The WashPost article by Tim Craig is one of the more insightful pieces on migration and the border published by the “mainstream media” recently. This is a great story! Why has the Biden Administration done such a horrible job of asylum seeker resettlement? Also, seems like some missed potential for NGOs to fill the gap in getting folks to places where they are needed and will be appreciated.

 

“We are not here to reject any immigration. As a matter of fact, we want to make this the most safe, welcoming, thriving place in America, and you can’t do that without immigration,” Pittsburgh Mayor Ed Gainey (D) said in an interview, adding that he does not make distinctions on the basis of someone’s immigration status or how the person entered the country. “Why wouldn’t we want them?”

Thanks so much for your dynamic, inspirational, humanitarian leadership, Rachel! The Administration, Congress, and the media would do well to pay more attention to what experts like you are saying and reject the cruel, anti-humanitarian, false narratives that currently appear to be “guiding” the one-sided asylum “debate” in Congress!

New York City business leaders have asked the Biden administration to provide more federal aid and expedite work permits for asylum seekers. If asylum seekers could work, they would likely find their own housing, which would ease the burden on New York and other city governments. Businesses around the country seek more workers to fill positions. Advocates recommend policies that would provide a more comprehensive solution amid an historic refugee crisis that analysts consider unlikely to be addressed through enforcement-only policies.

A Plea From Businesses

“The New York business community is deeply concerned about the humanitarian crisis that has resulted from the continued flow of asylum seekers into our country,” according to an August 28, 2023, letter from the Partnership for New York City to President Biden and Congressional leaders. “We write to support the request made by New York Governor Hochul for federal funding for educational, housing, security and health care services to offset the costs that local and state governments are incurring with limited federal aid.

“In addition, there is a compelling need for expedited processing of asylum applications and work permits for those who meet federal eligibility standards. Immigration policies and control of our country’s border are clearly a federal responsibility; state and local governments have no standing in this matter. There are labor shortages in many U.S. industries, where employers are prepared to offer training and jobs to individuals who are authorized to work in the United States.”

For each of my classes in Immigration Law & Policy @ Georgetown Law, the students were required to find and report on an item relating or illustrating the topic for the class. Stuart Anderson was one of the “most reported on” sources! I think it’s because his writing is so clear, understandable, and sensible to all audiences!

Joshua Mutshaila slept in a shelter when he first arrived in Portland. Now he is studying political science at the University of Southern Maine.

Claudette Ndayininahaze could only get a cleaning job during her first years in Maine, despite extensive work experience and a degree in business administration. Now she runs a nonprofit to try to smooth the transition for other immigrant women and families.

Apphia Kamanda was one of the first students at Common Threads of Maine, a nonprofit that teaches skills needed for textile jobs. Now she leads the sewing school and teaches classes in multiple languages.

David Ngandu worked as a doctor in the Democratic Republic of Congo. He’s trying to be one again here.

They are among thousands of African immigrants who – often at great personal risk – fled perils they knew all too well at home for an uncertain future in this country. They settled in Maine, a state with a population that is 94% white and the nation’s oldest, and where businesses are increasingly struggling to find workers. They got multiple jobs, but their skills were still underutilized. Slowly and painstakingly, they built new lives, while often looking for ways to help others who came after them. In turn, they brought new life to their communities.

The Press Herald talked to a diverse group of people who came here from Africa about how they see their futures in Maine – and Maine’s future with more immigrants in it.

🗽 MAINE DELEGATION RENEWS BIPARTISAN PUSH FOR EARLIER EMPLOYMENT AUTHORIZATION FOR ASYLUM SEEKERS! — Effort Has Little Traction In Congress!

Federal and state lawmakers are renewing efforts to shorten the amount of time asylum seekers must wait before they can work and become self-sufficient.

Local officials in communities such as Portland, a destination for waves of people seeking asylum, have called on federal officials for years to reduce the waiting period for work permits, which is a minimum of six months and often much longer. They argue speeding up the process is a way to address workforce shortages as well as reduce the costs of providing financial assistance to asylum seekers who aren’t allowed to support themselves.

But every effort dating to at least to 2015, when Sen. Angus King of Maine submitted a bill to shorten the wait period to 30 days, has failed to gain traction in Congress because the appeals have been caught up in partisan and regional conflicts over immigration reform and border security.

Republican Sen. Susan Collins and Rep. Chellie Pingree, D-1st District, have proposed similar bills in recent years. And both are doing so again this session, while King, an independent, is signing on as a co-sponsor.

Despite national polarization over the issue, calls for allowing asylum seekers to work and become self-sufficient are widely supported in Maine by Republicans, Democrats and independents. The fact that Maine has more jobs available than there are workers to fill them is a key reason for the broad support.

Even former Gov. Paul LePage, who opposed efforts to help asylum seekers during his eight years in office, revised his position during the gubernatorial campaign last fall, saying at a debate in Portland that “if asylum seekers are here, and (President) Joe Biden is not going to enforce federal law on immigration … I want to put them to work.”

Collins started pushing for the reform in 2019 and announced on Friday that she introduced a bill with Sen. Kyrsten Sinema, an Arizona independent and former Democrat, that would reduce the waiting period from six months to 30 days for asylum seekers who have gone through preliminary screening. And Pingree plans to reintroduce her bill in the House in the coming weeks.

Gosh, when even former GOP right-wing Gov. Paul LePage is on board, seems like it should be a “no-brainer” for Congress. But, that isn’t the way things work (or don’t) on the Hill these days.

As to requesting a “waiver” of the current 180 day statutory “lock out” provision, there currently doesn’t appear to be any process for that. The statute does state that:  “An applicant for asylum is not entitled to employment authorization, but such authorization may be provided under regulation by the Attorney General.”

Therefore, it appears that the Biden Administration could establish a waiver process by regulation if it chose to. I’m not aware of any plans by the Administration to propose such a regulation.

The Administration has addressed immediate work authorization in their recently announced parole program for certain nationals of Venezuela, Nicaragua, Haiti, and Cuba. Individuals approved for this program abroad will be “paroled” into the U.S. for two years with work authorization.

The relief for states like Maine under this parole program is limited, because 1) only nationals of the four specified countries can apply; 2) the program applies prospectively only; 3) it’s uncertain what will happen to parolees after two years (one can imagine that any future GOP Administration would terminate the program, given that GOP politicos are now suing to halt it); and 4) the is no clear path to a green card for these paroled individuals.

To date, the Administration has not “leveraged” other potential legal mechanisms to expedite employment authorization.

One option would be to greatly expand use of the new regulatory authority for USCIS Asylum Officers to grant asylum status to applicants arriving at the border. This would result in immediate admission in an orderly, work-authorized asylum legal status and avoid the current 2.1 million Immigration Court backlog. It also would trigger a statutory process for asylees to apply for green cards after being physically present in the U.S. for one year. Additionally, granting asylum expeditiously at the AO would be available to all asylum applicants, not just those from the four specified nations.

Another option, that could be used in conjunction with the first one, would be to ramp up much more robust and inclusive refugee programs outside the U.S. This could be in the countries in crisis or in third countries. Like asylees, refugees enter the U.S. in a legal status that authorizes them to work immediately. Like asylees, they have access to a statutory provision for obtaining a green card after being physically present in the U.S. for one year. Refugee status is potentially available to refugees from any country where the President finds a “special humanitarian concern” following “consultation” with Congress.

Unfortunately, in my view, the Biden Administration has shown little interest in, nor aptitude for, maximizing the mechanisms available to legally admit refugees, from abroad or as asylum seekers. As pointed out above, doing so also would address the issues in Maine and other states who have welcomed refugees and asylum seekers. 

Instead, the Administration has relied on a mishmash of:

  1. Trump-era, nativist, deterrence policies, many with questionable legal basis;
  2. A series of ever-changing, ad hoc, subjective, discretionary “exceptions” to those policies administered without any transparency or accountability;
  3. An ad hoc, nationality specific, parole program divorced from the statutory “refugee” definition, having a much more tenuous legal basis than using the established refugee and asylum admission provisions now in the INA, and certainly leaving the future fate of those “paroled” thereunder “up in the air” and subject to maximum political gamesmanship.

The sum total is to leave too many refugees and asylees, and the individuals and communities in the U.S. trying to help them, “dangling in the air” without the necessary support and humanitarian leadership from the Administration.

The late Senator Bill Proxmire (D-WI) was a ”good government activist,” famous for his monthly “Golden Fleece Awards!” 🏆🐑 The latter were presented to recognize, or more accurately expose, “the biggest, most ridiculous or most ironic example of government spending.” 

Proxmire was Wisconsin’s longest-serving U.S. Senator (1957-89), having been elected in a 1957 special election to replace the infamous Sen. Joe McCarthy (R-WI) who died in office. (1957 was the year the then Milwaukee Braves beat the mighty NY Yanks to bring Milwaukee what remains its only World Series Championship. We were allowed to listen on the PA system at Washington Grade School, in Wauwatosa, where I was a student!) 

According to his Congressional bio, “Proxmire also set an attendance record not likely to be beaten. Over a period of more than 20 years, he did not miss a single roll-call vote, casting 10,252 consecutive votes before leaving the Senate in 1989.” https://www.senate.gov/senators/FeaturedBios/Featured_Bio_ProxmireWilliam.htm. (Actually, the record was recently broken by Sen. Chuck Grassley (R-IA), sort of, as Grassley eclipsed Proxmire’s years of service, but cast thousands fewer votes, thanks to Congress’s lackadaisical approach to governing in recent years.)

He also famously won contested re-election in 1976 spending under an inflation adjusted $1,000! “He relied upon retail politics — selling himself to Wisconsinites by shaking hands and listening to their stories — to fuel his reelection bid.” https://captimes.com/content/tncms/live/. Proxmire was a rare pol who “walked the walk!”

Sen. Proxmire left the Senate well before the creation of DHS. But, he would have had a field day with entrenched bureaucracy, lack of creativity, and spendthrift ways that have become ingrained in DHS’s poor to pathetic delivery of public services. USCIS lost its way under the malicious incompetence of the Trump Administration and such stunningly unqualified   “leaders” as Ken “Cooch Cooch” Cuccinelli. But, it has continued to “wander in the wilderness” under Biden.

David “hits the nail on the head”: with these two paragraphs:

USCIS is charging more money for less efficient work. It is not surprising that it is taking adjudicators much longer to process forms because the length of the forms keeps growing. The average form length has increased from about 3 pages in 2003—when the agency started—to about 10 pages in 2022.

USCIS should be eliminating the number of required applications and streamlining the process through electronic filing. The “discounts” for online filing that it plans on introducing hardly compensate applicants who must spend much more time using USCIS’s difficult online application portals, and regardless, online filing will remain unavailable for many types of forms. USCIS is moving too slowly to create a modern immigration system.

I’ll bet that with his brilliant mind and work ethic, Eric Holder could actually substantially improve on the alleged 13.2 minute average “adjudication” time for Form I-765.

The EAD is probably the most egregious example of an out of control bureaucracy that charges more for less service and complicates, rather than simplifies, a routine “no-brainer/low risk” function. Even the current $410 fee for an EAD is a ripoff that should be generating tons of excess cash for USCIS. Given the incomprehensible EAD backlog, in fact, the public has paid for lots of “service” that has never been “delivered.” 

In private industry, that would be a “red flag” for potential fraud, waste, and abuse. If there were a “Better Business Bureau” for the bureaucracy, USCIS be in hot — no boiling — water! 

Actually, the DHS IG and the GAO are supposed to perform this function for the Government, but have been largely “MIA” on the rapid downward spiral of the immigration bureaucracy over the past decade! In any event, nobody appears to pay much attention to their reports. They are issued, covered initially by the media, the subject of a few “political sound bites,” and then buried and forgotten (except, perhaps, by historians and scholars). 

DHS needs new creative management, an emphasis on public service, and some close oversight (something Dems conveniently ignored while they had “unified control” of Congress). Most of us “get” that Trump and his flunkies intentionally destroyed what passed for “service” at USCIS. But, that was a well-known fact going into the 2020 election.

After two years in office, whining about what the Trump kakistocracy did or didn’t do, and pointing to Congress’s undoubted dereliction of duty, is getting old. Very old!

The Biden Administration needs to get new leadership into the dysfunctional immigration bureaucracy at DHS, DOJ, DOL, DOS, & other agencies. That must be leadership with a vision, courage, expertise, and a determination to deliver great public services in a competent, timely manner without “breaking the bank” or further blaming, shaming, punishing, or burdening the public “victims” of failed government.

Additionally, the out of touch “Miller Lite Brew Crew” that passes for immigration, human rights, and security advisors at and to the Biden White House needs to be replaced with practical experts who can get the job done without breaking laws and resorting to “built to fail” gimmicks. 

Perhaps Senate Dems need much more of “Sen. Bill Proxmire’s Ghost” 👻 and far less tolerance for “Miller Lite thinking” among Congressional Dems and the Biden Administration!

Undoubtedly, once they get rolling, the “GOP Clown Show” 🤡  in the House will provide lots of unwanted “oversight” to Mayorkas and Garland. But, given the GOP’s toxic record on immigration, it’s highly unlikely to focus on solving any of the REAL problems in the immigration bureaucracy, nor will it promote better public service — something simply not in the GOP lexicon these days.

Sen. Collins introduces bill to help asylum seekers get jobs sooner

Sens. Susan Collins and Kyrsten Sinema, D-Ariz., introduced legislation Thursday to shorten the waiting period before asylum seekers are allowed to receive work authorizations.

The bill, co-sponsored by Sen. Angus King, would reduce the waiting period for work authorization eligibility to 30 days after an application for asylum is filed. It comes shortly after Rep. Chellie Pingree introduced a similar proposal in the House.

“The law currently prohibits asylum seekers from working for extended periods of time, which prevents them from supporting themselves and their families as they want to do. It also inadvertently places the burden of care on states and municipalities,” Collins, a Republican, said in a news release.

The bill comes as Maine is seeing an influx of asylum seekers to Portland, many of whom are being housed in hotels paid for with state and federal funds because of a lack of shelter space and available housing. For the week ending Feb. 5, Portland was housing 189 families, a total of 639 people, in hotels.

“Our bipartisan legislation would permit these individuals to work and contribute to the local economy while their asylum claims are being adjudicated,” Collins said. “This commonsense bill would help cities like Portland and their partners in the nonprofit community that are currently caring for a large number of asylum seekers.”

As Senator King says:  “Maine has always welcomed asylum seekers, who have made our communities stronger and richer – but current federal laws are blocking these people from pursuing a job to help them support their families and contribute to their local economies!”

The current work authorization bill system for asylum applicants and other migrants seeking relief from the hopelessly backlogged USCIS or equally out of control Immigration Courts was left in complete shambles by the “malicious incompetence” of the Trump White Nationalist immigration bureaucracy. Fixing it should have been “Day 1 Low Hanging Fruit” for the Biden Administration. After all, these are simple mostly “no-brainer adjudications” — such that they can barely be called “adjudications” at all. Basically, they require computerized records checks that most high school students probably could be trained to do efficiently in a few days. For example, the “adjudication” of an extension of work authorization is estimated to take about 12 minutes.

I’m old enough to remember the days “before the dreaded EAD” at the “Legacy INS.” Upon filing certain applications with the District Office, the officer simply stamped “Employment Authorized” on the individual’s paper I-94 card or in the passport and returned it to the  applicant on the spot. It wasn’t perfect, but it worked and was reasonably prompt, practical, functional, and inexpensive to administer.

Now, there are 31 pages of instructions for filing an Application for Employment Authorization on Form I-765. Many categories require a rather bloated $410 filling fee and others require an $85 “biometrics fee,” thus making “EAD” issuance and renewal a “profit center” for supposedly largely self-supporting USCIS adjudications. 

The only things missing from this “new improved process:” common sense, competence, efficiency, and, most of all, public service, despite Director Jaddou’s recent rewrite of the USCIS mission statement. I wish she’d spend less time thinking and talking about “public service” and more effort fixing the fairly obvious problems interfering with the actual daily delivery of public service by USCIS.

Court Vacates Two Trump-Era Rules That Denied Work Authorization To Asylum Seekers

“A federal court ruled that two rules issued by the Trump administration restricting — and in some cases eliminating — access to work authorization for asylum seekers were illegally issued and are therefore invalid.

More than a year ago, a group of nearly 20 asylum seekers along with three organizations sued the Department of Homeland Security (DHS) challenging these rules. The individual asylum seekers include transgender women, parents with small children, and children and adults who fled political persecution, gender-based violence, or gang and drug-cartel violence. The rules prevented or delayed their access to a work permit. The organizational plaintiffs — AsylumWorks, the Tahirih Justice Center, and Community Legal Services in East Palo Alto — argued that the rules derailed their missions to provide employment assistance and legal and social services to asylum seekers.

The National Immigrant Justice Center, Quinn Emanuel Urquhart & Sullivan, LLP, the Center for Gender & Refugee Studies, Kids in Need of Defense, and Tahirih Justice Center provided counsel in the case.

Plaintiffs challenged the substantive provisions that drastically curtailed access to work authorization, and they argued that the rules were invalid because purported Acting DHS Secretary Chad Wolf issued them even though he was not lawfully installed as DHS Secretary. The rules took effect in August 2020 and were partially enjoined by a different court in September 2020, but that decision left many of the rules’ harmful provisions in place. Despite these ongoing harms and despite a change in administration, the government dragged its feet arguing that the rules should remain in place “for the time being” to allow “developing administrative actions” to resolve the case.

The U.S. District Court for the District of Columbia refused to entertain these delay requests, and rejected the government’s “interpretative acrobatics” to justify Mr. Wolf’s purported authority to engage in rulemaking. Instead, the court followed numerous other courts around the country and concluded that “Wolf’s ascension to the office of Acting Secretary was unlawful.” The court also rejected the Biden administration’s attempt to ratify one of the rules in question, reasoning that the ratification “did not cure the defects … caused by Wolf’s unlawful tenure as Acting Secretary.”

Reflections from Counsel and Organizational Plaintiffs:

“The ability to earn an income is critical to asylum seekers’ ability to survive in the United States as they pursue protection from persecution,” said Keren Zwick, director of litigation at the National Immigrant Justice Center. “The court’s decision recognizes that the government cannot neglect to fill a cabinet position with a Senate-approved candidate for 665 days and then rely on unvetted, temporary officials to strip asylum seekers of access to a livelihood in the United States.”

“The court got it right,” said Annie Daher, senior staff attorney at the Center for Gender & Refugee Studies. “People seeking asylum should be treated with dignity and fairness as they pursue their legal claims. Access to work permits allows asylum seekers to provide for their families, obtain vital legal representation, and ultimately find safety and security in the United States. Today’s ruling will make a life-saving difference for our plaintiffs and for all people who turn to this country for refuge.”

“Children seeking asylum often need a USCIS-issued ‘employment authorization’ document as their only form of photo ID, to access education and other services critical to their stability and well-being during the asylum process,” said Scott Shuchart, senior director, legal strategy, at Kids in Need of Defense. “The court correctly restored access to these important documents for, potentially, thousands of unaccompanied children who will now have the opportunity to build a more secure life in the United States as they pursue lifesaving protection.”

“The right to work is an essential component of humanitarian protection,” said Joan Hodges-Wu, executive director and founder of AsylumWorks. “Work is not only imperative to economic survival; it also represents a means for asylum seekers to maintain personal dignity and self-respect during the long and protracted legal process. The court took a critical step toward upholding the rights of asylum seekers by vacating illegally-issued rules created to deter individuals and families seeking safety from harm. We applaud the court’s decision and look forward to continuing our work to help asylum seekers prepare for and retain safe, legal, and purposeful employment.”

“This decision restores the critical ability of countless survivors of gender-based violence to work, and thus be independent and provide for their families, while their asylum applications are pending—a process that often takes many years,” said Richard Caldarone, senior litigation counsel at the Tahirih Justice Center. “It also makes clear that the government remains obligated to promptly decide survivors’ requests for work authorization rather than leaving them in bureaucratic limbo for months or years. The decision takes arbitrary and punitive restrictions on work permanently off the books. We applaud the court’s decision and look forward to its immediate implementation.”

“We are thrilled that our motion for summary judgment was granted. This decision will have an enormous impact on our clients and so many other asylum seekers who come to this country seeking safety and justice,” said Christina Dos Santos, the Immigration Program director at Community Legal Services in East Palo Alto. “The Trump-era rules were punitive and cruel to asylum seekers, preventing them from receiving the right to work, potentially for years, as they waited to have their cases heard in our backlogged immigration court system. We have seen first hand how these policies forced asylum-seekers and their families into poverty and destitution. A resolution was urgently needed. We applaud the court’s decision.””

Garland’s poor judgement, legally deficient, ethically questionable defenses of illegal and inhumane Trump-era immigration policies continue to astound! Also, the inane maneuvers conducted by Mayorkas, presumably with Garland’s approval, attempting to illegally “ratify” one of these rules is simply disgraceful! Chief Judge Beryl A. Howell strongly and correctly rejected this flailing waste of Government resources in her opinion.

Chief Judge Howell’s decision describes a compendium of some of the most egregious evasions of rules and wasteful attempts to paper them over, by both the Trump and Biden Administrations, that can be imagined. It’s an appalling example of the failure of Biden’s “good government” pledge! Inflicting this utter nonsense on the Federal Courts and on individuals fighting for their lives and rights, and stretching the resources of their pro bono lawyers, is on Garland! It’s inexcusable!

The Trump Administration Will Soon Deny Work Permits For Asylum-Seekers Who Enter The US Without Authorization
BuzzFeed: The policy, which was first reported by BuzzFeed News in August, will make asylum-seekers who do not cross into the country at a port of entry ineligible for a work permit in most cases. It will also delay the time it takes for those who apply for asylum — either while already in the US or after crossing the border and referred to immigration court — to become qualified to get a work permit, from 150 days to 365 days. Asylum-seekers who do not file for protections within one year of arriving in the US will also be denied a permit.

Businesses Brace for Possible Limits on Foreign Worker Visas
NYT: Citing the economic slump, the president could act this week to limit H-1B, L-1 and other visas as well as a program allowing foreign students to work in the United States after they graduate. Representation at Bond Hearings Rising but Outcomes Have Not Improved
TRAC: Despite the rising rate of representation, bond grant rates have not improved. During FY 2015 and FY 2016, immigration judges granted bond at 56 percent of these hearings. This fell to 50 percent during FY 2018. Since FY 2018 grant rates have fallen to 48 percent where they have remained for the last three years.

DHS Acting Secretary Announces Extension of Border Restrictions

DHS Announces Imposition of Visa Sanctions on Burundi
DHS announced that it has imposed visa sanctions on Burundi “due to lack of cooperation in accepting its citizens and nationals ordered removed” from the U.S. As of 6/12/20, the Bujumbura U.S. embassy has discontinued issuance of all NIVs, with exceptions, for Burundian citizens and nationals. Just so we understand the work authorization fraud perpetrated by Trump, currently individuals who seek asylum at ports of entry are “rocketed” to the exceptionally dangerous countries of Mexico, El Salvador, Guatemala, and Honduras (none of which have a fair or functional asylum system) without any hearing, meaningful inquiry, or a chance to apply for asylum in the U.S. So, no work authorization for them.

Those who recognize the futility of trying to use our now-fraudulent legal system to seek protection might therefore cross the border and turn themselves in to DHS or, if they get to the interior, turn themselves in to USCIS to apply for asylum. They also will be denied work authorization under the latest Trump scheme.

So you, or some Federal Judge actually interested in upholding the law, might ask: “Who gets employment authorization under Trump’s shell game?” The answer: “Pretty much nobody.”

So, you might then ask, isn’t this government fraud, or at least grotesque dishonesty? Of course, but but “it’s only refugees not real humans.” For the most part, courts have allowed Trump, Miller, and company to run roughshod over the legal rights and humanity of migrants, with particular emphasis on looking the other way while refugees, women, and children are abused. So, it’s OK. Until Trump strips you of your humanity without recourse.

As if to punctuate the Constitutional malpractice and moral vapidity of everyone on the Supremes save Justice Sonia Sotomayor, on Saturday Trump headed off to Tulsa, Oklahoma, the site of one of the worst White-led race massacres in U.S. history, one day after the Juneteenth Celebration of African American liberation in America. Given the timing and the mood in the nation, it appeared to be a rather thinly disguised attempt by Trump to provoke some type of racial confrontation that he thought would benefit him politically.

Failing that, and faced with a smaller-than-expected audience of cultists, Trump turned the evening into a celebration of lies, hate, insults, and racism – denying the reality and justice of the cause of equal justice under law, using an offensive racist slur against Asians, and “joking” about 120,000 dead Americans and his totally incompetent response to COVID-19, to name just a few of his very public and intentional transgressions against our nation and human decency.

America can’t go any further with Trump and the GOP in charge and promoting an agenda of racism, hate, division, and inequality. But, it’s also worth asking how far we can get with eight Justices who are willfully blind to Trump’s obvious racism, his and his lawyers’ lack of honesty and ethics, and the toxic agenda of prolonging and deepening institutional racism in America that he and his supporters so ardently back and, to be frank, only exists because the Supremes and other government institutions have assisted it for more than a century.

Over more than two centuries, America has failed over and over again to deal honestly, ethically, courageously, and realistically with racism. At some point, the failures will become fatal for our republic. A house divided against itself and with rot in its structural integrity cannot stand for much longer.

Those in charge might claim cluelessness; but you should have your eyes open to the pernicious effects of malicious incompetence and systemic racism.

Some day, the full ugly truth of the Trump regime, its unbridled racism, its total dishonesty, its selfishness, its cowardice, its “crimes against humanity,” and our disgraceful national complicity will come out. It always does. Then, those in charge who were derelict their duties and looked the other way in the face of tyranny and needless human suffering will claim “just doing my job” or “how could I have known?” Don’t let them and/or their apologists get away with the “Nuremberg Defense!”  We know; they know! It’s time to end the willful blindness and deal with the truth!

I have been getting “unverified hearsay” reports from Courtside readers and others across the country that an emboldened and now totally unrestrained Trump regime actively is planning an all-out extralegal, extrajudicial onslaught against established asylum laws. It’s likely to claim the lives of many of the most vulnerable and deserving asylum seekers in the United States.

 

Predictably, this atrocious attack on humanity and human dignity is the “brainchild” of newly married neo-fascist White Nationalist hate monger Stephen Miller. Although unconfirmed, these reports have come from diverse enough sources and sound so consistent with the regime’s nativist, xenophobic approach to asylum that I, for one, give them credence. It’s time to start sounding the alarm for the regime’s latest vile assault on the rule of law and our common humanity!

 

I have gleaned that there is a 200-page anti-asylum screed floating around the bowels of the regime’s immigration bureaucracy representing more or less the nativist version of the “final solution” for asylum seekers. The gist of this monumental effort boils down along these lines:

 

[W]ould ban the grant of asylum claims involving PSGs defined solely by criminal activity, terrorist activity, persecutory actions, presence in country with generally high crime rates, attempted recruitment by criminal, terrorist, persecutors, perception of wealth, interpersonal disputes which government were not aware of or involved in and do not extend countrywide; private criminal acts which government was not aware of and do not extend countrywide; status as returned from U.S. and gender. Note the inclusion of “gender” at the end.

 

Thus, in one “foul swoop” the regime would illegally: 1) strip women and the LGBTQ community of their decades-long, hard-won rights to protection under asylum laws; 2) eliminate the current rebuttable regulatory “presumption of countrywide future persecution” for those who have suffered past persecution; 3) reverse decades of well-established U.S. and international rulings that third party actions that the government was unwilling or unable to protect against constitute persecution; and 4) encourage adjudicators to ignore the legal requirement to consider “mixed motivation” in deciding asylum cases.

 

There is neither legal nor moral justification for this intentional distortion and rewriting of established human rights principles. Indeed, in my experience of more than two decades as a judge at both the appellate and trial levels, a substantial number, perhaps a majority, of the successful asylum and/or withholding of removal claims in Immigration Court involved non-governmental parties and/or gender-based “particular social groups.” They were some of the clearest, most deserving, and easiest to grant asylum cases coming before the Immigration Courts.

 

At the “pre-Trump” Arlington Immigration Court, many of these cases were so well-documented and clearly “grantable” that they were “pre-tried” by the parties and moved up on my docket by “joint motion” for “short hearing” grants. This, in turn, encouraged and rewarded multiparty cooperation and judicial efficiency. It was “due process with efficiency, in action.”

 

Consequently, in addition to its inherent lawlessness, cruelty, and intentional inhumanity, the regime’s proposed actions will stymie professional cooperation between parties and inhibit judicial efficiency. This is just one of many ways in which the regime has used a combination of wanton cruelty and “malicious incompetence” to artificially “jack up” the Immigration Court backlog to over 1.3 million pending and “waiting” cases, even with the hiring of hundreds of additional Immigration Judges.

 

In a functioning democracy, with an independent judiciary, staffed by judges with knowledge, integrity, and courage, you might expect a timely judicial intervention to block this impending legal travesty and humanitarian disaster as soon as it becomes effective. But, as Justice Sotomayor recently pointed out in a blistering dissent, Chief Justice Roberts and his four GOP colleagues appear to have “tilted” in favor of the regime.

 

They can’t roll over and bend the laws fast enough to “greenlight” each new immigrant-bashing gimmick instituted by the regime. Moreover, as I’m sure is intended, once these new anti-asylum regulations are railroaded into force, the USCIS Asylum Offices will deny “credible fear” in nearly all cases, thus preventing most asylum applicants from even getting a day in court to properly challenge the regulations. All this will happen while the life-tenured Article III Courts look the other way.

 

For Stephen Miller, the coming Armageddon for defenseless asylum seekers must represent the ultimate triumph of fascism over democracy, hate over reason, and racism over tolerance. Miller was recently quoted in a New Yorker article about how screwing asylum applicants, and presumably knowing that they and their families would suffer and die, be tortured, or be otherwise harmed by his unlawful acts, was, in effect, his “life’s dream.” “It’s just that this is all I care about. I don’t have a family. I don’t have anything else. This is my life,” said Miller after a meeting in which he had promoted a fraudulent “Safe Third Country Agreement” with El Salvador, a country he acknowledged was without a functioning asylum system.” https://slate.com/news-and-politics/2020/02/stephen-miller-immigration-this-is-my-life.html.

 

It appears that even Miller’s forlorn “love life” has taken an upturn. Although the Trump Administration has been a “coming out party” for racists, White Nationalists, and White Supremacists of all stripes, the “hater dater circuit” has remained somewhat “restricted.” Evidently, not everyone “gets off” on the chance to get “up close and personal” with “wannabe war criminals.”

 

Nevertheless, in the middle of all the suffering he has caused, Miller finally found somebody who apparently hates and despises humanity just as much as he does, in Vice Presidential Press Secretary Katie Waldman. They were recently married at the Trump Hotel in D.C. with the “Hater-in-Chief” himself attending the festivities. How can America “get any greater,” particularly if you have the good fortune not to be a refugee condemned to rape, torture, abuse, family separation, beatings, disfiguration, burning, cutting, extortion or other horribles by this cruel, scofflaw, and “maliciously incompetent” regime?

Unfortunately the comments are being flooded by uninformed, irrelevant, blatantly anti-immigrant, pro-Trump comments on the proposed regulation, such as:

By way of background, as a result of the Rosario litigation, USCIS is now adjudicating initial asylum EAD applications within 30 days. In response, USCIS has proposed to simply eliminate the 30-day deadline. This proposed rule will harm asylum seekers and their families, and USCIS even estimates it will lead to $100s of millions of lost tax revenue.

Using this template, I submitted my opposition to this outrageous proposal which would actually destroy human lives as well as cost the U.S. economy hundreds of millions of dollars. It took fewer than five minutes.

 

Obviously, the human and economic costs of xenophobic bias are astronomically high. But, that’s of no apparent concern to “White Nationalist Nation,” which is willing to pay anything to screw America and the most vulnerable among us!
