3 Roger Stone prosecutors quit over Justice Department sentencing reversal

The Justice Department’s decision to reportedly back off its sentencing recommendation for President Trump’s longtime adviser Roger Stone apparently wasn’t well-received by two of his prosecutors.

Upon learning the Department reversed course and said seven to nine years was “grossly disproportionate” given Stone’s offenses — which include lying to Congress, witness tampering, and obstructing a House investigation related to 2016 Russian election interference — prosecutor Special Assistant U.S. Attorney Aaron Zelinsky withdrew from Stone’s case. However, it looks like he’ll be sticking with the Justice Department and returning to his old job in Maryland.

Another prosecutor, Special Assistant U.S. Attorney Adam Jed, is doing the same. Meanwhile, Assistant U.S. Attorney Jonathan Kravis, is resigning from the department altogether.

The decisions by the prosecutors appear to be in protest of what they consider interference from Justice Department higher-ups. The sentencing recommendation was reversed after Trump tweeted angrily about it, although there’s no confirmation if the White House was directly driving the change.

I will be interested in seeing 1) how Judge Amy Berman Jackson handles this; and 2) if Trump just goes ahead and pardons the uber sleazy and unrepentant Stone.  The GOP has made it crystal clear that the rule of law in America is “for suckers only.”

NO SURPRISE HERE! — TRUMP’S GONZO IMMIGRATION ENFORCEMENT PRODUCES LESS THAN ADVERTISED – Majority Of So-Called “Criminal” Arrests & Removals Apparently Involve Relatively Minor Offenders!

“U.S. immigration agents are going after minor offenders rather than the hardened criminals President Trump repeatedly warned about, a report released Tuesday by the U.S. Immigrations and Customs Enforcement reveals. Illegal crossings into the United States have dropped and immigration arrests are up under the Trump administration, but the report suggests nearly three-quarters of those apprehensions have been for minor transgressions.

Of the 143,470 immigration arrests made in fiscal year 2017, less than 25 percent of the people arrested had been convicted of or charged with violent crimes. Although the ICE report notes that 92 percent of the people arrested between Jan. 20 and Sept. 30, 2017, did have some criminal convictions or charges against them, the top four criminal charges against those arrested were described as DUIs, “dangerous drugs,” immigration-related violations, or traffic offenses.

In January, Trump signed an executive order to crack down on illegal immigration and declared that “many aliens who illegally enter the United States … present a significant threat to national security and public safety.” Acting ICE Director Thomas Homan indicated at a press conference Tuesday that the agency would have more “collateral arrests” of people who were not initially targeted in ICE raids: “We’re going to arrest them either way. Chances are when we go to their homes, or place of business, we’re going to find other illegal aliens that weren’t even on our radar to begin with.”

From “The Week:” Strange Bedfellows — If “Sanctuary Cities” & Migrants’ Advocates Defeat President Trump’s Policies In Court, They Might Owe A Huge Debt To Conservative Judges, Like The Late Justice Antonin Scalia!

Self-described “free-market progressive libertarian” Shikha Dalmia writes in The Week:

“But there’s another big cost that will hamstring this sanctuary city crackdown: If he can’t command local cooperation by threatening to cut funds, then President Trump also can’t de facto deputize local law enforcement agents. So he will have to cough up large sums of federal money to triple the size of the federal deportation force that would be required to eject millions of additional people.

And that will also mean bad optics, because without cooperative local authorities, President Trump will not be able to order ICE agents to whisk away all of these folks quietly in the dead of the night, shielded from media cameras. Instead, he’ll have to start raiding schools, neighborhoods, and workplaces, which will make for terrible publicity.

Whether Trump will go that far remains to be seen. But thanks primarily to the conservative justices on the Supreme Court, it’ll be very hard for him to do so. And that gives undocumented workers far more of a chance than if they had to depend only on the good intentions of local liberal politicians.

The irony is that these immigrants would be in much bigger trouble if Justice Sonia Sotomayor, along with her liberal colleague Ruth Bader Ginsburg, had prevailed in the ObamaCare ruling, as many liberals had hoped at the time. They were completely on board with ObamaCare’s efforts to use federal funds to strong-arm states.

So what’s the lesson? That standing up for bedrock checks and balances is a far better protector of vulnerable minorities than do-gooding liberal politics.”

I’ve written before that the Trump Administration might not get the anticipated “free pass” to bash migrants that they apparently anticipate from Republican appointees on the U.S. Courts of Appeals and a conservative majority Supreme Court.  Leaving aside “hot button” or “litmus test” issues like abortion, doctrinal conservatives often have great Constitutional reservations about the unbridled use of Executive Power. Indeed, doctrinal conservatism at some point comes close to libertarianism, and libertarianism has some things in common with liberalism.

Thus, at some point in my career, I found myself sitting at a Cato Institute Seminar and nodding in agreement when none other than Grover Norquist described his essentially “free market” approach to migration and border enforcement issues.

In  the end, the fact that independent Article III judges, conservative, liberal, middle of the roaders, Republicans, and Democrats, freed of political control, will deliberatively decide what the law requires could turn out to be a bigger problem for the Trump Administration than they had anticipated.
