As noted by my Round Table colleague “Sir Jeffrey” Chase, our Round Table has spoken out about the need for a separate Immigration Court system for children:

As you know, our Round Table signed on to a letter of support for proposed legislation to create a Children’s Immigration Court.

[Director Neal’s statement is] a positive administrative development.

Here’s my take:

  1. While progress is always welcome, this statement shrouds the concept of “best interest of the child” (“BIC”) with legal gobbledygook and bureaucratic doublespeak. (P. 3 of Neal Memo under “Legal Standards”).
  2. Here’s what a clear, correct statement on BIC would look like:

BIC, regardless of whether or not presented by a “Child Advocate” or incorporated in a “Best Interests Determination” (“BID”), can be directly relevant to issues of removability. For example, evidence of removability obtained by methods that clearly conflict with the BIC could be found unreliable or the result of “egregious misconduct” for the purposes of determining removability.

The BIC can also be highly relevant to issues of eligibility for relief. For example, a government or society that deprives certain children of all meaningful educational oportunities might well be engaging in persecution.

In addition, in NLPR cancellation cases, the BIC could be persuasive, even determinative, evidence that removal of a parent will result in “exceptional and extremely unusual hardship” to a USC or LPR child or children.

3) Finally, since the EOIR Director is an administrator, not a quasi-judicial official, his or her policies have a distinct “you can take it or leave it” effect in Immigration Court. Therefore ameliorative statements from the Director, no matter how well-intended, are only effective if the BIA is willing and able to insist on and enforce “best practices” on Immigration Judges, preferably through precedent decisions and reassigning cases away from those IJs who show repeated contempt for due process and best practices.

Unfortunately, the current version of the BIA has, as a body, shown neither much sympathy nor concern for the substantive and due process rights of asylum seekers and other immigrants in Immigration Court. Unless and until Garland “cleans house” and appoints a BIA where all Appellate Judges are immigration/human rights experts laser focused on due process and best practices in Immigration Court — and not afraid of enforcing them uniformly in individual cases and incorporating them in binding precedents — the Director’s latest somewhat ameliorative statement is likely to be as toothless in practice as past efforts.

To a large extent, that’s a “nutshell” of why Garland’s Immigration Courts are in dire failure that threatens our entire democracy.

Unfortunately, that we are three years into this Administration and Garland is still bumbling along with a BIA that largely represents the mistakes and shortcomings of his predecessors suggests that waiting for him to “get religion” on the need for expertise, due process, fundamental fairness, and best practices at EOIR will continue to be an exercise in “Waiting for Godot!”

Both parties have doubled down on inhumane border policies, but it’s the GOP that is taking it to new depths in its race to the bottom over who can be more deliberately cruel.

It’s like some kind of grotesque Last Supper: In a publicity photo from last week’s press conference, Texas governor Greg Abbott is seated at the center of a long table surrounded by grim-faced White men, most of them elderly, in various postures of mental agita. Next to them is a large illustration on an easel board titled “Live Test of Attempt to Breach.” It shows a man with an inner tube (presumably an asylum seeker) clinging to a floating red buoy. Hundreds of these buoys Abbott announced, will be deployed on the Rio Grande near the town of Eagle Pass. The barrier will be 1,000 feet long, and its netting will extend underwater, catching anyone who tries to swim under it.

“We don’t want anyone to get hurt,” said Steve McCraw, head of Texas’s Department of Public Safety, at the June 9 press conference. “We want to prevent people from drowning.”

The floating buoy barrier will persuade people not to cross, he said. “This is to deter them from even coming in the water.”

But we already know this isn’t true. Both McCraw and Abbott were parroting the same strategy, known as “prevention through deterrence,” introduced in the mid-1990s during the Clinton administration. It has turned our southern border into a graveyard. After nearly three decades of militarized border buildup that has pushed people into increasingly deadly terrain like the Sonoran Desert, people haven’t stopped coming. But thousands of them have died.

As Todd [Miller] recently wrote in his poignant piece about this deadly strategy, “On the cusp of summer, we can predict like clockwork that hundreds of otherwise healthy people will be dead by summer’s end. It has an aura of premeditated murder.”

These floating barriers, which, according to the manufacturer’s website, can also be reinforced with spikes, will only contribute to an already-skyrocketing death count. Abbott’s latest announcement has already spurred many human rights organizations to sound a warning. Jenn Budd, a former Border Patrol agent and now border human rights activist, along with fellow Texas-based activist Marianna Treviño Wright, released a bilingual video warning migrants of the deadly new policy.

All-in on Fascism

Abbott has long toyed with the idea of running for president. While it increasingly looks less likely that he will, Florida governor Ron DeSantis has already joined the fray. And he’s all-in on fascism. When he’s not treating fellow human beings like FedEx packages, he’s modeling himself after Viktor Orbán, Hungary’s authoritarian leader, and darling of the CPAC circuit. Last week DeSantis released “B-roll” of Florida state troopers surveying the Texas-Mexico border as they participate in Abbott’s Operation Lone Star. I suspect they didn’t include any audio in the B-roll because it would humanize the children and adults waving to the troopers from the Mexican side of the river, detracting from DeSantis’s threatening narrative of an invading army.

DeSantis’s campaign video begins with a Texas DPS officer, who sports an official DPS seal on his tactical face covering, unlocking a tiny metal door surrounded by razor wire. This is next-level border security theater, as comical as it is utterly surreal and tragic. Several other Republican-led states are also, once again, sending troopers and National Guard soldiers to the Texas border—as they did before the 2022 midterm—to wage war against the Biden White House before the election. Unfortunately, it’s border communities and migrants who are caught in the crossfire.

For many years, I’ve documented border theater as it has ebbed and flowed depending on the political tide. But as I’ve been documenting in The Border Chronicle, we’ve reached an altogether different and deadly era of disinformation, with the GOP parroting invasion and great replacement rhetoric, and increasingly dehumanizing people, spurring mass shootings and political violence. This behavior is championed by a growing right-wing media ecosystem which in turn promotes more anti-democratic and extremist behavior.

I quoted Muñoz in a recent article, and wanted to include my full Q&A with him here. As Muñoz warns, the U.S. is in a “dangerous moment” as it approaches the 2024 presidential election.

Yes, “deterrence gimmicks” directed at refugees have a decades-long proven record of failure. You can just look at the efforts of the EU to “bar the door” to refugees from Africa and the Middle
East. 

The boats continue to come, some sink, people drown. But, not surprisingly to those other than the “overprivileged and elitist White power class” like Abbott and DeSantis, desperate individuals forced from their homes are going continue to come — at any cost, even their own health, safety, and sometime lives. 

Most would rather “risk it all” on a shot — even a very long shot — at stability and a real life, rather than facing the certainty of wasting away without hope, freedom, or opportunity and having to watch the same thing happening to younger generations. Some, against all odds, continue to believe that rich, powerfu Western countries like the U.S. will eventually live up to their solemn legal obligations to protect refugees and asylum seekers!

While, as Melissa cogently points out, these inane, yet deadly, gimmicks do kill migrants, they don’t do so at a high enough rate to materially affect the flow. It’s just causing pain, suffering, and sometimes death for their own perverted sake.

Apparently, neo-fascists like Abbott, DeSantis, Trump, and their “role model” Stephen Miller just “get off on” watching others suffer unnecessarily. Bullies and cowards often get a kick out of observing the effects of their handiwork.

Meanwhile, the public money being wasted on these cruel, yet ultimately ineffective stunts (remember former AZ Gov. Ducey’s shipping containers arrayed and then disassembled at government expense), could much, much better be spent on providing representation, organized resettlement, and humanitarian assistance to asylum seekers.

As Melissa says, the GOP’s (and sometimes, unfortunately the Dems’) “uber-enforcement/deterrence gimmicks are “as comical as [they are] utterly surreal and tragic.” It’s time for decent Americans to “just say no” to these horrible folks and their failed and deadly policies of dehumanization and degradation!

The pandemic has reset settled expectations about how we interact in the workplace, and that transformation has hurled the nation’s immigration courts on a technological voyage into the 21st century.

Despite record congressional appropriations over the past few cycles targeted, in part, on technological advances, the court has relied historically on physical files, paper communications and traditional, in-person exchanges.[1]

Although video teleconferencing has been in limited use at the immigration court since the mid-1990s, those hearings were most often in detained settings, relying typically on judges, attorneys, interpreters and legal staff who were physically present in the courthouse.[2]

Not so post-September 2021, when pandemic restraints required the U.S. Department of Justice‘s Executive Office for Immigration Review, or EOIR, home to the immigration court system, to rethink the basics of how we interact.

During the pandemic, with court staff hamstrung for months, struggling to process mountains of court-paper filings, and judges in some jurisdictions unable to hold hearings, EOIR rolled out about 100 specially equipped laptops with digital audio recording applications installed and connected to a commercially available video conferencing application called Cisco Webex.

These so-called DAR laptops enable the parties, the witnesses, the public and even the judge to appear at hearings virtually because the laptops can digitally record the video hearings in the same way as a judge in a courtroom.[3]

This powerful advance was made all the more effective with the introduction of the EOIR Courts and Appeals System, or ECAS, an online tool for filing and maintaining records of proceeding that is now operational throughout the entire immigration court system.[4]

With improvements sure to be made as technological capabilities advance in the years ahead, the OIG has recommended that immigration courts “[c]ontinue the deployment of remote kits to immigration judges to ensure that immigration judges have the equipment necessary to adjudicate hearings efficiently from non-court settings.” This way, judges can more easily assist courts in areas overwhelmed by new cases, and mitigate health- and safety-related court cancelations.

Expansion of the remote judge corps program offers obvious efficiencies, especially if the court is able to speed up and optimize digitization of our backlogged files. Although there are some courts that are reducing reliance on the remote hearing program, as of February that appears to be an anomaly given the overwhelming support nationwide for the program.[14]

With the trial immigration judges poised to adapt and adopt these advances, it will be up to EOIR management to lead the way in determining how quickly and effectively these and other stakeholder-identified challenges can be addressed.

Garland is a disgraceful failure as our nation’s top lawyer; Congress is deadlocked and uninterested in solving immigration and human rights problems; Federal Courts, these days often “stacked” with far-right ideologues, too often look the other way at gross violations of due process, overt racism, misogyny, and bad interpretations as long as it’s “only migrants of color” (“non-persons” in the view of some) and their lawyers whose lives are being trashed. At best, the Circuits provide widely inconsistent review and results — perhaps not quite as bad as EOIR, but still far beyond anything that would be acceptable if migrants were actually treated as “persons” as the Constitution clearly provides.

I receive some desperate anecdotal complaints about the absurdly broken system and unprofessional conduct by some IJs and EOIR officials here at “Courtside.”

Here’s a recent one from a long-time practitioner that more or less sums up Garland and the Biden Administration’s incredibly disreputable mal-administration of EOIR:

Everything at EOIR is such a disgrace. It is now very difficult for me to appear before IJs, as I have complete contempt for the agency. It is so much worse now than when Trump was in charge. But of course, EOIR could care less, and obviously, this IJ could care less as well…

“Much worse now than when Trump was in charge!” Let that sink in folks!

As I’ve said before, “This just isn’t right!” But, we seem to be dealing with three branches of “Government” who have simply turned their collective backs on the Constitution, the rule of law, common sense, and the fundamental obligations of decency that human beings owe to each other. They also deny the truth: That immigrants are and will continue to be an essential part of the fabric of our society. So, many have asked me “What’s the answer?”

Storm the fort “from the inside!” Use your superior knowledge, organizational, and problem solving skills to get on the Immigration Bench and get paid to do things the right way, help force systemic change over time, save some very deserving lives, and help preserve and improve our democracy at the same time. 

One of the few advantages of working in an “out of control” system is this: there isn’t much control. That often motivates sloppy work, corner-cutting, and a “who cares” approach. 

But, it can also motivate and allow those with the skills and moral integrity to “do the right thing,” to put due process first, solve problems (satisfying), and institute “best practices” rather than worst practices in YOUR courtroom, even if only on a case-by-case basis. And, guess what? Things that “work” and efficiently resolve problems in your courtroom do impact the rest of the system! 

Eventually, it can lead to demands to stop doing things the same old wrong and unfair way and start start treating others fairly and with dignity. Surprisingly, despite persistent bureaucratic myths to the contrary, doing things the right way and treating everyone fairly is more efficient than repeating the same old mistakes, based on the same old discredited “deterrence myths,” over and over. Recognizing and timely granting deserving cases is the very best, totally overlooked, way of cutting backlog and forcing the system to be more efficient without stomping on anyone’s rights or humanity!

Sure, the EOIR system only superficially claims to be interested in efficiency. What they really want is the “appearance of efficiency” with the ability to shift blame for problems to the “victims” of their incredibly poor performance! 

But, eventually enough folks in the right places can get the idea that doing things the right way could actually be better for the system than repeating past mistakes and covering up. The latter gets stressful, even for politicos and bureaucrats who have made careers out of avoiding accountability and responsibility. And, there are certainly plenty of those in today’s EOIR and DOJ.

So here are 10 great opportunities to “get on the inside” and start fixing justice in America and the critical “retail level.”

It is REALLY important that great attorneys of all genders and ethnic groups apply for these important positions. EOIR has NEVER been representative of either the communities it serves or the talent and diversity of the private immigration/human rights bar. The “bureaucratic excuse” has been that the “pool” of USG applicants, particularly those from DHS and prosecutorial backgrounds, is always far “superior.” 

I call BS! But, the only way to “prove it wrong” is if “the best and brightest” from the private sectors apply en masse. 

EOIR will NOT improve voluntarily. Over the past two disgraceful years, Garland has proved that “beyond a reasonable doubt.” So, get on the inside and start changing this system to promote impeccable scholarship, due process, fundamental fairness, and best practices from the inside and from “the bottom up!”

Because, waiting for Merrick Garland and his “clueless” crew @ DOJ and EOIR to get the job done for equal justice and racial justice in America will be like “Waiting for Godot.” And, we all know how that turns out.

Glad you wrote this. It has been so hard. I am working 7 days a week and feel like I am losing my mind. Hopefully they start making changes, because how this is currently going is just not sustainable. Many of the Judges are not granting the continuances or making you go to the IH and giving you a hard time about it. Multiple Judges told me a month or even less notice was “plenty of time.” O boy!

Meanwhile, government watchdog groups expressed concerns over two people whose initial conversion requests had since been approved.

One such conversion was that of Carl Risch, whose October conversion request to be the deputy director, the No. 2 job, at the Executive Office for Immigration Review within the Department of Justice (a civil service job), was approved in December. Risch had been an assistant secretary for consular affairs at the State Department, a political job. His new job came with a $10,000 raise.

His is at least the second conversion in the last year to land at the EOIR, which conducts removal and deportation proceedings in immigration courts across the country.

“It’s a red flag when there are multiple people being converted to jobs at a single entity. It really raises an even larger concern,” Stier, of the Partnership for Public Service, said. “The process is supposed to be that a political appointee in no way has a leg up on the competition for a career job, but when you see multiple go to the same agency, you really have to wonder how it can be possible that the best qualified individuals are not once, but multiple times, people who are political appointees.”

Risch did not respond to multiple requests for comment. EOIR spokeswoman Kathryn Mattingly said Risch went through the standard pre-hiring review process with the OPM and that the agency had approved his new position.

So, the folks who saved due process and stood up for the Constitution and racial justice while Judge Garland was enjoying his cushy ivory tower job at the D.C. Circuit over the past four years remain on the outside, twisting in the wind ⚰️ while their clients and colleagues suffer daily abuse in “Garland’s Star Chambers!” Nice touch!

Meanwhile, Garland hands out the big bucks and a hideout for a notoriously unqualified Trump/Miller political hack imported from the DOS. What does Risch know about immigrant justice or court management? Nothing? Oh, but why is that a problem at EOIR?

He occupies what is supposed to be a key senior management position in America’s most dysfunctional “court system” — running a simply astounding 1.3 million (known) case, largely self-created backlog, grinding out sloppy, unprofessional, biased opinions regularly rejected by even conservative Courts of Appeals, setting horrible anti-immigrant precedents and endangering the lives, health, and safety of those who are caught up in EOIR’s continuing White Nationalist cesspool of cruelty, mismanagement, and gross incompetence?

Is it any wonder that immigrant justice and racial justice remain in free-fall under Biden and Garland?

Let’s lay it on the line! By now, Garland should have cancelled all the Trump-era precedents (“day 1 stuff”), cleaned house at EOIR HQ, and transferred the entire BIA to somewhere where they can inflict no more damage on the American legal system!

That would also have sent a powerful  “signal” to the many Immigration Judges who have established “asylum free zones” in Immigration Courts throughout the U.S. over the past two Administrations that there will be a return of due process and fundamental fairness for asylum seekers and other immigrants at EOIR. 

Judges can get with the program, start granting asylum and other protection as the law requires, thereby reducing backlogs the “old fashioned way” — consistent with due process and fundamental fairness. Or, they can ship out and sign up with Stephen Miller’s “Aryian Nation Legal Team” — where it appears that many of them would be more at home.

Garland should have brought in folks already on the payroll like Judges Dana Marks, Noel Brennan, & Amiena Khan, all experts in due process, judicial management, immigration, and human rights laws, all of whom have demonstrated true leadership, consistent courage, and independence throughout their distinguished careers, on at least a temporary basis to start restoring justice, rationality, and order in the Immigration Courts. 

They would already have identified qualified sitting judges who know how to grant asylum to serve as Acting Appellate Judges at the BIA to start turning things around by enforcing due process and issuing precedents that advance, rather than retard, due process, fundamental, fairness, and judicial efficiency. 

Meanwhile, they would be developing legitimate merit selection criteria to recruit and hire as judges practical experts who will fairly and efficiently apply due process and fundamental fairness to all asylum seekers and other respondents, regardless of race, color, or creed. These criteria could be used to recruit and  hire a diverse progressive group of permanent Appellate Judges and Immigration Judges, to determine which “probationary IJs” should be retained, and eventually to re-compete all existing IJ positions to insure a real, diverse, independent, due-process focused, Immigration Judiciary comprised of the “best and brightest” American law has to offer! 

Greg Chen (AILA) and Professor Peter Moskowitz (Cardozo Law) should be on the EOIR payroll implementing their very achievable program for drastically slashing the unnecessary backlog without stomping on anyone’s rights.

IT’S NOT ROCKET SCIENCE! 🚀 — GREG CHEN & PROFESSOR PETER MARKOWITZ CAN CUT THE IMMIGRATION COURT BACKLOG IN HALF IMMEDIATELY WITH NO ADDITIONAL RESOURCES! — And, That’s Just The Beginning! — “Team Garland” Needs To Get The “A-Team” In Place @ EOIR & End The Nonsense, Injustice, & Waste Of “America’s Star Chambers!”

Garland should already have hired Professor Michele Pistone (Villanova Law, VIISTA) to develop quality, due process oriented training programs for everyone at EOIR.

Instead, Garland is bankrolling the current crew of proven incompetents, holdovers, hangers on, and Trump/Miller White Nationalists. In other words, he’s wasting our taxpayer money, destroying the lives and futures of the most vulnerable (and often most deserving) among us, undermining racial and social justice in America, and abusing and endangering the health and safety of members of the NDPA trying to bring some semblance of the rule of law and human decency into our disgustingly dysfunctional Immigration Courts.

Could it get any worse? How? 

Think about this! Neo-Nazi Stephen Miller and his fellow White Nationalists apparently were so impressed with the effective legal work done by courageous immigration/human rights/due process advocates in blocking many parts of his racist authoritarian agenda — basically the New Due Process Army (“NDPA”) and its “Senior Fighting Division” The Round Table of Former Immigration Judges — that they are forming their very own neo-Nazi legal advocacy group to help GOP AGs stymie any attempt by the Biden Administration to promote racial justice, social justice, and immigrant justice. 

Given the rather incompetent (not to mention ethically questionable) performance of many DOJ attorneys during the Trump regime, Garland is going to need all the help he can get to fend off Miller and the GOP. Rather than enlisting members of the NDPA on his team, letting them solve problems, and actively soliciting their support and alliance on litigation, he is turning them into highly motivated opponents!

How dumb and counterproductive is that! Turn your would-be friends into enemies? Sounds like something only a tone-deaf Dem politico could pull off!

I’m not a politico. But, I do understand the necessity in politics, as in almost any field, of being able to distinguish your friends from your enemies. Perhaps, Judge Garland has spent so much time in the ivory tower that he has forgotten how to play the game out here in the real world.

I’ve been hanging around the Washington legal scene for almost 50 years now. In that time, I might have witnessed a more inept start by an Attorney General of either party. But, really, I can’t remember when!

In the style of a wildlife documentary, Cruz captured his experience with the help of professional photographers and shared his recent journey to the US-Mexico border Thursday night on social media, where he aimed to shed light on what Republicans have dubbed a crisis.

Despite his claims that the border situation is a direct result of the Biden administration’s immigration policies, residents in the Rio Grande Valley have said no such crisis exists. In fact, the number of border crossings under the Biden administration largely mirror those under the former Trump administration. Cruz was accompanied by 18 other Republican senators including John Cornyn, Susan Collins and Lindsey Graham.

After claiming he ran into heckling cartel members and saw a dead body floating in the Rio Grande, Cruz was derided by many, including the former congressman Beto O’Rourke who said:  “You’re in a border patrol boat armed with machine guns. The only threat you face is unarmed children and families who are seeking asylum (as well as the occasional heckler).”

Read more at the link about the GOP’s complete farce — while much more courageous individuals, asylum seekers, are forced to risk their lives because the U.S. is incapable of administering our own asylum laws in a fair, responsible, and competent manner. Cruz & co apparently view this as a “photo op.” Actually, it’s a human tragedy for which history will hold Cruz and his racist party largely responsible, even if the voters fail to do so.

The best solution is to hire experts from the private/NGO/academic sectors; build a functioning asylum and refugee system that will process applicants fairly, generously, predictably, and efficiently; reopen legal ports of entry; establish a robust “on site” refugee program for the Northern Triangle; and work with the international community to alleviate the causes of forced migration. Figure out how new arrivals who qualify for legal status can help rebuild our economy moving forward. Develop a humane program for returning those who don’t qualify without endangering their lives, health, and safety.

An absolutely essential part of the solution is a new, “reimagined” EOIR, staffed with real judges who are experts in asylum, human rights, and due process. An EOIR that will “through teamwork and innovation, be the world’s best courts, guaranteeing fairness and due process for all.” Judge Garland, where are you in American justice’s hour of dire need?

Imperfect as our current laws may be, they cover all of the foregoing. What we really need to do is follow our own laws with common sense, humanity, and a sense of urgency!

Hi all:  The lesser asylum regs that were scheduled to take effect tomorrow were just blocked by a TRO and  preliminary injunction granted in D.C. District Court (order to follow). These regs would have required certain respondents to file their I-589s within 15 days of the first Master Calendar hearing, and would have required EOIR to reject any I-589 which left even a single space blank, among other things.

There needs to be a “day of reckoning” for DOJ lawyers who have “carried the water” for the racist kakistocracy @ the regime’s “Ministry of Nativist Propaganda & Crimes Against Humanity” (the Federal agency formerly known as the “Department of Justice”).

Illegal regulations, clogging the Federal Courts with frivolous positions, defending the actions of imposters impersonating Cabinet officers and other officials, inventing pretexts to cover invidious intent, targeting the most vulnerable among us have “real life” consequences.

WASHINGTON — President Donald Trump‘s senior adviser Stephen Miller has fleshed out plans to rev up Trump’s restrictive immigration agenda if he wins re-election next week, offering a stark contrast to the platform of Democratic nominee Joe Biden.

In a 30-minute phone interview Thursday with NBC News, Miller outlined four major priorities: limiting asylum grants, punishing and outlawing so-called sanctuary cities, expanding the so-called travel ban with tougher screening for visa applicants and slapping new limits on work visas.

The objective, he said, is “raising and enhancing the standard for entry” to the United States.

Some of the plans would require legislation. Others could be achieved through executive action, which the Trump administration has relied on heavily in the absence of a major immigration bill.

“In many cases, fixing these problems and restoring some semblance of sanity to our immigration programs does involve regulatory reform,” Miller said. “Congress has delegated a lot of authority. … And that underscores the depth of the choice facing the American people.”

Miller, who serves in a dual role as an adviser in the White House and to Trump’s re-election campaign, stressed that he was speaking about second-term priorities only in his capacity as campaign adviser.

Immigration has been overshadowed by surging coronavirus case numbers and an economy shattered by a nearly yearlong pandemic, but it was central to Trump’s rise to power in the Republican Party, and Miller has been a driving force for the administration’s often controversial policies to crack down on illegal migration and erect hurdles for aspiring legal immigrants.

Miller has spearheaded an immigration policy that critics describe as cruel, racist and antithetical to American values as a nation of immigrants. He scoffs at those claims, insisting that his only priority is to protect the safety and wages of Americans.

And he said he intends to stay on to see the agenda through in a second term if Trump is re-elected.

In the near term, Miller wouldn’t commit to lifting the freeze on new green cards and visas that’s set to expire at the end of the year, saying it would be “entirely contingent” on governmental analysis that factors in the state of the job market.

Asked whether he would support reinstating the controversial “zero tolerance” policy that led to families’ being separated, Miller said the Trump administration is “100 percent committed to a policy of family unity,” but he described the policy as one that would keep families together in immigration detention by changing what is known as the Flores settlement agreement.

Over the past year, the administration has sought to amend the Flores agreement, which says children can’t be held over 20 days in Immigration and Customs Enforcement detention. If it succeeds, immigrant families could be detained indefinitely as they await their day in immigration court.

On Trump’s watch, asylum grants have plummeted. Miller wants to keep it that way. He said a second-term Trump administration would seek to expand “burden-sharing” deals with Honduras, Guatemala and El Salvador that cut off pathways to the U.S. for asylum-seekers.

“The president would like to expand that to include the rest of the world,” Miller said. “And so if you create safe third partners in other continents and other countries and regions, then you have the ability to share the burden of asylum-seekers on a global basis.”

Kids in cages, refugees returned to torture and death, ethnic communities terrorized, lives destroyed, an economy and a society (make no mistake about it, immigrants will be essential to America’s recovery, future prosperity, and competitiveness) in tatters, tens of millions wasted on unnecessary and counterproductive Gulags, walls, and cruel enforcement while the Gruppenfuherer and his fellow human rights criminals remain at large and and an existential threat to our nation and our world!

Also, even Miller couldn’t possibly believe that the Democratic House will pass any part of this racist manifesto. Truth is, Trump failed to pass any meaningful immigration legislation in four years, even when the GOP controlled all the political branches! In fact, Miller’s nativist legislative game-plan “poisoned the well” and was soundly defeated in both Houses of Congress! So, he intends to use Executive misrule, bureaucratic corruption, and a fascism-enabling, racially tone-deaf GOP Supremes’ majority to rule without Congress (as has been the case for the last four years.)

But make no mistake: the real “Reichsplan” here is directed at further institutionalizing racism, spreading hate, and targeting Americans of color. That’s what the regime’s “Dred Scottification” is really about. Reducing or eliminating YOUR Constitutional rights! Immigrants are the “usual suspects.” But, by no means will they be the only victims of Gruppenfuhrer Miller’s White Nationalist, racist, hate extravaganza.

As reported at the link above, The Biden-Harris campaign immediately and forcefully condemned the Gruppenfuhrer’s plans for “ethnic cleansing:”

“We are going to win this election so that people like Stephen Miller don’t get the chance to write more xenophobic policies that dishonor our American values,” Molina said. “Unlike Trump, Vice President Biden knows that immigrants make America stronger and helped build this country.”

America is immigration! It’s our past, present, and future! When we deny those truths, we deny ourselves and betray our own humanity!

Get out the vote for Joe, Kamala, and the Dems! Top to bottom of the ballot! Our lives and the future of American Democracy depend on it! Days before they were to go into effect, a federal court in the Northern District of California issued a national injunction blocking a dramatic fee hike for appliations for naturalized citizenship, permanent residency, asylum, and access to other immigration benefits. The new fees would have made immigration benefits unattainable for many. It would have nearly doubled citizenship from $640 to $1,170; increased lawful permanent residency and related application fees from $1,125 to $2,270; and added a $50 fee for asylum applications (the first time a fee has been assessed for asylum applications). The rule would have also eliminated most fee waivers for immigrants who cannot afford to pay the fees.

 

Judge Jeffrey White ruled that the nonprofit organizations that had challenged the fee increases would be likely to prevail in showing that Wolf’s appointment as Acting Director of the U.S. Department of Homeland Security, without Senate confirmation, violated the rules of succession. As a result, the fees ordered under his stewardship cannot take effect while the litigation progresses. Similar reasoning had been used in a separate lawsuit regarding Ken Cucinelli and his asylum directives.

This is also a great illustration of why, totally contrary to the nonsense GOP party line and folks like GOP-owned Justices Thomas and Gorsuch, the nationwide injunction is an essential tool for achieving justice. According to the GOP’s false dogma, plaintiffs, many pro se, or appearing with pro bono or “low bono” representation, should be required to win their cases before over 650 U.S. District Judges and in 12 Circuits to get effective relief from the Trump regime’s unrelenting war on our Constitution and the rule of law.

 

 

While Trump and his GOP toadies and sycophants spout BS platitudes about “law and order” the truth is simple: This is a party of arrogant, immoral “scofflaws” from top to bottom!

Says it all about Billy the Bigot. His “downward sprint to the finish” has rocketed him past “John the Con” Mitchell and Jeff “Gonzo Apocalypto” Sessions as the most corrupt AG in modern American history. 

That’s, of course, not to minimize or trivialize the crimes committed by either of the other contenders. I suspect we’ll still be unpacking the full extent of Gonzo’s “crimes against humanity” decades from now, as the uglier and uglier truth about this “21st Century Jim Crow” dribbles out a bit at a time

Gee, even the “Afternoon Neighborhood Dog Walking Club” — comprised of neither lawyers nor hard core liberals, can’t understand why Barr, this walking, talking ethics cesspool is 1) still in office; 2) not in jail; and 3) still licensed to practice the law. Here’s hoping that all three of these unfathomable mysteries are resolved favorably to the public interest in the near future! In the meantime, Billy serves as a stark reminder of what’s wrong with legal ethics and our justice system at present.

With all the hard-working, talented, pro bono lawyers out there working overtime to save lives and our democracy, it’s simply a national disgrace and a travesty that unqualified, corrupt, unethical creeps like Billy and Gonzo have been “rewarded” with the an office that is supposed to function as “The People’s Lawyer.”

The Don’s felons and fellow conspirators against America get free passes; meanwhile, Americans of color can’t catch a break from a system loaded against them. Go figure!

Unemployment is in double-digits, renters are scared of eviction notices, aid is stuck, and economic recovery seems to have slowed.

Republicans want Americans to believe that Joe Biden would “demolish” the American dream.

“This election will decide whether we save the American dream,” Trump said while accepting the Republican nomination for president on the final night of the Republican National Convention. “Or whether we allow a socialist agenda to demolish our cherished destiny.”

Speaker after speaker repeated the same message: Trump is the only candidate who can save the American dream, Democrats’ insistence on expanding the social safety net will stymie individuals’ opportunities, and Republicans are the party of dreaming big.

“Let me assure you, socialism doesn’t offer opportunity. Socialism deprives,” Florida Lt. Gov. Jeanette Nuñez said on the second night of the convention. “We can go down a dark road of chaos and government control, or we can choose the path of freedom and opportunity that was paved by those who sacrificed everything to preserve the American dream for future generations.”

But for many working Americans, policies under the Trump administration and Trump’s response to the pandemic have put the American dream further out of reach.

Trump’s message that he’s the savior of the American dream comes as the nation is in the middle of a widespread coronavirus outbreak, which public health experts and a vast majority of Americans say was worsened by Trump’s slow response. Unemployment sits at 10 percent, and the economy’s recovery has slowed over the summer months. Federal aid, which economists say kept upwards of 10 million people out of poverty, has been slashed or cut completely, as Republicans remain reluctant to continue unemployment benefits at the same levels.

Even before the pandemic hit and the economy appeared to be doing fine, Americans were dubious that there was an equality of opportunity afforded to everyone under Trump’s leadership.

In a January Pew Research Center survey, 70% of Americans said the economy was rigged in favor of the wealthy. There are partisan divides in the poll, with Republicans generally seeing the economy under Trump as fairer than Democrats do. But notably, 79% of lower-income Republicans said the wealthy had too much power today, and Democrats and Republicans agreed that small businesses were being overtaken by major corporations.

IMMIGRANTS & THEIR ADVOCATES NEED TO MAKE THEIR VOICES HEARD, NOW!

Truth is, Trump has no plan for reviving the American economy and is firmly opposed to equality. He hopes that the virus will go away or that he can shift the blame for his abject failure to deal with it to someone else (a false narrative already well underway). He has no clue on how to deal with businesses that will never reopen, jobs that no longer exist, industries (e.g., travel, hospitality, education) whose “traditional models” no longer will be economically viable, and workers whose ability to return to former jobs is limited by the long-term effects of COVID. 

What’s the regime’s plan to deal with mental health issues arising from unemployment or loss of loved ones? Beyond berating them for being sick or out of work, Trump and the GOP have no plan! Cut their unemployment, take away their health insurance, promote unsafe and exploitative working conditions, and immunize careless or negligent employers from liability — that’s the Trump/Moscow Mitch plan.

While I’m not a labor economist, I see evidence that the Trump regime’s gross mishandling of the pandemic, it’s glorification of myth over science, its open disdain for workers and their health and safety, and its nativist immigration restrictions will eventually cause a long term shortage of healthcare workers and teachers — essential workers whose lives and expertise are almost daily demeaned and devalued by the Trump regime and the GOP.

What’s Trump’s plan for African-American, Latino, and low-income communities that have been disproportionately affected by COVID and its collateral effects? More police brutality? Terrorism by DHS agents? Forced labor? Starvation? Disenfranchisement? Public assistance cuts? Lousy education? Slash Social Security? Tax cuts for the rich? Dirty air? Polluted water? How will folks living “paycheck to paycheck” (at best) save for retirement? Work till they drop dead to support the Trumps and McConnells of the world and finance more tax breaks for the rich and powerful?

Biden and Harris have an established record of concern for all workers and all communities. They are certainly American worker’s best chance for a better life and a better future!

My observation is that the immigrant and particularly refugee and asylee communities have a disproportionate number of entrepreneurs, businesspeople, innovators, risk takers, and practical problem solvers who have been able to reinvent and often retrain themselves under the most difficult circumstances imaginable with minimal outside assistance. This community, their colleagues, and immigration and human rights advocates need to be working at the highest levels with the Biden/Harris campaign on a plan to reestablish legal immigration (including refugee and asylum programs) as an essential part of the overall plan to create jobs, develop new or improved industries and businesses, and get all Americans back to work in jobs that will be both satisfying and economically viable.

This plan that would include rebuilding, strengthening, and creating new opportunities within our healthcare, safety net, educational, and vocational programs rather than destroying and looting them as Trump and his cronies have done. It’s called “teamwork, innovation, and best practices,” and it’s an anathema to Trump and the GOP —  the party that promotes systemic economic inequality and despises and ridicules expertise and cooperative efforts.

Immigrants of all types and statuses have helped all of us get through the pandemic, notwithstanding the racist abuse heaped on them by Trump, Miller, Wolf, and the GOP. Robust legal immigration is, as it always has been, part of the solution, not (as the Trump/Miller false narrative would have it) part of the problem. 

And, to state the obvious, most of the so-called “undocumented population” in the US, residing (many with families including U.S. citizens or green card holders) working, paying taxes, and otherwise contributing to our society, mindlessly targeted by Trump and GOP nativists, could and should long ago have been integrated into our legal immigration system at some level. 

But, it’s up to the immigration and human rights experts to get into the “inner circles” of the Biden/Harris campaign now, and to place immigration in its rightful place as one of the keys to American equality and prosperity, rather than that being “left on the sidelines” as happened with Obama. 

In many ways, Trump and his fundamentally anti-America policies, as masterminded by neo-Nazi Stephen Miller, are the price we have paid for the Obama Administration’s negligent failure to harness the positive power of immigration and of the notable absence of true immigration/human rights policy experts and advocates from the key positions in his Administration. 

Immigrants and their advocates can’t let history repeat itself! Policy, legislation, administration, and indeed judging are just variants of “advocacy.” In this case “advocacy” of due process, fundamental fairness, human rights, practical problem-solving, and human dignity. That’s something that the GOP right wrecking crew “gets” but to which Dems and liberals sometimes seem willfully oblivious! 

We can’t afford to get it wrong again. And, neither can the Biden/Harris campaign or the American people! The stakes are simply too high!

This November, vote like your life depends on it! Because it does!

Also, immigration and human rights advocates need to make their voices heard by Biden/Harris campaign! Now!
