Roughly 1.6 million people are caught up in an ever-expanding backlog in United States immigration court, according to new data tracking cases through December 2021. Those with open immigration cases must now wait for a decision determining their legal status for an average of 58 months—nearly five years.

Though the immigration court backlog has been getting longer for more than a decade, a deluge of new cases added between October and December 2021 significantly worsened wait times, according to the Transactional Records Access Clearinghouse (TRAC), a research institution at Syracuse University that obtained the figures through Freedom of Information Act requests. The backlog increased by nearly 140,000 during that period, the fastest growth on record and the direct result of an uptick in arrests by agencies housed under the Department of Homeland Security (DHS): Immigration and Customs Enforcement (ICE), and Customs and Border Protection (CBP).

1.6 million is just the “trip of the iceberg.” Each of those human beings potentially has family, friends, co-workers, teachers, fellow students, relatives, employers, employees, neighbors, sponsors, fellow parishioners, students, investors, etc. tied up in the trauma of their wait and the often arbitrary and capricious results once they get a final hearing. Virtually every community in America has a stake in Garland’s tragically broken “court” system.

Just applying TRAC’s math from recent studies, even in a time of inculturated anti-immigrant, anti-asylum bias and bad, skewed interpretations at EOIR, more than half of those in backlog would earn the right to stay  in America if they could get an individual hearting. But, in Garland’s broken and mis-prioritized system, “getting a merits hearing” is a “big if.” Many of those in the backlog are already doing “essential work” or have the job skills we need if their only be normalized. Garland’s failure is America’s trauma, and wasted human capital, and squandered Government resources.

 

A few other “lowlights:”

  • “Fewer than 1% of those new cases brought by ICE and CBP beginning in October 2021 involved alleged criminal activity.” So much for “new priorities.”
  • “A spokesperson for the Department of Justice’s Executive Office of Immigration Review (EOIR), which oversees the immigration court system, said courts have been relying on technology to continue operations, but blamed the on-going pandemic for the worsening backlog.” An absurdist “cop-out,” as those familiar with EOIR’s chronically bad technology and failure to adequately prepare and deal with COVID know. Poor and imperious communication with the public has also been a feature of EOIR (mis)management during the pandemic!
  • “One reason is an ever-increasing number of new immigration cases swamping the system, as both the Obama and Trump Administrations issued millions of deportation orders.” Truth is that despite DHS and EOIR attempts to shift blame to the victims, the backlog is largely self-created.
  • “But the problem cannot be solved by asking the existing immigration judges to work harder or faster, Long says.” Nor, with due respect to TRAC’s Susan Long, will it be solved by throwing more judges and resources into a biased, unfair, totally dysfunctional, anti-due-process, broken system. Fix the system first with common-sense progressive reforms, replace bad judges, hire new judges on a merit basis, with outside expert input, focusing on hiring judges with records of commitment to due process and fundamental fairness and established immigration/human rights expertise! Then, once fairness, expertise, quality, and efficiency have been established and institutionalized, decide whether the system should be expanded and, if so, how to do it. (Hint: Many experts believe that 500 completions annually is the most reasonable expectation for well-functioning, expert Immigration Judges complying with due process and “best practices.” That means the current system of approximately 560 IJ’s has a maximum capacity of 250,000 to 300,000 completions annually. DHS Enforcement must be required to work within those realistic limits in bringing new cases before the court.)
  • “While the dedicated docket was designed to address the backlog for recently-arrived families, it failed to take into account the staggering systemic failures at work, according to immigration lawyers, advocacy organizations and elected officials.” It was a “proven failure enforcement gimmick” as experts told Garland from the “git go.” A competent AG committed to due process, fundamental fairness, and the rule of law would have rejected this bad idea out of hand.
  • “There’s a long, long laundry list of things that have been tried in the past,” Long says. “It’s not going to be a quick fix.” I respectfully dissent! This isn’t rocket science! It’s a combination of cleaning out the deadwood, bringing in competence and progressive expertise in judging and administration, common sense, long overdue progressive reforms, creative thinking, appointing a BIA of expert appellate judges to issue sound legal precedents, require best practices, and hold judges, DOJ officials, and DHS personnel accountable for their often intentional undermining of justice in Immigration Court. As alluded to by Long, Garland had the incredible advantage of a laundry list of “enforcement and just pedal faster gimmicks” that are proven failures! Garland knew in advance what NOT to do and what NOT to try. He also had access to an impressive array of practical scholarship and that produced sound, straightforward recommendations on how to fix the system. He had a golden opportunity to shake up the system on “Day One,” “clean house,” and bring in the new progressive experts and dynamic leaders to fix the system. Yes, I recognize that as Long suggests, the system won’t be fixed “overnight.” But, had Garland acted promptly and timely, the system could already be showing dramatic improvements on all levels. You have to start the process of reform and improvement somewhere. Garland’s dilatory approach to EOIR has greatly increased the difficulty. But, fixing EOIR is still “low hanging fruit” for the Administration if they only had the backbone and vision to “blow up” the current failed and flailing EOIR  and bring in and empower experts to start taking names, kicking tail, and implementing due process and best practices reforms.
  • Garland apparently has operated on the false premise that fixing “Immigration Courts” isn’t a priority and that advice and assistance of progressive experts can just be “blown off” in favor of the type of politically-driven, bogus-enforcement-oriented, bureaucratic nonsense that is endemic at DOJ and DHS. Not happening! And continued aggressive litigation by the NDPA is an essential element of stopping the injustice and holding Garland and his flunkies accountable. That litigation is not going to stop either unless, and until, one way or another, Garland is forced to take notice and make the obvious progressive reforms and improvements.

Garland’s management “style” and unwillingness to bring in the progressive experts necessary to radically reform EOIR has become a huge part of the problem, propelling an already broken system to new heights of dysfunction, disorder, and injustice!

I’m no fan of Virginia’s new GOP neo-fascist Attorney General Jason Miyares. But, before the end of Inauguration Day, the heads were rolling, and his message was very clear: liberalism, environmental protection, racial justice, good government, and public health are out — far-right neo-fascism is in!  Get  with the program or get out! Republicans loved it, Dems hated it. But it happened!

By sharp contrast, Garland is still running EOIR with much of the same personnel and many of the same broken and bad policies of his predecessors, Trump, and Stephen Miller. That’s a good illustration of why “Democrats can’t govern” while Republicans constantly outflank them and dismantle the system in short order. What’s the future of a party that doesn’t recognize its own self-interest, the common good, and act and govern accordingly?

The Need For Full-Fledged Asylum Hearings

It has been said that Immigration Judges hear death penalty cases under traffic court conditions.1  The death penalty cases are of course asylum claims, which, if wrongly denied, can result in the applicant being returned to their death.

The Biden Administration recently published proposed regulations seeking to revise the system for hearing the asylum claims of those arriving at the southern border.  Any positives envisioned in the proposal are greatly outweighed by the damage the rules will do to the right to immigration court review.  If enacted as drafted, traffic court conditions would be far preferable to the meager access to review that would remain for many asylum seekers.

To provide some context: presently, arriving asylum seekers who after screening by USCIS asylum officers are found to have established a sufficient risk of harm proceed directly to Immigration Court, where they have a full hearing on their claim before an Immigration Judge.  In those proceedings, asylum seekers may freely submit  documents, call witnesses, and elicit testimony.

This was as Congress intended it.   In creating the present credible fear screening system in 1996, Congress made clear that those passing the screening, in the words of then Senator Alan Simpson (R-WY), “will be provided a full – full – asylum hearing.”2  This sentiment was echoed by Senator Patrick Leahy (D-VT), who stated that those who establish credible fear “get a full hearing without any question,”3 and Rep. Lamar Smith (R-TX), who emphasized that those with a credible fear of persecution “can go through the normal process of establishing their claim.”4

Under the proposal, those who pass the preliminary screening (known as a credible fear interview) will instead have their full asylum claim heard by an asylum officer.  This could be a positive development if the rules continued to assure the right to a full court proceeding to those not granted at this initial stage.

Unfortunately, the proposed rules would reduce Immigration Judges to reviewers of transcripts of the asylum office interviews.   Additional evidence (including testimony)  that was not provided at the Asylum Office will only be allowed if deemed to be “non-duplicative” and necessary to complete the record.  If an Immigration Judge determines that the applicant (who may not have been represented by a lawyer) provided sufficient evidence to the asylum officer, the claim may be decided entirely on the record from that initial non-court interview.

It bears noting that the Immigration Judges making these determinations remain subject to the completion quotas imposed under the prior administration.  While Immigration Judges must be guided by the requirements of due process and fairness in making such decisions, it would be remiss not to point out that for newly hired judges still on probation, the ability to exclude new evidence and essentially rubber stamp the asylum officer’s decision offers the prospect of a very quick completion for quota purposes.  Judges should not be put in the position of choosing between the dictates of justice and their own job security.

As the drafters of the proposed rules are well aware, Immigration Judges have long decided cases that were first heard by Asylum Officers.  The outcomes of those cases offer strong reason to question the logic of what is now being proposed.  EOIR’s Statistical Yearbook for 2016 (the last year such stats were made available) shows that 83% of cases referred by asylum officers were granted asylum that year by Immigration Judges conducting de novo hearings.5

Having heard referred cases as an Immigration Judge, as well as having represented asylum applicants at the Asylum Office, I have no doubt that the right to a full de novo court hearing, in which attorneys are free to offer documents, briefs, and present testimony as they see fit, is the reason for that large disparity.  The current system itself recognizes this; it is why Asylum Officers are limited to granting clearly meritorious cases, and must refer the rest to courts better equipped to delve into the intricacies of a highly complex field of law.  Immigration Judges also enjoy greater decisional independence than asylum officers, who require supervisory approval of their decisions,6 are more susceptible to political pressure, and are more limited in the legal theories they may rely on.

As to the criteria for supplementing the record, whether evidence is duplicative or necessary is a fuzzy concept.  For example, the law accords  greater deference to government sources, such as State Department reports, and at times, Immigration Judges may find other evidence deserving of “little evidentiary weight.”  Thus, sometimes duplicative evidence is necessary to persuade a judge who may otherwise not be sufficiently swayed by a single report.  But that need might not become apparent until the hearing is concluded, whereas decisions to exclude additional testimony and documentary evidence are made much earlier, at the outset of the proceeding.

There are constitutional considerations as well.  In a 2013 decision, Oshodi v. Holder, the U.S. Court of Appeals for the Ninth Circuit held that limiting an asylum seeker’s testimony to events that were not duplicative of the written application, on the belief that the written record would suffice for deciding veracity, was a violation of the asylum seeker’s due process rights.  Yet the proposed regulations seek to codify what according to Oshodi the Constitution specifically forbids.  The court in Oshodi stated that “the importance of live testimony to a credibility determination is well-recognized and longstanding.”  Having heard live testimony as a judge, I can vouch for this.  I decided many cases in which an in person demeanor observation was instrumental to my credibility finding.

I will also state from experience that critical “Eureka” moments arise unexpectedly in the course of hearing testimony.  A question from counsel, or sometimes from the judge, will elicit an answer that unexpectedly gives rise to a new line of questioning, or even a legal theory of the case.  An example is found in last year’s Second Circuit decision in Hernandez-Chacon v. Barr.  In that case, the Second Circuit found that a woman’s act of resisting rape by an MS-13 gang member could constitute a political opinion based on one sentence not contained in the written application, and uttered for the first time at the immigration court hearing: when asked why she resisted, the petitioner responded: “Because I had every right to.”  From that single sentence, the Second Circuit  found that the resistance transcended mere self-protection and took on a political dimension.  Under the proposed rules, the attorney would likely never have been able to ask the question that elicited the critical answer.  At asylum office interviews, attorneys are relegated to sitting in the corner and quietly taking notes.  Furthermore, I have been told by former asylum officers that the concept of imputed political opinion was not available to them as a basis for granting asylum, a fact that pretty much guarantees it will not be covered in an asylum office interview.

The proposed limitations on Immigration Judge review are not necessary to increase efficiency.  Whatever cases asylum officers grant pursuant to their new up front review will significantly reduce the Immigration Court case load.  And even an imperfect transcript from those interviews in claims referred to the court will provide attorneys for both sides the opportunity for advance conferencing to narrow down the issues in dispute, a practice which significantly reduces hearing times and which should be greatly encouraged.

According to the website of the New York State Department of Motor Vehicles, at a traffic court hearing, “you or your attorney may ask the officer questions. You may testify, bring witnesses or present evidence on your behalf.”7  The Biden Administration cannot provide less rights than these to those facing the life and death consequences inherent in asylum claims.

Those interested may submit their comments on the new regs by October 19.

Like many of our colleagues, I granted the majority of “referred” asylum cases, most without ICE appeal. It wasn’t that the Asylum Office did a bad job. The records were often poor or incomplete (as too many individuals attempted to represent themselves at the AO). With the additional information and elucidation from counsel provided at a full hearing, the merits of the case came into focus.  

There were a few cases where the parties stipulated to the record before the AO, and just asked me for a legal ruling. This procedure would be available in appropriate cases, without any regulations changes, and should be encouraged for the parties, particularly ICE. Obviously, the key is that both parties must agree that the record before the AO was adequate. 

Additionally, at the time, the AO could not grant withholding or CAT, so an inordinate number of one-year filling denial cases were in the referrals. As Jeffrey suggests, this could be fixed without eliminating the right to a full hearing upon referral. 

Also, as I have said many times, instituting a new system that reduces the right to a full hearing, without first making badly needed major structural, personnel, training, and leadership changes at both the AO and EOIR is simply insane and another serious breach of trust by the Biden Administration!

Biden picks California Attorney General Xavier Becerra to be Secretary of Health and Human Services

Noam N. Levey, Eyan Halper,  and Patrick McGreevy for the Los Angeles Times  reported that President-elect Joe Biden has tapped California Attorney General  Xavier Becerra to be Health and Human Services secretary, which would make him the first Latino to hold the office. According to the story, Becerra “has become one of the most important defenders of the Affordable Care Act, leading the fight to preserve the landmark law against efforts by the Trump administration and conservative states to persuade federal courts to repeal it. . . . And he has become a leading champion of reproductive health, going to court repeatedly to challenge Trump administration efforts to scale back women’s access to abortion services and contraceptive coverage.”

Becerra’s mother was born in Jalisco, Mexico and immigrated to the United States after marrying his father, who was born in Sacramento and raised in Tijuana.  Becerra’s father started out picking vegetables. “He got treated like he wasn’t a citizen,” Becerra recalled in 2017. “He couldn’t walk into restaurants because the sign said ‘No dogs or Mexicans allowed.’”

Elected to the House in 1992, he rose through the ranks to become the highest-ranking Latino in Congress at the time.

As Attorney General, Becerra has filed 100 challenges to Trump administration policies, including many immigration and immigrant-related ones such as the rescission of the Deferred Action for Childhood Arrivals, efforts to defund sanctuary cities, addition of a U.S. citizenship question to Census 2020, and more.  Just last week Becerra won a challenge to President Trump’s public charge rule in the Ninth Circuit.

I personally would have preferred Becerra as Attorney General. The totally dysfunctional and demoralized DOJ, where “Justice” has been eradicated from the mission, urgently needs a progressive Hispanic leader. Someone who fully understands the overt racism of the nativist immigration policies implemented by Sessions and Barr and how they are connected to the regime’s larger White Nationalist agenda of denying equal justice under law to all persons of color in the U.S. Someone who will make cleaning up the “EOIR Clown Show” 🤡 the top priority!

Nevertheless, there is no denying the overriding importance of public health at the present moment. And, although he isn’t a medical professional, Becerra is a good administrator who understands the intimate connection between public health failures and racism in America. It’s no accident that the African American,Latino, and lower income communities have been disproportionately harmed by the regime’s criminally incompetent and malicious response to the COVID crisis.🤮☠️⚰️ 

Public health is just another aspect of social justice. And, social justice has been in abject failure in the Federal System for the past four years!

Historical Footnote: Ah, Dec. 7, Pearl Harbor Day,! 

That reminds me of yet another “Great Moment in EOIR History,” even before the “advent of the kakistocracy.” When the Arlington Immigration Court was also assigned to the Cleveland, Ohio Televideo docket, we filled all of the then-available hearing dates on our calendars. Our request to “HQ” in Falls Church to “open” the next year for scheduling was denied, apparently on the ground that it would make the docket charts look bad by being yet another year “out.” 

So, we were advised by our Court Administrator to schedule all hearings for December 7, of the last “open” year until further notice. It didn’t take long for the Ohio Bar and the Assistant Chief Counsel to recognize that on any given Master Calendar thereafter, every hearing date assigned was Dec. 7, of the same year. As I used to tell them: “Hey, I’m just an Immigration Judge. I only work here, I’m not in charge of anything.” 

Of course, hundreds of cases eventually had to be rescheduled to real dates! “Aimless Docket Reshuffling” at its best!

Ironically, today’s Immigration Judges are even more feckless and powerless to manage the system than we were many years ago. Yet that didn’t stop the “GOP fraudsters” on the FLRA from illegally and dishonestly declaring them to be “management officials.” Talk about kakistocracy!

Management officials, my foot! I doubt today’s Immigration “Judges” can even schedule bathroom breaks without asking permission from the Falls Church Clown Show!🤡

Later Friday, the United States recorded more than 40,000 new coronavirus cases — its largest one-day total.

It was the latest example of whiplash from the Trump administration, which has struggled to put forward a consistent message about the pandemic. While public health experts urge caution and preventive measures such as mask-wearing and social distancing, Trump, Pence and other top aides repeatedly flout their advice, leaving confused Americans struggling to determine who to believe.

“They’re creating a cognitive dissonance in the country,” one former senior administration official said. “It’s more than them being asleep at the wheel. They’re confusing people at this point when we need to be united.”

This portrait of a nation in crisis — and its failure to contain an epic pandemic — is based on interviews with 47 administration officials, lawmakers at the national and state level, congressional staff, federal and local health officials, public health experts and other current and former officials involved in the bungled and confused response.

America’s position as the world’s leader in coronavirus cases and deaths is in large part the result of human error, and the still-rising caseload stands as a stark reminder of the blunders that have characterized the national response. Trump’s actions, and his position in the Oval Office, make him a central figure in any assessment of the country’s handling of the outbreak.

As local officials struggled to enforce stay-at-home orders and other restrictions, the virus continued to circulate throughout a country riven by partisan politics and devoid of a national public health strategy, said Max Skidmore, a political scientist at the University of Missouri at Kansas City and author of a book on presidential leadership during health crises.

“We’re the only country in the world that has politicized the approach to a pandemic,” he said.

Now, covid-19, the disease caused by the coronavirus, is advancing at an accelerated pace in the United States, even as other countries reopen their economies after getting their outbreaks under control. European diplomats are poised to approve an agreement that will reopen the European Union to travel from many countries but not American tourists, because the coronavirus is still raging in the United States.

In contrast, states from Arizona to Florida are pausing or reversing their attempts to reopen their economies.

The new peak in cases — coming so quickly after the first and with just months to go before a presidential election and an impending flu season — has alarmed public health experts and the president’s political allies.

“These epidemics are going to be hard to get under control,” said Scott Gottlieb, the former commissioner of the Food and Drug Administration and an informal adviser to the Trump administration. He said he expects deaths to soon climb to more than 1,000 per day again. “It’s going to continue to spread until you do something to intervene. I’m not sure we are taking enough forceful action to break the trend right now.”

The Trump administration has repeatedly claimed that the US is “leading the world” with its response to the pandemic, but it does not seem to be going in any direction the world wants to follow.

Across Europe, Asia, Africa and Latin America, views of the US handling of the coronavirus crisis are uniformly negative and range from horror through derision to sympathy. Donald Trump’s musings from the White House briefing room, particularly his thoughts on injecting disinfectant, have drawn the attention of the planet.

“Over more than two centuries, the United States has stirred a very wide range of feelings in the rest of the world: love and hatred, fear and hope, envy and contempt, awe and anger,” the columnist Fintan O’Toole wrote in the Irish Times. “But there is one emotion that has never been directed towards the US until now: pity.”

The US has emerged as a global hotspot for the pandemic, a giant petri dish for the Sars-CoV-2 virus. As the death toll rises, Trump’s claims to global leadership have became more far-fetched. He told Republicans last week that he had had a round of phone calls with Angela Merkel, Shinzo Abe and other unnamed world leaders and insisted “so many of them, almost all of them, I would say all of them” believe the US is leading the way.

None of the leaders he mentioned has said anything to suggest that was true. At each milestone of the crisis, European leaders have been taken aback by Trump’s lack of consultation with them – when he suspended travel to the US from Europe on 12 March without warning Brussels, for example. A week later, politicians in Berlin accused Trump of an “unfriendly act” for offering “large sums of money” to get a German company developing a vaccine to move its research wing to the US.

The president’s abrupt decision to cut funding to the World Health Organization last month also came as a shock. The EU’s foreign policy chief, Josep Borrell, a former Spanish foreign minister, wrote on Twitter: “There is no reason justifying this move at a moment when their efforts are needed more than ever to help contain & mitigate the coronavirus pandemic.”

A poll in France last week found Merkel to be far and away the most trusted world leader. Just 2% had confidence Trump was leading the world in the right direction. Only Boris Johnson and Xi Jinping inspired less faith.

A survey this week by the British Foreign Policy Group found 28% of Britons trusted the US to act responsibly on the world stage, a drop of 13 percentage points since January, with the biggest drop in confidence coming among Conservative voters.

Dacian Cioloș, a former prime minister of Romania who now leads the Renew Europe group in the European parliament, captured a general European view this week as the latest statistics on deaths in the US were reported.

“Post-truth communication techniques used by rightwing populism movements simply do not work to beat Covid-19,” he told the Guardian. “And we see that populism cost lives.”

Around the globe, the “America first” response pursued by the Trump administration has alienated close allies. In Canada, it was the White House order in April to halt shipments of critical N95 protective masks to Canadian hospitals that was the breaking point.

The Ontario premier, Doug Ford, who had previously spoken out in support of Trump on several occasions, said the decision was like letting a family member “starve” during a crisis.

“When the cards are down, you see who your friends are,” said Ford. “And I think it’s been very clear over the last couple of days who our friends are.”

In countries known for chronic problems of governance, there has been a sense of wonder that the US appears to have joined their ranks.

Are we still “to be feared,” even if no longer admired or respected? Good question!

Probably, insofar as our collapse would take down a chunk of the world’s economy with it, leave a leadership vacuum, and change the balance of power, perhaps in favor of China, Russia, South Korea, Canada, and India. We also still have a big military and lots of sophisticated weapons, although modern terrorism has shown that sophistication in expensive weaponry is not always the “be all and end all” either for winning wars or causing mass disorder, death, and mayhem.

Still, as our civil governance and international influence disintegrates, what happens with and to our military is a huge concern and a “big X factor.” Will the tradition of  “civilian control over the military” also fall victim to the kakistocracy and the failure of civilian governing institutions? What’s happened to our intelligence community under the Trump kakistocracy is likely a bad omen.

Who would have thought that Trump could do so much permanent or at least long-term damage in such a short period of time? And who would have believed that our centuries-old constitutional and democratic institutions, meant to protect individual rights, enforce the rule of law, and check unrestrained abuses of power by a megalomaniac, yet highly incompetent, dishonest, dangerous, and evil Executive would have crumbled so quickly and performed so haplessly when confronted by a President and an unscrupulous, corrupt, authoritarian regime and party of toadies perfectly willing to press aggressively inane and illegal policies and false narratives to destroy the nation and everyone in it as a means of pillaging and enhancing their own power? 

Yet, here we are! Much of the rest of the world appears to “get” it. Yet tens of millions of Americans who continue to support and enable the kakistocracy don’t, or they simply don’t care about our nation and the common good.

Immigrants Jailed by ICE Are Sick, Panicking, and Can’t Get Coronavirus Tests

“They don’t want to die in here.“

José listed off his symptoms: fever, nausea, diarrhea, difficulty breathing. The 38-year-old from Mexico, now detained in an ICE detention center in Southern California, told VICE News he worries he has COVID-19, the potentially deadly disease caused by the novel coronavirus.

But he doesn’t know. His jailers won’t test him.

Instead, José, who is from Mexico and came to the U.S. when he was 15, sleeps in a cell with seven other detained immigrants at the Adelanto detention facility in San Bernardino, Calif, which is run by the for-profit GEO Group. He wakes up in the middle of the night gasping for air, his heart beating wildly. After complaining to a judge, he was taken to the infirmary, where a doctor told him it was just a cold, he said.

“They just tell me to drink a lot of water and eat the food they give us,” said José, who has been incarcerated for five years fighting a deportation order. “There are other guys in here that are also coughing, have a fever. But we have no idea if we have the coronavirus because they won’t give us a test.”

This week, the first immigrants detained by ICE tested positive for COVID-19. It comes after weeks of warnings by public health experts and civil right lawyers that a mass outbreak in detention centers is inevitable, endangering both asylum seekers, those being detained for immigration violations, and staff. They also say an outbreak would strain an already critically low supply of respirators, leading to more deaths in the communities surrounding detention centers as well as among immigrant detainees.

Across the immigration system there appears to be little being done to prevent a spread of the coronavirus, except banning visitors. There are currently some 37,000 detained immigrants in ICE custody, most of them held in for-profit detention centers in the south and California. ICE recently requested 45,000 N95 masks from the federal government for its officers to carry out detentions of undocumented immigrants.

VICE News spoke with six men currently being held in ICE detention facilities in California, and two men released this month from ICE facilities in Louisiana. They described congested living conditions with up to 110 men sleeping in a room and days-long waitlists to be seen by a medical professional.

The Trump administration was prepared to separate more than 26,000 children from their families between May and September 2018 under a zero tolerance policy for unauthorized border crossing, according to the inspector general report released on Wednesday. But in spite of the plan for mass separations ― ultimately blocked in court in June 2018 ― the government didn’t have the technology to track family separations.

The estimate that roughly 3,000 children were taken from their parents between May and June 2018 is undoubtedly lower than the true number.

The Department of Homeland Security failed to accurately record the family relationships of roughly 1,400 children over a year and a half, from October 2017 to February 2019, according to the report.

Immigration officials knew about these technical issues long before the zero tolerance policy was implemented. But they failed to fix them before taking children from their families en masse, making an already traumatic situation for parents and kids all the more chaotic.

“It just confirms that the real policy and attitude of dehumanization of this population,” said Michelle Brané, the director of the Migrant Rights and Justice Program at the Women’s Refugee Commission. “I really think a part of this administration’s approach is that we don’t view this population as having human rights.”

DHS and HHS did not immediately respond to a request for comment.

The Trump administration has admitted that it didn’t have a proper system to track separated families across both DHS and HHS. HHS is responsible for unaccompanied immigrant children, including those taken from their families at the border.

In April, after an internal watchdog report revealed the Trump administration had likely separated thousands more children from their parents than previously known, HHS officials said it could take up to two years to identify them because of the disorganized data. In a court filing, a deputy director at HHS called the process of tracking down these children a “burden” and said the department didn’t have enough staff to take on the project.

During family separation, DHS’s IT system did not have the ability to properly label separated family members or track them after they were split up, according to the inspector general report. As a result, employees came up with various ad hoc methods of tracking families. But they were not standardized across the department and caused widespread confusion once the data reached ICE officers.

Agents were also not properly trained on how to use the existing technology, and mistakes were rampant. Shortly after the zero tolerance policy was implemented, eight children were separately entered into the system despite being from the same family, according to the report. There was also no plan to reunify families post-separation, despite the fact that parents were being deported without their children.

While the stated goal of the zero tolerance policy was to prevent immigrants from being apprehended and released into the U.S. while they awaited legal proceedings ― a process derisively known as “catch-and-release” ― the result was that children were traumatized and detained for record amounts of time.

Brané said the government has still failed to take accountability for its faulty tracking system and the lifelong trauma it has caused these families.

“There was an affirmative decision not to record,” she said. “They continue to drag their feet and act defensive as though this was some sort of natural disaster that happened to them that they didn’t respond to in the best way.”

When thousands of migrant children ended up stranded in U.S. Border Patrol stations last spring, President Trump’s administration characterized the crisis as a spontaneous result of the record crush of migrants overwhelming the U.S. immigration system. But the backup also was a result of policy decisions that officials knew would ensnare unaccompanied minors in bureaucratic tangles and leave them in squalid conditions, according to dozens of interviews and internal documents viewed by The Washington Post.The policies, which administration officials began pursuing soon after Trump took office in January 2017, made it harder for adult relatives of unaccompanied minors to secure the children’s release from U.S. custody. Enhanced vetting of sponsors — including fingerprints and other paperwork — and the sharing of that information between child welfare and immigration authorities slowed down the release of children and exposed the sponsors to deportation.

The government knew the moves would strain child shelters, according to documents and current and former officials, but it was aimed at sending a message to Central American migrants: Coming to the United States illegally has consequences.

Administration officials said the policy was designed to protect children from potential abusers or criminals, but they also wanted to create a broad deterrent effect; they reasoned that undocumented migrants might hesitate to claim their children for fear of being deported. Authorities weighed deterrence — a central aspect of U.S. immigration policy under both President Barack Obama and Trump — against the possibility of children crowding into border stations. And they chose to push forward, knowing what would result.

“This will strain bed capacity,” authorities wrote in a discussion paper in February 2018.

The approach caused thousands of unaccompanied minors to be stranded in U.S. custody and exacerbated the appearance of a crisis on the southern border — a major element underlying the administration’s public request for billions of dollars in additional funding from Congress.

Lawyers were allowed to visit children in the border stations, and Democratic lawmakers were invited to tour the facilities when they were at their worst. They witnessed — and shared with the public — scenes of desperate children held in crowded cells without basic necessities.

According to current and former government officials, and emails and memos detailing the Trump administration’s strategy, it is clear they knew that without enough beds in government shelters, children would languish in Border Patrol stations not equipped to care for them, making the government a target of lawsuits and public criticism — both of which occurred.

One of the key figures in that strategizing, Chad Wolf, is set to take the helm at the Department of Homeland Security. Senators on Tuesday are expected to first vote on Wolf’s confirmation to his current job as undersecretary for strategy, policy and plans. Wolf is Trump’s favored pick to then take over as acting head of the agency, just as officials brace for what could be another increase in migrant crossings.

Top DHS officials have warned that the reprieve from the record influx of migrants in recent months is probably temporary. Acting Customs and Border Protection commissioner Mark Morgan said last month that the number of people crossing the border is still higher than at the same time last year and remains a “crisis.” Migration also typically increases in the spring, and the U.S. government is preparing for another surge of families and unaccompanied minors.

Such a potential wave of children is what inspired the early discussions about policy changes within the Trump administration in 2017 — along with debate about the policy’s effects.

‘Safety’ vs. ‘anguish’

Staff at the Department of Health and Human Services’ Office of Refugee Resettlement, which is in charge of caring for unaccompanied migrant children, argued against the policy in weekly memos during the summer of 2017. Jonathan White, then deputy director of the ORR’s children’s program, warned in a July 2017 memo that the administration’s plan to separate children from their families and to alter the process of handing children over to sponsors would “result in significant increases” in how long children would be held.

White wrote that children would spend an average of 95 days in federal custody and that the department would need at least 6,500 additional beds in just three months. White declined to comment for this story.

Documents reviewed by The Post show that officials also estimated that HHS would need an additional $686 million in funding — more than 50 percent above its planned budget — to accommodate the policy and create additional bed space.

But the administration did not formally request extra money for that purpose at the time, according to senior Democratic and Republican congressional aides who spoke on the condition of anonymity to discuss private negotiations.

Mark Weber, an HHS spokesman, did not dispute those details but maintained that the border backups resulted from a historic influx of unaccompanied children. In May alone, 9,000 children were referred to the government’s care, he said.

Administration officials also thought the backlog would be short-lived.

“At some point in FY19, the deterrent effect of the new policy should stop families and unscrupulous adult aliens from using the reunification process, normalizing and reversing the volume trend” of unaccompanied minors arriving at the border, authorities wrote in a discussion paper that the National Security Council shared with senior administration officials. The paper was shared with an interagency group that met regularly in the White House Situation Room to discuss immigration and border security.

Some senior officials acknowledged in interviews that they expected some children to remain in custody for longer periods of time, but they said the policy was developed with child safety in mind; they did not want children to be released to smugglers or criminals.

“My number one concern on this was making sure that kids were safe,” Tom Homan, former acting director of U.S. Immigration and Customs Enforcement, said in an interview. “I know it’s a tough decision. It was never easy. You have to weigh the operational concerns, and the humanitarian concerns, and how long they’re going to stay in detention. . . . Yeah, it was going to increase the bed stay, but it wouldn’t be like twofold, threefold, fourfold. We thought it was worth a try, and it if doesn’t work, we can always pedal back and change gears.”

Acting ICE director Matthew Albence said the policy was part of the “deterrent effect” the government was seeking: “The goal was to prevent these children from coming on this dangerous journey.”

Albence, Homan and other Trump administration officials say the backlog arose because of Washington politics, blaming Democrats in Congress for being too slow to authorize funding for more shelter beds at facilities designed to care for children.

“No one who values child welfare and safety would argue smuggled, exploited and unaccompanied children at the southern border should be handed over to illegal alien ‘sponsors’ without reliable identity confirmation and background checks,” said deputy White House press secretary Hogan Gidley. “The only ones responsible for crowded shelters are Democrats who want to preserve and expand loopholes used by child smugglers for purely political purposes.”

A few months after the policy was implemented, HHS officials determined that it was not improving child safety. They concluded that the added vetting was redundant and needlessly extended the time children remained in custody, according to internal documents that ORR Deputy Director Jallyn Sualog presented to Congress, and to testimony on Capitol Hill.

Advocates saw a darker motive in policies that they say were “intentionally developed to inflict maximum anguish on children,” said Heidi Altman, of the National Immigrant Justice Center. She said officials knew that their plans “would trigger a chain of events that left children hungry, abused and sick in overcrowded CBP facilities.”

Democrats likewise have argued that the White House set up the crisis. Rep. Rosa L. DeLauro (D-Conn.), presiding over a House Oversight subcommittee hearing last month, noted that it had always been possible for the government to ease conditions but that officials chose not to.

“We did not have to have a backlog. We did not,” DeLauro said. “That was created.”

Tightening the rules

The Department of Homeland Security did a test run of the policy in the summer of 2017, instructing border agents to interview young migrants about the relatives they wanted to live with in the United States. They then created “target folders” for those adults that could be used to take action against them, according to internal emails that the American Immigration Council obtained via the Freedom of Information Act and made available online.

 

At the ORR, then-director Scott Lloyd was thinking about the administration’s “moral imperative” to protect children from smugglers and to ensure that gangs were not exploiting the child shelter system to enter the country.

“Our legal responsibilities are child welfare,” Lloyd said in an interview. “But even from a child welfare perspective, it’s desirable to deter people from taking that risk, putting their kids in that type of harm.”

Lloyd said he and his staff agreed that better communication between his agency and DHS was the best way to address those concerns.

“We needed to know if a kid had any gang ties or gang ties in their family — we needed to make sure that DHS had that information and that we had that information,” Lloyd said.

The partnership was formalized in an agreement that mandated significantly stricter fingerprinting and screening requirements for all adults who hoped to sponsor a migrant child or who lived in a house where a migrant child might stay.

“If this could get finalized and implemented soon, it would have a tremendous deterrent effect,” Gene Hamilton, counsel to then-attorney general Jeff Sessions, wrote in notes he sent by email in December 2017 to Wolf, the senior DHS official who is now in line to take over as acting secretary. The existence of the notes — but not the identity of the authors or the recipients — was first reported by NBC News.

Wolf declined to comment.

Alexei Woltornist, a Justice Department spokesman, said the agreement was just one of “numerous steps” to prevent the victimization of children: “Ending the trauma these children can face requires taking action against all parties who entrust criminals and cartels to transport their children across the border.”

HHS Secretary Alex Azar and then-DHS secretary Kirstjen Nielsen — the two department heads tasked with carrying out the policy — voiced serious concerns, according to two officials familiar with the discussions. They worried that the agreement would be impossible to implement, could lead to longer detention times for children and would be viewed publicly as unnecessarily harsh, said the officials, who spoke on the condition of anonymity to discuss internal policy deliberations.

Caitlin Oakley, an HHS spokeswoman, did not dispute that account, but she said in a statement that Azar “supports the Trump administration’s goal of enforcing immigration laws and securing the border.”

“The backup at the border of minors witnessed this summer was the consequence of a broken immigration system,” Oakley added.

Nielsen declined to comment.

One HHS employee who spoke on the condition of anonymity to discuss internal matters recalled Lloyd telling staffers that the White House wanted them “to do everything you can to prevent backups into border stations. But it is better that there be a backup in a border station than that we not enforce immigration laws and that we not deter migration.”

Lloyd denied that account.

“I don’t ever recall holding, even temporarily, the idea that backups at border stations was a remotely acceptable scenario,” Lloyd said.

Internal memos show that for months before implementing the policy, government lawyers worried about lawsuits and discussed ways to claim that the policy would make children safer. In a January 2018 draft memo, viewed by The Post, Justice Department lawyers proposed defending the plan to conduct enhanced background checks and share them with enforcement agents as a means of protecting migrant children from witnessing the eventual deportation of their parents or relatives.

“We can argue that whether a proposed sponsor is subject to removal is a key factor in determining suitability, given the impact that immigration enforcement against, or detention of, a sponsor would have on the circumstances faced by” unaccompanied minors living with the sponsor, Justice Department lawyers wrote in January 2018 correspondence with DHS and HHS officials as part of an “analysis of litigation risk” associated with the agreement.

Federal judge blocks Trump administration from detaining migrant children for indefinite periods

The administration also developed and rolled out its family separation policy in the spring of 2018, part of its “zero tolerance” approach at the border. The months-long initiative, which separated thousands of children from their parents, compounded the need for shelter space. After a public outcry, the administration ended the policy.

By the fall of 2018, most of the families had been reunited, and the number of unaccompanied children crossing the border had fallen, but the population of children in the shelters continued to grow, according to HHS data. By October 2018, migrant children were spending an average of more than 90 days in federal custody — exactly as White had predicted — more than twice the length of stays two years earlier.

While some adult migrants were afraid to come forward to claim their children, the contractors tasked with carrying out the background checks and fingerprinting were overwhelmed, according to current and former HHS officials. The American Civil Liberties Union and other advocates filed lawsuits challenging the policy, arguing that parents waited months for fingerprinting results.

Time in custody grows

Kevin Dinnin, the head of the nonprofit that operated a shelter for migrant children in Tornillo, Tex., said the crush of minors became increasingly severe through late 2018, and he told the agency he could not continue. Images of teenagers behind chain-link fences shuffling single-file from tent to tent had drawn public outrage, and Dinnin could not understand why children continued arriving at the shelter even though migrant crossings had slowed and family separations had ended.

“The problem was, kids were coming and not being discharged,” Dinnin said. “The average length of stay just kept increasing.”

An HHS official who spoke on the condition of anonymity to discuss sensitive policy decisions said the agency would never have opened the Tornillo shelter had it not been for the agreement with DHS.

“It was the increase in average length of care that created a need for thousands of beds,” the official said.

U.S. returns 100 migrant children to overcrowded border facility as HHS says it is out of space

HHS career staff members decided that the agency had no choice but to eliminate some aspects of the background checks to relieve the pressure on the system. To avoid roiling the White House, they slowly rolled back the policy through several “operational directives” over a period of months, according to current and former HHS officials.

The agency announced that it would stop fingerprinting all adult members of a sponsor’s household in December 2018, and the government then quickly released thousands of children from custody. The Tornillo shelter closed a few weeks later.

But with the agency still fingerprinting sponsors, some children continued to languish in custody for months, especially when migrant crossings surged again in the spring. Children apprehended at the border were left in Border Patrol stations as a result.

Democratic lawmakers, lawyers and advocates toured Border Patrol stations in late spring and early summer and delivered scathing descriptions of the suffering they witnessed. DHS and HHS officials pleaded with Congress for more money, saying they had been blindsided by the numbers. HHS canceled English classes, soccer and legal aid for migrant children, citing inadequate funds.

In June, Congress approved a $4.6 billion emergency border spending package, shortly after hearing the government’s pleas about what they described as a humanitarian crisis at the border.

Officials credited the subsequent release of hundreds more children to the aid package. But in court documents and congressional testimony, they acknowledged that moves to scale back the enhanced background checks had made the difference. Those included a final directive in June to stop fingerprinting aunts, uncles and grandparents seeking custody of migrant children, speeding up the release of more than 1,000 children in a matter of weeks and allowing the emergency shelter in Homestead, Fla., to close.

“I do support the four operational directives in order to expedite the release of children to properly vetted sponsors,” ORR Director Jonathan Hayes said at a congressional hearing in July. “I want to see the children back with their families.”

Officials have argued that shortening the time that children are held in federal custody will boost the incentive for migrant families to seek entry into the United States.

“The shorter the stay, the more likely they’re willing to take it on,” Homan said. “If I think I’ll be detained for a year, I might not come. But if I’ll be detained for a week and be released, that may convince me to make that trip.”

The Trump Administration continues to intentionally misrepresent the conditions in the Northern Triangle that are sending families and children in flight to the U.S., notwithstanding their knowledge of the dangers and the overt cruelty and racism of the Trump Administration directed against them.

It’s a result of conditions in the sending countries and won’t be stopped or prevented by unilateral actions on the part of receiving countries, even extreme cruelty.  The phenomenon might, however, be increased by the overtly anti-refugee policies and statements of the Trump Administration and the actions of the Trump Administration in coddling dictators and tyrants, which actually produces more child refugees.

Also, what about the criminals over at HHS who have abandoned their Congressionally-assigned duty to protect and look out for the best interests of children for a White Nationalist, racist, nativist enforcement policy that targets kids. When folks like Alex Azar & company are sent packing from Government some day, remember for what they really stand!

Nov . 7, 2019. In a little noticed move, “Trump Chump” Attorney General Billy Barr in October advanced conservative GOP appointed Appellate Immigration Judge Garry D. Malphrus to the position of Acting Chair of the Board of Immigration Appeals in Falls Church Virginia. The move followed the sudden reputedly essentially forced “retirement” of former Chair David Neal in September.

 

Notably, Barr bypassed long-time BIA Vice Chair and three-decade veteran of the Executive Office for Immigration Review (“EOIR”) (which “houses” the BIA) Judge Charles “Chuck” Adkins-Blanch to elevate Judge Malphrus. Increasingly, particularly in the immigration area, the Trump Administration has circumvented bureaucratic chains of command and normal succession protocols for “acting” positions in favor of installing those committed to their restrictionist political program.

 

Like former Chair Neal, Vice Chair Adkins-Blanch has long been rumored not to be on the “Restrictionist A Team” at EOIR. Apparently, that’s because he occasionally votes in favor of recognizing migrants’ due process rights and for their fair and impartial treatment under the immigration laws.

 

For example, although generally known as a low-key “middle of the road jurist,” Vice Chair Adkins-Blanch authored the key BIA precedent Matter of A-R-C-G-, 26 I&N Dec. 388 (BIA 2014). There, the BIA recognized the right of abused women, particularly from the Northern Triangle area of Central America, to receive protection under our asylum, and immigration laws. That decision was widely hailed as both appropriate and long overdue by immigration scholars and advocates and saved numerous lives and futures during the period it was in effect.  It also promoted judicial efficiency by encouraging ICE to not oppose well-documented domestic violence cases.

 

Nevertheless, in a highly controversial 2018 decision, White Nationalist restrictionist Attorney General Jeff Sessions dismantled A-R-C-G-. This was an an overt attempt to keep brown-skinned refugees, particularly women, from qualifying for asylum. Matter of A-B –, 27 I&N Dec. 316 (A.G. 2018). Session’s decision was widely panned by immigration scholars and ripped apart by U.S. District Judge Emmet Sullivan, the only Article III Judge to address it in detail to date, in Grace v. Whitaker, 344 F. Supp. 3d 96 (D.D.C. 2018). Nevertheless, Matter of A-B- remains a precedent in Immigration Court.

 

In addition to the Malphrus announcement, sources have told “Courtside” that veteran BIA Appellate Immigration Judges John Guendelsberger and Molly Kendall Clark will be retiring at the end of December. While the current BIA intentionally has been configured over the past three Administrations to have nothing approaching a true “liberal wing,” Judges Guendelsberger and Kendall Clark were generally perceived as fair, scholarly, and willing to support and respect individual respondents’ rights, at least in unpublished, non-precedential decisions.

 

This was during an era when the BIA as a whole was moving in an ever more restrictive direction, seldom publishing precedent decisions favoring or vindicating the rights of individuals over DHS enforcement. Additionally, under Sessions and now Barr, the BIA has increasingly been pushed aside and given the role of “restrictionist enforcer” rather than “expert tribunal.” The most significant policies are rewritten in favor of hard-line enforcement and issued as “precedents” by the Attorney General, sometimes without any input or consultation from the BIA at all.

 

The BIA’s new role evidently is to insure that Immigration Judges aggressively use these restrictionist precedents to quickly remove individuals without regard to due process. Apparently, this new role also includes promptly reversing any grants of relief to individuals, thus insuring that ICE Enforcement wins no matter what, and actively discouraging individuals from daring to use our justice system to assert their rights. To this end, Barr’s six most recent judicial appointments to the BIA, part of an obvious “court-packing scheme,” are all Immigration Judges with asylum denial rates far in excess of the national average and reputations for being unsympathetic, sometimes also rude and demeaning, to respondents and their attorneys.

 

Indeed, adding insult to injury, Barr’s latest regulatory proposal would give a non-judicial official, the EOIR Director, decisional and precedent setting authority over the BIA in certain cases. This directly undoes some of the intentional separation of administrative and judicial functions that had been one of the objectives of EOIR.

 

Judge Guendelsberger was originally appointed to the BIA by the late Attorney General Janet Reno in 1995. However, as a member (along with me) of the notorious due process oriented “Gang of Five,” he often wrote or joined dissents from some of the BIA majority’s unduly restrictive asylum jurisprudence. Consequently, Judge Guendelsberger and the rest of the “Gang” were “purged” from the BIA by Attorney General John Ashcroft in 2003.

Reassigned to “re-education camp” in the bowels of the BIA, Judge Guendelsberger worked his way back and was “rehabilitated” and reappointed to the BIA by Attorney General Eric Holder in August 2009. This followed several years as a “Temporary Board Member,” (“TBM”). The TBM is a clever device used to conceal the dysfunction caused by the Ashcroft purge by quietly designating senior BIA staff as judges to overcome the shortage caused by the purge and irrational BIA “downsizing” used to cover up the political motive for the purge. TBMs are also disenfranchised from voting at en banc, thus insuring a more compliant and less influential temporary judicial workforce.

Judge Guendelsberger was the only member of the “Gang of Five” to achieve rehabilitation. However, his former “due process fire” was gone. In his “judicial reincarnation” he seldom dissented from BIA precedents. He even joined and authored decisions restricting the ability of refugees to qualify for asylum based on persecution from gangs that the governments of the Northern Triangle were unwilling or unable to control or were actually using to achieve political ends.

Indeed, his later public judicial pronouncements bore little resemblance to the courageous and often forward-looking jurisprudence with which he was associated during his “prior judicial life” with the “Gang of Five.” Nevertheless, he continued to save lives whenever possible “under the radar screen” in his unpublished decisions, which actually constitute the vast bulk of a BIA judge’s work.

Judge Kendall Clark was finally appointed to a permanent BIA Appellate Judgeship by Attorney General Loretta Lynch in February 2016, following a lengthy series of appointments as a TBM. Perhaps because of her disposition to recognize respondents’ rights in an era of sharp rightward movement at the BIA, she authored few published precedents.

However, she did write or participate in a number of notable unpublished cases that saved lives at the time and advanced the overall cause of due process. She also had the distinction of serving as a Senior Legal Advisor to four different BIA Chairs (including me) from 1995 to 2016.

Thus, the BIA continues its downward spiral from a tribunal devoted to excellence, best practices, due process, and fundamental fairness to one whose primary function is to serve as a “rubber stamp” for White Nationalist restrictionist enforcement initiatives by DHS. The voices of reasonable, thoughtful, scholarly jurists like Judges Guendelsberger and Kendall Clark will be missed.

They are some of the last disappearing remnants of what EOIR could have been under different circumstances.  Their departure also shows why an independent Article I Judiciary, with unbiased judges appointed because of their reputations for fairness, scholarship, timeliness, teamwork, and demonstrated respect for the statutory and constitutional rights of individuals, is the only solution for the current dysfunctional mess at EOIR.

Outrageous!

One of the “under the radar” aspects of this “deconstruction of justice in America” is the arrogant confidence of Sessions, Barr, and their minions at DOJ and EOIR that Congress and the Article III Courts will turn a “blind eye” to their blatantly “in your face” unconstitutional behavior. So far, they have been right.

Article III Courts have recognized the Immigration Judges’ “duty to remain neutral and impartial when they conduct immigration hearings.” See, e.g., Wang v. Att’y Gen., 423 F.3d 260, 267–68 (3d Cir. 2005). Yet, they have basically ignored their own rules and pronouncements by continuing to approve decisions from a “fake” court system. One where the “judges” are selected, supervised, and can be removed by the “Chief Prosecutor” and are told that they owe their first duty of obedience to that prosecutor rather than to the Constitution or the rule of law that they are sworn to uphold. Even when they do rule in favor of the individual, the prosecutor can and does simply reach in, change the result, and then designate his prosecutorial decision as a “precedent.”

What kind of “Due Process” and “fundamental fairness” is that? What Article III Judge would submit him or herself to such a parody of “justice?”

EOIR as “redesigned, politicized, and weaponized” against migrants and their courageous representatives by the Trump DOJ mocks the stated criteria and standards of the Article IIIs. Why are the Article IIIs afraid to follow up their legal rhetoric with the actions that logically should flow from it?

Under Trump, the Attorney General and his toadies have disingenuously disparaged the motives and character of the individuals coming before the “courts” and their attorneys. Many are actually forced to appear “unrepresented” and have no idea what is happening and the intentionally arcane, hyper technical, and confusing “rules” being applied to extinguish their rights and claims.

DOJ officials have also demeaned, disparaged, and denigrated the work ethic and character of their own “judges” with limitations on their authority, “Mickey Mouse” quotas and timeframes, and giving away judicial authority to non-judicial officials at EOIR, as Judge Tabaddor cogently points out.

Article III Courts compound that error when they improperly “defer” to Executive Branch adjudicators who are neither “fair and impartial” nor in many cases “expert.” The whole system is intentionally put under pressure to “produce and deport,” with scholarship, independent judicial decision making, and Due Process being shoved to the “back of the bus.”

By accepting contemptuous unlawful actions from Barr and the DOJ, the Article III Judiciary basically diminishes itself and demeans its Constitutional role. Perhaps that doesn’t make any difference to most of them; life tenure guarantees that they get paid every day just for waking up regardless of what they do afterwards. But, as Congress is finding out, once you establish yourselves as feckless in the face of a tyrannical and overbearing Executive, respect and proper Constitutional roles might prove difficult or impossible to regain.

Since the NAIJ leadership seem to be the only ones courageous enough to speak out against the travesty occurring in the Immigration Courts, no wonder the DOJ is trying to illegally disband the NAIJ. I wonder why these very overt actions to suppress the First Amendment and subvert the Fifth Amendment are going “over the heads” of the Article III Judiciary. What’s the purpose of an “independent judiciary” that is afraid or unwilling to stand up for judicial independence when it matters most!

As the late Dr. Martin Luther King, Jr., said:

Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.”

I think he would be totally disgusted with the overall performance of the Article III Appellate Judiciary in failing to stand up for and protect the legal rights and very lives of the most vulnerable among us: migrants, including asylum seekers.

The Department of Justice has quietly changed hiring procedures to permanently place immigration judges repeatedly accused of bias to a powerful appellate board, adding to growing worries about the politicization of the immigration court system.

Documents obtained through Freedom of Information Act requests describe how an already opaque hiring procedure was tweaked for the six newest hires to the 21-member Board of Immigration Appeals. All six board members, added in August, were immigration judges with some of the highest asylum denial rates. Some also had the highest number of decisions in 2017 that the same appellate body sent back to them for reconsideration. All six members were immediately appointed to the board without a yearslong probationary period.

“They’re high-level deniers who’ve done some pretty outrageous things [in the courtroom] that would make you believe they’re anti-immigrant,” said Jeffrey Chase, a former immigration judge and past senior legal adviser at the board. “It’s a terrifying prospect … They have power over thousands of lives.”

Among the hiring documents are four recommendation memos to the Attorney General’s office from James McHenry, director of the Executive Office for Immigration Review, which oversees the nation’s immigration court system.

The memos, dated July 18, recommend immigration judges William A. Cassidy, V. Stuart Couch, Earle B. Wilson, and Keith E. Hunsucker to positions on the appellate board. McHenry’s memos note new hiring procedures had been established on March 8, to vet “multiple candidates” expressing interest in the open board positions.

A footnote in the memos states that applicants who are immigration judges would be hired through a special procedure: Instead of going through the typical two-year probationary period, they would be appointed to the board on a permanent basis, immediately. This was because a position on the appellate board “requires the same or similar skills” as that of an immigration judge, according to the memo.

Appellate board members, traditionally hired from a variety of professional backgrounds, are tasked with reviewing judicial decisions appealed by the government or plaintiff. Their decisions, made as part of a three-member panel, can set binding precedents that adjudicators and immigration judges rely on for future cases related to asylum, stays of deportation, protections for unaccompanied minors and other areas.

McHenry, appointed in 2018 by then-Attorney General Jeff Sessions, concludes his recommendation memos by noting that the judge’s “current federal service was vetted and no negative information that would preclude his appointment” was reported. He does not mention any past or pending grievances, although public complaints have been filed against at least three of the judges.

These documents, obtained through FOIA via Muckrock, a nonprofit, collaborative that pushes for government transparency, and shared with CQ Roll Call, reflect “the secrecy with which these rules are changing,” said Matthew Hoppock, a Kansas City-based immigration attorney. “It’s very hard to remove or discipline a judge that’s permanent than when it’s probationary, so this has long term implications.”

The Department of Justice declined to answer a series of questions asked by CQ Roll Call regarding the new hiring practices, why exemptions were made in the case of these immigration judges and whether complaints against any of the judges were considered.

“Board members, like immigration judges, are selected through an open, competitive, and merit-based process involving an initial review by the Office of Personnel Management and subsequent, multiple levels of review by the Department of Justice,” a DOJ official wrote via email. “This process includes review by several career officials. The elevation of trial judges to appellate bodies is common in almost every judicial system, and EOIR is no different.”

Opaque hiring process

When the department posted the six board vacancies in March, the openings reflected the first time that board members would be allowed to serve from immigration courts throughout the country. Previously, the entire appellate board worked out of its suburban Virginia headquarters.

In addition, the job posts suggested that new hires would be acting in a dual capacity: They may be asked to adjudicate cases at the trial court level and then also review the court decisions appealed to the board. Previously, board members stuck to reviewing appeals cases, a process that could take more than a year.

Ultimately, all six hires were immigration judges, although past board candidates have come from government service, private sector, academia and nonprofits.

“This was stunning,” MaryBeth Keller, chief immigration judge until she stepped down this summer, said in a recent interview with The Asylumist, a blog about asylum issues. “I can’t imagine that the pool of applicants was such that only [immigration judges] would be hired, including two from the same city.”

Keller said immigration judges are “generally eminently qualified to be board members, but to bring in all six from the immigration court? I’d like to think that the pool of applicants was more diverse than that.”

Paul Wickham Schmidt, a retired immigration judge who headed the board under President Bill Clinton, said the panel always had arbitrary hiring procedures that changed with each administration and suffered from “quality control” issues. But the Trump administration has “pushed the envelope the furthest,” he said.

“This administration has weaponized the process,” he told CQ Roll Call. “They have taken a system that has some notable weaknesses in it and exploited those weaknesses for their own ends.”

The reputation and track record of the newest immigration judges has also raised eyebrows.

According to an analysis of EOIR data by the Transactional Records Access Clearinghouse at Syracuse University, each of these newest six judges had an asylum denial rate over 80 percent, with Couch, Cassidy, and Wilson at 92, 96, and 98 percent, respectively. Nationally, the denial rate for asylum cases is around 57 percent. Previous to their work as immigration judges, all six had worked on behalf of government entities, including the Department of Homeland Security, Department of Justice and the military.

“It mirrors a lot of the concerns at the trial level,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association (AILA). She said several new hires at the trial level have been Immigration and Customs Enforcement attorneys.

“Every day across the country, people’s lives hang in the balance waiting for immigration judges to decide their fate,” she said. “Asylum grant rates for immigration court cases vary widely depending on the judge, suggesting that outcomes may turn on which judge is deciding the case rather than established principles and rules of law.”

Immigration experts note that denial rates depend on a variety of factors, including the number and types of cases that appear on a judge’s docket. Perhaps a better measure of an immigration judge’s decision-making may be the rate that rulings get returned by the appeals board.

For 2017, the last full year for which data is available, Couch and Wilson had the third and fourth highest number of board-remanded cases — at 50 and 47 respectively, according to federal documents obtained by Bryan Johnson, a New York-based immigration lawyer. The total number of cases on their dockets that year were 176 and 416, respectively.

Some of the behavior by the newer judges also have earned them a reputation. In 2018, AILA obtained 11 complaints against Cassidy that alleged prejudice against immigrant respondents. In a public letter the Southern Poverty Law Center sent last year to McHenry, the group complained that Cassidy bullied migrants in his court. He also asked questions that “exceeded his judicial authority,” Center lawyers wrote.

Another letter, sent in 2017 by SPLC lawyers and an Emory University law professor whose students observed Cassidy’s court proceedings, noted the judge “analogized an immigrant to ‘a person coming to your home in a Halloween mask, waving a knife dripping with blood’ and asked the attorney if he would let that person in.”

SPLC also has documented issues with Wilson, noting how he “routinely leaned back in his chair, placed his head in his hands and closed his eyes” during one hearing. “He held this position for more than 20 minutes as a woman seeking asylum described the murders of her parents and siblings.”

Couch’s behavior and his cases have made news. According to Mother Jones, he once lost his temper with a 2-year-old Guatemalan child, threatening to unleash a dog on the boy if he didn’t stop making noise. But he is perhaps better known as the judge who denied asylum to “Ms. A.B.,” a Salvadoran domestic violence survivor, even after the appellate board asked him to reconsider. Sessions, the attorney general at the time, ultimately intervened and made the final precedent-setting ruling in the case.

Couch has a pattern of denying asylum to women who have fled domestic violence, “despite clear instructions to the contrary” from the appellate board, according to Johnson, the immigration lawyer who said Couch “has been prejudging all claims that have a history of domestic violence, and quite literally copying and pasting language he used to deny other domestic violence victims asylum.”

Jeremy McKinney, a Charlotte-based immigration lawyer and second vice president at AILA, went to law school with Couch and called him “complex.” While he was reluctant to characterize the judge as “anti-immigrant,” he acknowledged “concerning” stories about the Couch’s court demeanor.

“In our conversations, he’s held the view that asylum is not the right vehicle for some individuals to immigrate to the U.S. — it’s one I disagree with,” McKinney said. “But I feel quite certain that that’s exactly why he was hired.”

Politicizing court system

Increasingly, political appointees are “micromanaging” the dockets of immigration judges, said Ashley Tabaddor, head of the union National Association of Immigration Judges. Appointees also are making moves that jeopardize their judicial independence, she said. Among them: requiring judges to meet a quota of 700 completed cases per year; referring cases even if they are still in the midst of adjudication to political leadership, including the Attorney General, for the final decision; and seeking to decertify the immigration judges’ union.

These are “symptoms of a bigger problem,” said Tabaddor. “If you have a court that’s situated in the law enforcement agency … that is the fundamental flaw that needs to be corrected.”

In March, the American Bar Association echoed calls by congressional Democrats to investigate DOJ hiring practices in a report that warned the department’s “current approach will elevate speed over substance, exacerbate the lack of diversity on the bench, and eliminate safeguards that could lead to a resurgence of politicized hiring.”

“Moreover, until the allegations of politically motivated hiring can be resolved, doubt will remain about the perceived and perhaps actual fairness of immigration proceedings,” the organization wrote. “The most direct route to resolving these reasonable and important concerns would be for DOJ to publicize its hiring criteria, and for the inspector general to conduct an investigation into recent hiring practices.”

One of the most disgusting developments, that the media sometimes misses, is that having skewed and biased the system specifically against Central American asylum seekers, particularly women and children, the Administration uses their “cooked” and “bogus” statistics to make a totally disingenuous case that the high denial rates show the system is being abused by asylum seekers and their lawyers. That, along with the “fiction of the asylum no show” been one of “Big Mac’s” most egregious and oft repeated lies! There certainly is systemic abuse taking place here — but it is by the Trump Administration, not asylum seekers and their courageous lawyers.

 

This system is a national disgrace operating under the auspices of a feckless Congress and complicit Article III courts whose life-tenured judges are failing in their collective duty to put an end to this blatantly unconstitutional system: one that  also violates statutory provisions intended to give migrants access to counsel, an opportunity to fully present and document their cases to an unbiased decision maker, and a fair opportunity to seek asylum regardless of status or manner of entry. Basically, judges at all levels who are complicit in this mockery of justice are “robed killers.”

 

Just a few years ago, asylum seekers were winning the majority of individual rulings on asylum in Immigration Court. Others were getting lesser forms of protection, so that more than 60 percent of asylum applicants who got final decisions in Immigration Court were receiving much-needed, life-saving protection. That’s exactly what one would expect given the Supreme Court’s pronouncements in 1987 about the generous standards applicable to asylum seekers in INS v. Cardoza-Fonseca.

 

Today, conditions have not improved materially in most “refugee sending countries.” Indeed, this Administration’s bogus designation of the Northern Triangle “failed states” as “Safe Third Countries” is absurd and shows their outright contempt for the system and their steadfast belief that the Federal Judiciary will “tank” on their responsibility to hold this Executive accountable.

 

As a result of this reprehensible conduct, the favorable trend in asylum adjudication has been sharply reversed. Now, approximately two-thirds of asylum cases are being denied, many based on specious “adverse credibility” findings, illegal “nexus” findings that intentionally violate the doctrine of “mixed motives”enshrined in the statute, absurdly unethical and illegal rewriting of asylum precedents by Sessions and Barr, intentional denial of the statutory right to counsel, and overt coercion through misuse of DHS detention authority to improperly “punish” and “deter” legal asylum seekers.

 

Right under the noses of complicit Article III Judges and Congress, the Trump Administration has “weaponized” the Immigration “Courts” and made them an intentionally hostile environment for asylum seekers and their, often pro bono or low bono, lawyers. How is this acceptable in 21st Century America?

 

That’s why it’s important for members of the “New Due Process Army” to remember my “5 Cs Formula” – Constantly Confront Complicit Courts 4 Change. Make these folks with “no skin the game” feel the pain and be morally accountable for those human lives they are destroying by inaction in the face of Executive illegality and tyranny from their “ivory tower perches.”  

We’re in a war for the survival of our democracy and the future of humanity.  There is only one “right side” in this battle. History will remember who stood tall and who went small when individual rights, particularly the rights to Due Process and fair treatment for the most vulnerable among us, were under attack by the lawless forces of White Nationalism and their enablers!

You’ve heard of the Wars on Drugs, Terror, Poverty, even Women. Well, welcome to the War on Children.

It’s being waged by the Trump administration and other right-wing public officials, regardless of any claimed “family values.”

For evidence, look no further than the report released Wednesday by the Department of Health and Human Services’s own inspector general. It details the trauma suffered by immigrant children separated from their parents under the Trump administration’s evil “zero tolerance” policy.

Thousands of children were placed in overcrowded centers ill-equipped to provide care for them physically or psychologically. Visits to 45 centers around the country resulted in accounts of children who cried inconsolably; who were drugged; who were promised family reunifications that never came; whose severe emotional distress manifested in phantom chest pains, with complaints that “every heartbeat hurts”; who thought their parents had abandoned them or had been murdered.

Such state-sanctioned child abuse was designed to serve as a “deterrent” for asylum-seeking families, as then-Chief of Staff John F. Kelly and other administration officials made clear.

Of course, they failed to recognize just how horrific are the conditions these asylum-seeking children are fleeing — conditions that further decreased HHS’s ability to adequately care for them.

“Staff in multiple facilities reported cases of children who had been kidnapped or raped” back in their home countries, the IG report states. Other children witnessed family members raped or murdered.

But hey, Trump believes these kiddos must be punished further for the crime of seeking refuge — a.k.a., the “invasion” of America.

Despite this and other abundant evidence that government facilities are not able to care for children for extended periods, last month, the administration also announced a new policy that would allow it to keep children (along with their families) in jail-like conditions for longer periods of time.

 

This is hardly the only way the administration has knowingly enacted policies that harm children.

In August, it finalized a rule that would make it more difficult for immigrants to receive green cards if they have used certain safety-net services they’re legally entitled to — or if government officials suspect they might ever use such services. Confusion and fear about the policy and whom it affects abound. This has already created a “chilling effect” for usage of social services, with immigrant parents disenrolling even their U.S.-citizen children just to be safe.

Last fall, for instance, I interviewed a green-card-holding mother who decided not to enroll her underweight newborn in a program that would have provided free formula (even though the program in question was not mentioned in the rule, and the baby is a U.S. citizen). Huge recent declines in children’s Medicaid and Children’s Health Insurance Program enrollment are also believed to be at least partly a result of fears about this policy change.

If Your Dog Does This, It Could Be Them Signaling A Warning

And lest you think only immigrant or brown children are being targeted in this war: U.S. servicemembers’ children, of all sorts of backgrounds, are being hurt, too.

The Trump administration is siphoning billions from various defense projects to fund border wall construction, despite promises that Mexico would pay for it. This might sound unlikely to affect kids, but somehow the Trump administration found a way. Among the projects losing funds are schools for the children of U.S. servicemembers based in Kentucky, Germany and Japan, and a child-care center at Joint Base Andrews in Maryland.

Trump’s proposed federal budgets have likewise axed funding for other programs that serve children, such as subsidized school meals and Medicaid. Indeed, both federal and state GOP officials more broadly are still working to kill the Medi­caid expansion, as well as other Affordable Care Act provisions that benefit kids.

The GOP has likewise ignored the pleas of children who want their lives protected from gun violence, or who want their futures protected from a warming planet.

A year ago, I offered a suggestion : that Democrats make children the theme of their midterm campaign. They mostly ignored me and still did okay. Nonetheless, I’m re-upping it.

Because even without Trump’s baby jails and proposed Medicaid cuts, our country’s emphasis on children’s well- being is seriously deficient.

Last year, for the first time on record, we spent a greater share of the federal budget servicing the national debt than we did on children, according to an analysis out next week from First Focus on Children. Spending on children as a share of the federal budget is also expected to shrink over the coming decade, crowded out by both debt service and spending on the elderly.

This is despite the fact that spending on children (especially low-income children) has among the highest returns on investment of any form of government spending.

Whatever the opposite of Trump’s War on Children is, that’s what Democrats should be running on.

“A new and chilling normal is coming into view,” Miliband concluded. “Civilians seen as fair game for armed combatants, humanitarians seen as an impediment to military tactics and therefore unfortunate but expendable collateral, and investigations of and accountability for war crimes an optional extra for state as well as nonstate actors.”

But these evils cannot be isolated from the larger political corrosion in the rest of the world — and this includes the long-standing democracies themselves. “The checks and balances that protect the lives of the most vulnerable people abroad,” he said, “will only be sustained if we renew the checks and balances that sustain liberty at home.”

This isn’t simply about aligning principle and practice. More fundamentally, when governments abandon a commitment to accountability domestically, they no longer feel any obligation to insist upon it internationally. It’s no accident, as Miliband noted, that under President Trump, the United States “has dropped the promotion of human rights around the world from its policy priorities.”

He pulled no punches: “The new order is epitomized in the photo of Russian President [Vladimir] Putin and Saudi Crown Prince [Mohammed bin] Salman high-fiving each other at the G-20 meeting in Argentina in November last year. With Syria in ruins, Yemen in crisis, and political opponents like Boris Nemtsov and Jamal Khashoggi dead, theirs was the embrace of two leaders unencumbered by national institutions or by the fear of international law.”

Miliband acknowledged the mistakes of an earlier era (including the Iraq War) but argued that “accountability, not impunity” was on the rise in the 1990s, when there was “an unusual consensus across the left-right divide” about “the need for global rules.” We have said goodbye to all that.

In 2002, Samantha Power, later the U.S. ambassador to the United Nations, published “ ‘A Problem from Hell’: America and the Age of Genocide,” a book that stirred consciences about the world’s obligations to helpless people unprotected — and often targeted — by sovereign governments.

Nearly two decades on, we are numb, distracted and inward-looking.

Miliband understands that democratic citizens, grappling with their own discontents, will be inclined to look away from the travails of others “until there is a new economic and social bargain that delivers fair shares at home.”

But an Age of Impunity not only poses immediate dangers to millions confronting violence far away. It also corrodes the sense of obligation of the privileged in wealthy nations toward those left behind. When anything goes, no one is safe.

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

Four toddlers were so severely ill and neglected at a U.S. Border Patrol facility in McAllen, Texas, that lawyers forced the government to hospitalize them last week.

The children, all under age 3 with teenage mothers or guardians, were feverish, coughing, vomiting and had diarrhea, immigration attorneys told HuffPost on Friday. Some of the toddlers and infants were refusing to eat or drink. One 2-year-old’s eyes were rolled back in her head, and she was “completely unresponsive” and limp, according to Toby Gialluca, a Florida-based attorney.

She described seeing terror in the children’s eyes.

“It’s just a cold, fearful look that you should never see in a child of that age,” Gialluca said. “You look at them and you think, ‘What have you seen?’”

Another mother at the same facility had a premature baby, who was “listless” and wrapped in a dirty towel, as HuffPost previously reported.

The lawyers feared that if they had not shown up at the facility, the sick kids would have received zero medical attention and potentially died. The Trump administration has come under fire for its treatment ― and its alleged neglect ― of migrants who have been crossing the southern border in record numbers. The result is overcrowded facilities, slow medical care and in some instances, deaths.

Immigration authorities say they’re overwhelmed; activists say they’re not trying hard enough.

“It’s intentional disregard for the well-being of children,” Gialluca said. “The guards continue to dehumanize these people and treat them worse than we would treat animals.”

U.S. Customs and Border Protection declined to respond to HuffPost’s request for comment.

The Associated Press reported this week that children in border facilities don’t have adequate access to food, water, soap or showers. On Tuesday, a Justice Department attorney argued in court that the government should not have to provide detained children with soap, toothbrushes or beds.

The AP report is based on interviews a group of lawyers conducted with hundreds of children in three Texas-based Border Patrol stations last week as part of the Flores settlement ― an agreement that outlines conditions for detained children. The lawyers say children are also being held in these facilities for longer than the 72-hour limit the settlement specifies, and in some cases up to three weeks.

Lawyers are particularly concerned about the spread of illness inside Border Patrol facilities, which can sometimes turn fatal. Five children have died in Border Patrol custody since December, some of whom were initially diagnosed with a common cold or the flu. The processing center in McAllen, known as Ursula, recently quarantined three dozen migrants who were sick after a 16-year-old died of the flu at the same facility.

Children and their parents told lawyers that in some cases they didn’t have any access to medical treatment in Border Patrol facilities despite being visibly ill. Gialluca spoke with one 16-year-old mother whose toddler had the flu, but was told by a guard the child “wasn’t sick enough to see a doctor.” She said others also reported being denied medical attention despite having critically sick babies.

Medical experts say that because children have less developed immune and respiratory systems, their symptoms can escalate quickly if they aren’t properly treated.

Dr. Julie Linton, the co-chair of the American Academy of Pediatrics, previously told HuffPost that children can’t recover from illnesses in Border Patrol facilities. These centers are described as “hieleras” ― Spanish for iceboxes ― because of their freezing temperatures, and migrants describe sleeping on floors under bright lights that shine 24/7, with nothing but Mylar blankets to keep warm.

Gialluca met one 16-year-old mother whose 8-month-old baby was sick with the flu and forced to sleep outside for four days at the McAllen Border Patrol station. The mother said the guards took the clothing off the baby’s back, leaving her in a diaper, and forced them to sleep on concrete without a blanket.

A sick 2-year-old girl was shivering in a T-shirt and had shallow breathing, according to Mike Fassio, a Seattle-based immigration attorney who visited Ursula.

“I was very, very concerned,” he said, adding lawyers spoke with immigrants in a room outside of the facility. “When she left us, I knew she was going back to a place that was cold, crowded and unsanitary.” Fassio noted that guards referred to the children as “bodies.”

Some children were so exhausted they fell asleep during the interviews, said Clara Long, a senior researcher at Human Rights Watch who spoke with kids at a facility in Clint, Texas. Long met a 3-year-old boy who was dirty with matted hair and was being taken care of by his 11-year-old brother. She said that more than 10 sick children were being quarantined in cells.

While the group of roughly eight lawyers and interpreters at Ursula were supposed to be interviewing children about conditions in the facilities, they also ended up asking guards and government officials to bring kids to the hospital because they were so worried about their state. Gialluca added that she and her colleagues interviewed only a small portion of migrants in the facility, which is the largest processing center in the U.S. and can hold up to 1,000 people. She believes the number of migrants in need of hospitalization is likely much higher.

Government officials have blamed horrific conditions at detention facilities on the fact that Congress has not yet passed an emergency funding package that would include almost $3 billion to help care for unaccompanied migrant children. But Gialluca says border officials shouldn’t need more resources to treat immigrants like human beings.

“Money isn’t keeping guards from allowing people to access toilets,” she said. “Money isn’t causing guards to take clothing and medicine away from children.”

8-YEAR-OLD MIGRANTS BEING FORCED TO CARE FOR TODDLERS IN DETENTION CAMPS

 

A team of lawyers conducted 60 interviews with migrant children being held in an El Paso, Texas, detention camp and found conditions to be dismal.

Fifteen of those in the holding center had the flu and 10 more are quarantined with illness, according to the lawyers, who first gave the data to the Associated Press. Three infants are being detained alongside their teenage mothers, and many children are under the age of 12.

“A Border Patrol agent came in our room with a 2-year-old boy and asked us, ‘Who wants to take care of this little boy?’ Another girl said she would take care of him, but she lost interest after a few hours and so I started taking care of him yesterday,” one teenaged girl told the lawyers in an interview. The boy was not wearing a diaper and his shirt was covered in mucus, she said.

Law professor Warren Binford, who aided in the interviews, said she witnessed an 8-year-old girl caring for a 4-year-old child who was very dirty, the girl was unable to get the boy to take a shower. She also described the children she interviewed as sleep-deprived, often falling asleep while speaking with her.

“In my 22 years of doing visits with children in detention, I have never heard of this level of inhumanity,” said Holly Cooper, co-director of the University of California, Davis’ Immigration Law Clinic, to the AP.

The lawyers were inspecting the facility as part of the Flores agreement, which resulted from a landmark 1985 case that established that facilities where minor migrants are held must be kept “safe and sanitary.”

A representative of the Trump administration, the Justice Department’s Sarah Fabian, argued Tuesday that safe and sanitary conditions don’t necessarily have to include toothbrushes, soap or towels for children.

TRUMP ADMINISTRATION PLANS MAJOR ICE RAIDS FOR SUNDAY
U.S. immigration authorities plan to raid Miami, Houston, Chicago and Los Angeles and other cities. They intend to arrest up to 2,000 families, three U.S. officials with knowledge of the plans told The Washington Post. The orders reportedly come directly from President Donald Trump.

On Monday, the president tweeted: “Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in.”

Officials told The Washington Post that the Department of Homeland Security agency plans to hold families in hotel rooms until they are deported. Acting DHS Secretary Kevin McAleenan is allegedly targeting families that have completely dropped out of the court process, but has warned that the operation could lead to further cases of families being separated.

Los Angeles Police Department Chief Michel Moore confirmed the raids on Friday, saying that about 140 families in southern California will be targeted in pre-dawn raids early next week. The chief also made clear that the raids are done on a federal level and that the police department will not be involved.

On Thursday, Carla Provost, chief of the United States Border Patrol argued that the Department of Homeland Security was not receiving enough money to properly care for migrants on the southern border, and that was leading to terrible conditions in detention centers. On Wednesday, the Senate Appropriations Committee agreed to $4.6 billion in emergency funds for what the Trump administration has referred to as a “border crisis.”

Texas Congressman Joaquin Castro questioned how the agency could afford mass raids while asking for more money Friday. “The Trump Administration says it needs more money (supplemental bill) for the situation at the border yet they may be starting massive immigration raids next week. So how do you have the money for that if you’re running out of money ICE?” he tweeted.

“These potential raids are a disgusting political ploy to stoke fear and rile up Trump’s base for 2020,” wrote Sandra Cordero, Director of Families Belong Together, an immigration advocacy group, in a statement. “Past raids have left children alone and afraid in empty homes, praying they won’t be left to care for younger siblings by themselves, with no idea if they’ll see their parents again. This is yet another flagrant disregard for the welfare of children on behalf of a cruel administration bent on fomenting fear and creating chaos.”

Come on, Carla, cut the BS and butt covering. The “mix” of arrivals at the Southern Border began to shift to refugee families from the Northern Triangle back in the summer of 2014. So, CBP and DHS have had five years to prepare for this “change” which is actually “old news.” 

More “old news” is the increased flow of asylum seekers with kids which began back before Thanksgiving. Plenty of time for CBP and DHS to bring back retired asylum officers and adjudicators and reassign other adjudicative personnel to the border to insure prompt, orderly, safe, and efficient processing of asylum applicants at ports of entry, thus eliminating the incentive (or necessity) for folks to turn themselves in after crossing the border between ports.

Also, plenty of time to work with NGOs, pro bono groups, states, and communities to insure representation and proper placement of family groups in various locations throughout the country without panic or “dumping.” 

Another bogus claim spread by Trump, Provost, and the rest of the sycophants: that the prevalence of kids among new asylum arrivals is somehow totally a response to the Flores settlement (which actually has been in effect for decades).

Undoubtedly, with the Trump Administration’s active assistance, unscrupulous smugglers and coyotes are encouraging some folks to bring children as the only way to have a shot at fair processing under the tilted U.S. asylum system promoted by Trump. Indeed, as I have observed before, the Trump Administrations has consistently been a “best friend” to gangs, smugglers, traffickers, cartels, and druggies seeking to “jack up” profits by further exploiting the human misery caused by the Trump Administration’s “maliciously incompetent “ approach to immigration, effective law enforcement, and humanity generally. https://apple.news/AFQw_eqcHSZCYxUznmP0wpQ

Undoubtedly, some of these unscrupulous individuals are telling families to travel with kids. But, the truth is that according to the UNHCR, over one-half of today’s refugees are children. https://www.unhcr.org/children-49c3646c1e8.html.

So, the prevalence of children among new arrivals should properly been seen as part of a sad worldwide trend that Trump and his cronies disgustingly have done everything possible to encourage, exploit, and aggravate. It most certainly is not primarily caused by the Flores settlement or by giving soap, toothbrushes, blankets, or medical care to children being abused in the “DHS Gulag” administered in part by disingenuous folks like Provost.

Any honest observer of what’s going on knows that the majority of the asylum applications that passed credible fear probably could have been granted (or given protection under the Convention Against Torture — “CAT”) by the Asylum Office without even going to Immigration Court under the proper generous interpretation of our asylum laws, an honest interpretation of CAT that reflects the true conditions in the Northern Triangle, and a very “doable” change in procedures. 

Only dishonest fools in the Trump Administration (and a few from the Obama Administration) would maintain that gender isn’t a social group subject to widespread persecution in the Northern Triangle, deny that gangs have assumed the role of quasi-governmental entities thus making most of the harm they inflict on resisters “political persecution,” and make the beyond ludicrous claim that the corrupt failed states of the Northern Triangle have either the ability or much real interest in protecting those subject to persecution.

And, Carla, why aren’t you out there today registering a public protest of the waste of time and funds in ICE going after families with ridiculously inappropriate “raids” when every  resource could and should be focused instead on providing humanitarian assistance to asylum seekers arriving at the Southern Border?

This racist-inspired  “Sunday Morning Reign of Terror” directed at U.S. ethnic communities is specifically designed to return helpless families to the very dangerous countries from which they originally fled! Thus, Trump and his phony DHS are intentionally feeding “fresh meat” to gangs and cartels and insuring that the cycle of northward migration, no matter how dangerous, will continue until everyone who needs to leave its either gone or dead (the latter apparently the “solution” favored by Provost, Trump, Morgan, McAleenan, Miller, and others).

Provost, McAleenan, Morgan, and their co-conspirators are all participants in a cynical scheme to intentionally “crash” the asylum system, rather than competently administering it. They are intentionally endangering the lives of children and other vulnerable asylum seekers, many entitled to legal protections, to promote, along with GOP restrictionists, totally bogus, dishonest, and completely unnecessary and unwarranted restrictions of the precious, life-saving right of refugees to seek asylum in the U.S. 

It’s an unbelievably dishonest and cowardly scheme, and a complete breach of both oaths of office and public trust. It might be that those who long ago abandoned American values will lap up this insult to human values and human dignity.

But, there are plenty of us out here who know and understand exactly what you are doing. We will not only resist it, but will be historical witnesses to your cruel, inhuman, and unlawful schemes and gimmicks to “abuse and kill the innocent.” And, we’ll be keeping count.
