This morning, Haitian Bridge Alliance (HBA) along with 288 immigration, civil rights, human rights, and faith-based organizations, sent a letter to President Biden urging him to protect Haitian asylum seekers. Pretty much says it all! A Dem Administration abandons the values of racial justice and immigrant justice for some “strategy” that sure escapes me.

It’s not like continuing to “beat up” on Haitians and other migrants of color and threatening to inflict even more extreme violations of legal and  human rights than the Trump Administration has garnered ANY support or acceptance from the far right. They continue to characterize all Administration policies as “open borders,” although nothing could be further from the truth.

Additionally, failure to reinstitute and improve the rule of law at the border for legal asylum seekers has failed to create an orderly process for screening asylum seekers at ports of entry or for refugee status outside the U.S. and timely and generously processing valid claims for protection. The result has been a loss of an important group of  legal immigrants who could have helped reduce inflation and improved the economic outlook. At the same time, shifting asylum screening away from legal ports of entry has overburdened the Border Patrol by forcing everyone seeking protection to cross the border between ports of entry.

As a related point, I defy anyone to explain on what basis some asylum seekers apprehended at the border are allowed to enter and pursue claims and others similarly situated are orbited back into danger with no process whatsoever. It’s certainly NOT the result of the prompt screening by USCIS Asylum Officers that Congress mandated, but the Trump and Biden Administrations have ignored — to everyone’s detriment.

This resulting “disorder at the border” has NOT attracted independent voters to the Administration’s immigration stance. 

At the same time it has driven an unwise and entirely unnecessary wedge between the Administration and 1) Democrats who want “order at the border” and a reduction in extralegal entries; 2) Democrats who believe in strictly honoring our legal, Constitutional, treaty, and human rights obligations to asylum seekers regardless of race; and 3) Democrats who believe that both 1) and 2) are achievable!

I have no idea what the Biden Administration’s “vision” of border law and policy is. But, I can tell you for sure that it’s NOT working and that more, harsher, racially discriminatory enforcement without reinstating our refugee and asylum systems and reforming the totally dysfunctional Immigration Courts is NOT the answer!

OBSERVATION: The Biden Administration has been in office for 17 months. During that time the could have established a realistic, robust refugee program, working with UNHCR and NGOs, to screen and process those waiting in Mexico.

Those who qualified would be admitted in legal status, with permanent work authorization, on their way to green cards and eventual citizenship. No CBP, no Asylum Office Backlogs, no backlogged Immigration Courts, no arbitrary, capricious, wildly inconsistent decisions from EOIR and the 5th Circuit, no expensive and inhumane detention, no ankle bracelets. Those legally admitted would also be eligible immediately for refugee resettlement assistance! America is something like 11 million workers “short” — the answer is staring us in the face! It’s also worth noting that the so-called “record numbers” at the border often count the same person over and over — a phenomenon aggravated by arbitrary use of Title 42 to return many individuals without proper legal screening.

WASHINGTON — Attorney General Merrick Garland on Thursday reversed an order from Trump’s Attorney Generald Jeff Sessions that barred immigration judges from closing cases and removing them from their docket if they deem them low-priority.

The move will cut down on the ballooning backlog of immigration cases in the U.S., now surpassing 1.3 million, according to data compiled by TRAC out of Syracuse University.

Garland said in his order that immigration judges’ ability to administratively close cases previously allowed “government counsel to request that certain low-priority cases be removed from the immigration judges’ active calendars,” thereby allowing judges “to focus on higher-priority cases.”

Garland previously overturned two other immigration court decisions by his Trump-era predecessors that had made it harder for victims of gang and domestic violence to win asylum.

Immigration advocates also believe uncertainty surrounding the Title 42 policy is driving many migrants to take more dangerous routes to avoid being apprehended all together.

“The Biden administration’s retention of Title 42 and refusal to open the legal ports of entry is having the perverse effect of forcing desperate asylum seekers fleeing danger to cross between the ports, which is to nobody’s benefit,” said Lee Gelernt, deputy director of the ACLU’s immigrants’ rights project and a lead plaintiffs’ lawyer in a lawsuit challenging the use of Title 42.

For now, the Biden administration has made no promises of end dates for the Title 42 policy, even as Covid-19 restrictions ease across the country. Department of Homeland Secretary Alejandro Mayorkas has said that the policy is in place to protect both migrants, who would need to be kept temporarily in congregate care settings if allowed in, and agents.

Gelernt said the policy of only guaranteeing unaccompanied children entry forces some families to self-separate in order to give their children the best chance of seeking asylum in the U.S.

The expertise, practical problem solving ability, and resources are available. Most of it is in the private/NGO/academic sectors right now. These are the leaders and experts the Biden Administration should have brought into Government “right off the bat” to solve the problem, but has tragically failed to do so. Not like they were’t told well in advance!

It won’t happen with the bureaucrats and “tunnel visioners” the Biden Administration is relying upon  — folks committed to repeating the failures of the past who lack the experience, vision, courage, independence, and creative problem solving ability necessary to lead the way to a better future. Using the law (or lack thereof) as a “deterrent” and issuing threats won’t stop desperate refugees from coming. As we can see, it only “turns them off” on using our (unavailable and now largely defunct) legal system and drives them first into the hands of traffickers and smugglers and eventually into our underground “extralegal” population.

Human migration is eons older than our republic! It won’t be eradicated or turned off and on by the utterances and actions of politicos and law enforcement officials.  It requires a thoughtful, informed approach that has been largely absent from our government for decades, which is why the failures and resulting human trauma, wasted resources, and squandered human opportunities persist Administration after Administration, regardless of party and rhetoric.

Jeff “Gonzo Apocalypto” Sessions had no problem running all over the rule of law when he wanted to implement his illegal, White Nationalist, misogynist agenda and degrade asylum seekers with dehumanization and “Dred Scottification” of the other, primarily women, children, and  individuals of color.

Unfortunately, by contrast, the Biden Administration, is too weak-kneed to stand up for the rule of law and human dignity!

But, folks like Julia Ainsley and her team are making a permanent public record. As in the Trump Administration, the Biden Administration doesn’t appear to recognize the concept of accountability in Government, particularly as applied to itself. But, I doubt history will be as kind and as accommodating to those, regardless of political affiliation, carrying out these illegal, irrational,  inhumane, and “designed to fail” policies.

Perhaps, the “dead can’t speak!” ☠️⚰️ But, others certainly can and will speak for them and see that the abusers of humanity are held accountable.

WASHINGTON — The White House is expected to select Michelle Brané of the Women’s Refugee Commission as the executive director of the task force to reunite migrant families separated by the Trump administration, three sources familiar with the decision tell NBC News.

The selection of Brané, director of migrant rights and justice programs at the Women’s Refugee Commission, is welcome news to the immigration advocate community, as most of the task force is made of government officials.

“If selected, Michelle would be a fantastic choice. She would bring deep expertise on the issues and the perfect mixture of passion and common sense,” said Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project.

President-elect Joe Biden will roll out a sweeping overhaul of nation’s immigration laws the day he is inaugurated, including an eight-year pathway to citizenship for immigrants without legal status and an expansion of refugee admissions, along with an enforcement plan that deploys technology to patrol the border.

Biden’s legislative proposal, which will be sent to Congress on Wednesday, also includes a heavy focus on addressing the root causes of migration from Central America, a key part of Biden’s foreign policy portfolio when he served as vice president.

The centerpiece of the plan from Biden and Vice President-elect Kamala D. Harris is the eight-year pathway, which would put millions of qualifying immigrants in a temporary status for five years and then grant them a green card once they meet certain requirements such as a background check and payment of taxes. They would be able to apply for citizenship three years later.

The focus on Central America reflects the message that Biden has relayed to senior officials in the region: that he will advocate for policy changes aimed at what drives scores of migrants there to come to the United States illegally to seek safe harbor.

“Ultimately, you cannot solve problems of migration unless you attack the root causes of what causes that migration,” one official said, pointing to the various reasons — from economic to safety — that drive migrants to flee their home countries. “He knows that in particular is the case in Central America.”

Transition officials are aware of recent reports of the increased numbers of migrants at or heading to the border in anticipation of the end of Trump’s presidency, and urged them to stay in their home countries. They emphasized that newly arriving immigrants would not qualify for the legalization program that Biden proposes.

Biden wants to move the refugee and asylum systems “back to a more humane and orderly process,” the official said. But “it’s also been made clear that that isn’t a switch you flip overnight from the 19th to the 20th, especially when you’re working with agencies and processes that have been so gutted by the previous administration.”

Biden hopes to reinstate a program granting minors from Central America temporary legal residence in the United States. The Trump administration terminated the program in August 2017, officials said. The administration also wants to set up a reunification program for Central American relatives of U.S. citizens that would allow those who have been already approved for U.S. residency to be admitted into the country, rather than waiting at home for an opening. The program would be similar to ones that existed for Cubans and Haitians but also were ended by the Trump administration.

The Biden proposal also would put in place a refugee admissions program at multiple processing centers abroad that would better help identify and screen those who would qualify to be admitted as refugees into the United States.

As for border enforcement, the plan calls on the Department of Homeland Security to develop a proposal that uses technology and other similar infrastructure to implement new security measures along the border, both at and between ports of entry. Biden has long vowed not to expand the border wall Trump has marginally extended.

“This is not a wall; this is not taking money from [the Department of Defense],” a transition official said, referring to how Trump helped to finance his wall after pledging Mexico would pay for it. “It’s a very different approach.”

This is a welcome change from the poorly conceived, often ill-informed approach to immigration by the Obama Administration. It appears that Biden and Harris have actually “listened to the experts” and acted a accordingly.

The concentration on addressing the reality of Central American migration and dealing honestly and constructively with its root causes in a sensible and humane way is also refreshing. Using intelligence and technology to address real border security issues (as opposed to squandering resources on politically manufactured ones) also shows promise.

Many of the latter were  energized by the Trump/DHS program of White Nationalist racist fear-mongering and intentionally false anti-immigrant, anti-due-process narratives. That’s what “applied malicious incompetence” looks like — DHS and EOIR are two of the most egregious examples in a regime that raised it to an “art form.” It will take an aggressive and far-reaching “house cleaning” to get these agencies that have abandoned the common good and now operate “on the dark side” back on track.

The immediate “knee-jerk opposition” to rational, practical, fact-based immigration reform by notorious White Nationalist racist Sen. Tom Cotton (R-ARK) shows that Team Biden is on the right track to disavow the toxic institutionalized racism and biased policies of the Trump regime and move America along the path to racial justice and realistic, progressive immigration policies that will further the national interest and lead to a better future for all!

It’s a great, if long overdue, start to getting beyond Jim Crow and “Dred Scottification” and saving and enhancing our democracy! But, the proof will be in the results!

Biden, of course, will also face the formidable challenges of dealing with the human carnage left behind by the Trump regime’s disastrous mis-handling of COVID-19, economic inequality, the environment, racial justice, and foreign policy where American “prestige” has plummeted to levels not seen since the days of the Barbary Pirates.

He also must address a failing Federal Justice System that, particularly at its appellate levels, did not effectively stand up to the Trump regime’s  unrelenting assault on human decency and American democracy. You could say that about almost everything in the departing, defeated White Nationalist regime!

I’ll note for the record that among other things, the Supremes’ tone-deaf majority has been responsible for letting bona fide asylum seekers rot in squalor in camps in Mexico while waiting for non-existent “due process,” and also authorized the imposition of potential death sentences and torture on asylum seekers within our jurisdiction without any whit of due process.

The GOP majority’s disgraceful failure to stand up for voting rights of African Americans, Latinos, and other voters of color has also deepened racial injustice in America and helped usher in a horrible “Jim Crow Revival” pushed, incited, and enabled by the GOP, “The Party of the Failed Insurrection.”

Any competent first-year law student might ask “How could this happen in America?” That’s a question that Roberts and his gang of fellow Trump enablers and apologists will have to answer before the “court of history!”

WASHINGTON — The Trump White House blocked the Justice Department from making a deal in October 2019 to pay for mental health services for migrant families who had been separated by the Trump administration, two current and two former senior administration officials told NBC News.

Three sources involved in the discussions who requested anonymity said the Office of White House Counsel made the decision to reject the settlement of a federal lawsuit after consultation with senior adviser Stephen Miller, the driving force behind many of President Donald Trump’s immigration policies, including family separations.

“DOJ strongly, and unanimously, supported the settlement, but not all agencies involved were on the same page,” an administration official said. “Ultimately, the settlement was declined at the direction of the White House counsel’s office.”

Another administration official said: “Ultimately, it was Stephen who prevailed. He squashed it.”

The White House’s refusal to accept the deal ended up costing taxpayers $6 million.

What kind of people are we? As a society, are we so decadent and insecure that we show “toughness” by deliberately being cruel to innocent children? Is this what our nation has come to? Or are we better than that?

This election demands we answer those questions. The choice between President Trump and Joe Biden is not just political. It is also moral. And perhaps nothing more starkly illustrates the moral dimension of that decision than the Trump administration’s policy of kidnapping children at the southern U.S. border, ripping them away from their families — and doing so for no reason other than to demonstrate Trump’s warped vision of American strength.

We learned this week that some of those separations will probably be permanent. As NBC News first reported, 545 boys and girls taken as many as three years ago — the children of would-be immigrants and asylum seekers, mostly from Central America — have not been reunited with their parents and may never see their families again.

These are not among the nearly 3,000 families separated at the border in 2018, when children were kept in cages like animals or shipped away to facilities across the country, hundreds or thousands of miles from the border. We now know, thanks to the American Civil Liberties Union and other pro bono lawyers, that an additional 1,500 children were torn away from their families beginning in 2017, when the Trump administration conducted a trial run of the separation policy.

Please think about that. The shocking scenes we saw two years ago did not result from a sudden spasm of presidential anger. They didn’t stem from a Fox News segment Trump might have seen one evening. Rather, the administration rehearsed this form of cruelty.

What the administration did not plan for was how to reunite the children taken in 2017 with their families. Many of the parents were deported, and their children were placed in shelters around the country, then ostensibly released to parents or guardians, placements that the ACLU is still trying to confirm.

The ACLU and other organizations have sent investigators to towns and villages in Central America in an attempt to find the kidnapped children’s families — an effort complicated not just by time and distance, but also by the covid-19 pandemic. Parents of 545 children have not been found, the ACLU reported this week.

Disturbingly, the Department of Homeland Security suggested that some of the parents declined to get their children back so they could remain in the United States. Keep in mind that most of these families were seeking asylum from deadly violence in their home countries. The Trump administration changed immigration guidelines to make it unlikely that the families would ultimately be allowed to stay in the United States, but federal law gives them the right to apply for asylum and to have their cases heard. They did nothing wrong. They should never have been asked to choose between parenting their children and getting them to safety — not by their home countries, and not by the United States.

Trump’s racism and xenophobia have been hallmarks of his presidency from the beginning, so perhaps it should be no surprise that he would preside over such an outrage. But he didn’t do this by himself. He had plenty of help.

Former attorney general Jeff Sessions seized an opportunity to make his rabid antipathy toward Hispanic immigration into policy. White House senior adviser Stephen Miller, a former Sessions aide in the Senate, was the architect of Trump’s “zero tolerance” immigration policy. Then-White House Chief of Staff John F. Kelly said in 2018 that the children taken would be “taken care of — put into foster care or whatever.” Former homeland security secretary Kirstjen Nielsen said last year that she regretted that “information flow and coordination to quickly reunite the families was clearly not in place” — but not the separations themselves.

President Donald Trump’s administration started and carried out a policy that took more than 4,000 children from their parents, at least 545 of whom are still split apart years later. But at Thursday’s debate, the president insisted that he did nothing wrong at all ― blaming his Democratic predecessors and even insisting the kids are doing fine.

“They are so well taken care of,” Trump said of the children taken from their parents by his administration. “They’re in facilities that were so clean.”

Trump’s first term was marked by a full-out assault on immigration, both legal and unauthorized. The most dramatic was his “zero tolerance” policy on unauthorized border-crossing, used in a 2017 pilot program and expanded more broadly in 2018, that led to criminal prosecution of parents and locking up their kids separately. Splitting up families was intentional and calculated, according to multiple reports.

Thanks to mass public outrage and a court order, Trump was forced to stop his family separation policy. Most families were reunited, but the American Civil Liberties Union, which was part of the lawsuit against the government that stopped the policy, said this week that at least 545 kids are still away from their parents.

“Their kids were ripped from their arms and separated,” Democratic nominee Joe Biden said during the debate. “And now they cannot find over 500 sets of those parents and those kids are alone. Nowhere to go. Nowhere to go. It’s criminal.”

That is the number of children still separated from their families by the Trump administration — separated deliberately, cruelly and recklessly. They might never be reunited with their parents again. Even if they are, the damage is unimaginable and irreparable.

Even one would be too many. Each one represents a unique tragedy. Imagine being ripped from your parents, or having your child taken from you. Imagine the desperation that the parents feel, the trauma inflicted on their children.

That number represents an indelible stain on President Trump and every individual in his administration who implemented this policy, flawed at the conception and typically, gruesomely incompetent in the execution. It is, perhaps in the technical sense but surely in the broader one, a crime against humanity. It is torture.

That number — I will stop repeating it, yet it cannot be repeated enough — represents a moral challenge and responsibility for the next administration. If Joe Biden is elected president, he must devote the maximum resources of the federal government to fixing this disaster. The United States broke these families; it must do whatever it takes to help them heal.

Nothing like that would happen in a second Trump term, because Trump himself doesn’t care. He doesn’t grasp the horror that he oversaw. He doesn’t comprehend the policy, and he is incapable of feeling the pain it inflicted.

Those truths could not have been clearer cut than during Thursday night’s debate.

Moderator Kristen Welker of NBC News asked the president a simple question: “How will these families ever be reunited?”

First, Trump misstated the situation: “Their children are brought here by coyotes and lots of bad people, cartels, and they’re brought here, and they used to use them to get into our country.”

No. These are children separated from their families, not separated from smugglers. They are children brought by their parents in desperate search of a better life, desperate enough that they would take the risk of the dangerous journey.

Then Trump pivoted to the irrelevant: “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers. And we let people in, but they have to come in legally.”

Welker persisted: “But how will you reunite these kids with their families, Mr. President?”

Trump responded by pointing his finger at his predecessor: “Let me just tell you, they built cages. You know, they used to say I built the cages, and then they had a picture in a certain newspaper and it was a picture of these horrible cages and they said look at these cages, President Trump built them, and then it was determined they were built in 2014. That was him.”

This is typical Trumpian deflection, bluster undergirded by ignorance. The “cages” are ugly but irrelevant to the topic at hand: the deliberately cruel plan to deter border-crossing by separating children from parents. That was a Trump administration special, implemented with callous sloppiness and so extreme that even the Trump administration abandoned it.

Welker, for the third time: “Do you have a plan to reunite the kids with their families?”

At which point Trump made clear that he did not: “We’re trying very hard, but a lot of these kids come out without the parents, they come over through cartels and through coyotes and through gangs.” The children, he added later, “are so well taken care of, they’re in facilities that were so clean.”

The third and final presidential debate gave Donald Trump and Joe Biden the opportunity to make their final pitch to the American people before the 2020 election. For the Democratic nominee, that meant driving home the point that he believes in science, that he’ll take the COVID-19 pandemic seriously, that climate change is real, and that systemic racism must be dealt with. For Trump, it meant making it clear that in addition to being a science-denying, QAnon-promoting dimwit, he’s also an actual monster who thinks separating small children from their parents, in some cases permanently, is absolutely fine.

Asked by moderated Kristen Welker about the news that parents of 545 children separated at the border—60 of whom are under the age of five—cannot be located, Trump defended the policy and gave no explanation for how the government plans to find these people and reunite their families. “Children are brought here by coyotes and lots of bad people, cartels, and they’re brought here and they used to use them to get into our country,” Trump said, which is objectively false, as they are brought here by their parents, which is why it’s called the family separation policy. “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers and we let people in but they have to come in legally.”

Noting that Trump hadn’t answered the question, Welker pressed: “But how will you unite these kids with their families?”

“They built cages, they used to say I built cages…that was him,” Trump said, pointing to Biden and referring to the fact that the Obama administration did build temporary enclosures but failing, naturally, to mention that his predecessor did not separate families.

“Do you have a plan to reunite the kids with their parents?” Welker asked a third time. Again, Trump responded by claiming that the children “come without the parents, they come over through cartels and through coyotes and through gangs.”

At this point, Joe Biden was given a chance to weigh in and used his time to describe the policy implemented by Trump as the horror show all non-sociopaths know it to be. “Parents, their kids were ripped from their arms and they were separated and now they cannot find over 500 sets of those parents and those kids are alone, nowhere to go. It’s criminal.”

Then Trump interjected with what he apparently believed was an important point that would cast his administration in a much more favorable light and perhaps might even win it some awards or sainthood by the Catholic church. “Kristen, I will say this,” he told the moderator, of the children stolen from their parents. “They’re so well taken care of. They’re in facilities that are so clean.

With regard to that claim, NBC News reporter Jacob Soboroff weighed in on that after the debate, telling Rachel Maddow: “I was one of the reporters I guess the president mentioned, they invited me to go to the epicenter of this policy…what I saw was little children sitting on concrete floors, covered by mylar blankets, supervised by security contractors in a watchtower, it makes me sick every time I recall it. And Physicians for Human Rights…called this torture…the American Academy of Pediatrics called this state-sanctioned child abuse, and the president of the United States I guess interprets that as children being well taken care of.”

Trump cabinet officials voted in 2018 White House meeting to separate migrant children, say officials

WASHINGTON — In early May 2018, after weeks of phone calls and private meetings, 11 of the president’s most senior advisers were called to the White House Situation Room where they were asked, by a show-of-hands vote, to decide the fate of thousands of migrant parents and their children, according to two officials who were there.

Trump’s senior adviser, Stephen Miller, led the meeting and, according to the two officials, he was angry at what he saw as defiance by Department of Homeland Security Secretary Kirstjen Nielsen.

It had been nearly a month since then-Attorney General Jeff Sessions had launched the Trump administration’s “zero tolerance” policy, announcing that every immigrant who crossed the U.S. border illegally would be prosecuted, including parents with small children. But so far, U.S. border agents had not begun separating parents from their children to put the plan into action, and Miller, the architect of the Trump administration’s crackdown on undocumented immigrants, was furious about the delay.

Those invited included Sessions, Nielsen, Health and Human Services Secretary Alex Azar and newly installed Secretary of State Mike Pompeo, according to documents obtained by NBC News.

Nielsen told those at the meeting that there were simply not enough resources at DHS, nor at the other agencies that would be involved, to be able to separate parents, prosecute them for crossing the border and return them to their children in a timely manner, according to the two officials who were present. Without a swift process, the children would enter into the custody of Health and Human Services, which was already operating at near capacity.

Two officials involved in the planning of zero tolerance said the Justice Department acknowledged on multiple occasions that U.S. attorneys would not be able to prosecute all parents expeditiously, so sending children to HHS was the most likely outcome.

As Nielsen had said repeatedly to other officials in the weeks leading up to the meeting, according to two former officials, the process could get messy and children could get lost in an already clogged system.

Miller saw the separation of families not as an unfortunate byproduct, but as a tool to deter more immigration. According to three former officials, he had devised plans that would have separated even more children. Miller, with the support of Sessions, advocated for separating all immigrant families, even those going through civil court proceedings, the former officials said.

While “zero tolerance” ultimately separated nearly 3,000 children from their parents, what Miller proposed would have separated an additional 25,000, including those who legally presented themselves at a port of entry seeking asylum, according to Customs and Border Protection data from May and June 2018.

That plan never came to fruition, in large part because DHS officials had argued it would grind the immigration process to a halt. But after Sessions’ announcement that all families entering illegally would be prosecuted, the onus had fallen on DHS to act.

At the meeting, Miller accused anyone opposing zero tolerance of being a lawbreaker and un-American, according to the two officials present.

“If we don’t enforce this, it is the end of our country as we know it,” said Miller, according to the two officials. It was not unusual for Miller to make claims like this, but this time he was adamant that the policy move forward, regardless of arguments about resources and logistics.

No one in the meeting made the case that separating families would be inhumane or immoral, the officials said. Any moral argument regarding immigration “fell on deaf ears” inside the White House, said one of the officials.

“Miller was tired of hearing about logistical problems,” said one of the officials. “It was just, ‘Let’s move forward and staff will figure this out.'”

Frustrated, Miller accused Nielsen of stalling and then demanded a show of hands. Who was in favor of moving forward, he asked?

A sea of hands went up. Nielsen kept hers down. It was clear she had been outvoted, according to the officials.

In the days immediately following the meeting, Nielsen had a conversation with then-CBP Commissioner Kevin McAleenan inside her office at the Ronald Reagan Building, and then signed a memo instructing DHS personnel to prosecute all migrants crossing the border illegally, including parents arriving with their children.

So, separated families and children continue to suffer, much of the harm and trauma irreparable and life-defining. This “policy” was so clearly illegal and unconstitutional that DOJ attorneys conceded its unconstitutionality in Federal Court. 

However, in an ethics-free DOJ, those same lawyers falsely claimed that there was no such policy. Rudimentary “due diligence” on their part, required by professional ethics, would have revealed that their representations on behalf of corrupt institutional “clients” were false.

The article also confirms the complicity of Kevin “Big Mac  With Lies” McAleenan in gross, intentional human rights violations. Courtside exposed “Big Mac” long ago! 

While the victims continue to suffer, Miller, Sessions, Nielsen, Big Mac, and other cowards who planned and carried out these “crimes against humanity,” directed at some of the most vulnerable humans in the world, remain at large. Some, like Miller, actually remain on the “public dole.” Likely, so do the DOJ lawyers who unprofessionally defended and helped obscure this misconduct in Federal Court.

It’s also worth examining the role of U.S. Magistrate Judges and U.S. District Judges along the southern border, most of whom turned a blind eye to the transparent racial and political motives, not to mention the grotesque misallocation of public resources, driving Sessions’s “zero tolerance” misdirection of scarce prosecutorial resources from serious felonies to minor immigration prosecutions. 

As I’ve been saying, “Better Federal Judges for a better America!” And, better Federal Judges start with removal of the Trump regime as well as the ousting of “Moscow Mitch” and the GOP from Senate control. 

Will there ever be accountability? Our national soul and future might depend on the answer!

The Trump administration has proposed a new rule that would allow it to deny asylum to immigrants who are deemed a public health risk.

The soon-to-be published rule would let the Department of Homeland Security and Department of Justice to block immigrants from seeking asylum in the U.S. based on “potential international threats from the spread of pandemics,” according to a notice announcing it Wednesday.

The rule would apply to immigrants seeking asylum and those seeking “withholding of removal” — a protected immigration status for those who have shown they may well face danger if returned to their home countries.

This outrageous, totally pretextual, racist proposal violates the Constitution, asylum laws, international agreements, morality, and human values. The factual basis is absurd since there has been no showing that asylum applicants are a source of COVID spread. To the contrary, unnecessarily detained asylum applicants have been victims of Trump’s failed policies. Moreover, if DHS actually were worried about COVID, they could easily test and quarantine to identify and deal constructively and humanely with the few applicants who might have been infected someplace other than DHS facilities.

This is White Nationalist racism at its worst.

We need better judges, and particularly better Justices on the Supremes, for a better America! Judges who will prevent, rather than encourage, racist-driven “crimes against humanity.” Standing up against such crimes, particularly when they are disgracefully directed by a racist Executive at our most vulnerable humans, should be a “no-brainer” for a unanimous Supremes with Justices qualified for the high offices they hold. For the “JR Five” a “no brainer” has too often been a “non-starter.” So, the regime’s gross abuses of migrants and people of color and the damage, societal disorder, wasted time, squandered resources, and the human misery they cause roll on.

“Dred Scottification” is wrong! Period! And Supreme Court Justices who enable it are wrong for America!

WASHINGTON — The Trump administration has expedited the deportation of child migrants during the coronavirus pandemic, citing public health, but documents obtained by NBC News show that as far back as 2017, now–DHS Acting Secretary Chad Wolf sought to expedite child deportations in order to discourage Central American asylum seekers.

Recent reports from immigration lawyers, DHS officials and congressional staff have indicated a rise in the number of rapid deportations of unaccompanied migrant children. Previously, children who arrived in the U.S. without a parent or legal guardian were given protections under anti-trafficking laws, which included the right to claim asylum and to be placed in the custody of the Department of Health and Human Services until they could be placed with a guardian.

The New York Times recently reported that more than 900 children have been deported under a new policy that sends children back to their home countries before they have had a chance to coordinate plans with a guardian at home or claim asylum in the U.S.. Many of those children, according to the Times, were in the U.S. and living in HHS custody or with family members before the pandemic began.

DHS has said the deportations are justified under Title 42, which allows restrictions on immigration to slow the spread of disease.

But a 2017 policy proposal by Wolf shows that the agency has long sought the ability to deport children more quickly, long before the threat of a virus gave it cover to do so.

The documents were first obtained by Sen. Jeff Merkley, D.-Ore., and then shared with NBC News.

Wolf, who was then chief of staff to DHS Secretary Kirstjen Nielsen, sent a collection of policy ideas to the Justice Department, which included plans to reclassify unaccompanied migrant children as accompanied once they had been placed in the care of a parent or sponsor.

WASHINGTON — Several immigrant rights organizations are outraged by a new choice U.S. Immigration and Customs Enforcement is presenting to migrant parents: Separate from your child or stay together in detention indefinitely.

Starting on Thursday, the groups claim, ICE began distributing a form in all three of its family detention centers that would allow parents to apply for their minor children to be released. The form, a copy of which was obtained by NBC News, states that it is in compliance with the Flores court agreement, which prohibits ICE from holding minors for more than 20 days.

The released children are placed with family members, sponsors or placed in the custody of the Department of Health and Human Services.

The Trump administration faced intense criticism for a Zero Tolerance policy in 2018 in which undocumented migrant children were separated from parents who had illegally crossed the order. The policy was implemented in May 2018 but reversed after an outcry in June.

The current, “voluntary” concept was previously termed “binary choice,” but has never been fully implemented. Now, lawyers representing clients in ICE family detention say parents may be persuaded to separate from their children if they are worried about exposing them to COVID-19 in detention.

The timing is no coincidence, said Shayln Fluharty, director of the Dilley Pro Bono Project, which provides legal services for families in detention in Dilley, Texas. A federal judge recently told ICE it was not in compliance with the Flores agreement, and the forms, said Fluharty, are a way for ICE to show that these parents have chosen to keep their children in detention.

Just another “in your face” unlawful move by DHS officials sending a strong message of contempt to the Federal Judges handling various aspects of the regime’s intentional child abuse, family separation, and punishing asylum seeking families by needless imprisonment in the New American Gulag (“NAG”).

 

Yes, the District Court Judges handling these matters have ordered the Government to take various forms of corrective action. But, even where the judges use forceful language, it’s largely ineffective to change illegal policies. The regime and its officials just play “hide the ball” and develop schemes and “work arounds” to violate the law and court orders in other ways. That they continue to do this over and over – a strategy known as “malicious compliance” – shows their total disrespect for the Federal Courts and that they share Trump and Miller’s belief that they are above the law.

 

So far, particularly in the immigration and refugee area, the scofflaws have largely prevailed. They have dismembered immigration and asylum laws with neither legislative enactments nor meaningful judicial consequences. They have publicly and arrogantly “thumbed their noses” at court orders they don’t like. Unless and until the Federal Judges back up their orders by holding Chad Wolf and other scofflaw officials in contemptreal contempt – jail time not just meaningless fines – the abuse and the open disregard for the rule of law and for the authority of Federal Judges will continue.

 

The law, our Constitution, and human rights will continue to be mocked. Even the best of Federal Judges will appear feckless unless and until they start treating immigration officials as the lawless criminals they actually are!

 

Undoubtedly, some of the children and families intentionally being abused, dehumanized, and punished  by the Trump regime as Federal Courts play bystander won’t survive long enough to tell their stories. But, some will. While those officials, legislators, and judges enabling, or in some cases masterminding and encouraging, these abuses appear likely to escape “temporal” legal accountability for their actions, moral and historical accountability are a different matter altogether. Lots of folks who believe they are “operating under the radar screen” are going to look very bad when the light of history shines on the grotesque human rights, moral, and constitutional violations at our borders and in our Gulags and those who carried them out or failed to effectively halt them.

Trump admin announces rule further limiting immigrants’ eligibility for asylum

DUIs, drug paraphernalia possession and unlawful receipt of public benefits would be among seven triggers barring migrants from even applying for asylum.

WASHINGTON — The Trump administration announced a new rule Wednesday that would further limit immigrants’ eligibility for asylum if they have been convicted of certain crimes, including driving under the influence and possession of drug paraphernalia.

The rule, if finalized, would give asylum officers seven requirements with which to deem an immigrant ineligible to apply for asylum.

Other acts that would make an immigrant ineligible for asylum under the new rule include the unlawful receipt of public benefits, illegal re-entry after being issued a deportation order and being found “by an adjudicator” to have engaged in domestic violence, even if there was no conviction for such violence.

The rules could eliminate large numbers of asylum-seekers from ever having their cases heard in court. Currently, immigration courts have a backlog of over 1 million cases, according to data kept by Syracuse University.

In a statement, the Department of Justice and the Department of Homeland Security said the new rule would “increase immigration court efficiencies.”

Andrew Free, an immigration attorney based in Nashville, said the new regulation is “calculated to enable the denial of as many claims as possible.”

Free said the most common charges he sees for his immigrant clients are driving under the influence, domestic violence and driving without a license. Driving without a license is particularly common for immigrants who have had to use fake travel documents to enter the U.S. and live in states that do not give licenses to undocumented migrants.

“People who are fleeing persecutions and violence are not going to be able to get travel documents from the governments inflicting violence upon them. If you have to resort to other means of proving your identity, you won’t be eligible [for asylum,]” Free said.

The Trump administration has unveiled a number of new requirements meant to curb asylum applications this year. The most successful of those policies has been “Remain in Mexico” or MPP, that requires lawful asylum-seekers from Central America to wait in Mexico, often in dangerous conditions, until their court date in the United States. Over 60,000 asylum-seekers are currently waiting in Mexico for a decision to be made in their case, a process that can take over a year.

The Beat Goes On! Joint Notice of Proposed Rulemaking to Restrict Certain “Criminal Aliens'” Eligibility for Asylum

Consistent with the efforts to facilitate removal of “criminal aliens,” the Department of Justice and Department of Homeland Security released the announcement below today:

“The Department of Justice and the Department of Homeland Security (collectively, “the Departments”) today issued a notice of proposed rulemaking (NPRM) that would amend their respective regulations in order to prevent certain categories of criminal aliens from obtaining asylum in the United States. Upon finalization of the rulemaking process, the Departments will be able to devote more resources to the adjudication of asylum cases filed by non-criminal aliens.

Asylum is a discretionary immigration benefit that generally can be sought by eligible aliens who are physically present or arriving in the United States, irrespective of their status, as provided in section 208 of the Immigration and Nationality Act (INA), 8 U.S.C. § 1158. However, in the INA, Congress barred certain categories of aliens from receiving asylum. In addition to the statutory bars, Congress delegated to the Attorney General and the Secretary of Homeland Security the authority to establish by regulation additional bars on asylum eligibility to the extent they are consistent with the asylum statute, as well as to establish “any other conditions or limitations on the consideration of an application for asylum” that are consistent with the INA. Today, the Attorney General and Secretary of Homeland Security are proposing to exercise their regulatory authority to limit eligibility for asylum for aliens who have engaged in specified categories of criminal behavior. The proposed rule will also eliminate a regulation concerning the automatic reconsideration of discretionary denials of asylum applications in limited cases.

The proposed regulation would provide seven additional mandatory bars to eligibility for asylum. The proposed rule would add bars to eligibility for aliens who commit certain offenses in the United States.Those bars would apply to aliens who are convicted of:

(1) A felony under federal or state law;

(2) An offense under 8 U.S.C. § 1324(a)(1)(A) or § 1324(a)(1)(2) (Alien Smuggling or Harboring);

(3) An offense under 8 U.S.C. § 1326 (Illegal Reentry);

(4) A federal, state, tribal, or local crime involving criminal street gang activity;

(5) Certain federal, state, tribal, or local offenses concerning the operation of a motor vehicle while under the influence of an intoxicant;

(6) A federal, state, tribal, or local domestic violence offense, or who are found by an adjudicator to have engaged in acts of battery or extreme cruelty in a domestic context, even if no conviction resulted; and

(7) Certain misdemeanors under federal or state law for offenses related to false identification; the unlawful receipt of public benefits from a federal, state, tribal, or local entity; or the possession or trafficking of a controlled substance or controlled-substance paraphernalia.

The seven proposed bars would be in addition to the existing mandatory bars in the INA and its implementing regulations, such as those relating to the persecution of others, convictions for particularly serious crimes, commission of serious nonpolitical crimes, security threats, terrorist activity, and firm resettlement in another country.

Under the current statutory and regulatory framework, asylum officers and immigration judges consider the applicability of mandatory bars to asylum in every proceeding involving an alien who has submitted an application for asylum. Although the proposed regulation would expand the mandatory bars to asylum, the proposed regulation does not change the nature or scope of the role of an immigration judge or an asylum officer during proceedings for consideration of asylum applications.

The proposed rule would also remove the provisions at 8 C.F.R. § 208.16(e) and §1208.16(e) regarding reconsideration of discretionary denials of asylum. The removal of the requirement to reconsider a discretionary denial would increase immigration court efficiencies and reduce any cost from the increased adjudication time by no longer requiring a second review of the same application by the same immigration judge.” (bold added).

What total, unadulterated BS and gratuitous cruelty!

For example, 8 C.F.R. § 208.16(e) and §1208.16(e) are humanitarian provisions that seldom come up except in highly unusual and sympathetic cases. The idea that they represent a “drain” on IJ time is preposterous! And, if they did, it would be well worth it to help to keep deserving and vulnerable refugee families together!

I had about three such cases involving those regulations in 13 years on the bench, although I cited the existing regulation for the proposition that discretionary denials are disfavored, as they should be under international humanitarian laws. Federal Courts and the BIA have held that asylum should not be denied for “discretionary reasons” except in the case of “egregious adverse factors.” Therefore, an Immigration Judge properly doing his or her job would very seldom have occasion to enter a “discretionary denial” to someone eligible for asylum. Obviously, the regime intends to ignore these legal rulings.

One of my colleagues wrote “they are going to capture a lot of people and force IJs to hear separate asylum applications for each family member. So counterproductive.”

Cruelty, and more “aimless docket reshuffling” is what these “maliciously incompetent gimmicks” are all about.

I note that this is a “joint proposal” from EOIR and DHS Enforcement, the latter supposedly a “party” to every Immigration Court proceeding, but actually de facto in charge of the EOIR “judges.” That alone makes it unethical, a sign of bias, and a clear denial of Due Process for the so-called “court” and the “Government party” to collude against the “private party.”

When will the Article IIIs do their job and put an end to this nonsense? It’s not “rocket science.” Most first year law students could tell you that this absurd charade of a “court” is a clear violation of Due Process! So, what’s the problem with the Article IIIs? Have they forgotten both their humanity and what they learned in Con Law as well as their oaths of office they took upon investiture?

Right now, as intended by the regime with the connivance and complicity of the Article IIIs, those advocating for the legal, constitutional, and human rights of asylum seekers are being forced to divert scarce resources to respond to the “regime shenanigan of the day.” It’s also abusing and disrespecting the Article III Courts. Why are they so blind to what’s REALLY going on when the rest of us see it so clearly? These aren’t “legal disputes” or “legitimate policy initiatives.” No, they are lawless outright attacks on our Constitution, our nation, our human values, and our system of justice which Article III Judges are sworn to uphold!

WASHINGTON — The Trump administration is pulling $271 million in funding from the Department of Homeland Security, including the Federal Emergency Management Agency’s Disaster Relief Fund, to pay for immigration detention space and temporary hearing locations for asylum-seekers who have been forced to wait in Mexico, according to department officials and a letter sent to the agency by a California congresswoman.

To fund temporary locations for court hearings for asylum-seekers along the southern border, ICE would gain $155 million, all from FEMA’s Disaster Relief Fund, according to the letter from Rep. Lucille Roybal-Allard, D-Calif., which was seen by NBC News.

The allocations were sent to Congress as a notification rather than a request, because the administration believes it has the authority to repurpose these funds after Congress did not pass more funding for ICE detention beds as part of an emergency funding bill for the southwest border in June.

Specifically, the Department of Homeland Security will lose $116 million previously allocated for Coast Guard operations, aviation security and other components in order to fund nearly 6,800 more beds for immigrant detainees, the officials said.

“We would not say this is with no risk but we would say that we worked it in a way to…minimize the risk. This was a must pay bill that needed to be addressed,” said a DHS official, who noted that the funds would begin transfer immediately to fund ICE through Sept. 30.

Combined with existing space, the funding would allow ICE to detain nearly 50,000 immigrants at one time.

The Trump administration has claimed that the sudden rise in border crossings in 2019 has overwhelmed resources at the border, and that the lack of detention space at ICE has caused backlogs at border stations that offer migrants substandard conditions.

In July, there were 82,049 undocumented migrants who were apprehended or presented themselves at the southwest border, a sharp decline from over 144,000 in May, but still double the number seen the same month the previous year.

The $155 million for court hearings was originally allocated to FEMA in 2006 and 2007, but would have been used in the current budget to prepare to respond to natural disasters, such as hurricanes.

The administration began sending Central American migrants back to Mexico to await their court hearings in the U.S. as a means of slowing down the number of asylum-seekers who present themselves for asylum and remain in the U.S. until their court hearing. The funding will allow those immigrants waiting in Mexico to have their cases heard at the border, rather than being transported to locations within the interior of the country.

“I object to the use of funds for that purpose because the Department has provided no substantiation for a claim that this transfer is necessary due to ‘extraordinary circumstances that imminently threaten the safety of human life or the protection of property,’” Roybal-Allard said, referring to a provision that would allow DHS to repurpose funds at this point in the budget cycle without notifying Congress.

Sen. Jon Tester of Montana, the ranking Democrat on the Senate Appropriations Subcommittee on Homeland Security, also expressed reservations about the administration’s plan.

“I have grave concerns about DHS’s proposed end-run around laws passed by Congress that would drain millions from agencies tasked with protecting the homeland from security threats and natural disasters like hurricanes and wildfires — including CBP, TSA, FEMA and the Coast Guard,” Tester said in a statement.

“Congress has already deliberated DHS’s request and appropriated the highest-ever funding for border security and immigration enforcement, which passed on a bipartisan basis and was signed by President Trump,” he added.

So, this is how Trump “rewarded” those Democrats who voted for his emergency funding, ostensibly to help out children being held in substandard detention. (There is actually no hard evidence that I am aware of that this “emergency” money has been spent on improving conditions for children, rather than more mindless family detention.) More cruel, wasteful, and totally unnecessary detention in the face of Congress’s very specific refusal to increase detention funding.

Perhaps it’s time for the Democrats to wise up and play “hardball” with DHS funding. Much of the restrictionist “uber enforcement” nonsense on which Trump is squandering money has little or nothing to do with true “national security.” DHS detention could be cut to a small fraction of its current scope without any discernible harm to real national security.
