By the time migrants get to Mexico’s northern border, they also demonstrate a clear understanding that they are engaged in an inherently participatory enterprise. The migrant shelters in Tijuana are poor and under-resourced — sometimes desperately so — but they do not lack in human leadership and initiative. Leaders at migrant shelters remind me of young people working on classroom projects in university settings, or participating in community organizations and social movements, or launching new ventures or start-ups in “co-working” environments.

But to characterize migrants arriving at our southern border as driven primarily by criminal and malevolent motives is a misdiagnosis of the highest order. Perhaps U.S. authorities should start documenting how many “migrant entrepreneurs” they are detaining at the U.S.-Mexico border.

The lifting of Title 42 — the policy that shut down the U.S. asylum system for three years — should have been an inflection point leading to a more humane and orderly system for processing asylum seekers. Instead, the Biden administration doubled down on the politics of exclusion, introducing new restrictive measures, including an asylum ban, that keep asylum out of reach for those who need protection the most.

When asylum seekers are finally able to ask for protection, they are often met not with compassion but with cruelty. Just days ago in San Ysidro, I saw mothers with children sleeping on dirt while in Customs and Border Protection custody, sharing one port-a-potty for more than 500 people. Good Samaritans handed out supplies because CBP did not provide sufficient food, water or medicine.

President Biden has perpetuated these failed deterrence policies despite his campaign promises to restore humanity at our border. The administration has turned its back on asylum seekers. These are real people. They deserve our protection. They deserve to be safe.

You don’t have to be either an immigration expert or very smart to recognize that desperate individuals trying to turn themselves in to CBP agents at or near the border, to exercise their legal rights to seek protection, are NOT going to be a meaningful source of fentanyl smuggling. That trade is controlled by cartels who basically smuggle product through ports of entry in large quantities disguised as or mingled with legitimate commercial commerce. 

Indeed, the preoccupation of CBP with improperly “deterring,” “discouraging,” and “punishing” legal asylum seekers not only empowers cartels, but significantly detracts from actual law enforcement against drug smugglers. And, the millions of dollars being misappropriated and wasted by Junkman and others on bogus National Guard deployments could much better and more appropriately be spent on humanitarian aid, coordinated, orderly resettlement programs for asylum seekers and asylees, and securing them legal representation to aid in the fair and timely processing of asylum claims. 

However, the repetition of bogus and deliberately fabricated narratives like the “Junkman’s” latest wasteful stunt creates a “guilt by repetition” syndrome that feeds and enables the racist agenda of today’s GOP as well as the spineless “rollover” response of the Biden Administration, and, sadly, some other so-called Democrats.

Customs and Border Protection officials are now processing Ukrainians fleeing Russia’s invasion of their country at the San Diego-Tijuana border through a pedestrian crossing that remains closed to the general public.

The move, according to volunteers helping the Ukrainians and the Tijuana mayor’s office, is to speed up how many Ukrainians border officials can process in a day. PedWest, the pedestrian crossing at the western end of the San Ysidro Port of Entry, has been closed to general traffic for the past two years.

At around 6 a.m. Wednesday morning, a busload of Ukrainians arrived at El Chaparral plaza on the south side of the crossing. That is where a camp of hundreds of mostly Central American and Mexican asylum seekers were camped for months, waiting for the Biden administration to open processing for refugee screenings. Mexican authorities bulldozed the camp in February, and the Biden administration has said that asylum processing won’t resume until May 23, with the exception of the Ukrainians.

I’ve been advocating (obviously unsuccessfully) for this type of preferred processing of asylum applicants to be applied to ALL NATIONALITIES, regardless of race or ethnicity, in advance of the May 23 date for the end of the Title 42 charade. https://immigrationcourtside.com/2022/04/02/%f0%9f%97%bd%e2%9a%96%ef%b8%8f-cdc-announces-end-of-covid-bar-but-only-7-weeks-from-now-compare-what-dhs-should-have-said-with-what-they-did-say-with-51/

DHS, with the assistance of NGOs, UNHCR, and other volunteers from the human rights community can screen those waiting over the next six weeks to insure that applicants with the strongest claims are moved to the front of the line in advance or even admitted under an “exception” (DHS seems to be able to invent these at their whim) before May 23.

That’s the way to establish an orderly, fair, and humane transition back to the rule of law at all border ports of entry!  

Additionally, because Garland has basically abdicated his duty to restructure and restaff the Immigration Courts to provide fair, positive interpretations of what asylum cases should be granted and to establish practical evidentiary and proof standards, the Asylum Office can work with the UNHCR and asylum experts to fill the gap. 

While the BIA might be intentionally short on positive asylum guidance, there are plenty of decent Circuit decisions and some unpublished IJ decisions out there that point the way toward a fair, generous, functional legal asylum system that will actually fulfill the humanitarian promise of older precedents. Cases such as the Supreme’s decision in Cardoza Fonseca; the BIA’s complimentary positive guidance in cases like Matter of Mogharrabi, Matter of Kasinga, Matter of O-Z- & I-Z-, and Matter of A-R-C-G-; and the regulations establishing a “presumption of future persecution” based on past persecution all point the way toward a much more generous, practical, and humane interpretation and application of U.S. asylum law. 

Honest interpretations of asylum law disgracefully fell into disuse as the Trump regime improperly “weaponized” the Immigration Courts against asylum seekers and attempted to replace qualified Asylum Officers with patently unqualified Border Patrol Agents. But, despite a lackadaisical performance to date, the Biden Administration still has a golden opportunity to reverse the mistakes of the past and to lead the way to a better future. Whether they will take that opportunity remains to be seen!

Twenty years ago, the American military marched into Afghanistan with the declared intent of hunting down Osama bin Laden and ridding the country of Taliban extremists. Led by government leaders working in bad faith, thousands of civilians and soldiers were led to their deaths for a war now universally considered a failure. However, the most vulnerable population susceptible to death in Afghanistan are those Afghan allies who risked their lives to work for the foreign forces. They served as translators and services workers and any role that required the help of the local population. Now, with the Taliban back in power, they will be the first to face death.

When local Afghans agreed to work for coalition forces, they were made a promise: work for us and we will give you a visa to the U.S. They put their safety on the line working for the military forces but did so in order to give them and their families the chance for a better future outside Afghanistan. They worked anywhere service members went, from battlefields to bases. Often, they were the people who saved the lives of the soldiers they worked for. They were not just local Afghans but critical allies necessary for the ongoing mission in their country. At that point, we had nothing short of a deep-seated moral obligation to make sure they were protected.

In the months before her death, Chavez Segovia had tried to cross the border at least two other times by land and had been expelled under Title 42, a Trump-era policy that allows the government to deny non-citizens entry into the country in response to the threat of COVID-19.

Migrant advocates have warned the strict border policy is pushing desperate people to take larger risks to try to cross the border into the United States, increasing the chances they become injured or killed.

“There are more people choosing to cross through dangerous routes, including the maritime crossing, because they don’t have the ability to present themselves at the ports because the ports are closed as a result of the Title 42 orders,” explained Pedro Rios, the director of the American Friends Service Committee’s U.S.-Mexico Border Program.

Chavez Segovia was trying to cross not just for work, but also because she was afraid, and was trying to claim asylum, said her sister, Gabriela, who is undocumented and living in northern California. She said Chavez Segovia tried to claim asylum on both previous crossing attempts.

Gabriela said she too was fearful of sharing details of her sister’s situation, especially because her sons remain in Mexico. But Gabriela said she wishes Chavez Segovia had gotten a chance to plead her case, and that U.S. border authorities had listened.

“Ella les dijo que viene de peligro; que corría peligro y ellos no le hicieron caso,” said Gabriela. “She told them she was coming from danger, that she was running from danger and they didn’t listen to her.

“What are you going to do? Wait until someone sits down and writes you a letter that says ‘I am threatening you.’ No, of course not, you’re going to go at the first opportunity,” said Gabriela, frustrated at the high bar of legal proof needed for one to make an asylum claim.

For the world’s most vulnerable, protection in the United States has all but disappeared.
Wait times for asylum seekers at the U.S.-Mexico border that already seemed indefinite now seem impossible. Families struggle to find food and shelter to outlast a pandemic order with no end date.
Those who cross north are sent back to Mexico in a matter of hours — or even put onto planes back to the countries from which they fled — without any opportunity to explain why they came.
In its response to COVID-19, the Trump administration achieved what it long sought, a shutdown of the U.S. asylum system. And with new regulations introduced this summer, the administration has moved to squeeze out any real chance at refuge in case the pandemic order is lifted.
But even before the current president began his campaign against asylum in the United States, people often struggled to win protection — no matter how strong their cases appeared to be.
In its 40-year history, the system has chronically fallen short of its promise of safety.
RETURNED: PART II
The second in an occasional series in which the Union-Tribune explores the asylum system through the eyes of people who experience it firsthand, with drastically different outcomes.
The Trump administration has used statistics about grant rates to justify closing off access to asylum, saying that those who lose their cases are illegitimate asylum seekers.
The facts show a different story: Thousands of people turned away based not on the merits of their cases, but on the capriciousness of a system so riven with inequity that many outcomes seem little more than arbitrary.

There can be no excuse for the “horror chamber” that this already broken, battered, and unfair system has devolved into. It will take genuine changes in expertise, attitude, courage, and intellectual integrity across all three branches of Government to get this system functioning in a fair, legal, and constitutional manner consistent with due process and our international obligations.
It also will require much better, more educated, more courageous, more practical, and more intellectually honest judges from the Immigration Courts (which must become independent from the Executive) all the way up to and including the Supremes.

Better judges for a better America! Life tenure means it won’t happen overnight. But, the process needs to begin now for our nation to survive and prosper!

We can’t achieve equal justice for all with so many judges who don’t believe in it, don’t have expertise in and a commitment to human rights, and don’t have the guts to stand up for the legal, constitutional, and human rights of all individuals coming before our justice system. That specifically includes the “most vulnerable among us” – asylum seekers and other of our fellow humans whose humanity and right to live seem to fall below the “radar screen” of the current Supremes’ majority!

A San Diego federal judge ordered Immigration and Customs Enforcement to review for release a list of newly identified detainees at the Otay Mesa Detention Center who would be at high risk for serious health complications if they get COVID-19.

U.S. District Court Judge Dana Sabraw granted the American Civil Liberties Union’s request to create a subclass of people at high risk under the pandemic, which has spread widely within the facility. The judge made his decision after learning that the facility’s warden had undercounted the number of people in that category in his initial declaration for the case.

“That information is significant,” Sabraw told attorneys during a telephonic hearing Thursday. “It does change measurably the underlying facts and whether or not the petitioners are entitled to relief.”

A spokeswoman for CoreCivic, the private prison company that runs the facility, said that the initial report sent to the judge was compiled with data from ICE Health Service Corps, which provides the medical care at the facility, and the report “was made with the best available information we had from our partners at the time.”

There was a time, long ago, when a Government agency’s submission of false, materially incomplete, or misleading information to a Federal Court would have earned sanctions up to and including threats of contempt from a U.S. District Judge. Sadly, bending the truth, omitting material information, and outright lies have become “the norm” for DHS and DOJ under Trump. 

Indeed, the burden is now on the plaintiffs, often serving pro bono and stretched to the limit, to show and document for the courts each false, incomplete, or misleading affirmation from the Government. Against reason and the clear record over the past three years, Federal Courts continue to presume the proven unlikely — nay, likely impossible — that a regime led by a pathological liar and his toadies will provide them true, accurate, and complete information about anything!

Instead of asylum applicants being given “the benefit of the doubt,” as our law is supposed to require, that benefit of the doubt is now being given to an overtly bigoted and dishonest Executive who in no way has earned or deserved it. Everything has been turned upside down.

But, until the Article III Courts take actions to insure that this regime respects the integrity of the process, the practice of “lie, obfuscate, and mislead first and see if they catch you” will continue largely unabated. Vulnerable migrants aren’t the only victims here. Failing to force the regime to act in an honest, ethical, and professional manner in Federal litigation is eroding the integrity of the Article III Courts all the way up to the complicit Supremes.

Remember, several years ago, the DHS and DOJ lied to Federal Courts and the public about the existence of Sessions’s “child separation policy.” Two years later, they continue to feed erroneous information to the courts with impunity. But, who’s surprised when in the meantime the Supremes’ majority has sent such a powerful and consistent message that “Brown Lives Don’t Matter” and they won’t examine the truth or actual motivation behind any Executive attack on the rights, lives, and safety of migrants.

Here’s a report from a member of the NDPA and a Courtside reader on the front lines of the battle to save humanity: “[T]wo of our clients detained in Otay Mesa Detention Center were finally released after a Federal Judge issued a TRO. I am relieved. ICE has been unreasonable and in my opinion reckless with the lives of people in detention and even their own employees. . . .  And the attorneys at the ACLU are the true heroes here and . . . students.”

Why is this abject failure of responsible Government and absence of powerful, coordinated, courageous judging that puts an end to these human rights abuses acceptable? Why isn’t our Supreme Court delivering a powerful message that Executive dishonesty, denials of due process, systemic detention abuses, and disregard of established human rights principles aren’t acceptable in 21st Century America? Why is “Dred Scottification” the new policy endorsed by the “JR Five” on the Supremes?

Until we get better Federal Judges willing to stand up to Executive abuses and a Congress that retakes its responsibility to legislate and oversee the Executive in the area of immigration and human rights, it will continue to fall to the private bar and NGO lawyers to force officials among our failed institutions in all three Branches to do their jobs in accordance with the law and the Constitution. That’s not the way it’s supposed to work. But, it’s the only way it does work in today’s America. Thank goodness for the (non-regime) lawyers!

On the same day the first person in immigration custody in San Diego was confirmed to have the new coronavirus, the American Civil Liberties Union sued for the release of certain high-risk detainees at the region’s two detention centers.

In the lawsuit, ACLU attorneys argue that specific detainees at Otay Mesa Detention Center and Imperial Regional Detention Facility who have pre-existing conditions that would make severe symptoms of COVID-19 more likely should be released in order to protect them from likely exposure to the virus. Some similar cases, filed by other groups around the country, have been successful in getting immigrant detainees released.

Similar suits have produced mixed results throughout the country. While some U.S. District Judges have ordered or threatened to order the release of certain detainees, others have “blown off” legitimate health concerns and the failure of DHS and DOJ authorities to follow health guidelines during the pandemic.

Of course, the idea that social distancing, universal testing, basic hygiene, or individual protective equipment is being employed in any part of the “DHS Gulag” and the Immigration “Courts” is preposterous on its face. Yet, remarkably, some U.S. District Judges prefer the “show me the dead bodies approach” as an alternative to the sensible preventive measures recommended by health professionals. After all, “they are only aliens” in the eyes of the regime and some Federal Judges.

Others, more astutely, have recognized that those stuck in the Gulag and the never-ending dysfunction of the Immigration “Courts” are actually their fellow human beings, most without serious criminal convictions. They are also “persons” under the Fifth Amendment to the U.S. Constitution, entitled to have their health, safety, and lives protected from dangerous and unreasonable actions by the Federal Government.

Bárbara never thought she would leave Nicaragua.

But early one morning, she kissed her sleeping son goodbye. She had spent the night watching him in his bed. It was almost his 10th birthday.

“Fue el peor momento de mi vida,” Bárbara said. It was the worst moment of my life.

It had been nearly a year since Bárbara had been left for dead outside her clothing store, a victim of the Nicaraguan government’s bloody campaign to silence pro-democracy protests that rose up in 2018.

She knew she had to flee, but she didn’t think she could protect her son on the notorious migrant trail. She wasn’t willing to risk him.

So the 29-year-old entrepreneur escaped north alone, putting herself at the mercy of the U.S. asylum system — a system meant to protect the world’s most vulnerable.

The first in an occasional series in which the Union-Tribune explores the asylum system through the eyes of people who experience it firsthand, with drastically different outcomes.

Interestingly, there was a time in the past when the GOP and the Reagan Administration went out of its way to help and give refuge to those Nicaraguans fleeing the Sandinistas and Daniel Ortega. The Nicaraguan and Central American Relief Act (“NACARA”), one of the best, most effective, and most efficient pieces of immigration legislation ever passed, was a result of bipartisan support for providing permanent relief to Nicaraguans, El Salvadorans, and Guatemalans fleeing the mess in Central American that our Government played a significant role in creating. Some off those fleeing Cuba and Eastern Europe also were covered. Now, under the influence of Trump, neo-fascist Stephen Miller, and the rest of the White Nationalist nativist gang, this GOP-led regime simply turns its back on vulnerable refugees like Barbara, the human carnage resulting from Ortega’s misrule of Nicaragua.

Perhaps in the future, Kate will put it all together in a book. Hope so!

TIJUANA — A 35-year-old man from El Salvador returned to Mexico under a controversial Trump administration program was brutally killed in Tijuana while waiting for an outcome to his U.S. asylum case, according to his family’s attorney.

During a seven-month period, the man and his family repeatedly told U.S. officials — including a San Diego immigration court judge, officials with Immigration and Customs Enforcement and border agents with U.S. Customs and Border Protection — that they were not safe in Tijuana, the lawyer said.

Customs and Border Protection returned the man and his family to Tijuana anyway, records show. In November, he was killed in Zona Norte, one of Tijuana’s more dangerous regions near the border.

“I don’t know how there’s an argument that Mexico is a safe country,” said Richard Sterger, the family’s immigration attorney. “My clients begged not to be sent back there.”

The family fled El Salvador and presented themselves at the San Ysidro Port of Entry in May asking to be allowed into the United States to assert their legal right to seek asylum, Sterger said.

The family was placed into the Migrant Protection Protocols program, also known as MPP or “Remain in Mexico.” The man’s wife and their two children are not being identified because they fear for their lives after reporting and speaking about his slaying.

Sterger said he could not discuss details of their asylum claim, such as why they fled El Salvador, because it is part of their ongoing immigration case.

Between May and September, the family members waited in Tijuana for their first court appearance, he said.

During their Sept. 11 immigration court hearing, they pleaded with a San Diego immigration judge to not be sent back to Mexico because they feared for their safety. At the time, the family did not have legal representation, Sterger said.

“I told the judge that I was afraid for my children because we were in a horrible, horrible place, and we didn’t feel safe here,” the widow told the Spanish-language news station Telemundo 20.

The judge referred the case to ICE, a process called “red sheeting,” and the family was interviewed about its fears of returning to Tijuana without a legal representative, the attorney said.

A spokeswoman for ICE said a “red sheet” is placed at the top of a person’s immigration court case file to alert Customs and Border Protection officials that an interview needs to be done about whether or not a family can continue safely waiting in Mexico.

She said she could not comment specifically on the man’s case because of privacy and identification policies.

Under international law, countries are forbidden to return asylum seekers to any nation where they are likely to face danger of persecution because of their “race, religion, nationality, membership of a particular social group or political opinion.” The legal principle is known as “non-refoulement.”

Migrant rights advocates have been warning the public that the U.S. government is violating the “non-refoulement” principle with the MPP program, which is facing numerous challenges and lawsuits in federal court.

Sterger said his clients’ case is a perfect example.

After telling U.S. officials they were afraid to be in Tijuana, the members of the family were sent back anyway without explanation.

A Baja California death certificate says the husband and father died Nov. 20 of stab wounds to his neck. It also says he had cuts and stab wounds all over his torso that a Baja California investigator confirmed could indicate torture.

Started under the Trump administration, MPP requires that migrants trying to legally enter the United States remain in Mexico during the immigration court process.

That process usually takes several months, sometimes up to a year, and involves multiple court hearings, which requires migrants to present themselves at El Chaparral border crossing near the San Ysidro Port of Entry to travel to immigration court in San Diego.

Officials with the Baja California prosecutors’ office said that during the process of repeatedly presenting themselves at the border, U.S. asylum seekers can easily be spotted and targeted by criminal groups as potential victims.

In Tijuana, the threat of violence for migrants is so severe that Baja California state police have been going around to various migrant shelters giving presentations on how to avoid becoming a victim since the MPP program began.

Under the program, rolled out in January in Tijuana and then expanded across the U.S.-Mexico border, tens of thousands of U.S. asylum seekers have been returned to Mexico.

Immigration advocacy groups, attorneys and human rights organizations have been urgently warning the U.S. government that border cities are not safe places for asylum seekers to be forced to wait while their cases are processed.

The nonprofit group Human Rights First identified 636 publicly reported cases of “rape, torture, kidnapping and other violent assaults against asylum seekers and migrants forced to return to Mexico by the Trump administration.”

Of that, at least 138 cases involved children being kidnapped or nearly kidnapped in Mexico, according to a report by the group.

“The MPP fear screening process is a sham with interviews that have become increasingly cursory and adversarial resulting in the return of vulnerable and victimized asylum seekers to new dangers,” the report highlighted.

Sterger agreed.

“We are literally putting people’s lives at risk,” he said.

The attorney said that after the father and husband of the family was brutally slain, the mother ran to the border with her children, both younger than 10. She told border officers what happened and begged to be let into the United States.

I’m, glad Wendy reports on these continuing “crimes against humanity.” But, it must be tough being  on the “Watchdog & Accountability Team” in a system where complicit and complacent Federal Judges are unwilling to hold the regime accountable for their outrageously illegal and unconstitutional (not to mention unconscionable) behavior.

Asylum seekers who have finished their court cases are being sent back to Mexico with documents that contain fraudulent future court dates, keeping some migrants south of the border indefinitely, records show.

Under the Migrant Protection Protocols policy, asylum seekers with cases in the United States have to wait in Mexico until those cases are resolved. The Mexican government agreed to accept only migrants with future court dates scheduled.

Normally, when migrants conclude their immigration court cases, they are either paroled into the United States or kept in federal custody depending on the outcome of the case.

However, records obtained by the San Diego Union-Tribune show that on at least 14 occasions, Customs and Border Protection agents in California and Texas gave migrants who had already concluded their court cases documents with fraudulent future court dates written on them and sent the migrants back to Mexico anyway.

Those documents, unofficially known as tear sheets, are given to every migrant in the Migrant Protection Protocols program who is sent back to Mexico. The document tells the migrants where and when to appear at the border so that they can be transported to immigration court. What is different about the tear sheets that migrants with closed cases receive is that the future court date is not legitimate, according to multiple immigration lawyers whose clients have received these documents.

This has happened both to migrants who have been granted asylum and those who had their cases terminated — meaning a judge closed the case without making a formal decision, usually on procedural grounds. Additionally, at least one migrant was physically assaulted after being sent back to Mexico this way, according to her lawyer.

Bashir Ghazialam, a San Diego immigration lawyer who represents six people who received these fake future court dates, said he was shocked by the developments.

“This is fraud,” he said. “I don’t call everything fraud. This is the first time I’ve used the words, ‘U.S. government’ and ‘fraud’ in the same sentence. No one should be OK with this.”

The Department of Homeland Security and Customs and Border Protection did not respond to multiple requests to comment about why they had engaged in the practice.

Ghazialam first noticed this in September, when three of his clients were sent back to Mexico after their cases were terminated on Sept. 17. After the judge made his decision, the family spent 10 days in Customs and Border Protection custody.

On Sept. 27, the family was given a document that read, in part, “At your last court appearance, an immigration judge ordered you to return to court for another hearing.” That piece of paper told them to return to court on Nov. 28.

However, the immigration judge ordered no further hearing. Ghazialam’s clients do not have a hearing scheduled on that or any other day.

To confirm Ghazialam’s claims, a reporter called a Department of Justice hotline that people with immigration court cases use to check their status and dates of future hearings. That hotline confirmed that the family’s case had been terminated on Sept. 17 and that “the system does not contain any information regarding a future hearing date on your case.”

“That date is completely made up and the Mexican authorities are not trained enough to know this is a fake court date,” Ghazialam said.

After being returned to Mexico, the mother was stabbed in the forearm while protecting her children from an attempted kidnapping. She still has stitches from the wound, Ghazialam said.

The mother presented herself at the border shortly after the stabbing. She told Customs and Border Protection agents that she was afraid to stay in Mexico. The agents gave her a fear of return interview and tried to send her back to Mexico.

But this time, Mexican immigration officials refused to let her and her children back into Mexico because they did not have a court date, Ghazialam said. She is currently with relatives in New York, waiting to figure out the future of her legal status in the United States while wearing an ankle monitor.

In most of these cases, immigration attorneys aren’t aware that their clients were sent back to Mexico until it’s too late.

In one case, a Cuban asylum seeker was returned to Mexico after an immigration judge in Brownsville, Texas, granted her asylum.

The woman’s lawyer, Jodi Goodwin, remembers hugging her client after the decision and arranging a place to meet after authorities released her later that day following processing.

Goodwin expected the process to take 45 minutes, so she went to a nearby Whataburger and ordered a chocolate milkshake. About 40 minutes later, she got a phone call from her client.

“She was hysterical and crying,” Goodwin said. “I’m like, ‘What happened?’ and she says, ‘I’m in Mexico.’ ”

Goodwin called U.S. and Mexican immigration authorities to try to find out what happened. She spent five hours at the border until 9 p.m. and then went home to draft a lawsuit. It wasn’t until she threatened to sue CBP that her client was paroled into the United States.

“It was total chaos for 24 hours to try to figure it out,” Goodwin said. “It shouldn’t be like that, especially when CBP is blatantly lying. They are creating documents that have false information.”

The American Immigration Lawyers Assn. said it was worried about the practice.

“The idea that even though these vulnerable individuals are able to obtain an asylum grant from an immigration judge and CBP is sending them back to harm’s way in Mexico is really disturbing, especially under the guise that there’s a future hearing date,” said Laura Lynch, senior policy counsel for the organization.

Mexico’s National Institute of Migration did not immediately respond to questions about this practice.

Although Ghazialam and Goodwin were able to eventually get their clients back into the United States, some people are still in Mexico.

That’s what happened to a Guatemalan woman and her two children after a judge terminated their case on Oct. 18. The same day the judge closed their case, a U.S. immigration official gave her a piece of paper with the false hearing date of Jan. 16.

“But this appointment does not exist,” said the woman’s New York City attorney, Rebecca Press. “If you check with the immigration court system, there is no January hearing date and the case has already been terminated.”

It’s unclear how widespread this practice is. Lawyers in San Diego; Laredo, Texas; and Brownsville confirmed they have seen it firsthand.

However, only about 1% of asylum seekers in the Migrant Protection Protocols program have lawyers. Therefore it’s difficult to track what happens to the overwhelming majority of the people in the program.

Lawyers said asylum seekers without legal representation who have been sent back in this manner probably have no way of advocating for themselves. It took Goodwin hours of calls to high-level officials in both U.S. and Mexican immigration agencies plus the threat of a lawsuit to get her client back into the United States.

“If you don’t have someone who’s willing to sit around and spend five hours on the phone and stay up all night drafting litigation to force their hand, you’re going to be stuck,” she said.

As news of these false hearing dates spread among the immigration attorney community, some lawyers are taking proactive steps to protect their clients from being returned to Mexico after their court cases are closed.

Siobhan Waldron, a Los Angeles lawyer, wrote a letter to Mexican immigration officials explaining that her client had no future hearing date and outlined a step-by-step process Mexican officials could take to verify that her client’s case had been closed by using the Department of Justice hotline.

The letter worked at first.

When CBP officers tried to return Waldron’s client to Mexico on Nov. 1 with a false January hearing date, her client showed the note to Mexican officials, who refused to take her in. However, the next day, CBP officers sent Waldron’s client back to Mexico with another false court date and this time did not allow her to show Mexican officials her lawyer’s letter that she kept in a special folder, Waldron said.

“They didn’t let her take it out,” Waldron said. “They said, ‘You can’t present anything from that folder.’ ”

The lawyer plans to file “any complaint you can imagine” to CBP, the Department of Homeland Security and other regulatory agencies because “these agents need to be held accountable.”

Her client is still in Mexico, too afraid to walk outside because she has already been kidnapped and assaulted, Waldron said.

Why have a “Judicial Branch” that won’t stand up for individual legal rights in the face of Executive tyranny, overreach, and downright fraud? Customs and Border Protection may be violating the law by holding asylum-seeking children longer than the agency is allowed to, according to lawyers who represent migrants along the U.S.-Mexico border.

Lawyers are accusing Customs and Border Protection in San Diego of breaking their own policies and potentially the law by holding migrant children in custody longer than the agency is allowed to.

Under the Flores Settlement Agreement, the federal government generally cannot detain migrant children and their parents together for more than brief periods. The agreement states CBP should not hold children for more than 72 hours and Immigration and Customs Enforcement should not detain them for more than 20 days.

However, asylum-seeking children are routinely held for more than 72 hours in San Diego, according to Erika Pinheiro, a staff attorney with the nonprofit Al Otro Lado.

“We are seeing cases of prolonged detention every day,” she said. “There is no rhyme or reason to it. Sometimes they are released the same day, sometimes it’s a week later. We’ve had cases of people in CBP custody for three weeks.”

Many of the people being held in CBP custody are part of the Remain in Mexico program, which forced asylum seekers to live in Mexico while waiting for their cases to be decided in immigration courts.

The latest example involves a 9-year-old asylum seeker and her mother who have been in CBP custody since Oct. 4, as first reported by KPBS.

The mother and family were released from CBP custody Monday afternoon, Pinheiro said.

That case is particularly disturbing because both the child and mother are reportedly sick — suffering from stomach pain and diarrhea — which could be a separate violation of the Flores Settlement Agreement, the lawyer added.

Apart from limiting the amount of time children can be in federal custody, the Flores Settlement Agreement also establishes basic standards of care that include access to medical care.

A CBP spokesman declined to answer specific questions about the 9-year-old’s case or more general questions about Pinheiro’s claims that the agency is violating the law.

The spokesman said that the agency treats those in its custody with, “dignity and respect,” while striving to, “process individuals as expeditiously as possible,” and noted that, “most individuals are in our facilities for 72 hours or less.”

President Trump has called the Flores Settlement Agreement a “loophole,” that allows immigrants to be released from immigration detention centers. In August, the Trump administration unveiled proposed regulations that would replace Flores.

Specifically, the new policies would abolish ICE’s 20-day limit on detaining families and establish new minimum standards of care for people held in detention centers.

According to CBP’s own policies, “detainees should generally not be held for longer than 72 hours in CBP facility and every effort must be made to hold detainees for the least amount of time required for their processing, transfer, release, or repatriation as appropriate and as operationally feasible.”

Immigration attorney Rose Thompson has seen multiple asylum seekers spend more than 72 hours in CBP custody, including a case of a mother and her adult daughter spending 12 days in CBP custody.

Another asylum seeker said the conditions inside CBP custody were so poor that she asked to be sent back to Mexico, Thompson said.

“It’s horrible,” she said. “It’s not an area that’s intended to detain people for longer than 48 or 72 hours because it’s not comfortable. I don’t know even if there are beds.”

An August 2019 report of conditions inside federal custody noted that the average length of detention for asylum seekers here in San Diego was 3.4 days and more than eight percent of migrants surveyed in the report were held in custody for five days or more.

That report, published by the U.S. Immigration Policy Center, noted that more than 10 percent of asylum seekers in custody reported experiencing medical issues in detention.

The Flores Settlement Agreement also requires the federal government to provide basic care for children in custody. It stipulates that minors most be treated with, “dignity, respect, and special concern for their particular vulnerability.”

Similarly, CBP guidelines regarding medical treatment state that officers are required to report illnesses to a supervisor and document them in an electronic system of record while also seeking or providing medical care in a timely manner.

However, Pinheiro claims that CBP is also violating this aspect of both the Flores Agreement and the agency’s internal policies.

She points to the mother and daughter released from detention on Monday as just the latest example of migrants not receiving adequate care while in custody.

“I have never had a client say they saw a doctor while in CBP custody,” she said.

Conditions of migrants in CBP custody made headlines in June, when a group of lawyers in Texas asked a judge to issue a temporary restraining order and a contempt order calling for CBP to “immediately start processing children for release to parents or relatives,” and provide children with, “basic necessities including adequate food, clean water, medical care, and access to sleep.”

There is a fairly simple solution for the problem of a Government that disobeys the law. Federal Judges should start throwing “Cooch Cooch,” his subordinates, Barr, and the DOJ lawyers advancing untrue and unethical arguments in support of their “clients’” indefensible positions in jail for contempt of court. In the case of lawyers, like “Cooch Cooch,” Barr, and his subordinates they should also be referred to their respective state bars for disbarment proceedings.

Until these thugs are held accountable, the child abuse and other human rights outrages will continue.

San Ysidro rally focuses on treatment of immigrant women, girls at border

Critics say detention centers deny proper health care, feminine hygiene products

Activists from across the county held a rally Sunday in San Ysidro to highlight the inhumane treatment of immigrant women and girls held at detention centers across the nation’s southern border.

Waving signs saying “stop racism now” and “respect women of color,” the activists chanted “classrooms not cages” and “when immigrant rights are under attack, what do we do — stand up and fight back.”

Gathered on a baseball field near the international border and the Otay Mesa Detention Center, the roughly 60 activists listened to a series of speakers describe reports of poor treatment that women and girls are receiving in detention centers.

“The punishing conditions imposed by the Department of Homeland Security, ICE and Customs and Border Protection on immigrants at the southern border continue to threaten the lives of tens of thousands of vulnerable persons,” said Toni Van Pelt, president of the National Organization for Women, which organized the rally.

Van Pelt said there are an estimated 40,000 to 50,000 immigrants in detention centers along the border and that many are experiencing intolerable conditions.

Women and girls, she said, have experienced sexual assaults, harassment and limited access to feminine hygiene products. In addition, she said they are often not provided interpreters, reproductive health care or mental health care.

Van Pelt drew angry shouts of support from the crowd when she described women and girls being forced to continue wearing soiled undergarments because they aren’t provided proper hygiene products.

Government officials have acknowledged overcrowding and other problems at the detention centers.

President Donald Trump has said conditions are better than they were under the Obama administration. But many reports from immigrant and human rights groups dispute that.

Dolores Huerta, an 89-year-old icon in the feminist and labor movement, was the featured speaker at the rally.

Huerta, who co-founded the National Farm Workers Association, led the crowd in a chant of “Who’s got the power, we’ve got the power — feminist power.”

She also said it’s crucial for activists and others concerned about racism and poor treatment of immigrants to become as politically active as possible.

“There is only one way to change the situation,” she said. “We’ve got to get active out there in these next elections. We are the only ones who can make it happen — we can’t rely on anyone else.”

Among those at the rally were two first-year students at Cal State San Marcos.

“We want people to know that everyone deserves rights, not just one specific group,” said Vanessa Span, a Latina who grew up in Redding.

Kimi Herrera, also Latina, said our country was founded on immigration so it’s important to continue to respect the process.

“Coming from a background of immigrants, I think this is something really important to bring attention to,” said Herrera, who grew up in Glendora.

The rally took place at the Cesar Chavez Recreation Center in San Ysidro.

Judge orders U.S. to hold asylum seeker

Doubtful about his mental state, jurist prevents migrant from being sent to Mexico.

SAN DIEGO — An immigration judge has ordered the Department of Homeland Security to keep a Honduran asylum seeker in the United States while he waits for his court proceedings, instead of returning him to Mexico again under a Trump administration program.

Judge Scott Simpson said that after evaluating the man’s mental competence in a special hearing on Friday, he found that the man would need safeguards in his case to ensure due process. He ordered one put in place immediately: to remove the man from a program known officially as Migrant Protection Protocols and more widely as “Remain in Mexico.”

“I find that he lacks a rational and factual understanding of the nature of the proceedings,” Simpson said in issuing his order.

This is the first time that a judge has made such a ruling since the program was implemented in January, according to advocates who have been monitoring immigration court proceedings.

The program requires certain asylum seekers from Honduras, El Salvador and Guatemala to wait in Mexico while their cases progress in immigration court. The man has been waiting in Tijuana as part of the program for several months.

A Customs and Border Protection guide for officials implementing the program says that migrants with known physical or mental health issues should not be included.

“It’s a big deal that a judge recognized that there was a predatory nature to having put this person in the ‘Migrant Persecution Protocols,’ ” said Ian Philabaum of Innovation Law Lab, calling the program a name used by some immigrant rights advocates. “He wasn’t going to have a chance, and now he gets a chance.”

At the man’s first hearing in March, Simpson quickly became concerned that the man might have a mental competency issue that would make him ineligible for the program or require other protections. He ordered DHS to evaluate the man’s mental state.

Simpson asked government attorneys at each hearing after that whether the man’s mental state had been evaluated and whether the government believed he should continue to be included in the program.

Each time, the government attorney responded that the man should continue in MPP.

Still skeptical, Simpson told Immigration and Customs Enforcement attorney Dan Hua to be prepared to give details Friday about DHS’s evaluation of the man before he was returned to Mexico. When the judge came into court Friday morning, Hua was not able to answer that question.

“The government’s inability to provide that information is simply not excusable,” Simpson said. He gave Hua 30 minutes to find out answers.

Hua said immigration officials at the port of entry had evaluated the man each time he’d come to court, meaning that as of Friday, he’d been evaluated four times.

The attorney could not produce evidence showing what the evaluation observed or what standard it used when the judge pressed for more details.

Philabaum said that fact was significant.

“That assessment of the mental competency was performed on four different occasions, and on four different occasions, according to the U.S. government attorney, their assessment was he was perfectly competent to proceed with his immigration case representing himself,” Philabaum said. But in the man’s “first hearing, it took the immigration judge approximately two minutes to realize there was an issue of competency here.

“Whatever type of standard that CBP has instituted to assess the competency of an individual to be eligible, according to the immigration judge today, it has failed.”

DHS officials, CBP officials and Department of Justice officials did respond to a request for comment.

Simpson decided to do his own evaluation of the man’s mental state under an immigration court precedent known as the Matter of MAM.

He listed the rights that the man has, such as the right to present evidence and the right to question witnesses. He asked if the man understood his rights.

“Um, yes. I need more,” said the man through a Spanish interpreter. “I need more because here I only have some letters, some birth certificates. They’re not translated into English yet.”

“Sir, I’m the immigration judge in your case. It’s my job to decide whether you can stay in the United States,” Simpson said. “In your own words, tell me who am I and what’s my job.”

“I cannot understand you,” the man responded.

In the end, the man was only able to appropriately respond to simple questions such as the date and what city he was in. He told the judge he had not had much schooling and couldn’t read or write.

ICE later confirmed the man is pending transfer to the agency’s custody. He could be taken to an immigration detention facility or released “on parole” into the U.S. to a sponsor while he waits for his next hearing.

Simpson said that depending which option the government chooses, other safeguards may be necessary, including providing an attorney for him if he’s detained.

Every day the human carnage mounts as the 9th Circuit continues to “sponsor” Trump’s illegal, deadly, and unconstitutional “Remain in Mexico Program.” Interesting how a few non-life-tenured Immigration Judges in San Diego and one courageous U.S. District Judge in the Southern District of California seem to be the only Federal officials interested in either the rule of law or the Due Process Clause of our Constitution. Go figure! 

Congrats to Judge Scott Simpson for standing up for the rule of law and the rights of the most vulnerable in the face of massive dereliction of duty by those higher up the line.

Sadly, unlike the 9th Circuit, Judge Simpson lacks authority to enjoin further violations of the law and human rights by the Trump Administration. How many more human beings will suffer, be wronged, and perhaps die as a result of the 9th Circuit’s complicity in scofflaw behavior having little or nothing to do with protecting our borders or any other legitimate policy end and everything to do with punishing and dehumanizing those who seek justice under our laws.?

ANALYSIS:  Trump Lays Another Egg On Immigration — Everybody Loses, But It Could Have Been Much, Much Worse

Alexandria, VA, June 9, 2019.  After a week of petulance, threats, and self-created drama, Trump produced a resounding trade and immigration dud. Faced with advisors telling him that he was endangering the economy, the only thing propping up his sagging popularity, a potential rebellion among GOP legislators, and an unexpectedly tough and resolute Mexico, Trump backed off of his insane and blatantly illegal plan to ignore U.S. asylum obligations and thereby rocket the U.S. to the upper echelons of international scofflaws and human rights violators. 

The latter scheme, known as “safe third country,” would have mis-designated Mexico and, incredibly, Guatemala, two clearly “unsafe” countries to do the U.S.’s job by processing tens of thousands of asylum applications from those fleeing the Northern Triangle. Neither of the two countries has a viable, fair, and effective asylum adjudication system and both have major safety and human rights issues.

Instead, Trump accepted a vague compact by which Mexico and the U.S. basically agreed to do what they had already been doing without taking any decisive or effective action to address the actual humanitarian crisis in the Northern Triangle that Trump and his flunkies have consistently mischaracterized as a “law enforcement emergency.” Indeed, the New York Times reported that most of Mexico’s “unprecedented steps” had already been worked out in secret with deposed DHS Secretary Kirstjen Nielsen months ago. https://www.nytimes.com/2019/06/08/us/politics/trump-mexico-deal-tariffs.html. To be sure, desperate and vulnerable asylum seekers, particularly women and children, will continue to abused, raped, beaten, extorted, obscenely tortured, and killed with impunity and little if any recourse as a result of this week’s actions. But, at least for now, the U.S. and Mexico are maintaining much of the basic framework of domestic and international protection laws. 

Contrary to the lies and false narratives spread by Trump and his DHS cronies, U.S. law is not filled with “loopholes.” Rather, it is a fairly straightforward implementation of the international protection regime and treaties that have been in effect since World War II to prevent another holocaust from occurring on our watch. 

If anything, since the enactment of the Refugee Act of 1980, the U.S. has watered down its asylum commitment somewhat by adding a legally tenuous “credible fear” process to “pre-screen” arriving asylum applicants in mass migration situations. However, to date, the DHS under Trump has been too incompetent, misdirected, and frankly downright stupid to utilize this streamlined screening process fairly and efficiently. 

By treating a somewhat predictable humanitarian refugee flow as a bogus “law enforcement problem” and mindlessly shoving cases into a “captive” court system that they already had abused, mismanaged, and destroyed, the Administration lost effective control. In panic, they have tried to blame the refugees, Democrats, Mexico, Obama, judges, the media, and even the truly hapless failed states of the Northern Triangle for their largely self-created human and operational disaster.

The first of the “unprecedented steps,” involves Mexico sending approximately 6,000 National Guard troops to the Guatemalan border to control illegal crossings. Never mind that the Mexican National Guard is a recent creation that exists largely on paper. Also, forget that Mexico has a questionable record of controlling corruption and systematic human rights abuses among its existing police and military forces.

The U.S., a much larger, better organized, and more prosperous country than Mexico, has resorted to militarizing the border, mass incarceration, family concentration camps, kids in cages, malicious criminal prosecutions, family separations, walls, fences, overt political interference in the asylum adjudication system, and violating international protection norms. These “gonzo” enforcement efforts not only failed to stem the tide, but have actually aided smugglers and traffickers and increased the flow of migrants. 

Will newly minted, untrained Mexican troops succeed where the might of the U.S. has failed miserably? Don’t count on it. 

Also, the last time I checked, it appeared that most of the Mexican coast and some parts of the U.S. are reasonably accessible by boat from the Northern Triangle. So, assuming that the Mexicans could “shut down” their land border with Guatemala, why wouldn’t smugglers “take to the sea?” How’s that Mexican Navy?

The second “unprecedented step,” is a continuation and expansion of the existing “Remain in Mexico Program.” This toxic gimmick punishes those who have been legally determined to have a “credible fear” of persecution by making them remain in some of the most dangerous locations in the world where they are intentionally and illegally impeded in many ways from pursuing their U.S. asylum claims from Mexico. To date, this program has only been implemented in a few locations, like San Diego where it has been an unmitigated failure according to a report from Kate Morrissey of the San Diego Union-Tribune. https://immigrationcourtside.com/2019/06/06/cruel-yet-really-stupid-trumps-remain-in-mexico-policy-denies-due-process-while-creating-court-chaos-enfeebled-judges-fume-as-aimless-docket-reshufflin/.

The results of this ill-advised effort by Trump to circumvent U.S. asylum laws reads like a “legal toxicology report:” “Aimless Docket Reshuffling,” mass confusion, lack of information, insufficient and deficient hearing notices, massive violations of the statutory right to be represented by counsel, no opportunity to fairly prepare, document, and present asylum claims, interference with the attorney-client relationship by DHS, and few actual case completions to name just a few of the many abuses. And, how will an already dysfunctional EOIR deal with yet another round of “new priorities” and more “Aimless Docket Reshuffling?”

A Federal District Judge actually enjoined this circus before it could get rolling. But, a “tone-deaf panel” of the Ninth Circuit allowed Trump’s assault on the rule of law to go forward, at least for now. 

Nevertheless, the case remains pending with the Ninth Circuit. As EOIR’s rushed and sloppy work product starts to accumulate on their docket and the bodies and horror stories start to pile up in Mexico, more responsible Circuit Judges might actually force the Administration to comply with the law and the Constitution, not to mention simple human decency.

Mexico has pledged to “accept and protect” those sentenced to remain there. But, the Mexican border locations to which individuals are forced to return are dangerous for a reason. Presumably, if Mexican can’t maintain safety and order for its own citizens, it won’t do any better for vulnerable asylum seekers.

Finally, in third “unprecedented step,” Mexico and the U.S. agreed to promote the “Comprehensive Development Plan launched by the government of Mexico in concert with the governments of El Salvador, Guatemala and Honduras” to create “prosperity, good governance and security in Central America.” This part of the agreement makes the most sense. But “promoting” in this case appears limited to using development funds that were “already in the pipeline” in both countries. In other words, nothing really new here.

This was a golden opportunity for the U.S. to show real leadership by dramatically increasing its investment in bringing stability and prosperity to Mexico and Central America. Additionally, we could have created incentives (rather than threats) and benchmarks for Mexico to improve its asylum adjudication system and human rights performance. Partnering with non-governmental-organizations and legal assistance groups on both sides of the border also would bring much needed expertise in resolving asylum issues to the table.

But, that would have taken a President with vision, empathy, compassion, courage, competency, intelligence, and creative problem solving ability. Trump is the exact antithesis of all of these qualities.

Consequently, sooner or later we can expect Trump’s “latest egg” to fail, like all of his other gimmicks and maliciously incompetent schemes on immigration. Our “child president” will undoubtedly then embark on a new barrage of lies, false narratives, idiotic tweets, idle threats, blame shifting, insults, racist dog whistles, and general nonsense aimed at diverting attention from his own failures as a leader and more critically, as a human being.

Innocent people will be harmed and die, America and Mexico will be embarrassed and diminished, and the world will be a worse place. But, until America figures out how to use its democratic institutions to remove the kakistocracy, the disaster will continue. That it could have been worse, is only small consolation.

Why not strive to be  the “best that we can be,” rather than just “not as bad as we might have been?”
