As I always say: “Better Judges for a better America!” This a step forward, although we still have a long way to go to repair the extensive damage inflicted on the Federal Judiciary by Trump & McConnell.

Moreover, as I will discuss below, one of America’s most important (and readily “improvable”) judiciaries, one completely controlled by the Biden Administration, the U.S. Immigration Court, has actually taken steps backward in terms of progressive appointments under Garland. It’s like a new coach taking over in the 4th quarter of a game his team is losing 48-7 and saying “OK, let’s spot them another 17 points before we start playing to win!” Incredible, yet, sadly, true!

As the latest census shows an increasingly diverse America, the Article III Federal Judiciary remains an embarrassing backwater of “non-diversity.” This was intentionally aggravated by Trump & McConnell who, as noted above, elevated primarily White ultra right wing men, many with thin or questionable qualifications, to the Federal Bench!

As stated above:

It is crucial that the more than 1.1 million immigrants and nearly 1 million Latinx people in Washington feel that they are represented on the courts by people who share their experiences and identities.

Evidently, AG Merrick Garland and his team @ DOJ haven’t gotten that message. So far, Garland’s appointments to the Immigration Court, and the composition of his BIA, look more like Stephen Miller’s, Billy Barr’s, and Jeff “Gonzo Apocalypto” Sessions’s “skewed whitewashed vision” of America than they do the real America. That’s particularly true when you consider the American communities whose lives and futures are existentially affected (primarily adversely) by substandard and biased EOIR decisions that continue to be cranked out under Garland. This is despite a few moves by Garland to “kill off” the most horrible of the many bad precedents cranked out by the AG and the BIA during the Trump regime.

Judge Estrada sounds like just the type of individual that Garland should be appointing to the U.S. Immigration Court and the BIA. Compare Judge Estrada’s experience, qualifications, and “real life” background and human engagement with the lackluster profiles of Immigration Judges recently appointed by Garland and with many of those appointed to the Immigration Court and the BIA over the past two decades.

There are plenty of diverse, extraordinarily talented, courageous, practical experts out there in the NDPA to reform and improve the EOIR Judiciary at all levels! Many haven’t applied in the past (or have had their applicants rejected in favor of lesser-qualified candidates) because of the White Nationalist, xenophobic, nativist tone set by Sessions and Barr. Indeed, I spoke over the weekend to one of the leading progressive immigration/human rights experts in America who felt that way. Obviously, I encouraged that “NDPA superstar” to submit the applications — not just for EOIR but also for the Article III Judiciary which also needs to get its act together on human rights, immigration, and racial justice.

Garland & team need to reform and improve the selection criteria, involve outside expert input, and then actively recruit the “best and the brightest” from the NDPA to remake and elevate the Immigration Judiciary! As I have mentioned before, my colleagues in the Round Table and I have done more outreach, cajoling, inspiring, and recruiting among the progressive immigration and human rights community to apply for EOIR jobs than have those at DOJ and elsewhere in the Administration whose job it should be to do just that! It’s ridiculous, and it’s wrong!

No wonder things continue to be an ungodly mess at EOIR despite mountains of blueprints, action plans, and other readily achievable reform recommendations and proposed improvements produced by practical experts in the immigration/human rights/racial justice community! The Immigration Judiciary cries out for diverse, progressive, talented, practical scholar “role models” drawn from the NDPA! 

Lucas Guttentag, are you listening somewhere out there? Don’t get co-opted by the DOJ bureaucracy that overall failed to stand up to Trump and his gang of insurrectionists! Don’t let the new leadership at DOJ “de-prioritize or back burner” essential, long overdue, achievable EOIR reforms! Expose “Obamathink revolution by evolution” as the ridiculous and dangerous nonsense that it is (and always was)! Fight for your ideals, speak out, and shake up this disastrously broken and unfair system with the progressive change we need! At this point in your distinguished career, what do you have to lose? Those who consciously chose “not to rock the boat” at EOIR in the past, when human lives, due process, and human dignity were at stake, now share in the responsibility for its sinking!

Court Orders Release of ICE Prisoner: Pimentel-Estrada v. Barr

“Today U.S. District Court Judge Richard Martinez ordered the federal government to release an immigrant detained at the Northwest Detention Center (NWDC), AKA Northwest ICE Processing Center (NWIPC), who is at high risk of serious illness or death if he contracts COVID-19. The Court ordered the release of Mr. Pimentel, a 65-year old man who has been a lawful permanent resident in the United States since 1996, but was placed in removal proceedings after pleading guilty to a drug offense. After completing his sentence, Mr. Pimentel returned to live with his family in Salt Lake City, Utah, but was subsequently arrested by ICE in May of 2019 after he appeared for an appointment. ICE ultimately transferred Mr. Pimentel to the detention center in Tacoma, Washington.

Judge Martinez found that federal immigration authorities “detain Petitioner at the NWIPC in conditions that create a substantial risk he will be exposed to the coronavirus and contract COVID-19.”

Judge Martinez relied on declarations from public health experts stating that once COVID-19 reaches the detention center it will spread like “wildfire.” The Court noted that experts have attributed a mortality rate as high as 15% for high risk individuals who contract COVID-19. Judge Martinez ultimately concluded that “Petitioner has made a clear showing that he faces a substantial risk of serious harm due to the conditions of his present confinement and the fact that he is at higher risk for serious illness or death from COVID-19.”

Judge Martinez ordered that Mr. Pimentel be immediately released. He will now be permitted to return to live with his son and daughter-in-law in Salt Lake City while he waits for his immigration case to be completed.

Wonder how many more “Mr. Pimentels” are out there in the Gulag but in the wrong jurisdiction or without the good fortune to get the legal representation necessary to secure release?

What if we had a functional, impartial, expert U.S. Immigration Court that could order release of folks like this without protracted litigation in the U.S. District Courts? Indeed, what’s the purpose of a so-called “court system” that’s incapable of doing much of anything except “rubber stamping” the unconstitutional actions and extraordinarily poor judgments of DHS officials and their contractors?

A Seattle federal judge ruled Tuesday that asylum-seeking migrants detained for being in the U.S. illegally have the right to a bond hearing in immigration court rather than being held until their cases are complete.

U.S. District Judge Marsha Pechman said it is unconstitutional to indefinitely detain migrants who fled to the U.S. seeking asylum protections.

The decision reverses an April directivefrom Attorney General William Barr ordering immigration judges not to release migrants on bail after an applicant successfully establishes “a credible fear of persecution or torture” in the home country — a policy that has been in place since 2005.

“The court finds that plaintiffs have established a constitutionally-protected interest in their liberty, a right to due process, which includes a hearing before a neutral decision maker to assess the necessity of their detention and a likelihood of success on the merits of that issue,” Pechman wrote.

In her ruling, Pechman also took issue with an aspect of Barr’s policy that left open the possibility that migrants, still awaiting a hearing, could be re-detained by ICE after being released on bond.

“The Government’s unwillingness to unconditionally assert that Plaintiffs will not be re-detained means that the specter of re-detention looms and these Plaintiffs and many members of their class face the real and imminent threat of bondless and indefinite detention …,” she said.

The ruling comes amid a widespread shortage of immigration judges that has caused massive delays in processing hearings. The most recent dataavailable from The Transactional Records Access Clearinghouse shows a total of 424 judges nationwide face a backlog of 892,517 cases on the courts’ active dockets as of the end of April.

“The three largest immigration courts were so under-resourced that hearing dates were being scheduled as far out as August 2023 in New York City, October 2022 in Los Angeles, and April 2022 in San Francisco,” TRAC reports

Pechman also modified a preliminary injunction issued earlier this year. The new injunction requires the government to ensure bond hearings are held within seven days after they are requested by eligible asylum-seekers. If the government exceeds that limit, the undocumented immigrant must be released.

Immigrant rights advocates, including the American Civil Liberties Union and the Northwest Immigrant Rights Project, sued to block the policy, which was set to take effect this month.

In a statement, Matt Adams, legal director of Northwest Immigrant Rights Project, said: “The court reaffirmed what has been settled for decades: that asylum seekers who enter this country have a right to be free from arbitrary detention.”

Michael Tan, senior staff attorney for the ACLU’s Immigrants’ Rights Project, added: “Try as it may, the administration cannot circumvent the Constitution in its effort to deter and punish asylum-seekers applying for protection.”

The Department of Justice is expected to appeal the ruling quickly.

So, while the 9thCircuit is bopping along violating human rights by enabling Trump’s absurdly illegal “Kill ‘Em in Mexico Program,” as a result of a three-judge panel who tanked on their oaths of office, Judge Pechman and some others at the “retail level” of the Federal Judiciary are still on the job and upholding our Constitution against the all-out assault led by Barr on behalf of Trump.

 

It’s also worth remembering that the U.S. Attorney General is supposed to uphold the Constitution and protect individual rights, rather than serving as tool of racist White Nationalist extremism as Sessions and Barr have done. Already in shambles and a disgraceful ethical morass, there won’t be anything left of the “Justice” Department by the time Barr’s toxic tenure ends.

 

Bill Barr is a national disgrace and an affront to American justice. But, hey, it’s the Trump Adminisration, so what else is new?
