⚖️😎 THE BLUM REPORT: Roberto Covers A “212(c) Redux” In Houston, Highlighting Garland’s Disturbing Failure to “Harvest The Low Hanging Fruit” 🍒 @ EOIR!

Hello Judge, it has been a while since I reported from Houston. Although I have not reported, I have kept reading (and learning from) your writings. So it was a pleasant surprise when I recently came across some BIA decisions and saw your name written on them.

They are Matter of Arreguin, 21 I&N Dec. 38 (BIA 1995) and Matter of Fuentes-Campos, 21 I&N Dec. 905 (BIA 1997).

You see, I was preparing for a individual hearing on the merits, where the client, a 65-year old Mexican national, who has lived in the U.S. since about 1979, and was admitted as a Legal Permanent Resident in 1991, was found to be deportable under INA section 237(a)(2)(b)(i) due to a controlled substance conviction from 1994. His relief: Section 212(c).

The saga started in early January 2012, when he was encountered by ICE, was detained, and placed into removal proceedings. The firm I work for began to represent him at that point. While waiting for his detained merits date, the client suffered a medical condition and was not expected to survive, so ICE released him to family members, essentially so he wouldn’t die in their custody. However, he did not die, he survived, and made a full recovery.

Fast forward to today. Ever since his release, his case got stuck in the “aimless docket reshuffling” that you so often write about. It was not until today, June 28, 2023, that he finally got his day in court for an immigration judge (IJ) to consider his case.

Not knowing whether the assigned IJ or DHS trial attorney (TA) would have any experience with Section 212(c) because this is an old type of relief that is not very common anymore and also due to the hostility often encountered at Houston EOIR, I prepared for the worst case scenario, and feared that the client might not get a fair shake.

Fortunately on the day of trial, I saw an experienced TA was representing the government. Before the IJ went on the record the TA and I discussed the case, and the TA told me that he did not have any issues with the case. I asked if he would stipulate to a grant of relief and he said yes, but warned the IJ might still want to take testimony. The IJ came on the record shortly thereafter, and asked if we had any agreements, at which point I told the IJ that we had an agreement for stipulation to a grant of relief because the evidence submitted was sufficient to carry our burden. The TA confirmed our agreement, and the IJ responded that she had reviewed the record, and also agreed that the client was eligible and deserving of relief because of his long-time physical presence, the conviction was very old, and the client had not had any recent criminal history.

In less than 5 minutes, this case that had been pending over 11 years and 5 months (or about 4,184 days), was resolved by agreement of all parties! The client was stunned and did not even know what happened. He did not expect it to be this fast after waiting so long. The client confided in me that his mother passed away a few days ago in Mexico, and he had been very worried because all of his witnesses (family members) went to Mexico to attend the funeral and were not available to testify on his behalf. I remembered something my grandmother would tell me as a child, that when a close loved one dies, they go to heaven and become your guardian angel, so I thought… just maybe… his mother had been his guardian angel today and whispered in the TA and IJ’s ear before the hearing.

In all seriousness, I ask myself (as this is not the only case I have had that has been pending for over 10 years, only to be resolved by stipulation at the final hearing in less than 5 minutes) how much $$$ is the government spending to fight a case like this for more than a decade–only for it to be resolved in 5 minutes of discussion. (Of course if it had not been resolved favorably, we would have continued litigating the case and appealed to the BIA, something that under current wait times would last another 3 or more years and who knows how much more resources). I imagine that between the IJ and TA’s salary, the court staff, support staff, and even utilities of operating a court, the price tag might be well above $100,000 for a case like this. This is not sustainable.

I asked the client for permission to share the photo we took after the hearing, and if I get the permission I will share it with you.

I am glad the case was resolved favorably by agreement, however, I was ready to use your cases to help defend my client.

Matter of Arreguin, written by the late Judge Fred W. Vacca,  was one of the first precedents issued, in Volume 21 of the I&N Dec., during my time as BIA Chair. That Volume also reflected the “new style” of BIA precedent format with the “bound volume” citation and pagination available in the “slip opinion” and the individual author of the majority and separate opinions clearly identified. 

Always gratifying to see that the now “old” precedents turned out by the long-gone “Schmidt Board” still have something to say and teach. It was a time when intellectual dialogue and meaningful debate of important issues was encouraged, rather than being discouraged and avoided as has happened in today’s “assembly line culture” at EOIR!

Additionally, Roberto’s report raises a continuing question. What if rather than misusing EOIR as a “deterrent,” and thereby engaging in “Aimless Docket Reshuffling,” Garland and the other “powers that be within the Administration” returned EOIR to its original purpose of insuring due process, fundamental fairness, and best, most efficient judicial practices? 

I’m sure there is lots of “low hanging fruit,” 🍒exemplified by this case, that could be prioritized for quick disposition or reassigned to a better-functioning version of USCIS for more efficient completion. Indeed, with guidance and some institutional discipline by a “Better BIA” of true asylum expert Appellate Judges, I’d guess that the majority of the hundreds of thousands of asylum cases pending for more than two years could be granted without full hearings, either at EOIR or a better functioning Asylum Office. Additionally, many of the long-pending “Non-LPR Cancellation Cases” now clogging the EOIR docket could be more efficiently handled by a better functioning and better staffed USCIS.

It appears that nobody with any realistic vision of what the future could and should look like, and an appreciation of both the cosmic importance and great positive potential of a functional EOIR, has paid any attention to 1) the composition of the EOIR backlog, 2) the abundant opportunities for positive resolutions that would benefit everyone, 3) the lack of quality control at today’s EOIR, and 4) the glaring absence of practical problem solving skills among senior EOIR management and the BIA (not to mention DOJ management and leadership in this area, such as it is).

Meet the two Texas attorneys behind the Children’s Immigration Law Academy

Dalia Castillo-Granados and Yasmin Yavar. So far this year, the Children’s Immigration Law Academy has responded to more than 300 legal technical assistance questions. It has coordinated five in-depth virtual trainings and hosted eight webinars that attracted more than 1,600 attendees.

Dalia Castillo-Granados had just begun her fellowship with the St. Frances Cabrini Center for Immigrant Legal Assistance, a program of Catholic Charities of the Archdiocese of Galveston-Houston, when she met Yasmin Yavar in 2008.

Like Castillo-Granados, Yavar focused a lot of her attention on special immigrant juvenile status cases as the pro bono coordinator of Kids in Need of Defense’s new office in Houston. Despite changes in the law that allowed more children to apply for this form of immigration relief—which gives those who have been abused, neglected or abandoned a pathway to lawful permanent residence in the United States—attorneys were just beginning to test the waters in this area.

After collaborating on a case, Castillo-Granados and Yavar stayed in touch and created their own support system.

“There was a very small community of attorneys, even nationwide, representing unaccompanied children,” says Castillo-Granados. “In Houston, Yasmin and I were trying to get into state court and educating judges about why we were there. We had each other on speed dial, calling to talk over strategy and get suggestions and push the cases forward.”

Several years later, as an increasing number of unaccompanied children crossed the United States-Mexico border, Castillo-Granados and Yavar wanted to support the legal service providers and volunteer attorneys who were taking their cases. They drafted a plan for a legal resource center focused on children’s immigration law, and Yavar, who had worked with the ABA’s South Texas Pro Bono Asylum Representation Project in Harlingen, Texas, shared it with Commission on Immigration Director Meredith Linsky.

At the time, Linsky met regularly with the ABA Working Group on Unaccompanied Minor Immigrants. Its members liked the idea, and in September 2015, Linsky helped Castillo-Granados and Yavar launch the Children’s Immigration Law Academy.

“We decided to do exactly what we did for each other back when we were starting, but for everyone else,” says Castillo-Granados, who serves as CILA’s director.

Here’s an interesting contrast in problem-solving, creative thinking, dynamic leadership, and effectively using resources. Between 2008, when they met, and 2021, Dalia and Yasmin experienced an approximately 15X growth in the number of unaccompanied children, from 8,000 to 120,000. Faced with this stressful situation and a U.S. Government that under Administrations of both parties has displayed a rather callous indifference to child welfare, it would have been easy to give up and take their talents to another area of law!

Because they worked for an NGO, the couldn’t demand more resources or claim that drastic reductions in children’s rights, harsher enforcement, or “deterrence” were the “only solutions.” Interestingly, these were exactly the type of “rote, alarmist, reactionary reactions” that the Obama Administration had and that the Trump Administration tried to “implement” without the benefit of legislation.

Dalia and Yasmin viewed the problem as challenging, yet solvable, came up with a plan, and sold it to other members of the legal community — on its merits, not its “scare value.” They were able to “leverage” their experience, skills, and dynamic leadership to pool resources, create teamwork, and “teach and inspire others to help those in need.” 

They actually expanded, improved quality, and increased efficiency, thus multiplying rather than diluting their effectiveness. The also relied largely on existing tools and frameworks, but “leveraged” them in a creative and more efficient manner.

I submit that this is the exact opposite of how the broken bureaucracies at DHS, DOJ, and ORR have reacted to most immigration issues. Given lots of personnel, considerable resources, a workable, if not “perfect,” legal framework, and ample flexibility to redirect and repurpose wasted or misused resources, the last three Administrations have fallen “flat on their overstuffed and moribund bureaucratic faces.” 

With billions in taxpayer dollars, thousands of employees, and a legal framework that actually provides plenty of useful options, the USG has underachieved, to put it charitably. It has fallen back on wasteful, disruptive, and inefficient “proven to fail” deterrence “gimmicks;” ludicrous rhetoric; mythical threats; aimless reshuffling and churning of existing workload; bolloxed priorities; victim shaming and blaming; cruelty; and most disturbingly, massive scofflaw actions, crackpot proposals, and blatant curtailment of important human and legal rights.

To make matters worse, at least the Biden Administration has had access to what is probably the greatest “talent pool” of human rights, immigration, and child welfare experts on the face of the earth — almost all of it in the private/NGO/advocacy/academic sectors! Yet, they have resisted sound expert advice and creative solutions, while largely passing over available dynamic and inspiring leadership to overstuff their bloated immigration bureaucracy largely with a mixture of Trump holdovers, Obama retreads, and lesser lights. 

Obviously, talented NDPA superstars like Dalia and Yasmin are the wave of our future — not just in immigration and human rights, but in government, politics, our legal system, and American society! The issue is how we can force unwilling, “stuck in reverse” Dem Administrations to grow some backbone, enforce the values they espouse during elections, “clean house” in the bureaucracy and the ranks of ineffective, often clueless, politicos, and “repopulate and reform” the USG immigration bureaucracy and the beyond dysfunctional Immigration Courts with stars like Dalia and Yasmin. That is, courageous, visionary, experts who can actually solve problems rather than creating new ones and blaming the victims and those striving to hep them!

Here’s another remand you might like to read. This time it was Nexus and PSG with IJ Monique Harris (previously in Houston). According to TRAC she has a 96.5 asylum denial rate. The prior remand I shared was IJ Khan who is at 97% denial rate. Clearly these IJs are getting a lot of “matter of life and death” decisions wrong. As you say, haste makes waste. This case (like the previous one) should have been easy grants with all of the supporting documents that were included. I appeared at the individual hearing and my colleague Bryan Russell Terhune (from the same office) worked on the BIA Brief.

P.S. you can see this news article:  https://sv.usembassy.gov/court-inaugurated-memory-pnc-agent/ ,  from our own U.S. Embassy in El Salvador where they inaugurated an athletic court in the Usulutan Police Delegation, named after the PNC officer Nelson Panameño, who was killed. Panameño was one of the instructors from the Gang Resistance Education and Training Program (GREAT) which my client closely worked with for many years helping him and the PNC gain trust with the community and local youth. This was part of the record, plus a lot more evidence showing this specific connection and the specific and imminent warnings that Panameno gave to my client before his own murder. This was just one of the many great things this client did in El Salvador to try and make his country a better place. We are lucky to have him and his family in this country now.

This was just one of the many great things this client did in El Salvador to try and make his country a better place. We are lucky to have him and his family in this country now.

That this respondent is here to contribute to our country is due to Roberto and his colleagues in the Law Office of Juan Reyes, Houston, and to this particular panel of BIA Appellate Judges. But it is “no thanks” to the IJ who got this case egregiously wrong below!

Nor, is it thanks to an Attorney General who has allowed injustice, bad judgment, and poor quality decision-making to flourish at the “retail level” of his wholly-owned “court” system. What about the many folks who don’t have Roberto or someone like him for a lawyer or who get members of the “BIA asylum deniers club” appointed under Trump to “pack the BIA for an anti-asylum agenda” instead of this panel of conscientious appellate judges?

I note that Judge Elise Manuel and Judge Denise Brown are currently denominated “Temporary” Appellate Judges. At least in this case, along with Judge Ellen Liebowitz, they “got it” at a level at odds with the work of too many of their so-called “permanent” colleagues. Why has Garland allowed this obviously problematic situation to continue to fester with human lives at stake?

Judge Ellen Liebowitz’s compact, cogent, powerful opinion is a terrific “mini-primer” on how PSG and “one central reason” nexus cases properly should be decided! As Judge Liebowitz demonstrates, you don’t have to write a lot to say a lot. You just have to know what you’re doing!

The gross, fundamental errors in the application of basic statutory terms by the IJ below in this case are, unfortunately, repeated on a regular basis by many of her colleagues across America who are improperly “programmed to deny” clearly grantable asylum cases.

It belies the bogus claim that EOIR is an “expert subject matter tribunal!” That expertise is, at least in part, what the questionable doctrines of “Chevron deference” and “Brand X abdication” by the Supremes rest upon. Shouldn’t it make a difference that in EOIR’s case, it’s a lie?

Why is Garland allowing this to happen when it could be remedied? Make this case a precedent and start removing, retraining, or reassigning so-called “judges” who don’t follow it and who continue to disregard the law and the rights of asylum seekers! 

Why isn’t this case a precedent? Why is an IJ who is so clearly unqualified to decide asylum cases still on the Immigration Bench under Garland? Why aren’t cases like this being used to end the “asylum free zone” improperly established by some Houston IJs?

These are the “tough questions” that Garland should have addressed. Why hasn’t he? Why is “refugee roulette” still plaguing EOIR and American justice — 15 years after the problem was first “outed” by my Georgetown Law colleagues Professors Schrag, Schoenholtz, and Ramji-Nogales? How is this “good government,” or even “minimally competent government?”

When compelling, well-documented cases like this are turned down at the trial level, something clearly is rotten in the system! Make no mistake about it, lack of expertise, bad judicial attitudes, widespread anti-asylum bias, counterproductive “haste makes waste gimmicks,” and way, way too many denials are significant “drivers” of the backlog that continues to mushroom under Garland.

The arbitrary and often grotesquely unfair, unprofessional, and results-driven state of “justice” in Garland’s dysfunctional Immigration Courts was recently highlighted by Brooklyn Law Associate Dean Stacey Caplow in her lament about the Supremes’ abdication of responsibility in Patel v Garland.

As Dean Caplow cogently points out:

Patel shuts the door firmly and unequivocally, preventing independent review of fact-finding by Immigration Judges, however irrational and indefensible once the Board of Immigration Appeals has affirmed. This makes the need to populate the Immigration Court bench with independent, highly qualified, experienced, non-political unbiased individuals with appropriate temperament even more urgent. Perhaps this case will provide new impetus for reform such as Real Courts, Rule of Law Act of 2022 voted by the House Judiciary Committee in May just days before the Supreme Court’s decision.

While an independent, subject matter expert Article I Immigration Court is the obvious answer, unfortunately, it’s not immediately on the horizon. Meanwhile, the innocent and vulnerable continue to suffer daily injustices, sometimes gratuitous humiliation or dehumanization, in Garland’s broken system. It DOESN’T have to be this way!

As Dean Caplow says, we “need to populate the Immigration Court bench with independent, highly qualified, experienced, non-political unbiased individuals with appropriate temperament.” It’s not “rocket science” 🚀— just intellectual excellence, courage, and a fair-minded approach to justice!

There are literally hundreds of extraordinarily well-qualified individuals out there in the private sector who could outperform the IJ in this case in every critical aspect of the job! Why hasn’t Garland actively recruited them for his courts? Why isn’t his system functioning correctly “on the retail level?”

Garland has the authority to take the bold action necessary to redirect, refocus, and re-populate his current parody of a court system to laser-focus on due process, fundamental fairness, judicial expertise in immigration and human rights, and efficiency (without sacrificing due process or decisional excellence). All of us who care about the future of American justice should be asking why he isn’t doing his job!

Just think how much better this system would work if Immigration Judges were getting guidance from the BIA to get these correct in the first place. 

Also raises additional questions of why: 1) cases like this aren’t precedents; and 2) so-called “Temporary” Appellate Immigration Judges like Judge Gabe Gonzalez are “outperforming” most “permanent” BIA Judges?
