A private prison guard physically assaulted a five-year-old boy at an immigration detention center in Texas, according to a complaint filed with the Department of Homeland Security (DHS).

Advocates for the boy and his mother expect the family to be deported on Friday and asked the US government to halt the deportation to investigate the alleged assault. The advocates also said the family, who are anonymous for safety reasons, face imminent harm or death in their home country of Honduras.

The alleged assault occurred in late September, when the boy was playing with a guard employed by the private prison company CoreCivic who had played with the boy before.

The five-year-old tried to give the guard a high-five, but accidentally hit him instead, angering the guard, according to a complaint seen by the Guardian. The guard then allegedly grabbed the boy’s wrist “very hard” and would not let go.

“The boy’s mother told the guard to let go and tried to pull her son’s hand away, but the guard kept holding on,” according to the complaint. “He finally released the boy and threatened to punish him if he hit him again.”

The complaint said the boy’s hand was swollen and bruised and he was treated with pain medication and ice at the South Texas family residential center in Dilley, in a remote part of the state about 100 miles from the US-Mexico border.

The Dilley detention center has been controversial since it opened in 2014. Dilley can hold 2,400 people, the most of any family detention center in the country, and in March 2019 held at least 15 babies under one year old.

“Since the assault, the boy is afraid of male officials at the jail, goes to the bathroom in his pants, bites his nails until they bleed, and does not want to play, sleep, eat, or bathe,” the complaint said.

The Guardian contacted US Immigration and Customs Enforcement (Ice), the homeland security agency which oversees immigration detention, and CoreCivic for comment, but they had not provided a response at the time of publication.

Katy Murdza, advocacy manager for the Dilley Pro Bono Project, which sends volunteers into the Dilley detention center to help families, met with the mother on Wednesday.

Murdza said the mother is fearful of her imminent deportation and is upset about what happened to her son because she had little power to protect him.

“She was unable to prevent someone from hurting her child and while she has tried to report it, she hasn’t received any information on what the results are, so she still does not have control of whether the detention center let that staff member back in,” Murdza said.

“When people are detained and it’s hidden from the public, these sorts of things happen and there are probably many other cases that we have never learned about that could be similar to this,” Murdza added.

The American Academy of Pediatrics said in March 2017 that no migrant child in the custody of their parent should ever be detained because the conditions could harm or retraumatize them.

The US government can release asylum-seeking families in the US while they wait for their cases to be heard in court, but Donald Trump’s administration favors expanding detention and has tried to extend how long children can be held in detention centers.

Katie Shepherd, national advocacy counsel with the American Immigration Council’s Immigration Justice Campaign, filed the complaint on Thursday with the DHS watchdog, the office of the inspector general, and with its office for civil rights and civil liberties.

“The government has a long history demonstrating it’s not capable of holding people in their custody responsibly and certainly not children who require special protections and safeguards,” Shepherd said. “They require a different environment, not one where guards are going to be physically abusing them.”

I was recently reminded of how John Kelly, former DHS Secretary and former White House Chief of Staff, is now on the board of Caliburn International: the conglomerate that runs detention facilities for migrant children. He is despicable. This was reported in May:

Former White House Chief of Staff John Kelly can now count on a second line of income.

In addition to his attempt at scoring paid speaking gigs, Kelly has now joined the board of Caliburn International, the company has confirmed to CBS News. Caliburn is the parent company of Comprehensive Health Services, which operates four massive for-profit shelters that have government contracts to house unaccompanied migrant children.

Kelly’s new job first became apparent when protesters gathered outside Comprehensive Health Services’ Homestead, Florida facility last month — it’s the biggest unaccompanied migrant child detention center in the country. They, along with a local TV station, spotted Kelly enter the facility, and CBS News later confirmed his affiliation. Read more..

Apparently, Kelly’s USG pension as a retired 4-star General wasn’t enough to support him in the style to which he aspired (perhaps after rubbing shoulders with the Trump family and its circle of grifters). So, he found it necessary to supplement his income off the misery of families and children in the “New American Gulag” he helped establish.

I had accurately predicted that Kelly wouldn’t leave his “service” to Trump with his reputation intact. Nobody does, except those with no reputation to start with.

Trump runs a kakistocracy. The private sector should treat the steady stream of spineless senior officials fleeing the Trump Circus accordingly.

Or compare the “achievements” of horrible frauds like these guys, who abused their time in the service of Trump by betraying our country’s most fundamental values, with that of a real American hero like the late Congressman Elijah Cummings (D-MD) who was eulogized today. Oct. 11, 2019. Acting Homeland Secretary Kevin McAleenan’s resignation was announced by Trump this evening. It contained the minimal “faint praise” for his efforts and the standard disingenuous bureaucratic BS about wanting to spend more time with the family and pursuing interests in the private sector. At least Big Mac has a family left, unlike those asylum seekers who died seeking legal protection, illegally separated children, abused asylum applicants living on streets in Mexico, and mindlessly deported long-time residents who suffered under his corrupt, yet inept, leadership at DHS.

Some news reports claim it was Big Mac’s decision. But, that seems unlikely, since he never was on the “Trump/Miller A Team.” It’s more likely that Big Mac actually was forced out by the White Nationalist Cabal lead by neo-Nazi Miller.

While cruel, corrupt, and complicit, Big Mac didn’t appear sufficiently ideologically committed to Miller’s racist restrictionist hate agenda. He certainly willingly abused human rights, but he didn’t do it with the obscene glee and delight in unnecessary human suffering consistently exhibited by Trump, Miller, and “Cooch Cooch.”

The DHS Secretary position has been a parade of horrors for the American Constitution, the Rule of Law, human rights, and human decency. McAleenan, like his predecessors General John Kelly and Kristjen Nielsen, came to the job with an undeserved reputation for professionalism and bipartisanship. In practice, he followed in the footsteps of his predecessors by performing like a typical political hack and Trump sycophant.

Illegal child separations, deaths in substandard detention conditions, misappropriation of funding for the Wall, totally absurd and dishonest “Safe Third Country” agreements with some of the most dangerous and “asylum free” countries in the world, abuse of legal asylum seekers under the “Let ‘em Die In Mexico” program, disrespect for and hindrance of attorney representation, bogus claims about failures to appear, expansion of the “New American Gulag,” illegal regulations aimed at indefinite detention of families and children, trashing the U.S. Refugee Program, illegal attempts to impose discriminatory “public change” requirements, illegal use of unreliable information to apprehend individuals, false imprisonment of U.S. citizens, mindless deportation of long-term residents who were actually benefitting America, tremendous backlogs of applications for legal stratus, overloading the Immigration Courts with improvidently commenced cases, schemes to discourage legal immigrants, insults to Federal Judges, lack of candor in dealing with Congress, and disrespect for Congressional Representatives are just some of the abominations that took place on Big Mac’s watch.

Indeed, in the past month lower Federal Courts have slammed as illegal at least five of the racist gimmicks that Big Mac and the DHS have tried to foist on the migrant community at the urging of Miller, “Cooch Cooch,” and the other White Nationalists. Some of Big Mac’s most egregious actions came in connection with the “in your face” regulations that DHS & DOJ presented to Judge Dolly Gee in the Flores litigation. Those regulations proposed unlimited abuses to be inflicted on detained children in unregulated facilities during indefinite detention, which was just the opposite of what Judge Gee had ordered. The DOJ’s unethical arguments in support of Big Mac’s indefensible position left Judge Gee incredulous.

Undoubtedly, he will be replaced by someone with a more overt ideology of racism and hate. Neo-Nazis like Ken “Cooch Cooch” Cuccinelli, now illegally serving as head of USCIS, or some of the DHS underlings who have been competing for Miller’s attention with public statements of cruelty, anti-immigrant sentiment, and disrespect for the law are strong possibilities. Trump has a penchant for finding and selecting the worst that humanity has to offer to serve him.

Indeed, it’s quite likely that Trump’s next choice will be so spectacularly unqualified and unpalatable, even to some in the GOP (see, “Cooch Cooch”), that “Moscow Mitch” might balk at pushing the nomination through. But, since Trump prefers to flaunt the Constitution and to operate with “acting toadies” anyway, that probably won’t make any difference.

The Trump Administration is a kakistocracy. So, expect the worst, but be prepared for something far more grotesque and absurd. In the meantime, Big Mac should be remembered for the laws he broke, his attacks on human rights and human decency, his intellectual dishonesty, his immorality, his cowardice in the face of tyranny, the cruel and unnecessary pain he inflicted on legal asylum seekers invoking our laws, and the many lives that he needlessly ruined in service to the worst and most unqualified President in U.S. history.

CATHERINE RAMPELL @ WASHPOST: Trump & His GOP’s Cowardly “War On Children” Should Outrage Every American! — Join The “New Due Process Army” & Fight To Save Humanity!

You’ve heard of the Wars on Drugs, Terror, Poverty, even Women. Well, welcome to the War on Children.

It’s being waged by the Trump administration and other right-wing public officials, regardless of any claimed “family values.”

For evidence, look no further than the report released Wednesday by the Department of Health and Human Services’s own inspector general. It details the trauma suffered by immigrant children separated from their parents under the Trump administration’s evil “zero tolerance” policy.

Thousands of children were placed in overcrowded centers ill-equipped to provide care for them physically or psychologically. Visits to 45 centers around the country resulted in accounts of children who cried inconsolably; who were drugged; who were promised family reunifications that never came; whose severe emotional distress manifested in phantom chest pains, with complaints that “every heartbeat hurts”; who thought their parents had abandoned them or had been murdered.

Such state-sanctioned child abuse was designed to serve as a “deterrent” for asylum-seeking families, as then-Chief of Staff John F. Kelly and other administration officials made clear.

Of course, they failed to recognize just how horrific are the conditions these asylum-seeking children are fleeing — conditions that further decreased HHS’s ability to adequately care for them.

“Staff in multiple facilities reported cases of children who had been kidnapped or raped” back in their home countries, the IG report states. Other children witnessed family members raped or murdered.

But hey, Trump believes these kiddos must be punished further for the crime of seeking refuge — a.k.a., the “invasion” of America.

Despite this and other abundant evidence that government facilities are not able to care for children for extended periods, last month, the administration also announced a new policy that would allow it to keep children (along with their families) in jail-like conditions for longer periods of time.

This is hardly the only way the administration has knowingly enacted policies that harm children.

In August, it finalized a rule that would make it more difficult for immigrants to receive green cards if they have used certain safety-net services they’re legally entitled to — or if government officials suspect they might ever use such services. Confusion and fear about the policy and whom it affects abound. This has already created a “chilling effect” for usage of social services, with immigrant parents disenrolling even their U.S.-citizen children just to be safe.

Last fall, for instance, I interviewed a green-card-holding mother who decided not to enroll her underweight newborn in a program that would have provided free formula (even though the program in question was not mentioned in the rule, and the baby is a U.S. citizen). Huge recent declines in children’s Medicaid and Children’s Health Insurance Program enrollment are also believed to be at least partly a result of fears about this policy change.

If Your Dog Does This, It Could Be Them Signaling A Warning

And lest you think only immigrant or brown children are being targeted in this war: U.S. servicemembers’ children, of all sorts of backgrounds, are being hurt, too.

The Trump administration is siphoning billions from various defense projects to fund border wall construction, despite promises that Mexico would pay for it. This might sound unlikely to affect kids, but somehow the Trump administration found a way. Among the projects losing funds are schools for the children of U.S. servicemembers based in Kentucky, Germany and Japan, and a child-care center at Joint Base Andrews in Maryland.

Trump’s proposed federal budgets have likewise axed funding for other programs that serve children, such as subsidized school meals and Medicaid. Indeed, both federal and state GOP officials more broadly are still working to kill the Medicaid expansion, as well as other Affordable Care Act provisions that benefit kids.

The GOP has likewise ignored the pleas of children who want their lives protected from gun violence, or who want their futures protected from a warming planet.

A year ago, I offered a suggestion : that Democrats make children the theme of their midterm campaign. They mostly ignored me and still did okay. Nonetheless, I’m re-upping it.

Because even without Trump’s baby jails and proposed Medicaid cuts, our country’s emphasis on children’s well- being is seriously deficient.

Last year, for the first time on record, we spent a greater share of the federal budget servicing the national debt than we did on children, according to an analysis out next week from First Focus on Children. Spending on children as a share of the federal budget is also expected to shrink over the coming decade, crowded out by both debt service and spending on the elderly.

This is despite the fact that spending on children (especially low-income children) has among the highest returns on investment of any form of government spending.

Whatever the opposite of Trump’s War on Children is, that’s what Democrats should be running on.

The erratic Trump administration has had just one consistent policy principle, one guiding North Star: punitive and often sadistic treatment of nonwhite immigrants.

President Trump’s claim that he supports legal immigration, as opposed to the undocumented “invasion” he rails against, turns out to be — big surprise — a lie. On Monday, the administration proved its antagonism toward those who “stand in line” and “come in the right way” by issuing a new rule forcing many legal immigrants to make an impossible choice: accept needed government benefits to which they are fully entitled, or preserve their chances of obtaining permanent residence.

Say you’re an immigrant from Mexico who came here legally to join family members who are already permanent residents or citizens. Say you’re working a full-time minimum-wage job, plus odd jobs nights and weekends. You are a productive member of society. You are paying payroll taxes, sales taxes, vehicle registration fees and other government levies. Still, as hard as you work, you can’t make ends meet.

You may be legally entitled to health care through Medicaid. You may be entitled to food assistance through the SNAP program, formerly known as food stamps. You may be entitled to housing assistance. But according to the new Trump administration rule — set to take effect in two months — if you use any of these programs, you might forfeit the opportunity to ever obtain a green card making you a permanent resident. That means you also forfeit the chance of ever becoming a citizen.

Long advocated by White House adviser Stephen Miller, the Torquemada of the immigration inquisition, the new policy is a major step in Trump’s crusade to Make America White Again. If it survives court challenges, the new rule could dramatically reduce legal — I repeat, legal — immigration from low-income countries. Not just coincidentally, I am sure, this means fewer black and brown people would be granted resident status.

Trump’s message to the world: Keep your tired, your poor, your huddled masses yearning to breathe free. As he memorably and disgracefully put it: “Our Country is FULL!”

This is part of a well-established pattern. Trump often uses immigrants as scapegoats, encouraging his supporters to blame them for any and all problems they face. But beneath the cynical posturing there appears to be genuine animus.

Does the president hate all immigrants? He did once allegedly muse about wanting more newcomers from Norway. But those who are not white are treated, by this administration, as if they were not fully human.

How else to characterize a policy of cruelly separating children from their asylum-seeking parents at the border? Of keeping children in cages and denying them toothbrushes or soap? Of cramming adults into overcrowded lockups when their only crime was to lawfully seek refuge from violence and persecution?

Last week, U.S. Immigration and Customs Enforcement staged what was apparently the biggest one-day immigration raid in modern American history. Approximately 680 men and women classified as “removable aliens” were arrested at seven work sites in Mississippi. Taken from their job sites, many left young children waiting in vain, and in anguish, for their parents to pick them up from school or day care.

ICE has limited resources — certainly nowhere near enough to go after all the estimated 11 million unauthorized immigrants in the United States. The only policy that makes sense is to prioritize the capture and removal of those who pose a genuine danger, such as MS-13 gang members. But that’s not who you find punching a clock for minimum wage at a chicken plant in Mississippi. Instead, you find hard-working people trying to put food on the table for their families.

The raid was a demonstration, a warning, a show of force. If the administration were serious, it would have gone after the employers, who were not immediately hit with charges or sanctions — and are already looking for replacement workers. The message to undocumented migrants was: You are weak. We can hurt you whenever we want.

Sensible immigration reform would provide the law-abiding undocumented with a pathway to legal status and citizenship. But the Republican Party blocks action because it is terrified that these immigrants would eventually become Democrats. I wonder why.

I’m betting that not a single unemployed steelworker or laid-off coal miner moves to Mississippi to take those jobs plucking poultry. Trump’s immigration policy isn’t a matter of economics. Nor is it a matter of principle or fairness.

Cruelty isn’t a sideshow in the way Trump deals with nonwhite immigrants. It’s the main event.

Are collasing bridges and deteriorating roads great? Is using public office for private gain great? Is nepotism great? Is failing to pay taxes great? Just what part of Trumpism does the “MAGA Crowd” think is “great?”

It’s not rocket science. Trump, Miller, ”Cooch Cooch,” & company are the vilest racists since the supposed end of Jim Crow (as we’re now seeing, that was an illusion; it never ended for the GOP and the Trumps of the world). The DHS and disgraceful and disingenuous cowards like McAleenan, Morgan, Albence, and Provost are their “handmaidens.” Barr is their enforcer. And the GOP is the racist party of the “New Jim Crow.”

It’s not just immigrants, Eugene. Once Trump and his neo-Nazi gang are done “Dred Scottifying” migrants, they are going after you and every other person of color and minority in the U.S. who dares to stand up to up to them.

Ironically, it’s a small handful of truly bizarre African Americans and Hispanic Americans who continue to support Trump, wrongly thinking that they are now “De Facto White” and consequently the “railroad cars will never be coming for them,” along with those who don’t vote, who could give Trump the electoral college edge he needs to remain in office (while likely losing the popular vote by an even larger margin than in 2016) and seal their own eventual demise and that of their families.

Some German Jews had converted to Lutheranism or Catholicism before World War II thinking that it would save them from Hitler and the anti-Semites. How did that work out for them?

Trump and today’s GOP are unapologetic racists as well as congenital liars lacking in any type of fundamental values. Their lies are many, selfishness rampant, and their policies and pronouncements vile. But, they must be taken seriously for the existential threat they are to the rest of us. To treat them as anything else or to express surprise when they turn out to be “as advertised,” is to push America and the world ever closer to the abyss.

Treating Trump as “normal” or a “legitimate” U.S. President, as too may Federal Judges, legislators, and some members of the media do, is a potentially fatal mistake. He’s a 24-caret fraud, but every bit as much of a threat to our nation’s future as George III was when the Declaration of Independence was written; probably greater, because he’s here on our shore, in person –trying to satisfy his own insatiable ego while destroying our nation.

THE DEPORTATION sweep Wednesday by hundreds of U.S. Immigration and Customs Enforcement agents at several food processing plants in Mississippi left a trail of tears, business jitters and widespread anxiety in places where undocumented immigrants are so tightly woven into communities that the towns would struggle to exist without them. The raids inflicted predictable suffering — especially among children whose parents were suddenly carted off — to such a degree that just 24 hours afterward, ICE had released some 300 of the 680 migrants it had arrested, including those who had no criminal records.

President Trump, whose own family business has for many years employed migrants who entered the country illegally , pronounced the Mississippi action a “very good deterrent ” to unauthorized immigration. The evidence for that assertion is nil. Still, the sweep provided some useful reminders, not least that the United States cannot deport its way out of a dysfunctional immigration system.

First, the raids underline American agriculture’s deep dependency on undocumented workers, who in 2014 accounted for 17 percent of employees in the sector — and considerably more than that on farms and in many food processing plants. Little wonder that plant managers and local residents in towns targeted by ICE last week worried that the raids would sap their businesses and vitality.

The fact is that relatively few Americans want dirty, dangerous jobs that pay $12 per hour, while requiring some employees to report to work at 3 a.m. One study commissioned by the dairy industry suggested 3,500 dairy farms would close if half the country’s foreign-born workers were deported; another survey, from North Carolina, showed that in 2011, a minuscule number of the state’s nearly half-million jobless workers applied for 6,500 available farm jobs, and most of those who were hired couldn’t hack the work; most of the jobs were then filled by Mexicans.

Second, any large-scale enforcement action will inevitably result in families being broken apart — including those whose children are U.S. citizens. In 2017, two-thirds of unauthorized adult migrants had lived in the United States for more than a decade, according to the Pew Research Center; their median duration of residence was 15 years. Officials may not like the optics of crying toddlers and preteens whose parents have been taken away, but they shouldn’t be surprised.

Third, businesses like the ones in Mississippi that employ undocumented workers are subject to federal prosecution. But it was Republican leaders in the House of Representatives last year, on Mr. Trump’s watch, who blocked legislation that would have required private employers to use E-Verify, a data system used to check whether employees are legally present in the country. Farm groups, including those who represent major employers in Republican districts in California and elsewhere, are dead set against requiring E-Verify, knowing it would produce severe labor shortages.

ICE officials and federal prosecutors are right that deportation sweeps are within their purview as lawful enforcement actions. The problem is that the law is so blatantly misaligned with economic, social and political realities that it is magical thinking to believe that enforcement alone, in the absence of sweeping reform of existing laws, can make a dent in the nation’s population of 10.5 million undocumented immigrants.

Best Point: Immigrants at the “lower levels” of our economic ladder make just as much, probably more, contribution to the national prosperity, continued existence, and welfare as those at the top. And, certainly they do more for the good of the nation than Trump and the useless civil enforcement authorities at DHS.

While I’m not going to turn away a “rocket scientist” who wants to immigrate, we certainly need more qualified agricultural, home health care, and construction workers than “rocket scientists.” And, yes, logical choices to enforce and administer the law in a rational manner, including declining to enforce useless and counterproductive provisions, and to resist political pandering stemming from racist motives are well within the lawful discretion of all law enforcement agencies.

Quibble: Just because enforcement is technically “lawful” does not mean that it’s prudent or appropriate. Most of today’s civil immigration enforcement is immoral, wasteful, and corruptly intended to support racism and White Nationalism.

I suspect that the majority of the criminal statutes and ordinances now on the books in the U.S. are largely unenforced or only sporadically enforced. That’s good policing, good public policy, and poor legislating.

What if your local police devoted 100% of their resources to “busting” anyone who drove 1 mile over the speed limit while failing to investigate and prosecute homicide, rape, robbery, and other violent felonies? That’s technically “legal,” but both inane and fundamentally corrupt. Those responsible would likely be quickly removed from office.

And, let’s be clear: While DHS resources are being concentrated on White Nationalist nonsense like the “Mississippi Raids,” REAL CRIMES, such as fraud, wage and hour violations, abuse of migrants, hate crimes directed at migrants, human trafficking, drug trafficking, domestic violence, rape, bribery, soliciting of sexual favors by DHS agents, extortion, perjury, tax evasion, and other felonies are NOT being aggressively investigated or prosecuted by Trump’s White Nationalist regime.

That’s basically the way the immigration laws are being (mal)enforced in Trump’s name by folks like McAleenan, Albence, Morgan, Provost, and others. Don’t fall for their nonsensical apologist “we’re only enforcing the law” BS. (Also, what about the laws protecting refugees, asylum seekers, and encouraging legal immigration that these complicit clowns are unlawfully perverting or failing to enforce?)

Instead, vote to insure they and everyone associated with Trump are removed from office, required to make an honest living in the future, and replaced with competent, humane, and ethical folks who will resist and when necessary “out” racism and White Nationalism in all of its toxic forms. Just because enforcement of obsolete, unworkable, and discriminatory laws might be technically “legal” doesn’t make it right, sensible, or moral. And, in the case of the Trump Administration, it’s downright immoral, dishonest, and counterproductive.

In case anyone missed it, the president of the United States had some choice words to describe Maryland’s 7th congressional district on Saturday morning. Here are the key phrases: “no human being would want to live there,” it is a “very dangerous & filthy place,” “Worst in the USA” and, our personal favorite: It is a “rat and rodent infested mess.” He wasn’t really speaking of the 7th as a whole. He failed to mention Ellicott City, for example, or Baldwin or Monkton or Prettyboy, all of which are contained in the sprawling yet oddly-shaped district that runs from western Howard County to southern Harford County. No, Donald Trump’s wrath was directed at Baltimore and specifically at Rep. Elijah Cummings, the 68-year-old son of a former South Carolina sharecropper who has represented the district in the U.S. House of Representatives since 1996.

The congressman has been a thorn in this president’s side, and Mr. Trump sees attacking African American members of Congress as good politics, as it both warms the cockles of the white supremacists who love him and causes so many of the thoughtful people who don’t to scream. President Trump bad-mouthed Baltimore in order to make a point that the border camps are “clean, efficient & well run,” which, of course, they are not — unless you are fine with all the overcrowding, squalor, cages and deprivation to be found in what the Department of Homeland Security’s own inspector-general recently called “a ticking time bomb.”

In pointing to the 7th, the president wasn’t hoping his supporters would recognize landmarks like Johns Hopkins Hospital, perhaps the nation’s leading medical center. He wasn’t conjuring images of the U.S. Social Security Administration, where they write the checks that so many retired and disabled Americans depend upon. It wasn’t about the beauty of the Inner Harbor or the proud history of Fort McHenry. And it surely wasn’t about the economic standing of a district where the median income is actually above the national average. No, he was returning to an old standby of attacking an African American lawmaker from a majority black district on the most emotional and bigoted of arguments. It was only surprising that there wasn’t room for a few classic phrases like “you people” or “welfare queens” or “crime-ridden ghettos” or a suggestion that the congressman “go back” to where he came from.

This is a president who will happily debase himself at the slightest provocation. And given Mr. Cummings’ criticisms of U.S. border policy, the various investigations he has launched as chairman of the House Oversight Committee, his willingness to call Mr. Trump a racist for his recent attacks on the freshmen congresswomen, and the fact that “Fox & Friends” had recently aired a segment critical of the city, slamming Baltimore must have been irresistible in a Pavlovian way. Fox News rang the bell, the president salivated and his thumbs moved across his cell phone into action.

As heartening as it has been to witness public figures rise to Charm City’s defense on Saturday, from native daughter House Speaker Nancy Pelosi to Mayor Bernard C. “Jack” Young, we would above all remind Mr. Trump that the 7th District, Baltimore included, is part of the United States that he is supposedly governing. The White House has far more power to effect change in this city, for good or ill, than any single member of Congress including Mr. Cummings. If there are problems here, rodents included, they are as much his responsibility as anyone’s, perhaps more because he holds the most powerful office in the land.

Finally, while we would not sink to name-calling in the Trumpian manner — or ruefully point out that he failed to spell the congressman’s name correctly (it’s Cummings, not Cumming) — we would tell the most dishonest man to ever occupy the Oval Office, the mocker of war heroes, the gleeful grabber of women’s private parts, the serial bankrupter of businesses, the useful idiot of Vladimir Putin and the guy who insisted there are “good people” among murderous neo-Nazis that he’s still not fooling most Americans into believing he’s even slightly competent in his current post. Or that he possesses a scintilla of integrity. Better to have some vermin living in your neighborhood than to be one.

Tellingly, what set off this latest barrage of racist lies was Cummings’s very legitimate anger at and criticism of the Border Patrol and Kevin “Big Mac With Lies” McAleenan during a recent oversight hearing.

The Border Patrol atrocities that Cummings cited, and that “Big Mac” and his GOP backers deny, have all been documented beyond a reasonable doubt by countless reporters, lawyers, Congressmen, the victims themselves, and, most tellingly, the DHS’s own Inspector General. They aren’t “matters of opinion;” they are irrefutable facts that McAleenan disingenuously continues to deny, obscure, and cover up.

Beyond that, recent reports about the racist website in which many Border Patrol personnel, including Chief Carla Provost, participate show that the Border Patrol has a serious racism and lack of professionalism problem that is right out in the open that McAleenan has failed to solve and appears to minimize. No, he’s too busy abusing children and other migrant detainees and dishonestly promoting “Safe Third Country” agreements that violate the statute and his oath of office. In a normal times, McAleenan would be a strong candidate for removal from office and criminal prosecution. Here, he’s just another dishonest Trump stooge.

Hang in there Chairman Cummings! Don’t let the vile racists and White Nationalists who have taken over our Government and are trampling both our Constitution and human decency off the hook!

In the video Op-Ed above, children read testimonies given by young migrants detained in Customs and Border Protection facilities. They reveal harrowing stories of children living in cages, going hungry and tending to infants without their parents.

Border Patrol has been detaining thousands of children, sometimes for weeks, in conditions no child anywhere should suffer. At a June hearing before a federal appeals court, judges were stunned by the administration’s arguments that these children were kept in “safe and sanitary” facilities, as required by the Flores Settlement.

The overcrowding, long stays and inhumane, possibly illegal living conditions are a result of the Trump administration’s cruel immigration policies and mismanagement of the Department of Homeland Security, which oversees the border agency.

Barring exceptional circumstances, the legal limit for Border Patrol to detain children is 72 hours. The agency is then supposed to transfer children to the custody of the Office of Refugee Resettlement for a maximum of 20 days. But the resettlement office has been keeping children far longer, creating a backlog across the entire system. As a result, Border Patrol centers have not been quickly processing unaccompanied children and migrant families, who have recently been crossing the border in record-breaking numbers.

Detained children provided the testimonies read in this video last month to lawyers who visited Border Patrol centers as part of an ongoing investigation of detention facilities.

WASHINGTON — The poor treatment of migrant children at the hands of U.S. border agents in recent months extends beyond Texas to include allegations of sexual assault and retaliation for protests, according to dozens of accounts by children held in Arizona collected by government case managers and obtained by NBC News.

A 16-year-old Guatemalan boy held in Yuma, Arizona, said he and others in his cell complained about the taste of the water and food they were given. The Customs and Border Protection agents took the mats out of their cell in retaliation, forcing them to sleep on hard concrete.

A 15-year-old girl from Honduras described a large, bearded officer putting his hands inside her bra, pulling down her underwear and groping her as part of what was meant to be a routine pat down in front of other immigrants and officers.

The girl said “she felt embarrassed as the officer was speaking in English to other officers and laughing” during the entire process, according to a report of her account.

A 17-year-old boy from Honduras said officers would scold detained children when they would get close to a window, and would sometimes call them “puto,” an offensive term in Spanish, while they were giving orders.

Earlier reports from investigators for the Department of Homeland Security’s Office of the Inspector General from the El Paso and Rio Grande Valley sectors in Texas detailed horrific conditions for children and other migrants held in overcrowded border stations where they were not given showers, a clean change of clothes or space to sleep. The reports from the Yuma CBP sector describe similar unsanitary and crowded conditions but go further by alleging abuse and other misconduct by CBP officers.

President Trump has pushed back against reports of poor conditions for children, and Kevin McAleenan, acting secretary of DHS, which oversees CBP, has said the reports are “unsubstantiated.”

In a statement about the Yuma allegations, a CBP spokesperson said, “U.S. Customs and Border Protection treats those in our custody with dignity and respect and provides multiple avenues to report any allegations of misconduct. … The allegations do not align with common practice at our facilities and will be fully investigated. It’s important to note that the allegation of sexual assault is already under investigation by the Department of Homeland Security’s Office of Inspector General.”

DHS had been sounding the alarm on overcrowding in border facilities for months, resulting in a $4.5 billion emergency funding bill recently passed by Congress. In Yuma, a soft-sided tent facility was opened at the end of June to accommodate overcrowding at the border station.

But in nearly 30 accounts obtained from “significant incident reports” prepared between April 10 and June 12 by case managers for the Department of Health and Human Services, the department responsible for migrant children after they leave CBP custody, kids who spent time in the Yuma border station repeatedly described poor conditions that are not pure byproducts of overcrowding. They reported being denied a phone call, not being offered a shower, sleeping on concrete or outside with only a Mylar blanket, and feeling hungry before their 9 p.m. dinnertime.

One child reported “sometimes going to bed hungry because dinner was usually served sometime after 9 p.m. and by that time she was already asleep,” according to the documents.

All children who gave accounts to case managers had been held at the border station longer than the 72 hours permitted by law.

Laura Belous, advocacy attorney for a organization that provides legal services to migrant children, the Florence Immigrant & Refugee Rights Project, said her group was “horrified and sickened by the allegations of abuse … But unfortunately, we are not surprised.”

“The children that we represent have reported being held in overcrowded and unsanitary conditions for days,” said Belous.

“Our clients tell us that they have seen CBP agents kick other children awake, that children do not know whether it’s day or night because lights are left on all the time, and that they have had food thrown at them like they were wild animals.

“Our clients and all migrants deserve to be treated with dignity and respect.”

Nearly every child interviewed by the HHS case workers after leaving the Yuma border station reported poor sleeping conditions. A 17-year-old boy from Guatemala reported having to sleep outside even though his clothes were wet from having recently crossed a river, likely the Colorado River.

Once he was transferred inside, the conditions were not much better. “He shared that there was not always space on the floor as there were too many people in the room. He further shared that there would be room available when someone would stand up,” his report stated.

Many migrant children said they were either not given a mattress, pillow or blanket to sleep with, or were just given a Mylar blanket instead.

Other children described being scared of the officers and said the officers would get angry if they asked for anything. One child wore soiled underwear for the 10 days he was in the border station because he was afraid to ask the officers for a clean pair, according to one of the reports. Another, a 15-year-old girl from Guatemala, described the food as “gross and cold most of the time.”

HHS referred NBC News to DHS for comment.

In a statement to NBC News, Rep. Elijah Cummings, D-Md., chairman of the House Committee on Oversight and Reform, said, “These allegations are very concerning and need to be fully investigated. The president has denied any problems with these detention centers — despite multiple confirmed reports to the contrary — but it is the Trump administration’s own policies that have contributed to this humanitarian crisis and this lack of accountability.”

Cummings has called on McAleenan to testify about the poor conditions for immigrants at the border.

Pretty disgusting. Both Trump and McAleenan are proven liars when it comes to denying and covering up cruel and inhuman treatment of detainees. They particularly enjoy targeting women and children. A group of roughly 100 Haitians, Africans and South Americans cross the Rio Grande, just shallow enough for adults to wade despite an overnight storm.

As they wait on the muddy bank near Del Rio, Texas, to surrender themselves to the Border Patrol, the voices of children in the group carry across the river to the Mexican side.

There, in the city of Ciudad Acuña, hundreds of migrants have formed an impromptu refugee camp in an ecological park bound on one side by the river. Just outside the park, the official port of entry to the United States sits at the end of a short bridge.

They’ve crossed thousands of miles by foot, boat and bus to seek asylum in the U.S., only to find themselves stalled in a purgatory of soggy tents and overflowing bathrooms. Now, they face an uncertain wait prolonged by Trump administration policy.

The temptation to make the risky and illegal river crossing mounts daily.

“If you see people jumping over the river, it is because they are tired of staying here,” said one resident of the camp, Luis, who declined to give his last name out of fear for the safety of his family back home.

Home for him would be the West African nation of Cameroon, where Luis was vice principal of a school until he fled last fall. He escaped a widening conflict between the country’s English-speaking minority and its Francophone-majority government, which receives security assistance from the U.S.

He was jailed and tortured before escaping to neighboring Nigeria, Luis said. After a trek across three continents, he landed here, where he has waited for six weeks to present himself to U.S. officials at the Del Rio port of entry.

He hopes to join a sister in Ohio.

“At times, it is really disheartening,” he said, “so it is difficult to wait.”

Cruel, “designed to fail” policies and complicit judges who fail to protect the statutory, constitutional, and human rights of others are unlikely to stop the flow of forced migrants in the long run. E.J. Dionne, Jr. writes in the Washington Post commenting on a recent speech by David Miliband, Chief Executive of the International Rescue Committee:

“A new and chilling normal is coming into view,” Miliband concluded. “Civilians seen as fair game for armed combatants, humanitarians seen as an impediment to military tactics and therefore unfortunate but expendable collateral, and investigations of and accountability for war crimes an optional extra for state as well as nonstate actors.”

But these evils cannot be isolated from the larger political corrosion in the rest of the world — and this includes the long-standing democracies themselves. “The checks and balances that protect the lives of the most vulnerable people abroad,” he said, “will only be sustained if we renew the checks and balances that sustain liberty at home.”

This isn’t simply about aligning principle and practice. More fundamentally, when governments abandon a commitment to accountability domestically, they no longer feel any obligation to insist upon it internationally. It’s no accident, as Miliband noted, that under President Trump, the United States “has dropped the promotion of human rights around the world from its policy priorities.”

He pulled no punches: “The new order is epitomized in the photo of Russian President [Vladimir] Putin and Saudi Crown Prince [Mohammed bin] Salman high-fiving each other at the G-20 meeting in Argentina in November last year. With Syria in ruins, Yemen in crisis, and political opponents like Boris Nemtsov and Jamal Khashoggi dead, theirs was the embrace of two leaders unencumbered by national institutions or by the fear of international law.”

Miliband acknowledged the mistakes of an earlier era (including the Iraq War) but argued that “accountability, not impunity” was on the rise in the 1990s, when there was “an unusual consensus across the left-right divide” about “the need for global rules.” We have said goodbye to all that.

In 2002, Samantha Power, later the U.S. ambassador to the United Nations, published “ ‘A Problem from Hell’: America and the Age of Genocide,” a book that stirred consciences about the world’s obligations to helpless people unprotected — and often targeted — by sovereign governments.

WASHINGTON — Government investigators have identified poor conditions in another sector of the southern border, publishing graphic photos showing extreme overcrowding in Rio Grande Valley migrant facilities and finding that children there did not have access to showers and had to sleep on concrete floors.

Investigators for the Department of Homeland Security who visited border stations in the El Paso, Texas, sector in May found similar conditions: Migrants being held in temporary facilities for weeks rather than days, single adults living in standing room-only cells with no space to lie down, and concerns about serious health risks.

The investigators for the DHS Office of the Inspector General toured five Border Patrol facilities and two ports of entry in the Rio Grande Valley sector during the week of June 10 and published their report as a “management alert” to the department on Tuesday.

The Rio Grande valley of Texas has the highest volume of immigrants along the United States-Mexico border. At the time of the visits by investigators, Border Patrol was holding 8,000 detainees in custody, with 3,400 being held longer than the 72-hour limit.

One senior manager at a facility called the situation a “ticking time bomb,” according to the report. When immigrants detained in the facilities saw investigators walking through, they banged on the cell windows and pressed notes against the plexiglass to show the length of time they had spent in custody. One said “Help 40 Day Here.”

On Monday, NBC News published findings by the inspector general that detailed poor conditions for migrants in border stations in El Paso as far back as May 7. Acting DHS Secretary Kevin McAleenan said at a press conference Friday that reports of poor conditions for children in border stations were “unsubstantiated.” McAleenan said children were given showers as soon as they could be made available.

“Most single adults had not had a shower in CBP custody despite several being held for as long as a month,” according to the latest report on conditions in the Rio Grande Valley.

The report also detailed what it called “security incidents” in which immigrants have tried to escape and once refused to return to their cells after being removed during maintenance. To address the problem, Border Patrol called in its special operations force to “demonstrate it was prepared to use force if necessary,” the report said.

COURTSIDE HAS BEEN SAYING IT FOR YEARS; THE NY TIMES FINALLY PICKS UP: Trump & Co’s White Nationalist Racist Immigration Policies Are Corrupting America!

Last year, as part of an effort to carry out President Trump’s promise of “extreme vetting” of visitors to the United States, the Department of Homeland Security began collecting social media account information from millions of people seeking to cross the border.

After all, a radical online could be a radical offline.

That’s why the stream of posts ricocheting around a 9,500-member Facebook group, comprising current and former Border Patrol agents as well as some people with no apparent connection to the Border Patrol, is so troubling. Members of the group, as documented by ProPublica this week, “joked about the deaths of migrants, discussed throwing burritos at Latino members of Congress visiting a detention facility in Texas on Monday and posted a vulgar illustration depicting Rep. Alexandria Ocasio-Cortez engaged in oral sex with a detained migrant, according to screenshots of their postings.”

Of a 16-year-old migrant from Guatemala who died while in Border Patrol custody in May, a member of the group wrote, “If he dies, he dies.”

Customs and Border Protection said on Monday that it had informed the Department of Homeland Security’s inspector general about the posts and had started its own investigation. The National Border Patrol union decried the posts as “inappropriate and unprofessional.”

A reckoning from their superiors is due for any border agents who dishonored their uniform by spreading vileness on social media. In June, when the Plain View Project, a nonprofit research effort, released documentation on dozens of police officers from eight departments across the country posting racist, misogynist and Islamophobic material, 72 police officers in Philadelphia were pulled off the streets and the top prosecutor in St. Louis said she would no longer accept cases from 22 officers.

In a larger sense, the Border Patrol Facebook posts reveal a worrying mind-set among some of those charged with administering the harshest crackdown on migrants and asylum-seekers in decades. “These are clearly agents who are desensitized to the point of being dangerous to migrants and their co-workers,” Representative Joaquin Castro, who heads the Congressional Hispanic Caucus, told ProPublica.

The realities of that crackdown have created conditions that Americans would condemn if they were in another country.

While lawmakers refuse to compromise on emergency aid for the humanitarian needs at the border, “children are held for weeks in deplorable conditions, without access to soap, clean water, showers, clean clothing, toilets, toothbrushes, adequate nutrition or adequate sleep,” groups supporting the children wrote in a recent court filing. A judge on Friday ordered Customs and Border Protection to allow health workers into facilities where children are being held to ensure that conditions are “safe and sanitary.”

On Monday, Ms. Ocasio-Cortez toured facilities where migrants and asylum-seekers are being held. “Officers were keeping women in cells w/ no water & had told them to drink out of the toilets,” she tweeted.

As the congressional delegation arrived at one detention facility, they were heckled and cursed at by demonstrators, including one man wearing a Make America Great Again hat. (Another heckler hurled ethnic slurs at Representative Rashida Tlaib.)

Only a callous person could find mirth in the misery at the border. And only a desensitized nation could continue to permit the separation of children from their parents — and detaining all of them in atrocious conditions — as a morally acceptable form of deterrence.

The constant lies, false narratives, intentional inhumanity, and “deterrence only” of Trump’s self-created “border crisis” are merely the latest example of how White Nationalism demeans our nation. This Administration has all of the legal tools necessary to process arriving asylum seekers in a fair, timely, and orderly manner. They just refuse to use them as they were intended to solve, rather than intentionally create and aggravate, migration problems.

Contrary to Trump/GOP false narratives, that includes the present ability to establish a legitimate refugee application program in or near the Northern Triangle and to use it as an incentive for refugees to apply outside the United States rather than coming to the border to apply for asylum. However, to work as an incentive, rather than a failed deterrent, the refugee program must be administered in a fair and generous manner that would allow those who have legitimate fears of persecution on the basis of gender, actual or political opposition to gangs, ethnicity, or religious activities to be properly classified as refugees and resettled here or in some other truly safe location as determined in conjunction with the UNHCR and signatory countries outside the Northern Triangle who can actually provide at least a reasonable chance of safety.

That likely means a goal of admitting at least 50,000 to 100,000 refugees to the U.S. from Central America over the next year. That, along with robust aid to address the problems creating the refugee flow would be the legal and effective approach to the forced migration issue.

Additionally, the Administration has the ability to reauthorize and extend “Temporary Protected Status” (“TPS”) to qualified individuals from the Northern Triangle already present in the U.S. until such time as the conditions in their home countries can be stabilized. This would also have the advantage of tracking the presence of such individuals in the United States while reducing the pressure on the already backlogged U.S. Immigration Court system.

Of course, the Administration has no intention of using any of these tools to solve the problem. That would be inconsistent with their racist, restrictionist, White Nationalist agenda aimed primarily at keeping non-white individuals out of the United States and reducing the rights and political power of those who are already citizens. The purpose of refugee protection laws is actually to protect refugees, not, as this Administration posits, to kill as many of them as possible outside the U.S. or at our border to “deter” other refugees from coming.

Indeed, the Administration’s absurdly inhuman and unlawful proposal to keep refugees from leaving the very countries where they are being persecuted, without addressing the conditions there, is basically that having them die, be tortured, or abused there is just fine with us. Whether folks like to face it or not, that is indeed a neo-Nazi philosophy. And, every day that Trump remains in the office for which he is so supremely unqualified further corrupts our nation.

AMERICA’S “MASS ATROCITY” — Professor Kate Cronin-Furman Says Don’t Kid Yourself About What The Trump Administration Is Doing In Your Name & How “Ordinary Civil Servants” Carry Out The Unthinkable & Unacceptable!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

U.S. asylum officers slammed President Trump’s policy of forcing migrants to remain in Mexico while they await immigration hearings in the United States, urging a federal appeals court Wednesday to block the administration from continuing the program. The officers, who are directed to implement the policy, said it is threatening migrants’ lives and is “fundamentally contrary to the moral fabric of our Nation.”

The labor union representing asylum officers filed a friend-of-the-court brief that sided with the American Civil Liberties Union and other groups challenging Trump’s Migrant Protection Protocols program, which has sent 12,000 asylum-seeking migrants to Mexico since January. The policy aims to deter migrants from coming to the United States and to keep them out of the country while courts weigh their claims.

The union argued that the policy goes against the nation’s long-standing view that asylum seekers and refugees should have a way to escape persecution in their homelands, with the United States embracing its status as a safe haven since even before it was founded — with the arrival of the Pilgrims in the 17th century. The union said in court papers that the policy is compelling sworn officers to participate in the “widespread violation” of international and federal law — “something that they did not sign up to do when they decided to become asylum and refugee officers for the United States government.”

“Asylum officers are duty bound to protect vulnerable asylum seekers from persecution,” the American Federation of Government Employees Local 1924, which represents 2,500 federal workers, including asylum officers, said in a 37-page court filing with the U.S. Court of Appeals for the 9th Circuit in California. “They should not be forced to honor departmental directives that are fundamentally contrary to the moral fabric of our Nation and our international and domestic legal obligations.”

The legal filing is an unusual public rebuke of a sitting president by his own employees, and it plunges a highly trained officer corps that typically operates under secrecy into a public legal battle over one of Trump’s most prized immigration policies.

Under Trump, the asylum division has become a target of internal ire, often assailed for approving most initial asylum screenings and sending migrants to immigration court for a full hearing. Trump administration officials say most cases are denied. Last week, the acting director of U.S. Citizenship and Immigration Services, Ken Cuccinelli, outraged some asylum officers by sending the staff an email they thought criticized them for approving so many initial screenings.

Trump placed Cuccinelli, an immigration hard-liner and former Virginia attorney general, in the position ostensibly as part of his move to get tough on immigration policy, and the union’s legal filing appears to be directly at odds with that approach.

The policy has been challenged in federal court, with a lower-court judge temporarily halting MPP in April, saying it probably violates federal law. A three-judge appellate panel allowed the program to resume in May while the court considers the policy.

Justice Department lawyers have said in court filings that migrants are filing thousands of sham claims because they virtually guarantee their release into the United States pending a hearing in the backlogged immigration courts. The U.S. government cannot process the migrants’ cases quickly or detain children for long periods, which means some migrants can stay in the country for months or years while waiting for their cases to play out.

Ending the program, the government lawyers have said, “would impose immediate, substantial harm on the government’s ability to manage the crisis on our southern border.”

The Justice Department declined to comment on the filing Wednesday. The Department of Homeland Security, which oversees the program, did not respond to a request for comment.

The influx of Central American migrants at the southern border has overwhelmed the U.S. immigration system. It also has led to a political fight between congressional Democrats and the White House regarding crowded and unsanitary conditions in border holding facilities amid Trump’s push for heightened enforcement. More than 144,000 migrants were taken into custody in May after crossing the southern border, the largest monthly total in more than a decade, and asylum filings have soared.

Trump administration officials this week have been pleading with Congress to approve emergency funding for the humanitarian crisis at the border. The Senate on Wednesday responded, passing a $4.6 billion emergency spending measure amid debates about treatment of migrants and the risks they face as they try to enter the United States, with a graphic photo of a migrant and his young daughter having drowned in the Rio Grande as the backdrop.

In the federal court filing, the asylum officers say they are enforcing the laws as Congress intended, based on approaches and international treaties shaped after World War II and atrocities connected with the Holocaust. Federal laws hinge on the principle of “non-refoulement” — which means people should not be sent back to countries where they could be harmed or killed. To qualify for asylum, migrants must show that they face harm based on their “race, religion, nationality, membership in a particular social group or political opinion.”

The asylum officers say Mexico is too dangerous for Central American asylum seekers, particularly women, people who are gay, lesbian or transgender, and indigenous minority groups. They cited State Department reports showing that gang violence and activity is widespread and that crimes are rarely solved.

“Mexico is simply not safe for Central American asylum seekers,” the filing said, noting that gangs that terrorized migrants in their home countries might easily follow them into Mexico. “And despite professing a commitment to protecting the rights of people seeking asylum, the Mexican government has proven unable to provide this protection.”

Asylum officers say the U.S. asylum system is “not, as the Administration has claimed, fundamentally broken,” and that they could handle more cases quickly without sending people back to Mexico.

MPP is “entirely unnecessary, as our immigration system has the foundation and agility necessary to deal with the flow of migrants through our Southern Border,” the officers wrote.

The officers said they fear that MPP is sending asylum seekers back to a country where they are in danger, a violation of federal and international law. The said immigration agents do not ask migrants if they fear persecution or torture in Mexico, and that they only send migrants to asylum officers for screenings if the migrants independently express fear of return.

The latter are granted an initial asylum screening, often by phone or video. But they must prove that they are “more likely than not” going to face persecution in Mexico, a higher bar than in the immigration courts, where migrants are offered safeguards such as access to lawyers, a reading of their rights, and the right to appeal.

“The MPP, however, provides none of these safeguards,” the officers said.

Officials are attempting to extend the program along the nearly 2,000-mile border and are giving Mexico time to expand its shelter capacity, a top official at U.S. Customs and Border Protection has said.

So why do Asylum Officers have the courage and integrity to stand up to what is essentially fraud, abuse, and murder of asylum seekers by the Trump Administration when Article III Judges won’t? U.S. Immigration Judges have so spoken out against
Administration abuses through the National Association of Immigration Judges (“NAIJ”), although a minority of Immigration Judges have contributed to the problem by engaging in unlawful and unconstitutional bias against asylum seekers.

Obviously, we have the wrong type of individuals holding judicial positions in the U.S., something that the next competent and honest Administration should consider before appointing more complicit “go alongs to get alongs” to any type of bench.

It started with the Supreme’s atrocious and cowardly cop out on the Travel Ban case and has continued. Courage and the willingness to stand up against Government abuses are the primary qualifications for judges.

Other than some U.S. District Court Judges, too few Article IIIs have measured up to the task, and innocent people are being harmed, abused, and killed by Trump and his enablers as a result. The Courts of Appeals who have ignored the glaring Constitutional defects and clearly substandard justice in the Immigration Court system for more than a decade are particularly complicit in this unfolding disaster.

Moreover, as I have pointed out before, the lack of understanding of asylum law and unwillingness to stand up for the legal rights of asylum seekers among some Immigration Judges and too many Article III Judges is simply appalling!

To date, the performance of the Article III Judges on the 9th Circuit on the “Remain in Mexico”/“Die in Mexico” atrocity has been so disastrously deficient and incompetent as to make the wheels come off of the entire Government. This is a “rebellion” that should never have been necessary had the irresponsible, incoherent, and clueless three-“judge” panel that let “Die in Mexico” proceed done their jobs.

Hurrah for the Asylum Corps! Boo to the cowardly and unqualified judges who continue to enable Trump’s destruction of America and of human rights! And “double boo” to the career lawyers at the DOJ defending the Administration’s dishonest and illegal policies with lies and false narratives! Whatever happened to ethical standards for Federal Employees? Why do they apply to Asylum Officers, but not to DOJ “judges” and attorneys?

Some German Jews had converted to Lutheranism or Catholicism before World War II thinking that it would save them from Hitler and the anti-Semites. How did that work out for them?
