Notably, the four categories of “mandatory appearance” described by the Deputy Chief Counsel apply to only an infinitesimally small percentage of the roughly 2 million cases currently pending before the Immigration Courts.

Compare this with the treatment of the private bar who experience:

* Aimless reshuffling and rescheduling of their already-prepared cases, often without notice or with inadequate notice of the new hearing date;

* Arbitrary and capricious denials by some Immigration Judges of reasonable motions to continue;

* Possible disciplinary referrals for failure to appear at a scheduled hearing when listed as counsel of record.

Would the DOJ submit a similar missive to U.S. District Court Judges unilaterally announcing that they would only “selectively appear” in criminal and civil cases where the U.S. Government is a party? I doubt it!

So, what’s an Immigration Judge who does not want to perform DHS’s job for them to do? Contempt of court, you say? After all, the IJ’s authority to hold any party or counsel in Immigration Court proceeding in contempt is right there in plain language in the INA. See, INA section 240(b)(1).

Ah, but there is a catch! A big one! Although the contempt provision was added by Congress more than a quarter of  century ago, AGs of both parties have steadfastly refused to promulgate the necessary implementing regulations.

Evidently, the theory is that while IJs might be qualified to issue potential death sentences to migrants in Immigration Court, they can’t be trusted to fairly and reasonably use their contempt authority on lawyers who, after all, are mostly U.S. citizens and whose livelihood might be adversely affected. Essentially, the life of a migrant is worth less than a monetary fine for contempt to a U.S. lawyer.

Additionally, there apparently was a special concern about giving IJ’s authority to regulate the conduct of their “fellow Government attorneys” at INS, and later DHS. After all, that would be interfering with another Government agency’s “sacrosanct” authority to regulate and discipline (or not) its own employees.

In many ways, under Garland, the Immigration Courts are losing what limited public respect the might still have possessed and accelerating the move backwards to an “inquisitorial model” to replace the “adversary model” for decison-making. Ironically, this reverses over a half century of efforts by Congress, reformers, and sometimes the Executive itself to make Immigration Courts function as part of the adversary system — in other words, like “real” courts of law.

As one informed expert commenter stated upon learning of this latest development:

As we have all been saying, (1) EOIR doesn’t view itself as part of an ecosystem which also includes ICE, the private bar, non-profits, law school clinics, interpreters, USCIS, etc.; and (2) EOIR is run at it’s upper level by mindless, gutless people suffering from a complete lack of imagination existing in a bubble.

As a practical matter, I assume ICE is strategically choosing not to appear in hearings before IJs who deny everything? If not, it could actually work in your favor. In truth, the UNHCR model doesn’t envision asylum being heard in adversarial hearings; as Paul has articulately stated, it sees asylum as a collaborative effort between adjudicator and asylum seeker.

Chronicle investigation: U.S. Justice Department lacks strong harassment oversight for judges

WASHINGTON — One judge made a joke about genitalia during a court proceeding and was later promoted. Another has been banned for more than seven years from the government building where he worked after management found he harassed female staff, but is still deciding cases.

A third, a supervisor based mostly in San Francisco, commented with colleagues about the attractiveness of female job candidates, an internal investigation concluded. He was demoted and transferred to a courtroom in Sacramento.

The three men, all immigration judges still employed by the Justice Department, work for a court system designed to give immigrants a fair chance to stay in the U.S. Every day, they hear some of the most harrowing stories of trauma in the world, many from women who were victims of gender-based violence and who fear that their lives are at risk if they are deported to their native countries.

These judges’ behavior toward women is not an isolated phenomenon in the immigration courts system. A Chronicle investigation revealed numerous similar instances of harassment or misconduct in the courts, and found a system that allows sexually inappropriate behavior to flourish.

In response to detailed questions before President Biden took office, the Justice Department declined to comment on specific allegations against judges, citing the privacy of personnel matters in some instances and the lack of written complaints in others, but said generally that it follows department procedures on misconduct. The Biden White House did not immediately respond to a request for comment.

Interviews with dozens of attorneys across the country and current and former government officials, as well as internal documents obtained by The Chronicle, show the problems have festered for years. The Justice Department has long lacked a strong system for reporting and responding to sexual harassment and misconduct.

And when such behavior has come to its attention, the department has in some instances simply transferred the offenders elsewhere.

The judges’ behavior appears to violate the department’s conduct policies and raises questions about the immigration courts’ ability to function fairly. Attorneys who have been the victims of harassment say they fear that if they try to hold judges accountable, they risk severe consequences, not only for themselves but for vulnerable clients.

“In the moment, you just know that you have to stay calm,” said Sophia Genovese, who has been an immigration attorney for three years and worked in the field of immigration policy for five. “You know if you do anything to piss him off, that’s going to ruin your reputation in his eyes. In that moment, am I thinking that I might be perpetuating sexism in the system? No, I’m thinking, I just need to get through this.”

She added, “If all you have to do is force a smile so that your client is not deported, the answer is obvious what practitioners are going to do.”

Michelle Mendez of the Catholic Legal Immigration Network, which provides legal representation to immigrants and helps attorneys report allegations of judicial misconduct, said lawyers face tremendous pressure not to call out judges’ bad behavior, even though they know ignoring it means it is likely to continue.

“An immigration judge might retaliate against the advocate by punishing her clients — and these are people fleeing persecution, rape and even death,” Mendez said. “It’s quite literally a Sophie’s choice that should never happen in the American legal system.”

The Trump administration did little to change the pattern, The Chronicle found, and in one case even promoted a judge who many women have said made them feel uncomfortable in open court and behind the scenes for years. Justice Department data shows the administration dismissed more complaints against judges than its predecessor.

It’s a problem that Biden’s administration has inherited. The very structure of the courts creates the conditions that allow bad actors to escape consequences, experts say. But that leaves Biden with a problem, they add: Does he reform the system to be independent of political influence, or does he use his political control over it to clean it up?

What an ongoing national disgrace! The arrogance, audacity, and belief that there will be no accountability for abusing “the other” is both stunning and totally in line with four years of the Trump/Miller/Sessions/Barr/Hamilton/McHenry (surprise, all white males whose collective, genuine immigration and judicial “expertise” would fit in a thimble with room left over) kakistocracy and institutionalized abuses of migrants and their attorneys at EOIR and DOJ.

And many thanks to heroes like Michelle Mendez, Sophia Genovese, and other courageous members of the NDPA, and many “Knightesses” of our Round Table of Former Immigration Judges for having the courage to speak out in so many different and effective ways about the ongoing abuses inflicted by EOIR!

We must keep fighting and publicizing until these abuses end, and justice is restored to this ludicrously abusive, biased, openly misogynistic, anti-asylum, anti-due-process, and intentionally dehumanizing system.

The solution to the “problem” posed in Tal’s last sentence is not rocket science! 

There is nothing wrong with using Executive authority to get rid of the kakistocracy, putting in experts and widely respected “due-process warriors and warrior-queens” as judges and judicial administrators, and giving them independence to reform and reformulate every aspect of this totally broken system and the disgraceful anti-migrant jurisprudence it has spawned. Get rid of the “deadwood” (or worse), put the right folks in charge, and then trust them to solve judicial problems without political interference. That’s how any “real” independent court system works, for Pete’s sake! 

That certainly can and should include a new “merit selection system” for Immigration Judges that values immigration scholarship, human rights expertise, experience representing migrants and asylum seekers in Immigration Court, courage to oppose abuses, diversity, and a demonstrated lifetime commitment to due process and equal justice under our Constitution for all persons in the United States! 

Over time, every judge currently in the system should be required to re-compete for their job under the new merit system. That system must be open, transparent, and involve public input in the selection process. (Unlike the current, largely closed, system designed to favor prosecutors and other government attorneys, and which has produced a remarkably, shockingly non-diverse, non-expert, and non-representative “judiciary,” particularly in light of the communities most involved in, and affected by, the Immigration Court process).

Those incumbent judges who have demonstrated a commitment to guaranteeing fairness and due process for all should have no trouble being retained. But, those who have carried out the departed regime’s “dump on asylum seekers and their lawyers program” should and will be removed and replaced by better-qualified judges. Human lives simply are too important to be at the mercy of bad judges — and, without knowing exactly how many, there are some “bad judges” operating  in the EOIR system!

Remove the Clown Show🤡🦹🏿‍♂️☠️! Put Michelle, Sophia Genovese, and/or other leading members of the NDPA in charge of EOIR & the BIA and let them solve the problems! Empower them to root out the “bad actors” (including members of the “90% Asylum Denial Club” — some disgracefully ensconced at the BIA) in the judiciary, support reform of the process and the law without interfering with judicial independence, then get 100% behind the legislative push for an Independent Article I Immigration Court with expert, due-process-committed, diverse, courageous judges! 

There are hundreds, perhaps thousands, of well-qualified lawyers in the NDPA out there who could solve these pressing problems!

Stay tuned! Courtside will have lots to say about this until somebody in the Biden DOJ takes notice and solves the problem! The Clown Show has got to go!

Immigration Judges Sue DOJ, Alleging Unconstitutional Gag on Speech

It’s the latest clash between the immigration judges’ union and the Justice Department, after DOJ officials pushed to decertify the union.

A union of immigration judges is suing the Department of Justice over a policy allegedly restricting them from speaking publicly about immigration and other issues in violation of their constitutional rights, the latest escalation of tensions between the union and the federal department where they work.

The lawsuit, filed Wednesday on behalf of the National Association of Immigration Judges by attorneys with the Knight First Amendment Institute and Virginia attorney Victor Glasberg, says DOJ’s Executive Office for Immigration Review in 2017 began requiring the judges to seek preapproval to speak in their own capacity, and not on behalf of the office.

That was replaced earlier this year with a “more restrictive policy,” which mandates the judges cannot speak publicly about immigration or DOJ policies, and must obtain approval to speak, write or talk with members of the media about any other topic.

The lawsuit notes the policy was implemented during a series of changes in the immigration system and that the immigration judges are “uniquely positioned to inform the public on these issues, but the 2020 policy prevents them from doing so.”

Really, isn’t this continuing circus and parody of justice supposed to be under “adult supervision?” Obviously, both Congress and the Article III Courts have taken a pass on the role. So, what, in fact, are they good for?

I do understand why those responsible for this mess don’t want to be publicly “outed” for the fraud, waste, and abuse that they have created. The desire to escape accountability runs deep in bureaucracies, particularly in an Administration that lies about almost everything and consistently refuses to take responsibility for its own innumerable screw-ups. Dishonesty and lack of accountability starts at the top of this rubbish heap.

EOIR Embroiled In Controversy On Several Fronts!

Few agencies in the U.S. Government are as publicity and conflict averse as the Executive Office for Immigraton Review (“EOIR,” pronounced “Eeyore”), a division of the U.S. Department of Justice that houses the U.S. Immigration Court system. So, officials at EOIR and their DOJ handlers must be “going bananas” (when they aren’t preoccupied with the Comey firing) about several recent news items that cast an unwelcome spotlight on the agency.

First, super-sleuth NPR reporter Beth Fertig smoked out the story of ex-con Carlos Davila (12 years in prison for first-degree manslaughter and  sexual abuse while on parole) who is using the EOIR “recognition and accreditation” program to practice law (without a license) under the guise of being a “nonprofit charitable organization.” Davila is apparently under investigation by EOIR, but continues to practice.

As a result of Beth’s story, New York Congresswoman Nydia Velázquez  has asked the House Judiciary Committee to investigate the program.

As noted in the article, the “R&A” program, allows well-qualified non-attorneys working at reputable nonprofit charitable organizations to represent migrants in Immigration Court and/or before the DHS. The R&A program fills a critically important role in providing due process in the U.S. Immigration Courts. This is particularly true today, in light of increased enforcement and very limited pro bono and “low bono” immigration attorney resources.

The Davila situation, as described by Beth, sounds like a scam to me.  Under the regulations, “accredited representatives” are supposed to be working for “recognized organizations” — nonprofits that provide legal services (usually along with other types of social services) on a largely pro bono basis.

Only “nominal fees” can be charged. But the term “nominal fees” has never been defined. We worked on it, off an on, for most of my tenure as BIA Chair in the late 1990s and never could come up with a specific definition that was acceptable to both NGOs and bar associations.

From the article, it appears to me that Davila is actually running a profit-making law firm for himself and his staff under the “shell” of a non-profit.  For example, charging someone $200 for a piece of paper that basically restates their rights under the Constitution, the INA, and the regulations seems far beyond a “nominal fee.” The research is simple, and the card itself could be printed off for a few cents a copy. So, $200 seems grossly excessive.

Also, fees of $1,000 to $3,500 for asylum applications seem to be beyond “nominal fees.”  If fact, that’s probably close to what some legitimate “low bono” law firms would charge. So, it seems like Davila is really practicing law for a living without a license, rather than providing essentially pro bono services for a charitable organization.

I agree that there should be more thorough investigation and vetting of organizations and accredited representatives by EOIR. This seems like something that should be right up Attorney General Sessions’s alley.

To my knowledge, EOIR does not currently employ any “investigators” who could be assigned to the EOIR staff working on the recognition and accreditation program. But there are tons of retired FBI agents and DHS agents out there who could be hired on a contract basis to do such investigations. Given the money that this Administration is planning to throw at immigration enforcement, finding funds for a needed “upgrade” to this program should not be a problem.

The second controversial item concerns an ongoing dispute between the Federation for American Immigration Reform (“FAIR”) and the Immigration Reform Law Institute (“IRLI”) on one side and the Southern Poverty Law Center (“SPLC”)  and other immigrants’ rights groups on the other. In  2014, the SPLC and other advocacy groups requested that the BIA “strike” an amicus brief filed by FAIR and IRLI because, among other things, FAIR was a “hate group.” FAIR responded by asking EOIR to discipline the SPLC and other advocacy group attorneys involved for “unprofessional conduct.”

On March 28, 2016, the EOIR Disciplinary Counsel issued a confidential letter finding that the SPLC and related attorneys had engaged in professional misconduct. However, in lieu of formal disciplinary proceedings, the Disciplinary Counsel issued a “reminder” to the concerned attorneys “that practitioners before EOIR should be striving to be civil and professional in their interactions with each other, the public, and the Board and Immigration Courts.”

But, that was not the end of the matter. On May 8, 2017, the IRLI published the “confidential” letter of discipline on the internet, stating:

“Although the SPLC’s utter lack of ethics was thoroughly condemned by the DOJ, the agency inexplicably requested that FAIR keep their conclusions confidential. FAIR and IRLI have complied with the request for more than a year; however, in that time, the SPLC has continued and escalated its attacks on both FAIR and IRLI, likely in part in retaliation for FAIR and IRLI filing a complaint with DOJ regarding its conduct. At this time, IRLI has decided it must release the letter to defend itself and protect its charitable purposes.”

So, now, the EOIR “confidential” letter is sitting smack dab in the middle of what looks like the “Hundred Years War” between FAIR and the SPLC.  Not the kind of “stuff” that EOIR and DOJ like to be involved in!

On the plus side, perhaps in response to this situation, the BIA in 2015 changed its amicus procedures to publicly request briefing from any interested party in matters of significant importance that likely will lead to precedent decisions. Indeed, a number of such notices have been published on this blog.
