Hi everyone,

 

I am pleased to report that we, along with co-counsel SPLC, DRA, Orrick, and Willkie, just got the attached order on our motion to enforce our Fraihat COVID preliminary injunction. We are working on developing guidance for detained folks, their families, advocates and allies. We encourage you to read it through if you’re interested because there are a lot of gems in there, but did want to flag these four big takeaways ASAP:

 

  1. Defendants shall mandate more widespread and regular testing of medically vulnerable people, consistent with CDC guidelines and above the level provided by the BOP and state prisons.
  2. Defendants shall mandate that medical isolation and quarantine are distinct from solitary, segregated, or punitive housing, that extended lockdowns as a means of COVID-19 prevention are not allowed, and that access to diversion and to telephones must be maintained to the fullest extent possible.
  3. Defendant shall provide more protective, and more concrete, transfer protocols to protect medically vulnerable people, including a suspension of transfers with a narrow and well defined list of exceptions consistent with CDC guidance.
  4. On custody redeterminations, blanket or cursory release denials are prohibited. Only in rare cases should a medically vulnerable detained individual who is not subject to mandatory detention remain detained, and any exceptions must be supported by specific justifications. With respect to people who are subject to mandatory detention, defendants must perform an individualized assessment, and should only continue to be detained after consideration of the risk of severe illness or death, with due regard to the public health emergency.

What if we had an independent U.S. Immigration Court with judges who had demonstrated due process and human rights expertise? Such a court could require ICE to comply with the law, take appropriate corrective action against contemptuous non-compliance, and relieve US District Judges from the responsibility to supervise ICE.

A plague was the check and balance, not the rule of law, not civility. Trump and Republicans showed hubris in the face of a force of nature that cannot be gaslit, bullied, or emotionally manipulated. A virus demands you engage with it truthfully. You can’t bluster your way out of infection. Trump’s lies and arrogance regarding Covid-19 have cost 210,000 Americans their lives. Those lies and arrogance have finally caught up with him, and he may pay a heavy price. Some people think that’s poetic justice. They are being rebuked by those who think you should never be that callous, not even to a fascist.

Fascists know how to weaponize the norms governing civility to gain and maintain control over others. They know how to exploit sympathy. They know if they pretend to play nice sometimes, people believe they’ll begin to adhere to these norms and stop their harm. It’s a con. It works, though. That’s why four years into the Trump regime, reporters and pundits are still, embarrassingly, talking about his change of tone and his becoming more “presidential” any time he displays the barest modicum of decorum. This dynamic lowers the bar all the way down to Hell. Playing along is always the wrong move.

Just look at yesterday’s Courtside posting — kids and legal refugees continue to suffer while Sessions collects his pension, Hamilton continues to plan criminal enterprises on our dollar, and Rosenstein racks up the big bucks pretending like his venture into child abuse and crimes against humanity were just “normal activities of a senior Government official at the DOJ.” Not normal! Not acceptable!

History tells us what happens to those who “play along to get along.” The U.S. Olympic Committee turning an intentionally blind eye to Hitler’s virulent anti-Semitism so that the U.S. could participate in “Hitler’s Big Show” — the 1936 Olympics. British Prime Minister Neville Chamberlain selling out the Czechs, babbling about “peace in our time” on the eve of the bloodiest war in world history, and pretending that Hitler was “just another German politician” with “traditional” nationalist aspirations.

This Fall, vote Trump and the GOP out at all levels of Government. It might be the last chance to save our democracy from fascism and to save more lives from the malfeasance, ignorance, hate, and evil of Trump and his GOP enablers.

As Paul had written about in August, the New Jersey chapter of the American Immigration Lawyers Association (AILA-NJ) filed a complaint against the Department of Justice/Executive Office for Immigration Review (DOJ/EOIR) over the arbitrary re-opening of the Newark Immigration Court for in-person hearings on July 13, 2020, without proper COVID-19 safety procedures and protocols in place.

 

This is despite the fact that in March, numerous individuals contracted COVID-19 because the Court did not timely close at the outset of the pandemic. To date, a well-respected immigration attorney who was present in the building during that time passed away from COVID-19 complications. Three additional people who worked in the building have also passed away from COVID-19, and many individuals became quite ill due to the exposure; some of whom have permanent health complications as a result.

 

As of now, most courts in NJ remain closed; courts at the municipal, country, state, and federal level have successfully utilized either telephonic or televideo technology to ensure that cases move forward. In fact, the NJ District Court is literally next door to the Newark Immigration Court; it remains closed, and the U.S. Attorney’s Office, which is located in the same building as the Newark Immigration Court, remains closed as well.

 

Before filing the lawsuit, AILA-NJ asked EOIR to provide them with information regarding what safeguards were going to be implemented at the time of reopening, but EOIR declined to respond.

It should be noted that the National Association of Immigration Judges (NAIJ) has been seeking the same information from EOIR, and EOIR has refused to release information to NAIJ as well.

 

Accordingly, AILA-NJ, through the pro bono representation of Gibbons, P.C., filed a complaint and an injunction request in the NJ District Court. DOJ, represented by the U.S. Attorney’s Office, advised the Court that it was not their responsibility to ensure the safety of individuals utilizing the Court; it was the parties’ responsibility to follow proper COVID-19 safety protocols. While Judge Vasquez did not grant the injunction, he was extremely critical of DOJ’s position, calling it “shocking” and “disheartening.” He noted that it was impossible for him to determine if EOIR had acted in an arbitrary and capricious manner in reopening the Newark Immigration Court without being advised as to what went into the decision-making process.

 

Two and ½ weeks ago, DOJ asked for a 2-week extension to file their responses to Judge Vasquez’s requests for information regarding EOIR’s safety plans, any policy discussions/memoranda from the various agencies who were allegedly involved in the decision to reopen Newark Immigration Court in July. DOJ also indicated that, despite previously stating that televideo proceedings were not possible, they were looking into setting them up at Newark.  AILA-NJ agreed to the continuance request.

 

The Newark Immigration Court has held a few televideo hearings over the past two weeks. Attorneys are required to have their clients present with them in their offices when appearing before the Court. One attorney who was forced to do this tested positive for COVD-19 two days later and is now in quarantine.

 

Instead of then complying with Judge’s Vasquez’s order, last Thursday, DOJ filed a letter brief asking the Judge to dismiss the lawsuit as moot. AILA-NJ offered to settle the matter through the use of a consent order; DOJ refused. Therefore, AILA-NJ has opposed the request to dismiss the lawsuit, noting the continuing safety issues, the lack of any uniform procedures for the video hearings, the fact that televideo hearings are subject to individual judges’ discretion, and other concerns.

 

There is a telephonic conference now scheduled before Judge Vasquez for Thursday, October 8, at 11:30 am.

 

As of now, televideo hearings are only being offered at Newark Immigration Court, (not nationwide) and only to AILA-NJ attorney members who request it. Non-AILA-NJ attorneys are not being offered this option, and neither are pro se litigants, who are required to appear in person for master calendar and individual hearings. Court staff, interpreters, and immigration judges are required to be physically present for hearings, thus risking exposure to COVID-19, which is currently on the rise again in New Jersey generally, and in Newark in particular.

 

We have always suspected that EOIR had no safety plans or protocols in place before it decided to arbitrarily reopen the Newark Immigration Court. This view is shared by the NAIJ. The fact that EOIR reversed course and set up televideo hearings in Newark in less than 2 weeks and are now seeking to not release any information demonstrates just how disingenuous and unscrupulous DOJ has become.

 

NAIJ, the New Jersey State Bar Association, the Hispanic Bar Association, and the Round Table of Former Immigration Judges, among others, have all issued statements in support of the AILA-NJ litigation.

Most Asylum Seekers Have No Legal Counsel. This Villanova Program Trains Non-Lawyers to Step In.

has created a college course in which laypeople can learn to advocate for immigrants.

 

The contrast, for a young lawyer in a high-powered New York firm, couldn’t have been clearer. In 1991, Michele R. Pistone was part of a team of lawyers helping Donald J. Trump restructure his massive debts as his Atlantic City casinos hemorrhaged money. Pistone, who was 25 at the time, recalls walking into her client’s office with closing documents and being greeted by an entire floor-to-ceiling wall of framed magazine covers with his photo.

 

Fast-forward a few months to the pro bono assignment that would change the course of her career and inspire her to start a program at Villanova University aimed at expanding legal assistance to immigrants and asylum seekers.

 

Volunteering for a group now called Human Rights First, she represented a father and son who had fled Somalia during a bloody civil war. The father, a minister whose life had been threatened during the uprising, had been charged with alien smuggling since his son did not have a visa. If forced to return to his country, the elderly man faced the possibility he could be killed.

 

About six years after she won their case, the son, who had just earned U.S. citizenship, and his father gave her a colorful straw bag as a thank you. It is a constant reminder, she said, of the power and privilege she has as a lawyer. “It was so amazing to be in a position to save someone’s life.”

 

Pistone, who led lobbying efforts in the mid-90s in Washington, D.C., to protect asylum seekers, estimates that she has helped free more than 100 clients from detention, including former child soldiers, women who fled gender-based violence, and children who fled gang violence.

 

As a professor of law at Villanova, her focus now is on making sure that more refugees and asylum seekers, six out of 10 of whom confront the immigration system alone, get that help.

 

After a successful pilot that ended in May, she started a program this fall to certify students to become legal advocates for migrants and refugees. “Villanova Interdisciplinary Immigration Studies Training for Advocates,” offered through the university’s College of Professional Studies, is described as the first university-based, fully online program to train immigrant advocates. That format, planned before the pandemic forced most courses online, allows easier access for working professionals, including those in rural areas, and keeps costs low.

 

Graduates can apply to become Department of Justice “accredited representatives,” non-lawyers who are authorized to provide inexpensive legal representation to migrant and refugee families. Accredited representatives, who must work or volunteer for a recognized group like a nonprofit or faith-based organization, can sign legal documents, accompany clients to interviews, and perform other duties a lawyer would handle in court.

 

In the United States, where deportation cases are civil proceedings, immigrants are not entitled to court-appointed lawyers the way they are in criminal proceedings.

 

Access to legal representation makes a huge difference, according to the Vera Institute of Justice. The nonprofit research and policy group found that immigrants are 12 times more likely to get available relief when they have an advocate.

 

“Tens of thousands of people each year go unrepresented, including asylum seekers, longtime legal residents, immigrant parents or spouses of U.S. citizens, and even children,” the Vera Institute notes. “They are left to defend themselves in an adversarial and notoriously complex system against the United States government, which is always represented by counsel.”

 

The Committee for Immigration Reform Implementation estimated in 2014 that at least one million of the unauthorized immigrants living in the U.S. were eligible for legal relief and would be permitted to live in the U.S. if they had access to legal representation.

 

Few people facing the threat of deportation can afford to hire lawyers, and nationwide, there are only about 300 fully accredited representatives authorized to counsel clients in court, Pistone said. That’s where VIISTA hopes to make a difference.

 

The program is divided into three 14-week modules. The certificates students earn after completing each module authorize them to take on increasing levels of responsibility for representing immigrants. The first module, which prepares students to interview and be sensitive to the needs of immigrants, addresses why people migrate, the structure of government immigration systems, and cultural differences. The second and third focus on immigration law and train people to become partially or fully accredited representatives. Students can complete one, two, or three modules.

 

Among the students who completed all three modules in the pilot this spring is Eileen Doherty-Sil, an adjunct associate professor of political science at the University of Pennsylvania who teaches about forced migration. It’s one thing, Doherty-Sil said, to teach about the United Nations Convention Against Torture, and quite another to represent a client who could face torture if returned to his home country.

 

The insights she gained in the program will enrich her teaching, she said. “Michele’s program gave us a really clear-eyed idea of what it looks like for someone to face a judge and say, ‘Please don’t send me back.’”

 

Without someone to advise him, an asylum seeker who fears he could be tortured or killed if he’s returned might instead say in court that his goal is to get a good job and be a good citizen. “They can’t possibly know that that’s the wrong thing to say,” Doherty-Sil said. Asylum is for refugees fleeing persecution, not for someone seeking a better life.

 

Pistone likens the development of specialized legal representatives to the growth of nurse practitioners and physician assistants in the medical field. (The role is different from paralegals, who are trained to support lawyers within their offices but aren’t authorized to appear in court.)

 

The problem of representation became more acute as mounting tuition and shrinking job opportunities caused the number of law-school applications to tumble beginning in 2008-9. But even when people complained about a glut of lawyers, there never seemed to be enough people willing, or financially able, to represent the poorest clients.

 

“A lot of people in the legal academy think the solution to access to justice is lawyers, yet we’ve been trying for so long using lawyers,” Pistone said. The system, she said, is clearly broken. “It’s up to those of us in the system to come up with a viable, scalable solution.”

 

All three modules of the VIISTA program can be completed in 10 months, for a cost of under $4,000.

 

Pistone’s students have included teachers, social workers, and others who want to play a more active role in helping immigrants.

 

“I want to train 1,000 people a year,” Pistone said. “And if they each represented one client a month, that’s 12,000 families that are getting an advocate in immigration court.”

‘We Need to Take Away Children,’ No Matter How Young, Justice Dept. Officials Said

Top department officials were “a driving force” behind President Trump’s child separation policy, a draft investigation report said.

WASHINGTON — The five U.S. attorneys along the border with Mexico, including three appointed by President Trump, recoiled in May 2018 against an order to prosecute all undocumented immigrants even if it meant separating children from their parents. They told top Justice Department officials they were “deeply concerned” about the children’s welfare.

But the attorney general at the time, Jeff Sessions, made it clear what Mr. Trump wanted on a conference call later that afternoon, according to a two-year inquiry by the Justice Department’s inspector general into Mr. Trump’s “zero tolerance” family separation policy.

“We need to take away children,” Mr. Sessions told the prosecutors, according to participants’ notes. One added in shorthand: “If care about kids, don’t bring them in. Won’t give amnesty to people with kids.”

Rod J. Rosenstein, then the deputy attorney general, went even further in a second call about a week later, telling the five prosecutors that it did not matter how young the children were. He said that government lawyers should not have refused to prosecute two cases simply because the children were barely more than infants.

“Those two cases should not have been declined,” John Bash, the departing U.S. attorney in western Texas, wrote to his staff immediately after the call. Mr. Bash had declined the cases, but Mr. Rosenstein “instructed that, per the A.G.’s policy, we should NOT be categorically declining immigration prosecutions of adults in family units because of the age of a child.”

The Justice Department’s top officials were “a driving force” behind the policy that spurred the separation of thousands of families, many of them fleeing violence in Central America and seeking asylum in the United States, before Mr. Trump abandoned it amid global outrage, according to a draft report of the results of the investigation by Michael E. Horowitz, the department’s inspector general.

The separation of migrant children from their parents, sometimes for months, was at the heart of the Trump administration’s assault on immigration. But the fierce backlash when the administration struggled to reunite the children turned it into one of the biggest policy debacles of the president’s term.

Though Mr. Sessions sought to distance himself from the policy, allowing Mr. Trump and Homeland Security Department officials to largely be blamed, he and other top law enforcement officials understood that “zero tolerance” meant that migrant families would be separated and wanted that to happen because they believed it would deter future illegal immigration, Mr. Horowitz wrote.

The draft report, citing more than 45 interviews with key officials, emails and other documents, provides the most complete look at the discussions inside the Justice Department as the family separation policy was developed, pushed and ultimately carried out with little concern for children.

This article is based on a review of the 86-page draft report and interviews with three government officials who read it in recent months and described its conclusions and many of the details in it. The officials, who spoke on the condition of anonymity because they had not been authorized to discuss it publicly, cautioned that the final report could change.

Before publishing the findings of its investigations, the inspector general’s office typically provides draft copies to Justice Department leaders and others mentioned in the reports to ensure that they are accurate.

Mr. Horowitz had been preparing to release his report since late summer, according to a person familiar with the investigation, though the process allowing for responses from current and former department officials whose conduct is under scrutiny is likely to delay its release until after the presidential election.

Mr. Sessions refused to be interviewed, the report noted. Mr. Rosenstein, who is now a lawyer in private practice, defended himself in his interview with investigators in response to questioning about his role, according to two of the officials. Mr. Rosenstein’s former office submitted a 64-page response to the report.

“If any United States attorney ever charged a defendant they did not personally believe warranted prosecution, they violated their oath of office,” Mr. Rosenstein said in a statement. “I never ordered anyone to prosecute a case.”

The Government did not seriously question the correctness of this finding! 

Intentionally violating Constitutional rights (not to mention lying and attempting to cover it up) is clearly a violation of 18 USC 242.

Here’s the text of that section from the DOJ’s own website:

TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, … shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Sure looks like an”open and shut” case for prosecution.

The irony: Families and their kids have been traumatized for life, perhaps even killed or disabled by the actions of these criminal conspirators; however, the “perps” remain at large.

Hamilton is on the public dole continuing to wreak-havoc on the Constitution, the rule of law, the Immigration Courts, and human decency at the corrupt Barr DOJ; Rosenstein works for a “fat cat” law firm hauling down a six figure salary while he avoids justice and accountability for his misdeeds; “Gonzo” had the absolute audacity to try to reinsert himself onto the public dole by running for the Senate from Alabama (thankfully, unsuccessfully, even though he previously held the seat for years and misused it as a public forum to spread his racist ideas, xenophobic venom, lies, false narratives, and unrelenting cruelty).

Where’s the “justice” in a system that punishes victims while letting “perps” prosper and go free?

Paul Schmidt, who served as a board member and board chair of the Board of Immigration Appeals under the [Clinton] administration, said that Trump is not the first to manipulate the courts. In 2003, President George Bush’s Attorney General John Ashcroft removed board members whose views did not match the administration’s ideas for immigration. “You can track the downward trajectory of the immigration courts from Ashcroft,” he said. “We call it the purge. If you’re not with the program, your job could be on the line.… Ashcroft rejiggered the system so there’s no dissent.”

Schmidt said he “got bounced” because of his views, which makes him skeptical of the courts ever being independent in the current system. “How can you be a little bit independent?” he said. “It’s like being a little bit pregnant. You either are, or you aren’t.”

Congrats to Marcia for recognizing that while the seeds of the current Immigration Court disaster originated in the Bush II Administration, they also grew steadily because of the Obama Administration’s mismanagement and misuse of the Immigration Courts.

Given a rare chance to create a truly progressive, due-process-oriented judiciary, without any interference from Mitch McConnell and the GOP, the Obama group chose another path. They promoted “Aimless Docket Reshuffling” at EOIR to meet improper political policy objectives. At the same time, they almost totally “shut out” the human rights, clinical, and immigration bars by appointing over 90% of Immigration Judges from Government backgrounds, overwhelmingly DHS prosecutors. 

Notwithstanding a process that did not require Senate Confirmation, the Obama Administration politicos took a mind boggling average of two years to fill Immigration Court judicial vacancies! They also left an unconscionable number of unfilled positions on the table for White Nationalist AG Jeff Sessions to fill!

Sure, it’s not “malicious incompetence” like the Trump regime. But, for asylum applicants and other migrants whose lives and due process rights are now going down the drain at an unprecedented accelerated rate, the difference might be negligible.

Dead is dead! Tortured is tortured! Missed opportunities to save lives are lives lost!

First, and foremost, Biden/Harris need to get elected. But, then they must escape the shadow of Obama’s immigration failures and do better for the many vulnerable and deserving folks whose lives are on the line.

Shouldn’t be that hard! The progressive legal talent is out there for a better Federal Judiciary from the Immigration Courts to the Supremes.

It just requires an Administration that takes due process, human rights, human dignity, and equal justice for all seriously and recognizes that in the end, “it all runs through immigration and asylum!” The failure to establish a sound, independent, institutionalized due process and equal justice foundation at the U.S. Immigration Courts, the “retail level” of our courts, now threatens to infect and topple the entire U.S. justice system! We need to end “Dred Scottification” before it eradicates all of our individual rights.

Unlike criminal defendants, asylum seekers have no right to “appointed counsel.” Yet, never in the history of our country has access to legal assistance been more important to asylum seekers’ Fifth Amendment Due Process rights.

The Justice Department and the DHS have actively sought to skew asylum law against asylum seekers by reversing favorable precedents and promulgating restrictive regulations intended to evade the protections available under the Refugee Act of 1980, the Immigration & Nationality Act, and international conventions. They have also used arrests, detention, shortened filing deadlines, pressure on Asylum Officers and Immigration Judges to deny more asylum applications, and other “gimmicks” to discourage legitimate asylum seekers from filing, documenting, and pursuing their applications.

Without access to competent counsel, experienced in the latest developments in asylum law and enforcement, asylum seekers have little chance of prevailing at the administrative level and virtually no chance of successfully seeking review and intervention from Article III Courts to protect and vindicate precious, often life-saving, statutory and Constitutional rights.

SIJS Priority Dates

For the first time in more than two years, the priority dates for SIJS applicants from El Salvador, Honduras, and Guatemala have advanced. The new priority date is February 1, 2018. All I-360 SIJS applications filed on or before February 1, 2018 may now file for adjustment of status. The priority date for Mexican SIJS cases is current which means that any Mexican SIJS applicant may file now for adjustment of status. SIJS adjustment cases will not be able to waive the considerable filing fees if/when the new rules go into effect and given the opacity of the visa bulletin, we are not sure the priority dates will remain at the current dates past October 31.

NYT: The change in the number of refugees that Mr. Trump plans to admit is not drastic: no more than 15,000 in the fiscal year that began Thursday, down from 18,000 in the 2020 fiscal year, which was a record low. The number was set in a notice sent to Congress late Wednesday, shortly before the statutory deadline to set the new limit. SCMP: The United States has released guidance on its immigration laws that will make it almost impossible for members of a Communist party or similar to be granted permanent residence or citizenship of America. A federal judge in Maryland has granted an undocumented Indonesian immigrant temporary reprieve from deportation, ruling Friday evening that immigration authorities cannot remove him from the country until he has a chance to pursue religious asylum.

Binsar Siahaan, a 52-year-old father to two U.S. citizens, attracted considerable support from faith-based activists nationwide after he was arrested by U.S. Immigration and Customs Enforcement last month at his home on the grounds of Glenmont United Methodist Church in Silver Spring, Md. He and his wife, also an undocumented Indonesian immigrant, work there as church caretakers.

ICE arrested an undocumented immigrant on church grounds. They lied to coax him out, family and attorney say.

Siahaan’s attorneys, Elsy Ramos Velasquez and Patrick Taurel, had argued the arrest was made under false pretenses, without a warrant and in violation of ICE’s policy that typically prohibits agents from making arrests on church property. They also argued that Siahaan, who is Christian, should not be deported to majority-Muslim Indonesia until he has a chance to fully pursue religious asylum.

On Friday, U.S. District Judge Paul Grimm agreed, granting Siahaan a preliminary injunction that blocks ICE from removing him from the country until the Board of Immigration Appeals, or a higher federal court, makes a ruling on his pending appeal. Siahaan is being held at a detention center in Georgia, where he was transferred from Baltimore to await deportation. Grimm also ordered ICE to bring him back to Baltimore, where he will remain in custody closer to his family.

“When the ruling came down, we were really relieved,” said the Rev. Kara Scroggins, pastor at Glenmont United Methodist. “We’re glad that he’s closer to home at the detention facility in Baltimore, but we’re going to keep fighting until he’s home with his family.”

ICE could not immediately be reached for comment Saturday but previously said Siahaan was arrested “after he received full due process in the nation’s immigration courts.”

Hats off to the litigation team and to U.S. District Judge Paul Grimm! By ordering ICE to return Siahaan to Maryland, rather than detaining him in Georgia, generally known as one of the worst places in the “New American Gulag,” Judge Grimm took the kind of effective action necessary to stop the abusive actions of ICE and to guarantee real due process!

 

In a functioning system with an independent U.S. Immigration Court comprised of Judges with expertise in asylum and human rights laws and a commitment to due process and the rule of law, Immigration Judges could take the actions necessary to protect fundamental rights and hold ICE accountable without constant resort to the U.S. District Courts. A “captive” Immigration Court, where Immigration Judges are subservient to Billy the Bigot Barr and pressured to act as “ICE enforcement in robes” ill-serves the national interest! It’s also highly inefficient and wasteful of public resources!

A federal judge has ordered that the 2020 Census count continue until Oct. 31, blocking for now the government’s efforts to complete the survey in time to deliver apportionment data to the president by the end of the year.

 

The ruling late Thursday night by U.S. District Judge Lucy Koh of the Northern District of California follows a tense week in which the government appeared to try to circumvent a preliminary injunction against ending the count early.

 

After a surprise announcement Monday that the bureau was moving the end date by just five days, from Sept. 30 to Oct. 5, plaintiffs in the case asked Koh to provide clarification of her earlier order and other sanctions.

 

Census Bureau announces new ‘target date’ of Oct. 5 to finish 2020 Census count

Rejecting the government’s argument that the request was “an attempt to radically modify the preliminary injunction,” Koh’s new ruling clarified that the end date for collection must revert to Oct. 31, as the bureau had originally planned.

 

It also ordered that on Friday, the government must send text messages to all Census Bureau employees notifying them of the Oct. 31 end date, and that Director Steven Dillingham must file a declaration by Monday that “unequivocally confirms Defendants’ ongoing compliance with the Injunction Order and details the steps Defendants have taken to prevent future violations of the Injunction Order.”

The suit, brought by the National Urban League and a group of counties, cities and others, said a truncated schedule would irreparably harm communities that might be undercounted.

 

On Friday, Kristen Clarke, president and executive director of the Lawyers’ Committee for Civil Rights Under Law, which is arguing the case, said, “Once again, the court has stopped the administration in its tracks.” Noting that some states with significant minority populations still face an undercount, she added, “Much work remains to be done to achieve an accurate census count that satisfies constitutional standards.”

 

The Justice and Commerce departments did not respond to requests for comment.

The government had appealed Koh’s Sep. 24 injunction to the U.S. Court of Appeals for the 9th Circuit, which denied the appeal Tuesday.

Nevertheless, Koh found that after her injunction, the government continued to tell employees to wind down operations by Sept. 30, and the Census Bureau’s website, “which is updated daily,” continued for four days after her injunction to say that data collection would end that day.

In the absence of any justifying change in fact or law, the Attorney General (“AG”) has reopened Mr. Chowdhury’s case fourteen (14) years after he received a final decision on the merits of his claim for asylum following a full evidentiary hearing before the Immigration Judge (“IJ”) and a complete and fair review by the Board of Immigration Appeals (“BIA” or “Board”).
The AG’s invocation of his self-referral authority is wholly improper here. As an initial matter, the AG lacks the authority to reopen and terminate asylum cases once asylum has been granted by an IJ or the Board. But even if the AG had such authority, doing so in this case constitutes ultra vires conduct in violation of Mr. Chowdhury’s due process rights given the excessive and unreasonable delay in referral. The referral is additionally improper because, under the principles of res judicata, there should be a finality and certainty to judgments, particularly where there is no change in fact or law and so much time has passed. In addition, it appears that the AG is succumbing to political pressure from the Executive branch and is reopening the case to align with its foreign policy to aid Bangladesh. Such bias and political motivation is contrary to our immigration system, and indeed our entire legal system. Lastly, the unjustified and excessive delay in reviewing Mr. Chowdhury’s case violates his due process rights and runs contrary to the humanitarian intent of the law.
The AG’s decision to intervene unfairly and unlawfully in a long-settled asylum case infringes the sense of safety, security, and wellbeing of not only Mr. Chowdhury and his family, but also tens of thousands of other asylees who have made their homes in the U.S. in reliance on asylum and protection from persecution and in many cases, violence, in their countries of origin. The Amici Curie respectfully urge the AG to leave Mr. Chowdhury’s asylum case undisturbed, thereby respecting his rights as well, as the rights of the tens of thousands of asylees who have been granted refuge here, and maintaining the fair and impartial adjudication process in place.

On Friday afternoon, Donald Trump’s approach for the entirety of the pandemic, i.e. utter disdain for mask-wearing, social distancing, and taking the advice of experts in general, reached its inevitable conclusion when he was transported to Walter Reed hospital after testing positive for COVID-19 in the early hours of the morning. On top of the president’s escalating health situation, the virus has also infected a number of people with whom Typhoid Donald and others in the administration have come in contact over the last several days, including first lady Melania Trump, adviser Hope Hicks, three members of the White House press corp, a White House staffer, Republican National Committee Chairwoman Ronna McDaniel, and Senator Mike Lee, who spent last weekend rubbing up against anyone in arm’s reach at an event in the Rose Garden to announce Amy Coney Barrett’s nomination to the Supreme Court. And while at this point mandating masks in the White House would be kind of a no-brainer, if not an extreme case of the horse having already left the Oval Office, apparently the administration is planning to just let herd immunity take its course.

Yes, as of Friday afternoon, the Associated Press and the Wall Street Journal were both reporting that the administration still wasn’t requiring employees to wear masks, describing the use of the coverings as “a personal choice,” despite overwhelming evidence that they help stop the spread of the highly contagious disease. As if to really drive home the point that the administration remains hostile toward science and medical expertise, throughout the day numerous officials appeared on camera sans mask, including chief of staff Mark Meadows . . . .

Wow! Who would have thought that taking COVID-19 seriously, taking precautions, and wearing a mask would make a difference? Certainly, nobody in the White House!

While some reporters are using the term “surreal” to describe yesterday at the White House, that term would hardly distinguish yesterday from every other day of the Trump Administration. We’ve been living in “The Twilight Zone” for so long that nobody can remember what “normal” was.

Election 2020:  Some Ways to Get Involved

 

  • Mass texting. This is a means of voter outreach that it is a lot of fun and effective in getting the message out and having conversations with many voters in a short period of time — and great for those with strong aversions to talking to strangers on the phone.  Although some training is needed for this, mass texting can be learned within an hour, and anyone can pick up how it is done within a short time of starting to do the actual texts.  Organizations use programs that allow volunteers to send a pre-written text message out to voters through their computers in batches of 200-1000, which can be done in no more than 2-4 minutes.  On average, 10-20% will answer, some immediately and others trickling in over the next few hours.  Volunteers can then engage with many of these voters, usually through a wide variety of scripted answers which mostly cover the waterfront of responses they receive, and sometimes result in more creative and substantive conversations.  You can complete all of your conversations for a batch in 60-90 minutes, with occasional check-ins for a few responses that trickle in over the next 48 hours.  The voters only get your first name and don’t have your phone number or further information about you. You can get going in doing mass texts that reach 1000 voters at a time and result in many substantive discussions through the People’s Action Network, which is now sending over a million texts a week to voters in key swing states, by clicking here:

 

  • Phone banking. While phone banking has its rewards and occasional frustrations, it has been found to be the most effective means of engaging voters other than door-to-door canvassing.  Most campaigns now use electronic dialers, to dial quickly and allow callers to speak only to people who answer, and they also usually provide a script to use and adapt to their own words.  While there can be many wrong numbers and occasional confrontations, many of the phone banks target likely friendly groups of people (e.g. Dem voters who we encourage to come out and get or submit ballots).  In this year of COVID, phone bankers are finding that the proportion of lonely people who will pick up the phone and talk is increasing.

 

  • Writing post cards.  A great outreach technique for the worst technophobes!    A nationally known non-partisan campaign called Reclaim Our Vote has sent over 5 million post cards, primarily to deregistered (purged from the rolls) voters of color in swing states, urging recipients to register and to vote, and provide needed contact info, and is looking to send out many more as soon as possible, before shifting its efforts to phone banking and texting.  (https://actionnetwork.org/forms/reclaim-our-vote-signup).  Reclaim Our Vote is also one of the few campaign-related organizations that houses of worship and other 501(c)(3) organizations can participate in, and to which people can make tax-deductible contributions, because it is non-partisan (it does not search out voters by party registration).  Its parent organization, Center for Common Ground, is itself a 501(c)(3) organization.  Another group called Postcards to Voters (https://postcardstovoters.org/) writes post cards to Democratic leaning voters in swing states around the country.  The group has a few openings in a local chapter in the DC area where one of our JAMAAT members is active, and they get together in periodic friendly Zoom meetings to write post cards and get to know each other.  Please contact us at JAMAAT if you are interested.

 

  • Writing Letters. Another great outlet for the tech-challenged.   An organization called Vote Forward, https://votefwd.org, is working with groups such as Swing Left to have volunteers write 10 million letters to infrequent Democratic voters in swing states, to send shortly before the election to remind them to vote.  They have had past success with their strategy, because recipients are likely to open the handwritten, personally addressed letters that remind people to vote shortly before the election.  This year, they have decided to send their letters out on October 17.

 

  • Organizing friends and family. We all know that individuals have far more influence on people they know than on strangers.  The Biden campaign has come up with a training program and app called Vote Joe, available on the App Store, to help organize friends and family, which seems particularly useful for young people with infrequently voting friends or people with friends and family who need to be acquainted with basic facts on the issues.  The app allows users to help figure out whom to target, by providing access to publicly available voting data to show how frequently any person has voted and (depending on the state) the party for which they registered, and provides easily accessible information on the major issues of concern to voters.   For the next of the training programs that shows how to use the app and more, see  https://www.mobilize.us/2020victory/?address=20850&lat=39.0839994&lon=-77.1527813.

  • Poll watching and voter assistance hotlinesWith all the news about Republican efforts at voter suppression and massive disqualification of votes, Democratic groups have sprung up to resist such efforts through voter education and poll observation.  You can get involved with the Biden campaign as a poll observer by clicking here, be trained on how to answer questions on the Biden campaign’s National Voter Assistance hotline by clicking here, and become involved as a nonpartisan Election Protection volunteer, supported by many of our country’s best-known non-partisan election protection organizations, by clicking here.
  • Giving money. You are all deluged with requests for donations that seem to come from every organization on Earth, each of which professes to be the one in greatest need of your money.  This document will not endorse giving to any of the worthy organizations listed here over any others.  But if you have money to donate to one or more political campaigns, and you care about particular issues, you can increase the impact of your contribution by donating through a PAC of an interest group whose positions on your issue of concern are supported by that group.  One organization to consider, for anyone interested in promoting an equitable two-state solution in Israel and Palestine, is the J Street PAC, https://jstreet.org/about-us/about-jstreetpac/#.X0gfNMhKg2w.   In its 12 years that it has been in existence, this group has hired some of the savviest people on the Hill, which has helped propel J Street into becoming one of the most successful Jewish organizations in Washington.  One service they offer, if you wish to donate to Senate or House campaigns but could use some guidance on which campaigns are most in need of money that can make a difference, is to consult with their resident expert on this subject, Capital/South Assistant Regional Director Mike Fox, mike@jstreet.org. You will need to become a member of J Street through its web site in order to donate through the PAC, at no financial obligation.  All monies donated through the PAC will go directly to the designated candidate.

 

  • Organizations doing various types of voter outreach

 

  • 2020 Victory (mobilize.us/2020victory/) is the website for the DNC, for both the Biden/Harris campaign and downballot campaigns in battleground states. Here you can get text training (required before doing any texting on their campaigns), phone banking, and different types of organizing, and then sign up for particular phone banking, texting, and get out the vote events to all manner of targeted audiences.

 

  • Moms Demand Action on Gun Sense has a very active Maryland chapter coordinating postcarding for Spanberger and Luria (the two likely close congressional races in our area) and for Reclaim Our Vote, as well as texting (currently with 2020 Victory) and phone banking.  They do frequent small group Zoom parties in connection with their events, led by their experienced team heads, to give tips, conversation, and offer incentives like campaign swag for frequent participants.   • Seed the Votehttps://www.everydaypeoplepac.org/seedthevote/, a Bay Area-organized campaign of progressive organizations, is teaming with groups from AZ, PA, and FL to do phone-banking and texting to those critical states each day of the week. Their partner organizations feature a “deep canvassing” technique to try to understand the concerns of infrequent and swing voters, to get back to them with answers to questions they cannot handle from initial questions, and to refer people in need of resources to helping institutions.

 

  • Powered by People is a PAC started and led by Beto O’Rourke, which makes calls to Texas Democrats and people of color: see https://map.betoorourke.com/  Its phone banks feature 1 or 2 weekly 2-hour sessions that start with a Zoom conference with inspirational remarks led by Beto himself, and feature both an automatic dialer I’ve found works very well and a good supportive staff who can help with issues while calls are ongoing.

 

  • Bend the Arc: Jewish Action, the progressive Jewish organization that focuses on domestic issues such as racial justice, immigration, and the environment, is running a Vote Out Fear campaign (https://www.bendthearc.us/vote_out_fear_pb), doing phone banking and text banking aimed at swing Jewish voters (initially in Florida and Georgia, now expanded to include six other key states).

 

  • Turnout 2020, https://turnout2020.org/, a program of a coalition of left-leaning groups called the Progressive Turnout Project, primarily makes calls to infrequent Democratic swing state voters to urge them to take action, normally on Tuesdays and Thursdays. They are currently calling Arizona and Pennsylvania voters to encourage that they request a vote-by-mail ballot, with talking points to help voters understand options.

 

  • JAMAAT (Jews and Muslims and Allies Acting Together) is a small grass roots organization in the DC area that focuses on fighting Islamophobia and anti-Semitism, as well as on issues like immigration, preventing gun violence, and the environment. Its members have been working with all of the groups listed here.  Interested people can participate in our next virtual organizing meeting on Sunday, October 4 at 7:00 pm EDT, for which they should register at http://bit.ly/jamaat2020.  Any questions should be referred to gsampliner@gmail.com.

 

  • Reclaim our Vote, https://actionnetwork.org/forms/reclaim-our-vote-signup, which will be pivoting later in September from post card writing to phone and text banking, and they have useful training courses coming up to help hesitant phone bankers, some on Mondays and some at other times.

 

  • Grassroots Democrats (https://grassrootsdems.org/) is a California-based organization that has gone national and participates in phone banking and texting campaigns in most of the battleground states. They have a well-organized website to hook interested people into phone banking and texting opportunities, as well as training, in battleground state races of their choice, and good links to other key websites to get brief summaries of the candidates; background and positions.

 

 

 

o   Changing the Conversation (ctctogether.org) is a group that is doing both telephone and (under a strict protocol) door-to-door canvassing, focusing on Pennsylvania.  They train people extensively in “deep canvassing,” which has worked to persuade reluctant voters to vote and change the minds of least the less ardent Trump supporters, not by using facts and arguments but by story-telling, building empathy, and getting voters to tell their own stories that can cause them to convince themselves to come out to vote and vote our way.

 

o   Environmental Voter Project (https://www.environmentalvoter.org/) is a non-partisan organization that uses big-data analytics to identify inactive environmentalists in battleground states and then through its phone banks and text banks, applies cutting-edge behavioral science to turn them into more consistent voters.

“The Trump administration proposed its annual refugee admissions ceiling just before midnight on Wednesday, September 30, committing to resettle just 15,000 individuals in Fiscal Year 2021, which would be the lowest admissions ceiling since the inception of the U.S. Refugee Admissions Program (USRAP).

The announcement comes on the heels of what was previously the lowest level of refugee admissions in American history. For FY 2020, which ended on September 30, the administration had set a goal to welcome just 18,000 refugees, in stark contrast to the average admissions ceiling of approximately 95,000 since the beginning of the USRAP. Despite this historically low target, the administration barely attained 65% of allotted admissions – resettling only 11,814 refugees this fiscal year, according to Lutheran Immigration and Refugee Service.

“In just four years, this Administration has cut the refugee resettlement program from 110,000 to a historic low of fifteen thousand. At a time of unprecedented global need, today’s decision to further cut the refugee admissions ceiling is a complete abdication of our humanitarian and moral duty.” said Krish O’Mara Vignarajah, president and CEO of Lutheran Immigration and Refugee Service, a resettlement agency that has welcomed hundreds of thousands of refugees since 1939. “Let this serve as a wake-up call to those who believe this administration supports avenues of legal immigration. Refugees go through extreme vetting and have done everything our government has asked of them, yet they continue to be met with open hostility and egregious processing delays from this administration”

The record-low admissions figures have also disproportionately impacted certain groups. Admissions of Muslim refugees have declined to just 2,503, down from approximately 38,900 in FY 2016 and approximately 4,900 in FY 2019. Additionally, the Trump administration set aside 4,000 slots for Iraqi allies who assisted U.S. interests in their home country. However, it fell drastically short, resettling only 123 individuals in this category, or just 3% of the admissions goal.

“It shows the tragic extent to which we have abandoned our Iraqi allies who risked their lives, and those of their family members, to assist U.S. government and military personnel,” noted Vignarajah. “This further undermines our diplomatic and military efforts, rendering it nearly impossible to garner support from regional allies moving forward.”

Given FY2020’s record-low admissions numbers and an FY2021 proposed admissions ceiling of only 15,000, refugee advocates are deeply concerned by the human toll on the most vulnerable.

“In real terms, this means that families who have already waited years are forced to postpone reunification. It means that thousands who would otherwise find safety on our shores are left to languish in refugee camps, with no end in sight,” concluded Vignarajah. “This heartless decision is diametrically opposed to our values as a welcoming nation and it dishonors our common humanity at a time of dire need.”

A federal judge on Thursday ordered the Trump administration not to release a report by the Presidential Commission on Law Enforcement and the Administration of Justice, finding that the group ― comprised entirely of current and former members of law enforcement ― had been “far from transparent.”

Senior U.S. District Judge John Bates, a George W. Bush appointee, issued a 45-page ruling finding that commission ― which President Donald Trump announced with fanfare at a police conference last year ― had violated the Federal Advisory Committee Act (FACA), which requires that committees be “fairly balanced” in the viewpoints represented.

Attorney General William Barr said there was a need to hear from a “diversity of backgrounds and perspectives,” but the commission was full of law enforcement officials. Bates’ order requires Barr “to ensure the Commission has a fairly balanced membership.”

Last month, as HuffPost previously reported, an elected prosecutor quit one of the commission’s working groups because he worried that it was “providing cover” for a predetermined law-and-order agenda that “will only widen the divisions in our nation.”

Bates wrote that the commission’s membership “consists entirely of current and former law enforcement officials” and that no commissioner “has a criminal defense, civil rights, or community organization background.”

“Especially in 2020, when racial justice and civil rights issues involving law enforcement have erupted across the nation, one may legitimately question whether it is sound policy to have a group with little diversity of experience examine, behind closed doors, the sensitive issues facing law enforcement and the criminal justice system in America today,” he wrote.
