STATE LEVEL DIVERGENCE IN RESPONSE TO THE MIGRATION SURGE

While legislative reform continues to be blocked at the federal level, states across the country have adopted diametrically opposed responses to the surge of migrants that have reached the U.S.-Mexico border in search of safety and economic opportunity.

On one side of the split screen, we see real innovation happening with 20 states now having dedicated, high-level staff focused on immigrant integration and building a more welcoming, inclusive America. That includes programs designed to better incorporate immigrants and refugees into state workforce systems, expand the capacity of legal and direct service providers, and ensure access to other support systems that welcome new arrivals with dignity and care.

On the other side of the screen, we see Governor Abbott (TX) continuing to sow constitutional chaos. Building on his claim that Texas has a “right to self-defense” that supersedes the Constitution – a claim endorsed by 25 Republican governors – he announced his intention to “build an 80-acre base to house up to 1,800 Texas National Guard members near Eagle Pass.” This base could “expand to incorporate up to 2,300 personnel” and “cements a large law enforcement infrastructure in the region,” The state is also targeting a Catholic migrant shelter with “human smuggling”, elevating the state’s challenge to federal supremacy over immigration and border enforcement.

We are undoubtedly facing a unique set of pressures at our southern border and in states and cities throughout the country as a result of historic levels of migration throughout the hemisphere. Our current inability to effectively respond to these pressures is the result of decades of Congressional failure to forge compromise on the contours of a flexible system that can effectively manage migration. As states take steps to fill the breach, we are seeing very different visions of what the future may hold.

2) U.S. Judge In Texas Tosses GOP States’ Frivolous Challenge To Successful Parole Program — From The Border News

https://open.substack.com/pub/bordercenter/p/drownings-spike-along-san-diego-coastline?r=1se78m&utm_medium=ios

🌍 Humanitarian Asylum Program Survives States’ Challenge, Federal Judge Upholds Entry for Migrants from Four Countries

The Associated Press’s Eric Gay.- A federal judge in Texas dismissed a lawsuit from Republican-led states challenging a Biden administration program that allows a certain number of migrants from Cuba, Haiti, Nicaragua, and Venezuela to enter the U.S. on humanitarian grounds. U.S. District Judge Drew B. Tipton ruled that the states failed to demonstrate financial harm caused by the humanitarian parole program, which admits up to 30,000 asylum seekers each month from the specified countries. The program aims to offer lawful pathways while reducing unauthorized border crossings. The White House hailed the ruling, emphasizing the program’s role in addressing labor shortages and enhancing border management. Despite the legal challenge, over 357,000 individuals have benefited from the program, with Haitians being the largest group. The decision underscores the administration’s use of parole authority for urgent humanitarian reasons or significant public benefit, marking an important victory for immigration advocates and the migrants they serve.

******************

Notes:

How unhinged was Texas’s parole challenge?  U.S. District Judge Drew B. Tipton is a Trump appointee, certainly not known for being sympathetic to migrants or the Biden Administration. Previously, he probably was best known for his attempt to block the so-called “Mayorkas Memo” on prosecutorial discretion, which decision later was overturned by the Supremes. See, e.g.https://immigrationcourtside.com/2021/08/19/%f0%9f%8f%b4%e2%80%8d%e2%98%a0%ef%b8%8f%f0%9f%a4%aetexas-style-racism-trumpy-usd-judge-tipton-in-bid-to-take-over-ice-reinstate-gonzo-white-nationalist-enforcement-directed-at-comm/.

Biden must step up on reception and resettlement. This should be a huge “win-win” for the Administration and the nation. With some states, localities, and NGOs already doing the “heavy lifting,” what’s needed is White House leadership and resources! That’s exactly what Heidi Altman of NIJC and other experts recommend with a White House Task Force.  See, e.g.,https://immigrationcourtside.com/2024/03/10/%F0%9F%A4%AE-the-presidential-candidates-are-feeding-us-fear-driven-bs-%F0%9F%92%A9-on-the-border-w-o-meaningful-pushback-from-the-complicit-media-get-some-constructive-practical-humane/.

But, without new expert, dynamic “kick ass” leadership, empowered to supersede those currently bobbling this program at the national level, it will remain a sore point, a horrendous missed opportunity for the Administration, and a “de-energizer” for his core progressive supporters.

Come on, Joe, lead and build on the good work already done by your friends, rather than undermining it by spreading the fears and parroting “lite” versions of the xenophobic approaches of your opponents! Instead of challenging Trump to join you in “closing the border to asylum seekers,” invite everyone to join you in developing and implementing humane, achievable, solutions for fairer and more efficient asylum processing at the border and elsewhere!

Biden must “lose the Miller Lite BS on the border” and tout his successes, like the parole program. Joe, Joe, Joe! Think it through! Trump is going to “win” the “race to the bottom on the border” because he’s a natural “bottom dweller.” So, you need to pivot and emphasize and expand upon the positive things you have done to solve migration problems, like these parole programs!

Additionally, as recently pointed out by David J. Bier of the Cato Institute, your legally and morally correct decision to eliminate the scofflaw Title 42 “bogus border closing” has resulted in an unprecedented drop in the “number of known successful evasions of Border Patrol (“gotaways”) [which] have fallen to just 800 per day in fiscal year 2024.” See  https://substack.com/redirect/a275d25f-333e-4e38-9951-2b452d9b1ea3?j=eyJ1IjoiMXNlNzhtIn0.8hVV2FxILD3e6tMtjfLdJqJhstwOJgxvhGPCBO-pvCg.

Logically, re-opening ports of entry for asylum claims (despite the huge widespread problems with “CBP One”) and incentivizing those who can’t wait at the ports to turn themselves in to CBP in an orderly manner for asylum screening after crossing elsewhere (despite both physical impediments and artificial legal obstacles to doing so) works to reduce the number of those seeking to avoid screening! This is directly contrary to the nativist blather surrounding Title 42!

As Bier says, “This should force the many members of Congress and the administration who opposed ending Title 42 to rethink their position.” While there is zero chance that the GOP will do this, because their position is based on spreading fear and xenophobia for perceived political gain, you and your advisors should reverse your disastrous public stance on how to best promote real, durable, achievable border security.

As Heidi and others have cogently suggested, future success will come from investing in better asylum screening, processing, adjudication, and resettlement, NOT from bombastic threats to “close the border” and effectively eliminate the fundamental right to seek asylum!

Immigration is Fueling America’s Economic Boom – So Why is Migration Still A “Bad” Thing?

Immigration makes America, America.

pastedGraphic.png

BEATRIZ LOPEZ

MAR 1, 2024

This month, in case you missed it, there were several news headlines that once again proved that immigration is not just good for the U.S. economy, but freaking amazing. I’m not exaggerating – just take a look at the glorious reports revealed in February:

  • A Congressional Budget Office report found that, “The labor force in 2033 is larger by 5.2 million people, mostly because of higher net immigration. As a result of those changes in the labor force, we estimate that, from 2023 to 2034, GDP will be greater by about $7 trillion and revenues will be greater by about $1 trillion than they would have been otherwise.”
  • The most powerful economic rebound post-pandemic in the world is thanks to immigration in the U.S. The Washington Post reported, “About 50 percent of the labor market’s extraordinary recent growth came from foreign-born workers between January 2023 and January 2024, according to an Economic Policy Institute analysis of federal data.” Impressively, the surge in hires of immigrant workers filled “unprecedented gaps in the economy that threatened the country’s ability to recover from prolonged shutdowns.”
  • Even The New York Times piled on: “A resumption in visa processing in 2021 and 2022 jump-started employment, allowing foreign-born workers to fill some holes in the labor force that persisted across industries and locations after the pandemic shutdowns. Immigrants also address a longer-term need: replenishing the work force, a key to meeting labor demands as birthrates decline and older people retire.” The report also features a City Council president and member of the Plumbers and Steamfitters union in Indiana who says he would welcome migrants with open arms as his union is in desperate need of members.

Despite so many economists, industry and business leaders, and fellow Americans clamoring for immigrants to come to America and live and work in a small town in the middle of nowhere or somewhere, our politicians are stuck in the quicksand of deterrence, slowly sinking into policy and politics that muddle speeches and don’t make anyone want to save them.

Don’t get me wrong– I do want to save President Biden but, buddy, we need to work on those talking points. While I agree border communities and immigration officials are in dire need of resources and should be provided the proper funding and manpower, President Biden’s continual push for the Senate bipartisan bill was half futile. I get the political jab; use it, in fact, as it works against Republicans. But for the love of God stop trying to push the bill forward. It’s dead. Start planting the messaging seeds for better, more galvanizing solutions that address the border, resource welcoming communities, and deliver legal pathways. And above all center the economic and cultural contributions of Dreamers and immigrant families that Trump is eager to deport.

Humanizing the narrative is always a winning strategy. Recognizing the rewards of immigration and the hard work of immigrants, both in policies and messaging, speaks to those persuadable voters that Biden and Democrats must win over.

Where have you gone, John Fetterman? I roll my lonely eyes at you.

Now here’s someone who’s actually sinking. Yesterday, Senator John Fetterman (PA), on an apparent quest to prove he’s a tough border security hawk, said he would support H.R. 2 except for its aim to terminate DACA. He claims to have analyzed the bill, and if he did, then I am stupid for having ever thought he was a decent guy who understood the importance of immigration in America.

As a reminder, H.R. 2 is basically a Stephen Miller wet dream (I apologize for the imagery): it would (1) end legal representation for unaccompanied children and deport them faster, (2) shut down the asylum system, (3) give any DHS secretary the authority to deny every single migrant the right to seek asylum (in other words, permanent Title 42), (4) jail and detain immigrant families, (5) eliminate humanitarian parole, (6) punish and defund faith-based organizations and NGOs for supporting newly-arrived migrants, and (7) jail and penalize immigrants who overstay their visa. (Imagine if that last one were in place when Fetterman’s wife and mother-in-law had arrived in the U.S.)

Neither H.R. 2 nor the Senate bipartisan bill are “grand bargains” unless it’s a deal scored by a used car salesman hiding the 20% annual interest rate.  When immigration is decidedly incredible for the economy, when immigrants are proudly working and thriving alongside their fellow American, when those seeking freedom and opportunity are willing to risk their lives for a leg up to work – work! – when businesses and communities are desperate for immigrants to fuel their future, our leaders should be grand-standing with a 21st century plan that embraces immigration and immigrants for all that they can do for America.

After all, immigration makes America, America.

Thanks for speaking truth to power, Beatriz!

While Trump and Biden trade barbs and disgracefully try to ”one up” each other as to who can be the most cruel, cowardly, and dumb on “bogus border security,” the real humanitarian and asylum processing crises go unaddressed; the most vulnerable continue to suffer at the hands of a country they want to help while saving their own lives. This is a potential “win-win” that our politicians refuse to embrace!

On the plus side, Senior USDJ David Alan Ezra of the W.D. Tex., preliminarily enjoined SB 4, Texas’s extremist attempt to subvert the Constitution by taking over immigration law enforcement. https://www.aclu.org/press-releases/federal-court-blocks-extreme-texas-legislation-that-would-overstep-federal-immigration-law

Texas will appeal to the too-often-lawless Fifth Circuit, so this saga is only beginning. But, at least this time the “good guys” struck first and won the opening round.

Jaswinder Bolina writes in WashPost:

As a former president of the United States excoriates immigrants for “poisoning the blood” of our country, as the governors of Texas and my current home state of Florida bus and fly migrants to points north — including my hometown, Chicago — my thoughts turn to baseball.

. . . .

While that inhospitable bunch has been villainizing migrants and refugees as a strain on U.S. resources, I have been marveling at how much foreign-born players have enlivened (and enriched) baseball in recent decades. Far from being poisoned, the sport has been rejuvenated by infusions of immigrants from Ohtani to Soto to Ronald Acuña Jr., Yordan Álvarez, Ha-Seong Kim, the Cubs’ Seiya Suzuki and so many others.

As these non-White non-Americans wow — and earn — millions with their transcendent talents, in a sport still emerging from its startlingly racist past, bigoted fictions about the “blood of our country” are being exposed. It’s true that baseball is still struggling with exploitative international recruiting practices, decreasing numbers of U.S.-born Black players and a lack of diversity among its executive ranks. Yet the increasing number of foreign-born major leaguers now counted among the best in the game’s long history dispels the self-aggrandizing myth that the United States possesses any monopoly on excellence.

The Republican presidential front-runner might argue that undocumented migrants and refugees aren’t elite athletes and are instead “animals” arriving from “s—hole countries.” But such dehumanizing insults are not only guilty of offensive fixation on national origin, ethnicity and race. They also mistake a person’s predicament for a person’s potential.

This is made plain by the origin stories of some of baseball’s biggest stars. Those same players who fashioned makeshift mitts out of milk cartons and cardboard, who rose to the game’s highest levels through arduous, harrowing and near-tragic journeys, might have languished on the other side of a barbed and militarized wall if this country’s right wing had its way.

The politicians who would build those walls, who attack immigrants for supposedly burdening our national resources, need only consider baseball’s explosive growth into a $10 billion industry and the financial value of Ohtani alone to the Dodgers — some estimate the team could make more than $1 billion off his deal over the course of a decade — to see that industries and economies thrive by inclusion, not exclusion.

Even so, ideologues seek to end inclusive practices in private industry and public education. They guarantee endless winning and new revolutions by promising to slash resources and wall off our country — all while whiffing on the most rudimentary of winning principles understood by most every baseball fan in America:

Great teams are made great by deep, diversified rosters. They are built on investment in both homegrown and international talent. And there are no curses except those that are self-inflicted by cheap, regressive thinking.

As the Republican presidential primary churns toward that party’s national convention, coincidingthis July with baseball’s annual All-Star Game, all of this will be evident to anyone ready to take a break from the campaign, take a seat in the bleachers and take in the world’s greatest ballplayers thriving at America’s game.

“Mistaking a person’s predicament for a person’s potential!” That’s exactly what Biden’s new-found attacks on asylum seekers and their advocates (his 2020 supporters!) are doing!

Biden is flying in the face of the sage advice for running on a pro-immigration, pro-asylum, pro-rule-of-law platform cogently set forth by Beatriz Lopez on Substack and reposted here on Courtsidehttps://immigrationcourtside.com/2024/02/21/%f0%9f%91%82listen-up-biden-campaign-dems-a-dynamic-latina-leader-%f0%9f%a6%b8%f0%9f%8f%bd%e2%99%80%ef%b8%8f-has-the-formula-for-success-%e2%9c%8c%ef%b8%8fon-immigration-in-2024-sequence/.

It’s not quite too late for Biden to start fixing the asylum and resettlement system at the border and elsewhere so it works in a fair and timely manner for America and forced migrants. But, he can’t do it with the lame advice he’s getting from his advisors, his own moral relativism, and the failed leadership at DOJ and DHS. He needs to move the “bush leaguers” aside, bring in, and pay attention to, some “major league talent” before it IS too late. See, e.g.,https://immigrationcourtside.com/2023/12/19/%E2%9A%96%EF%B8%8F%F0%9F%A4%AF%F0%9F%91%A9%F0%9F%8F%BD%E2%9A%96%EF%B8%8F%F0%9F%91%A8%F0%9F%8F%BB%E2%9A%96%EF%B8%8F-as-garlands-backlog-hits-3-million-way-past-time-to-clean/.

It’s painful to watch the errors pile up and the game slipping away from the Dems! 😣 Meanwhile, rather than being out there helping unify and re-elect Biden and Harris, advocates are marshaling their resources and considerable energy to fight tooth and nail in courts against the Administration’s apparent bone-headed intention to violate asylum law and human rights with illegal asylum bars! Energizing former core supporters to fight against your inane and immoral actions during an election year: A “strategy” that only inept, tone-deaf Dem politicos could love!

⚖️ SUPREMES TOSS GOP AGS’ EFFORTS TO OVERRULE IMMIGRATION POLICIES, ON STANDING GROUNDS — U.S. v. Texas  — A Look Back At Prosecutorial Discretion (“PD”) Over Five Decades — GOP’s Nativist “Open Borders BS” Continues To Dominate Political Debate! 🤯🏴‍☠️

Josh Gerstein

White House Reporter

Josh Gerstein reports for Politico:

States can’t use the federal courts to try to force the federal government to arrest and deport more people who are in the country illegally, the Supreme Court ruled Friday.

The 8-1 decision could cut down on a flood of lawsuits recent administrations have faced from state attorneys general and governors who disagree with Washington on immigration and crime policy.

The high court’s ruling found that Texas and Louisiana lacked standing to pursue litigation challenging immigration enforcement priorities established by President Joe Biden’s administration soon after he took office.

It’s the second decision in eight days in which the Supreme Court has rejected lawsuits from Texas on standing grounds. Last week, the court ruled that the state did not have standing to challenge a federal law that gives preferences to Native American families in the adoptions of Native children.

State standing is a key question in another major issue still awaiting decision from the court in the coming days: the legality of Biden’s decision to wipe out billions of dollars in student debt.

Six states are challenging the debt-relief plan, but it’s not clear if the states have suffered the sort of concrete harm that is typically necessary to challenge a policy in court. (In a separate case, two student-loan borrowers who oppose the plan are also suing. Their legal standing is also contested.)

In the immigration case, critics of the states’ approach said their claim of likely financial injury from unwarranted release of undocumented migrants was murky. But the court’s majority opinion written, by Justice Brett Kavanaugh, took a different tack and said the case was flawed because of a general principle against suits trying to force the executive branch to enforce the law against someone else.

“This Court has consistently recognized that federal courts are generally not the proper forum for resolving claims that the Executive Branch should make more arrests or bring more prosecutions,” Kavanaugh wrote, in an opinion joined by Chief Justice John Roberts and the court’s three liberals. “If the Court green-lighted this suit, we could anticipate complaints in future years about alleged Executive Branch under-enforcement of any similarly worded laws — whether they be drug laws, gun laws, obstruction of justice laws, or the like. We decline to start the Federal Judiciary down that uncharted path.”

Read Josh’s complete article at the above link. The aptly titled case is United States v. Texas, and here’s a link to the full opinion:   https://www.supremecourt.gov/opinions/22pdf/22-58_i425.pdf

I suppose whether you “like” or “hate” this decision depends on who is in power and what you think about them. As my friend and immigration commentator Nolan Rappaport told me, immigrants’ rights advocates might cheer this decision today, but will not be happy if Trump is elected and they can no longer team up with Democrat State AGs to challenge alleged abuses of prosecutorial authority by Trump’s Administration.

Recognizing Nolan’s point that the “sword cuts both ways,” I think this is the correct result. Perhaps, that’s because it’s a derivation of a long line of cases on prosecutorial discretion that we often successfully invoked during my time in the “Legacy INS” OGC. Also, it seems correct from a “separation of powers” standpoint.

One of the cases that the Court relied upon is Linda R. S. v. Richard D., 410 U. S. 614 (1973). Interestingly, that case, then relatively recently decided, was one of the many I cited in the July 15, 1976 opinion that I drafted for then General Counsel Sam Bernsen approving the INS’s use of prosecutorial discretion.  See https://immigrationcourtside.com/wp-content/uploads/2018/02/Bernsen-Memo-service-exercise-pd.pdf.

Prosecutorial discretion was also an issue at the heart of the immigration case of John Lennon, which was recently in the news again because of the death of his legendary immigration counsel, Leon Wildes. See, e.g., https://immigrationcourtside.com/2024/01/09/😇-obit-leon-wildes-90-legendary-immigration-lawyer-educator-a-fond-remembrance-appreciation-from-careen-shannon-🗽/.

The “Bernsen opinion” (FN 8) cited the various Lennon cases and made reference to Leon’s article in Interpreter Releases (1976) on the topic.

After five decades of working in the immigration field in different positions and different levels, I think it’s always interesting how things from my “early career” still have relevance today!

U.S. v. Texas could also spell bad news for Texas GOP insurrectionists Gov. Greg Abbott and AG Ken Paxton in their lawless attempts to impede the U.S. Border Patrol enforcement at the border. See, e.g., https://www.cnn.com/2024/01/17/us/texas-border-patrol-us-mexico?cid=ios_app.

Indeed, although you wouldn’t know it from the mainstream media and the “alternate universe debate” now going on in Congress, the GOP claims of “open borders” and lack of immigration enforcement are total BS. In fact, the Biden Administration has far “out-deported” and “out-enforced” the Trump Administration. See, e.g., https://amsterdamnews.com/news/2024/01/03/deportation-numbers-under-biden-surpass-trumps-record/.

As experts and those who actually work with migrants at the border know, “enforcement only” doesn’t work at the border or anywhere else, although it does fuel political movements and powerful corporate interests. See, e.g., .https://open.substack.com/pub/theborderchronicle/p/prepare-yourselves-for-the-2024-border?r=1se78m&utm_medium=ios&utm_campaign=post. But, truth, rationality, humanity, expertise, and the rule of law are largely absent from today’s one-sided immigration discussions. That doesn’t bode well for the future of our nation or the world.

OLAFIMIHAN OSHIN & Rebecca Beitsch report in The Hill:

https://thehill.com/regulation/court-battles/4203346-federal-judge-again-declares-daca-immigration-program-unlawful/

A federal judge for the second time found the DACA program unlawful, but held back from ordering the deportation of the nearly 600,000 people who remain in the country as “Dreamers.”

The Deferred Action for Childhood Arrivals program, first crafted with a 2012 memo under the Obama administration, was likewise found unlawful by federal District Court Judge Andrew Hanen in a similar ruling in 2021.

“While sympathetic to the predicament of DACA recipients and their families, this Court has expressed its concerns about the legality of the program for some time,” Hanen wrote in the 40-page ruling.

“The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, has decided not to pass DACA-like legislation.”

Given earlier challenges to the DACA program’s creation through a memo, the Department of Homeland Security (DHS) in 2022 underwent formal rulemaking to solidify the basis for the program.

But Hanen found while the government followed the law in undergoing notice and comment rulemaking, the new rule essentially carried the 2012 memo into a formal rule without addressing prior issues criticized by the court.

Last year the Fifth Circuit Court of Appeals, before remanding the case to Hanen, found broader issues with DACA, saying the policy was inconsistent with immigration processes laid out under the Immigration and Nationality Act.

Hanen pointed to that in his Wednesday ruling, noting that while the record underlying the new rule showed DACA to be beneficial to both recipients and the U.S. “DHS did nothing to change or resolve the substantive problems found by this court or the fifth circuit. The decision earned swift backlash from immigration advocates and spurred familiar calls for Congress to act.

. . . .

The decision earned swift backlash from immigration advocates and spurred familiar calls for Congress to act.

pastedGraphic.png“While expected, today’s court ruling is devastating. It impacts hundreds of thousands of immigrant youth and their loved ones, who have already endured years of uncertainty stemming from politicized attacks on DACA,”  Kica Matos, president of the National Immigration Law Center said in a statement.

“Congress has failed to pass a permanent legislative solution, and it is urgent that they act now. We cannot allow court rulings to continue to upend the lives of hundreds of thousands of immigrant youth whose home is here.”

The ruling comes months after a coalition of nine GOP-led states asked Hanen to end the federal program, referring to the program as “unlawful” and “unconstitutional.”

Once you get beyond GOP White Nationalist politicos and judges, DACA legislation is widely popular across the political spectrum. Yet, the GOP is happy to defy the common good, and, sadly, Dems are afraid to leverage and elevate DACA to a “Tier One” issue! So, a generation of younger talent that American needs for the future continues to “twist in the wind!” Stupid, cruel, wasteful!

🏴‍☠️ 🤯 ABSURDIST SCOFFLAW TEX “GOV” ABBOTT BLOWN AWAY IN ROUND I OF “BUOY BATTLE!” — Texas Federal Judge Rejects Ludicrous “Invasion Defense!”

Priscilla Alvarez
CNN Digital Expansion 2019, Priscilla Alvarez
Politics Reporter, CNN

Priscilla Alvarez reports for CNN:

https://www.cnn.com/2023/09/06/politics/texas-mexico-border-water-barriers-migrants/index.html

CNN  —

A federal judge ordered Texas to remove floating barriers in the Rio Grande and barred the state from building new or placing additional buoys in the river, according to a Wednesday court filing, marking a victory for the Biden administration.

Judge David Alan Ezra ordered Texas to take down the barriers by September 15 at its own expense.

The border buoys have been a hot button immigration issue since they were deployed in the Rio Grande as part of Gov. Greg Abbott’s border security initiative known as Operation Lone Star. The Justice Department had sued the state of Texas in July claiming that the buoys were installed unlawfully and asking the judge to force the state to remove them.

In the lawsuit, filed in US District Court in the Western District of Texas, the Justice Department alleged that Texas and Abbott violated the Rivers and Harbors Appropriation Act by building a structure in US water without permission from United States Army Corps of Engineers and sought an injunction to bar Texas from building additional barriers in the river. The Republican governor, meanwhile, has argued the buoys are intended to deter migrants from crossing into the state from Mexico.

Texas swiftly appealed the judge’s order.

. . . .

Ezra also found Texas’ self-defense argument – that the barriers have been placed in the face of invasion – “unconvincing.”

Who knows how this will play out in the 5th Circuit and the Supremes, given the composition of those courts. But, at least for a day, Judge Ezra has brought some common sense and the rule of law to bear on out of control grandstanding Texas “Governor” Greg Abbott.

In addition to being cruel and illegal, Abbott’s $140 million buoy boondoggle is predictably a failure from a deterrence standpoint. See, e.g., https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwi-5saEvpiBAxUXpIkEHU1VBwoQFnoECBoQAQ&url=https://www.livemint.com/news/texas-floating-border-wall-fails-to-deter-migrants-11693942981798.html&usg=AOvVaw0TX6bBkO0Fv0MezJLQPJkk&opi=89978449. (Although Abbott and his White Nationalist supporters falsely claim otherwise.) But, as my friends Dan Kowalski and Judge “Sir Jeffrey” Chase often say, effective deterrence isn’t the point — the cruelty and dehumanization is!

We should also remember that the vast majority of those whom Abbott and the nativists bogusly call “invaders” seek only to turn themselves in to U.S. authorities so they can exercise their clear legal rights to apply for asylum — rights that attach regardless of status or manner of entering the U.S. (Rights that also have improperly been diminished and impeded by the Biden Administration’s ill-advised asylum regulations, currently under legal challenge).

If successful (under a legal system intentionally rigged against them), these so-called “invaders” will use their skills and work ethic to expand our economy and help Americans prosper while saving their lives and those of their families. To anybody other than Abbott and other White Nationalists, that sounds like a potential “win-win” that could and should be “leveraged” for everyone’s benefit!

Melissa Del Bosque writes in the Border Chronicle:

. . . .

While this might seem uniquely cruel, Abbott is closely following the authoritarian playbook of Viktor Orbán, Hungary’s prime minister, and current European thought leader for MAGA Republicans. Donald Trump calls Orbán a friend, and White supremacist Tucker Carlson spent a week covering him for his former show on Fox, later making a “documentary” about Hungary called Hungary vs. Soros: Fight for Civilization. For the last two years, the right-wing Conservative Political Action Conference, founded in the U.S., has held a “Woke Free Zone” conference in Budapest.

Share

By studying Orbán’s crackdown on asylum seekers and its progression over the last several years, you can see exactly where Abbott’s Texas is headed (and DeSantis’s Florida, for that matter).

In a speech in July 2022, Orbán argued that European and non-European people should not mix. Europeans “do not want to become peoples of mixed-race,” he said. After the speech, one of Orbán’s longtime advisers quit in protest. “I don’t know how you didn’t notice that you were presenting a pure Nazi text worthy of Goebbels,” his adviser wrote in her public resignation letter. Orbán’s speech was widely condemned in Europe, and it further alienated him from other Western leaders.

But in Texas, just days after his speech “worthy of Goebbels,” Orbán was welcomed with a standing ovation at the CPAC conference in Dallas, where he touted his “zero migration” and Judeo-Christian nationalism. “The globalists can all go to hell,” he boasted. “I have come to Texas.”

On the same CPAC stage that day, Abbott followed with similar xenophobic talking points. He bragged about Operation Lone Star and encouraged conference-goers to donate to a state-run website to pay for bussing migrants out of Texas. Lieutenant Governor Dan Patrick echoed Orbán’s White Christian nationalism: “The framers did not write the Constitution,” he said. “God wrote the Constitution. We are a Christian nation.”

. . . .

Unsurprisingly, Orbán’s cruel tactics against asylum seekers, which have included kidnappings and beatings, do not deter people from coming. They are fleeing wars, after all. But Orbán has used his poisonous populism to solidify his power, just as Abbott and DeSantis are trying to do. It began with asylum seekers in 2015, but now in Hungary there is no independent media or judiciary, and the LGBTQ community and immigrants have become targets for persecution as the prime minister has consolidated his control over the government. Antisemitism is also on the rise.

This is the playbook that MAGA Republicans are following in Texas, Florida, and elsewhere. We already know how it ends. Orbán’s “illiberal democracy,” which is being lionized by Trump, Abbott, and others, is nothing new. In fact, it’s very old. It’s called fascism.

Read Melissa’s complete article at the link. Nearly 80 years after the fall of the Nazi regime, Hitler’s hateful, racist, virulently anti-Semitic views are alive and well in today’s GOP. 🇺🇸⚖️🗽 ANDREA R. FLORES @ NYT: We Know That “Uber Deterrence” Fails At The Border — Title 42 Debacle Under Trump Proves It: Biden Must Abandon The Restrictionist Remnants & Restore Legality & Integrity To Our Current Refugee & Asylum Systems!

Andrea writes in a NYT Op-Ed:

U.S. asylum laws were designed to protect people fleeing harm. They were enacted in the decades following the Holocaust to ensure that the United States never again turned away people fleeing persecution. But now, many blame these laws for the chaos and inhumanity at the nation’s southern border.

The biggest blow to America’s commitment to asylum came during the pandemic, when former President Donald Trump invoked Title 42, an emergency measure that allowed border agents to turn away asylum seekers, under the justification of preventing the spread of the virus.

When Title 42 restrictions were lifted in May, President Biden enacted a carrot-and-stick approach aimed at deterring new asylum seekers from traveling by foot to the border. These new measures included a set of legal pathways, including a parole program that allows people from select countries, including Cuba and Haiti, to legally enter the country for at least two years, provided they have a financial sponsor in the United States. Doing so has discouraged would-be migrants from taking a dangerous trek with a smuggler, often through multiple continents.

This approach would have been a great step forward if it wasn’t paired with a counter measure that prohibits some asylum-seekers at the border from applying for protection in the United States. The vast majority of migrants must secure an appointment at an official port of entry, which are difficult to obtain, or else they will be subject to expedited removal if they cannot prove that they sought legal protection in another country along the way.

. . . .

If proponents of a secure border are serious about lowering border crossing numbers and decreasing unauthorized migration, they should support Mr. Biden’s attempts to create new legal pathways. Instead, a coalition of Republican attorneys general is challenging the president’s parole program. In Congress, Senate Republicans are trying to eliminate the same parole authority that allowed Afghans to temporarily resettle in the United States. There have been no challenges to the use of the parole authority to bring Ukrainians to the United States.

These actions reveal that our current fight over the border is not about the number of people trying to come here — it is about which should be allowed to come. American voters may not have strong opinions about the future of the asylum system or the legal pathways being created, but voters of both parties dislike the chaos and human suffering that have subsumed this issue for the past 10 years. Over a million American citizens have signed up to sponsor migrants from Cuba, Haiti, Venezuela and Nicaragua.

At a moment of record global displacement, we can’t keep waiting for Congress to modernize our immigration laws. Safe legal pathways are good for the people who use our immigration system. Mr. Biden has taken some critical steps to give migrants better options, but with no hope of congressional action in the near future, more is needed.

Andrea R. Flores is the vice president for immigration policy and campaigns at FWD.us.

Read the complete op-ed at the link.

Much of what Andrea says echoes what I have said over and over on Courtside and has been repeatedly recommended by experts, who are then largely ignored by the Biden Administration.

As I have argued before, the “low hanging fruit” here would be EOIR reform: A new BIA of “practical scholars;” better IJs with proven asylum and human rights experience; ending “Aimless Docket Reshuffling On Steroids” (which drives many poor policy and legal decisions); and getting some dynamic, fearless, expert leadership on human rights and immigration at the DOJ — which is either the driver or the facilitator of many of the problems at the border, depending on how you look at it.

We can also see how Garland’s lackluster performance on immigration affects other areas of justice such as civil rights, women’s rights, and LGBTQ rights, to name a few of the most obvious ones. Nobody at today’s DOJ appears to possess the “big picture” knowledge and experience to “connect the dots” on these critical issues.

So, how is this type of legal and human abuse acceptable from a Dem Administration that promised good government and to do better than the Trumpsters?

Just to be clear, the chances of a third country volunteering to take a non-national granted CAT relief are very slim.  I don’t remember it happening on any case on my docket during my time on the bench in Arlington. Also, were that to happen, the DHS would be obligated to give the respondent an opportunity to seek  CAT to that third country, likely a lengthy process.

So, detention in this circumstance doesn’t make sense from a practical, legal, or fiscal standpoint!

**Pre-Program Lecture Online scheduled for Friday, September 22, from 12:00 – 1:30 PM EST.**

WHY YOU SHOULD ATTEND

As an immigration defense lawyer, you know that practicing in immigration court is increasingly rife with changes and complexity. NITA recognizes this reality and, in response, has developed Advocacy in Immigration Matters, a specialized and timely program designed to help you rapidly upgrade your skills in representing those facing removal from the United States.

WHAT YOU WILL LEARN

This is the only trial skills advocacy course available that covers everything you will experience during an immigration trial. From pre-trial to trial, you will receive on-your-feet training and guidance that goes beyond a lecture-focused learning experience. During this three-day program, you will:

  • make and meet objections,
  • conduct direct, cross, and re-direct examinations,
  • accredit a proposed expert witness,
  • obtain the required opinion from an expert witness, and
  • offer a concise yet compelling closing argument.

All of this will be done in small groups of your peers, with feedback and at a pace that will help boost your performance.

The instructors—some of the most experienced immigration trial lawyers and judges in the country—will share constructive feedback and specific ideas on how to refine your skills. As you watch your peers perform, you will also absorb the “teachable moments” from their performance and instructor critique, which means each layer of learning is continually reinforced by what you hear, see, and most importantly, do.

After three days, you will be able to step into the courtroom with the confidence and practical skills you need to be a good advocate for your client.

In addition, to supplement this “learning-by-doing,” you will have access to NITA’s trial skills video lectures and watch the faculty demonstrate skills. Furthermore, NITA will offer a pre-program, one-and-a-half-hour session on case analysis that will be foundational to the rest of the program and will ensure that participants seek and present the information most relevant to the assigned particular social group.

In just three days, this Advocacy in Immigration Matters program—as with the other time-tested, premier programming that NITA is known for—will swiftly refine your trial practice, leaving you with greater skill and confidence that shows up where it matters the most: when you stand shoulder-to-shoulder with your client in the courtroom.

NITA’s LEARNING-BY-DOING METHOD

NITA’s learning-by-doing method allows you to take calculated risks without ever jeopardizing your client’s case or your own reputation. It is a safe space to learn and practice. This course will employ the tried-and-true learning-by-doing method by providing ALL participants the opportunity to apply their learned skills as if they are presenting in court. You get to participate and observe, learning not only from your mistakes and triumphs but those of your fellow participants as well.

Expert faculty will provide you with constructive feedback, and you will have the option of recording yourself on your phone, which allows you to see and hear yourself the way judges and juries do. But unlike in a trial where there are real stakes at risk, at NITA you will have the opportunity to correct your mistakes, eliminate any bad habits you may have developed, and refine your trial skills.

When you return to your office, you will feel empowered by having learned skills that will serve you the rest of your career.

WHO SHOULD ATTEND?

You should!

Although some removal defense cases may not go to trial because of prosecutorial discretion, learning and refining your trial skills will translate into better outcomes for your clients.

Honing your trial skills will improve virtually every aspect of the many things you do as a litigator from negotiating with the OPLA assistant chief counsel to convincing the immigration judge to grant your client relief.

YOUR REGISTRATION INCLUDES

  • One-on-one personalized feedback and coaching from NITA faculty
  • Case materials
  • One credit toward the NITA Advocate Designation.

WHAT ARE PEOPLE SAYING ABOUT THIS COURSE?

“I would highly recommend this course to immigration practitioners. It was especially helpful for me as someone who began practicing during COVID, but I could see that the skills would also be useful to practice for more experienced practitioners. The course was 100% worth it and I came out of it feeling more confident in my ability to do defensive work.” — NITA – NIPNLG “Advocacy in Immigration Matters” course attendee (August 2022)

“This was literally the most useful training I’ve had in the legal field, including law school, internships and many other PD opportunities I’ve tried to take advantage of. I think in the legal profession, there’s such an emphasis on being right and being prepared that we have a hard time taking risks and messing up. Even in trainings and simulations, I participated very little because I felt like there was this very high amount of minimum knowledge that I needed, didn’t have, and didn’t know how to get. I guess I figured everyone had learned this in debate or Model UN, which I never did. But somehow, the instructors created this baseline understanding that we’re there to learn, we can start from zero, and messing up is welcomed because it shows we’re taking risks. I feel much more ready to work on my cases. What’s more, in a field where burnout is so high, I feel excited to prep for trial now.” — Advocacy in Immigration Matters online course attendee (April 2022)

“In the over twenty years I had the honor to serve as an immigration judge, I frequently saw attorneys who, although bright, dedicated and familiar with their clients’ cases, had very limited understanding of evidentiary rules, proper forms of direct and cross-examination, effective storytelling, and the art of closing argument. These basic trial skills are not usually part of a law school curriculum, and once engaged in the practice of law most attorneys do not take the time to develop or hone their skills, other than by “trial and error,” which is, sadly, sometimes at the expense of their clients. The NITA program provides a unique opportunity to develop these extremely important skills. I encourage those who are seeking to represent asylum seekers in Immigration Court to consider taking advantage of this unique and valuable opportunity.” — Hon. Eliza C. Klein, United States Immigration Judge (Ret.)

🏴‍☠️ ADMINISTRATIONS CHANGE, BUT SCOFFLAW MISTREATMENT OF ASYLUM SEEKERS DOESN’T — US District Judge Jon S. EBSC III MSJ order

Here’s a report from Hon. “Sir Jeffrey” Chase of the Round Table:

Hi all: As you know, our group filed an amicus brief in East Bay Sanctuary v. Garland, challenging the new rules at the border that would make most of those unable to get an online appointment through an app ineligible to apply for asylum.

District Court Judge Jon Tigar just issued the attached order granting summary judgment to plaintiffs and denying defendants’ motion for summary judgment.

From Judge Tigar’s order:

“Congress granted the agencies authority to impose additional conditions on asylum eligibility, but only those consistent with section 1158…Two of the conditions imposed by the Rule have been previously found to be inconsistent with Section 1158…

The Court concludes that the Rule is contrary to law because it presumes ineligible for asylum noncitizens who enter between ports of entry, using a manner of entry that Congress expressly intended should not affect access to asylum. The Rule is also contrary to law because it presumes ineligible for asylum noncitizens who fail to apply for protection in a transit country, despite Congress’s clear intent that such a factor should only limit access to asylum where the transit country actually presents a safe option.”

The order is stayed for 14 days to allow the government to appeal.

Our group has once again helped make a difference in providing fairness and due process. Congrats to all.

**********************

Congrats to the plaintiffs and to my Round Table colleagues!

This was basically a blowout for the plaintiffs on all issues! The USG argument essentially was that complying with the law would be too difficult and/or politically unpopular. Therefore, they have chosen to violate the law and to use rather transparent pretexts (actually misrepresentations about the bogus “presumption”) to evade it.

Really, folks, how do we have a Dem AG who 1) approves such complete legal nonsense; 2) advances essentially frivolous and disingenuous arguments in an attempt to defend the indefensible; and 3) can’t make the legal system for asylum work in a fair and legal manner at EOIR or DHS?

How immoral and intellectually dishonest are Garland’s arguments. Here’s one of my favorite passages from Judge Tigar’s opinion:

While they wait for an adjudication, applicants for asylum must remain in Mexico, where migrants are generally at heightened risk of violence by both state and non-state actors.

See, e.g., PC 32446–68 (2022 State Department report noting credible reports of gender-based violence against migrants; reports of migrants being tortured by migration authorities; “numerous instances” of armed groups targeting migrants for kidnapping, extortion, and homicide; and that asylum seekers and migrants were vulnerable to forced labor); PC 22839–42 (NGO report documenting violent crimes against 13,480 migrants in Mexico, by both state and non-state actors, between January 2021 and December 2022); PC 76248–87 (table of crimes summarized in preceding report); PC 21752–58 (2022 NGO report discussing gender-based violence in northern Mexico border cities, including against LGBTQI+ and Black migrants); PC 21610–11 (2022 NGO report concerning gender-based violence against Venezuelan women and LGBTIQ+ migrants in southern Mexico).16

16 In addition to these examples, the record is replete with additional documentation of the extraordinary risk of violence many migrants face in Mexico. See, e.g., PC 22129–30 (2023 news report documenting instances of kidnapping of asylum seekers in northern Mexico); PC 23247–50 (2022 news report quoting Chihuahua state police chief stating that “organized criminal gangs are financing their operations through migrant trafficking”); PC 23082 (2023 NGO report discussing treatment of migrants and asylum seekers); PC 20937–43 (2021 NGO report documenting kidnapping and extortion of Venezuelan migrants in Mexico); PC 29740–29744 (2021 NGO report documenting instances of rape, kidnapping, and other violence experienced by migrant women in Mexico); PC 75946–48 (2022 NGO report documenting violence against migrants in Mexico); AR 4881 (2022 NGO report noting that asylum seekers from Central America have been pursued across the border and found in southern Mexico by their persecutors).

Only somebody who avoids the border, has never represented asylum seekers there, and is impervious to facts and reality could make such outlandish arguments in favor of an outrageously deficient and illegal “policy.” Sounds like something out of the “Stephen Miller Playbook!” Why is it coming from a Dem AG?

There are not a lot of big wins for Viridiana Chabolla ’13 in her line of work. It’s not for a lack of trying, or a lack of sweat and tears. Her commitment has been tested over the years but she remains determined. Chabolla is an attorney working in immigration law. The landscape is grim, she says. It can be heartbreaking. Demoralizing. She’s not just an attorney. She is an immigrant, too, and for most of her life she was undocumented.

In February, the Los Angeles Times wrote a story about one of her recent clients. Leonel Contreras, a U.S. Army veteran, was a legal permanent resident before being deported to Mexico after serving time for a nonviolent crime. Contreras had grown up in the U.S., but after his deportation he worked and lived in Tijuana for at least a decade before the Immigrant Defenders Law Center in Los Angeles took his case and Chabolla helped him return to his family members in California. He became a U.S. citizen earlier this year.

“It’s really nice to wave an American flag at a naturalization ceremony,” says Chabolla, who began working at the Immigrant Defenders Law Center (ImmDef) in October 2021. “Immigration law is so harsh and when it’s not harsh, it’s just not helpful. It’s hard to have a win. When you have those moments, you have to grab on and make them last.”

Chabolla was born in Guanajuato, Mexico. Her mother came to the U.S. to escape a bad relationship and start a new life. A 2-year-old Chabolla and the rest of her mother’s family joined her soon after. Chabolla grew up with her grandparents, aunts and cousins all living close to each other in East Los Angeles. “I’d remember seeing my mom and aunts getting ready for work at ridiculous hours of the day,” she says of the early-morning hubbub. “I remember always being surrounded by people and conversations. There were a lot of disagreements but a lot of love.”

When she was 11, Chabolla met a group of lawyers who worked in East L.A. Although she didn’t know what exactly they did, she recalls thinking that they seemed to hold a lot of power. They seemed to have some kind of authority to help her and others like her—people who were not born in the U.S.

It was during Chabolla’s junior year at Pomona that the Obama administration established an immigration policy that changed her life. Deferred Action for Childhood Arrivals (DACA) allowed certain immigrants who were brought to the U.S. as children to receive a renewable two-year period of deferred action from deportation and also become eligible for a work permit.

For the first time, Chabolla was able to have a job on campus. She saved her first pay stub. It wasn’t much in terms of money, but it was significant for Chabolla.

With DACA, Chabolla’s future seemed a bit brighter. She could now apply for jobs after graduation. Her first work after Pomona was as an organizer with the pro bono legal services nonprofit Public Counsel, a choice that set her on a course for a win of historic proportions.

For four years, Chabolla took down the stories of plaintiffs for cases being handled by Public Counsel. As time passed, she began to feel more empowered to share her immigration status with her director, Mark Rosenbaum, even as the national political landscape was transitioning from an Obama presidency to a Trump one.

“When Trump was elected, I broke down,” she says. She remembers Rosenbaum calling her to tell her she didn’t have to go to work the next day: “Go be with your family, go through your emotions,” he told her.

“We didn’t know what Trump would do first. We just hit the ground running,” says Chabolla, who worked on the defense case for Daniel Ramirez Medina, the first person to have his DACA permit taken away. “With everything going on, we focused on putting out fires. Trump wasn’t taking out DACA in one go just yet. He was creating all of this panic everywhere first.”

Her time at Public Counsel rekindled Chabolla’s original interest in law.

“I kept thinking of the best way I could help others. I loved the idea of gaining new knowledge, and a degree in law would allow me to have a sense of power,” she says. The attorneys at Public Counsel, like her boss Rosenbaum, not only practiced law and led big cases but they also wrote articles and taught university-level courses.

In September of 2017, the Trump administration announced it was officially rescinding DACA. Chabolla had just started at the UC Irvine School of Law. Her initial response was to focus on school and wait.

Then Chabolla got a call from Rosenbaum. “He called me to be a plaintiff in a case against the United States. I felt terrified.”

Chabolla phoned her mother and her family. “If I shared my story, I would have to share their story,” she says. She also was married by then and discussed the possible ramifications with her husband.

Her family was supportive. Chabolla felt compelled to help.

The Public Counsel lawsuit led by Rosenbaum was filed as Garcia v. United States. As it made its way through the higher courts, it was merged with four other cases and ultimately became known as Department of Homeland Security v. Regents of the University of California by the time it reached the U.S. Supreme Court.

As a plaintiff in the case, Chabolla shared her story with a lawyer for a written declaration. While she never testified before any judges, she did have to share her immigration story multiple times as the case garnered national media attention.

On June 18, 2020, the Supreme Court delivered its 5-4 decision blocking the Trump administration’s elimination of DACA. Chabolla was in Washington for the hearing. “A few of us got to go inside,” she recalls. “Some DACA students were there, too. And it was really powerful. These justices were hearing arguments on this huge case…but I know maybe for them all cases they hear are huge. But we occupied half the room and that was really powerful and really unusual.”

Chabolla took notes during the hearing. “I remember writing down something that Justice [Sonia] Sotomayor said: ‘This is not about the law; this is about our choice to destroy lives.’

“So much of what Trump did was done without following administrative law,” explains Chabolla about how they “won” this case. “Trump didn’t follow procedure,” she says. “If they had taken their time and done it right, it would have passed. But I remember taking the win.”

Chabolla, who had just recently become a U.S. resident through marriage, remembers feeling relief for the DACA community.

“The DACA victory in the Supreme Court is a testament to the vision, commitment and tireless efforts of many, and Viri’s name would surely be at the top of that list,” says Rosenbaum. “I had the privilege of working with Viri at Public Counsel, first as an organizer…and then to come forward as a plaintiff in Garcia to inspire others to do the same and make the case that our nation needs DACA recipients to build a kinder and more inclusive community for all of us.”

Upon returning home, Chabolla once again focused on school—it was her second-to-last semester at UC Irvine. She spent a year as a graduate legal assistant with the Office of the Attorney General for the California Department of Justice. It was a tough gig for a newly graduated lawyer. After one year, she left for her current job as a staff attorney at ImmDef, a legal services nonprofit with a post-conviction unit that drew her interest. “They take on clients who have criminal convictions like possession of marijuana from 40 years ago with deportation orders—deportation is not a fair punishment for everyone.

“Many of our clients have been living here as legal permanent residents for more than 20 years. Most find out they’re getting deported just when they’re going to be released,” she says. “The statistics show that immigrants commit fewer crimes than the general population and our clients have already served their time—in jail, or prison, they’ve paid their dues and they’ve even paid their fines. Adding deportation is a way of saying ‘I don’t like that you’re an immigrant.’ It’s extra punishment.”

The work is tough. “My supervisor has shared that sometimes we have to redefine what a win is,” says Chabolla. “It makes up partially for the times when we have a clinic and all these people show up thinking they can apply for residency when they actually can’t.”

She says that the immigrants she talks to are so full of hope. They believe that an attorney—like herself—can do it all. “Every situation is different. No lawyer has a miracle cure.

“It’s heartbreaking to know how many people are becoming elders who don’t have a nest egg, who paid taxes into the system but they can’t access Social Security, can’t access Medicare,” Chabolla adds. “It’s something I’ve been thinking a lot about in the past two years: How can I help aside from placing my hopes in a Congress that is more concerned about building borders than dealing with these issues?”

In 2021, Chabolla became a U.S. citizen. The day was bittersweet and laden with guilt. “It was one of those moments where I felt I was further abandoning my undocumented community, but I know that’s not true,” she says. Although her mother recently became a U.S. resident, some of her family remains undocumented.

Chabolla says she’s been able to find some balance as an ally who was once directly impacted by immigration policies. “I’m trying to find a place where I can remain hopeful in my job and be a zealous lawyer and advocate.”

Congrats and way to go Viri! You have already established yourself as a “New Generation Leader” of the NDPA! Awesome!

For years, the GOP has been mindlessly blocking various versions of DACA, at a great human cost as well as a huge cost to our nation. Dreamers who are able to achieve citizenship, without special help from Congress, and other “New Generation” members of the NDPA must follow the lead of Rep. Hillary Scholten (D-MI) by getting into the “power structure” and forcing long overdue progressive changes.

Thanks to Chief Justice Roberts, the Supremes got this one right, barely 5-4. One vote has made a huge difference in literally hundreds of thousands of lives, and helped to shape American’s future for the better. By contrast, the Trump Administration’s failed attempts to undo this important program was a disgraceful abuse of Government resources! The inability of GOP-controlled states to let this issue go — essentially too keep bullying and threatening some of the most productive and deserving members of our society — is beyond disgusting.

🇺🇸Due Process Forever!
