To no one’s surprise, this past week the bipartisan border bill, creatively named “The National Security Act, 2024” and introduced by an all white cast of Senators, failed to pass the chamber. Many Democratic Senators who once stood beside immigration advocates at rallies to push back against the proposal fell in line with their president and voted in favor of a flawed and dangerous bill that would fall short of mitigating migration. None but the beltway nerds and press were paying attention to C-SPAN as the proposal died, triggering Democratic political operatives to salivate over the “gotcha” vote that’ll be used against Republicans on the campaign trail.

For many of us battle-tested, seasoned advocates, there was no true satisfaction at seeing Republicans implode or an undesirable proposal fall apart. Hanging above our heads like a Florida cockroach threatening to fly into our faces was the fact that the Biden administration, Majority Leader Chuck Schumer, Senator Chris Murphy, and Democrats who voted for the bill had officially moved the goalpost on immigration.
‘Tis a slippery slope to empower the nation’s president to shut the border down to block asylum seekers and codify measures to make it nearly impossible to claim asylum and easier and faster to deport people back to dangerous conditions while hoping a developing nation with its own set of serious problems cracks down on vulnerable children and families seeking safety and refuge. To be okay with all of this means you’ve – as Isabel Wilkerson so aptly wrote – gone through a “process, a programming” to dehumanize both the issue and those at our doors, begging for shelter and freedom.
And look I get it. I’ve heard the rhetorical, exasperated questions: what else are Democrats supposed to do when migrants keep coming to the border? When Republicans keep hammering us on the border? And Chicago and New York are struggling to manage those bussed into the cities? And in a pivotal election year, these questions carry an extra ounce of GTFO.
And to them I say – I hear you. I’m listening. I’m worried, too. But I’m not concerned about the tenacity and brilliance of local leaders and NGOs on the ground working to help newly-arrived immigrants to settle in this powerful and abundant country. Or least of all anxious over visionary funders and creative mayors and governors seeking ways to welcome new settlers into regions eager for consumers and workers. I’m not even worried about Trump and Republicans relentlessly attacking Democrats on the campaign trail – it’s nothing new.
What I am truly troubled by is Democrats choosing flight over fight.
The current conundrum that President Biden and Democrats find themselves in goes beyond the challenges of global migration. Since 2017, Democratic messaging has been devoid of pro-immigrant messaging. Were it not because of the loud cries of a toddler separated from her mother and the incredible journalistic accounting that shook the soul of America did it spring even moderate Democrats into action. But, when it came to political advertising and a constant drumbeat of both values-based immigration messaging and Republican accountability on the issue, you had to search far and wide to find solid examples. Thanks to the David Shor’s of the political class, most Democrats chose to avoid the issue, leaving a vacuum gladly filled by Stephen Miller types.
The Democratic choice to neither proudly display their position on immigration or celebrate the immigration wins has left the American people believing they’re for “open borders” or wondering where they stand on the issue and have they done anything on it? What’s worse, they consistently fail to counter their opponent’s radical, Trumpian rhetoric and anti-immigrant ideas. While racist and radical media and online influencers, such as Tucker Carlson, yell anti-immigrant obscenities and the GOP spend millions upon millions trying to convince Americans that immigrants are bad people who are trying to replace them, infiltrate their communities with drugs and crime, and steal their jobs and social security, Democrats have responded by pivoting to other kitchen table issues.
The gradual damage of this messaging to America’s psyche and perception of the other – immigrants – has created the current moment. Now, even reporters from major news outlets are asking me why and how Trump dismantled our immigration system and what actions President Biden had taken to restore the system. The first question often leaves me baffled, for how quick we forget the heinous wrongs of the past, and the second is no surprise, just sad.
It’s really disappointing that not many people, reporters included, don’t know that the Biden administration has taken over 500 actions that have had such a positive impact on women, families, children and workers in the U.S.
No Democrat should be afraid of their immigration shadow. It’s time to stop running away or running to the right of the issue. You can be sensible without spite. Until Republicans can treat the cancer that is Trump, Democrats have to go to bat for the issue with gutsy resolve, bold solutions and radical empathy. They have to be in it for the short and long game. Like investing in an index fund or supporting reproductive rights or gay marriage, it’ll pay off to tell Americans and Republicans that Democrats stand for an immigration system that lives up to our values and meets our nation’s economic demands, that we’ll secure our border with smart and humane solutions – not band-aids that create chaos and jeopardize lives – that we’ll do whatever it takes to deliver a path to citizenship for Dreamers and hard-working immigrants who have waited too long for our government to act, and that we’ll fight like hell against Trump and anyone who threatens to separate families, deport our neighbors en masse, and divide our communities.
No one is immune to mistakes or bad votes. For Democrats, this is a moment to reflect and admit you fucked up. Now do better. Yes, use the vote to hold Trump and Republicans accountable – but don’t you dare use that bill as a model for legislation or campaign rhetoric.
You can’t out-Trump Trump.
Humanize the issue. Show courage and compassion. Talk solutions. Remind voters what and who you stand for and what’s at stake if Trump and anti-immigrant Republicans have it their way. Be disciplined and keep repeating. Throw some money behind that messaging. And I promise you, you’ll win.

Case in point: A very recent Congressional Budget Office (“CBO”) study reaffirmed what those who work with migrants have always known: Directly contrary to the GOP and media myths, migrants of all types — regardless of status — are a huge source of economic growth for America. They will help fuel a $7 trillion boost in the U.S. economy over the next decade!See, e.g., https://time.com/6692645/immigration-economy-us-gdp-growth-cbo-report/.
But, you sure wouldn’t know this from the one-sided “debate” about migration going on today. The GOP spreads (and the media promotes, largely without critical analysis) blatant lies and myths about the largely fabricated and often self-created “burdens” of migration (see, Abbott, DeSantis). Yet rather than rebutting them and embracing truth, Dems basically look the other way and try to change the conversation.
This has caused them to “run away from” and “downplay” one of the Biden Administration’s most important positive achievements — functioning parole programs that move migrant flows from the “irregular” to the “regular!” Moreover, that processing takes place in advance, outside the United States, rather than adding to the border pressure or becoming part of the overhyped asylum backlog resulting from poor performance by Administrations of both parties and Congress over decades (but hugely aggravated by the Trump kakistocracy). Even the immediate work authorization problem is solved by the advance parole programs.
Are these programs perfect? No, they are far too limited both in terms of numbers and scope of eligible nationalities. They also don’t answer questions about the long-term fate of those paroled. But, they are certainly a step in the right direction that could be built upon and “model” the case for more durable long-term legislative expansions of visa programs.
The GOP’s irrational attacks on what is working and helps our country and the world shows just how little they care about solving problems or the long-term prosperity, stability, and strength of our nation. Yet, the largely indisputable benefits of parole and the willingness of the Administration to engage in creative and successful problem-solving gets scant mention from either the Biden campaign or Congressional Dems.
And, the media is no better. Given the current high-profile of immigration on the national scene, one might reasonably have expected “front page coverage” of the CBO report and findings, particularly since it directly contradicts many of the false claims raised by both parties during the recent failed “Senate compromise” proposal. Instead, even I had to do some “digging” to come up with articles featuring the CBO report.
Curiously, the GOP plays to the most extreme, dangerous, and unreasonable elements of its far right base.
Conversely, Dems run against the values and views of some of the most reasonable, dedicated, and energizing elements of their progressive base.

Lots of power and truth in five sentences. Let’s celebrate Black History Month by embracing and understanding what right wing politicos don’t want you to know about our nation, how we got to where we are today, and how we can finally achieve the long-unfulfilled promise of “equal justice for all!”
People close to Mr. Biden said he had always supported enforcing the law. Some of his top aides, such as Susan E. Rice, who served as his domestic policy adviser until last summer, and Jake Sullivan, his national security adviser, embodied that tough-minded approach.
“Migrants and asylum seekers absolutely should not believe those in the region peddling the idea that the border will suddenly be fully open to process everyone on Day 1,” Ms. Rice had said early on in Mr. Biden’s presidency.
Contrary to these border myths, which the NYT article does not really adequately take on, “the law” requires that individuals be given a chance to apply for asylum regardless of “status” and “entry point.” Congress provided a “quick screening” process called “credible fear” to deal with “mass migration” situations.
Assuming for the sake of argument that “the law” also requires that individuals be “detained” while credible fear screening and adjudication of claims by those who pass takes place, four elements are necessary for the legal system to work in a fair and timely manner.
Humane, NGO-operated reception centers, with on-site representation available, in locations preferably removed from the immediate border for screening to take place;
A huge corps of true expert Asylum Officers to do credible fear screening and outright grant clearly valid cases wherever possible;
A large corps of true expert Immigration Judges and BIA Appellate Judges to guide Asylum Officers, review their work, and, where the case can’t be granted at first instance, conduct timely full adjudication of claims for those who pass credible fear, prioritizing those claims most likely to succeed;
A functional resettlement program for those granted asylum and those whose cases require more in-depth process.
These four steps are the core of what real law enforcement at the border is all about! Prioritize them, accomplish them, and the other pieces will fall in place.
Contrary to Susan Rice, Jake Sullivan, and what the NYT article suggests, a plan to accomplish this 1) isn’t rocket science; 2) does not require legislation; and 3) needed to be “ready to go” with dynamic, courageous, due-process-focused leadership on Day 1 of the Administration or very shortly thereafter.
As always in Government, it’s a question of priorities, courage, and leadership. Despite the “overabundance” of proven, creative legal and administrative talent then in the private sector, most of whom were available to assist Biden, the Administration was not “ready to roll” with this program on Day 1 (as Steven Miller was with his vile “kill asylum and asylum seekers” agenda).
Sadly, even today, the Administration has not come close to putting in place any of these four critical requirements for success. It was highly predictable to any informed expert that forced migrants would continue to arrive at the border in large numbers and that GOP White Nationalists would “leverage” the Administration’s failure to achieve order at the border.
There is something else that’s completely predicable: That, if passed (a big if), the “nativist-driven compromise” now being “debated” by Congress and the Administration will NOT solve the humanitarian issue of forced migration BUT WILL create more death, trauma, and failure at the border and beyond.
Until America elects humanitarian-focused, problem-solving leaders with the vision to regularize fair asylum processing and the courage and skills to implement it, our border will continue to be a godawful mess: Just as GOP White Nationalists want! And, the great opportunity presented by talented asylum seekers who want only to save their and their families’ lives while helping us succeed will be squandered.
The long-awaited bipartisan Senate deal on immigration contains no real reforms, such as a pathway to citizenship for undocumented immigrants. It’s all about “securing” the border.
Biden and Senate Democrats have caved to Senate Republican hardliners. Among other restrictions, the bill would make it much harder for people to apply for asylum.
On Friday evening Biden called the bill “the toughest and fairest set of reforms to secure the border we’ve ever had in our country.”
Then Biden went further — endorsing a full border shutdown. He said the bill “would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”
I very much doubt Biden would shut the border if he signs this bill into law.
So what’s going on here? The underlying politics here has nothing to do with funding Ukraine. It doesn’t have to do with reforming immigration. It doesn’t even have much to do with the practical challenge of securing the border.
It has everything to do with the 2024 election, in which border security has become a big issue.
The nation does have to take reasonable action to stem the illegal flow of immigrants. But Trump has stoked American’s fears with lies (see below).
Trump and Biden are engaged in a giant pre-election kabuki fight over the border.
Biden wants to take the border issue away from Trump and figures this bill will do it. Which is exactly why Trump doesn’t want the bill enacted. “As the leader of our party, there is zero chance I will support this horrible, open-borders betrayal of America,” Trump said on Saturday. “It’s not going to happen, and I’ll fight it all the way.”
Trump says he welcomes criticism from GOP senators. “Please, blame it on me. Please, because they were getting ready to pass a very bad bill.”
House Speaker Mike Johnson, Trump’s lapdog-in-chief, says the bill is “dead on arrival” in the House. Besides, he now says, it isn’t needed because Biden already has all the authority he needs to close the border.
Um … just last year, Johnson argued that Congress must tighten immigration laws to strengthen the president’s hand. When he was president, Trump sought similar additional authority from Congress.
Meanwhile, House Republicans are about to begin impeachment proceedings against Alejandro Mayorkas, homeland security secretary, for allegedly being too soft on border security — even though Mayorkas worked with Senate Republicans to come up with this hardline border deal.
We need to deal with the border, but Republicans are now the ones sitting on their hands because they’re beholden to Trump. We also need to deal with immigration in a humane way by offering a broad and reasonable path to citizenship, but Democrats seem to have forgotten this basic goal.
The public, meanwhile, is utterly confused by Trump’s demagoguing. Here are Trump’s biggest lies, followed by the truth.
Trump claims Biden doesn’t want to stem illegal immigration and has created an “open border.”
Rubbish. Since he took office, Biden has consistently asked for additional funding for border control.
Republicans have just as consistently refused. They’ve voted to cut Customs and Border Protection funding in spending bills and blocked passage of Biden’s $106 billion national security supplemental that includes border funding.
Trump blames the drug crisis on illegal immigration.
Trump claims that undocumented immigrants are terrorists.
Baloney. America’s southern border has not been an entry point for terrorists. For almost a half-century, no American has been killed or injured in a terrorist attack in the United States that involved someone who crossed the border illegally.
Trump says undocumented immigrants are stealing American jobs.
Nonsense. Evidence shows immigrants are not taking jobs that American workers want. The surge across the border is not increasing unemployment. Far from it: Unemployment has been below 4 percent for roughly two years, far lower than the long-term average rate of 5.71 percent. It’s now 3.7 percent.
Trump claims undocumented immigrants are responsible for more crime in America.
More BS. In fact, a 2020 study by the Proceedings of the National Academy of Sciences, cited by the Department of Justice, showed that undocumented immigrants have “substantially” lower crime rates than native-born citizens and legal immigrants. Despite the recent surge in illegal immigration, America’s homicide rate has fallen nearly 13 percent since 2022 — the largest decrease on record. Local law enforcement agencies are also reporting drops in violent crime.
Since he entered politics, Donald Trump has fanned nativist fears and bigotry.
Now he’s moving into full-throttled neofascism, using the actual language of Hitler to attack immigrants — charging that undocumented immigrants are “poisoning the blood of our country” and saying they’re “like a military invasion. Drugs, criminals, gang members and terrorists are pouring into our country at record levels. We’ve never seen anything like it. They’re taking over our cities.” He promises to use the U.S. military to round up undocumented immigrants and put them into “camps.”
The parallels with Nazi Germany are chilling. In 1932, the canny Nazi propagandist Joseph Goebbels called for “a thick wall around Germany,” to protect against immigrants. “Certainly we want to build a wall, a protective wall.”
Trump and his enablers want us to forget that almost all of us are the descendants of immigrants who fled persecution, or were brought to America under duress, or simply sought better lives for themselves and their descendants.
Immigration has been good for America. As the median age of Americans continues to rise, we’ll need more young people from around the world.
The central question shouldn’t be how to secure our borders. It should be how to create an orderly and humane path to citizenship.

Lost in the overheated and too often misleading media hype of this issue is a simple truth: Congress and Administrations of both parties have failed to fulfill our Government’s duties under international and domestic laws (which are based on international requirements) to establish a fair, generous, expert, timely asylum adjudication system — one that complies with due process and actually gives asylum applicants the required “benefit of the doubt.”
Now, in a show of supreme political cowardice, egged on by the White Nationalist right and their lies, politicos of both parties and in all three branches of Government seek to cover up their failure by punishing and endangering the lives of their victims! The latter are legal asylum seekers — human beings — who overwhelmingly present themselves to authorities at the border in an orderly fashion to get a fair adjudication of their claims. Our Government routinely denies them that fundamental right through ridiculous delays, bad precedents, poor quality adjudications, underfunding, deficient leadership, and coercive gimmicks like bogus prosecutions, imprisonment, denial of access to counsel, and illegal and immoral family separation.
Meanwhile, Dems are failing to stand up for the human and legal right to seek asylum, which is being violated right and left and which the “Senate compromise” promises even more scofflaw violations of human rights and basic human dignity.
We can diminish ourselves as a nation, but it won’t stop human migration — particularly forced migration!

(RNS) — Chicago was already facing a homelessness crisis before Texas’ Republican governor, Greg Abbott, began directing thousands of migrants entering his state to Democratic bastions that had declared themselves migrant-friendly sanctuary cities.
Since the transfers began in April 2022, more than 20,000 migrants, many of them destitute Venezuelans, have arrived, and many Chicagoans have expressed concerns that the city’s resources are being drained and have accused government officials of failing to communicate about the migrants’ cost and their fates.
At the same time, advocates for the migrants, especially community organizers in more vulnerable neighborhoods, have pushed back against attempts to pit two marginalized groups against each other. These groups have stepped up to support the new arrivals and in many cases have found allies in local faith leaders.

Black said the majority of community residents want to find a way to both support the migrants and build support for a part of Chicago that has been historically underserved and underresourced. At the banquet at First Presbyterian, a speaker from Southside Together Organizing for Power, a community organizing group, talked about what it means to have Black and brown unity.
“It’s basically founded on this idea that there’s no scarcity,” Black said. “Not only is there enough for everybody — for the asylum-seekers, and the historically disenfranchised populations of South Side Chicago.”
He added, “We have so much more to gain from our unity than from the division which is being manufactured and orchestrated by interests that don’t want these communities to get the resources they need.”

I report that today Immigration Clinic student-attorneys Raisa Shah, Jennifer Juang-Korol, and I participated in the Newcomer Fair that the District of Columbia Public Schools sponsored at Langdon Elementary for families who have recently arrived from Texas and Arkansas via bus, primarily Venezuelans living in DC shelters. We shared immigration and social services information, GW swag, and met lots of cute kids. We were the only law school that participated. Please see the attached.

Have been thinking a lot about this statement & questioning how we got here. Anyone who works in this space knows just how complicated our laws & system are, the challenges global crises present, all compounded by recent attempts to totally destroy our immigration system. We know this is hard. However, the President has had at his service very smart ppl, experts, not to mention those in NGO space w decades of experience who have provided him reams of recommendation papers from before he was elected President, all wanting to help him to succeed at making the immigration system more efficient, more fair, but I’d guess most also came out of 4 yrs of Trump wanting to ensure we treat ppl w dignity & respect their basic human rights. If only he would listen.
How did the President go from vowing to “restore asylum” & “stop kids in cages” to essentially trying to out-Trump Trump? I wish we had a President who had the political courage to stand by immigrants, to stand in public & declare why detention, border walls, & summary deportations don’t work, & to invest in humane & smart solutions. The truly enraging thing about this is he will never win in his gross political posturing despite throwing migrants under the bus, or more aptly–literally to the cartels–the Right will never be satisfied & now he has put himself on record as in favor of Trump’s policies.
Shame. Shame on whoever had a hand in this hateful declaration and shame on the leader who put his name to it.

Even in a time of “politicos’ bipartisan national fear-mongering, irresponsibility, and trashing of human rights,” courageous NDPA “freedom fighters” still stand up for human dignity and the right to asylum!
We all have heard the story about the Rev. Martin Luther King Jr. the night before he was killed. How he’d seen the promised land and might not be with us when we got to the mountaintop. It’s important that we remember King incorporated the good Samaritan story into his speech.
He was in Memphis to aid sanitation workers, who were marching for a livable wage and safe working conditions. He went despite threats to his life and the fact that other civil rights leaders were present to march along with 1,300 Black workers on strike. He went because if not him, who? Here’s where he incorporated a Bible story we’ve heard before.
“And so the first question that the Levite asked was, ‘If I stop to help this man, what will happen to me?’ But then the good Samaritan came by. And he reversed the question: ‘If I do not stop to help this man, what will happen to him?’
“That’s the question before you tonight. Not, ‘If I stop to help the sanitation workers, what will happen to all of the hours that I usually spend in my office every day and every week as a pastor?’ The question is not, ‘If I stop to help this man in need, what will happen to me?’ ‘If I do not stop to help the sanitation workers, what will happen to them?’ That’s the question.”

Compare this message of self-sacrificing kindness toward fellow humans with the GOP “race to the bottom” taking place today during the totally overhyped and over-covered Iowa caucuses! (One more breathless account of the “enthusiasm gap” among Haley voters — not to mention her double-digit deficit in the endless “up to the minute” polls — could make a person want to puke.🤮)
There, dominant front-runner Trump promises not a better, fairer, more humane America for all, but rather a selfish, grievance-filled, program of hate, revenge, retribution, dehumanization, and exclusion on his “enemies!” And, his floundering GOP “rivals” promise the same nasty, deeply anti-American, agenda, but without the “distraction” of Trump’s “personality.” Hardly a winning message! If Iowa GOP voters want a true bottom-dweller, and it appears they overwhelmingly do, why not go with the “original” rather than “semi-sanitized imitations?”
Thank goodness for NFL playoff games today which should allow the rest of us to avoid the networks insipid “Iowa coverage!”
ONEONTA, N.Y.—Raphael and Ngongo Joseph have been refugees for more than 20 years, but they are thinking this small college town in upstate New York will be home for the foreseeable future.
They arrived this summer from Central Africa, displaced by ethnic conflict and back to back civil wars in Burundi and the Congo. Their new home is an upstairs apartment near the Susquehanna River, where they said people have been friendly.
“We were empty-handed,” Raphael, who goes by Joseph, said in Swahili. “We came to an apartment filled with our needs.”
Ngongo works at Hartwick College, one of two schools whose students account for about half of the 12,500 residents in this former railroad hub.
Joseph and Ngongo’s settlement is an early test of a new federal program called Welcome Corps under which grass-roots groups are able to sponsor the resettlement of refugees. It, by extension, could lead to a more dispersed refugee resettlement effort that could change the character of small—and sometimes shrinking—communities like Oneonta.
But they are arriving at a time and in a region where immigration has become controversial. More than 140,000 migrants have come to New York City in the past 18 months, overwhelming its shelter system and prompting officials to begin busing asylum seekers to hotels in upstate communities, often over the objection of local officials.

Newcomers are often painted with a broad brush, officials said, though they arrive through very different streams. The refugee-admissions program is a highly regulated system under which refugees living at camps across the globe can be nominated to come to the U.S., though they must undergo years of security and medical vetting before being allowed to move. It is entirely separate from the asylum system, which handles people after they have made it onto U.S. soil.
“We need them as much as they need us,” said Mark Wolff, a French language professor who has assisted the couple. “If you talk about immigration in the abstract, it can be scary. But when you meet people like Ngongo and Joseph you just want to help them.”

Yes, I know that refugees coming from abroad are screened and processed differently from refugees applying for asylum in the U.S! Yet, the basic principle is the same: Help them in an orderly, rational way to get to places where they will be welcomed, can find food and shelter, and where their skills can best be used or developed. And, from a legal standpoint, refugees stand in the same position, whether they come directly from overseas or are processed in the U.S. or at our borders!
The “delays” in the overseas refugee program could be minimized with some creative problem solving when dealing with asylum applicants. That’s why experts have long urged the USG to invest in ”reception centers” for asylum seekers rather than prisons, walls, prosecutions, and other expensive, inhumane, “deterrence” measures that make the humanitarian situation worse, not better! It’s going to take some “fresh thinking,” “new blood,” and more dynamic expert leadership to stop repeating and doubling down on past mistakes and address the humanitarian reality in practical ways that recognize opportunity and minimize fear and repression.
Rational resettlement, along with a better, more timely, asylum processing system staffed with humanitarian experts, would be a far better investment for our nation than more schemes for expensive, cruel, counterproductive, likely illegal, and ultimately futile, “deterrence.” It’s a shame that our leaders and legislators are so short-sighted and driven by fear, restrictionist myths, and false narratives about migration.
Although the U.S. economy is doing well, one thing that could enable even greater expansion is affordable housing for workers and their families. Why not harness the power of immigrant innovators and refugees (of all types) to address this need for the benefit of all U.S. workers and their communities? Create visible success stories showing and realizing the opportunities and benefit to the U.S. of welcoming refugees and asylees!

There is not a “border crisis,” but rather a humanitarian crisis at our border.
This humanitarian crisis has worsened over the years because of an overwhelming backlog of cases, resources not being funneled to lawful and humane processing, and harmful policy choices, such as the implementation of the Title 42 expulsion order. These choices have decimated our asylum system, making it almost impossible for people fleeing violence and seeking safety to access their legal right to seek asylum.

Yet, the so-called “mainstream media” exhibits little interest in the realities and benefits of migration. Instead they prefer to uncritically repeat White Nationalist “talking points” about “invasions,”“burdens,”“costs,” and “unprecedented crises.”
They also regularly blur the distinction between “unauthorized entrants” and the many asylum seekers who are screened and allowed into the U.S. to exercise their legal rights to apply for protection under U.S. and international laws (in, I might add, a legal system intentionally stacked against them). Such individuals are here with official permission; they are “NOT” “illegal entrants” as White Nationalists like to incorrectly characterize them. Indeed, the “scofflaws” here are actually those who seek to deny both the humanity and the legal rights of asylum seekers!
The Administration aggravates this situation by failing to speak out forcibly in favor of immigrants’ rights and the realities and benefits of immigration. They also have not developed a coordinated reception and resettlement approach to combat the shenanigans of GOP nativist governors and politicos. The Dems thus have mistakenly turned the initiative on human rights and immigration over to haters, nativists, and fabricators — folks with no interest whatsoever in instituting humanity, efficiency, and the rule of law at the border!
Thus, the truth about immigration and its benefits as well as humane, realistic ways of improving our immigration system (including the process for accepting refugees and asylees) remains largely hidden “beneath the radar screen.”
In a recent post, Attorney Jorge Gonzalez stated his actual experience helping asylum seekers at the southern border:
I interviewed many migrants awaiting their credible fear interview. All of them suffered persecution during their time in Mexico, whether they were robbed by police, cartel members, or ordinary citizens. Many were kidnapped and held for ransom. Some had group members that did not finish the journey.
This speaks loudly about those, from both parties, who seek to impose “gimmicks” and“further restrictions” at our already over-militarized border that would “deter” legal asylum seekers by forcing them to remain in Mexico or denying them fair hearings on their applications. The question of “right or wrong” here is not fairly debatable! Intentionally mistreating asylum seekers is wrong from both a legal and a moral standpoint! Yet, one sure wouldn’t know that from listening to the “mainstream media!”
The GOP prefers demagoguery to truth. Meanwhile, the Dems are scared to embrace the truth about immigration.

The following post is the final part of my 2017 Black Immigration Primer! I delve into the impact of former President Donald Trump’s early executive orders on Black immigrants, the consequences of which are still being felt today.
It seems like ages since 45 (the former President of the U.S.) issued a volley of executive orders affecting various areas of our lives. Here, I want to talk about the two versions of the Travel Ban (a.k.a. the #MuslimBan) and how they target Black immigrants, Muslim immigrants, and Black Muslim immigrants. The travel bans live at the intersection of anti-Blackness and Islamophobia.
First, some terms and their definitions. Anti-Blackness (also known as anti-Black racism) is what it sounds like: systems, policies, beliefs, and behaviors that are “resistant or antagonistic to Black people or their values or objectives.” We often see anti-Blackness in other communities of color. Some argue that assimilation into American culture is predicated on embracing anti-Blackness (in order to succeed in America, one must separate oneself from Black people and violently oppose Black people’s success). Islamophobia is a “dislike or prejudice against Islam or Muslims, especially as a political force.” It’s important that anti-Blackness and Islamophobia are not merely individual beliefs; they encompass power of the systemic kind. Anti-Blackness and Islamophobia result in harmful, deadly policies and wars.
It’s safe to say that 45 and his administration are a number of things (misogynistic, racist, unethical, evil, and so forth) but they are also distinctly anti-Black and Islamophobic. 45 and his minions’ embrace of anti-Blackness and Islamophobia produced two Travel Bans that harmed hundreds of people. It’s going to take more than $1 million in “security assistance” to a HBUC and $100k to victims’ families to cover up the far right GOP’s responsibility for promoting racism and hate crimes in America. And, the war on immigrants of color is a key part of the racism, Islamophobia, and misogyny that has found a home in the far right of today’s GOP!

The future of American immigration advocacy looks promising, notwithstanding the incredibly dark visions being falsely promoted by GOP restrictionists and the disturbingly feeble response from the Biden Administration and Dems in Congress. The talent in the “New Generation” of the NDPA continues to grow thanks to the inspiration and tutelage of Professors Benitez and Vera and many others like them who have dedicated their lives to making things better for everyone!
As a result, there is a rapidly expanding talent gap between the NDPA and the sluggish, unresponsive, “go along to get along” USG immigration bureaucracy — right up to the White House where so-called “policy makers” fear standing up for the rule of law and American values! David W. Blight reviews Rachel Swarns’s new book “The 272” For The NYT:

“The 272,” Rachel L. Swarns’s deeply researched and revelatory new book, is the story of the remarkable Mahoney clan and how their lives, nearly a century and a half after Ann Joice’s, intersected with those of Mulledy, McSherry and the Jesuits in one of American slavery’s most withering tragedies. “The 272” is a fascinating meditation on the meaning of slavery and of people converted to property and commodities — assets of wealth and objects of sale. It’s a book that journeys to slavery’s heart of darkness: to the separation of families, the terror of being sold into the vast unknown and of bodies transformed into profits and investments. But it is also the moving human story of some of the people who endured and survived this ordeal, and who have long awaited rediscovery.
Swarns, a contributing writer for The New York Times and a professor of journalism at N.Y.U., is an African American Catholic who was raised on Staten Island. Beginning with an article in The Times in 2016, she revealed the story of the Jesuits as slaveholders and traders, leading to a stunning reckoning by Georgetown University with its past as well as one within the Jesuit order itself. Swarns writes with a keen eye and distinctive voice both about her Black subjects and about the hypocrisy and brutality of their onetime owners. The Jesuits were no monolith of greed and evil, however; Swarns sustains empathy for some who tried, largely unsuccessfully, to protect the enslaved people they had known so closely from the agony of sale that looms over this story.

What comes through most effectively is the sorrow and the determination to survive of the enslaved people whom Swarns brings to light through her sleuthing and resonant prose. (Of Ann Joice, Swarns writes, “She would have no wealth, no land and no savings to leave her family, but she still had her story. … The story would be her legacy.”) Swarns also underscores the importance of Georgetown’s ongoing efforts at serious reparations for the deeds of its early leaders. An independent nonprofit, the Georgetown Memory Project, has identified around 6,000 living descendants of the original 272. In turn, the university has offered descendants formal “legacy” status for admission, sought atonement through a highly publicized apology and created a fund that would dedicate $400,000 a year to community projects, including support for health clinics and schools, likely to benefit descendants. Leaders of the Jesuit conference of priests have also vowed to establish a $100 million trust to benefit descendants and promote racial reconciliation.
No single work of history can remedy the vexing issue of repair for slavery in America, but “The 272” advances the conversation and challenges the collective conscience; without knowing this history in its complexity we are left with only raw, uncharted memory.

This is the kind of important, often intentionally buried, history that GOP white nationalists like DeSantis, Trump, and others don’t want read and honestly discussed. But, as with most artificially suppressed works, the truth will out! There are just too many people speaking it these days for even the neo-fascist censors to silence them all.
It also illuminates the heretofore unknown and unheralded stories of enslaved African-Americans like Ann Joice who, against the odds, persevered in a grotesquely unjust and horrible system so that future generations could have a chance at a better life. These are are among the real heroes ofAmerican history who helped make our country what it is today. Their stories deserve to be told and studied.

The birthright citizenship clause of the 14th Amendment, based on similar language found in the Civil Rights Act of 1866, was a direct response to and a rebuke of [chief Justice] Taney’s reasoning [in Dred Scott]. Having won the argument on the battlefield, the United States would amend its Constitution to establish an inclusive and, in theory, egalitarian national citizenship.
The authors of the 14th Amendment knew exactly what they were doing. In a country that had already seen successive waves of mass immigration, they knew that birthright citizenship would extend beyond Black and white Americans to people of other hues and backgrounds. That was the point.
Asked by an opponent if the clause would “have the effect of naturalizing the children of Chinese and Gypsies born in this country,” Senator Lyman Trumbull, who helped draft the language of birthright citizenship in the Civil Rights Act, replied “Undoubtedly.” Senator John Conness of California said outright that he was “ready to accept the provision proposed in this constitutional amendment, that the children born here of Mongolian parents shall be declared by the Constitution of the United States to be entitled to civil rights and to equal protection before the law with others.”
In 1867, around the time Congress was debating and formulating the 14th Amendment, Frederick Douglass delivered a speech in Boston where he outlined his vision of a “composite nationality,” an America that stood as a beacon for all peoples, built on the foundation of an egalitarian republic. “I want a home here not only for the Negro, the mulatto and the Latin races; but I want the Asiatic to find a home here in the United States, and feel at home here, both for his sake and for ours,” Douglass said. “The outspread wings of the American Eagle are broad enough to shelter all who are likely to come.”
If birthright citizenship is the constitutional provision that makes a multiracial democracy of equals possible, then it is no wonder that it now lies in the cross hairs of men who lead a movement devoted to unraveling that particular vision of the American republic.
Embedded in birthright citizenship, in other words, is the potential for a freer, more equal America. For Donald Trump and Ron DeSantis, that appears to be the problem.

As we know, Congress has failed to address the realities of immigration since the enactment of IRCA in 1986. That has inevitably led to a large, disenfranchised population of undocumented residents — essential members of our society, yet deprived of political power and the ability to reach their full potential by their “status.” Consequently, they aresubject to exploitation.
Nevertheless, this phenomenon would be much more serious without the “genius of the 14th Amendment.” Notwithstanding the failure of the political branches to address immigration in a realistic manner, the overwhelming number of the “next generation” of that underground population are now full U.S. citizens with the ability to participate in our political system and otherwise assert their full rights in our society.
Thus, because of the 14th Amendment we have avoided the highly problematic phenomenon of generations of disenfranchised Americans, essentially “stateless individuals,” forced into an underground existence. It’s not that these individuals born in the U.S., who have known no other country, would be going anywhere else, by force or voluntarily. Nor would it be in our best interests to degrade, dehumanize, and exclude generations of our younger fellow citizens as Trump, DeSantis, and the GOP far right extremist crazies advocate.
Additionally, in contradiction of traditional GOP dogma about limited government, the Trump/DeSantis charade would spawn a huge new and powerful “citizenship determining bureaucracy” that almost certainly would work against the poor, vulnerable, and individuals of color in deciding who “belongs” and who doesn’t and what documentation suffices. How many adult American citizens today who have deceased parents could readily produce definitive documentation of their parents’ citizenship?
So, notwithstanding GOP intransigence, their vile and baseless attacks on the 14th Amendment, and the lack of political will to solve and harness the realities and power of human immigration, the 14th Amendment is at work daily, solving much of the problem for us and making us a better nation, sometimes in spite of our Government’s actions or inactions. And, it performs this essential service in a manner that is relatively transparent and minimally bureaucratic for most.

Editorial: Sanctuary cities are working just fine, thank you
When Republican Govs. Greg Abbott of Texas and Ron DeSantis of Florida bused and flew migrants to Los Angeles, New York, Washington, D.C., and other so-called “sanctuary cities,” they might have envisioned they were exporting the same chaos as border states have experienced as they grapple with a historic number of migrants. They wanted leaders in these cities to admit they were wrong about their immigrant-friendly policies.
But Abbott and DeSantis are mistaken if they think they are teaching cities with sanctuary polices any lessons with their inhumane political stunts or causing their leaders to rethink their commitment to not treating migrants as criminals.
Those governors and their political allies also seem to be confused about what it means when cities have sanctuary policies. Though policies vary, providing sanctuary means not turning migrants over to federal immigration authorities simply for being in the country illegally. It means treating them like humans in need rather than pawns.
That’s what leaders in Los Angeles, Sacramento and other “sanctuary cities” did as buses and planes dumped dozens of tired and often confused migrants on their doorsteps in recent months. They rallied attention and resources, while religious and other nonprofit organizations stepped up to welcome the migrants with shelter, food and clothes. In some instances, these migrants have even found temporary jobs, illustrating the need for their labor.
Abbott and DeSantis may also not realize that sanctuary policies were designed to help law enforcement keep communities safe. Sanctuary policies were developed because police in many cities such as Los Angeles were frustrated because undocumented immigrants were not reporting crimes or stepping forward as witnesses for fear of deportation.
Critics say these sanctuary cities have laws and policies that shield criminals and obstruct federal immigration policies. But cities with sanctuary policies have lower than average crime rates, higher household incomes and lower poverty rates, according to various studies.
Local authorities did not refuse to cooperate with immigration enforcement, as critics claim. They simply limited the role of local law enforcement in immigration cases, for example, by not using local police to do immigration checks or by not holding an undocumented immigrant in custody for a few extra days to serve federal authorities’ schedules.
Los Angeles is in the midst of transitioning from a “city of sanctuary” to “sanctuary city.” The difference is more than just semantics. The former designation is little more than a statement by city leaders in 2017 that they opposed then-President Trump’s dehumanizing anti-immigrant policies, which included separating young children from their parents. Some of those children have yet to be reunited with their parents years later. Earlier this month, the City Council voted to strengthen the policy by banning city personnel or resources from being used for immigration enforcement.
It’s true that the transports of migrants by the Texas and Florida governors have been inconvenient to cities such as Washington and New York, which have had to scramble to find housing and other resources. But they haven’t done a thing to undermine the foundation on which sanctuary policies were built.

The money wasted by these GOP nativist neo-fascists could much better be spent on coordinated efforts to help asylum seekers to help themselves and our nation in the process. Obviously, GOP states like Florida and Texas have money toburn.
Also, to the extent that cities “targeted” by these GOP White Nationalist Governors have persevered in the face ofattempts to sow chaos, it has been largely without the coordination, guidance, and leadership of the Biden Administration. Seems like that should be “low hanging fruit” for progressive Democrats to change!

Both parties have doubled down on inhumane border policies, but it’s the GOP that is taking it to new depths in its race to the bottom over who can be more deliberately cruel.
It’s like some kind of grotesque Last Supper: In a publicity photo from last week’s press conference, Texas governor Greg Abbott is seated at the center of a long table surrounded by grim-faced White men, most of them elderly, in various postures of mental agita. Next to them is a large illustration on an easel board titled “Live Test of Attempt to Breach.” It shows a man with an inner tube (presumably an asylum seeker) clinging to a floating red buoy. Hundreds of these buoys Abbott announced, will be deployed on the Rio Grande near the town of Eagle Pass. The barrier will be 1,000 feet long, and its netting will extend underwater, catching anyone who tries to swim under it.
“We don’t want anyone to get hurt,” said Steve McCraw, head of Texas’s Department of Public Safety, at the June 9 press conference. “We want to prevent people from drowning.”
The floating buoy barrier will persuade people not to cross, he said. “This is to deter them from even coming in the water.”
But we already know this isn’t true. Both McCraw and Abbott were parroting the same strategy, known as “prevention through deterrence,” introduced in the mid-1990s during the Clinton administration. It has turned our southern border into a graveyard. After nearly three decades of militarized border buildup that has pushed people into increasingly deadly terrain like the Sonoran Desert, people haven’t stopped coming. But thousands of them have died.
As Todd [Miller] recently wrote in his poignant piece about this deadly strategy, “On the cusp of summer, we can predict like clockwork that hundreds of otherwise healthy people will be dead by summer’s end. It has an aura of premeditated murder.”
These floating barriers, which, according to the manufacturer’s website, can also be reinforced with spikes, will only contribute to an already-skyrocketing death count. Abbott’s latest announcement has already spurred many human rights organizations to sound a warning. Jenn Budd, a former Border Patrol agent and now border human rights activist, along with fellow Texas-based activist Marianna Treviño Wright, released a bilingual video warning migrants of the deadly new policy.
All-in on Fascism
Abbott has long toyed with the idea of running for president. While it increasingly looks less likely that he will, Florida governor Ron DeSantis has already joined the fray. And he’s all-in on fascism. When he’s not treating fellow human beings like FedEx packages, he’s modeling himself after Viktor Orbán, Hungary’s authoritarian leader, and darling of the CPAC circuit. Last week DeSantis released “B-roll” of Florida state troopers surveying the Texas-Mexico border as they participate in Abbott’s Operation Lone Star. I suspect they didn’t include any audio in the B-roll because it would humanize the children and adults waving to the troopers from the Mexican side of the river, detracting from DeSantis’s threatening narrative of an invading army.
DeSantis’s campaign video begins with a Texas DPS officer, who sports an official DPS seal on his tactical face covering, unlocking a tiny metal door surrounded by razor wire. This is next-level border security theater, as comical as it is utterly surreal and tragic. Several other Republican-led states are also, once again, sending troopers and National Guard soldiers to the Texas border—as they did before the 2022 midterm—to wage war against the Biden White House before the election. Unfortunately, it’s border communities and migrants who are caught in the crossfire.
For many years, I’ve documented border theater as it has ebbed and flowed depending on the political tide. But as I’ve been documenting in The Border Chronicle, we’ve reached an altogether different and deadly era of disinformation, with the GOP parroting invasion and great replacement rhetoric, and increasingly dehumanizing people, spurring mass shootings and political violence. This behavior is championed by a growing right-wing media ecosystem which in turn promotes more anti-democratic and extremist behavior.

I quoted Muñoz in a recent article, and wanted to include my full Q&A with him here. As Muñoz warns, the U.S. is in a “dangerous moment” as it approaches the 2024 presidential election.

Yes, “deterrence gimmicks” directed at refugees have a decades-long proven record of failure. You can just look at the efforts of the EU to “bar the door” to refugees from Africa and the Middle
East.
The boats continue to come, some sink, people drown. But, not surprisingly to those other than the “overprivileged and elitist White power class” like Abbott and DeSantis, desperate individuals forced from their homes are going continue to come — at any cost, even their own health, safety, and sometime lives.
Most would rather “risk it all” on a shot — even a very long shot — at stability and a real life, rather than facing the certainty of wasting away without hope, freedom, or opportunity and having to watch the same thing happening to younger generations. Some, against all odds, continue to believe that rich, powerfu Western countries like the U.S. will eventually live up to their solemn legal obligations to protect refugees and asylum seekers!
While, as Melissa cogently points out, these inane, yet deadly, gimmicks do kill migrants, they don’t do so at a high enough rate to materially affect the flow. It’s just causing pain, suffering, and sometimes death for their own perverted sake.
Apparently, neo-fascists like Abbott, DeSantis, Trump, and their “role model” Stephen Miller just “get off on” watching others suffer unnecessarily. Bullies and cowards often get a kick out of observing the effects of their handiwork.
Meanwhile, the public money being wasted on these cruel, yet ultimately ineffective stunts (remember former AZ Gov. Ducey’s shipping containers arrayed and then disassembled at government expense), could much, much better be spent on providing representation, organized resettlement, and humanitarian assistance to asylum seekers.
As Melissa says, the GOP’s (and sometimes, unfortunately the Dems’) “uber-enforcement/deterrence gimmicks are “as comical as [they are] utterly surreal and tragic.” It’s time for decent Americans to “just say no” to these horrible folks and their failed and deadly policies of dehumanization and degradation!
