Executive Summary

This paper examines the staffing needs of the US Department of Justice’s Executive Office for Immigration Review (EOIR), as it seeks to eliminate an immigration court backlog, which approached 2.5 million pending cases at the end of fiscal year (FY) 2023. A previous study by the Center for Migration Studies of New York (CMS) attributed the backlog to systemic, long-neglected problems in the broader US immigration system. This paper provides updated estimates of the number of immigration judges (IJs) and “judge teams” (IJ teams) needed to eliminate the backlog over ten and five years based on different case receipt and completion scenarios. It also introduces a data tool that will permit policymakers, administrators and researchers to make their own estimates of IJ team hiring needs based on changing case receipt and completion data. Finally, the paper outlines the pressing need for reform of the US immigration system, including a well-resourced, robust, and independent court system, particularly in light of record “encounters” of migrants at US borders in FY 2022 and 2023.

More Than 2 in 3 Voters Support Having an Asylum System and Hiring More Immigration Judges and Asylum Officers

Members of Congress are once again engrossed in debate related to immigration and border security, issues that have seen little progress or reform in more than two decades. The current debate particularly focuses on the application process for asylum — a form of legal immigration that protects people who have faced persecution in their home country on account of race, religion, nationality, and/or membership in a particular political or social group.

A new Data for Progress survey asked likely voters in the U.S. about various funding measures and proposed policy changes related to the U.S. immigration system.

First, we find at least 80% of voters think reforming the legal immigration system and securing the border with Mexico should be priorities for the U.S. government. Seventy-one percent of voters also say addressing the root causes of migration from South and Central America through diplomatic relations and humanitarian aid should be a priority.

A strong majority of voters (69%) also support the U.S. having a system for asylum seekers to legally migrate to the U.S. to seek protection. When asked about potential changes to the asylum application process that would allow immigration officials to deport asylum seekers without allowing them to see a judge, voters prefer giving asylum seekers a meaningful opportunity to make their case before a judge rather than a higher standard that could lead to expedited removal.

Along these lines, a majority of voters, including 69% of Democrats and 58% of Independents, don’t think the U.S. should make it harder for asylum seekers to meet with an immigration judge.

When asylum seekers come to the U.S. and fill out an asylum application, they must wait a minimum of six months before they are able to apply for work authorization. Some lawmakers have proposed eliminating this six-month waiting period so that asylum seekers can support themselves instead of relying on others for assistance. Sixty-two percent of voters, including a majority of Democrats (73%), Independents (58%), and Republicans (54%), support eliminating the six-month waiting period for asylum seekers to apply for work authorization.

Since October, President Biden has been lobbying Congress to pass a more than $105 billion spending package for national security purposes that includes additional military aid for Ukraine and Israel, as well as roughly $14 billion for various funding measures related to immigration and border security.

Voters support many of the key immigration-related measures in this proposal, such as enhancing security at ports of entry (82%), increasing personnel and capacity to process immigrants at the U.S.-Mexico border (75%), hiring new immigration judges (67%), and hiring new asylum officers (67%).

Lastly, 79% of voters, including 84% of Democrats, 78% of Independents, and 75% of Republicans, oppose separating migrant children from their parents or caregivers at the border.

These findings underscore that a strong majority of voters want the U.S. government to prioritize reforming the legal immigration system and securing the border, while also providing leniency to asylum seekers in regards to making their case before an immigration judge and being able to apply for work authorization.

From January 13 to 14, 2024, Data for Progress conducted a survey of 1,196 U.S. likely voters nationally using web panel respondents. The sample was weighted to be representative of likely voters by age, gender, education, race, geography, and voting history. The survey was conducted in English. Rather than looking for ways to restrict or eliminate asylum, Congress and the Administration should be concerned about quality-control and expertise reforms in asylum adjudication, including a long-overdue independent Article I Immigration Court! Once again, the BIA violates Circuit precedent to deny asylum.

The answer to systemically unfair, (intentionally) unduly restrictive interpretations, and often illegal treatment of asylum seekers by the USG should not be to further punish asylum seekers! It should be fixing the asylum adjudication system to comply with due process, fundamental fairness, best practices, and professionalism!

The Tahirih Justice Center is outraged by the news that the administration appears willing to play politics with human lives. These attacks on immigrants and people seeking asylum represent not simply a broken promise, but a betrayal and we urge the President and Congress to reverse course.

“I am gravely concerned that, if passed, these policies will further trap and endanger immigrant survivors of gender-based violence.  Selling out asylum seekers and immigrant communities under the guise of ‘border security’ in order to pass a supplemental funding package is absolutely unacceptable,” said Casey Carter Swegman, Director of Public Policy at the Tahirih Justice Center. “And we know the impact of these cruel, deterrence-based policies will land disproportionately on already marginalized immigrants of color. I urge the White House and Congress not to sell out immigrants and asylum seekers for a funding deal.”

Every day, people fleeing persecution – including survivors of gender-based violence – arrive at our border having escaped unspeakable violence. Raising the fear standard, enacting a travel ban, putting a cap on asylum seekers, and expanding expedited removal nationwide (to name just a few proposals that have been floated in recent days) will do nothing to solve the challenges at the southern border and serve only to create more confusion, narrow pathways to humanitarian relief, increase the risk of revictimization and suffering, and punish immigrants seeking safety and a life of dignity.

These kinds of proposals double down on the climate of fear that many immigrants in this country already face on a day-to-day basis and will disproportionately impact Black, Brown and Indigenous immigrant communities.Immigrants should not be met with hostile and unmanageable policies that violate their humanity as well as their legal rights. We can and must do better.

These are “negotiations” in which those whose legal rights and humanity are being “compromised” (that is, tossed away) have no voice at the table as politicos ponder what will best suit their own interests.

“Pie in the sky?” Hardly! Undoubtedly, these measures could be carried out far less expensively than further, ultimately fruitless, border militarization and enhanced cruelty being pushed by the GOP and some Dems. And, they would be more effective in bringing “law and order” to the border and our overall legal system.

Fanned by alarmist narratives being spread by folks like Adams and Hochul (no, Governor, 8 billion people aren’t going to descend on your state — in fact, the U.S. has a “refugee/1,000 population ratio” far below that of many smaller, much poorer countries), and the mainstream media’s insatiable need for a “trumped-up invasion narrative” to create headlines and sound bites, I suspect that the Administration and Dem politicos might be prepared to “throw asylum seekers under the bus” to reach an agreement with the GOP to keep the Government open. After all, asylum seekers don’t vote, and their advocates have historically been good “team players” who go to bat for the Dem Party despite having their contributions, energy, and ideas consistently undervalued, even dissed, once elections are over.

Don’t do it Dems! Giving in to the righty nativists will NOT solve anything, nor will abandoning values help you in the next election! Indeed, the Administration could set more “world records” for exclusions, deportations, denials, imprisonments, wall-building, enforcement hiring, “rocket dockets,” and the GOP would still spout the same “open borders” myth, and the media would give it equal, or greater, time. They largely ignore HRF and other experts who actually understand the border, migration, and have practical, humane, if less inflammatory or drastic, solutions to offer.

The mainstream media seems to have endless time for folks like Trump, Gaetz, Jordan, Haley, Ramaswamy, etc., who have little to contribute to solving pressing national problems. Why aren’t they talking to the folks who understand migration, asylum seekers, the border, and the legal framework? Why aren’t they “headlining” and publicizing reasonable, humane, values-based solutions rather than promoting narratives of doom, hopelessness, and expensive, often illegal, cruelty as the only “solutions?” There actually have been some bipartisan proposals for addressing the border while respecting and even enhancing the rights of asylum seekers. Humane, sensible, legally compliant, cost effective solutions to migration issues proposed by experts, many of whom are immersed in the reality on a daily basis, are often dismissed, if even mentioned, as “impractical,” “unrealistic,” “idealistic,” “costly.” On the other hand, when politicos, think tankers, reporters, commenters, profiteers, many largely removed from the human trauma of the border situation, present costly, proven to fail, draconian, often illegal measures directed against asylum seekers, the same prejorative, dismissive terms are seldom used.

Indeed, the worse, crueler, and more hare-brained a scheme is, the more likely it is to be mischaracterized as a “realistic response” to a hyped-up emergency! Somehow, wanton cruelty and end-running legal obligations are packaged as a “practical necessities,” while creative ideas on how to solve problems and make the current laws work are summarily brushed aside, often without meaningful analysis and discussion.

A bipartisan duo of Hispanic women Tuesday introduced the most robust immigration proposal to date this Congress, a significant collaboration as a new generation of lawmakers pushes for meaningful reform of the nation’s immigration system after decades of failed attempts.

For six months, Reps. Maria Elvira Salazar (R-Fla.) and Veronica Escobar (D-Tex.) have been quietly negotiating on key issues where Republican and Democrats have previously sought changes, while leaning on their lived experiences as lawmakers representing border districts with majority Hispanic constituencies.

The result is a roughly 500-page bill called the Dignity Act that, among other things, would provide billions of dollars for border security measures, create pathways to citizenship for some undocumented migrants already in the United States, update the legal immigration process, and establish “humanitarian campuses” on the U.S. border that would process asylum claims in 60 days.. . . . .

Salazar and Escobar were joined at a news conference Tuesday by four original co-sponsors who are all women: Reps. Hillary J. Scholten (D-Mich.), Kathy E. Manning (D-N.C.), Lori Chavez-DeRemer (R-Ore.) and Del. Jenniffer González-Colón (R-Puerto Rico.). Rep. Michael Lawler (N.Y.), a vulnerable Republican representing a Democratic-leaning district, signed onto the measure late Monday and also attended. Rep. Adriano Espaillat (D-N.Y.) also signed on Tuesday.

The bill’s introduction comes after House Republicans passed a border security bill this month along party lines; House Republican leaders have said since last year that consideration of a large-scale immigration overhaul would not happen until a border security plan had passed the chamber.

Asked whether broad immigration legislation could be considered this year, Majority Leader Steve Scalise (R-La.) appeared to suggest last week that it would not happen until a border security plan is signed into law.

“We’ve got to first start with border security,” he said, before adding that it would mean getting such a bill to the president’s desk. “If we get that done, then you can start talking about the interior problems that exist.”

“Nothing is off the table,” Salazar said when asked about the prospects of a discharge petition, a procedural effort that would allow them to bypass the regular pathway for a bill to reach the floor.

Escobar then responded, “All it takes to make this happen is 218 people in the House of Representatives saying that they’re ready for a real solution.”

The myth that “border security” is unrelated to taking a more practical, humane, and realistic approach to migration generally shows how determined GOP leadership is NOT to address immigration problems in a fair and constructive manner and to “tune out” those interested in a potential bipartisan solution.

For those who don’t already know her, Rep. Hillary Scholten is, to my knowledge, the only EOIR attorney ever elected to Congress and has, therefore, seen how broken and in need of reform our system is at the “grass roots level.” So, her support of this measure is very significant.

Ex-judges: Immigration courts should be independent

Two retired immigration judges urged Congress to create an independent immigration court system, removing the courts from under the U.S. Justice Department, where they currently reside.

Panelists on a recent ABA webinar argued that immigration judges are not truly independent as long as they answer to the U.S. attorney general.

The former judges made their call at a panel discussion March 17 — “Adjudicatory Independence: Are Immigration Judges a Warning or a Model?” — organized by the American Bar Association Judicial Division. They and other panelists argued that immigration judges are not truly independent as long as they answer to the U.S. attorney general, who can overturn their decisions, fire them and create new immigration policies that they must follow.

Steven Morley, a retired immigration judge in Philadelphia, talked about a case he handled in 2018, called the Matter of Castro-Tum, which he considered a red flag for judicial independence.

The case involved an unaccompanied minor who illegally entered the United States, was detained by authorities, then released to relatives in the United States pending a hearing to force him to leave the county. Hearing notices were sent to the relatives’ address, but the boy did not appear. Finally, after four postponements, Morley administratively closed — or indefinitely suspended — the case, ruling that the Department of Homeland Security could not show it had a reliable address to notify the boy of his hearing.

At that point, U.S. Attorney General Jeff Sessions referred the case to himself and overturned the judge’s decision. Sessions ruled that immigration judges do not have the authority to administratively close cases as Morley did. The new policy made it harder for immigration judges across the country to indefinitely suspend cases. This caused an uproar among immigration judges and advocates.

Three years later, in 2021, Merrick Garland — a new attorney general in a new administration — overturned Sessions’ action.

Such actions undermine the independence of immigration judges, Morley said. “The flaws in the system allow this to happen, and we should always be concerned for the integrity of the court system.”

Morley said attorneys general under President Donald Trump referred immigration cases to themselves to overturn judges’ decisions 17 times in four years, a large number compared to previous administrations. “This is no way to run immigration policy, to have ping-ponging back and forth of policy, from one attorney general to another attorney general.”

Joan Churchill, a retired immigration judge in Northern Virginia, outside Washington, D.C., also emphasized the importance of maintaining due process in immigration courts, particularly hearing notices to defendants. “Adequate notice of the hearing is on everybody’s list as a requirement of due process,” she said.

Churchill noted that the U.S. Supreme Court, in a decision a few years ago, written by Justice Neil Gorsuch, found that notices in immigration court often were not constitutionally adequate. “Justice Gorsuch said any notices that did not include the time and place of the hearing — which many of them did not; they just said time and place to be determined — those were not adequate notice of the hearing and therefore the cases were defective.”

In 2010, the ABA House of Delegates adopted a policy supporting the creation of an independent Article I system of immigration courts. More than 150 organizations support this position, including the National Association of Immigration Judges and the American Immigration Lawyers Association, Churchill said.

The program was co-sponsored by the ABA Commission on Immigration, ABA International Law Section, National Association of Women Judges, ABA Section of Administrative Law and Regulatory Practice and ABA Civil Rights and Social Justice Section.

Several “quick takes” from Tea’s interview with Senator Gillibrand:

  • She has introduced an “Article I Immigration Court Bill” in the Senate and believes it’s the type of bipartisan initiative that might interest enough GOP legislators to form a “working bipartisan majority.” A similar bill introduced by Rep. Thanks Craig for speaking truth when so many are spreading false information and advocating trading human rights that aren’t ours to give away for “benefits” that should be conferred on their own merits with no “strings attached.” 

Unhappily, even the normally reliable and sensible Greg Sargent @ WashPost is spouting some of this absolute nonsense! He speaks of indefinitely extending massive violations of legal and human rights (“Title 42”), prisons for asylum seekers (“processing centers”), and expedited dockets (“deportation railroads without due process”) as if they are “OK trade-offs” for so-called “immigration reform.”

Notably, there is nothing now stopping the Administration from processing more refugees outside the U.S., providing grants to innovative organizations like “VIISTA Villanova” for training more qualified pro bono asylum representatives without having to rely exclusively on law schools, replacing poorly qualified Asylum Officers and Immigration Judges with asylum and human rights experts, appointing a new expert BIA qualified to establish affirmative precedents to guide Asylum Officers, IJs, and lawyers on both sides in how to recognize, document, and grant asylum in accordance with the generous intent of the law and the U.N. Convention on which it is based, providing grants to NGOs for systemic resettlement of asylees and applicants away from the border, targeting and prosecuting  human smugglers, and expeditiously removing those arriving at or near the border who can’t establish a “credible fear” of persecution.

That the Administration has failed to bring in the necessary visionary, dynamic, competent leadership to accomplish any of the foregoing, and that  a Dem-controlled Congress has failed in its oversight responsibilities and to push the Administration to fulfill its legal obligations to asylum seekers is a question of competence and will, NOT the fault of asylum seekers and their advocates. Nor is it a basis to reduce the already unfairly and illegally compromised rights of asylum seekers

Craig basically echoes some of the themes I set forth this week in my “Dissenting Opinion!”

I dissent. 

I was outraged when I read in this morning’s Washington Post about the horrible “Sinema/Tillis misnamed immigration compromise” (actually a “sellout”) being negotiated during the lame duck session of Congress. In short, that proposal apparently would trade long overdue protection for “Dreamers” for the rights and lives of refugees and asylum seekers.

Incredibly, in the face of U.S. District Judge Emmet Sullivan’s findings that the intentional illegal use of Title 42 had resulted in countless clear violations of the legal rights of asylum seekers, subjecting them to a litany of horrors and abuses that he described as “dire harm,” these legislators would extend those abuses for an indefinite period! That’s notwithstanding evidence not only of the irreparable harm that Title 42 has caused, but also the rather obvious fact that once we “normalize” those abuses, they will never end. 

There will always be another fabricated reason for extending the Title 42 charade. Indeed, once we start mischaracterizing abuse as “law,” we can’t even call it “abuse” and hold the abusers accountable! That’s all part of the dehumanizing or “Dred Scottification” process! 

Additionally, in the place of a functioning working asylum and refugee system, the proposal would eventually substitute so called “processing centers” and “expedited procedures” to railroad asylum seekers out of the country without due process. And, it wouldn’t address the total dysfunction and denial of due process in our Immigration “Courts” by enacting another long overdue provision:  the “Lofgren Article I Immigration court bill!” What a farce!

Let’s be clear about what’s happening here! The legal and human rights of refugees and asylum seekers are not “ours” to trade away for relief for another deserving group that has long been irrationally denied! “Processing centers” are a euphemism for “immigration prisons” — part of the “New American Gulag.” “Expedited processing” is a euphemism for “railroading.” Both detention and artificially expediting dockets have been proven to be ineffective and unjust, over and over. Yet, here we go again! 

My outrage turned to shock and dismay when I learned that some erstwhile defenders of due process, human rights, and racial justice for asylum seekers (incredibly) thought that this type of immoral compromise was a “good idea!” Not me!

Restrictionist/nativist Dems masquerading as “moderates” are a huge problem. They play right into the GOP’s hands. 

When committing crimes against humanity or giving away refugees’ rights becomes a “strategy,” “option,” or “bargaining chip,” we’re lost as a nation. And, that’s exactly where we’re heading with horrible, immoral proposals like this.

Human rights and due process are non-negotiable! And, I guarantee that extending Title 42, building additional Gulag (rather than making the existing legal asylum and refugee systems work), and railroading asylum seekers will empower smugglers and lead to further growth of our underground population. 

Human migration won’t be stopped by ineffective and immoral “deterrence.” And, although many hate the idea, refugees basically “self-select” and are driven by forces beyond our immediate control. 

Refugees are, by definition, folks who can’t return! So, there is no reason to believe that true refugees (of which there are many) are going to be “deterred.” They might be “incentivized” to seek refuge in particular, relatively safe, places; but, nobody seems interested in a “carrot” approach — even though the “stick approach” has failed and continues to do so!

Look at the folks who continue to die in vessels in the Mediterranean even though they are fully aware that they are unwanted and that the EU will stop at no cruelty to keep them out. 

And, examine the wealth of documentation that folks forced to “remain in Mexico” — and apply under what we know to be a corrupt and inadequate system — are systematically abused and exploited. 

This time, we’re not just “pushing the St. Louis out to sea.” We’re torpedoing her and watching the passengers drown. And Dems are a huge part of the problem!

Other (soon to be former) progressive Democrats might choose to “go along to get along” with heaping additional abuses on largely defenseless refugees and asylum seekers. But, not me! I dissent!

Immigration Reform: Might Past Be Prologue?

It’s been over 30 years since Congress enacted the most recent set of comprehensive immigration reforms: the Immigration Reform and Control Act of 1986 and the Immigration Act of 1990. These bipartisan yet hotly contested bills passed only after a debate spanning five presidential administrations, eight congressional sessions, and painful compromises by all parties. Even then, both bills died on the House floor before being resurrected at the 11th hour.

Can lessons learned during the last round of reform be applied to future debates? Charles Kamasaki, author of “Immigration Reform: The Corpse That Will Not Die” (Mandel Vilar Press, 2019), thinks so. The book provides a history of how the 1980s-era reforms were enacted, along with a summary of developments since then. It concludes with seven lessons that advocates and lawmakers should consider in advancing future immigration reform.

Yes, you can expect Biden to veto any of this. Still, upcoming generations of younger Americans will have to decide whether they want to live and raise their children in the the “American Hungary” — a neo-Nazi state where racial and ethic hatred and anti-Semitism will be at the center of all authoritarian Government policy. If not, the younger generation of the NDPA needs to come up with ways of keeping the GOP out of political power from the top to the bottom. 

However welcome, the latest hard-fought victory over racist nativism and xenophobia was just the beginning of the struggle for the heart and soul of America.

After years of advocacy from theNational Immigration Judges Association (here and here), immigration attorneys (from ABA and AILA), and scholars, Representatives Zoe Lofgren (D-CA), Jerrold Nadler (D-NY), and Hank Johnson (D-GA), introduced the Real Courts, Rule of Law Act of 2022 (H.R. 6577) that has passed House Judiciary Committeewith a vote of 24-12. It will next move to the House floor.

The Evacuate our Allies Coalition of faith, veterans’, and human rights groups has been advocating for an Afghan Adjustment Act (AAA), to allow our Afghan evacuees (many of whom have only been admitted as “parolees” whose status will expire 1 or 2 years from entry) to be treated equivalently to “refugees,” and thereby made eligible to apply for permanent residence in the U.S. after 1 year here (with the requisite vetting).  We now have a good shot to have AAA language passed by Congress, as part of the Ukraine Supplemental appropriation now being sought by President Biden.  The AAA has solid Democratic support as well as notable and increasing Republican support, but proponents can use assurances of additional Republican support to assure that AAA language remains in a bill that gets passed by Congress.
