WASHINGTON (The Borowitz Report)—Citing “unfortunate economic realities,” Clarence Thomas is hiking the price of Supreme Court decisions to keep up with inflation.

The jurist disclosed his new rate card in a mass e-mail sent to more than a hundred super-donors.

“I have tried to keep my prices reasonable, but, as inflation proves more stubborn than predicted, I have no choice but to adjust my rates accordingly,” he wrote.

“Sadly, the days of shredding civil rights in exchange for ten private-jet flights are over,” he added.

It remains to be seen whether the billionaires who received Thomas’s e-mail will tolerate his steeper prices or whether they will explore a budget option such as Neil Gorsuch.

Predictably, no public hearings were held on the Justice’s sudden rate hike, which blindsided many right wing billionaires with business before the Court! “We believed in good faith that Clarence & Ginni were bought and paid for at least until the end of the upcoming term,” complained one super donor. “I mean, if the guy demands any more private flights to fancy vacation retreats, we’ll probably have to consider buying him his own private jetliner. Perhaps, he should spend at least a little more time in his chambers in D.C. spouting originalism and obstructing justice! After all, that’s what we’re paying him for!”😨**

Unhappily, in the days of GOP mega-corruption, satire has become almost a lost art.

In some ways it was bound to happen. For months the public focus has been on Justice Clarence Thomas. Per excellent reporting by ProPublica, Thomas had secretly accepted myriad unreported gifts from billionaire-with-an-archvillain’s-name Harlan Crow: lavish private flights, luxury trips, years of private tuition for a family member, and money for the sale and renovation of his mother’s home (where she still lives rent free). With all that rotting out in the open, it was naturally time to look at the records and practices of other justices who seem to operate outside ethical rules.

This time in the barrel belongs to Justice Samuel Alito, the author and possible leaker of the Dobbs decision that struck down 50 years of federal abortion rights protections under Roe v. Wade. Like Justice Thomas, Alito has been cozy with his own billionaire, hedge fund owner Paul Singer. According to a new blockbuster report from ProPublica by the same team of reporters who brought us the corrupt tales of Justice Thomas, billionaire Singer flew Alito to Alaska on a private plane for a salmon fishing retreat back in 2008.

These billionaires sure like making friends with Supreme Court justices.

As with Thomas and Crow, Alito never disclosed the trip or his relationship with Singer, even though Singer had many cases that regularly came before the Court for review. This included a doozy in which Alito joined the majority in handing Singer’s company an outcome worth $2.4 billion. More on that below.

This controversy is further unique because Alito, seeking to get out ahead of the story, went to his buddies at the Wall Street Journal Opinions department and got them to publish an OpEd written by him entitled “ProPublica Misleads Its Readers.” It purported to “respond” to the ProPublica report hours before it was published. It is awkward and frankly embarrassing to see a justice opine on something he hasn’t even read, all in the hopes of saving his own petard.

Alito’s stated rationales for why he didn’t report the trip, along with his downplaying of his relationship with Singer, are unconvincing and in many ways ludicrous. More on that below, too. But his words do nothing to change the fact that we now have two sitting justices who are trying to explain away apparent efforts to buy influence with the Court.

As Ronald Reagan once put it, if you’re explaining, you’re losing.

Let’s look at the basic facts uncovered in the ProPublica reporting, and then at Alito’s lame responses in his OpEd. If Chief Justice John Roberts thought the scrutiny and collapsing public faith in the High Court had subsided, he thought wrong.

Alito’s “defense” explained in plain English:

Here’s the deal. I’m only a humble Supreme’s Justice, so I didn’t really understand Federal ethics law. Rather than wasting time getting an opinion from an impartial expert, I looked at what others (defined as “my GOP judicial cronies Clarence Thomas and the late Antonin Scalia”) were doing. I reasonably concluded that since the wine I was served at dinner cost less than $1,000 a bottle, there was no problem.

Moreover, please understand that I hardly knew the guy who offered me the $100,000 trip on his private jet. That’s why I found it necessary to take a vacant seat on his private jet, to keep it from going to waste.

Since that put me in Alaska anyway, I figured why not get in a couple of days of salmon fishing with some GOP fat cat donors while roughing it in $1,000/night rustic accommodations like most Alaskans live in. It put me more in touch with the average billionaire and allowed me to empathize with their dire predicament in a socialist society.

Moreover, I’m a busy guy. How could I possibly know or predict that some of these random billionaires would have business before our Court or would have their financial interests materially affected by our rulings?

Would the “woke crowd” at Pro Publica be raising a stink if I had taken the same trip with homeless folks or asylum applicants being flown to Alaska by Gov. DeSantis or Gov. Abbott. I doubt it! Clearly, the liberal media’s double standard is being applied here.

These outrageous charges against me and GOP billionaires I hardly know are just more proof that under Democrats, America has become hostile territory for billionaires. No “reasonable person” (defined as a “GOP Judge who hobnobs with billionaires they hardly know”) would see an “appearance of impropriety” here!

How many “average American reasonable persons” other than me find themselves harassed by the press just for weekending with random billionaires in Alaska? None! Has there ever been a clearer case of media bullying?

As I always say, ignorance of the law is no excuse when applied to poor criminal defendants or unrepresented immigrants who can’t understand the complexities and illogic of our immigration laws. But, I’m not a criminal defendant nor am I a migrant, who, in my view, isn’t a “person” at all under our Constitution. Let them eat cake or drink $1,000 bottles of wine. Moreover, bad judgement is not a crime nor is it a legal disqualification from being a Justice and continuing to pass final, un-reviewable judgement on others.

Finally, I want to say that I am being persecuted by far left journalists who are threatening to publish facts in an article I’ve not yet read. They gave me a chance to respond in advance, but I stonewalled it in favor of an op-ed that was immediately run by my buddies over at the WSJ editorial board. That’s what any “reasonable person” would do when falsely accused of accepting favors from billionaires they hardly know.

Let’s look at this another way. Immigration Judge X accepts a $100,000 private plane ride and a couple of days of salmon fishing and uber-expensive dinners at an exclusive, $1,000 per night fishing camp in Alaska. Judge X claims that he barely knew the guy who offered him the trip, but merely went to keep an otherwise vacant seat on the private plane from going unused. Judge X was later shocked to learn that his benefactor’s spouse had a removal case pending before Judge X, which Judge X later heard and decided in the spouse’s favor. 

Raise your hand 🙋🏼‍♀️if you think Judge X would still have a job after these facts surfaced! Would Judge X get a chance to “rebut the allegations in advance” in the WSJ?

Think that there is “equal justice for all” in America?

A hallmark of great journalism is that it shines a bright light on information that is in the public’s interest but that powerful forces and actors desperately want to remain hidden.

A perfect example of this came today with a blockbuster investigative report from ProPublica about serious ethical questions concerning Supreme Court Justice Clarence Thomas. 

In a thorough examination of Thomas’s two-decade relationship with billionaire and Republican megadonor Harlan Crow, reporters Joshua Kaplan, Justin Elliott, and Alex Mierjeski detail a series of trips gifted to Thomas and his wife, Ginni, that on the open market would likely have totaled hundreds of thousands of dollars.

None of these were disclosed by Thomas, who likes to portray himself as a man of simple tastes. The report notes that in a recent documentary about his life, Thomas stated, “I prefer the RV parks. I prefer the Walmart parking lots to the beaches and things like that. There’s something normal to me about it.” Let’s just say that none of the trips Thomas took with Crow on his yacht and to his private resort in the Adirondacks resembled a Walmart parking lot.

It is fitting that this news would drop a day after we wrote about the election for the Wisconsin Supreme Court. The reporting on Thomas shows the utter hypocrisy of those on the political right claiming that progressive judges are the ones undermining faith in our judicial system.

Supreme Court Chief Justice John Roberts likes to intone on how much he cares for the integrity of the court. But under his watch, the court’s standing with the public has dropped precipitously. And he need look no further than his ideological counterparts in the court’s right-wing majority.

The damage to the court’s reputation has been manifest in a series of rulings that have made a mockery of the ideas of judicial restraint and precedent. These have overturned Roe v. Wade, emboldened unrestricted gun rights, and undermined our representative government through gerrymandered elections. And that’s just the beginning.

Then there is the personal conduct of the justices, of which Thomas, a hero to the right, is a particularly egregious example. Here he is hobnobbing with rich, powerful interests and not letting anyone know. There he was refusing to recuse himself from a case involving the January 6 insurrection even though his own wife was implicated. It is clear he feels he has no need to defend his actions to anyone. He is completely unaccountable and flaunts it.

Senate Democrats today called for an ethics code for the Supreme Court. But color us skeptical that anything will change anytime soon.

This is a time of great tension in the function (or perhaps more aptly, the dysfunction) of our democracy. It feels as if we have been walking a high wire for years. But the tension still increases. In just the last few days, we have seen a state legislator in North Carolina who had run as a solid Democrat switch parties, giving Republicans a supermajority. In Tennessee, Republicans in the state’s House expelled two Democratic representatives who had joined students in protesting inaction on gun violence. And this on top of what we saw in Wisconsin.

There is also the backdrop of the former president facing numerous strands of legal peril.

There has always been an element of hardball in politics. There have always been public officials who skirted or crossed the lines of ethics and the law. There have always been judges who had dubious connections. Democracy is always precarious.

But there is a sense that now the danger is building. Voters are angry. The will of the majority is being undermined on issues like abortion and gun safety. Power is being accrued for its own sake and not to address the needs of the people.

These are times when we need a fearless press to explain where there is peril and where there is promise around the ability of our nation to regain its footing and thrive. Kudos to ProPublica for its contribution to the health of American democracy.

They worked hard to give “equal (or greater) time” to a unified disingenuous effort by this guy’s supporters to portray him as “the victim!” In perhaps a new “modern journalistic low” they willingly provided a platform for dangerous wacko conspiracy theorist “MTG” to spew forth her vile “sicko-fascist” rantings — with little pushback and no fact checking!

Fortunately, as pointed out by Rather and Kirschner, somebody, in this case Pro Publica, was out there doing serious investigative journalism while their “mainstream” colleagues indulged their fantasies!

Sometimes we write a lot of words on Steady. Today will be an exception. Because for all that there is to say, for all that needs to be said, for all that an accounting for history requires we say, the general sentiments are quite simple:

They knew. They all knew.

It was clear to anyone who had an ounce of appreciation for what the job of the presidency entails, to anyone who respected the constitutional order of our government, to anyone who worried about the health and safety of this nation, to anyone with a moral compass, to anyone who prizes the common sense of purpose that great leaders can summon, that Donald J. Trump had no business anywhere near the presidency.

Now, as he melts down in the face of a serious criminal investigation, as we see pictures of how he stored classified material and his utter disregard for our nation’s most sensitive secrets, as we are left to wonder what he was up to and what damage was done, we should recognize that we would not be where we are today without his enablers, apologists, and hangers-on.

They heralded his outrageousness in a chorus of sycophancy.
They feted his vileness.
They viciously attacked those who pointed out the obvious, that Trump was mentally, emotionally, intellectually, morally, and constitutionally unfit for his office.

And who are they? They are the Republican politicians, the so-called serious ones who expressed their concerns in private even as they used Trump to achieve their desired tax cuts and judges. They are the members of his administration — senior and junior — who jockeyed to maximize their career benefit at the expense of doing the necessary work for the American people. They are the lawyers who twisted themselves into pretzels to try to legalize his inherent lawlessness. They are the media personalities who saw Trump as a printing press for their accrual of wealth and power. They are the capitalists who put corporate earnings ahead of the well-being of the nation.

While Trump’s voters were primed with a toxic stew of hatred, bigotry, and divisiveness, the small cabal playing the inside game didn’t bother with the MAGA hats. They were too busy trading access for favors. The naked self-interest was so rampant that Trump’s West Wing could be considered a nudist colony where decency was shed instead of clothing.

But make no mistake…

In their cowardice, they knew.
In their cynicism, they knew.
In their contempt, they knew.
In their rationalizations, they knew.
In their acquittals of his conduct, even for impeachment, they knew.

They knew when they could have stopped him — before he became president, and once he was president.

But they didn’t stop him. And with their inaction, they encouraged him.

As the Trump bubble begins to pop, all these people who knew what he was all along will likely scurry like cockroaches when the lights go on. They will make all sorts of excuses for their complicity. They will gaslight, lie, and try to rewrite history. You can already see it in many of their so-called tell-all books. Except what they are telling is only the story they want people to hear. It is not the truth.

The truth is that they don’t dare say what we all know. They knew.

The judge overseeing the last two weeks of hearings and testimonies of Omar Ameen’s immigration case has been changed by the Department of Justice, sources close to the case told KCRA 3.

Ameen was the Sacramento refugee accused of being an ISIS leader and killing an Iraqi police officer in 2014.

Earlier this year, a Sacramento federal judge said there were major problems with the case against Ameen and refuse extradition to Iraq.

However, the U.S. Immigration Department took Ameen into custody the day he was released and began proceedings to deport him, claiming he lied on refugee applications.

Sources told KCRA 3 Investigates that immigration Judge Scott Laurent, after weeks of hearings and testimony in the deportation case, is no longer the judge in the case.

The removal comes just two weeks after Laurent issued an order that was, in part, critical of the government’s case against Ameen.

In particular, Laurent was critical of the Department of Justice for wanting FBI agents to testify for the government, but not be cross-examined by Ameen’s attorneys.

Unlike a criminal court, immigration judges work for the Department of Justice, which is the agency looking to deport Ameen.

No reason was immediately provided for Laurent’s removal from the case.

More than 130 federal judges have violated U.S. law and judicial ethics by overseeing court cases involving companies in which they or their family owned stock.

A Wall Street Journal investigation found that judges have improperly failed to disqualify themselves from 685 court cases around the nation since 2010. The jurists were appointed by nearly every president from Lyndon Johnson to Donald Trump.

About two-thirds of federal district judges disclosed holdings of individual stocks, and nearly one of every five who did heard at least one case involving those stocks.

Alerted to the violations by the Journal, 56 of the judges have directed court clerks to notify parties in 329 lawsuits that they should have recused themselves. That means new judges might be assigned, potentially upending rulings.

When judges participated in such cases, about two-thirds of their rulings on motions that were contested came down in favor of their or their family’s financial interests.

This is seriously bad stuff that should never have happened.

Admittedly, Federal conflict of interest rules can be both complicated and annoying. But, complicated legal issues are these judges’ “specialty.” “Ignorance is no excuse” is a common judicial cliche!

Even at EOIR, judges got decent training in these types of ethical requirements, including examples that covered the types of conflicts uncovered by the WSJ; they were fairly rare at EOIR given the subject matter at issue in most cases and the relatively modest financial circumstances of most Immigration Judges, many of whom were career civil servants.

Other types of potential conflicts or “appearance” issues did arise more frequently at EOIR. We were advised “When in doubt, sit it out!”

Obviously, the Administrative Office for U.S. Courts (“AOUSC”) isn’t doing its job here! It appears that using the same public information available to the WSJ reporters, the AOUSC could have not only discovered these conflicts much earlier (perhaps before decisions were rendered) but also set up an automated system for discovering potential conflicts in advance. Jones Day had such a system when I was there three decades ago!

Chief Justice John Roberts must insist that all Article III Judges take their ethical obligations more seriously and that they become thoroughly familiar with the requirements applicable to them. And, he should demand that the AOUSC provide the necessary training and monitor compliance with an automated conflicts identification system!

“Kevelin Danery Espinal-Lagos and her two minor sons were ordered removed to Honduras by an Immigration Judge. While their appeal was pending before the Board of Immigration Appeals, the petitioners filed derivative U visa applications with United States Citizenship and Immigration Services that, if granted, would allow them to move to reopen their removal proceedings. Accordingly, the petitioners filed a motion requesting that the Board remand their case so that they could seek a continuance from the Immigration Judge pending the resolution of their derivative U visa applications. The Board dismissed their appeal and denied their motion to remand, reasoning that their “U-visa eligibility and the steps being taken in pursuit of a U-visa could have been discussed at the hearing before the Immigration Judge entered a decision.” For the narrow ground articulated herein, we hold that the Board abused its discretion in its reason for denying the petitioners’ motion to remand. … Espinal-Lagos did not become prima facie “eligible” for a derivative U visa until her husband filed his U visa application with USCIS on July 6, 2018—several months after her hearing before the IJ on February 7, 2018. Indeed, during oral argument when asked, “When was Ms. Espinal-Lagos eligible for a U visa?”, the Government responded that she was “eligible when it’s filed”—“it” being Bethanco’s U visa application.1 The position the Government urges—that Espinal-Lagos should have disclosed to the IJ her potential future eligibility given the district attorney signature on her husband’s U visa certification— has no basis in the regulations. Therefore, the Board’s denial of Espinal-Lagos’s motion to remand was based on a legally erroneous interpretation of the governing regulations. Navarrete-Lopez, 919 F.3d at 953. The Board’s decision was also irrational because it required Espinal-Lagos to have presented information to the IJ that could not have been discovered or presented at that time. … Because the Board abused its discretion in its single reason for denying Espinal-Lagos’s motion to remand, we grant the petition for review and REMAND to the Board for proceedings consistent with this opinion.”

Although this case is unpublished, it’s significant for these reasons:

  • The “super-conservative” 5th Circuit seldom reverses removal orders;
  • Granting the legally-required remand in this case would have been about a 30-second “adjudication” (tops) by a competent BIA appellate judge;
  • Instead of confessing error and asking for a remand, OIL defended this clearly wrong garbage, a likely violation of ethics, an abuse of the Circuit Court’s time, and dilatory action that took the Fifth Circuit two years to correct;
  • Why would a rational, ethical system even want to remove a family eligible for derivative U status, let along violate the law and make extra work to achieve an irrational, inhumane, and counterproductive result;
  • For Pete’s sake, this was an UNOPPOSED MOTION TO REMAND at the BIA, but incompetent judges, bad lawyering, and a vile anti-immigrant culture at DOJ created an unnecessary disaster;
  • As those of us who are actually familiar with the EOIR system know, mistakes like this are a daily, if not hourly, occurrence at today’s thoroughly dysfunctional EOIR! It’s just that relatively few individuals are fortunate to have the time, knowledge, and competent legal assistance to obtain justice at the Court of Appeals level.

NO, Judge Garland, as all outside experts have been telling you, the answer to largely unnecessary, self-created, out of control EOIR backlogs is NOT “dedicated dockets,” idiotic quotas, more mindless gimmicks, or even throwing more judges into an already out of control and dysfunctional system. 

It starts, but does not end, with replacing the BIA and incompetent judges at EOIR with qualified progressive experts, bringing in dynamic progressive judicial leadership that solves problems rather than creates them, ending the anti-immigrant “culture of denial” at EOIR and DOJ generally, installing real, due-process-focused training and giving new progressive expert judges independence to establish and enforce quality decision-making, due process, and best practices!

Also, OIL needs a remake and some leadership from skilled, progressive immigration litigators committed to “speaking for justice,” using judicial time wisely, and making the system work rather than mindlessly assisting in the building of backlog.

Due process is a team effort! Sadly, after four years of enabling and defending the indefensible actions of the Trump fascist kakistocracy, there aren’t many folks out there at EOIR and DOJ generally who can “play this game.”

BIA screwups on the x’s and o’s of judicial decision-making continue to “burn up the internet.”

Here’s yet another unpublished rebuke from the 2d Cir. on EOIR’s “any reason to deny worst practices” sent in by my colleague “Sir Jeffrey” Chase of Round

We conclude that the BIA and IJ erred by relying on an alleged inconsistency between Tamrakar’s testimony before the IJ that the Maoists threatened him and tried to grab him before he escaped and Tamrakar’s statement during his credible fear interview that the Maoists left after threatening him to support its adverse credibility determination without first raising that discrepancy to Tamrakar. That inconsistency was not “self-evident,” Ming Shi Xue, 439 F.3d at 114, because, during the same credible fear interview, Tamrakar stated that the Maoists “tried to grab [him] but [he] ran away from them.” A.R. at 369. This statement was consistent with his testimony. Because the IJ and BIA “relied on the combined force of [three] inconsistencies,” Singh, 2021 WL 3176764, at *7, and did not provide Tamrakar the opportunity to explain one of them, we “cannot confidently predict whether the agency would adhere to [its] determination absent [its] error[].” Id. at *4. Further lessening our confidence, one of the other inconsistencies that the BIA and IJ relied on (whether Tamrakar’s friend accompanied him during the first incident or not) is closely analogous to one that our Court determined gave “no substantial support” to an adverse credibility finding on its own. Id. at *8 (noting that an inconsistency regarding whether a third party accompanied the petitioner to the police station after a key attack could be explained by differing recollections or another innocent explanation). Because we cannot confidently predict what the agency would do absent error, we vacate its decision.

Unfortunately, chronically sloppy work and wrongful denials have become so “routinized” at EOIR that the Circuits don’t even publish many of them any more! But, there are plenty of them out there!

They are just the “tip of the iceberg” of the systemic unfairness, racially-tinged bias, utter disdain for due process, lack of equal justice, unprofessionalism, glaring lack of expertise, and gross abuse of Government resources taking place in “Garland’s Star Chamber/Clown Courts!” Even one of these these is one too many!

The Human Rights advocacy community needs to organize and demand progressive changes from Garland, starting with long-overdue personnel and leadership changes at EOIR! How many more vulnerable individuals will be wrongfully denied or deported before a “responsible government official” (of which there seems to be as distinct shortage at Garland’s DOJ) pulls the plug 🔌 on this ongoing, intolerable human rights and racial justice farce going on at the DOJ!

Rudy Giuliani has been suspended from practicing law in the state of New York.

Giuliani, a former New York City mayor and the former head prosecutor for the federal Southern District of New York, was suspended for making “false and misleading statements” about the election loss of his client, former President Donald Trump.

In a ruling sought by the Attorney Grievance Committee of the First Judicial Department (a mid-level appellate court in the state), a five judge panel implemented an interim suspension of Giuliani’s law license, pending further AGC proceedings.

The ruling, issued Thursday, takes effect immediately.

“There is uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020,” the court wrote in its decision.

“These false statements were made to improperly bolster respondent’s narrative that due to widespread voter fraud, victory in the 2020 United States presidential election was stolen from his client. We conclude that respondent’s conduct immediately threatens the public interest and warrants interim suspension from the practice of law.”

Visavakumar Thamotar, a Sri Lankan citizen of Tamil ethnicity, seeks review of the Board of Immigration Appeals’ (“BIA”) order affirming an Immigration Judge’s discretionary denial of his application for asylum and grant of withholding of removal. Mr. Thamotar argues that because removal was withheld, federal regulation 8 C.F.R. § 1208.16(e)1 required reconsideration of his asylum claim, which the Immigration Judge and BIA failed to give. We agree with Mr. Thamotar that the agency failed to conduct the proper reconsideration. When an asylum applicant is denied asylum but granted withholding of removal, 8 C.F.R.

§ 1208.16(e) requires reconsideration anew of the discretionary denial of asylum, including addressing reasonable alternatives available to the petitioner for family reunification.2 And where the Immigration Judge has failed to do so, the BIA must remand for the Immigration Judge to conduct the required reconsideration.

Here, the Immigration Judge failed to reconsider Mr. Thamotar’s asylum claim under § 1208.16(e). The BIA’s failure to remand on this issue was therefore

manifestly contrary to law and an abuse of discretion. It is clear that neither the Immigration Judge nor the BIA conducted the proper reconsideration because the record contained no information about Mr. Thamotar’s ability to reunite with his family, information that the agency must review under § 1208.16(e). Thus, the BIA should have remanded the case for further factfinding. We grant the petition, vacate the BIA’s order, and remand to the BIA with instructions to remand to the Immigration Judge for reconsideration of the discretionary denial of asylum.

Lots of work for a bogus asylum denial by EOIR! And the utter nonsense isn’t over! Just a “remand” to give EOIR  yet another chance to deny for specious reasons (as they have already done twice). This  idiocy will continue until Judge Garland replaces the BIA with real judges who will properly, fairly, and timely apply the law and regulations! 

The poor analysis of the IJ, mindlessly affirmed by the BIA, failed to come anywhere close to the “most egregious adverse factors” requirement of the BIA’s own precedent in Matter of Kasinga, 21 I&N Dec. 357, 367 (BIA 1996):

A grant of asylum to an eligible applicant is discretionary. The final issue is whether the applicant merits a favorable exercise of discretion. The danger of persecution will outweigh all but the most egregious adverse factors. Matter of Pula, 19 I&N Dec. 467, 474 (BIA 1987). 

Get this, folks! The IJ and the BIA both found that meeting the higher standard for withholding of deportation based on probability of persecution somehow was an “adverse factor” that outweighed family separation! That’s right, an “adverse factor!”  

I can’t imagine how this gang of so-called “judges, got through law school and admitted to the bar! Maybe “imposters” took their exams for them! THIS is the best American justice has to offer? If not, why are they making life or death decisions and imposing potential permanent family separation on refugees?

Notwithstanding the assembly line climate and lackadaisical approach to law in Garland’s Immigration “Courts,” these are NOT TRAFFIC COURTS! They are more like “death penalty courts” or “courts of last resort” and those humans appearing before them and their representatives deserve better. 

Judge Garland and his team should hypothesize that this type of inferior justice were being meted out in life or death cases to THEIR FAMILY MEMBERS AND LOVED ONES — actual human beings, NOT “just migrants” who, according to Garland’s EOIR, appear to exist in a twilight zone beneath the rest of humanity. That’s what the ongoing “Dred Scottification of the other” still being permitted and  promoted by Garland at DOJ is all about!

A fitting celebration of the first Federal Juneteenth Holiday would have been to remove the entire BIA so that they can no longer inflict “Dred Scottification” on migrants of color, their families, their friends, and their communities, among others! Symbolism is only effective if followed by action. And, so far, Garland’s actions on wiping out the “vestiges of Dred Scott at Justice” have fallen woefully short!

This raises serious, unaddressed questions of why such weakly qualified individuals are on the bench in the first place when there are many immigration experts out there who can and would do better. Much better! And it wouldn’t take them years and multiple hearings, appeals, and trips to the Circuit to grant asylum. 

This isn’t a “deep” case except that it represents the “deep dodo” 💩 at EOIR, the stench of which is fouling our entire justice system and shaking the foundations of our democracy! This case is about following the Code of Federal Regulations, properly applying precedent, and fairly treating asylum seekers. It’s “Law 101” — things L-1s would have to know to get to L-2! I can’t begin to think what the paper would look like like if one of my students gave me this kind of garbage on a final exam. Fortunately, to date, nobody ever has!

Nor is this a Circuit renowned for critical analysis or holding the Government to a high standards in immigration cases. Indeed, the Eleventh Circuit itself bears some responsibility for this mess! They are well aware of the anti-asylum bias and poor decision-making emanating from the Atlanta Immigration Court, within their jurisdiction, and have chosen to ignore it. It’s a “comedy” of errors, questionable ethics, and amateurish legal work that the DOJ should be ashamed of and which Garland should end — NOW! No wonder this ridiculous national embarrassment has created an unnecessary 1.3 million case backlog that continues to grow under Garland! 

Don’t let Garland or anyone else in the Administration tell you that this self-created backlog justifies a truncation of due process or more “bogus attempts to expedite” asylum cases. NO! What it requires is for Garland to bring in real judges and experts from the private/NGO sector to fix the Immigration Courts so they comply with due process and fundamental fairness!

Judge Garland, “come on man!” These deadly robed clowns and their “defenders” represent YOU — “the top legal officer in our Executive Branch!” YOU have a responsibility to the American people (NOT just the failed DOJ or the President) to “get out the big hook” and “yank” these anti-due process, anti-immigrant, anti-asylum, anti-racial-justice clowns 🤡 off YOUR bench and replace them with competence and fairness. A little (now missing) diversity wouldn’t hurt either! It’s called fulfilling the promises made by Biden and Harris during the election!

It’s not going to improve until Garland replaces the BIA with qualified judges, hires only Immigration Judges who know how to fairly adjudicate asylum cases, (with outstanding public reputations for fairness, scholarship, timeliness, teamwork, and respect), and AAG Vanita Gupta brings in better leadership at OIL to put an end to this tragic, totally unnecessary, disgracefully wasteful abuse of our Federal Judicial system and the resulting human carnage! 

NDPA warriors, don’t be fooled or lured into complacency by this week’s long overdue positive developments in A-B- and L-E-A- — things that experts said should have been done by Judge Garland on “Day 1.” Keep showing your total dis-satisfaction and disgust with the glacial pace of reform at DOJ and the myriad of highly unqualified “judges” still being allowed to continue to inflict racial injustice and “worst imaginable practices” on vulnerable individuals (and their lawyers) who are entitled to due process and justice — not a continuing deadly ☠️ clown 🤡 show! A watchdog group has filed a brief opposing the Justice Department’s push to keep secret former Attorney General William Barr’s memo concerning ex-President Donald Trump’s possible obstruction of the investigation into Russia’s interference in the 2016 election.

“The DOJ must produce the document, clean up the department, and show that it will not be used for the personal protection of any president,” the Citizens for Responsibility and Ethics in Washington said in a statement Friday after it filed the brief. CREW initially sought release of the memo through the Freedom of Information Act.

At issue is Barr’s decision to ignore any obstruction of justice issues concerning Trump despite strong evidence against him revealed by then-special counsel Robert Mueller. Critics said Barr misled the public by cherry-picking quotes from Mueller’s report to protect Trump. They accused him of making a political decision rather than a legal one.

Barr claimed that justification for the lack of any action against Trump was carefully considered and spelled out in the memo, which had previously only been made public in a highly redacted form.

But according to U.S. District Judge Amy Berman Jackson, who ordered the release of the nine-page memo earlier this month, Barr’s decision was a foregone conclusion. Barr had already made up his mind not to prosecute Trump before considering any of the advice or analysis that he claimed informed his decision, she said in her order.

Jackson added that the memo contained “strategic, as opposed to legal, advice” and that both the writers and the recipients already had a mutual understanding about what the prosecutorial decision would be.

A “review of the document reveals that the Attorney General was not engaged in making a decision about whether the President should be charged with obstruction of justice; the fact that he would not be prosecuted was a given,” the judge wrote in the order.

If Team Garland has a plan to “clean up the Department,” as advocated by Citizens for Responsibility and Ethics in Washington in their brief, they are certainly keeping THAT a secret.

Nowhere has Garland’s failure to be the long awaited “Mr.Clean” been more notable and harmful to good governance than at EOIR. There, he has inexplicably continued to unconstitutionally promote a charade of a  “court” system that lacks fair and impartial judges. Rather than bringing in the necessary expert progressive reformers from the NDPA to clean up the mess, restore due process, create quasi-judicial independence, and institute best practices, the dysfunction continues to get worse, progressive advocacy groups (who helped put Biden/Harris in office) are totally outraged and frustrated, the “same old, same old” deficient recruitment and hiring practices remain in effect, and the totally dysfunctional bureaucratic structure, comprised largely of Trump holdovers and bureaucrats, maintains its “death spiral.”⚰️

[Above] please find a redacted email obtained through a FOIA request by private attorney Matthew Hoppock. It is a private email between Kent Frederick, the ICE District Counsel in Philadelphia, and Jack Weil, who at the time was the Philadelphia court’s ACIJ.  Although the first part of the email is redacted, in the second part, the ICE District Counsel provides Jack with the basis that led to removing Castro-Tum from the case’s proper IJ, Steve Morley.

It should be noted that this is not a motion with service on opposing counsel; this is a private email between ICE and the ACIJ about the handling of a particular case.

While the Chief Immigration Judge should be taking steps to prohibit these types of communications, it bears noting that the present Chief Immigration Judge is the former Atlanta ICE District Counsel.

Thanks to NDPA warrior Matthew Hoppock for once again having the perseverance to use the FOIA to document and “out” misconduct @ DOJ, EOIR, and DHS! What’s the purpose of an “appeals process” if DHS can just raise its dis-satisfaction with legal issues to their “partners” in EOIR “administration” and ask them to take action? For the record, Judge Morley eventually was removed from the case and replaced with an Assistant Chief Immigration Judge who carried out Sessions’s wishes.

I think this is EXACTLY the type of misconduct that “Gonzo” Sessions intended to promote when he unethically exhorted “his judges” to “partner with DHS” to deny due process, target refugee women for abuse, torture, and death, and speed up removals. (However, because Sessions’s undeniable maliciousness was accompanied by mind-boggling and resource squandering incompetence, the overall result was to exponentially increase backlogs while institutionalizing injustice, unethically endangering the lives of migrants, and falsely smearing the professional reputations of their attorneys.)

Sessions, unethically acting as a “quasi-judicial official,” in violation of every ethical rule of judicial disqualification for overt bias, prejudgement, lack of impartiality (every case in which “Gonzo” Sessions participated is a grotesque violation of this — a man whose overt racism once led HIS OWN PARTY to find him unqualified for a Federal Judgeship!), appearance of conflict, and actual conflict of interest, unleashed a torrent of gross unethical behavior at DOJ and DHS. But, there were plenty of lawyers already “on the payroll” who were perfectly happy to engage in unethical conduct in support of the Trump kakistocracy’s White Nationalist, racist, xenophobic, misogynist agenda.

I’ll let the various comments I have received speak for themselves:

When I was an IJ . . . I complained about this practice to Chief IJ Creppy at an open forum at the IJ conference involving an ex parte complaint Frederick had lodged against . . . . Creppy just brushed it off as interagency cooperation.

Jack has been nothing but a profound disappointment.  I’m sure you all remember his arrogant and almost insane boast that he. could teach constitutional law to a child respondent. This email is both unethical and stupid: what kind of intellect allows for this response to him to put in writing?  I never expect much from an ICE official, but I am always go smacked when a judge acts like a Watergate miscreant.

The conduct of “Gonzo” Sessions, then-Director McHenry (still on the EOIR payroll, although thankfully removed from participation in the Immigration Courts), and the EOIR and DOJ officials involved in this sorry incident is reprehensible.

BUT, HERE’S THE REAL PROBLEM:  AG Merrick Garland, a respected Article III Judge and one-time Supreme Court nominee, was appointed by President Biden supposedly to clean up the ungodly mess at Justice left by the Trump kakistocracy. He isn’t getting the job done! Not even close!

EOIR requires immediate due process reforms, competent administration, a complete “housecleaning,” and, most of all, progressive leadership by “practical scholars.” 

Yet, after three months in office Garland has nary lifted a finger to institute even rudimentary progressive reforms to restore due process at EOIR. Things are just as bad in our disgracefully dysfunctional Immigration Courts as they were on Jan. 20, 2021, in some cases even worse!

Beyond this indolence, Garland outrageously affirmatively appointed 17 non-expert, non-diverse, non-progressive “judges” who were recruited and hand-picked by Billy Barr. Along with Gonzo Sessions, Barr is one of the most unethical, unqualified, un-indicted (yet) AGs in American history. Garland’s lack of awareness, absence of immigration expertise, disrespect for progressive “practical scholars,” and trashing of humane values is super-damaging to our nation!

Of course, nobody can be an “expert” in every legal subject. But, the job of an effective leader is to pick folks who are experts to manage and staff these areas. I don’t see that type of expertise at today’s DOJ or EOIR Headquarters (although there are some well-qualified progressive Immigration Judges on local courts who could have been immediately detailed to EOIR HQ to stabilize the out of control situation).

Garland presides over a massive, deadly, systemic failure and chaotic “Clown Show” 🤡 @ EOIR that threatens the entire U.S. Justice system. I’ve actually known excellent Immigration Judges who have been suspended, docked pay, or threatened with removal for ex parte communications far, far, far less serious than that described above.

How do we teach ethics to an upcoming generation of lawyers when AG Garland and his senior managers are unwilling to hold accountable those who participated in the Trump White Nationalist kakistocracy @ Justice? 

Team Garland daily mocks justice by not instituting standards that require demonstrated subject matter expertise, unswerving commitment to due process, fundamental fairness, and a record of ethical behavior from those appointed to, and continuing to serve in, Immigration Judgeships. 

Under Garland, EOIR is a life threatening, democracy destroying “disaster zone.” “Team Garland’s” inexcusable failure to appoint qualified progressive experts and to undertake the “no brainer” immediate reforms essential to get the EOIR system back on track has, sadly, become a major problem for the Biden Administration and our nation. 

It’s all so unnecessary, so aggravating, so damaging to humanity and American democracy. It’s even worse because the “complicit culprits” are folks (Biden appointees) who were “supposed to know better” and had the incredible, unprecedented advantages of potentially drawing on years of exceptionally high quality research, overwhelming documentation, smart, creative, practical recommendations, and extraordinarily qualified progressive “practical scholars and advocates” ready to solve problems from “inside Government.” 

But, they can’t solve the problems solely “from the outside.” It takes an unrelenting combination of progressive experts pushing from the outside and receptive progressive judges and officials on the inside to make the radical changes necessary to save our nation!

Garland’s disrespectful, indolent, and tone deaf treatment of migrants, progressives, and simple human dignity, as well as his gross misunderstanding and diminution of what continues to drive racial and social injustice in America, will certainly come back to haunt the Biden Administration!

Let me reiterate: There will be neither racial justice nor social justice in America as long as our Immigration Courts operate as White Nationalist enforcers of “Dred Scottification of the other.” Immigration/human rights are where “the rubber meets the road” for racial and social justice in America! Immigrants’ rights are human rights, are civil rights, are constitutional rights! As MLK, Jr., said “Injustice anywhere is a threat to justice everywhere!”

What remains of Bill Barr’s sullied reputation was blown up when federal district Judge Amy Berman Jackson ruled that the government must turn over the memorandum, which the public has yet to fully see and that the Justice Department relied upon in declining to prosecute the 45th president.

Not only was Barr being personally “disingenuous” by announcing his decision before the Mueller report was released and pretending he used the report to reach a conclusion instead of simply announcing the one he’d come to beforethe special counsel’s work had even finished his work, she wrote, “but DOJ has been disingenuous to this Court.”

“The fact that (Trump) would not be prosecuted was a given,” the judge wrote. In reality, it was a given from the moment Barr was appointed by Trump, as the past inevitably became prelude given his first stint as attorney general under George H.W. Bush. Back then, DOJ resisted efforts to get to the bottom of U.S. government-backed financing of Iraq in the run-up to Saddam Hussein’s invasion of Kuwait.

Think of Barr as an updated version of Roy Cohn, an earlier Trump lawyer. Both men attended Horace Mann, the swank private school in the Riverdale section of New York City, and Columbia University. As with Cohn, things are not ending well for Barr.

This is actually just the “tip of the ethics iceberg” at the DOJ. Unethical behavior was a staple of the DOJ’s various defenses of the Trump/Miller/Sessions/Barr White Nationalist agenda. 

How about things like:

  • There is no child separation policy;
  • The “Muslim ban” isn’t a Muslim ban even though Trump said that was exactly what it was;
  • DHS is taking proper COVID-19 precautions in detention centers; 
  • We can’t find children separated from their families under our child separation policy that we previously said didn’t exist;
  • The proposed census changes were necessary to protect the civil rights of minorities; 
  • The need to prevent refugees from legally seeking asylum at our borders is a “national emergency” requiring Supreme intervention.

That just a small sampling of the “disingenuous” arguments that were a regular part of defending basically indefensible (and often clearly illegal) positions and policies in immigration cases presented by OIL and the SG’s Office during the Trump regime.

While Billy the Bigot is (thankfully) gone, I’m betting that most of the “career” lawyers who conducted his disingenuous defenses are still on the DOJ payroll. Despite well-founded allegations of rampant misconduct and corruption at the DOJ (see, e.g., https://www.americanprogress.org/issues/democracy/news/2019/12/06/478254/lack-oversight-trumps-justice-department/), few if any “heads have rolled” after Garland assumed office. 

As a number of us have observed, the DOJ needed an immediate and thorough “housecleaning” which there is no sign of Garland being willing to undertake. Most DOJ attorneys are in the “excepted service” or “management officials” meaning that they largely are exempted from civil service protections and basically serve at the AG’s pleasure.

Just this week, we discovered that Garland had “honored” all of the Barr/Miller “holdover” appointments of Immigration Judges. There was absolutely no requirement that he do so, and every single reason why he should have withdrawn and cancelled these inappropriate, if not outright illegal, “holdover appointments” of judges who clearly and beyond any doubt were not the “best and brightest” selections for these important, life-determining Federal judgeships!

Who needs Mitch McConnell to gum up the works when you have Judge Garland to shoot himself and his Administration in the foot 17 times over while their (perhaps soon to be former) supporters look on in outrage and horror at yet another “unforced error” by the Biden Administration on immigration?

Honestly, doesn’t any Dem know how to play “hardball?” Maybe they need to take a seminar from the GOP!

As all of us who served in the Federal Government know, you don’t have a Federal job until you take the oath of office and enter on duty. Until then, appointments can, and have in the past been, withdrawn and/or cancelled.

Given the nearly universal condemnation of the Trump Administration’s Immigration Judge and BIA selection criteria — from conservative commentators like Nolan Rappaport (The Hill), as well as liberals and progressives — a moratorium on further judicial appointments generated by the Trump Administration as many recommended should have been a “no brainer” for Garland.

At a minimum, these jobs should have been re-competed under new merit-based criteria that required immigration expertise and fairly credited experience gained through actually representing individuals in Immigration Court or teaching or supervising others doing so. Another requirement should be legitimate recruitment efforts within communities of minority attorneys and the immigration, human rights, and constitutional due process litigation bars.

Additionally, to state the blatantly obvious, the overt racism, misogyny, and improper and unethical enforcement weaponization of the Immigration Judiciary during the Trump regime discouraged many well-qualified progressive candidates from applying! Indeed, a number who were already in Immigration Judge positions, like some esteemed members of our Round Table, felt compelled to resign their judicial positions because of unethical or illegal interference by the Trump DOJ and their EOIR toadies with their quasi-judicial independence and their sworn obligation to uphold the Constitution. 

Therefore, the 17 holdover Barr/Miller IJ appointments are necessarily tainted! Far beyond not making further appointments from Barr/Miller lists, a competent Dem AG would institute a review of all Barr IJ appointments still within the two-year probation period and apply merit-based retention criteria — with avenues for comment from the private immigration bar — to decisions as to whether these “probationary judges” should remain on the bench. Based on the anecdotal comments I have received at Courtside from across the country, a number of the Barr-appointed judges should not be on the bench under any circumstances.

This is not about the imaginary “job rights” of Barr/Miller selectees and appointees. No, it’s about the due process rights of migrants in Immigration Court — rights to a fair hearing before a qualified, impartial judge that are being violated on a wide-scale, daily basis in EOIR “courts” (a/k/a “Garland’s Star Chambers”) throughout the nation! It’s also about the right of those representing individuals in Immigration Court, many pro bono or “low-bono,” to respectful, professional treatment by well-qualified Immigration Judges.

Right now, attorneys are sometimes forced to appear before “judges” who know far less about asylum and immigration laws than they do. Many believe that they actually have to “train” these new judges in the law, only to have them go on and deny their meritorious cases on specious grounds.

How would Judge Garland and his “ivory tower lieutenants” like to “practice law” under these conditions! To be honest, “retail level experience” representing humans (not government agencies) in Immigration Count should be a minimum requirement for all Federal Judges up to the Supremes, not just for Immigration Judges! The caviler attitudes and fundamental misunderstandings that Federal Judges at all levels of our broken justice system too often exhibit toward the lives and rights of asylum seekers and migrants are both appalling and unacceptable in a functioning democracy.

This system is broken, and despite having the blueprints for reform in his hands, and hundreds of NDPA experts he could tap to help, Garland hasn’t done squat to fix it!

All and all, Judge Garland is off to a disappointing, actually horrible, start at Justice. And, the idea that he can fix racial justice, equal justice, voting rights, and civil rights while running “Star Chambers” at EOIR is total non-starter. Not going to happen!

The failure of Garland to remove an obvious, unqualified political hack — neither Immigration Court nor judicial experience — from his job at an agency clearly failing in its mission to provide anything approaching due process and fundamental fairness to migrants clearly has come to the attention of  honest civil servants at EOIR who have struggled to keep the flames of justice alive over the past few years. And, as Chairman Durbin’s letter points out, this is by no means the only example of “hackism” and contempt for basic competence in civil service at Justice.

The problems were well known and well-documented long before Garland was sworn in. Not dealing with them swiftly, competently, and decisively is failed leadership on restoring due process, competence, and independence in the most obviously broken and dysfunctional part of the U.S. Justice System — the Immigration Courts.

The Biden administration’s acting attorney general, a longtime career official named Monty Wilkinson, took part in a controversial 2017 decision to remove a justice department (DoJ) lawyer in Texas who had raised concerns about migrant children who were being separated from their parents.

Emails seen by the Guardian show that Wilkinson, who is expected to serve as acting attorney general until Judge Merrick Garland is formally confirmed by the Senate, worked with another longtime career official, Iris Lan, in reviewing complaints about Joshua Stern, a prosecutor who had told colleagues he was “disturbed” by the Trump administration’s separation policy.

The policy ultimately led to the separation of about 1,550 children from their parents, hundreds of whom have still not been reunited, although Joe Biden has said he would make that one of his top priorities.

Stern, who is no longer employed by the DoJ, was ultimately removed from his post as a temporary detailee, two weeks after senior officials in Texas raised concerns about him to officials in Washington DC, including Wilkinson.

Wilkinson, who Biden chose to serve as acting attorney general until Garland is confirmed, had been overseeing human resources, security planning and the library at the justice department before he was elevated to serve as acting attorney general.

A recent report in the New York Times suggested that Wilkinson was a trusted longtime official, and that his “low profile” all but guaranteed that he was not involved in any of the myriad scandals that defined the justice department under Donald Trump and the former attorney general Bill Barr.

But a report published by the Guardian in September 2020 revealed that Wilkinson was one of several career officials who reviewed complaints that ultimately led to the removal of Stern from the western district of Texas in 2017.

The report was focused on the role a senior justice department official, Iris Lan, played in reviewing those complaints. Lan had been nominated to serve in a lifetime appointment as a federal judge, but the nomination was never taken up in the Senate after a number of immigrant rights groups raised concerns about Lan following publication of the Guardian’s article.

It is not clear whether Wilkinson or Lan privately supported or criticized the administration’s child separation policy when they heard about Stern’s concerns.

It’s not like Courtside hasn’t been saying it for several years now: Cruelty, lawlessness, inhumanity, racism, and dishonesty end up corrupting everyone. Sessions is essentially a “21st Century Nazi war criminal” — everyone who served him is tarnished by his miserable lack of ethics, humanity, intelligence, honesty, and anything close to the basic qualifications for office. The same can be said for Billy the Bigot and short-timer Matt Whitaker. 

Even a guy like “Monty” — basically considered “safe” because he was a bureaucratic nebbish who kept out of sight and off the radar screen — turns out to have been bathed in the slime 🤮 that Sessions and his cronies unleashed on the Department.

Of course, it’s more fun to come “riding in on a white horse” to rally and save the dispirited troops. But, in this case, the “troops” who willingly carried water for the immoral, racist, lawless, White Nationalist, anti-democracy, and ultimately insurgent kakistocracy at the DOJ are part of the problem. And, that goes for some career lawyers who failed to live up to their oaths of office, not just the vile politicos. 

If “Team Garland” doesn’t knock some heads, re-establish ethical standards, provide some moral leadership, and hold some folks who should have known better accountable, they are not going to be able to get the job done! The EOIR kakistocracy is the obvious starting point. But, it can’t be the end of “operation clean sweep!”🧹

In the meantime, the Biden Administration might have to look in the JMD motor pool or the mail room to find an “Acting” AG not tarnished by the Barr-Whitaker-Sessions kakistocracy @ Justice!

And, while you’re at it, Judge Garland, you must examine the role of the sleazy DOJ lawyers who mounted an essentially frivolous defense for this nonsense in Federal Court. Sadly, you’re looking at systemic failure here, as well as a totally disrespectful and unwarranted effort to “beat the clock” in implementing the Miller/Hamilton White Nationalist, racist, anti-due-process, xenophobic agenda! 

Obviously, EOIR cut corners and tried to rush these bogus changes into effect before the well-established “end date” of the Trump kakistocracy on Jan. 20, 2020. EOIR also of acted in full knowledge that the incoming Biden Administration would go a “different direction” on immigration matters. 

In plain terms, this was an illegal bad-faith effort to undermine the incoming Biden Administration and illegally punish legal service providers by making them use time and resources in undoing the illegal mischief EOIR intentionally inflicted. CLINIC and their allies should be devoting resources to representing individuals in Immigration Court, not to fending off a bad-faith racist agenda sponsored by no less than a Department of “Justice” that has completely lost its way and impedes the public good.

This is a very serious ongoing national disgrace and abuse of the legal process by the DOJ. It needs to stop! Now! And those responsible for this outrage must face accountability for their unwarranted and illegal actions!
