Lawsuit Seeks to Uncover Secretive Expansion of Judicial Black Sites for Immigration Cases

 

WASHINGTON, DC — Immigration groups filed a lawsuit today in the United States District Court for the District of Columbia against the Executive Office for Immigration Review (EOIR)—which oversees immigration courts—and the General Services Administration (GSA) requesting information on the expansion and creation of immigration adjudication centers, which were established as part of EOIR’s Strategic Caseload Reduction plan designed to accelerate removal proceedings at the expense of due process.

 

The lawsuit—filed by the American Immigration Council, American Immigration Lawyers Association, the Chicago AILA Chapter, and the National Immigrant Justice Center— seeks the disclosure of records on the obscure procedural rules for immigration adjudication centers. The centers are a new initiative created under the Trump administration where immigration judges adjudicate immigration cases from around the country in remote-only settings that are closed to the public.

 

Immigration adjudication centers appear to have been created to address immigration court backlogs, but attorneys and immigrants facing deportation have little instruction on the procedures for appearing before these centers. Immigration lawyers and advocates have expressed concerns after public reports indicate the potential expansion of immigration adjudication centers across the country.

 

The lawsuit challenges EOIR’s failure to disclose information in response to a Freedom of Information Act request submitted in March 2020. EOIR and GSA have failed to disclose critical information about what immigration courts presently exist, immigration court expansion, and contracts governing this expansion.

 

“Immigration lawyers and advocates have an interest in pressing for more transparency in the immigration courts, helping ensure the due process rights of all who appear in court, and providing guidance to the lawyers representing people before these courts,” said Claudia Valenzuela, FOIA senior attorney at the American Immigration Council.

 

“Transparency is essential to a fair day in court. Unfortunately, the secretive creation and expansion of immigration adjudication centers where immigration judges conduct remote-only proceedings in facilities closed to the public demonstrate how opaque an already complex immigration court system has become at the hands of this administration. While the Department of Justice regulations require immigration hearings to generally be open to the public, this administration has imposed significant new barriers to the public’s ability to observe these proceedings and has led to some hearings being conducted in secret, calling into question whether the fundamental elements of due process are being met. We are proud to stand alongside our partners in this effort,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association.

 

“Everyone deserves a fair day in court. The lack of transparency in EOIR operations compromises the integrity of our immigration system and undermines public confidence in this system,” said Nell Barker, chair of the American Immigration Lawyers Association’s Chicago Chapter. “The secretive expansion of immigration courts is a blow to due process and adds a layer of unnecessary unpredictability to a system that struggles to inform stakeholders about changing procedures. We are concerned about the increasing inaccessibility of immigration courtrooms to lawyers, clients, and the public.”

 

“The secretive and inaccessible immigration adjudication centers, where judges determine whether noncitizens will be deported to persecution and torture or permanent family separation, are a disturbing example of the manner in which this administration has developed and expanded numerous policies and procedures intended to expedite the deportation of noncitizens without due process,” said Sarah Thompson, senior litigation attorney at the National Immigrant Justice Center. “EOIR must make public its plan for future adjudication centers and the procedures under which these centers operate.”

After over 7 months, EOIR finally provided the Immigration Judges’ asylum grants and denials for FY 2018 and FY 2019, respectively.

To see the same statistics from FY 2014 to FY 2017, see this previous post. (which took less than 1 month for responsive records)

Of note is the asylum grants and denials for the 6 Immigration Judges who AG William Barr hand-picked for the Board of Immigration Appeals in 2019:

2 of the 6 new BIA members–Hunsucker and Cassidy–denied all their asylum cases in FY 2019.

All 6 of the new BIA members had asylum grant rates of below 10% in FY 2019.

Judge Gorman and Goodwin’s asylum grant rates dropped precipitously in FY 2019–from 14% to 3% and 9% to 3 %, respectively.

The idea that a “court” system is providing “fair and impartial” decisions to  asylum seekers by advancing to important appellate positions biased, obviously unqualified, anti-asylum “jurists”with grant rates that are a small fraction of the already artificially and unethically suppressed “national average” is a total fraud — a grotesque national disgrace rivaled only by the gutless Article III judges who have allowed and encouraged this to happen on their watch!

Somewhat remarkably, after three years of concerted efforts to “zero out” asylum grants, including gimmicks like illegally and unethically rewriting asylum law to screw refugees, denying the statutory and Constitutional right to counsel, using coercive and punitive detention, abusive criminal prosecutions, and family separation to coerce asylum seekers into giving up viable claims, production quotas encouraging rote asylum denials, packing the Immigration Courts with appointees from enforcement backgrounds, and stacking the BIA with anti-asylum zealots, the overall asylum grant rate is still 29%.

That suggests that under a fair and impartial judicial system asylum seekers  could and should succeed in the vast majority of cases. With no material improvements in worldwide refugee-creating conditions, and indeed a record number of refugees fleeing oppression, there is no bona fide explanation for how grant rates would go from 43% in FY 2016 to 29% in FY 2019 without any legislative changes. And, let’s be clear: the 43% in 2016 was already artificially suppressed from 56% in FY 2012. Even the 2012 rate was unrealistically low. A realistic grant rate under a properly generous application of asylum law probably would have been in the 70%-80% range.

The answer is obvious: Government fraud and misfeasance in asylum adjudication on a massive scale, motivated by a White Nationalist, racist, nativist political agenda that clearly violates both the asylum laws and our Constitution. And, this doesn’t even take into account the many asylum seekers artificially denied access to the system at all through the “Let ‘Em Die in Mexico Program,” and ludicrously illegal and fraudulent “Safe Third Country” agreements with patently unsafe and corrupt failed states. 

Yet, while it’s all happening in plain view, indeed touted by Stephen Miller and other racist officials, the Article III Courts of Appeals and the Supremes have taken a dive. They are are allowing the “Second Coming of Jim Crow” to unfold before their eyes, every day, without taking the strong, courageous judicial actions necessary to preserve Due Process and fundamental fairness and to “just say no” to the overt racism driving anti-asylum policies.

Sure, the stock market is up and we’re essentially at full employment. But, that really has little or nothing to do with justice, morality, values, and the rule of law. Eventually, the inevitable economic cycles will turn again. 

With social justice, integrity, the rule of law, and our republic in shambles, how will the Article IIIs and the other cowardly enablers justify their roles and dereliction of their duty to stand up for the rights of the most vulnerable among us? And, who will stand up for them and their rights when the anti-American forces driving Trumpism decide that these toady judges’ complicit role is no longer essential to the planned destruction of American democracy?

In INS v. Cardoza Fonseca, 480 U.S. 421, 452 (1987), Justice Blackmun, in his concurring opinion, cautioned:

“The efforts of these courts stand in stark contrast to — but, it is sad to say, alone cannot make up for — the years of seemingly purposeful blindness by the INS, which only now begins its task of developing the standard entrusted to its care.” INS v. Cardoza-Fonseca, 480 U.S. 421, 452 (1987).

Unfortunately, after years of progress under Administrations with more integrity and intellectual honesty, the interpretation and application of U.S. asylum law is now in, perhaps terminal, regression under this corrupt and intellectually dishonest White Nationalist regime and the kakistocracy it has constructed within the immigration bureaucracy, including the parody of justice and Due Process that takes place daily in the Immigration “Courts.”

Even more tragically, this time around the Supremes and the Article III Circuit Courts, far from being part of the solution and fearless defenders of the rule of law and the rights of vulnerable asylum seekers, have become a key part of the “purposeful blindness” feeding and driving the problem — in effect, “slaughtering the innocents.” By their complicity and fecklessness, they are ripping apart our system of justice and our established constitutional order. I’m sure that Justice Blackmun would be both horrified and outraged by the institutional cowardice and dereliction of duty by his black-robed, life tenured successors.

President Trump told a crowd of staff from the United States Mission to the United Nations on Thursday morning that he wants to know who provided information to a whistle-blowerabout his phone call with the president of Ukraine, saying that whoever did so was “close to a spy” and that “in the old days,” spies were dealt with differently.

The remark stunned people in the audience, according to a person briefed on what took place, who had notes of what the president said. Mr. Trump made the statement several minutes into his remarks before the group of about 50 mission employees and their families at the event intended to honor the mission. At the outset, he condemned the former Vice President Joseph R. Biden Jr.’s role in Ukraine at a time when his son Hunter Biden was on the board of a Ukrainian energy company.

Mr. Trump repeatedly referred to the whistle-blower and condemned the news media reporting on the complaint as “crooked.” He then said the whistle-blower never heard the call in question.

“I want to know who’s the person who gave the whistle-blower the information because that’s close to a spy,” Mr. Trump said. “You know what we used to do in the old days when we were smart with spies and treason, right? We used to handle it a little differently than we do now.”

The complaint, which was made public on Thursday morning, said the whistle-blower obtained information about the call from multiple United States officials.

“Over the past four months, more than half a dozen U.S. officials have informed me of various facts related to this effort,” the complaint stated. It described concerns that the president was using his phone call with the Ukrainian president for personal gain to fulfill a political vendetta.

Some in the crowd laughed, the person briefed on what took place said. The event was closed to reporters, and during his remarks, the president called the news media “scum” in addition to labeling them crooked.

The ambassador to the United Nations, Kelly Knight Craft, was in the room.

A White House spokesman did not immediately respond to a request for comment.

An intelligence whistle-blower law protects intelligence officials from reprisal — like losing their security clearance or being demoted or fired — as long as they follow a certain process for bringing allegations of wrongdoing to the attention of oversight authorities.

The whistle-blower followed that process — filing a complaint with the inspector general for the intelligence community. The Trump Justice Department later proclaimed that the information the whistle-blower put forward did not qualify under the intelligence whistle-blower law, raising the question of whether the official was still protected from reprisal. The acting director of national intelligence, Joseph Maguire, has said he would not permit the official to suffer retaliation, but the inspector general has pointed out that this personal assurance is not a legal shield.

Moreover, whistle-blower laws are aimed at channeling complaints to certain officials with oversight responsibilities — Congress, supervisors or inspectors general — and do not protect officials who provide information to other people without authorization. For that reason, these laws almost certainly do not protect the officials who told the whistle-blower about the call in the first place.

Mr. Trump spoke as the director of the Office of the Director of National Intelligence was testifying before Congress that the president had never asked for the identity of the whistle-blower, whose complaint was initially withheld from Congress by the Trump administration.

At a fund-raiser at Cipriani 42nd Street in Manhattan immediately after the United Nations event, Mr. Trump walked out before the crowd of several hundred donors clutching paper in one of his hands and said, “This is the call.” He then said it was “the greatest thing” to happen to the Republican Party because they had raised so much money off the controversy.

In a Twitter post later in the day, Mr. Trump referred again to the whistle-blower having “second hand information” and called the inquiry “Another Witch Hunt!”

Those of us who have been saying for some time now that Trump’s conduct makes him a “clear and present danger” to the continued existence of our nation have been proved right again. Not, of course, that it means that Trump, with lots of help from the GOP and complicit courts, won’t succeed in destroying American democracy. Democracy is “on the ropes” while Trump is still in office.

What would Thomas More, former Lord High Chancellor of England, say about Trump’s rhetoric? More was famously executed in 1535 for refusing to recognize Henry VIII as the head of the Church in England.

In a time where Trump, Barr, McAleenan, Mulvaney, Pence, Graham, McConnell, Pompeo, the majority of the Supremes, and many others illustrate the complete absence of integrity and ethics in Government, the “Whistleblower” reminds us that there still are are some persons of integrity left in our Government. Sadly, they appear to be an “endangered species.”

Voters have a chance to save our nation by throwing Trump and his GOP scoundrels out of office, at every level, in 2020. Whether they are “up to the task” or not remains to be seen.
