A federal judge on Thursday ordered the Trump administration not to release a report by the Presidential Commission on Law Enforcement and the Administration of Justice, finding that the group ― comprised entirely of current and former members of law enforcement ― had been “far from transparent.”

Senior U.S. District Judge John Bates, a George W. Bush appointee, issued a 45-page ruling finding that commission ― which President Donald Trump announced with fanfare at a police conference last year ― had violated the Federal Advisory Committee Act (FACA), which requires that committees be “fairly balanced” in the viewpoints represented.

Attorney General William Barr said there was a need to hear from a “diversity of backgrounds and perspectives,” but the commission was full of law enforcement officials. Bates’ order requires Barr “to ensure the Commission has a fairly balanced membership.”

Last month, as HuffPost previously reported, an elected prosecutor quit one of the commission’s working groups because he worried that it was “providing cover” for a predetermined law-and-order agenda that “will only widen the divisions in our nation.”

Bates wrote that the commission’s membership “consists entirely of current and former law enforcement officials” and that no commissioner “has a criminal defense, civil rights, or community organization background.”

“Especially in 2020, when racial justice and civil rights issues involving law enforcement have erupted across the nation, one may legitimately question whether it is sound policy to have a group with little diversity of experience examine, behind closed doors, the sensitive issues facing law enforcement and the criminal justice system in America today,” he wrote.

Former Trump Strategist Steve Bannon Indicted In ‘Build The Wall’ Scheme

The former Trump campaign executive was arrested Thursday morning. A grand jury said he used donated funds to cover personal expenses.

Steve Bannon, a former chief strategist in President Donald Trump’s White House, was arrested on Thursday after a grand jury indicted him on federal charges for allegedly using hundreds of thousands of dollars from an online “We Build The Wall” fundraiser to cover his personal expenses.

Bannon and three others ― Brian Kolfage, Andrew Badolato and Timothy Shea ― were charged in connection with their roles in “defrauding hundreds of thousands of donors in connection with an online crowdfunding campaign known as ‘We Build the Wall’ that raised more than $25 million,” the U.S. Attorney’s Office for the Southern District of New York announced Thursday morning.

The four defendants are each charged with one count of conspiracy to commit wire fraud and one count of conspiracy to commit money laundering. Each charge carries a maximum penalty of 20 years in prison.

Kolfage, the founder of “We Build the Wall,” had assured donors that all the money would go toward construction of a wall along the U.S.-Mexico border, acting U.S. Attorney for the Southern District of New York Audrey Strauss said in a statement. But the defendants “secretly schemed to pass hundreds of thousands of dollars to Kolfage, which he used to fund his lavish lifestyle,” she said.

Bannon, 66, received over $1 million from the crowdfunding campaign, which he funneled through a nonprofit that he operates, according to prosecutors. Hundreds of thousands of dollars of that money reportedly went toward his personal expenses.

“WASHINGTON ― President Donald Trump on Friday pardoned a notorious former Arizona sheriff who willfully violated a federal judge’s order by unlawfully detaining individuals his officers claimed might be in the country illegally.
Former Maricopa County Sheriff Joe Arpaio, who had previously proclaimed himself “America’s toughest sheriff,” was convicted of criminal contempt last month for violating a 2011 order that barred Arpaio and his office from detaining individuals solely based on suspicions about their legal status. Arpaio, 85, was scheduled to be sentenced on Oct. 5.
“Throughout his time as Sheriff, Arpaio continued his life’s work of protecting the public from the scourges of crime and illegal immigration,” the White House said in a statement late Friday. “Sheriff Joe Arpaio is now eighty-five years old, and after more than fifty years of admirable service to our Nation, he is a worthy candidate for a Presidential pardon.”
Trump’s pardon of Arpaio, the first of his presidency, amounts to a tacit endorsement of Arpaio’s discriminatory tactics and reads as a favor to a political ally. The media-savvy former sheriff, known for parading inmates around in pink underwear, supported the former reality TV star’s presidential campaign and spoke at the Republican National Convention last summer. Both men were prominent promoters of the racist conspiracy theory that former President Barack Obama wasn’t born in the United States.
Arpaio, who served as sheriff from 1993 through 2016, had long been accused of discriminatory practices against Latinos. A 2011 report by the U.S. Department of Justice’s Civil Rights Division concluded there was reasonable cause to believe that Arpaio and his office engaged in a pattern or practice of unlawful policing and racial profiling. Arpaio’s officers called Latinos “wetbacks,” “Mexican bitches,” “fucking Mexicans” and “stupid Mexicans,” the Justice Department found, and Latino drivers were four to nine times as likely to be stopped by his officers as non-Latino drivers were. A lawsuit filed by the Justice Department was settled in 2015.
“With his pardon of Arpaio, Trump has chosen lawlessness over justice, division over unity, hurt over healing,” Cecillia Wang, deputy legal director of the American Civil Liberties Union, said in a statement Friday. “Once again, the president has acted in support of illegal, failed immigration enforcement practices that target people of color and have been struck down by the courts. His pardon of Arpaio is a presidential endorsement of racism.”

“CHICAGO ― In the final months of the Obama administration, the Justice Department’s Civil Rights Division scrambled to complete its biggest-ever investigation of a city police department: a 13-month probe of Chicago’s 12,000-strong police force that wrapped up just a week before President Donald Trump’s inauguration.

For more than a year, the division’s lawyers reviewed thousands of Chicago Police Department documents, visited all 22 police districts, went on 60 ride-alongs, reviewed 170 police shooting files, examined over 425 incidents of less-lethal force, interviewed 340 department members and talked to about 1,000 Chicago residents.

Their final report, issued Jan. 13, recognized the tough job officers had in Chicago as they dealt with spiking gun violence, and praised the “diligent efforts and brave actions of countless” officers. But a “breach in trust” eroded Chicago’s ability to prevent crime, because officers were able to escape accountability when they broke the law, the report found. Because “trust and effectiveness in combating violent crime are inextricably intertwined,” the report found “broad, fundamental reform” was needed in Chicago.

Without a formal legal agreement to reform — known as a consent decree — and independent monitoring, the report concluded, reform efforts in Chicago were “not likely to be successful.”

Jeff Sessions, Trump’s attorney general, disagrees. In recent weeks, Sessions has expressed deep skepticism about the role of the federal government in fixing broken police departments, leaving serious doubts about the ultimate outcome of the Justice Department’s work in Chicago.

Sessions wants the Justice Department to serve as the “leading advocate for law enforcement in America.” While admitting he hadn’t read the full Chicago report, he called it “anecdotal” and “not so scientifically based.” Earlier this month in Baltimore, a Justice Department lawyer said Sessions had “grave concerns” about an agreement previously reached between that city and the Obama administration. A federal judge signed off on the deal over Sessions’ objections.

In an interview with a conservative radio host this month, Sessions seemed to suggest that Justice Department investigations and consent decrees were resulting in “big crime increases.” In an op-ed for USA Today last week, Sessions wrote that consent decrees could amount to “harmful federal intrusion” that could “cost more lives by handcuffing the police instead of the criminals.” There’s too much focus on “a small number of police who are bad actors,” Sessions wrote, and “too many people believe the solution is to impose consent decrees that discourage the proactive policing that keeps our cities safe.”

Chicago has a serious violent crime problem. Last year was the deadliest in the city in two decades, with 762 homicides. But supporters of police reform like Jonathan Smith, a former official in the Justice Department’s Civil Rights Division, said that Sessions was “simply wrong” to suggest that crime goes up as a result of reform (or, in Chicago’s case, an investigation). DOJ investigations can increase community confidence in police departments and make people safer, Smith argued.

Lorie Fridell, a criminologist and police bias expert from whom the Chicago’s Police Accountability Task Force solicited information for its report released last year, said DOJ investigations not only help to usher in badly need reforms to the specific departments probed, but other departments also rely on the reports to determine if their own departments are meeting constitutional standards.

“I think it’s very unfortunate the DOJ is no longer going to prioritize police reform,” Fridell said. ”The future of police reform is therefore going to have to come from the ground up. It’s going to be important for concerned individuals to demand high-quality policing.”

“WASHINGTON ― Less than a week on the job as U.S. attorney general, Jeff Sessions faces a potentially explosive situation: He was a top adviser to Donald Trump’s presidential campaign, but he’s now overseeing the agency investigating members of that campaign.

The FBI, which falls under the umbrella of Sessions’ Justice Department, is leading a multi-agency probe of possible connections between Trump associates and the Russian government. Law enforcement and intelligence officials have phone records and intercepted calls that show members of Trump’s campaign repeatedly communicated with senior Russian intelligence officials in the months before the election, the New York Times reported Tuesday. Sessions has ties to at least two of the people who are reportedly under investigation.

The FBI is also separately examining intercepted communications between the Russian ambassador to the U.S. and former Trump National Security Adviser Michael Flynn, who served with Sessions as a member of the Trump campaign’s national security advisory council. The FBI interviewed Flynn days into the Trump presidency, according to The New York Times, and reportedly had concerns about whether he was entirely forthcoming. Lying to the FBI is a felony. If the FBI investigation into Flynn’s conduct turns up wrongdoing, Sessions could be responsible for signing off on the prosecution.

Flynn, who resigned as national security adviser on Monday, denies intentionally mischaracterizing his conversations with the Russian ambassador. The incident, he said in his resignation letter, was due to the “fast pace of events.”

Investigators are also reportedly looking into Trump’s former campaign chairman Paul Manafort, whom Sessions has known since the 1970s and communicated with frequently during the campaign. Manafort said in an email that he has never been contacted by the FBI and that he has never had any connection to Putin or the Russian government. He gave a similar statement to The New York Times but added, “It’s not like these people wear badges that say, ‘I’m a Russian intelligence officer.’”

Former foreign policy adviser Carter Page and Republican operative Roger Stone are also under scrutiny, The New York Times reported.

The FBI applied for a warrant from the Foreign Intelligence Surveillance Court last year to monitor several members of the Trump team as part of its investigation, The Guardian reported in January. If the FBI wanted to request another FISA warrant to monitor those individuals, it would likely have to get approval from Sessions.”
