Multiple sources report that now-former Chief Immigration Judge Tracy Short resigned today. This long overdue action ends one of the most grotesque ongoing farces in the American legal system. 

This total travesty saw the Trump holdover member of the Sessions-Hamilton “Atlanta Xenophobic Mafia” — appointed by former AG Barr without any judicial experience or qualifications — continue to drag down the Immigration Courts with increased due-process-denying backlogs and anti-immigrant shenanigans during the first 18 months of the Biden Administration. As a “Senior Executive,” Short could and should have been reassigned long ago by AG Merrick Garland to a position where he no longer could undermine American justice.

ICE Atlanta and the Atlanta Immigration Court were generally held in low professional regard by practitioners and observers not part of the nativist cabal with which both have long been associated. 

Short’s appointment was particularly galling to those committed to due process and fundamental fairness because he replaced then Acting Chief Immigration Judge Christopher Santoro, a far more qualified candidate who had been an outspoken force for fairness and impartiality. That’s actually what the Immigration Courts are supposed to be about, but clearly were not during the Trump era at DOJ.

Short’s resignation comes as the National Association of Immigration Judges (“NAIJ”) seeks “re-recognition” from the Biden Administration. Short helped spearhead Barr’s inexplicably successful effort to “de-certify” the NAIJ as thinly disguised “punishment” for speaking out for judicial independence and exposing the many ongoing abuses of due process at EOIR.

Predictably, nativist/restrictionist groups and their “GOP cheerleaders” like Sen. Chuck Grassley (R-IA) and insurrectionist apologist Rep. Jim Jordan (R-OH) raised absurdist claims of a “political vendetta.” That’s ironic considering that the Trump group improperly “weaponized” EOIR to serve not as a legitimate quasi-judicial arbiter, but rather as an overtly biased and unqualified “enforcer” of their racially-charged “gonzo” enforcement policies. 

The latter combined illegality, incompetence, and gratuitous cruelty in a toxic brew directed at migrants. It particularly targeted those of color, women, and children.

This apoplectic response by the radical right in and of itself should assure Garland that he is finally on the right track with getting unqualified judges and administrators out of EOIR and replacing them with competent judges with reputations as fair-minded experts in due process, human rights, and immigration. Perhaps the curtain is finally beginning to come down on the long-running “clown show” at EOIR!

During the Trump Administration, appointment of former prosecutors as Immigration Judges outnumbered appointments from the ranks of private and academic sector practitioners by approximately nine to one. At first, Garland curiously did little to change that — actually elevating some of his predecessors’ questionably-qualified candidates. Now, this very modest long overdue effort to rid the system of “deadwood” and bring in at least some experts from outside the world of government prosecutors is sending “shockwaves” through “restrictionist world.” Restrictionists ran roughshod over the Immigration Court system during the days of White Nationalist Stephen Miller and his cronies! They obviously hate the idea that the Biden Administration belatedly is acting like the 2020 election actually had consequences!

No immediate  replacement for Short was named by EOIR. Garland must not pass up this opportunity to bring true expertise and dynamic due-process-focused leadership into his broken EOIR court system! It’s up to everyone committed to fairness and due process for all at EOIR to make sure that Garland “gets it right” this time around!

A Top Immigration Court Official Called For Impartiality In A Memo He Sent As He Resigned

A leading immigration court official stepped down Thursday after sending a pointed email to court employees emphasizing the importance of the appearance of impartiality and the benefits of providing protections for people fleeing to the US. The message came on the same day the Trump administration tapped the former top Immigration and Customs Enforcement prosecutor to take his position, a move that outraged immigrant advocates.

The Trump administration selected Tracy Short, previously the lead ICE prosecutor, for the chief immigration judge role. ICE prosecutors often take up roles as immigration judges, but the selection of Short, formerly ICE’s principal legal adviser, left some claiming the move would undercut the appearance of neutrality at the court.

Christopher Santoro, the acting chief immigration judge, appeared to signal that in his message to court employees announcing his resignation.

His resignation and Short’s hiring comes as the Trump administration has undertaken a monumental overhaul of the way immigration judges work: placing quotas on the number of cases they should complete every year, restricting when asylum can be granted, and pouring thousands of previously closed cases back into court dockets. In the meantime, the case backlog has increased and wait times have continued to skyrocket to hundreds of days.

“There will always be those who disagree with a judge’s (or jury’s) decision and our court system is no different,” he wrote in the email on Thursday, which was obtained by BuzzFeed News. “But for the public to trust a court system, for the public to believe that a court is providing fair and equitable treatment under the law, that court system must not only dispense justice impartially but also appear to be impartial. Maintaining the appearance of impartiality and fairness can often be more difficult than being impartial and is a goal each of us – regardless of our role – must strive for every day.”

Santoro, who had himself served as a senior ICE advisor during the Obama administration, said he delivers this message in training to immigration judges and it applied to everyone involved with the court.

“Santoro’s emphasis on impartiality and protecting vulnerable populations is a sharp departure from this administration’s priorities, which have focused around speedy adjudications and reducing the backlog,” said Sarah Pierce, an analyst at the Migration Policy Institute. “Someone who recognizes the dire need for impartiality in this system has to watch a prosecutor lead the charge in his wake.”

Two Department of Justice employees said the decision to tap Short was misguided. The Office of the Chief Immigration Judge “provides overall program direction, articulates policies and procedures, and establishes priorities” for the court.

“His hiring is further confirmation that the Executive Office for Immigration Review leadership wishes EOIR to be a tool for enforcement agencies, focused on removal orders and nothing else,” said one employee, who could not speak publicly on the matter. The employee said that Santoro is “incredibly respected, and, in normal times, he would have been the chief immigration judge.”

Another DOJ employee said that Short’s appointment was “one step closer to the death knell for impartiality at the Immigration Court and more persuasive evidence that our code of American justice and fairness is not being followed at the Department of Justice.”

Ashley Tabaddor, who heads the union that represents immigration judges, said they were sad to hear of Santoro’s departure, adding that he is “a well-respected judge and will be tremendously missed.”

In his email, Santoro praised the immigration court for its work in recent years.

“Despite the many challenges thrown our way – ranging from changing priorities to lapses in appropriations to the temporary loss of our case management system to our million-plus pending caseload – you have risen to meet and exceed expectations each and every time. I have never worked with a finer group of professionals,” Santoro wrote.

He later said that the “nation benefits when we welcome those who bring different skills, perspectives, and experiences, and when we protect those who would be persecuted or tortured in their home country. We also benefit when we ensure that our laws are enforced fairly and consistently.”

Observers of the court — including current and former officials — said the email was eye opening.

“I’m heartened, but not surprised, to see Judge Santoro join the dozens of judges who have resigned from this administration and expressed a deep concern for the due process rights of vulnerable asylum seekers in our immigration court system,” said Rebecca Jamil, a former immigration judge who stepped down due to the administration’s immigration policies. “For a court system to mean anything, the public has to trust that it is fair and unbiased, and the Immigration Court simply does not have that important contract with the current Attorney General. I’m grateful that Judge Santoro reached the same conclusion that I did.”

This is yet another disgraceful incident in three years of unconstitutional bias and failure of due process at EOIR. The competent, scholarly, fair, and impartial are driven out and replaced by unqualified politicos. 

Just heard this statement on TV in connection with yet another racially motivated killing: “We have a morality problem in America!” EOIR has both a competency and a morality problems. When will someone put an end to this unconscionable and deadly nonsense?

As I have said before, Judge Santoro was our Assistant Chief Immigration Judge during some of my time in Arlington. A “straight-up” professional who cared about both public service and the health and welfare of Court employees in very stressful situations.

What a squandering of public funds and goodwill when the competent are pushed out and replaced by those stunningly unqualified to serve in any type of judicial position, let alone one calling for ethical and moral leadership.

The lesson of this case: The DHS intentionally puts superfluous information on its form NTA so it doesn’t make any difference whether they fill it in or not. The BIA is there to “fill in the blanks” and help their DHS buddies rack up maximo removals, preferably without in person hearings because it’s faster and helps fulfill “quotas,” under the Let ‘Em Die in Mexico Program (a/k/a “jokingly” as the “Migrant ‘Protection’ Protocols” (“MPP”) — which, of course, serve to intentionally endanger and discourage, not protect, asylum seekers). 

This follows Matter of J.J. Rodriguez where the BIA found that the DHS wasn’t required to put a usable mailing address for the respondent on the NTA. I can only imagine what would have happened in the Arlington Immigration Court if a respondent had given me “Fairfax County, Virginia, USA” as his one and only address! The former is actually probably a “better” address than “Known Domicile, Tijuana, Baja California, Mexico” which was used in this case. What a farce! But, of course, it’s not very funny when it’s your life, or that of a loved one or client that is going down the tubes☠️.

There actually is an old legal axiom of construing problems against the drafter of a document, particularly when the drafter is in a more powerful position than the recipient. It even has a fancy legal name: Contra proferentem. But, today’s EOIR follows a much simpler maxim: The respondent always loses, particularly in precedent decisions.

I suppose at some point the BIA will be called upon to enter an in absentia removal order in a case where the NTA is blank except for the respondent’s name. I have no doubt, however, that they will be “up to the job.”

To his credit, Judge Edward Kelly entered a brief “concurring opinion” specifically noting that the statutory or constitutional authority for the so-called MPP was not at issue. In plain terms, that means, thanks in large measure to a complicit Supremes’ majority, even if that program, certainly a illegal and unconstitutional hoax, were later found to be unconstitutional, it would be far too late for those already removed, extorted, kidnapped, maimed, tortured, sickened 🤮, or dead ⚰️ thereunder. But, of course, the BIA, like Trump himself, will take no responsibility for any of the deadly fallout of their actions.

Great way to run a government! But, it’s the “New America” under Trump. Most of those in a position to stop the abuse merely shrug their shoulders, look the other way, and plug their ears so as not to have their serenity and complicity, as well as their paychecks, bothered by the screams and fruitless pleas of the abused. Except, of course, for true sadists ☠️ like Stephen Miller and his White Nationalist cronies 🏴‍☠️ who actually “get off” on the death, ⚰️ torture, abuse, and suffering of “others” they believe to be of “inferior stock” and therefore deserving of dehumanization and death⚰️.

Apparently, the “Tower Rumor Mill” @ EOIR HQ says that Acting Chief Immigration Judge Christopher Santoro will soon be replaced by a permanent Chief Immigration Judge hand selected from among DOJ political hacks by none other than one of the American taxpayers’ most highly paid, unelected White Nationalists, White House Advisor Stephen Miller. The name of Gene Hamilton, like Miller an uber restrictionist former sidekick of “Gonzo Apocalypto” Sessions, still kicking around the DOJ, has been bandied about. However, other parts of the “rumor mill” have expressed skepticism about whether Hamilton really wants the job. He might be able to score more “kills” from his current job, whatever it is.

Stay tuned! In the absence of a functioning Congress or a courageous Federal Judiciary, the “killing fields”⚰️⚰️⚰️⚰️⚰️👎 are just getting rolling @ EOIR. Like “Firing Randomly Into a Crowd”

On March 23, a panel of the U.S. Court of Appeals for the Ninth Circuit issued a sua sponte order in a case pending before it, ordering the Petitioner’s immediate release from detention “in light of the rapidly escalating health crisis, which public health authorities predict will especially impact immigration detention centers.”  In taking such action, the court used its authority to protect those under its jurisdiction.This is what judges and courts are supposed to do.

In contrast, the leadership of EOIR, the agency which oversees our nation’s immigration courts, sees its mission quite differently.  With shocking indifference to those subject to its authority, including its own employees as well as members of the public, EOIR’s present leadership seeks only to please its Department of Justice masters, much like a dog rolling over or playing dead to earn a pat on the head from its owner.

As we all began to comprehend the seriousness of the coronavirus pandemic weeks ago, EOIR refused to close immigration courts out of fear of sending a message contrary to Trump’s statements that the health crisis was a “hoax.”  Christopher Santoro, the coward holding the title of Acting Chief Immigration Judge, ordered court staff to remove CDC-issued advisories on ways to help stop the spread (i.e. by not shaking hands) on the grounds that the immigration judges lacked the authority to hang such notices in their own courtrooms.  In defense of his stupidity, Santoro offered the age-old excuse of the weak: that he was only following orders.

As the virus spread, and people began dying, EOIR kept its courts open far longer than it should have.  An ICE attorney who represented the government throughout a crowded Master Calendar hearing in Newark, NJ on March 13 is presently in a coma in intensive care with COVID-19 fighting for his life.  I’ve heard that an immigration judge in one of NYC’s immigration courts is presently ill with COVID-19 and pneumonia.There have been additional reports of others at immigration detention centers testing positive.

As cities locked down and sheltered in place, EOIR finally agreed to postpone non-detained hearings, but only until April 10.  Hearings in detained courts continue to go forward.And for some reason, non-detained courts that were closed and should have remained so were reopened for the filing of documents only, with such openings announced by nighttime tweets.  On Wednesday night, EOIR tweeted that several courts would “open” the next morning, without explaining whether that meant hearings that had previously been announced as postponed would instead go forward the following morning.As this occurred after business hours, there was no one to call for clarification.  In fact, the opening was only to file documents.EOIR’s leadership (for want of a better term) has decided that all court filings due during the court closings are now due on March 30.Many lawyers in NYC have no way to meet this deadline, as their office buildings have been locked in compliance with the state’s shutdown order.

In order to accept these filings, EOIR is forcing court clerical staff to leave the safety of their homes, disobey the state PAUSE directive and expose themselves and their family members to possible infection in order to report to work.  In NYC, traveling to work for most employees requires riding trains and buses, further increasing the risk of exposure.As schools are closed, how those court staff with child care needs will manage in a time requiring social isolation is unknown.

Furthermore, not all judges hearing detained cases are granting continuances despite the crisis.  EOIR has not informed judges that the present crisis exempts them from meeting their performance metrics, which requires all judges to complete 700 cases per year, and to finish 95 percent of cases on the day of their first-scheduled individual hearing.  Newly hired judges, who are on probation for two years, are therefore being forced to choose between their own job security and the health and welfare of all those who appear in their courts.

In recent days, EOIR has been besieged with letters from health care professionals, law professors, and various legal and advocacy organizations containing strong arguments to do what the Ninth Circuit had done instinctively and without having to be asked.  In one of these letters, attorney George Terezakis, writing on behalf of the New York-based Association of Deportation Defense Attorneys (on whose Board of Directors I sit), described how the mother of a detained respondent who traveled from her home in Long Island to the court in Lower Manhattan by commuter train and subway to file a document for her son’s hearing was later diagnosed with the coronavirus.  Terezakis continued: “Just as someone firing randomly into a crowd of Immigration Judges, court staff, attorneys, interpreters and detainees’ family members will foreseeably and inevitably kill someone…keeping the courts open ensures continued, needless infection, serious illness and death…”The letter continued: “This is a real crisis requiring real leadership to take decisive action that will place the safety of those under its jurisdiction ahead of other concerns.  There is no escaping the inevitable consequences of inaction.”

As for Santoro, “I was only following orders” has historically fared poorly as a defense.  Someone whose name is preceded by the title “Chief Immigration Judge” is required to stand up and take appropriate action in a time of crisis, and accept the consequences of such action.  And for those in EOIR’s leadership chain who refuse to do so, it is incumbent on all of us to do everything in our power to ensure that they will be held fully accountable for their inaction under the next administration.

The coronavirus is causing unprecedented disruptions to nearly every area of life, and the Immigration Courts are no exception. The courts were already in a post-apocalyptic era, with over one million cases in the backlog, and now the situation has been thrown into near total chaos. The fundamental problem is that EOIR–the Executive Office for Immigration Review, the office that oversees Immigration Courts and the Board of Immigration Appeals–is determined to continue adjudicating cases, even if that means risking the lives of its own employees; not to mention the lives of respondents, witnesses, and lawyers (and anyone who comes into contact with them).

EOIR is closing and re-opening various courts seemingly at random, often times with an after-hours Tweet, such as one last night at 9:23 PM, declaring that the Newark and Seattle Immigration Courts will reopen today for purposes of accepting filings and litigating detained cases (non-detained cases through April 10, 2020 have been postponed). In reaction to this latest news, Susan G. Roy, an attorney and former Immigration Judge (and my friend from law school – Hi Sue!) wrote last night–

NJ has the second highest number of corona virus cases in the nation, second only to NY. The Newark Immigration Court was closed because someone tested positive for the virus. Now a DHS attorney is fighting for his life in ICU, another attorney is very ill, and an interpreter has tested positive. These are the ones we know about. The Court was set to reopen on April 12. That is a reasonable time to ensure that everyone is safe and that the risk of transmission is limited. How is it even remotely reasonable to decide to open TOMORROW? Even if it is only for filings, court staff and others will be forced to violate the Governor’s Executive Order [directing all residents to stay at home], put themselves at great risk, and risk contaminating others, while many people who work in the same building remain under mandatory quarantine. You are ruthlessly jeopardizing the lives of your own employees, not to mention the public, for no legitimate reason.

 

And it’s not just advocates who are upset about EOIR’s decision-making. The National Association of Immigration Judges (“NAIJ” – the judges’ union) and ICE attorneys are also reacting with anger. In response to EOIR’s tweet reopening the courts in Seattle and Newark, NAIJ responds, “Putting our lives at risk, one Tweet at a time.” And Fanny Behar-Ostrow, an ICE prosecutor and president of AFGE Local 511, says of EOIR: “It’s like insanity has taken over the agency,“

The gravity of keeping courts open is reflected in one incident, described in a recent letter from the Association of Deportation Defense Attorneys in New York–

One of our members recently had a detained master calendar hearing scheduled for this past Friday, March 20, at the Varick St. Court. In order to prepare the bond application and for the master, the attorney and his staff met with the client‘s mother. A request for a bond hearing, together with the required relief applications, and a request for a telephonic hearing, were hand delivered to the Court at noon on Wednesday March 18th, 2020. The attorney did not receive any response to the motion for a telephonic hearing, and repeated calls to the court that day and the next went unanswered. To ensure that the Court was aware of the request, the client‘s mother retrieved from the attorney‘s office, Thursday evening, a letter to the court confirming the request for a telephonic hearing. She traveled to the court in Manhattan, from Long Island, and delivered the letter to the Clerk, and thereafter waited in the waiting area with family members of other detainees and other attorneys who were compelled to appear.

Today we received confirmation the client‘s mother has been diagnosed with COVID–19 virus, through medical testing. Can you imagine the number of people she came into contact with as the result of the decision to keep this court open? In addition to exposing the attorney and office staff, she traveled from her home on Long Island, on the Long Island Railroad, to Penn Station, from there to the subway and ultimately to the Court. Undoubtedly she came into contact with, and exposed, countless numbers of people, who in turn exposed countless others.

Anyone with a basic grasp of the fundamental principles of epidemiology – easily garnered from watching CNN or the local evening news – understands how easily this virus spreads. Given this, the decision to continue to keep the courts open can only be construed as a conscious decision on the part of EOIR to subject our Immigration Judges, court staff, interpreters, DHS attorneys, institutional defenders, members of the private bar, our clients, their families, and all whom they come into contact with, to an unreasonable risk of infection, serious illness and death.

NAIJ echoes this sentiment: “With [New York] the epicenter of the virus, DOJ is failing to protect its employees and the public we serve.”

The appropriate path forward is painfully obvious. EOIR should immediately close all courts for all cases. Staff should work remotely when possible to re-set dates and adjudicate bond decisions (so non-criminal aliens who do not pose a danger to the community can be released from detention). That is the best way to protect everyone involved with the Immigration Court system and the public at large.

Finally, I think it is important to name names. The Director of EOIR is James McHenry. I have never been a fan. Mr. McHenry was profoundly unqualified for his job, having gone from supervising maybe half a dozen people in a prior position to overseeing thousands at EOIR. However, he was politically aligned with the goals of the Trump Administration and he got the job. I have previously described the functioning of the agency during Mr. McHenry’s tenure as maliciousness tempered by incompetence. But these days, it is more like maliciousness exacerbated by incompetence. And in the current crisis, incompetence can be deadly. It’s time for Mr. McHenry and EOIR to do the right thing: Close the courts now.

They thereby essentially gave rogue Federal officials a “license to kill,” at least where the victim was merely an unarmed Mexican teenager. It appears that Barr, McHenry, and others in the “chain of command” are trying out their new “licenses.” They had better hope that J.R. & Co’s “willful blindness” and  unwillingness to stand up for lives and Constitutional rights extend even when American citizen lawyers and court clerks are among the casualties.
  • Not surprisingly, EOIR’s contempt for due process and the lives of asylum seekers, families, children, and other migrants has expanded to include the lives of their own employees and members of the public forced to deal with this godawful, unconstitutional mess.
  • When the reckoning comes, we should not forget the negligent complicity of Congress as well as the Article III Courts for allowing the life-threatening, dysfunctional, unconstitutional mess that EOIR has become continue to operate and to threaten the health, safety, and welfare of all Americans.

I’m repeating myself. I’ve always found Acting Chief Judge Santoro to be an advocate for “good government” and “doing the right thing” for the people he works with and for the public. For a number of years, he was “our” Assistant Chief Judge in Arlington. I enjoyed working with him and found him consistently concerned with the well-being of our employees and the efficient operation of  our court. He also went to great lengths to insure that we were always informed about what was happening, particularly in the (normal) absence of much meaningful communication from “on high.” Even then, though, some areas and directives were “outside his portfolio.”

I’m relatively sure that his “hands are tied” in this situation and that the “strings at EOIR are being pulled” by others above him in the “food chain.” The latter are driven by political and ideological agendas often quite different from the overall public interest and usually have little, if any, demonstrated concern for he the safety and welfare of EOIR’s “captive clientele.” Indeed, the DOJ politicos don’t seem to have much concern for their own employees either, leaving them largely to “twist in the wind” in a time of national crisis.

Dear Director McHenry and Chief Immigration Judge Santoro,

Public access to the immigration courts is vital to the constitutional protections of the respond- ents who appear in court. Pursuant to 8 C.F.R. § 1003.27 the immigration courts are open to the public. Limited exceptions to public access exist under the regulations, for example, to protect witnesses or parties or the public interest (§ 1003.27(b)), in VAWA cases (§ 1003.27(c)), and when there is a protective order (§ 1003.27(d)). Asylum hearings are confidential and are not open to the public unless the asylum applicant consents (8 C.F.R. § 1208.6).

Migrant Protection Protocol “MPP” hearings are routinely conducted in violation of 8 C.F.R. § 1003.27. Observers have been denied access to remote hearing locations where respondents are appearing in “tent courts.” In addition, it was recently announced that some MPP hearings would be heard via video teleconference by immigration judges in the Fort Worth Adjudication Center. For such hearings, public access is entirely restricted, as observers are not allowed in the tent courts or the adjudication centers. As Judge Ashley Tabaddor stated in an interview with CNN, “MPP is rife with issues but by assigning the adjudication centers to the tent courts takes us to a new low where public access to the court are now eliminated.” She further stated, “[t]his is not the way we as judges or courts should function.”

We agree with Judge Tabaddor. On December 5, 2019, a member of our group of former immi- gration judges, Ilyce Shugall, was denied access to the immigration court while attempting to observe an MPP individual calendar hearing. Human Rights First requested permission for the observers to sit in Laredo with the respondents in the tent courts. The request was denied. Ac- cordingly, the observers, including Former Immigration Judge Shugall, who traveled across the country, were required to sit in San Antonio to observe respondents appearing from Laredo via

VTC. Although the individual hearing was an asylum merits hearing, the respondent consented to Former Judge Shugall observing the hearing.

Early in the hearing, Immigration Judge Cynthia Lafuente-Gaona confirmed that the respondent consented to Former Judge Shugall observing, as she was with a delegation from Human Rights First. Subsequently, Judge Lafuente-Gaona asked Former Judge Shugall to step out of the court- room because she was taking notes on her computer and looking at her cell phone. The assistant chief counsel for ICE was taking notes on his computer, but was never asked to cease his note taking. Former Judge Shugall advised she would put both her phone and computer away and take notes on a note pad. Judge Lafuente-Gaona told Former Judge Shugall she “should know better” because she was a former judge. Former Judge Shugall explained that attorneys and ob- servers used computers and phones in her courtroom when she was on the bench and had used her computer and phone in court all week, including in Judge Lafuente-Gaona’s courtroom the prior day. Former Judge Shugall remained in the courtroom and continued her note taking on a note pad. Some time later, a legal fellow from Human Rights First entered the courtroom. Judge Lafuente-Gaona again confirmed with the respondent that he consented to the additional observ- er. While doing so, she told the respondent that the observers were “writing about what he was saying,” which was entirely untrue. Judge Lafuente-Gaona then told the observers that their note taking on note pads was distracting and asked both to leave. After a break, the observers con- firmed with Judge Lafuente-Gaona that she was requiring they remain outside of the courtroom for the remainder of the hearing. She had two male guards escort the two female attorneys out of the courtroom. That same day the legal fellow from Human Rights First was prevented from ob- serving another pro se merits hearing.

Immigration judges preside over individual and master calendar hearings that are rife with dis- tractions. During master calendar hearings, people are constantly entering and leaving the court- room, taking notes, talking, and moving papers. On many dockets, children are crying, crawling on the floors, throwing toys and food, and playing with microphones. In addition, in immigra- tion courtrooms across the country, parties routinely take notes on computers and use cell phones in court. Observers taking notes during a pro se asylum hearing is not inherently distracting. That the judge became distracted because a former immigration judge and an attorney from a human rights organization made her nervous does not justify closing the courtroom.

While the above examples are specific to MPP hearings, issues related to public access to the immigration courts is not exclusively limited to MPP. For example, according to a Daily Beast article, earlier this month a reporter was forced to leave an immigration courtroom in New York.

Very few respondents subject to MPP are represented. There are significant concerns with ac- cess to counsel and due process in MPP proceedings. Allowing observers in court, pursuant to the regulations, is crucial. A judge’s failure to follow the regulations and the constitution should be of great concern to EOIR. It is certainly of paramount concern to this group of former immi- gration judges.

As former immigration judges, we understand that a judge has the right to control the conduct of those attending a hearing, but exercise of that control cannot compromise the parties’ due pro-

cess rights. We request that EOIR investigate this issue and ensure that the public has appropri- ate access to all immigration courts.

Public access is critical to Due Process and Fundamental Fairness in Immigration Court. In the Arlington Immigration Court, we were constantly “under observation” by reporters, Congressional staff, NGOs, students, Senior Executives from DOJ and DHS, Asylum Officers, OIL Attorneys, EOIR Headquarters and BIA staff, ORR staff, and other members of the public. We welcomed it. All of us viewed it as a “teaching opportunity” and a chance to demonstrate “Due Process in action” and to communicate our judicial philosophies and expertise in the law to others. It was an important “public education” opportunity. 

Indeed, when I taught “Refugee Law & Policy” as an Adjunct Professor at Georgetown Law “Court Observation” was a required assignment. The same was true of many of my teaching colleagues at the many law schools in DC and Virginia.

Far from “disruptive” or “distracting,” I found that public observation actually improved everyone’s performance, including my own. Everyone in the courtroom got into “teaching mode,” willing and eager to demonstrate the importance of their roles in the justice system. Counsel on both sides would often remain for a few minutes after the case to discuss their respective roles and how they came to choose immigration law as a career (of course, being careful not to discuss particular case facts).

Indeed, one of the most meaningful items of “feedback” I got from an observer (paraphrased) was: “I expected something much more openly adversarial and hostile. I was surprised by the degree of cooperation, mutual respect, and teamwork by everyone in the courtroom including counsel, the witnesses, the interpreter, and the judge to complete the case in the time allotted and to inform the judge’s decision. Everyone seemed to be working toward a common goal of resolution, even though they had different roles and views on the right outcome.” 

Of course that was then. I’ve been told that most Immigration Courts these days are much more “openly hostile territory” particularly for respondents and their counsel. All the more reason why we need more, rather than less, in person court observation.

Videos start replacing interpreters at immigration court hearings

WASHINGTON — The Trump administration began the process of eliminating in-person interpreters at immigrants’ initial court hearings Wednesday, replacing them with a video advising people of their rights.

Advocates who observed court proceedings said the video was confusing and difficult to understand, and said they feared the new system would not give immigrants a fair shot in cases that decide whether they will be deported.

The new system went into place at immigration courts in New York and Miami, according to multiple sources. Details were sketchy, as the policy was applied only to immigrants who were not represented by lawyers, meaning that in some instances there were no observers in the courtroom.

The immigration court in San Francisco is not among those where the videos are being used in a pilot program, but eventually interpreters are expected to be replaced there as well.

The Chronicle was first to report the new policy, shortly after immigration judges were told about it in June. Some judges have since raised concerns, and their union hopes to negotiate changes with the Justice Department, which runs the courts.

The department says replacing interpreters with videos at initial court appearances will save money. The main purpose of such initial hearings is to inform immigrants of their rights and schedule further proceedings.

After the video is shown, immigrants who want to ask questions of the judge will have no way of doing so unless they have a bilingual attorney on hand. If they don’t, judges will have to try to track down an interpreter who happens to be free or use a telephone interpreting service.

Advocates say the new system is likely to lead to confusion among some immigrants, who might miss their next hearing as a result. Missing a hearing can be grounds for deportation.

Witnesses who were in court in New York on Wednesday said the video was roughly 20 minutes long and featured Christopher Santoro, the principal deputy chief immigration judge of the immigration courts. As he spoke in English, the video was dubbed in Spanish with Spanish subtitles. After the video, immigrants received an 11-page FAQ handout in Spanish.

Joan Racho-Jansen, an organizer with New Sanctuary Coalition, which provides non-attorney volunteers to immigrants, said the video was slickly produced but difficult to understand even for Spanish speakers with whom she watched. She also said it spent considerable time on the immigrants’ right to accept “voluntary departure” from the U.S.

Immigrants in the courtroom “were either asleep or very, very frightened because they were saying things (in the video) that were scary,” Racho-Jansen said. “We had (experienced) volunteers who spoke Spanish and they just kept shaking their heads and felt disturbed by language that was far too confusing for them to understand.”

She said the video was full of “legalese” that would go over the heads of even fluent Spanish speakers — and many Central American immigrants speak indigenous languages and little or no Spanish.

The handout, viewed by The Chronicle, was clear but technical, with a volume of information that could challenge people from rural foreign countries who have no familiarity with courts.

“I asked the interpreters what they thought (of the video), and they said it was very confusing, that the person who was dubbing occasionally couldn’t pronounce or didn’t understand the word they were saying so they said it incorrectly,” Racho-Jansen said.

She said interpreters were present in the New York courtrooms and that judges used them after the video. It’s not clear if the Justice Department scheduled them to be there or if they were in court for other reasons.

The department declined to comment and refused The Chronicle’s request to view the video.

The continuing denigration of Due Process by EOIR is appalling. This time, in addition to the real victims, the migrants who are forced to use this rancid system, EOIR is taking a “cheap shot” at the professional interpreters who have helped the foundering agency keep its head above water for years.

 

Sorry to see Principal Deputy Chief Judge Chris Santoro participating in this scam. Chris is someone I always admired and who was always very helpful and supportive to me during my career.

Where is Congress on this ugly and unnecesasry mess? Certainly, requiring EOIR to conform to Due Process by providing live interpretation ought to be a “bipartisan no-brainer.”

INSIDE EOIR: THE REEMERGENCE OF “THE GREAT SANTORINI” – Could Judge Chris Santoro’s Reputed Takeover Of The Law Library and Training Functions At Headquarters Be Some Good News For A Beleaguered Court System & Its “Customers?”

It’s been a tough year for EOIR, the agency of the U.S. Department of Justice that oversees the U.S. Immigration Court system. (Although, admittedly, probably not as tough for EOIR as for the many individuals forced to count on EOIR for potentially life-saving due process who were short-changed and the often disrespected attorneys representing, or trying to represent, them.)

 

The backlog has continued to mushroom to more than 640,000 cases with no end in sight; new Immigration Judge hiring and courtroom expansion continued to lag; e-filing remains a pipe dream; recently retired former Director and BIA Chair Juan Osuna died suddenly and unexpectedly; and a new Attorney General took office who apparently views the Immigration Courts not as a “real” judiciary charged with acting independently to protect the due process and other legal rights of migrants, but rather as a mere “whistle stop on the DHS deportation express.”

 

But, at least some good news could be in the offing. Reportedly, Judge Christopher A. “The Great Santorini” Santoro, who currently serves as the Acting Chief of Staff for the Acting Director of EOIR, Judge James McHenry, will assume overall responsibility for the BIA’s Law Library (which includes the highly-regarded “Virtual Law Library”) and the Judicial Training Program. Both important functions will be “relocated” to the Office of Policy in the Director’s Office.

 

Judge Santoro served as the Assistant Chief Immigration Judge for the Arlington Immigration Court during some of my tenure there and later went on to be an Acting Deputy Chief Immigration Judge before mysteriously disappearing for a time into the bowels of the EOIR bureaucracy (becoming essentially a “bureaucratic non-person” – off the organizational “depth charts”). He subsequently was “rehabilitated” and reappeared last spring when Acting Director McHenry appointed him Acting Chief of Staff.

 

Judge Santoro has a stellar reputation for hard work, efficiency, sound administration, and creative problem solving. In Arlington, he was viewed as a “trial judges’ judge” who devoted himself to supporting the judges and resolving problems while not interfering with the things that were working.

 

He also provided unprecedented feedback and guidance about what was “really happening at The Tower” – normally a “dark hole” for field judges. During my illness, he, along with my colleagues Judge Roxanne Hladylowicz and Judge Robert Owens, pitched in and handled some of my Master Calendars so they didn’t have to be rescheduled. I always found him to be totally supportive and responsive, as well as a great colleague. He cared deeply about and paid attention to the hard-working and underappreciated court staff. He is known as a manager who in the words of one former employee will likely “put competent people in charge and let them do their jobs.”

 

The Law Library has been under the outstanding leadership of Head Law Librarian Karen L. Drumond dating back to my tenure as BIA Chair (1995-2001). The upgrading of the Law Library, hiring of additional staff, and the creation of the Virtual Law Library were carried out with the encouragement and enthusiastic support of then-Director (and later BIA Member) Anthony C. “Tony” Moscoto. Tony correctly envisioned changing the previously, rather ignored, BIA Law Library into a major research aid for the Immigration Judiciary as well as a help to the public and a repository for certain historical materials about the BIA and EOIR’s history.

 

The Virtual Law Library, in particular, has been widely acclaimed as an important research tool in the world of immigration law. I still use the public version on a regular basis and recommend it to my students and others as a great resource!

 

Assistant Chief Judge Jack Weil has very capably managed the EOIR Judicial Training Program for years. However, despite Judge Weil’s best efforts, training too often fell victim to budget shortages or other bureaucratic impediments. Unfortunately, it has been, quite incorrectly, considered a “low priority” within the bureaucracy.

 

Immigration Judge Training hit bottom this past year when the incoming Administration without explanation cancelled critical in–person nationwide training for Immigrating Judges — the only real CLE and training that most Judges receive during the year. This was notwithstanding the arrival of many newly hired Immigration Judges who have never had a chance to attend a nationwide training conference or, indeed, even to meet the vast majority of their judicial colleagues!

 

I know that Judge Santoro takes legal research, professional excellence, fairness, and training very seriously. Indeed, while at the Office of Chief Immigration Judge he “directed” several “new judge training videos” with an all-star cast including some of our multi-talented former Arlington Judicial Law Clerks.

 

Generally, I interpret bringing the Law Library and Judicial Training functions under the Director’s Office and selecting a “total judicial management pro” like Judge Santoro to lead them as a positive sign for EOIR and the immigration world. Hopefully, the Law Library and Judicial Training will prosper and expand under Judge Santoro’s leadership to meet the challenges of the 21st Century.

 

“Job One” at EOIR is NOT about removing migrants at record paces, denying more asylum applications, or deterring future migrants. No, it’s all about fairness, scholarship, timeliness, respect, teamwork, and delivering Due Process and even-handed justice to some of the most vulnerable individuals in America.

Currently, EOIR is failing to discharge its critical duties to guarantee fairness and due process in the manner one would expect from one of the largest, perhaps the largest, and most important Federal Court systems. Hopefully, Judge Santoro will be part of the solution to the problems facing EOIR and those whose lives and futures depend on it.

INSIDE THE IMMIGRATION COURTS: Principal Deputy Chief Immigration Judge Michael C. McGoings To Retire — Judge Christopher A. Santoro Named Acting Chief Of Staff

Sources in EOIR relate that Principal Deputy Chief Immigration Judge Michael C. McGoings has announced that he will retire at the end of this month. I hired  Judge McGoings as an Assistant Chief Counsel for the “Legacy INS” back in 1987, shortly before I left to go into private practice. He has served in numerous management and executive positions and has been a Deputy Chief Immigration Judge since 2009 and the Principal Deputy Chief Immigration Judge since 2013. Congratulations, thanks for many years of service, and all the best to Judge McGoings in his well-earned retirement.

Meanwhile, Acting EOIR Director Judge James McHenry has announced that he is appointing Judge Christopher A. Santoro as his Acting Chief of Staff. Judge Santoro was the Assistant Chief Immigration Judge with responsibility for the Arlington Immigration Court during part of my tenure there, from 2012 to 2015. He was known for his collegiality, hard work, organizational skills, problem solving ability, and willingness to jump in and actually hear cases in emergency situations. After serving as an Acting Deputy Chief Immigration Judge in 2015 until early 2016, Judge Santoro mysteriously disappeared from view somewhere into the “bowels of the EOIR bureaucracy” becoming essentially a “bureaucratic non-person.” I am pleased to see that he has resurfaced in a position where he can apply his skills to help stabilize a court system that is rapidly spiraling out of control.
