A recent report from the Urban Institute found that more than 1 in 6 adults in immigrant families reported avoiding a government benefit program or other help with basic needs last year because of immigration concerns. This chilling effect was so persistent that households where every foreign-born member had already been naturalized said they’re avoiding benefits. Just to be safe.

Despite an ongoing national crisis with record levels of illness, financial stress and hunger.

“More than once, pediatricians have told us they’ve had children come in so sick and so malnourished that [Child Protective Services] had been called on these families,” said Cheasty Anderson, director of immigration policy and advocacy at Children’s Defense Fund-Texas. Struggling parents believe they’re “on the horns of this dilemma,” she said. They think they must choose between accepting food and medical assistance for their children — or face possible deportation, and thus separation from their children.

That’s what the Trump administration has conditioned them to believe.

Given trends so far — particularly those declines in childhood immunizations — advocates worry that the “public charge” rule might discourage immigrants from getting themselves or their children vaccinated against covid-19. Which would affect the well-being of not just these immigrant families, of course, but their surrounding communities as well. Some advocates have expressed frustration that the Biden administration hasn’t immediately rescinded the rule. Formal repeal is likely a ways off, assuming the administration goes through the usual (cumbersome, protracted) rulemaking process.

But even if the order that Biden signed this week was really more about marketing than action, that pro-immigrant P.R. is valuable. After all, “most of the original damage was done by messaging,” as the Center for Law and Social Policy’s executive director, Olivia Golden, told me. It can, and should, be undone by the same means.

If we want immigrant families to stay healthy — and keep their nonimmigrant neighbors healthy, too — the government needs to put better policies on the books. But it needs to rebuild immigrants’ trust in those policies, too. That part may ultimately be harder.

But, let’s not forget that the bureaucratic kakistocracy at DHS, DOJ, and other agencies happily carried out and promoted the Trump/Miller bogus, racist, anti-immigrant narratives. That’s going to make it challenging for Secretary Mayorkas and incoming AG Garland to change the policies, change the messaging (if you want to see how brutally corrupt and manipulative the DHS “PR Kakistocracy” was, check out the highly acclaimed documentary “Immigration Nation”), and change the attitudes and the reality at the “retail level” — the DHS field offices and the Immigration Courts.

But it’s a challenge they must meet and conquer — for the sake of our nation.

Also, it’s worth remembering that the Supremes’ GOP majority dishonestly bent the rules to interfere with lower Federal Court rulings that had properly blocked this invidious, White nationalist, nativist attack on American communities — targeting communities of color and low-income communities. Just another example of how the Supremes’ elitist right wing majority operates outside reality (the factual record of comments from experts opposing this bogus “rule” was simply overwhelming and basically ignored by the Trump regime and the Supremes’ majority) and without regard or understanding of the human and public policy consequences of their skewed “Dred Scottifying” rulings. They are also above accountability, which makes their abuse of the most vulnerable among us even more disgusting and cowardly.

I think it’s highly unlikely that we’d see the same tone deaf misapplication of the law if it were the Justices’ kids, grandkids, neighbors, and friends unnecessarily suffering from illness and malnutrition aggravated by racist government policies. No more Justices and Federal Judges who have spent their adult lives studiously ignoring the rights and problems of those struggling to get by in a society where the rules are designed to protect the White ruling class rather than all persons living here.

It’s very clear that for GOP Justices, most of the time, only some lives and rights matter and are worth protecting. The rest of humanity can “go pound sand” as far as they are concerned.

For Pete’s sake, guns and corporate entities get more protection from the Roberts’ Court than do asylum seekers whose lives are at stake! As Justice Sotomayor says: “This is not justice.”  The question remains of why we have Supremes who all too often promote injustice and fail to resist evil?

As the Migration Policy Institute has shown, the Trump-era changes to the immigration system numbered in the hundreds and consisted of dramatic reinterpretations of the laws alongside seemingly clerical changes, such as revised application forms for visas, higher fees and tighter deadlines in immigration courts — all to advance a maximalist enforcement agenda and slow down the ordinary gears of immigrant admissions. High-level White House advisers, working with knowledgeable allies in the Homeland Security and Justice departments, pushed out regulation after regulation to render asylum laws more restrictive and make it harder for noncitizens to present their case in immigration courts. Trump’s attorneys general exerted unprecedented authority to define asylum laws to severely limit claims by victims of domestic and gang violence, and to constrain immigration judges’ ability to grant relief and manage their dockets in a way that provides a semblance of due process.

And yet, the new administration’s policy agenda will not be complete unless legislative proposals are accompanied by concerted executive action across the administrative state, and not just because ambitious legislation on any issue faces an uphill climb in a Senate with the narrowest of Democratic majorities. Even when it comes to pass, legislation emerges from a bargain, leaving issues unaddressed, introducing new concepts to be interpreted and creating new programs that demand administration. Changing the direction of our government requires not only executive vision, but also multilayered strategies that make their way through the bureaucracy and down to the ground — along with the stamina and patience to see them through.

Read Cristina’s complete article at the link. The book that she and Adam Cox wrote The President and Immigration Law along with that of my friend and colleague Professor Phil Schrag, Baby Jails, should be required reading for all incoming Biden-Harris officials.

A “democracy” that doesn’t understand how it came to run prisons for vulnerable kids and star chambers for legal asylum seekers, and how to end them immediately, can expect little success in achieving social justice, promoting economic equality and prosperity for all, or leading and advocating for democracy abroad. 

It all starts with immigration. I can draw a straight line from the Muslim Ban, to the Roberts’ Court’s disgraceful and cowardly abdication of responsibility to stop it in its tracks (grotesquely undermining the many lower court Federal Judges who had courageously “mapped it out for them”), to GOP politicos running around undermining our free and fair elections, to “magamorons” and other traitor/crazies storming the Capitol. Folks “get” the abdication of moral responsibility and legal accountability when it is delivered by those who should be standing up for democracy.

The failure of career civil servants at all levels to “just say no” and rebel against these outrageous failures of Constitutional governance and simple human decency, combined with a horribly deficient Supremes’ majority that abandoned both legal legitimacy and moral leadership, created a beyond dangerous pattern that came very close to toppling two centuries of the “democratic experiment” and still has the future of our democratic republic “on the ropes.” 

Just look at what happened at the DOJ in the final weeks of the regime! Government officials who knew better settled for “heading off” a President’s treasonous acts rather than exposing them to the public, the Vice President, and leaders of Congress (perhaps other than treacherous co-conspirator Kevin McCarthy) who could have taken action for the immediate removal of this “clear and present threat” to our national security from the office for which he was so completely unqualified. Who knows, they might even have stopped the insurrection!

Look at the failed and ethically vapid Solicitor General’s Office (once, but no longer, one of the “Jewels in the Crown” of Government) that time and time again moved forward to defend unethical and unconstitutional policies before a willing Supremes’ majority based on patently false narratives and obvious pretexts (not very convincingly) concealing the overt racist, White Nationalist agenda of Trump, Miller, and the other neo-Nazis who had seized control of large portions of our governing machinery. Who, with the disgraceful complicity of the Supremes, turned American asylum law from the life-saving humanitarian refuge it was intended to be to instead an ugly weapon of racism, xenophobia, misogyny, child abuse, death, torture, unjust imprisonment, and overall dehumanization of the most vulnerable among us! What’s wrong with this picture? Everything!

Checks and balances and the courage and integrity of a professional career civil service are supposed to halt abuses like this, even in the face of failure of one of our two major political parties and our highest Court to act with integrity and adhere to democratic norms! But, with a few exceptions, courageous folks like U.S. Immigration Judge Ashley Tabaddor, Col. Alexander Vindman, and others like them, it did not happen over the past four years. That nearly cost us our country! (Note that Tabaddor, Vindmin, and others like them were punished, with the disgraceful treasonists from the GOP looking on and actually cheerleading, for speaking out and upholding their oaths of office.) 

Buried in the carnage of the departed regime are the many lives unnecessarily lost, futures ruined, and lasting trauma — trauma that will continue to adversely affect our nation far into the future — caused by failure to stop the kakistocracy’s unconstitutional, cruel, and inhuman abuses. From intentionally inept COVID policies, to “politicizing” masks, to deaths in detention, to unlawful deportations to torture, to unfair, clearly political misapplications of the death penalty (basically “legalized murder”), to officially-sanctioned misogyny — this damage can’t be swept away overnight. 

Like legislative and judicial failures, bureaucratic failure comes at a cost — a huge one! The fact that it might be largely “out of sight, out of mind” to the arrogant, largely white, privileged, ruling elites and ivory tower “High Court” jurists doesn’t mean the harm isn’t real. Just that our society has enabled some in power to look away and avoid meaningful contact with the human wreckage and lasting pain and damage they have caused and or tolerated!

Already, we can see how the Biden-Harris Administration’s inexplicable failure to “take charge” at a broken DOJ is undermining the long-overdue and well-thought-out progressive immigration agenda they announced with such fanfare. Here’s what’s come to light in just the past few days at the broken and dysfunctional DOJ:

  • Seeking the illegal deportation to Haiti of a mentally ill individual denied due process by the EOIR kakistocracy;
  • Failure to repudiate scurrilous, misogynist attacks on well-known refugee woman “Ms. A-B-“ by unqualified then “acting” AG Jeffrey Rosen; 
  • Issuance by the “EOIR Clown Show” of more false narratives and anti-migrant “precedents” — basically delivering the “big, public middle finger” to the new Administration and the AG-designate;
  • Release of a blockbuster investigative report on misogyny and misconduct within the Immigration Judiciary — with no response or plan for corrective action from the DOJ;
  • Appointment of a bunch of bureaucratic nobodies to “caretaker” duties at the DOJ — including one quickly found by reporters — but apparently missed by the incoming Administration — to have had ties to the grotesque child abuse program run by White Nationalist former AG “Gonzo” Sessions;
  • Release by the IG of a report showing the role of Sessions, Rosenstein, and other DOJ officials in “official child abuse” –  without any promise of accountability for past or future misconduct;
  • A treasonous plot by the President, a GOP Congressman, and a corrupt DOJ political hack that, although thwarted, went unreported until uncovered by reporters from The NY Times!

To state the obvious, why weren’t folks with known integrity, courage, and ability — professional decision-makers with track records of upholding our Constitution — like Judge Ashley Tabaddor and her colleagues in the leadership of the National Association of Immigration Judges — put in charge of the DOJ debacle to “ride herd”on this mess, restore some integrity, and prevent any more damage until “Team Garland” arrives? Few folks at Justice know as much about the “inept DOJ bureaucracy and failure of justice at Justice” than the NAIJ leadership which has been “at war” with the kakistocracy for years!

The solutions are still out there. But, it will take boldness, courage, and some “quick thinking outside the box” by “Team Garland” to get this completely (and unnecessarily) unacceptable situation under control!

That begins with an immediate clean-up of the “immigration kakistocracy/bureaucracy” throughout Justice — starting with the “EOIR Clown Shown.” Bring in the immigration/human rights/due process experts and let them start fixing the problems! 

Stop defending the unprofessional garbage being aimlessly tossed into the Federal Courts by the EOIR White Nationalist deportation factory still running under orders from Miller and Hamilton. Have all these cases reviewed by experts in immigration/human rights/due process and racial justice! 

Fire anyone in the SG’s office who presents bogus arguments concerning fake “immigration emergencies” and illegally promulgated “regulations” to the Supremes. End the unethical practice of using one-sided “precedents” to develop anti-immigrant “litigating positions” for OIL. 

Stop appointing unqualified individuals to precious Immigration Judgeships. Remove the entire BIA and replace it with real expert appellate judges unswervingly committed to fundamental fairness and due process for all. Replace “worst practices” with “best practices.” Stop the “Aimless Docket Reshuffling” at EOIR. Cut the largely self-created Immigration Court “backlog.”

Bring in Professor Rodriguez, Professor Schrag, Professor Ingrid Eagly, Judge Dana Marks (who argued and won the landmark Cardoza-Fonseca case before the Supremes), Judge (and former BIA Judge and high-ranking DOJ official) Noel Brennan, Judge Amiena Khan, Judge Mimi Tsankov, Marielena Hincapie (NCIJ), Dean Kevin Johnson (UC Davis Law), and a “due process brain trust” of others like them! Let them start “kicking some tail,” fixing the problems, and restoring sanity, humanity, and due process to the broken immigration kakistocracy at DOJ. Now, before any more lives are lost or futures irrevocably ruined! 

Let “practical scholars” like Rodriguez, Schrag, Eagly, and Johnson “turn their research and great thoughts into action.” “A little less talk, and a lot more action,” as Toby Keith would say!

The NDPA has already shown that it can out-litigate and out-strategize the Government immigration kakistocracy. In many ways, only the abject failure of the Supremes’ majority to stand up for the Constitution, rule of law, and human decency has prevented the NDPA from completely annihilating the kakistocracy, wiping out all of its misdeeds by judicial decree, and perhaps even holding criminals like Miller and Wolf accountable for their “crimes against humanity.” 

Judge Garland is a smart person. The “smart thing” would be to get the “NDPA on the inside at Justice,” creating order from chaos and re-establishing justice @ Justice now! 

Otherwise, smart or not, he’s likely to spend the bulk of his tenure as a “caption” on the never-ending avalanche of new legal actions filed against the deadly immigration bureaucracy by the NDPA. Because, I promise that the fight for due process in immigration and human rights isn’t over! It has just begun! 

There is lots to be gained by working together to solve these problems. But if it takes litigation, continuing conflict, and a never-ending political and press crusade against an Administration I otherwise support to get the job done, so be it!

The battle isn’t over until the kakistocracy is removed, at every level, and due process, fundamental fairness, equal justice, and respect for human dignity — all both Constitutional and human rights — become a reality for all persons in America (including those physically present at our borders) rather than just the cruel, unfulfilled promises they have been to date.

URGING A SPEEDY REVERSAL ON ASYLUM POLICIES

 

The Biden administration has said it may need 6 months to reverse Trump administration asylum policies and bring asylum seekers stranded in Mexico to safety. Tragically, some may not survive that long.

 

In her newest blog post, Legal Fellow Julia Neusner presents a heartbreaking portrait of the violence, discrimination, and trauma asylum seekers have endured under the Trump administration’s policies.

 

Julia writes about victims of these policies, including Ana and Jorge, an Afro-Cuban couple who were kidnapped after US border officers expelled them to Mexico under MPP. Armed men robbed them and forced them into a room covered in blood. Other kidnapping victims were moaning on the floor, some with severed body parts.

 

“They told us [a friend] would have to pay $4,000 for both of us, and if he didn’t, they would cut us up, part by part,” Ana recalled. “I lost control and started crying. My boyfriend pleaded with them, and they hit him with a gun. Then they beat me. It was horrible. We spent these days in hell.”

 

SETTING THE RECORD STRAIGHT ON ASYLUM

 

On Wednesday, President Trump travelled to the southern border to tout his immigration record. In response, Human Rights First released a fact sheet outlining the Trump administration’s record on asylum: one defined by chaos, cruelty, and illegality.

 

From separating over 5,500 families to delivering people to life-threatening danger in Mexico to spurring the spread of COVID-19 by refusing the repeated pleas of epidemiologists to release asylum seekers and immigrants from detention, Trump’s real record is deep damage our asylum system.

A key to “setting the record straight on asylum” is immediate removal of the “EOIR Clown Show” 🤡🦹🏿‍♂️ in Falls Church, a retraction of the gross lies and misleading anti-asylum, anti-lawyer narratives set forth in their White Nationalist nativist “Bogus Fact Sheets,” immediately cancelling the insane anti-due process, anti-lawyer procedures now in place, and setting the record straight on asylum law, including the toxic, unethical, and unconstitutional role of EOIR in actively undermining the legal rights and humanity of asylum seekers as well as being responsible for gross mismanagement of the Immigration Courts.

There are folks out there in the private/NGO/academic community who can get the job done, starting day one! Yeah, there are many other priorities; that’s a beyond compelling reason for bringing in the experts and empowering them to solve the problems, sooner rather than later! There really is no viable “later” here! 

We simply don’t have six months to stop killing people and violating human rights on a daily basis! If we don’t make radical changes and take some calculated risks to end the abuses and mismanagement at EOIR, the SG’s Office, and DHS right off the bat, it will be too late for too many!

Maybe Judge Garland and his Executive Team need to spend a few days with some immigration practitioners and NGOs right now to see what’s happening in the “Star Chambers impersonating courts” that they will “own” in a few weeks. Maybe they should spend some time in the squalid migrant camps in Mexico, seeing what existence is really like for those to whom we have shirked our legal and moral responsibilities. 

Ask themselves, would THEY subject THEIR families to such mistreatment? If not, then why hasn’t a plan been announced to end the deadly “EOIR Clown Show” 🤡🦹🏿‍♀️☠️ immediately and put some legitimate judges and competent managers who understand asylum law and immigration practice in place?

Judge Garland, with all due respect, when the incoming Administration tells lawyers, many working pro bono or low bono, who are risking their lives to save their clients’ lives in the “living Hell” of today’s U.S. Immigration Courts  to “be patient, we’ll get to you soon,” you are giving them a very clear and chilling message: THEIR LIVES, SAFETY, AND SANITY AREN’T YOUR PRIORITY — I/O/W, THEIR LIVES DON’T MATTER! 

That’s neither an appropriate nor uplifting message to give to an embattled group whose support, assistance, ideas, creativity, and energy will be absolutely essential to your plans to “restore justice to Justice!”

The sad truth is that time does not, in fact, “heal all wounds,” and failures that kill and damage people for life can’t be “undone,”

Yesterday, the Supreme Court granted certiorari in Sanchez v. Wolf, which presents the question under the Immigration and Nationality Act whether a Temporary Protected Status (TPS) recipient may adjust his or her status to that of a lawful permanent resident.  The Third Circuit held that TPS recipients were not entitled to adjust their status because TPS status was not an “admission,” under 8 U.S.C. § 1255.   The Third Circuit decision in Sanchez conflicts with the rulings of the Sixth and Ninth Circuits.

Here’s the government’s position in a nutshell: Notwithstanding the “plain language” of section 244(f)(4) which makes holders of TPS status eligible to adjust status in the U.S. if they meet all of the requirements for legal immigration (usually an an approved visa petition based on family ties or job skills), we have employed legal gobbledygook to refuse to adjust them. Thereby, we mindlessly keep them in “suspended animation” in the U.S. although they are long-time productive members of our society who have resided here with permission and work authorization and now meet our criteria for permanent immigration.

Sound pretty stupid? That’s because it is! I actually had this issue argued before me at the Arlington Immigration Court. Not surprisingly, the ICE Assistant Chief Counsel was unable to come up with any rational reason for circumventing the statutory language to achieve a nonsensical result that actually unnecessarily inflated the case backlog and served no legitimate government purpose. Needless to say, I ruled in the respondent’s favor.  

This isn’t “rocket science.” The new SG should join the petitioner’s counsel, JAIME W. APARISI (who regularly appeared before me in Arlington) and LISA S. BLATT (Williams & Connolly LLP) in agreeing that this issue was correctly resolved in the respondents’ favor by the Sixth & Ninth Circuits.

Then, ICE should ask the “new BIA” (real judges with immigration and human rights backgrounds appointed by AG Garland) to adopt this view nationwide.

Presto! 

  • No more bogus, contrived “circuit split;”
  • TPSers with adjustment eligibility can be taken out of EOIR’s ridiculous 1.1 – 1.5 million case backlog and returned to USCIS for routine adjustment of status;
  • Productive, long-time members of our society can become green card holders, get on the path to citizenship, and reach their full productive potential for both their benefit and the benefit of our society;
  • A win, win, win, instead of wasting time attempting to achieve an illegal, undesirable, yet fundamentally stupid, irrational, and counterproductive result;
  • And, unlike the stupidity going on now, it actually doesn’t require expenditure of funds (actually will save and perhaps even generate money from adjustment filing fees), major regulatory changes, new legislation, or protracted litigation. It’s “low hanging fruit” that the Trump immigration kakistocracy has let rot on the tree! Rational administration of the immigration laws can actually be quite efficient.

Is it any wonder that the EOIR bogus “court,” whose “guiding principle” is “always construe the law against the individual and in favor of DHS” is building uncontrollable backlog hand over fist, even with double the number of “judges?” This is “fraud, waste, and abuse” in action! 💸🤮 Not something I’d want to “own” if I were Judge Garland (which, of course, I’m not, and never will be)!

That’s how “practical scholarship” @ EOIR, DOJ, and ICE; smarter, better, more ethical progressive leadership at the DOJ; and the private/NGO/academic bar can work together to solve legal problems and stop wasting the time of the Federal Courts and the Supremes. Perhaps, with the time saved, the Williams Connolly LLP team can even take some more pro bono asylum cases, make the system work better at the “retail level,” and save some deserving lives of vulnerable individuals who have been mistreated by Miller and his neo-Nazi gang of thugs and the malicious incompetents now “running” EOIR (into the ground) in the process.

Not rocket science! But, it will require Judge Garland to bring in some members of the NDPA who actually understand the interrelated issues of immigration, human rights, due process, civil rights, equal justice, and practical problem solving to replace the current “Clown Show” 🤡🦹🏿‍♂️ at EOIR and the DOJ. (Not to mention, a comprehensive “de-clownification” 🦹🏿‍♂️🤡 of DHS by Secretary-designate Mayorkas and his team). All of those skills have been conspicuously absent from the Executive branch during the last four years of kakistocracy.

Happy New Year! I hope you are staying well. We are pleased to share an amicus brief filed in the Northern District of California last week challenging the “monster” asylum rule, published as a final rule in December 2020. We are grateful to the immigration law scholars who signed onto this brief. The brief is focused on three aspects of the rule: 1) expansion of discretionary bars in general; 2) discretionary bars on unlawful entry and use of fraudulent documents in particular; and 3) expansion of the firm resettlement bar. The brief argues that these bars conflict with the immigration statute and further that the Departments have failed to provide a reasonable explanation for departing from past statutory interpretation with regard to these bars.

 

Co-counsel included Loeb & Loeb, Peter Margulies, and myself. We are grateful to the Harvard Immigration and Refugee Clinical Program and other organizations who served as counsel to plaintiffs in this case.

Introduction

President-elect Biden has promised a broad array of reforms that would impact refugees, asylum seekers, and other forced migrants. He has indicated he will restore Temporary Protected Status, place a moratorium on deportations, and end prolonged detention and for-profit detention centers. These are all crucially important to the safety and security of migrants and their families in the United States and other countries, especially in the Western Hemisphere. President-elect Biden has also promised to end the Trump administration’s policy of making asylum seekers “remain in Mexico” while awaiting hearings in U.S. immigration court.

However, in recent weeks, a flawed and fatalistic view of migration to the U.S. southern border has taken hold in some media accounts and reports. It goes like this: President Trump’s Remain in Mexico (or MPP) policy has created a logistical and humanitarian crisis at the southern U.S. border that, despite President-elect Biden’s promises, will be very difficult to undo. Further, a combination of pull and push factors (especially in the wake of hurricanes in Central America) will lead to increased migration to the southern U.S. border this spring such that President-elect Biden will have little choice but to keep the border sealed under an order from the Centers for Disease Control and Prevention (CDC), as he attempts to deal with COVID-19 in border states and fulfill other immigration policy promises—including uniting families the Trump administration ripped apart two years ago.

There are several problems with this line of argument, many of which are addressed in this report. Most fundamentally, keeping the border sealed and migrants waiting in Mexico will perpetuate serious abuses. Family separations and other violations of human rights, as well as violations of U.S. law, will continue to occur under a Biden administration that does not implement new policies at the border. Recently, MPP and the CDC border closure have exacerbated smuggling and trafficking at the border, as well as other forms of abuse against migrants. For example, the CDC order has led to the repatriation of Nicaraguan dissidents as well as the return of a sexually abused Guatemalan child.  It has also led asylum seekers to try to cross undetected in remote desert areas. Further, unwinding MPP and allowing asylum seekers to ask for protection at the border is not only the right thing to do, but also feasible with the proper planning. Indeed, it presents the incoming administration with an opportunity to rethink migration management, especially for those seeking asylum, and to implement a new screening process that is both more humane and more efficient.

President-elect Biden has invoked President Franklin Delano Roosevelt—healer, rebuilder, and practical problem solver—as a model. During World War II, Roosevelt planned and devoted significant resources to resolving the largest displacement crisis the world had ever known. This planning was part of an effort to ensure that what happened in 1939 to the S.S. St. Louis—a ship of asylum-seeking Jews turned away by the United States and other countries—would not occur again.  

During his first week in office, President-elect Biden should issue an executive order on border asylum policy that departs dramatically from that which President Trump put forth during his first week. President Biden’s executive order should give asylum seekers access to the border and provide for cooperation with border states and shelters to safely and humanely receive asylum seekers. It should allocate resources to alternatives to detention, including case management, and to improved adjudication of asylum claims in immigration courts, especially through provision of legal services. It should also commit to ending practices associated with expedited removal of asylum seekers that have resulted in abuses, and to the use of parole to unwind MPP. Finally, through revocation of Trump administration decisions, regulations, and policies, as well as through settlement of lawsuits and the withdrawal of appeals to federal courts regarding these policies, the executive order should commit to restoring asylum eligibility to those who have fled persecution but have been denied or prevented from obtaining protection. 

In taking such action, President-elect Biden would be fulfilling not only his campaign promises but the commitment he made when he voted for Senate passage of the Refugee Act of 1980. That law, supported by large majorities of both parties, promised to ensure fair access to asylum at the border 

This report shows why it is imperative that the Biden administration do this rather than keep us mired in a policy framework that does not work and that has led to a cycle of crises. It does so by looking back to a momentous time of transition about thirty years ago. With the Cold War ending, the United States had to rethink its assumptions about who merited refugee status. Only a handful of refugee resettlement slots in the U.S. Refugee Program were allotted to Central Americans, and the United States had not yet developed clear procedures for effectively handling asylum seekers at the southwestern border. Rather than acknowledge the forces pushing people northward, U.S. policymakers adopted a paradigm that was focused primarily, if not exclusively, on deterrence. This is a paradigm that we are still in today.

At different points over the past thirty years, humanitarian and constructive policies have tempered the harshness of this paradigm, and such policies have also brought benefits in terms of cost and efficiency. These policies need to be adapted and scaled up. But they also need to be placed within a welcoming framework that does not presume asylum seekers are a threat. Instead of devoting tremendous resources to a futile and rights-violating attempt to block those already on the move, we have to try to better understand the drivers of migration, which, for Central Americans, include corruption, poverty, insecurity, and violence.  We must devote resources instead to humanely receiving asylum seekers and adjudicating their claims fairly. We also have to stop assuming that the best place to manage admissions of all Central Americans seeking protection is at the border.

The Deterrence Paradigm 

The deterrence paradigm has been implemented repeatedly using the same counterproductive strategies.

The skill set to establish a lawful, better, humane, efficient asylum system, consistent with our Constitutional, statutory, and international obligations is out there, mainly in the private/NGO/academic communities. I/O/W the “practical scholars, litigators, and advocates” in the NDPA.

It’s a just a question of the incoming Biden/Harris Administration getting beyond the “enforcement only” mentality, personnel, and White Nationalist nativist thinking that currently infects the entire USG immigration bureaucracy, at all levels. Replace the current failed leadership with experts from the NDPA and empower them to work with other experts in the private sector to institute a better system that would be no more costly, likely less, than the current “built to fail” abominations that not only waste resources but destroy human lives and are an ugly stain on our national conscience!

Immigration Court Reform

EOIR policies during the Trump administration have been at odds with principles of due process and judicial independence. These include the imposition of numeric case completion quotas and docket management policies that deprive asylum seekers of procedural protections; appointment of judges who almost exclusively come from prosecutorial backgrounds (especially working at DHS and in law enforcement); promotion to permanent positions on an expanded BIA of judges with asylum denial rates much higher than the national average; and procedures that limit the ability of claimants to effectively appeal their cases. The Biden administration should conduct an urgent review of EOIR hiring practices and immigration court procedures and develop recommendations for regulatory or structural changes consistent with the protection needs of asylum seekers.

 

The critical “urgent review” should be done by a “Team of Experts from the NDPA” brought in on an immediate temporary basis, if necessary, in accordance with Federal Personnel Rules, to replace the current Senior “Management” @ EOIR as well as the entire BIA. There’s no better way to fix the system than to take over management, restore fairness and order, and get inside the current disastrous mess @ the Clown Show 🤡🦹🏿‍♂️! Importantly, the “Team of Experts” with effective operational control could immediately begin fixing (and conversely stop aggravating and creating) the glaring problems while putting the structure and personnel in place for long-term reforms.

Lives ☠️⚰️ are at stake here! We need ACTION, not merely study and evaluation. “Fixing the system on the fly” may be challenging, but it’s perfectly within the capabilities of the right team of NDPA experts! Dems often prefer study and dialogue to effective actions. As Toby Keith would say: We need “a little less talk and a lot more action.”

If he refuses to sign the deal, which is attached to a $1.4-trillion government funding bill, it will force a federal government shutdown, in addition to delaying aid checks and halting unemployment benefits and eviction protections in the most dire stretch of the pandemic.

“Made many calls and had meetings at Trump International in Palm Beach, Florida. Why would politicians not want to give people $2000, rather than only $600?” he tweeted after leaving the golf course Friday afternoon. “It wasn’t their fault, it was China. Give our people the money!”

Trump’s attack on the bill has been seen, at least in part, as punishment for what he considers insufficient backing by congressional Republicans for his push to overturn the Nov. 3 election results with unfounded claims of fraud.

Helping to “custom design” obvious pretexts for racist and hate inspired policies, for consumption by right-wing judges who only seek “cover” for going along  to get along with fascism, is wrong. Duh!

It’s no surprise that the clearly unconstitutional and racially and religiously bigoted “Travel Ban,” willingly embraced by an intellectually dishonest and morally compromised Supremes majority, was first on the list in Erica’s “confession.” 

But, don’t expect any apologies from the vast majority of Trumpist lawyer/enablers who violated their oaths of office or from the big time law firms (one where I was formerly a partner) who have granted them undeserved refuge at fat salaries! Nor should we expect large-scale redemption from the legions of Government lawyers in DOJ, DHS, and elsewhere who will assert the “Nuremberg defense” of “just following orders.”  But, that doesn’t mean that the rest of us can’t demand some accountability for participation in  what are essentially “crimes against humanity.” 

Erica’s article largely echoes what my friend and colleague Judge Jeffrey Chase, many of our colleagues in the Round Table of Former Immigration Judges, ⚔️🛡 and numerous members of the New Due Process Army (“NDPA”) have been saying throughout this Administration. Indeed, I frequently have noted that the once-respected Solicitor General’s Office and EOIR operated as basically “ethics free zones” under the disgraced “leadership” of Sessions, Whitaker, and Barr.

It’s also why the the Biden-Harris team that takes over at DOJ must: 

  1. immediately remove all the current “executives” (and I use that term lightly) at EOIR as well as all members of the BIA and transfer them to positions where they can do no further damage to asylum seekers, migrants, their (often pro bono or low bono) lawyers, or the rest of humanity; 
  2. replace them with qualified individuals from the NDPA; and 
  3. be circumspect in eventually making retention decisions for Immigration Judges, taking into account public input as to the the degree to which each such judge’s jurisprudence during the Trump kakistocracy continued to reflect adherence to constitutionally required due process and fundamental fairness to migrants, respect for migrants and their representatives, best practices, and interpretations that blunted wherever reasonably possible the impact of the kakistocracy’s xenophobic, racist, White Nationalist policies. 

American justice has been ill-served by the DOJ and the Immigration Courts over the past four years. That’s something that must not be swept under the carpet (as is the habit with most incoming Administrations). 

The career Civil Service overall, and particularly complicit and often ethics-free government lawyers,  failed to put up the necessary resistance to an overtly anti-American regime with an illegal and immoral agenda. Lives were lost or irreparably ruined as a result. That’s a big-time problem that if not addressed and resolved will likely make continuance of our national democratic republic impossible.

The Ghost of Grifters Not Yet Past was everywhere over the weekend. In the New York Times, we read about how the Ghost had arranged for a meeting of the political Chronic Ward in the White House. In the Washington Post, we read about how the Ghost had visited his feral children, Ignorance and Want, upon the land by giving them national political leaders who couldn’t pour piss out of a boot if the instructions were on the heel, and, worse, had no desire to learn how, even in the midst of the greatest public health crisis in a century. 

While the Times’ account of the Mad Hatter’s seditious tea party is the flashier story, it is the Post’s deep spelunking into the administration*’s brutal (and quite deliberate) mishandling of the pandemic that is more likely to resound in historical memory as the most criminal dereliction of duty in the history of the American presidency. By comparison, Herbert Hoover at the onset of the Great Depression and James Buchanan as the nation slid toward the Civil War were positive pikers in their disregard for the office they held and the country they were chosen to lead.

Hey, you know that massive, scary, very likely Russian hack that reportedly breached multiple U.S. government agencies in what may have been the biggest government hack in history? The one that Trump’s former Homeland Security adviser estimates could have affected 18,000 organizations, including most federal government unclassified networks and a number of Fortune 500 companies? The magnitude of which, he says, cannot be overstated? The same one that Donald Trump has said nothing about? Well, no biggie, but apparently hackers also reportedly accessed the networks of the Energy Department and the National Nuclear Security Administration. Which, as you might have guessed, maintain the country’s nuclear weapons stockpile.

Per Politico:

On Thursday, DOE and NNSA officials began coordinating notifications about the breach to their congressional oversight bodies after being briefed by Rocky Campione, the chief information officer at DOE. They found suspicious activity in networks belonging to the Federal Energy Regulatory Commission (FERC), Sandia and Los Alamos national laboratories in New Mexico and Washington, the Office of Secure Transportation at NNSA, and the Richland Field Office of the DOE. The hackers have been able to do more damage at FERC than the other agencies, and officials there have evidence of highly malicious activity, the officials said, but did not elaborate.

The attack on DOE is the clearest sign yet that the hackers were able to access the networks belonging to a core part of the U.S. national security enterprise. The hackers are believed to have gained access to the federal agencies’ networks by compromising the software company SolarWinds, which sells IT management products to hundreds of government and private-sector clients…. NNSA is responsible for managing the nation’s nuclear weapons, and while it gets the least attention, it takes up the vast majority of DOE’s budget. Similarly, the Sandia and Los Alamos National Labs conduct atomic research related to both civil nuclear power and nuclear weapons. The Office of Secure Transportation is tasked with moving enriched uranium and other materials critical for maintaining the nuclear stockpile.

While Joe Biden commented on the issue Thursday, saying “Our adversaries should know that, as president, I will not stand idly by in the face of cyber assaults on our nation,” Trump has remained curiously silent, or at least it would be curious had he not made it explicitly clear the last four years that Vladimir Putin, and really, any of his favorite dictators, can often do whatever they want. (The Russian embassy said on Sunday that it had nothing to do with the hack, though experts believe it almost certainly came from a Russian intelligence agency.)

But hey! There may be an entirely reasonable explanation for why Trump hasn’t bothered to address the issue, and it’s that he’s been extremely busy working on much more important issues. No, not fruitlessly attempting to overturn the results of the 2020 election, though that does take up a decent amount of his time. In this case, it’s something even bigger:

The U.S. Department of Energy on Tuesday finalized a pair of new rules rolling back water efficiency standards on showerheads and other consumer appliances, punctuating President Donald Trump’s long-documented water flow grievances in the final weeks of his administration. The new showerhead rule goes after the two-and-a-half-gallon-per-minute maximum flow rate set by Congress in the 1990s. Under current federal law, each showerhead in a fixture counts toward that limit collectively—but the Energy Department’s new rule means each showerhead individually can reach the limit set by Congress.

The slate of recent changes align with Trump’s larger dismantling of environmental regulations, and, more specifically, his open disdain for poor water flow. Trump claimed late last year that Americans are flushing their toilets “10 times, 15 times, as opposed to once” and are having difficulty washing their hands. “We have a situation where we’re looking very strongly at sinks and showers and other elements of bathrooms where you turn the faucet on—and in areas where there’s tremendous amounts of water, where the water rushes out to sea because you could never handle it, and you don’t get any water,” the president said last December during a roundtable with small business leaders about deregulatory actions. “You turn on the faucet and you don’t get any water. They take a shower and water comes dripping out. Just dripping out, very quietly dripping out,“ the president continued, lowering his voice as he spoke about the drips.

“Today the Trump Administration affirmed its commitment to reducing regulatory burdens and safeguarding consumer choice,” Secretary of Energy Dan Brouillette proudly declared in a statement. “With these rule changes, Americans can choose products that are best suited to meet their individual needs and the needs of their families.” The rollbacks were chastised not only by environmental groups but consumer organizations as well, with Andrew deLaski, executive director of the Appliance Standards Awareness Project, saying, “Changing the rules to address one of President Trump’s pet peeves is simply silly. Thousands of showerhead models on the market today meet the standards that Congress set way back in 1992 and provide a great shower.”

In related news, to date it remains unclear why it takes Trump 15 flushes to clear a toilet.

Wow! The EOIR kakistocracy is truly going out in a “blaze of inglorious malicious incompetence,” taking human lives and a chunk of our justice system down with it!

It’s likely that the “record backlog” @ EOIR reported by TRAC is substantially understated. First, it apparently doesn’t include approximately 300,000 cases mindlessly and illegally “queued up” to artificially increase the backlog by the now long departed Jeff “Gonzo Apocalypto” Sessions.

Additionally, given the well-documented intellectual dishonesty and incompetent record-keeping at EOIR, there likely are hundreds of thousands of additional “off-docket” cases that simply aren’t reflected in EOIR records and might or might not ever be found in the disastrous “non-e-filing system.”

The solution to the backlog really isn’t “rocket science.” With a “system capacity” of approximately 250,000 – 300,000 cases annually, all non-detained, non-emergency cases should be removed from the docket. DHS should be allowed to re-file their 250,000 “highest priority” cases and then to file new cases only in a responsible manner that complies with and respects the “system max.”

No more “Aimless Docket Reshuffling” and intentional creation of unnecessary backlogs! Moving forward from a kakistocracy of malicious incompetents and racists will be a huge challenge — probably the biggest ever faced by an incoming President. But, Joe Biden and and Kamala Harris have the leadership, knowledge, skills, and plans to make it happen.
