Let’s hope this is the first step to dismantling the disreputable “Supremes Shadow Docket” used by the Court and the SG’s Office during the Trump regime to screw asylum seekers and other migrants, deny due process, and stomp on human rights, many times without even deigning to provide a full rationale to those they are victimizing and abusing. Never seen so many totally unjustified stays of correct lower Federal Court rulings blocking blatantly illegal and invidious Executive action.

For many of us, it didn’t take an armed insurrection to show the Trump regime’s racism, contempt for democracy, and disregard of our Constitution. But, the Supremes’ GOP majority feigned ignorance that Trump wasn’t a “normal Executive” whose decisions might be entitled to “deference.” So much for all those fancy Ivy League law degrees! (Not to mention anti-American, anti-Democracy insurrectionists and conspiracy theory mongers Teddy Cruz and Josh Hawley who also had the benefit of what was once thought to be a “premier” legal education.)

America deserves better from its highest Court and the Government lawyers who appear before it! Hopefully, this is the beginning of a new day in American justice!

Three days after President Trump took his re-election campaign to a construction site of his border wall in Arizona, a federal appeals court ruled Friday that he had defied Congress’ constitutional authority over federal spending by redirecting $2.5 billion in military funds to build 130 miles of barriers in California, Arizona and New Mexico.

Congress appropriated the funds for military pay, weapons and other Defense Department purposes, and never authorized Trump to spend them on wall construction, the Ninth U.S. Circuit Court of Appeals in San Francisco said in a pair of 2-1 rulings.“Funding for the wall had been denied by Congress,” and the Trump administration “lacked independent constitutional authority to authorize the transfer of funds,” said Chief Judge Sidney Thomas, joined by Judge Kim Wardlaw. Both were appointed by President Bill Clinton.

Judge Daniel Collins, a Trump appointee, dissented from both decisions. He said the military funds were legally transferred and also that the plaintiffs — California and 15 other states, the Sierra Club and and an advocacy group for border communities — had no right to sue over the alleged violation of congressional spending powers.

Although the appeals court upheld a federal judge’s injunction against construction of the wall segments, the ruling did not halt construction. The Supreme Court voted 5-4 last July to allow the work to continue while the case proceeded. Its brief, unsigned decision said the administration “has made a sufficient showing at this stage that the plaintiffs have no cause of action” — that is, that they had not shown direct harm from the construction that would entitle them to challenge it in court.

The appeals court majority reached a different conclusion, citing the plaintiffs’ claims that the wall was harming the environment and wildlife at the border and the states’ ability to enforce their own environmental laws. Similar issues are pending before the same panel in a case over $3.6 billion for additional wall segments, and the dispute could soon return to the high court.

Jared Kushner’s New Big Boy Job: Building Trump’s Wall

First order of business: Seize all the private land.

When we last checked in about the progress of Donald Trump’s fantasy border wall, things were not going super well in that very little of it had actually been built. Plagued by logistical issues—not to mention opposition by the majority of Americans—as of last month the administration had reportedly acquired only 16% of the land it needs in Texas, where at least 100 landowners will have to give up valuable property for the project to happen. That news was presumably of little bother to the millions of people who think the border wall is a patently absurd, wildly racist, completely pointless monument to Trump’s ego, but for the president it was completely unacceptable. So, insistent that he will deliver the fence by the end of 2020 as a gift to his rabid base, he’s brought in the big guns: Jared Kushner.

Yes, in addition to his 387 other jobs at the White House, which include bringing peace to the Middle East, solving the opioid crisis, “fixing the government with business ideas,” reforming veteran care, and overhauling the entire immigration system, the first son-in-law is the “de facto project manager” for constructing the border wall, according to a new report from the Washington Post. What big ideas has he come up with so far? Well, where government officials have been resistant to the president’s “take the land” edict, wherein he thinks using eminent domain to seize private land will go over great both legally and politically, Jared is all for it. Once a slumlord, always a slumlord!

According to one person involved in the matter, Kushner has “annoyed” officials due to his total lack of knowledge of the government’s procurement process for obtaining land and the “realities” of the project. “So he took a much more hands-on role in figuring out, mile by mile, how to get more wall up,” this person told the Post. “It didn’t help put wall up faster and cheaper. His interventions actually just created more inefficiency in the process.”

While Kushner insists that everything is on target to meet the goal of 450 miles by the end of next year—a pace that means accelerating construction at least fourfold—to date just 83 miles of new barrier have been completed, with nearly all of that classified by CBP as “replacement wall,” a characterization the president does not appreciate:

Though Kushner has blamed his predecessors for not moving quickly enough to obtain necessary land, a former Department of Homeland Security official told the Post the reason for that was this little thing called the law. “We weren’t taking people’s land willy-nilly,” said the official.

The White House declined to comment; Kushner’s allies in the administration say he is bringing private sector know-how to the project, which is a bit worrisome given his track record in the private sector.

Imagine what we could do if the time and money spent on these political gimmicks were redirected to humane, practical immigration enforcement that complied with laws and Due Process. Gee, we might actually solve problems instead of making them worse and unnecessarily creating new ones.

Also, remember that there was a time when the GOP claimed to stand for the “sanctity of private property.” But, that was then; this is now.

Trump may not use military money for border wall, federal appeals court decides

A federal appeals court Wednesday upheld an injunction barring the Trump administration from using military funds to pay for a wall along the southern border.

In a 2-1 decision, a panel of the U.S. 9th Circuit Court of Appeals said Trump was likely to lose his appeal and the injunction by a district judge should remain in place.

After failing to win funding for the wall from Congress, Trump announced in February that he planned to divert $8.1 billion for the border wall from funds slated for military construction and other Department of Defense operations.

The Sierra Club and the Southern Border Communities Coalition sued, winning an injunction in late May. The Trump administration asked the 9th Circuit to block that order while the case is on appeal.

In rejecting the administration’s request, the 9th Circuit said using the military funds “violates the constitutional requirement that the executive branch not spend money absent an appropriation from Congress.

The public interest is “best served by respecting the Constitution’s assignment of the power of the purse to Congress,” the 9th Circuit said.

The order was signed by Judges Richard Clifton, appointed by President George W. Bush, and Michelle Friedland, an Obama appointee.

Ninth Circuit Judge N. Randy Smith, appointed by President George W. Bush, dissented.

Basically, Trump tried to steal money Congress refused to give him and use it for a bogus political stunt — building a wall for political show that could have no real effect on legitimate law enforcement other than to enrich smugglers and kill some more innocent asylum seekers by forcing them to use smugglers to take them over a more dangerous spot or to tunnel, scale, or break through the wall.

For the record, Judge Randy N. Smith “tanked” on his oath of office and his Constitutional responsibilities to stop such nonsense. Fortunately, Judge Richard Clifton and Judge Michelle Friedland stood up for the Constitution and our right to have a Government that follows its own laws. 

Undoubtedly, there will be an appeal, so stay tuned. The Supremes are much more “marshmallowy” when comes to forcing Trump to operate within the Constitution.

Nation with Crumbling Bridges and Roads Excited to Build Giant Wall

WASHINGTON (The Borowitz Report)—As America’s bridges, roads, and other infrastructure dangerously deteriorate from decades of neglect, there is a mounting sense of urgency that it is time to build a giant wall.

Across the U.S., whose rail system is a rickety antique plagued by deadly accidents, Americans are increasingly recognizing that building a wall with Mexico, and possibly another one with Canada, should be the country’s top priority.

Harland Dorrinson, the executive director of a Washington-based think tank called the Center for Responsible Immigration, believes that most Americans favor the building of border walls over extravagant pet projects like structurally sound freeway overpasses.

“The estimated cost of a border wall with Mexico is five billion dollars,” he said. “We could easily blow the same amount of money on infrastructure repairs and have nothing to show for it but functioning highways.”

Congress has dragged its feet on infrastructure spending in recent years, but Dorrinson senses growing support in Washington for building a giant border wall. “Even if for some reason we don’t get the Mexicans to pay for it, five billion is a steal,” he said.

While some think that America’s declining infrastructure is a national-security threat, Dorrinson strongly disagrees. “If immigrants somehow get over the wall, the condition of our bridges and roads will keep them from getting very far,” he said.

“Washington (CNN)Construction on prototypes for President Donald Trump’s long-promised border wall has been delayed until winter at the earliest after bidders who were passed over filed protests about the decision, according to an update obtained by CNN.

The delay pushes back construction of the potential wall designs months beyond when the administration had hoped to break ground. The plan had originally been to build in June, and in recent weeks the Department of Homeland Security has insisted it was still on track to begin work on prototypes this summer.
But according to a memo sent out by the Customs and Border Protection legislative affairs office, obtained by CNN, two companies that were not selected to be finalists — who then were asked to submit more detailed proposals — filed a total of four protests of the process. While two of the protests, from WNIS, were dismissed, two from Penna Group are still under review and won’t be decided until October, the update said.
That sets the earliest that prototype construction could begin for November, to be completed by early December. That’s if no further protests are filed and if the original protests are dismissed, the update notes, and acknowledges that protests are a common part of government contracting.
CBP did not immediately respond to a request for comment.
The news comes as the House is set to vote Thursday night on a security funding package that would include money to build new border wall next fiscal year, though Democrats in the Senate have signaled they will oppose any such effort.
Since Congress has yet to appropriate any money for Trump’s signature campaign pledge, the prototypes have been the only step the administration has been able to take in executing Trump’s vision.”

Is Jeff Sessions About To Go After Tax Credits For U.S. Citizen Kids To Fund “The Wall?” — Sessions’s Motives Questioned — CA Girds For Legal Battle With USDOJ! — Trump Administration Fuels Federal Civil Litigation Bonanza!

“We’re going to get paid for it one way or the other,” Attorney General Jeff Sessions said of President Trump’s proposed border wall while speaking with ABC’s George Stephanopoulos on Sunday. After raising the issue, Stephanopoulos asked if Sessions has any evidence Mexico will fund construction, as Trump repeatedly promised on the campaign trail.

Sessions conceded he does not expect the government of Mexico to “appropriate money,” but maintained the United States has other options to get money from Mexicans. We could “deal with our trade situation to create the revenue,” he suggested, or, “I know there’s $4 billion a year in excess payments,” Sessions continued, “tax credits that they shouldn’t get. Now, these are mostly Mexicans. And those kind of things add up — $4 billion a year for 10 years is $40 billion.”

Sessions appears to be referencing a 2011 audit report Trump also cited while campaigning. As Politifact explains, the report said that in 2011, $4.2 billion in child tax credits was paid to people filing income taxes using an Individual Taxpayer Identification Number (ITIN) instead of a Social Security number. Some of these filers are illegal immigrants, but many are legal foreign workers, and the audit did not say how many are Mexican.

“The vast majority of that $4.2 billion, the filer may be undocumented, but you have to have a child to receive it,” said Bob Greenstein of the Center on Budget and Policy Priorities. “And the children are overwhelmingly U.S. citizens.” Watch an excerpt of Sessions’ remarks below. Bonnie Kristian”

De Leon was not the only California public official to strike back at Sessions’s attack on so-called “Sanctuary cities” last week. As reported in the L.A. Times, in a “Battle of the AGs:”

“[California Attorney General Xavier] Becerra said on Friday that threats to withhold federal funds from states and cities that limit cooperation with federal immigration authorities are reckless and undermine public safety.

. . . .

Becerra said Sunday that California is ready to fight any attempt to withhold federal funds.

“Whoever wants to come at us, that’s hostility, we’ll be ready,” Becerra said. “We’re going to continue to abide by federal law and the U.S. Constitution. And we’re hoping the federal government will also abide by the U.S. Constitution, which gives my state the right to decide how to do public safety.”

The state attorney general was skeptical about comments by President Trump in recent days that so-called Dreamers —young immigrants brought to this country illegally by a parent —  will not be targeted for immigration enforcement.

“It’s not clear what we can trust, what statement we can believe in, and that causes a great deal of not just anxiety, but confusion — not just for those immigrant families, but for our law enforcement personnel,” Becerra said.

He also denounced the Trump proposal to build a wall at the U.S.-Mexico border as a “medieval solution” to immigration issues, adding that neither U.S. taxpayers nor Mexico want to pay for the proposal.”
