As noted by my Round Table colleague “Sir Jeffrey” Chase, our Round Table has spoken out about the need for a separate Immigration Court system for children:

As you know, our Round Table signed on to a letter of support for proposed legislation to create a Children’s Immigration Court.

[Director Neal’s statement is] a positive administrative development.

Here’s my take:

  1. While progress is always welcome, this statement shrouds the concept of “best interest of the child” (“BIC”) with legal gobbledygook and bureaucratic doublespeak. (P. 3 of Neal Memo under “Legal Standards”).
  2. Here’s what a clear, correct statement on BIC would look like:

BIC, regardless of whether or not presented by a “Child Advocate” or incorporated in a “Best Interests Determination” (“BID”), can be directly relevant to issues of removability. For example, evidence of removability obtained by methods that clearly conflict with the BIC could be found unreliable or the result of “egregious misconduct” for the purposes of determining removability.

The BIC can also be highly relevant to issues of eligibility for relief. For example, a government or society that deprives certain children of all meaningful educational oportunities might well be engaging in persecution.

In addition, in NLPR cancellation cases, the BIC could be persuasive, even determinative, evidence that removal of a parent will result in “exceptional and extremely unusual hardship” to a USC or LPR child or children.

3) Finally, since the EOIR Director is an administrator, not a quasi-judicial official, his or her policies have a distinct “you can take it or leave it” effect in Immigration Court. Therefore ameliorative statements from the Director, no matter how well-intended, are only effective if the BIA is willing and able to insist on and enforce “best practices” on Immigration Judges, preferably through precedent decisions and reassigning cases away from those IJs who show repeated contempt for due process and best practices.

Unfortunately, the current version of the BIA has, as a body, shown neither much sympathy nor concern for the substantive and due process rights of asylum seekers and other immigrants in Immigration Court. Unless and until Garland “cleans house” and appoints a BIA where all Appellate Judges are immigration/human rights experts laser focused on due process and best practices in Immigration Court — and not afraid of enforcing them uniformly in individual cases and incorporating them in binding precedents — the Director’s latest somewhat ameliorative statement is likely to be as toothless in practice as past efforts.

To a large extent, that’s a “nutshell” of why Garland’s Immigration Courts are in dire failure that threatens our entire democracy.

Unfortunately, that we are three years into this Administration and Garland is still bumbling along with a BIA that largely represents the mistakes and shortcomings of his predecessors suggests that waiting for him to “get religion” on the need for expertise, due process, fundamental fairness, and best practices at EOIR will continue to be an exercise in “Waiting for Godot!”

Dear Secretary Mayorkas, Director Jaddou, Acting Commissioner Miller, and Director Neal,

We, the undersigned 112 civil, human rights, faith-based, and immigration groups write to express our deep concern with your return to the Trump-era policy of forcing asylum seekers to explain by phone the life-threatening harms they’re fleeing mere hours after arriving in the U.S., while being held in Customs and Border Protection (CBP) detention, and essentially cut off from legal help. In March 2023, nearly 100 organizations reminded President Biden of his commitment to end the Trump policy, urging him not to rush back to the broken, anti-asylum policies that this administration rightly terminated. We are incredibly disappointed that this administration has chosen to move forward, full steam ahead. We call on the Biden administration to immediately cease conducting credible fear interviews (CFIs) in CBP custody and instead ensure that asylum seekers are given full and fair access to the U.S. asylum system, including meaningful access to counsel.

Since taking effect, President Biden’s iteration of this policy has produced systemic due process barriers similar to its predecessor policy, with asylum seekers being rushed through CFIs and immigration judge reviews with little to no access to counsel. President Biden’s asylum ban, another iteration of Trump-era policies, is further exacerbating these mass due process violations and fueling the systematic deportation of individuals who may qualify for protection in the U.S., in violation of the non-derogable principle of non-refoulement.

The Biden administration is effectively denying asylum seekers any meaningful chance to consult with counsel and rushing them through a sham process to quickly deport them, including by:

  • Conducting CFIs shortly upon an individual’s arrival in CBP detention without providing or allowing them to access the time and resources needed to recover from their journey or the harm they survived;
  • Barring attorneys from entering the CBP facilities where asylum seekers are jailed and CFIs are conducted;
  • Truncating the minimum time period individuals have to attempt to telephonically consult with an attorney to a mere 24 hours after receiving notice of the credible fear process. This change is especially absurd given that new policies, such as the asylum ban and the return of certain nationalities to Mexico, expand the content about which an individual may need to consult an attorney;
  • Failing to provide asylum seekers hard copies of the M-444 Information About Credible Fear Interview in contravention of 8 CFR § 208.30(d)(2), hard copies of the list of pro bono legal service providers, and advanced written notice of the CFI;
  • Heightening the standard for requests to reschedule a CFI to a showing of “extraordinary circumstances,” likely making it nearly impossible for asylum seekers to reschedule a CFI in order to secure representation or prepare for the interview;
  • Restricting asylum seekers’ access to telephones, in contravention of 8 CFR § 208.30(d)(4), and denying them writing utensils, in effect forcing them to attempt to commit key information to memory, including their attorney’s contact information and information about the CFI process;
  • Requiring an applicant’s signature on the Form G-28 for attorneys to enter an appearance with the Asylum Office, which often cannot be timely obtained by attorneys who are remotely representing jailed clients, thereby obstructing their ability to obtain information about their clients;
  • Conducting CFIs, including outside of normal business hours and on weekends, without the attorney of record present, in contravention of 8 CFR § 208.30(d)(4);
  • Failing to provide advance written notice to attorneys of record prior to a scheduled CFI or immigration court review hearing, including by not updating the EOIR Cases and Appeals System (ECAS) to reflect upcoming court hearings;
  • Failing to afford individuals time and opportunity following negative fear determinations to consult with counsel who could advise them about their rights and the review process;
  • Failing to serve asylum seekers and their attorneys with their record of credible fear determinations in contravention of 8 CFR § 208.30(g)(1);
  • Blocking attorneys from entering an appearance with the immigration court, including by not docketing immigration court review cases in a timely manner, thereby preventing them from representing their clients;
  • Refusing to permit attorneys to actively participate in immigration court reviews and rejecting evidence submitted in advance of the immigration court review; and
  • Conducting Immigration Judge reviews of negative credible fear findings without the attorney of record present.

Forcing asylum seekers in CBP detention to proceed with their CFIs while facing nearly insurmountable barriers to legal counsel –while also subjecting them to an asylum ban – upends any notion of fairness. Instead, it is an evisceration of our asylum system. The installation of new phone booths, which you claim differentiate Biden’s program from the Trump policy, fails entirely to address any of these systemic obstacles. Additionally, the Biden administration’s decision to conduct immigration court reviews immediately following these lightning-fast CFIs, while the individual is still in CBP custody, unacceptably further heightens the due process barriers asylum seekers must overcome to avoid summary deportation.

We have also received troubling reports of the terrible conditions that asylum seekers face in CBP custody while awaiting their CFIs, in line with years of reports of abusive, dehumanizing, and sometimes life-threatening conditions that include medical neglect, inedible food and water, and lack of access to showers and other basic hygiene. It has been less than a month since the unforgivable death of eight-year-old Anadith Tanay Reyes Álvarez, who was jailed in one of the CBP facilities where your administration conducts CFIs. We are horrified that the administration has systematized the detention of asylum seekers in these same deadly conditions while rushing them through fear screenings.

Notably, the administration has a choice: it is not required to use expedited removal and has the authority to refer people for full asylum hearings, rather than subjecting them to rushed CFIs in dehumanizing CBP detention while cut off from legal help. Sacrificing fairness for speed by jailing people fleeing persecution and torture, subjecting them to a ban on asylum, and forcing them to proceed with a life-or-death interview without meaningful access to counsel must not be this administration’s response to people wishing to exercise their fundamental human right to seek asylum. These policies punish people seeking safety and prioritize political optics over the administration’s stated aim of working to “restore and strengthen our own asylum system, which has been badly damaged by policies enacted over the last four years that contravened our values and caused needless human suffering.”

First, can someone please share with the RT as a whole?  I can’t do it from where I am at the moment.

 

Second, yes, believe it or not, Newark EOIR is implementing a “policy” (if you can call it that, since it hasn’t been written anywhere) starting Monday, October 3, 2022, that ALL DHS and Respondents’ attorneys must appear IN PERSON for almost EVERY case, including master calendar hearings.  Their stated reason?  “Webex bandwidth issues.”  This is the Court that started Webex.  This is the Court that caused the death of at least one person (and in fact 4 people ultimately died) and the severe illness of many more, because of its court policies at the beginning of the pandemic.  And Newark EOIR’s completely unsafe and short-sighted policy just last year is what generated the lawsuit filed by AILA-NJ against EOIR.

 

The OPLA attorneys’ union and AILA-NJ have issued a JOINT press release (which is attached) after a joint letter to David Neal unfortunately did not resolve the issue. The NJ State Bar Association has also submitted a letter to Director Neal. (Also attached).

 

In fact, the Newark EOIR policy flies in the face of the DM issued by Director Neal himself regarding the use of WebEx throughout the nation’s immigration courts.

 

Some Newark IJs have already begun denying ALL WebEx motions for both DHS and Respondents’ attorneys, regardless of the reason behind the motion (such as, undergoing chemotherapy; receiving treatment for heart conditions; or having oral argument scheduled before the U.S. Court of Appeals on the same day, just to give some examples).

 

In any event, feel free to share widely and publicly. The Chair of AILA-NJ this year is Jason Camilo, who I have cc’d on this email just so he is aware.

   PROSECUTORS AND ATTORNEYS

CALL FOR CONTINUATION OF VIRTUAL HEARINGS AND OPPOSE CHANGE IN POLICY IN NEWARK IMMIGRATION COURT

New Jersey – Both AILA NJ and AFGE Local 511 (ICE Professionals Union) call on the Newark Immigration Court, part of the U.S. Department of Justice, Executive Office for Immigration Review (EOIR), to continue to allow virtual hearings for all attorneys and immigrants, in all cases, without exception. These attorneys are opposed to the recently- announced policy of the Newark Immigration Court requiring all attorneys to either return in person to hearings beginning on October 3, 2022 or to seek waiver of in-person appearance for good cause. Public safety requires virtual hearings, especially for routine preliminary hearings that generate large groups of people in small courtrooms.

This new policy goes far beyond the policies of all other New Jersey court systems, from municipal courts, State courts, and federal courts, and puts everyone at risk—prosecutors, attorneys, court staff, immigrants, and the public at large. Federal and New Jersey State Courts are still operating almost entirely virtually, with exceptions only for criminal jury trials and some other specific proceedings. “EOIR’s new policy of making everyone return to the courtroom in person is dangerous and unjustified,” says Jason Scott Camilo, Chair of AILA NJ. Newark EOIR is not just requiring in-person appearances for contested individual hearings; it is requiring attorneys to appear in person at master calendar hearings as well, which can involve 50-60 cases per judge, per courtroom, every morning and afternoon. Thus, literally hundreds of people will once again be forced into small, unventilated courtrooms and narrow hallways every single day.

Sadly, this is not the first time Newark EOIR has tried to force prosecutors, attorneys, and the public into the courtroom during the pandemic. Numerous people contracted COVID-19 as a result of attending immigration court proceedings in March 2020. One well-respected AILA NJ member passed away as a result, and several people became seriously ill. Other federal workers at the same federal building have also succumbed to the disease. This is in addition to those who suffered and still suffer from long COVID complications.

Despite this, Newark EOIR compelled people back into courtrooms in July 2020. New Jersey immigration attorneys and the New Jersey Chapter of American Immigration Lawyers Association, (AILA NJ), sued EOIR on July 31, 2020 in Federal District Court, New Jersey,

 seeking protection from EOIR!s first attempt compelling attorneys to appear in person during the pandemic. Due to this suit, Newark EOIR committed to providing attorneys with remote videoconferencing for the duration of the pandemic and to troubleshoot and address any glitches or interruptions in its use. All Immigration Courts nationwide soon adopted internet based hearings as the default for cases.

Since August 2020, prosecutors, attorneys, and immigrants have been appearing remotely, and, according to polling conducted by AILA NJ, the vast majority of internet-based hearings are proceeding without issue. Secretary Becerra of the United States Health & Human Services recently announced the continuation of the nationwide public health emergency on July 15, 2022. More than 34,000 New Jerseyans have died from COVID-19; over 2,500 people a day are still falling ill in New Jersey alone.

Acknowledging the benefits of internet-based hearings, David L. Neal, Director of EOIR, issued guidance on August 11, 2022, indicating that “all immigration courts have the capacity to hold such hearings…,” that “internet-based hearings have proven a valuable safety measure during the pandemic, as immigration judges can conduct such hearings without requiring groups of people to congregate in a courtroom…,” and that “EOIR anticipates that, going forward, internet-based hearings will remain essential to EOIR’s operations.”

“In fact, EOIR has been holding stakeholder meetings across the country to explain the continued benefits of utilizing Webex in immigration court proceedings. Why, then, would Newark EOIR, which was the first immigration court in the nation to use the WebEx system, suddenly choose to abandon it? Logically and logistically, this makes no sense,” explained Jason Scott Camilo.

Virtual hearings provide other benefits as well. Virtual hearings allow the courts to efficiently process more cases safely. Private attorneys and pro bono organizations are able to represent immigrants more effectively, having the ability to beam into various courtrooms in different locations in a single day.

According to AFGE Local 511, virtual court appearances enable prosecutors to minimize their exposure to hundreds of people in crowded courtrooms every day, while having more time to allocate their limited resources towards resolving cases outside the courtroom in motion practice and in consultation with opposing counsel. OPLA offices are understaffed, and virtual courtrooms enable telework, which in turn permits them to better manage their out of court duties, which primarily consist of efforts to reduce the immigration court backlog. “It makes no sense to hinder government attorneys attempting to assist EOIR in resolving cases ,” said AFGE Local 511’s Executive Vice President, Ginnine Fried, who is assigned to the Newark office.

Newark EOIR’s newly-announced policy requiring attorneys to appear in person or request a waiver is in direct opposition to the resolution of the federal lawsuit, is in direct opposition to the policy of the EOIR Director and, if implemented on October 3, 2022 as planned, will imperil the

 health and safety of all who will be forced to appear in person. No other court in the state has taken such radical action. AILA NJ attorneys and AFGE Local 511 attorneys agree there is no valid public policy reason to implement this drastic change, and numerous public policy reasons to continue with virtual immigration court hearings: public safety, increased court efficiency, and uniformity. Standing united, these opposing sides are beseeching the Newark EOIR to let safety prevail and to preserve the health of those Americans working to preserve a fair and equitable Immigration system.

 On behalf of the New Jersey State Bar Association, which includes immigration attorneys among its 16,000 attorney members, I write to seek reconsideration of the policy change the Executive Office of Immigration Review (EOIR) has scheduled to implement in Newark, NJ, on Oct. 3, 2022. After more than two years of successful Webex Master Calendar hearings, EOIR will again require immigration attorneys to appear in person. While vague Webex bandwidth issues have been cited as the impetus for the change, there has been no stated reason why EIOR will not default to the prior practice of holding Master Calendar hearings telephonically. To be sure, there are legitimate concerns about the ability to judge credibility or simultaneous interpretation in certain telephonic immigration hearings, but those issues are not in play here as EOIR has waived clients’ appearance in Master Calendar hearings. Reverting to the pre-pandemic, inflexible court appearance requirements is both unnecessary, in light of back-up telephonic hearing capabilities, and presents costly time and monetary burdens to attorneys and respondents.

I. EOIR HAS SUCCESSFULLY HELD WEBEX HEARINGS SINCE THE HEIGHT OF THE COVID-19 PANDEMIC IN 2020.

EOIR Newark began Webex hearings in summer 2020 because of litigation filed by New Jersey immigration attorneys in the New Jersey chapter of Association of Immigration Lawyers Association (AILA) on July 31, 2020, in the District Court of New Jersey, Newark Vicinage. That suit sought protection from EOIR Newark’s order compelling attorneys to appear in person during the pandemic. As a result of this litigation, Assistant Chief Immigration Judge David Cheng (ACIJ Cheng) of the New Jersey Immigration Court, and on behalf of EOIR Newark, committed to providing attorneys with remote videoconferencing for the duration of the pandemic. As part of the parties’ stipulation for dismissal, the parties agreed to the following:

WHEREAS, PM 21-03 further provides that, “[o]nce WebEx compatibility is available at an immigration court, for the duration of the declared national emergency related to COVID-19, either party may file a motion for the alien or the representative for either party to appear at a hearing by VTC through WebEx rather than in person,” see id.; and

WHEREAS, PM 21-03 further provides that motions to appear at a hearing by VTC through WebEx for any party or party attorney/representative, like motions for telephone appearances, are “subject to the discretion of the immigration judge, any applicable law and any applicable requirements of the ICPM [Immigration Court Practice Manual], a standing order, or a local operating procedure,” see PM 21-03 at p. 4.

In the wake of that consent order, EOIR Newark joined all other state and federal courts in New Jersey in operating virtually during the pandemic. In practice, and pursuant to ACIJ Cheng’s Standing Order dated June 19, 2020, all Master Calendar hearings were held telephonically, without the need for a motion, and all respondents’ appearances were waived if an attorney appeared on their behalf. See Standing Order dated June 19, 2020, attached hereto as Exhibit B. This Standing Order was rescinded pursuant to ACIJ Cheng’s Standing Order on Dec. 28, 2021, effective Jan. 10, 2022, at which time Master Calendar hearings changed from being held telephonically to being held via Webex. As it was before, these were without the need for a motion, and all respondents’ appearances continued to be waived if an attorney appeared on their behalf. See Standing Order dated Dec. 28, 2021, attached hereto as Exhibit C.

Even today, many court operations across New Jersey continue to be virtual. To name a few, state municipal matters are being managed remotely, except for DUIs and trials, and in Superior Court, non-consequential hearings such as preliminary appearances and status conferences continue to be held remotely.1 The U.S. District Court for the District of New Jersey extended its standing order on Aug. 8, 2022, regarding virtual hearings for criminal proceedings.2

Additionally, EOIR itself has acknowledged the benefits of internet-based hearings, for which Newark was a national leader in its overall success as a pilot program jurisdiction. On Aug. 11, 2022, EOIR issued Director’s Memorandum 22-07.3 That stated, “all immigration courts have the capacity to hold such hearings…,” and “internet-based hearings have proven a valuable safety measure during the pandemic, as immigration judges can conduct such hearings without requiring groups of people to congregate in a courtroom…” The memo cites the benefits of internet-based hearings, including that “Respondents and counsel appearing remotely are

relieved from traveling to court.” Finally, the memo said that “EOIR anticipates that, going forward, internet-based hearings will remain essential to EOIR’s operations.”

II. EOIR NEWARK INTENDS TO SUSPEND STANDARD WEBEX HEARINGS ON OCT. 3, 2022, WITHOUT PROPER NOTICE TO THE BAR, INCLUDING NJSBA.

Notwithstanding the above, the EOIR seeks to disband the standard for Webex hearings without proper notice to New Jersey attorneys and their clients who will be substantially and disproportionately affected by this sudden policy shift. The NJSBA only learned of this policy through its affiliate AILA NJ members when the committee chair for AILA NJ announced the new policy to its members by email on Aug. 30, 2022. The email was supplemented on Aug. 31, 2022, and again Sept. 8, 2022. The below paragraphs, taken from our AILA NJ colleagues’ letter to EOIR leadership, contain the entirety of the new policy, which was communicated via the emails referenced above.

From the Aug. 30, 2022 Email from EOIR Committee Chair:

The standing order for Webex hearings is revoked and in person appearances required as of 10/3/22. This of course is subject to exceptions and variations as follows:

1. Webex hearings will continue for all cases heard by Judge Ranasinghe and Judge Jeannopolous

2. Judge Pierro and Judge Chen will have in person master calendars and Webex merits hearings.

3. Judges Rubin, Rastegar, Riefkohl, Finston, Wilson and Lane will have in person hearings master and merits.

4. Represented respondents’ appearances are waived for master calendars like they are now on Webex masters, but not for merits hearings. This includes cases where an attorney is already on record or making his/her first appearance. Atty shows up, the respondent does not have to appear. If you are hired at the last minute and can’t make it, the respondent has to appear.

5. This does not apply to Elizabeth hearings as the facility does not admit visitors, all remote hearings.

6. If it is Judge Shirole or Pope and the hearing notice is for Newark, (DD Case), in person at Newark. Any doubts about Shirole call Elizabeth. Pope will all be in person.

7. You can still file a motion for a Webex hearing for good cause but it MUST be filed 15 days or before. If it is not granted you have to

appear. I am told the reason for this is the Webex bandwidth is incapable of handling the level of internet traffic that has developed. The system is crashing constantly. More and more attorneys are using it with technical issues constantly. So the “good cause” issue will be a major consideration in granting or denying motions for Webex calendars.

From August 31, 2022 Email from EOIR Committee Chair:

1. DHS has to appear in person and they will be required to file motions for Webex.

2. I failed to include ACIJ Cheng and IJ Mullican among the list of judges where in person appearances are required.

From September 8, 2022 Email from EOIR Committee Chair:

ACIJ Cheng has rephrased the “good cause” language requirement for a Webex motion. He chooses to phrase it as “there has to be a reason”.

III. THE NEW POLICY FAILS TO PROVIDE PROPER NOTICE TO NEW JERSEY ATTORNEYS AND IT IS IN CONFLICT WITH PRINCIPLES OF EQUAL ACCESS TO JUSTICE, DUE PROCESS AND FUNDAMENTAL FAIRNESS.

EOIR Newark failed to circulate a general notice to the entire bar of the policy change and thereby limited the ability of all practitioners to learn of the change in a timely fashion.

 Indeed,

 unless immigration attorneys are members of AILA NJ, which some, but not all NJSBA Immigration Law Section members are, they might still be unaware of this abrupt change in policy, which will prejudice them and their clients. To date, EOIR Newark has not published a formal standing order to officially announce it. This lack of notice will hinder equal access to the justice system for countless respondents whose attorneys are not aware of the sweeping changes

 made to the practice. As our AILA NJ colleagues adeptly stated, notice of these changes should come directly from EOIR Newark in the form of a standing order, notice to the bar, website update, or other written statement. Further, the new policy is confusing and complicated in its

 implementation.

 This new policy also denies equal access to justice because of the effect it will have on attorneys’ fees. The fees for appearing at Master Calendar hearings in person, rather than virtually, will be markedly more expensive, and needlessly so, for immigration clients. Although clients’ appearance would be waived, the time attorneys spend to appear in person will be exponentially greater than that spent at a Webex appearance. In immigration removal proceedings, where respondents have no right to court-appointed counsel, many clients will find it cost prohibitive to pay an attorney for protracted appearances at Master Calendar hearings in Newark. An additional

 consequence may be that seasoned immigration attorneys would limit the removal defense cases

 they accept that require needless Newark appearances.

Consistency in agency practices is a hallmark of due process and fundamental fairness. Respondents and attorneys should be able to rely on established policies and practices and conform their behavior accordingly. To be clear, changes should be announced with reasonable notice and ample breadth to the entire legal community. EOIR Newark’s decision to change course without prior, reasonable notice will have serious economic and practical consequences to immigration attorneys and their clients.

IV. THE NEW POLICY WILL BE UNNECESSARILY BURDENSOME AND WILL RESULT IN ADDITIONAL BACKLOGS AND INEFFICIENCIES THROUGHOUT THE IMMIGRATION COURT SYSTEM.

 The new EOIR Newark policy will burden immigration attorneys by immediately requiring them to appear in person in Newark for Master Calendar hearings while their clients’ appearances remain waived. A Master Calendar hearing in Immigration Court is the equivalent to a status conference in most other litigation-based practice areas. They are administrative, taking approximately five to 15 minutes to complete. This will place a heavy burden on immigration attorneys across New Jersey all of whom will again be required to be physically present on the 12th Floor of EOIR Newark, which is New Jersey’s sole immigration court, by 8:30 a.m. on any given weekday for a hearing that will likely last fewer than 15 minutes. This change will be a hardship for attorneys from the south, such as an attorney from Cape May who would have to travel 148 miles to Newark, as well as those from the north, such as an attorney from Montague

 who would have to travel 59 miles to Newark, all for a brief hearing.

 A silver lining of the COVID-19 pandemic has been the legal community’s embrace of technology. Attorneys and courts alike learned, adopted, and then mastered a more efficient process to effectively practice law. There is no reason to revert to antiquated, unnecessary practices. Health concerns aside, appearing for Master Calendar hearings via Webex has proven to be a much more efficient process that reallocates attorneys’ time into their files and clients’ valuable financial resources. If Webex is experiencing bandwidth issues, telephonic Master

 Calendar hearings should be the back-up policy for attorneys rather than in person Master Calendar hearings. Immigration attorneys rely on Webex hearings to manage their practices, caseloads and clients’ schedules and expectations. Immigration attorneys have relied on the belief that EOIR Newark’s Master Calendar hearings would be handled in a remote fashion and have entered into retainer agreements with clients with fee estimates that do not contemplate in- person appearances, have scheduled their calendars, and accepted other court hearing dates, upon that belief. This new policy, which is being implemented in a haphazard manner, creates numerous conflicts, requiring voluminous motion practice to correct. The new policy would upend these successfully established practices on which attorneys, their staff, and their clients

 have come to rely over the last two years.

 The new policy states that motions to appear via Webex will be entertained, but that they must enumerate a “reason for the request.” Requiring a motion requesting a virtual hearing on every Master Calendar hearing, where an attorney may have dozens in any given week, is an

 overwhelming and unnecessary burden. Additionally, the court, and its already backlogged docket, will be flooded with motions for virtual hearings. The most likely reality is that a majority of attorney motions requesting Webex appearances would be undecided by the date of the appearance. That would lead to a stressful situation each week in which immigration attorneys cannot properly plan their schedules and calendars because they do not know whether or how the immigration judge has ruled on their motion, and whether an in-person appearance will be necessary. Additionally, calling EOIR Newark to ascertain an immigration judge’s decision on a pending Webex motion is, and will continue to be, an unreliable practice strategy. Court staff are already far too busy with court administration to field dozens of additional calls

 from immigration attorneys each day relating to these issues.

 EOIR should continue to permit immigration attorneys to appear for Master Calendar hearings via Webex as standard policy, without a motion. Although EOIR Newark has cited bandwidth concerns as an impetus for the sudden return to in person hearings, it has failed to set forth any basis for not defaulting to the process of holding Master Calendar hearings telephonically nor any substantive reasoning to support the policy that an attorney’s in-person appearance at a Master Calendar hearing is vital to the judicial process. Indeed, prior to the Dec. 21, 2021, EOIR Newark standing order to conduct Master Calendar hearings by Webex, all Master Calendar hearings were handled successfully via telephone, with the respondent’s appearance waived. If bandwidth upgrades are a concern, EOIR Newark should temporarily reinstate that practice and hold Master Calendar hearings with immigration attorneys via telephone until Webex bandwidth

 issues are rectified.

Once again, the NJSBA urges this court to permit hearings for all Master Calendar hearings to be held telephonically or via Webex, without the need for a motion. When we learn and implement a better process, we should embrace that spirit of innovation and creative problem solving rather than revert to antiquated processes. We look forward to working with EOIR Newark to find solutions that allow the court to efficiently accomplish its work and best serve the litigants who appear before it.

One of my reliable sources in the DMV area says that DHS is predicting the same awful “bandwidth” mess at the newly opened “Sterling Immigration Court.” How does a judicial system open “new courts” and mass reschedule cases without checking out basics like “bandwidth capacity” in advance? Total, inexcusable incompetence!

Sadly, this is not a surprise to those of us who have been blasting Garland’s horrible failure to make the glaringly obvious (to all but him) systemic, structural, and personnel changes to restore at least a modicum of due process in his failed “court system” — America’s worst courts, as I have been saying over and over.

When are Dems in Congress finally going to provide some meaningful oversight and force Garland to answer tough questions about his “due process disgrace” @ EOIR? Senator Booker and Senator Menendez, where are you?

William Van Wyke

On August 14, the immigration law community lost a true giant. William Van Wyke, a former Immigration Judge, advocate, and scholar unexpectedly passed away.

How does one capture William’s essence? I’m going to attempt to do so through his own words (in bold), taken from both public sources and emails he wrote to his former Immigration Judge colleagues in conversations after his retirement from the bench.

“The fearful and crude ideas get put into practice by reflex; compassionate and thoughtful ones wait around until everyone agrees with them. – William” – April 1, 2021 email.

My first real impression of William came from reading his 1992 article “A New Perspective on ‘Well-Founded Fear,” which appeared in AILA’s conference handbook that year.1 In very simple, easy to understand language, WIlliam turned the existing method of asylum adjudication on its head, using an easy to apply concept that correctly brought the process in line with international law. It was absolutely brilliant. Thirty years later, we are still waiting around for the government agencies overseeing asylum adjudication to agree with it.

Prior to authoring that article, WIlliam had spent nine years pioneering the representation of Central American refugees before the Immigration Courts in Washington and Baltimore, beginning this work when the 1980 Refugee Act was still new.

“’We have a law that was intended to be generous, that, when it is well understood, would cover many cases — many, many more cases — than those that are granted,’ Van Wyke says.” –  Quote in Eyder Peralta, “Why A Single Question Decides The Fates Of Central American Migrants,” NPR, Feb. 25, 2016.

In one 1990 case in which his clients were denied asylum, William succeeded in persuading the Immigration Judge to rule that those clients could not be deported to their native El Salvador as long as the civil war continued there. William achieved this result by arguing customary international law, and analogizing a refugee’s flight from war to the customary practice of allowing a ship in distress the right to enter a port without authorization. The Washington Post quoted an immigration law authority who called the decision “one of the most impressive victories ever in an immigration court.” The decision was the subject of a law review article the following year.3

“My own experience is that people with anti-immigrant sentiments, whether in INS, DHS, EOIR or anywhere else, have always cringed at the idea of an IJ giving an unrepresented person sufficient information to make genuinely informed decisions… I remember a talk by Janet Reno at one of our conferences 20 years ago when she mentioned ‘compassion’ 12 times — I counted them. But try to actually be compassionate in specific cases in a legally appropriate and consequential way and you’re accused of overstepping judicial bounds. Didn’t I know that compassion is supposed to be a decoration, not something that actually helps the people before us?”  – Email, Sept. 18, 2019

William’s appointment as an Immigration Judge in March, 1995 sent a message of hope to the immigration law community. On the bench, William maintained his methodical, detail-oriented approach.  Early in his career on the bench, William reported that the INS trial attorneys had given him the nickname “the Van Wyck Expressway,” a reference to the similarly named NYC roadway that most know from traveling to or from JFK Airport. When William pointed out to one of those INS attorneys that his courtroom actually moved quite slowly, the attorney responded: “So does the Van Wyck Expressway.”

While we were both on the bench, I heard that William had developed a highly unique seating plan for his courtroom, and asked him about it one day. He showed it to me, explaining in detail his deeply thought out reasoning for the placement of every chair in the room. I don’t remember the specifics so many years later, but it was a perfect example of the strong sense of responsibility WIlliam felt towards all who set foot in his courtroom.

That sense of responsibility became even more heightened when WIlliam transferred from the court in New York to what he used to call “plain old York,” meaning the detained immigration court in York, Pennsylvania, located inside of the York County Prison.4

In one case he heard there, a non-citizen sat in jail awaiting approval of a green card petition filed by his U.S. citizen wife that could have saved him from deportation. But approval of visa petitions is not something an immigration judge can do; that power lies with the same government agency that was seeking the non-citizen’s deportation (at the time, that was INS; it is now DHS). After continuing the case multiple times to allow for a decision on the visa petition, WIlliam was repeatedly informed by INS’s attorney that no action had been taken.  The INS attorney further refused to inquire as to when a decision might be expected, and insisted that rather than wait, the non-citizen should be ordered deported.

Although at the time such action required the consent of both parties, WIlliam took the bold step of administratively closing the case over the government’s objection, writing a detailed decision explaining the necessity of doing so under the facts presented.

Remarkably, rather than appeal William’s denial to the Board of Immigration Appeals, the INS attorney privately and most improperly contacted the Chief Immigration Judge by phone, who in turn improperly reopened the matter and placed it back on for hearing.

In a decision that should be required reading for all EOIR management, WIlliam fired back at both INS and his own higher-ups, stating that it would be a “manifest injustice” to deport the respondent “simply because INS has not performed its Congressionally-mandated adjudication in a timely fashion.”

Detailing the extensive efforts he had undertaken to get INS to adjudicate the visa petition, WIlliam further noted that “[t]he asymmetry of ordering one party, but asking, begging, pleading and cajoling the other party hearing after hearing without effect, can only diminish the court as an authoritative and independent arbiter in the public’s eyes.”

WIlliam took the INS and the Office of the Chief Immigration Judge to task for their unethical ex parte communication, and the latter’s unauthorized action in response to such conversation:

The Chief Immigration Judge is an administrative and policy officer without appellate or other legal authority to overrule the immigration judge’s procedural decisions in the case, see 8 CFR 3.9, 3.1(b), and ethical rules require the Chief Immigration Judge as well as immigration judges to refrain from taking action in a specific case following an ex parte communication about the case by one of the parties.

William further noted that his “decision to close the case temporarily was not a mere administrative one subject to OCIJ’s general direction, but a legal decision made as an integral part of the adjudicatory process in an individual case.” William cautioned that the private communication, which denied opposing counsel the right to be heard, protected INS from having to defend its position in an appeal to the BIA, thus giving

a procedural and tactical advantage to the INS by demonstrating to respondent, rightly or wrongly, that an INS call to the Office of the Chief Immigration Judge may be enough to undo what the immigration judge does in open court, while encouraging the INS to continue to seek results from the OCIJ privately that it might not be able to get from the BIA publicly.

William concluded:

Unable to establish or enforce the standards of conduct that this judge believes must apply, he will recuse himself from further consideration of the case. In the court’s view, only the OCIJ, which went beyond mere administrative action to direct a particular course of action in this case, is in a position to cure the appearance of impropriety its intervention has produced. The court will therefore refer this case back to the Chief Immigration Judge for whatever action he may deem fit and appropriate.

The extraordinary nature of the matter was reported in an article in the New York Times.5

In retirement, William was a member of our Round Table that filed an amicus brief in an important case in the U.S. Court of Appeals for the Second Circuit, Velasco-Lopez v. Decker.  The case challenged the practice of requiring a detained non-citizen to themself prove that they would not pose a flight risk or danger to the community in order to warrant their release from detention. In its precedent decision, the circuit court agreed that such burden should be borne by the government, and not the detainee.

I share here part of William’s response to the decision

In this decision, the important starting point is that due process applies to every person in their relation to the power of government. This principle humanizes immigrant “others” and shows that when Big Government (i.e. the kind that wields power in favor of the already rich and already powerful) treads on anyone, everyone’s rights are in jeopardy. The principles relevant in bond decisions –– having ties to our communities and not being a danger to others –– are strong values that most of us honor and share, whether recent immigrants or earlier-generation immigrants, and should make all of us resist limitations on our freedom by the coercive power of jailing people.

I don’t know if they still staple those little yellow cards with red print onto files of jailed immigrants that used to say, “RUSH: detained at government expense.”  Years ago when I was at York I wrote to… EOIR General Counsel, to ask if we couldn’t change those cards to be more humane, to say, “RUSH: person deprived of liberty,” or at least more neutral: “person deprived of liberty at government expense.” A change, of course, was “unnecessary” because everyone already knew the immigrants’ hardship, even if our boss’s reminder focused only on the government’s. Maybe they’ll change the cards now to remind adjudicators: “Rush: this person should not be deprived of freedom unless the government quickly decides he/she lacks any community ties AND is dangerous.” I won’t hold my breath, though.

I will conclude by saying that just recently, I set about researching a narrow legal issue that I would imagine most Immigration Judges would resolve in a few pages at most. I came across a decision that William had written on the topic shortly before his retirement from the bench that was exactly what I was looking for. It was 39 pages single spaced, and of course, absolutely brilliant.

On behalf of your fellow judges, and of all who have appeared in Immigration Court, thank you, William, for being you, for never lowering your standards. You restored the hope of so many in the power of law to make a positive difference in people’s lives, and so often showed that there was a way forward when we thought there was none. You are already greatly missed.

My first real impression of William came from reading his 1992 article “A New Perspective on ‘Well-Founded Fear,” which appeared in AILA’s conference handbook that year.1 In very simple, easy to understand language, WIlliam turned the existing method of asylum adjudication on its head, using an easy to apply concept that correctly brought the process in line with international law. It was absolutely brilliant. Thirty years later, we are still waiting around for the government agencies overseeing asylum adjudication to agree with it.

William spent those years trying to persuade the government of the proper application of the new law.  However, INS and the newly created EOIR remained largely mired in the Cold War-influenced view of asylum that preceded the 1980 changes. And under that Cold War approach, Central Americans fleeing pro-U.S. regimes had nearly no chance to obtain asylum

A 1991 Washington Post article documented how this institutional resistance only caused William to be more persistent and creative in his legal approach.2

Kind of says it all about the entrenched, continuing, institutional resistance at EOIR to correct, generous, fair, practical interpretations of asylum law and other immigration and human rights laws! That’s what helps generate uncontrollable backlogs and brings our entire justice system into disrepute! Worst of all, it threatens the lives of those denied justice by its legal misinterpretations and mis-applications of the law!

What does it say about an institution that no longer touts or actively pursues its noble one-time-vision of “through teamwork and innovation, be the world’s best administrative tribunals, guaranteeing fairness and due process for all?” Ironically, William’s life and achievements embody that now-defunct “EOIR vision.” But, nobody in “management” actually acknowledged that during his often-difficult tenure there.

Encouragingly, a number of Garland’s recent judicial appointments are distinguished, expert, widely respected “practical scholars” in the “Van Wyke mold.” Unfortunately, it’s going to take immediate and dramatic changes in moribund, uninspired EOIR leadership and in the “any reason to deny” BIA to overcome the “Cold War mentality,” anti-immigrant bias, assembly line procedures, “institutionalized go along to get alongism,” and unacceptably poor performance of EOIR. Right now, it’s still drag on our entire justice system that puts the future of our nation at risk!

No wonder we already miss William, his outspoken courage, and his wisdom so much. There is a void in our justice system right now where fierce due-process-focused, creative, humane, practical scholars should be leading the way in our institutions of justice! 

It’s up to the “new generation” of the NDPA to break down the walls of official resistance by Garland and other short-sighted bureaucrats and politicos who lack the vision to make racial justice, immigrant justice, and equal justice for all realities rather than disingenuous unfulfilled rhetoric! Guys, your lives and those of your descendants might depend on it! So, dial up the pressure on the intransigents, many of them in the Biden Administration you helped to elect and who expect your support and votes again this Fall!

The ship is rudderless and sinking! Many of the sailors are inept or think they are working for a different Navy! The solution: More Lt. Commanders on deck, each doing someone else’s job and giving random orders, to add to the confusion and disorder!

Let me be clear: EOIR and its long-suffering “customers” and “stakeholders” need this superfluous position like a hole in the head! Perhaps less! This looks like “EOIR imitating the DHS bureaucracy” that it is supposed to be treating as a “party,” not a “role model!”

The “Office of Policy” — totally unnecessary and inconsistent with the mission of a quasi-judicial court system — is a serious boondoggle created by the last Administration. Eliminating it and redeploying its wasted resources into competent, expert quasi-judicial decision making should have been “Day One Stuff” for Garland. But it wasn’t!

EOIR needs better, expert judges, who know immigration and human rights laws, and are unswervingly committed to due process, fundamental fairness, and best practices! It also needs a “lean team” of well qualified judicial administrators to recruit, hire, train, and support judges and court staff!

Incredibly, most of this PD sounds like it’s right out of the PDs for BIA Chair, BIA Member, CIJ, Director, Deputy Director, or General Counsel. Get folks who can do those jobs and eliminate the Office of Policy and the other “non-operational bureaucratic fat” in Falls Church!

Does the Supreme Court have a “U.S. Law Division?” How about the D.C. Circuit where Garland once served? What on earth is Garland doing with this wasteful nonsense!

For Pete’s sake, the BIA IS the “Immigration Law Division!” If, as I maintain, most of the current Appellate Judges are not capable of performing those functions competently and in accordance with due process and fundamental fairness, then get better judges in there! Now!

Sure, it’s not the “popular solution” within the self-perpetuating bureaucracy. But, it’s the right one!

Stop the unnecessary proliferation of inept bureaucrats at EOIR! “Hey, hey, Ho, ho, the EOIR Clown Show has got to go!” Throwing more “ringmasters” into this circus is NOT the answer!

EOIR Announces Appointment of Mary Cheng as Deputy Director

FALLS CHURCH, VA – The Executive Office for Immigration Review (EOIR) today announced the appointment of Mary Cheng as the agency’s Deputy Director. Judge Cheng has served EOIR since 2009, including as a Deputy Chief Immigration Judge for the past five years.

“Judge Cheng brings a welcome combination of experience and expertise, preparing her for certain success as EOIR’s deputy director,” EOIR Director David L. Neal said. “Her experience on the immigration bench, her expertise as a managing judge, and her appreciation for the view from both counsels’ tables perfectly position her to help lead the agency to a reinvigorated commitment to our mission and to public service.”

As Deputy Director, Judge Cheng will assist Director Neal in supervising and managing all EOIR components, and developing and implementing agency policies and short- and long-term strategies.

Since April 2021, Judge Cheng has served as the Regional Deputy Chief Immigration Judge for the Eastern Region at EOIR. She previously served as a Deputy Chief Immigration Judge from 2017 to 2021, and she was the Acting Principal Deputy Chief Immigration Judge from August 2020 to February 2021. Judge Cheng has also served in the New York Immigration Court both as an Assistant Chief Immigration Judge from 2015 to 2017, and as an Immigration Judge from 2009 to 2015. Before joining EOIR, she served as Assistant Chief Counsel for the Department of Homeland Security, Immigration and Customs Enforcement, from 2002 to 2009; and before that, she practiced immigration law in New York from 2000 to 2002. Judge Cheng received her Bachelor of Arts from New York University and a Juris Doctor from the New York Law School. She is a member of the New York State Bar.

Judge Cheng had a 71.5% asylum grant rate while on the bench in NYC. That makes her an “outlier” (in a good way) among EOIR HQ “honchos” with significant Immigration Court experience.

Judge Cheng spent two years in the private practice of  immigration law, albeit several decades ago, as well as serving as a JLC at the NY Immigration Court and an ICE prosecutor. So, she has a more “balanced perspective” on the system than many in EOIR.

Interestingly, Judge Cheng’s record on asylum cases is the “inverse” of the nationwide rate, where 2/3 of the asylum cases are denied and many IJs disgracefully reject almost every asylum case coming before them. So, she knows the system is broken, biased, unfair, and unprofessional! 

The question is whether she will use her knowledge and skills to stand up for due process and fair treatment of asylum seekers? Or, will she become another in the long line of EOIR “go along to get along bureaucrats” — willing to sacrifice immigrants’ lives for job security and career advancement?

Hopefully, Judge Cheng will implement some “attitude changes” in an agency still far too committed to the Sessions/Barr “culture of denial” and to misusing, abusing, and mismanaging the Immigration Courts as a “deterrent” — carrying out Administration enforcement “priorities” —  rather than acting as an independent court system using “enlightened practical scholarship” to guarantee due process and fundamental fairness for the individuals coming before it. EOIR has lost sight of its mission and Garland doesn’t seem interested in or capable of changing that. 

As for the “certain success,” predicted by Director Neal, that’s been elusive for some previous Deputy Directors. Three previous Deputies have gone on to become EOIR Director: The late Kevin Rooney, Judge Kevin Ohlson, and the late Juan Osuna. But, “success” in an organization in failure that lacks a dynamic plan for long overdue fundamental personnel, procedural, and structural reforms looks like a tall order. It’s probably  “Mission Impossible!”

The only true measure of “success” is whether the community that EOIR is supposed to serve comes to view the courts as fair, humane, and professional. That depends on changing the results of EOIR’s anti-asylum, often anti-immigrant “assembly line” approach to justice and its chronic, backlog-building  “Aimless Docket Reshuffling” produced by attempting to please DOJ politicos at the expense of justice. Bureaucratic metrics and bogus DOJ and Administration political goals and agendas are meaningless in the “real world.”

What kind of “short and long-term strategies” will work in a struggling “court” system plagued by a burgeoning 1.8 million case backlog, endemic “Aimless Docket Reshuffling,” an appellate body stuck in reverse, a byzantine “agency management” structure, institutionalized “worst practices,” and too many judges who were the product of a poor selection process and inadequate training? There are some measures that potentially could succeed. But, “Team Garland” has pointedly ignored them with predictably bad consequences. 

No one person can change the disastrous trajectory of EOIR. But, someone willing to take risks and give due process and fundamental fairness a chance could make a difference in the lives of the most vulnerable among us. Could Judge Cheng be that person? We’ll see.

Immigration Court’s Data on Minors Facing Deportation is Too Faulty to Be Trusted

After careful analysis and consideration, TRAC is forced to suspend its publication of data on juveniles facing deportation in Immigration Court due to serious, unresolved deficiencies in the EOIR’s data. TRAC’s analyses indicate that the data used by the Immigration Court for tracking and reporting on juveniles who are facing deportation appear to be seriously flawed to the point that we question whether the agency has the ability to meaningfully and reliably report on juveniles in its caseload.

We wrote to EOIR’s Acting Director Jean King on September 22, 2021 to share TRAC’s findings, request feedback from the agency, and offer to share additional details to support the agency’s efforts to identify and resolve the issues. TRAC did not receive any response to that letter. We wrote to the EOIR again on October 15, 2021, this time to Director David Neal who had subsequently been appointed as EOIR’s permanent director by Attorney General Merrick Garland. We reiterated our initial concerns, but TRAC did not receive a response to that letter either.

TRAC is now regretfully withdrawing its own Juvenile App since EOIR’s data are too flawed to be used. Because these significant data problems arose only at the time EOIR implemented a series of changes in the latter part of 2017 impacting how unaccompanied juveniles were tracked, the results compiled before these changes occurred will be retained online for use in historical research.

The Immigration Court’s failure to respond to or address TRAC’s findings of significant data quality issues regarding minors is particularly concerning given the highly sensitive nature of children facing deportation. This data quality problem on tracking juvenile cases adds to EOIR’s earlier refusal to address data quality issues regarding asylum cases that continue to disappear from the agency’s master database which it relies on to manage its workload. Furthermore, TRAC recently uncovered additional data problems leading EOIR to falsely report its asylum backlog had allegedly declined this past year when in fact the backlog had markedly grown.

Taken individually, each specific issue is significant and noteworthy in its own right. But taken together, these now multiple unresolved data quality issues are compounding upon each other. TRAC has repeatedly offered to work with the EOIR to aid the agency as it seeks an understanding of the problem and a meaningful solution—yet thus far EOIR has continued to ignore its growing data management problems.

The public should be increasingly troubled by the indifference that the Immigration Courts have shown to these issues and should push for improved transparency and accountability.

On July 15, 2021, the Attorney General issued a precedential decision in Matter of Cruz-Valdez, 28 I&N Dec. 326 (A.G. 2021). In that decision, the Attorney General restored the authority of immigration judges and the Board of Immigration Appeals (Board) to administratively close cases. This memorandum discusses the practical implications of the Attorney General’s decision, particularly in light of the Executive Office for Immigration Review’s (EOIR) pending caseload.

II. Administrative Closure to Date

Administrative closure “is a docket management tool that is used to temporarily pause removal proceedings.” Matter of W-Y-U-, 27 I&N Dec. 17, 18 (BIA 2017). An immigration judge’s or appellate immigration judge’s administrative closure of a case “temporarily remove[s] [the] case from [the] Immigration Judge’s active calendar or from the Board’s docket.” Matter of Avetisyan, 25 I&N Dec. 688, 692 (BIA 2012). Administrative closure came into widespread use by EOIR adjudicators in the 1980s. Cases have been administratively closed for a variety of reasons over the years, and the Board has issued several decisions addressing when administrative closure is appropriate. The Board’s two most recent such decisions are Matter of Avetisyan and Matter of W-Y-U-, issued in 2012 and 2017, respectively.

In 2018, Attorney General Sessions issued Matter of Castro-Tum, 27 I&N Dec. 271 (A.G. 2018). He held that, with limited exceptions, “immigration judges and the Board do not have the general authority” to administratively close cases. Matter of Castro-Tum, 27 I&N Dec. at 272. The Third, Fourth, Sixth, and Seventh Circuits subsequently ruled on challenges to Matter of Castro- Tum. A circuit split emerged, with the Third, Fourth, and Seventh Circuits holding that

adjudicators have the general authority to administratively close cases,1 but with the Sixth Circuit holding that adjudicators have the authority to administratively close cases only in limited circumstances.2 In 2020, the Department of Justice (Department) promulgated a final rule that essentially codified Matter of Castro-Tum, restricting EOIR adjudicators’ ability to administratively close cases. See “Appellate Procedures and Decisional Finality in Immigration Proceedings; Administrative Closure,” 85 Fed. Reg. 81588 (Dec. 16, 2020). However, this rule has been preliminarily enjoined nationwide. See Centro Legal de La Raza v. Exec. Office for Immigration Review, 524 F.Supp.3d 919 (N.D. Cal. Mar. 10, 2021).

In Matter of Cruz-Valdez, the Attorney General noted that Matter of Castro-Tum “departed from long-standing practice” by prohibiting administrative closure in the vast majority of circumstances. Matter of Cruz-Valdez, 28 I&N Dec. at 329. He also noted that the Department is “engaged in a reconsideration” of the enjoined 2020 rule. Id. Given these factors, the Attorney General, in Matter of Cruz-Valdez, “overrule[d] [Matter of Castro-Tum] in its entirety,” and he “restore[d] administrative closure” pending the current rulemaking. Id. He specified that, in deciding whether to administratively close cases pending the rulemaking, “except when a court of appeals has held otherwise, immigration judges and the Board should apply the standard for administrative closure set out in Avetisyan and W-Y-U-.” Id.

III. Administrative Closure after Matter of Cruz-Valdez

With administrative closure restored, EOIR adjudicators have the authority, under the Board’s case law, to administratively close a wide variety of cases. Going forward, pending the promulgation of a regulation addressing administrative closure, adjudicators must evaluate requests to administratively close cases under Matter of Avetisyan and Matter of W-Y-U-, as well under as the Board’s case law predating those decisions, to the extent that case law is consistent with those decisions. Adjudicators should accordingly familiarize themselves with Matter of Avetisyan, Matter of W-Y-U-, and the Board’s prior case law addressing administrative closure.

The restoration of administrative closure will assist EOIR adjudicators in managing their dockets given EOIR’s caseload. In Matter of Cruz-Valdez, the Attorney General recognized that administrative closure has in the past “served to facilitate the exercise of prosecutorial discretion, allowing government counsel to request that certain low-priority cases be removed from immigration judges’ active calendars or the Board’s docket, thereby allowing adjudicators to focus on higher-priority cases.” Matter of Cruz-Valdez, 28 I&N Dec. at 327. EOIR has finite resources and a daunting caseload. Given this reality, it is important that adjudicators focus on two categories of cases: those in which the Department of Homeland Security (DHS) deems the respondent to be an immigration enforcement priority,3 and those in which the respondent

2 Specifically, the Sixth Circuit initially held that the regulations do not delegate to immigration judges or the Board the general authority to administratively close cases. Hernandez-Serrano v. Barr, 981 F.3d 459, 466 (6th Cir. 2020) . desires a full adjudication of his or her claim or claims. Being able to administratively close low priority cases will help adjudicators do this.

Under case law, where DHS requests that a case be administratively closed because a respondent is not an immigration enforcement priority, and the respondent does not object, the request should generally be granted and the case administratively closed. See Matter of Yewondwosen, 21 I&N Dec. 1025, 1026 (BIA 1997) (stating that the parties’ “agreement on an issue or proper course of action should, in most instances, be determinative”); Matter of Cruz-Valdez, 28 I&N Dec. at 327 (recognizing the role of administrative closure in “facilitat[ing] the exercise of prosecutorial discretion”).

Administrative closure is appropriate in many other situations as well. For example, it can be appropriate to administratively close a case to allow a respondent to file an application or petition with an agency other than EOIR. See Matter of Avetisyan, 25 I&N Dec. at 696 (identifying “the likelihood the respondent will succeed on any petition, application, or other action he or she is pursuing outside of removal proceedings” as a factor for adjudicators “to weigh” in evaluating requests for administrative closure); 8 C.F.R. § 212.7(e)(4)(iii) (permitting a respondent in removal proceedings to file a Form I-601A, Application for Provisional Unlawful Presence Waiver, with U.S. Citizenship and Immigration Services where the “proceedings are administratively closed and have not yet been recalendared at the time of filing the application”). It can also be appropriate to administratively close a case while an agency adjudicates a previously filed application or petition, or, if a visa petition has been approved, while waiting for the visa to become available. See Matter of Avetisyan, 25 I&N Dec. at 696. It is generally appropriate to administratively close a case where a respondent has been granted temporary protected status. See Matter of Sosa Ventura, 25 I&N Dec. 391, 396 (BIA 2010). This is only a partial list; administrative closure can be appropriate in other situations not mentioned here. See Matter of Avetisyan, 25 I&N Dec. at 696 (stating that each request for administrative closure “must be evaluated under the totality of the circumstances of the particular case”).

Where a respondent requests administrative closure, whether in a scenario described above or another scenario where administrative closure is appropriate, and DHS does not object, the request should generally be granted and the case administratively closed. See Matter of Yewondwosen, 21 I&N Dec. at 1026. Where a request for administrative closure is opposed, “the primary consideration . . . is whether the party opposing administrative closure has provided a persuasive reason for the case to proceed and be resolved on the merits.” Matter of W-Y-U-, 27 I&N Dec. at 20. But adjudicators should bear in mind that “neither party has ‘absolute veto power over administrative closure requests.’” Id. at n. 5 (quoting Matter of Avetisyan, 25 I&N Dec. at 692).

Where at all possible, issues involving administrative closure should be resolved in advance of individual calendar hearings and not at hearings. Immigration judges are therefore encouraged to send scheduling orders to parties well before the hearing takes place, inquiring of DHS whether the respondent is an immigration enforcement priority, and otherwise soliciting the parties’ positions on administrative closure and other issues related to prosecutorial discretion. such issues have not been resolved in advance of an individual calendar hearing, the immigration judge should ask DHS counsel on the record at the beginning of the hearing whether the respondent is an immigration enforcement priority. Where DHS counsel responds that the respondent is not a priority, the immigration judge should further ask whether DHS intends to exercise some form of prosecutorial discretion in the case. As part of this colloquy, the 4 immigration judge should ask whether the parties want the case administratively closed.

IV. Conclusion

Administrative closure is a longstanding, and valuable, tool for EOIR adjudicators. As the Attorney General noted in Matter of Cruz-Valdez, the Department is currently engaged in rulemaking that will address adjudicators’ authority to administratively close cases. Pending that rulemaking, adjudicators have the authority under Matter of Cruz-Valdez to administratively close many cases before them when warranted under Board case law. Adjudicators should familiarize themselves with the situations in which administrative closure is appropriate, and adjudicators should be proactive in inquiring whether parties wish for cases to be 5 administratively closed. 4 There is one potential caveat to the guidance and instructions in this section. As noted above, the Attorney General stated that, pending the promulgation of a regulation addressing administrative closure, immigration judges and the Board should apply the Board’s case law “except when a court of appeals has held otherwise.” Matter of Cruz- Valdez, 28 I&N Dec. at 329. For cases arising in the Sixth Circuit, adjudicators must determine to what extent administrative closure is permitted given that court’s case law, and they must handle issues involving administrative closure accordingly. See Garcia-DeLeon, 999 F.3d 986; Hernandez-Serrano, 981 F.3d 459.

5 This memorandum does not create any legal rights or benefits for either party, and it does not mandate that a particular motion for administrative closure be granted or denied. In all cases, immigration judges and appellate immigration judges must exercise their independent judgment and discretion in adjudicating motions for administrative closure consistent with the law. See 8 C.F.R. §§ 1003.1(d)(1)(ii), 1003.10(b).

WHAT SHOULD HAVE HAPPENED: Garland should have appointed the “Chen-Markowitz BIA” and empowered them to aggressively clean up the backlog, using administrative closing among others tools (such as referral to USCIS and more favorable precedents requiring the granting of relief in meritorious cases).

In a properly functioning quasi-judicial system, this same “guidance” should have come in a series of BIA precedents that would require BIA panels and the Article IIIs to enforce compliance among recalcitrant Immigration Judges. That could be accompanied by unilateral action by the BIA to close “deadwood” cases on the appellate docket. Either party could request re-docketing, with a justification. (Hint: In my BIA career, we closed thousands of cases of this way and I could count on one hand the number of “redocketing” motions we received.) Also, in a better system, the Immigration Judges already would be aggressively taking these “common sense” steps.  Precedents properly applying asylum, withholding, and CAT would be cutting into the largely “manufactured” backlog.

WHAT ACTUALLY HAPPENED: Typical Dem timid approach.

Unless the BIA actually believes in this “guidance” (doubtful, given it’s current “packing” with notorious anti-immigrant judges by Sessions and Barr, unaddressed by Garland) and is willing to enforce it and incorporate it into precedents, it won’t achieve its objective of promoting fairness and efficiency! Nor will it significantly reduce the backlog. 

Perhaps the “rulemaking” referenced in Director Neal’s memo will solve the problem. But, EOIR’s history of completing such rulemaking, particularly in Dem Administrations, has been less than stellar. See, e.g., Gender-Based Asylum Regs (3 Dem Administrations, 0 Regs); Ineffective Assistance of Counsel Regs (2 Dem Administrations, 0 Regs). 

One problem: Dem Administrations often feel compelled to engage in false “dialogue,” look for an unachievable “consensus,” and pay attention to public comments; GOP Administrations simply plow ahead with their preconceived agenda without regard to expert input, public opinion, or empirical data. 

Consequently, although Dems have failed over more than two decades to finalize final gender-based asylum regulations, Stephen Miller was able to publish outrageous final regulations eliminating more than two decades of gender-based case law progress in a few months. Fortunately, those regs were promptly enjoined!

Over the past two decades, the GOP has radically “weaponized” EOIR as an enforcement tool. Dems have pretended not to notice and have squandered at least nine years of basically “unrestricted” opportunities to restore some semblance of due process, sanity, and humanity @ EOIR! As my friend Karen Musalo said in her recent LA Times op-ed, “actions speak louder than words.” 

EOIR’s latest “actions,” while better than nothing, are unnecessarily ineffective.This is supposed to be a “court system,” not a bureaucratic “agency,” run by “policy directives” and a top-heavy, bloated bureaucracy with fancy-titled “supervisors” and superfluous “program managers.”

Until we get an Attorney General who considers migrants to be persons (humans), views immigrant justice as important, understands what a court is, how it operates, and has the guts to install the practical progressive experts who can make it happen, EOIR will continue to be an embarrassment to American justice.

An End to a Highly Controversial Quota System Imposed on Immigration Judges

This week Immigration Judges received an email message from Chief Immigration Judge Tracy Short stating that the performance metrics imposed by the Trump administration which violated judicial ethics are now “suspended.”

WASHINGTON –A deeply flawed and inefficient U.S. Department of Justice program that evaluated Immigration Judges primarily on the number of cases they heard, has been “suspended.” The DOJ will no longer evaluate judges on the number of cases they decide Chief Judge Tracy Short wrote in an email sent to the nation’s roughly 500 Immigration Judges this week.

Over the past three plus years, Immigration Judges have looked over their shoulders, worried about being disciplined, just for doing their jobs — providing due process.

“This week’s actions by the Department of Justice under Executive Office for Immigration Review Director David Neal are a step in the right direction toward restoring a greater measure of integrity to our nation’s Immigration Courts,” said Mimi Tsankov, president of the National Association of Immigration Judges. “Our organization looks forward to working with management to restore a fairer process that allows judges to focus on doing their jobs properly. The performance metrics developed by the Trump administration were a violation of judicial ethics, they belong in the trash bin.”

“The Agency is in the process of developing new performance measures, drawing from past successful measures and appropriate input, that will accurately reflect the workload of an immigration judge,” the chief judge wrote in his emailed message. “These new performance measures will focus on balance and equity for the various types of docket assignments.”

In 2018, then U.S. Attorney General Jeff Session imposed a quota of 700 decisions per year on each Immigration Judge, tied to performance reviews, regardless of the complexity of the cases.

The Trump administration also attempted to silence NAIJ from speaking out on the quota system and other policies by decertifying the union. While the union-busting efforts of the previous administration were not completely successful, full collective bargaining rights have yet to be restored to NAIJ.

The National Association of Immigration Judges (NAIJ), founded in 1971, is a voluntary organization formed with the objectives of promoting independence and enhancing the professionalism, dignity, and efficiency of the Immigration Court.

Can David Neal bring all the real parties in interest “to the table,” fashion workable, realistic judicial policies and procedures driven by due process and the realities of Immigration Court practice, keep DOJ’s political meddling at bay, and then tap “new talent” that can actually implement positive change in a judicial, non-bureaucratic manner that achieves “systemic buy-in?” Does he even want to? If so, will Team Garland empower him to succeed, or undermine him?

One thing in Director Neal’s favor: He already retired from EOIR once and presumably could do so again if pressured to elevate political agendas over due process and best practices.

On the flip side, at least one other Director in that same position chose to “go along to get along” with decisions and policies from the DOJ that actively undermined due process and substantially decreased confidence in government.

We’ll see whether the NAIJ’s “cautious optimism” about the “Neal Era @ EOIR” is justified or just another dashed dream about due process, fundamental fairness, and best practices!

Sources in and outside of EOIR confirm that new EOIR Director “David Neal has ended the dashboard. Supposedly, new IJ quotas are coming, which will be presented as kinder, more humane quotas.”

The “IJ Dashboards,” inextricably tied to due-process-denying “deportation quotas” for Immigration Judges were one of the stupidest, most childish, and transparently counterproductive wastes of taxpayer money by the Trump regime at the DOJ. They were harshly criticized both internally and by outside commentators, including “Courtside.” Their ineffectiveness in reducing backlogs and their adverse effects on already “below basement level” IJ morale are matters of public record!

Shockingly, this wasteful abuse of technology was undertaken at a time when EOIR was continuing its two decade abject failure to implement a badly-needed and long overdue nationwide e-filing system. Who knows how many files and filings are actually floating around EOIR (“lost in space”)? EOIR incompetence means we might never know the full extent of the ongoing backlog disaster! Will David Neal become the first Director in more than two decades to actually solve this problem, rather than just scrambling to conver up failure?

Congratulations to Director Neal for “taking at least one small step for mankind.” We’ll wait to hear what he does to make “IJ quotas” more “kind and gentle.” 

The obvious “no brainer” answer is to eliminate them entirely. They could be replaced with realistic, non-mandatory “goals” or “guidelines” for deciding certain types of cases. This might provide helpful guidance for IJs in setting expectations and fairly and professionally handling clogged dockets, rather than ham-handed attempts at coercion and transparent “blame shifting.”

However those guidelines would have to be developed with input from the Immigration Judges themselves, counsel from both the private bar and DHS, and some true judicial experts — perhaps “on loan” from the Administrative Office for U.S. Courts, the Brennan Center, the ABA, and/or the FBA.

Past “goals and timetables” have been the product of political posturing and wishful thinking by those bureaucrats at DOJ and EOIR trying to shift blame and CTA for the failing system under their responsibility. The legitimacy of the process by which any guidelines are established is critical to making them realistic and helpful, rather than just another bureaucratic gimmick untethered to reality as past guidelines have been.

Attorney General Merrick B. Garland Announces Appointment of David Neal as Director of the Executive Office for Immigration Review

WASHINGTON – Attorney General Merrick B. Garland today announced the appointment of David L. Neal as the Director of the Executive Office for Immigration Review (EOIR) at the Department of Justice.

“The Justice Department’s commitment to a fair and efficient immigration court system, governed by due process and the rule of law, is exemplified by recent policy changes and our pursuit of significant additional resources,” said Attorney General Garland. “David Neal brings invaluable experience that will help further EOIR’s mission.”

The EOIR director is responsible for the supervision of the Chairman of the Board of Immigration Appeals (BIA), the Chief Immigration Judge, the Chief Administrative Hearing Officer and all agency personnel. EOIR has more than 2,300 employees in its 69 immigration courts nationwide, at the BIA and at EOIR headquarters in Falls Church, Virginia. As provided in the President’s Budget Request for FY 22, EOIR anticipates increasing its immigration judge corps from 535 today to 734 by the end of the next fiscal year.

Most recently, Mr. Neal was a consultant specializing in immigration policy and practice. Previously, he held positions at EOIR over two decades. From 2009 to 2019, he served as Chairman of the BIA at EOIR, where he was chief judge of the appeals board and managed judicial and administrative operations. Mr. Neal served in multiple other capacities at EOIR, including as Vice Chairman of the BIA, Chief Immigration Judge, Assistant Chief Immigration Judge, Immigration Judge and Assistant to the Director.

Prior to his tenure with EOIR, Mr. Neal served in the U.S. Senate Judiciary Committee as chief counsel of the Subcommittee on Immigration. Mr. Neal began his legal career as the Director of Policy Analysis at the American Immigration Lawyers Association and also worked for a law firm in Los Angeles, representing immigration cases before the former Immigration and Naturalization Service, the State Department, the Department of Labor and EOIR.

Mr. Neal received his Bachelor of Arts from Wabash College in Crawfordsville, Indiana, Master of Divinity from Harvard University’s School of Divinity and his Juris Doctor from Columbia Law School. Mr. Neal is a member of the District of Columbia and New York bars.

David thus becomes the first EOIR Director to have served as both BIA Chair and Chief Immigration Judge, as well as briefly as an Immigration Judge.

Congratulations and good luck to David in his new position! It’s going to take a monumental effort, extraordinary management ability, creativity, and lots courage and determined due-process-best-practices-oriented leadership to straighten out the godawful legal, professional, and administrative mess in America’s most unfair and dysfunctional court system, now running a largely self-created 1.4 million case backlog.

Will he be able to hold off the politicos at DOJ and finally put an end to the DOJ-generated “Aimless Docket Reshuffling” (“ADR”) that has been the major cause of the 1.4 million case backlog at EOIR that has gown up over the last two decades of mismanagement at DOJ and EOIR? Will he be able to end the reprehensible officially-sanctioned “victim shaming” and cowardly “blame shifting” that has been heaped by the DOJ and EOIR on those suffering from its defective administrative practices over the past two decades?

If, as Garland claims, 200 new Immigration Judge positions will be added by the end of FY 2022, will David be able to institute merit-based Immigration Judge hiring that 1) involves public input from those who actually practice before the Immigration Courts, e.g., the private bar; 2) gives appropriate credit to “practical scholars” in immigration, human rights, and civil rights with clearly-established records of independent thinking and unswerving commitment to due process for individuals; 3) appropriately honors and weighs experience gained actually representing individuals, particularly asylum seekers, in Immigration Court, and 4) removes demeaning “production quotas,” limitations on docket management, and unnecessary restrictions on public scholarship, writing, and teaching which have made the job intentionally unattractive to many of the “best and brightest” progressive candidates from the private immigration and human rights sector. Will he actually go out and actively recruit a broader, more diverse, and more representative candidate base for IJ hiring, rather than using “insider procedures” that don’t reach or encourage many of the best candidates for these important jobs?

HINT: More “gimmicks,” like “dedicated dockets,” continued “Mickey Mouse”  🐭 uber enforcement “production quotas,” and appointments of judges who have never represented an individual in Immigration Court won’t do the trick! That is being proved every single day, beyond any reasonable doubt!

Nor will being at war with the National Association of Immigration Judges (“NAIJ”) and their leadership further due process. NAIJ leaders are the only ones at EOIR who have been providing meaningful professional training over the past four years of darkness and ignorance at EOIR.

They, along with the Private/NGO/Clinical Bar and OPLA Assistant Chief Counsel have the best and most practical ideas on how to fix EOIR! David would be wise to give them all “seats at his table,” and listen carefully to their views, rather than attempting to “lock them in a dark cellar,” as was the practice of the Trump immigration kakistocracy that effectively destroyed EOIR!

Since “built to fail” enforcement-generated non-solutions are the things EOIR appears “wedded to,” David is going to have to persuade Garland and his lieutenants to radically change course. Can he get them to treat Immigration Courts as “real courts,” controlling the lives of “real human beings,” folks like you and me, in dire need of real judicial administration and real progressive expert judges, to get out of EOIR’s current “death spiral.”☠️ Or, will we see a continuation of “Dred Scottification” of women and people of color, along with substandard trial judging, defective appellate review, and lousy biased precedents that end up creating more problems than they solve? 🤮 Only time will tell!
