With the U.S. “on pace to encounter more individuals on the southwest border than we have in the last 20 years,” as Homeland Security Secretary Alejandro Mayorkas said in a statement March 16, immigration at the U.S.-Mexico border has emerged as one of the toughest challenges facing the Biden Administration. Last week, President Biden put Vice President Kamala Harris in charge of “stemming” the flow of migrants, Biden was questioned about the immigration situation at his first official press conference, immigrant detention centers began to fill up once again, and lawmakers from both sides of the aisle made trips to the border to publicize the issue and propose solutions.

Biden’s attempts to address immigration may be new, but the issue is one that has dogged his predecessors for decades. Since the 1970s, Republicans and Democrats alike have tried to address undocumented immigration by constructing ever more draconian policies of border control, deportation and detention—border theater that grabs headlines and sometimes leads to short-term change, but never actually solves the problem.

There’s a reason why the U.S. government has failed for so many years to “control” the border: none of these policies have addressed the real reasons for migration itself. In migration studies, these are known as “push” and “pull” factors, the causes that drive migrants from one country to another.

Today, the countries sending the most migrants to the U.S.-Mexico border–especially the Central American countries of Guatemala, Honduras and El Salvador–are experiencing a combination of push factors that include poverty and inequality, political instability, and violence. And while the current situation may be unique, it is also deeply rooted in history.

Many countries in Central America have struggled with poverty since the time of independence from Spain in the early 19th century. While they are beautiful countries that are rich in culture and history, that colonial past has meant they have historically been home to large, landless, poor, rural populations, including many indigenous people of Mayan descent. In the years after Spanish control, they were typically ruled by small oligarchies that disproportionately held wealth, land and power, and their economies were primary export-dependent, which brought great riches to landowners but also exacerbated and perpetuated inequality and the poverty of the majority. Those dynamics have carried forward to today. More recently, climate change–in particular, drought and massive storms–has forced the vulnerable rural poor out of the countryside.

And while many Central Americans could indeed qualify for asylum based on their experiences of persecution, the previous administration made every effort to limit their ability to obtain it. Now the Biden Administration must decide whether to restore the asylum framework, which has become the only possible path to legal migration (as well as safety and security) for Central Americans and other migrants who—due to these combined push and pull factors—are desperate to come to the United States.

Given the complicated and deep-rooted reasons behind migration, lawmakers cannot control or “solve” the ongoing crisis at the border by simply pouring money and resources into ever more militaristic border theater. It’s no wonder that decades of such policies have done little to change the underlying dynamics.

Instead, if Americans are serious about changing the situation at the border, we need to address the push and pull factors behind Central American migration. We need to acknowledge the reality of the U.S. economy (in particular, that it demands immigrant labor to work low-wage jobs) and work to construct new legal frameworks that reflect that reality. We need to target financial and logistical support to encourage Central American countries to address the poverty and inequality that fuel migration, rather than cutting foreign aid, as the Trump Administration did. We need to do all we can to end the pervasive gang violence that pushes so many migrants out of their homelands. And of course, we must continue to evaluate our own historical and contemporary role in creating the longstanding problems that are pushing Central Americans to migrate.

One key truth: many more Central American migrants would qualify for asylum and be legally admitted to our society under a fair application of our asylum laws directed and supervised by real expert judges who scrupulously enforce due process and best practices on a now biased, unfair, and dysfunctional system!

“Stemming the tide” might be neither realistic nor possible at this time. But, controlling it, managing it humanely and legally, and regularizing it, while lessening the “push” factors should be achievable.

It would, however, require bold actions:

  • Recognizing the primacy of humanitarian protection laws and insisting on due process in implementing them;
  • Putting experts in humanitarian situations, due process advocates, diplomats, labor economists, and demographers in leadership positions; and
  • Embracing much larger levels of legal immigration, particularly from Latin America.

Unfortunately for Vice President Harris and the rest of us who want humane, realistic immigration policies, there are reasons for our half-century of overall failure on the border.

Bloated government bureaucracies, powerful corporate interests, nativist politicians, and even foreign leaders are heavily invested in expensive and guaranteed to fail “uber enforcement” gimmicks. Failure basically creates a never-ending demand for more: more enforcement agents, “civil prisons,” jailers, deporters, cars, trucks, guns, boats, ammo, walls, fences, technology, courts, judges, prosecutors, lobbyists, “baby jails,” processing centers, foreign aid that goes largely into the pockets of corrupt leaders and their cronies, and a never-ending supply of underground, low-wage, politically neutered workers.

Additionally, we now have an entire political party with an agenda of overt institutionalized racism, dehumanization of the other, and fear-mongering White Nationalist myths driving its bogus populist narrative.

None of these “architects and enablers of border failure and institutionalized racism” are going “quietly into the night.” They will fight tooth and nail to defend their sinecures, profitable empires, and politically useful White Nationalist myths.

The politician who finally breaks the deadly cycle of failure and human misery at our border, while harnessing and realizing the positive power of human migration, will become a hero for future historians and undoubtedly merit a chapter in a new edition of Profiles in Courage.

Sadly, such recognition and adulation is likely to come long after she is gone from the scene. Long term vision and moral courage are not necessarily rewarded with short-term political popularity. Just ask the few Republicans who voted in accordance with the overwhelming, basically uncontested, evidence of Trump’s “high crimes and misdemeanors!” 

That’s why it’s a tough challenge even for someone of Vice President Harris’s undoubted intelligence and abilities. It’s up to those of us who believe in a better America to keep her from getting sidetracked and co-opted by the vested interests of failure and White Nationalist myth-makers and purveyors.

SUMMARY:

The Government appeals from a judgment of the United States District Court for the Southern District of New York (Carter, J.), granting Carlos Alejandro Velasco Lopez’s petition for a writ of habeas corpus. Velasco Lopez was detained pursuant to 8 U.S.C. § 1226(a), which provides for discretionary detention of noncitizens during the pendency of removal proceedings. His habeas petition challenged the procedures employed in his bond hearings, which required him to prove, to the satisfaction of an immigration judge, that he is neither a danger to the community nor a flight risk. We hold that the district court correctly granted the petition, and provided the correct remedy by ordering a new bond hearing in which the Government bore the burden of showing by clear and convincing evidence that Velasco Lopez was either a danger or a flight risk.

KEY QUOTE:

The irony in this case is that, in the end, all interested parties prevailed. The Government has prevailed because it has no interest in the continued incarceration of an individual who it cannot show to be either a flight risk or a danger to his community. Velasco Lopez has prevailed because he is no longer incarcerated. And the public’s interest in seeing that individuals who need not be jailed are not incarcerated has been vindicated.

Judge Parker is correct insofar as he cogently states what should be a “win-win-win” under a functioning Government. I wholeheartedly join lead counsel Julie Dona of the Legal Aid Society, NY, in appreciating and recognizing  Judge Parker’s understanding of the grim realities of today’s mal-functioning Immigration Courts and the important Constitutional rights being abridged by DHS & EOIR (essentially one and the same under the Trump kakistocracy).

But, that statement of how Government should be functioning glosses over the unfortunate reality of the Trump regime’s lawless, White Nationalist, nativist immigration agenda. The Trump regime doesn’t seek to create “win-win-win” situations! Instead, they seek to make political statements, dehumanize and degrade “the other,” and promote the biases of their “base” over sound public policy that benefits the common good.

The purpose of imprisonment in the Trump Gulag all too often has little or nothing to do with the legal criteria of danger to the community or flight risk. Rather, detention in the Gulag is used by the Trump regime’s DHS, with the connivence of the DOJ and often the courts, to punish individuals who choose to assert their legal rights; make it more difficult for them to obtain effective representation; and to coerce them into abandoning viable claims for relief, appeals, and judicial review. It’s all about punishment and deterrence, not mainly about the public interest, which is ill-served by most of Trump’s biased and counterproductive immigration policies.

DHS detention in the Trump era primarily serves Trump’s political interests and the interests of those running the for-profit prisons comprising much of Trump’s New American Gulag. Any time Trump’s policies match up with a legitimate national interest, it’s purely happenstance, not part of some overall plan to govern in the public interest.

Miller’s plans are so explosively ugly, overtly racist, and anti-American that they are being kept under wraps (for now) because of a (quite legitimate) fear that they could drive the small, yet potentially significant, minority of voters of color that Trump needs to have any chance of extending his rule to do something rational and in their self-interest: Vote for Biden-Harris. Look for things like eliminating birthright citizenship, eradicating all refugee and asylum laws, making it difficult or impossible for family members and people of color to immigrate legally, a wave of summary deportations, deporting “Dreamers,” and exterminating every last ounce of compassion and humanity from our laws. If you think that Black Lives don’t matter much to Trump and his cronies, just wait until he turns the Gruppenfuhrer loose! Think the Federal Courts will stop him? Just look at Trump’s “wholly owned and proud to brag about it” Supremes’ majority!  And, he’s also “stacked” — effectively “packed” —  the lower Federal Courts with loyalist ideologues.

America can no longer afford life-tenured judges who treat Trump as “normal” and are unwilling or incapable of “connecting the dots” among the dehumanization and demonization of migrants, institutionalized racism, and the end of American democracy. Immigrants’ rights are human rights; human rights are Constitutional rights; dehumanization of “the other” dehumanizes us all!

It’s past time that America stopped granting the privilege and responsibilities of life-tenure to those who won’t publicly adhere to those fundamental truths! Not rocket science! Just basic Constitutional law and human decency! Better judges for a better America! It all starts with a better President and a better Senate! That’s why this election might be our final chance to take back our country and preserve our democracy!

ICE moves to quickly deport more immigrants without court hearings

CBS: U.S. Immigration and Customs Enforcement (ICE) is implementing new rules unveiled in July 2019 that allow agents to expand their use of “expedited removal,” a fast-tracked deportation process created by a 1996 law that bars certain immigrants from seeking relief before an immigration judge.

 

New Trump Administration Rule Further Restricts Asylum Eligibility

USNWR: Under the regulation, having fake identification documents, including a fake ID, will render an immigrant ineligible for asylum in most cases. Unlawfully receiving public benefits will similarly bar someone from being granted asylum, as will a conviction for drug possession or possession of drug paraphernalia, with the single exception of having 30 grams or less of marijuana. An immigrant with two DUI convictions, or a single DUI conviction that resulted in the harm of another person, will be ineligible for asylum protections. The rule also bars immigrants convicted of domestic violence, stalking, child abuse and similar crimes, no matter the severity, from asylum. It also notably deems ineligible for asylum any immigrant whom an asylum officer “knows or has reason to believe” engaged in acts of battery or extreme cruelty – regardless of if the immigrant was arrested for such a crime.

 

‘Stunning’ Executive Order Would Politicize Civil Service

Gov Exec: Positions in the new Schedule F would effectively constitute at-will employment, without any of the protections against adverse personnel actions that most federal workers currently enjoy, although individual agencies are tasked with establishing “rules to prohibit the same personnel practices prohibited” by Title 5 of the U.S. Code. The order also instructs the Federal Labor Relations Authority to examine whether Schedule F employees should be removed from their bargaining units, a move that would bar them from being represented by federal employee unions. [It is unclear at this stage how/if this would affect the BIA, IJs, and other immigration officials.]

MPP Cases Highest Since Start of Pandemic

TRAC: In September 2020, the Immigration Court recorded 1,133 new MPP cases, up from a low of 136 in May, and the highest since the start of the pandemic in March when 2,282 MPP cases were filed. A total of 24,540 MPP cases are currently pending before the Immigration Court.

 

The Pandemic and ICE Use of Detainers in FY 2020

TRAC: Average weekday detainer usage, already trending downward this year, began to show some reduction starting in mid-March when it fell below 400 per weekday, and by the first of April had fallen below 300. By the second week of April the daily weekday average fell to around 240. However, after mid-April usage started climbing back up. By the end of the first week in May it was back up to a weekday average of around 300, and by mid-May usage had recovered completely.

Conversely, by voting the Trump regime and the GOP out, we can regain control of our Government and get broken, incompetent, and biased institutions like DHS and EOIR working for the people, rather than a White Nationalist minority with an anti-American, anti-democracy, anti-social-justice, anti-equality agenda!

Vote like your life and America’s future depend on it. Because they most certainly do!

Over the past 3 1/2 years, President Donald Trump has aggressively pushed an “America First” agenda that has significantly weakened more than seven decades of peaceful cooperation between the United States and her treaty partners around the world. In parallel moves, this president has continued a courtship with Russian President Vladimir Putin and a dangerous, nuclear-armed North Korea while allowing China to extend its geopolitical reach and goal of economic dominance.

Despite the widening of perilous fault lines that have emerged from growing diplomatic tensions, the mercurial and ill-equipped president continues to criticize and undermine, with no intellectual rigor, the post-World War II order that has given us 70 years of relative political and economic stability.

Moreover, Trump’s isolationist moves are progressively weakening America. Withdrawing from the Paris climate accord (ratified by nearly 190 nations, including Russia and China), the Iran nuclear deal, the Trans-Pacific Partnership trade agreement, UNESCO, the United Nations Human Rights Council, the World Health Organization and numerous other long-standing international commitments has become part and parcel of his unabashed goal of turning his back — and by extension America’s — on the world.

What kind of people are we? As a society, are we so decadent and insecure that we show “toughness” by deliberately being cruel to innocent children? Is this what our nation has come to? Or are we better than that?

This election demands we answer those questions. The choice between President Trump and Joe Biden is not just political. It is also moral. And perhaps nothing more starkly illustrates the moral dimension of that decision than the Trump administration’s policy of kidnapping children at the southern U.S. border, ripping them away from their families — and doing so for no reason other than to demonstrate Trump’s warped vision of American strength.

We learned this week that some of those separations will probably be permanent. As NBC News first reported, 545 boys and girls taken as many as three years ago — the children of would-be immigrants and asylum seekers, mostly from Central America — have not been reunited with their parents and may never see their families again.

These are not among the nearly 3,000 families separated at the border in 2018, when children were kept in cages like animals or shipped away to facilities across the country, hundreds or thousands of miles from the border. We now know, thanks to the American Civil Liberties Union and other pro bono lawyers, that an additional 1,500 children were torn away from their families beginning in 2017, when the Trump administration conducted a trial run of the separation policy.

Please think about that. The shocking scenes we saw two years ago did not result from a sudden spasm of presidential anger. They didn’t stem from a Fox News segment Trump might have seen one evening. Rather, the administration rehearsed this form of cruelty.

What the administration did not plan for was how to reunite the children taken in 2017 with their families. Many of the parents were deported, and their children were placed in shelters around the country, then ostensibly released to parents or guardians, placements that the ACLU is still trying to confirm.

The ACLU and other organizations have sent investigators to towns and villages in Central America in an attempt to find the kidnapped children’s families — an effort complicated not just by time and distance, but also by the covid-19 pandemic. Parents of 545 children have not been found, the ACLU reported this week.

Disturbingly, the Department of Homeland Security suggested that some of the parents declined to get their children back so they could remain in the United States. Keep in mind that most of these families were seeking asylum from deadly violence in their home countries. The Trump administration changed immigration guidelines to make it unlikely that the families would ultimately be allowed to stay in the United States, but federal law gives them the right to apply for asylum and to have their cases heard. They did nothing wrong. They should never have been asked to choose between parenting their children and getting them to safety — not by their home countries, and not by the United States.

Trump’s racism and xenophobia have been hallmarks of his presidency from the beginning, so perhaps it should be no surprise that he would preside over such an outrage. But he didn’t do this by himself. He had plenty of help.

Former attorney general Jeff Sessions seized an opportunity to make his rabid antipathy toward Hispanic immigration into policy. White House senior adviser Stephen Miller, a former Sessions aide in the Senate, was the architect of Trump’s “zero tolerance” immigration policy. Then-White House Chief of Staff John F. Kelly said in 2018 that the children taken would be “taken care of — put into foster care or whatever.” Former homeland security secretary Kirstjen Nielsen said last year that she regretted that “information flow and coordination to quickly reunite the families was clearly not in place” — but not the separations themselves.

President Donald Trump’s administration started and carried out a policy that took more than 4,000 children from their parents, at least 545 of whom are still split apart years later. But at Thursday’s debate, the president insisted that he did nothing wrong at all ― blaming his Democratic predecessors and even insisting the kids are doing fine.

“They are so well taken care of,” Trump said of the children taken from their parents by his administration. “They’re in facilities that were so clean.”

Trump’s first term was marked by a full-out assault on immigration, both legal and unauthorized. The most dramatic was his “zero tolerance” policy on unauthorized border-crossing, used in a 2017 pilot program and expanded more broadly in 2018, that led to criminal prosecution of parents and locking up their kids separately. Splitting up families was intentional and calculated, according to multiple reports.

Thanks to mass public outrage and a court order, Trump was forced to stop his family separation policy. Most families were reunited, but the American Civil Liberties Union, which was part of the lawsuit against the government that stopped the policy, said this week that at least 545 kids are still away from their parents.

“Their kids were ripped from their arms and separated,” Democratic nominee Joe Biden said during the debate. “And now they cannot find over 500 sets of those parents and those kids are alone. Nowhere to go. Nowhere to go. It’s criminal.”

That is the number of children still separated from their families by the Trump administration — separated deliberately, cruelly and recklessly. They might never be reunited with their parents again. Even if they are, the damage is unimaginable and irreparable.

Even one would be too many. Each one represents a unique tragedy. Imagine being ripped from your parents, or having your child taken from you. Imagine the desperation that the parents feel, the trauma inflicted on their children.

That number represents an indelible stain on President Trump and every individual in his administration who implemented this policy, flawed at the conception and typically, gruesomely incompetent in the execution. It is, perhaps in the technical sense but surely in the broader one, a crime against humanity. It is torture.

That number — I will stop repeating it, yet it cannot be repeated enough — represents a moral challenge and responsibility for the next administration. If Joe Biden is elected president, he must devote the maximum resources of the federal government to fixing this disaster. The United States broke these families; it must do whatever it takes to help them heal.

Nothing like that would happen in a second Trump term, because Trump himself doesn’t care. He doesn’t grasp the horror that he oversaw. He doesn’t comprehend the policy, and he is incapable of feeling the pain it inflicted.

Those truths could not have been clearer cut than during Thursday night’s debate.

Moderator Kristen Welker of NBC News asked the president a simple question: “How will these families ever be reunited?”

First, Trump misstated the situation: “Their children are brought here by coyotes and lots of bad people, cartels, and they’re brought here, and they used to use them to get into our country.”

No. These are children separated from their families, not separated from smugglers. They are children brought by their parents in desperate search of a better life, desperate enough that they would take the risk of the dangerous journey.

Then Trump pivoted to the irrelevant: “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers. And we let people in, but they have to come in legally.”

Welker persisted: “But how will you reunite these kids with their families, Mr. President?”

Trump responded by pointing his finger at his predecessor: “Let me just tell you, they built cages. You know, they used to say I built the cages, and then they had a picture in a certain newspaper and it was a picture of these horrible cages and they said look at these cages, President Trump built them, and then it was determined they were built in 2014. That was him.”

This is typical Trumpian deflection, bluster undergirded by ignorance. The “cages” are ugly but irrelevant to the topic at hand: the deliberately cruel plan to deter border-crossing by separating children from parents. That was a Trump administration special, implemented with callous sloppiness and so extreme that even the Trump administration abandoned it.

Welker, for the third time: “Do you have a plan to reunite the kids with their families?”

At which point Trump made clear that he did not: “We’re trying very hard, but a lot of these kids come out without the parents, they come over through cartels and through coyotes and through gangs.” The children, he added later, “are so well taken care of, they’re in facilities that were so clean.”

The third and final presidential debate gave Donald Trump and Joe Biden the opportunity to make their final pitch to the American people before the 2020 election. For the Democratic nominee, that meant driving home the point that he believes in science, that he’ll take the COVID-19 pandemic seriously, that climate change is real, and that systemic racism must be dealt with. For Trump, it meant making it clear that in addition to being a science-denying, QAnon-promoting dimwit, he’s also an actual monster who thinks separating small children from their parents, in some cases permanently, is absolutely fine.

Asked by moderated Kristen Welker about the news that parents of 545 children separated at the border—60 of whom are under the age of five—cannot be located, Trump defended the policy and gave no explanation for how the government plans to find these people and reunite their families. “Children are brought here by coyotes and lots of bad people, cartels, and they’re brought here and they used to use them to get into our country,” Trump said, which is objectively false, as they are brought here by their parents, which is why it’s called the family separation policy. “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers and we let people in but they have to come in legally.”

Noting that Trump hadn’t answered the question, Welker pressed: “But how will you unite these kids with their families?”

“They built cages, they used to say I built cages…that was him,” Trump said, pointing to Biden and referring to the fact that the Obama administration did build temporary enclosures but failing, naturally, to mention that his predecessor did not separate families.

“Do you have a plan to reunite the kids with their parents?” Welker asked a third time. Again, Trump responded by claiming that the children “come without the parents, they come over through cartels and through coyotes and through gangs.”

At this point, Joe Biden was given a chance to weigh in and used his time to describe the policy implemented by Trump as the horror show all non-sociopaths know it to be. “Parents, their kids were ripped from their arms and they were separated and now they cannot find over 500 sets of those parents and those kids are alone, nowhere to go. It’s criminal.”

Then Trump interjected with what he apparently believed was an important point that would cast his administration in a much more favorable light and perhaps might even win it some awards or sainthood by the Catholic church. “Kristen, I will say this,” he told the moderator, of the children stolen from their parents. “They’re so well taken care of. They’re in facilities that are so clean.

With regard to that claim, NBC News reporter Jacob Soboroff weighed in on that after the debate, telling Rachel Maddow: “I was one of the reporters I guess the president mentioned, they invited me to go to the epicenter of this policy…what I saw was little children sitting on concrete floors, covered by mylar blankets, supervised by security contractors in a watchtower, it makes me sick every time I recall it. And Physicians for Human Rights…called this torture…the American Academy of Pediatrics called this state-sanctioned child abuse, and the president of the United States I guess interprets that as children being well taken care of.”

On Veterans Day, Americans will lay wreaths on the graves of service men and women who served to protect the rights and values we celebrate as Democracy. For veterans across the nation who we will honor this day, our tributes may ring hollow if we fail to perform our most important civic duty: exercising our right to vote. Simply put, the vote has never been more important than at this moment in our history.

Our nation faces a range of health, economic, and security threats as we go to the polls on November 3. But we are blessed with great strength that, when coupled with competent and courageous leadership, can prevail in any situation. While some of today’s threats are international in nature, our view is that the greatest threat lies within our own borders. It’s an existential threat to our democracy, civil society, national solvency, and international standing. This is not an issue of conservative versus liberal or Republican or Democrat, but an issue for all Americans.

We are shamed by a government that no longer honors the basic precepts of our democracy: justice, truth, courage, caring, and integrity; a government that fans the fires of fear, hatred, incivility and flat out dishonesty; and a government that fails to accept and respect the very values that we spent our active duty lives defending. We served to protect a country that exemplifies the virtues that we in the military demanded of each other — integrity above all, courage to stand up against wrong, service over self, dignity in all interactions, and extending a helping hand to a shipmate who has stumbled.

Missing in action, or to a lesser degree being unaccounted for, are profoundly disturbing situations in which military leaders are unable to account for their most precious asset and responsibility — their fighting men and women. The former is the most dreaded because you assume the worst — capture, death or incapacitation.

Sadly, now the term “missing in action” seems to fit the behavior and performance of the military’s commander in chief and our president. He has failed to acknowledge the severity of COVID-19 by taking meaningful steps to reduce death and infection rates. He has failed to protect the integrity of our electoral process from foreign adversaries. He has failed to denounce hate groups and emboldened them by his silence. He has failed to build longstanding alliances — to include global climate action. He has weakened our national security and the international world order.

And now, after nine months of minimizing the pandemic and flaunting proven protective measures, he and some of his closest advisers became sick with COVID-19. Most disturbing but not surprising is the president’s lack of transparency with regard to his health further undermining faith in government and stability of the economy and markets. The shock waves are beginning to be felt by our remaining friends and allies and will be seized upon by nations and nonstate actors who wish us harm.

Donald Trump said he alone could fix the challenges facing our country. But as we’ve seen during these past four years, he’s in over his head — and we’re all paying the price for that. It’s time to take President Trump off the field.

Months into this pandemic, coronavirus cases are continuing to skyrocket in Wisconsin. More than 1,500 Wisconsinites have lost their lives to the pandemic. Green Bay, a city I love dearly, is seeing some of the highest infection rates in the country. Hospitals are overflowing, people are hurting, and families are needlessly suffering. More than 4,000 fewer people in Green Bay are employed now, compared to when President Trump took office. Far too many small businesses have had to close their doors for good. And the heart and soul of Green Bay — our game days with thousands of fans at Lambeau Field — are no more.

President Trump’s failure to mount a forceful response to the coronavirus pandemic will go down as one of the most consequential failures of government in American history. In Green Bay alone, the indefinite hold on fans at Lambeau Field — yet another consequence of President Trump’s failed leadership — is proving devastating to Green Bay’s small businesses. Each Packers home game provides $15 million in economic impacts to the city of Green Bay — but not this year.

Hillary is an amazing example of how the younger generation of the NDPA is courageously fighting for leadership positions that will change America for the better at all levels!  The NDPA has been dominant in courtroom advocacy, scholarship, and clinical teaching. Election 2020:  Some Ways to Get Involved

 

  • Mass texting. This is a means of voter outreach that it is a lot of fun and effective in getting the message out and having conversations with many voters in a short period of time — and great for those with strong aversions to talking to strangers on the phone.  Although some training is needed for this, mass texting can be learned within an hour, and anyone can pick up how it is done within a short time of starting to do the actual texts.  Organizations use programs that allow volunteers to send a pre-written text message out to voters through their computers in batches of 200-1000, which can be done in no more than 2-4 minutes.  On average, 10-20% will answer, some immediately and others trickling in over the next few hours.  Volunteers can then engage with many of these voters, usually through a wide variety of scripted answers which mostly cover the waterfront of responses they receive, and sometimes result in more creative and substantive conversations.  You can complete all of your conversations for a batch in 60-90 minutes, with occasional check-ins for a few responses that trickle in over the next 48 hours.  The voters only get your first name and don’t have your phone number or further information about you. You can get going in doing mass texts that reach 1000 voters at a time and result in many substantive discussions through the People’s Action Network, which is now sending over a million texts a week to voters in key swing states, by clicking here:

 

  • Phone banking. While phone banking has its rewards and occasional frustrations, it has been found to be the most effective means of engaging voters other than door-to-door canvassing.  Most campaigns now use electronic dialers, to dial quickly and allow callers to speak only to people who answer, and they also usually provide a script to use and adapt to their own words.  While there can be many wrong numbers and occasional confrontations, many of the phone banks target likely friendly groups of people (e.g. Dem voters who we encourage to come out and get or submit ballots).  In this year of COVID, phone bankers are finding that the proportion of lonely people who will pick up the phone and talk is increasing.

 

  • Writing post cards.  A great outreach technique for the worst technophobes!    A nationally known non-partisan campaign called Reclaim Our Vote has sent over 5 million post cards, primarily to deregistered (purged from the rolls) voters of color in swing states, urging recipients to register and to vote, and provide needed contact info, and is looking to send out many more as soon as possible, before shifting its efforts to phone banking and texting.  (https://actionnetwork.org/forms/reclaim-our-vote-signup).  Reclaim Our Vote is also one of the few campaign-related organizations that houses of worship and other 501(c)(3) organizations can participate in, and to which people can make tax-deductible contributions, because it is non-partisan (it does not search out voters by party registration).  Its parent organization, Center for Common Ground, is itself a 501(c)(3) organization.  Another group called Postcards to Voters (https://postcardstovoters.org/) writes post cards to Democratic leaning voters in swing states around the country.  The group has a few openings in a local chapter in the DC area where one of our JAMAAT members is active, and they get together in periodic friendly Zoom meetings to write post cards and get to know each other.  Please contact us at JAMAAT if you are interested.

 

  • Writing Letters. Another great outlet for the tech-challenged.   An organization called Vote Forward, https://votefwd.org, is working with groups such as Swing Left to have volunteers write 10 million letters to infrequent Democratic voters in swing states, to send shortly before the election to remind them to vote.  They have had past success with their strategy, because recipients are likely to open the handwritten, personally addressed letters that remind people to vote shortly before the election.  This year, they have decided to send their letters out on October 17.

 

  • Organizing friends and family. We all know that individuals have far more influence on people they know than on strangers.  The Biden campaign has come up with a training program and app called Vote Joe, available on the App Store, to help organize friends and family, which seems particularly useful for young people with infrequently voting friends or people with friends and family who need to be acquainted with basic facts on the issues.  The app allows users to help figure out whom to target, by providing access to publicly available voting data to show how frequently any person has voted and (depending on the state) the party for which they registered, and provides easily accessible information on the major issues of concern to voters.   For the next of the training programs that shows how to use the app and more, see  https://www.mobilize.us/2020victory/?address=20850&lat=39.0839994&lon=-77.1527813.

  • Poll watching and voter assistance hotlinesWith all the news about Republican efforts at voter suppression and massive disqualification of votes, Democratic groups have sprung up to resist such efforts through voter education and poll observation.  You can get involved with the Biden campaign as a poll observer by clicking here, be trained on how to answer questions on the Biden campaign’s National Voter Assistance hotline by clicking here, and become involved as a nonpartisan Election Protection volunteer, supported by many of our country’s best-known non-partisan election protection organizations, by clicking here.
  • Giving money. You are all deluged with requests for donations that seem to come from every organization on Earth, each of which professes to be the one in greatest need of your money.  This document will not endorse giving to any of the worthy organizations listed here over any others.  But if you have money to donate to one or more political campaigns, and you care about particular issues, you can increase the impact of your contribution by donating through a PAC of an interest group whose positions on your issue of concern are supported by that group.  One organization to consider, for anyone interested in promoting an equitable two-state solution in Israel and Palestine, is the J Street PAC, https://jstreet.org/about-us/about-jstreetpac/#.X0gfNMhKg2w.   In its 12 years that it has been in existence, this group has hired some of the savviest people on the Hill, which has helped propel J Street into becoming one of the most successful Jewish organizations in Washington.  One service they offer, if you wish to donate to Senate or House campaigns but could use some guidance on which campaigns are most in need of money that can make a difference, is to consult with their resident expert on this subject, Capital/South Assistant Regional Director Mike Fox, mike@jstreet.org. You will need to become a member of J Street through its web site in order to donate through the PAC, at no financial obligation.  All monies donated through the PAC will go directly to the designated candidate.

 

  • Organizations doing various types of voter outreach

 

  • 2020 Victory (mobilize.us/2020victory/) is the website for the DNC, for both the Biden/Harris campaign and downballot campaigns in battleground states. Here you can get text training (required before doing any texting on their campaigns), phone banking, and different types of organizing, and then sign up for particular phone banking, texting, and get out the vote events to all manner of targeted audiences.

 

  • Moms Demand Action on Gun Sense has a very active Maryland chapter coordinating postcarding for Spanberger and Luria (the two likely close congressional races in our area) and for Reclaim Our Vote, as well as texting (currently with 2020 Victory) and phone banking.  They do frequent small group Zoom parties in connection with their events, led by their experienced team heads, to give tips, conversation, and offer incentives like campaign swag for frequent participants.   • Seed the Votehttps://www.everydaypeoplepac.org/seedthevote/, a Bay Area-organized campaign of progressive organizations, is teaming with groups from AZ, PA, and FL to do phone-banking and texting to those critical states each day of the week. Their partner organizations feature a “deep canvassing” technique to try to understand the concerns of infrequent and swing voters, to get back to them with answers to questions they cannot handle from initial questions, and to refer people in need of resources to helping institutions.

 

  • Powered by People is a PAC started and led by Beto O’Rourke, which makes calls to Texas Democrats and people of color: see https://map.betoorourke.com/  Its phone banks feature 1 or 2 weekly 2-hour sessions that start with a Zoom conference with inspirational remarks led by Beto himself, and feature both an automatic dialer I’ve found works very well and a good supportive staff who can help with issues while calls are ongoing.

 

  • Bend the Arc: Jewish Action, the progressive Jewish organization that focuses on domestic issues such as racial justice, immigration, and the environment, is running a Vote Out Fear campaign (https://www.bendthearc.us/vote_out_fear_pb), doing phone banking and text banking aimed at swing Jewish voters (initially in Florida and Georgia, now expanded to include six other key states).

 

  • Turnout 2020, https://turnout2020.org/, a program of a coalition of left-leaning groups called the Progressive Turnout Project, primarily makes calls to infrequent Democratic swing state voters to urge them to take action, normally on Tuesdays and Thursdays. They are currently calling Arizona and Pennsylvania voters to encourage that they request a vote-by-mail ballot, with talking points to help voters understand options.

 

  • JAMAAT (Jews and Muslims and Allies Acting Together) is a small grass roots organization in the DC area that focuses on fighting Islamophobia and anti-Semitism, as well as on issues like immigration, preventing gun violence, and the environment. Its members have been working with all of the groups listed here.  Interested people can participate in our next virtual organizing meeting on Sunday, October 4 at 7:00 pm EDT, for which they should register at http://bit.ly/jamaat2020.  Any questions should be referred to gsampliner@gmail.com.

 

  • Reclaim our Vote, https://actionnetwork.org/forms/reclaim-our-vote-signup, which will be pivoting later in September from post card writing to phone and text banking, and they have useful training courses coming up to help hesitant phone bankers, some on Mondays and some at other times.

 

  • Grassroots Democrats (https://grassrootsdems.org/) is a California-based organization that has gone national and participates in phone banking and texting campaigns in most of the battleground states. They have a well-organized website to hook interested people into phone banking and texting opportunities, as well as training, in battleground state races of their choice, and good links to other key websites to get brief summaries of the candidates; background and positions.

 

 

 

o   Changing the Conversation (ctctogether.org) is a group that is doing both telephone and (under a strict protocol) door-to-door canvassing, focusing on Pennsylvania.  They train people extensively in “deep canvassing,” which has worked to persuade reluctant voters to vote and change the minds of least the less ardent Trump supporters, not by using facts and arguments but by story-telling, building empathy, and getting voters to tell their own stories that can cause them to convince themselves to come out to vote and vote our way.

 

o   Environmental Voter Project (https://www.environmentalvoter.org/) is a non-partisan organization that uses big-data analytics to identify inactive environmentalists in battleground states and then through its phone banks and text banks, applies cutting-edge behavioral science to turn them into more consistent voters.

To Trump and his core enablers and supporters, the laws of Trump Nation authorize him to do whatever he wants. Anti-Trump Nation’s laws constrain him, but they’re illegitimate because they are made and enforced by the people who reject him.

If he loses the election, Trump will not accept the result because it would be the product of Anti-Trump Nation

So Trump’s call to the president of Ukraine seeking help with the election was “perfect”. It was fine for Russia to side with him in 2016, and it’s fine for it to do so again. And of course the justice department, postal service and Centers for Disease Control and Prevention should help him win re-election. They’re all aiding Trump Nation.

By a similar twisted logic, Anti-Trump Nation is dangerous. Hence, says Trump, the armed teenager who killed two in Kenosha, Wisconsin, acted in “self-defense”, yet the suspected killer of a rightwinger in Portland deserved the “retribution” he got when federal marshals killed him.

It follows that if he loses the election, Trump will not accept the result because it would be the product of Anti-Trump Nation, and Trump isn’t the president of people who would vote against him. As he recently claimed, “The only way we’re going to lose this election is if the election is rigged.”

In the warped minds of Trump and his acolytes, this could lead to civil war. Just this week he refused to commit to a peaceful transition of power. His consigliere Roger Stone urges him to declare “martial law” if he loses. Michael Caputo, assistant secretary of public affairs at the Department of Health and Human Services, warns “the shooting will begin” when Trump refuses to go.

Civil war is unlikely, but the weeks and perhaps months after election day will surely be fraught. Even if Trump is ultimately forced to relinquish power, his core adherents will continue to view him as their leader. If he retains power, many if not most Americans will consider his presidency illegitimate.

So whatever happens, Trump’s megalomaniacal ego will prevail. America will have come apart over him, and Trump Nation will have seceded from Anti-Trump Nation.

And would we have expected anything different from Sen. Lindsey O. Graham (R-S.C.), the shape-shifting chairman of the Judiciary Committee?

Back in the days when he pretended to care about something more than sucking up to power, Graham used to say Republicans would have to live with what they had done to Obama’s 2016 nominee, Merrick Garland. In October 2018, shortly before taking the gavel of the committee that will consider Trump’s nomination, Graham promised: “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait till the next election.”

Now — surprise! — Graham has promised, via Twitter: “I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.” His rationale, if you can dignify it by calling it that, is that Democrats did things that offended him. So it’s payback time.

Oh, and let’s consider the sanctimonious and pseudointellectual Sen. Ted Cruz (R-Tex.), whom Trump has said he would consider for future openings on the court. When running for president in early 2016, he loftily declared to NBC’s Chuck Todd: “It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year. And what this means, Chuck, is we ought to make the 2016 election a referendum on the Supreme Court.”

What Cruz said wasn’t true, as is so often the case. There had indeed been instances of presidential nominees being confirmed during election years. In February 1988, a Democratic-led Senate voted 97-0 to put Ronald Reagan’s pick, Anthony M. Kennedy, on the court.

But this was only the beginning for Cruz. When it still appeared that Hillary Clinton would win in 2016, he also suggested that the court could get along just fine with only eight members indefinitely. Now — surprise! — Cruz is warning that having an even number of justices constitutes a “grave danger.”

The contrast worries liberal activists who see it as further evidence that the Democratic Party isn’t paying enough attention to an area where conservatives have made big inroads in recent years: control of the courts.

“The fact that Democrats spent so little to no time discussing the federal bench failed to take into account that their critically important goals for the future will be challenged in the courts,” said Nan Aron, the president of the liberal judicial advocacy group Alliance for Justice.

She added: “It’s a major misstep, given the fact that these 200 judges will make it very difficult, if not impossible in many cases, for the Democrats to accomplish their worthy goals going forward.”

Thanks, Nan, for speaking out! I’ve always been astounded by the Dems’ failure to recognize the importance of getting demonstrated advocates for due process, fundamental fairness, human rights, equal justice under law, and best practices on the Federal Bench.

Heck, look at the Dems beyond disastrous and just plain incompetent approach to the Immigration Bench in the Obama Administration — an administrative court controlled entirely by the Attorney General. Can’t blame Mitch and the GOP for:

    • Ridiculously convoluted and entirely unnecessary 2-year hiring process (under former Director Anthony C. Moscato, the Clinton Administration could sometimes do it in a fraction of that time with better, or at least no worse, results);
    • Eschewing progressive judicial candidates, including well-qualified underrepresented groups, with scholarly credentials and practical expertise in immigration, asylum, human rights, and due process in favor of an endless stream of  largely “insider only, don’t rock the boat” picks;
    • Leaving numerous positions unfilled at the end of the Administration for White Nationalist xenophobe Jeff Sessions to fill;
    • Ignoring obvious, achievable management reforms like e-filing!

The Trump Administration is teeming with malicious incompetents, particularly in the Immigration-related agencies. Notwithstanding that, they immediately figured out how to expedite Immigration Judge hiring and to load the bench with some of the worst, most unqualified, and biased so-called “judges” in modern American legal history! 

In other words, Sessions, Whitaker, and Barr shamelessly and rapidly weaponized the Immigration Courts and made them subservient shills and zealots for DHS enforcement and Stephen Miller’s White Supremacist agenda. And feckless Article III Courts, now also stuffed with Trump judges, have, with a few notable exceptions, looked the other way as the slaughter of Constitutional due process and vulnerable humans (including kids) unfolds. You couldn’t write a worse script for the rule of law and future of humanity!

Democrats pretended that the Immigration Courts existed merely to “go along to get along with the policy flavor of the day.” They did not reinforce due process, fundamental fairness, or view the Immigration Bench as a source of expertise, creativity, progressive legal thinking, or creative legal problem solving. The backlogs grew, morale slid (although admittedly not at the breakneck pace under the Trump regime), and the bodies of those who should have been saved but weren’t started to pile up. Simple reforms — try e-filing, for example — were left unaccomplished!

It wasn’t “malicious incompetence” — just good old fashioned “administrative incompetence.” But the latter paved the way for the former to “go on steroids” during the Trump regime. This isn’t just political malpractice and academic debate! Real people have lost their lives, families, or futures because of the Dems’ diddling approach to justice — including America’s largest and perhaps most significant court system over which they had total control!

It’s actually pretty simple: Better judges (from the Supremes to the Immigration Courts) for a better America! And, time for the immigration/human rights community to wake up, join the NDPA, and demand that the Dems do better next time around!
