From Education to Everything Else

Felicia Rangel-Samporano and Victor Cavazos founded The Sidewalk School, then a migrant shelter in Mexico. Now they also provide tech-support for a flawed U.S. immigration app.

Since opening, the school has also expanded to the neighboring Mexican border city of Reynosa. Because life in the migrant camps is transitory, The Sidewalk School’s teachers came and went, sometimes within weeks, said Rangel-Samponaro. They decided it would be easier to hire educators from Mexican border communities instead. Residents also understand better how to navigate the complicated dynamics at play in cities like Matamoros and Reynosa, which are riven by cartel-related crime—most recently, the kidnapping of four U.S. citizens in Matamoros, two of whom were shot and killed by cartel gunmen.

The Sidewalk School teaches based on the U.S. school calendar. In February they celebrated Black History Month, for example, she said. They focus on reading, writing, drawing, and play activities. Classes are typically held from 10:00 a.m. to 3:00 p.m. They currently have 10 people on staff in Matamoros and Reynosa. “We need even more staff,” Rangel-Samponaro said. “In both cities.”

Frontline Responders

As elected leaders in both Mexico and the United States fail to acknowledge the seismic shift in global displacement due to climate change, Covid-19, and other factors, migrant camps continue to appear up and down the Mexican border.

Border residents have been frontline responders, adapting to the most pressing needs in the camps, one of which is housing. Recently, The Sidewalk School joined the church group Kaleo International to build a shelter in Reynosa. The shelter houses mostly Haitian and African migrants, who are some of the most vulnerable since they are routinely targeted for kidnapping and persecution in Mexico.

But one of the biggest surprises, said Rangel-Samponaro, is that they now serve as tech support for the CBP One app, which was rolled out in January by the U.S. government for migrants to apply for asylum, as an exemption to Title 42. The app has been plagued with errors. And humanitarian groups have complained that the app, which requires that each person upload a selfie to begin the asylum process, often won’t accept photos of darker-skinned applicants.

Currently, there are thousands of Haitians in both Reynosa and Matamoros, as well as other darker-skinned asylum seekers, who are stuck because they can’t get the app to accept their photos. (The manual on the app, which Sidewalk School employees consult daily is 73 -pages long).

I visited Reynosa and The Sidewalk School in late February and spoke with several Haitian families who had tried to use the CBP One app.

Upgrade to paid

I was quickly surrounded by frustrated parents who said they’d been trying for weeks to make the app work. Living in makeshift shelters made of tarps and cardboard and having little to no access to the internet, parents were waking up at 3:00 a.m. in the morning to find a place with an internet connection, then registering, and trying to take and upload their photo before 8:00 a.m., when the app began accepting daily applications.

“I have an appointment,” one father told me. “But the app won’t accept the photos of my children, so I can’t get appointments for them.”

The app often timed out, crashed, or gave error messages, they said. “It’s a disaster,” one man said, after I asked him to sum up his experience trying to use the app.

“People don’t like hearing it, much less acknowledging what is happening to Black asylum seekers,” Rangel-Samponaro said. “They are stuck inside these encampments for months compared to people of Latin descent, who are at the camps for maybe two weeks or a month.”

I spoke with at least 10 different Haitian families, and they all told me that they’d been living in the migrant camp in Reynosa for at least five months.

“We don’t have enough food,” a Haitian boy told me in Spanish, who said he was 11 years old. “And I have this rash on my face.” He pointed to his cheek. Open sewers and trash littered the area around the camps. And the families, who said they couldn’t work and were struggling to buy food, said they were growing desperate.

So desperate that families were considering splitting up. Rangel-Samponaro  said there had been anguished meetings with parents who were considering sending their children across as unaccompanied minors. If the parents could get appointments through the app, they would reclaim their children once they arrived in the United States. At least that’s what they hoped.

Recently, The Sidewalk School brought in an immigration attorney to explain to parents how difficult it can be to find a child once they have been designated as unaccompanied in the U.S. immigration system. Children are held by CBP, then transferred to a shelter run by the Office of Refugee Resettlement somewhere in the country. “We’ve explained to them that it’s unlikely that they will cross, and their child will be there waiting for them,” she said.

And once people are accepted by the app for an appointment, they are extensively vetted through a series of law enforcement databases, and some are turned back, she said. “Just because you’ve got an appointment doesn’t mean they’re going to let you in to the United States.”

Rangel-Samponaro, like many others who provide humanitarian services in Mexico, is in frequent contact with CBP about problems with the app. In early March, she said, the agency updated the app so that it only requires one member of the family to submit a photo. But there are still not enough appointments for every member of the family, she said, so families are still splitting up and sending their children across as unaccompanied minors.

The Border Chronicle requested a response from CBP about the app. Tammy Melvin, a CBP press officer, replied in an email that the agency “continues to make improvements to the app based on stakeholder feedback.”

She said that “appointments will only be shown if enough slots for each member in the profile is available.”

And Melvin added in the email that they’ve not seen any issues linked to ethnicity. “CBP One is not conducting facial recognition that compares photos submitted in the application against any other reference system to identify someone,” She wrote. “CBP is not seeing any issues with the capture of the liveness photos due to ethnicity.”

Rangel-Samponaro and others disagree. “We’ve invited the app developers to Reynosa and Matamoros to see the problems we’re having firsthand, but they’ve declined to visit,” she said.

Meanwhile, the hardships keep growing for asylum seekers. Recently, the Biden Administration announced, beginning in May after Title 42 is lifted, that asylum seekers must apply for asylum in the first country they enter, rather than at the U.S.-Mexico border.

Rangel-Samponaro said The Sidewalk School is doing everything it can to help, as even more people will likely be stuck in limbo after the policy change in May. They’re providing educational programs, running a shelter, and now providing tech support, and helping people navigate the U.S. government’s glitch-filled app. “I struggle to categorize everything that we do now,” she said.

The first two years were rough going, she said, and she and Cavazos spent their own money to keep The Sidewalk School afloat. Now they’re receiving some grants and donations. But it’s always a struggle, she said. “We need more volunteers, more funding,” she said. “Because the need never stops.”

How’s this for “contrast?” Felicia Rangel-Samporano and Victor Cavazos, private citizens, gave up comfortable lives in the U.S. and invested their own time and money in addressing the needs of children and families essentially “tashed” by lawless inhumane policies of both the Trump and Biden Administrations. Meanwhile, racist, cowardly, bullying Gov. Greg Abbott (R-TX) is leading a clearly unconstitutional effort to deny children in Texas U.S. the public education to which they are entitled under Supreme Court precedent. Have to ask what’s wrong with a state that puts a horrible person like Abbott, who doesn’t even govern very well in emergencies or other areas, in charge? They also enabled Texas Attorney General Ken Paxton (R), another bullying, lawless, coward who is basically the “bottom of the barrel!”

What the major networks and “mainstream”nmedia aren’t telling you:

  • “[E]lected leaders in both Mexico and the United States fail to acknowledge the seismic shift in global displacement due to climate change, Covid-19, and other factors;”
  • “Same old, same old” deterrence and officially-sanctioned cruelty, even in large, expensive, wasteful doses will NOT “solve” refugee flows;
  • The U.S. “system,” such as it is, systematically mistreats Black asylum seekers;
  • “CBP One” is defective technology that should never have been put into operation without testing and approval from the humanitarians actually working in the camps in Mexico;
  • So bad is CBP One that it is encouraging family separation;
  • The “requirement” that every family member obtain a separate appointment through  CBP One is totally insane;
  • Even when asylum applicants get an appointment, it’s still a “crap shoot” because the Administration functions in a lawless, opaque, and arbitrary fashion without the necessary legal and practical expertise and safeguards in place;
  • The very idea that Mexico is a “safe” place to send non-Mexicans rejected at the border, under the totally irrational and illegal “presumption of denial” proposed by the Administration, is beyond preposterous;
  • The Biden Administration has failed to heed the advice of experts who have actually worked on the border and who have constructive ideas for making the law work.

I’m not just getting the above from this article. I have recently had a chance to hear from individuals actually providing legal and humanitarian services at the border who basically said that the situation there is “beyond FUBAR” and that the Administration officials “crafting” border policies are out of touch with reality and not up to their jobs! In some cases, they are just paying no attention to the law or the advice of those who actually understand the system, both in and out of Government. 

That seems exactly what we voted out of office when the Trump kakistocracy was removed. Why, then, does Biden think that ignorance, bias, cruelty, and incompetence on human rights and racial justice is now a “winner?” Why is he aligning himself and his Administration with GOP nativist zealots like Abbott, Paxton, DeSantis, Trump, and Miller, rather than with folks like Rangel-Samporano  and Cavazos who actually represent the humane, practical, problem-solving values that the Dems ran on in 2020?🤯

With human lives at stake every day, one would think that our Government’s massive violations of human rights and cavalier dismissal of legal rights recognized for more than four decades, would be of great interest to the so-called “mainstream media” and that all Democrats would be demanding changes in human rights/immigration leadership (obviously, Mayorkas & Garland are the wrong folks) and a competent, legal, humane approach from the Biden Administration. But, unfortunately, you would be wrong!  Dead wrong, in some cases! ☠️⚰️

The Biden administration and Hill Democrats are expected later this week to release an immigration reform bill, multiple sources familiar with the planning tell NBC News.

The legislative text of the “U.S. Citizenship Act of 2021” will reflect the immigration priorities that President Joe Biden unveiled on his first day in office. His proposal includes an earned pathway to citizenship for 11 million undocumented immigrants, expands the refugee resettlement program and deploys more technology to the Southern border. There are additional protections that are being considered in the legislation, such as asylum processing in home countries for minors, expanded benefits for DREAMers and ending the public charge rule.

While previous attempts at massive immigration reform have failed under both Republican and Democratic administrations, the Biden White House has signaled support for breaking the legislation into pieces.

As a potential secondary path, lawmakers would work to pass bills legalizing farmworkers and Dreamers right away, and then move toward a more expansive overhaul. The main objective, officials and advocates say, is progress.

WASHINGTON — The White House is expected to select Michelle Brané of the Women’s Refugee Commission as the executive director of the task force to reunite migrant families separated by the Trump administration, three sources familiar with the decision tell NBC News.

The selection of Brané, director of migrant rights and justice programs at the Women’s Refugee Commission, is welcome news to the immigration advocate community, as most of the task force is made of government officials.

“If selected, Michelle would be a fantastic choice. She would bring deep expertise on the issues and the perfect mixture of passion and common sense,” said Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project.

WASHINGTON — The Trump White House blocked the Justice Department from making a deal in October 2019 to pay for mental health services for migrant families who had been separated by the Trump administration, two current and two former senior administration officials told NBC News.

Three sources involved in the discussions who requested anonymity said the Office of White House Counsel made the decision to reject the settlement of a federal lawsuit after consultation with senior adviser Stephen Miller, the driving force behind many of President Donald Trump’s immigration policies, including family separations.

“DOJ strongly, and unanimously, supported the settlement, but not all agencies involved were on the same page,” an administration official said. “Ultimately, the settlement was declined at the direction of the White House counsel’s office.”

Another administration official said: “Ultimately, it was Stephen who prevailed. He squashed it.”

The White House’s refusal to accept the deal ended up costing taxpayers $6 million.

WASHINGTON — The poor treatment of migrant children at the hands of U.S. border agents in recent months extends beyond Texas to include allegations of sexual assault and retaliation for protests, according to dozens of accounts by children held in Arizona collected by government case managers and obtained by NBC News.

A 16-year-old Guatemalan boy held in Yuma, Arizona, said he and others in his cell complained about the taste of the water and food they were given. The Customs and Border Protection agents took the mats out of their cell in retaliation, forcing them to sleep on hard concrete.

A 15-year-old girl from Honduras described a large, bearded officer putting his hands inside her bra, pulling down her underwear and groping her as part of what was meant to be a routine pat down in front of other immigrants and officers.

The girl said “she felt embarrassed as the officer was speaking in English to other officers and laughing” during the entire process, according to a report of her account.

A 17-year-old boy from Honduras said officers would scold detained children when they would get close to a window, and would sometimes call them “puto,” an offensive term in Spanish, while they were giving orders.

Earlier reports from investigators for the Department of Homeland Security’s Office of the Inspector General from the El Paso and Rio Grande Valley sectors in Texas detailed horrific conditions for children and other migrants held in overcrowded border stations where they were not given showers, a clean change of clothes or space to sleep. The reports from the Yuma CBP sector describe similar unsanitary and crowded conditions but go further by alleging abuse and other misconduct by CBP officers.

President Trump has pushed back against reports of poor conditions for children, and Kevin McAleenan, acting secretary of DHS, which oversees CBP, has said the reports are “unsubstantiated.”

In a statement about the Yuma allegations, a CBP spokesperson said, “U.S. Customs and Border Protection treats those in our custody with dignity and respect and provides multiple avenues to report any allegations of misconduct. … The allegations do not align with common practice at our facilities and will be fully investigated. It’s important to note that the allegation of sexual assault is already under investigation by the Department of Homeland Security’s Office of Inspector General.”

DHS had been sounding the alarm on overcrowding in border facilities for months, resulting in a $4.5 billion emergency funding bill recently passed by Congress. In Yuma, a soft-sided tent facility was opened at the end of June to accommodate overcrowding at the border station.

But in nearly 30 accounts obtained from “significant incident reports” prepared between April 10 and June 12 by case managers for the Department of Health and Human Services, the department responsible for migrant children after they leave CBP custody, kids who spent time in the Yuma border station repeatedly described poor conditions that are not pure byproducts of overcrowding. They reported being denied a phone call, not being offered a shower, sleeping on concrete or outside with only a Mylar blanket, and feeling hungry before their 9 p.m. dinnertime.

One child reported “sometimes going to bed hungry because dinner was usually served sometime after 9 p.m. and by that time she was already asleep,” according to the documents.

All children who gave accounts to case managers had been held at the border station longer than the 72 hours permitted by law.

Laura Belous, advocacy attorney for a organization that provides legal services to migrant children, the Florence Immigrant & Refugee Rights Project, said her group was “horrified and sickened by the allegations of abuse … But unfortunately, we are not surprised.”

“The children that we represent have reported being held in overcrowded and unsanitary conditions for days,” said Belous.

“Our clients tell us that they have seen CBP agents kick other children awake, that children do not know whether it’s day or night because lights are left on all the time, and that they have had food thrown at them like they were wild animals.

“Our clients and all migrants deserve to be treated with dignity and respect.”

Nearly every child interviewed by the HHS case workers after leaving the Yuma border station reported poor sleeping conditions. A 17-year-old boy from Guatemala reported having to sleep outside even though his clothes were wet from having recently crossed a river, likely the Colorado River.

Once he was transferred inside, the conditions were not much better. “He shared that there was not always space on the floor as there were too many people in the room. He further shared that there would be room available when someone would stand up,” his report stated.

Many migrant children said they were either not given a mattress, pillow or blanket to sleep with, or were just given a Mylar blanket instead.

Other children described being scared of the officers and said the officers would get angry if they asked for anything. One child wore soiled underwear for the 10 days he was in the border station because he was afraid to ask the officers for a clean pair, according to one of the reports. Another, a 15-year-old girl from Guatemala, described the food as “gross and cold most of the time.”

HHS referred NBC News to DHS for comment.

In a statement to NBC News, Rep. Elijah Cummings, D-Md., chairman of the House Committee on Oversight and Reform, said, “These allegations are very concerning and need to be fully investigated. The president has denied any problems with these detention centers — despite multiple confirmed reports to the contrary — but it is the Trump administration’s own policies that have contributed to this humanitarian crisis and this lack of accountability.”

Cummings has called on McAleenan to testify about the poor conditions for immigrants at the border.

Pretty disgusting. Both Trump and McAleenan are proven liars when it comes to denying and covering up cruel and inhuman treatment of detainees. They particularly enjoy targeting women and children. As the reports from throughout the Gulag mount, their denials and obfuscations get more and more outlandish. 

What we as a country are permitting the Trump Administration to do to asylum applicants, particularly families and children, is a stain that will continue to fester and diminish America long after Trump and his toxic toadies are gone from the scene.

Test of steel prototype for border wall showed it could be sawed through

President Donald Trump has repeatedly advocated for a steel slat design for his border wall, which he described as “absolutely critical to border security” in his Oval Office address to the nation Tuesday. But Department of Homeland Security testing of a steel slat prototype proved it could be cut through with a saw, according to a report by DHS.

A photo exclusively obtained by NBC News shows the results of the test after military and Border Patrol personnel were instructed to attempt to destroy the barriers with common tools.

The Trump administration directed the construction of eight steel and concrete prototype walls that were built in Otay Mesa, California, just across the border from Tijuana, Mexico. Trump inspected the prototypes in March 2018. He has now settled on a steel slat, or steel bollard, design for the proposed border barrier additions. Steel bollard fencing has been used under previous administrations.

However, testing by DHS in late 2017 showed all eight prototypes, including the steel slats, were vulnerable to breaching, according to an internal February 2018 U.S. Customs and Border Protection report.

Photos of the breaches were not included in a redacted version of the CBP report, which was first obtained in a Freedom of Information Act Request by San Diego public broadcaster KPBS.

The photo of testing results obtained by NBC News was taken at the testing location along the California-Mexico border, known as “Pogo Row.”

Responding to the picture from the South Lawn of the White House on Thursday morning, Trump claimed “that’s a wall designed by previous administrations.”

While it is true that previous administrations used this design, the prototype was built during his administration.

“It’s very, very hard — the wall that we are doing is very, very hard to penetrate,” Trump said.

NBC News toured the eight wall prototypes twice before President Trump’s March 2018 inspection. According to San Diego Sector Border Patrol Chief Rodney Scott, the versions seen by NBC News and the president, however, were larger than the actual prototypes tested at “Pogo Row.”

In a statement, DHS Spokeswoman Katie Waldman said, “The steel bollard construction is based on the operational requirements of the United States Border Patrol and is a design that has been honed over more than a decade of use. It is an important part of Border Patrol’s impedance and denial capability.”

“While the design currently being constructed was informed by what we learned in the prototypes, it does not replicate those designs,” said Waldman. “The steel bollard design is internally reinforced with materials that require time and multiple industrial tools to breach, thereby providing U.S. Border Patrol agents additional response time to affect a successful law enforcement resolution. In the event that one of the steel bollards becomes damaged, it is quick and cost-effective to repair.

“The professionals on the border know that a wall system is intended not only to prevent entry, it is intended to defer and to increase the amount of time and effort it takes for one to enter so that we can respond with limited border patrol agents. Even a wall that is being breached is a valuable tool in that it allows us to respond to the attempted illegal entry.”

In response to KPBS, CBP spokesman Ralph DeSio said the prototypes “were not and cannot be designed to be indestructible,” but were designed to “impede or deny efforts to scale, breach, or dig under such a barrier, giving agents time to respond.”

In his address to the nation Tuesday, Trump said the steel fence design is “what our professionals at the border want and need. This is just common sense.”

As a candidate, Trump promised to build an “impenetrable, physical, tall, powerful, beautiful” wall on the border that would be paid for by Mexico. Before the Oval Office address, the White House’s Office of Management and Budget sent a letter to Congress requesting $5.7 billion for the construction of 234 miles of steel barrier.

Amid a government shutdown over his border wall proposal, Trump will travel to McAllen, Texas Thursday to make the case for building the additional border barrier.

House Homeland Security Committee Chairman Rep. Bennie Thompson, D.-Miss., said there is “nothing special” about Trump’s wall design.

“President Trump likes to pretend a wall will solve all our problems, but it’s been clear for some time that it is little more than a very expensive vanity project,” said Thompson. “Whether steel or concrete, there is nothing special about his wall and it will not secure our borders. Democrats are willing to work with the administration to improve our border security, but let’s get back to proven and effective solutions.”

One of Trump’s many, many lies is that this is about “border security.” That’s never been a real concern of his. No, it’s all about politics, racist symbolism, power, and vanity. As Chairman Thompson and many others of us have said all along, if we want “border security” there are many smarter and more effective ways to spend $5.9 million, with additional physical barriers playing a relatively minor role.

“Trumps Folly” would take about 10 years to build, do nothing to stop drug smugglers or other criminals, destroy the environment along the border in a number of ways, and have little, if any, long-term impact on extra-legal migration except, perhaps, to raise smuggling fees and kill some more migrants by forcing them to use smugglers employing more dangerous methods or routes. The idea that this is a “national emergency” or that it would be an appropriate response to an ongoing humanitarian situation is simply outlandish, even by Trump’s corrupt standards.

Indeed, Trump’s erratic behavior and inappropriate threats make a strong case that Congress should repeal or severely circumscribe the President’s statutory authority to declare a “national emergency,” and that while they are at it they also should repeal section 212(f) of the INA which was misused to support the bogus Travel Ban (a/k/a “Muslim Ban”).

As others have observed recently, Trump is a walking, talking argument for an end to the “Imperial Presidency” and a return to a more balanced Government where Congress actually lives up to its important Constitutional role.
