Regarding the April 12 editorial “Faced with the loss of her sons, she asked for a lawyer — and was refused”:

Erica Starkey’s story exposes the unjust nature of civil court proceedings for people who cannot afford counsel. People facing deportation also face a similar “affront to justice” as immigration cases are also civil proceedings. The majority of people in detention (70 percent) have no legal representation because people facing deportation do not have the right to a public defender, leaving them to navigate an unjust legal system alone. As a result, many immigrants languish in detention facilities for months or even years, often in inhumane and deadly conditions.

We have seen leaders in communities as diverse as Philadelphia, Denver and Harris County, Tex., collaborate with advocates and lawyers to create and expand deportation defense programs that secure due process rights for all. Together with existing representation programs, these efforts that center fairness and dignity have paved the way for a federal defender system for all immigrants. This critical work must continue across all levels of government to undo the radiating impacts of continued criminalization, mass detention, and separation and deportation of immigrants, and advance a new vision of justice for our communities.

Attorney General Merrick Garland announced with great fanfare plans to investigate the Minneapolis Police Department.

Seems quite hypocritical given the glaring lack of constitutional due process, institutionalized xenophobia, racism, misogyny, and incompetence infecting his own Immigration Courts. 

How is a Department that has failed to address systematic injustice in its own dysfunctional and unfair “courts” going to credibly address problems in the rest of our American Justice system?

Nothing will harm a campaign like the wishful thinking, fearful hesitation, or sheer complacency that fails to address what voters can plainly see. Kenosha gives Biden a chance to help himself and the country. Ordinarily it’s the incumbent president’s job to show up at the scene of a national tragedy and give a unifying speech. But Trump is temperamentally incapable of doing so and, in fact, has a political interest in America’s open wounds and burning cities.

Biden, then, should go immediately to Wisconsin, the crucial state that Hillary Clinton infamously ignored. He should meet the Blake family and give them his support and comfort. He should also meet Kenoshans like the small-business owners quoted in the Times piece, who doubt that Democrats care about the wreckage of their dreams. Then, on the burned-out streets, without a script, from the heart, Biden should speak to the city and the country. He should speak for justice and for safety, for reform and against riots, for the crying need to bring the country together. If he says these things half as well as Julia Jackson did, we might not have to live with four more years of Trump.

Seems like a sound plan. Joe probably should take Kamala with him to Kenosha. Get the input of the residents and public officials living with this horrible situation every day and see what common ground they might suggest for both repairing the damage that has been done (to the extent it can be repaired — obviously, there is no restoring Mr. Blake to his pre-shooting condition) and moving forward as a united community and as a country. Assuming, as I do, that the vast majority of Americans favor both justice for all and peaceful, prosperous communities, what are some specifics about how we might get there by working together and across racial and party lines.

Threats and more force won’t solve the problem. We know that. But just that knowledge isn’t enough to solve the problem.

I think it also would be a good idea for Joe and Kamala to seek the views of individuals like LeBron James, Giannis Antetokounmpo, Steph & Ayesha Curry, George Hill, Kenny Smith, Colin Kaepernick (who was born in Milwaukee and spent the first four yers of his life in Fond du Lac, WI)and others in the African-American community. How would they solve the problem of racial injustice while building community harmony. How could they use their influence to help. Elizabeth Warren, Bernie Sanders, AOC, and Sen. Doug Jones (to name just a few) might also have some good ideas to contribute.

Donald Trump is not, and never will be, a thoughtful, unifying problem solver. It’s just not in his makeup or “skill set.” He has no coherent plan for anything.

By contrast, Joe Biden has shown himself to be thoughtful, willing to admit and move by past mistakes, and able to build on his experience and past views to address the present. Now, he needs to put it all together in “real time” and show America what a competent, caring, and listening Government could do for the common good. Without necessarily “becoming Elizabeth Warren,” he and Kamala “need a plan for that.” And listening to the “real people of Kenosha” seems like the place to start.

“CHICAGO ― In the final months of the Obama administration, the Justice Department’s Civil Rights Division scrambled to complete its biggest-ever investigation of a city police department: a 13-month probe of Chicago’s 12,000-strong police force that wrapped up just a week before President Donald Trump’s inauguration.

For more than a year, the division’s lawyers reviewed thousands of Chicago Police Department documents, visited all 22 police districts, went on 60 ride-alongs, reviewed 170 police shooting files, examined over 425 incidents of less-lethal force, interviewed 340 department members and talked to about 1,000 Chicago residents.

Their final report, issued Jan. 13, recognized the tough job officers had in Chicago as they dealt with spiking gun violence, and praised the “diligent efforts and brave actions of countless” officers. But a “breach in trust” eroded Chicago’s ability to prevent crime, because officers were able to escape accountability when they broke the law, the report found. Because “trust and effectiveness in combating violent crime are inextricably intertwined,” the report found “broad, fundamental reform” was needed in Chicago.

Without a formal legal agreement to reform — known as a consent decree — and independent monitoring, the report concluded, reform efforts in Chicago were “not likely to be successful.”

Jeff Sessions, Trump’s attorney general, disagrees. In recent weeks, Sessions has expressed deep skepticism about the role of the federal government in fixing broken police departments, leaving serious doubts about the ultimate outcome of the Justice Department’s work in Chicago.

Sessions wants the Justice Department to serve as the “leading advocate for law enforcement in America.” While admitting he hadn’t read the full Chicago report, he called it “anecdotal” and “not so scientifically based.” Earlier this month in Baltimore, a Justice Department lawyer said Sessions had “grave concerns” about an agreement previously reached between that city and the Obama administration. A federal judge signed off on the deal over Sessions’ objections.

In an interview with a conservative radio host this month, Sessions seemed to suggest that Justice Department investigations and consent decrees were resulting in “big crime increases.” In an op-ed for USA Today last week, Sessions wrote that consent decrees could amount to “harmful federal intrusion” that could “cost more lives by handcuffing the police instead of the criminals.” There’s too much focus on “a small number of police who are bad actors,” Sessions wrote, and “too many people believe the solution is to impose consent decrees that discourage the proactive policing that keeps our cities safe.”

Chicago has a serious violent crime problem. Last year was the deadliest in the city in two decades, with 762 homicides. But supporters of police reform like Jonathan Smith, a former official in the Justice Department’s Civil Rights Division, said that Sessions was “simply wrong” to suggest that crime goes up as a result of reform (or, in Chicago’s case, an investigation). DOJ investigations can increase community confidence in police departments and make people safer, Smith argued.

Lorie Fridell, a criminologist and police bias expert from whom the Chicago’s Police Accountability Task Force solicited information for its report released last year, said DOJ investigations not only help to usher in badly need reforms to the specific departments probed, but other departments also rely on the reports to determine if their own departments are meeting constitutional standards.

“I think it’s very unfortunate the DOJ is no longer going to prioritize police reform,” Fridell said. ”The future of police reform is therefore going to have to come from the ground up. It’s going to be important for concerned individuals to demand high-quality policing.”
