz’s initial legislation on the border crisis proposed doubling the number of immigration judges, to 750 from roughly 375. And Attorney General Jeff Sessions has taken steps to strengthen the immigration courts, allowing them to process many cases without trials and limiting their ability to delay other cases.

“I have sent 35 prosecutors to the Southwest and moved 18 immigration judges to the border,” Sessions told an audience in San Diego earlier this year. “That will be about a 50 percent increase in the number of immigration judges who will be handling the asylum claims.”

While wrestling with their own response, Republicans have shifted blame to Democrats, who have been critical of both Sessions’s moves and drafts of immigration legislation. In a Sunday afternoon tweet, Senate Minority Leader Charles E. Schumer (D-N.Y.) argued for “a czar to break through the bureaucracy and get these kids out of limbo and back in their parents’ arms.”

On the Sunday political talk shows, Republicans echoed Trump in accusing Democrats of rejecting any serious solution in favor of inflicting political hurt — and charging that they want “open borders.”

“Chuck Schumer says, ‘No, no, no, we’re not going to bring it up,’ ” Rep. Jim Jordan (R-Ohio), a leader of the House Freedom Caucus, said on CBS’s “Face the Nation.” “What they want is the political issue. They don’t want to solve the problems. They don’t want to keep families together and adjudicate this and have a go through the hearing process and do it in a way that’s consistent with the rule of law.”

Meanwhile, Defense Secretary Jim Mattis on Sunday said the Defense Department is working on details of a plan to house migrants at two military bases in the United States. Speaking to reporters en route to a visit to Alaska, Mattis said the Pentagon had received a request from the Department of Homeland Security to receive migrants and is finalizing how many people would need to be housed and what they would require.

Mattis said the Pentagon’s role is limited, and compared it to the department’s housing of migrants from Vietnam and people displaced by natural disasters.

“We’re in a logistics support response mode to the Department of Homeland Security,” he said.

What can you say about a horrible President who mocks the law, our Constitution, divides us intentionally, and dehumanizes the most vulnerable and human among us.

The individuals Trump tries to degrade and dehumanize are mostly legitimate refugees fleeing what respected war correspondent Richard Engel of NBC describes as a low-grade war zone where the (already corrupt  and ineffective) governments have lost control of much of the country to gangs and cartels. In plain terms, gangs have become the “de facto government” in much of the Northern Triangle. Individuals who oppose the gangs are viewed as political opponents and punished accordingly.

It’s bad enough that our government has intentionally twisted asylum law against legitimate refugees from the Northern Triangle even before Trump & Sessions. Sessions has now intentionally misconstrued the law to eliminate protection of women who have suffered domestic violence and who won’t be protected in their home countries.

Individuals seeking refugee are entitled to a chance to present their applications, to a fair consideration and adjudication, and to humane and respectful treatment.

Trump’s statements and ignorance of the law are a national disgrace. A decent nation would ignore him and welcome those who can establish their status as refugees.

We are diminishing ourselves as a nation with every day Trump remains in office; but that won’t stop human migration.

In his interview with NBC’s Craig Melvin, Bill Clinton had a chance to acknowledge the impropriety of his relationship with then intern Monica Lewinsky and to sincerely apologize to her. It would have cost him absolutely nothing.

Instead, he chose to react defensively, attack Melvin, misrepresent the facts, and spout non sequiturs about JFK, LBJ, and how much in debt he was when he left the White House. No genuine acceptance of responsibility; no real remorse; no graciousness; no humility; no class. In other words, just what we’d expect from Donald Trump.

In retrospect, the Dems shot themselves in the foot by nominating a 2016 candidate who carried too much baggage and was too tied to the past and its problems. It’s time for the Dems to move forward and leave the Clintons to a past era that they were never really capable of understanding, acknowledging, and facing up to in a fully responsible manner.

“WASHINGTON — The Justice Department’s No. 3 attorney had been unhappy with her job for months before the department announced her departure on Friday, according to multiple sources close to Associate Attorney General Rachel Brand.

Brand grew frustrated by vacancies at the department and feared she would be asked to oversee the Russia investigation, the sources said.

She will be leaving the Justice Department in the coming weeks to take a position with Walmart as the company’s executive vice president of global governance and corporate secretary, a job change that had been in the works for some time, the sources said.

As far back as last fall, Brand had expressed to friends that she felt overwhelmed and unsupported in her job, especially as many key positions under her jurisdiction had still not been filled with permanent, Senate-confirmed officials.

Four of the 13 divisions overseen by the associate attorney general remain unfilled, including the civil rights division and the civil division, over one year into the Trump administration.

While Brand has largely stayed out of the spotlight, public criticism of Deputy Attorney General Rod Rosenstein by President Donald Trump worried Brand that Rosenstein’s job could be in danger.

Should Rosenstein be fired, Brand would be next in line to oversee Special Counsel Robert Mueller’s investigation into Russia’s meddling in the 2016 election, thrusting her into a political spotlight that Brand told friends she did not want to enter.

The Justice Department pushed back on NBC’s report.

“It is clear these anonymous sources have never met Rachel Brand let alone know her thinking. All of this is false and frankly ridiculous,” said Justice Department spokeswoman Sarah Flores.

Brand has had a long legal career that has spanned several administrations, including under Democratic President Barack Obama and Republican George W. Bush.

In announcing her departure, Attorney General Jeff Sessions described Brand as “a lawyer’s lawyer,” noting that she graduated from Harvard Law School and clerked at the Supreme Court.

In the same statement, Brand said, “I am proud of what we have been able to accomplish over my time here.”

Undoubtedly, the DOJ under Trump and Sessions has made some great strides in attacking the rule of law, undermining social justice, mal-administering the Immigration Courts, eroding the credibility of DOJ attorneys in court, and generally diminishing the quality and fairness of the justice system in the United States.

While those might give Rachel “bragging rights” over at Wal-Mart or in right-wing legal circles, I don’t see that they are anything to “write home about.”  Hopefully, at some point in the future, having served as a politico in the Trump/Sessions DOJ will become a “career killer” for any future Government appointments.

But, in today’s topsy-turvy legal-political climate, it’s still a shrewd “self-preservation” move on Brand’s part. And, she’s somewhat less likely to be stomping on anyone’s civil rights over at Wal-Mart (although you never know when an opportunity to dump on the civil rights of the  LGBTQ community, African-Americans, Latinos, immigrants, women, the poor, or to promote religious intelerance might present itself in a corporate setting).

Vargas writes:

“In the story of our country, the Trump administration’s dismantling of the DACA program is a national tragedy that will be a source of confusion for generations to come. The program was one of the few compromises that the Obama administration made in attempt to right unjust, inhumane and outdated immigration laws. Our own history tells us that laws are fluid and change over time; they do not dictate morality, but are dictated by morality (or the lack thereof). It wasn’t until the 20th century, for example, that we saw women first granted the right to vote and the abolishment of Jim Crow laws.

The pervasive rhetoric around immigrants who received DACA and their families is predicated on an underlying judgement that their mere presence in this country is a crime. It is not: Being in the U.S. without authorization is a civil offense.

Yet if a crime has been committed, someone must be responsible, right? If you qualify for DACA, it means that you were under a certain age when you came here, so you were too young to have committed a “crime.” You are a “good,” “acceptable,” “assimilated” one. But your parents are not. America will accept you — provisionally — but you must condemn the actions of your family members who brought you here.

“Divide and conquer.”

No wall has yet been built, no border yet drawn, no law yet written that overpowers the love of parents for their children. Let us celebrate and give thanks to the resilience of immigrant families who, despite all possible obstacles, find ways to survive, even thrive. Our laws and various languages may separate them, but united they stand.

One of the most offensive things that Sessions consistently does is to undervalue the contributions of immigrants, both documented and undocumented. This was particularly true in his slandering of “Dreamers.” They are America’s youth; we’re fortunate to have them!

The closely related idea of GOP White Nationalist restrictionists that “chain migration” is bad is equally insulting and totally wrong. Family immigration has contributed as much to America as has so-called “employment-based” immigration. Undocumented migrants have also contributed to our success, particularly our economic success.

Our real problem is with White Nationalists and restrictionists who insist on overly restrictive immigration policies that are unenforceable, expensive, corrosive, and against our national interests.
