Dear Judge/President Tabbador:
I’m curious. NAIJ represents immigration judges nationwide, all of whom are subordinate employees of the DOJ–akin to another group of subordinates (soldiers in the military) and their employer (the DOD). I ask why should immigration judges who also take an oath to “preserve, protect, and defend the [Federal] Constitution against all enemies, foreign and domestic” (as do soldiers in the military) be excused from the natural adverse consequences for obeying orders from the AG that are inherently counter to the oath they took to preserve, protect and defend the Constitution…..? I am old enough to recall that a Lieutenant (William Calley) was convicted for murdering an entire Vietnamese small town in the 1970s and that his defense at trial that he was merely following orders from Captain Medina did not succeed! Don’t get me wrong. I understand the obvious distinctions between your group of subordinates and those of Lieutenant Calley; between the DOJ and the DOD, between the AG and Captain Medina, but in the end, I am curious, both subordinates took the same oath to uphold the Federal Constitution, therefore, under these circumstances–wouldn’t it be more effective for all NAIJ members to refuse to take the AG’s orders at whatever personal or professional cost to your members?

Below is an example from my earlier post of yesterday (excluding the lyrics)–

A real Hero. Navy Capt. Brett E. Crozier was fired from the Navy because he rebelled against the US Navy in his effort to save the lives of 114 sailors that could/would fall fatal victims of the COVID19. He faced a dilemma though because these COVID infected 114 sailors were rapidly expanding the risks of all sailors at the Theodore Roosevelt. Captain Crozier had to make a choice: do I stay compliant with my superiors to keep this problem under-raps and risk the sailors’ lives? (may be like Lieutenant Calley’s dilemma?) or, do I go public and bring attention and a solution to this problem from the outside?
“Ahhh. This is an easy choice! I will not let my lifelong love to remain the Captain of this great destroyer at the expense of [what would become anyway] a rapid sinking ship if some or many of the sailors begin to die from this sickness.” (Quotations are fictitious, made up; they don’t exist!)
A difficult walk to walk for the skipper.
But the TR’s sailors and most of US are glad he walked it.
I am not sure that one can equate his heroism with (the aspirations of) the 5th amend., but for sure–Capt. Crozier swore to defend the four corners of the September 17, 1787 writing in Philly just the same as every NAIJ member took the same oath. Leaders like Captain Crozier are easy to admire because in difficult times, they walked the right walk.
(*) Just an odd way to add one more to the list of good men and women that have fallen victim of the Greatest Administration Ever since 1776.

A sad note.
A continued mounting tragedy unfolding before his family and his befriending sailors–RealHero Captain Crozier–is now diagnosed with COVID-19.
Because of the stuff that you are made of Sir, you’l be well soon.
