For all the sound and fury around Tuesday’s elections, there was one clear signal: Abortion rights are politically popular, no matter where or when they are on the ballot.

And that, no matter how you slice it, is good news for Democrats as the parties plot their strategies ahead of the 2024 elections.

Gov. Glenn Youngkin – the Virginia Republican who believed he could crack one of the most intractable issues in American politics with the promise of “reasonable” abortion restrictions – will not lead a GOP-controlled legislature in the Commonwealth, which denied the party control of the state Senate and put a swift end to both his plan for a 15-week abortion ban and rumors he might pursue a 2024 presidential bid.

Meanwhile, voters in Ohio decisively said they wanted a constitutionally protected right to abortion with the passage of a ballot measure – only a few months after they rejected another measure that would have made it harder for them to shield abortion rights.

And in Kentucky, the Democratic governor defeated his Republican challenger, a state attorney general with close ties to former President Donald Trump and Senate Minority Leader Mitch McConnell, after a campaign in which abortion became a flashpoint.

So, how is this type of legal and human abuse acceptable from a Dem Administration that promised good government and to do better than the Trumpsters?

Just to be clear, the chances of a third country volunteering to take a non-national granted CAT relief are very slim.  I don’t remember it happening on any case on my docket during my time on the bench in Arlington. Also, were that to happen, the DHS would be obligated to give the respondent an opportunity to seek  CAT to that third country, likely a lengthy process.

So, detention in this circumstance doesn’t make sense from a practical, legal, or fiscal standpoint!

The 4th Circuit on Jurisdiction

On June 30, the U.S. Court of Appeals for the Fourth Circuit issued a decision that might not have received the attention it deserved.  The end result of the court’s published decision in Herrera-Alcala v. Garland was to affirm an Immigration Judge’s denial of asylum based on a lack of credibility.1

But before reaching the merits, the court addressed a jurisdictional issue, and that is where our interest lies.  At his removal proceeding, the petitioner was detained at a Louisiana correctional facility, which placed him physically within the territory of the Fifth Circuit.  For some reason, the Administrative Control Court (which is where the administrative record for the case was created and maintained, and where documents were filed by the parties) having jurisdiction over that Louisiana correctional facility was in Fort Snelling, Minnesota, which is physically located within the Eighth Circuit’s jurisdiction.

However, the immigration judge who conducted the hearing remotely by video and rendered the decision was sitting at the Immigration Adjudication Center in Falls Church, Virginia, which is within the geographic jurisdiction of the Fourth Circuit.  So after the BIA dismissed the petitioner’s appeal, his counsel sought review with the Fourth Circuit.  The Department of Justice moved to change venue to the Fifth Circuit, arguing that the petitioner’s location was determinative. And an amicus brief filed by an immigrants’ rights group took the position that venue properly belonged in the Eighth Circuit, where the control court was located.

The Fourth Circuit resolved the question of jurisdiction using the language of the relevant statute.  Since 8 U.S.C. section 1252(b)(2) states that the “petition for review shall be filed with the court of appeals for the judicial circuit in which the immigration judge completed the proceedings,” the court interpreted that to mean it is the location of the judge that determines jurisdiction.  And as the judge in this case was in Virginia, it found proper jurisdiction to be with the Fourth Circuit.

The decision yields an immediate benefit, as there are presently nineteen Immigration Judges sitting in the two Immigration Adjudication Centers that are located within the Fourth Circuit’s jurisdiction (in Falls Church and Richmond, VA).  Based on the Fourth Circuit’s ruling, any of the thousands of noncitizens whose cases were heard by one of these Virginia-based judges now have the option of seeking judicial review in the Fourth Circuit.

The impact of this becomes apparent when we look at the BIA’s precedent decision in Matter of L-E-A-.2  In that case, the Board held that the respondent’s family constituted a valid particular social group for asylum purposes, but then denied asylum by finding that a nexus had not been established between that family membership and the feared persecution.  In fact, the decision created an unreasonably high standard for nexus in a commonly occurring type of asylum claim.   But the decision contains a footnote recognizing that the Fourth Circuit holds a significantly different view of nexus in such cases, adding that L-E-A- did “not arise in the Fourth Circuit.”3

Although the Board doesn’t go as far as saying so, applying Fourth Circuit case law to the facts of L-E-A-  would have resulted in a grant of asylum.  As I discussed in far greater depth in this blog post in December, the Fourth Circuit has repeatedly reversed the Board on nexus, citing the latter’s error of focusing on why the persecutor targeted the group in question, instead of asking why they targeted the asylum applicant themself.  For example, if the group in question is a family, it doesn’t matter if the persecutor is targeting that family for an unprotected reason such as money, revenge, or self-preservation.  Per the Fourth Circuit, if the asylum seeker themself wouldn’t be targeted if not for their membership in that family, then nexus has been established, regardless of the reason the family is at risk in the first place.4

In addition to its more favorable take on nexus, the Fourth Circuit is also among the handful of circuits to consider verbal death threats to constitute persecution.5  This is  important, because one who has been threatened in those circuits has thus established past persecution, causing burdens of proof regarding future fear and internal relocation to then shift to the government to rebut, and further opening the possibility for humanitarian grants of asylum even where the government meets its burden of rebuttal.6

The Fourth Circuit has also imposed on Immigration Judges a strong obligation under international law to fully develop the record in hearings involving asylum claims, particularly (but not exclusively) where the respondent is pro se, and considers an IJ’s failure to meet this obligation to be “presumptively prejudicial.”7   Any attorney who is representing on appeal an asylum applicant who appeared pro se below where the IJ had been sitting in Virginia might want to review the record to see if the duties imposed by the Fourth Circuit to develop the record, which includes a “broad and robust duty to help pro se asylum seekers articulate their particular social groups,” was satisfied.8

In spite of the above-listed benefits, advocates have identified a potential downside to the ruling in Herrera-Alcala should the Fourth Circuit’s view on jurisdiction be adopted nationwide.  To illustrate this concern, I’ll use a hypothetical example arising in a circuit such as the Fourth with a body of case law favorable to asylum applicants.  Let’s imagine that after briefing and documenting the claim in line with that circuit’s law, the presiding judge in Baltimore is out sick on the day of the merits hearing.  A deserving asylum seeker could have a likely grant of asylum upended if a judge stationed in a jurisdiction with far less favorable case law is enlisted to hear the case by video under EOIR’s “No Dark Courtrooms” policy.9  While the intent behind substituting in a remote judge might be an innocent one, the impact on the asylum seeker of unexpectedly having to overcome a much tougher standard for nexus or a narrower definition of persecution could be devastating, as the Matter of L-E-A- example illustrated.

The Fourth Circuit’s view is presently limited to the Fourth Circuit.  But should it come to be the universal rule, while whether a particular circuit will accept jurisdiction over a petition for review is beyond EOIR’s control, the agency may itself still choose which circuit’s case law its own Immigration Judges should apply in individual cases before the Immigration Courts.  EOIR would do well to look to the example of USCIS, which advises its asylum officers conducting credible fear interviews that where there is disagreement among the circuits as to the proper interpretation of a legal issue, “generally the interpretation most favorable to the applicant is used when determining whether the applicant meets the credible fear standard.”10

I mentioned above the Fourth Circuit’s recognition of the duty of Immigration Judges to ensure that the record is fully developed in asylum claims.  Scholars credit that obligation to the legal requirement on nations to implement treaties in good faith.  For example, in discussing the adjudicator’s duty to develop the record in asylum cases, two leading international refugee law scholars explain the duty to implement treaties in good faith as holding states “not simply to ensuring the benefits of the Convention are withhold from persons who are not refugees, but equally to doing whatever is within their ability to ensure recognition of genuine refugees.”11

But shouldn’t that same obligation apply to not only developing the evidence of record, but also to deciding which law to apply when, as in Herrera-Alcala, there is more than one option?  If there is an obligation on our government to do everything in its ability to ensure recognition of genuine refugees, then isn’t that obligation breached where an individual sitting in a geographic area in which the law deems her deserving of asylum is then denied protection because the judge being beamed into that courtroom is sitting in a place with less enlightened precedent?

At the “Legacy INS,” the acronym for what were then called “Remote Adjudication Centers” was “The RACK” — with good reason! Once upon a time, EOIR went out of the way to emphasize the differences with, and independence from, INS —  it ran “courts” not “adjudication centers,” and it was comprised of “judges” NOT “adjudicators.”

Indeed, I can remember a past (in person) IJ National Conference where a senior DOJ official received a rather chilly reception for referring to the IJs in the room as “highly paid immigration examiners who worked for the AG.”

But, times change, and passage of time does not always bring progress. In many important ways EOIR is going backwards. Over the years, particularly 2017-2021, it probably has become more “politicized, compromised, weaponized, and subservient to immigration enforcement” than it was when it operated within the “Legacy INS.” Now, its bloated hierarchical bureaucracy, unmanageable backlogs, lousy public service, and emphasis on “productivity” and carrying out DOJ policies, looks more and more like DHS — the successor to the agency from which it declared “independence” back in 1983. What an unforgivable mess!

I do not know if I can survive three more years of Democrats stumbling over themselves to disavow the Democratic platform in a doomed attempt to win bad-faith culture wars. It is too painful, like watching ruthless hunters herding panicked animals over the side of a cliff. The poor, dumb beasts inevitably go extinct if they are not able to outthink such a rudimentary strategy.

Walk around your town. Explore a major American city. Drive across the country. What are the most important problems you see? There is poverty. Homelessness. A lack of affordable housing. Vast and jaw-dropping economic and racial inequality. There is a lack of public transportation, a broken healthcare system, environmental degradation, and a climate crisis that threatens to upend our way of life. These are real problems. These are the things that we need our government to fix. These are what we need to hear politicians talk about. These are what we must debate and focus on, if we are really concerned about human rights and our children’s future and all the other big things we claim to value.

I guarantee you that neither “cancel culture” nor “critical race theory” nor, worse of all, “wokeness” will grab you as enormous problems after your exploration of America, unless that exploration ranges only from a college faculty lounge to a cable TV studio to the office of a rightwing thinktank. These are all words that mean nothing. To the extent that they are real at all, they are niche concerns that plague such a small subset of Americans that they deserve to be addressed only after we have solved the many other, realer problems.

All these terms function primarily as empty vessels into which bad-faith actors can pour racism, so that it may appear more palatable when it hits the public airwaves. Common sense tells us we should spend most of our time talking about the biggest problems, and less time on the lesser problems, and no time on the mythical problems. To engage in long and tortured debates over these slippery and indefinable culture war terms is to violate that rule, with awful consequences for everyone.

Republicans will push these culture wars as far as they can, but it takes Democrats to make the strategy work

Let’s not bullshit about this. Racism is a wonderfully effective political tool for Republicans, yet explicit racism is frowned upon in polite society now, so there is a constant flow of new issues to stand in for racism in political discourse. Lee Atwater, who invented Nixon’s “southern strategy”, explained this all decades ago, and it is still true. George Wallace could be outright racist, but subsequent generations of politicians have had to cloak it in “welfare reform” or being “tough on crime” or, now, opposition to “wokeness” and “critical race theory” – things which mean, by the way, “caring about racism”.

Three-quarters of a million Americans are dead from a pandemic. We have a Democratic president and a booming economy. So we will get culture wars, and more culture wars, all of which are built on stoking various forms of hate. This is a game that serious leaders should not play. Unfortunately, we don’t have too many serious leaders. We have the Democratic party.

Read the complete article at the link. Nobody manipulated “stand in racism” more skillfully than incoming Virginia GOP Governor Glenn Younkin. So, we can expect a steady onslaught of these sleazy, yet highly effective, tactics over the next three years. 

By now, a Dem Administration could have eliminated Title 42 restrictions, regularized asylum processing at the border, instituted a robust refugee program near the Northern Triangle to “incentivize” applications abroad, slashed the Immigration Court backlog to a manageable size, and replaced unsuitable Immigration Judges and Appellate Immigration Judges with competent ones who would do the right thing and issue the necessary positive guidance to end systemic abuses by both EOIR and DHS. 

As an added bonus, unnecessary and expensive litigation in the Circuits resulting from EOIR‘s poor performance could be reduced. The savings on both sides could be “repurposed” into increasing Immigration Court representation.

Sure, Repubs would drum up racist myths and carry out an energetic campaign of hate and xenophobia to rally their base. They undoubtedly would make the outrageously false claim that complying with the Refugee Act of 1980, the 5th Amendment to the U.S. Constitution, and the Convention Against Torture amounts to “open borders.” But, in case the Dems haven’t noticed, that’s already happening! 

The Biden Administration could shoot everyone approaching our border dead and the GOP would still say “open borders.” Honesty, reality, and human decency simply aren’t part of the GOP game plan. Yet, the Dems keep falling for the bait!

The Administration is basically carrying out a “Miller Lite” restrictionist immigration policy and demeaning themselves by violating statutory and constitutional requirements right and left. But, that hasn’t stopped the GOP from dishonestly claiming “open borders,” nor has it deterred the so-called “mainstream media” from repeating this BS.

What the Dems have done is “de-energized” an important segment of their own base as well as dis-served the nation by continuing illegal anti-immigrant policies at a time when we could and should be admitting more immigrants through a revived legal immigration system and much more honest and robust refugee and asylum programs. In other words, Dems have shot themselves in both feet!

Following the asylum and refugee laws and giving applicants due process isn’t actually a “policy option.” It’s the law!

Dem spinelessness and intransigence on immigration have created the worst of all worlds. Even with truth, logic, justice, and common sense potentially on their side, the Dems cluelessly are helping the GOP succeed on their toxic agenda of stupidity, dishonesty, hate, and “deconstruction of democracy.” 

There is, of course, no guarantee that any particular actions will bring electoral victory in the future. But, rather than being the GOP’s foil, why not do the right thing? Even if they ultimately lose, the Dems would save some lives, improve the situation of millions of Americans, and, at the very worst, go down fighting for something worthwhile, rather than being “herded over the cliff” by the GOP racists.

deportation-ready provision of the law kicks in. According to the American Immigration Council, fewer than 2% of immigrants who received persecution-based relief in fiscal year 2017 were ultimately deported to a third country.

The Justice Department also raised the possibility that having to scrutinize the practical odds of removal from immigrant to immigrant would be “patently unworkable.”

“A case-by-case approach … would needlessly add to the burdens that are already ‘overwhelming our immigration system,'” the department said, quoting a prior case.

But a coalition of former immigration trial and appeals judges pushed back on that idea with their own amicus brief Thursday.

“Bond hearings in withholding of removal proceedings are no different than bond hearings in other contexts,” the group, representing 34 judges who have cumulatively overseen thousands of cases, wrote. “Contrary to [the administration’s] assertion, bond hearings in withholding of removal proceedings neither lead to a slowdown of cases that ‘thwart Congress’ objectives’ in enacting the immigration laws, nor impose an administrative burden on immigration courts.” The American Civil Liberties Union is represented by its own Michael Tan, Omar Jadwat, Judy Rabinovitz, Cecillia Wang and David D. Cole.

This disgraceful performance by the Solicitor General’s Office (once revered, now reviled) has become “the norm” under Trump. Francisco’s arguments are those of an attorney who didn’t do “due diligence,” but doesn’t expect the Court to know or care what really happens in Immigration Court. And, unfortunately, with the exception of Justice Sotomayor and perhaps Justice Kagan, that may well be a correct assumption. But that doesn’t make it any less of a powerful and disturbing indictment of our entire U.S. Justice system in the age of Trump.

Reality check: I routinely did 10-15, sometimes more, bond hearings at a Detained Master Calendar in less than one hour. I treated everyone fairly, applied the correct legal criteria, and set reasonable bonds (usually around $5,000) for everyone legally eligible. Almost all represented asylum seekers and withholding seekers eligible for bond who had filed complete and well-documented asylum or withholding applications were released on bond. About 99% showed up for their merits hearings.

I encouraged attorneys on both sides to file documents in advance, discuss the case with each other, and present a proposed agreed bond amount or a range of amounts to me whenever possible. Bond hearings were really important (freedom from unnecessary restraint is one of our most fundamental rights), but they weren’t “rocket science.” Bond hearings actually ran like clockwork.

Indeed, if the attorneys were “really on the ball,” and ICE managed to find and present all the detainees timely, I could probably do 10-15 bond cases in 30 minutes, and get them all right. My courtroom and my approach weren’t any different from that of my other then-colleagues at Arlington. In thirteen years on the bench, I set thousands of bonds and probably had no more than six appeals to the BIA from my bond decisions. I also reviewed many bond appeals at the BIA. (Although, most bond appeals to the BIA were “mooted” by the issuance of a final order in the detained case before the bond appeal was adjudicated.) Most took fewer than 15 minutes.

Indeed, my past experience suggests that a system led (not necessarily “run”) by competent judicial professionals and staffed with real judges with expertise in immigration, asylum, and human rights and unswervingly committed to due process and fundamental fairness could establish “best practices” that would drastically increase efficiency, cut (rather than mindlessly and exponentially expand) backlogs, without cutting out anyone’s rights. In other words, EOIR potentially could be a “model American judiciary,” as it actually was once envisioned, rather than the slimy mass of disastrous incompetence and the national embarrassment that it is today!

The idea that doing something as straightforward as a bond hearing would tie the system in knots is pure poppycock and a stunning insult to all Immigration Judges delivered by a Solicitor General who has never done a bond case in his life!

Yes the system is overwhelmingly backlogged and dysfunctional! But that has nothing to do with giving respondents due process bond hearings.

It has everything to do with unconstitutional and just plain stupid “politicization” and “weaponization” of the courts under gross incompetence and mismanagement by political hacks at the DOJ who have installed their equally unqualified toadies at EOIR. It also has to do with a disingenuous Solicitor General who advances a White Nationalist political agenda, rather than constitutional rights, fundamental fairness, rationality, and best practices. It has to do with a Supreme Court majority unwilling to take a stand for the legal rights and human dignity of the most vulnerable, and often most deserving, among us in the face of bullying and abuse by a corrupt, would-be authoritarian, fundamentally anti-American and anti-democracy regime.

It has to do with allowing a corrupt, nativist, invidiously-motivated regime to manipulate and intentionally misapply asylum and protection laws at the co-opted and captive DHS Asylum Office; thousands of “grantable” asylum cases are wrongfully and unnecessarily shuffled off to the Immigration Courts, thus artificially inflating backlogs and leading to more pressure to cut corners and dispense with due process.

It also paints an intentionally false and misleading picture that the problem is asylum applicants rather than the maliciously incompetent White Nationalists who have seized control of our system and acted to destroy years of structural development and accumulated institutional expertise.

Good Government matters! Maliciously incompetent Government threatens to destroy our nation! (Doubt that, just look at the totally inappropriate, entirely dishonest, response of the Trump kakistocracy to their overwhelming election defeat by Biden-Harris and the unwillingness of both the GOP and supporters to comply with democratic norms and operate in the real world of facts, rather than false narratives.)

Due process, fundamental fairness, equal justice, simple human decency, and Good Government won’t happen until we get the White Nationalist hacks out of the DOJ and replace the “clown show” at EOIR with qualified members of the New Due Process Army. Problem solvers, rather than problem creators; over-achievers, rather than screw-ups!

The incoming Biden-Harris Administration is left with a stark, yet simple, choice: oust the malicious incompetents and bring in the “competents” from the NDPA to fix the system; or become part of the problem and have the resulting mess forever sully your Administration.

The Obama Administration (sadly) chose the latter. President Elect Biden appears bold, confident, self-aware, and flexible enough to recognize past mistakes. But, recognition without reconstruction (action) is useless! Don’t ruminate — govern! Like your life depends on it!

And, by no means is EOIR the only part of DOJ the needs “big time” reform and a thorough shake up. We must have a Solicitor General committed to following the rules of legal ethics and common human decency and who will insist on her or his staff doing likewise.

The next Solicitor General must also have demonstrated expertise in asylum, immigration, civil rights, and human rights laws and be committed to expanding due process, equal justice, racial justice, and fundamental fairness throughout the Government bureaucracy and “pushing” the Supremes to adopt and endorse best, rather than worst, practices in these areas.

American Justice and our court systems are in “free fall.” This is no time for more “amateur night at the Bijou.”

And here are some thoughts for the future if we really want to achieve “Good Government” and equal justice for all:

  • Every future Supreme Court Justice must have served a minimum of two years as a U.S. Immigration Judge with an “asylum grant rate” that is at or exceeds the national average for the U.S. Immigration Courts;
  • Every future Solicitor General must have done a minimum of ten pro bono asylum cases in U.S. Immigration Court.

🇺🇸IT’S A BEAUTIFUL DAY IN THE NEIGHBORHOOD — Joy, Relief, Optimism Pour Into The Streets!🗽⚖️

 

About 11:30 AM yesterday, I was on our screen porch working on Courtside. I heard the first joyful shouts. Simultaneously, my iPad screen told me that Pennsylvania had been called for Biden. I bellowed out a loud, YES! Then, I put up our American flag. 

At 5 PM, by arrangement on the neighborhood e-Mail, folks started streaming out their doors, standing on the curb, glasses and champaign bottles in hand, for a toast to Joe Biden, Kamala Harris, the return of democracy, rationality, and human decency. Then we mixed and mingled, of course in a socially distant way. Dogs and kids were welcome. “Finally, able to breathe again” was a common refrain, as was “national nightmare coming to an end.”

Our neighbors are from all backgrounds and many different origins: doctors, lawyers, teachers, techies, designers, consultants, Federal bureaucrats, immigrants, parents, grandparents, singles. One mother had been naturalized just so she could vote in this election. All of us shared relief and joy at the return of sane, humane sound government and informed, reasonable dialogue on how to resolve our pressing national problems.

Later we adjourned to a back yard fire pit and celebrated and chatted some more, before drifting away to our respective homes. Cathy and I left the empty bottles and plastic cups on our lawn, intending to clean up in the daylight. But, by the time we arose, one of the neighbors had already done the job for us.

The aura of optimism still hung in the air today. At least for now, the world looks a lot brighter than it did four years ago.

Trailblazing Alexandria Judge Retires With Warm Community Send-Off

People in Old Town Alexandria held a big celebration Friday for the retirement of the city’s first Black judge. After serving on the bench for nearly three decades, Judge Nolan Dawkins hung up his robe.

Well-wishers gathered outside the courthouse and sheriff’s deputies led a 60-car parade down Pitt Street to surprise Dawkins as he made his final goodbyes.

Dawkins grew up in the community he served and said he saw the people in his court first as humans.

“I did know that sometimes what you were seeing in court is not in fact the person,” Dawkins told News4. “Sometimes we need to see through the law and make the decision based on who the person is.”

Even though Dawkins operated that way from the bench, he said he wasn’t always treated with the same regard growing up in segregated Alexandria.

He recounted the time a woman called the police on a friend and him playing behind a grocery store when he was a young child.

“They carried a fingerprint kit and at 8 years old I was fingerprinted,” Dawkins said. “I wondered all my life, ‘Have those fingerprints followed me?'”

Despite the mistreatment he faced, Dawkins broke barriers. He became one of the first students to integrate the former George Washington High School. He was one of five Black students in his graduating class.

“In order to transfer to the all-white school, we had to get an application and essentially prove we could perform in the school system,” he said.

That’s exactly what Dawkins went on to do. He got an ROTC scholarship in college and then served as an officer in Vietnam. When he returned, he attended law school.

In 1994, he became the first Black judge to serve in Alexandria, starting in juvenile and domestic relations court. Dawkins said it’s “one court where you can make a difference.”

Dawkins created one of the first family drug treatment courts, giving addicted parents who had their children taken away a second chance. He says it’s not uncommon now for people to come up to him in the grocery store to say thank you.

For the past 13 years, Dawkins has worked on civil cases in circuit court. Regardless of the type of work, Dawkins said his guiding principle as a judge has been simple.

“I don’t come to court as a judge. I come to court and I see people,” he said.

I don’t know what some judges in the “Trump era” are seeing out there, but it often doesn’t seem to be the people or humanity. Indeed, many seem willfully ignorant of reality and the human consequences of some of Trump’s worst shenanigans. Law is written by humans to govern human conduct and should always be applied with humanity in mind.

Congratulations, Judge Dawkins and our deepest appreciation for your service to our Alexandria community and to justice in America. You are indeed a trail blazer and an inspirational role model for future generations of American judges. ⚖️🗽🇺🇸👍

Small Acts of ThanksI would like to share a nice story (for once).  It illustrates how a postscript can sometimes prove far more meaningful than the main story.

A friend and colleague in the DC area, Eileen Blessinger of Blessinger Legal, planned a series of training lectures via Zoom during the pandemic.  When I initially agreed to present one of the sessions on asylum law, I was told it would be for an audience of eighteen people.

Somehow, the number of attendees increased significantly.  Because meetings of more than 100 people require an upgrade on Zoom, Eileen asked participants for a small donation.  I believe the training went well, and that seemed to be the end of the story.

Later that night, Eileen informed me that because the number of attendees was well over 100, there was a surplus of donations beyond what was needed to cover the Zoom upgrade.  After a brief exchange, we agreed that the surplus should go to pandemic first responders.

Realizing the virtue of what was initially an unintended consequence, the next speaker, Louisiana-based attorney Glenda Regnart, also agreed to open her session to a wider audience, who were invited to make a small donation to treat first responders.  Subsequent speakers Kelly White, Himedes Chicas, Anam Rahman, Julie Soininen, Danielle Beach-Oswald, Heain Lee, and Jennifer Jaimes agreed to follow suit.  Over $1300 was raised.

Eileen took over from there, inviting suggestions for recipients from her staff.  So far, she has provided meals to nurses at Mass General Hospital in Boston; to employees at supermarkets in Louisiana and Virginia, and to preparers of meals for those in need in Alexandria, VA.  Plans are also in the works to provide a meal for DC-area sanitation workers.

Those of us able to quarantine comfortably and work from home owe an unimaginable debt to those putting themselves at risk to keep our cities and towns running, keeping us all fed and safe.  And as most of us read of infection and death rates as impersonal statistics, the nurses and other medical workers who are battling the disease on the frontlines on a daily basis, putting their own health at risk in the process, are far beyond our ability to properly thank.

It was a donation to another group that touched me in an unexpected way because of its connection to an earlier unspeakable tragedy.  Eileen forwarded me the accompanying photo of FDNY firefighters enjoying the meal provided for them from the training surplus.  Looking at the photo, I was suddenly transported back to the fall of 2001.  My wife and I, who both worked in lower Manhattan, were physically very close to events on 9/11.  What we saw still triggers traumatic memories.  Among the horrible and tragic statistics is the heartbreaking fact that 343 firefighters died that day.  More than 200 more have died as the result of illnesses they subsequently contracted in the rescue effort.

I walked past the firehouse on Duane Street every day on my way to and from work when I was an immigration judge.  I remember the feeling of grief when passing by in the months following 9/11, and of stopping there one day in October to make a donation, and of words completely failing me as I tried to express my sadness and gratitude.

In the present pandemic, 15 firefighters in the unit pictured here (Engine 286/Ladder 135) had contracted COVID-19 as of last week.  As early as April 7, 500 of New York’s Bravest had contracted coronavirus.  Many more continue to be exposed as first responders to emergency calls from those stricken with the disease.  And the firefighter who took the photo, Jerry Ross, was also a 9/11 responder.

So once again, we are reminded of the great debt we owe to so many.  Thanks again to Eileen and all of the other speakers, and of course to all who contributed.  Hopefully, these small acts of thanks will bring a little joy to these most essential and selfless heroes.

On Monday, Kellyanne Conway responded to a reporter’s question about why the president’s public schedule of events included no function to commemorate Martin Luther King Jr., on a holiday designated to honor him. Conway decided to answer this question by claiming that Dr. King would have hated impeachment: “The president … agrees with many of the things that Dr. Martin Luther King stood for and agreed with for many years, including unity and equality,” she said. “He’s not the one trying to tear the country apart through an impeachment process and a lack of substance that really is very shameful at this point.”

If this claim—that really it’s the impeachment process that’s tearing this nation apart—sounds familiar, it’s because it was also the lament of GOP House members as impeachment unfolded there. Yes, the day before the president’s impeachment trial opens in the Senate, and on the selfsame day Senate Majority Leader Mitch McConnell introduced rules that will, he hopes, preclude the calling of witnesses, hearing of evidence, and any other indicia of a “trial” in the Senate trial, the GOP has fallen perfectly in line behind the “stop tearing the country apart” argument as its impeachment defense. It’s the new authoritarian’s lament.

“This is a sad day for America,” intoned Ohio Rep. Bill Johnson, as the House debated the articles of impeachment in December, before calling for a moment of silence to memorialize the 63 million Americans who voted for Trump. As Michelle Goldberg noted at the time, “On the surface it seems strange, this constant trumpeting of a vote total that is more than two million less than the total received by Trump’s opponent, Hillary Clinton. Trump didn’t just lose the popular vote—he lost it by a greater margin than any successful presidential candidate in American history. … But as I watched impeachment unfold, it seemed like something more than that—an assertion of whom Republicans think this country belongs to.” The Republican howls about an unruly minority of socialists and protesters who seek the removal of this president misconstrue the fact that a majority of Americans do not agree to be governed by diktat. A new CNN poll shows that 51 percent of Americans want Trump removed from office, 74 percent of them are closely watching impeachment coverage, and 69 percent want to hear witness testimony. In other words, the majority of America does not consent to authoritarian Senate procedures and rules, and it is not some small faction of illiberal Democrats who are tearing the country apart, as Conway suggests. The majority of Americans are not willing to submit to autocracy, though we will turn to the Senate Tuesday to see if the majority of Americans’ wishes are to be trammeled by Senate Republicans. Spoiler alert: It seems all but inevitable that they will be, which tells you a good deal about how the Senate represents American voters.

If you would like to see another example of what minority rule feels like, kindly turn your attention to the 22,000 people who showed up in Richmond, Virginia, for what is now being described in the media as a “peaceful” march and a triumph of peaceable assembly. Armed with assault-style weapons and body armor, militia members were seen wearing masks and carrying semi-automatic rifles outside the seat of government. The biggest star of the rally—identified by the Washington Post as Brandon Lewis—brandished his .50-caliber Barrett M82A1 rifle, as passersby expressed admiration. “This sends a strong visual message,” Lewis, cradling the firearm and decked out in a helmet and bulletproof vest, told the Post. “The government is not above us. They are us.” The Washington Post clocked another protester wearing full-body camo, with a bulletproof vest, a handgun and an AR-15–style assault rifle. The protesters were overwhelmingly white and overwhelmingly male and overwhelmingly dedicated to a vision of “peace” that looks like this. They were there to refuse to abide by any democratically passed gun control measures, and they stood outside the state capitol chanting First Amendment–protected threats to oust Virginia’s democratically elected governor. More than 100 counties, cities, and towns in Virginia have declared themselves Second Amendment sanctuaries and vowed to oppose any new “unconstitutional restrictions” on guns, presumably following the lead of one of Monday’s speakers, a county sheriff who last month promised to “deputize” gun owners if lawmakers continue to push gun control measures. This nullification will be attempted despite the fact that the great majority of Virginia voters actually favor Democratic proposals to limit gun access, a Washington Post–Schar School poll found in October.

Todd Gilbert, the Republican Leader of the Virginia House of Delegates, issued a statement on Jan. 10 after the decision was taken to declare a temporary state of emergency, banning all weapons from the Capitol grounds from Friday at 5 p.m. until Tuesday at 5 p.m. Gilbert’s statement deplored that action as “disgusting and wrong.” The same Todd Gilbert reversed himself on Sunday, issuing a statement opposing protesters who would spread “white supremacist garbage,” hate, civil unrest, or violence, after multiple white supremacists and Nazis were arrested and it became clear that there was at least a possibility of violence at the march. The threat of violence is only as serious as your most recent FBI briefing, it seems. That doesn’t make for a peaceful demonstration—it puts you at the mercy of the armed marchers.

But because there was no violence in the end, we are told, the rally was “peaceful.” As Jim Geraghty at National Review noted smugly, the threatened violence never occurred, which means that the media panic (and apparently that of Todd Gilbert) was overblown. The march was apparently peaceful, he writes, because “perhaps the hateful types decided to stay away.”

Perhaps there were violent people who decided to stay away from Richmond on Monday. But there were also nonviolent people who decided they needed to stay away from Richmond on Monday. As Garrett Epps notes, those who stayed away included many other groups who had equally compelling First Amendment statements to offer:

The Coalition to Stop Gun Violence had also planned to assemble and petition for gun-control legislation—as it had done in peaceful competition with gun-rights groups in previous years. This year, because of the threats of armed violence surrounding the gun-rights march, that gun-control demonstration had to be canceled. The delegate from Manassas, Lee Carter, the South’s only socialist legislator, went into hiding because of death threats. Carter had not, in fact, sponsored an anti-gun measure, but gun-rights groups spread disinformation on the internet that he had done so; his life—and his ability to function as a legislator—was endangered.

Pages from the Legislature’s page program were told to stay home. Many legislators asked their staffs to stay away or work from home. The rally forced officials to reschedule the city’s Martin Luther King Jr. Day vigil for the first time in 28 years. New Virginia Majority—one of the largest progressive groups in the commonwealth—postponed its annual MLK Day of Action due to threats from armed racist groups and because “we cannot protect our people from individuals committed to acts of violence.” Mothers Demand Action stayed off the streets and held phone-banking events, and it almost goes without saying that virtually all people of color stayed home. And so a “peaceful” march, as fêted in the media and fêted by those who seek to blur the line between First Amendment speech and Second Amendment threats, will now include in its definition mass marches in which participants are armed with assault weapons, many of whom were also wearing masks. (Only one person in a mask was arrested Monday despite the fact that hundreds were masked. She was unarmed.)

I have always found ridiculous the GOP’s disingenuous claim that removal of Trump would “disenfranchise 63 million voters,” when more than 71 million voters didn’t vote for him and have basically been dismissed by Trump and the GOP who have pandered almost exclusively to the parochial interests of the minority. Included in the majority who didn’t vote for Trump are the nearly 66 million people who voted for Hillary Clinton.

It’s clear that the GOP won’t remove Trump from office no matter how overwhelming the evidence against him. But, even if he were removed, it would in no way be a “reversal” of the 2016 election. 

Trump would be replaced not by Hillary Clinton or any other Democrat, but by his hand-picked GOP toady Mike Pence, who was actually elected with him. So, the most corrupt and lawless GOP President in history would be succeeded by a perhaps somewhat less overtly corrupt GOP politico. 

To the extent that Trump voters wanted a regime motivated by White Nationalism, religious intolerance, hate, disenfranchisement of voters of color, intellectual dishonesty, and lots of tax breaks for the wealthy few, Pence wouldn’t disappoint them. It’s possible that Pence wouldn’t be as  chummy with authoritarian dictators and wouldn’t publicly treat our allies with contempt and disrespect. He might also cut a deal with the Dems on infrastructure improvements or some other relatively non-controversial topic. And, he seems capable of speaking and writing in complete, largely grammatical sentences. But, Trump voters should be able to live with that, particularly since removal from office wouldn’t remove Trump from Twitter.

On Friday, the New York Times reported that former Virginia attorney general Kenneth Cuccinelli will be tapped for a role in the Trump administration. He will be put in charge of the country’s legal immigration system, as head of U.S. Citizenship and Immigration Services (USCIS). While it had been earlier rumored that Cuccinelli would be placed in a new job as “immigration czar,” both the Times and the Washington Post noted that he now seems set for the top spot at USCIS.

No matter what job Cuccinelli ends up in, he is neither deserving nor qualified to play any role in shaping immigration policy. He is an immigration hardliner with views that are at odds with American values. He has a history of xenophobic, homophobic, and sexist comments. Ironically, one nice thing that can be said about Cuccinelli is that he fosters bipartisanship — he has generated opposition from both sides of the aisle.

Given that Cuccinelli could soon be presiding over USCIS, his comments on immigration are worthy of review. In 2018, he told Breitbart News Daily that states should use “war powers” to turn back migrants: “You just point them back across the river and let them swim for it,” he said. In 2015, appearing on a conservative radio station, he claimed that President Obama was encouraging an “invasion” of undocumented immigrants. In 2012, he compared immigration policy to pest control. He’s called the infamous Rep. Steve King (R-Iowa) “one of my very favorite congressman.” So Cuccinelli is hardly someone who can be trusted to run USCIS in keeping with the agency’s core values, which include “respect” and “integrity.”

Most importantly, Cuccinelli has no significant experience in immigration policy, notwithstanding his failed attempt to end birthright citizenship as a state senator. He is not from a border state, nor has he been a credible voice in the immigration debate. His background is in law enforcement, not immigration law.

Cuccinelli’s prime qualification for his new job seems to be that he has been a tireless defender of the president on cable news. That could almost be seen as laughable if the stakes were not so high. Consider that as head of USCIS, Cuccinelli would wield tremendous power over immigrants like refugees, domestic abuse victims, and asylum-seekers. Or that our legal immigration system is byzantine and complicated, attracting the largest number of immigrants in the world. In FY 2017, the U.S. granted Legal Permanent Resident status to about 1.1 million people, including 120,000 refugees and 25,000 asylum-seekers.

Cuccinelli’s anti-LGBTQ record is especially troubling. As attorney general, he was against policies banning discrimination on the basis of sexual orientation in public colleges and universities. As a state senator, he unsuccessfully fought to criminalize sodomy, calling “homosexual acts… intrinsically wrong.” In 2008, he declared that homosexuality “brings nothing but self-destruction, not only physically but of their soul.” The extreme views matter because LGBTQ people are among our most vulnerable immigrants. The Human Rights Campaign, for example, has documented “the precarious position of transgender immigrants and asylum seekers.” Sadly, it seems unlikely that Cuccinelli would respect their human rights, let alone treat LGBTQ immigrants with kindness and compassion.

There are myriad ways in which Cuccinelli has demonstrated that he is far out of the mainstream, so much so that handing him a huge job would be dangerous. The man who worried about getting his newborn son a social security number because he was concerned about the government tracking his family is probably not the ideal person to put in charge of E-Verify, the federal database that checks employment eligibility.

True, the president can choose whomever he likes for high-level positions. But Cuccinelli isn’t even a smart political pick. In addition to being unpopular with Democrats, he doesn’t have the full support of Republican lawmakers either. According to the website Vox, Sen. Mitch McConnell (R-Ky.) does not want to confirm Cuccinelli (the ill will stems from the fact that Cuccinelli headed up a political action committee that supported primary challenges to incumbent Republicans in 2014). Besides, on immigration most Americans are moving away from Trump. This January, the Pew Center found that 62 percent of Americans believe that immigrants strengthen our country. A restrictionist like Cuccinelli is not what the public wants or needs.

As head of USCIS, Cuccinelli would bring little to the job except a track record as a Trump loyalist. With his outdated and narrow views, he would be a disaster overseeing our legal immigration system.

Let’s remember that fired hardliner L. Francis Cissna was the man who “took the ‘Services’ out of US Citizenship and Immigration Services.” His dismal anti-immigrant polices and undermining of public service have brought unprecedented backlogs to USCIS adjudications that are now under Congressional investigation. He also reportedly “tanked” employee morale at USCIS. Nevertheless, he wasn’t quite nasty enough for Trump and his neo-Nazi White Nationalist advisor Stephen MIller.

As a Virginia resident who suffered through “Cooch Cooch’s”  disastrous tenure as Attorney General and his thankfully unsuccessful bid to become our Governor, I can testify that he is indeed without any redeeming social values. In other words, a perfect fit for the “Trump Immigration Kakistocracy.” But, “Cooch Cooch” has some powerful enemies in the GOP Senate. He pissed off Senate Majority Leader Mitch McConnell, and powerful Senator Chuck Grassley (R-IA) can’t be too pleased with Trump’s treatment of his former staffer Cissna.

In the meantime, it’s “chaos as usual” in the DHS/USCIS kakistocracy.

NEW VIRGINIA LAWS HELP IMMIGRANT CHILDREN SEEK PROTECTION FROM ABUSE, NEGLECT, AND ABANDONMENT

RICHMOND: On Friday, February 22, the Virginia General Assembly passed SB 1758 and HB 2679, identical bills that will aid immigrant children fleeing abuse, neglect, and abandonment in their home countries in seeking protection from deportation in Virginia.

Across the country, many immigrant children and DREAMers facing deportation proceedings seek a form of immigration relief called “Special Immigrant Juvenile Status” (SIJS). SIJS is unique in that it requires a state court to issue a certain type of order before the child may even attempt to seek SIJS relief from the federal government. In a 2017 case called Canales v. Torres-Orellana, brought by the Legal Aid Justice Center, the Virginia Court of Appeals sharply restricted state judges’ ability to issue these orders, leaving hundreds of Virginia immigrant children without protection. Virginia became one of the most difficult states in the nation to obtain SIJS.

During this year’s General Assembly session, Legal Aid Justice Center worked closely with legislators and the Governor’s office to pass these bills, which would overturn the Canales case and restore Virginia immigrant children’s ability to apply for SIJS. The bills also address the needs of other children before the juvenile courts, easing the way for any Virginia child to seek a state court’s assistance in proving eligibility for other benefits such as adoption assistance, TANF assistance, and timely public school enrollment.

SB 1758 was introduced by Sen. Scott Surovell (D-Mount Vernon). HB 2679 was introduced by Del. Marcus Simon (D-Falls Church). The bills initially took different approaches to fixing this issue, and each passed their respective chambers with an overwhelming bipartisan majority of votes. The bills were then placed into committees of conference in an attempt to gain consensus, and identical bills emerged that combined the approach of both; they garnered unanimous support in the House, and only two dissenting votes in the Senate. The bills now go to Governor Northam’s desk for his signature; once signed, they will take effect on July 1 of this year. “Immigrant children in Virginia can breathe a little more easily now,” said Simon Sandoval-Moshenberg, Legal Director of Legal Aid Justice Center’s Immigrant Advocacy Program. “Our agency has represented over 150 children fleeing truly horrific situations of abuse or neglect in their home countries. Fairness dictates that they be afforded the same rights as immigrant children in any other state. Now these new DREAMers will be able to seek protection and apply to remain in the United States with green cards.”

“This excellent result could not have come about without the leadership and hard work of Senator Surovell and Delegate Simon, and the support of Governor Northam’s administration,” said Amy Woolard, Legal Aid Justice Center Attorney and Policy Coordinator. “Virginia’s Juvenile and Domestic Relations courts should exist to protect the best interests of all children in the Commonwealth, and these bills will now make clear that is true for immigrant children seeking safety through SIJS, as well.”

“The United States has a long history of protecting abused, neglected, and abandoned children, and the Commonwealth will continue to play its part,” said Sen. Surovell. “These bills will clarify and restore Virginia courts’ authority to make factual findings necessary to protect children fleeing abuse, neglect, and abandonment from abroad, and I appreciate the broad bipartisan support of legislators who saw this as consistent with Virginia’s longstanding values.”

“I’m so pleased we were able to pass this important legislation to give our courts the authority they need to be able help some of the most vulnerable and powerless people in our Commonwealth,” said Del. Simon. “It is so important that we not let victims of abuse, neglect, and often abandonment fall through the cracks because of a technical deficiency in our code. Those are the common sense problems we are elected to come down here and fix.”

Passage of HB19-1042: Extension of State Court Jurisdiction for Vulnerable Youth 

RMIAN is thrilled to announce the passage of House Bill 19-1042 through the Colorado House and Senate. The bill was sponsored by Representative Serena Gonzales Gutierrez and Senator Julie Gonzales and is now awaiting signature by Governor Polis. This bill will allow immigrant youth who have been abused, neglected, and abandoned to gain access to Colorado State courts for necessary protection and care, and to establish their eligibility for federal immigration relief. Ashley Harrington with RMIAN Children’s Program helped to craft this important legislation with Representative Gonzales Gutierrez, Senator Gonzales, Denise Maes with the ACLU of Colorado, Kacie Mulhern with the Children’s Law Center, Ashley Chase from the Office of the Child’s Representative, Katie Glynn with Grob & Eirich, and Bridget McCann, a RMIAN pro bono family law attorney. SIJ cases also have the huge benefit of being processed outside the clogged U.S. Immigration Court asylum system, thus keeping many cases out of the largely artificially created “backlog” that is handicapping Due Process in Immigration Court.

There are many ways of using and building on current laws to make the immigration and justice systems work better. It’s a national disgrace that the Trump Administration isn’t interested in Due Process, fairness, or making our immigration system function in a more rational manner.

The good news: Eventually, the small minds, incompetence, and “radical White Nationalism” of this Administration and its enablers will be replaced by smarter, wiser, more capable folks like those in the LAJC, the RMIAN, and other members of the New Due Process Army. These are the folks who someday will lead us out of today’s darkness into a brighter and more enlightened future for all Americans!

POLITICS: METAMORPHOSIS: 🤥🤥🤥🤥🤥How Ralph Northam Morphed Into A “Trump-Style” Liar Before Our Eyes — Resign Now, Ralph, Before You Inflict Even Further Harm On Our Commonwealth & Our Nation!

Ralph Northam, the governor of Virginia, swears he’s telling the truth. On Friday, Northam confessed to appearing in a racist photo in a 1984 yearbook. On Saturday, after Democrats called on him to resign, he reversed himself and said it was a case of mistaken identity. “I will stand and live by my word,” Northam told reporters at an afternoon press conference. He quoted the honor code of his alma mater, the Virginia Military Institute: “A cadet shall not lie, cheat, steal, or tolerate those who do.”

I don’t know whether Northam is one of the people in the photo. But I do know he’s been lying in his responses to this story. The evidence is in his own words. Let’s take his denials, one by one.

1. He believed right away that he wasn’t in the picture. The photo appears in the yearbook of Eastern Virginia Medical School, where Northam was a student. It seems to have been taken at a party, and it appears on a page that bears Northam’s name, alongside what are clearly pictures of him. It shows one person in blackface and another in a Ku Klux Klan hood and robes. The two people are hard to identify. In a written statement that Northam read aloud at his press conference, he asserted that when he was first shown the photo, “I believed then and now that I am not either of the people in that photo.”

That denial contradicts Northam’s previous statements. The photo was initially posted on a conservative website, Big League Politics, on Friday afternoon. Reporters confirmed that it was in the yearbook. Around 6 p.m., Northam issued a statement acknowledging that it was “a photograph of me.” He apologized for “the decision I made to appear as I did in this photo.” Two hours later, he released a video statement in which he apologized for “my past actions,” “the decisions I made,” and “the harm my behavior caused.” Northam’s Friday statements, like his Saturday statement, were scripted, so he couldn’t have misspoken. Either he believed on Friday that he wasn’t in the photo—in which case his Friday statements were false—or he didn’t, in which case his Saturday statement was false.

Northam also told the Virginia Legislative Black Caucus that he was in the picture. According to three lawmakers, the governor confirmed in a Friday-night meeting with the caucus that he was in the photo. “Last night, from his mouth to my ear, he apologized to me for the mistake that he made,” Sen. Louise Lucas, a member of the caucus, reported on Saturday. Did Northam mislead the caucus? Or is he misleading everyone else now?

2. He knew he couldn’t have done it. This is a stronger denial, based on Northam’s moral certainty that he isn’t the sort of person who could have worn such costumes. At the press conference, he claimed that when he first saw the photo, “My first impression, actually, [was] that this couldn’t be me.” In fact, it was more than impression. “There is no way that I have ever been in a KKK uniform,” he declared. “I am not the person in that uniform. And I am not the person [in blackface] to the right.”

But if Northam was that certain of his innocence, why didn’t he say so on Friday? When he was asked at the press conference, he pleaded, “I didn’t know at the time.” He claimed to have confessed initially because “based on the evidence presented to me at the time, the most likely explanation [was] that it was indeed me in the photo.” He added, “It has taken time for me to make sure that it’s not me.”

3. He could tell just by looking at the photo. “It is definitely not me. I can tell by looking at it,” Northam told reporters on Saturday. Later, he repeated, “If one looks at the picture, it’s not my picture.” That’s not consistent with the governor’s confessions of guilt or his confessions of uncertainty. The picture was the first piece of information he had. If it was sufficient to exonerate him, why didn’t he say so? When a reporter posed that question at the press conference, all Northam could say was, “I didn’t study it as well as I should.”

That’s just not credible. What changed between Friday night and Saturday morning wasn’t Northam sitting up late with a magnifying glass. It was two other things. First, based on the governor’s initial confessions, a wave of Democrats, including the Virginia Democratic Party and House Speaker Nancy Pelosi, announced that he should resign. Second, Northam contacted his former medical school classmates. At the press conference, he said they told him they had “never seen me in any outfit like that.” He also said he had asked a former classmate, “Is there a possibility, you think, that someone could have put a photo on the wrong page?” Northam said that this classmate told him photos had been misplaced “on numerous pages in this very yearbook. … Photos laid out on a table. One could mistakenly get put on the wrong page. This happened numerous times in this yearbook. And I suspect that’s what happened in this case.”

Northam presented these conversations with his classmates as evidence of his innocence.
And maybe that’s what they’ll turn out to be. But for now, they’re just evidence that he checked to see whether anyone in his class might have information that could support the case against him. Nobody remembers him wearing anything like the costumes in that picture. He has also found a witness who could testify that pictures were sometimes misplaced. So what Northam knows now—but didn’t know on Friday night—was that if he denies he’s in that photo, he might be able to get away with it.

I hope Northam isn’t in that picture. But one way or the other, he’s been lying.

No excuses, no delays, the best and only thing that Northam can do for the people of Virginia and for himself is to resign, get out of the political arena, and use his medical skills to promote social justice and improve the lives of all Virginians.

Every additional minute that he remains in office demeans and embarrasses the state and the office for which he was elected, while continuing to insult African-Americans and humane values everywhere.

Resign now! Call Lt. Gov. Justin Fairfax and pass him the helm tonight. Don’t make us go through the painful and unnecessary circus of removing you.
