U.S. District Judge Raymond Dearie, who is acting as a special master in the Mar-a-Lago documents case, on Thursday demanded that Donald Trump’s lawyers substantiate another one of the former president’s claims: that the FBI “planted” records.

Dearie ordered Trump’s legal team to submit by Sept. 30 a list of of specific items in the Justice Department’s 11-page inventory of documents taken from the Mar-a-Lago resort — including top secret files — that “plaintiff asserts were not seized from the premises.” They must also submit a list of any items seized that were not on the inventory, the order states.

“This submission shall be Plaintiff’s final opportunity to raise any factual dispute as to the completeness and accuracy of the Detailed Property Inventory,” Dearie said.

CA11 Finds Petitioner Failed to Prove That Florida’s Cocaine Statute Covers More Substances Than the Federal Statute

AILA: The court held that the petitioner, who had been convicted of cocaine possession under Florida law, had failed to show that Florida’s definition of cocaine covers more than its federal counterpart, and thus upheld the BIA’s denial of cancellation of removal. (Chamu v. Att’y Gen., 1/26/22)

 

Feds Fight Detention Probe In Migrant Counsel Access Suit

ETHICS ON VACATION @ DHS & DOJ: Apparently a Frivolous DHS Appeal Asking BIA To Publish Intentional Misconstruction of 7th Circuit Law is SOP For Mayorkas, Garland, & Underlings!

So, DHS argues on appeal that the BIA should violate, and intentionally and dishonestly, “misconstrue” 7th Circuit precedent. And, for a good measure, publish the result to insure that no IJ in the 7th Circuit gets it right in the future. 

BIA Chairman Wetmore, a former OILer who, whatever his shortcomings might be, does recognize the importance of not “overtly dissing” the Article IIIs, correctly says “No.” Perhaps, as suggested by my colleague Hon. “Sir Jeffrey” Chase, Wetmore had in mind that the 7th Circuit previously threatened to hold the Board in contempt for willfully ignoring its orders. Why aren’t there ethical problems with this outrageous, unprofessional DHS appellate argument? Why isn’t this a precedent, as it provides helpful guidance and can be used to prevent future frivolous litigation by DHS? Why is there no accountability for this frivolous appeal, request to publish, and the blatant effort by DHS counsel to “pull the wool over the eyes” of the IJ and the BIA?

The pattern of taking a frivolous appeal, making unethical arguments, and asking the BIA to publish as a precedent shows the arrogant view of ICE that they “have EOIR in their pocket” (certainly consistent with the Sessions/Barr rhetoric) and that there will be neither accountability nor consequences for frivolous and unethical conduct by DHS attorneys! By not publishing the result as a precedent, the BIA leaves it open for other IJs and single Appellate Judge BIA “panels” to get it wrong in the future. It also sends a signal that taking a whack at making misleading arguments for illegal and unethical results has no downside at Mayorkas’s DHS or Garland’s BIA.

Wonder why there are gross inconsistencies and endless backlogs at EOIR?  A totally undisciplined, unprofessional system where “anything goes” and “almost anything” will be defended in pursuit of removal orders certainly has something to do with it! It’s simply been building, under Administrations of both parties, since 2001!

The one-sided BIA precedent process — publishing mainly cases favorable to DHS — is no accident either. Pro-DHS rulings can be used by OIL (correctly or incorrectly) to argue for so-called “Chevron deference” or its evil cousin “Brand X” disenfranchisement of Article III Judges.

By contrast, precedents favorable to individuals merely promote due process, fundamental fairness, best practices, consistency, and efficiency. They might also be used to curb misbehavior by IJs and DHS counsel. Nothing very important in the eyes of EOIR’s DOJ political overlords.

GOP AGs, from Ashcroft through Sessions and Barr, have made it clear that precedents favorable to DHS Enforcement are far less likely to be “career threatening” or “career limiting” for their “captive judges.” On the other hand, precedents  standing for due process, vindicating migrants’ rights, or curbing “outlier” behavior by IJs and DHS attorneys can be risky. And, perhaps surprisingly, Dem AGs in the 21st Century also have been “A-OK” with that, as Garland demonstrates on a daily basis.

Where are Ur Mendoza Jaddou (yes, she’s at USCIS, not ICE,  but she’s “upper management,” knows the issues, and has access to Mayorkas) and Kerry Doyle at DHS? Whatever happened to Lisa Monaco, Vanita Gupta, and Lucas Guttentag at DOJ? 

These are the types of “real time” problems that leadership can and should be solving by setting a “no nonsense due process first” tone and bringing in and empowering expert Appellate Judges (“real judges”) and DHS Chief Counsel who will put due process, fundamental fairness, and ethics foremost! But, apparently it’s “below the radar screen” of Biden Administration leadership at DHS and DOJ.

The case for an independent Article I Court has never been stronger! Garland’s lack of leadership and furthering of injustice adds to Chairperson Lofgren’s case for fundamental change and removal of EOIR from DOJ, every day!

Hi all:To end the week on a positive note, in oral arguments today before the Second Circuit, one of the judges asked the OIL attorney the following:

“What are we to make of the amicus brief filed by so many former IJs who stress the importance of in person hearing in the special role of Immigration Judges in developing the facts before rendering an opinion, particularly in something as factually heavy as this, as undue hardship to the children?They emphasize the importance of hearing in person testimony and suggest that it is an abuse of discretion to not permit it when it is requested.How do you respond?”

The case is Martinez-Roman v. Garland.

The IJ wouldn’t let two witnesses testify: the medical expert, and a 13-year-old child of the respondent.So when the judge asked that question, the OIL attorney claimed that the IJ was trying to protect the child from the psychological trauma of testifying.The judges pointed out that the IJ had actually said he wouldn’t allow the testimony only because it would be duplicative.In the child’s case, it was supposedly “duplicative” of a one-page handwritten statement written by the child.In the expert’s case, the IJ admitted that he hadn’t actually read the expert’s written statement, causing the circuit judges to ask how the IJ could have known the testimony would be duplicative of a statement he hadn’t read.

So, Merrick, it’s an “A-OK” judicial practice for your judges to deem live testimony “duplicative” of a statements they never read! That’s some feat of clairvoyance!  

“Clairvoyance” appears to be more of a qualification for your “judges” than actual expertise and experience vindicating due process in Immigration Court!

Also, when your attorneys are confronted with the defects in your judges’ performance by Article IIIs who have actually read the record and familiarized themselves with the evidence, (something you apparently deem “optional” for both your IJs and the attorneys defending them) it’s also “A-OK” for your attorneys to fabricate any bogus pretextual excuse, even one that is clearly refuted by the record.

Perhaps, SG Liz Prelogar should take a break from losing cases before the Supremes and pay attention to what nonsense DOJ attorneys are arguing before the lower Federal Courts. What, Liz, is the legality and the morality of defending a broken system, wholly owned and operated by your “boss,” that dishonestly denies due process to the most vulnerable among us?

Harvard Law might have spared Solicitor General Elizabeth Prelogar from having to work in the “legal trenches” of Immigration Court, unlike the lawyers who have been fighting to keep democracy alive over that past five years! Apparently, she took a pass on the Ethics class too, as DOJ lawyers under her overall direction “make it up as they go along” in defending the dysfunctional Immigration Courts before the Article IIIs!

Is this what they taught you at Harvard law? Did you miss the required course on ethics and professional responsibility? Why is the Round Table doing the work YOU should be doing as a supposedly responsible Government official who took an oath to uphold the Constitution and the rule of law?

Yeah, I know that Prelogar, like her other elitist political appointee colleagues, operates in the “legal stratosphere,” has clerked for two liberal Supremes, and otherwise “punched all the right tickets” in Dem politics. But, the problem here is that like it or not, Immigration Courts are the “retail level” of American justice that affects everything else! Right now, that effect is stunningly and unacceptably adverse!

The GOP White Nationalist nativists, like Sessions, Barr, and their hand-selected toadies, “got that.” That’s why they used their time in office to weaponize EOIR and degrade due process and humanity, while using “Dred Scottification” developed in immigration to diminish and degrade the rights of “the other” throughout our legal and political systems! The dots aren’t that hard to connect, unless, apparently, you’re a Dem Politico serving in the DOJ!

For whatever reason, perhaps because Dems keep appointing politicos who haven’t had to personally confront the mess in Immigration Court, folks like Garland, Monaco, Gupta, Clarke, and Prelogar entertain the elitist belief that standing up to the “nativist appeasers” in the Biden White House, getting rid of bad judges and incompetent administrators at EOIR, and bringing our dysfunctional (“killer”) Immigration Courts into conformity with Constitutional Due Process, international standards, and simple human dignity are “below their pay grade.” Not so!

Have to hope that the Chairman Lofgren and her staff are paying attention and will start throwing more light on Garland’s deficient handling of EOIR and the disgraceful, intellectually dishonest, arguments his attorneys are making before the Article IIIs! 

This system is BROKEN, and going into the second year of the Biden Administration, Garland has NOT taken the necessary bold, decisive, yet quite obvious and realistically achievable, steps to FIX it! What gives?

Since Liz has never been a judge, let me provide an insight.  No judge, life-tenured or “administrative,” liberal, conservative, or centrist, likes being played for a fool, misled, or “BS’ed” 💩 by counsel. (I actually remember “chewing out” attorneys in open court for failing to acknowledge controlling precedent in arguing before me.)

They particularly hate such conduct when it comes from lawyers representing the USG! Because Federal Judges often come from a bygone generation, many still retain the apparently now long outdated concept that DOJ attorneys should be held to a “higher standard.” Your predecessor, Trump shill Noel Francisco, certainly mocked that belief during his disgraceful tenure at the DOJ, particularly in his disingenuous and aggressive defense of the White Nationalist, anti-immigrant, anti-asylum agenda! Do you REALLY want to follow in HIS footsteps? Sadly, At this early  point in time, that answer appears to be “yes.”

So, that leads to another question. Why do progressive human rights and immigration advocates continue to turn out the vote and loyally support a Dem Party that, once in office, considers them, their values, and the human souls they represent to be “expendable” — essentially “fungible political capital?” It’s something I often wondered when I was on the inside watching Dem Administrations screw up EOIR and immigration policy. I still don’t know the answer, and perhaps never will.

Not news for anyone who (unlike Garland) has even passing familiarity with the daily mockery of justice being carried out by Garland’s “wholly-owned bogus ‘court’ system.” These AREN’T aberrations or isolated incidents! They are “business as usual” in Garland’s totally dysfunctional and out of control Immigration “Courts.”

These aren’t “courts;” they are “adjuncts of DHS enforcement, masquerading as courts,” redesigned as such by Sessions and Barr with Stephen Miller’s influence and enabled to continue their disgraceful degradation of American justice by Garland!

DRC cases, if credible and documented, should be “slam dunk grants of asylum.” They could be put on the “30 minute docket.” Instead, EOIR has been allowed and encouraged to engage in this type of obscene, dilatory nonsense, with obvious racial overtones.

This case is a microcosm of how EOIR and the DOJ have built astounding due process denying backlog! The solution is NOT more Immigration Judges! It’s better Immigration Judges.

Obviously Garland has neither standards nor any shame! 

Dishonest, biased, and incompetent decisions like this should long ago have resulted in the removal from the BIA and reassignment of the BIA “judge(s)” involved.

BIA judges and EOIR judges AREN’T Article IIIs, and they DON’T have life tenure in their particular jobs.

Law students and attorneys of the NDPA are out there helping refugees every day. Meanwhile, over at Garland’s dysfunctional EOIR, Immigration Judges and BIA Appellate Immigration Judges strain to improperly “diddle the record” to deny relief to asylum seekers! Then, OIL defends them!

Essentially, in this case, the BIA “made it up and misrepresented the record” in an effort to deny asylum for specious reasons! Then, OIL tried to “blow it by” the Circuit!

Whatever happened to legal and judicial ethics? Clearly they were “deep sixed” under Sessions and Barr. But, why is Garland continuing to operate DOJ as an “ethics and quality free zone?”

This is a bad system with the wrong folks in too many judicial and leadership positions and presenting an overwhelming need for robust, bold change in how decisions are made and defended in Circuit Court. So far, Garland has not made the fundamental personnel changes and “quality upgrades” necessary to bring due process and some semblance of expertise and order back to his broken Immigration Courts! Why not?

Why are the kind of individuals who should be Immigration Judges and EOIR judicial leaders, talented lawyers like Elena and Irene, still “on the outside” rather than being actively recruited and brought in to replace those unable to perform judicial, administrative, and litigation duties in a fair, expert manner, that enhances due process? Why is EOIR still operating with a “judiciary” the majority of whom were installed by the Trump regime at Justice to “dehumanize, deport, and deter” without regard for due process? Why is OIL continuing to “defend the indefensible?” Why isn’t Congress asking Garland these questions?

Government lacking in expertise, intellectual honesty, professional ethics, and accountability is “bad government.” That’s true no matter which party holds power!

Not all judges should be immigration judges. Sometimes being a judge is just not for everyone, period. Bad attitudes and questionable decision making within the immigration courts often cause the most noise because the impact is often more than a rude remark. While I do not believe problematic judges make up the whole picture of immigration courts, just one bad judge can be enough to impact the lives of many, and I only wonder whether it is the system that perpetuates behavior, the history and beliefs of immigration, or both that give rise to bad experiences.

Surprisingly in our own city, San Francisco Judge Nicholas Ford was the subject of a complaint that was sent to the U.S. Justice Department for being hostile and having biased treatment of immigrants in the courtroom. The accusations stated that he belittled migrants’ stories and struggles by making inappropriate comments. One account stated that he said “I can tell an indigent person when I see one, and you can afford an attorney” in response to someone who claimed they could not pay. Many accounts also made it a point to mention that he had previously been criticized for jailing a pregnant woman without bail for a nonviolent crime – this gives an idea of his character in court. When he was first appointed by the Attorney General under the Trump administration, Ford had been a judge in the criminal justice system and apparently had no prior immigration law experience. Other judges that have similar backgrounds can take biases from the criminal justice system and bring them into the immigration law field. There is the risk that the treatment of criminals becomes synonymous with the treatment of immigrants.

Even if judges like Ford represent a minority, the behavior exhibited by him is not unusual in immigration courts. In Jacinto v. INS, 208 F. 3d 725 (9th Cir. 2000), it was difficult for the respondent to even answer basic questions about her family’s struggles; she was constantly faced with interruptions by the immigration judge and a blatant lack of patience. Most people regardless of being an immigrant or not could become overwhelmed during questioning or lack of information about legal procedures. Lacking compassion and basic manners, whenever Jacinto was asked a question regarding why she was seeking asylum, the immigration judge or government attorney would interrupt her midsentence and not allow her to ask any clarifying questions. The transcripts reveal a sense of confusion and urgency, as they treated her as if they were in a rush and like she was wasting their time.

Kelsea Villanueva, a law student, “gets” it! So why don’t Garland and his lieutenants? 

Perhaps, because they are too far removed from the human trauma and and the practical problems in the broken and unfair “courts” for which they are responsible! They obviously have become indifferent to the unnecessary human suffering they cause by tolerating this systemic stain on American justice.

It’s not that there aren’t lots of exceptionally well-qualified immigration lawyers, practical scholars, and effective litigators in the Bay Area (and most other areas where Immigration Courts are located) who would make great Immigration Judges. Therefore, it has taken a concerted effort over the past four Administrations, including the Biden Administration, NOT to recruit, attract, and hire the “best and  brightest” for these life or death judicial positions. 

One “key to building dysfunction” has been the childish, demeaning, and disrespectful treatment heaped upon the “IJ Corps” by DOJ politicos and EOIR “Management” trying to appease their “handlers.” Attempts to enforce “assembly line justice,” lousy technology, poor training, screwed up and always changing “priorities,” micromanagement by non-judges, and favoring “quick numbers” over thoughtful high quality judicial work product obviously discourages many of the most talented and well-qualified lawyers in the business from even applying. 

Some of those who do make the effort are then demoralized and discouraged when clearly inferior candidates, some lacking even basic immigration and asylum knowledge, are hired by a DOJ bureaucratic system that too often seeks and rewards complicity and “following orders” over intellectual excellence, proven immigration and human rights expertise, and the courage to make the right decisions even in the face of political pressure from above to “go along to get along” with each Administration’s enforcement agenda.

Surely, no panel of immigration/human rights experts would have recommended hiring someone like Judge Ford for the job! So, why was he even on the Immigration Bench in the first place? 

In every way, Judge Ford was EOIR’s self-created problem! It tied up both private resources and Government investigative resources that could have been better used. It further damaged EOIR’s reputation and ruined human lives. In the end, the “Ford brouhaha” produced no transparent results, thus further eroding public confidence in Government. It prompted neither accountability nor reforms to insure a better judicial selection process!

The best way to limit the administrative nonsense, unnecessary and inappropriate meddling, and time and resources wasted building a needless, ineffective bureaucracy to “monitor performance” and investigate complaints is to hire exceptionally well-qualified judges in the first place — good judges need neither much supervision nor significant monitoring. All they need is support, independence, professional training, continuing judicial education, and some inspirational encouragement from dynamic, well-qualified judicial leadership — things that generally have been in short supply within the EOIR bureaucracy, particularly over the past four years!

Leaders should be sitting judges — not just disconnected bureaucratic “managers” — who continue to handle regular dockets so they have the necessary perspective and first-hand experience to lead this broken system back to functionality. In what other “real” judicial system do the “chief judges and chief justices” largely or completely cease to perform judicial duties?

For example, Chief Justice John Roberts has no shortage of administrative and leadership tasks. Yet, somehow, he finds time to participate in every merits case coming before the Court! 

Almost every day, we see Court of Appeals decisions in which the Chief Judge of the Circuit was a panel member, sometimes even writing the opinion. Chief U.S. District Judges hear cases and sometimes author lengthy opinions in notable and controversial cases. 

There are few, if any, examples of successful judiciaries in which those in leadership positions isolate and insulate themselves from the judicial tasks of their colleagues! Yet, this has become “standard operating practice” at DOJ/EOIR. This is despite “clear and convincing evidence” that DOJ/EOIR’s bloated “Vatican style” (a/k/a “Legacy INS style”) bureaucracy is incapable of practical problem solving and has presided over the demise of a court system that once aspired to greatness, even if the efforts sometimes fell short!

The taxpayer money wasted on ludicrous “Immigration Judge Dashboards,” unnecessary “supervisors” who almost never go to court, ineffective and inefficient “Dedicated Dockets,” establishing “TV Adjudication Centers” in strange places, and running “kangaroo courts” embedded in the DHS Gulag could be repurposed into funding legal representation programs, a functioning e-filing system, more Judicial Law Clerks, judicial training by experts, and other badly needed and long overdue improvements and reforms. These things would actually help the system achieve justice with efficiency, rather than aggravating existing problems!

EOIR’s “customer service,” transparency, and engagement with the public get consistently low marks from Government watchdogs. I see no improvement under Garland.

Any legitimate system for judicial tenure or retention relies on robust public input and some peer involvement — things that are foreign to the DOJ/EOIR model which, if I do say so myself, bears a disturbing resemblance to the Byzantine bureaucracy of the “Legacy INS” (although the there are only a few us still around who experienced the latter “first hand”). 

Ironically, EOIR was originally established as an independent agency within DOJ to “free” it from the “Legacy INS;” over the years it has come more and more to look, feel, and operate like the worst aspects of that long-disbanded agency. 

In particular, it has “retaken on” the image of “being just another appendage of immigration enforcement” — a complete abandonment of the original goal of increased judicial independence in both fact and appearance!

Numerous private lawyers have related to me that being in an EOIR “courtroom” is too often “like facing two prosecutors.” Some say that their already traumatized clients are “re-traumatized” by the rude, disrespectful, and inhumane treatment they receive in Immigration Court as they attempt to plead for their lives and their families’ futures! What kind of judiciary “operates” in this manner?

For heaven’s sake, even former AG Alberto “Gonzo I” Gonzalez, hardly a “due process warrior,” spoke out publicly against demeaning treatment of migrants by Immigration Judges! Article III Courts continue to document instances of bias, incompetence, and cavalier treatment of human lives in Garland’s Immigration Courts at both trial and appellate levels. Yet, he says nothing and has taken few actions to solve the myriad of festering problems! We deserve better, much better, from the “people’s top lawyer!”

It’s also worth contemplating why law students understand the systemic problems and potential solutions better than the senior Government lawyers and officials we are employing and paying to mismanage it!

Twenty years ago, the American military marched into Afghanistan with the declared intent of hunting down Osama bin Laden and ridding the country of Taliban extremists. Led by government leaders working in bad faith, thousands of civilians and soldiers were led to their deaths for a war now universally considered a failure. However, the most vulnerable population susceptible to death in Afghanistan are those Afghan allies who risked their lives to work for the foreign forces. They served as translators and services workers and any role that required the help of the local population. Now, with the Taliban back in power, they will be the first to face death.

When local Afghans agreed to work for coalition forces, they were made a promise: work for us and we will give you a visa to the U.S. They put their safety on the line working for the military forces but did so in order to give them and their families the chance for a better future outside Afghanistan. They worked anywhere service members went, from battlefields to bases. Often, they were the people who saved the lives of the soldiers they worked for. They were not just local Afghans but critical allies necessary for the ongoing mission in their country. The Biden administration is making a serious mistake in placing the self-interest of the Justice Department ahead of the people’s right to know if former Atty. Gen. William Barr acted to cover up Donald Trump’s possible engagement in obstruction of justice.

A federal judge in Washington, D.C., in early May ordered the release of a crucial Justice Department memo that will shed light on Barr’s conduct and whether he acted inappropriately. Rather than comply with the judge’s command and disclose the document, the Biden Justice Department is appealing the order in an effort to keep the memo secret.

In March 2019, special counsel Robert S. Mueller III delivered his report into Russian interference in the 2016 presidential election to then-Atty. Gen. Barr. While keeping the report secret, Barr sent a letter to congressional leaders purporting to “summarize the principal conclusions.” Barr said that Mueller “did not draw a conclusion — one way or the other — as to whether the examined conduct constituted obstruction,” and that “the evidence developed during the Special Counsel’s investigation is not sufficient to establish that the President committed an obstruction-of-justice offense.” Trump then declared that he was fully exonerated.

Barr said that he had reached his conclusion “in consultation with the Office of Legal Counsel and other Department lawyers.” A Freedom of Information Act request was filed by a watchdog group to obtain the OLC memo that purportedly was the basis for Barr’s judgment that the Mueller report exonerated Trump of obstruction of justice.

A reading of the Mueller report indicates that Barr’s statements were a gross mischaracterization of the evidence it presented. There was substantial evidence that Trump had engaged in obstruction of justice and Mueller said that he offered no conclusion only because Justice Department rules prevented indicting a sitting president.

Federal Judge Amy Berman Jackson reviewed the OLC memo and concluded that there was no legal basis for withholding it from release. Indeed, she was sharply critical of the Justice Department’s arguments for secrecy. She said that the “affidavits” submitted in favor of withholding the document “are so inconsistent with evidence in the record, they are not worthy of credence.” She said that her review of the documents led her to conclude “that not only was the Attorney General being disingenuous then, but DOJ has been disingenuous to this Court with respect to the existence of a decision-making process that should be shielded by the deliberative process privilege.” She said that the agency’s “redactions and incomplete explanations obfuscate the true purpose of the memorandum.”

In plain English, she slammed the Justice Department for misleading the court in trying to keep the document secret.

This issue is central to a government operating under the rule of law: Did the attorney general act to deceive Congress and the American people to protect Trump from being seen as having engaged in obstruction of justice? The OLC memo is key to understanding what happened.

During his Senate confirmation hearings Judge Garland presented himself well and indicated a sound understanding of justice, the proper role of the Attorney General, and the public interest. However, that now appears to have been largely skillful misdirection.

Since actually being sworn in, Garland has, surprisingly and sadly, conducted business largely without regard to progressive values, expert advice, common sense, or the public interest.

WASHINGTON, D.C. – Senator Jeff Merkley of Oregon has called for the investigation and prosecution of current and former Trump administration officials after the Department of Justice Office of the Inspector General released “a disturbing report confirming that the Trump administration knew their zero tolerance policy would lead to family separations,” the Oregon Democrat said in a statement.

“We finally have more answers about how this diabolical plan came to be,” Merkley said. “It is crystal clear that Jeff Sessions, Stephen Miller, Chad Wolf, Kirstjen Nielsen and other senior Trump administration officials were not only fully aware that their policy would have traumatizing impacts on families, but also that their intention was to inflict that trauma as a means to deter people from coming to America in search of a better life.”

The senator added “it’s now confirmed that they committed perjury by lying to Congress about their intentions and actions in order to avoid accountability for their monstrous initiative.”

In June 2018, Merkley traveled to Texas and attempted to enter a child detention center in a former Walmart, calling attention to the practice of separating and detaining children apart from their families.

“The intentional infliction of harm on innocent children is unforgivable and has no place on our soil,” Merkley said Thursday. “The architects should be investigated and prosecuted to the full extent of the law for any crimes connected with both the atrocities and the cover-up.”

Merkley returned to the border 6 more times and advocated for families to be reunited – and for people seeking refuge “from gang violence, murder, rape, and extortion in their home countries” be allowed to make their case – something the senator alleges the Trump adminitration has not allowed in keeping with the law.

“America is at its strongest when we embrace our historic role as a beacon of hope for persecuted people from around the world,” Merkley said. “I am determined to work with the Biden administration to ensure that we turn that vision into a reality, and to hold the perpetrators of the Trump administration’s cruelty fully accountable.”

Also, Judge Garland needs to look into the conduct of the DOJ lawyers who defended the regime’s transparent lies and false claims that there was “no child separation policy.” These turkeys 🦃  took no responsibility for their clients’ ongoing crimes and cover ups. Indeed, outrageously, they got away with making it the burden of the plaintiffs’ lawyers to reunite families the Government intentionally and illegally separated without any plans for reunification.

The invidious racist, unconstitutional motives of criminals like Trump, Miller, Sessions, Hamilton, and Rosenstein was no secret. Except for the degree of Rosenstein’s involvement, it was widely reported at the time. Trump was a well-established liar whose public statements and rationales should have been assumed false until proven true. (Ask yourself what would happen to a corporate lawyer who took at face value and presented to a court as “facts” or a “defense” in a civil suit false statements by a corrupt CEO with a long-standing record of fraud, racism, and dishonesty.)

Also, what was the a racist hack like Sessions (the report also reveals that he was as totally incompetent as a lawyer as he was devoid of human decency) doing running border enforcement programs that had intentionally been removed from the AG’s portfolio by Congress when DHS was created? How does that fit with “Gonzo’s” transparently unethical and unconstitutional actions as a “quasi-judicial officer” in interfering with due process at the EOIR Clown Show🤡/Star Chamber🦹🏿‍♂️?

This IG report is just the “tip of the iceberg” of the institutionalized racism and systemic misconduct that polluted the immigration kakistocracy at DOJ and DHS during the Trump regime. The failings of the U.S. Justice system from top to bottom, starting with the Supremes’  consistent failure to critically examine the regime’s transparent pattern of unconstitutional, racist, biased behavior culminating  in an insurrection can’t be “swept under the carpet.”

Nor can their enabling of the White Nationalist immigration agenda of “Dred Scottification” pushed by unethical SG Noel Francisco! In a well-functioning democracy, the Trumpist thugs’ child abuse should have been stopped in its tracks. Thanks to the failure of legal, ethical, and moral leadership by Roberts and his righty GOP buddies, it wasn’t!

The entire beyond disgraceful and patently illegal “zero tolerance program” instituted by Gonzo was a grotesque misuse of public funds and abuse of prosecutorial discretion. Real crimes (the Trump regime has been an absolute boon to serious criminals from the Oval Office on down) went un-prosecuted and un-investigated. That’s why the critical democratic standard of a “peaceful and orderly transfer of power” has fallen by the wayside and the Biden-Harris Inauguration will take place in an armed camp. Ironically, the man administering the oath to President Biden, Chief Justice John Roberts and his GOP colleagues on the Supremes bear a major responsibility for democracy’s peril and the pain and suffering of those like separated families whom they failed to protect from Executive abuses!

As I’ve said before, although it won’t happen, the resignations of Roberts and his fellow GOP Justices should be on President Biden’s desk on the morning of January 21. That would be a real start on healing, restoring democracy, and reinstituting human decency and respect for human lives and the rule of law in America.

(Let’s not forget that ethics-challenged Justices Thomas and Coney Barrett showed up at what essentially was a “MAGA campaign rally” at the White House on the eve of the election that eventually resulted in impeachable acts of insurrection and sedition by a patently dishonest and dangerous Chief Executive whose unfitness to govern was more than clear by that time. Honestly, it’s going to take more than a black robe to cover the shame of these dudes who stand for protecting and enabling tyranny and against justice for the people. If nothing else, it’s high time for a Democrat-led Congress to impose at least some minimal ethical standards on the Supremes, since they appear to have none to mention. This Court is now the fifth federal court to be asked to plow the same ground about Wolf’s authority vel non to change the immigration regulations. If the government had proffered new facts or law with respect to that question, or a hitherto unconsidered argument, this might have been a worthwhile exercise. It did not. The government has recycled exactly the same legal and factual claims made in the prior cases, as if they had not been soundly rejected in well-reasoned opinions by several courts. The government initially appealed two of these decisions, both of which it later voluntarily dismissed, and appears to have only one appeal pending. In the main, the government contents itself simply with saying the prior courts were wrong, with scant explanation. See, e.g., Pangea Dkt. No. 48 at ECF p. 11 (“the various courts that have embraced this argument are mistaken”); Immigration Equality Dkt. No. 37 at 14 (same).

This is a troubling litigation strategy. In effect, the government keeps crashing the same car into a gate, hoping that someday it might break through. To be sure, one court decision alone does not necessarily close the door to any further cases or arguments along similar lines. Our common law system contemplates that more than one judicial examination of facts and issues is often merited. But our system has no room for relitigating the same facts and law in successive district court cases ad infinitum. That is what the government is doing here. The Court took pains at oral argument to discuss this with counsel for the government, and specifically asked how their arguments here are in any way different from the ones made and rejected in the preceding cases.4 Counsel responded mainly with a disparaging comment to the effect that the other district courts had shirked from working their way through the record. That is untrue. Each of the prior decisions conducted a painstaking analysis of the facts with respect to the Acting Secretary

position at DHS, with full attention to the unprecedented efforts to validate Wolf’s claim to the job, irrespective of governing law and procedures.

A good argument might be made that, at this point in time, the government’s arguments lack a good-faith basis in law or fact. But the Court need not reach that conclusion to reject those arguments yet again. The Court’s independent review of the record indicates that Batalla Vidal, 2020 WL 6695076, which is the latest decision before this order, correctly identified and analyzed the salient points vitiating Wolf’s claim of rulemaking authority, and the Court agrees with it in full.

Wolf’s continuing impersonation of a Cabinet Officer and Barr’s knowingly illegal, ultra vires approval of clearly unlawfully promulgated regulations that actually threaten the lives of bona fide asylum seekers should be dealt with as criminal offenses after Jan. 20, 2021. Every Government official who participated in this travesty, as well as the unethical DOJ officials and their supervisors who were involved in the frivolous and unethical “defense” of this clearly unlawful, and invidiously motivated, action should be removed from Federal Service. Clearly,  prosecutions should be explored against racist mastermind “human rights criminal” Stephen Miller.

As the regime of treason and insurrection comes to an end, those who knowingly helped further its gross illegalities should be held fully accountable under the law. Criminals have no right to government lawyers to defend their scofflaw behavior in civil actions like this!

The EOIR Clown Show 🦹🏿‍♂️🤡 must go! But, there also must be some accountability for those who abused their government positions and violated their oaths of office to illegally inflict harm and suffering on the most vulnerable among us. 

We have seen a serious breakdown of legal ethics and bar policing responsibility at all levels of the Federal Government during the regime. That breakdown extends to Federal Judges all the way up to the indolent Supremes who have consistently failed to hold U.S. Government attorneys (including, specifically, the highly unethical former Solicitor General and his staff) accountable for their unethical behavior in engaging in frivolous civil litigation, advancing “bad faith” defenses for clearly illegal actions, seeking unjustified stays, manufacturing and arguing clear “pretexts” for unconstitutionally discriminatory Executive actions, failing to do even minimal “due diligence,” putting forth factually erroneous and misleading arguments, and allowing the government to abuse, harass, and waste the time of private counsel for improper purposes.

This case also reinforces the absolute necessity of nationwide injunctive relief against Government abuses like this. The “solicitation” of cases challenging and improperly narrowing this necessary form of relief, a corrupt project of the Federalist Society and the former Solicitor General, should raise serious questions of the judicial qualifications of the two “GOP Justices” who recently engaged in this form of rancid, immoral, and legally defective political pandering in their “separate opinion.”  Better Justices for a Better America!

What really held the American legal system together for the last four perilous years was the tenacity of lawyers, many of them arguing Immigration or human rights cases pro bono, and the legal scholarship and courage of some U.S. District Judges who stood tall even in the face of a spineless and complicit Supremes’ majority that all too often failed to support them and could barely move fast enough to give a patently lawless, corrupt, racist, treasonous, and clearly unqualified President and his neo-Nazi minions carte blanch to abuse humanity and “Dred Scottify” persons of color. Leadership, moral courage, and integrity count. But for Sotomayor, Kagan, Breyer, and the late RBG, the Supremes came up disastrously short of fulfilling their Constitutional rule in far, far too many cases, and innocent people suffered and died because of it. This is simply unacceptable in our highest level judges.

It’s high time for law schools to reexamine and beef up obviously inadequate ethical training, for a review of the failure of basic ethics throughout Government, and for review and reform of the scurrilous and unacceptable abdication of ethical norms and responsibilities by Federal Judges at every level of our floundering and failing Federal legal system. Criminals like Wolf and Miller and clowns like EOIR officials violate the laws and degrade humanity because they have every reason to believe they will get away with it. They must be held accountable if we want the abuses that came close to destroying our democracy this week to be stopped!

Says it all. Obviously, ethics have become “optional,” at best, at DOJ and DHS. That’s certainly going to be a problem for the incoming Biden Administration. 

This is “civil” litigation, where the Government and its corrupt officials like “Wolfman the Illegal” have no right to a “day in court” to defend their frivolous positions. For the last four years, Government lawyers have regularly been putting forth obvious pretexts, false narratives, and frivolous positions in defense of the regime’s racist immigration agenda. Basic “due diligence” on some of the outlandish assertions by regime officials has become a forgotten concept. 

The breakdown in ethics, and the general unwillingness of Federal Judges to enforce ethical requirements on Government lawyers and Trump’s personal lawyers to the same extent they would on the private bar, has become a potentially debilitating legal scandal emerging from four years of kakistocracy!

For the last month, we have been subjected to a barrage of totally frivolous litigation openly pursued by Rudy and the other clowns on “the Big Loser’s” so-called “litigation team” designed for the dual purposes of 1) undermining our democracy, and, 2) assisting in a fundraising scam being conducted from the Oval Office to corruptly line the pockets of the Trump family. These aren’t “state secrets.” The fraud and disloyalty to our nation and our constitutional institutions is right out there in plain view!

Yet Rudy and his buddies aren’t in jail. Stunningly, after publicly conducting a nationwide losing scheme of frivolous litigation and lies, they are still licensed to practice law!

The good news: DACA kids get another shot! And, the incoming Biden-Harris Administration has vowed to protect them. The regime’s disgusting four-year White Nationalist effort to dump on them, led by notorious racists like “Gonzo” Sessions, Miller, Cooch, and Wolfman, has gone down in a blaze of scofflaw behavior and “malicious incompetence.” Like the “Big Loser.”

deportation-ready provision of the law kicks in. According to the American Immigration Council, fewer than 2% of immigrants who received persecution-based relief in fiscal year 2017 were ultimately deported to a third country.

The Justice Department also raised the possibility that having to scrutinize the practical odds of removal from immigrant to immigrant would be “patently unworkable.”

“A case-by-case approach … would needlessly add to the burdens that are already ‘overwhelming our immigration system,'” the department said, quoting a prior case.

But a coalition of former immigration trial and appeals judges pushed back on that idea with their own amicus brief Thursday.

“Bond hearings in withholding of removal proceedings are no different than bond hearings in other contexts,” the group, representing 34 judges who have cumulatively overseen thousands of cases, wrote. “Contrary to [the administration’s] assertion, bond hearings in withholding of removal proceedings neither lead to a slowdown of cases that ‘thwart Congress’ objectives’ in enacting the immigration laws, nor impose an administrative burden on immigration courts.” The American Civil Liberties Union is represented by its own Michael Tan, Omar Jadwat, Judy Rabinovitz, Cecillia Wang and David D. Cole.

This disgraceful performance by the Solicitor General’s Office (once revered, now reviled) has become “the norm” under Trump. Francisco’s arguments are those of an attorney who didn’t do “due diligence,” but doesn’t expect the Court to know or care what really happens in Immigration Court. And, unfortunately, with the exception of Justice Sotomayor and perhaps Justice Kagan, that may well be a correct assumption. But that doesn’t make it any less of a powerful and disturbing indictment of our entire U.S. Justice system in the age of Trump.

Reality check: I routinely did 10-15, sometimes more, bond hearings at a Detained Master Calendar in less than one hour. I treated everyone fairly, applied the correct legal criteria, and set reasonable bonds (usually around $5,000) for everyone legally eligible. Almost all represented asylum seekers and withholding seekers eligible for bond who had filed complete and well-documented asylum or withholding applications were released on bond. About 99% showed up for their merits hearings.

I encouraged attorneys on both sides to file documents in advance, discuss the case with each other, and present a proposed agreed bond amount or a range of amounts to me whenever possible. Bond hearings were really important (freedom from unnecessary restraint is one of our most fundamental rights), but they weren’t “rocket science.” Bond hearings actually ran like clockwork.

Indeed, if the attorneys were “really on the ball,” and ICE managed to find and present all the detainees timely, I could probably do 10-15 bond cases in 30 minutes, and get them all right. My courtroom and my approach weren’t any different from that of my other then-colleagues at Arlington. In thirteen years on the bench, I set thousands of bonds and probably had no more than six appeals to the BIA from my bond decisions. I also reviewed many bond appeals at the BIA. (Although, most bond appeals to the BIA were “mooted” by the issuance of a final order in the detained case before the bond appeal was adjudicated.) Most took fewer than 15 minutes.

Indeed, my past experience suggests that a system led (not necessarily “run”) by competent judicial professionals and staffed with real judges with expertise in immigration, asylum, and human rights and unswervingly committed to due process and fundamental fairness could establish “best practices” that would drastically increase efficiency, cut (rather than mindlessly and exponentially expand) backlogs, without cutting out anyone’s rights. In other words, EOIR potentially could be a “model American judiciary,” as it actually was once envisioned, rather than the slimy mass of disastrous incompetence and the national embarrassment that it is today!

The idea that doing something as straightforward as a bond hearing would tie the system in knots is pure poppycock and a stunning insult to all Immigration Judges delivered by a Solicitor General who has never done a bond case in his life!

Yes the system is overwhelmingly backlogged and dysfunctional! But that has nothing to do with giving respondents due process bond hearings.

It has everything to do with unconstitutional and just plain stupid “politicization” and “weaponization” of the courts under gross incompetence and mismanagement by political hacks at the DOJ who have installed their equally unqualified toadies at EOIR. It also has to do with a disingenuous Solicitor General who advances a White Nationalist political agenda, rather than constitutional rights, fundamental fairness, rationality, and best practices. It has to do with a Supreme Court majority unwilling to take a stand for the legal rights and human dignity of the most vulnerable, and often most deserving, among us in the face of bullying and abuse by a corrupt, would-be authoritarian, fundamentally anti-American and anti-democracy regime.

It has to do with allowing a corrupt, nativist, invidiously-motivated regime to manipulate and intentionally misapply asylum and protection laws at the co-opted and captive DHS Asylum Office; thousands of “grantable” asylum cases are wrongfully and unnecessarily shuffled off to the Immigration Courts, thus artificially inflating backlogs and leading to more pressure to cut corners and dispense with due process.

It also paints an intentionally false and misleading picture that the problem is asylum applicants rather than the maliciously incompetent White Nationalists who have seized control of our system and acted to destroy years of structural development and accumulated institutional expertise.

Good Government matters! Maliciously incompetent Government threatens to destroy our nation! (Doubt that, just look at the totally inappropriate, entirely dishonest, response of the Trump kakistocracy to their overwhelming election defeat by Biden-Harris and the unwillingness of both the GOP and supporters to comply with democratic norms and operate in the real world of facts, rather than false narratives.)

Due process, fundamental fairness, equal justice, simple human decency, and Good Government won’t happen until we get the White Nationalist hacks out of the DOJ and replace the “clown show” at EOIR with qualified members of the New Due Process Army. Problem solvers, rather than problem creators; over-achievers, rather than screw-ups!

The incoming Biden-Harris Administration is left with a stark, yet simple, choice: oust the malicious incompetents and bring in the “competents” from the NDPA to fix the system; or become part of the problem and have the resulting mess forever sully your Administration.

The Obama Administration (sadly) chose the latter. President Elect Biden appears bold, confident, self-aware, and flexible enough to recognize past mistakes. But, recognition without reconstruction (action) is useless! Don’t ruminate — govern! Like your life depends on it!

And, by no means is EOIR the only part of DOJ the needs “big time” reform and a thorough shake up. We must have a Solicitor General committed to following the rules of legal ethics and common human decency and who will insist on her or his staff doing likewise.

The next Solicitor General must also have demonstrated expertise in asylum, immigration, civil rights, and human rights laws and be committed to expanding due process, equal justice, racial justice, and fundamental fairness throughout the Government bureaucracy and “pushing” the Supremes to adopt and endorse best, rather than worst, practices in these areas.

American Justice and our court systems are in “free fall.” This is no time for more “amateur night at the Bijou.”

And here are some thoughts for the future if we really want to achieve “Good Government” and equal justice for all:

  • Every future Supreme Court Justice must have served a minimum of two years as a U.S. Immigration Judge with an “asylum grant rate” that is at or exceeds the national average for the U.S. Immigration Courts;
  • Every future Solicitor General must have done a minimum of ten pro bono asylum cases in U.S. Immigration Court.

The Outrageous Decision to Decertify the IJ’s Union

Our attention is understandably focused elsewhere right now.  However, it must be mentioned that on the eve of Election Day, a panel decision of the Federal Labor Relations Authority decertified the National Association of Immigration Judges (NAIJ) as a union.  While this might seem to be a minor issue at the moment, it is not.   At stake is the integrity of the nation’s Immigration Courts and the life-changing decisions its judges make.

The NAIJ was formed in 1971, and was certified as the recognized collective bargaining representative of Immigration Judges in 1979, 41 years ago.  It weathered a similar decertification effort in 2000.  Then as now, the agency argued that Immigration Judges are managers, and thus ineligible to unionize.  Under federal labor law, one is classified as a manager if their position “influences policy.”  20 years ago, both the initial decision of the Regional Director and the appeal to the FLRA resoundingly dismissed that notion.  In its September 2000 decision, the FLRA agreed with the finding below that IJs are not involved in creating agency policy.  The FLRA then noted that “unlike decisions of the Board of Immigration Appeals, the decisions of  Immigration Judges are not published, do not constitute precedent, are binding only on the parties to the proceedings, and are subject to de novo review. The RD accordingly concluded that the decisions of the Judges do not influence and determine the Agency’s immigration policy, in contrast to the decisions of the Board.”

In two decades, the only change to the above is that while the IJ’s findings of law remain subject to de novo  review, their findings of fact are now reviewed for clear error.  Of course, facts are entirely case-specific, and thus have no influence whatsoever on policy.  So as before, rather than create or influence policy, IJs implement established policy. Yet EOIR once again sought decertification.  At the hearing in January, EOIR stipulated that the judges’ duties and responsibilities had not changed since the prior decision.  As reported in an article covering the hearing, EOIR’s Director, James McHenry, testified  that Immigration Judges are not supervisors, adding that they “are at the bottom of the org chart so they don’t supervise anything,” and further noted that “they cannot hire or fire anyone.”  Nevertheless, he argued that because an Immigration Judge’s decision becomes a final ruling binding the agency if not appealed, Immigration Judges influence policy.

The Regional Director dismissed the claim based on the above arguments and testimony.  But there was always a sense that the administration had something up its sleeve.  That “something” turned out to be two Trump appointees,  FLRA Chairperson Colleen Duffy Kiko, and FLRA Member James T. Abbott.  They have jointly issued a series of decisions overturning decades of precedent to erode the rights of federal employees’ unions, a result clearly favored by the administration that appointed them.  The two stayed true to form in decertifying the NAIJ.  The FLRA’s lone Democratic appointee, Ernest DuBester, issued a scathing opinion  in the NAIJ’s case, which concluded with the following language:

This is the antithesis of reasoned decision making. Based upon the conclusory nature of the majority’s analysis, along with the facetious manner in which it reconciles its decision with Authority precedent precluding collateral attacks on unit certifications, it is abundantly clear that the majority’s sole objective is to divest the IJs of their statutory rights. Once again, I refuse to join a decision “so fundamentally adverse to the principles and purposes of our Statute.”

By deciding in this matter, the decision violates the FLRA’s own rules regarding when such reversals of past holdings are allowed. Moreover, not that it matters to Chairperson Kiko and Member Abbott, but if allowed to stand, their decision ignoring the NAIJ’s 41 years as a certified union and reversing its own precedent without any reasoned basis will accomplish the following damage.

First, Immigration Judges would lose their voice, collective bargaining rights, ability to be individually defended by their union representative, and their ability to push back against the relentless attack on their independence, neutrality, and ability to fulfill their proper function as a check against executive branch overreach.  Second, NAIJ officers have remained the only Immigration Judges able to allow the public to peek behind the scenes at these tribunals, by speaking at law schools and conferences (with the exception of management level judges who may be permitted to state the party line, sometimes by reading it from index cards).  As several leading scholars explained in an article in Slate:  “Judges and asylum officers are being instructed to decide cases in ways that many contend are contrary to law. A virtual gag rule has been placed on them in the context  of law schools and the broader public. This denies information to coming generations of lawyers and eliminates public discourse on some of the most critical civil rights issues of our time.”

But of great importance is a point I raised last year in an article I wrote for Law360 on the decertification effort: the administration’s citing to a recent decision of the Supreme Court in the case of Lucia v. SEC:

while irrelevant to the management inquiry, the citing of Lucia points to another motive of the DOJ.  In a leaked internal memo, the Justice Department indicated its interpretation of the decision as a basis to bypass the Merit System Protection Board, allowing the Administration to more easily terminate ALJs whose decisions don’t align with its political views.  Such actions would constitute a troubling attempt by the executive branch to influence case outcomes.  Similarly, decertifying the NAIJ would simplify the removal of IJs whose decisions are at odds with the administration’s stated immigration goals by eliminating the present collective bargaining agreement’s right to an independent arbitrator in matters concerning IJ discipline and termination.

Just prior to the FLRA’s decision, an executive order  creating a schedule of career federal employees who can be more easily fired for purely political reasons (such as issuing decisions not in line with the administration’s views).  By ruling that IJs influence agency policy (contrary to its prior decision), the FLRA has put the Immigration Judges squarely in the crosshairs of the new executive order.  To be clear: Immigration Judges whose neutral and independent application of the law would lead them to issue decisions the administration doesn’t like would be subject to easy termination. And of course, having just lost their union, those judges will have lost their best means of challenging such termination. Then, the hiring of their replacements would become even more nakedly partisan.

While it seems as I write this there will be a new administration come January, that doesn’t render this issue irrelevant.  First, the earlier decertification effort in 2000 occurred under a Democratic administration.  Second, leaving the above ruling in place would allow it be used as a weapon in the ways described by any subsequent administration.  Whatever one’s political leanings or views on immigration, we should all be able to agree that decisions of such importance should be rendered by fair, neutral judges by applying law to facts, protected from rank political pressures.

The creation of an Article I Immigration Court is ultimately the most durable way to guarantee the independence of these vital tribunals, but the evisceration or protections caused by allowing this decision to stand is too egregious to ignore even in the short term.  It is therefore hoped that readers will amplify the news of the decision and all it means.  It is hoped those with the capacity to do so will provide amicus or other legal support for further actions by the NAIJ to legally challenge the FLRA decision.  And the decision must be brought to the attention of an incoming Biden administration, which has so much damage to correct

There also needs to be consequences for those who abandoned their obligation of fairness and neutrality under the present administration.  FLRA Member DuBester is to be applauded for continuing to strongly voice his defense of justice in the dissent.  But perhaps a Biden administration can assess whether Kiko and Abbott might be better suited for other work.

Susan Church, an immigration attorney in Boston, ended the first week of the Trump administration arm in arm with protesters at Logan Airport, resisting an executive order banning travel from several predominantly Muslim countries. But what happened the next day, away from the public chants of “Let them stay!” was more typical of what the life of the former chair of the New England chapter of the American Immigration Lawyers Association (AILA) was to become under the Trump administration.

Church and an associate filed an emergency lawsuit to secure the release of immigrants from Customs and Border Protection (CBP) custody. “I got a federal judge on the phone, you know, on a Saturday night at eight o’clock.” The judge told Church to go to court immediately. An hour later, the attorneys were in court defending their clients.

“For me, that was the canary in the coal mine about what the rest of my four years under the Trump administration was going to be like,” Church said. “It’s just a nonstop series of emergency litigation filed to try to rescue one or 10 or 100 or 1,000 people, depending on which issue it is.” Eventually, the speed of the work, and the physical and mental exhaustion it triggered, landed Church in the hospital. “I thought I was having a heart attack,” she said.

Church stayed with the fight to reunite parents with their children. She described the process of taking affidavits from clients, which require she learn every harrowing detail of a client’s trauma. In one instance, CBP ripped away one woman’s eight-year-old daughter at the border. “She had to comb her daughter’s hair and change her daughter’s clothes and put her on a bus and say goodbye to her,” Church said through tears. The two were separated for nearly two months, even after the mother was released from detention.

Church was able to reunite her client with her child, but the episode—like many, many other cases—weighs heavy on her shoulders. “I don’t think I’ll ever be quite the same person that I was beforehand,” she said.

Four years into this migration crisis, there’s a parallel migration under way—of immigration lawyers out of the profession. Survey data and interviews the Prospect conducted with more than a dozen lawyers around the country reveal the physical, mental, and financial toll endured by members of the bar. Given the extreme violence, trauma, and inhumanity their clients often endure, immigration attorneys don’t like to talk about how it affects them. But secondary trauma also leaves a mark, making it impossible to continue for some attorneys. Although numerical data is limited, there is evidence that some attorneys are cutting back on some types of cases, such as deportation defense work, or even leaving immigration law altogether. Removal defense casework is one of the most time-intensive, emotional, and exigent parts of lawyers’ loads. It’s also where the administration has aimed much of its cruelest policymaking, severely limiting lawyers’ efficacy.

Under the Trump administration, immigration law has changed not only profoundly, but also so rapidly that it’s hard for immigration attorneys to keep up. Susan Church—and several other attorneys interviewed for this article—described combating Trump’s policies as a game of whack-a-mole.

Forget all the right wing BS and the “originalist hoax!” This is about “democracy (or the destruction thereof) in action.” 

Remember, all of these cosmic “immigration law changes” have taken place without a single piece of major legislation enacted by Congress! Indeed, the Trump regime’s ham-handed attempt to force it’s nativist agenda down the throats of the Congress as part of the “Dreamer fiasco” fell flat on its face in both Houses!  But, the Supremes have both encouraged and enabled Trump (actually notorious white supremacist Stephen Miller) to rewrite the law through. “Executive fiat.” Totally inappropriate, not to mention glaringly unconstitutional.

The Supremes’ majority has time and again improperly sided with the unethical, immoral, and Constitutionally bankrupt “Dred Scottification” of migrants, particularly asylum seekers. It’s not much different from what has happened to African Americans, Latinos, and other minorities following the Civil War. But, this is supposed to be the 21st Century where we have put “Jim Crow” behind us. Obviously, we haven’t!

Failing to protect “officers of the court” (lawyers) and their clients from a scheme of abuses heaped upon them by a corrupt, biased, out of control, overtly racist Executive and his sycophants is a gross dereliction of duty by the Supremes. It’s basically like allowing, and even encouraging, the badgering of a witness during trial! 

It’s painfully obvious that we have many of the wrong folks on the bench — from the Immigration Courts to the Supremes. Indeed, the nation and the world would be much better served if many more of those courageous lawyers who serve the immigrant community and human rights experts were on the Federal Bench at all levels. 

Trump, Roberts, and the GOP judicial misfits have also shown us first-hand the profiles of individuals who should not be serving in judicial positions. Let them litigate their “originalist,” “unitary Executive,” and other “far out” righty philosophies as lawyers appearing before real judges —“practical scholars” who live in the 21st Century and are committed to problem solving rather than problem creating. As Joe Biden has noted, the entire judicial selection system and particularly the Supremes need a thoughtful re-examination and reform. 

Never again should we have Justices like Amy Coney Barrett and Clarence Thomas performing highly inappropriate and unethical televised “campaign stunts” for an incumbent President during an ongoing election. Geez! What kind of “impartial jurists” are they? 

Most first year law students could tell you that’s a “no-go!” Why have we “normalized” and “accepted” such obvious bias, misbehavior, and lack of sound judgment at the highest levels of our (not Trump’s or Mitch’s personal) Judiciary?

It’s not “Rocket Science!” The fundamental building blocks of our society are immigration, human rights, and equal justice! Any lawyer who who doesn’t embody those virtues and doesn’t publicly embrace them should not in the future be given a lifetime appointment as a Federal Judge — at any level!

We need better judges for a better America! We will never achieve constitutionally-required “equal justice for all” for African Americans, Latinos, or anyone else, nor can we reach our diverse nation’s full potential, if we don’t start “pushing back” against Roberts and the GOP’s right wing judicial oligarchy, their obtuse legal gibberish, and their anti-democratic “jurisprudence.”

It starts with voting to take back our country from the far right. But, that’s just the beginning of the changes needed if equal justice for all is to become a reality, rather than an ever unfulfilled promise, limited to certain privileged (predominantly White) groups within our society!

And, all of society owes a debt of gratitude to Ms. Church and other brave lawyers like her who represent the best our country has to offer and have actually suffered for standing up for the rule of law and the legal and human rights of the most vulnerable among us. In other words, standing up for all of our rights against a tyranny! 

Compare that with the utterly dismal composition of the “Trump kakistocracy” and its “Dred Scottification” of “the other.”
