Elected officials must act to prevent more migrant deaths

The United States has the resources to welcome new neighbors, but it is going to take cooperation, from the White House to the mayor’s office, to prevent further loss of life and improve safety for migrants.

It was heartbreaking to learn of the death of 5-year-old Jean Carlos Martinez Rivero, who had been living with his family at a privately contracted Chicago migrant shelter. This tragedy must be a wakeup call for all levels of government to start working together to protect people’s basic human rights at a time of increasing global humanitarian displacement.

For months, community members raised concerns about conditions inside the city’s shelters and volunteered to help better meet migrants’ basic needs. The accounts of life inside the shelter now coming to light are disturbingly similar to those that my colleagues at the National Immigrant Justice Center hear from clients held in immigration detention centers.

The city and the companies profiting from shelter contracts must be held accountable.

No doubt, the city has been forced to face the unprecedented challenge of welcoming thousands of new neighbors with minimal support from the federal government. The Biden administration and Congress must also be held accountable to repair the broken immigration system, support cities like Chicago that are welcoming migrants, and provide legal pathways so new arrivals have access to employment, secure housing and safety.

Jean Carlos’ death occurred at the same time the Biden administration and some U.S. senators are considering signing off on extreme anti-immigrant legislation in exchange for military aid for Ukraine and Israel.

The proposals under negotiation would create permanent new barriers to asylum protection and put U.S. immigrant communities at heightened risk of mass deportations. The proposals are structured to put Black, Brown and Indigenous communities at most risk.

Biden seems to have lost sight of his prior promises to defend immigrants’ rights, not to mention the U.S. government’s obligations to uphold international human rights law. Chicagoans should be holding our own Sens. Dick Durbin and Tammy Duckworth accountable to loudly oppose these proposals.

Unfortunately, accountability seems unlikely unless it happens at the ballot box.  The GOP has become the party of inhumanity, irresponsibility, and immunity. And, although the Biden Administration and “wobbly” Dems tend to avoid overtly dehumanizing asylum seekers with their language, their actions and attitudes too often mirror those of Trump, Miller, and the GOP nativists. Indeed, quite disgustingly, politicos of both parties appear to expect to harvest political gains from the blood of migrants!   🤮

The Senate is basically engaging in “bipartisan” negations to knowingly and intentionally violate domestic and international protection laws, abrogate constitutional due process, and increase the number of unnecessary deaths of asylum seekers. That arrogant politicos, on both sides of the aisle, although primarily the GOP, openly advocate for such actions shows just how little fear of any type of accountability they have. 

In many ways, that’s precisely the message that Trump and his MAGAmaniacs have been pushing — intentionally hateful and inflammatory language, followed by horrible, sometimes deadly, actions with little or no fear of any type of accountability.  Sadly, the Dems seem to think that a program of cowardly acquiescence, rather than principled opposition, is the key to political success.

rom the sands of the Sahel to the waters of the Mediterranean, from the wilderness of the Darien in Central America to the Bay of Bengal, millions of refugees and migrants journey along routes that are synonymous with desperation, exploitation and lost lives. As the heads of the two U.N. agencies that protect and support people on the move, we believe this is one of the great global challenges of our time.

The loudest political response has been to claim that only tougher action can resolve it. Most recently, a number European states have announced  plans to “offshore” or simply deport asylum seekers and/or make conditions around immigration and asylum more hostile.

Such plans are increasingly in vogue. They are also wrong. They overly concentrate on deterrence, control and law enforcement, and disregard the fundamental right to seek asylum. This approach is ineffective and irresponsible, leaving people stranded or compelling them to take even greater risks.

We do not want to understate the scale of the challenge created by today’s population movements. But to meet it, bigger thinking and bolder leadership are needed. The right strategy would tackle every stage of the journey, through a comprehensive and route-based approach of engagement. So, what should such a strategy look like?

First, we need to address the issues that compel people to leave home in the first place. Resolving conflicts, improving security, reinforcing human rights, providing sustained and reliable financial support to boost growth and resilience—all address the root causes of displacement and migration by investing in people’s futures. Failing to make these investments and cutting development aid are false economies.

Nonetheless, millions of people have no choice but to leave home—protracted conflicts, widescale rights abuses, intolerable poverty, and the devastating effects of climate change are just some of the causes. Yet the same point applies: offer hope and opportunity and people will take it.

Two ingredients are essential for our proposals to succeed: cooperation and real responsibility-sharing between governments, even in these divisive times; and attention to every part of the journey. An approach focused mainly on deterrence will fail—indeed, it is already failing.

During this Christmas season, GOP Nativists in Congress, their Dem enablers, and the Biden Administration are “debating” how many forced migrant men, women, and children should be killed, tortured, maimed, imprisoned, separated, or otherwise irreparably damaged at the U.S. Border to secure more bombs and weapons for foreign wars!  This is a monument for those who have died attempting to cross the US-Mexican border. “Offer hope and opportunity and people will take it!” That’s essentially what the Supremes said 35 years ago in the landmark decision INS v. Cardoza-Fonseca requiring a suitably generous interpretation and application of the international “refugee” definition that also governs asylum. 

Over the next several decades, slow but noticeable progress was made toward “realizing the full promise of Cardoza.” At one point, largely as a result of some Court of Appeals interventions, and a few positive BIA precedents granting asylum in the mid to late 1990’s, the “combined protection granted rate” for asylum, withholding, and CAT by EOIR, the primary precedent-setter and adjudicator of asylum law in the Executive Branch, exceeded 60% for those actually able to get to merits hearings in the somewhat haphazard system. 

However, over the past several Administrations most of that progress has been reversed, sometimes intentionally, other times negligently. The dysfunction, mounting backlogs, poor precedents, lack of asylum expertise, endless “any reason to deny gimmicks,” and the dreaded “Aimless Docket Reshuffling” have made a mockery of justice for asylum seekers at EOIR. It has also generated a tidal wave of failure and mindless attempts by the USG to evade the rule of law and their responsibilities to fairly adjudicate asylum claims that goes far beyond our borders.

None of the nativist, restrictionist, proposals now being discussed in the Senate would help this situation! Indeed, they would undoubtedly make everything worse in the long run! They will also compromise our national security and enrich and embolden human smugglers and cartels. Nativist deterrence is definitely a “lose-lose proposition” even if many U.S. politicos are unwilling or unable to admit that!

In many ways, the “head in the sand” approach of prosperous nations to human migration reminds me of their past attempts to deny or ignore the effect of climate change — something that is directly related to forced migration and not adequately addressed by the post WW II refugee framework.

I was heartened to see among the recommendations in this article:

But this is not just about policies and strategies. It means engaging more closely with the people in mixed movements, such as offering practical and legal advice on accessing protection, to guidance on applying for third-country options. Such a chain of engagement might require new, bespoke models of collaboration but, if done strategically, would address a range of situations.\

This supports the recent proposal that Retired Wisconsin Judge Thomas Lister and I published on “Courtside” for the creation of a volunteer group of “Judges Without Borders” (“JW/OB”). https://immigrationcourtside.com/2023/12/13/%F0%9F%91%A9%F0%9F%8F%BD%E2%9A%96%EF%B8%8F%F0%9F%91%A8%F0%9F%8F%BB%E2%9A%96%EF%B8%8F-%E2%9A%96%EF%B8%8F%F0%9F%97%BDjudges-without-borders-an-innovative-op/

Volunteer retired judges from various State and Federal systems could potentially assist the USG and NGOs by advance screening applicants, inside and outside the U.S., for asylum with an eye toward helping individuals make good choices and directing those unable to meet the current refugee and asylum criteria to humane alternatives. It’s exactly the type of new, creative, “model of collaboration” (and cost efficiency) that the authors recommend!

Given the current state of the world, with active wars on several fronts, and many corrupt and/or repressive governments, it’s highly likely that forced migration will continue to increase in the foreseeable future. That makes it essential that developed nations work with each other and humanitarian experts on viable, durable solutions that recognize the complexity, the opportunities, and the inevitability of human migration. 

On Meet the Press today, Sen. Lindsey Graham (R-SC) spouted virtually every “border myth” in the book, without much effective pushback from moderator Kristen Welker. In particular, Welker continued her practice of not featuring any experts who actually work with forced migrants at the border. Meanwhile, Graham was unwilling to condemn Trump’s Hitlerian language about immigrants “poisoning the blood” despite numerous opportunities by Welker for him to do so.

What Graham didn’t do, and Welker didn’t press him on, was establish any connection between eliminating asylum and either reducing terrorist threats or fighting drug smuggling which has been shown time and again to have little or nothing to do with individuals struggling to get appointments through “CBP One” or turning themselves in to CBP upon entry to submit to asylum screening.

Additionally, Graham continued to repeat, without evidence (other than one lame anecdote), the nativist claim that almost nobody coming to the border has a legitimate fear of return. That contradicts almost all reports from those who actually work with forced migrants at the border and elsewhere. It’s also remarkable because the vast majority of those who have been allowed into the U.S. in the past year have not had an opportunity to document and present their claims in the fair merits hearing required by law. Yet the “border debate” remains largely one-sided and reality free!

That’s not to minimize the failure of the Biden Administration to heed expert advice and make major administrative, personnel, and expertise changes in the asylum adjudication system and the Immigration Courts on “Day One.” Nor does it excuse their failure to set up an organized, mutually beneficial, system for resettling those screened the into the country away from border points of entry.

Again, the absence of coherent rational discussion of asylum adjudication by experts by Meet the Press and other so-called “mainstream media” is both telling and disturbing. Certainly, internationally-recognized experts like Filippo Grande and Amy Pope must be available to Welker. Why don’t we ever hear from them?

Demand that Congress and the Biden Administration stop the toxic nonsense of “trading” the lives and rights of forced migrants for bombs and weapons to fight foreign wars. It’s time to get serious about developing immigration and refugee policies that operate in the “real world” of human migration, eschew expensive, cruel, proven to fail “deterrence only,” and give primacy to the humanity and rights of migrants and the opportunities they present for our world’s future!

WASHINGTON — An immigration judge and lawyer told a U.S. Senate Judiciary panel on Wednesday that an independent immigration court would help ease a  backlog of more than 2 million pending cases.

Because the immigration court system is an arm of the U.S. Justice Department — the Executive Office for Immigration Review — each presidential administration has set immigration policy, and often those courts are subject to political interference, said Mimi Tsankov, an immigration judge, and Jeremy McKinney, an immigration attorney.

In the immigration court system, judges hold formal court proceedings to determine whether someone who is a noncitizen should be allowed to remain in the United States, or should be deported.

“Every administration has interfered with the courts. This undermines the courts’ integrity, and many of the executive branch’s manipulations of judges and their dockets simply backfire,” said McKinney, the former president of the American Immigration Lawyers Association.

Tsankov, the president of the National Association of Immigration Judges, said in order to alleviate the backlog of immigration court cases, Congress should establish an independent immigration court under Article I of the U.S. Constitution.

“An independent board will begin the process of healing this broken system,” she said.

The witnesses also argued that many people going through the immigration system lack legal representation, which can greatly impact their outcome.

The top Republican on the Senate panel, John Cornyn of Texas, argued that most cases are without merit, as opposed to asylum cases, which are based on a credible fear of death or harm. He said that people are “clogging the courts” and are aware the severe backlogs will allow them to stay in the country. Some courts have backlogs until 2027.

Sen. Mazie Hirono, Democrat of Hawaii, pushed back.

“People who have attorneys are 10.5 times more likely to be granted relief,” she said. “So it is when they have attorneys that they can proceed with their asylum claims.”

She added that another issue is that many children who are unaccompanied, even some toddlers, are expected to legally represent themselves.

“There is no guarantee that children will also have a lawyer, and this is alarming because children are some of the most vulnerable people in our immigration system,” she said.

Cornyn said he did not believe that “the taxpayer should be on the hook” for paying for legal fees and representation.

McKinney said that those who have representation and are not detained are five times more likely to gain relief. Immigrants who are detained and have legal representation are 10 times more likely to be granted relief than those who do not have representation.

“The point is that representation ensures due process,” he said. “It also makes the system more efficient when all the parties know the rules and know how to present a case. Cases move faster.”

In his opening statement, ranking GOP Sen. Cornyn made it very clear that fixing the Immigration Courts is a nonstarter for the GOP. 

Instead of engaging on this critically important initiative, he wasted much of his introduction disingenuously repeating the oft-debunked claim of a connection between asylum seekers and fentanyl smuggling. Obviously grasping at straws, in the absence of any empirical support for his nativist “scare scenario,” Cornyn went so far as to suggest — of course without a shred of evidence — that perhaps “go-arounds” were smuggling fentanyl. 

This theory appears particularly questionable in light of evidence that most fentanyl is successfully smuggled through ports of entry by U.S. citizens and legal residents. Why would cartels abandon proven successful methods of port of entry smuggling to entrust their cargos to individuals who might not even survive the border crossing and, if apprehended, would certainly be searched? Cornyn had no answer.

What does seem likely is that by concentrating border law enforcement largely on “apprehending” and fruitlessly trying to “deter” those merely seeking to turn themselves in to exercise legal rights, the USG has diverted attention and resources from real law enforcement like an anti-fentanyl strategy. That almost certainly would require undercover infiltration of smuggling rings — dangerous and sophisticated law enforcement operations far removed from “apprehending” folks who WANT to be caught because they were forced to leave their home countries, are unsafe in Mexico, and can’t wait to schedule asylum appointments at ports of entry through the badly flawed and inadequate “CBP One App!” Building a fair and efficient asylum system should even help CBP apprehend more of Sen. Cornyn’s “go arounds!”

But, Cornyn’s misdirection isn’t just a distraction; it’s actually dangerous! As the GOP has shown over and over, if you repeat a lie or myth enough times, folks start to believe it. Witness the demonstrably totally frivolous claims of election interference that drive much of the GOP’s agenda and has become “truth” for their misguided “base.”

A case in point is the outrageous political boondoggle recently carried out by Virginia’s right-wing Governor Glenn Youngkin. In response to Texas Gov. Greg Abbott’s White Nationalist plea, Youngkin wasted two million taxpayer dollars on a bogus detail of the National Guard to the Texas border, ostensibly to “protect Virginians from the scourge of fentanyl.”

However, a recent NBC 4 DC investigative team report showed that the Guard encountered no fentanyl at the border!  They accomplished nothing notable except to deny thirsty migrants they encountered water — on orders from Abbott’s troops! As we often say, “The cruelty is the point!”

What if Youngkin had spent the same amount of money supporting NGOs in Virginia struggling to resettle and represent migrants aimlessly bussed to the DMV by Abbott and DeSantis as part of a political stunt? Community social justice NGOs generally use funds more carefully and efficiently than GOP blowhards like Youngkin and co.

The GOP claim that most asylum claims are frivolous also is misleading. For those who can actually get a merits hearing on asylum at EOIR — often in and of itself no mean feat given the prevalence of “Aimless Docket Reshuffling” — TRAC statistics for FY 2022 show that 46% are granted. See https://trac.syr.edu/whatsnew/email.221129.html#. And, this is in a system that is still heavily tilted against asylum seekers. EOIR still has many “holdover judges” from the Trump years who were hired not because of their expertise, qualifications, or reputations for fairness, but because their backgrounds indicated that they were likely to be unsympathetic to asylum seekers!

Moreover,  contrary to myth, the vast majority of represented asylum seekers show up for their immigration hearings. See, e.g., https://www.americanimmigrationcouncil.org/news/11-years-government-data-reveal-immigrants-do-show-court.

Admittedly, the manner in which EOIR keeps asylum statistics can make meaningful analysis difficult. For example, more than half of asylum “dispositions” are listed as “other” — which covers  “abandoned, not adjudicated, other, or withdrawn,” a facially, at least partially, circular definition! Moreover, since EOIR procedures generally require that all potential relief be stated at the time of pleading or presumptively be waived, prudence requires that the right to appply for asylum be protected, even if it is unlikely that the case will proceed to the merits on that application.

Also, it’s worth remembering that the Government already has a powerful tool for both identifying and quickly tossing frivolous asylum claims and expeditiously granting clearly meritorious claims to keep them out of the Immigration Court. It’s called the Asylum Office at USCIS! That despite much ballyhooed regulatory changes, DHS has failed to obtain “maximum leverage” from the credible fear/Asylum Office process is not a reason for eschewing EOIR reform!

What we can tell from the available data is that, rather than wasting more money on expensive and ineffective “deterrence gimmicks,” the best “bang for the buck” for the USG would be to invest in representation for asylum seekers and in a better, professionally-managed EOIR with better, independent judges, acknowledged experts in asylum law, who could “keep the lines moving” without denying due process or stomping on individual rights. They could also set helpful precedents for the Asylum Office. That’s what Congress and the Administration should be investing in.

Reforming the Immigration Courts and creating an independent Article I Court should be a high national priority. While no single action can bring “order to the border” overnight, fixing EOIR is an achievable priority that will support the rule of law and dramatically improve the quality and efficiency of justice at the border and throughout the U.S.

As Chairman Padilla (D-CA) said, this should be a bipartisan “no-brainer.” Just don’t look to today’s White-Nationalist-myth-driven GOP for help or rational dialogue on the subject.

I always tell the new immigration attorneys at Immigrant Defenders Law Center to never forget just how stacked against our clients the odds are in immigration court. Today was a classic example.

Went in with a case that we have spent weeks on end prepping for, seeking asylum protection for our client. We extensively argued our case. Govt attorney waived arguments & had no filings for today, last filing they made in case was in 2020. Yet the judge found that despite a finding of past persecution the govt had rebutted the presumption of a well-founded fear of future persecution.

So the govt atty who didn’t make an argument, who didn’t file anything was found to have successfully rebutted our claims. We plan to appeal, but the imbalance of power in an immigration courtroom, even when someone has an attorney, is profound. Without an attorney it is inhumane.

At the end of the hearing the judge excused the ICE attorney so he did not have to stay through the oral decision. So we sat there, with our client wiping tears from his eyes, and received the decision. We took notes on its mistakes. We reserved the right to appeal.

And I felt this pit in my stomach knowing that my client was seeing his life flash before his eyes, knowing this put him in grave danger. And yet the ICE atty, one of the principal ppl responsible for putting him at risk, couldn’t even bother to stay to the end of the hearing.

A very sad commentary on the “culture of denial” still prevalent at EOIR and Garland’s failure to address it head on. Seems like the ACC knew how the judge would rule in advance. 

I actually remember a long-ago time at the USDOJ when a “win” was “when justice was done” not just “another denial and deportation notched.” As a few “old timers” might remember, I actually incorporated it into my “welcoming speech” to new INS trial counsel when I was the Deputy General Counsel/sometimes Acting GC at the “Legacy INS.” In a GOP Administration, no less!

Times have changed, I guess, to where a Dem Administration and a Dem AG function “below the Reagan line!” Interesting, yet depressing!

The IJ “excusing” the ACC from the oral decision — at least a violation of judicial etiquette, disrespectful, and unprofessional, if not marginally unethical — shows just where things stand in a system run by a former Federal Judge who has forgotten what justice and public service are all about — at least when it comes to those stuck in his dysfunctional and unprofessional “courts!”

I always insisted that both counsel be present for the delivery of an oral decision. If that were impossible, because of time constraints or a legitimate personal emergency, then the obvious solution was to either 1) issue a written decision, or 2) invite the parties to return another day to listen to the oral decision. A third option was to record it “in chambers,” and have a JLC or intern transcribe and edit it for issuance as a written decision. I actually noticed when the INS ACC was working on the files for the next case or “secretly” looking at an i-phone under counsel table while I was dictating the oral decision. While I didn’t mention it, it did “inform” my opinion of them as attorneys.

Unfortunately, I wouldn’t count on Garland’s Trump holdover BIA to correct the egregious injustices on the merits of this case. The appeals system is also “programmed to deny and deport” — just as Sessions and Barr constructed it! 

One might have thought that a Dem Administration and a former Federal Judge would be interested in bringing due process, fundamental fairness, and decisional excellence to one of the most important Federal “Court” Systems — one they totally control! Not so! This is most disappointing and enraging, particularly for those practicing in the “skewed against the individual” mess that Garland tolerates and enables!

The unprofessional, disgraceful performance of EOIR described above, and the inexcusable failure to “clean house,” bring in qualified expert judges and professional judicial administrators, and support and institutionalize competent expert judging at EOIR, as represented by Judge Burgie and some others, would be disgraceful in ANY Administration! Coming during a Democratic Administration that RAN ON A PLATFORM of ending xenophobic, extralegal, nativist-motivated abuses directed at asylum seekers (often of color), immigrants, and their courageous, dedicated attorneys is totally unacceptable!

Yet, Senate Dems have failed to haul Garland and his lieutenants before the Senate Judiciary Committee to be confronted by those abused on their watch and to answer for their abject failure to bring due process, fundamental fairness, best practices, and competent, expert judicial decision making to EOIR’s dystopian, dysfunctional, and outrageously unfair “faux courts!”

As Lindsay says, “I always tell the new immigration attorneys at Immigrant Defenders Law Center to never forget just how stacked against our clients the odds are in immigration court.” It does NOT have to be this way! 

These are NOT life-tenured Article III judges! They are, as the DOJ is constantly reminding them, “DOJ attorneys.” GOP Administrations have demonstrated time and again the recognition that they have the power to “purge” judges who stand up for immigrants’ rights and due process and to “stack” the Immigration Courts against asylum seekers and immigrants. 

Garland has the power to do the opposite: “unstack” EOIR, bring in qualified judges and administrators who are recognized, respected experts in immigration law, human rights, and due process, and create a “model Federal Judiciary” and a source for future experienced, well-qualified Article III appointments.

In nearly two years of inept and dilatory “administration” of EOIR, Garland has failed to achieve, or indeed even attempt, these essential, long-overdue reforms. Indeed, so poorly has he performed on immigration, human rights, equal justice, and racial equity, that many dedicated immigration practitioners tell me that things are markedly worse now for due process and fair judging at EOIR than at the end of the Trump Administration. The late Senator Bill Proxmire (D-WI) was a ”good government activist,” famous for his monthly “Golden Fleece Awards!” 🏆🐑 The latter were presented to recognize, or more accurately expose, “the biggest, most ridiculous or most ironic example of government spending.” 

Proxmire was Wisconsin’s longest-serving U.S. Senator (1957-89), having been elected in a 1957 special election to replace the infamous Sen. Joe McCarthy (R-WI) who died in office. (1957 was the year the then Milwaukee Braves beat the mighty NY Yanks to bring Milwaukee what remains its only World Series Championship. We were allowed to listen on the PA system at Washington Grade School, in Wauwatosa, where I was a student!) 

According to his Congressional bio, “Proxmire also set an attendance record not likely to be beaten. Over a period of more than 20 years, he did not miss a single roll-call vote, casting 10,252 consecutive votes before leaving the Senate in 1989.” https://www.senate.gov/senators/FeaturedBios/Featured_Bio_ProxmireWilliam.htm. (Actually, the record was recently broken by Sen. Chuck Grassley (R-IA), sort of, as Grassley eclipsed Proxmire’s years of service, but cast thousands fewer votes, thanks to Congress’s lackadaisical approach to governing in recent years.)

He also famously won contested re-election in 1976 spending under an inflation adjusted $1,000! “He relied upon retail politics — selling himself to Wisconsinites by shaking hands and listening to their stories — to fuel his reelection bid.” https://captimes.com/content/tncms/live/. Proxmire was a rare pol who “walked the walk!”

Sen. Proxmire left the Senate well before the creation of DHS. But, he would have had a field day with entrenched bureaucracy, lack of creativity, and spendthrift ways that have become ingrained in DHS’s poor to pathetic delivery of public services. USCIS lost its way under the malicious incompetence of the Trump Administration and such stunningly unqualified   “leaders” as Ken “Cooch Cooch” Cuccinelli. But, it has continued to “wander in the wilderness” under Biden.

David “hits the nail on the head”: with these two paragraphs:

USCIS is charging more money for less efficient work. It is not surprising that it is taking adjudicators much longer to process forms because the length of the forms keeps growing. The average form length has increased from about 3 pages in 2003—when the agency started—to about 10 pages in 2022.

USCIS should be eliminating the number of required applications and streamlining the process through electronic filing. The “discounts” for online filing that it plans on introducing hardly compensate applicants who must spend much more time using USCIS’s difficult online application portals, and regardless, online filing will remain unavailable for many types of forms. USCIS is moving too slowly to create a modern immigration system.

I’ll bet that with his brilliant mind and work ethic, Eric Holder could actually substantially improve on the alleged 13.2 minute average “adjudication” time for Form I-765.

The EAD is probably the most egregious example of an out of control bureaucracy that charges more for less service and complicates, rather than simplifies, a routine “no-brainer/low risk” function. Even the current $410 fee for an EAD is a ripoff that should be generating tons of excess cash for USCIS. Given the incomprehensible EAD backlog, in fact, the public has paid for lots of “service” that has never been “delivered.” 

In private industry, that would be a “red flag” for potential fraud, waste, and abuse. If there were a “Better Business Bureau” for the bureaucracy, USCIS be in hot — no boiling — water! 

Actually, the DHS IG and the GAO are supposed to perform this function for the Government, but have been largely “MIA” on the rapid downward spiral of the immigration bureaucracy over the past decade! In any event, nobody appears to pay much attention to their reports. They are issued, covered initially by the media, the subject of a few “political sound bites,” and then buried and forgotten (except, perhaps, by historians and scholars). 

DHS needs new creative management, an emphasis on public service, and some close oversight (something Dems conveniently ignored while they had “unified control” of Congress). Most of us “get” that Trump and his flunkies intentionally destroyed what passed for “service” at USCIS. But, that was a well-known fact going into the 2020 election.

After two years in office, whining about what the Trump kakistocracy did or didn’t do, and pointing to Congress’s undoubted dereliction of duty, is getting old. Very old!

The Biden Administration needs to get new leadership into the dysfunctional immigration bureaucracy at DHS, DOJ, DOL, DOS, & other agencies. That must be leadership with a vision, courage, expertise, and a determination to deliver great public services in a competent, timely manner without “breaking the bank” or further blaming, shaming, punishing, or burdening the public “victims” of failed government.

Additionally, the out of touch “Miller Lite Brew Crew” that passes for immigration, human rights, and security advisors at and to the Biden White House needs to be replaced with practical experts who can get the job done without breaking laws and resorting to “built to fail” gimmicks. 

Perhaps Senate Dems need much more of “Sen. Bill Proxmire’s Ghost” 👻 and far less tolerance for “Miller Lite thinking” among Congressional Dems and the Biden Administration!

Undoubtedly, once they get rolling, the “GOP Clown Show” 🤡  in the House will provide lots of unwanted “oversight” to Mayorkas and Garland. But, given the GOP’s toxic record on immigration, it’s highly unlikely to focus on solving any of the REAL problems in the immigration bureaucracy, nor will it promote better public service — something simply not in the GOP lexicon these days.

Democrats were projected to retain control of the Senate on Saturday, clinching a narrow majority as they showed strength in battleground races in a daunting midterm year that handed President Biden a major victory as he looks to his next two years in office.

The final blow to Republican hopes of retaking the chamber came in Nevada, where on Saturday Sen. Catherine Cortez Masto (D) was projected to win reelection, edging past Adam Laxalt (R), a former state attorney general. Cortez Masto’s projected win ensures Democrats a 50th seat, with a runoff election still to come in Georgia on Dec. 6. Vice President Harris is empowered to cast tiebreaking votes in the Senate.

Control of the House was still up in the air on Saturday, as vote counting continued days after an election in which Democrats overperformed expectations in many contested areas across the country. Democratic control of the Senate dashes GOP hopes of a full takeover on Capitol Hill.

That’s welcome news for Biden, who was staring down the possibility of humbling defeats as the election neared. Now, the Senate, which oversees the confirmation of executive branch personnel and federal judges, will stay in his party’s corner. A Senate majority will also give the president and his party more say over legislative debates on domestic and foreign spending and other major issues.

Senate Majority Leader Charles E. Schumer (D-N.Y.) called the results a “vindication” for Democrats and their agenda, and said Republicans had turned off voters with extremism and “negativity,” including some candidates’ false insistence that the 2020 election had been stolen. “America showed that we believed in our democracy,” he told reporters in New York, while praising the quality of Democratic incumbents.

Cortez Masto announced she would deliver a victory speech on Sunday.

In Nevada, Cortez Masto’s win was part of a perfect record so far by incumbent senators seeking reelection in the midterms, as voters tilted strongly against upending the established order in the chamber. It was part of a strong showing by Democrats in battleground areas where Republicans fell short after emphasizing rising prices and concerns about crime during an era of one-party control in Washington.

Importantly, Biden & Sen. Chuck Schumer will retain authority to appoint better qualified, progressive, Federal Judges from diverse backgrounds, schools, and experiences to counteract the toxic influx of poorly qualified far-right jurists, many ideologues hand-picked by the Federalist Society and the Heritage Foundation for their extremist, anti-democracy, far right views that threaten the credibility and the legitimacy of the Federal Judiciary. 

Biden’s & Schumer’s attention and success at timely appointing and advancing exceptionally well-qualified Article III judges whose views support and advance the rule of law, equal justice for all, and reasonable legal interpretations has been one of the “under the radar” success stories of his first two years. For once, if perhaps a little late in the game, the Dems have treated Federal Judicial appointments with the same urgency, strategic thinking, and determination to fundamentally reshape the judiciary as the GOP!

If only Garland had paid the same attention to reforming, improving, and reshaping the Immigration Judiciary to make expertise, due process, fundamental fairness, and best judicial practices paramount after four years of highly questionable judicial appointments and “packing” of the BIA  by Sessions and Barr in support of their nativist, anti-immigrant agenda!

Senator Cortez Masto’s victory also saves America from another round of Sen. Mitch McConnell (R-TN) as majority leader. Additionally, it’s a well-deserved setback for arrogant GOP Senate campaign honcho Rick Scott (R-FL) — a guy whose idea of America is to block all progress, steal from the poor, give to the rich, and never give an honest answer.

All and all, it’s a good night for American democracy, although the narrowness of Dem victories despite the obvious superiority of Dem candidates should serve as a warning sign that our nation is not out of the “far-right woods” by any means. Next, it remains critically important for the Dems to re-elect Sen. Raphael Warnock (D-GA, an outstanding and articulate spokesperson for democratic values over the spectacularly incoherent and unqualified Trump-backed GOP challenger Herschel Walker in December’s Georgia runoff. A one-vote “cushion” is critical in the event of death or incapacity of any of the Dem Senators.

Importantly, voters across America rejected every corrupt Trump election denier running on the GOP ticket for positions that would have given them control over state elections.

The thread running through Whitehouse’s spoken essays is that the current 6-3 conservative majority on the court is no accident but the product of special interests and dark money – hundreds of millions of dollars in anonymous hidden spending.

The special interests are able to groom young judges, promote them in advertising campaigns and then try to influence them in legal briefs, all lacking in transparency. The outcome is a dire threat to the climate, reproductive rights and myriad issues that touch people’s everyday lives.

Whitehouse chose his title carefully. “It implies that this is not random,” he says. “This is not just, ‘Oh, we’re conservatives, and so we’re going to appoint conservative thinking judges,’ which is the veneer. They would like to maintain this is just conservatives being conservatives.”

Whitehouse suggests that the model of “agency capture”, when an administrative agency is co-opted to serve the interests of a minor constituency, was applied to the supreme court. “Once you’re over that threshold of indecency, it actually turned out to be a pretty easy target. The other construct to bear in mind is covert operations, because essentially what’s happened is that a bunch of fossil fuel billionaires have run a massive covert operation in and against their own country. And that’s a scheme.”

Democrats have been criticised for being complacent as Republicans unspooled their 50-year campaign to capture the courts. Whitehouse agrees. “It’s way late. It’s really embarrassing how we let this dark money crowd steal a march on us.”

He observes: “From a political perspective it never mattered as much to the Democratic base as it did to the Republican base because we did not have the history of Roe versus Wade, Brown versus Board of Education [desegregating public schools] decisions that provoked massive cultural objections on the far right.

“So they got highly motivated and we did not but then once we saw this machinery begin to go in operation to capture the court, we never bothered to call it out either. It’s not just that our base didn’t care as much. It’s that we were sleeping sentries.”

Whitehouse is planning at least three or four more speeches about The Scheme. Like his climate series, he hopes that the message will get through: it is time to wake up.

“I hope there’ll be a more general understanding that what’s going on at the court has a lot less to do with conservatism than it has to do with capture and, with any luck, it might cause a bit of an epiphany with some of the judges that they don’t want to be associated with what they’re actually associated with. And the American public will see it for what it is and give us in politics more opportunities to administer a repair.”

Sen. Whitehouse’s reference to “agency capture” is a perfect descriptor of what has happened at EOIR and in our Immigration Courts. Remade, co-opted, and weaponized by Miller, Sessions, Barr, and Gene Hamilton during the Trump regime, the Immigration Courts now represent a nativist/restrictionist culture, philosophy, and approach to justice, including racial justice, that is far, far out of the legal mainstream.

It’s so far out of the mainstream that even the most conservative circuits and Trump judicial appointees occasionally hand Garland’s poorly performing BIA “its head” on sloppy, poorly reasoned, substandard performance. It’s also light years away from the restoration of the rule of law and humane values promised by Biden and Harris during their 2020 campaign!

“Agency capture” appears to be a “GOP specialty,” that Democrats lack. How many key immigration officials, political or “career,” at DHS and DOJ were “Obama holdovers?” How long did the few who weren’t replaced at the outset last? How much influence did they retain or exercise? Yet, Garland continues to operate the Immigration Courts with largely the same toxic culture and badly flawed personnel he inherited from Sessions and Barr. Nonsensical? Disgraceful? Dumb? You bet!

The situation is aggravated many times over because these aren’t “normal agency decisions.” No, they are essentially life or death decisions in a “traffic court setting” that affect humanity, our future as a nation, and often “dribble over” into discriminatory and biased approaches to minority populations and rights outside the field of immigration!

Another serious aggravating factor is the astoundingly dysfunctional and incompetent “Byzantine Empire Style” agency bureaucracy at EOIR which bears no resemblance to competent, professional court management and administration. 

Not surprisingly, the latter are outside the DOJ’s skill set. Shockingly, however, A.G. Garland failed to “recognize the obvious” and to bring in the needed outside professional experts to straighten it out. 

Even worse, although he essentially “wholly owns” the broken, anti-due-process immigration “judiciary,” Garland has ignored experts’ calls for replacement of the current precedent-setting BIA with judges who are recognized leaders and role models in due process and human rights in the immigration context. 

Nor has he actively recruited and appointed enough experts with NGO, clinical, and other private sector backgrounds to Immigration Judge positions. Further, he has failed to develop and implement a transparent, merit-based judicial selection and retention program to “re-compete” the many “new” IJ positions that were created and maliciously used by Sessions and Barr to “pack” EOIR with anti-asylum bias, often involving judges without expertise or with disturbingly thin due-process/fundamental fairness credentials. 

Developing a fair, transparent, merit-based system, with outside input, to weed-out underperforming judges in a competitive process and, where warranted, to replace them with some of the brilliant and high-achieving immigration/human rights potential judicial talent now “out there in the market place” but largely ignored by the Biden Administration should have been high on Garland’s list. The process and criteria by which these life or death judicial positions are filled remains largely a mystery shrouded in opaque bureaucracy and with no input from those who actually have to practice before EOIR or who have been researching and documenting the abject, deadly failures of the current system! 

With due respect, I think Senator Whitehorse needs to focus some of his attention and ire on the disgraceful performance of the U.S. Immigration Courts under Garland. Unlike the Article IIIs, this Federal Court system could and should have been majorly reformed, restructured, and vastly improved with a more enlightened, courageous, due-process oriented approach by DOJ.

Why doesn’t Senator Whitehouse call up his former Senate colleague VP Harris, who has done a “disappearing act” on immigration and human rights following her tone-deaf excursion to the Northern Triangle? Is he teaming with Chair Lofgren to introduce the Senate version of her Article I Immigration Court Bill? Some of the foregoing could be even more effective in “raising consciousness” and promoting constructive reform than giving speeches to an empty Senate Chamber!

The result of a reformed U.S. Immigration Court should be a “Model Federal Judiciary” — one laser-focused on fairness, scholarship, timeliness, respect, teamwork, due process, fundamental fairness, and best practices! Indeed, that’s what all Federal Courts should be, but are not right now. Not by a long shot! 

The Immigration Courts could and should be a training and development ground for a diverse, high-functioning, practical, due-process-oriented Federal Judiciary all the way up to the Supremes — where failure by right-wing ivory-tower jurists who live “above  the fray” to understand the reality of our broken Immigration Courts and to courageously vindicate the legal, constitutional, and human rights of abused and vulnerable migrants is literally destroying our republic. 

That Garland and the Biden Administration generally are squandering this opportunity is as inexplicable as it is inexcusable! Perhaps Sen. Whitehouse can “light a fire!” 🔥

Sens. Cory Booker (D-N.J.) and Alex Padilla (D-Calif.) on Sunday made history with their appointments to lead two separate Senate subcommittees.

The Senate Judiciary Committee, headed by Sen. Dick Durbin (D-Ill.), announced Booker will chair the subcommittee on criminal justice and counterterrorism. He’s the first Black chair of a Senate Judiciary subcommittee.

The committee also announced Padilla will chair the subcommittee on immigration, citizenship and border safety ― the first Latino to do so. He became the first Latino senator from California last month when he took over Kamala Harris’ seat as she assumed the vice presidency.

In a statement Sunday, Padilla said he’s honored by the historic appointment, noting his roots as the “proud son of immigrants from Mexico.”

“While no state has more at stake in immigration policy than California, the entire nation stands to benefit from thoughtful immigration reform,” Padilla said. “I commit to bringing the urgency to immigration reform that this moment demands and millions of hard working immigrants have earned.”

“Urgency” on immigration and human rights is exactly what’s needed and has been sorely missing from Dem leadership in the past. There is nothing more “urgent” than insuring immediate comprehensive Immigration Court reform at the DOJ, eventually leading to the creation of a progressive, independent, Article I Immigration Court.

Without dramatic Immigration Court reforms, most other immigration reforms will prove to be sporadic, inconsistent, and ineffective. Somebody has to insure that the Executive Branch complies with due process and other legal requirements. That’s been totally lacking over the past four years, and has also been problematic in past Dem Administrations!

Without addressing the institutionalized dehumanization inflicted on people of color (“Dred Scottification”) by the immigration system, there will be no real racial justice in America!

Trump attacks on immigration system raise serious concerns about safety during pandemic

More than 1,000 people in immigration detention have tested positive for COVID-19, and five have died

 

Washington, DC – Today, Senators Sheldon Whitehouse (D-RI), Dick Durbin (D-IL), and Mazie Hirono (D-HI) led a Senate request to the top congressional watchdog to investigate the practices of the Executive Office of Immigration Review (EOIR) under President Trump, including its management of immigration courts during the current COVID-19 pandemic.  In a letter to the Government Accountability Office (GAO), the senators raise concerns first voiced to the Justice Department in February about mismanagement of the EOIR under Attorney General William Barr, as well as the Trump administration’s regulatory and procedural changes at the Justice Department that have curtailed the independence of immigration courts.  The administration’s mismanagement of and meddling with the immigration courts – done in the name of “efficiency” – are particularly troubling during the COVID-19 pandemic, when an overburdened system can lead to unsafe practices that place individuals at grave risk and jeopardize due process, the senators write to the GAO.

 

“While the Trump administration has justified its incursions into the independence of immigration courts as efficiency measures, legal service providers have explained that EOIR’s response to the COVID-19 pandemic demonstrates how the agency can use seemingly neutral measures to tip the scales of justice against noncitizens,” the senators write.  “In order to defend themselves in immigration court, noncitizens must file motions and other papers in person at physical court locations; obtain counsel; meet with their attorneys; present testimony from family members, employers, and/or expert witnesses; and provide medical records, tax records, and other supporting documents.  Yet COVID-19 makes these actions potentially dangerous.”

 

Joining Whitehouse, Durbin, and Hirono in the request to the GAO are Senators Dianne Feinstein (D-CA), Patrick Leahy (D-VT), Amy Klobuchar (D-MN), Chris Coons (D-DE), Richard Blumenthal (D-CT), Cory Booker (D-NJ), and Kamala Harris (D-CA).

 

The senators continue in their letter to GAO, “Immigration courts are now reopening around the country, including in areas that are seeing increases in the number of COVID-19 cases.  Because EOIR does not have consistent policies for when attorneys, let alone translators or witnesses, may appear telephonically or by video, participants often must appear in person or not at all.  Immigration courts have continued to issue in absentia orders of removal for noncitizens who do not appear, even when the likely cause is COVID-19.  Nor has EOIR uniformly extended deadlines or continued cases, despite the difficulty noncitizens face in finding and consulting with counsel, obtaining and filing necessary documents and evidence, or securing the appearance of witnesses.  These difficulties are particularly acute for detained clients, who have limited access to phone calls and attorney visits.  As a result, noncitizens cannot obtain counsel or litigate their cases, and attorneys cannot effectively represent their clients.”

 

The Trump administration’s management of the immigration system has come under close scrutiny during the COVID-19 crisis.  Reports suggest immigrants face a range of unsafe conditions and practices as a result of Trump administration management decisions, including the detention of children using unaccountable private contractors.  More than 1,000 people in immigration detention have tested positive for COVID-19, and five people have died.

We are writing to request that the Government Accountability Office (GAO) analyze and audit the Executive Office of Immigration Review’s (EOIR) practices with respect to the hiring, training, and evaluation of immigration judges and staffing of immigration courts, as well as their management of these courts during the current COVID-19 pandemic.  GAO’s insight will help Congress determine if additional legislation is necessary to address these issues, as well as inform appropriations decisions.

In February, we wrote to Attorney General William Barr to express our concern that the Trump administration is undermining the independence of immigration courts.  As outlined in that letter, attached, we are concerned about the mismanagement of EOIR and troubled by regulatory and procedural changes within the Department of Justice (DOJ) that have curtailed the independence of immigration courts.  Although more than six months have passed, we have not received a response from DOJ or EOIR.  Instead, in that time, EOIR has continued to use its administrative powers to put its thumb on the scale of justice.  Most recently, EOIR attempted to buy out all nine career Board of Immigration Appeals judges who had been hired in prior administrations.[1]  When the judges refused, they were reassigned to new roles.[2]

EOIR’s facially-neutral policies during the COVID-19 pandemic have raised systemic due process concerns.[11]  Immigration judges, staff, and litigators have also expressed concerns about the health risks to them and the litigants who appear in immigration courts.[12] Given GAO’s prior work on immigration courts,[13] it is uniquely suited to conduct an audit and analysis of EOIR.  We ask GAO to look into the following questions:

  1. What criteria does EOIR use to hire immigration judges and Board of Immigration Appeals judges?  What criteria does EOIR use to determine the number of deputy chief and other management positions for judges, and what criteria does EOIR use to hire for these positions?  To what extent does EOIR assess its immigration judge and Board of Immigration Appeals judge hiring efforts?  What, if any, challenges has EOIR encountered in recruiting and retaining immigration judges and Board of Immigration Appeals judges?  How, if at all, has it addressed them?
  2. How does EOIR determine targets for immigration court and Board of Immigration Appeals case completion time frames and caseloads?
  3. To what extent has EOIR assessed its immigration court and Board of Immigration Appeals staffing needs? What have any such assessments shown?  How do current immigration court staffing levels compare to staffing needs EOIR has identified?
  4. How does EOIR assess immigration and Board of Immigration Appeals judge performance?
  5. To what extent has EOIR assessed immigration judge and Board of Immigration Appeals judge training needs? What have any such assessments shown?
  6. How has EOIR’s use of video teleconferencing changed since GAO last reported on it in 2017?  What, if any, data is EOIR collecting on hearings using video teleconferencing and the effects of that technology on hearing outcomes?
  7. How do EOIR’s practices compare to other administrative courts?
  8. How, if at all, is EOIR addressing the backlog of cases that were postponed in response to the COVID-19 pandemic?

 

  1. How, if at all, has EOIR’s response to COVID-19 affected noncitizens’ ability to locate and meet with counsel, obtain and present evidence in their cases, and appear in court? To what extent have the challenges of COVID-19 impacted the number of in absentia orders issued by immigration courts?

Basically, confirms what AILA, NAIJ, our Round Table, NGOs, and much of the media have been saying for a long time now! Obviously, the Dems lack the power in the Senate to take effective action to eliminate EOIR and replace it with an independent Article I Court, at present. Hopefully, that will be remedied in November.

The Trump administration has carried out nearly 10,000 summary deportations or “expulsions” since March 21, using emergency public health measures that have given U.S. Customs and Border Protection broad authority to bypass immigration laws, CBP officials said Thursday.

The measures have allowed the agency to quickly turn away most unauthorized migrants —  sending them back across the Mexican border. The moves have dramatically slashed the number of detainees held in border stations, where they fear the coronavirus could spread, the officials said. CBP currently has fewer than 100 detainees in custody, down from nearly 20,000 at this time last year during last year’s border crisis, officials said.

Since the implementation of the rapid expulsions, unlawful border crossings have dropped 56 percent, said acting CBP commissioner Mark Morgan. Morgan also acknowledged that the United States has all but closed its borders to asylum seekers who are fleeing persecution, including those who attempt to enter legally at U.S. ports of entry.

“Those who are undocumented or don’t have documents or authorization are turned away,” Morgan said.

Democratic lawmakers have accused the administration of defying U.S. laws and exceeding the authority of the coronavirus public health order, but Morgan defended the emergency measures as a necessary step to stop the spread of the disease.

“This is not about immigration,” Morgan said. “This is about public health. This is about putting forth aggressive mitigation and containment strategies.”

CBP said the number of migrants detained at the border fell to 33,937 in March, down 7 percent from February. Single adults from Mexico accounted for 70 percent to 75 percent of those taken into custody, and most of the remainder were from Central America’s Northern Triangle countries: Guatemala, El Salvador and Honduras.

The Mexican government has agreed to accept the rapid return of migrants from those nations at the border under an agreement reached with the Trump administration last month.

The recent expulsions include children who would otherwise be protected from rapid removal by U.S. anti-trafficking laws. Since the emergency order took effect, the United States has expelled nearly 400 underage migrants, according to the most recent tally by the Reuters news agency. The minors were released into Mexico or boarded onto planes and flown back to Central America without being transferred to the care of the U.S. Department of Health and Human Services.

It’s going to take more than a letter from Sen. Pat Leahy (D-VT) and other Dems to restore the Constitution and the rule of law. Indeed, with the help of J.R. and his Trumpist GOP majority on the Supremes, I would expect that asylum laws, like voting rights, Due Process, and other individual rights will remain a “dead letter” until we get both 1) regime change; and 2) reform in the appointment of Article III Judges.

There is little, if any, data right now to support the view that asylum seekers at the Southern Border have been a significant source for the initial spread of coronavirus in the U.S.; however, their arbitrary removal to other countries might have helped the worldwide spread of the disease.

Moreover, as COVID-19 spreads into the Gulag and the Immigration Courts from the rest of America, infections in those locations could help spread the virus, given the lawyers, Government employees, and contractors exposed at those dangerous locations. Nor were Asian Americans responsible.

We do, however, have some data to show that U.S. citizens and other travelers returning from Europe were inadvertently a source of the virus’s spread in New York, and that Trump’s ineptness and failure to heed early warnings contributed to the spread.

Top Senate Democrats warn that the Trump administration is deliberately undermining the independence of immigration courts.

In a bluntly-worded letter to the Justice Department, which oversees the immigration courts, the senators accuse the administration of waging an “ongoing campaign to erode the independence of immigration courts,” including changing court rules to allow more political influence over decisions, and promoting partisan judges to the Board of Immigration Appeals.

“The administration’s gross mismanagement of these courts,” they write, threatens to do “lasting damage to public confidence in the immigration court system.”

The letter was sent Thursday to Attorney General William Barr. It was signed by nine Democratic members of the Senate Judiciary Committee, including Sheldon Whitehouse of Rhode Island, Richard Durbin of Illinois, Mazie Hirono of Hawaii and Amy Klobuchar of Minnesota. They are requesting extensive information about the department’s hiring practices for trial-level and appellate judges, among other documents.

The Justice Department did not immediately respond to a request for comment on the letter.

The senators’ concerns echo those voiced by former and current immigration judges, including the head of the union representing those judges. Ashley Tabaddor, the president of the National Association of Immigration Judges, testified at a House Judiciary Committee hearing last month that immigration courts should no longer be overseen by the Justice Department.

“The only real and lasting solution is the establishment of an independent Immigration Court,” Tabaddor wrote in her testimony. “It must be free from the constantly changing (often diametrically opposed) politicized policy directives of the Department of Justice.”

The judge’s union has pushed back against productivity quotas for immigration judges, which were announced in 2018. The union also opposed new Trump administration rules that gave more power to the director of the Executive Office for Immigration Review, a political appointee.

The Trump administration, for its part, has moved to decertify the judges’ union.

Immigration courts face a massive backlog of more than a million cases. And there’s wide agreement that the court system needs reform. But not everyone believes that removing immigration courts from the Justice Department is the right approach.

“The attorney general and his subordinates are actively working to remedy this problem, by providing the needed resources to the immigration courts,” wrote Andrew Arthur, a former immigration judge who is now a fellow at the Center for Immigration Studies, in his testimony before the House Judiciary Committee last month. “Restructuring the immigration courts … will almost certainly not address the core problems that are facing those courts,” Arthur added.

At a time when caseloads are surging, some immigration judges are quitting, citing frustration and exhaustion. Judge Charles Honeyman retired from the Philadelphia Immigration Court in January after 24 years on the job.

“I would want future administrations and the Congress to think of immigration judges as judges, literally, and give them the autonomy and the independence and the confidence to make decisions without political interference or overreach,” he said in an interview with NPR’s Noel King.

“The only way to do that is to create an independent court where the judge makes a decision and the judge isn’t afraid of how many cases he has to complete for the year or whether some political actor is going to be looking over his shoulder and say, I don’t agree with that decision; we’re going to find a way to put pressure on you,” Honeyman said.

After seeing how Trump attacked an Article III life-tenured U.S. District Judge this week, does anyone seriously think that an Immigration Judge, a mere civil servant, who ruled against the Trump/Miller White Nationalist agenda in a case that came to Trump’s attention would retain their job under Billy Barr? After seeing how Trump treated some career civil servants and military officers after they “spoke truth to power” does anyone seriously think that Billy Barr of any other regime sycophant would defend fair and impartial decision making that Trump didn’t like?
No way! So how can ANY foreign national get a fair hearing before a “fake court system” where the prosecution authorities retain the right to change any result that goes against them and to remove subordinates who are supposed to be exercising independent judgement from their jobs if they don’t like the result.
The entire Immigraton Court system is and has been for some time now a cruel, unconstitutional hoax. route to the United States.5 The Trump Administration’s approach to asylum seekers is not only inhumane and potentially illegal; it could also overwhelm the asylum systems ofGuatemala, El Salvador, and Honduras and further destabilize those countries. As such, these agreements could have serious and detrimental implications for U.S. national security.

There is significant evidence that the Northern Triangle countries are unlikely to provide safety or adequate protection for asylum seekers, both because ofthe pervasive violent crime and targeted persecution there as well as their governments’ weak or practically non-existent asylum capacities. We are also concerned that expelling asylum seekers under this framework raises serious legal and procedural questions, including the degree to which the Administration complied with relevant law in producing and signing these agreements.

As you know, the Northern Triangle countries have some ofthe highest homicide rates in the world and are experiencing massive forced displacement both internally and across borders.6•7•8 The Department of State’s own human rights reports for these countries describe the dangers of rape, femicide, forced child labor, and threats against the LGBTQ community.9 Gang violence is pervasive and often transcends borders; some ofthese criminal organizations are so dangerous that even some police forces trained to combat gang violence are themselves fleeing to the United States.10 Despite these troubling facts, on November 21,2019, the Administration expelled a Honduran man to Guatemala in the first transfer under these agreements.11 ·

The Administration has since expelled more than 250 migrants from Honduras and El Salvador to Guatemala.12 At first, the Administration said it would transfer only single adults.13 However,

the Administration has begun to transfer children and families, including a Honduran mother with two children who had been hospitalized.14 Reportedly, many ofthese migrants are not even aware in advance ofthe country to which they are being transferred. Upon arrival, they are told that they have 72 hours to either apply for asylum or leave, but are reportedly given practically no information about the process.15

Because ofthe lack ofprotection offered in Guatemala, El Salvador and Honduras, these agreements raise serious legal questions. On November 18,2019, the Department ofJustice and DHS released an interim fmal rule (“Rule”) amending departmental regulations in order to implement the ACAs.16 The Rule, effective November 19, 2019, characterizes the ACAs as “safe third country” agreements as described in the Immigration and Nationality Act, which provides that asylum seekers may be removed under the following conditiop.s:

“[I]fthe Attorney General determines that the alien may be removed, pursuant to a bilateral or multilateral agreement, to a country (other than the country ofthe alien’s nationality or, in the case ofan alien having no nationality, the country of the alien’s last habitual residence) in which the alien’s life or freedom would not be threatened on account ofrace, religion, nationality, membership in a particular social group, or political opinion, and where the alien would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection, uilless the Attorney General fmds that it is in the public interest for the alien to receive asylum in the United States.”17

The Rule provides that the Attorney General and the Secretary of Homeland Security will make “categorical” determinations as to whether the Northern Triangle countries offer access to a “full and fair procedure” for determining asylum claims. Written information provided to our offices by the Administration indicates that “[t]he Attorney General and Secretary ofHomeland Security determined that Guatemala’s asylum system provides full and fair access to individuals seeking protection, as required by U.S. law, prior to the ACA entering into force on November 15.”18

The notion that Guatemala or the other two Northern Triangle countries offers such a procedure strains credulity-their systems for determining asylum claims are, at best, deeply flawed and under-resourced, and at worst, practically non-existent. According to the State Department’s human rights reports, in Guatemala, “identification and referral mechanisms for potential asylum seekers were inadequate… [and] migration and police authorities lacked adequate training

concerning the rules for establishing refu,gee status.”19 Guatemala does not have a dedicated office for resolving asylum cases; instead, a commission offour officials from several ministries and the immigration department.meet a few times a year to decide cases.20 Reportedly, these officials did not resolve a single case in the first seven months of2019.21 Honduras and El Salvador do not have a single full-time asylum officer. By contrast, U.S. Citizenship and Immigration Services has about 500 asylum officers who are currently tasked with adjudicating over 300,000 pending asylum cases.22 Thus, the Northern Triangle countries are not remotely equipped to fully and fairly handle even a small fraction ofthese cases.

The lack of asylum capacity poses a grave risk that these Northern Triangle governments w ill- whether inadvertently or willfully-return asylum seekers to their country ofpersecution, constituting the serious human rights violation of refoulement that is prohibited under Section 208(a)(2)(A) ofthe U.S Immigration and Nationality Act.

This provision ofU.S.law codifies U.S. obligations prohibiting the return ofrefugees to a territory where his or her life or freedom would be threatened as a state party to the 1967 Protocol Relating to the Status of Refugees. The ACAs may also violate U.S. obligations as a party to the 1984 Convention against Torture.23 Indeed, in response to the publication ofthe Rule, the United Nations High Commissioner for Refugees released a statement, saying it “has serious concerns about the new U.S. policy on asylum,” calling it “an approach at variance with international law that could result in the transfer ofhighly vulnerable individuals to countries where they may face life-threatening dangers.”24 A recently filed lawsuit details additional legal violations posed by the implementation ofthe ACAs.25

The ACAs recently signed by DHS appear to have been drafted in haste, with multiple typographical errors introduced into the agreements.26 There is little sign that they were

negotiated in a meaningful way individually with each country. Furthermore, the President’s actions leading up to the agreements’ signing-including social media statements threatening to withhold, and subsequent withholding of, Congressionally-appropriated aid to the region- indicate that Central American officials may have accepted the terms under duress.27

~ Additionally, one news report indicated that, in a private meeting with President Trump, Secretary Pompeo criticized the agreement with Guatemala, “ca:lled the agreement flawed and a mistake,” and told the President that ”the Guatemalan government did not have the ability to carry out its terms.”28 This raises questions about the degree to which the State Department was involved in policy deliberations and decisions underlying these agreements.

Accordingly, please provide answers to the following questions by February 18, 2020:

  1. Did any officials within the State Department raise concerns abol)t the feasibility of implementing these ACAs due to the lack of capacity of the Northern Triangle countries’ asylum systems, or for any other reason? Please provide any such memoranda or communications in which any such concerns were articulated.
  2. What specific concerns about the agreement with Guatemala were raised by Secretary Pompeo in the reported Oval Office meeting with the President? Have these concerns been addressed?
  1. Were any assessments of the Northern Triangle countries’ asylum adjudication procedures made prior to the negotiation or conclusion ofthe ACAs? Please provide any documents related to any such assessments.
  2. The ACAs indicate that the parties shall develop standard operating procedures and plans regarding the implementation ofthese agreements. What is the status ofthese plans in each Northern Triangle coll.ntry?

The ACAs indicate that they shall enter into force upon “exchange ofnotes” indicating that both countries have compl~ted the n~cessary domestic legal procedures for bringing the agreement into force. Over two years elapsed between December 5, 2002, when that agreement was signed, and December 29, 2004, when it came into force.30 In contrast, less than four months elapsed between July 26, 2019, when the ACA with Guatemala was signed, and November 15,2019, when it came into force.

Washington, D.C. – Today, U.S. Senator Cortez (D-Nev) Masto joined Senators Kamala D. Harris (D-Calif)  and Dianne Feinstein (D-Calif) and other Senate Democrats in sending a letter to Attorney General Jeff Sessions urging that the Justice Department uphold a ruling by the Board of Immigration Appeals (BIA) that provides protections for LGBTQ asylum seekers who are fleeing persecution. In the letter, the senators highlight the increasing threat of violence LGBTQ individuals face in many parts of the world.

“LGBTQ individuals’ access to the U.S. asylum process has assumed increased urgency today as their persecution by both state and private actors is worsening in many parts of the world,” said the senators. “As of 2017, 72 countries worldwide effectively outlaw same-sex sexual relations between consenting adults. Eight apply the death penalty as a punishment for such relations. A majority of countries lack applicable hate crime laws and have law enforcement agencies that neither effectively investigate nor document hate-motivated private violence against LGBTQ individuals.”

The senators continued, “Altering the BIA’s decision in Matter of A-B- to place additional roadblocks and burdens upon asylum seekers could potentially deprive deserving LGBTQ applicants with an opportunity to secure protection in the U.S. that would save their lives. Any increase in the burden of proof for LGBTQ asylum seekers experiencing private harm – additional evidence not now needed by either the immigration courts or asylum officers to fairly adjudicate claims – would be unnecessary and contrary to the public interest.”

Dear Attorney General Sessions:

We write to express our concerns about your pending review of the Board of Immigration Appeals (“BIA”) decision in Matter of A-B-, 27 I&N Dec. 227 (A.G. 2018) and the adverse impact such a decision could have on vulnerable populations fleeing persecution and violence.  We urge you to uphold the BIA’s decision, which reflects a well-settled matter of law that provides critical protections for vulnerable populations, including LGBTQ individuals subject to private persecution that foreign governments are unwilling or unable to control.

LGBTQ individuals’ access to the U.S. asylum process has assumed increased urgency today as their persecution by both state and private actors is worsening in many parts of the world. As of 2017, 72 countries worldwide effectively outlaw same-sex sexual relations between consenting adults. Eight apply the death penalty as a punishment for such relations. A majority of countries lack applicable hate crime laws and have law enforcement agencies that neither effectively investigate nor document hate-motivated private violence against LGBTQ individuals. As just two alarming examples of state sponsored anti-LGBTQ actions this past year, Russian authorities in Chechnya undertook an anti-gay purge that involved the alleged torture of dozens of men, and Egyptian authorities engaged in a campaign to target and incarcerate individuals solely based on their sexual orientation.

Your referral order for the Matter of A-B- – in which you aim to address, “Whether, and under what circumstances, being a victim of private criminal activity constitutes a cognizable ‘particular social group’ for purposes of an application for asylum or withholding of removal” –has great import for the majority of LGBTQ asylum seekers who arrive in the United States fleeing persecution by private individuals.  In the decades since this country first recognized LGBTQ status as a protected particular social group, it has been well established that LGBTQ individuals face grave risks in reporting private persecution or seeking governmental protection from such persecution abroad. Any change to this body of law would be a mistake.

In countries where government authorities engage in serious physical and sexual assaults of LGBTQ individuals, it is effectively impossible for them to seek protection from those same authorities when faced with private persecution. In some countries, simply asking for protection from state authorities can result in government-sponsored persecution. Even where state authorities are not active perpetrators of violence against LGBTQ individuals, they frequently turn a blind eye, emboldening private actors to engage in hate-motivated violence. U.S. State Department research highlights that foreign government retribution towards and lack of assistance for LGBTQ individuals who face private threats of persecution is commonplace, even when the population is not expressly criminalized. This chills the ability of LGBTQ individuals to report such persecution in their home countries.

Societal and familial considerations also often prevent LGBTQ victims of private persecution from coming forward to foreign authorities. They may be threatened with reprisals from their persecutors or coming forward would reveal their LGBTQ status and increase other persecution. In many countries, the act of reporting violence can have deadly consequences.

Altering the BIA’s decision in Matter of A-B- to place additional roadblocks and burdens upon asylum seekers could potentially deprive deserving LGBTQ applicants with an opportunity to secure protection in the U.S. that would save their lives.  Any increase in the burden of proof for LGBTQ asylum seekers experiencing private harm – additional evidence not now needed by either the immigration courts or asylum officers to fairly adjudicate claims – would be unnecessary and contrary to the public interest. As such, we strongly urge you to leave undisturbed the BIA’s decision in Matter of A-B-.

The effort is likely to be futile. It’s hard to believe that Sessions, given his xenophobic record and anti-asylum rhetoric, certified the case to himself (actually over the objection of both the DHS and the Respondent) just to uphold and strengthen refugee protections for abused women and LGBTQ individuals. Indeed, Sessions has a clear record of anti-LGBTQ views and actions to go along with his anti-asylum bias.

But, the law favoring asylum protections for victims of DV and LGBTQ individuals who suffer harm at the hands of non-state-actors that governments are unwilling or unable to control is now well established. Therefore, Sessions’s likely “scofflaw” attempt to undo it and deny protections to such vulnerable refugees is likely to “muck up the system” and artificially increase the backlogs in the short run, while failing in the long run to achieve the perversion of justice and denial of Due Process for asylum seekers that he seeks to impose.

Surprisingly, the Article III (“real”) courts don’t allow the disgruntled prosecutor to “certify” results that he doesn’t like to himself and rewrite the law in his own favor! That’s why the facade of “courts” operating within the USDOJ must come to an end, sooner or later!

The president killed off all attempts at compromise, then went dark after the government shut down, refusing to say what he would support on immigration or even to engage in negotiations. But in this leadership vacuum, something remarkable happened: Twenty-five senators, from both parties, rediscovered their role as lawmakers. They crafted a deal over the weekend that offers a possible path forward, and, in dramatic fashion on the Senate floor Monday, signaled the end of the shutdown with a lopsided 81-to-18 vote.

The agreement may not end in a long-sought immigration deal and a long-term spending plan. Trump could yet kill any deals they reach. And liberal interest groups are furious at what they see as a Democratic surrender. But Monday’s breakthrough shows there is at least the potential for lawmakers to take the wheel from an erratic and dangerous driver.

Senate Minority Leader Chuck Schumer (D-N.Y.), announcing his deal with Senate Majority Leader Mitch McConnell (R-Ky.) on the Senate floor Monday afternoon, said he hadn’t even heard from Trump since Friday, before the government closed. “The White House refused to engage in negotiations over the weekend. The great dealmaking president sat on the sidelines,” Schumer said, adding that he reached agreement with McConnell “despite and because of this frustration.”

Looking down from the gallery Monday afternoon, I saw the sort of scene rarely observed any longer in the Capitol: bipartisan camaraderie. Sens. Chris Coons (D-Del.) and Susan Collins (R-Maine), two architects of the compromise, were talking, when McConnell, with a chipper “Hey, Chris,” beckoned him for a talk with Sen. Lamar Alexander (R-Tenn.), who soon broke off for a word with Sen. Joe Manchin (D-W.Va.). Sen. Mike Rounds (R-S.D.) hobnobbed with Coons and Sen. Tim Kaine (D-Va.). Sen. Roy Blunt (R-Mo.) put an arm around Sen. Dick Durbin (D-Ill.) as he chatted with Sens. Debbie Stabenow (D-Mich.) and Jeanne Shaheen (D-N.H.). During the vote, Manchin sat on the Republican side with Sen. Shelley Moore Capito (R-W.Va.), and Sen. Sheldon Whitehouse (D-R.I.) sat with Sen. Lindsey Graham (R-S.C.).

Durbin marveled at the festival of bonhomie. “What I have seen here on the floor of the Senate in the last few days is something we have not seen for years,” he said.

Neither side particularly wanted this shutdown. It was the work of a disengaged president who contributed only mixed signals, confusion and sabotage. After provoking the shutdown by killing a bipartisan compromise to provide legal protection for the “dreamers” (undocumented immigrants who came as children), Trump’s political arm put up a TV ad exploiting the dreamers by saying “Democrats who stand in our way will be complicit in every murder committed by illegal immigrants.”

Trump’s anti-immigrant ad and his racist outburst in the White House last week will only increase Republicans’ long-term political problems, but, in the short term, Republicans succeeded in portraying Democrats as shutting down the government to protect illegal immigrants. And liberal interest groups took the bait. In a conference call just before news of the deal broke Monday morning, a broad array of progressive groups — Planned Parenthood, labor unions, the Human Rights Campaign, the ACLU, MoveOn and Indivisible — joined immigration activists in demanding Democrats refuse to allow the government to reopen without an immediate deal for the dreamers.”

I’ve said all along that there is potential for Congress to govern if McConnell, Ryan, and the rest of the GOP leadership would permit it. But, that means ditching the “Hastert Rule” (named, btw, for convicted “perv” and former GOP Speaker Denny Hastert) and thereby “PO’ing” both the “White Nationalist” and “Bakuninist Wings” of the GOP. That’s why it likely won’t happen. Because although they could govern in this manner, in coalition with many Dems, the modern GOP is beholden to both the White Nationalists and the Bakuninists to win elections and have a chance at being in the legislative majority.

In the end, if the Dems want to change the way America is governed for the better, they’re going to have to win some elections — lots of them. And, that’s not going to happen overnight. Although I can appreciate the Dreamers’ frustration, I think they would do better getting behind the Dems, and even the moderate GOP legislators who support them, rather than throwing “spitballs.”

Ironically, the disappearing breed of “GOP moderates” — who played a key role in restarting the Government — could be more effective and wield more power if they were in the minority, rather than being stuck in a majority catering to the extremest elements of  a perhaps loud, but certainly a distinct minority, of Americans!

First, we can all thank Senator Elect Doug Jones and the voters of Alabama for saving America from the horrible spectacle and damage that would have been caused by the election of the heinous bigot, liar, slanderer, racist, homophobe, xenophobe, theocrat of a false religion, coward, scofflaw, and apparent sexual predator Roy Moore. Jones’s election is a striking rebuke to that other sleazy, corrupt, dishonest, bigoted unrepentant sexual predator in America, Trump. And, by narrowing the GOP advantage in the Senate to a razor-thin 51-49, it raises the possibility that the Democrats with the help of just two responsible Republicans could block substantial parts of Trump’s and the GOP’s insane “War on America” and protect us from some of Trump’s worst excesses.

How ironic that White Nationalist and “Jim Crow relic” Attorney General Jeff “Gonzo Apocalyopto” Sessions is being replaced by a by a competent and decent person who believes in American democracy and governing for the “common good” rather than as an out of touch ideologue with a strong anti-American, anti-Diversity, hate promoting agenda.

It’s also ironic that Jones has done the GOP a favor by relieving them of the lengthy circus of both expelling him from their party and ultimately removing him from the Senate. Anything short of that would have been a continuing embarrassment for the party. Quite contrary to Trump’s outrageous statements in support of the Ayatollah, any vote that a party wins because of support of a total scumbag like Moore damages that party as well as our country. (It does, however, raise in my mind the question of when they are going to expel the anti-American, racist, bigot Steve King from their party. There is no room in any major party for the likes of King.)

Hats off to the African-American community in Alabama who were not deterred by the Sessions/GOP voter suppression anti-Civil Rights initiatives and showed up in the numbers required to make a difference in the election. After being shut out of their fair share of political power in Alabama for over 300 years, African-Americans are finally in a position to make their voices and feelings heard in the U.S. Senate.

Also, hats off to GOP Southern Senators Richard Shelby of Alabama and Tim Scott of South Carolina for standing up and “Just Saying No” to the Moore nonsense. As pointed out by Shelby, Alabama could do better than Ayatollah Roy (not a very high hurdle), and they now have in the person of Doug Jones.

Hopefully, Jones will over time find a way to “win over” most of those misguided souls who voted for Ayatollah Roy notwithstanding the very credible evidence of sexual misconduct with minors in his past, his arrogant “not credible” defense, the clear lies that he told in attempting to smear those who came forward, and his scofflaw, anti-American views. What a jerk!

“THANK YOU, Alabama.

In Tuesday’s special election, the state by a narrow margin chose to spare the nation the indignity of seating an accused child molester in the U.S. Senate. Though the stain of electing Republican Roy Moore would have sullied Alabama, seemingly confirming every negative stereotype about the Deep South state, the shame would have been national. Instead, Alabama voters chose Democrat Doug Jones to represent them until 2021.

Mr. Jones is not in perfect sync with many Alabama voters on some issues, most notably abortion. But he is an honorable man with an admirable record of public service who ran a respectful campaign. His behavior suggests he will serve with decency and care in the Senate. He should make his state proud. None of these fine things could have been said of Mr. Moore. It is beyond heartening that Alabamians refused to overlook or forgive Mr. Moore’s misshapen character.

Mr. Jones’s victory shows that, while partisanship might be extreme, it still has limits. Even in deep-red Alabama, enough voters refused to succumb to lies about how negative stories on Mr. Moore were merely fake news cooked up by a hostile media.

Americans do not send senators to Washington merely to vote mechanically on a few hot-button issues, but to exercise judgment when cameras are not rolling, on issues that are important but not headline-grabbing. Good lawmakers also protect the nation’s democratic institutions, preserve the independence of their branch of government and work with people with whom they disagree. It takes character to fulfill these responsibilities. Mr. Jones seems ready to do such work. Mr. Moore did not.

Mr. Jones’s victory also suggests that the nation’s recent awakening on sexual harassment and assault is spreading across the country. Enough Alabamians believed the women.

If Americans should feel grateful to Alabama voters, so should the Republican Party, much of which debased itself by following President Trump into the gutter of support for Mr. Moore. Its majority in the Senate will be slightly narrower, but the dignity of the Senate GOP caucus will be at least partially salvaged. Alabama voters spared the Senate Ethics Committee the dilemma of how to handle a senator who was clearly unfit but who nevertheless won a popular election. Instead of inviting controversy and chaos, they elected Mr. Jones, a man who deserves the honor.

Thanks to Alabama, Americans can wake up Wednesday morning feeling hopeful about the decency and dignity of their democracy.”

On to the other big story, Aaron Rodgers (“AR”). AR’s recovery from a broken collarbone which required surgery, two plates, and 13 screws is about as amazing as Jones’s victory.

AR is a smart player, tough guy, and great competitor. It’s certainly possible that he will be able to lead the Pack (currently 7-6 and “on the outside looking in” for a playoff spot) to a sweep of the final three games and a possible playoff birth. But, certainly no “slam dunk!”

The O line will have to do a perfect job of protecting AR. He will have to suppress his tendency to run with the football when nobody is open and the Pack needs a first down.

If the Pack should lose to the Panthers on Sunday, they will have to make a decision on whether to play AR in the final two games. A defeat would pretty much end any realistic hope of the playoffs this year. So, it might make sense to let backup Brett Hundley (3-4 as a starter in AR’s absence) start the last two games. On the other hand, being the competitor that he is, AR will want to play.

Congrats to AR on his return, good luck, and stay tuned.

“The news catapults the Packers’ playoff chances from a pipe dream to a legitimate possibility with three games remaining. Conventional wisdom says the Packers must win all three — at Carolina, vs. Minnesota and at Detroit — to have a chance at a wild card in the top-heavy NFC. Accomplishing that feat with Brett Hundley at quarterback was unlikely after he won just three games in seven starts; but with Rodgers the odds shift dramatically.

Beginning Wednesday, Rodgers will have three days of practice to prepare for his first game since Oct. 15, when a hit from Minnesota Vikings linebacker Anthony Barr resulted in a broken right collarbone. Rodgers underwent surgery in California to stabilize the fracture, and the Packers ultimately placed him on injured reserve. He returned to practice on a limited basis Dec. 2 and spent the last two weeks running the scout team, dazzling his teammates each day.

His initial return meant nothing, though, if Rodgers could not be medically cleared. He underwent a series of scans Monday to reveal the progress of his collarbone, and the interpretations of those scans by team physician Patrick McKenzie, several outside specialists and general manager Ted Thompson would determine whether the risk of further injury would be worth the reward of having Rodgers for a potential playoff run.

For a while it appeared bleak. Monday came and went with nothing but party-line comments by coach Mike McCarthy, who reiterated during a news conference that any decision on Rodgers’ future would be made by medical professionals. That Rodgers spun the football during pregame at Heinz Field or zinged passes in the Don Hutson Center was irrelevant, just as his assistant coaching efforts in Cleveland did nothing but reinforce his passion.

With Tuesday morning came additional silence, and social media wondered if the lengthy delay lessened Rodgers’ chances of returning. But the results of his scans were sent to specialists around the country, in multiple time zones, and the coordination of gathering various opinions certainly influenced the timeline. It’s quite possible that Rodgers’ surgeon in California, who at this point is unidentified, had a large say in the discussion.

If nothing else, the painstaking deliberation surrounding Rodgers’ health captures the importance of franchise quarterbacks, and in particular elite franchise quarterbacks. In breadth alone the discussion might have stretched to a dozen people: McKenzie, Thompson, McCarthy, the doctor who performed surgery, several outside experts and, of course, Rodgers himself. The crew needed 36 hours to probe the conundrum from various angles.

Everything started, of course, with the fairly black-and-white question of whether Rodgers’ collarbone had calcified since two plates and 13 screws were inserted to stabilize the fracture eight weeks ago. Enough time had passed for the bone to heal significantly, though perhaps not entirely, and therein lies the gray area for whoever reviewed the scans. How sturdy must his collarbone be to withstand the punishment of 300-pound defensive linemen or hard-charging linebackers?

There were also football questions that clouded the equation. At 7-6, the Packers must win out to have a realistic shot at the playoffs — and even then, they could fall short. Why risk Rodgers’ throwing shoulder when the Packers don’t control their postseason destiny? Surely that question irked the conscience of Thompson, whose conservative disposition is well-documented in Green Bay.

One has to wonder if the two-day uncertainty weighed on Hundley as well. With Sunday’s win over the Browns came the cleansing exhale of accomplishing his primary job: keeping the Packers in playoff contention until Rodgers was eligible to return. He achieved that feat with consecutive overtime victories that cast light on his moxie.

But narrow escapes against the Browns and Buccaneers bear little resemblance to the challenge of the next three weeks. To beat the Panthers (9-4), Vikings (10-3) and Lions (7-6) — two of which are on the road — the Packers will need reinforcements.

As it turns out, that’s just what the doctor ordered.”
